Peterson</otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill addresses performance funding and enrollment funding in higher education.</gd><hphead lineno="6">Highlighted Provisions:</hphead><hp numlevel="1" lineno="7" slineno="0-7">This bill:<hl numlevel="1" lineno="8" slineno="0-8" level="1">defines terms;</hl><hl numlevel="1" lineno="9" slineno="0-9" level="1">repeals a study requirement for the Higher Education Appropriations Subcommittee that <ln numlevel="1" lineno="10" slineno="0-10"/>this legislation fulfills;</hl><hl ssid="0" numlevel="1" lineno="11" slineno="0-11" level="1">requires the Higher Education Appropriations Subcommittee to ensure the inclusion of <ln numlevel="1" lineno="12" slineno="0-12"/>certain factors in non-statutory funding formulas for technical colleges;</hl><hl numlevel="1" lineno="13" slineno="0-13" level="1">establishes a process and formula for determining certain enrollment-based funding for <ln numlevel="1" lineno="14" slineno="0-14"/>institutions of higher education, including degree-granting universities and technical <ln numlevel="1" lineno="15" slineno="0-15"/>colleges;</hl><hl numlevel="1" lineno="16" slineno="0-16" level="1">establishes new performance metrics and goals for performance-based funding;</hl><hl numlevel="1" lineno="17" slineno="0-17" level="1">amends provisions regarding certain meetings of legislative committees in relation to the <ln numlevel="1" lineno="18" slineno="0-18"/>performance funding model;</hl><hl numlevel="1" lineno="19" slineno="0-19" level="1">enacts certain sunset dates; lineno="125" slineno="2-5" level="1" placement="noreturn"><display>(1)</display>As used in this section,<amend anum="0" ea="amend" pairid="5" groupid="5" style="1" owner="admin" level="1" amendtag="both"> </amend>"research university" means the University of Utah or Utah State <ln numlevel="1" lineno="126" slineno="2-6"/>University.</subsection><subsection ssid="12-null-2" dnum="2-o" numlevel="1" lineno="127" slineno="2-7" level="1" space="false"><display>(2)</display><subsection ssid="12-null-3" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Subject to Subsection <xref depth="4" refnumber="53B-7-101(3)">(3)</xref>, the board shall recommend a combined appropriation <ln numlevel="1" lineno="128" slineno="2-8"/>for the operating budgets of institutions and the board for inclusion in a state <ln numlevel="1" lineno="129" slineno="2-9"/>appropriations act.</subsection><subsection ssid="12-null-4" dnum="b-o" numlevel="1" lineno="130" slineno="2-10" level="2"><display>(b)</display>The board's combined budget recommendation shall include:<subsection ssid="12-null-5" dnum="i-o" numlevel="1" lineno="131" slineno="2-11" level="3"><display>(i)</display>employee compensation;</subsection><subsection ssid="12-null-6" dnum="ii-o" numlevel="1" lineno="132" slineno="2-12" level="3"><display>(ii)</display>mandatory costs, including building operations and maintenance, fuel, and power;</subsection><subsection ssid="12-null-7" dnum="iii-o" numlevel="1" lineno="133" slineno="2-13" level="3"><display>(iii)</display>performance funding described in <xref depth="2" refnumber="53B-7-3">Part 3</xref>, Performance Funding;</subsection><subsection ssid="12-null-8" dnum="iv-o" numlevel="1" lineno="134" slineno="2-14" level="3"><display>(iv)</display>statewide and institutional priorities, including scholarships, financial aid, and <ln numlevel="1" lineno="135" slineno="2-15"/>technology infrastructure; and</subsection><subsection ssid="12-null-9" dnum="v-o" numlevel="1" lineno="136" slineno="2-16" level="3"><display>(v)</display>enrollment <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="admin" level="1" deltag="both">growth</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="admin" level="1" amendtag="both" space="true">funding described in Section <xref depth="3" refnumber="53H-2-211">53H-2-211</xref></amend>.</subsection></subsection><subsection ssid="12-null-10" dnum="c-o" numlevel="1" lineno="137" slineno="2-17" level="2"><display>(c)</display>The board's recommendations shall be available for presentation to the governor and <ln numlevel="1" lineno="138" slineno="2-18"/>to the Legislature at least 30 days before the convening of the Legislature, and shall <ln numlevel="1" lineno="139" slineno="2-19"/>include schedules showing the recommended amounts for each institution and the <ln numlevel="1" lineno="140" slineno="2-20"/>board, including separately funded programs or divisions.</subsection><subsection ssid="12-null-11" dnum="d-o" numlevel="1" lineno="141" slineno="2-21" level="2"><display>(d)</display>The recommended appropriations shall be determined by the board only after the <ln numlevel="1" lineno="142" slineno="2-22"/>board has reviewed the proposed institutional operating budgets, and has consulted <ln numlevel="1" lineno="143" slineno="2-23"/>with the various institutions and board staff in order to make appropriate adjustments.</subsection></subsection><subsection ssid="12-null-12" dnum="3-o" numlevel="1" lineno="144" slineno="2-24" level="1"><display>(3)</display>In the combined request for appropriation, the board shall differentiate between <ln numlevel="1" lineno="145" slineno="2-25"/>appropriations requested for academic education and appropriations requested for <ln numlevel="1" lineno="146" slineno="2-26"/>technical education.</subsection><subsection ssid="12-null-13" dnum="4-o" numlevel="1" lineno="147" slineno="2-27" level="1" space="false"><display>(4)</display><subsection ssid="12-null-14" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Institutional operating budgets shall be submitted to the board at least 90 days <ln numlevel="1" lineno="148" slineno="2-28"/>before the convening of the Legislature in accordance with procedures established by <ln numlevel="1" lineno="149" slineno="2-29"/>the board.</subsection><subsection ssid="12-null-15" dnum="b-o" numlevel="1" lineno="150" slineno="2-30" level="2"><display>(b)</display>Except as provided in Sections <xref depth="3" refnumber="53H-9-604">53H-9-604</xref> and <xref depth="3" refnumber="53H-9-504">53H-9-504</xref>, funding requests <ln numlevel="1" lineno="151" slineno="2-31"/>pertaining to capital facilities and land purchases shall be submitted in accordance <ln numlevel="1" lineno="152" slineno="2-32"/>with procedures prescribed by the Division of Facilities Construction and <ln numlevel="1" lineno="153" slineno="2-33"/>Management.</subsection></subsection><subsection ssid="12-null-16" dnum="5-o" numlevel="1" lineno="154" slineno="2-34" level="1" space="false"><display>(5)</display><subsection ssid="12-null-17" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The budget recommendations of the board shall be accompanied by full <ln numlevel="1" lineno="155" slineno="2-35"/>explanations and supporting data.</subsection><subsection ssid="12-null-18" dnum="b-o" numlevel="1" lineno="156" slineno="2-36" level="2"><display>(b)</display>The appropriations recommended by the board shall be made with the dual objective <ln numlevel="1" lineno="157" slineno="2-37"/>of:<subsection ssid="12-null-19" dnum="i-o" numlevel="1" lineno="158" slineno="2-38" level="3"><display>(i)</display>justifying for institutions appropriations consistent with the institutions' needs, and <ln numlevel="1" lineno="159" slineno="2-39"/>consistent with the financial ability of the state; and</subsection><subsection ssid="12-null-20" dnum="ii-o" numlevel="1" lineno="160" slineno="2-40" level="3"><display>(ii)</display>determining an equitable distribution of funds among the respective institutions in <ln numlevel="1" lineno="161" slineno="2-41"/>accordance with the aims and objectives of the statewide master plan for higher <ln numlevel="1" lineno="162" slineno="2-42"/>education.