Ward</otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This resolution relates to non-opioid pain medication and state employee health coverage.</gd><hphead lineno="6">Highlighted Provisions:</hphead><hp numlevel="1" lineno="7" slineno="0-7">This resolution:<hl numlevel="1" lineno="8" slineno="0-8" level="1">directs the Public Employees' Benefit and Insurance Program to adjust the state employee <ln numlevel="1" lineno="9" slineno="0-9"/>health insurance plan related to non-opioid pain medication.</hl></hp><moni numlevel="1" lineno="10" slineno="0-10" display="none">Money Appropriated in this Bill:</moni><moniNone lineno="11">None</moniNone><oc numlevel="1" lineno="12" slineno="0-12">Other Special Clauses:</oc><ocNone lineno="13">None</ocNone></lt><enacthead lineno="14"/><enact numlevel="1" lineno="15" slineno="0-15">Be it resolved by the Legislature of the state of Utah, the Governor concurring therein:</enact><bdy><bsec buid="1" type="enact" src="reso" uid="RESO" sort="00000R" numlevel="1" lineno="16" slineno="1-1" sn="1"><section type="enact" display="false" src="reso"><amend anum="0" ea="amend" pairid="1" groupid="1" style="X" owner="admin" level="1" amendtag="both">WHEREAS, in accordance with Section <xref depth="3" refnumber="49-20-201">49-20-201</xref>, the state participates in the Public <ln numlevel="1" lineno="17" slineno="1-2"/>Employees' Benefit and Insurance Program (PEHP);<eol numlevel="1" lineno="18" slineno="1-3" display="tab"/>WHEREAS, Utah has experienced significant harm from the opioid epidemic, with <ln numlevel="1" lineno="19" slineno="1-4"/>thousands of Utahns suffering from opioid addiction and hundreds dying from opioid-related <ln numlevel="1" lineno="20" slineno="1-5"/>overdoses annually;<eol numlevel="1" lineno="21" slineno="1-6" display="tab"/>WHEREAS, the federal Centers for Disease Control and Prevention has issued guidelines <ln numlevel="1" lineno="22" slineno="1-7"/>recommending that non-opioid therapies be considered as first-line treatments for chronic pain;<eol numlevel="1" lineno="23" slineno="1-8" display="tab"/>WHEREAS, many health insurance plans impose utilization barriers to accessing <ln numlevel="1" lineno="24" slineno="1-9"/>non-opioid pain medications through:<eol numlevel="1" lineno="25" slineno="1-10" display="tab"/>1. higher copayments and coinsurance rates compared to opioid medications;<eol numlevel="1" lineno="26" slineno="1-11" display="tab"/>2. prior authorization requirements that delay or prevent access to non-opioid alternatives;<eol numlevel="1" lineno="27" slineno="1-12" display="tab"/>3. quantity limits that restrict the supply of non-opioid medications; and<eol numlevel="1" lineno="28" slineno="1-13" display="tab"/>4. formulary placement that designates non-opioid options as non-preferred or specialty <ln numlevel="1" lineno="29" slineno="1-14"/>drugs;<eol numlevel="1" lineno="30" slineno="1-15" display="tab"/>WHEREAS, some health insurance plans do not apply these same requirements to opioid <ln numlevel="1" lineno="31" slineno="1-16"/>drugs; and<eol numlevel="1" lineno="32" slineno="1-17" display="tab"/>WHEREAS, these coverage disparities create perverse incentives that encourage the use of <ln numlevel="1" lineno="33" slineno="1-18"/>opioid medications over safer non-opioid alternatives<marker pairid="7">:</marker><eol numlevel="1" lineno="34" slineno="1-19" display="tab"/>NOW, THEREFORE, BE IT RESOLVED that the Legislature of the state of Utah, the <ln numlevel="1" lineno="35" slineno="1-20"/>Governor concurring therein, beginning with the 2027 plan year, directs PEHP for state <ln numlevel="1" lineno="36" slineno="1-21"/>employees:<eol numlevel="1" lineno="37" slineno="1-22" display="tab"/>1. to include in PEHP's drug formulary at least one clinically appropriate non-opioid <ln numlevel="1" lineno="38" slineno="1-23"/>prescription drug as an alternative for each opioid prescription drug; <eol numlevel="1" lineno="39" slineno="1-24" display="tab"/>2. not to place cost sharing, prior authorization, step therapy, or other utilization review <ln numlevel="1" lineno="40" slineno="1-25"/>requirements on a covered non-opioid prescription drug that are more restrictive than the <ln numlevel="1" lineno="41" slineno="1-26"/>requirements placed on a covered opioid prescription drug; and<eol numlevel="1" lineno="42" slineno="1-27" display="tab"/>3. to implement this resolution within an appropriation of $150,000 and to request an <ln numlevel="1" lineno="43" slineno="1-28"/>additional appropriation if the cost for complying with this resolution were to exceed $150,000.</amend><sectionText/></section></bsec></bdy><foot><rev><tm>3-5-26 7:55 AM</tm></rev></foot></leg>
