Section <bold>63M-7-101.5</bold> is amended to read:</secline><catline lineno="39"><bold>63M-7-101.5<parens/>. Definitions for chapter.</bold></catline><sectionText lineno="40"><tab/>As used in this chapter:</sectionText><subsection ssid="14-null-1" dnum="1-o" numlevel="1" lineno="41" slineno="1-4" level="1"><display>(1)</display>"Commission" means, except as provided in Sections <xref depth="3" refnumber="63M-7-901">63M-7-901</xref> and <xref depth="3" refnumber="63M-7-1101">63M-7-1101</xref>, the <ln numlevel="1" lineno="42" slineno="1-5"/>State Commission on Criminal and Juvenile Justice created in Section <xref depth="3" refnumber="63M-7-201">63M-7-201</xref>.</subsection><subsection ssid="14-null-2" dnum="2-o" numlevel="1" lineno="43" slineno="1-6" level="1"><display>(2)</display>"Desistance" means an individual's abstinence from further criminal activity after a <ln numlevel="1" lineno="44" slineno="1-7"/>previous criminal conviction.</subsection><subsection ssid="14-null-3" dnum="3-o" numlevel="1" lineno="45" slineno="1-8" level="1"><display>(3)</display>"Intervention" means a program, sanction, supervision, or event that may impact <ln numlevel="1" lineno="46" slineno="1-9"/>recidivism.</subsection><subsection ssid="14-null-4" dnum="4-o" numlevel="1" lineno="47" slineno="1-10" level="1"><display>(4)</display>"Recidivism" means a return to criminal activity after a previous criminal conviction.</subsection><subsection ssid="14-8" dnum="_-o:5-i" numlevel="1" lineno="48" slineno="1-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1004" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="13" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="end">"Recidivism standard metric" means the number of individuals who are incarcerated in <ln numlevel="1" lineno="49" slineno="1-12"/>a county jail or a state correctional facility:</amend><subsection ssid="14-19" dnum="_-o:a-i" numlevel="1" lineno="50" slineno="1-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="68" groupid="53" style="1" owner="jchristopherson" level="1" amendtag="end">within three years after the day on which the individuals are released from <ln numlevel="1" lineno="51" slineno="1-14"/>incarceration in a county jail or state correctional facility for a prior conviction; and</amend></subsection><subsection ssid="14-20" dnum="_-o:b-i" numlevel="1" lineno="52" slineno="1-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="73" groupid="57" style="1" owner="jchristopherson" level="1" amendtag="end">due to:</amend><subsection ssid="14-21" dnum="_-o:i-i" numlevel="1" lineno="53" slineno="1-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="78" groupid="61" style="1" owner="jchristopherson" level="1" amendtag="end">a subsequent conviction; or</amend></subsection><subsection ssid="14-22" dnum="_-o:ii-i" numlevel="1" lineno="54" slineno="1-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="83" groupid="65" style="1" owner="jchristopherson" level="1" amendtag="end">an arrest for:</amend><subsection ssid="14-23" dnum="_-o:A-i" numlevel="1" lineno="55" slineno="1-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="88" groupid="69" style="1" owner="jchristopherson" level="1" amendtag="end">a felony offense; or</amend></subsection><subsection ssid="14-25" dnum="_-o:B-i" numlevel="1" lineno="56" slineno="1-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="95" groupid="75" style="1" owner="jchristopherson" level="1" amendtag="end">a misdemeanor offense when an element of the misdemeanor offense is the <ln numlevel="1" lineno="57" slineno="1-20"/>use or attempted use of physical force against an individual or property.</amend></subsection></subsection></subsection></subsection><subsection ssid="14-null-5" dnum="5-o:_-i" numlevel="1" lineno="58" slineno="1-21" ea="erase" anum="0" owner="jchristopherson" style="2" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1011" style="2" owner="o" level="1" deltag="start">(5)</amend></display><amend anum="0" ea="erase" pairid="3" groupid="2" style="2" owner="jchristopherson" level="1" deltag="end">"Recidivism standard metric" means the number of individuals who are returned to <ln numlevel="1" lineno="59" slineno="1-22"/>prison for a new conviction within the three years after the day on which the individuals <ln numlevel="1" lineno="60" slineno="1-23"/>were released from prison.</amend><amendoutend style="2"/></subsection></section></bsec><bsec buid="16" num="63M-7-102" type="amend" src="code" uid="C63M-7-S102_2026050620260506" sort="63M07 01020020260506" numlevel="1" lineno="61" slineno="2-1" sn="2"><section number="63M-7-102" numlevel="1" lineno="62" slineno="2-2" type="amend"><secline lineno="61">Section 2. Section <bold>63M-7-102</bold> is amended to read:</secline><catline lineno="62"><bold>63M-7-102<parens/>. Recidivism metrics -- Reporting.</bold></catline><subsection ssid="16-null-1" dnum="1-o" numlevel="1" lineno="63" slineno="2-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="16-null-2" dnum="a-o:_-i" ea="erase" anum="0" owner="jchristopherson" style="2" level="2" placement="sameline"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1013" style="2" owner="o" level="1" deltag="start">(a)</amend></display><amend anum="0" ea="erase" pairid="17" groupid="11" style="2" owner="jchristopherson" level="1" deltag="end">The</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="19" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">When reporting data on statewide recidivism, the</amend> commission, the <ln numlevel="1" lineno="64" slineno="2-4"/>Department of Corrections, and the Board of Pardons and Parole<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="21" groupid="15" style="2" owner="jchristopherson" level="1" deltag="start">, </amend><amend anum="0" ea="erase" pairid="20" groupid="14" style="2" owner="jchristopherson" level="1" deltag="end">when reporting <ln numlevel="1" lineno="65" slineno="2-5"/>data on statewide recidivism, </amend><amendoutend style="2"/>shall include data reflecting the recidivism standard <ln numlevel="1" lineno="66" slineno="2-6"/>metric.</subsection><subsection ssid="16-null-3" dnum="b-o:_-i" numlevel="1" lineno="67" slineno="2-7" ea="erase" anum="0" owner="jchristopherson" style="2" level="2" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1014" style="2" owner="o" level="1" deltag="start">(b)</amend></display><subsection ssid="16-null-4" dnum="i-o:_-i" ea="erase" anum="0" owner="jchristopherson" style="2" level="3" placement="sameline"><display><amend anum="0" ea="erase" pairid="1015" style="2" owner="o" level="1">(i)</amend></display><amend anum="0" ea="erase" pairid="11" groupid="6" style="2" owner="jchristopherson" level="1" deltag="end">On or before August 1, 2024, the commission shall reevaluate the recidivism <ln numlevel="1" lineno="68" slineno="2-8"/>standard metric to determine whether new data streams allow for a broader <ln numlevel="1" lineno="69" slineno="2-9"/>definition, which may include criminal convictions that do not include prison time.</amend><amendoutend style="2"/></subsection><subsection ssid="16-null-5" dnum="ii-o:_-i" numlevel="1" lineno="70" slineno="2-10" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1016" style="2" owner="o" level="1" deltag="start">(ii)</amend></display><amend anum="0" ea="erase" pairid="12" groupid="7" style="2" owner="jchristopherson" level="1" deltag="end">On or before November 1, 2024, the commission shall report to the Law <ln numlevel="1" lineno="71" slineno="2-11"/>Enforcement and Criminal Justice Interim Committee:</amend><amendoutend style="2"/><subsection ssid="16-null-6" dnum="A-o:_-i" numlevel="1" lineno="72" slineno="2-12" ea="erase" anum="0" owner="jchristopherson" style="2" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1017" style="2" owner="o" level="1" deltag="start">(A)</amend></display><amend anum="0" ea="erase" pairid="13" groupid="8" style="2" owner="jchristopherson" level="1" deltag="end">the result of the reevaluation described in Subsection (1)(b)(i); and</amend><amendoutend style="2"/></subsection><subsection ssid="16-null-7" dnum="B-o:_-i" numlevel="1" lineno="73" slineno="2-13" ea="erase" anum="0" owner="jchristopherson" style="2" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1018" style="2" owner="o" level="1" deltag="start">(B)</amend></display><amend anum="0" ea="erase" pairid="14" groupid="9" style="2" owner="jchristopherson" level="1" deltag="end">other recommendations regarding standardized recidivism metrics.</amend><amendoutend style="2"/></subsection></subsection></subsection></subsection><subsection ssid="16-null-8" dnum="2-o" numlevel="1" lineno="74" slineno="2-14" level="1"><display>(2)</display>A report on statewide criminal recidivism may also include other information reflecting <ln numlevel="1" lineno="75" slineno="2-15"/>available recidivism, intervention, or desistance data.</subsection><subsection ssid="16-null-9" dnum="3-o" numlevel="1" lineno="76" slineno="2-16" level="1"><display>(3)</display>A criminal justice institution, agency, or entity required to report adult recidivism data <ln numlevel="1" lineno="77" slineno="2-17"/>to the commission:<subsection ssid="16-null-10" dnum="a-o" numlevel="1" lineno="78" slineno="2-18" level="2"><display>(a)</display>shall include:<subsection ssid="16-null-11" dnum="i-o" numlevel="1" lineno="79" slineno="2-19" level="3"><display>(i)</display>a clear description of the eligible individuals, including:<subsection ssid="16-null-12" dnum="A-o" numlevel="1" lineno="80" slineno="2-20" level="4"><display>(A)</display>the criminal population being evaluated for recidivism; and</subsection><subsection ssid="16-null-13" dnum="B-o" numlevel="1" lineno="81" slineno="2-21" level="4"><display>(B)</display>the interventions that are being evaluated;</subsection></subsection><subsection ssid="16-null-14" dnum="ii-o" numlevel="1" lineno="82" slineno="2-22" level="3"><display>(ii)</display>a clear description of the beginning and end of the evaluation period; and</subsection><subsection ssid="16-null-15" dnum="iii-o" numlevel="1" lineno="83" slineno="2-23" level="3"><display>(iii)</display>a clear description of the events that are considered as a recidivism-triggering <ln numlevel="1" lineno="84" slineno="2-24"/>event; and</subsection></subsection><subsection ssid="16-null-16" dnum="b-o" numlevel="1" lineno="85" slineno="2-25" level="2"><display>(b)</display>may include supplementary data including:<subsection ssid="16-null-17" dnum="i-o" numlevel="1" lineno="86" slineno="2-26" level="3"><display>(i)</display>the length of time that elapsed before a recidivism-triggering event described in <ln numlevel="1" lineno="87" slineno="2-27"/>Subsection <xref depth="4" refnumber="63M-7-102(3)(a)(iii)">(3)(a)(iii)</xref> occurred;</subsection><subsection ssid="16-null-18" dnum="ii-o" numlevel="1" lineno="88" slineno="2-28" level="3"><display>(ii)</display>the severity of a recidivism-triggering event described in Subsection <xref depth="4" refnumber="63M-7-102(3)(a)(iii)">(3)(a)(iii)</xref>;</subsection><subsection ssid="16-null-19" dnum="iii-o" numlevel="1" lineno="89" slineno="2-29" level="3"><display>(iii)</display>measures of personal well-being, education, employment, housing, health, family <ln numlevel="1" lineno="90" slineno="2-30"/>or social support, civic or community engagement, or legal involvement; or</subsection><subsection ssid="16-null-20" dnum="iv-o" numlevel="1" lineno="91" slineno="2-31" level="3"><display>(iv)</display>other desistance metrics that may capture an individual's behavior following the <ln numlevel="1" lineno="92" slineno="2-32"/>individual's release from an intervention.