level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="342" groupid="263" style="1" owner="admin" level="1" amendtag="end">feature that encourages active learning rather than passive consumption.</amend></subsection></subsection></subsection><subsection ssid="27-74" dnum="_-o:e-e" numlevel="1" lineno="168" slineno="2-42" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1068" style="1" owner="e" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="353" groupid="270" style="1" owner="admin" level="1" amendtag="end">"Clickstream data" means data an LEA or third-party provider collects from a <ln numlevel="1" lineno="169" slineno="2-43"/>student's use of an online service, application, or device that records the student's <ln numlevel="1" lineno="170" slineno="2-44"/>navigation or sequence of actions.</amend></subsection><subsection ssid="27-75" dnum="_-o:f-e" numlevel="1" lineno="171" slineno="2-45" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1069" style="1" owner="e" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="364" groupid="278" style="1" owner="admin" level="1" amendtag="end">"Digital privacy agreement" means a contract between a contracting entity and a <ln numlevel="1" lineno="172" slineno="2-46"/>digital provider that:</amend><subsection ssid="27-77" dnum="_-o:i-e" numlevel="1" lineno="173" slineno="2-47" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1070" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="365" groupid="279" style="1" owner="admin" level="1" amendtag="end">ensures compliance with Chapter 9, Student Privacy and Data Protection; and</amend></subsection><subsection ssid="27-78" dnum="_-o:ii-e" numlevel="1" lineno="174" slineno="2-48" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1071" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="368" groupid="281" style="1" owner="admin" level="1" amendtag="end">governs access, use, protection, retention, and disclosure of student data.</amend></subsection></subsection><subsection ssid="27-79" dnum="_-o:g-e" numlevel="1" lineno="175" slineno="2-49" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1072" style="1" owner="e" level="1" amendtag="start">(g)</amend></display><amend anum="0" ea="amend" pairid="375" groupid="286" style="1" owner="admin" level="1" amendtag="end">"Educational software" means software that:</amend><subsection ssid="27-80" dnum="_-o:i-e" numlevel="1" lineno="176" slineno="2-50" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1073" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="376" groupid="287" style="1" owner="admin" level="1" amendtag="end">serves an educational purpose; and</amend></subsection><subsection ssid="27-81" dnum="_-o:ii-e" numlevel="1" lineno="177" slineno="2-51" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1074" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="379" groupid="289" style="1" owner="admin" level="1" amendtag="end">is designed for student instruction, assessment, or instructional support.</amend></subsection></subsection><subsection ssid="27-85" dnum="_-o:h-e" numlevel="1" lineno="178" slineno="2-52" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1075" style="1" owner="e" level="1" amendtag="start">(h)</amend></display><amend anum="0" ea="amend" pairid="393" groupid="299" style="1" owner="admin" level="1" amendtag="end">"Passive consumption" means receiving information through viewing, listening, or <ln numlevel="1" lineno="179" slineno="2-53"/>browsing without requiring the student to engage in cognitive processing necessary to <ln numlevel="1" lineno="180" slineno="2-54"/>analyze, apply, or create knowledge or skills.</amend></subsection><subsection ssid="27-86" dnum="_-o:i-e" numlevel="1" lineno="181" slineno="2-55" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1076" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="400" groupid="304" style="1" owner="admin" level="1" amendtag="end">"School-issued device" means any electronic hardware device an LEA provides to a <ln numlevel="1" lineno="182" slineno="2-56"/>student for educational use.</amend></subsection><subsection ssid="27-88" dnum="_-o:j-e" numlevel="1" lineno="183" slineno="2-57" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1077" style="1" owner="e" level="1" amendtag="start">(j)</amend></display><amend anum="0" ea="amend" pairid="406" groupid="309" style="1" owner="admin" level="1" amendtag="end">"Skill development" means the acquisition or improvement of academic abilities or <ln numlevel="1" lineno="184" slineno="2-58"/>competencies necessary to perform a task aligned to state academic standards, <ln numlevel="1" lineno="185" slineno="2-59"/>including guided practice, modeling, or feedback.