Ballard</otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill amends provisions related to guardianship.</gd><hphead lineno="6">Highlighted Provisions:</hphead><hp numlevel="1" lineno="7" slineno="0-7">This bill:<hl numlevel="1" lineno="8" slineno="0-8" level="1">clarifies that a person's rights under the Health Insurance Portability and Accountability <ln numlevel="1" lineno="9" slineno="0-9"/>Act of 1996 are not altered or abridged by Utah code provisions related to the rights of a <ln numlevel="1" lineno="10" slineno="0-10"/>person alleged to be incapacitated;</hl><hl numlevel="1" lineno="11" slineno="0-11" level="1">amends provisions related to the qualifications of a health care provider appointed by a <ln numlevel="1" lineno="12" slineno="0-12"/>court to assess an individual alleged to be incapacitated, and standards for the tools the <ln numlevel="1" lineno="13" slineno="0-13"/>health care professional uses for the assessment;</hl><hl numlevel="1" lineno="14" slineno="0-14" level="1">clarifies that the court appointed health care professional's report must be filed with the <ln numlevel="1" lineno="15" slineno="0-15"/>court;</hl><hl numlevel="1" lineno="16" slineno="0-16" level="1">clarifies that a court appointed visitor's report must be filed with the court;</hl><hl numlevel="1" lineno="17" slineno="0-17" level="1">provides that the court appointed health care provider may interview the person seeking <ln numlevel="1" lineno="18" slineno="0-18"/>to be appointed a guardian, but may not base the health care provider's assessment solely <ln numlevel="1" lineno="19" slineno="0-19"/>or predominately on that individual's opinion; and</hl><hl numlevel="1" lineno="20" slineno="0-20" level="1">makes technical and conforming changes.</hl></hp><moni numlevel="1" lineno="21" slineno="0-21" display="none">Money Appropriated in this Bill:</moni><moniNone lineno="22">None</moniNone><oc numlevel="1" lineno="23" slineno="0-23">Other Special Clauses:</oc><ocNone lineno="24">None</ocNone><sa numlevel="1" lineno="25" slineno="0-25">Utah Code Sections Affected:<saamd numlevel="1" lineno="26" slineno="0-26"><snhead>AMENDS:</snhead><sn num="75-5-301.5" src="code" uid="C75-5-S301.5_2026050620260506" buid="6" sort="75 05 03010520260506" numlevel="1" lineno="27" slineno="0-27"><bold>75-5-301.5</bold>, as last amended by Laws of Utah 2025, Chapter 533</sn><sn num="75-5-303" src="code" uid="C75-5-S303_2026050620260506" buid="4" sort="75 05 03030020260506" numlevel="1" lineno="28" slineno="0-28"><bold>75-5-303</bold>, as last amended by Laws of Utah 2025, Chapters 310, 338 and 533</sn></saamd></sa></lt><enacthead lineno="29"/><enact numlevel="1" lineno="30" slineno="0-30">Be it enacted by the Legislature of the state of Utah:</enact><bdy><bsec buid="6" num="75-5-301.5" type="amend" src="code" uid="C75-5-S301.5_2026050620260506" sort="75 05 03010520260506" numlevel="1" lineno="31" slineno="1-1" sn="1"><section number="75-5-301.5" numlevel="1" lineno="32" slineno="1-2" type="amend"><secline lineno="31">Section 1. Section <bold>75-5-301.5</bold> is amended to read:</secline><catline lineno="32"><bold>75-5-301.5<parens/>. Rights of a person alleged to be incapacitated -- Rights of an <ln numlevel="1" lineno="33" slineno="1-3"/>incapacitated person.</bold></catline><subsection ssid="6-null-1" dnum="1-o" numlevel="1" lineno="34" slineno="1-4" level="1" placement="noreturn"><display>(1)</display>Except as otherwise provided by this chapter or any other law, a person alleged to be <ln numlevel="1" lineno="35" slineno="1-5"/>incapacitated has the right to:<subsection ssid="6-null-2" dnum="a-o" numlevel="1" lineno="36" slineno="1-6" level="2"><display>(a)</display>be represented by counsel before a guardianship is imposed and have counsel <ln numlevel="1" lineno="37" slineno="1-7"/>represent the person during the guardianship proceeding, except as provided in <ln numlevel="1" lineno="38" slineno="1-8"/>Subsection <xref depth="4" refnumber="75-5-303(6)(e)">75-5-303(6)(e)</xref>;</subsection><subsection ssid="6-null-3" dnum="b-o" numlevel="1" lineno="39" slineno="1-9" level="2"><display>(b)</display>receive a copy of all documents filed in a guardianship proceeding;</subsection><subsection ssid="6-null-4" dnum="c-o" numlevel="1" lineno="40" slineno="1-10" level="2"><display>(c)</display>have a relative, physician, physician assistant, or any interested person speak about <ln numlevel="1" lineno="41" slineno="1-11"/>or raise any issue of concern on behalf of the person during the guardianship <ln numlevel="1" lineno="42" slineno="1-12"/>proceeding;</subsection><subsection ssid="6-null-5" dnum="d-o" numlevel="1" lineno="43" slineno="1-13" level="2"><display>(d)</display>receive information about guardianships from the court; and</subsection><subsection ssid="6-null-6" dnum="e-o" numlevel="1" lineno="44" slineno="1-14" level="2"><display>(e)</display>be treated with respect and dignity.