</subsection></subsection></subsection><subsection ssid="16-null-21" dnum="4-o" numlevel="1" lineno="93" slineno="2-33" level="1"><display>(4)</display>Unless otherwise specified in statute:<subsection ssid="16-null-22" dnum="a-o" numlevel="1" lineno="94" slineno="2-34" level="2"><display>(a)</display>the evaluation period described in Subsection <xref depth="4" refnumber="63M-7-102(3)(a)(ii)">(3)(a)(ii)</xref> is three years; and</subsection><subsection ssid="16-null-23" dnum="b-o" numlevel="1" lineno="95" slineno="2-35" level="2"><display>(b)</display>a recidivism-triggering event under Subsection <xref depth="4" refnumber="63M-7-102(3)(a)(iii)">(3)(a)(iii)</xref> shall include:<subsection ssid="16-null-24" dnum="i-o" numlevel="1" lineno="96" slineno="2-36" level="3"><display>(i)</display>an arrest;</subsection><subsection ssid="16-null-25" dnum="ii-o" numlevel="1" lineno="97" slineno="2-37" level="3"><display>(ii)</display>an admission to prison;</subsection><subsection ssid="16-null-26" dnum="iii-o" numlevel="1" lineno="98" slineno="2-38" level="3"><display>(iii)</display>a criminal charge; or</subsection><subsection ssid="16-null-27" dnum="iv-o" numlevel="1" lineno="99" slineno="2-39" level="3"><display>(iv)</display>a criminal conviction.</subsection></subsection></subsection></section></bsec><bsec buid="9" num="63M-7-208" type="amend" src="code" uid="C63M-7-S208_2026050620260506" sort="63M07 02080020260506" numlevel="1" lineno="100" slineno="3-1" sn="3"><section number="63M-7-208" numlevel="1" lineno="101" slineno="3-2" type="amend"><secline lineno="100">Section 3. slineno="3-9" level="2"><display>(b)</display>examine and make recommendations on the use of third-party entities or an <ln numlevel="1" lineno="109" slineno="3-10"/>intermediary organization to assist with implementation and to support the <ln numlevel="1" lineno="110" slineno="3-11"/>performance-based contracting system authorized in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="29" groupid="28" style="2" owner="jchristopherson" level="1" deltag="both">(1)(m)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="17" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="63M-7-208(2)(m)">(2)(m)</xref></amend>;</subsection><subsection ssid="9-null-43" dnum="c-o" numlevel="1" lineno="111" slineno="3-12" level="2"><display>(c)</display>oversee the development of performance measures to track juvenile justice reforms, <ln numlevel="1" lineno="112" slineno="3-13"/>and ensure early and ongoing stakeholder engagement in identifying the relevant <ln numlevel="1" lineno="113" slineno="3-14"/>performance measures;</subsection><subsection ssid="9-null-44" dnum="d-o" numlevel="1" lineno="114" slineno="3-15" level="2"><display>(d)</display>evaluate currently collected data elements throughout the juvenile justice system and <ln numlevel="1" lineno="115" slineno="3-16"/>contract reporting requirements to streamline reporting, reduce redundancies, <ln numlevel="1" lineno="116" slineno="3-17"/>eliminate inefficiencies, and ensure a focus on <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="30" groupid="29" style="2" owner="jchristopherson" level="1" deltag="both">recidivism reduction</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="18" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the reduction of <ln numlevel="1" lineno="117" slineno="3-18"/>juvenile recidivism</amend>;</subsection><subsection ssid="9-null-45" dnum="e-o" numlevel="1" lineno="118" slineno="3-19" level="2"><display>(e)</display>review averted costs from reductions in out-of-home placements for juvenile justice <ln numlevel="1" lineno="119" slineno="3-20"/>youth placed with the Division of Juvenile Justice and Youth Services and the <ln numlevel="1" lineno="120" slineno="3-21"/>Division of Child and Family Services, and make recommendations to prioritize the <ln numlevel="1" lineno="121" slineno="3-22"/>reinvestment and realignment of resources into community-based programs for youth <ln numlevel="1" lineno="122" slineno="3-23"/>living at home, including the following:<subsection ssid="9-null-46" dnum="i-o" numlevel="1" lineno="123" slineno="3-24" level="3"><display>(i)</display>statewide expansion of:<subsection ssid="9-null-47" dnum="A-o" numlevel="1" lineno="124" slineno="3-25" level="4"><display>(A)</display>juvenile receiving centers, as defined in Section <xref depth="3" refnumber="80-1-102">80-1-102</xref>;</subsection><subsection ssid="9-null-48" dnum="B-o" numlevel="1" lineno="125" slineno="3-26" level="4"><display>(B)</display>mobile crisis outreach teams, as defined in Section <xref depth="3" refnumber="26B-5-101">26B-5-101</xref>;</subsection><subsection ssid="9-null-49" dnum="C-o" numlevel="1" lineno="126" slineno="3-27" level="4"><display>(C)</display>youth courts; and</subsection><subsection ssid="9-null-50" dnum="D-o" numlevel="1" lineno="127" slineno="3-28" level="4"><display>(D)</display>victim-offender mediation;</subsection></subsection><subsection ssid="9-null-51" dnum="ii-o" numlevel="1" lineno="128" slineno="3-29" level="3"><display>(ii)</display>statewide implementation of nonresidential diagnostic assessment;</subsection><subsection ssid="9-null-52" dnum="iii-o" numlevel="1" lineno="129" slineno="3-30" level="3"><display>(iii)</display>statewide availability of evidence-based programs and practices including <ln numlevel="1" lineno="130" slineno="3-31"/>cognitive behavioral and family therapy programs for minors assessed by a <ln numlevel="1" lineno="131" slineno="3-32"/>validated risk and needs assessment as moderate or high risk;</subsection><subsection ssid="9-null-53" dnum="iv-o" numlevel="1" lineno="132" slineno="3-33" level="3"><display>(iv)</display>implementation and infrastructure to support the sustainability and fidelity of <ln numlevel="1" lineno="133" slineno="3-34"/>evidence-based juvenile justice programs, including resources for staffing, <ln numlevel="1" lineno="134" slineno="3-35"/>transportation, and flexible funds; and</subsection><subsection ssid="9-null-54" dnum="v-o" numlevel="1" lineno="135" slineno="3-36" level="3"><display>(v)</display>early intervention programs such as family strengthening programs, family <ln numlevel="1" lineno="136" slineno="3-37"/>wraparound services, and proven truancy interventions;</subsection></subsection><subsection ssid="9-null-55" dnum="f-o" numlevel="1" lineno="137" slineno="3-38" level="2"><display>(f)</display>assist the Administrative Office of the Courts in the development of a statewide <ln numlevel="1" lineno="138" slineno="3-39"/>sliding scale for the assessment of fines, fees, and restitution, based on the ability of <ln numlevel="1" lineno="139" slineno="3-40"/>the minor's family to pay;</subsection><subsection ssid="9-null-56" dnum="g-o" numlevel="1" lineno="140" slineno="3-41" level="2"><display>(g)</display>analyze the alignment of resources and the roles and responsibilities of agencies, <ln numlevel="1" lineno="141" slineno="3-42"/>such as the operation of early intervention services, receiving centers, and diversion, <ln numlevel="1" lineno="142" slineno="3-43"/>and make recommendations to reallocate functions as appropriate, in accordance with <ln numlevel="1" lineno="143" slineno="3-44"/>Section <xref depth="3" refnumber="80-5-401">80-5-401</xref>;</subsection><subsection ssid="9-null-57" dnum="h-o" numlevel="1" lineno="144" slineno="3-45" level="2"><display>(h)</display>comply with the data collection and reporting requirements under Section <xref depth="3" refnumber="80-6-104">80-6-104</xref>;</subsection><subsection ssid="9-null-58" dnum="i-o" numlevel="1" lineno="145" slineno="3-46" level="2"><display>(i)</display>develop a reasonable timeline within which all programming delivered to minors in <ln numlevel="1" lineno="146" slineno="3-47"/>the juvenile justice system must be evidence-based or consist of practices that are <ln numlevel="1" lineno="147" slineno="3-48"/>rated as effective for reducing <amend anum="0" ea="amend" pairid="19" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="both">juvenile </amend>recidivism by a standardized program <ln numlevel="1" lineno="148" slineno="3-49"/>evaluation tool;</subsection><subsection ssid="9-null-59" dnum="j-o" numlevel="1" lineno="149" slineno="3-50" level="2"><display>(j)</display>provide guidelines to be considered by the Administrative Office of the Courts and <ln numlevel="1" lineno="150" slineno="3-51"/>the Division of Juvenile Justice and Youth Services in developing tools considered <ln numlevel="1" lineno="151" slineno="3-52"/>by the Administrative Office of the Courts and the Division of Juvenile Justice and <ln numlevel="1" lineno="152" slineno="3-53"/>Youth Services in developing or selecting tools to be used for the evaluation of <ln numlevel="1" lineno="153" slineno="3-54"/>juvenile justice programs;</subsection><subsection ssid="9-null-60" dnum="k-o" numlevel="1" lineno="154" slineno="3-55" level="2"><display>(k)</display>develop a timeline to support improvements to juvenile justice programs to achieve <ln numlevel="1" lineno="155" slineno="3-56"/>reductions in <amend anum="0" ea="amend" pairid="20" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="both">juvenile </amend>recidivism and review reports from relevant state agencies on <ln numlevel="1" lineno="156" slineno="3-57"/>progress toward reaching that timeline;</subsection><subsection ssid="9-null-61" dnum="l-o" numlevel="1" lineno="157" slineno="3-58" level="2"><display>(l)</display>subject to Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="31" groupid="30" style="2" owner="jchristopherson" level="1" deltag="both">(2)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="21" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="63M-7-208(3)">(3)</xref></amend>, assist in the development of training for juvenile <ln numlevel="1" lineno="158" slineno="3-59"/>justice stakeholders, including educators, law enforcement officers, probation staff, <ln numlevel="1" lineno="159" slineno="3-60"/>judges, Division of Juvenile Justice and Youth Services staff, Division of Child and <ln numlevel="1" lineno="160" slineno="3-61"/>Family Services staff, and program providers;</subsection><subsection ssid="9-null-62" dnum="m-o" numlevel="1" lineno="161" slineno="3-62" level="2"><display>(m)</display>subject to Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="32" groupid="31" style="2" owner="jchristopherson" level="1" deltag="both">(3)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="22" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="63M-7-208(4)">(4)</xref></amend>, assist in the development of a performance-based <ln numlevel="1" lineno="162" slineno="3-63"/>contracting system, which shall be developed by the Administrative Office of the <ln numlevel="1" lineno="163" slineno="3-64"/>Courts and the Division of Juvenile Justice and Youth Services for contracted <ln numlevel="1" lineno="164" slineno="3-65"/>services in the community and contracted out-of-home placement providers;</subsection><subsection ssid="9-null-63" dnum="n-o" numlevel="1" lineno="165" slineno="3-66" level="2"><display>(n)</display>assist in the development of a validated detention risk assessment tool that is <ln numlevel="1" lineno="166" slineno="3-67"/>developed or adopted and validated by the Administrative Office of the Courts and <ln numlevel="1" lineno="167" slineno="3-68"/>the Division of Juvenile Justice and Youth Services as provided in Section <xref depth="3" refnumber="80-5-203">80-5-203</xref>; <ln numlevel="1" lineno="168" slineno="3-69"/>and</subsection><subsection ssid="9-null-64" dnum="o-o" numlevel="1" lineno="169" slineno="3-70" level="2"><display>(o)</display>annually issue and make public a report to the governor, president of the Senate, <ln numlevel="1" lineno="170" slineno="3-71"/>speaker of the House of Representatives, and chief justice of the Utah Supreme Court <ln numlevel="1" lineno="171" slineno="3-72"/>on the progress of the reforms and any additional areas in need of review.