and</hl><hl numlevel="1" lineno="18" slineno="0-18" level="2">the voter may request to have the voter's signature removed from the candidate <ln numlevel="1" lineno="19" slineno="0-19"/>nomination petition by submitting a written statement to the election official <ln numlevel="1" lineno="20" slineno="0-20"/>requesting removal of the signature;</hl></hl><hl numlevel="1" lineno="21" slineno="0-21" level="1">requires an election official to make the website posting described above regardless of <ln numlevel="1" lineno="22" slineno="0-22"/>whether the voter's voter registration record is classified as a private record;</hl><hl numlevel="1" lineno="23" slineno="0-23" level="1">amends candidate nomination petition forms to include information notifying a voter of <ln numlevel="1" lineno="24" slineno="0-24"/>the posting and signature removal processes described above; </hl><hl numlevel="1" lineno="25" slineno="0-25" level="1">for a candidate seeking the nomination of a qualified political party to an elective office <ln numlevel="1" lineno="26" slineno="0-26"/>through signature gathering, shortens the deadline for the candidate to submit signatures <ln numlevel="1" lineno="27" slineno="0-27"/>to an election official from 14 to 21 days before the day on which the qualified political <ln numlevel="1" lineno="28" slineno="0-28"/>party holds a convention to nominate a candidate for the same elective office; Section <bold>20A-1-501</bold> is amended to read:</secline><catline lineno="50"><bold>20A-1-501<parens/>. Candidate vacancies -- Procedure for filling.</bold></catline><subsection ssid="15-null-1" dnum="1-o" numlevel="1" lineno="51" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>As used in this section, "central committee" means:<subsection ssid="15-null-2" dnum="a-o" numlevel="1" lineno="52" slineno="1-4" level="2"><display>(a)</display>the state central committee of a political party, for a candidate for:<subsection ssid="15-null-3" dnum="i-o" numlevel="1" lineno="53" slineno="1-5" level="3"><display>(i)</display>United States senator, United States representative, governor, lieutenant governor, <ln numlevel="1" lineno="54" slineno="1-6"/>attorney general, state treasurer, or state auditor; or</subsection><subsection ssid="15-null-4" dnum="ii-o" numlevel="1" lineno="55" slineno="1-7" level="3"><display>(ii)</display>state legislator if the legislative district encompasses all or a portion of more than <ln numlevel="1" lineno="56" slineno="1-8"/>one county; or</subsection></subsection><subsection ssid="15-null-5" dnum="b-o" numlevel="1" lineno="57" slineno="1-9" level="2"><display>(b)</display>the county central committee of a political party, for a party candidate seeking an <ln numlevel="1" lineno="58" slineno="1-10"/>office, other than an office described in Subsection <xref depth="4" refnumber="20A-1-501(1)(a)" start="0">(1)(a)</xref>, elected  at an election held <ln numlevel="1" lineno="59" slineno="1-11"/>in an even-numbered year.</subsection></subsection><subsection ssid="15-null-6" dnum="2-o" numlevel="1" lineno="60" slineno="1-12" level="1"><display>(2)</display>Except as provided in Subsection <xref depth="4" refnumber="20A-1-501(6)" start="0">(6)</xref>, the central committee may certify the name of <ln numlevel="1" lineno="61" slineno="1-13"/>another candidate to the appropriate election officer if:<subsection ssid="15-null-7" dnum="a-o" numlevel="1" lineno="62" slineno="1-14" level="2"><display>(a)</display>for a registered political party that will have a candidate on a ballot in a primary <ln numlevel="1" lineno="63" slineno="1-15"/>election:<subsection ssid="15-null-8" dnum="i-o" numlevel="1" lineno="64" slineno="1-16" level="3"><display>(i)</display>after the close of the period for filing a declaration of candidacy and continuing <ln numlevel="1" lineno="65" slineno="1-17"/>through the day before the day on which the lieutenant governor provides the list <ln numlevel="1" lineno="66" slineno="1-18"/>described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="5" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="20A-9-403(4)(a)" start="0">20A-9-403(4)(a)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="20A-9-403(8)(a)">20A-9-403(8)(a)</xref></amend>, only one or two <ln numlevel="1" lineno="67" slineno="1-19"/>candidates from that party have filed a declaration of candidacy for that office and <ln numlevel="1" lineno="68" slineno="1-20"/>one or both dies, resigns as a candidate, or is disqualified as a candidate; and</subsection><subsection ssid="15-null-9" dnum="ii-o" numlevel="1" lineno="69" slineno="1-21" level="3"><display>(ii)</display>the central committee provides written certification of the replacement candidate <ln numlevel="1" lineno="70" slineno="1-22"/>to the appropriate election officer before the day on which the lieutenant governor <ln numlevel="1" lineno="71" slineno="1-23"/>provides the list described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="6" groupid="6" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="20A-9-403(4)(a)" start="0">20A-9-403(4)(a)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="20A-9-403(8)(a)">20A-9-403(8)(a)</xref></amend>;</subsection></subsection><subsection ssid="15-null-10" dnum="b-o" numlevel="1" lineno="72" slineno="1-24" level="2"><display>(b)</display>for a registered political party that does not have a candidate on the ballot in a <ln numlevel="1" lineno="73" slineno="1-25"/>primary, but will have a candidate on the ballot for a regular general election:<subsection ssid="15-null-11" dnum="i-o" numlevel="1" lineno="74" slineno="1-26" level="3"><display>(i)</display>after the close of the period for filing a declaration of candidacy and continuing <ln numlevel="1" lineno="75" slineno="1-27"/>through the day before the day on which the lieutenant governor makes the <ln numlevel="1" lineno="76" slineno="1-28"/>certification described in Section <xref depth="3" refnumber="20A-5-409" start="0">20A-5-409</xref>, the party's candidate dies, resigns as <ln numlevel="1" lineno="77" slineno="1-29"/>a candidate, or is disqualified as a candidate; and</subsection><subsection ssid="15-null-12" dnum="ii-o" numlevel="1" lineno="78" slineno="1-30" level="3"><display>(ii)</display>the central committee provides written certification of the replacement candidate <ln numlevel="1" lineno="79" slineno="1-31"/>to the appropriate election officer before the day on which the lieutenant governor <ln numlevel="1" lineno="80" slineno="1-32"/>makes the certification described in Section <xref depth="3" refnumber="20A-5-409" start="0">20A-5-409</xref>; or</subsection></subsection><subsection ssid="15-null-13" dnum="c-o" numlevel="1" lineno="81" slineno="1-33" level="2"><display>(c)</display>for a registered political party with a candidate certified as winning a primary <ln numlevel="1" lineno="82" slineno="1-34"/>election:<subsection ssid="15-null-14" dnum="i-o" numlevel="1" lineno="83" slineno="1-35" level="3"><display>(i)</display>after the close of the period for filing a declaration of candidacy and continuing <ln numlevel="1" lineno="84" slineno="1-36"/>through the day before the  day on which the lieutenant governor makes the <ln numlevel="1" lineno="85" slineno="1-37"/>certification described in Section <xref depth="3" refnumber="20A-5-409" start="0">20A-5-409</xref>, the party's candidate dies, resigns as <ln numlevel="1" lineno="86" slineno="1-38"/>a candidate, or is disqualified as a candidate; and</subsection><subsection ssid="15-null-15" dnum="ii-o" numlevel="1" lineno="87" slineno="1-39" level="3"><display>(ii)</display>the central committee provides written certification of the replacement candidate <ln numlevel="1" lineno="88" slineno="1-40"/>to the appropriate election officer before the day on which the lieutenant governor <ln numlevel="1" lineno="89" slineno="1-41"/>makes the certification described in Section <xref depth="3" refnumber="20A-5-409" start="0">20A-5-409</xref>.</subsection></subsection></subsection><subsection ssid="15-null-16" dnum="3-o" numlevel="1" lineno="90" slineno="1-42" level="1"><display>(3)</display>If no more than two candidates from a political party have filed a declaration of <ln numlevel="1" lineno="91" slineno="1-43"/>candidacy for an office elected at a regular general election and one resigns to become <ln numlevel="1" lineno="92" slineno="1-44"/>the party candidate for another position, the central committee of that political party may <ln numlevel="1" lineno="93" slineno="1-45"/>certify the name of another candidate to the appropriate election officer.</subsection><subsection ssid="15-null-17" dnum="4-o" numlevel="1" lineno="94" slineno="1-46" level="1"><display>(4)</display>Each replacement candidate shall file a declaration of candidacy as required by Chapter <xref depth="2" refnumber="20A-9-2"><ln numlevel="1" lineno="95" slineno="1-47"/>9, Part 2</xref>, Candidate Qualifications and Declarations of Candidacy.</subsection><subsection ssid="15-null-18" dnum="5-o" numlevel="1" lineno="96" slineno="1-48" level="1" space="false"><display>(5)</display><subsection ssid="15-null-19" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The name of a candidate who is certified under Subsection <xref depth="4" refnumber="20A-1-501(2)(a)" start="0">(2)(a)</xref> after the <ln numlevel="1" lineno="97" slineno="1-49"/>deadline described in Subsection <xref depth="4" refnumber="20A-1-501(2)(a)(ii)" start="0">(2)(a)(ii)</xref> may not appear on the primary election <ln numlevel="1" lineno="98" slineno="1-50"/>ballot.</subsection><subsection ssid="15-null-20" dnum="b-o" numlevel="1" lineno="99" slineno="1-51" level="2"><display>(b)</display>The name of a candidate who is certified under Subsection <xref depth="4" refnumber="20A-1-501(2)(b)" start="0">(2)(b)</xref> after the deadline <ln numlevel="1" lineno="100" slineno="1-52"/>described in Subsection <xref depth="4" refnumber="20A-1-501(2)(b)(ii)" start="0">(2)(b)(ii)</xref> may not appear on the general election ballot.</subsection><subsection ssid="15-null-21" dnum="c-o" numlevel="1" lineno="101" slineno="1-53" level="2"><display>(c)</display>The name of a candidate who is certified under Subsection <xref depth="4" refnumber="20A-1-501(2)(c)" start="0">(2)(c)</xref> after the deadline <ln numlevel="1" lineno="102" slineno="1-54"/>described in Subsection <xref depth="4" refnumber="20A-1-501(2)(c)(ii)" start="0">(2)(c)(ii)</xref> may not appear on the general election ballot.</subsection></subsection><subsection ssid="15-null-22" dnum="6-o" numlevel="1" lineno="103" slineno="1-55" level="1"><display>(6)</display>A political party may not replace a candidate who is disqualified for failure to timely <ln numlevel="1" lineno="104" slineno="1-56"/>file a campaign disclosure financial report under Chapter 11, Campaign and Financial <ln numlevel="1" lineno="105" slineno="1-57"/>Reporting Requirements, or Section <xref depth="3" refnumber="17-70-403">17-70-403</xref>.</subsection><subsection ssid="15-null-23" dnum="7-o" numlevel="1" lineno="106" slineno="1-58" level="1"><display>(7)</display>This section does not apply to a candidate vacancy for a nonpartisan office.</subsection></section></bsec><bsec buid="2" num="20A-3a-106" type="amend" src="code" uid="C20A-3a-S106_2027010120270101" sort="20A03a01060020270101" numlevel="1" lineno="107" slineno="2-1" sn="2"><section number="20A-3a-106" numlevel="1" lineno="108" slineno="2-2" type="amend"><secline lineno="107">Section 2. Section <bold>20A-3a-106</bold> is amended to read:</secline><catline lineno="108"><bold>20A-3a-106<parens/>. Rulemaking authority relating to conducting an election.</bold></catline><sectionText lineno="109"><tab/>The director of elections, within the Office of the Lieutenant Governor, may make rules, <ln numlevel="1" lineno="110" slineno="2-4"/>in accordance with <xref depth="1" refnumber="63G-3" start="0">Title 63G, Chapter 3, Utah Administrative Rulemaking Act</xref>, establishing <ln numlevel="1" lineno="111" slineno="2-5"/>requirements for:</sectionText><subsection ssid="2-null-7" dnum="1-o" numlevel="1" lineno="112" slineno="2-6" level="1"><display>(1)</display>a return envelope, to ensure uniformity and security of the envelopes;</subsection><subsection ssid="2-null-8" dnum="2-o" numlevel="1" lineno="113" slineno="2-7" level="1"><display>(2)</display>complying with the signature comparison audit requirements described in Section <xref depth="3" refnumber="20A-3a-402.5" start="0"><ln numlevel="1" lineno="114" slineno="2-8"/>20A-3a-402.5</xref>;</subsection><subsection ssid="2-null-9" dnum="3-o" numlevel="1" lineno="115" slineno="2-9" level="1"><display>(3)</display>conducting and documenting the identity verification process described in Subsection <xref depth="4" refnumber="20A-3a-401(7)(b)" start="0"><ln numlevel="1" lineno="116" slineno="2-10"/>20A-3a-401(7)(b)</xref>; or</subsection><subsection ssid="2-null-10" dnum="4-o" numlevel="1" lineno="117" slineno="2-11" level="1"><display>(4)</display>establishing specific requirements and procedures for an election officer to:<subsection ssid="2-null-11" dnum="a-o" numlevel="1" lineno="118" slineno="2-12" level="2"><display>(a)</display>perform the signature comparison audits described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both">20A-9-408(9)(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="20A-9-408(9)(d)"><ln numlevel="1" lineno="119" slineno="2-13"/>20A-9-408(9)(d)</xref></amend>; or</subsection><subsection ssid="2-null-12" dnum="b-o" numlevel="1" lineno="120" slineno="2-14" level="2"><display>(b)</display>fulfill the chain of custody requirements described in Section <xref depth="3" refnumber="20A-9-408.3">20A-9-408.3</xref>.</subsection></subsection></section></bsec><bsec buid="3" num="20A-6-301" type="amend" src="code" uid="C20A-6-S301_2027010120270101" sort="20A06 03010020270101" numlevel="1" lineno="121" slineno="3-1" sn="3"><section number="20A-6-301" numlevel="1" lineno="122" slineno="3-2" type="amend"><secline lineno="121">Section 3. Section <bold>20A-6-301</bold> is amended to read:</secline><catline lineno="122"><bold>20A-6-301<parens/>. Manual ballots -- Regular general election.</bold></catline><subsection ssid="3-null-36" dnum="1-o" numlevel="1" lineno="123" slineno="3-3" level="1" placement="noreturn"><display>(1)</display>Each election officer shall ensure that:<subsection ssid="3-null-37" dnum="a-o" numlevel="1" lineno="124" slineno="3-4" level="2"><display>(a)</display>all manual ballots furnished for use at the regular general election contain:<subsection ssid="3-null-38" dnum="i-o" numlevel="1" lineno="125" slineno="3-5" level="3"><display>(i)</display>no captions or other endorsements except as provided in this section;</subsection><subsection ssid="3-null-39" dnum="ii-o" numlevel="1" lineno="126" slineno="3-6" level="3"><display>(ii)</display>no symbols, markings, or other descriptions of a political party or group, except <ln numlevel="1" lineno="127" slineno="3-7"/>for a registered political party that has chosen to nominate its candidates in <ln numlevel="1" lineno="128" slineno="3-8"/>accordance with Section <xref depth="3" refnumber="20A-9-403" start="0">20A-9-403</xref>; and</subsection><subsection ssid="3-null-40" dnum="iii-o" numlevel="1" lineno="129" slineno="3-9" level="3"><display>(iii)</display>no indication that a candidate for elective office has been nominated by, or has <ln numlevel="1" lineno="130" slineno="3-10"/>been endorsed by, or is in any way affiliated with a political party or group, unless <ln numlevel="1" lineno="131" slineno="3-11"/>the candidate has been nominated by a registered political party in accordance <ln numlevel="1" lineno="132" slineno="3-12"/>with Subsection <xref depth="4" refnumber="20A-9-202(4)" start="0">20A-9-202(4)</xref> or Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="20A-9-403(5)" start="0">20A-9-403(5)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref tempid="879">20A-9-403(9)</xref></amend>;</subsection></subsection><subsection ssid="3-null-41" dnum="b-o" numlevel="1" lineno="133" slineno="3-13" level="2"><display>(b)</display>at the top of the ballot, the following endorsements are printed in 18 point bold type:<subsection ssid="3-null-42" dnum="i-o" numlevel="1" lineno="134" slineno="3-14" level="3"><display>(i)</display>"Official Ballot for ____ County, Utah";</subsection><subsection ssid="3-null-43" dnum="ii-o" numlevel="1" lineno="135" slineno="3-15" level="3"><display>(ii)</display>the date of the election; and</subsection><subsection ssid="3-null-44" dnum="iii-o" numlevel="1" lineno="136" slineno="3-16" level="3"><display>(iii)</display>the words "certified by the Clerk of __________ County" or, as applicable, the <ln numlevel="1" lineno="137" slineno="3-17"/>name of a combined office that includes the duties of a county clerk; </subsection></subsection><subsection ssid="3-null-45" dnum="c-o" numlevel="1" lineno="138" slineno="3-18" level="2"><display>(c)</display>unaffiliated candidates, candidates not affiliated with a registered political party, and <ln numlevel="1" lineno="139" slineno="3-19"/>all other candidates for elective office who were not nominated by a registered <ln numlevel="1" lineno="140" slineno="3-20"/>political party in accordance with Subsection <xref depth="4" refnumber="20A-9-202(4)" start="0">20A-9-202(4)</xref> or Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="4" groupid="4" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="20A-9-403(5)" start="0"><ln numlevel="1" lineno="141" slineno="3-21"/>20A-9-403(5)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref tempid="922">20A-9-403(9)</xref></amend>, are listed with the other candidates for the same office <ln numlevel="1" lineno="142" slineno="3-22"/>in accordance with Sections <xref depth="3" refnumber="20A-6-109">20A-6-109</xref> and <xref depth="3" refnumber="20A-6-110">20A-6-110</xref>, without a party name or title;</subsection><subsection ssid="3-null-46" dnum="d-o" numlevel="1" lineno="143" slineno="3-23" level="2"><display>(d)</display>each ticket containing the lists of candidates, including the party name and device, <ln numlevel="1" lineno="144" slineno="3-24"/>are separated by heavy parallel lines;</subsection><subsection ssid="3-null-47" dnum="e-o" numlevel="1" lineno="145" slineno="3-25" level="2"><display>(e)</display>the offices to be filled are plainly printed immediately above the names of the <ln numlevel="1" lineno="146" slineno="3-26"/>candidates for those offices;</subsection><subsection ssid="3-null-48" dnum="f-o" numlevel="1" lineno="147" slineno="3-27" level="2"><display>(f)</display>the names of candidates are printed in capital letters, not less than one-eighth nor <ln numlevel="1" lineno="148" slineno="3-28"/>more than one-fourth of an inch high in heavy-faced type not smaller than 10 point, <ln numlevel="1" lineno="149" slineno="3-29"/>between lines or rules three-eighths of an inch apart; and</subsection><subsection ssid="3-null-49" dnum="g-o" numlevel="1" lineno="150" slineno="3-30" level="2"><display>(g)</display>on a ticket for a race in which a voter is authorized to cast a write-in vote and in <ln numlevel="1" lineno="151" slineno="3-31"/>which a write-in candidate is qualified under Section <xref depth="3" refnumber="20A-9-601" start="0">20A-9-601</xref>:<subsection ssid="3-null-50" dnum="i-o" numlevel="1" lineno="152" slineno="3-32" level="3"><display>(i)</display>the ballot includes a space for a write-in candidate immediately following the last <ln numlevel="1" lineno="153" slineno="3-33"/>candidate listed on that ticket; or</subsection><subsection ssid="3-null-51" dnum="ii-o" numlevel="1" lineno="154" slineno="3-34" level="3"><display>(ii)</display>for the offices of president and vice president and governor and lieutenant <ln numlevel="1" lineno="155" slineno="3-35"/>governor, the ballot includes two spaces for write-in candidates immediately <ln numlevel="1" lineno="156" slineno="3-36"/>following the last candidates on that ticket, one placed above the other, to enable <ln numlevel="1" lineno="157" slineno="3-37"/>the entry of two valid write-in candidates.</subsection></subsection></subsection><subsection ssid="3-null-52" dnum="2-o" numlevel="1" lineno="158" slineno="3-38" level="1"><display>(2)</display>An election officer shall ensure that:<subsection ssid="3-null-53" dnum="a-o" numlevel="1" lineno="159" slineno="3-39" level="2"><display>(a)</display>each individual nominated by any registered political party under Subsection <xref depth="4" refnumber="20A-9-202(4)" start="0"><ln numlevel="1" lineno="160" slineno="3-40"/>20A-9-202(4)</xref> or Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">20A-9-403(5)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="8" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="20A-9-403(9)">20A-9-403(9)</xref></amend>, and no other individual, is <ln numlevel="1" lineno="161" slineno="3-41"/>placed on the ballot:<subsection ssid="3-null-54" dnum="i-o" numlevel="1" lineno="162" slineno="3-42" level="3"><display>(i)</display>under the registered political party's name, if any; or</subsection><subsection ssid="3-null-55" dnum="ii-o" numlevel="1" lineno="163" slineno="3-43" level="3"><display>(ii)</display>under the title of the registered political party as designated by them in their <ln numlevel="1" lineno="164" slineno="3-44"/>certificates of nomination or petition, or, if none is designated, then under some <ln numlevel="1" lineno="165" slineno="3-45"/>suitable title;</subsection></subsection><subsection ssid="3-null-56" dnum="b-o" numlevel="1" lineno="166" slineno="3-46" level="2"><display>(b)</display>the names of all unaffiliated candidates that qualify as required in <xref depth="2" refnumber="20A-9-5" start="1">Chapter 9, Part 5, <ln numlevel="1" lineno="167" slineno="3-47"/>Candidates not Affiliated with a Party</xref>, are placed on the ballot;</subsection><subsection ssid="3-null-57" dnum="c-o" numlevel="1" lineno="168" slineno="3-48" level="2"><display>(c)</display>the names of the candidates for president and vice president are used on the ballot <ln numlevel="1" lineno="169" slineno="3-49"/>instead of the names of the presidential electors; and</subsection><subsection ssid="3-null-58" dnum="d-o" numlevel="1" lineno="170" slineno="3-50" level="2"><display>(d)</display>the ballots contain no other names.