</subsection></subsection></subsection><subsection ssid="12-null-21" dnum="6-o" numlevel="1" lineno="163" slineno="2-43" level="1" space="false"><display>(6)</display><subsection ssid="12-null-22" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The board shall request a hearing with the governor on the recommended <ln numlevel="1" lineno="164" slineno="2-44"/>appropriations.</subsection><subsection ssid="12-null-23" dnum="b-o" numlevel="1" lineno="165" slineno="2-45" level="2"><display>(b)</display>After the governor delivers the governor's budget message to the Legislature, the <ln numlevel="1" lineno="166" slineno="2-46"/>board shall request hearings on the recommended appropriations with the Higher <ln numlevel="1" lineno="167" slineno="2-47"/>Education Appropriations Subcommittee.</subsection><subsection ssid="12-null-24" dnum="c-o" numlevel="1" lineno="168" slineno="2-48" level="2"><display>(c)</display>If either the total amount of the state appropriations or <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="14" groupid="13" style="2" owner="admin" level="1" deltag="both">its</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="12" groupid="11" style="1" owner="admin" level="1" amendtag="both" space="true">the</amend> allocation <amend anum="0" ea="amend" pairid="13" groupid="12" style="1" owner="admin" level="1" amendtag="both">of the state <ln numlevel="1" lineno="169" slineno="2-49"/>appropriations </amend>among the institutions as proposed by the Legislature or the Higher <ln numlevel="1" lineno="170" slineno="2-50"/>Education Appropriations Subcommittee is substantially different from the <ln numlevel="1" lineno="171" slineno="2-51"/>recommendations of the board, the board may request further hearings with the <ln numlevel="1" lineno="172" slineno="2-52"/>Legislature or the Higher Education Appropriations Subcommittee to reconsider both <ln numlevel="1" lineno="173" slineno="2-53"/>the total amount and the allocation.</subsection></subsection><subsection ssid="12-null-25" dnum="7-o" numlevel="1" lineno="174" slineno="2-54" level="1"><display>(7)</display>The board may devise, establish, periodically review, and revise formulas for the <ln numlevel="1" lineno="175" slineno="2-55"/>board's use and for the use of the governor and the Higher Education Appropriations <ln numlevel="1" lineno="176" slineno="2-56"/>Subcommittee in making appropriation recommendations.</subsection><subsection ssid="12-null-26" dnum="8-o" numlevel="1" lineno="177" slineno="2-57" level="1" space="false"><display>(8)</display><subsection ssid="12-null-27" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The board shall recommend to each session of the Legislature the minimum <ln numlevel="1" lineno="178" slineno="2-58"/>tuitions, resident and nonresident, for each institution which it considers necessary to <ln numlevel="1" lineno="179" slineno="2-59"/>implement the budget recommendations.</subsection><subsection ssid="12-null-28" dnum="b-o" numlevel="1" lineno="180" slineno="2-60" level="2"><display>(b)</display>Subject to Subsection <xref depth="4" refnumber="53B-7-101(13)">(13)</xref>, the board may fix the tuition, fees, and charges for each <ln numlevel="1" lineno="181" slineno="2-61"/>institution at levels the board finds necessary to meet budget requirements.</subsection></subsection><subsection ssid="12-null-29" dnum="9-o" numlevel="1" lineno="182" slineno="2-62" level="1"><display>(9)</display>Money allocated to each institution by legislative appropriation may be budgeted in <ln numlevel="1" lineno="183" slineno="2-63"/>accordance with institutional work programs approved by the board, provided that the <ln numlevel="1" lineno="184" slineno="2-64"/>expenditures funded by appropriations for each institution are kept within the <ln numlevel="1" lineno="185" slineno="2-65"/>appropriations for the applicable period.</subsection><subsection ssid="12-null-30" dnum="10-o" numlevel="1" lineno="186" slineno="2-66" level="1"><display>(10)</display>The dedicated credits, including revenues derived from tuitions, fees, federal grants, <ln numlevel="1" lineno="187" slineno="2-67"/>and proceeds from sales received by the institutions are appropriated to the respective <ln numlevel="1" lineno="188" slineno="2-68"/>institutions to be used in accordance with institutional work programs.</subsection><subsection ssid="12-null-31" dnum="11-o" numlevel="1" lineno="189" slineno="2-69" level="1"><display>(11)</display>An institution may do the institution's own purchasing, issue the institution's own <ln numlevel="1" lineno="190" slineno="2-70"/>payrolls, and handle the institution's own financial affairs under the general supervision <ln numlevel="1" lineno="191" slineno="2-71"/>of the board.</subsection><subsection ssid="12-null-32" dnum="12-o" numlevel="1" lineno="192" slineno="2-72" level="1"><display>(12)</display>If the Legislature appropriates money in accordance with this section, the money shall <ln numlevel="1" lineno="193" slineno="2-73"/>be distributed to the board and institutions to fund the items described in Subsection <xref depth="4" refnumber="53B-7-101(2)(b)"><ln numlevel="1" lineno="194" slineno="2-74"/>(2)(b)</xref>.</subsection><subsection ssid="12-null-33" dnum="13-o" numlevel="1" lineno="195" slineno="2-75" level="1"><display>(13)</display>The board shall create policies requiring an institution of higher education to waive <ln numlevel="1" lineno="196" slineno="2-76"/>transcript fees for a student who is under <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="8" style="2" owner="admin" level="1" deltag="both">the age of </amend><amendoutend style="2"/>26<amend anum="0" ea="amend" pairid="8" groupid="7" style="1" owner="admin" level="1" amendtag="both"> years old</amend> and:<subsection ssid="12-null-34" dnum="a-o" numlevel="1" lineno="197" slineno="2-77" level="2"><display>(a)</display>is homeless, as defined in Section <xref depth="3" refnumber="26B-3-207">26B-3-207</xref>;</subsection><subsection ssid="12-null-35" dnum="b-o" numlevel="1" lineno="198" slineno="2-78" level="2"><display>(b)</display>is a person who is homeless, as defined in Section <xref depth="3" refnumber="35A-5-302">35A-5-302</xref>;</subsection><subsection ssid="12-null-36" dnum="c-o" numlevel="1" lineno="199" slineno="2-79" level="2"><display>(c)</display>is an individual whose primary nighttime residence is a location that is not designed <ln numlevel="1" lineno="200" slineno="2-80"/>for or ordinarily used as a sleeping accommodation for an individual;</subsection><subsection ssid="12-null-37" dnum="d-o" numlevel="1" lineno="201" slineno="2-81" level="2"><display>(d)</display>is a homeless child or youth, as defined in 42 U.S.C. Sec. 11434a;</subsection><subsection ssid="12-null-38" dnum="e-o" numlevel="1" lineno="202" slineno="2-82" level="2"><display>(e)</display>is in the custody of the Division of Child and Family Services; or</subsection><subsection ssid="12-null-39" dnum="f-o" numlevel="1" lineno="203" slineno="2-83" level="2"><display>(f)</display>was in the custody of the Division of Child and Family Services but is no longer in <ln numlevel="1" lineno="204" slineno="2-84"/>the custody of the Division of Child and Family Services due to the individual's age.</subsection></subsection></section></bsec><bsec buid="16" num="53H-8-211" type="enact" src="code" uid="C53H-8-S211_2026070120260701" sort="53H08 02110020260701" numlevel="1" lineno="205" slineno="3-1" sn="3"><section numlevel="1" lineno="206" slineno="3-2" number="53H-8-211" type="enact"><secline lineno="205">Section 3. owner="admin" level="1" amendtag="end">"Basic graduate" means the level of a master's course at a degree-granting institution.</amend></subsection><subsection ssid="16-58" dnum="_-o:c-e" numlevel="1" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1088" style="1" owner="e" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="105" groupid="84" style="1" owner="admin" level="1" amendtag="end">"Full-time equivalent" means a metric that measures student course load by <ln numlevel="1" lineno="219" slineno="3-15"/>converting course hours into a number representing a full-time student equivalent <ln numlevel="1" lineno="220" slineno="3-16"/>load.