</subsection></subsection><subsection ssid="9-null-65" dnum="2-o:3-i" numlevel="1" lineno="172" slineno="3-73" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1065" style="2" owner="o" level="1" deltag="both">(2)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1066" style="1" owner="i" level="1" amendtag="both" space="true">(3)</amend></display>Training described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="33" groupid="32" style="2" owner="jchristopherson" level="1" deltag="both">(1)(l)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="23" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="63M-7-208(2)(l)">(2)(l)</xref></amend> should include instruction on <ln numlevel="1" lineno="173" slineno="3-74"/>evidence-based programs and principles of juvenile justice, such as risk, needs, <ln numlevel="1" lineno="174" slineno="3-75"/>responsivity, and fidelity, and shall be supplemented by the following topics:<subsection ssid="9-null-66" dnum="a-o" numlevel="1" lineno="175" slineno="3-76" level="2"><display>(a)</display>adolescent development;</subsection><subsection ssid="9-null-67" dnum="b-o" numlevel="1" lineno="176" slineno="3-77" level="2"><display>(b)</display>identifying and using local behavioral health resources;</subsection><subsection ssid="9-null-68" dnum="c-o" numlevel="1" lineno="177" slineno="3-78" level="2"><display>(c)</display>cross-cultural awareness;</subsection><subsection ssid="9-null-69" dnum="d-o" numlevel="1" lineno="178" slineno="3-79" level="2"><display>(d)</display>graduated responses;</subsection><subsection ssid="9-null-70" dnum="e-o" numlevel="1" lineno="179" slineno="3-80" level="2"><display>(e)</display>Utah juvenile justice system data and outcomes; and</subsection><subsection ssid="9-null-71" dnum="f-o" numlevel="1" lineno="180" slineno="3-81" level="2"><display>(f)</display>gangs.</subsection></subsection><subsection ssid="9-null-72" dnum="3-o:4-i" numlevel="1" lineno="181" slineno="3-82" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1072" style="2" owner="o" level="1" deltag="both">(3)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1073" style="1" owner="i" level="1" amendtag="both" space="true">(4)</amend></display>The system described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="34" groupid="33" style="2" owner="jchristopherson" level="1" deltag="both">(1)(m)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="24" groupid="23" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="63M-7-208(2)(m)">(2)(m)</xref></amend> shall provide incentives for:<subsection ssid="9-null-73" dnum="a-o" numlevel="1" lineno="182" slineno="3-83" level="2"><display>(a)</display>the use of evidence-based juvenile justice programs and practices rated as effective <ln numlevel="1" lineno="183" slineno="3-84"/>by the tools selected in accordance with Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="35" groupid="34" style="2" owner="jchristopherson" level="1" deltag="both">(1)(j)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="25" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="63M-7-208(2)(j)">(2)(j)</xref></amend>;</subsection><subsection ssid="9-null-74" dnum="b-o" numlevel="1" lineno="184" slineno="3-85" level="2"><display>(b)</display>the use of three-month timelines for program completion; and</subsection><subsection ssid="9-null-75" dnum="c-o" numlevel="1" lineno="185" slineno="3-86" level="2"><display>(c)</display>evidence-based programs and practices for minors living at home in rural areas.</subsection></subsection><subsection ssid="9-null-76" dnum="4-o:5-i" numlevel="1" amendtag="both" space="true">commission</amend> in accordance with <ln numlevel="1" lineno="189" slineno="3-90"/>Subsection <xref depth="4" or</subsection><subsection ssid="10-null-65" dnum="b-o" numlevel="1" lineno="211" slineno="4-22" level="2"><display>(b)</display>who is:<subsection ssid="10-null-66" dnum="i-o" numlevel="1" lineno="212" slineno="4-23" level="3"><display>(i)</display>not accompanied by the child's parent or guardian; and</subsection><subsection ssid="10-null-67" dnum="ii-o" numlevel="1" lineno="213" slineno="4-24" level="3"><display>(ii)</display>without care, as defined in Section <xref depth="3" refnumber="80-5-602">80-5-602</xref>.</subsection></subsection></subsection><subsection ssid="10-null-68" dnum="11-o" numlevel="1" lineno="214" slineno="4-25" level="1"><display>(11)</display>"Housing unit" means an area with secured entrances, minor rooms, and common area <ln numlevel="1" lineno="215" slineno="4-26"/>space.</subsection><subsection ssid="10-null-69" dnum="12-o" numlevel="1" lineno="216" slineno="4-27" level="1"><display>(12)</display>"Minor room" means a secured room where an individual sleeps and uses restroom <ln numlevel="1" lineno="217" slineno="4-28"/>facilities.</subsection><subsection ssid="10-null-70" dnum="13-o" numlevel="1" lineno="218" slineno="4-29" level="1"><display>(13)</display>"Observation and assessment program" means a nonresidential service program <ln numlevel="1" lineno="219" slineno="4-30"/>operated or purchased by the division that is responsible only for diagnostic assessment <ln numlevel="1" lineno="220" slineno="4-31"/>of minors, including for substance use disorder, mental health, psychological, and sexual <ln numlevel="1" lineno="221" slineno="4-32"/>behavior risk assessments.</subsection><subsection ssid="10-null-71" dnum="14-o" numlevel="1" lineno="222" slineno="4-33" level="1"><display>(14)</display>"Performance based contracting" means a system of contracting with service providers <ln numlevel="1" lineno="223" slineno="4-34"/>for the provision of residential or nonresidential services that:<subsection ssid="10-null-72" dnum="a-o" numlevel="1" lineno="224" slineno="4-35" level="2"><display>(a)</display>provides incentives for the implementation of evidence-based juvenile justice <ln numlevel="1" lineno="225" slineno="4-36"/>programs or programs rated as effective for reducing <amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both">juvenile </amend>recidivism<amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both">, as defined <ln numlevel="1" lineno="226" slineno="4-37"/>in Section <xref depth="3" refnumber="80-6-104">80-6-104</xref>,</amend> by a standardized tool in accordance with Section <xref depth="3" refnumber="63M-7-208">63M-7-208</xref>; <ln numlevel="1" lineno="227" slineno="4-38"/>and</subsection><subsection ssid="10-null-73" dnum="b-o" numlevel="1" lineno="228" slineno="4-39" level="2"><display>(b)</display>provides a premium rate allocation for a minor who receives the evidence-based <ln numlevel="1" lineno="229" slineno="4-40"/>dosage of treatment and successfully completes the program within three months.</subsection></subsection><subsection ssid="10-null-74" dnum="15-o" numlevel="1" lineno="230" slineno="4-41" level="1"><display>(15)</display>"Puberty inhibition drug treatment" means administering, prescribing, or supplying for <ln numlevel="1" lineno="231" slineno="4-42"/>effectuating or facilitating an individual's attempted sex change, any of the following <ln numlevel="1" lineno="232" slineno="4-43"/>alone or in combination with aromatase inhibitors:<subsection ssid="10-null-75" dnum="a-o" numlevel="1" lineno="233" slineno="4-44" level="2"><display>(a)</display>gonadotropin-releasing hormone agonists; or</subsection><subsection ssid="10-null-76" dnum="b-o" numlevel="1" lineno="234" slineno="4-45" level="2"><display>(b)</display>androgen receptor inhibitors.</subsection></subsection><subsection ssid="10-null-77" dnum="16-o" numlevel="1" lineno="235" slineno="4-46" level="1"><display>(16)</display>"Primary sex characteristic surgical procedure" means the same as that term is defined <ln numlevel="1" lineno="236" slineno="4-47"/>in Section <xref depth="3" refnumber="26B-4-1001">26B-4-1001</xref>.</subsection><subsection ssid="10-null-78" dnum="17-o" numlevel="1" lineno="237" slineno="4-48" level="1"><display>(17)</display>"Rescission" means the same as that term is defined in Section <xref depth="3" refnumber="80-6-102">80-6-102</xref>.</subsection><subsection ssid="10-null-79" dnum="18-o" numlevel="1" lineno="238" slineno="4-49" level="1"><display>(18)</display>"Restitution" means the same as that term is defined in Section <xref depth="3" refnumber="80-6-102">80-6-102</xref>.</subsection><subsection ssid="10-null-80" dnum="19-o" numlevel="1" lineno="239" slineno="4-50" level="1"><display>(19)</display>"Revocation" means the same as that term is defined in Section <xref depth="3" refnumber="80-6-102">80-6-102</xref>.</subsection><subsection ssid="10-null-81" dnum="20-o" numlevel="1" lineno="240" slineno="4-51" level="1"><display>(20)</display>"Secondary sex characteristic surgical procedure" means the same as that term is <ln numlevel="1" lineno="241" slineno="4-52"/>defined in Section <xref depth="3" refnumber="26B-4-1001">26B-4-1001</xref>.</subsection><subsection ssid="10-null-82" dnum="21-o" numlevel="1" lineno="242" slineno="4-53" level="1"><display>(21)</display>"Temporary custody" means the same as that term is defined in Section <xref depth="3" refnumber="80-6-102">80-6-102</xref>.</subsection><subsection ssid="10-null-83" dnum="22-o" numlevel="1" lineno="243" slineno="4-54" level="1"><display>(22)</display>"Temporary homeless youth shelter" means a facility that:<subsection ssid="10-null-84" dnum="a-o" numlevel="1" lineno="244" slineno="4-55" level="2"><display>(a)</display>provides temporary shelter to homeless youth; and</subsection><subsection ssid="10-null-85" dnum="b-o" numlevel="1" lineno="245" slineno="4-56" level="2"><display>(b)</display>is licensed by the Department of Health and Human Services, created in Section <xref depth="3" refnumber="26B-1-201"><ln numlevel="1" lineno="246" slineno="4-57"/>26B-1-201</xref>, as a residential support program.