</subsection></subsection><subsection ssid="6-null-7" dnum="2-o" numlevel="1" lineno="45" slineno="1-15" level="1"><display>(2)</display>For a guardianship granted before May 7, 2025, the rights of an incapacitated person for <ln numlevel="1" lineno="46" slineno="1-16"/>whom a guardian is appointed are in accordance with the statutory provisions in effect as <ln numlevel="1" lineno="47" slineno="1-17"/>of the date that the guardianship was granted, including, as applicable, Subsection <xref tempid="466" depth="4" refnumber="75-5-312(1)(c)(i)"><ln numlevel="1" lineno="48" slineno="1-18"/>75-5-312(1)(c)(i)</xref> unless expressly limited by a court in the order of appointment.</subsection><subsection ssid="6-null-8" dnum="3-o" numlevel="1" lineno="49" slineno="1-19" level="1"><display>(3)</display>Except as otherwise provided by this chapter or any other law, for a guardianship <ln numlevel="1" lineno="50" slineno="1-20"/>granted on or after May 7, 2025, an incapacitated person for whom a guardian is <ln numlevel="1" lineno="51" slineno="1-21"/>appointed has the right to:<subsection ssid="6-null-9" dnum="a-o" numlevel="1" lineno="52" slineno="1-22" level="2"><display>(a)</display>have counsel represent the incapacitated person at any time after the guardian is <ln numlevel="1" lineno="53" slineno="1-23"/>appointed;</subsection><subsection ssid="6-null-10" dnum="b-o" numlevel="1" lineno="54" slineno="1-24" level="2"><display>(b)</display>have a relative, physician, physician assistant, or any interested person speak about <ln numlevel="1" lineno="55" slineno="1-25"/>or raise any issue of concern on behalf of the person in any court hearing about the <ln numlevel="1" lineno="56" slineno="1-26"/>guardianship;</subsection><subsection ssid="6-null-11" dnum="c-o" numlevel="1" lineno="57" slineno="1-27" level="2"><display>(c)</display>receive a copy of all documents filed in court regarding the guardianship;</subsection><subsection ssid="6-null-12" dnum="d-o" numlevel="1" lineno="58" slineno="1-28" level="2"><display>(d)</display>receive information about guardianships from the court;</subsection><subsection ssid="6-null-13" dnum="e-o" numlevel="1" lineno="59" slineno="1-29" level="2"><display>(e)</display>ask questions and express concerns or complaints about a guardian and the actions of <ln numlevel="1" lineno="60" slineno="1-30"/>a guardian to the court;</subsection><subsection ssid="6-null-14" dnum="f-o" numlevel="1" lineno="61" slineno="1-31" level="2"><display>(f)</display>be granted the greatest degree of freedom possible that is consistent with the reasons <ln numlevel="1" lineno="62" slineno="1-32"/>for the guardianship;</subsection><subsection ssid="6-null-15" dnum="g-o" numlevel="1" lineno="63" slineno="1-33" level="2"><display>(g)</display>be treated with respect and dignity;</subsection><subsection ssid="6-null-16" dnum="h-o" numlevel="1" lineno="64" slineno="1-34" level="2"><display>(h)</display>be treated fairly by the incapacitated person's guardian;</subsection><subsection ssid="6-null-17" dnum="i-o" numlevel="1" lineno="65" slineno="1-35" level="2"><display>(i)</display>have all services provided by a guardian at a reasonable rate of compensation;</subsection><subsection ssid="6-null-18" dnum="j-o" numlevel="1" lineno="66" slineno="1-36" level="2"><display>(j)</display>have a court review any request for payment by a guardian to avoid excessive or <ln numlevel="1" lineno="67" slineno="1-37"/>unnecessary fees or duplicative billing;</subsection><subsection ssid="6-null-19" dnum="k-o" numlevel="1" lineno="68" slineno="1-38" level="2"><display>(k)</display>receive prudent financial management of the incapacitated person's property;</subsection><subsection ssid="6-null-20" dnum="l-o" numlevel="1" lineno="69" slineno="1-39" level="2"><display>(l)</display>subject to Subsections <xref depth="4" refnumber="75-5-312(4)(h)">75-5-312(4)(h)</xref> and <xref depth="4" refnumber="75-5-417(4)">75-5-417(4)</xref>, and subject to the exception <ln numlevel="1" lineno="70" slineno="1-40"/>provided in Subsection <xref tempid="611" depth="4" refnumber="75-5-312(7)(d)">75-5-312(7)(d)</xref>, receive a copy of an accounting report <ln numlevel="1" lineno="71" slineno="1-41"/>regarding the incapacitated person's estate that is submitted to the court by the <ln numlevel="1" lineno="72" slineno="1-42"/>guardian under Section <xref depth="3" refnumber="75-5-312">75-5-312</xref> or the conservator under Section <xref depth="3" refnumber="75-5-417">75-5-417</xref> if a <ln numlevel="1" lineno="73" slineno="1-43"/>conservator is appointed for the incapacitated person; and</subsection><subsection ssid="6-null-21" dnum="m-o" numlevel="1" lineno="74" slineno="1-44" level="2"><display>(m)</display>ask the court to:<subsection ssid="6-null-22" dnum="i-o" numlevel="1" lineno="75" slineno="1-45" level="3"><display>(i)</display>review the management activity of a guardian if a dispute cannot be resolved <ln numlevel="1" lineno="76" slineno="1-46"/>regarding the guardian's management;</subsection><subsection ssid="6-null-23" dnum="ii-o" numlevel="1" lineno="77" slineno="1-47" level="3"><display>(ii)</display>continue to review the need for a guardianship or to modify or terminate a <ln numlevel="1" lineno="78" slineno="1-48"/>guardianship <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="11" groupid="6" style="2" owner="admin" level="1" deltag="both">pursuant to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="10" groupid="5" style="1" owner="admin" level="1" amendtag="both" space="true">in accordance with</amend> Section <xref depth="3" refnumber="75-5-306">75-5-306</xref> and Section <xref depth="3" refnumber="75-5-307"><ln numlevel="1" lineno="79" slineno="1-49"/>75-5-307</xref>; and</subsection><subsection ssid="6-null-24" dnum="iii-o" numlevel="1" lineno="80" slineno="1-50" level="3"><display>(iii)</display>enter an order restoring the incapacitated person's capacity at the earliest possible <ln numlevel="1" lineno="81" slineno="1-51"/>time <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="14" groupid="9" style="2" owner="admin" level="1" deltag="both">pursuant to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="13" groupid="8" style="1" owner="admin" level="1" amendtag="both" space="true">in accordance with</amend> Section <xref depth="3" refnumber="75-5-306">75-5-306</xref> and Section <xref depth="3" refnumber="75-5-307">75-5-307</xref>.</subsection></subsection></subsection><subsection ssid="6-null-25" dnum="4-o" numlevel="1" lineno="82" slineno="1-52" level="1"><display>(4)</display>The court may not waive, suspend, or limit a right described in Subsection <xref refnumber="75-5-301.5(3)" depth="4">(3)</xref>.</subsection><subsection ssid="6-null-26" dnum="5-o" numlevel="1" lineno="83" slineno="1-53" level="1"><display>(5)</display>Except as otherwise provided by this chapter or any other law, and subject to Subsection <xref refnumber="75-5-301.5(6)" depth="4"><ln numlevel="1" lineno="84" slineno="1-54"/>(6)</xref>, for a guardianship granted on or after May 7, 2025, an incapacitated person for <ln numlevel="1" lineno="85" slineno="1-55"/>whom a guardian is appointed has the right, to the extent practicable, to:<subsection ssid="6-null-27" dnum="a-o" numlevel="1" lineno="86" slineno="1-56" level="2"><display>(a)</display>participate in developing an individualized plan for the incapacitated person's care, <ln numlevel="1" lineno="87" slineno="1-57"/>including:<subsection ssid="6-null-28" dnum="i-o" numlevel="1" lineno="88" slineno="1-58" level="3"><display>(i)</display>managing the incapacitated person's assets and property;</subsection><subsection ssid="6-null-29" dnum="ii-o" numlevel="1" lineno="89" slineno="1-59" level="3"><display>(ii)</display>determining the incapacitated person's residence; and</subsection><subsection ssid="6-null-30" dnum="iii-o" numlevel="1" lineno="90" slineno="1-60" level="3"><display>(iii)</display>determining the services to be received by the incapacitated person;</subsection></subsection><subsection ssid="6-null-31" dnum="b-o" numlevel="1" lineno="91" slineno="1-61" level="2"><display>(b)</display>be given consideration in regards to the incapacitated person's