Section <bold>10-6-106</bold> is amended to read:</secline><catline lineno="38"><bold>10-6-106<parens/>. Definitions.</bold></catline><sectionText lineno="39"><tab/>As used in this chapter:</sectionText><subsection ssid="1-null-78" dnum="1-o" numlevel="1" lineno="40" slineno="1-4" level="1"><display>(1)</display>"Account group" is defined by generally accepted accounting principles as reflected in <ln numlevel="1" lineno="41" slineno="1-5"/>the Uniform Accounting Manual for Utah Cities.</subsection><subsection ssid="1-null-79" dnum="2-o" numlevel="1" lineno="42" slineno="1-6" level="1"><display>(2)</display>"Appropriation" means an allocation of money by the governing body for a specific <ln numlevel="1" lineno="43" slineno="1-7"/>purpose.</subsection><subsection ssid="1-null-80" dnum="3-o" numlevel="1" lineno="44" slineno="1-8" level="1" space="false"><display>(3)</display><subsection ssid="1-null-81" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Budget" means a plan of financial operations for a fiscal period which embodies <ln numlevel="1" lineno="45" slineno="1-9"/>estimates of proposed expenditures for given purposes and the proposed means of <ln numlevel="1" lineno="46" slineno="1-10"/>financing them.</subsection><subsection ssid="1-null-82" dnum="b-o" numlevel="1" lineno="47" slineno="1-11" level="2"><display>(b)</display>"Budget" may refer to the budget of a particular fund for which a budget is required <ln numlevel="1" lineno="48" slineno="1-12"/>by law or it may refer collectively to the budgets for all such funds.</subsection></subsection><subsection ssid="1-null-83" dnum="4-o" numlevel="1" lineno="49" slineno="1-13" level="1"><display>(4)</display>"Budget officer" means<amend anum="0" ea="amend" pairid="12" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both">:</amend> <subsection ssid="1-null-84" dnum="_-o:a-i" numlevel="1" lineno="50" slineno="1-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>the city auditor in a city of the first and second class<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="23" groupid="20" style="2" owner="jchristopherson" level="1" deltag="both">,</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="22" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">;</amend> </subsection><subsection ssid="1-null-85" dnum="_-o:b-i" numlevel="1" lineno="51" slineno="1-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="both">(b)</amend></display>the mayor or some person appointed by the mayor with the approval of the city <ln numlevel="1" lineno="52" slineno="1-16"/>council in a city of the third, fourth, or fifth class<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="30" groupid="26" style="2" owner="jchristopherson" level="1" deltag="both">,</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="29" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">;</amend> </subsection><subsection ssid="1-null-86" dnum="_-o:c-i" numlevel="1" lineno="53" slineno="1-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="both">(c)</amend></display>the mayor in the council-mayor optional form of government<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="37" groupid="32" style="2" owner="jchristopherson" level="1" deltag="both">,</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="36" groupid="31" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">;</amend> or </subsection><subsection ssid="1-null-87" dnum="_-o:d-i" numlevel="1" lineno="54" slineno="1-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="both">(d)</amend></display>the person designated by the charter in a charter city.</subsection></subsection><subsection ssid="1-null-88" dnum="5-o" numlevel="1" lineno="55" slineno="1-19" level="1"><display>(5)</display>"Budget period" means the fiscal period for which a budget is prepared.</subsection><subsection ssid="1-null-89" dnum="6-o" numlevel="1" lineno="56" slineno="1-20" level="1"><display>(6)</display>"Budgetary fund" means a fund for which a budget is required.</subsection><subsection ssid="1-null-90" dnum="7-o" numlevel="1" lineno="57" slineno="1-21" level="1"><display>(7)</display>"Check" means an order in a specific amount drawn upon a depository by an authorized <ln numlevel="1" lineno="58" slineno="1-22"/>officer of a city.</subsection><subsection ssid="1-null-91" dnum="8-o" numlevel="1" lineno="59" slineno="1-23" level="1"><display>(8)</display>"City general fund" means the general fund used by a city.</subsection><subsection ssid="1-null-92" dnum="9-o" numlevel="1" lineno="60" slineno="1-24" level="1"><display>(9)</display>"Current period" means the fiscal period in which a budget is prepared and adopted, i.e., <ln numlevel="1" lineno="61" slineno="1-25"/>the fiscal period next preceding the budget period.</subsection><subsection ssid="1-null-93" dnum="10-o" numlevel="1" lineno="62" slineno="1-26" level="1"><display>(10)</display>"Department" means any functional unit within a fund that carries on a specific <ln numlevel="1" lineno="63" slineno="1-27"/>activity, such as a fire or police department within a city general fund.</subsection><subsection ssid="1-null-94" dnum="11-o" numlevel="1" lineno="64" slineno="1-28" level="1" space="false"><display>(11)</display><subsection ssid="1-null-95" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1017" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>"Encumbrance system" means a method of budgetary control in which part of an <ln numlevel="1" lineno="65" slineno="1-29"/>appropriation is reserved to cover a specific expenditure by charging obligations, <ln numlevel="1" lineno="66" slineno="1-30"/>such as purchase orders, contracts, or salary commitments to an appropriation <ln numlevel="1" lineno="67" slineno="1-31"/>account at their time of origin.</subsection><subsection ssid="1-null-96" dnum="_-o:b-i" numlevel="1" lineno="68" slineno="1-32" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="both">(b)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="53" groupid="45" style="2" owner="jchristopherson" level="1" deltag="both">  Such obligations cease</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="72" groupid="61" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">An obligation described in Subsection <xref depth="4" refnumber="10-6-106(11)(a)">(11)(a)</xref> ceases</amend> to be <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="52" groupid="44" style="2" owner="jchristopherson" level="1" deltag="both"><ln numlevel="1" lineno="69" slineno="1-33"/>encumbrances</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="51" groupid="43" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">an encumbrance</amend> when paid or when the actual liability is entered on <ln numlevel="1" lineno="70" slineno="1-34"/>the city's books of account.</subsection></subsection><subsection ssid="1-null-97" dnum="12-o" numlevel="1" lineno="71" slineno="1-35" level="1"><display>(12)</display>"Enterprise fund" means a fund as defined by the Governmental Accounting Standards <ln numlevel="1" lineno="72" slineno="1-36"/>Board that is used by a municipality to report an activity for which a fee is charged to <ln numlevel="1" lineno="73" slineno="1-37"/>users for goods or services.</subsection><subsection ssid="1-null-98" dnum="13-o" numlevel="1" lineno="74" slineno="1-38" level="1"><display>(13)</display>"Estimated revenue" means the amount of revenue estimated to be received from all <ln numlevel="1" lineno="75" slineno="1-39"/>sources during the budget period in each fund for which a budget is being prepared.