</subsection></subsection><subsection ssid="10-null-86" dnum="23-o" numlevel="1" lineno="247" slineno="4-58" level="1"><display>(23)</display>"Termination" means the same as that term is defined in Section <xref depth="3" refnumber="80-6-102">80-6-102</xref>.</subsection><subsection ssid="10-null-87" dnum="24-o" numlevel="1" lineno="248" slineno="4-59" level="1"><display>(24)</display>"Victim" means the same as that term is defined in Section <xref depth="3" refnumber="80-6-102">80-6-102</xref>.</subsection><subsection ssid="10-null-88" dnum="25-o" numlevel="1" lineno="249" slineno="4-60" level="1"><display>(25)</display>"Work program" means a nonresidential public or private service work project <ln numlevel="1" lineno="250" slineno="4-61"/>established and administered by the division for juvenile offenders for the purpose of <ln numlevel="1" lineno="251" slineno="4-62"/>rehabilitation, education, and restitution to victims.</subsection><subsection ssid="10-null-89" dnum="26-o" numlevel="1" lineno="252" slineno="4-63" level="1" space="false"><display>(26)</display><subsection ssid="10-null-90" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Youth services" means services provided in an effort to resolve family conflict:<subsection ssid="10-null-91" dnum="i-o" numlevel="1" lineno="253" slineno="4-64" level="3" tab="1"><display>(i)</display>for families in crisis when a minor is ungovernable or a runaway; or</subsection><subsection ssid="10-null-92" dnum="ii-o" numlevel="1" lineno="254" slineno="4-65" level="3" tab="1"><display>(ii)</display>involving a minor and the minor's parent or guardian.</subsection></subsection><subsection ssid="10-null-93" dnum="b-o" numlevel="1" lineno="255" slineno="4-66" level="2"><display>(b)</display>"Youth services" include efforts to:<subsection ssid="10-null-94" dnum="i-o" numlevel="1" lineno="256" slineno="4-67" level="3"><display>(i)</display>resolve family conflict;</subsection><subsection ssid="10-null-95" dnum="ii-o" numlevel="1" lineno="257" slineno="4-68" level="3"><display>(ii)</display>maintain or reunite minors with the minors' families; and</subsection><subsection ssid="10-null-96" dnum="iii-o" numlevel="1" lineno="258" slineno="4-69" level="3"><display>(iii)</display>divert minors from entering or escalating in the juvenile justice system.</subsection></subsection><subsection ssid="10-null-97" dnum="c-o" numlevel="1" lineno="259" slineno="4-70" level="2"><display>(c)</display>"Youth services" may provide:<subsection ssid="10-null-98" dnum="i-o" numlevel="1" lineno="260" slineno="4-71" level="3"><display>(i)</display>crisis intervention;</subsection><subsection ssid="10-null-99" dnum="ii-o" numlevel="1" lineno="261" slineno="4-72" level="3"><display>(ii)</display>short-term shelter;</subsection><subsection ssid="10-null-100" dnum="iii-o" numlevel="1" lineno="262" slineno="4-73" level="3"><display>(iii)</display>time-out placement; and</subsection><subsection ssid="10-null-101" dnum="iv-o" numlevel="1" lineno="263" slineno="4-74" level="3"><display>(iv)</display>family counseling.</subsection></subsection></subsection><subsection ssid="10-null-102" dnum="27-o" numlevel="1" lineno="264" slineno="4-75" level="1"><display>(27)</display>"Youth services center" means a center established by, or under contract with, the <ln numlevel="1" lineno="265" slineno="4-76"/>division to provide youth services.</subsection></section></bsec><bsec buid="12" num="80-6-104" type="amend" src="code" uid="C80-6-S104_2026050620260506" sort="80 06 01040020260506" numlevel="1" lineno="266" slineno="5-1" sn="5"><section number="80-6-104" numlevel="1" lineno="267" slineno="5-2" type="amend"><secline lineno="266">Section 5. or</amend></subsection><subsection ssid="12-null-65" dnum="_-o:ii-i" numlevel="1" lineno="279" slineno="5-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1134" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="27" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="end">the juvenile court ordered a disposition for the individual resulting in secure care, <ln numlevel="1" lineno="280" slineno="5-15"/>community-based placement, formal probation, or intake probation.</amend></subsection></subsection><subsection ssid="12-null-66" dnum="_-o:e-i" numlevel="1" lineno="281" slineno="5-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1135" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="15" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">"School" means the same as that term is defined in Section <xref depth="3" refnumber="80-6-103">80-6-103</xref>.</amend></subsection><subsection ssid="12-null-71" dnum="_-o:f-i" numlevel="1" lineno="282" slineno="5-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1136" style="1" owner="i" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="end">"School-based offense" means an offense that is committed, or allegedly committed, <ln numlevel="1" lineno="283" slineno="5-18"/>by a minor enrolled in school when school is in session or at a school-sponsored <ln numlevel="1" lineno="284" slineno="5-19"/>activity.</amend></subsection><subsection ssid="12-null-67" dnum="_-o:g-i" numlevel="1" lineno="285" slineno="5-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1137" style="1" owner="i" level="1" amendtag="start">(g)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">"School-based referral" means the referral of a minor under Section <xref depth="3" refnumber="53G-8-211">53G-8-211</xref> for a <ln numlevel="1" lineno="286" slineno="5-21"/>school-based offense to an evidence-based alternative intervention or for prevention <ln numlevel="1" lineno="287" slineno="5-22"/>and early intervention youth services, or to a law enforcement officer or agency or a <ln numlevel="1" lineno="288" slineno="5-23"/>court, within six months, one year, two years, and three years after the day on which:</amend><subsection ssid="12-null-68" dnum="_-o:i-i" numlevel="1" lineno="289" slineno="5-24" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1138" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="32" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="end">the minor was referred under Section <xref depth="3" refnumber="53G-8-211">53G-8-211</xref> for a school-based offense;</amend></subsection><subsection ssid="12-null-69" dnum="_-o:ii-i" numlevel="1" lineno="290" slineno="5-25" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1139" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="39" groupid="31" style="1" owner="jchristopherson" level="1" amendtag="end">the minor accepted a nonjudicial adjustment for a school-based offense; or</amend></subsection><subsection ssid="12-null-70" dnum="_-o:iii-i" numlevel="1" lineno="291" slineno="5-26" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1140" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="42" groupid="33" style="1" owner="jchristopherson" level="1" amendtag="end">the juvenile court ordered a disposition for a school-based offense resulting in <ln numlevel="1" lineno="292" slineno="5-27"/>secure care, community-based placement, formal probation, or intake probation <ln numlevel="1" lineno="293" slineno="5-28"/>for the minor.</amend></subsection></subsection><subsection ssid="12-null-72" dnum="c-o:h-i" numlevel="1" lineno="294" slineno="5-29" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1141" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1142" style="1" owner="i" level="1" amendtag="both" space="true">(h)</amend></display>"School is in session" means the same as that term is defined in Section <xref depth="3" refnumber="53E-3-516"><ln numlevel="1" lineno="295" slineno="5-30"/>53E-3-516</xref>.</subsection><subsection ssid="12-null-73" dnum="d-o:i-i" numlevel="1" lineno="296" slineno="5-31" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1142" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1143" style="1" owner="i" level="1" amendtag="both" space="true">(i)</amend></display>"School-sponsored activity" means the same as that term is defined in Section <xref depth="3" refnumber="53E-3-516"><ln numlevel="1" lineno="297" slineno="5-32"/>53E-3-516</xref>.</subsection></subsection><subsection ssid="12-null-74" dnum="2-o" numlevel="1" lineno="298" slineno="5-33" level="1"><display>(2)</display>Before July 1 of each year, the Administrative Office of the Courts shall submit the <ln numlevel="1" lineno="299" slineno="5-34"/>following data to the State Commission on Criminal and Juvenile Justice, broken down <ln numlevel="1" lineno="300" slineno="5-35"/>by judicial district, for the preceding calendar year:<subsection ssid="12-null-75" dnum="a-o" numlevel="1" lineno="301" slineno="5-36" level="2"><display>(a)</display>the number of referrals to the juvenile court;</subsection><subsection ssid="12-null-76" dnum="b-o" numlevel="1" lineno="302" slineno="5-37" level="2"><display>(b)</display>the number of minors diverted to a nonjudicial adjustment;</subsection><subsection ssid="12-null-77" dnum="c-o" numlevel="1" lineno="303" slineno="5-38" level="2"><display>(c)</display>the number of minors that satisfy the conditions of a nonjudicial adjustment;</subsection><subsection ssid="12-null-78" dnum="d-o" numlevel="1" lineno="304" slineno="5-39" level="2"><display>(d)</display>the number of minors for whom a petition for an offense is filed in the juvenile court;</subsection><subsection ssid="12-null-79" dnum="e-o" numlevel="1" lineno="305" slineno="5-40" level="2"><display>(e)</display>the number of minors for whom an information is filed in the juvenile court;</subsection><subsection ssid="12-null-80" dnum="f-o" numlevel="1" lineno="306" slineno="5-41" level="2"><display>(f)</display>the number of minors bound over to the district court by the juvenile court;</subsection><subsection ssid="12-null-81" dnum="g-o" numlevel="1" lineno="307" slineno="5-42" level="2"><display>(g)</display>the number of petitions for offenses committed by minors that were dismissed by the <ln numlevel="1" lineno="308" slineno="5-43"/>juvenile court;</subsection><subsection ssid="12-null-82" dnum="h-o" numlevel="1" lineno="309" slineno="5-44" level="2"><display>(h)</display>the number of adjudications in the juvenile court for offenses committed by minors;</subsection><subsection ssid="12-null-83" dnum="i-o" numlevel="1" lineno="310" slineno="5-45" level="2"><display>(i)</display>the number of guilty pleas entered into by minors in the juvenile court;</subsection><subsection ssid="12-null-84" dnum="j-o" numlevel="1" lineno="311" slineno="5-46" level="2"><display>(j)</display>the number of dispositions resulting in secure care, community-based placement, <ln numlevel="1" lineno="312" slineno="5-47"/>formal probation, and intake probation; and</subsection><subsection ssid="12-null-85" dnum="k-o" numlevel="1" lineno="313" slineno="5-48" level="2"><display>(k)</display>for each minor charged in the juvenile court with a firearm-related offense:<subsection ssid="12-null-86" dnum="i-o" numlevel="1" lineno="314" slineno="5-49" level="3"><display>(i)</display>the minor's age at the time the offense was committed or allegedly committed;</subsection><subsection ssid="12-null-87" dnum="ii-o" numlevel="1" lineno="315" slineno="5-50" level="3"><display>(ii)</display>the minor's zip code at the time that the offense was referred to the juvenile court;</subsection><subsection ssid="12-null-88" dnum="iii-o" numlevel="1" lineno="316" slineno="5-51" level="3"><display>(iii)</display>whether the minor is a restricted person under Subsection <xref depth="4" refnumber="76-11-302(4)">76-11-302(4)</xref> or <xref refnumber="76-11-303(4)" depth="null"><ln numlevel="1" lineno="317" slineno="5-52"/>76-11-303(4)</xref>;</subsection><subsection ssid="12-null-89" dnum="iv-o" numlevel="1" lineno="318" slineno="5-53" level="3"><display>(iv)</display>the type of offense for which the minor is charged;</subsection><subsection ssid="12-null-90" dnum="v-o" numlevel="1" lineno="319" slineno="5-54" level="3"><display>(v)</display>the outcome of the minor's case in juvenile court, including whether the minor <ln numlevel="1" lineno="320" slineno="5-55"/>was bound over to the district court or adjudicated by the juvenile court; and</subsection><subsection ssid="12-null-91" dnum="vi-o" numlevel="1" lineno="321" slineno="5-56" level="3"><display>(vi)</display>if a disposition was entered by the juvenile court, whether the disposition <ln numlevel="1" lineno="322" slineno="5-57"/>resulted in secure care, community-based placement, formal probation, or intake <ln numlevel="1" lineno="323" slineno="5-58"/>probation.