</amend></subsection><subsection ssid="16-59" dnum="_-o:e-e" numlevel="1" lineno="221" slineno="3-17" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1089" style="1" owner="e" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="267" groupid="205" style="1" owner="admin" level="1" amendtag="end">"High-cost upper-division" means an upper-<marker pairid="312"/>division course in a program with a <ln numlevel="1" lineno="222" slineno="3-18"/>classification of instruction program code of 11, 14, 51, or 52.</amend></subsection><subsection ssid="16-38" dnum="_-o:f-e" numlevel="1" lineno="223" slineno="3-19" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1090" style="1" owner="e" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="181" groupid="141" style="1" owner="admin" level="1" amendtag="end">"Level of instruction" means the following credits of education at <ln numlevel="1" lineno="233" slineno="3-29"/>a degree-granting institution; or</amend></subsection><subsection ssid="16-6" dnum="_-o:ii-e" numlevel="1" lineno="234" amendtag="start">(h)</amend></display><amend anum="0" ea="amend" pairid="23" groupid="18" style="1" owner="admin" level="1" amendtag="end">"Technical certificate education" means technical education that a technical college <ln numlevel="1" lineno="236" slineno="3-32"/>provides to students who are seeking a certificate, continuing occupational education, <ln numlevel="1" lineno="237" slineno="3-33"/>or enrolled as a secondary student.</amend></subsection><subsection ssid="16-7" dnum="_-o:i-e" numlevel="1" lineno="238" slineno="3-34" ea="amend" anum="0" owner="admin" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1102" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><subsection ssid="16-9" dnum="_-o:i-e" ea="amend" anum="0" owner="admin" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1103" style="1" owner="e" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="47" groupid="37" style="1" owner="admin" level="1" amendtag="end">"Upper-division" means the level of a course that:</amend><subsection ssid="16-10" dnum="_-o:A-e" numlevel="1" lineno="239" slineno="3-35" ea="amend" anum="0" owner="admin" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1104" style="1" owner="e" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="52" groupid="41" style="1" owner="admin" level="1" amendtag="end">is an advanced undergraduate course at a degree-granting institution; and</amend></subsection><subsection ssid="16-11" dnum="_-o:B-e" numlevel="1" lineno="240" slineno="3-36" ea="amend" anum="0" owner="admin" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1105" style="1" owner="e" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="57" groupid="45" style="1" owner="admin" level="1" amendtag="end">students typically complete in the last two years of a bachelor's degree.</amend></subsection></subsection><subsection ssid="16-12" dnum="_-o:ii-e" numlevel="1" lineno="241" slineno="3-37" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1106" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="64" groupid="51" style="1" owner="admin" level="1" amendtag="end">"Upper-division" includes major-specific courses.</amend></subsection></subsection><subsection ssid="16-3" dnum="_-o:j-e" numlevel="1" lineno="242" slineno="3-38" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1107" style="1" owner="e" level="1" amendtag="start">(j)</amend></display><amend anum="0" ea="amend" pairid="18" groupid="14" style="1" owner="admin" level="1" amendtag="end">"Vocational education" means career and technical education that a degree-granting <ln numlevel="1" lineno="243" slineno="3-39"/>institution provides.</amend></subsection></subsection><subsection ssid="16-26" dnum="_-o:2-e" numlevel="1" lineno="244" slineno="3-40" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1108" style="1" owner="e" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="167" groupid="130" style="1" owner="admin" level="1" amendtag="end">In accordance with this section, the Legislature shall, as part of the higher education <ln numlevel="1" lineno="245" slineno="3-41"/>appropriations budget process, annually determine the change in the amount of <ln numlevel="1" lineno="246" slineno="3-42"/>enrollment funding for each:</amend><subsection ssid="16-27" dnum="_-o:a-e" numlevel="1" lineno="247" slineno="3-43" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1109" style="1" owner="e" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="139" groupid="111" style="1" owner="admin" level="1" amendtag="end">degree-granting institution; and</amend></subsection><subsection ssid="16-28" dnum="_-o:b-e" numlevel="1" lineno="248" slineno="3-44" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1110" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="142" groupid="113" style="1" owner="admin" level="1" amendtag="end">technical college.</amend></subsection></subsection><subsection ssid="16-32" dnum="_-o:3-e" numlevel="1" lineno="249" slineno="3-45" ea="amend" anum="0" owner="admin" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1111" style="1" owner="e" level="1" amendtag="start">(3)</amend></display><subsection ssid="16-41" dnum="_-o:a-e" ea="amend" anum="0" owner="admin" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1112" style="1" owner="e" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="196" groupid="152" style="1" owner="admin" level="1" amendtag="end">The Legislature shall determine the change in the amount of an institution's <ln numlevel="1" lineno="250" slineno="3-46"/>enrollment funding based on the positive or negative change in enrollment at the <ln numlevel="1" lineno="251" slineno="3-47"/>institution by:</amend><subsection ssid="16-42" dnum="_-o:i-e" numlevel="1" lineno="252" slineno="3-48" ea="amend" anum="0" owner="admin" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1113" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="282" groupid="215" style="1" owner="admin" level="1" amendtag="end">calculating the average direct instructional cost per budget-related full-time <ln numlevel="1" lineno="253" slineno="3-49"/>equivalent at each level of instruction on a system-wide basis;</amend></subsection><subsection ssid="16-43" dnum="_-o:ii-e" numlevel="1" lineno="254" slineno="3-50" ea="amend" anum="0" owner="admin" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1114" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="202" groupid="156" style="1" owner="admin" level="1" amendtag="end">calculating the five-year average full-time equivalent budget-related resident <ln numlevel="1" lineno="255" slineno="3-51"/>enrollment at each level of instruction at each institution for the five-year period <ln numlevel="1" lineno="256" slineno="3-52"/>ending with the previous fiscal year and the five-year period ending with the year <ln numlevel="1" lineno="257" slineno="3-53"/>before the previous fiscal year;</amend></subsection><subsection ssid="16-44" dnum="_-o:iii-e" numlevel="1" lineno="258" slineno="3-54" ea="amend" anum="0" owner="admin" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1115" style="1" owner="e" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="205" groupid="158" style="1" owner="admin" level="1" amendtag="end">calculating the percentage change between each five-year period described in <ln numlevel="1" lineno="259" slineno="3-55"/>Subsection <xref depth="4" refnumber="53H-8-211(3)(a)(ii)">(3)(a)(ii)</xref> by each level of instruction;</amend></subsection><subsection ssid="16-45" dnum="_-o:iv-e" numlevel="1" lineno="260" slineno="3-56" ea="amend" anum="0" owner="admin" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1116" style="1" owner="e" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="208" groupid="160" style="1" owner="admin" level="1" amendtag="end">if