</subsection><subsection ssid="1-null-99" dnum="14-o" numlevel="1" lineno="76" slineno="1-40" level="1"><display>(14)</display>"Financial officer" means the mayor in the council-mayor optional form of government <ln numlevel="1" lineno="77" slineno="1-41"/>or the city official as authorized by Section <xref depth="3" refnumber="10-6-158" start="0">10-6-158</xref>.</subsection><subsection ssid="1-null-100" dnum="15-o" numlevel="1" lineno="78" slineno="1-42" level="1"><display>(15)</display>"Fiscal period" means the annual or biennial period for accounting for fiscal operations <ln numlevel="1" lineno="79" slineno="1-43"/>in each city.</subsection><subsection ssid="1-null-101" dnum="16-o" numlevel="1" lineno="80" slineno="1-44" level="1"><display>(16)</display>"Fund" is as defined by generally accepted accounting principles as reflected in the <ln numlevel="1" lineno="81" slineno="1-45"/>Uniform Accounting Manual for Utah Cities.</subsection><subsection ssid="1-null-102" dnum="17-o" numlevel="1" lineno="82" slineno="1-46" level="1"><display>(17)</display>"Fund balance," "retained earnings," and "deficit" have the meanings commonly <ln numlevel="1" lineno="83" slineno="1-47"/>accorded such terms under generally accepted accounting principles as reflected in the <ln numlevel="1" lineno="84" slineno="1-48"/>Uniform Accounting Manual for Utah Cities.</subsection><subsection ssid="1-null-103" dnum="18-o" numlevel="1" lineno="85" slineno="1-49" level="1"><display>(18)</display>"General fund" is as defined by the Governmental Accounting Standards Board as <ln numlevel="1" lineno="86" slineno="1-50"/>reflected in the Uniform Accounting Manual for All Local Governments prepared by the <ln numlevel="1" lineno="87" slineno="1-51"/>Office of the Utah State Auditor.</subsection><subsection ssid="1-null-104" dnum="19-o" numlevel="1" lineno="88" slineno="1-52" level="1"><display>(19)</display>"Governing body" means a city council, or city commission, as the case may be, but <ln numlevel="1" lineno="89" slineno="1-53"/>the authority to make any appointment to any position created by this chapter is vested <ln numlevel="1" lineno="90" slineno="1-54"/>in the mayor in the council-mayor optional form of government.</subsection><subsection ssid="1-null-105" dnum="20-o" numlevel="1" lineno="91" slineno="1-55" level="1"><display>(20)</display>"Interfund loan" means a loan of cash from one fund to another, subject to future <ln numlevel="1" lineno="92" slineno="1-56"/>repayment.</subsection><subsection ssid="1-null-106" dnum="21-o" numlevel="1" lineno="93" slineno="1-57" level="1"><display>(21)</display>"Last completed fiscal period" means the fiscal period next preceding the current <ln numlevel="1" lineno="94" slineno="1-58"/>period.</subsection><subsection ssid="1-115" dnum="_-o:22-i" numlevel="1" lineno="95" slineno="1-59" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1029" style="1" owner="i" level="1" amendtag="start">(22)</amend></display><amend anum="0" ea="amend" pairid="76" groupid="64" style="1" owner="jchristopherson" level="1" amendtag="end">"Municipality" means a city or a town.</amend></subsection><subsection ssid="1-null-107" dnum="22-o:23-i" numlevel="1" lineno="96" slineno="1-60" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1030" style="2" owner="o" level="1" deltag="both">(22)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1031" style="1" owner="i" level="1" amendtag="both" space="true">(23)</amend></display><subsection ssid="1-null-108" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Public funds" means any money or payment collected or received by an <ln numlevel="1" lineno="97" slineno="1-61"/>officer or employee of the city acting in an official capacity and includes money or <ln numlevel="1" lineno="98" slineno="1-62"/>payment to the officer or employee for services or goods provided by the city, or the <ln numlevel="1" lineno="99" slineno="1-63"/>officer or employee while acting within the scope of employment or duty.</subsection><subsection ssid="1-null-109" dnum="b-o" numlevel="1" lineno="100" slineno="1-64" level="2"><display>(b)</display>"Public funds" does not include money or payments collected or received by an <ln numlevel="1" lineno="101" slineno="1-65"/>officer or employee of a city for charitable purposes if the mayor or city council has <ln numlevel="1" lineno="102" slineno="1-66"/>consented to the officer's or employee's participation in soliciting contributions for a <ln numlevel="1" lineno="103" slineno="1-67"/>charity.<subsection ssid="1-null-110" dnum="23-o:_-i" numlevel="1" lineno="104" slineno="1-68" ea="erase" anum="0" owner="jchristopherson" style="2" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1033" style="2" owner="o" level="1" deltag="both">(23)</amend><amendoutend style="2"/></display></subsection></subsection></subsection><subsection ssid="1-null-111" dnum="_-o:24-i" numlevel="1" lineno="105" slineno="1-69" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1034" style="1" owner="i" level="1" amendtag="both">(24)</amend></display>"Special fund" means any fund other than the city general fund.</subsection><subsection ssid="1-null-112" dnum="24-o:25-i" numlevel="1" lineno="106" slineno="1-70" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1035" style="2" owner="o" level="1" deltag="both">(24)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1036" style="1" owner="i" level="1" amendtag="both" space="true">(25)</amend></display>"Utility" means a utility owned by a city, in whole or in part, that provides <ln numlevel="1" lineno="107" slineno="1-71"/>electricity, gas, water, or sewer, or any combination of <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="14" groupid="12" style="2" owner="jchristopherson" level="1" deltag="both">them</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="13" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">electricity, gas, water, or <ln numlevel="1" lineno="108" slineno="1-72"/>sewer</amend>.</subsection><subsection ssid="1-null-113" dnum="_-o:26-i" numlevel="1" lineno="109" slineno="1-73" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1036" style="1" owner="i" level="1" amendtag="start">(26)</amend></display><amend anum="0" ea="amend" pairid="57" groupid="48" style="1" owner="jchristopherson" level="1" amendtag="end">"Utility-adjacent service" means the maintenance, construction, and improvement of <ln numlevel="1" lineno="110" slineno="1-74"/>storm water infrastructure.</amend></subsection><subsection ssid="1-null-114" dnum="25-o:27-i" numlevel="1" lineno="111" slineno="1-75" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1037" style="2" owner="o" level="1" deltag="both">(25)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1038" style="1" owner="i" level="1" amendtag="both" space="true">(27)</amend></display>"Warrant" means an order drawn upon the city treasurer, in the absence of <ln numlevel="1" lineno="112" slineno="1-76"/>sufficient money in the city's depository, by an authorized officer of a city for the <ln numlevel="1" lineno="113" slineno="1-77"/>purpose of paying a specified amount out of the city treasury to the person named or to <ln numlevel="1" lineno="114" slineno="1-78"/>the bearer as money becomes available.