</subsection></subsection></subsection><subsection ssid="12-null-92" dnum="3-o" numlevel="1" lineno="324" slineno="5-59" level="1"><display>(3)</display>The State Commission on Criminal and Juvenile Justice shall track the disposition of a <ln numlevel="1" lineno="325" slineno="5-60"/>case resulting from a firearm-related offense committed, or allegedly committed, by a <ln numlevel="1" lineno="326" slineno="5-61"/>minor when the minor is found in possession of a firearm while school is in session or <ln numlevel="1" lineno="327" slineno="5-62"/>during a school-sponsored activity.</subsection><subsection ssid="12-null-93" dnum="4-o" numlevel="1" lineno="328" slineno="5-63" level="1"><display>(4)</display>In collaboration with the Administrative Office of the Courts, the division, and other <ln numlevel="1" lineno="329" slineno="5-64"/>agencies, the State Commission on Criminal and Juvenile Justice shall collect data for <ln numlevel="1" lineno="330" slineno="5-65"/>the preceding calendar year on:<subsection ssid="12-null-94" dnum="a-o" numlevel="1" lineno="331" slineno="5-66" level="2"><display>(a)</display>the length of time that minors spend in the juvenile justice system, including the total <ln numlevel="1" lineno="332" slineno="5-67"/>amount of time minors spend under juvenile court jurisdiction, on community <ln numlevel="1" lineno="333" slineno="5-68"/>supervision, and in each out-of-home placement;</subsection><subsection ssid="12-null-95" dnum="b-o" numlevel="1" lineno="334" slineno="5-69" level="2"><display>(b)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="11" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">recidivism of minors who are diverted to a nonjudicial adjustment and minors for <ln numlevel="1" lineno="335" slineno="5-70"/>whom dispositions are ordered by the juvenile court</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="9" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">juvenile recidivism</amend>, including <ln numlevel="1" lineno="336" slineno="5-71"/>tracking minors into the adult corrections system;</subsection><subsection ssid="12-null-96" dnum="_-o:c-i" numlevel="1" lineno="337" slineno="5-72" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1165" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="48" groupid="37" style="1" owner="jchristopherson" level="1" amendtag="end">school-based referrals;</amend></subsection><subsection ssid="12-null-97" dnum="c-o:d-i" numlevel="1" lineno="338" slineno="5-73" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1166" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1167" style="1" owner="i" level="1" amendtag="both" space="true">(d)</amend></display>changes in aggregate risk levels from the time minors receive services, are under <ln numlevel="1" lineno="339" slineno="5-74"/>supervision, and are in out-of-home placement; and</subsection><subsection ssid="12-null-98" dnum="d-o:e-i" numlevel="1" lineno="340" slineno="5-75" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1167" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1168" style="1" owner="i" level="1" amendtag="both" space="true">(e)</amend></display>dosages of programming.</subsection></subsection><subsection ssid="12-null-99" dnum="5-o" numlevel="1" lineno="341" slineno="5-76" level="1"><display>(5)</display>On and before October 1 of each year, the State Commission on Criminal and Juvenile <ln numlevel="1" lineno="342" slineno="5-77"/>Justice shall prepare and submit a written report to the Judiciary Interim Committee and <ln numlevel="1" lineno="343" slineno="5-78"/>the Law Enforcement and Criminal Justice Interim Committee that includes:<subsection ssid="12-null-100" dnum="a-o" numlevel="1" lineno="344" slineno="5-79" level="2"><display>(a)</display>data collected by the State Commission on Criminal and Juvenile Justice under this <ln numlevel="1" lineno="345" slineno="5-80"/>section;</subsection><subsection ssid="12-null-101" dnum="b-o" numlevel="1" lineno="346" slineno="5-81" level="2"><display>(b)</display>data collected by the State Board of Education under Section <xref depth="3" refnumber="53E-3-516">53E-3-516</xref>; and</subsection><subsection ssid="12-null-102" dnum="c-o" numlevel="1" lineno="347" slineno="5-82" level="2"><display>(c)</display>recommendations for legislative action with respect to the data described in this <ln numlevel="1" lineno="348" slineno="5-83"/>Subsection <xref depth="4" refnumber="80-6-104(5)">(5)</xref>.</subsection></subsection><subsection ssid="12-null-103" dnum="6-o" numlevel="1" lineno="349" slineno="5-84" level="1"><display>(6)</display>After submitting the written report described in Subsection <xref depth="4" refnumber="80-6-104(5)">(5)</xref>, the State Commission <ln numlevel="1" lineno="350" slineno="5-85"/>on Criminal and Juvenile Justice may supplement the report at a later time with updated <ln numlevel="1" lineno="351" slineno="5-86"/>data and information the State Board of Education collects under Section <xref depth="3" refnumber="53E-3-516">53E-3-516</xref>.</subsection><subsection ssid="12-null-104" dnum="7-o" numlevel="1" lineno="352" slineno="5-87" level="1"><display>(7)</display>Nothing in this section shall be construed to require the disclosure of information or <ln numlevel="1" lineno="353" slineno="5-88"/>data that is classified as controlled, private, or protected under Title 63G, Chapter 2, <ln numlevel="1" lineno="354" slineno="5-89"/>Government Records Access and Management Act.</subsection></section></bsec><bsec buid="3" num="80-6-205" type="amend" src="code" uid="C80-6-S205_2026050620260506" sort="80 06 02050020260506" numlevel="1" lineno="355" slineno="6-1" sn="6"><section number="80-6-205" numlevel="1" lineno="356" slineno="6-2" type="amend"><secline lineno="355">Section 6. Section <bold>80-6-205</bold> is amended to read:</secline><catline lineno="356"><bold>80-6-205<parens/>. Admission to detention -- Rights of a minor in detention.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="357" slineno="6-3" level="1" placement="noreturn"><display>(1)</display>If a minor is taken to a detention facility under Section <xref depth="3" refnumber="80-6-203">80-6-203</xref>, a designated staff <ln numlevel="1" lineno="358" slineno="6-4"/>member of the detention facility shall immediately review the form and determine, <ln numlevel="1" lineno="359" slineno="6-5"/>based on the results of the detention risk assessment tool and Subsection <xref depth="4" refnumber="80-6-205(2)">(2)</xref>, whether to:<subsection ssid="3-null-2" dnum="a-o" numlevel="1" lineno="360" slineno="6-6" level="2"><display>(a)</display>admit the minor to secure detention;</subsection><subsection ssid="3-null-3" dnum="b-o" numlevel="1" lineno="361" slineno="6-7" level="2"><display>(b)</display>admit the minor to home detention;</subsection><subsection ssid="3-null-4" dnum="c-o" numlevel="1" lineno="362" slineno="6-8" level="2"><display>(c)</display>place the minor in an alternative to detention<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1" groupid="1" style="2" owner="jchristopherson" level="1" deltag="both">, except that the staff member may not <ln numlevel="1" lineno="363" slineno="6-9"/>place the minor in a correctional facility that is intended to hold adults accused or <ln numlevel="1" lineno="364" slineno="6-10"/>convicted of offenses as an alternative to detention</amend><amendoutend style="2"/>; or</subsection><subsection ssid="3-null-5" dnum="d-o" numlevel="1" lineno="365" slineno="6-11" level="2"><display>(d)</display>if the minor is a child, return the minor home upon a written promise by the minor's <ln numlevel="1" lineno="366" slineno="6-12"/>parent, guardian, or custodian to bring the minor to the juvenile court at a time set or <ln numlevel="1" lineno="367" slineno="6-13"/>without restriction.</subsection></subsection><subsection ssid="3-null-6" dnum="2-o" numlevel="1" lineno="368" slineno="6-14" level="1"><display>(2)</display>The designated staff member may not admit a minor to detention under Subsection <xref depth="4" refnumber="80-6-205(1)">(1)</xref> <ln numlevel="1" lineno="369" slineno="6-15"/>unless:<subsection ssid="3-null-7" dnum="a-o" numlevel="1" lineno="370" slineno="6-16" level="2"><display>(a)</display>the minor is detainable based on the detention guidelines; or</subsection><subsection ssid="3-null-8" dnum="b-o" numlevel="1" lineno="371" slineno="6-17" level="2"><display>(b)</display>the minor has been brought to detention in accordance with:<subsection ssid="3-null-9" dnum="i-o" numlevel="1" lineno="372" slineno="6-18" level="3"><display>(i)</display>a court order;</subsection><subsection ssid="3-null-10" dnum="ii-o" numlevel="1" lineno="373" slineno="6-19" level="3"><display>(ii)</display>a warrant described in Section <xref depth="3" refnumber="80-6-202">80-6-202</xref>; or</subsection><subsection ssid="3-null-11" dnum="iii-o" numlevel="1" lineno="374" slineno="6-20" level="3"><display>(iii)</display>a division warrant described in Section <xref depth="3" refnumber="80-6-806">80-6-806</xref>.</subsection></subsection></subsection><subsection ssid="3-null-12" dnum="3-o" numlevel="1" lineno="375" slineno="6-21" level="1"><display>(3)</display>If the designated staff member determines to admit a minor to home detention, the staff <ln numlevel="1" lineno="376" slineno="6-22"/>member shall notify the juvenile court of that determination.</subsection><subsection ssid="3-null-13" dnum="4-o" numlevel="1" lineno="377" slineno="6-23" level="1"><display>(4)</display>Even if a minor is eligible for secure detention, a peace officer or other person who <ln numlevel="1" lineno="378" slineno="6-24"/>takes a minor to a detention facility, or the designated staff member of the detention <ln numlevel="1" lineno="379" slineno="6-25"/>facility, may release a minor to a less restrictive alternative than secure detention.