</subsection></subsection><subsection ssid="3-null-59" dnum="3-o" numlevel="1" lineno="171" slineno="3-51" level="1"><display>(3)</display>When the ballot contains a nonpartisan section, the election officer shall ensure that:<subsection ssid="3-null-60" dnum="a-o" numlevel="1" lineno="172" slineno="3-52" level="2"><display>(a)</display>the designation of the office to be filled in the election and the number of candidates <ln numlevel="1" lineno="173" slineno="3-53"/>to be elected are printed in type not smaller than eight point;</subsection><subsection ssid="3-null-61" dnum="b-o" numlevel="1" lineno="174" slineno="3-54" level="2"><display>(b)</display>the words designating the office are printed flush with the left-hand margin;</subsection><subsection ssid="3-null-62" dnum="c-o" numlevel="1" lineno="175" slineno="3-55" level="2"><display>(c)</display>the words, "Vote for one" or "Vote for up to _____ (the number of candidates for <ln numlevel="1" lineno="176" slineno="3-56"/>which the voter may vote)" extend to the extreme right of the column;</subsection><subsection ssid="3-null-63" dnum="d-o" numlevel="1" lineno="177" slineno="3-57" level="2"><display>(d)</display>the nonpartisan candidates are grouped according to the office for which they are <ln numlevel="1" lineno="178" slineno="3-58"/>candidates;</subsection><subsection ssid="3-null-64" dnum="e-o" numlevel="1" lineno="179" slineno="3-59" level="2"><display>(e)</display>the names in each group are placed in accordance with Sections <xref depth="3" refnumber="20A-6-109">20A-6-109</xref> and <xref depth="3" refnumber="20A-6-110"><ln numlevel="1" lineno="180" slineno="3-60"/>20A-6-110</xref>, with the surnames last; and</subsection><subsection ssid="3-null-65" dnum="f-o" numlevel="1" lineno="181" slineno="3-61" level="2"><display>(f)</display>each group is preceded by the designation of the office for which the candidates seek <ln numlevel="1" lineno="182" slineno="3-62"/>election, and the words, "Vote for one" or "Vote for up to _____ (the number of <ln numlevel="1" lineno="183" slineno="3-63"/>candidates for which the voter may vote)," according to the number to be elected.</subsection></subsection><subsection ssid="3-null-66" dnum="4-o" numlevel="1" lineno="184" slineno="3-64" level="1"><display>(4)</display>Each election officer shall ensure that:<subsection ssid="3-null-67" dnum="a-o" numlevel="1" lineno="185" slineno="3-65" level="2"><display>(a)</display>proposed amendments to the Utah Constitution are listed on the ballot in accordance <ln numlevel="1" lineno="186" slineno="3-66"/>with Section <xref depth="3" refnumber="20A-6-107" start="0">20A-6-107</xref>;</subsection><subsection ssid="3-null-68" dnum="b-o" numlevel="1" lineno="187" slineno="3-67" level="2"><display>(b)</display>ballot propositions submitted to the voters are listed on the ballot in accordance with <ln numlevel="1" lineno="188" slineno="3-68"/>Section <xref depth="3" refnumber="20A-6-107" start="0">20A-6-107</xref>;</subsection><subsection ssid="3-null-69" dnum="c-o" numlevel="1" lineno="189" slineno="3-69" level="2"><display>(c)</display>bond propositions that have qualified for the ballot are listed on the ballot under the <ln numlevel="1" lineno="190" slineno="3-70"/>title assigned to each bond proposition under Section <xref depth="3" refnumber="11-14-206" start="0">11-14-206</xref>; and</subsection><subsection ssid="3-null-70" dnum="d-o" numlevel="1" lineno="191" slineno="3-71" level="2"><display>(d)</display>the judicial retention section of the ballot includes a statement at the beginning <ln numlevel="1" lineno="192" slineno="3-72"/>directing voters to the Judicial Performance Evaluation Commission's website in <ln numlevel="1" lineno="193" slineno="3-73"/>accordance with Subsection <xref depth="4" refnumber="20A-12-201(4)" start="0">20A-12-201(4)</xref>.</subsection></subsection></section></bsec><bsec buid="4" num="20A-6-302" type="amend" src="code" uid="C20A-6-S302_2027010120270101" sort="20A06 03020020270101" numlevel="1" lineno="194" slineno="4-1" sn="4"><section number="20A-6-302" numlevel="1" lineno="195" slineno="4-2" type="amend"><secline lineno="194">Section 4. Section <bold>20A-6-302</bold> is amended to read:</secline><catline lineno="195"><bold>20A-6-302<parens/>. Manual ballots -- Placement of candidates' names.</bold></catline><subsection ssid="4-null-25" dnum="1-o" numlevel="1" lineno="196" slineno="4-3" level="1" placement="noreturn"><display>(1)</display>An election officer shall ensure, for manual ballots in regular general elections, that:<subsection ssid="4-null-26" dnum="a-o" numlevel="1" lineno="197" slineno="4-4" level="2"><display>(a)</display>each candidate is listed by party, if nominated by a registered political party under <ln numlevel="1" lineno="198" slineno="4-5"/>Subsection <xref depth="4" refnumber="20A-9-202(4)" start="0">20A-9-202(4)</xref> or Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both">20A-9-403(5)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="20A-9-403(9)">20A-9-403(9)</xref></amend>;</subsection><subsection ssid="4-null-27" dnum="b-o" numlevel="1" lineno="199" slineno="4-6" level="2"><display>(b)</display>candidates' surnames are listed in alphabetical order on the ballots when two or more <ln numlevel="1" lineno="200" slineno="4-7"/>candidates' names are required to be listed on a ticket under the title of an office; and</subsection><subsection ssid="4-null-28" dnum="c-o" numlevel="1" lineno="201" slineno="4-8" level="2"><display>(c)</display>the names of candidates are placed on the ballot in:<subsection ssid="4-null-29" dnum="i-o" numlevel="1" lineno="202" slineno="4-9" level="3"><display>(i)</display>the manner described in Section <xref depth="3" refnumber="20A-6-109">20A-6-109</xref>; and</subsection><subsection ssid="4-null-30" dnum="ii-o" numlevel="1" lineno="203" slineno="4-10" level="3"><display>(ii)</display>the order described in Section <xref depth="3" refnumber="20A-6-110">20A-6-110</xref>.</subsection></subsection></subsection><subsection ssid="4-null-31" dnum="2-o" numlevel="1" lineno="204" slineno="4-11" level="1" space="false"><display>(2)</display><subsection ssid="4-null-32" dnum="a-o" level="2" placement="sameline"><display>(a)</display>When there is only one candidate for county attorney at the regular general <ln numlevel="1" lineno="205" slineno="4-12"/>election in counties that have three or fewer registered voters of the county who are <ln numlevel="1" lineno="206" slineno="4-13"/>licensed active members in good standing of the Utah State Bar, the county clerk <ln numlevel="1" lineno="207" slineno="4-14"/>shall cause that candidate's name and party affiliation, if any, to be placed on a <ln numlevel="1" lineno="208" slineno="4-15"/>separate section of the ballot with the following question: "Shall (name of candidate) <ln numlevel="1" lineno="209" slineno="4-16"/>be elected to the office of county attorney? Yes ____ No ____.".</subsection><subsection ssid="4-null-33" dnum="b-o" numlevel="1" lineno="210" slineno="4-17" level="2"><display>(b)</display>If the number of "Yes" votes exceeds the number of "No" votes, the candidate is <ln numlevel="1" lineno="211" slineno="4-18"/>elected to the office of county attorney.</subsection><subsection ssid="4-null-34" dnum="c-o" numlevel="1" lineno="212" slineno="4-19" level="2"><display>(c)</display>If the number of "No" votes exceeds the number of "Yes" votes, the candidate is not <ln numlevel="1" lineno="213" slineno="4-20"/>elected and may not take office, nor may the candidate continue in the office past the <ln numlevel="1" lineno="214" slineno="4-21"/>end of the term resulting from any prior election or appointment.</subsection><subsection ssid="4-null-35" dnum="d-o" numlevel="1" lineno="215" slineno="4-22" level="2"><display>(d)</display>When the name of only one candidate for county attorney is printed on the ballot <ln numlevel="1" lineno="216" slineno="4-23"/>under authority of this Subsection <xref depth="4" refnumber="20A-6-302(2)" start="0">(2)</xref>, the county clerk may not count any write-in <ln numlevel="1" lineno="217" slineno="4-24"/>votes received for the office of county attorney.</subsection><subsection ssid="4-null-36" dnum="e-o" numlevel="1" lineno="218" slineno="4-25" level="2"><display>(e)</display>If no qualified individual files for the office of county attorney or if the candidate is <ln numlevel="1" lineno="219" slineno="4-26"/>not elected by the voters, the county legislative body shall appoint the county <ln numlevel="1" lineno="220" slineno="4-27"/>attorney as provided in Section <xref depth="3" refnumber="20A-1-509.2" start="0">20A-1-509.2</xref>.</subsection><subsection ssid="4-null-37" dnum="f-o" numlevel="1" lineno="221" slineno="4-28" level="2"><display>(f)</display>If the candidate whose name would, except for this Subsection <xref depth="4" refnumber="20A-6-302(2)(f)" start="0">(2)(f)</xref>, be placed on <ln numlevel="1" lineno="222" slineno="4-29"/>the ballot under Subsection <xref depth="4" refnumber="20A-6-302(2)(a)" start="0">(2)(a)</xref> has been elected on a ballot under Subsection <xref depth="4" refnumber="20A-6-302(2)(a)" start="0">(2)(a)</xref> <ln numlevel="1" lineno="223" slineno="4-30"/>to the two consecutive terms immediately preceding the term for which the candidate <ln numlevel="1" lineno="224" slineno="4-31"/>is seeking election, Subsection <xref depth="4" refnumber="20A-6-302(2)(a)" start="0">(2)(a)</xref> does not apply and that candidate shall be <ln numlevel="1" lineno="225" slineno="4-32"/>considered to be an unopposed candidate the same as any other unopposed candidate <ln numlevel="1" lineno="226" slineno="4-33"/>for another office, unless a petition is filed with the county clerk before 5 p.m. no <ln numlevel="1" lineno="227" slineno="4-34"/>later than the day before that year's primary election that:<subsection ssid="4-null-38" dnum="i-o" numlevel="1" lineno="228" slineno="4-35" level="3"><display>(i)</display>requests the procedure set forth in Subsection <xref depth="4" refnumber="20A-6-302(2)(a)" start="0">(2)(a)</xref> to be followed; and</subsection><subsection ssid="4-null-39" dnum="ii-o" numlevel="1" lineno="229" slineno="4-36" level="3"><display>(ii)</display>contains the signatures of registered voters in the county representing in number <ln numlevel="1" lineno="230" slineno="4-37"/>at least 25% of all votes cast in the county for all candidates for governor at the <ln numlevel="1" lineno="231" slineno="4-38"/>last election at which a governor was elected.</subsection></subsection></subsection><subsection ssid="4-null-40" dnum="3-o" numlevel="1" lineno="232" slineno="4-39" level="1" space="false"><display>(3)</display><subsection ssid="4-null-41" dnum="a-o" level="2" placement="sameline"><display>(a)</display>When there is only one candidate for district attorney at the regular general <ln numlevel="1" lineno="233" slineno="4-40"/>election in a prosecution district that has three or fewer registered voters of the <ln numlevel="1" lineno="234" slineno="4-41"/>district who are licensed active members in good standing of the Utah State Bar, the <ln numlevel="1" lineno="235" slineno="4-42"/>county clerk shall cause that candidate's name and party affiliation, if any, to be <ln numlevel="1" lineno="236" slineno="4-43"/>placed on a separate section of the ballot with the following question: "Shall (name of <ln numlevel="1" lineno="237" slineno="4-44"/>candidate) be elected to the office of district attorney? Yes ____ No ____.".</subsection><subsection ssid="4-null-42" dnum="b-o" numlevel="1" lineno="238" slineno="4-45" level="2"><display>(b)</display>If the number of "Yes" votes exceeds the number of "No" votes, the candidate is <ln numlevel="1" lineno="239" slineno="4-46"/>elected to the office of district attorney.</subsection><subsection ssid="4-null-43" dnum="c-o" numlevel="1" lineno="240" slineno="4-47" level="2"><display>(c)</display>If the number of "No" votes exceeds the number of "Yes" votes, the candidate is not <ln numlevel="1" lineno="241" slineno="4-48"/>elected and may not take office, nor may the candidate continue in the office past the <ln numlevel="1" lineno="242" slineno="4-49"/>end of the term resulting from any prior election or appointment.</subsection><subsection ssid="4-null-44" dnum="d-o" numlevel="1" lineno="243" slineno="4-50" level="2"><display>(d)</display>When the name of only one candidate for district attorney is printed on the ballot <ln numlevel="1" lineno="244" slineno="4-51"/>under authority of this Subsection <xref depth="4" refnumber="20A-6-302(3)" start="0">(3)</xref>, the county clerk may not count any write-in <ln numlevel="1" lineno="245" slineno="4-52"/>votes received for the office of district attorney.</subsection><subsection ssid="4-null-45" dnum="e-o" numlevel="1" lineno="246" slineno="4-53" level="2"><display>(e)</display>If no qualified individual files for the office of district attorney, or if the only <ln numlevel="1" lineno="247" slineno="4-54"/>candidate is not elected by the voters under this subsection, the county legislative <ln numlevel="1" lineno="248" slineno="4-55"/>body shall appoint a new district attorney for a four-year term as provided in Section <xref depth="3" refnumber="20A-1-509.2" start="0"><ln numlevel="1" lineno="249" slineno="4-56"/>20A-1-509.2</xref>.</subsection><subsection ssid="4-null-46" dnum="f-o" numlevel="1" lineno="250" slineno="4-57" level="2"><display>(f)</display>If the candidate whose name would, except for this Subsection <xref depth="4" refnumber="20A-6-302(3)(f)" start="0">(3)(f)</xref>, be placed on <ln numlevel="1" lineno="251" slineno="4-58"/>the ballot under Subsection <xref depth="4" refnumber="20A-6-302(3)(a)" start="0">(3)(a)</xref> has been elected on a ballot under Subsection <xref depth="4" refnumber="20A-6-302(3)(a)" start="0">(3)(a)</xref> <ln numlevel="1" lineno="252" slineno="4-59"/>to the two consecutive terms immediately preceding the term for which the candidate <ln numlevel="1" lineno="253" slineno="4-60"/>is seeking election, Subsection <xref depth="4" refnumber="20A-6-302(3)(a)" start="0">(3)(a)</xref> does not apply and that candidate shall be <ln numlevel="1" lineno="254" slineno="4-61"/>considered to be an unopposed candidate the same as any other unopposed candidate <ln numlevel="1" lineno="255" slineno="4-62"/>for another office, unless a petition is filed with the county clerk before 5 p.m. no <ln numlevel="1" lineno="256" slineno="4-63"/>later than the day before that year's primary election that:<subsection ssid="4-null-47" dnum="i-o" numlevel="1" lineno="257" slineno="4-64" level="3"><display>(i)</display>requests the procedure set forth in Subsection <xref depth="4" refnumber="20A-6-302(3)(a)" start="0">(3)(a)</xref> to be followed; and</subsection><subsection ssid="4-null-48" dnum="ii-o" numlevel="1" lineno="258" slineno="4-65" level="3"><display>(ii)</display>contains the signatures of registered voters in the county representing in number <ln numlevel="1" lineno="259" slineno="4-66"/>at least 25% of all votes cast in the county for all candidates for governor at the <ln numlevel="1" lineno="260" slineno="4-67"/>last election at which a governor was elected.</subsection></subsection></subsection></section></bsec><bsec buid="5" num="20A-6-304" type="amend" src="code" uid="C20A-6-S304_2027010120270101" sort="20A06 03040020270101" numlevel="1" lineno="261" slineno="5-1" sn="5"><section number="20A-6-304" numlevel="1" lineno="262" slineno="5-2" type="amend"><secline lineno="261">Section 5. Section <bold>20A-6-304</bold> is amended to read:</secline><catline lineno="262"><bold>20A-6-304<parens/>. Regular general election -- Mechanical ballots.</bold></catline><subsection ssid="5-null-15" dnum="1-o" numlevel="1" lineno="263" slineno="5-3" level="1" placement="noreturn"><display>(1)</display>Each election officer shall ensure that:<subsection ssid="5-null-16" dnum="a-o" numlevel="1" lineno="264" slineno="5-4" level="2"><display>(a)</display>the format and content of a mechanical ballot is arranged in approximately the same <ln numlevel="1" lineno="265" slineno="5-5"/>order as manual ballots;</subsection><subsection ssid="5-null-17" dnum="b-o" numlevel="1" lineno="266" slineno="5-6" level="2"><display>(b)</display>the titles of offices and the names of candidates are displayed in vertical columns or <ln numlevel="1" lineno="267" slineno="5-7"/>in a series of separate displays;</subsection><subsection ssid="5-null-18" dnum="c-o" numlevel="1" lineno="268" slineno="5-8" level="2"><display>(c)</display>the mechanical ballot is of sufficient length to include, after the list of candidates:<subsection ssid="5-null-19" dnum="i-o" numlevel="1" lineno="269" slineno="5-9" level="3"><display>(i)</display>the names of candidates for judicial offices and any other nonpartisan offices; and</subsection><subsection ssid="5-null-20" dnum="ii-o" numlevel="1" lineno="270" slineno="5-10" level="3"><display>(ii)</display>any ballot propositions submitted to the voters for their approval or rejection;</subsection></subsection><subsection ssid="5-null-21" dnum="d-o" numlevel="1" lineno="271" slineno="5-11" level="2"><display>(d)</display>the office titles are displayed above or at the side of the names of candidates so as to <ln numlevel="1" lineno="272" slineno="5-12"/>indicate clearly the candidates for each office and the number to be elected;</subsection><subsection ssid="5-null-22" dnum="e-o" numlevel="1" lineno="273" slineno="5-13" level="2"><display>(e)</display>the party designation of each candidate who has been nominated by a registered <ln numlevel="1" lineno="274" slineno="5-14"/>political party under Subsection <xref depth="4" refnumber="20A-9-202(4)" start="0">20A-9-202(4)</xref> or Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both">20A-9-403(5)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="20A-9-403(9)"><ln numlevel="1" lineno="275" slineno="5-15"/>20A-9-403(9)</xref></amend> is displayed adjacent to the candidate's name; and</subsection><subsection ssid="5-null-23" dnum="f-o" numlevel="1" lineno="276" slineno="5-16" level="2"><display>(f)</display>if possible, all candidates for one office are grouped in one column or upon one <ln numlevel="1" lineno="277" slineno="5-17"/>display screen.</subsection></subsection><subsection ssid="5-null-24" dnum="2-o" numlevel="1" lineno="278" slineno="5-18" level="1"><display>(2)</display>Each election officer shall ensure that:<subsection ssid="5-null-25" dnum="a-o" numlevel="1" lineno="279" slineno="5-19" level="2"><display>(a)</display>proposed amendments to the Utah Constitution are displayed in accordance with <ln numlevel="1" lineno="280" slineno="5-20"/>Section <xref depth="3" refnumber="20A-6-107" start="0">20A-6-107</xref>;</subsection><subsection ssid="5-null-26" dnum="b-o" numlevel="1" lineno="281" slineno="5-21" level="2"><display>(b)</display>ballot propositions submitted to the voters are displayed in accordance with Section <xref depth="3" refnumber="20A-6-107" start="0"><ln numlevel="1" lineno="282" slineno="5-22"/>20A-6-107</xref>;</subsection><subsection ssid="5-null-27" dnum="c-o" numlevel="1" lineno="283" slineno="5-23" level="2"><display>(c)</display>bond propositions that have qualified for the ballot are displayed under the title <ln numlevel="1" lineno="284" slineno="5-24"/>assigned to each bond proposition under Section <xref depth="3" refnumber="11-14-206" start="0">11-14-206</xref>; and</subsection><subsection ssid="5-null-28" dnum="d-o" numlevel="1" lineno="285" slineno="5-25" level="2"><display>(d)</display>the judicial retention section of the ballot includes a statement at the beginning <ln numlevel="1" lineno="286" slineno="5-26"/>directing voters to the Judicial Performance Evaluation Commission's website in <ln numlevel="1" lineno="287" slineno="5-27"/>accordance with Subsection <xref depth="4" refnumber="20A-12-201(4)" start="0">20A-12-201(4)</xref>.</subsection></subsection></section></bsec><bsec buid="6" num="20A-9-403" type="amend" src="code" uid="C20A-9-S403_2027010120270101" sort="20A09 04030020270101" numlevel="1" lineno="288" slineno="6-1" sn="6"><section number="20A-9-403" numlevel="1" lineno="289" slineno="6-2" type="amend"><secline lineno="288">Section 6. Section <bold>20A-9-403</bold> is amended to read:</secline><catline lineno="289"><bold>20A-9-403<parens/>. Regular primary elections.</bold></catline><subsection ssid="6-null-72" dnum="1-o" numlevel="1" lineno="290" slineno="6-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="6-null-73" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Candidates for elective office that are to be filled at the next regular general <ln numlevel="1" lineno="291" slineno="6-4"/>election shall be nominated in a regular primary election by direct vote of the people <ln numlevel="1" lineno="292" slineno="6-5"/>in the manner prescribed in this section.  The regular primary election is held on the <ln numlevel="1" lineno="293" slineno="6-6"/>date specified in Section <xref depth="3" refnumber="20A-1-201.5">20A-1-201.5</xref>.  Nothing in this section shall affect a <ln numlevel="1" lineno="294" slineno="6-7"/>candidate's ability to qualify for a regular general election's ballot as an unaffiliated <ln numlevel="1" lineno="295" slineno="6-8"/>candidate under Section <xref depth="3" refnumber="20A-9-501">20A-9-501</xref> or to participate in a regular general election as a <ln numlevel="1" lineno="296" slineno="6-9"/>write-in candidate under Section <xref depth="3" refnumber="20A-9-601">20A-9-601</xref>.</subsection><subsection ssid="6-null-74" dnum="b-o" numlevel="1" lineno="297" slineno="6-10" level="2"><display>(b)</display>Each registered political party that chooses to have the names of the registered <ln numlevel="1" lineno="298" slineno="6-11"/>political party's candidates for elective office featured with party affiliation on the <ln numlevel="1" lineno="299" slineno="6-12"/>ballot at a regular general election shall comply with the requirements of this section <ln numlevel="1" lineno="300" slineno="6-13"/>and shall nominate the registered political party's candidates for elective office in the <ln numlevel="1" lineno="301" slineno="6-14"/>manner described in this section.