</subsection></section></bsec><bsec buid="2" num="10-6-161" type="enact" src="code" uid="C10-6-S161_2025050720250507" sort="10 06 01610020250507" numlevel="1" lineno="115" slineno="2-1" sn="2"><section numlevel="1" lineno="116" slineno="2-2" number="10-6-161" type="enact"><secline lineno="115">Section 2. Section <bold>10-6-161</bold> is enacted to read:</secline><catline lineno="116"><bold>10-6-161<parens/>. Establishment of service fees -- Political subdivision lien for past due <ln numlevel="1" lineno="117" slineno="2-3"/>service fees.</bold></catline><subsection ssid="2-null-117" dnum="_-o:1-i" numlevel="1" lineno="118" slineno="2-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1038" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="166" groupid="118" style="1" owner="jchristopherson" level="1" amendtag="end">As used in this section, "service" means a water utility service, sewer utility service, or a <ln numlevel="1" lineno="119" slineno="2-5"/>utility-adjacent service provided by a municipality, either directly or through a <ln numlevel="1" lineno="120" slineno="2-6"/>contracted third-party, to a customer in the municipality.</amend></subsection><subsection ssid="2-null-118" dnum="_-o:2-i" numlevel="1" lineno="121" slineno="2-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1039" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><subsection ssid="2-null-119" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1040" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="13" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="end">If a governing body of a municipality establishes by ordinance or resolution a fee <ln numlevel="1" lineno="122" slineno="2-8"/>schedule for a service, the municipality may charge a fee to a customer according to <ln numlevel="1" lineno="123" slineno="2-9"/>the fee schedule.</amend></subsection><subsection ssid="2-null-120" dnum="_-o:b-i" numlevel="1" lineno="124" slineno="2-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1041" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="126" groupid="88" style="1" owner="jchristopherson" level="1" amendtag="end">If a municipality contracts with a third-party to provide a service, the municipality <ln numlevel="1" lineno="125" slineno="2-11"/>may agree to:</amend><subsection ssid="2-null-121" dnum="_-o:i-i" numlevel="1" lineno="126" slineno="2-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1042" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="131" groupid="92" style="1" owner="jchristopherson" level="1" amendtag="end">pay the third-party directly for the contracted service; and</amend></subsection><subsection ssid="2-null-122" dnum="_-o:ii-i" numlevel="1" lineno="127" slineno="2-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1043" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="136" groupid="96" style="1" owner="jchristopherson" level="1" amendtag="end">collect the fees for the service from a customer either directly or through a <ln numlevel="1" lineno="128" slineno="2-14"/>third-party billing program.</amend></subsection></subsection></subsection><subsection ssid="2-null-123" dnum="_-o:3-i" numlevel="1" lineno="129" slineno="2-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1044" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><subsection ssid="2-null-124" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1045" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="114" groupid="80" style="1" owner="jchristopherson" level="1" amendtag="end">A municipality, directly or through a contracted third-party, shall provide billing <ln numlevel="1" lineno="130" slineno="2-16"/>notices to a customer detailing:</amend><subsection ssid="2-null-125" dnum="_-o:i-i" numlevel="1" lineno="131" slineno="2-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1046" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="119" groupid="84" style="1" owner="jchristopherson" level="1" amendtag="end">the fees due for a service provided by the municipality or a third-party contracted <ln numlevel="1" lineno="132" slineno="2-18"/>by the municipality; and</amend></subsection><subsection ssid="2-null-126" dnum="_-o:ii-i" numlevel="1" lineno="133" slineno="2-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1047" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="154" groupid="108" style="1" owner="jchristopherson" level="1" amendtag="end">the due date for payment of the fees.</amend></subsection></subsection><subsection ssid="2-null-127" dnum="_-o:b-i" numlevel="1" lineno="134" slineno="2-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1048" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="153" groupid="107" style="1" owner="jchristopherson" level="1" amendtag="end">A municipality or third-party billing service may combine a service billing notice <ln numlevel="1" lineno="135" slineno="2-21"/>with another billing notice provided directly by the municipality or through a <ln numlevel="1" lineno="136" slineno="2-22"/>contracted third-party.</amend></subsection></subsection><subsection ssid="2-null-128" dnum="_-o:4-i" numlevel="1" lineno="137" slineno="2-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1049" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="19" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="end">A municipality may hold a political subdivision lien, as that term is defined in Section <xref depth="3" refnumber="11-60-102"><ln numlevel="1" lineno="138" slineno="2-24"/>11-60-102</xref>, on a customer's property for a past due service fee authorized under this <ln numlevel="1" lineno="139" slineno="2-25"/>section by:</amend><subsection ssid="2-null-129" dnum="_-o:a-i" numlevel="1" lineno="140" slineno="2-26" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1050" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="171" groupid="122" style="1" owner="jchristopherson" level="1" amendtag="end">notifying the customer of the past due service fee;</amend></subsection><subsection ssid="2-null-130" dnum="_-o:b-i" numlevel="1" lineno="141" slineno="2-27" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1051" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="176" groupid="126" style="1" owner="jchristopherson" level="1" amendtag="end">subject to Subsections <xref depth="4" refnumber="10-6-161(5)(a)">(5)(a)</xref> and <xref depth="4" refnumber="10-6-161(5)(b)(i)">(5)(b)(i)</xref>, if the past due service fee remains unpaid, <ln numlevel="1" lineno="142" slineno="2-28"/>no earlier than 60 days after the day on which the customer is notified of the past due <ln numlevel="1" lineno="143" slineno="2-29"/>service fee, notifying the customer that the municipality intends to file a political <ln numlevel="1" lineno="144" slineno="2-30"/>subdivision lien on the customer's property to which the utility or utility-related <ln numlevel="1" lineno="145" slineno="2-31"/>service was provided if the past due service fee continues to remain unpaid; and</amend></subsection><subsection ssid="2-null-131" dnum="_-o:c-i" numlevel="1" lineno="146" slineno="2-32" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1052" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="181" groupid="130" style="1" owner="jchristopherson" level="1" amendtag="end">subject to Subsection <xref depth="4" refnumber="10-6-161(5)(b)(ii)">(5)(b)(ii)</xref>, if the past due service fee remains unpaid, no