current and previously <ln numlevel="1" lineno="92" slineno="1-62"/>stated desires, preferences for health care and medical treatment, and religious and <ln numlevel="1" lineno="93" slineno="1-63"/>moral beliefs;</subsection><subsection ssid="6-null-32" dnum="c-o" numlevel="1" lineno="94" slineno="1-64" level="2"><display>(c)</display>remain as independent as possible, including giving deference to the incapacitated <ln numlevel="1" lineno="95" slineno="1-65"/>person's preference for the incapacitated person's residence and standard of living:<subsection ssid="6-null-33" dnum="i-o" numlevel="1" lineno="96" slineno="1-66" level="3"><display>(i)</display>as expressed or demonstrated before a determination of capacity was made; or</subsection><subsection ssid="6-null-34" dnum="ii-o" numlevel="1" lineno="97" slineno="1-67" level="3"><display>(ii)</display>as currently expressed or demonstrated by the incapacitated person if the <ln numlevel="1" lineno="98" slineno="1-68"/>preference is reasonable under the circumstances;</subsection></subsection><subsection ssid="6-null-35" dnum="d-o" numlevel="1" lineno="99" slineno="1-69" level="2"><display>(d)</display>be able to exercise control over all aspects of the incapacitated person's life that are <ln numlevel="1" lineno="100" slineno="1-70"/>not granted to the guardian in an order of appointment of a limited guardianship;</subsection><subsection ssid="6-null-36" dnum="e-o" numlevel="1" lineno="101" slineno="1-71" level="2"><display>(e)</display>maintain privacy and confidentiality in personal matters, to the extent that privacy <ln numlevel="1" lineno="102" slineno="1-72"/>and confidentiality does not inhibit the ability of the incapacitated person's guardian <ln numlevel="1" lineno="103" slineno="1-73"/>to fulfill the guardian's responsibilities or perform the guardian's duties;</subsection><subsection ssid="6-null-37" dnum="f-o" numlevel="1" lineno="104" slineno="1-74" level="2"><display>(f)</display>receive telephone calls and personal mail and associate with relatives and <ln numlevel="1" lineno="105" slineno="1-75"/>acquaintances unless the guardian and the court determine that the association should <ln numlevel="1" lineno="106" slineno="1-76"/>be restricted or prohibited in accordance with Section <xref depth="3" refnumber="75-5-312.5">75-5-312.5</xref>;</subsection><subsection ssid="6-null-38" dnum="g-o" numlevel="1" lineno="107" slineno="1-77" level="2"><display>(g)</display>receive timely, effective, and appropriate health care and medical treatment that does <ln numlevel="1" lineno="108" slineno="1-78"/>not violate the incapacitated person's rights;</subsection><subsection ssid="6-null-39" dnum="h-o" numlevel="1" lineno="109" slineno="1-79" level="2"><display>(h)</display>receive an allowance or control a reasonable amount of the incapacitated person's <ln numlevel="1" lineno="110" slineno="1-80"/>earnings or other income; and</subsection><subsection ssid="6-null-40" dnum="i-o" numlevel="1" lineno="111" slineno="1-81" level="2"><display>(i)</display>collaborate with the incapacitated person's guardian to use appropriate financial tools <ln numlevel="1" lineno="112" slineno="1-82"/>to maintain a bank account and manage the incapacitated person's personal money.</subsection></subsection><subsection ssid="6-null-41" dnum="6-o" numlevel="1" lineno="113" slineno="1-83" level="1"><display>(6)</display>The court may waive or limit a right described in Subsection <xref refnumber="75-5-301.5(5)" depth="4">(5)</xref> if:<subsection ssid="6-null-42" dnum="a-o" numlevel="1" lineno="114" slineno="1-84" level="2"><display>(a)</display>an interested party requests the waiver or limitation; and</subsection><subsection ssid="6-null-43" dnum="b-o" numlevel="1" lineno="115" slineno="1-85" level="2"><display>(b)</display>the court finds, by clear and convincing evidence, that there is a compelling reason <ln numlevel="1" lineno="116" slineno="1-86"/>for the waiver or limitation.</subsection></subsection><subsection ssid="6-null-44" dnum="7-o" numlevel="1" lineno="117" slineno="1-87" level="1" space="false"><display>(7)</display><subsection ssid="6-null-45" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The rights of an incapacitated person under this section do not abrogate any <ln numlevel="1" lineno="118" slineno="1-88"/>remedy provided by law.