the percent change in enrollment is greater than or equal to a 1% increase or <ln numlevel="1" lineno="261" slineno="3-57"/>decrease, multiplying the average cost per full-time equivalent by the actual <ln numlevel="1" lineno="262" slineno="3-58"/>change in full-time equivalent;</amend></subsection><subsection ssid="16-46" dnum="_-o:v-e" numlevel="1" lineno="263" slineno="3-59" ea="amend" anum="0" owner="admin" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1117" style="1" owner="e" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="211" groupid="162" style="1" owner="admin" level="1" amendtag="end">applying a state cost-sharing weight based on institution type in accordance with <ln numlevel="1" lineno="264" slineno="3-60"/>Subsection <xref depth="4" refnumber="53H-8-211(3)(b)">(3)(b)</xref>; and</amend></subsection><subsection ssid="16-47" dnum="_-o:vi-e" numlevel="1" lineno="265" slineno="3-61" ea="amend" anum="0" owner="admin" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1118" style="1" owner="e" level="1" amendtag="start">(vi)</amend></display><amend anum="0" ea="amend" pairid="214" groupid="164" style="1" owner="admin" level="1" amendtag="end">summing the amounts for the institution.</amend></subsection></subsection><subsection ssid="16-48" dnum="_-o:b-e" numlevel="1" lineno="266" slineno="3-62" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1119" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="221" groupid="169" style="1" owner="admin" level="1" amendtag="end">The Legislature shall apply the following state cost-sharing weights in accordance <ln numlevel="1" lineno="267" slineno="3-63"/>with Subsection <xref depth="4" refnumber="53H-8-211(3)(a)(v)">(3)(a)(v)</xref>, representing the percentage of the average cost per <ln numlevel="1" lineno="268" slineno="3-64"/>full-time equivalent described in Subsection <xref depth="4" refnumber="53H-8-211(3)(a)">(3)(a)</xref> that the state funds:</amend><subsection ssid="16-49" dnum="_-o:i-e" numlevel="1" lineno="269" slineno="3-65" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1120" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="234" groupid="180" style="1" owner="admin" level="1" amendtag="end">for a research university described in Subsection <xref depth="4" refnumber="53H-3-602(1)(b)(i)">53H-3-602(1)(b)(i)</xref>, 50%;</amend></subsection><subsection ssid="16-50" dnum="_-o:ii-e" numlevel="1" lineno="270" slineno="3-66" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1121" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="233" groupid="179" style="1" owner="admin" level="1" amendtag="end">for a regional university described in Subsection <xref depth="4" Definitions.</bold></catline><sectionText lineno="278"><tab/>As used in this part:</sectionText><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="279" slineno="4-4" level="1"><display>(1)</display>"Account" means the Performance Funding Restricted Account created in Section <xref depth="3" refnumber="53H-8-302"><ln numlevel="1" lineno="280" slineno="4-5"/>53H-8-302</xref>.</subsection><subsection ssid="1-12" dnum="_-o:2-e" numlevel="1" lineno="281" slineno="4-6" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1127" style="1" owner="e" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="31" groupid="25" style="1" owner="admin" level="1" amendtag="end">"Award" means a degree or certificate that an institution grants.</amend></subsection><subsection ssid="1-13" dnum="_-o:3-e" numlevel="1" lineno="282" slineno="4-7" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1128" style="1" owner="e" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="35" groupid="28" style="1" owner="admin" level="1" amendtag="end">"Cohort" means a group of students, defined by the year in which the group enrolls in an <ln numlevel="1" lineno="283" slineno="4-8"/>institution.</amend></subsection><subsection ssid="1-null-2" dnum="2-o:4-e" numlevel="1" lineno="284" slineno="4-9" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1129" style="2" owner="o" level="1" deltag="both">(2)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1130" style="1" owner="e" level="1" amendtag="both" space="true">(4)</amend></display>"Estimated revenue growth from targeted jobs" means the estimated increase in <ln numlevel="1" lineno="285" slineno="4-10"/>individual income tax revenue generated by individuals employed in targeted jobs, <ln numlevel="1" lineno="286" slineno="4-11"/>determined in accordance with Sections <xref depth="3" refnumber="53H-8-302">53H-8-302</xref> and <xref depth="3" refnumber="53H-8-306">53H-8-306</xref>.</subsection><subsection ssid="1-null-3" dnum="3-o:5-e" numlevel="1" lineno="287" slineno="4-12" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1130" style="2" owner="o" level="1" deltag="both">(3)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1131" style="1" owner="e" level="1" amendtag="both" space="true">(5)</amend></display>"Full new performance funding amount" means the maximum amount of new <ln numlevel="1" lineno="288" slineno="4-13"/>performance funding that an institution may qualify for in a fiscal year, determined by <ln numlevel="1" lineno="289" slineno="4-14"/>the Legislature in accordance with Section <xref depth="3" refnumber="53H-8-303">53H-8-303</xref>.</subsection><subsection ssid="1-null-4" dnum="4-o:6-e" numlevel="1" lineno="290" slineno="4-15" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1131" style="2" owner="o" level="1" deltag="both">(4)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1132" style="1" owner="e" level="1" amendtag="both" space="true">(6)</amend></display>"Full-time" means the number of credit hours the board determines is full-time <ln numlevel="1" lineno="291" slineno="4-16"/>enrollment for a student.<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="11" groupid="10" style="2" owner="admin" level="1" deltag="both"> </amend><amendoutend style="2"/></subsection><subsection ssid="1-8" dnum="_-o:7-e" numlevel="1" lineno="292" slineno="4-17" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1132" style="1" owner="e" level="1" amendtag="start">(7)</amend></display><amend anum="0" ea="amend" pairid="10" groupid="9" style="1" owner="admin" level="1" amendtag="end">"High-demand" job means:</amend><subsection ssid="1-9" dnum="_-o:a-e" numlevel="1" lineno="293" slineno="4-18" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1133" style="1" owner="e" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="21" groupid="18" style="1" owner="admin" level="1" amendtag="end">a targeted job; and</amend></subsection><subsection ssid="1-10" dnum="_-o:b-e" numlevel="1" lineno="294" slineno="4-19" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1134" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="22" style="1" owner="admin" level="1" amendtag="end">a strategically important occupation that the board identifies in accordance with <ln numlevel="1" lineno="295" slineno="4-20"/>Subsection <xref depth="4" refnumber="53H-8-303(2)">53H-8-303(2)</xref>.</amend></subsection></subsection><subsection ssid="1-null-5" dnum="5-o:8-e" numlevel="1" lineno="296" slineno="4-21" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1135" style="2" owner="o" level="1" deltag="both">(5)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1136" style="1" owner="e" level="1" amendtag="both" space="true">(8)</amend></display>"New performance funding" means the difference between the total amount of <ln numlevel="1" lineno="297" slineno="4-22"/>money in the account and the amount of money appropriated from the account for <ln numlevel="1" lineno="298" slineno="4-23"/>performance funding in the current fiscal year.