earlier <ln numlevel="1" lineno="147" slineno="2-33"/>than 10 days after the day on which the customer is notified that the municipality <ln numlevel="1" lineno="148" slineno="2-34"/>intends to file a political subdivision lien on the customer's property:</amend><subsection ssid="2-null-132" dnum="_-o:i-i" numlevel="1" lineno="149" slineno="2-35" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1053" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="191" groupid="138" style="1" owner="jchristopherson" level="1" amendtag="end">certifying to the county treasurer of the county in which the customer's property is <ln numlevel="1" lineno="150" slineno="2-36"/>located the amount of:</amend><subsection ssid="2-null-133" dnum="_-o:A-i" numlevel="1" lineno="151" slineno="2-37" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1054" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="205" groupid="149" style="1" owner="jchristopherson" level="1" amendtag="end">past due service fees; and</amend></subsection><subsection ssid="2-null-134" dnum="_-o:B-i" numlevel="1" lineno="152" slineno="2-38" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1055" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="210" groupid="153" style="1" owner="jchristopherson" level="1" amendtag="end">if applicable, subject to Section <xref depth="3" refnumber="10-6-162">10-6-162</xref>, interest and administrative costs; <ln numlevel="1" lineno="153" slineno="2-39"/>and</amend></subsection></subsection><subsection ssid="2-null-135" dnum="_-o:ii-i" numlevel="1" lineno="154" slineno="2-40" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1056" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="196" groupid="142" style="1" owner="jchristopherson" level="1" amendtag="end">recording the political subdivision lien with the county recorder of the county in <ln numlevel="1" lineno="155" slineno="2-41"/>which the customer's property is located.</amend></subsection></subsection></subsection><subsection ssid="2-null-136" dnum="_-o:5-i" numlevel="1" lineno="156" slineno="2-42" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1057" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><subsection ssid="2-146" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1058" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="217" groupid="159" style="1" owner="jchristopherson" level="1" amendtag="end">Before notifying the customer that the municipality intends to file a political <ln numlevel="1" lineno="157" slineno="2-43"/>subdivision lien, as described in Subsection <xref depth="4" refnumber="10-6-161(4)(b)">(4)(b)</xref>, the municipality shall make <ln numlevel="1" lineno="158" slineno="2-44"/>reasonable efforts to determine whether the customer is a different person than the <ln numlevel="1" lineno="159" slineno="2-45"/>owner of record of the property where the customer receives service.</amend></subsection><subsection ssid="2-145" dnum="_-o:b-i" numlevel="1" lineno="160" slineno="2-46" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1059" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="227" groupid="167" style="1" owner="jchristopherson" level="1" amendtag="end">If the municipality determines the customer and owner of record are different, as <ln numlevel="1" lineno="161" slineno="2-47"/>described in Subsection <xref depth="4" refnumber="10-6-161(5)(a)">(5)(a)</xref>, the municipality shall:</amend><subsection ssid="2-158" dnum="_-o:i-i" numlevel="1" lineno="162" slineno="2-48" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1060" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="274" groupid="203" style="1" owner="jchristopherson" level="1" amendtag="end">provide the same notice to the owner of record as the notice the municipality <ln numlevel="1" lineno="163" slineno="2-49"/>provides to the customer under Subsection <xref depth="4" refnumber="10-6-161(4)(b)">(4)(b)</xref> as described in Subsection <xref depth="4" refnumber="10-6-161(5)(c)">(5)(c)</xref>; <ln numlevel="1" lineno="164" slineno="2-50"/>and</amend></subsection><subsection ssid="2-159" dnum="_-o:ii-i" numlevel="1" lineno="165" slineno="2-51" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1061" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="279" groupid="207" style="1" owner="jchristopherson" level="1" amendtag="end">if the past due service fee remains unpaid, record the political subdivision lien as <ln numlevel="1" lineno="166" slineno="2-52"/>described in Subsection <xref depth="4" refnumber="10-6-161(4)(c)">(4)(c)</xref> no earlier than 20 days after the day on which the <ln numlevel="1" lineno="167" slineno="2-53"/>customer and owner of record is notified that the municipality intends to file a <ln numlevel="1" lineno="168" slineno="2-54"/>political subdivision lien.</amend></subsection></subsection><subsection ssid="2-151" dnum="_-o:c-i" numlevel="1" lineno="169" slineno="2-55" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1062" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="239" groupid="175" style="1" owner="jchristopherson" level="1" amendtag="end">When providing notice to the owner of record under Subsection <xref depth="4" refnumber="10-6-161(5)(b)(i)">(5)(b)(i)</xref>, the <ln numlevel="1" lineno="170" slineno="2-56"/>municipality shall:</amend><subsection ssid="2-152" dnum="_-o:i-i" numlevel="1" lineno="171" slineno="2-57" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1063" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="244" groupid="179" style="1" owner="jchristopherson" level="1" amendtag="end">use the current residential or business address of the real property owner;</amend></subsection><subsection ssid="2-153" dnum="_-o:ii-i" numlevel="1" lineno="172" slineno="2-58" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1064" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="249" groupid="183" style="1" owner="jchristopherson" level="1" amendtag="end">if the municipality is not reasonably able to obtain the address described in <ln numlevel="1" lineno="173" slineno="2-59"/>Subsection <xref depth="4" refnumber="10-6-161(5)(c)(i)">(5)(c)(i)</xref>, use the last known address of the real property owner that the <ln numlevel="1" lineno="174" slineno="2-60"/>municipality is able to obtain via a reasonable inquiry into public records; or</amend></subsection><subsection ssid="2-154" dnum="_-o:iii-i" numlevel="1" lineno="175" slineno="2-61" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1065" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="254" groupid="187" style="1" owner="jchristopherson" level="1" amendtag="end">if the municipality is not reasonably able to obtain an address described in <ln numlevel="1" lineno="176" slineno="2-62"/>Subsection <xref depth="4" refnumber="10-6-161(5)(c)(i)">(5)(c)(i)</xref> or <xref depth="4" refnumber="10-6-161(ii)">(ii)</xref>, post the notice:</amend><subsection ssid="2-155" dnum="_-o:A-i" numlevel="1" lineno="177" slineno="2-63" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1066" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="259" groupid="191" style="1" owner="jchristopherson" level="1" amendtag="end">on the real property; and</amend></subsection><subsection ssid="2-156" dnum="_-o:B-i" numlevel="1" lineno="178" slineno="2-64" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1067" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="264" groupid="195" style="1" owner="jchristopherson" level="1" amendtag="end">on the municipality's website, if the municipality has a website, for at least 20 <ln numlevel="1" lineno="179" slineno="2-65"/>consecutive days or until the past due service fee is paid, whichever occurs first.