</subsection><subsection ssid="6-null-46" dnum="b-o" numlevel="1" lineno="119" slineno="1-89" level="2"><display>(b)</display>This section may not be interpreted in a way that would permit or justify any action <ln numlevel="1" lineno="120" slineno="1-90"/>that violates a provision in Sections <xref depth="3" refnumber="76-5-111">76-5-111</xref> through <xref depth="3" refnumber="76-5-111.4">76-5-111.4</xref> or Section <xref depth="3" refnumber="76-5-112.5"><ln numlevel="1" lineno="121" slineno="1-91"/>76-5-112.5</xref>.</subsection><subsection ssid="6-50" dnum="_-o:c-e" numlevel="1" lineno="122" slineno="1-92" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1046" style="1" owner="e" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="8" groupid="3" style="1" owner="admin" level="1" amendtag="end">Nothing in this section shall be construed to alter or preempt the requirements for <ln numlevel="1" lineno="123" slineno="1-93"/>protecting health information und<marker pairid="15">er the Health </marker>Insurance Portability and <ln numlevel="1" lineno="124" slineno="1-94"/>Accountability Act of 1996, 50 Pub. L. No. 104-191, 110 Stat. 1936, as amended.</amend></subsection></subsection><subsection ssid="6-null-47" dnum="8-o" numlevel="1" lineno="125" slineno="1-95" level="1"><display>(8)</display>Any right described in this section may be:<subsection ssid="6-null-48" dnum="a-o" numlevel="1" lineno="126" slineno="1-96" level="2"><display>(a)</display>addressed in a guardianship proceeding; or</subsection><subsection ssid="6-null-49" dnum="b-o" numlevel="1" lineno="127" slineno="1-97" level="2"><display>(b)</display>enforced through a private cause of action.</subsection></subsection></section></bsec><bsec buid="4" num="75-5-303" type="amend" src="code" uid="C75-5-S303_2026050620260506" sort="75 05 03030020260506" numlevel="1" lineno="128" slineno="2-1" sn="2"><section number="75-5-303" numlevel="1" lineno="129" slineno="2-2" type="amend"><secline lineno="128">Section 2. Procedure for court appointment of a guardian of an incapacitated <ln numlevel="1" lineno="130" slineno="2-3"/>person.</bold></catline><subsection ssid="4-null-1" dnum="1-o" numlevel="1" lineno="131" slineno="2-4" level="1" placement="noreturn"><display>(1)</display>An allegedly incapacitated person or any person interested in an allegedly incapacitated <ln numlevel="1" lineno="132" slineno="2-5"/>person's welfare may petition for a finding of incapacity and appointment of a guardian.</subsection><subsection ssid="4-null-2" dnum="2-o" numlevel="1" lineno="133" slineno="2-6" level="1" space="false"><display>(2)</display><subsection ssid="4-null-3" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Upon the filing of a petition, the court shall set a date for hearing on the issues of <ln numlevel="1" lineno="134" slineno="2-7"/>incapacity.</subsection><subsection ssid="4-null-4" dnum="b-o" numlevel="1" lineno="135" slineno="2-8" level="2"><display>(b)</display>Unless the allegedly incapacitated person has counsel of the person's own choice, the <ln numlevel="1" lineno="136" slineno="2-9"/>court shall appoint an attorney to represent the person in the proceeding the cost of <ln numlevel="1" lineno="137" slineno="2-10"/>which shall be paid by the allegedly incapacitated person, unless the allegedly <ln numlevel="1" lineno="138" slineno="2-11"/>incapacitated person and the allegedly incapacitated person's parents are indigent.</subsection><subsection ssid="4-null-5" dnum="c-o" numlevel="1" lineno="139" slineno="2-12" level="2"><display>(c)</display>If the court determines that the petition is without merit, the attorney fees and court <ln numlevel="1" lineno="140" slineno="2-13"/>costs shall be paid by the person filing the petition.</subsection><subsection ssid="4-null-6" dnum="d-o" numlevel="1" lineno="141" slineno="2-14" level="2"><display>(d)</display>If the court appoints the petitioner or the petitioner's nominee as guardian of the <ln numlevel="1" lineno="142" slineno="2-15"/>incapacitated person, regardless of whether the nominee is specified in the moving <ln numlevel="1" lineno="143" slineno="2-16"/>petition or nominated during the proceedings, the petitioner shall be entitled to <ln numlevel="1" lineno="144" slineno="2-17"/>receive from the incapacitated person reasonable attorney fees and court costs <ln numlevel="1" lineno="145" slineno="2-18"/>incurred in bringing, prosecuting, or defending the petition.