</subsection><subsection ssid="1-null-6" dnum="6-o:9-e" numlevel="1" lineno="299" slineno="4-24" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1136" style="2" owner="o" level="1" deltag="both">(6)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1137" style="1" owner="e" level="1" amendtag="both" space="true">(9)</amend></display>"Performance" means total performance across the metrics described in Section <xref depth="3" refnumber="53H-8-304"><ln numlevel="1" lineno="300" slineno="4-25"/>53H-8-304</xref>.</subsection><subsection ssid="1-14" dnum="_-o:10-e" numlevel="1" lineno="301" slineno="4-26" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1137" style="1" owner="e" level="1" amendtag="start">(10)</amend></display><amend anum="0" ea="amend" pairid="39" groupid="31" style="1" owner="admin" level="1" amendtag="end">"Strategically important occupation" means an occupation that:</amend><subsection ssid="1-15" dnum="_-o:a-e" numlevel="1" lineno="302" slineno="4-27" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1138" style="1" owner="e" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="44" groupid="35" style="1" owner="admin" level="1" amendtag="end">is not a targeted job; and</amend></subsection><subsection ssid="1-16" dnum="_-o:b-e" numlevel="1" lineno="303" slineno="4-28" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1139" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="49" groupid="39" style="1" owner="admin" level="1" amendtag="end">supports strategic objectives for state workforce development in core public services <ln numlevel="1" lineno="304" slineno="4-29"/>or emerging industries.</amend></subsection></subsection><subsection ssid="1-null-7" dnum="7-o:11-e" numlevel="1" lineno="305" slineno="4-30" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1140" style="2" owner="o" level="1" deltag="both">(7)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1141" style="1" owner="e" level="1" amendtag="both" space="true">(11)</amend></display>"Targeted job" means a four- and five-star job that requires postsecondary training <ln numlevel="1" lineno="306" slineno="4-31"/>as designated by the Department of Workforce Services.</subsection></section></bsec><bsec buid="31" num="53H-8-304" type="amend" src="code" uid="C53H-8-S304_2026070120260701" sort="53H08 03040020260701" numlevel="1" lineno="307" slineno="5-1" sn="5"><section number="53H-8-304" numlevel="1" lineno="308" slineno="5-2" type="amend"><secline lineno="307">Section 5. Section <bold>53H-8-304</bold> is amended to read:</secline><catline lineno="308"><bold>53H-8-304<parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>07/01/26</date></paren></parens>. Performance metrics for institutions -- <ln numlevel="1" lineno="309" slineno="5-3"/>Determination of performance.</bold></catline><subsection ssid="31-null-1" dnum="1-o" numlevel="1" lineno="310" slineno="5-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="31-null-2" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="31-null-3" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>The board shall establish a model for determining an institution's <ln numlevel="1" lineno="311" slineno="5-5"/>performance.</subsection><subsection ssid="31-null-4" dnum="ii-o" numlevel="1" lineno="312" slineno="5-6" level="3" tab="1"><display>(ii)</display>The board shall:<subsection ssid="31-null-5" dnum="A-o" numlevel="1" lineno="313" slineno="5-7" level="4"><display>(A)</display>set a five-year goal for the Utah System of Higher Education for each metric <ln numlevel="1" lineno="314" slineno="5-8"/>described in Subsection <xref depth="4" refnumber="53B-7-706(2)(a)">(2)(a)</xref>;</subsection><subsection ssid="31-null-6" dnum="B-o" numlevel="1" lineno="315" slineno="5-9" level="4"><display>(B)</display>adopt five-year goals for each institution that align with each goal described in <ln numlevel="1" lineno="316" slineno="5-10"/>Subsection <xref depth="4" refnumber="53B-7-706(1)(a)(ii)(a)">(1)(a)(ii)(A)</xref>;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="0" groupid="0" style="2" owner="admin" level="1" deltag="both"> and</amend><amendoutend style="2"/></subsection><subsection ssid="31-null-7" dnum="C-o" numlevel="1" lineno="317" slineno="5-11" level="4"><display>(C)</display>ensure the goals the board adopts for each institution described in Subsection <xref depth="4" refnumber="53B-7-706(1)(a)(ii)(b)"><ln numlevel="1" lineno="318" slineno="5-12"/>(1)(a)(ii)(B)</xref> are sufficiently rigorous to meet the goals described in Subsection <xref depth="4" refnumber="53B-7-706(1)(a)(ii)(a)"><ln numlevel="1" lineno="319" slineno="5-13"/>(1)(a)(ii)(A)</xref>; and</subsection><subsection ssid="31-41" dnum="_-o:D-e" numlevel="1" lineno="320" slineno="5-14" ea="amend" anum="0" owner="admin" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1148" style="1" owner="e" level="1" amendtag="start">(D)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="admin" level="1" amendtag="end">set a five-year goal for each institution for each metric described in <ln numlevel="1" lineno="321" slineno="5-15"/>Subsection <xref depth="4" refnumber="53H-8-304(2)(b)">(2)(b)</xref>.</amend></subsection></subsection></subsection><subsection ssid="31-null-8" dnum="b-o" numlevel="1" lineno="322" slineno="5-16" level="2" space="false"><display>(b)</display><subsection ssid="31-null-9" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The board shall submit a draft of the model described in this section to the <ln numlevel="1" lineno="323" slineno="5-17"/>Higher Education Appropriations Subcommittee and the governor for comments <ln numlevel="1" lineno="324" slineno="5-18"/>and recommendations.</subsection><subsection ssid="31-null-10" dnum="ii-o" numlevel="1" lineno="325" slineno="5-19" level="3"><display>(ii)</display>Every five years, the board shall:<subsection ssid="31-null-11" dnum="A-o" numlevel="1" lineno="326" slineno="5-20" level="4"><display>(A)</display>submit the model described in Subsection <xref depth="4" refnumber="53B-7-706(1)(a)(i)">(1)(a)(i)</xref> and the goals described in <ln numlevel="1" lineno="327" slineno="5-21"/>Subsection <xref depth="4" refnumber="53B-7-706(1)(a)(ii)">(1)(a)(ii)</xref> to the Higher Education Appropriations Subcommittee <ln numlevel="1" lineno="328" slineno="5-22"/>and to the governor for comments and recommendations; and</subsection><subsection ssid="31-null-12" dnum="B-o" numlevel="1" lineno="329" slineno="5-23" level="4"><display>(B)</display>consider the comments and recommendations described in Subsection <xref depth="4" refnumber="53B-7-706(1)(b)(ii)(a)"><ln numlevel="1" lineno="330" slineno="5-24"/>(1)(b)(ii)(A)</xref>, and make any necessary changes to the model described in <ln numlevel="1" lineno="331" slineno="5-25"/>Subsection <xref depth="4" refnumber="53B-7-706(1)(a)(i)">(1)(a)(i)</xref> and the goals described in Subsection <xref depth="4" refnumber="53B-7-706(1)(a)(ii)">(1)(a)(ii)</xref>.