</amend></subsection></subsection></subsection></subsection><subsection ssid="2-143" dnum="_-o:6-i" numlevel="1" lineno="180" slineno="2-66" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1068" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="215" groupid="157" style="1" owner="jchristopherson" level="1" amendtag="end">Upon certification and recording under Subsection <xref tempid="627" depth="4" refnumber="(4)(c)">(4)(c)</xref>, the past due service fees, and <ln numlevel="1" lineno="181" slineno="2-67"/>interest and administrative costs if applicable, become a political subdivision lien on the <ln numlevel="1" lineno="182" slineno="2-68"/>customer's property, in accordance with Title 11, Chapter 60, Political Subdivision Lien <ln numlevel="1" lineno="183" slineno="2-69"/>Authority.</amend></subsection><subsection ssid="2-null-137" dnum="_-o:7-i" numlevel="1" lineno="184" slineno="2-70" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1069" style="1" owner="i" level="1" amendtag="start">(7)</amend></display><amend anum="0" ea="amend" pairid="200" groupid="145" style="1" owner="jchristopherson" level="1" amendtag="end">Upon payment of the full amount owed under a political subdivision lien authorized by <ln numlevel="1" lineno="185" slineno="2-71"/>this section, the municipality shall file a release of the lien with the county recorder's <ln numlevel="1" lineno="186" slineno="2-72"/>office.</amend></subsection></section></bsec><bsec buid="3" num="10-6-162" type="enact" src="code" uid="C10-6-S162_2025050720250507" sort="10 06 01620020250507" numlevel="1" lineno="187" slineno="3-1" sn="3"><section numlevel="1" lineno="188" slineno="3-2" number="10-6-162" type="enact"><secline lineno="187">Section 3. Section <bold>10-7-14</bold> is amended to read:</secline><catline lineno="199"><bold>10-7-14<parens/>. Rules and regulations for use of water.</bold></catline><subsection ssid="9-null-1" dnum="1-o" numlevel="1" lineno="200" slineno="4-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="9-null-2" dnum="a-o" numlevel="1" lineno="201" slineno="4-4" level="2"><display>(a)</display>"Designated water service area" means the area defined by a municipality in <ln numlevel="1" lineno="202" slineno="4-5"/>accordance with the <ext_ref type="Utah Constitution">Utah Constitution, Article XI, Section 6</ext_ref>, Subsection <xref depth="4" refnumber="10-7-14(1)(c)" start="0">(1)(c)</xref>.</subsection><subsection ssid="9-null-3" dnum="b-o" numlevel="1" lineno="203" slineno="4-6" level="2"><display>(b)</display>"Retail customer" means an end user:<subsection ssid="9-null-4" dnum="i-o" numlevel="1" lineno="204" slineno="4-7" level="3"><display>(i)</display>who receives culinary water directly from a municipality's waterworks system; and</subsection><subsection ssid="9-null-5" dnum="ii-o" numlevel="1" lineno="205" slineno="4-8" level="3"><display>(ii)</display>whom the municipality described in Subsection <xref depth="4" refnumber="10-7-14(1)(b)(i)" start="0">(1)(b)(i)</xref> bills for water service.</subsection></subsection><subsection ssid="9-null-6" dnum="c-o" numlevel="1" lineno="206" slineno="4-9" level="2" space="false"><display>(c)</display><subsection ssid="9-null-7" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"Waterworks system" means municipally owned collection, treatment, storage, <ln numlevel="1" lineno="207" slineno="4-10"/>and distribution facilities for culinary or irrigation water, including any pipe, <ln numlevel="1" lineno="208" slineno="4-11"/>hydrant, or appurtenance to a pipe or hydrant.</subsection><subsection ssid="9-null-8" dnum="ii-o" numlevel="1" lineno="209" slineno="4-12" level="3"><display>(ii)</display>"Waterworks system" does not include a water right or a source of supply such as <ln numlevel="1" lineno="210" slineno="4-13"/>a well, spring, stream, or share in a mutual irrigation company.</subsection></subsection></subsection><subsection ssid="9-null-9" dnum="2-o" numlevel="1" lineno="211" slineno="4-14" level="1"><display>(2)</display>A municipality may enact ordinances, rules and regulations for the management and <ln numlevel="1" lineno="212" slineno="4-15"/>conduct of the waterworks system owned or controlled by it.</subsection><subsection ssid="9-null-10" dnum="3-o" numlevel="1" lineno="213" slineno="4-16" level="1"><display>(3)</display>A municipality that provides water to a retail customer outside of the municipality's <ln numlevel="1" lineno="214" slineno="4-17"/>boundary shall:<subsection ssid="9-null-11" dnum="a-o" numlevel="1" lineno="215" slineno="4-18" level="2"><display>(a)</display>create and maintain a map showing:<subsection ssid="9-null-12" dnum="i-o" numlevel="1" lineno="216" slineno="4-19" level="3"><display>(i)</display>the municipality's designated water service area; and</subsection><subsection ssid="9-null-13" dnum="ii-o" numlevel="1" lineno="217" slineno="4-20" level="3"><display>(ii)</display>each area outside the municipality's designated water service area where a retail <ln numlevel="1" lineno="218" slineno="4-21"/>customer receives water service from the municipality;</subsection></subsection><subsection ssid="9-null-14" dnum="b-o" numlevel="1" lineno="219" slineno="4-22" level="2"><display>(b)</display>transmit a copy of the map described in Subsection <xref depth="4" refnumber="10-7-14(3)(a)" start="0">(3)(a)</xref> to the state engineer;</subsection><subsection ssid="9-null-15" dnum="c-o" numlevel="1" lineno="220" slineno="4-23" level="2"><display>(c)</display>if the municipality has more than 500 retail customers, post the map described in <ln numlevel="1" lineno="221" slineno="4-24"/>Subsection <xref depth="4" refnumber="10-7-14(3)(a)" start="0">(3)(a)</xref> on the municipality's website;</subsection><subsection ssid="9-null-16" dnum="d-o" numlevel="1" lineno="222" slineno="4-25" level="2"><display>(d)</display>define, by ordinance, the area included in the municipality's designated water service <ln numlevel="1" lineno="223" slineno="4-26"/>area;</subsection><subsection ssid="9-null-17" dnum="e-o" numlevel="1" lineno="224" slineno="4-27" level="2"><display>(e)</display>adopt, by ordinance, any municipality rule or regulation applicable to the <ln numlevel="1" lineno="225" slineno="4-28"/>municipality's designated water service area or to a retail customer located outside of <ln numlevel="1" lineno="226" slineno="4-29"/>the municipality's designated water service area; and</subsection><subsection ssid="9-null-18" dnum="f-o" numlevel="1" lineno="227" slineno="4-30" level="2"><display>(f)</display>adopt, by ordinance<amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both"> or resolution</amend>, reasonable water rates for retail customers in the <ln numlevel="1" lineno="228" slineno="4-31"/>municipality's designated water service area, in accordance with Section <xref depth="3" refnumber="10-8-22" start="0">10-8-22</xref>.