</subsection></subsection><subsection ssid="4-null-7" dnum="3-o" numlevel="1" lineno="146" slineno="2-19" level="1"><display>(3)</display>The legal representation of an allegedly incapacitated person by an attorney shall <ln numlevel="1" lineno="147" slineno="2-20"/>terminate upon the appointment of a guardian, unless:<subsection ssid="4-null-8" dnum="a-o" numlevel="1" lineno="148" slineno="2-21" level="2"><display>(a)</display>there are separate conservatorship proceedings still pending before the court <ln numlevel="1" lineno="149" slineno="2-22"/>subsequent to the appointment of a guardian;</subsection><subsection ssid="4-null-9" dnum="b-o" numlevel="1" lineno="150" slineno="2-23" level="2"><display>(b)</display>there is a timely filed appeal of the appointment of the guardian or the determination <ln numlevel="1" lineno="151" slineno="2-24"/>of incapacity; or</subsection><subsection ssid="4-null-10" dnum="c-o" numlevel="1" lineno="152" slineno="2-25" level="2"><display>(c)</display>upon an express finding of good cause, the court orders otherwise.</subsection></subsection><subsection ssid="4-null-11" dnum="4-o" numlevel="1" lineno="153" slineno="2-26" level="1" space="false"><display>(4)</display><subsection ssid="4-null-12" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The court may appoint a health care provider, as that term is defined in Section <xref depth="3" refnumber="75A-3-101"><ln numlevel="1" lineno="154" slineno="2-27"/>75A-3-101</xref>, <amend anum="0" ea="amend" pairid="13" groupid="5" style="1" owner="admin" level="1" amendtag="both">who is qualified by training, education, and experience </amend>to examine the <ln numlevel="1" lineno="155" slineno="2-28"/>functional capabilities and limitations of the allegedly incapacitated person.</subsection><subsection ssid="4-null-13" dnum="b-o" numlevel="1" lineno="156" slineno="2-29" level="2"><display>(b)</display>An appointed health care provider shall <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="32" groupid="21" style="2" owner="admin" level="1" deltag="both">submit to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="31" groupid="20" style="1" owner="admin" level="1" amendtag="both" space="true">file with</amend> the court a report <ln numlevel="1" lineno="157" slineno="2-30"/>assessing, within the scope of the health care provider's license and experience, <amend anum="0" ea="amend" pairid="19" groupid="10" style="1" owner="admin" level="1" amendtag="both">using <ln numlevel="1" lineno="158" slineno="2-31"/>evidence-based screening tools appropriate for the assessment, </amend>the functional <ln numlevel="1" lineno="159" slineno="2-32"/>capabilities and limitations of the allegedly incapacitated person to, with or without <ln numlevel="1" lineno="160" slineno="2-33"/>appropriate technological assistance:<subsection ssid="4-null-14" dnum="i-o" numlevel="1" lineno="161" slineno="2-34" level="3"><display>(i)</display>receive and evaluate information;</subsection><subsection ssid="4-null-15" dnum="ii-o" numlevel="1" lineno="162" slineno="2-35" level="3"><display>(ii)</display>make and communicate decisions; and</subsection><subsection ssid="4-null-16" dnum="iii-o" numlevel="1" lineno="163" slineno="2-36" level="3"><display>(iii)</display>provide for necessities such as food, shelter, clothing, health care, or safety.</subsection></subsection><subsection ssid="4-40" dnum="_-o:c-e" numlevel="1" lineno="164" slineno="2-37" ea="amend" anum="0" owner="admin" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1066" style="1" owner="e" level="1" amendtag="start">(c)</amend></display><subsection ssid="4-45" dnum="_-o:i-e" ea="amend" anum="0" owner="admin" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1067" style="1" owner="e" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="48" groupid="35" style="1" owner="admin" level="1" amendtag="end">An appointed health care provider may interview the person seeking <ln numlevel="1" lineno="165" slineno="2-38"/>appointment as guardian.</amend></subsection><subsection ssid="4-44" dnum="_-o:ii-e" numlevel="1" lineno="166" slineno="2-39" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1068" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="43" groupid="31" style="1" owner="admin" level="1" amendtag="end">The appointed health care provider may not base the appointed health care <ln numlevel="1" lineno="167" slineno="2-40"/>provider's assessment described in Subsection <xref depth="4" refnumber="75-5-303(4)(b)">(4)(b)</xref> solely or predominately on <ln numlevel="1" lineno="168" slineno="2-41"/>the opinion of the person seeking appointment as guardian.