</subsection><subsection ssid="6-null-75" dnum="c-o" numlevel="1" lineno="302" slineno="6-15" level="2"><display>(c)</display>A filing officer may not permit an official ballot at a regular general election to be <ln numlevel="1" lineno="303" slineno="6-16"/>produced or used if the ballot denotes affiliation between a registered political party <ln numlevel="1" lineno="304" slineno="6-17"/>or any other political group and a candidate for elective office who is not nominated <ln numlevel="1" lineno="305" slineno="6-18"/>in the manner prescribed in this section or in Subsection <xref depth="4" refnumber="20A-9-202(4)">20A-9-202(4)</xref>.</subsection><subsection ssid="6-null-76" dnum="d-o" numlevel="1" lineno="306" slineno="6-19" level="2"><display>(d)</display>Unless noted otherwise, the dates in this section refer to those that occur in each <ln numlevel="1" lineno="307" slineno="6-20"/>even-numbered year in which a regular general election will be held.</subsection></subsection><subsection ssid="6-null-77" dnum="2-o" numlevel="1" lineno="308" slineno="6-21" level="1" space="false"><display>(2)</display><subsection ssid="6-null-78" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Each registered political party, in a statement filed with the lieutenant governor, <ln numlevel="1" lineno="309" slineno="6-22"/>shall:<subsection ssid="6-null-79" dnum="i-o" numlevel="1" lineno="310" slineno="6-23" level="3" tab="1"><display>(i)</display>either declare the registered political party's intent to participate in the next regular <ln numlevel="1" lineno="311" slineno="6-24"/>primary election or declare that the registered political party chooses not to have <ln numlevel="1" lineno="312" slineno="6-25"/>the names of the registered political party's candidates for elective office featured <ln numlevel="1" lineno="313" slineno="6-26"/>on the ballot at the next regular general election; and</subsection><subsection ssid="6-null-80" dnum="ii-o" numlevel="1" lineno="314" slineno="6-27" level="3" tab="1"><display>(ii)</display>if the registered political party participates in the upcoming regular primary <ln numlevel="1" lineno="315" slineno="6-28"/>election, identify one or more registered political parties whose members may <ln numlevel="1" lineno="316" slineno="6-29"/>vote for the registered political party's candidates and whether individuals <ln numlevel="1" lineno="317" slineno="6-30"/>identified as unaffiliated with a political party may vote for the registered political <ln numlevel="1" lineno="318" slineno="6-31"/>party's candidates.</subsection></subsection><subsection ssid="6-null-81" dnum="b-o" numlevel="1" lineno="319" slineno="6-32" level="2" space="false"><display>(b)</display><subsection ssid="6-null-82" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A registered political party that is a continuing political party shall file the <ln numlevel="1" lineno="320" slineno="6-33"/>statement described in Subsection <xref depth="4" refnumber="20A-9-403(2)(a)">(2)(a)</xref> with the lieutenant governor no later than <ln numlevel="1" lineno="321" slineno="6-34"/>5 p.m. on November 30 of each odd-numbered year.</subsection><subsection ssid="6-null-83" dnum="ii-o" numlevel="1" lineno="322" slineno="6-35" level="3"><display>(ii)</display>An organization that is seeking to become a registered political party under <ln numlevel="1" lineno="323" slineno="6-36"/>Section <xref depth="3" refnumber="20A-8-103">20A-8-103</xref> shall file the statement described in Subsection <xref depth="4" refnumber="20A-9-403(2)(a)">(2)(a)</xref> at the <ln numlevel="1" lineno="324" slineno="6-37"/>time that the registered political party files the petition described in Section <xref depth="3" refnumber="20A-8-103"><ln numlevel="1" lineno="325" slineno="6-38"/>20A-8-103</xref>.</subsection></subsection></subsection><subsection ssid="6-null-84" dnum="3-o" numlevel="1" lineno="326" slineno="6-39" level="1" space="false"><display>(3)</display><subsection ssid="6-null-85" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="103" groupid="86" style="2" owner="jchristopherson" level="1" deltag="both">(3)(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="101" groupid="84" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="20A-9-403(5)">(5)</xref></amend>, an individual who submits a <ln numlevel="1" lineno="327" slineno="6-40"/>declaration of candidacy under Section <xref depth="3" refnumber="20A-9-202">20A-9-202</xref> shall appear as a candidate for <ln numlevel="1" lineno="328" slineno="6-41"/>elective office on the regular primary ballot of the registered political party listed on <ln numlevel="1" lineno="329" slineno="6-42"/>the declaration of candidacy only if the individual is certified by the appropriate <ln numlevel="1" lineno="330" slineno="6-43"/>filing officer as having submitted a nomination petition that was:<subsection ssid="6-null-86" dnum="i-o" numlevel="1" lineno="331" slineno="6-44" level="3" tab="1"><display>(i)</display>circulated and completed in accordance with Section <xref depth="3" refnumber="20A-9-405">20A-9-405</xref>; and</subsection><subsection ssid="6-null-87" dnum="ii-o" numlevel="1" lineno="332" slineno="6-45" level="3" tab="1"><display>(ii)</display>signed by at least 2% of the registered political party's members who reside in the <ln numlevel="1" lineno="333" slineno="6-46"/>political division of the office that the individual seeks.</subsection></subsection><subsection ssid="6-null-88" dnum="b-o" numlevel="1" lineno="334" slineno="6-47" level="2" space="false"><display>(b)</display><subsection ssid="6-null-89" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A candidate for elective office shall, in accordance with Section <xref depth="3" refnumber="20A-9-408.3">20A-9-408.3</xref>, <ln numlevel="1" lineno="335" slineno="6-48"/>submit signatures for a nomination petition to the appropriate filing officer for <ln numlevel="1" lineno="336" slineno="6-49"/>verification and certification no later than 5 p.m. on March 31.</subsection><subsection ssid="6-null-90" dnum="ii-o" numlevel="1" lineno="337" slineno="6-50" level="3"><display>(ii)</display>A candidate may supplement the candidate's submissions at any time on or before <ln numlevel="1" lineno="338" slineno="6-51"/>the filing deadline.</subsection></subsection><subsection ssid="6-null-91" dnum="c-o" numlevel="1" lineno="339" slineno="6-52" level="2" space="false"><display>(c)</display><subsection ssid="6-null-92" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The lieutenant governor shall determine for each elective office the total <ln numlevel="1" lineno="340" slineno="6-53"/>number of signatures that must be submitted under Subsection <xref depth="4" refnumber="20A-9-403(3)(a)(ii)">(3)(a)(ii)</xref> or <xref depth="4" refnumber="20A-9-408(8)"><ln numlevel="1" lineno="341" slineno="6-54"/>20A-9-408(8)</xref> by counting the aggregate number of individuals residing in each <ln numlevel="1" lineno="342" slineno="6-55"/>elective office's political division who have designated a particular registered <ln numlevel="1" lineno="343" slineno="6-56"/>political party on the individuals' voter registration forms on or before November <ln numlevel="1" lineno="344" slineno="6-57"/>15 of each odd-numbered year.</subsection><subsection ssid="6-null-93" dnum="ii-o" numlevel="1" lineno="345" slineno="6-58" level="3"><display>(ii)</display>The lieutenant governor shall publish the determination for each elective office <ln numlevel="1" lineno="346" slineno="6-59"/>no later than November 30 of each odd-numbered year.</subsection></subsection><subsection ssid="6-null-94" dnum="d-o" numlevel="1" lineno="347" slineno="6-60" level="2"><display>(d)</display>The filing officer shall:<subsection ssid="6-null-95" dnum="i-o" numlevel="1" lineno="348" slineno="6-61" level="3"><display>(i)</display>except as otherwise provided in Section <xref depth="3" refnumber="20A-21-201">20A-21-201</xref>, and in accordance with <ln numlevel="1" lineno="349" slineno="6-62"/>Section <xref depth="3" refnumber="20A-9-408.3">20A-9-408.3</xref>, verify signatures on nomination petitions in a transparent <ln numlevel="1" lineno="350" slineno="6-63"/>and orderly manner, no later than 14 calendar days after the day on which a <ln numlevel="1" lineno="351" slineno="6-64"/>candidate submits the signatures to the filing officer;</subsection><subsection ssid="6-null-96" dnum="ii-o" numlevel="1" lineno="352" slineno="6-65" level="3"><display>(ii)</display>for <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="126" groupid="109" style="2" owner="jchristopherson" level="1" deltag="both">all qualifying candidates for elective office who submit nomination petitions <ln numlevel="1" lineno="353" slineno="6-66"/>to the filing officer, issue certifications referenced</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="122" groupid="105" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">each qualifying candidate for <ln numlevel="1" lineno="354" slineno="6-67"/>elective office who submits a nomination petition to the filing officer, issue the <ln numlevel="1" lineno="355" slineno="6-68"/>certification described</amend> in Subsection <xref depth="4" refnumber="20A-9-403(3)(a)">(3)(a)</xref> no later than the deadline described in <ln numlevel="1" lineno="356" slineno="6-69"/>Subsection <xref depth="4" refnumber="20A-9-202(1)(b)">20A-9-202(1)(b)</xref>;</subsection><subsection ssid="6-null-97" dnum="iii-o" numlevel="1" lineno="357" slineno="6-70" level="3"><display>(iii)</display>consider <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="129" groupid="112" style="2" owner="jchristopherson" level="1" deltag="both">active and inactive voters eligible to sign nomination petitions</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="128" groupid="111" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">an <ln numlevel="1" lineno="358" slineno="6-71"/>active and inactive voter eligible to sign a nomination petition</amend>;</subsection><subsection ssid="6-null-98" dnum="iv-o" numlevel="1" lineno="359" slineno="6-72" level="3"><display>(iv)</display>consider an individual who signs a nomination petition a member of a registered <ln numlevel="1" lineno="360" slineno="6-73"/>political party for purposes of Subsection <xref depth="4" refnumber="20A-9-403(3)(a)(ii)">(3)(a)(ii)</xref> if the individual has designated <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="47" groupid="39" style="2" owner="jchristopherson" level="1" deltag="both"><ln numlevel="1" lineno="361" slineno="6-74"/>that</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="45" groupid="37" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the</amend> registered political party as the individual's party membership on the <ln numlevel="1" lineno="362" slineno="6-75"/>individual's voter registration form; and</subsection><subsection ssid="6-null-99" dnum="v-o" numlevel="1" lineno="363" slineno="6-76" level="3"><display>(v)</display>except as otherwise provided in Section <xref depth="3" refnumber="20A-21-201">20A-21-201</xref> and with the assistance of <ln numlevel="1" lineno="364" slineno="6-77"/>the county clerk as applicable, use the procedures described in Section <xref depth="3" refnumber="20A-1-1002">20A-1-1002</xref> <ln numlevel="1" lineno="365" slineno="6-78"/>to verify submitted nomination petition signatures, or use statistical sampling <ln numlevel="1" lineno="366" slineno="6-79"/>procedures to verify submitted nomination petition signatures in accordance with <ln numlevel="1" lineno="367" slineno="6-80"/>rules made under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="117" groupid="100" style="2" owner="jchristopherson" level="1" deltag="both">(3)(f)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="111" groupid="94" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="20A-9-403(6)">(6)</xref></amend>.</subsection></subsection></subsection><subsection ssid="6-null-110" dnum="_-o:4-i" numlevel="1" lineno="368" slineno="6-81" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1130" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">Subject to Subsection <xref tempid="551">20A-9-405(11)(a)(i)</xref>, and notwithstanding Section <xref depth="3" refnumber="20A-2-104">20A-2-104</xref>, the <ln numlevel="1" lineno="369" slineno="6-82"/>filing officer shall, no later than one business day after the day on which the signature of <ln numlevel="1" lineno="370" slineno="6-83"/>an individual who signs a nomination petition is verified under Subsection <xref tempid="1000">(3)(d)</xref> or <ln numlevel="1" lineno="371" slineno="6-84"/>Section <xref depth="3" refnumber="20A-1-201">20A-1-201</xref>:</amend><subsection ssid="6-null-111" dnum="_-o:a-i" numlevel="1" lineno="372" slineno="6-85" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1131" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="9" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="end">post the individual's name, voter precinct number, and date of signature on the <ln numlevel="1" lineno="373" slineno="6-86"/>lieutenant governor's website, in a conspicuous location designated by the lieutenant <ln numlevel="1" lineno="374" slineno="6-87"/>governor, for at least 90 calendar days after the date of the primary election; and</amend></subsection><subsection ssid="6-null-112" dnum="_-o:b-i" numlevel="1" lineno="375" slineno="6-88" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1132" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="57" groupid="48" style="1" owner="jchristopherson" level="1" amendtag="end">if the individual's voter information in the voter registration database includes a valid <ln numlevel="1" lineno="376" slineno="6-89"/>email address, use an electronic notification system to send an email notice to the <ln numlevel="1" lineno="377" slineno="6-90"/>individual, informing the individual that:</amend><subsection ssid="6-null-113" dnum="_-o:i-i" numlevel="1" lineno="378" slineno="6-91" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1133" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="23" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="end">the individual's nomination petition signature is verified;</amend></subsection><subsection ssid="6-null-114" dnum="_-o:ii-i" numlevel="1" lineno="379" slineno="6-92" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1134" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="28" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="end">the individual's name and voter information described in Subsection <xref depth="4" refnumber="20A-9-403(4)(a)">(4)(a)</xref> is <ln numlevel="1" lineno="380" slineno="6-93"/>posted on the lieutenant governor's website; and</amend></subsection><subsection ssid="6-null-115" dnum="_-o:iii-i" numlevel="1" lineno="381" slineno="6-94" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1135" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="32" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="end">the individual has until the deadline described in Subsection <xref depth="4" refnumber="20A-9-405(10)(a)">20A-9-405(10)(a)</xref> to <ln numlevel="1" lineno="382" slineno="6-95"/>submit a statement to the filing officer, in accordance with Subsection <xref tempid="305"><ln numlevel="1" lineno="383" slineno="6-96"/>20A-1-1003(2)</xref>, requesting that the individual's signature be removed from the <ln numlevel="1" lineno="384" slineno="6-97"/>nomination petition.</amend></subsection></subsection></subsection><subsection ssid="6-null-100" dnum="e-o:5-i" numlevel="1" lineno="385" slineno="6-98" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1136" style="2" owner="o" level="1" deltag="both">(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1137" style="1" owner="i" level="1" amendtag="both" space="true">(5)</amend></display>Notwithstanding any other provision in <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="118" groupid="101" style="2" owner="jchristopherson" level="1" deltag="both">this Subsection (3)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="112" groupid="95" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Subsection <xref refnumber="1-null-13">(3)</xref>, (4), (6), <ln numlevel="1" lineno="386" slineno="6-99"/>or (7)</amend>, a candidate for lieutenant governor may appear on the regular primary ballot of a <ln numlevel="1" lineno="387" slineno="6-100"/>registered political party without submitting nomination petitions if the candidate files a <ln numlevel="1" lineno="388" slineno="6-101"/>declaration of candidacy and complies with Subsection <xref depth="4" refnumber="20A-9-202(3)">20A-9-202(3)</xref>.</subsection><subsection ssid="6-null-101" dnum="f-o:6-i" numlevel="1" lineno="389" slineno="6-102" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1137" style="2" owner="o" level="1" deltag="both">(f)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1138" style="1" owner="i" level="1" amendtag="both" space="true">(6)</amend></display>In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the <ln numlevel="1" lineno="390" slineno="6-103"/>director of elections, within the Office of the Lieutenant Governor, may make rules that:<subsection ssid="6-null-102" dnum="i-o:a-i" numlevel="1" lineno="391" slineno="6-104" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1138" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1139" style="1" owner="i" level="1" amendtag="both" space="true">(a)</amend></display>provide for the use of statistical sampling procedures that:<subsection ssid="6-null-103" dnum="A-o:i-i" numlevel="1" lineno="392" slineno="6-105" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1139" style="2" owner="o" level="1" deltag="both">(A)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1140" style="1" owner="i" level="1" amendtag="both" space="true">(i)</amend></display>filing officers are required to use to verify signatures under Subsection <xref depth="4" refnumber="20A-9-403(3)(d)">(3)(d)</xref>; <ln numlevel="1" lineno="393" slineno="6-106"/>and</subsection><subsection ssid="6-null-104" dnum="B-o:ii-i" numlevel="1" lineno="394" slineno="6-107" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1140" style="2" owner="o" level="1" deltag="both">(B)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1141" style="1" owner="i" level="1" amendtag="both" space="true">(ii)</amend></display>reflect a bona fide effort to determine the validity of a candidate's entire <ln numlevel="1" lineno="395" slineno="6-108"/>submission, using widely recognized statistical sampling techniques; and</subsection></subsection><subsection ssid="6-null-105" dnum="ii-o:b-i" numlevel="1" lineno="396" slineno="6-109" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1141" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1142" style="1" owner="i" level="1" amendtag="both" space="true">(b)</amend></display>provide for the transparent, orderly, and timely submission, verification, and <ln numlevel="1" lineno="397" slineno="6-110"/>certification of nomination petition signatures.</subsection></subsection><subsection ssid="6-null-106" dnum="g-o:7-i" numlevel="1" lineno="398" slineno="6-111" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1142" style="2" owner="o" level="1" deltag="both">(g)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1143" style="1" owner="i" level="1" amendtag="both" space="true">(7)</amend></display>The county clerk shall:<subsection ssid="6-null-107" dnum="i-o:a-i" numlevel="1" lineno="399" slineno="6-112" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1143" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1144" style="1" owner="i" level="1" amendtag="both" space="true">(a)</amend></display>review the declarations of candidacy filed by candidates for local boards of <ln numlevel="1" lineno="400" slineno="6-113"/>education to determine if more than two candidates have filed for the same seat;</subsection><subsection ssid="6-null-108" dnum="ii-o:b-i" numlevel="1" lineno="401" slineno="6-114" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1144" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1145" style="1" owner="i" level="1" amendtag="both" space="true">(b)</amend></display>place the names of all candidates who have filed a declaration of candidacy for a <ln numlevel="1" lineno="402" slineno="6-115"/>local board of education seat on the nonpartisan section of the ballot if more than two <ln numlevel="1" lineno="403" slineno="6-116"/>candidates have filed for the same seat; and</subsection><subsection ssid="6-null-109" dnum="iii-o:c-i" numlevel="1" lineno="404" slineno="6-117" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1145" style="2" owner="o" level="1" deltag="both">(iii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1146" style="1" owner="i" level="1" amendtag="both" space="true">(c)</amend></display>place the local board of education candidates' names on the ballot in accordance <ln numlevel="1" lineno="405" slineno="6-118"/>with Sections <xref depth="3" refnumber="20A-6-109">20A-6-109</xref> and <xref depth="3" refnumber="20A-6-110">20A-6-110</xref>.