[Title];<eol numlevel="1" lineno="21" slineno="1-3" display="tab"/>WHEREAS, the Utah Constitution was initially adopted without titles for any constitutional <ln numlevel="1" lineno="22" slineno="1-4"/>section;<eol numlevel="1" lineno="23" slineno="1-5" display="tab"/>WHEREAS, there is no statutory or constitutional requirement to include a title for each <ln numlevel="1" lineno="24" slineno="1-6"/>constitutional section;<eol numlevel="1" lineno="25" slineno="1-7" display="tab"/>WHEREAS, no title appeared next to a section number until 1967;<eol numlevel="1" lineno="26" slineno="1-8" display="tab"/>WHEREAS, since 1967, a title has been added, surrounded by brackets, to each section of <ln numlevel="1" lineno="27" slineno="1-9"/>the published Utah Constitution and each section has been referenced by section number and <ln numlevel="1" lineno="28" slineno="1-10"/>bracketed title in the table of contents of the published Utah Constitution;<eol numlevel="1" lineno="29" slineno="1-11" display="tab"/>WHEREAS, from initial adoption of the Utah Constitution until 1990, neither the <ln numlevel="1" lineno="30" slineno="1-12"/>Legislature nor the voters adopted a constitutional amendment that contained a title;<eol numlevel="1" lineno="31" slineno="1-13" display="tab"/>WHEREAS, since 1990, a bracketed title has been included in each joint resolution to <ln numlevel="1" lineno="32" slineno="1-14"/>amend the constitution adopted by the Legislature, in materials provided to the voters, and in <ln numlevel="1" lineno="33" slineno="1-15"/>the published copies of the Utah Constitution; and<eol numlevel="1" lineno="34" slineno="1-16" display="tab"/>WHEREAS, the Office of Legislative Research and General Counsel prepares the Utah <ln numlevel="1" lineno="35" slineno="1-17"/>Constitution for publication:<eol numlevel="1" lineno="36" slineno="1-18" display="tab"/>NOW, THEREFORE, BE IT RESOLVED that the Utah Legislature of the state of Utah <ln numlevel="1" lineno="37" slineno="1-19"/>determines that the titles and the surrounding brackets were added for convenience and <ln numlevel="1" lineno="38" slineno="1-20"/>provide no substantive meaning to the sections of the Utah Constitution.<eol numlevel="1" lineno="39" slineno="1-21" display="tab"/>BE IT FURTHER RESOLVED that the Utah Legislature determines that removal of the <ln numlevel="1" lineno="40" slineno="1-22"/>brackets surrounding the titles constitutes a technical edit to the Utah Constitution.<eol numlevel="1" lineno="41" slineno="1-23" display="tab"/>BE IT FURTHER RESOLVED that the Utah Legislature directs the Office of Legislative <ln numlevel="1" lineno="42" slineno="1-24"/>Research and General Counsel to prepare constitutional amendment resolutions for the 2027 <ln numlevel="1" lineno="43" slineno="1-25"/>General Session and thereafter without brackets surrounding the titles.<eol numlevel="1" lineno="44" slineno="1-26" display="tab"/>BE IT FURTHER RESOLVED that the Utah Legislature directs the Office of Legislative <ln numlevel="1" lineno="45" slineno="1-27"/>Research and General Counsel, when next preparing the published Utah Constitution, to <ln numlevel="1" lineno="46" slineno="1-28"/>remove the brackets surrounding the titles in the published Utah Constitution.<eol numlevel="1" lineno="47" slineno="1-29" display="tab"/>BE IT FURTHER RESOLVED that a copy of this resolution be sent to the Utah Attorney <ln numlevel="1" lineno="48" slineno="1-30"/>General, the Chief Justice of the Utah Supreme Court, and the publishers, WestLaw and <ln numlevel="1" lineno="49" slineno="1-31"/>LexisNexis.</amend><sectionText/></section></bsec></bdy><foot><rev><tm>1-20-26 4:40 PM</tm></rev></foot></leg>