</subsection></subsection><subsection ssid="9-null-19" dnum="4-o" numlevel="1" lineno="229" slineno="4-32" level="1"><display>(4)</display>Within the municipality's designated water service area, a municipality shall:<subsection ssid="9-null-20" dnum="a-o" numlevel="1" lineno="230" slineno="4-33" level="2"><display>(a)</display>provide service to all retail customers in a manner consistent with principles of equal <ln numlevel="1" lineno="231" slineno="4-34"/>protection; and</subsection><subsection ssid="9-null-21" dnum="b-o" numlevel="1" lineno="232" slineno="4-35" level="2"><display>(b)</display>apply restrictions on water use to all retail customers in times of anticipated or actual <ln numlevel="1" lineno="233" slineno="4-36"/>water shortages in a manner consistent with principles of equal protection.</subsection></subsection><subsection ssid="9-null-22" dnum="5-o" numlevel="1" lineno="234" slineno="4-37" level="1"><display>(5)</display>Nothing in this section:<subsection ssid="9-null-23" dnum="a-o" numlevel="1" lineno="235" slineno="4-38" level="2"><display>(a)</display>prohibits a municipality from enacting a service restriction or other restriction:<subsection ssid="9-null-24" dnum="i-o" numlevel="1" lineno="236" slineno="4-39" level="3"><display>(i)</display>affecting:<subsection ssid="9-null-25" dnum="A-o" numlevel="1" lineno="237" slineno="4-40" level="4"><display>(A)</display>a localized area; or</subsection><subsection ssid="9-null-26" dnum="B-o" numlevel="1" lineno="238" slineno="4-41" level="4"><display>(B)</display>the municipality's entire designated water service area; and</subsection></subsection><subsection ssid="9-null-27" dnum="ii-o" numlevel="1" lineno="239" slineno="4-42" level="3" space="false"><display>(ii)</display><subsection ssid="9-null-28" dnum="A-o" level="4" placement="sameline"><display>(A)</display>based on an operational or maintenance need;</subsection><subsection ssid="9-null-29" dnum="B-o" numlevel="1" lineno="240" slineno="4-43" level="4"><display>(B)</display>based on an emergency situation; or</subsection><subsection ssid="9-null-30" dnum="C-o" numlevel="1" lineno="241" slineno="4-44" level="4"><display>(C)</display>to address a health, safety, or general welfare need;</subsection></subsection></subsection><subsection ssid="9-null-31" dnum="b-o" numlevel="1" lineno="242" slineno="4-45" level="2"><display>(b)</display>expands or diminishes the ability of a municipality to enter into a contract to supply <ln numlevel="1" lineno="243" slineno="4-46"/>water outside of the municipality's designated water service area; or</subsection><subsection ssid="9-null-32" dnum="c-o" numlevel="1" lineno="244" slineno="4-47" level="2"><display>(c)</display>alters the authorities or definitions described in <xref depth="1" refnumber="19-4" start="0">Title 19, Chapter 4, Safe Drinking <ln numlevel="1" lineno="245" slineno="4-48"/>Water Act</xref>.</subsection></subsection><subsection ssid="9-null-33" dnum="6-o" numlevel="1" lineno="246" slineno="4-49" level="1"><display>(6)</display>A municipality may not sell or convey an interest, in part or in whole, of the <ln numlevel="1" lineno="247" slineno="4-50"/>municipality's waterworks system, except to a public entity as defined in Section <xref depth="3" refnumber="73-1-4" start="0">73-1-4</xref>.</subsection></section></bsec><bsec buid="7" num="10-8-22" type="amend" src="code" uid="C10-8-S22_2026050620260506" sort="10 08 00220020260506" numlevel="1" lineno="248" slineno="5-1" sn="5"><section number="10-8-22" numlevel="1" lineno="249" slineno="5-2" type="amend"><secline lineno="248">Section 5. Section <bold>10-8-22</bold> is amended to read:</secline><catline lineno="249"><bold>10-8-22<parens/>. Water rates.</bold></catline><subsection ssid="7-null-1" dnum="1-o" numlevel="1" lineno="250" slineno="5-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="7-null-2" dnum="a-o" numlevel="1" lineno="251" slineno="5-4" level="2"><display>(a)</display>"Designated water service area" means the area defined by a municipality in <ln numlevel="1" lineno="252" slineno="5-5"/>accordance with the <ext_ref type="Utah Constitution">Utah Constitution, Article XI, Section 6</ext_ref>, Subsection <xref depth="4" refnumber="10-8-22(1)(c)" start="0">(1)(c)</xref>.</subsection><subsection ssid="7-null-3" dnum="b-o" numlevel="1" lineno="253" slineno="5-6" level="2"><display>(b)</display>"Large municipal drinking water system" means a municipally owned and operated <ln numlevel="1" lineno="254" slineno="5-7"/>drinking water system serving a population of 10,000 or more.</subsection><subsection ssid="7-null-4" dnum="c-o" numlevel="1" lineno="255" slineno="5-8" level="2"><display>(c)</display>"Retail customer" means an end user:<subsection ssid="7-null-5" dnum="i-o" numlevel="1" lineno="256" slineno="5-9" level="3"><display>(i)</display>who receives culinary water directly from a municipality's waterworks system; and</subsection><subsection ssid="7-null-6" dnum="ii-o" numlevel="1" lineno="257" slineno="5-10" level="3"><display>(ii)</display>whom the municipality described in Subsection <xref depth="4" refnumber="10-8-22(1)(c)(i)" start="0">(1)(c)(i)</xref> bills for water service.</subsection></subsection></subsection><subsection ssid="7-null-7" dnum="2-o" numlevel="1" lineno="258" slineno="5-11" level="1"><display>(2)</display>A municipality shall fix the rates to be paid for the use of water furnished by the <ln numlevel="1" lineno="259" slineno="5-12"/>municipality.</subsection><subsection ssid="7-null-8" dnum="3-o" numlevel="1" lineno="260" slineno="5-13" level="1"><display>(3)</display>The setting of municipal water rates is a legislative act.</subsection><subsection ssid="7-null-9" dnum="4-o" numlevel="1" lineno="261" slineno="5-14" level="1"><display>(4)</display>Within the municipality's designated water service area, a municipality shall:<subsection ssid="7-null-10" dnum="a-o" numlevel="1" lineno="262" slineno="5-15" level="2"><display>(a)</display>establish, by ordinance<amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both"> or resolution</amend>, reasonable rates for the services provided to the <ln numlevel="1" lineno="263" slineno="5-16"/>municipality's retail customers;</subsection><subsection ssid="7-null-11" dnum="b-o" numlevel="1" lineno="264" slineno="5-17" level="2"><display>(b)</display>use the same method of providing notice to all retail customers of proposed rate <ln numlevel="1" lineno="265" slineno="5-18"/>changes; and</subsection><subsection ssid="7-null-12" dnum="c-o" numlevel="1" lineno="266" slineno="5-19" level="2"><display>(c)</display>allow all retail customers the same opportunity to appear and participate in a public <ln numlevel="1" lineno="267" slineno="5-20"/>meeting addressing water rates.</subsection></subsection><subsection ssid="7-null-13" dnum="5-o" numlevel="1" lineno="268" slineno="5-21" level="1" space="false"><display>(5)</display><subsection ssid="7-null-14" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A municipality may establish different rates for different classifications of retail <ln numlevel="1" lineno="269" slineno="5-22"/>customers within the municipality's designated water service area, if the rates and <ln numlevel="1" lineno="270" slineno="5-23"/>classifications have a reasonable basis.