</subsection></subsection><subsection ssid="6-null-116" dnum="4-o:8-i" numlevel="1" lineno="406" slineno="6-119" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1146" style="2" owner="o" level="1" deltag="both">(4)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1147" style="1" owner="i" level="1" amendtag="both" space="true">(8)</amend></display><subsection ssid="6-null-117" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Before the deadline described in Subsection <xref depth="4" refnumber="20A-9-409(4)(c)">20A-9-409(4)(c)</xref>, the lieutenant <ln numlevel="1" lineno="407" slineno="6-120"/>governor shall provide to the county clerks:<subsection ssid="6-null-118" dnum="i-o" numlevel="1" lineno="408" slineno="6-121" level="3" tab="1"><display>(i)</display>a list of the names of all candidates for federal, constitutional, multi-county, single <ln numlevel="1" lineno="409" slineno="6-122"/>county, and county offices who have received certifications under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="138" groupid="121" style="2" owner="jchristopherson" level="1" deltag="both">(3)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="137" groupid="120" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="20A-9-403(3)(a)"><ln numlevel="1" lineno="410" slineno="6-123"/>(3)(a)</xref></amend>, along with instructions on how those names shall appear on the primary <ln numlevel="1" lineno="411" slineno="6-124"/>election ballot in accordance with Sections <xref depth="3" refnumber="20A-6-109">20A-6-109</xref> and <xref depth="3" refnumber="20A-6-110">20A-6-110</xref>; and</subsection><subsection ssid="6-null-119" dnum="ii-o" numlevel="1" lineno="412" slineno="6-125" level="3" tab="1"><display>(ii)</display>a list of unopposed candidates for elective office who have been nominated by a <ln numlevel="1" lineno="413" slineno="6-126"/>registered political party under Subsection <xref depth="4" refnumber="20A-9-403(5)(c)">(5)(c)</xref> and instruct the county clerks to <ln numlevel="1" lineno="414" slineno="6-127"/>exclude the unopposed candidates from the primary election ballot.</subsection></subsection><subsection ssid="6-null-120" dnum="b-o" numlevel="1" lineno="415" slineno="6-128" level="2"><display>(b)</display>A candidate for lieutenant governor and a candidate for governor campaigning as <ln numlevel="1" lineno="416" slineno="6-129"/>joint-ticket running mates shall appear jointly on the primary election ballot.</subsection><subsection ssid="6-null-121" dnum="c-o" numlevel="1" lineno="417" slineno="6-130" level="2" format="full"><display>(c)</display>After the county clerk receives the certified list from the lieutenant governor under <ln numlevel="1" lineno="418" slineno="6-131"/>Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="120" groupid="103" style="2" owner="jchristopherson" level="1" deltag="both">(4)(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="114" groupid="97" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="20A-9-403(8)(a)">(8)(a)</xref></amend>, the county clerk shall post or publish a primary election notice in <ln numlevel="1" lineno="419" slineno="6-132"/>substantially the following form:<eol numlevel="1" lineno="420" slineno="6-133"/><para/>"Notice is given that a primary election will be held Tuesday, June ____, <ln numlevel="1" lineno="421" slineno="6-134"/>________(year), to nominate party candidates for the parties and candidates for nonpartisan <ln numlevel="1" lineno="422" slineno="6-135"/>local school board positions listed on the primary ballot.  The polling place for voting precinct <ln numlevel="1" lineno="423" slineno="6-136"/>____ is ____.  The polls will open at 7 a.m. and continue open until 8 p.m. of the same day.  <ln numlevel="1" lineno="424" slineno="6-137"/>Attest: county clerk."</subsection></subsection><subsection ssid="6-null-122" dnum="5-o:9-i" numlevel="1" lineno="425" slineno="6-138" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1152" style="2" owner="o" level="1" deltag="both">(5)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1153" style="1" owner="i" level="1" amendtag="both" space="true">(9)</amend></display><subsection ssid="6-null-123" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A candidate who, at the regular primary election, receives the highest number <ln numlevel="1" lineno="426" slineno="6-139"/>of votes cast for the office sought by the candidate is:<subsection ssid="6-null-124" dnum="i-o" numlevel="1" lineno="427" slineno="6-140" level="3" tab="1"><display>(i)</display>nominated for that office by the candidate's registered political party; or</subsection><subsection ssid="6-null-125" dnum="ii-o" numlevel="1" lineno="428" slineno="6-141" level="3" tab="1"><display>(ii)</display>for a nonpartisan local school board position, nominated for that office.</subsection></subsection><subsection ssid="6-null-126" dnum="b-o" numlevel="1" lineno="429" slineno="6-142" level="2"><display>(b)</display>If two or more candidates are to be elected to the office at the regular general <ln numlevel="1" lineno="430" slineno="6-143"/>election, those party candidates equal in number to positions to be filled who receive <ln numlevel="1" lineno="431" slineno="6-144"/>the highest number of votes at the regular primary election are the nominees of the <ln numlevel="1" lineno="432" slineno="6-145"/>candidates' party for those positions.</subsection><subsection ssid="6-null-127" dnum="c-o" numlevel="1" lineno="433" slineno="6-146" level="2" space="false"><display>(c)</display><subsection ssid="6-null-128" dnum="i-o" level="3" placement="sameline"><display>(i)</display>As used in this Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="104" groupid="87" style="2" owner="jchristopherson" level="1" deltag="both">(5)(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="102" groupid="85" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="20A-9-403(9)(c)">(9)(c)</xref></amend>, a candidate is "unopposed" if:<subsection ssid="6-null-129" dnum="A-o" numlevel="1" lineno="434" slineno="6-147" level="4" tab="1"><display>(A)</display>no individual other than the candidate receives a certification under <ln numlevel="1" lineno="435" slineno="6-148"/>Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="135" groupid="118" style="2" owner="jchristopherson" level="1" deltag="both">(3)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="134" groupid="117" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="20A-9-403(3)(a)">(3)(a)</xref></amend> for the regular primary election ballot of the candidate's <ln numlevel="1" lineno="436" slineno="6-149"/>registered political party for a particular elective office; or</subsection><subsection ssid="6-null-130" dnum="B-o" numlevel="1" lineno="437" slineno="6-150" level="4" tab="1"><display>(B)</display>for an office where more than one individual is to be elected or nominated, the <ln numlevel="1" lineno="438" slineno="6-151"/>number of candidates who receive certification under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="132" groupid="115" style="2" owner="jchristopherson" level="1" deltag="both">(3)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="131" groupid="114" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="20A-9-403(3)(a)">(3)(a)</xref></amend> for <ln numlevel="1" lineno="439" slineno="6-152"/>the regular primary election of the candidate's registered political party does <ln numlevel="1" lineno="440" slineno="6-153"/>not exceed the total number of candidates to be elected or nominated for that <ln numlevel="1" lineno="441" slineno="6-154"/>office.</subsection></subsection><subsection ssid="6-null-131" dnum="ii-o" numlevel="1" lineno="442" slineno="6-155" level="3"><display>(ii)</display>A candidate who is unopposed for an elective office in the regular primary <ln numlevel="1" lineno="443" slineno="6-156"/>election of a registered political party is nominated by the party for that office <ln numlevel="1" lineno="444" slineno="6-157"/>without appearing on the primary election ballot.</subsection></subsection></subsection><subsection ssid="6-null-132" dnum="6-o:10-i" numlevel="1" lineno="445" slineno="6-158" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1162" style="2" owner="o" level="1" deltag="both">(6)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1163" style="1" owner="i" level="1" amendtag="both" space="true">(10)</amend></display>The expense of providing all ballots, blanks, or other supplies to be used at any <ln numlevel="1" lineno="446" slineno="6-159"/>primary election provided for by this section, and all expenses necessarily incurred in <ln numlevel="1" lineno="447" slineno="6-160"/>the preparation for or the conduct of that primary election shall be paid out of the <ln numlevel="1" lineno="448" slineno="6-161"/>treasury of the county or state, in the same manner as for the regular general elections.</subsection><subsection ssid="6-null-133" dnum="7-o:11-i" numlevel="1" lineno="449" slineno="6-162" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1163" style="2" owner="o" level="1" deltag="both">(7)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1164" style="1" owner="i" level="1" amendtag="both" space="true">(11)</amend></display>An individual may not file a declaration of candidacy for a registered political <ln numlevel="1" lineno="450" slineno="6-163"/>party of which the individual is not a member, except to the extent that the registered <ln numlevel="1" lineno="451" slineno="6-164"/>political party permits otherwise under the registered political party's bylaws.</subsection></section></bsec><bsec buid="7" num="20A-9-405" type="amend" src="code" uid="C20A-9-S405_2027010120270101" sort="20A09 04050020270101" numlevel="1" lineno="452" slineno="7-1" sn="7"><section number="20A-9-405" numlevel="1" lineno="453" slineno="7-2" type="amend"><secline lineno="452">Section 7. Section <bold>20A-9-405</bold> is amended to read:</secline><catline lineno="453"><bold>20A-9-405<parens/>. Nomination petitions for regular primary elections.</bold></catline><subsection ssid="7-null-53" dnum="1-o" numlevel="1" lineno="454" slineno="7-3" level="1" placement="noreturn"><display>(1)</display>This section applies to the form and circulation of nomination petitions for regular <ln numlevel="1" lineno="455" slineno="7-4"/>primary elections described in Subsection <xref depth="4" refnumber="20A-9-403(3)(a)" start="0">20A-9-403(3)(a)</xref>.</subsection><subsection ssid="7-null-54" dnum="2-o" numlevel="1" lineno="456" slineno="7-5" level="1"><display>(2)</display>A candidate for elective office, and the agents of the candidate, may not circulate <ln numlevel="1" lineno="457" slineno="7-6"/>nomination petitions until the candidate has submitted a declaration of candidacy in <ln numlevel="1" lineno="458" slineno="7-7"/>accordance with Subsection <xref depth="4" refnumber="20A-9-202(1)" start="0">20A-9-202(1)</xref>.</subsection><subsection ssid="7-null-55" dnum="3-o" numlevel="1" lineno="459" slineno="7-8" level="1"><display>(3)</display>For the manual candidate qualification process, the nomination petitions shall be in <ln numlevel="1" lineno="460" slineno="7-9"/>substantially the following form:<subsection ssid="7-null-56" dnum="a-o" numlevel="1" lineno="461" slineno="7-10" level="2"><display>(a)</display>the petition shall be printed on paper 8-1/2 inches long and 11 inches wide;</subsection><subsection ssid="7-null-57" dnum="b-o" numlevel="1" lineno="462" slineno="7-11" level="2"><display>(b)</display>the petition shall be ruled with a horizontal line 3/4 inch from the top, with the space <ln numlevel="1" lineno="463" slineno="7-12"/>above that line blank for purposes of binding;</subsection><subsection ssid="7-null-58" dnum="c-o" numlevel="1" lineno="464" slineno="7-13" level="2"><display>(c)</display>the petition shall be headed by a caption stating the purpose of the petition and the <ln numlevel="1" lineno="465" slineno="7-14"/>name of the proposed candidate;</subsection><subsection ssid="7-null-59" dnum="d-o" numlevel="1" lineno="466" slineno="7-15" level="2"><display>(d)</display>the petition shall feature the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both">word "Warning" followed by the </amend><amendoutend style="2"/>following <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="82" groupid="67" style="2" owner="jchristopherson" level="1" deltag="both">statement</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="81" groupid="66" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="467" slineno="7-16"/>statements</amend> in no less than eight-point, single leaded type: <subsection ssid="7-107" dnum="_-o:i-i" numlevel="1" lineno="468" slineno="7-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1171" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>"<amend anum="0" ea="amend" pairid="8" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="both">WARNING: </amend>It is a class A misdemeanor for anyone to knowingly sign a <ln numlevel="1" lineno="469" slineno="7-18"/>nomination petition with any name other than the person's own name, or more <ln numlevel="1" lineno="470" slineno="7-19"/>than once for the same candidate, or if the person is not registered to vote in this <ln numlevel="1" lineno="471" slineno="7-20"/>state.";<amend anum="0" ea="amend" pairid="56" groupid="44" style="1" owner="jchristopherson" level="1" amendtag="both"> and</amend></subsection><subsection ssid="7-108" dnum="_-o:ii-i" numlevel="1" lineno="472" slineno="7-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1172" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="64" groupid="51" style="1" owner="jchristopherson" level="1" amendtag="end">"NOTICE: Your name, voter precinct number, and date of signature may be <ln numlevel="1" lineno="473" slineno="7-22"/>publicly disclosed on the lieutenant governor's website if you sign this petition. <ln numlevel="1" lineno="474" slineno="7-23"/>This disclosure may occur even if your voter registration record has been <ln numlevel="1" lineno="475" slineno="7-24"/>classified as a private record at your request. If your voter registration information <ln numlevel="1" lineno="476" slineno="7-25"/>includes a valid email address, you will receive an email notifying you of the <ln numlevel="1" lineno="477" slineno="7-26"/>disclosure as well as information on how to remove your name from this petition. <ln numlevel="1" lineno="478" slineno="7-27"/>To ensure your voter registration information includes a valid email address, <ln numlevel="1" lineno="479" slineno="7-28"/>please visit vote.utah.gov or the office of your county clerk.";</amend></subsection></subsection><subsection ssid="7-null-60" dnum="e-o" numlevel="1" lineno="480" slineno="7-29" level="2"><display>(e)</display>the petition shall feature 10 lines spaced one-half inch apart and consecutively <ln numlevel="1" lineno="481" slineno="7-30"/>numbered one through 10;</subsection><subsection ssid="7-null-61" dnum="f-o" numlevel="1" lineno="482" slineno="7-31" level="2"><display>(f)</display>the signature portion of the petition shall be divided into columns headed by the <ln numlevel="1" lineno="483" slineno="7-32"/>following titles:<subsection ssid="7-null-62" dnum="i-o" numlevel="1" lineno="484" slineno="7-33" level="3"><display>(i)</display>Registered Voter's Printed Name;</subsection><subsection ssid="7-null-63" dnum="ii-o" numlevel="1" lineno="485" slineno="7-34" level="3"><display>(ii)</display>Signature of Registered Voter;</subsection><subsection ssid="7-null-64" dnum="iii-o" numlevel="1" lineno="486" slineno="7-35" level="3"><display>(iii)</display>Party Affiliation of Registered Voter;</subsection><subsection ssid="7-null-65" dnum="iv-o" numlevel="1" lineno="487" slineno="7-36" level="3"><display>(iv)</display>Birth Date or Age (Optional);</subsection><subsection ssid="7-null-66" dnum="v-o" numlevel="1" lineno="488" slineno="7-37" level="3"><display>(v)</display>Street Address, City, Zip Code; and</subsection><subsection ssid="7-null-67" dnum="vi-o" numlevel="1" lineno="489" slineno="7-38" level="3"><display>(vi)</display>Date of Signature; and</subsection></subsection><subsection ssid="7-null-68" dnum="g-o" numlevel="1" lineno="490" slineno="7-39" level="2"><display>(g)</display>a photograph of the candidate may appear on the nomination petition.</subsection></subsection><subsection ssid="7-null-69" dnum="4-o" numlevel="1" lineno="491" slineno="7-40" level="1"><display>(4)</display>For the electronic candidate qualification process, the lieutenant governor shall design <ln numlevel="1" lineno="492" slineno="7-41"/>an electronic form, using progressive screens, that includes:<subsection ssid="7-null-70" dnum="a-o" numlevel="1" lineno="493" slineno="7-42" level="2" format="full"><display>(a)</display>the following warning:<eol numlevel="1" lineno="494" slineno="7-43"/><para/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="71" groupid="57" style="2" owner="jchristopherson" level="1" deltag="both">"Warning</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="70" groupid="56" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">WARNING</amend>: It is a class A misdemeanor for anyone to knowingly sign a <ln numlevel="1" lineno="495" slineno="7-44"/>nomination petition with any name other than the person's own name, or more than once for <ln numlevel="1" lineno="496" slineno="7-45"/>the same candidate, or if the person is not registered to vote in this state."; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="18" groupid="16" style="2" owner="jchristopherson" level="1" deltag="both">and</amend><amendoutend style="2"/></subsection><subsection ssid="7-null-71" dnum="_-o:b-i" numlevel="1" lineno="497" slineno="7-46" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1184" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="16" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="end">the following notice:<eol numlevel="1" lineno="498" slineno="7-47"/>"NOTICE: Your name, voter precinct number, and date of signature may be <ln numlevel="1" lineno="499" slineno="7-48"/>publicly disclosed on the lieutenant governor's website if you sign this petition. This <ln numlevel="1" lineno="500" slineno="7-49"/>disclosure may occur even if your voter registration record has been classified as a <ln numlevel="1" lineno="501" slineno="7-50"/>private record at your request. If your voter registration information includes a valid <ln numlevel="1" lineno="502" slineno="7-51"/>email address, you will receive an email notifying you of the disclosure as well as <ln numlevel="1" lineno="503" slineno="7-52"/>information on how to remove your name from this petition. To ensure your voter <ln numlevel="1" lineno="504" slineno="7-53"/>registration information includes a valid email address, please visit vote.utah.gov or <ln numlevel="1" lineno="505" slineno="7-54"/>the office of your county clerk."; and</amend></subsection><subsection ssid="7-null-72" dnum="b-o:c-i" numlevel="1" lineno="506" slineno="7-55" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1185" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1186" style="1" owner="i" level="1" amendtag="both" space="true">(c)</amend></display>the following information for each individual who signs the petition:<subsection ssid="7-null-73" dnum="i-o" numlevel="1" lineno="507" slineno="7-56" level="3"><display>(i)</display>name;</subsection><subsection ssid="7-null-74" dnum="ii-o" numlevel="1" lineno="508" slineno="7-57" level="3"><display>(ii)</display>party affiliation;</subsection><subsection ssid="7-null-75" dnum="iii-o" numlevel="1" lineno="509" slineno="7-58" level="3"><display>(iii)</display>date of birth or age, (optional);</subsection><subsection ssid="7-null-76" dnum="iv-o" numlevel="1" lineno="510" slineno="7-59" level="3"><display>(iv)</display>street address, city, zip code;</subsection><subsection ssid="7-null-77" dnum="v-o" numlevel="1" lineno="511" slineno="7-60" level="3"><display>(v)</display>date of signature;</subsection><subsection ssid="7-null-78" dnum="vi-o" numlevel="1" lineno="512" slineno="7-61" level="3"><display>(vi)</display>other information required under Section <xref depth="3" refnumber="20A-21-201" start="0">20A-21-201</xref>; and</subsection><subsection ssid="7-null-79" dnum="vii-o" numlevel="1" lineno="513" slineno="7-62" level="3"><display>(vii)</display>other information required by the lieutenant governor.</subsection></subsection></subsection><subsection ssid="7-null-80" dnum="5-o" numlevel="1" lineno="514" slineno="7-63" level="1" format="full"><display>(5)</display>For the manual candidate qualification process, if one or more nomination petitions are <ln numlevel="1" lineno="515" slineno="7-64"/>bound together, a page shall be bound to the nomination petition(s) that features the following <ln numlevel="1" lineno="516" slineno="7-65"/>printed verification statement to be signed and dated by the petition circulator:<eol numlevel="1" lineno="517" slineno="7-66"/><para/>"Verification<eol numlevel="1" lineno="518" slineno="7-67"/><para/>State of Utah, County of ____<eol numlevel="1" lineno="519" slineno="7-68"/><para/>I, ____, of ____, hereby state that:<eol numlevel="1" lineno="520" slineno="7-69"/><para/>I am at least 18 years old;<eol numlevel="1" lineno="521" slineno="7-70"/><para/>All the names that appear on the signature sheets bound to this page were, to the best of <ln numlevel="1" lineno="522" slineno="7-71"/>my knowledge, signed by the persons who professed to be the persons whose names appear on <ln numlevel="1" lineno="523" slineno="7-72"/>the signature sheets, and each of them signed the person's name on the signature sheets in my <ln numlevel="1" lineno="524" slineno="7-73"/>presence;<eol numlevel="1" lineno="525" slineno="7-74"/><para/>I believe that each has printed and signed the person's name and written the person's <ln numlevel="1" lineno="526" slineno="7-75"/>street address correctly, and that each signer is registered to vote in Utah."</subsection><subsection ssid="7-null-81" dnum="6-o" numlevel="1" lineno="527" slineno="7-76" level="1"><display>(6)</display>The lieutenant governor shall prepare and make public model nomination petition forms <ln numlevel="1" lineno="528" slineno="7-77"/>and associated instructions.</subsection><subsection ssid="7-null-82" dnum="7-o" numlevel="1" lineno="529" slineno="7-78" level="1"><display>(7)</display>A nomination petition circulator:<subsection ssid="7-null-83" dnum="a-o" numlevel="1" lineno="530" slineno="7-79" level="2"><display>(a)</display>must be at least 18 years old; and</subsection><subsection ssid="7-null-84" dnum="b-o" numlevel="1" lineno="531" slineno="7-80" level="2"><display>(b)</display>may affiliate with any political party.