</subsection></subsection></subsection><subsection ssid="31-null-13" dnum="c-o" numlevel="1" lineno="332" slineno="5-26" level="2"><display>(c)</display>Every five years<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="12" groupid="10" style="2" owner="admin" level="1" deltag="both">, the Executive Appropriations Committee, </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="10" groupid="8" style="1" owner="admin" level="1" amendtag="both" space="true">:</amend><subsection ssid="31-42" dnum="_-o:i-e" numlevel="1" lineno="333" slineno="5-27" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1155" style="1" owner="e" level="1" amendtag="both">(i)</amend></display>the Higher Education Appropriations Subcommittee<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="17" groupid="15" style="2" owner="admin" level="1" deltag="both">, and the Education Interim <ln numlevel="1" lineno="334" slineno="5-28"/>Committee shall prepare and jointly meet to consider </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="16" groupid="14" style="1" owner="admin" level="1" amendtag="both" space="true"> shall make <ln numlevel="1" lineno="335" slineno="5-29"/>recommendations to the Executive Appropriations Committee regarding </amend><ln numlevel="1" lineno="336" slineno="5-30"/>legislation for introduction at the following general legislative session to adopt the <ln numlevel="1" lineno="337" slineno="5-31"/>goals described in Subsection <xref depth="4" refnumber="53B-7-706(1)(a)(ii)">(1)(a)(ii)</xref><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="25" groupid="22" style="2" owner="admin" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="23" groupid="20" style="1" owner="admin" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="31-44" dnum="_-o:ii-e" numlevel="1" lineno="338" slineno="5-32" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1156" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="27" groupid="24" style="1" owner="admin" level="1" amendtag="end">the Executive Appropriations Committee shall approve or modify the Higher <ln numlevel="1" lineno="339" slineno="5-33"/>Education Appropriations Subcommittee's recommendations described in <ln numlevel="1" lineno="340" slineno="5-34"/>Subsection <xref depth="4" refnumber="53H-8-304(1)(c)(i)">(1)(c)(i)</xref>.</amend></subsection></subsection><subsection ssid="31-45" dnum="_-o:d-e" numlevel="1" lineno="341" slineno="5-35" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1157" style="1" owner="e" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="35" groupid="30" style="1" owner="admin" level="1" amendtag="end">After the release of the Department of Workforce Services' bi-annual long-term <ln numlevel="1" lineno="342" slineno="5-36"/>occupational projections:</amend><subsection ssid="31-47" dnum="_-o:i-e" numlevel="1" lineno="343" slineno="5-37" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1158" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="42" groupid="35" style="1" owner="admin" level="1" amendtag="end">the board may identify up to five strategically important occupations for <ln numlevel="1" lineno="344" slineno="5-38"/>degree-granting institutions and five strategically important occupations for <ln numlevel="1" lineno="345" slineno="5-39"/>technical colleges that:</amend><subsection ssid="31-48" dnum="_-o:A-e" numlevel="1" lineno="346" slineno="5-40" ea="amend" anum="0" owner="admin" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1159" style="1" owner="e" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="53" groupid="43" style="1" owner="admin" level="1" amendtag="end">the Talent, Education, and Industry Alignment Board created in Section <xref depth="3" refnumber="53H-13-302"><ln numlevel="1" lineno="347" slineno="5-41"/>53H-13-302</xref> recommends to the board; and</amend></subsection><subsection ssid="31-51" dnum="_-o:B-e" numlevel="1" lineno="348" slineno="5-42" ea="amend" anum="0" owner="admin" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1160" style="1" owner="e" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="56" groupid="45" style="1" owner="admin" level="1" amendtag="end">the board approves;</amend></subsection></subsection><subsection ssid="31-52" dnum="_-o:ii-e" numlevel="1" lineno="349" slineno="5-43" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1161" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="59" groupid="47" style="1" owner="admin" level="1" amendtag="end">if a strategically important occupation described in Subsection <xref depth="4" refnumber="53H-8-304(1)(d)(i)">(1)(d)(i)</xref> becomes <ln numlevel="1" lineno="350" slineno="5-44"/>a targeted job, the board may identify another strategically important occupation <ln numlevel="1" lineno="351" slineno="5-45"/>in accordance with the limit described in Subsection <xref depth="4" refnumber="53H-8-304(1)(d)(i)">(1)(d)(i)</xref>; and</amend></subsection><subsection ssid="31-53" dnum="_-o:iii-e" numlevel="1" lineno="352" slineno="5-46" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1162" style="1" owner="e" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="62" groupid="49" style="1" owner="admin" level="1" amendtag="end">if a job no longer constitutes a high-demand job, either because the board <ln numlevel="1" lineno="353" slineno="5-47"/>de-selects a strategically important occupation in favor of a different occupation <ln numlevel="1" lineno="354" slineno="5-48"/>or because a job is no longer a targeted job, the job shall remain a factor for <ln numlevel="1" lineno="355" slineno="5-49"/>performance funding calculations in relation to the students who were enrolled in <ln numlevel="1" lineno="356" slineno="5-50"/>the given program at the time the job most recently constituted a high-demand job.</amend></subsection></subsection></subsection><subsection ssid="31-null-14" dnum="2-o" numlevel="1" lineno="357" slineno="5-51" level="1" space="false"><display>(2)</display><subsection ssid="31-null-15" dnum="a-o" level="2" placement="sameline"><display>(a)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="66" groupid="52" style="2" owner="admin" level="1" deltag="both">The</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="65" groupid="51" style="1" owner="admin" level="1" amendtag="both" space="true">For the five-year performance period beginning on July 1, 2022, and ending <ln numlevel="1" lineno="358" slineno="5-52"/>on June 30, 2027, the</amend> board shall set the goals and establish the performance model <ln numlevel="1" lineno="359" slineno="5-53"/>described in Subsection <xref depth="4" refnumber="53B-7-706(1)(a)(i)">(1)(a)(i)</xref> for the following metrics:<subsection ssid="31-null-16" dnum="i-o" numlevel="1" lineno="360" slineno="5-54" level="3" tab="1"><display>(i)</display>access;</subsection><subsection ssid="31-null-17" dnum="ii-o" numlevel="1" lineno="361" slineno="5-55" level="3" tab="1"><display>(ii)</display>timely completion; and</subsection><subsection ssid="31-null-18" dnum="iii-o" numlevel="1" lineno="362" slineno="5-56" level="3" tab="1"><display>(iii)</display>high-yield awards.</subsection></subsection><subsection ssid="31-54" dnum="_-o:b-e" numlevel="1" lineno="363" slineno="5-57" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1168" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="71" groupid="56" style="1" owner="admin" level="1" amendtag="end">For the five-year performance period beginning on July 1, 2027, and ending on June <ln numlevel="1" lineno="364" slineno="5-58"/>30, 2032, the board shall establish the performance model described in Subsection <xref depth="4" refnumber="53H-8-304(1)(a)(i)"><ln numlevel="1" lineno="365" slineno="5-59"/>(1)(a)(i)</xref> and set the goals described in Subsection <xref depth="4" refnumber="53H-8-304(1)(a)(ii)(d)">(1)(a)(ii)(D)</xref> for the following <ln numlevel="1" lineno="366" slineno="5-60"/>metrics:</amend><subsection ssid="31-55" dnum="_-o:i-e" numlevel="1" lineno="367" slineno="5-61" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1169" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="72" groupid="57" style="1" owner="admin" level="1" amendtag="end">for each institution:</amend><subsection ssid="31-56" dnum="_-o:A-e" numlevel="1" lineno="368" slineno="5-62" ea="amend" anum="0" owner="admin" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1170" style="1" owner="e" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="75" groupid="59" style="1" owner="admin" level="1" amendtag="end">responsiveness to workforce needs, measured by degrees and certificates the <ln numlevel="1" lineno="369" slineno="5-63"/>institution awarded that map to high-demand jobs in the state; and</amend><amendoutend style="2"/></subsection><subsection ssid="31-null-24" dnum="ii-o:_-e" numlevel="1" lineno="399" slineno="5-93" ea="erase" anum="0" owner="admin" style="2" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1191" style="2" owner="o" level="1" deltag="start">(ii)</amend></display><amend anum="0" ea="erase" pairid="405" groupid="126" style="2" owner="admin" level="1" deltag="end">change in performance compared to the degree-granting institution's average <ln numlevel="1" lineno="400" slineno="5-94"/>performance over the previous five years.