</subsection><subsection ssid="3-null-14" dnum="5-o" numlevel="1" lineno="380" slineno="6-26" level="1" space="false"><display>(5)</display><subsection ssid="3-null-15" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If a minor taken to a detention facility does not qualify for admission under <ln numlevel="1" lineno="381" slineno="6-27"/>detention guidelines or this section, a designated staff member of the detention <ln numlevel="1" lineno="382" slineno="6-28"/>facility shall arrange an appropriate alternative, including admitting a minor to a <ln numlevel="1" lineno="383" slineno="6-29"/>juvenile receiving center or a shelter facility.</subsection><subsection ssid="3-null-16" dnum="b-o" numlevel="1" lineno="384" slineno="6-30" level="2" space="false"><display>(b)</display><subsection ssid="3-null-17" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Except as otherwise provided by this section, a minor may not be placed or <ln numlevel="1" lineno="385" slineno="6-31"/>kept in secure detention while court proceedings are pending.</subsection><subsection ssid="3-null-18" dnum="ii-o" numlevel="1" lineno="386" slineno="6-32" level="3"><display>(ii)</display>A child may not be placed or kept in a shelter facility while court proceedings are <ln numlevel="1" lineno="387" slineno="6-33"/>pending, unless the child is in protective custody in accordance with Chapter 3, <ln numlevel="1" lineno="388" slineno="6-34"/>Abuse, Neglect, and Dependency Proceedings.</subsection></subsection></subsection><subsection ssid="3-null-19" dnum="6-o" numlevel="1" lineno="389" slineno="6-35" level="1"><display>(6)</display>If a minor is taken into temporary custody and admitted to a secure detention, or another <ln numlevel="1" lineno="390" slineno="6-36"/>alternative to detention, a designated staff member of the detention facility shall:<subsection ssid="3-null-20" dnum="a-o" numlevel="1" lineno="391" slineno="6-37" level="2"><display>(a)</display>immediately notify the minor's parent, guardian, or custodian; and</subsection><subsection ssid="3-null-21" dnum="b-o" numlevel="1" lineno="392" slineno="6-38" level="2"><display>(b)</display>promptly notify the juvenile court of the placement.</subsection></subsection><subsection ssid="3-null-22" dnum="7-o" numlevel="1" lineno="393" slineno="6-39" level="1"><display>(7)</display>If a minor is admitted to secure detention, or another alternative to detention, outside the <ln numlevel="1" lineno="394" slineno="6-40"/>county of the minor's residence and a juvenile court determines, in a detention hearing, <ln numlevel="1" lineno="395" slineno="6-41"/>that secure detention, or an alternative to detention, of the minor shall continue, the <ln numlevel="1" lineno="396" slineno="6-42"/>juvenile court shall direct the sheriff of the county of the minor's residence to transport <ln numlevel="1" lineno="397" slineno="6-43"/>the minor to secure detention or another alternative to detention in that county.</subsection><subsection ssid="3-null-23" dnum="8-o" numlevel="1" lineno="398" slineno="6-44" level="1" space="false"><display>(8)</display><subsection ssid="3-null-24" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Subject to Subsection <xref depth="4" refnumber="80-6-205(8)(b)">(8)(b)</xref>, a minor admitted to detention has a right to:<subsection ssid="3-null-25" dnum="i-o" numlevel="1" lineno="399" slineno="6-45" level="3" tab="1"><display>(i)</display>phone the minor's parent, guardian, or attorney immediately after the minor is <ln numlevel="1" lineno="400" slineno="6-46"/>admitted to detention; and</subsection><subsection ssid="3-null-26" dnum="ii-o" numlevel="1" lineno="401" slineno="6-47" level="3" tab="1"><display>(ii)</display>confer in private, at any time, with an attorney, cleric, parent, guardian, or <ln numlevel="1" lineno="402" slineno="6-48"/>custodian.</subsection></subsection><subsection ssid="3-null-27" dnum="b-o" numlevel="1" lineno="403" slineno="6-49" level="2"><display>(b)</display>The division may:<subsection ssid="3-null-28" dnum="i-o" numlevel="1" lineno="404" slineno="6-50" level="3"><display>(i)</display>establish a schedule for which a minor in detention may visit or phone a person <ln numlevel="1" lineno="405" slineno="6-51"/>described in Subsection <xref depth="4" refnumber="80-6-205(8)(a)">(8)(a)</xref>;</subsection><subsection ssid="3-null-29" dnum="ii-o" numlevel="1" lineno="406" slineno="6-52" level="3"><display>(ii)</display>allow a minor in detention to visit or call persons described in Subsection <xref depth="4" refnumber="80-6-205(8)(a)">(8)(a)</xref> <ln numlevel="1" lineno="407" slineno="6-53"/>in special circumstances;</subsection><subsection ssid="3-null-30" dnum="iii-o" numlevel="1" lineno="408" slineno="6-54" level="3"><display>(iii)</display>limit the number and length of calls and visits for a minor in detention to persons <ln numlevel="1" lineno="409" slineno="6-55"/>described in Subsection <xref depth="4" refnumber="80-6-205(8)(a)">(8)(a)</xref> on account of scheduling, facility, or personnel <ln numlevel="1" lineno="410" slineno="6-56"/>constraints; or</subsection><subsection ssid="3-null-31" dnum="iv-o" numlevel="1" lineno="411" slineno="6-57" level="3"><display>(iv)</display>limit the minor's rights described in Subsection <xref depth="4" refnumber="80-6-205(8)(a)">(8)(a)</xref> if a compelling reason <ln numlevel="1" lineno="412" slineno="6-58"/>exists to limit the minor's rights.</subsection></subsection><subsection ssid="3-null-32" dnum="c-o" numlevel="1" lineno="413" slineno="6-59" level="2"><display>(c)</display>A minor admitted to detention shall be immediately advised of the minor's rights <ln numlevel="1" lineno="414" slineno="6-60"/>described in this Subsection <xref depth="4" refnumber="80-6-205(8)">(8)</xref>.</subsection></subsection></section></bsec><bsec buid="18" num="80-6-507" type="amend" src="code" uid="C80-6-S507_2026050620260506" sort="80 06 05070020260506" numlevel="1" lineno="415" slineno="7-1" sn="7"><section number="80-6-507" numlevel="1" lineno="416" slineno="7-2" type="amend"><secline lineno="415">Section 7. Section <bold>80-6-507</bold> is amended to read:</secline><catline lineno="416"><bold>80-6-507<parens/>. Commitment of a minor by a district court -- Provisional housing of a <ln numlevel="1" lineno="417" slineno="7-3"/>minor in a secure care facility.</bold></catline><subsection ssid="18-33" dnum="_-o:1-i" numlevel="1" lineno="418" slineno="7-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1206" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="122" groupid="94" style="1" owner="jchristopherson" level="1" amendtag="end">When sentencing a minor, the district court shall order the minor to make restitution in <ln numlevel="1" lineno="419" slineno="7-5"/>accordance with Title 77, Chapter 38b, Crime Victims Restitution Act.</amend></subsection><subsection ssid="18-null-1" dnum="1-o:2-i" numlevel="1" lineno="420" slineno="7-6" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1207" style="2" owner="o" level="1" deltag="both">(1)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1208" style="1" owner="i" level="1" amendtag="both" space="true">(2)</amend></display><subsection ssid="18-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If the district court determines that probation is not appropriate and <ln numlevel="1" lineno="421" slineno="7-7"/>commitment to prison is an appropriate sentence when sentencing a minor:<subsection ssid="18-null-3" dnum="i-o" numlevel="1" lineno="422" slineno="7-8" level="3" tab="1"><display>(i)</display>the district court shall order the minor committed to prison; and</subsection><subsection ssid="18-null-4" dnum="ii-o" numlevel="1" lineno="423" slineno="7-9" level="3" tab="1"><display>(ii)</display><amend anum="0" ea="amend" pairid="17" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="both">except as provided in Subsection <xref depth="4" refnumber="80-6-507(3)">(3)</xref> or <xref depth="4" refnumber="80-6-507(7)">(7)</xref>, </amend>the minor shall be provisionally <ln numlevel="1" lineno="424" slineno="7-10"/>housed in a secure care facility<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="82" groupid="65" style="2" owner="jchristopherson" level="1" deltag="both"> </amend><amendoutend style="2"/> until the minor reaches 25 years old, unless <ln numlevel="1" lineno="425" slineno="7-11"/>released earlier from incarceration by the Board of Pardons and Parole.</subsection></subsection><subsection ssid="18-null-5" dnum="b-o" numlevel="1" lineno="426" slineno="7-12" level="2"><display>(b)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="127" groupid="99" style="2" owner="jchristopherson" level="1" deltag="both">Subsection <xref depth="4" refnumber="80-6-507(1)" start="0">(1)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="125" groupid="97" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">This Subsection <xref depth="4" refnumber="80-6-507(2)">(2)</xref></amend> applies to any minor being provisionally housed <ln numlevel="1" lineno="427" slineno="7-13"/>in a secure care facility as described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="129" groupid="101" style="2" owner="jchristopherson" level="1" deltag="both">(1)(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="126" groupid="98" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="80-6-507(2)(a)">(2)(a)</xref></amend> on or after May 4, <ln numlevel="1" lineno="428" slineno="7-14"/>2022.</subsection><subsection ssid="18-null-6" dnum="c-o:_-i" numlevel="1" lineno="429" slineno="7-15" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1212" style="2" owner="o" level="1" deltag="start">(c)</amend></display><amend anum="0" ea="erase" pairid="114" groupid="88" style="2" owner="jchristopherson" level="1" deltag="end">The district court shall, as a part of sentencing, order the minor to make restitution <ln numlevel="1" lineno="430" slineno="7-16"/>in accordance with Title 77, Chapter 38b, Crime Victims Restitution Act.</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="18-20" dnum="_-o:3-i" numlevel="1" lineno="431" slineno="7-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1213" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="44" groupid="35" style="1" owner="jchristopherson" level="1" amendtag="end">The district court may order a minor to be committed to the physical custody of the <ln numlevel="1" lineno="432" slineno="7-18"/>Department of Corrections and housed in a correctional facility rather than secure care <ln numlevel="1" lineno="433" slineno="7-19"/>facility under Subsection <xref depth="4" refnumber="80-6-507(2)(a)(ii)">(2)(a)(ii)</xref> if:</amend><subsection ssid="18-21" dnum="_-o:a-i" numlevel="1" lineno="434" slineno="7-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1214" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="23" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="end">the minor is convicted of aggravated murder under Section <xref depth="3" refnumber="76-5-202">76-5-202</xref>;</amend></subsection><subsection ssid="18-22" dnum="_-o:b-i" numlevel="1" lineno="435" slineno="7-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1215" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="28" groupid="23" style="1" owner="jchristopherson" level="1" amendtag="end">the minor was 17 years old at the time that the aggravated murder occurred; and</amend></subsection><subsection ssid="18-23" dnum="_-o:c-i" numlevel="1" lineno="436" slineno="7-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1216" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="34" groupid="28" style="1" owner="jchristopherson" level="1" amendtag="end">the minor is 18 years old or older at the time of sentencing.