</subsection></subsection><subsection ssid="7-null-85" dnum="8-o" numlevel="1" lineno="532" slineno="7-81" level="1"><display>(8)</display>It is unlawful for any person to:<subsection ssid="7-null-86" dnum="a-o" numlevel="1" lineno="533" slineno="7-82" level="2"><display>(a)</display>knowingly sign the nomination petition described in this section or Section <xref depth="3" refnumber="20A-9-408" start="0"><ln numlevel="1" lineno="534" slineno="7-83"/>20A-9-408</xref>:<subsection ssid="7-null-87" dnum="i-o" numlevel="1" lineno="535" slineno="7-84" level="3"><display>(i)</display>with any name other than the person's own name;</subsection><subsection ssid="7-null-88" dnum="ii-o" numlevel="1" lineno="536" slineno="7-85" level="3"><display>(ii)</display>more than once for the same candidate; or</subsection><subsection ssid="7-null-89" dnum="iii-o" numlevel="1" lineno="537" slineno="7-86" level="3"><display>(iii)</display>if the person is not registered to vote in this state;</subsection></subsection><subsection ssid="7-null-90" dnum="b-o" numlevel="1" lineno="538" slineno="7-87" level="2"><display>(b)</display>sign the verification of a signature for a nomination petition if the person:<subsection ssid="7-null-91" dnum="i-o" numlevel="1" lineno="539" slineno="7-88" level="3"><display>(i)</display>has not witnessed the signing by those persons whose names appear on the <ln numlevel="1" lineno="540" slineno="7-89"/>nomination petition; or</subsection><subsection ssid="7-null-92" dnum="ii-o" numlevel="1" lineno="541" slineno="7-90" level="3"><display>(ii)</display>knows that a person whose signature appears on the nomination petition is not <ln numlevel="1" lineno="542" slineno="7-91"/>registered to vote in this state;</subsection></subsection><subsection ssid="7-null-93" dnum="c-o" numlevel="1" lineno="543" slineno="7-92" level="2"><display>(c)</display>pay compensation to any person to sign a nomination petition; or</subsection><subsection ssid="7-null-94" dnum="d-o" numlevel="1" lineno="544" slineno="7-93" level="2"><display>(d)</display>pay compensation to any person to circulate a nomination petition, if the <ln numlevel="1" lineno="545" slineno="7-94"/>compensation is based directly on the number of signatures submitted to a filing <ln numlevel="1" lineno="546" slineno="7-95"/>officer rather than on the number of signatures verified or on some other basis.</subsection></subsection><subsection ssid="7-null-95" dnum="9-o" numlevel="1" lineno="547" slineno="7-96" level="1"><display>(9)</display>Any person violating Subsection <xref depth="4" refnumber="20A-9-405(8)" start="0">(8)</xref> is guilty of a class A misdemeanor.</subsection><subsection ssid="7-null-96" dnum="10-o" numlevel="1" lineno="548" slineno="7-97" level="1" space="false"><display>(10)</display><subsection ssid="7-null-97" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A voter who signs a nomination petition may have the voter's signature removed <ln numlevel="1" lineno="549" slineno="7-98"/>from the petition by, no later than <amend anum="0" ea="amend" pairid="79" groupid="64" style="1" owner="jchristopherson" level="1" amendtag="both">5 p.m. </amend>three business days after the day on which <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="77" groupid="62" style="2" owner="jchristopherson" level="1" deltag="both"><ln numlevel="1" lineno="550" slineno="7-99"/>the candidate files the petition with the appropriate filing officer</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="51" groupid="41" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the filing officer <ln numlevel="1" lineno="551" slineno="7-100"/>makes the posting described in Subsection <xref refnumber="1-58">20A-9-403(4)(a)</xref></amend>, submitting to the filing <ln numlevel="1" lineno="552" slineno="7-101"/>officer a statement requesting that the voter's signature be removed.</subsection><subsection ssid="7-null-98" dnum="b-o" numlevel="1" lineno="553" slineno="7-102" level="2"><display>(b)</display>A statement described in Subsection <xref depth="4" refnumber="20A-9-405(10)(a)">(10)(a)</xref> shall comply with the requirements <ln numlevel="1" lineno="554" slineno="7-103"/>described in Subsection <xref depth="4" refnumber="20A-1-1003(2)">20A-1-1003(2)</xref>.</subsection><subsection ssid="7-null-99" dnum="c-o" numlevel="1" lineno="555" slineno="7-104" level="2"><display>(c)</display>The filing officer shall use the procedures described in Subsection <xref depth="4" refnumber="20A-1-1003(3)">20A-1-1003(3)</xref> to <ln numlevel="1" lineno="556" slineno="7-105"/>determine whether to remove an individual's signature from a nomination petition <ln numlevel="1" lineno="557" slineno="7-106"/>after receiving a timely, valid statement requesting removal of the signature.</subsection></subsection><subsection ssid="7-null-100" dnum="_-o:11-i" numlevel="1" lineno="558" slineno="7-107" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1213" style="1" owner="i" level="1" amendtag="start">(11)</amend></display><subsection ssid="7-null-101" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1214" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="39" groupid="31" style="1" owner="jchristopherson" level="1" amendtag="end">If a filing officer timely receives a statement requesting signature removal under <ln numlevel="1" lineno="559" slineno="7-108"/>Subsection <xref refnumber="3-null-44">(10)(a)</xref> and determines that the signature should be removed from the <ln numlevel="1" lineno="560" slineno="7-109"/>nomination petition under Subsection <xref tempid="753">20A-1-1003(3)</xref>, the filing officer shall:</amend><subsection ssid="7-null-102" dnum="_-o:i-i" numlevel="1" lineno="561" slineno="7-110" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1215" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="38" groupid="30" style="1" owner="jchristopherson" level="1" amendtag="end">remove the voter's name from the nomination petition;</amend></subsection><subsection ssid="7-109" dnum="_-o:ii-i" numlevel="1" lineno="562" slineno="7-111" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1216" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="76" groupid="61" style="1" owner="jchristopherson" level="1" amendtag="end">remove the voter's name, voter precinct number, and date of signature from the <ln numlevel="1" lineno="563" slineno="7-112"/>posting described in Subsection <xref depth="4" refnumber="20A-9-403(4)(a)">20A-9-403(4)(a)</xref>; and</amend></subsection><subsection ssid="7-null-103" dnum="_-o:iii-i" numlevel="1" lineno="564" slineno="7-113" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1217" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="44" groupid="35" style="1" owner="jchristopherson" level="1" amendtag="end">update the nomination petition signature totals.</amend></subsection></subsection><subsection ssid="7-null-104" dnum="_-o:b-i" numlevel="1" lineno="565" slineno="7-114" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1218" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="49" groupid="39" style="1" owner="jchristopherson" level="1" amendtag="end">The filing officer shall comply with Subsection <xref refnumber="3-49">(11)(a)</xref> no later than 5 p.m. the day <ln numlevel="1" lineno="566" slineno="7-115"/>before the day of the deadline described in Subsection <xref depth="4" refnumber="20A-9-202(1)(b)">20A-9-202(1)(b)</xref>.</amend></subsection></subsection></section></bsec><bsec buid="21" num="20A-9-406" type="amend" src="code" uid="C20A-9-S406_2027010120270101" Qualified political party -- Requirements and exemptions.</bold></catline><sectionText lineno="569"><tab/>The following provisions apply to a qualified political party:</sectionText><subsection ssid="21-null-1" dnum="1-o" numlevel="1" lineno="570" slineno="8-4" level="1"><display>(1)</display>the qualified political party shall, no later than 5 p.m. on the first Monday of October of <ln numlevel="1" lineno="571" slineno="8-5"/>each odd-numbered year, certify to the lieutenant governor the identity of one or more <ln numlevel="1" lineno="572" slineno="8-6"/>registered political parties whose members may vote for the qualified political party's <ln numlevel="1" lineno="573" slineno="8-7"/>candidates and whether unaffiliated voters may vote for the qualified political party's <ln numlevel="1" lineno="574" slineno="8-8"/>candidates;</subsection><subsection ssid="21-null-2" dnum="2-o" numlevel="1" lineno="575" slineno="8-9" level="1"><display>(2)</display>the following provisions do not apply to a nomination for the qualified political party:<subsection ssid="21-null-3" dnum="a-o" numlevel="1" lineno="576" slineno="8-10" level="2"><display>(a)</display>Subsections <xref depth="4" refnumber="20A-9-403(1)" start="0">20A-9-403(1)</xref> through <xref depth="4" refnumber="20A-9-403(3)(b)" start="0">(3)(b)</xref> and Subsections <xref depth="4" refnumber="20A-9-406(3)(d)(ii)">(3)(d)(ii)</xref> through <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="11" groupid="11" style="2" owner="jchristopherson" level="1" deltag="both">(4)(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="6" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref refnumber="(8)(a)" depth="4"><ln numlevel="1" lineno="577" slineno="8-11"/>(8)(a)</xref></amend>;</subsection><subsection ssid="21-null-4" dnum="b-o" numlevel="1" lineno="578" slineno="8-12" level="2"><display>(b)</display>Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="12" groupid="12" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="20A-9-403(5)(c)" start="0">20A-9-403(5)(c)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="20A-9-403(9)(c)">20A-9-403(9)(c)</xref></amend>; and</subsection><subsection ssid="21-null-5" dnum="c-o" numlevel="1" lineno="579" slineno="8-13" level="2"><display>(c)</display>Section <xref depth="3" refnumber="20A-9-405" start="0">20A-9-405</xref>;</subsection></subsection><subsection ssid="21-null-6" dnum="3-o" numlevel="1" lineno="580" slineno="8-14" level="1"><display>(3)</display>an individual may only seek the nomination of the qualified political party by using a <ln numlevel="1" lineno="581" slineno="8-15"/>method described in Section <xref depth="3" refnumber="20A-9-407" start="0">20A-9-407</xref>, Section <xref depth="3" refnumber="20A-9-408" start="0">20A-9-408</xref>, or both;</subsection><subsection ssid="21-null-7" dnum="4-o" numlevel="1" lineno="582" slineno="8-16" level="1"><display>(4)</display>the qualified political party shall comply with the provisions of Sections <xref depth="3" refnumber="20A-9-407" start="0">20A-9-407</xref>, <xref depth="3" refnumber="20A-9-408" start="0"><ln numlevel="1" lineno="583" slineno="8-17"/>20A-9-408</xref>, and <xref depth="3" refnumber="20A-9-409" start="0">20A-9-409</xref>;</subsection><subsection ssid="21-null-8" dnum="5-o" numlevel="1" lineno="584" slineno="8-18" level="1"><display>(5)</display>notwithstanding Subsection <xref depth="4" refnumber="20A-6-301(1)(a)" start="0">20A-6-301(1)(a)</xref>, <xref depth="4" refnumber="20A-6-301(1)(e)" start="0">(1)(e)</xref>, or <xref depth="4" refnumber="20A-6-301(2)(a)" start="0">(2)(a)</xref>, each election officer shall <ln numlevel="1" lineno="585" slineno="8-19"/>ensure that a ballot described in Section <xref depth="3" refnumber="20A-6-301" start="0">20A-6-301</xref> includes each individual nominated <ln numlevel="1" lineno="586" slineno="8-20"/>by a qualified political party:<subsection ssid="21-null-9" dnum="a-o" numlevel="1" lineno="587" slineno="8-21" level="2"><display>(a)</display>under the qualified political party's name, if any; or</subsection><subsection ssid="21-null-10" dnum="b-o" numlevel="1" lineno="588" slineno="8-22" level="2"><display>(b)</display>under the title of the qualified registered political party as designated by the qualified <ln numlevel="1" lineno="589" slineno="8-23"/>political party in the certification described in Subsection <xref depth="4" refnumber="20A-9-406(1)" start="0">(1)</xref>, or, if none is <ln numlevel="1" lineno="590" slineno="8-24"/>designated, then under some suitable title;</subsection></subsection><subsection ssid="21-null-11" dnum="6-o" numlevel="1" lineno="591" slineno="8-25" level="1"><display>(6)</display>notwithstanding Subsection <xref depth="4" refnumber="20A-6-302(1)(a)" start="0">20A-6-302(1)(a)</xref>, each election officer shall ensure, for <ln numlevel="1" lineno="592" slineno="8-26"/>ballots in regular general elections, that each candidate who is nominated by the <ln numlevel="1" lineno="593" slineno="8-27"/>qualified political party is listed by party;</subsection><subsection ssid="21-null-12" dnum="7-o" numlevel="1" lineno="594" slineno="8-28" level="1"><display>(7)</display>notwithstanding Subsection <xref depth="4" refnumber="20A-6-304(1)(e)" start="0">20A-6-304(1)(e)</xref>, each election officer shall ensure that the <ln numlevel="1" lineno="595" slineno="8-29"/>party designation of each candidate who is nominated by the qualified political party is <ln numlevel="1" lineno="596" slineno="8-30"/>displayed adjacent to the candidate's name on a mechanical ballot;</subsection><subsection ssid="21-null-13" dnum="8-o" numlevel="1" lineno="597" slineno="8-31" level="1"><display>(8)</display>"candidates for elective office," defined in Subsection <xref depth="4" refnumber="20A-9-101(1)(a)" start="0">20A-9-101(1)(a)</xref>, also includes an <ln numlevel="1" lineno="598" slineno="8-32"/>individual who files a declaration of candidacy under Section <xref depth="3" refnumber="20A-9-407" start="0">20A-9-407</xref> or <xref depth="3" refnumber="20A-9-408" start="0">20A-9-408</xref> <ln numlevel="1" lineno="599" slineno="8-33"/>to run in a regular general election for a federal office, constitutional office, multicounty <ln numlevel="1" lineno="600" slineno="8-34"/>office, or county office;</subsection><subsection ssid="21-null-14" dnum="9-o" numlevel="1" lineno="601" slineno="8-35" level="1"><display>(9)</display>an individual who is nominated by, or seeking the nomination of, the qualified political <ln numlevel="1" lineno="602" slineno="8-36"/>party is not required to comply with Subsection <xref depth="4" refnumber="20A-9-201(1)(c)" start="0">20A-9-201(1)(c)</xref>;</subsection><subsection ssid="21-null-15" dnum="10-o" numlevel="1" lineno="603" slineno="8-37" level="1"><display>(10)</display>notwithstanding <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="20" groupid="20" style="2" owner="jchristopherson" level="1" deltag="both">Subsection <xref depth="4" refnumber="20A-9-403(3)" start="0">20A-9-403(3)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="18" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Subsections <xref depth="4" refnumber="20A-9-403(3)">20A-9-403(3)</xref> through <xref depth="4" refnumber="20A-9-406(7)">(7)</xref></amend>, the <ln numlevel="1" lineno="604" slineno="8-38"/>qualified political party is entitled to have each of the qualified political party's <ln numlevel="1" lineno="605" slineno="8-39"/>candidates for elective office appear on the primary ballot of the qualified political party <ln numlevel="1" lineno="606" slineno="8-40"/>with an indication that each candidate is a candidate for the qualified political party;</subsection><subsection ssid="21-null-16" dnum="11-o" numlevel="1" lineno="607" slineno="8-41" level="1"><display>(11)</display>notwithstanding Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="14" groupid="14" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="20A-9-403(4)(a)" start="0">20A-9-403(4)(a)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="9" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="20A-9-403(8)(a)">20A-9-403(8)(a)</xref></amend>, the lieutenant <ln numlevel="1" lineno="608" slineno="8-42"/>governor shall include on the list provided by the lieutenant governor to the county <ln numlevel="1" lineno="609" slineno="8-43"/>clerks:<subsection ssid="21-null-17" dnum="a-o" numlevel="1" lineno="610" slineno="8-44" level="2"><display>(a)</display>the names of all candidates of the qualified political party for federal, constitutional, <ln numlevel="1" lineno="611" slineno="8-45"/>multicounty, and county offices; and</subsection><subsection ssid="21-null-18" dnum="b-o" numlevel="1" lineno="612" slineno="8-46" level="2"><display>(b)</display>the names of unopposed candidates for elective office who have been nominated by <ln numlevel="1" lineno="613" slineno="8-47"/>the qualified political party and instruct the county clerks to exclude such candidates <ln numlevel="1" lineno="614" slineno="8-48"/>from the primary-election ballot;</subsection></subsection><subsection ssid="21-null-19" dnum="12-o" numlevel="1" lineno="615" slineno="8-49" level="1"><display>(12)</display>notwithstanding Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="15" groupid="15" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="20A-9-403(5)(c)" start="0">20A-9-403(5)(c)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="10" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="20A-9-403(9)(c)">20A-9-403(9)(c)</xref></amend>, a candidate who is <ln numlevel="1" lineno="616" slineno="8-50"/>unopposed for an elective office in the regular primary election of the qualified political <ln numlevel="1" lineno="617" slineno="8-51"/>party is nominated by the party for that office without appearing on the primary ballot; <ln numlevel="1" lineno="618" slineno="8-52"/>and</subsection><subsection ssid="21-null-20" dnum="13-o" numlevel="1" lineno="619" slineno="8-53" level="1"><display>(13)</display>notwithstanding the provisions of Subsections <xref depth="4" refnumber="20A-9-403(1)" start="0">20A-9-403(1)</xref> and <xref depth="4" refnumber="20A-9-403(2)" start="0">(2)</xref> and Section <xref depth="3" refnumber="20A-9-405" start="0"><ln numlevel="1" lineno="620" slineno="8-54"/>20A-9-405</xref>, the qualified political party is entitled to have the names of <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="22" groupid="22" style="2" owner="jchristopherson" level="1" deltag="both">its</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="19" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the qualified <ln numlevel="1" lineno="621" slineno="8-55"/>political party's</amend> candidates for elective office featured with party affiliation on the ballot <ln numlevel="1" lineno="622" slineno="8-56"/>at a regular general election.</subsection></section></bsec><bsec buid="24" num="20A-9-408" type="amend" src="code" uid="C20A-9-S408_2027010120270101" sort="20A09 04080020270101" numlevel="1" lineno="623" slineno="9-1" sn="9"><section number="20A-9-408" numlevel="1" lineno="624" slineno="9-2" type="amend"><secline lineno="623">Section 9. Section <bold>20A-9-408</bold> is amended to read:</secline><catline lineno="624"><bold>20A-9-408<parens/>. Signature-gathering process to seek the nomination of a qualified <ln numlevel="1" lineno="625" slineno="9-3"/>political party -- Removal of signature.</bold></catline><subsection ssid="24-null-1" dnum="1-o" numlevel="1" lineno="626" slineno="9-4" level="1" placement="noreturn"><display>(1)</display>This section describes the requirements for a member of a qualified political party who <ln numlevel="1" lineno="627" slineno="9-5"/>is seeking the nomination of the qualified political party for an elective office through <ln numlevel="1" lineno="628" slineno="9-6"/>the signature-gathering process described in this section.</subsection><subsection ssid="24-null-2" dnum="2-o" numlevel="1" lineno="629" slineno="9-7" level="1"><display>(2)</display>Notwithstanding Subsection <xref depth="4" refnumber="20A-9-201(7)(a)" start="0">20A-9-201(7)(a)</xref>, the form of the declaration of candidacy <ln numlevel="1" lineno="630" slineno="9-8"/>for a member of a qualified political party who is nominated by, or who is seeking the <ln numlevel="1" lineno="631" slineno="9-9"/>nomination of, the qualified political party under this section shall be substantially as <ln numlevel="1" lineno="632" slineno="9-10"/>described in Section <xref depth="3" refnumber="20A-9-408.5" start="0">20A-9-408.5</xref>.</subsection><subsection ssid="24-null-3" dnum="3-o" numlevel="1" lineno="633" slineno="9-11" level="1"><display>(3)</display>Notwithstanding Subsection <xref depth="4" refnumber="20A-9-202(1)(a)" start="0">20A-9-202(1)(a)</xref>, and except as provided in Subsection <xref depth="4" refnumber="20A-9-202(4)" start="0"><ln numlevel="1" lineno="634" slineno="9-12"/>20A-9-202(4)</xref>, a member of a qualified political party who, under this section, is seeking <ln numlevel="1" lineno="635" slineno="9-13"/>the nomination of the qualified political party for an elective office that is to be filled at <ln numlevel="1" lineno="636" slineno="9-14"/>the next general election shall:<subsection ssid="24-null-4" dnum="a-o" numlevel="1" lineno="637" slineno="9-15" level="2"><display>(a)</display>except to the extent otherwise provided in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="126" groupid="98" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="20A-9-408(13)(a)">(13)(a)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="124" groupid="96" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(16)(a)</amend>, during the <ln numlevel="1" lineno="638" slineno="9-16"/>applicable declaration of candidacy filing period described in Section <xref depth="3" refnumber="20A-9-201.5" start="0">20A-9-201.5</xref>, <ln numlevel="1" lineno="639" slineno="9-17"/>and before gathering signatures under this section, file with the filing officer on a <ln numlevel="1" lineno="640" slineno="9-18"/>form approved by the lieutenant governor a notice of intent to gather signatures for <ln numlevel="1" lineno="641" slineno="9-19"/>candidacy that includes:<subsection ssid="24-null-5" dnum="i-o" numlevel="1" lineno="642" slineno="9-20" level="3"><display>(i)</display>the name of the member who will attempt to become a candidate for a registered <ln numlevel="1" lineno="643" slineno="9-21"/>political party under this section;</subsection><subsection ssid="24-null-6" dnum="ii-o" numlevel="1" lineno="644" slineno="9-22" level="3"><display>(ii)</display>the name of the registered political party for which the member is seeking <ln numlevel="1" lineno="645" slineno="9-23"/>nomination;</subsection><subsection ssid="24-null-7" dnum="iii-o" numlevel="1" lineno="646" slineno="9-24" level="3"><display>(iii)</display>the office for which the member is seeking to become a candidate;</subsection><subsection ssid="24-null-8" dnum="iv-o" numlevel="1" lineno="647" slineno="9-25" level="3"><display>(iv)</display>the address and telephone number of the member; and</subsection><subsection ssid="24-null-9" dnum="v-o" numlevel="1" lineno="648" slineno="9-26" level="3"><display>(v)</display>other information required by the lieutenant governor;</subsection></subsection><subsection ssid="24-null-10" dnum="b-o" numlevel="1" lineno="649" slineno="9-27" level="2"><display>(b)</display>except as provided in Subsection <xref depth="4" refnumber="20A-9-202(1)(c)" start="0">20A-9-202(1)(c)</xref>, file a declaration of candidacy, in <ln numlevel="1" lineno="650" slineno="9-28"/>person, with the filing officer during the applicable declaration of candidacy filing <ln numlevel="1" lineno="651" slineno="9-29"/>period described in Section <xref depth="3" refnumber="20A-9-201.5" start="0">20A-9-201.5</xref>; and</subsection><subsection ssid="24-null-11" dnum="c-o" numlevel="1" lineno="652" slineno="9-30" level="2"><display>(c)</display>pay the filing fee.