</amend><amendoutend style="2"/></subsection></subsection></subsection></subsection></subsection><subsection ssid="31-null-25" dnum="b-o:4-e" numlevel="1" lineno="401" slineno="5-95" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1192" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1193" style="1" owner="e" level="1" amendtag="both" space="true">(4)</amend></display>For each institution, the board shall annually:<subsection ssid="31-null-26" dnum="i-o:a-e" numlevel="1" lineno="402" slineno="5-96" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1193" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1194" style="1" owner="e" level="1" amendtag="both" space="true">(a)</amend></display>adopt annual performance goals for each metric described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="416" groupid="136" style="2" owner="admin" level="1" deltag="both"><xref depth="4" refnumber="53B-7-706(2)(a)(ii)"><ln numlevel="1" lineno="403" slineno="5-97"/>(2)(a)(ii)</xref> that will</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="413" groupid="133" style="1" owner="admin" level="1" amendtag="both" space="true">(2) that are sufficiently rigorous to</amend> advance the institution toward <ln numlevel="1" lineno="404" slineno="5-98"/>achievement of the five-year goals described in Subsection <xref depth="4" refnumber="53B-7-706(1)(a)(ii)">(1)(a)(ii)</xref>;</subsection><subsection ssid="31-null-27" dnum="ii-o:b-e" numlevel="1" lineno="405" slineno="5-99" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1194" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1195" style="1" owner="e" level="1" amendtag="both" space="true">(b)</amend></display>evaluate performance in meeting the goals described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="451" groupid="167" style="2" owner="admin" level="1" deltag="both"><xref depth="4" refnumber="53H-8-304(4)(a)">(3)(b)(i)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="450" groupid="166" style="1" owner="admin" level="1" amendtag="both" space="true"><xref refnumber="(4)(a)" depth="4"><ln numlevel="1" lineno="406" slineno="5-100"/>(4)(a)</xref></amend>; and</subsection><subsection ssid="31-null-28" dnum="iii-o:c-e" numlevel="1" lineno="407" slineno="5-101" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1195" style="2" owner="o" level="1" deltag="both">(iii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1196" style="1" owner="e" level="1" amendtag="both" space="true">(c)</amend></display>include a degree-granting institution's or technical college's performance under <ln numlevel="1" lineno="408" slineno="5-102"/>this section in the evaluation described in Subsection <xref depth="4" refnumber="53H-1-203(2)(i)">53H-1-203(2)(i)</xref>.</subsection></subsection><subsection ssid="31-null-29" dnum="4-o:5-e" numlevel="1" lineno="409" slineno="5-103" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1196" style="2" owner="o" level="1" deltag="both">(4)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1197" style="1" owner="e" level="1" amendtag="both" space="true">(5)</amend></display>The board shall use the model described in Subsection <xref depth="4" refnumber="53B-7-706(1)(a)(i)">(1)(a)(i)</xref> to make the report <ln numlevel="1" lineno="410" slineno="5-104"/>described in Section <xref depth="3" refnumber="53H-8-303">53H-8-303</xref> for determining an institution's performance funding.</subsection><subsection ssid="31-null-30" dnum="5-o:6-e" numlevel="1" lineno="411" slineno="5-105" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1197" style="2" owner="o" level="1" deltag="both">(5)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1198" style="1" owner="e" level="1" amendtag="both" space="true">(6)</amend></display>At the end of each five-year period for which the board sets goals under Subsection <xref depth="4" refnumber="53B-7-706(1)(a)(ii)"><ln numlevel="1" lineno="412" slineno="5-106"/>(1)(a)(ii)</xref>:<subsection ssid="31-null-31" dnum="a-o" numlevel="1" lineno="413" slineno="5-107" level="2"><display>(a)</display>the board shall:<subsection ssid="31-null-32" dnum="i-o" numlevel="1" lineno="414" slineno="5-108" level="3"><display>(i)</display>review the Utah System of Higher Education's performance in meeting the goals <ln numlevel="1" lineno="415" slineno="5-109"/>the board sets under Subsection <xref depth="4" refnumber="53B-7-706(1)(a)(ii)(a)">(1)(a)(ii)(A)</xref>;</subsection><subsection ssid="31-null-33" dnum="ii-o" numlevel="1" lineno="416" slineno="5-110" level="3"><display>(ii)</display>review each institution's performance in meeting the goals the board sets under <ln numlevel="1" lineno="417" slineno="5-111"/>Subsection <xref depth="4" refnumber="53B-7-706(1)(a)(ii)(b)">(1)(a)(ii)(B)</xref><amend anum="0" ea="amend" pairid="414" groupid="134" style="1" owner="admin" level="1" amendtag="both"> or <xref refnumber="(1)(a)(ii)(D)" depth="4">(1)(a)(ii)(D)</xref></amend>; and</subsection><subsection ssid="31-null-34" dnum="iii-o" numlevel="1" lineno="418" slineno="5-112" level="3"><display>(iii)</display>allocate any funds not allocated under Subsection <xref depth="4" refnumber="53H-8-303(6)(d)">53H-8-303(6)(d)</xref> to each<amend anum="0" ea="amend" pairid="415" groupid="135" style="1" owner="admin" level="1" amendtag="both"> </amend><ln numlevel="1" lineno="419" slineno="5-113"/>institution that meets or exceeds the goals the board sets under Subsection <xref depth="4" refnumber="53B-7-706(1)(a)(ii)(b)"><ln numlevel="1" lineno="420" slineno="5-114"/>(1)(a)(ii)(B)</xref><amend anum="0" ea="amend" pairid="419" groupid="138" style="1" owner="admin" level="1" amendtag="both"> or <xref refnumber="(1)(a)(ii)(D)" depth="4">(1)(a)(ii)(D)</xref></amend>; style="2" owner="o" level="1" deltag="both">(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1221" style="1" owner="e" level="1" amendtag="both" space="true">(i)</amend></display>for the access metric<amend anum="0" ea="amend" pairid="77" groupid="79" style="1" owner="admin" level="1" amendtag="both"> described in Subsection <xref depth="4" refnumber="53H-8-304(2)(a)(i)">53H-8-304(2)(a)(i)</xref></amend>, to increase <ln numlevel="1" lineno="453" slineno="6-23"/>the percent of Utah high school graduates participating in the system by 3.0%;</subsection><subsection ssid="6-null-13" dnum="b-o:ii-e" numlevel="1" lineno="454" slineno="6-24" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1221" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1222" style="1" owner="e" level="1" amendtag="both" space="true">(ii)</amend></display>for the timely completion metric<amend anum="0" ea="amend" pairid="96" groupid="89" style="1" owner="admin" level="1" amendtag="both"> described in Subsection <xref depth="4" refnumber="53H-8-304(2)(a)(ii)">53H-8-304(2)(a)(ii)</xref></amend>, <ln numlevel="1" lineno="455" slineno="6-25"/>to increase the system percentage of a cohort that completes an award in up to and <ln numlevel="1" lineno="456" slineno="6-26"/>including 1.5 times the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="199" groupid="165" style="2" owner="admin" level="1" deltag="both">standard completion time</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="197" groupid="163" style="1" owner="admin" level="1" amendtag="both" space="true">time in which a student <ln numlevel="1" lineno="457" slineno="6-27"/>typically completes an award program</amend> by 3.0%; and</subsection><subsection ssid="6-null-14" dnum="c-o:iii-e" numlevel="1" lineno="458" slineno="6-28" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1222" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1223" style="1" owner="e" level="1" amendtag="both" space="true">(iii)</amend></display>for the high-yield awards metric<amend anum="0" ea="amend" pairid="84" groupid="83" style="1" owner="admin" level="1" amendtag="both"> described in Subsection <xref depth="4" refnumber="53H-8-304(2)(a)(iii)">53H-8-304(2)(a)(iii)</xref></amend>, <ln numlevel="1" lineno="459" slineno="6-29"/>to increase the system percentage of high-yield awards by 3.0%.