</amend></subsection></subsection></subsection><subsection ssid="4-null-17" dnum="5-o" numlevel="1" lineno="169" slineno="2-42" level="1" space="false"><display>(5)</display><subsection ssid="4-null-18" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The court may appoint a court visitor to: <subsection ssid="4-null-19" dnum="i-o" numlevel="1" lineno="170" slineno="2-43" level="3" tab="1"><display>(i)</display>interview the person seeking appointment as guardian; </subsection><subsection ssid="4-null-20" dnum="ii-o" numlevel="1" lineno="171" slineno="2-44" level="3" tab="1"><display>(ii)</display>visit the present place of abode of the allegedly incapacitated person and the place <ln numlevel="1" lineno="172" slineno="2-45"/>it is proposed that the allegedly incapacitated person will be detained or reside if <ln numlevel="1" lineno="173" slineno="2-46"/>the requested appointment is made; or </subsection><subsection ssid="4-null-21" dnum="iii-o" numlevel="1" lineno="174" slineno="2-47" level="3" tab="1"><display>(iii)</display>conduct other investigations or observations as directed by the court.</subsection></subsection><subsection ssid="4-null-22" dnum="b-o" numlevel="1" lineno="175" slineno="2-48" level="2"><display>(b)</display>The court visitor shall <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="37" groupid="26" style="2" owner="admin" level="1" deltag="both">submit</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="35" groupid="24" style="1" owner="admin" level="1" amendtag="both" space="true">file</amend> a written report <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="38" groupid="27" style="2" owner="admin" level="1" deltag="both">to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="36" groupid="25" style="1" owner="admin" level="1" amendtag="both" space="true">with</amend> the court.</subsection></subsection><subsection ssid="4-null-23" dnum="6-o" numlevel="1" lineno="176" slineno="2-49" level="1" space="false"><display>(6)</display><subsection ssid="4-null-24" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The allegedly incapacitated person shall be present at the hearing and see or hear <ln numlevel="1" lineno="177" slineno="2-50"/>all evidence bearing upon the person's condition.  </subsection><subsection ssid="4-null-25" dnum="b-o" numlevel="1" lineno="178" slineno="2-51" level="2"><display>(b)</display>The court may only waive the presence of the allegedly incapacitated person if all of <ln numlevel="1" lineno="179" slineno="2-52"/>the following criteria are met:<subsection ssid="4-null-26" dnum="i-o" numlevel="1" lineno="180" slineno="2-53" level="3"><display>(i)</display>the person is represented by an attorney;</subsection><subsection ssid="4-null-27" dnum="ii-o" numlevel="1" lineno="181" slineno="2-54" level="3"><display>(ii)</display>a court visitor is appointed to investigate, the costs of which shall be paid by the <ln numlevel="1" lineno="182" slineno="2-55"/>person seeking the guardianship; and</subsection><subsection ssid="4-null-28" dnum="iii-o" numlevel="1" lineno="183" slineno="2-56" level="3"><display>(iii)</display>following the investigation, the court finds that there is no reasonable <ln numlevel="1" lineno="184" slineno="2-57"/>accommodation that will enable the allegedly incapacitated person to be present <ln numlevel="1" lineno="185" slineno="2-58"/>for or participate in the hearing.</subsection></subsection><subsection ssid="4-null-29" dnum="c-o" numlevel="1" lineno="186" slineno="2-59" level="2"><display>(c)</display>A court visitor is not required to investigate under Subsection <xref tempid="679" depth="4" refnumber="75-5-303(6)(b)(ii)">(6)(b)(ii)</xref> if there is <ln numlevel="1" lineno="187" slineno="2-60"/>clear and convincing evidence from a physician that the person alleged to be <ln numlevel="1" lineno="188" slineno="2-61"/>incapacitated is experiencing a state of extended comatosis that is likely to persist <ln numlevel="1" lineno="189" slineno="2-62"/>through the time of the hearing.