</subsection></subsection><subsection ssid="24-null-12" dnum="4-o" numlevel="1" lineno="653" slineno="9-31" level="1"><display>(4)</display>Notwithstanding Subsection <xref depth="4" refnumber="20A-9-202(2)(a)" start="0">20A-9-202(2)(a)</xref>, a member of a qualified political party <ln numlevel="1" lineno="654" slineno="9-32"/>who, under this section, is seeking the nomination of the qualified political party for the <ln numlevel="1" lineno="655" slineno="9-33"/>office of district attorney within a multicounty prosecution district that is to be filled at <ln numlevel="1" lineno="656" slineno="9-34"/>the next general election shall:<subsection ssid="24-null-13" dnum="a-o" numlevel="1" lineno="657" slineno="9-35" level="2"><display>(a)</display>during the applicable declaration of candidacy filing period described in Section <xref depth="3" refnumber="20A-9-201.5" start="0"><ln numlevel="1" lineno="658" slineno="9-36"/>20A-9-201.5</xref>, and before gathering signatures under this section, file with the filing <ln numlevel="1" lineno="659" slineno="9-37"/>officer on a form approved by the lieutenant governor a notice of intent to gather <ln numlevel="1" lineno="660" slineno="9-38"/>signatures for candidacy that includes:<subsection ssid="24-null-14" dnum="i-o" numlevel="1" lineno="661" slineno="9-39" level="3"><display>(i)</display>the name of the member who will attempt to become a candidate for a registered <ln numlevel="1" lineno="662" slineno="9-40"/>political party under this section;</subsection><subsection ssid="24-null-15" dnum="ii-o" numlevel="1" lineno="663" slineno="9-41" level="3"><display>(ii)</display>the name of the registered political party for which the member is seeking <ln numlevel="1" lineno="664" slineno="9-42"/>nomination;</subsection><subsection ssid="24-null-16" dnum="iii-o" numlevel="1" lineno="665" slineno="9-43" level="3"><display>(iii)</display>the office for which the member is seeking to become a candidate;</subsection><subsection ssid="24-null-17" dnum="iv-o" numlevel="1" lineno="666" slineno="9-44" level="3"><display>(iv)</display>the address and telephone number of the member; and</subsection><subsection ssid="24-null-18" dnum="v-o" numlevel="1" lineno="667" slineno="9-45" level="3"><display>(v)</display>other information required by the lieutenant governor;</subsection></subsection><subsection ssid="24-null-19" dnum="b-o" numlevel="1" lineno="668" slineno="9-46" level="2"><display>(b)</display>except as provided in Subsection <xref depth="4" refnumber="20A-9-202(1)(c)" start="0">20A-9-202(1)(c)</xref>, file a declaration of candidacy, in <ln numlevel="1" lineno="669" slineno="9-47"/>person, with the filing officer during the applicable declaration of candidacy filing <ln numlevel="1" lineno="670" slineno="9-48"/>period described in Section <xref depth="3" refnumber="20A-9-201.5" start="0">20A-9-201.5</xref>; and</subsection><subsection ssid="24-null-20" dnum="c-o" numlevel="1" lineno="671" slineno="9-49" level="2"><display>(c)</display>pay the filing fee.</subsection></subsection><subsection ssid="24-null-21" dnum="5-o" numlevel="1" lineno="672" slineno="9-50" level="1"><display>(5)</display>Notwithstanding Subsection <xref depth="4" refnumber="20A-9-202(3)(a)(iii)" start="0">20A-9-202(3)(a)(iii)</xref>, a lieutenant governor candidate who <ln numlevel="1" lineno="673" slineno="9-51"/>files as the joint-ticket running mate of an individual who is nominated by a qualified <ln numlevel="1" lineno="674" slineno="9-52"/>political party, under this section, for the office of governor shall, during the applicable <ln numlevel="1" lineno="675" slineno="9-53"/>declaration of candidacy filing period described in Section <xref depth="3" refnumber="20A-9-201.5" start="0">20A-9-201.5</xref>, file a <ln numlevel="1" lineno="676" slineno="9-54"/>declaration of candidacy and submit a letter from the candidate for governor that names <ln numlevel="1" lineno="677" slineno="9-55"/>the lieutenant governor candidate as a joint-ticket running mate.</subsection><subsection ssid="24-null-22" dnum="6-o" numlevel="1" lineno="678" slineno="9-56" level="1"><display>(6)</display>The lieutenant governor shall ensure that the certification described in Subsection <xref depth="4" refnumber="20A-9-701(1)" start="0"><ln numlevel="1" lineno="679" slineno="9-57"/>20A-9-701(1)</xref> also includes the name of each candidate nominated by a qualified <ln numlevel="1" lineno="680" slineno="9-58"/>political party under this section.</subsection><subsection ssid="24-null-23" dnum="7-o" numlevel="1" lineno="681" slineno="9-59" level="1"><display>(7)</display>Notwithstanding Subsection <xref depth="4" refnumber="20A-9-701(2)" start="0">20A-9-701(2)</xref>, the ballot shall, for each candidate who is <ln numlevel="1" lineno="682" slineno="9-60"/>nominated by a qualified political party under this section, designate the qualified <ln numlevel="1" lineno="683" slineno="9-61"/>political party that nominated the candidate.</subsection><subsection ssid="24-null-24" dnum="8-o" numlevel="1" lineno="684" slineno="9-62" level="1"><display>(8)</display>A member of a qualified political party may seek the nomination of the qualified <ln numlevel="1" lineno="685" slineno="9-63"/>political party for an elective office by:<subsection ssid="24-null-25" dnum="a-o" numlevel="1" lineno="686" slineno="9-64" level="2"><display>(a)</display>complying with the requirements described in this section; and</subsection><subsection ssid="24-null-26" dnum="b-o" numlevel="1" lineno="687" slineno="9-65" level="2"><display>(b)</display>collecting signatures, on a form approved by the lieutenant governor that complies <ln numlevel="1" lineno="688" slineno="9-66"/>with Subsection <xref depth="4" refnumber="20A-9-405(3)" start="0">20A-9-405(3)</xref>, during the period beginning on the day on which the <ln numlevel="1" lineno="689" slineno="9-67"/>member files a notice of intent to gather signatures and ending at the applicable <ln numlevel="1" lineno="690" slineno="9-68"/>deadline described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="15" groupid="11" style="2" owner="jchristopherson" level="1" deltag="both">(12)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="12" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref refnumber="(15)" depth="4">(15)</xref></amend>, in the following amounts:<subsection ssid="24-null-27" dnum="i-o" numlevel="1" lineno="691" slineno="9-69" level="3"><display>(i)</display>for a statewide race, 28,000 signatures of registered voters in the state who are <ln numlevel="1" lineno="692" slineno="9-70"/>permitted by the qualified political party to vote for the qualified political party's <ln numlevel="1" lineno="693" slineno="9-71"/>candidates in a primary election;</subsection><subsection ssid="24-null-28" dnum="ii-o" numlevel="1" lineno="694" slineno="9-72" level="3"><display>(ii)</display>except as provided in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="127" groupid="99" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="20A-9-408(13)(b)">(13)(b)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="125" groupid="97" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(16)(b)</amend>, for a congressional district <ln numlevel="1" lineno="695" slineno="9-73"/>race, 7,000 signatures of registered voters who are residents of the congressional <ln numlevel="1" lineno="696" slineno="9-74"/>district and are permitted by the qualified political party to vote for the qualified <ln numlevel="1" lineno="697" slineno="9-75"/>political party's candidates in a primary election;</subsection><subsection ssid="24-null-29" dnum="iii-o" numlevel="1" lineno="698" slineno="9-76" level="3"><display>(iii)</display>for a state Senate district race, 2,000 signatures of registered voters who are <ln numlevel="1" lineno="699" slineno="9-77"/>residents of the state Senate district and are permitted by the qualified political <ln numlevel="1" lineno="700" slineno="9-78"/>party to vote for the qualified political party's candidates in a primary election;</subsection><subsection ssid="24-null-30" dnum="iv-o" numlevel="1" lineno="701" slineno="9-79" level="3"><display>(iv)</display>for a state House district race, 1,000 signatures of registered voters who are <ln numlevel="1" lineno="702" slineno="9-80"/>residents of the state House district and are permitted by the qualified political <ln numlevel="1" lineno="703" slineno="9-81"/>party to vote for the qualified political party's candidates in a primary election;</subsection><subsection ssid="24-null-31" dnum="v-o" numlevel="1" lineno="704" slineno="9-82" level="3"><display>(v)</display>for a State Board of Education race, the lesser of:<subsection ssid="24-null-32" dnum="A-o" numlevel="1" lineno="705" slineno="9-83" level="4"><display>(A)</display>2,000 signatures of registered voters who are residents of the State Board of <ln numlevel="1" lineno="706" slineno="9-84"/>Education district and are permitted by the qualified political party to vote for <ln numlevel="1" lineno="707" slineno="9-85"/>the qualified political party's candidates in a primary election; or</subsection><subsection ssid="24-null-33" dnum="B-o" numlevel="1" lineno="708" slineno="9-86" level="4"><display>(B)</display>3% of the registered voters of the qualified political party who are residents of <ln numlevel="1" lineno="709" slineno="9-87"/>the applicable State Board of Education district; and</subsection></subsection><subsection ssid="24-null-34" dnum="vi-o" numlevel="1" lineno="710" slineno="9-88" level="3"><display>(vi)</display>for a county office race, signatures of 3% of the registered voters who are <ln numlevel="1" lineno="711" slineno="9-89"/>residents of the area permitted to vote for the county office and are permitted by <ln numlevel="1" lineno="712" slineno="9-90"/>the qualified political party to vote for the qualified political party's candidates in <ln numlevel="1" lineno="713" slineno="9-91"/>a primary election.</subsection></subsection></subsection><subsection ssid="24-null-35" dnum="9-o" numlevel="1" lineno="714" slineno="9-92" level="1" space="false"><display>(9)</display><subsection ssid="24-null-36" dnum="a-o" level="2" placement="sameline"><display>(a)</display>This Subsection <xref depth="4" refnumber="20A-9-408(9)" start="0">(9)</xref> applies only to the manual candidate qualification process.</subsection><subsection ssid="24-null-37" dnum="b-o" numlevel="1" lineno="715" slineno="9-93" level="2"><display>(b)</display>In order for a member of the qualified political party to qualify as a candidate for the <ln numlevel="1" lineno="716" slineno="9-94"/>qualified political party's nomination for an elective office under this section, using <ln numlevel="1" lineno="717" slineno="9-95"/>the manual candidate qualification process, the member shall:<subsection ssid="24-null-38" dnum="i-o" numlevel="1" lineno="718" slineno="9-96" level="3"><display>(i)</display>collect the signatures on a form approved by the lieutenant governor, using the <ln numlevel="1" lineno="719" slineno="9-97"/>same circulation and verification requirements described in Sections <xref depth="3" refnumber="20A-7-105" start="0">20A-7-105</xref> <ln numlevel="1" lineno="720" slineno="9-98"/>and <xref depth="3" refnumber="20A-7-204" start="0">20A-7-204</xref>; and</subsection><subsection ssid="24-null-39" dnum="ii-o" numlevel="1" lineno="721" slineno="9-99" level="3"><display>(ii)</display>in accordance with Section <xref depth="3" refnumber="20A-9-408.3">20A-9-408.3</xref>, submit the signatures to the election <ln numlevel="1" lineno="722" slineno="9-100"/>officer before the applicable deadline described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="16" groupid="12" style="2" owner="jchristopherson" level="1" deltag="both">(12)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="13" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref refnumber="(15)" depth="4">(15)</xref></amend>.</subsection></subsection><subsection ssid="24-null-40" dnum="c-o" numlevel="1" lineno="723" slineno="9-101" level="2"><display>(c)</display>Upon timely receipt of the signatures described in Subsections <xref depth="4" refnumber="20A-9-408(8)" start="0">(8)</xref> and <xref depth="4" refnumber="20A-9-408(9)(b)" start="0">(9)(b)</xref>, and in <ln numlevel="1" lineno="724" slineno="9-102"/>accordance with Section <xref depth="3" refnumber="20A-9-408.3">20A-9-408.3</xref>, the election officer shall, no later than the <ln numlevel="1" lineno="725" slineno="9-103"/>earlier of 14 calendar days after the day on which the election officer receives the <ln numlevel="1" lineno="726" slineno="9-104"/>signatures, or <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="17" groupid="13" style="2" owner="jchristopherson" level="1" deltag="both">one day</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="14" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">seven calendar days</amend> before the day on which the qualified <ln numlevel="1" lineno="727" slineno="9-105"/>political party holds the convention to select a nominee for the elective office to <ln numlevel="1" lineno="728" slineno="9-106"/>which the signature packets relate:<subsection ssid="24-null-41" dnum="i-o" numlevel="1" lineno="729" slineno="9-107" level="3"><display>(i)</display>check the name of each individual who completes the verification for a signature <ln numlevel="1" lineno="730" slineno="9-108"/>packet to determine whether each individual is at least 18 years old;</subsection><subsection ssid="24-null-42" dnum="ii-o" numlevel="1" lineno="731" slineno="9-109" level="3"><display>(ii)</display>submit the name of each individual described in Subsection <xref depth="4" refnumber="20A-9-408(9)(c)(i)" start="0">(9)(c)(i)</xref> who is not at <ln numlevel="1" lineno="732" slineno="9-110"/>least 18 years old to the attorney general and the county attorney;</subsection><subsection ssid="24-null-43" dnum="iii-o" numlevel="1" lineno="733" slineno="9-111" level="3"><display>(iii)</display>with the assistance of the county clerk as applicable, determine whether each <ln numlevel="1" lineno="734" slineno="9-112"/>signer is a registered voter who is qualified to sign the petition, using the same <ln numlevel="1" lineno="735" slineno="9-113"/>method, described in Section <xref depth="3" refnumber="20A-1-1002" start="0">20A-1-1002</xref>, used to verify a signature on a petition; <ln numlevel="1" lineno="736" slineno="9-114"/>and</subsection><subsection ssid="24-null-44" dnum="iv-o" numlevel="1" lineno="737" slineno="9-115" level="3"><display>(iv)</display>certify whether each name is that of a registered voter who is qualified to sign the <ln numlevel="1" lineno="738" slineno="9-116"/>signature packet.</subsection></subsection><subsection ssid="24-null-45" dnum="d-o:_-i" numlevel="1" lineno="739" slineno="9-117" ea="erase" anum="0" owner="jchristopherson" style="2" level="2" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1283" style="2" owner="o" level="1" deltag="start">(d)</amend></display><subsection ssid="24-null-46" dnum="i-o:_-i" ea="erase" anum="0" owner="jchristopherson" style="2" level="3" placement="sameline"><display><amend anum="0" ea="erase" pairid="1284" style="2" owner="o" level="1">(i)</amend></display><amend anum="0" ea="erase" pairid="18" groupid="14" style="2" owner="jchristopherson" level="1" deltag="end">A registered voter who physically signs a form under Subsections <xref depth="4" refnumber="20A-9-408(8)" start="0">(8)</xref> and <xref depth="4" refnumber="20A-9-408(9)(b)" start="0"><ln numlevel="1" lineno="740" slineno="9-118"/>(9)(b)</xref> may have the voter's signature removed from the form by, no later than 5 <ln numlevel="1" lineno="741" slineno="9-119"/>p.m. three business days after the day on which the member submits the signature <ln numlevel="1" lineno="742" slineno="9-120"/>form to the election officer, submitting to the election officer a statement <ln numlevel="1" lineno="743" slineno="9-121"/>requesting that the voter's signature be removed.</amend><amendoutend style="2"/></subsection><subsection ssid="24-null-47" dnum="ii-o:_-i" numlevel="1" lineno="744" slineno="9-122" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1285" style="2" owner="o" level="1" deltag="start">(ii)</amend></display><amend anum="0" ea="erase" pairid="23" groupid="19" style="2" owner="jchristopherson" level="1" deltag="end">A statement described in Subsection <xref depth="4" refnumber="20A-9-408(9)(d)(i)" start="0">(9)(d)(i)</xref> shall comply with the requirements <ln numlevel="1" lineno="745" slineno="9-123"/>described in Subsection <xref depth="4" refnumber="20A-1-1003(2)" start="0">20A-1-1003(2)</xref>.</amend><amendoutend style="2"/></subsection><subsection ssid="24-null-48" dnum="iii-o:_-i" numlevel="1" lineno="746" slineno="9-124" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1286" style="2" owner="o" level="1" deltag="start">(iii)</amend></display><amend anum="0" ea="erase" pairid="28" groupid="24" style="2" owner="jchristopherson" level="1" deltag="end">With the assistance of the county clerk as applicable, the election officer shall <ln numlevel="1" lineno="747" slineno="9-125"/>use the procedures described in Subsection <xref depth="4" refnumber="20A-1-1003(3)" start="0">20A-1-1003(3)</xref> to determine whether <ln numlevel="1" lineno="748" slineno="9-126"/>to remove an individual's signature after receiving a timely, valid statement <ln numlevel="1" lineno="749" slineno="9-127"/>requesting removal of the signature.</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="24-null-49" dnum="e-o:d-i" numlevel="1" lineno="750" slineno="9-128" level="2" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1287" style="2" owner="o" level="1" deltag="both">(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1288" style="1" owner="i" level="1" amendtag="both" space="true">(d)</amend></display><subsection ssid="24-null-50" dnum="i-o" level="3" placement="sameline"><display>(i)</display>An election officer shall, in accordance with this Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="47" groupid="40" style="2" owner="jchristopherson" level="1" deltag="both"><xref refnumber="20A-9-408(9)(e)" depth="4">(9)(e)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="41" groupid="34" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(9)(d)</amend> <ln numlevel="1" lineno="751" slineno="9-129"/>and rules made under Section <xref depth="3" refnumber="20A-3a-106">20A-3a-106</xref>, conduct regular audits of signature <ln numlevel="1" lineno="752" slineno="9-130"/>comparisons made between signatures gathered under this section and voter <ln numlevel="1" lineno="753" slineno="9-131"/>signatures maintained by the election officer.</subsection><subsection ssid="24-null-51" dnum="ii-o" numlevel="1" lineno="754" slineno="9-132" level="3"><display>(ii)</display>An individual who conducts an audit of signature comparisons under this section <ln numlevel="1" lineno="755" slineno="9-133"/>may not audit the individual's own work.</subsection><subsection ssid="24-null-52" dnum="iii-o" numlevel="1" lineno="756" slineno="9-134" level="3"><display>(iii)</display>The election officer shall:<subsection ssid="24-null-53" dnum="A-o" numlevel="1" lineno="757" slineno="9-135" level="4"><display>(A)</display>audit 1% of all signature comparisons described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="48" groupid="41" style="2" owner="jchristopherson" level="1" deltag="both">(9)(e)(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="42" groupid="35" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="20A-9-408(9)(d)(i)"><ln numlevel="1" lineno="758" slineno="9-136"/>(9)(d)(i)</xref></amend> to determine the accuracy of the comparisons made;</subsection><subsection ssid="24-null-54" dnum="B-o" numlevel="1" lineno="759" slineno="9-137" level="4"><display>(B)</display>record the individuals who conducted the audit;</subsection><subsection ssid="24-null-55" dnum="C-o" numlevel="1" lineno="760" slineno="9-138" level="4"><display>(C)</display>record the audit results;</subsection><subsection ssid="24-null-56" dnum="D-o" numlevel="1" lineno="761" slineno="9-139" level="4"><display>(D)</display>provide additional training or staff reassignments, as needed, based on the <ln numlevel="1" lineno="762" slineno="9-140"/>results of an audit described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="49" groupid="42" style="2" owner="jchristopherson" level="1" deltag="both">(9)(e)(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="43" groupid="36" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="20A-9-408(9)(d)(i)">(9)(d)(i)</xref></amend>; and</subsection><subsection ssid="24-null-57" dnum="E-o" numlevel="1" lineno="763" slineno="9-141" level="4"><display>(E)</display>record any remedial action taken.