</subsection><subsection ssid="7-null-15" dnum="b-o" numlevel="1" lineno="271" slineno="5-24" level="2"><display>(b)</display>A reasonable basis for charging different rates for different classifications may <ln numlevel="1" lineno="272" slineno="5-25"/>include, among other things, a situation in which:<subsection ssid="7-null-16" dnum="i-o" numlevel="1" lineno="273" slineno="5-26" level="3"><display>(i)</display>there is a difference in the cost of providing service to a particular classification;</subsection><subsection ssid="7-null-17" dnum="ii-o" numlevel="1" lineno="274" slineno="5-27" level="3"><display>(ii)</display>one classification bears more risk in relation to a system operation or obligation;</subsection><subsection ssid="7-null-18" dnum="iii-o" numlevel="1" lineno="275" slineno="5-28" level="3"><display>(iii)</display>retail customers in one classification invested or contributed to acquire a water <ln numlevel="1" lineno="276" slineno="5-29"/>source or supply or build or maintain a system differently than retail customers in <ln numlevel="1" lineno="277" slineno="5-30"/>another classification;</subsection><subsection ssid="7-null-19" dnum="iv-o" numlevel="1" lineno="278" slineno="5-31" level="3"><display>(iv)</display>the needs or conditions of one classification:<subsection ssid="7-null-20" dnum="A-o" numlevel="1" lineno="279" slineno="5-32" level="4"><display>(A)</display>are distinguishable from the needs or conditions of another classification; and</subsection><subsection ssid="7-null-21" dnum="B-o" numlevel="1" lineno="280" slineno="5-33" level="4"><display>(B)</display>based on economic, public policy, or other identifiable elements, support a <ln numlevel="1" lineno="281" slineno="5-34"/>different rate; </subsection></subsection><subsection ssid="7-null-22" dnum="v-o" numlevel="1" lineno="282" slineno="5-35" level="3"><display>(v)</display>there is a differential between the classifications based on a cost of service <ln numlevel="1" lineno="283" slineno="5-36"/>standard or a generally accepted rate setting method, including a standard or <ln numlevel="1" lineno="284" slineno="5-37"/>method the American Water Works Association establishes; or</subsection><subsection ssid="7-null-23" dnum="vi-o" numlevel="1" lineno="285" slineno="5-38" level="3"><display>(vi)</display>water conservation is used as an element in determining the rate charged for a <ln numlevel="1" lineno="286" slineno="5-39"/>block unit of water as provided in Section <xref depth="3" refnumber="73-10-32.5">73-10-32.5</xref>.</subsection></subsection><subsection ssid="7-null-24" dnum="c-o" numlevel="1" lineno="287" slineno="5-40" level="2"><display>(c)</display>An adjustment based solely on the fact that a particular classification of retail <ln numlevel="1" lineno="288" slineno="5-41"/>customers is located either inside or outside of the municipality's corporate boundary <ln numlevel="1" lineno="289" slineno="5-42"/>is not a reasonable basis.</subsection></subsection><subsection ssid="7-null-25" dnum="6-o" numlevel="1" lineno="290" slineno="5-43" level="1" space="false"><display>(6)</display><subsection ssid="7-null-26" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If more than 10% of the retail customers within a large municipal drinking water <ln numlevel="1" lineno="291" slineno="5-44"/>system's designated water service area are located outside of the municipality's <ln numlevel="1" lineno="292" slineno="5-45"/>corporate boundary, the municipality shall:<subsection ssid="7-null-27" dnum="i-o" numlevel="1" lineno="293" slineno="5-46" level="3" tab="1"><display>(i)</display>post on the municipality's website the rates assessed to retail customers within the <ln numlevel="1" lineno="294" slineno="5-47"/>designated water service area; and</subsection><subsection ssid="7-null-28" dnum="ii-o" numlevel="1" lineno="295" slineno="5-48" level="3" tab="1"><display>(ii)</display>establish an advisory board to make recommendations to the municipal legislative <ln numlevel="1" lineno="296" slineno="5-49"/>body regarding water rates, capital projects, and other water service standards.</subsection></subsection><subsection ssid="7-null-29" dnum="b-o" numlevel="1" lineno="297" slineno="5-50" level="2"><display>(b)</display>In establishing an advisory board described in Subsection <xref depth="4" refnumber="10-8-22(6)(a)(ii)" start="0">(6)(a)(ii)</xref>, a municipality <ln numlevel="1" lineno="298" slineno="5-51"/>shall:<subsection ssid="7-null-30" dnum="i-o" numlevel="1" lineno="299" slineno="5-52" level="3"><display>(i)</display>if more than 10% but no more than 30% of the municipality's retail customers <ln numlevel="1" lineno="300" slineno="5-53"/>receive service outside the municipality's municipal boundary, ensure that at least <ln numlevel="1" lineno="301" slineno="5-54"/>20% of the advisory board's members represent the municipality's retail customers <ln numlevel="1" lineno="302" slineno="5-55"/>receiving service outside the municipality's municipal boundary;</subsection><subsection ssid="7-null-31" dnum="ii-o" numlevel="1" lineno="303" slineno="5-56" level="3"><display>(ii)</display>if more than 30% of the municipality's retail customers receive service outside of <ln numlevel="1" lineno="304" slineno="5-57"/>the municipality's municipal boundary, ensure that at least 40% of the advisory <ln numlevel="1" lineno="305" slineno="5-58"/>board's members represent the municipality's retail customers receiving service <ln numlevel="1" lineno="306" slineno="5-59"/>outside of the municipality's municipal boundary; and</subsection><subsection ssid="7-null-32" dnum="iii-o" numlevel="1" lineno="307" slineno="5-60" level="3"><display>(iii)</display>in appointing board members who represent retail customers receiving service <ln numlevel="1" lineno="308" slineno="5-61"/>outside of the municipality's municipal boundary, as required in Subsections <xref depth="4" refnumber="10-8-22(6)(b)(i)" start="0"><ln numlevel="1" lineno="309" slineno="5-62"/>(6)(b)(i)</xref> and <xref depth="4" refnumber="10-8-22(6)(b)(ii)" start="0">(ii)</xref>, solicit recommendations from each municipality and county <ln numlevel="1" lineno="310" slineno="5-63"/>outside of the municipality's municipal boundary whose residents are retail <ln numlevel="1" lineno="311" slineno="5-64"/>customers within the municipality's designated water service area.</subsection></subsection></subsection><subsection ssid="7-null-33" dnum="7-o" numlevel="1" lineno="312" slineno="5-65" level="1"><display>(7)</display>A municipality that supplies water outside of the municipality's designated water service <ln numlevel="1" lineno="313" slineno="5-66"/>area shall supply the water only by contract and shall include in the contract the terms <ln numlevel="1" lineno="314" slineno="5-67"/>and conditions under which the contract can be terminated.</subsection><subsection ssid="7-null-34" dnum="8-o" numlevel="1" lineno="315" slineno="5-68" level="1"><display>(8)</display>A municipality shall:<subsection ssid="7-null-35" dnum="a-o" numlevel="1" lineno="316" slineno="5-69" level="2"><display>(a)</display>notify the director of the Division of Drinking Water of a contract the municipality <ln numlevel="1" lineno="317" slineno="5-70"/>enters into with a person outside of the municipality's designated water service area, <ln numlevel="1" lineno="318" slineno="5-71"/>including the name and contact information of the person named in each contract; and</subsection><subsection ssid="7-null-36" dnum="b-o" numlevel="1" lineno="319" slineno="5-72" level="2"><display>(b)</display>each year, provide to the director of the Division of Drinking Water any <ln numlevel="1" lineno="320" slineno="5-73"/>supplementing or new information regarding a contract described in Subsection <xref depth="4" refnumber="10-8-22(8)(a)" start="0">(8)(a)</xref>, <ln numlevel="1" lineno="321" slineno="5-74"/>including whether there is no new information to provide at that time.