</amend></subsection><subsection ssid="27-90" dnum="_-o:k-e" numlevel="1" lineno="186" slineno="2-60" ea="amend" anum="0" owner="admin" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1078" style="1" owner="e" level="1" amendtag="start">(k)</amend></display><subsection ssid="27-100" dnum="_-o:i-e" ea="amend" anum="0" owner="admin" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1079" style="1" owner="e" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="414" groupid="315" style="1" owner="admin" level="1" amendtag="end">"Software" means any application, web-based service, plug-in, or other <ln numlevel="1" lineno="187" slineno="2-61"/>code-based product, regardless of whether the application is free or for purchase, <ln numlevel="1" lineno="188" slineno="2-62"/>that:</amend><subsection ssid="27-91" dnum="_-o:A-e" numlevel="1" lineno="189" slineno="2-63" ea="amend" anum="0" owner="admin" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1080" style="1" owner="e" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="417" groupid="317" style="1" owner="admin" level="1" amendtag="end">runs on or is accessible from a school-issued device; and</amend></subsection><subsection ssid="27-92" dnum="_-o:B-e" numlevel="1" lineno="190" slineno="2-64" ea="amend" anum="0" owner="admin" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1081" style="1" owner="e" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="420" groupid="319" style="1" owner="admin" level="1" amendtag="end">an LEA assigns, requires, recommends, installs, or otherwise makes available <ln numlevel="1" lineno="191" slineno="2-65"/>for student use in connection with classroom instruction, including through a <ln numlevel="1" lineno="192" slineno="2-66"/>school-issued account or identity, regardless of whether the software is <ln numlevel="1" lineno="193" slineno="2-67"/>accessible on a school-issued or student-owned device.</amend></subsection></subsection><subsection ssid="27-93" dnum="_-o:ii-e" numlevel="1" lineno="194" slineno="2-68" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1082" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="423" groupid="321" style="1" owner="admin" level="1" amendtag="end">"Software" includes software an individual uses during school hours in <ln numlevel="1" lineno="195" slineno="2-69"/>connection with school-related purposes for:</amend><subsection ssid="27-94" dnum="_-o:A-e" numlevel="1" lineno="196" slineno="2-70" ea="amend" anum="0" owner="admin" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1083" style="1" owner="e" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="426" groupid="323" style="1" owner="admin" level="1" amendtag="end">instruction;</amend></subsection><subsection ssid="27-95" dnum="_-o:B-e" numlevel="1" lineno="197" slineno="2-71" ea="amend" anum="0" owner="admin" style="1" amendtag="end">institutions of higher education; and</amend></subsection><subsection ssid="27-43" dnum="_-o:vii-e" numlevel="1" lineno="263" slineno="2-137" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1139" style="1" owner="e" level="1" amendtag="start">(vii)</amend></display><amend anum="0" ea="amend" pairid="246" groupid="195" style="1" owner="admin" level="1" amendtag="end">other stakeholders the state board determines to be appropriate.</amend></subsection></subsection></subsection><subsection ssid="27-44" dnum="_-o:4-e" numlevel="1" lineno="264" slineno="2-138" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1140" style="1" owner="e" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="251" groupid="199" style="1" owner="admin" level="1" amendtag="end">Before July 1, 2027, the state board shall:</amend><subsection ssid="27-111" dnum="_-o:a-e" numlevel="1" lineno="265" slineno="2-139" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1141" style="1" owner="e" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="483" groupid="361" style="1" owner="admin" level="1" amendtag="end">publish on the state board's website guidance and best practices identified through <ln numlevel="1" lineno="266" slineno="2-140"/>the study described in this section; and</amend></subsection><subsection ssid="27-112" dnum="_-o:b-e" numlevel="1" lineno="267" slineno="2-141" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1142" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="490" groupid="367" style="1" owner="admin" level="1" amendtag="end">distribute the guidance and best practices to each LEA.</amend></subsection></subsection><subsection ssid="27-45" dnum="_-o:5-e" numlevel="1" lineno="268" slineno="2-142" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1143" style="1" owner="e" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="258" groupid="205" style="1" owner="admin" level="1" amendtag="end">Upon the request of the Education Interim Committee, the state board shall provide a <ln numlevel="1" lineno="269" slineno="2-143"/>report summarizing the study and the guidance described in Subsection <xref depth="4" refnumber="53E-3-527(4)">(4)</xref> to the <ln numlevel="1" lineno="270" slineno="2-144"/>Education Interim Committee.</amend></subsection></section></bsec><bsec buid="35" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="271" slineno="3-1" sn="3"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="271">Section 3.  <bold>Effective Date.</bold></secline><sectionText lineno="272"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="admin" level="1" amendtag="both">This bill