</amend></subsection></subsection><subsection ssid="18-null-7" dnum="2-o:_-i" numlevel="1" lineno="437" slineno="7-23" ea="erase" anum="0" owner="jchristopherson" style="2" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1217" style="2" owner="o" level="1" deltag="start">(2)</amend></display><subsection ssid="18-null-8" dnum="a-o:_-i" ea="erase" anum="0" owner="jchristopherson" style="2" level="2" placement="sameline"><display><amend anum="0" ea="erase" pairid="1218" style="2" owner="o" level="1">(a)</amend></display><amend anum="0" ea="erase" pairid="101" groupid="77" style="2" owner="jchristopherson" level="1" deltag="end">The division shall adopt procedures by rule, in accordance with <xref depth="1" refnumber="63G-3" start="0">Title 63G, <ln numlevel="1" lineno="438" slineno="7-24"/>Chapter 3, Utah Administrative Rulemaking Act</xref>, regarding the transfer of a minor <ln numlevel="1" lineno="439" slineno="7-25"/>provisionally housed in a secure care facility  under Subsection <xref depth="4" refnumber="80-6-507(1)" start="0">(1)</xref> to the physical <ln numlevel="1" lineno="440" slineno="7-26"/>custody of the Department of Corrections.</amend><amendoutend style="2"/></subsection><subsection ssid="18-null-9" dnum="b-o:_-i" numlevel="1" lineno="441" slineno="7-27" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1219" style="2" owner="o" level="1" deltag="start">(b)</amend></display><amend anum="0" ea="erase" pairid="94" groupid="73" style="2" owner="jchristopherson" level="1" deltag="end">If, in accordance with the rules adopted under Subsection <xref depth="4" refnumber="80-6-507(2)(a)" start="0">(2)(a)</xref>, the division <ln numlevel="1" lineno="442" slineno="7-28"/>determines that housing the minor in a secure care facility  presents an unreasonable <ln numlevel="1" lineno="443" slineno="7-29"/>risk to others or that it is not in the best interest of the minor, the division shall <ln numlevel="1" lineno="444" slineno="7-30"/>transfer the physical custody of the minor to the Department of Corrections.</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="18-null-10" dnum="3-o:4-i" numlevel="1" lineno="445" slineno="7-31" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1220" style="2" owner="o" level="1" deltag="both">(3)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1221" style="1" owner="i" level="1" amendtag="both" space="true">(4)</amend></display><subsection ssid="18-null-11" dnum="a-o" level="2" placement="sameline"><display>(a)</display>When a minor is committed to prison but provisionally housed in a secure <ln numlevel="1" lineno="446" slineno="7-32"/>care facility <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="81" groupid="64" style="2" owner="jchristopherson" level="1" deltag="both"> </amend><amendoutend style="2"/>under this section, the district court and the division shall immediately <ln numlevel="1" lineno="447" slineno="7-33"/>notify the Board of Pardons and Parole so that the minor may be scheduled for a <ln numlevel="1" lineno="448" slineno="7-34"/>hearing according to board procedures.</subsection><subsection ssid="18-null-12" dnum="b-o" numlevel="1" lineno="449" slineno="7-35" level="2"><display>(b)</display>If a minor who is provisionally housed in a secure care facility <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="110" groupid="85" style="2" owner="jchristopherson" level="1" deltag="both"> </amend><amendoutend style="2"/>under this section <ln numlevel="1" lineno="450" slineno="7-36"/>has not been paroled or otherwise released from incarceration by the time the minor <ln numlevel="1" lineno="451" slineno="7-37"/>reaches 25 years old, the division shall as soon as reasonably possible, but not later <ln numlevel="1" lineno="452" slineno="7-38"/>than when the minor reaches 25 years and 6 months old, transfer the minor to the <ln numlevel="1" lineno="453" slineno="7-39"/>physical custody of the Department of Corrections.</subsection></subsection><subsection ssid="18-null-13" dnum="4-o:5-i" numlevel="1" lineno="454" slineno="7-40" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1223" style="2" owner="o" level="1" deltag="both">(4)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1224" style="1" owner="i" level="1" amendtag="both" space="true">(5)</amend></display>Upon the commitment of a minor to the custody of the division or the Department <ln numlevel="1" lineno="455" slineno="7-41"/>of Corrections under this section, the Board of Pardons and Parole has authority over the <ln numlevel="1" lineno="456" slineno="7-42"/>minor for purposes of parole, pardon, commutation, termination of sentence, remission <ln numlevel="1" lineno="457" slineno="7-43"/>of restitution, fines or forfeitures, and all other purposes authorized by law.</subsection><subsection ssid="18-null-14" dnum="5-o:6-i" numlevel="1" lineno="458" slineno="7-44" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1224" style="2" owner="o" level="1" deltag="both">(5)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1225" style="1" owner="i" level="1" amendtag="both" space="true">(6)</amend></display>The authority<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="111" groupid="86" style="2" owner="jchristopherson" level="1" deltag="both"> </amend><amendoutend style="2"/> shall:<subsection ssid="18-null-15" dnum="a-o" numlevel="1" lineno="459" slineno="7-45" level="2"><display>(a)</display>hold hearings, receive reports, or otherwise keep informed of the progress of a minor <ln numlevel="1" lineno="460" slineno="7-46"/>in the custody of the division under this section; and</subsection><subsection ssid="18-null-16" dnum="b-o" numlevel="1" lineno="461" slineno="7-47" level="2"><display>(b)</display>forward to the Board of Pardons and Parole any information or recommendations <ln numlevel="1" lineno="462" slineno="7-48"/>concerning the minor.</subsection></subsection><subsection ssid="18-45" dnum="_-o:7-i" numlevel="1" lineno="463" slineno="7-49" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1227" style="1" owner="i" level="1" amendtag="start">(7)</amend></display><amend anum="0" ea="amend" pairid="161" groupid="127" style="1" owner="jchristopherson" level="1" amendtag="end">Upon a motion by a prosecuting attorney, the Board of Pardons and Parole may:</amend><subsection ssid="18-46" dnum="_-o:a-i" numlevel="1" lineno="464" slineno="7-50" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1228" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="162" groupid="128" style="1" owner="jchristopherson" level="1" amendtag="end">review the status of a minor who is provisionally housed in a secure care facility as <ln numlevel="1" lineno="465" slineno="7-51"/>described in Subsection <xref depth="4" refnumber="80-6-507(2)(a)(ii)">(2)(a)(ii)</xref>; and</amend></subsection><subsection ssid="18-47" dnum="_-o:b-i" numlevel="1" lineno="466" slineno="7-52" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1229" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="165" groupid="130" style="1" owner="jchristopherson" level="1" amendtag="end">order that the minor be committed to the physical custody of the Department of <ln numlevel="1" lineno="467" slineno="7-53"/>Corrections and housed in a correctional facility if:</amend><subsection ssid="18-48" dnum="_-o:i-i" numlevel="1" lineno="468" slineno="7-54" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1230" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="168" groupid="132" style="1" owner="jchristopherson" level="1" amendtag="end">the minor meets the requirements described in Subsections <xref depth="4" refnumber="80-6-507(3)(a)">(3)(a)</xref> through <xref depth="4" refnumber="80-6-507(c)">(c)</xref>; and</amend></subsection><subsection ssid="18-49" dnum="_-o:ii-i" numlevel="1" lineno="469" slineno="7-55" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1231" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="171" groupid="134" style="1" owner="jchristopherson" level="1" amendtag="end">the Board of Pardons and Parole finds that the commitment and transfer is <ln numlevel="1" lineno="470" slineno="7-56"/>warranted.</amend></subsection></subsection></subsection><subsection ssid="18-31" dnum="_-o:8-i" numlevel="1" lineno="471" slineno="7-57" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1232" style="1" owner="i" level="1" amendtag="start">(8)</amend></display><subsection ssid="18-34" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1233" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="134" groupid="105" style="1" owner="jchristopherson" level="1" amendtag="end">The division shall adopt procedures by rule, in accordance with Title 63G, <ln numlevel="1" lineno="472" slineno="7-58"/>Chapter 3, Utah Administrative Rulemaking Act, regarding the transfer of a minor <ln numlevel="1" lineno="473" slineno="7-59"/>provisionally housed in a secure care facility as described in Subsection <xref depth="4" refnumber="80-6-507(2)(a)(ii)">(2)(a)(ii)</xref>.</amend></subsection><subsection ssid="18-35" dnum="_-o:b-i" numlevel="1" lineno="474" slineno="7-60" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1234" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="139" groupid="109" style="1" owner="jchristopherson" level="1" amendtag="end">The division shall transfer the physical custody of a minor to the Department of <ln numlevel="1" lineno="475" slineno="7-61"/>Corrections if, in accordance with the rules adopted under Subsection <xref depth="4" refnumber="80-6-507(8)(a)">(8)(a)</xref>, the <ln numlevel="1" lineno="476" slineno="7-62"/>division determines that housing a minor in a secure care facility:</amend><subsection ssid="18-38" dnum="_-o:i-i" numlevel="1" lineno="477" slineno="7-63" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1235" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="156" groupid="123" style="1" owner="jchristopherson" level="1" amendtag="end">presents an unreasonable risk to others; or</amend></subsection><subsection ssid="18-37" dnum="_-o:ii-i" numlevel="1" lineno="478" slineno="7-64" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1236" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="151" groupid="119" style="1" owner="jchristopherson" level="1" amendtag="end">it is not in the best interest of the minor.</amend></subsection></subsection></subsection><subsection ssid="18-null-17" dnum="6-o:9-i" numlevel="1" lineno="479" slineno="7-65" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1237" style="2" owner="o" level="1" deltag="both">(6)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1238" style="1" owner="i" level="1" amendtag="both" space="true">(9)</amend></display>Commitment of a minor under this section is a prison commitment for all <ln numlevel="1" lineno="480" slineno="7-66"/>sentencing purposes.