</subsection></subsection><subsection ssid="24-null-58" dnum="iv-o" numlevel="1" lineno="764" slineno="9-142" level="3"><display>(iv)</display>The audit results described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="50" groupid="43" style="2" owner="jchristopherson" level="1" deltag="both">(9)(e)(iii)(C)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="44" groupid="37" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="20A-9-408(9)(d)(iii)(c)">(9)(d)(iii)(C)</xref></amend> are a public <ln numlevel="1" lineno="765" slineno="9-143"/>record.</subsection></subsection><subsection ssid="24-null-59" dnum="f-o:e-i" numlevel="1" lineno="766" slineno="9-144" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1297" style="2" owner="o" level="1" deltag="both">(f)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1298" style="1" owner="i" level="1" amendtag="both" space="true">(e)</amend></display>An election officer who certifies signatures under Subsection <xref refnumber="20A-9-408(9)(c)" depth="4">(9)(c)</xref> or  <xref refnumber="20A-9-403(3)(d)" depth="4"><ln numlevel="1" lineno="767" slineno="9-145"/>20A-9-403(3)(d)</xref> shall, after certifying enough signatures to establish that a candidate <ln numlevel="1" lineno="768" slineno="9-146"/>has reached the applicable signature threshold described in Subsection <xref refnumber="20A-9-408(8)" depth="4">(8)</xref> or <xref refnumber="20A-9-403(3)(a)" depth="4"><ln numlevel="1" lineno="769" slineno="9-147"/>20A-9-403(3)(a)</xref>, as applicable, continue to certify signatures submitted for the <ln numlevel="1" lineno="770" slineno="9-148"/>candidate in excess of the number of signatures required, until the election officer <ln numlevel="1" lineno="771" slineno="9-149"/>either:<subsection ssid="24-null-60" dnum="i-o" numlevel="1" lineno="772" slineno="9-150" level="3"><display>(i)</display>certifies signatures equal to 110% of the applicable signature threshold; or</subsection><subsection ssid="24-null-61" dnum="ii-o" numlevel="1" lineno="773" slineno="9-151" level="3"><display>(ii)</display>has reviewed all signatures submitted for the candidate before reaching an <ln numlevel="1" lineno="774" slineno="9-152"/>amount equal to 110% of the applicable signature threshold.</subsection></subsection></subsection><subsection ssid="24-null-62" dnum="10-o" numlevel="1" lineno="775" slineno="9-153" level="1" space="false"><display>(10)</display><subsection ssid="24-null-63" dnum="a-o" level="2" placement="sameline"><display>(a)</display>This Subsection <xref depth="4" refnumber="20A-9-408(10)" start="0">(10)</xref> applies only to the electronic candidate qualification <ln numlevel="1" lineno="776" slineno="9-154"/>process.</subsection><subsection ssid="24-null-64" dnum="b-o" numlevel="1" lineno="777" slineno="9-155" level="2"><display>(b)</display>In order for a member of the qualified political party to qualify as a candidate for the <ln numlevel="1" lineno="778" slineno="9-156"/>qualified political party's nomination for an elective office under this section, the <ln numlevel="1" lineno="779" slineno="9-157"/>member shall, before the deadline described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="119" groupid="91" style="2" owner="jchristopherson" level="1" deltag="both">(12)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="116" groupid="88" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="20A-9-408(15)">(15)</xref></amend>, collect <ln numlevel="1" lineno="780" slineno="9-158"/>signatures electronically:<subsection ssid="24-null-65" dnum="i-o" numlevel="1" lineno="781" slineno="9-159" level="3"><display>(i)</display>in accordance with Section <xref depth="3" refnumber="20A-21-201" start="0">20A-21-201</xref>; and</subsection><subsection ssid="24-null-66" dnum="ii-o" numlevel="1" lineno="782" slineno="9-160" level="3"><display>(ii)</display>using progressive screens, in a format approved by the lieutenant governor, that <ln numlevel="1" lineno="783" slineno="9-161"/>complies with Subsection <xref depth="4" refnumber="20A-9-405(4)" start="0">20A-9-405(4)</xref>.</subsection></subsection><subsection ssid="24-null-67" dnum="c-o" numlevel="1" lineno="784" slineno="9-162" level="2"><display>(c)</display>Upon timely receipt of the signatures described in Subsections <xref depth="4" refnumber="20A-9-408(8)" start="0">(8)</xref> and <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="51" groupid="44" style="2" owner="jchristopherson" level="1" deltag="both">(9)(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="45" groupid="38" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(10)(b)</amend>, <ln numlevel="1" lineno="785" slineno="9-163"/>the election officer shall, no later than the earlier of 14 calendar days after the day on <ln numlevel="1" lineno="786" slineno="9-164"/>which the election officer receives the signatures, or <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="52" groupid="45" style="2" owner="jchristopherson" level="1" deltag="both">one day</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="46" groupid="39" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">seven calendar days</amend> <ln numlevel="1" lineno="787" slineno="9-165"/>before the day on which the qualified political party holds the convention to select a <ln numlevel="1" lineno="788" slineno="9-166"/>nominee for the elective office to which the signature packets relate:<subsection ssid="24-null-68" dnum="i-o" numlevel="1" lineno="789" slineno="9-167" level="3"><display>(i)</display>check the name of each individual who completes the verification for a signature <ln numlevel="1" lineno="790" slineno="9-168"/>to determine whether each individual is at least 18 years old; and</subsection><subsection ssid="24-null-69" dnum="ii-o" numlevel="1" lineno="791" slineno="9-169" level="3"><display>(ii)</display>submit the name of each individual described in Subsection <xref depth="4" refnumber="20A-9-408(10)(c)(i)" start="0">(10)(c)(i)</xref> who is not <ln numlevel="1" lineno="792" slineno="9-170"/>at least 18 years old to the attorney general and the county attorney.</subsection></subsection></subsection><subsection ssid="24-81" dnum="_-o:11-i" numlevel="1" lineno="793" slineno="9-171" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1308" style="1" owner="i" level="1" amendtag="start">(11)</amend></display><amend anum="0" ea="amend" pairid="55" groupid="46" style="1" owner="jchristopherson" level="1" amendtag="end">Subject to Subsection <xref depth="4" refnumber="20A-9-408(13)(a)(i)">(13)(a)(i)</xref>, and notwithstanding Section <xref depth="3" refnumber="20A-2-104">20A-2-104</xref>, an election <ln numlevel="1" lineno="794" slineno="9-172"/>officer shall, no later than one business day after the day on which the signature of an <ln numlevel="1" lineno="795" slineno="9-173"/>individual who signs a petition is verified under Subsection <xref depth="4" refnumber="20A-9-408(9)(c)">(9)(c)</xref> or Section <xref depth="3" refnumber="20A-21-201">20A-21-201</xref>:</amend><subsection ssid="24-82" dnum="_-o:a-i" numlevel="1" lineno="796" slineno="9-174" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1309" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="56" groupid="47" style="1" owner="jchristopherson" level="1" amendtag="end">post the individual's name, voter precinct number, and date of signature on the <ln numlevel="1" lineno="797" slineno="9-175"/>lieutenant governor's website, in a conspicuous location designated by the lieutenant <ln numlevel="1" lineno="798" slineno="9-176"/>governor, for at least 90 calendar days after the date of the primary election; and</amend></subsection><subsection ssid="24-83" dnum="_-o:b-i" numlevel="1" lineno="799" slineno="9-177" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1310" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="59" groupid="49" style="1" owner="jchristopherson" level="1" amendtag="end">if the individual's voter information in the voter registration database includes a valid <ln numlevel="1" lineno="800" slineno="9-178"/>email address, use an electronic notification system to send an email notice to the <ln numlevel="1" lineno="801" slineno="9-179"/>individual, informing the individual that:</amend><subsection ssid="24-84" dnum="_-o:i-i" numlevel="1" lineno="802" verified;</amend></subsection><subsection ssid="24-85" dnum="_-o:ii-i" numlevel="1" lineno="803" slineno="9-181" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1312" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="65" groupid="53" style="1" owner="jchristopherson" level="1" amendtag="end">the individual's name and voter information described in Subsection <xref depth="4" refnumber="20A-9-408(11)(a)">(11)(a)</xref> is <ln numlevel="1" lineno="804" slineno="9-182"/>posted on the lieutenant governor's website; and</amend></subsection><subsection ssid="24-86" dnum="_-o:iii-i" numlevel="1" lineno="805" slineno="9-183" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1313" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="68" groupid="55" style="1" owner="jchristopherson" level="1" amendtag="end">the individual has until the deadline described in Subsection <xref depth="4" refnumber="20A-9-408(12)(a)">(12)(a)</xref> to submit a <ln numlevel="1" lineno="806" slineno="9-184"/>statement to the election officer, in accordance with Subsection <xref depth="4" refnumber="20A-1-1003(2)">20A-1-1003(2)</xref>, <ln numlevel="1" lineno="807" slineno="9-185"/>requesting that the individual's signature be removed from the petition.</amend></subsection></subsection></subsection><subsection ssid="24-87" dnum="_-o:12-i" numlevel="1" lineno="808" slineno="9-186" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1314" style="1" owner="i" level="1" amendtag="start">(12)</amend></display><subsection ssid="24-88" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1315" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="80" groupid="63" style="1" owner="jchristopherson" level="1" amendtag="end">A registered voter who physically signs a petition under Subsections <xref depth="4" refnumber="20A-9-408(8)">(8)</xref> and <xref depth="4" refnumber="20A-9-408(9)(b)"><ln numlevel="1" lineno="809" slineno="9-187"/>(9)(b)</xref>, or who electronically signs a petition under Subsections <xref depth="4" refnumber="20A-9-408(8)">(8)</xref> and <xref depth="4" refnumber="20A-9-408(10)(b)">(10)(b)</xref>, may <ln numlevel="1" lineno="810" slineno="9-188"/>have the voter's signature removed from the petition by, no later than 5 p.m. three <ln numlevel="1" lineno="811" slineno="9-189"/>business days after the day on which the election officer makes the posting described <ln numlevel="1" lineno="812" slineno="9-190"/>in Subsection <xref depth="4" refnumber="20A-9-408(11)(a)">(11)(a)</xref>, submitting to the election officer a statement requesting that <ln numlevel="1" lineno="813" slineno="9-191"/>the voter's signature be removed.</amend></subsection><subsection ssid="24-90" dnum="_-o:b-i" numlevel="1" lineno="814" slineno="9-192" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1316" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="83" groupid="65" style="1" owner="jchristopherson" level="1" amendtag="end">A statement described in Subsection <xref depth="4" refnumber="20A-9-408(12)(a)">(12)(a)</xref> shall comply with the requirements <ln numlevel="1" lineno="815" slineno="9-193"/>described in Subsection <xref depth="4" refnumber="20A-1-1003(2)">20A-1-1003(2)</xref>.</amend></subsection><subsection ssid="24-91" dnum="_-o:c-i" numlevel="1" lineno="816" slineno="9-194" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1317" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="86" groupid="67" style="1" owner="jchristopherson" level="1" amendtag="end">With the assistance of the county clerk as applicable, the election officer shall use the <ln numlevel="1" lineno="817" slineno="9-195"/>procedures described in Subsection <xref depth="4" refnumber="20A-1-1003(3)">20A-1-1003(3)</xref> to determine whether to remove <ln numlevel="1" lineno="818" slineno="9-196"/>an individual's signature from a petition after receiving a timely, valid statement <ln numlevel="1" lineno="819" slineno="9-197"/>requesting removal of the signature.</amend></subsection></subsection><subsection ssid="24-92" dnum="_-o:13-i" numlevel="1" lineno="820" slineno="9-198" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1318" style="1" owner="i" level="1" amendtag="start">(13)</amend></display><subsection ssid="24-93" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1319" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="98" groupid="75" style="1" owner="jchristopherson" level="1" amendtag="end">If an election officer timely receives a statement requesting signature removal <ln numlevel="1" lineno="821" slineno="9-199"/>under Subsection <xref depth="4" refnumber="20A-9-408(12)(a)">(12)(a)</xref> and determines that the signature should be removed from <ln numlevel="1" lineno="822" slineno="9-200"/>the petition under Subsection <xref depth="4" refnumber="20A-1-1003(3)">20A-1-1003(3)</xref>, the election officer shall:</amend><subsection ssid="24-95" dnum="_-o:i-i" numlevel="1" lineno="823" slineno="9-201" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1320" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="101" groupid="77" style="1" owner="jchristopherson" level="1" amendtag="end">remove the voter's name from the petition;</amend></subsection><subsection ssid="24-96" dnum="_-o:ii-i" numlevel="1" lineno="824" slineno="9-202" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1321" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="104" groupid="79" style="1" owner="jchristopherson" level="1" amendtag="end">remove the voter's name, voter precinct number, and date of signature from the <ln numlevel="1" lineno="825" slineno="9-203"/>posting described in Subsection <xref depth="4" refnumber="20A-9-408(11)(a)">(11)(a)</xref>; and</amend></subsection><subsection ssid="24-97" dnum="_-o:iii-i" numlevel="1" lineno="826" slineno="9-204" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1322" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="107" groupid="81" style="1" owner="jchristopherson" level="1" amendtag="end">update the petition signature totals.</amend></subsection></subsection><subsection ssid="24-98" dnum="_-o:b-i" numlevel="1" lineno="827" slineno="9-205" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1323" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="110" groupid="83" style="1" owner="jchristopherson" level="1" amendtag="end">The election officer shall comply with Subsection <xref depth="4" refnumber="20A-9-408(13)(a)">(13)(a)</xref> no later than 5 p.m. the day <ln numlevel="1" lineno="828" slineno="9-206"/>before the day of the convention described in Subsection <xref depth="4" refnumber="20A-9-408(14)(c)">(14)(c)</xref>.</amend></subsection></subsection><subsection ssid="24-null-70" dnum="11-o:14-i" numlevel="1" lineno="829" slineno="9-207" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1324" style="2" owner="o" level="1" deltag="both">(11)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1325" style="1" owner="i" level="1" amendtag="both" space="true">(14)</amend></display><subsection ssid="24-null-71" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An individual may not gather signatures under this section until after the <ln numlevel="1" lineno="830" slineno="9-208"/>individual files a notice of intent to gather signatures for candidacy described in this <ln numlevel="1" lineno="831" slineno="9-209"/>section.</subsection><subsection ssid="24-null-72" dnum="b-o" numlevel="1" lineno="832" slineno="9-210" level="2"><display>(b)</display>An individual who files a notice of intent to gather signatures for candidacy, <ln numlevel="1" lineno="833" slineno="9-211"/>described in Subsection <xref depth="4" refnumber="20A-9-408(3)(a)" start="0">(3)(a)</xref> or <xref depth="4" refnumber="20A-9-408(4)(a)" start="0">(4)(a)</xref>, is, beginning on the day on which the <ln numlevel="1" lineno="834" slineno="9-212"/>individual files the notice of intent to gather signatures for candidacy:<subsection ssid="24-null-73" dnum="i-o" numlevel="1" lineno="835" slineno="9-213" level="3"><display>(i)</display>required to comply with the reporting requirements that a candidate for office is <ln numlevel="1" lineno="836" slineno="9-214"/>required to comply with; and</subsection><subsection ssid="24-null-74" dnum="ii-o" numlevel="1" lineno="837" slineno="9-215" level="3"><display>(ii)</display>subject to the same enforcement provisions, and civil and criminal penalties, that <ln numlevel="1" lineno="838" slineno="9-216"/>apply to a candidate for office in relation to the reporting requirements described <ln numlevel="1" lineno="839" slineno="9-217"/>in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="120" groupid="92" style="2" owner="jchristopherson" level="1" deltag="both">(11)(b)(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="117" groupid="89" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="20A-9-408(14)(b)(i)">(14)(b)(i)</xref></amend>.</subsection></subsection><subsection ssid="24-null-75" dnum="c-o" numlevel="1" lineno="840" slineno="9-218" level="2"><display>(c)</display>Upon timely receipt of the signatures described in Subsections <xref depth="4" refnumber="20A-9-408(8)" start="0">(8)</xref> and <xref depth="4" refnumber="20A-9-408(9)(b)" start="0">(9)(b)</xref>, or <ln numlevel="1" lineno="841" slineno="9-219"/>Subsections <xref depth="4" refnumber="20A-9-408(8)" start="0">(8)</xref> and <xref depth="4" refnumber="20A-9-408(10)(b)" start="0">(10)(b)</xref>, the election officer shall, no later than the day before the <ln numlevel="1" lineno="842" slineno="9-220"/>day on which the qualified political party holds the convention to select a nominee <ln numlevel="1" lineno="843" slineno="9-221"/>for the elective office to which the signature packets relate, notify the qualified <ln numlevel="1" lineno="844" slineno="9-222"/>political party and the lieutenant governor of the name of each member of the <ln numlevel="1" lineno="845" slineno="9-223"/>qualified political party who qualifies as a nominee of the qualified political party, <ln numlevel="1" lineno="846" slineno="9-224"/>under this section, for the elective office to which the convention relates.</subsection><subsection ssid="24-null-76" dnum="d-o" numlevel="1" lineno="847" slineno="9-225" level="2"><display>(d)</display>Upon receipt of a notice of intent to gather signatures for candidacy described in this <ln numlevel="1" lineno="848" slineno="9-226"/>section, the lieutenant governor shall post the notice of intent to gather signatures for <ln numlevel="1" lineno="849" slineno="9-227"/>candidacy on the lieutenant governor's website in the same location that the <ln numlevel="1" lineno="850" slineno="9-228"/>lieutenant governor posts a declaration of candidacy.</subsection></subsection><subsection ssid="24-null-77" dnum="12-o:15-i" numlevel="1" lineno="851" slineno="9-229" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1331" style="2" owner="o" level="1" deltag="both">(12)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1332" style="1" owner="i" level="1" amendtag="both" space="true">(15)</amend></display>The deadline before which a member of a qualified political party must collect <ln numlevel="1" lineno="852" slineno="9-230"/>and submit signatures to the election officer under this section is 5 p.m. on the last <ln numlevel="1" lineno="853" slineno="9-231"/>business day that is at least <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="121" groupid="93" style="2" owner="jchristopherson" level="1" deltag="both">14</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="118" groupid="90" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">21</amend> calendar days before the day on which the qualified <ln numlevel="1" lineno="854" slineno="9-232"/>political party's convention for the office begins.</subsection><subsection ssid="24-null-78" dnum="13-o:16-i" numlevel="1" lineno="855" slineno="9-233" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1332" style="2" owner="o" level="1" deltag="both">(13)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1333" style="1" owner="i" level="1" amendtag="both" space="true">(16)</amend></display>For the 2026 election year only, an individual who desires to gather signatures to <ln numlevel="1" lineno="856" slineno="9-234"/>seek the nomination of a qualified political party for the office of United States <ln numlevel="1" lineno="857" slineno="9-235"/>representative shall:<subsection ssid="24-null-79" dnum="a-o" numlevel="1" lineno="858" slineno="9-236" level="2"><display>(a)</display>in accordance with Subsection <xref depth="4" refnumber="20A-9-408(3)(a)">(3)(a)</xref>, file a notice of intent to gather signatures <ln numlevel="1" lineno="859" slineno="9-237"/>during the period beginning at 8 a.m. on the first business day of January and ending <ln numlevel="1" lineno="860" slineno="9-238"/>at 5 p.m. on March 13, 2026; and</subsection><subsection ssid="24-null-80" dnum="b-o" numlevel="1" lineno="861" slineno="9-239" level="2"><display>(b)</display>during the period beginning on the day on which the individual files the notice of <ln numlevel="1" lineno="862" slineno="9-240"/>intent to gather signatures and ending at 5 p.m. on March 13, 2026, on a form <ln numlevel="1" lineno="863" slineno="9-241"/>approved by the lieutenant governor that complies with Subsection <xref depth="4" refnumber="20A-9-405(3)">20A-9-405(3)</xref>, <ln numlevel="1" lineno="864" slineno="9-242"/>collect 7,000 signatures of registered voters who are residents of the state and are <ln numlevel="1" lineno="865" slineno="9-243"/>permitted by the qualified political party to vote for the qualified political party's <ln numlevel="1" lineno="866" slineno="9-244"/>candidates in a primary election.</subsection></subsection></section></bsec><bsec buid="27" num="20A-9-502" type="amend" src="code" uid="C20A-9-S502_2027010120270101" sort="20A09 05020020270101" numlevel="1" lineno="867" slineno="10-1" sn="10"><section number="20A-9-502" numlevel="1" lineno="868" slineno="10-2" type="amend"><secline lineno="867">Section 10. Section <bold>20A-9-502</bold> is amended to read:</secline><catline lineno="868"><bold>20A-9-502<parens/>. Certificate of nomination -- Contents -- Circulation -- Verification -- <ln numlevel="1" lineno="869" slineno="10-3"/>Criminal penalty -- Removal of petition signature.