</subsection><subsection ssid="4-null-30" dnum="d-o" numlevel="1" lineno="190" slineno="2-63" level="2"><display>(d)</display>In addition to the rights described in Section <xref depth="3" refnumber="75-5-301.5">75-5-301.5</xref>, an allegedly incapacitated <ln numlevel="1" lineno="191" slineno="2-64"/>person is entitled to be represented by counsel, to present evidence, to cross-examine <ln numlevel="1" lineno="192" slineno="2-65"/>witnesses, including the court-appointed health care provider and the court visitor, <ln numlevel="1" lineno="193" slineno="2-66"/>and to trial by jury.  The issue may be determined at a closed hearing without a jury if <ln numlevel="1" lineno="194" slineno="2-67"/>the allegedly incapacitated person or the person's counsel so requests.</subsection><subsection ssid="4-null-31" dnum="e-o" numlevel="1" lineno="195" slineno="2-68" level="2"><display>(e)</display>Counsel for the allegedly incapacitated person is not required if all of the following <ln numlevel="1" lineno="196" slineno="2-69"/>criteria are met:<subsection ssid="4-null-32" dnum="i-o" numlevel="1" lineno="197" slineno="2-70" level="3"><display>(i)</display>the allegedly incapacitated person is the biological or adopted child of the <ln numlevel="1" lineno="198" slineno="2-71"/>petitioner;</subsection><subsection ssid="4-null-33" dnum="ii-o" numlevel="1" lineno="199" slineno="2-72" level="3"><display>(ii)</display>the value of the allegedly incapacitated person's entire estate does not exceed <ln numlevel="1" lineno="200" slineno="2-73"/>$20,000 as established by an affidavit of the petitioner in accordance with Section <xref depth="3" refnumber="75-3-1201"><ln numlevel="1" lineno="201" slineno="2-74"/>75-3-1201</xref>;</subsection><subsection ssid="4-null-34" dnum="iii-o" numlevel="1" lineno="202" slineno="2-75" level="3"><display>(iii)</display>the allegedly incapacitated person's appearance at the hearing has not been <ln numlevel="1" lineno="203" slineno="2-76"/>waived and the person appears in court with the petitioner, as described in <ln numlevel="1" lineno="204" slineno="2-77"/>Subsection <xref depth="4" refnumber="75-5-303(6)(a)">(6)(a)</xref>;</subsection><subsection ssid="4-null-35" dnum="iv-o" numlevel="1" lineno="205" slineno="2-78" level="3"><display>(iv)</display>the allegedly incapacitated person is given the opportunity to communicate, to <ln numlevel="1" lineno="206" slineno="2-79"/>the extent possible, the person's acceptance of or objection to the appointment of <ln numlevel="1" lineno="207" slineno="2-80"/>the proposed guardian, including the opportunity to communicate that acceptance <ln numlevel="1" lineno="208" slineno="2-81"/>or objection to the court and, as applicable, to the person's supporters, health care <ln numlevel="1" lineno="209" slineno="2-82"/>providers, and attorney;</subsection><subsection ssid="4-null-36" dnum="v-o" numlevel="1" lineno="210" slineno="2-83" level="3"><display>(v)</display>no attorney from the state court's list of attorneys who have volunteered to <ln numlevel="1" lineno="211" slineno="2-84"/>represent respondents in guardianship proceedings is able to provide counsel to <ln numlevel="1" lineno="212" slineno="2-85"/>the person within 60 days of the date of the hearing, as described in Subsection <xref depth="4" refnumber="75-5-303(2)(b)"><ln numlevel="1" lineno="213" slineno="2-86"/>(2)(b)</xref>;</subsection><subsection ssid="4-null-37" dnum="vi-o" numlevel="1" lineno="214" slineno="2-87" level="3"><display>(vi)</display>the court is satisfied that counsel is not necessary to protect the interests of the <ln numlevel="1" lineno="215" slineno="2-88"/>allegedly incapacitated person; and</subsection><subsection ssid="4-null-38" dnum="vii-o" numlevel="1" lineno="216" slineno="2-89" level="3"><display>(vii)</display>the court appoints a court visitor and receives a report from the court visitor <ln numlevel="1" lineno="217" slineno="2-90"/>under Subsection <xref depth="4" refnumber="75-5-303(5)">(5)</xref>.</subsection></subsection></subsection></section></bsec><bsec buid="10" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="218" slineno="3-1" sn="3"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="218">Section 3.  <bold>Effective Date.</bold></secline><sectionText lineno="219"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="admin" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>3-5-26 9:44 AM</tm></rev></foot></leg>