</subsection></section></bsec><bsec buid="1" num="80-6-704" type="amend" src="code" uid="C80-6-S704_2026050620260506" sort="80 06 07040020260506" numlevel="1" lineno="481" slineno="8-1" sn="8"><section number="80-6-704" numlevel="1" lineno="482" slineno="8-2" type="amend"><secline lineno="481">Section 8. Section <bold>80-6-704</bold> is amended to read:</secline><catline lineno="482"><bold>80-6-704<parens/>. Detention or alternative to detention -- Limitations.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="483" slineno="8-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="1-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The juvenile court may order a minor to detention, or an alternative to detention, <ln numlevel="1" lineno="484" slineno="8-4"/>if the minor is adjudicated for:<subsection ssid="1-null-3" dnum="i-o" numlevel="1" lineno="485" slineno="8-5" level="3" tab="1"><display>(i)</display>an offense under Section <xref depth="3" refnumber="80-6-701">80-6-701</xref>; or</subsection><subsection ssid="1-null-4" dnum="ii-o" numlevel="1" lineno="486" slineno="8-6" level="3" tab="1"><display>(ii)</display>contempt of court under Section <xref depth="3" refnumber="78A-6-353">78A-6-353</xref>.</subsection></subsection><subsection ssid="1-null-5" dnum="b-o" numlevel="1" lineno="487" slineno="8-7" level="2"><display>(b)</display>Except as provided in Subsection <xref depth="4" refnumber="78A-6-353(4)">78A-6-353(4)</xref>, and subject to the juvenile court <ln numlevel="1" lineno="488" slineno="8-8"/>retaining continuing jurisdiction over a minor's case, the juvenile court may order a <ln numlevel="1" lineno="489" slineno="8-9"/>minor to detention, or an alternative to detention, under Subsection <xref depth="4" refnumber="80-6-704(1)(a)">(1)(a)</xref> for a period <ln numlevel="1" lineno="490" slineno="8-10"/>not to exceed 30 cumulative days for an adjudication.</subsection><subsection ssid="1-null-6" dnum="c-o" numlevel="1" lineno="491" slineno="8-11" level="2"><display>(c)</display>If a minor is held in detention before an adjudication, the time spent in detention <ln numlevel="1" lineno="492" slineno="8-12"/>before the adjudication shall be credited toward the 30 cumulative days eligible as a <ln numlevel="1" lineno="493" slineno="8-13"/>disposition under Subsection <xref depth="4" refnumber="80-6-704(1)(b)">(1)(b)</xref>.</subsection><subsection ssid="1-null-7" dnum="d-o" numlevel="1" lineno="494" slineno="8-14" level="2"><display>(d)</display>If a minor spent more than 30 days in detention before a disposition, the juvenile <ln numlevel="1" lineno="495" slineno="8-15"/>court may not order the minor to detention under this section.</subsection></subsection><subsection ssid="1-null-8" dnum="2-o" numlevel="1" lineno="496" slineno="8-16" level="1"><display>(2)</display>An order for detention under Subsection <xref depth="4" refnumber="80-6-704(1)">(1)</xref> may not be suspended upon conditions <ln numlevel="1" lineno="497" slineno="8-17"/>ordered by the juvenile court.</subsection><subsection ssid="1-null-9" dnum="3-o" numlevel="1" lineno="498" slineno="8-18" level="1"><display>(3)</display>A juvenile court may not order a minor to detention for:<subsection ssid="1-null-10" dnum="a-o" numlevel="1" lineno="499" slineno="8-19" level="2"><display>(a)</display>contempt of court, except to the extent permitted under Section <xref depth="3" refnumber="78A-6-353">78A-6-353</xref>;</subsection><subsection ssid="1-null-11" dnum="b-o" numlevel="1" lineno="500" slineno="8-20" level="2"><display>(b)</display>a violation of probation;</subsection><subsection ssid="1-null-12" dnum="c-o" numlevel="1" lineno="501" slineno="8-21" level="2"><display>(c)</display>failure to pay a fine, fee, restitution, or other financial obligation;</subsection><subsection ssid="1-null-13" dnum="d-o" numlevel="1" lineno="502" slineno="8-22" level="2"><display>(d)</display>unfinished compensatory or community service hours;</subsection><subsection ssid="1-null-14" dnum="e-o" numlevel="1" lineno="503" slineno="8-23" level="2"><display>(e)</display>an infraction; or</subsection><subsection ssid="1-null-15" dnum="f-o" numlevel="1" lineno="504" slineno="8-24" level="2"><display>(f)</display>a status offense.</subsection></subsection><subsection ssid="1-null-16" dnum="4-o:_-i" numlevel="1" lineno="505" slineno="8-25" ea="erase" anum="0" owner="jchristopherson" style="2" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1253" style="2" owner="o" level="1" deltag="start">(4)</amend></display><amend anum="0" ea="erase" pairid="5" groupid="4" style="2" owner="jchristopherson" level="1" deltag="end">A juvenile court may not order a minor be placed in a correctional facility that is <ln numlevel="1" lineno="506" slineno="8-26"/>intended to hold adults accused or convicted of offenses as an alternative to detention <ln numlevel="1" lineno="507" slineno="8-27"/>under Subsection (1).</amend><amendoutend style="2"/></subsection><subsection ssid="1-null-17" dnum="5-o:4-i" numlevel="1" lineno="508" slineno="8-28" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1254" style="2" owner="o" level="1" deltag="both">(5)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1255" style="1" owner="i" level="1" amendtag="both" space="true">(4)</amend></display><subsection ssid="1-null-18" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If a minor is held in detention under this section, the minor is eligible to <ln numlevel="1" lineno="509" slineno="8-29"/>receive credit for good behavior against the period of detention.</subsection><subsection ssid="1-null-19" dnum="b-o" numlevel="1" lineno="510" slineno="8-30" level="2"><display>(b)</display>The rate of credit is one day of credit for good behavior for every three days spent in <ln numlevel="1" lineno="511" slineno="8-31"/>detention.</subsection></subsection><subsection ssid="1-null-20" dnum="6-o:5-i" numlevel="1" lineno="512" slineno="8-32" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1257" style="2" owner="o" level="1" deltag="both">(6)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1258" style="1" owner="i" level="1" amendtag="both" space="true">(5)</amend></display><subsection ssid="1-null-21" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A minor may not be held in secure detention following a disposition by the <ln numlevel="1" lineno="513" slineno="8-33"/>juvenile court:<subsection ssid="1-null-22" dnum="i-o" numlevel="1" lineno="514" slineno="8-34" level="3" tab="1"><display>(i)</display>under Chapter 3, Abuse, Neglect, and Dependency Proceedings; or</subsection><subsection ssid="1-null-23" dnum="ii-o" numlevel="1" lineno="515" slineno="8-35" level="3" tab="1"><display>(ii)</display>except as provided in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="12" groupid="11" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="80-6-704(6)(b)">(6)(b)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="10" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(5)(b)</amend>, for a community-based program.</subsection></subsection><subsection ssid="1-null-24" dnum="b-o" numlevel="1" lineno="516" slineno="8-36" level="2"><display>(b)</display>If a minor is awaiting placement by the division under Section <xref depth="3" refnumber="80-6-703">80-6-703</xref>, a minor <ln numlevel="1" lineno="517" slineno="8-37"/>may not be held in secure detention for longer than 72 hours, excluding weekends <ln numlevel="1" lineno="518" slineno="8-38"/>and holidays.</subsection><subsection ssid="1-null-25" dnum="c-o" numlevel="1" lineno="519" slineno="8-39" level="2"><display>(c)</display>The period of detention under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="13" groupid="12" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="80-6-704(6)(b)">(6)(b)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="11" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(5)(b)</amend> may be extended by the <ln numlevel="1" lineno="520" slineno="8-40"/>juvenile court for a cumulative total of seven calendar days if:<subsection ssid="1-null-26" dnum="i-o" numlevel="1" lineno="521" slineno="8-41" level="3"><display>(i)</display>the division, or another agency responsible for placement, files a written petition <ln numlevel="1" lineno="522" slineno="8-42"/>with the juvenile court requesting the extension and setting forth good cause; and</subsection><subsection ssid="1-null-27" dnum="ii-o" numlevel="1" lineno="523" slineno="8-43" level="3"><display>(ii)</display>the juvenile court enters a written finding that it is in the best interests of both the <ln numlevel="1" lineno="524" slineno="8-44"/>minor and the community to extend the period of detention.</subsection></subsection><subsection ssid="1-null-28" dnum="d-o" numlevel="1" lineno="525" slineno="8-45" level="2"><display>(d)</display>The juvenile court may extend the period of detention beyond the seven calendar <ln numlevel="1" lineno="526" slineno="8-46"/>days if the juvenile court finds, by clear and convincing evidence, that:<subsection ssid="1-null-29" dnum="i-o" numlevel="1" lineno="527" slineno="8-47" level="3"><display>(i)</display>the division, or another agency responsible for placement, does not have space for <ln numlevel="1" lineno="528" slineno="8-48"/>the minor; and</subsection><subsection ssid="1-null-30" dnum="ii-o" numlevel="1" lineno="529" slineno="8-49" level="3"><display>(ii)</display>the safety of the minor and community requires an extension of the period of <ln numlevel="1" lineno="530" slineno="8-50"/>detention.</subsection></subsection><subsection ssid="1-null-31" dnum="e-o" numlevel="1" lineno="531" slineno="8-51" level="2"><display>(e)</display>The division, or the agency with custody of the minor, shall report to the juvenile <ln numlevel="1" lineno="532" slineno="8-52"/>court every 48 hours, excluding weekends and holidays, regarding whether the <ln numlevel="1" lineno="533" slineno="8-53"/>division, or another agency responsible for placement, has space for the minor.</subsection><subsection ssid="1-null-32" dnum="f-o" numlevel="1" lineno="534" slineno="8-54" level="2"><display>(f)</display>The division, or agency, requesting an extension shall promptly notify the detention <ln numlevel="1" lineno="535" slineno="8-55"/>facility that a written petition has been filed.</subsection><subsection ssid="1-null-33" dnum="g-o" numlevel="1" lineno="536" slineno="8-56" level="2"><display>(g)</display>The juvenile court shall promptly notify the detention facility regarding the juvenile <ln numlevel="1" lineno="537" slineno="8-57"/>court's initial disposition and any ruling on a petition for an extension, whether <ln numlevel="1" lineno="538" slineno="8-58"/>granted or denied.</subsection></subsection></section></bsec><bsec buid="21" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="539" slineno="9-1" sn="9"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="539">Section 9.  <bold>Effective Date.</bold></secline><sectionText lineno="540"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>12-19-25 11:34 AM</tm></rev></foot></leg>