</bold></catline><subsection ssid="27-null-1" dnum="1-o" numlevel="1" lineno="870" slineno="10-4" level="1" placement="noreturn"><display>(1)</display>The candidate shall:<subsection ssid="27-null-2" dnum="a-o" numlevel="1" lineno="871" slineno="10-5" level="2" format="full"><display>(a)</display>prepare a certificate of nomination in substantially the following form:<eol numlevel="1" lineno="872" slineno="10-6"/><para/>"State of Utah, County of ______________________________________________<eol numlevel="1" lineno="873" slineno="10-7"/><para/>I, ______________, declare my intention of becoming an unaffiliated candidate for the <ln numlevel="1" lineno="874" slineno="10-8"/>political group designated as ____ for the office of ____. If your voter registration information includes a <ln numlevel="1" lineno="913" slineno="10-47"/>valid email address, you will receive an email notifying you of the disclosure as <ln numlevel="1" lineno="914" slineno="10-48"/>well as information on how to remove your name from this petition. If you choose not to provide it, your signature may <ln numlevel="1" lineno="941" slineno="10-75"/>not be certified as a valid signature if you change your address before petition <ln numlevel="1" lineno="942" slineno="10-76"/>signatures are certified or if the information you provide does not match your <ln numlevel="1" lineno="943" slineno="10-77"/>voter registration records."; and</subsection></subsection></subsection><subsection ssid="27-null-18" dnum="c-o" numlevel="1" lineno="944" slineno="10-78" level="2" format="full"><display>(c)</display>bind a final page to one or more signature sheets that are bound together that contains, <ln numlevel="1" lineno="945" slineno="10-79"/>except as provided by Subsection <xref depth="4" refnumber="20A-9-502(3)">(3)</xref>, the certificate of nomination under Subsection <xref depth="4" refnumber="20A-9-503(2)(b)"><ln numlevel="1" lineno="959" slineno="10-93"/>20A-9-503(2)(b)</xref> or <xref depth="4" refnumber="20A-9-502(4)(b)">(4)(b)</xref> may not sign the form described in Subsection <xref depth="4" refnumber="20A-9-502(1)(a)">(1)(a)</xref>.</subsection><subsection ssid="27-null-20" dnum="3-o" numlevel="1" lineno="960" slineno="10-94" level="1" space="false"><display>(3)</display><subsection ssid="27-null-21" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The candidate shall circulate the nomination petition and ensure that the person in <ln numlevel="1" lineno="961" slineno="10-95"/>whose presence each signature sheet is signed:<subsection ssid="27-null-22" dnum="i-o" numlevel="1" lineno="962" slineno="10-96" level="3" tab="1"><display>(i)</display>is at least 18 years old; and</subsection><subsection ssid="27-null-23" dnum="ii-o" numlevel="1" lineno="963" slineno="10-97" level="3" tab="1"><display>(ii)</display>verifies each signature sheet by completing the verification bound to one or more <ln numlevel="1" lineno="964" slineno="10-98"/>signature sheets that are bound together.</subsection></subsection><subsection ssid="27-null-24" dnum="b-o" numlevel="1" lineno="965" slineno="10-99" level="2"><display>(b)</display>A person may not sign the circulator verification if the person signed a signature <ln numlevel="1" lineno="966" slineno="10-100"/>sheet bound to the verification.</subsection></subsection><subsection ssid="27-null-25" dnum="4-o" numlevel="1" lineno="967" slineno="10-101" level="1" space="false"><display>(4)</display><subsection ssid="27-null-26" dnum="a-o" level="2" placement="sameline"><display>(a)</display>It is unlawful for any person to:<subsection ssid="27-null-27" dnum="i-o" numlevel="1" lineno="968" slineno="10-102" level="3" tab="1"><display>(i)</display>knowingly sign a certificate of nomination signature sheet:<subsection ssid="27-null-28" dnum="A-o" numlevel="1" lineno="969" slineno="10-103" level="4"><display>(A)</display>with any name other than the person's own name;</subsection><subsection ssid="27-null-29" dnum="B-o" numlevel="1" lineno="970" slineno="10-104" level="4"><display>(B)</display>more than once for the same candidate; or</subsection><subsection ssid="27-null-30" dnum="C-o" numlevel="1" lineno="971" slineno="10-105" level="4"><display>(C)</display>if the person is not registered to vote in this state and does not intend to <ln numlevel="1" lineno="972" slineno="10-106"/>become registered to vote in this state before the county clerk certifies the <ln numlevel="1" lineno="973" slineno="10-107"/>signatures; or</subsection></subsection><subsection ssid="27-null-31" dnum="ii-o" numlevel="1" lineno="974" slineno="10-108" level="3" tab="1"><display>(ii)</display>sign the verification of a certificate of nomination signature sheet if the person:<subsection ssid="27-null-32" dnum="A-o" numlevel="1" lineno="975" slineno="10-109" level="4"><display>(A)</display>has not witnessed the signing by those persons whose names appear on the <ln numlevel="1" lineno="976" slineno="10-110"/>certificate of nomination signature sheet; or</subsection><subsection ssid="27-null-33" dnum="B-o" numlevel="1" lineno="977" slineno="10-111" level="4"><display>(B)</display>knows that a person whose signature appears on the certificate of nomination <ln numlevel="1" lineno="978" slineno="10-112"/>signature sheet is not registered to vote in this state and does not intend to <ln numlevel="1" lineno="979" slineno="10-113"/>become registered to vote in this state.</subsection></subsection></subsection><subsection ssid="27-null-34" dnum="b-o" numlevel="1" lineno="980" slineno="10-114" level="2"><display>(b)</display>Any person violating this Subsection <xref depth="4" refnumber="20A-9-502(4)">(4)</xref> is guilty of a class A misdemeanor.</subsection></subsection><subsection ssid="27-null-35" dnum="5-o" numlevel="1" lineno="981" slineno="10-115" level="1" space="false"><display>(5)</display><subsection ssid="27-null-36" dnum="a-o" level="2" placement="sameline"><display>(a)</display>To qualify for placement on the general election ballot, the candidate shall, no <ln numlevel="1" lineno="982" slineno="10-116"/>earlier than the start of the applicable declaration of candidacy period described in <ln numlevel="1" lineno="983" slineno="10-117"/>Section <xref depth="3" refnumber="20A-9-201.5">20A-9-201.5</xref> and no later than 5 p.m. on June 15 of the year in which the <ln numlevel="1" lineno="984" slineno="10-118"/>election will be held:<subsection ssid="27-null-37" dnum="i-o" numlevel="1" lineno="985" slineno="10-119" level="3" tab="1"><display>(i)</display>comply with Subsection <xref depth="4" refnumber="20A-9-503(1)">20A-9-503(1)</xref>; and</subsection><subsection ssid="27-null-38" dnum="ii-o" numlevel="1" lineno="986" slineno="10-120" level="3" tab="1"><display>(ii)</display>submit each signature packet to the county clerk where the majority of the <ln numlevel="1" lineno="987" slineno="10-121"/>signatures in the packet were collected, with signatures totaling:<subsection ssid="27-null-39" dnum="A-o" numlevel="1" lineno="988" slineno="10-122" level="4"><display>(A)</display>at least 1,000 registered voters residing within the state when the nomination <ln numlevel="1" lineno="989" slineno="10-123"/>is for an office to be filled by the voters of the entire state; or</subsection><subsection ssid="27-null-40" dnum="B-o" numlevel="1" lineno="990" slineno="10-124" level="4"><display>(B)</display>at least 300 registered voters residing within a political division or at least 5% <ln numlevel="1" lineno="991" slineno="10-125"/>of the registered voters residing within a political division, whichever is less, <ln numlevel="1" lineno="992" slineno="10-126"/>when the nomination is for an office to be filled by the voters of any political <ln numlevel="1" lineno="993" slineno="10-127"/>division smaller than the state.</subsection></subsection></subsection><subsection ssid="27-null-41" dnum="b-o" numlevel="1" lineno="994" slineno="10-128" level="2"><display>(b)</display>A candidate has not complied with Subsection <xref depth="4" refnumber="20A-9-502(5)(a)(ii)">(5)(a)(ii)</xref>, unless the county clerks <ln numlevel="1" lineno="995" slineno="10-129"/>verify that each required signature is a valid signature of a registered voter who is <ln numlevel="1" lineno="996" slineno="10-130"/>eligible to sign the signature packet and has not signed a signature packet to nominate <ln numlevel="1" lineno="997" slineno="10-131"/>another candidate for the same office.</subsection><subsection ssid="27-null-42" dnum="c-o" numlevel="1" lineno="998" slineno="10-132" level="2"><display>(c)</display>In reviewing the signature packets, the county clerk shall count and certify only those <ln numlevel="1" lineno="999" slineno="10-133"/>persons who signed with a holographic signature, who:<subsection ssid="27-null-43" dnum="i-o" numlevel="1" lineno="1000" slineno="10-134" level="3"><display>(i)</display>are registered voters within the political division that the candidate seeks to <ln numlevel="1" lineno="1001" slineno="10-135"/>represent; and</subsection><subsection ssid="27-null-44" dnum="ii-o" numlevel="1" lineno="1002" slineno="10-136" level="3"><display>(ii)</display>did not sign any other certificate of nomination for that office.</subsection></subsection><subsection ssid="27-null-45" dnum="d-o" numlevel="1" lineno="1003" slineno="10-137" level="2"><display>(d)</display>The county clerk shall count and certify the number of registered voters who validly <ln numlevel="1" lineno="1004" slineno="10-138"/>signed a signature packet, no later than 30 calendar days after the day on which the <ln numlevel="1" lineno="1005" slineno="10-139"/>candidate submits the signature packet.</subsection><subsection ssid="27-null-46" dnum="e-o" numlevel="1" lineno="1006" slineno="10-140" level="2"><display>(e)</display>The candidate may supplement the signatures or amend the certificate of nomination <ln numlevel="1" lineno="1007" slineno="10-141"/>or declaration of candidacy at any time on or before 5 p.m. on June 15 of the year in <ln numlevel="1" lineno="1008" slineno="10-142"/>which the election will be held.</subsection><subsection ssid="27-null-47" dnum="f-o" numlevel="1" lineno="1009" slineno="10-143" level="2"><display>(f)</display>The county clerk shall use the procedures described in Section <xref depth="3" refnumber="20A-1-1002">20A-1-1002</xref> to <ln numlevel="1" lineno="1010" slineno="10-144"/>determine whether a signer is a registered voter who is qualified to sign the signature <ln numlevel="1" lineno="1011" slineno="10-145"/>packet.</subsection></subsection><subsection ssid="27-54" dnum="_-o:6-i" numlevel="1" lineno="1012" slineno="10-146" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1384" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="22" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="end">Subject to Subsection <xref depth="4" refnumber="20A-9-502(8)(a)(i)">(8)(a)(i)</xref>, and notwithstanding Section <xref depth="3" refnumber="20A-2-104">20A-2-104</xref>, the county <ln numlevel="1" lineno="1013" slineno="10-147"/>clerk shall, no later than one business day after the day on which the signature of a voter <ln numlevel="1" lineno="1014" slineno="10-148"/>who signs a signature packet is verified under Subsection <xref depth="4" refnumber="20A-9-502(5)(b)">(5)(b)</xref>:</amend><subsection ssid="27-55" dnum="_-o:a-i" numlevel="1" lineno="1015" slineno="10-149" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1385" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="23" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="end">post the voter's name, voter precinct number, and date of signature on the lieutenant <ln numlevel="1" lineno="1016" slineno="10-150"/>governor's website, in a conspicuous location designated by the lieutenant governor, <ln numlevel="1" lineno="1017" slineno="10-151"/>for at least 90 calendar days after the date of the general election; and</amend></subsection><subsection ssid="27-56" dnum="_-o:b-i" numlevel="1" lineno="1018" slineno="10-152" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1386" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="end">if the voter's voter information in the voter registration database includes a valid <ln numlevel="1" lineno="1019" slineno="10-153"/>email address, use an electronic notification system to send an email notice to the <ln numlevel="1" lineno="1020" slineno="10-154"/>voter, informing the voter that:</amend><subsection ssid="27-57" dnum="_-o:i-i" numlevel="1" lineno="1021" slineno="10-155" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1387" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="29" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="end">the voter's nomination petition signature is verified;</amend></subsection><subsection ssid="27-58" dnum="_-o:ii-i" numlevel="1" lineno="1022" slineno="10-156" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1388" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="32" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="end">the voter's name and voter information described in Subsection <xref depth="4" refnumber="20A-9-502(6)(a)">(6)(a)</xref> is posted on <ln numlevel="1" lineno="1023" slineno="10-157"/>the lieutenant governor's website; and</amend></subsection><subsection ssid="27-59" dnum="_-o:iii-i" numlevel="1" lineno="1024" slineno="10-158" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1389" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="35" groupid="28" style="1" owner="jchristopherson" level="1" amendtag="end">the voter has until the deadline described in Subsection <xref depth="4" refnumber="20A-9-502(7)(a)">(7)(a)</xref> to submit a <ln numlevel="1" lineno="1025" slineno="10-159"/>statement to the county clerk, in accordance with Subsection <xref depth="4" refnumber="20A-1-1003(2)">20A-1-1003(2)</xref>, <ln numlevel="1" lineno="1026" slineno="10-160"/>requesting that the voter's signature be removed from the petition.</amend></subsection></subsection></subsection><subsection ssid="27-null-48" dnum="6-o:7-i" numlevel="1" lineno="1027" slineno="10-161" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1390" style="2" owner="o" level="1" deltag="both">(6)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1391" style="1" owner="i" level="1" amendtag="both" space="true">(7)</amend></display><subsection ssid="27-null-49" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A voter who signs a signature packet under this section may have the voter's <ln numlevel="1" lineno="1028" slineno="10-162"/>signature removed from the signature packet by, no later than 5 p.m. three business <ln numlevel="1" lineno="1029" slineno="10-163"/>days after the day on which <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="46" groupid="37" style="2" owner="jchristopherson" level="1" deltag="both">the candidate submits the signature packet to the county <ln numlevel="1" lineno="1030" slineno="10-164"/>clerk</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="44" groupid="35" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the county clerk makes the posting described in Subsection <xref depth="4" refnumber="20A-9-502(6)(a)">(6)(a)</xref></amend>, submitting to <ln numlevel="1" lineno="1031" slineno="10-165"/>the county clerk a statement requesting that the voter's signature be removed.</subsection><subsection ssid="27-null-50" dnum="b-o" numlevel="1" lineno="1032" slineno="10-166" level="2"><display>(b)</display>A statement described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="47" groupid="38" style="2" owner="jchristopherson" level="1" deltag="both">(6)(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="45" groupid="36" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="20A-9-502(7)(a)">(7)(a)</xref></amend> shall comply with the <ln numlevel="1" lineno="1033" slineno="10-167"/>requirements described in Subsection <xref depth="4" refnumber="20A-1-1003(2)">20A-1-1003(2)</xref>.</subsection><subsection ssid="27-null-51" dnum="c-o" numlevel="1" lineno="1034" slineno="10-168" level="2"><display>(c)</display>The county clerk shall use the procedures described in Subsection <xref depth="4" refnumber="20A-1-1003(3)">20A-1-1003(3)</xref> to <ln numlevel="1" lineno="1035" slineno="10-169"/>determine whether to remove an individual's signature from a signature packet after <ln numlevel="1" lineno="1036" slineno="10-170"/>receiving a timely, valid statement requesting removal of the signature.</subsection></subsection><subsection ssid="27-60" dnum="_-o:8-i" numlevel="1" lineno="1037" slineno="10-171" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1394" style="1" owner="i" level="1" amendtag="start">(8)</amend></display><subsection ssid="27-61" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1395" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="52" groupid="41" style="1" owner="jchristopherson" level="1" amendtag="end">If a county clerk timely receives a statement requesting signature removal under <ln numlevel="1" lineno="1038" slineno="10-172"/>Subsection <xref depth="4" refnumber="20A-9-502(7)(a)">(7)(a)</xref> and determines that the signature should be removed from the <ln numlevel="1" lineno="1039" slineno="10-173"/>nomination petition under Subsection <xref depth="4" refnumber="20A-1-1003(3)">20A-1-1003(3)</xref>, the county clerk shall:</amend><subsection ssid="27-63" dnum="_-o:i-i" numlevel="1" lineno="1040" slineno="10-174" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1396" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="55" groupid="43" style="1" owner="jchristopherson" level="1" amendtag="end">remove the voter's name from the nomination petition;</amend></subsection><subsection ssid="27-64" dnum="_-o:ii-i" numlevel="1" lineno="1041" slineno="10-175" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1397" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="58" groupid="45" style="1" owner="jchristopherson" level="1" amendtag="end">remove the voter's name, voter precinct number, and date of signature from the <ln numlevel="1" lineno="1042" slineno="10-176"/>posting described in Subsection (6)(a); and</amend></subsection><subsection ssid="27-65" dnum="_-o:iii-i" numlevel="1" lineno="1043" slineno="10-177" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1398" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="61" groupid="47" style="1" owner="jchristopherson" level="1" amendtag="end">update the nomination petition signature totals.</amend></subsection></subsection><subsection ssid="27-66" dnum="_-o:b-i" numlevel="1" lineno="1044" slineno="10-178" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1399" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="64" groupid="49" style="1" owner="jchristopherson" level="1" amendtag="end">The county clerk shall comply with Subsection <xref depth="4" refnumber="20A-9-502(8)(a)">(8)(a)</xref> no later than five business days <ln numlevel="1" lineno="1045" slineno="10-179"/>after the day on which the county clerk receives a statement requesting signature <ln numlevel="1" lineno="1046" slineno="10-180"/>removal under Subsection <xref depth="4" refnumber="20A-9-502(7)(a)">(7)(a)</xref>.</amend></subsection></subsection></section></bsec><bsec buid="11" num="20A-9-701" type="amend" src="code" uid="C20A-9-S701_2027010120270101" sort="20A09 07010020270101" numlevel="1" lineno="1047" slineno="11-1" sn="11"><section number="20A-9-701" numlevel="1" lineno="1048" slineno="11-2" type="amend"><secline lineno="1047">Section 11. Section <bold>20A-9-701</bold> is amended to read:</secline><catline lineno="1048"><bold>20A-9-701<parens/>. Certification of party candidates to county clerks -- Display on ballot.</bold></catline><subsection ssid="11-null-5" dnum="1-o" numlevel="1" lineno="1049" slineno="11-3" level="1" placement="noreturn"><display>(1)</display>No later than August 31 of each regular general election year, the lieutenant governor <ln numlevel="1" lineno="1050" slineno="11-4"/>shall certify to each county clerk, for offices to be voted upon at the regular general <ln numlevel="1" lineno="1051" slineno="11-5"/>election in that county clerk's county:<subsection ssid="11-null-6" dnum="a-o" numlevel="1" lineno="1052" slineno="11-6" level="2"><display>(a)</display>the names of each candidate nominated under Subsection <xref depth="4" refnumber="20A-9-202(4)" start="0">20A-9-202(4)</xref> or <ln numlevel="1" lineno="1053" slineno="11-7"/>Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both">20A-9-403(5)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="20A-9-403(9)">20A-9-403(9)</xref></amend>; and</subsection><subsection ssid="11-null-7" dnum="b-o" numlevel="1" lineno="1054" slineno="11-8" level="2"><display>(b)</display>the names of the candidates for president and vice president that are certified by the <ln numlevel="1" lineno="1055" slineno="11-9"/>registered political party as the party's nominees.</subsection></subsection><subsection ssid="11-null-8" dnum="2-o" numlevel="1" lineno="1056" slineno="11-10" level="1"><display>(2)</display>The names shall be certified by the lieutenant governor and shall be displayed on the <ln numlevel="1" lineno="1057" slineno="11-11"/>ballot as they are provided on the candidate's declaration of candidacy.  No other names <ln numlevel="1" lineno="1058" slineno="11-12"/>may appear on the ballot as affiliated with, endorsed by, or nominated by any other <ln numlevel="1" lineno="1059" slineno="11-13"/>registered political party, political party, or other political group.</subsection></section></bsec><bsec buid="28" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="1060" slineno="12-1" sn="12"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="1060">Section 12.  <bold>Effective Date.</bold></secline><sectionText lineno="1061"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="1/1/2027">January 1, 2027</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>1-17-26 2:12 PM</tm></rev></foot></leg>