</subsection></subsection><subsection ssid="6-21" dnum="_-o:b-e" numlevel="1" lineno="460" slineno="6-30" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1223" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="14" groupid="13" style="1" owner="admin" level="1" amendtag="end">The board shall ensure that the goals the board establishes in accordance with <ln numlevel="1" lineno="461" slineno="6-31"/>Subsection <xref depth="4" refnumber="53H-8-304(1)(a)(ii)(d)">53H-8-304(1)(a)(ii)(D)</xref> for the five-year performance period beginning on <ln numlevel="1" lineno="462" slineno="6-32"/>July 1, 2027, and the workforce responsiveness metric described in Subsection <xref depth="4" refnumber="53H-8-304(2)(b)(i)(a)"><ln numlevel="1" lineno="464" slineno="6-34"/>53H-8-304(2)(b)(i)(A)</xref>, to:</amend><subsection ssid="6-34" dnum="_-o:A-e" numlevel="1" lineno="465" slineno="6-35" ea="amend" anum="0" owner="admin" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1225" style="1" owner="e" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="113" groupid="104" style="1" owner="admin" level="1" amendtag="end">increase the number of degrees and certificates an institution awards that map <ln numlevel="1" lineno="466" slineno="6-36"/>to high-demand jobs in the state by at least 1.0% each year; or</amend></subsection><subsection ssid="6-35" dnum="_-o:B-e" numlevel="1" lineno="467" slineno="6-37" ea="amend" anum="0" owner="admin" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1226" style="1" owner="e" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="119" groupid="109" style="1" owner="admin" level="1" amendtag="end">maintain the number described in Subsection <xref depth="4" refnumber="53H-8-305(2)(b)(i)(a)">(2)(b)(i)(A)</xref> at or above 80%;<marker pairid="176"/><marker pairid="175"/></amend></subsection></subsection><subsection ssid="6-25" dnum="_-o:ii-e" numlevel="1" lineno="468" slineno="6-38" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1227" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="37" groupid="29" style="1" owner="admin" level="1" amendtag="end">for the institutional efficiency metric described in Subsection <xref depth="4" refnumber="53H-8-304(2)(b)(i)(b)"><ln numlevel="1" lineno="469" slineno="6-39"/>53H-8-304(2)(b)(i)(B)</xref>, to increase the five-year rolling average number of degrees <ln numlevel="1" lineno="470" slineno="6-40"/>and certificates an institution awards per full-time equivalent student by at least <ln numlevel="1" lineno="471" slineno="6-41"/>1.0% each year;</amend></subsection><subsection ssid="6-26" dnum="_-o:iii-e" numlevel="1" lineno="472" slineno="6-42" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1228" style="1" owner="e" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="44" groupid="35" style="1" owner="admin" level="1" amendtag="end">for the timely completion metric for degree-granting institutions described in <ln numlevel="1" lineno="473" slineno="6-43"/>Subsection <xref depth="4" refnumber="53H-8-304(2)(b)(ii)(b)">53H-8-304(2)(b)(ii)(B)</xref>, to:</amend><subsection ssid="6-38" dnum="_-o:A-e" numlevel="1" lineno="474" slineno="6-44" ea="amend" anum="0" owner="admin" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1229" style="1" owner="e" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="137" groupid="122" style="1" owner="admin" level="1" amendtag="end">increase the percentage of timely completion at the institution by at least 1.0% <ln numlevel="1" lineno="475" slineno="6-45"/>each year; or</amend></subsection><subsection ssid="6-39" dnum="_-o:B-e" numlevel="1" lineno="476" slineno="6-46" ea="amend" anum="0" owner="admin" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1230" style="1" owner="e" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="143" groupid="127" style="1" owner="admin" level="1" amendtag="end">maintain the percentage described in Subsection <xref depth="4" refnumber="53H-8-305(2)(b)(iii)(a)">(2)(b)(iii)(A)</xref> at or above 75%<marker pairid="181"/>;</amend></subsection></subsection><subsection ssid="6-30" dnum="_-o:iv-e" numlevel="1" lineno="477" slineno="6-47" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1231" style="1" owner="e" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="66" groupid="70" style="1" owner="admin" level="1" amendtag="end">for the regional university and community college first-year student metric <ln numlevel="1" lineno="478" slineno="6-48"/>described in Subsection <xref depth="4" refnumber="53H-8-304(2)(b)(iii)(b)">53H-8-304(2)(b)(iii)(B)</xref>, to increase the number of <ln numlevel="1" lineno="479" slineno="6-49"/>students achieving the student's first 30 credit hours by at least 1.0% each year;</amend></subsection><subsection ssid="6-31" dnum="_-o:v-e" numlevel="1" lineno="480" slineno="6-50" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1232" style="1" owner="e" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="70" groupid="73" style="1" owner="admin" level="1" amendtag="end">for the research university research expenditure metric described in Subsection <xref depth="4" refnumber="53H-8-304(2)(b)(iv)(b)"><ln numlevel="1" lineno="481" slineno="6-51"/>53H-8-304(2)(b)(iv)(B)</xref>, to increase the total number of research dollars the <ln numlevel="1" lineno="482" slineno="6-52"/>university expended by at least 1.0% more than the year-over change in the <ln numlevel="1" lineno="483" slineno="6-53"/>Consumer Price Index that the United States Bureau <marker pairid="201"/><marker pairid="202"/>o<marker pairid="204"/>f Labor Statistics reports; <ln numlevel="1" lineno="484" slineno="6-54"/>and</amend></subsection><subsection ssid="6-32" dnum="_-o:vi-e" numlevel="1" lineno="485" slineno="6-55" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1233" style="1" owner="e" level="1" amendtag="start">(vi)</amend></display><amend anum="0" ea="amend" pairid="75" groupid="77" style="1" owner="admin" level="1" amendtag="end">for the technical college placement metric described in Subsection <xref depth="4" refnumber="53H-8-304(2)(b)(v)(b)"><ln numlevel="1" lineno="486" slineno="6-56"/>53H-8-304(2)(b)(v)(B)</xref>, to increase the placement rate of graduates in jobs or <ln numlevel="1" lineno="487" slineno="6-57"/>degree-granting programs by at least 1.0% each year.</amend></subsection></subsection></subsection><subsection ssid="6-null-15" dnum="3-o" numlevel="1" lineno="488" slineno="6-58" level="1"><display>(3)</display>In order to meet the system goals described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="213" groupid="174" style="2" owner="admin" level="1" deltag="both"><xref depth="4" refnumber="53H-8-305(2)(a)">(2)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="212" groupid="173" style="1" owner="admin" level="1" amendtag="both" space="true">(2)(a)</amend>, the goals for each <ln numlevel="1" lineno="489" slineno="6-59"/>institution for the five-year performance period are:<subsection ssid="6-null-16" dnum="a-o" numlevel="1" lineno="490" slineno="6-60" level="2"><display>(a)</display>for the access metric, to increase the institution's share of Utah high school graduates <ln numlevel="1" lineno="491" slineno="6-61"/>participating in the system by a percentage that the board determines;</subsection><subsection ssid="6-null-17" dnum="b-o" numlevel="1" lineno="492" slineno="6-62" level="2"><display>(b)</display>for the timely completion metric, to increase the percent of a cohort enrolled at the <ln numlevel="1" lineno="493"