</subsection></subsection></section></bsec><bsec buid="5" num="17B-1-902.1" type="amend" src="code" uid="C17B-1-S902.1_2025050720250507" sort="17B01 09020120250507" numlevel="1" lineno="322" slineno="6-1" sn="6"><section number="17B-1-902.1" numlevel="1" lineno="323" slineno="6-2" type="amend"><secline lineno="322">Section 6. Section <bold>17B-1-902.1</bold> is amended to read:</secline><catline lineno="323"><bold>17B-1-902.1<parens/>. Interest -- Collection of administrative costs.</bold></catline><subsection ssid="5-null-15" dnum="1-o" numlevel="1" lineno="324" slineno="6-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="5-null-16" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A special district may charge interest on a past due fee or past due charge.</subsection><subsection ssid="5-null-17" dnum="b-o" numlevel="1" lineno="325" slineno="6-4" level="2"><display>(b)</display>If a special district charges interest as described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="17B-1-902.1(1)(b)" start="0">(1)(b)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(1)(a)</amend>, the <ln numlevel="1" lineno="326" slineno="6-5"/>special district shall calculate the interest rate <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">for a calendar year:</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="9" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">in the same <ln numlevel="1" lineno="327" slineno="6-6"/>manner as a property tax lien described in Section <xref depth="3" refnumber="59-2-1331">59-2-1331</xref>.</amend><subsection ssid="5-null-18" dnum="i-o:_-i" numlevel="1" lineno="328" slineno="6-7" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1148" style="2" owner="o" level="1" deltag="start">(i)</amend></display><amend anum="0" ea="erase" pairid="12" groupid="11" style="2" owner="jchristopherson" level="1" deltag="end">based on the federal short-term rate determined by the secretary of the treasury <ln numlevel="1" lineno="329" slineno="6-8"/>under Section 6621, Internal Revenue Code, in effect for the preceding fourth <ln numlevel="1" lineno="330" slineno="6-9"/>calendar quarter; and</amend><amendoutend style="2"/></subsection><subsection ssid="5-null-19" dnum="ii-o:_-i" numlevel="1" lineno="331" slineno="6-10" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1149" style="2" owner="o" level="1" deltag="start">(ii)</amend></display><amend anum="0" ea="erase" pairid="15" groupid="13" style="2" owner="jchristopherson" level="1" deltag="end">as simple interest at the rate of eighteen percentage points above the federal <ln numlevel="1" lineno="332" slineno="6-11"/>short-term rate.</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="5-null-20" dnum="c-o:_-i" numlevel="1" lineno="333" slineno="6-12" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1150" style="2" owner="o" level="1" deltag="start">(c)</amend></display><amend anum="0" ea="erase" pairid="18" groupid="15" style="2" owner="jchristopherson" level="1" deltag="end">If a special district charges interest on a past due fee collected by the special district, <ln numlevel="1" lineno="334" slineno="6-13"/>regardless of whether the fee is certified, the special district may charge the interest <ln numlevel="1" lineno="335" slineno="6-14"/>monthly but may not compound the interest more frequently than annually.</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="5-null-21" dnum="2-o" numlevel="1" lineno="336" slineno="6-15" level="1" space="false"><display>(2)</display><subsection ssid="5-null-22" dnum="a-o" level="2" placement="sameline"><display>(a)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="29" groupid="26" style="2" owner="jchristopherson" level="1" deltag="both">A </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="24" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">In pursuing payment on a past due fee or a past due charge, in addition to <ln numlevel="1" lineno="337" slineno="6-16"/>interest authorized under Subsection <xref depth="4" refnumber="17B-1-902.1(1)">(1)</xref>, a </amend>special district may <amend anum="0" ea="amend" pairid="25" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="both">also </amend>charge and collect <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="44" groupid="40" style="2" owner="jchristopherson" level="1" deltag="both"><ln numlevel="1" lineno="338" slineno="6-17"/>only one of the following:</amend><amendoutend style="2"/><subsection ssid="5-null-23" dnum="i-o:_-i" numlevel="1" lineno="339" slineno="6-18" ea="erase" anum="0" owner="jchristopherson" style="2" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1153" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/></display>a one-time penalty<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="30" groupid="27" style="2" owner="jchristopherson" level="1" deltag="both"> charge</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="26" groupid="23" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">,</amend> not to exceed 8% for a <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="43" groupid="39" style="2" owner="jchristopherson" level="1" deltag="both">past-due</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="42" groupid="38" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">past due</amend> fee<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="45" groupid="41" style="2" owner="jchristopherson" level="1" deltag="both">; or</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="59" groupid="51" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"> <ln numlevel="1" lineno="340" slineno="6-19"/>or past due charge, as an administrative cost.</amend></subsection><subsection ssid="5-null-24" dnum="ii-o:_-i" numlevel="1" lineno="341" slineno="6-20" ea="erase" anum="0" owner="jchristopherson" style="2" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1154" style="2" owner="o" level="1" deltag="start">(ii)</amend></display><amend anum="0" ea="erase" pairid="54" groupid="46" style="2" owner="jchristopherson" level="1" deltag="end">an administrative cost for some or all of the following:</amend><amendoutend style="2"/><subsection ssid="5-null-25" dnum="A-o:_-i" numlevel="1" lineno="342" slineno="6-21" ea="erase" anum="0" owner="jchristopherson" style="2" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1155" style="2" owner="o" level="1" deltag="start">(A)</amend></display><amend anum="0" ea="erase" pairid="55" groupid="47" style="2" owner="jchristopherson" level="1" deltag="end">the collection cost of a past due fee or charge;</amend><amendoutend style="2"/></subsection><subsection ssid="5-null-26" dnum="B-o:_-i" numlevel="1" lineno="343" slineno="6-22" ea="erase" anum="0" owner="jchristopherson" style="2" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1156" style="2" owner="o" level="1" deltag="start">(B)</amend></display><amend anum="0" ea="erase" pairid="57" groupid="49" style="2" owner="jchristopherson" level="1" deltag="end">reasonable attorney fees actually incurred for collection and foreclosure costs, <ln numlevel="1" lineno="344" slineno="6-23"/>if applicable;
