Section <bold>73-3-1</bold> is amended to read:</secline><catline lineno="29"><bold>73-3-1<parens/>. Appropriation -- Manner of acquiring water rights.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="30" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>A person may acquire a right to the use of the unappropriated public waters in this state <ln numlevel="1" lineno="31" slineno="1-4"/>only as provided for in this title.</subsection><subsection ssid="1-null-2" dnum="2-o" numlevel="1" lineno="32" slineno="1-5" level="1"><display>(2)</display>The appropriation of public waters in the state shall comply with the requirements of <ln numlevel="1" lineno="33" slineno="1-6"/>this title.</subsection><subsection ssid="1-null-3" dnum="3-o" numlevel="1" lineno="34" slineno="1-7" level="1"><display>(3)</display>Except as provided in Subsection <xref depth="4" refid="C73-3-S1_1800010118000101" refnumber="73-3-1(7)" start="0">(7)</xref>, a person obtaining, initiating the use of, or <ln numlevel="1" lineno="35" slineno="1-8"/>providing notice of intent to appropriate a water right shall comply with the <ln numlevel="1" lineno="36" slineno="1-9"/>requirements of this chapter.</subsection><subsection ssid="1-null-4" dnum="4-o" numlevel="1" lineno="37" slineno="1-10" level="1"><display>(4)</display>An appropriation may be made only for a useful and beneficial purpose.</subsection><subsection ssid="1-null-5" dnum="5-o" numlevel="1" lineno="38" slineno="1-11" level="1" space="false"><display>(5)</display><subsection ssid="1-null-6" dnum="a-o:_-i" ea="erase" anum="0" owner="jchristopherson" style="2" level="2" placement="sameline"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1005" style="2" owner="o" level="1" deltag="both">(a)</amend><amendoutend style="2"/></display>Between appropriators, the one first in time is first in rights.</subsection><subsection ssid="1-null-7" dnum="b-o:_-i" numlevel="1" lineno="39" slineno="1-12" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1006" style="2" owner="o" level="1" deltag="start">(b)</amend></display><amend anum="0" ea="erase" pairid="3" groupid="2" style="2" owner="jchristopherson" level="1" deltag="end">A use designated by an application to appropriate any of the unappropriated waters <ln numlevel="1" lineno="40" slineno="1-13"/>of the state that would materially interfere with a more beneficial use of the water <ln numlevel="1" lineno="41" slineno="1-14"/>shall be dealt with as provided in Section <xref depth="3" refid="C73-3-S8_1800010118000101" refnumber="73-3-8" start="0">73-3-8</xref>.</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="1-null-8" dnum="6-o" numlevel="1" lineno="42" slineno="1-15" level="1"><display>(6)</display>A person may not acquire a right to the use of water either appropriated or <ln numlevel="1" lineno="43" slineno="1-16"/>unappropriated by adverse use or adverse possession.</subsection><subsection ssid="1-null-9" dnum="7-o" numlevel="1" lineno="44" slineno="1-17" level="1"><display>(7)</display>Notwithstanding Section <xref depth="3" refid="C73-3-S2_1800010118000101" refnumber="73-3-2" start="0">73-3-2</xref>, a person may directly capture and store precipitation as <ln numlevel="1" lineno="45" slineno="1-18"/>provided in Section <xref depth="3" refid="C73-3-S1.5_1800010118000101" refnumber="73-3-1.5" start="0">73-3-1.5</xref>.</subsection></section></bsec><bsec buid="5" num="73-3-7" type="amend" src="code" uid="C73-3-S7_2026050620260506" sort="73 03 00070020260506" numlevel="1" lineno="46" slineno="2-1" sn="2"><section number="73-3-7" numlevel="1" lineno="47" slineno="2-2" type="amend"><secline lineno="46">Section 2. Section <bold>73-3-7</bold> is amended to read:</secline><catline lineno="47"><bold>73-3-7<parens/>. Protests.</bold></catline><subsection ssid="5-null-1" dnum="1-o" numlevel="1" lineno="48" slineno="2-3" level="1" placement="noreturn"><display>(1)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="7" groupid="7" style="2" owner="jchristopherson" level="1" deltag="both">Any</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Subject to Subsection <xref refnumber="5-5">(2)</xref>, a</amend> person interested may file a protest with the state <ln numlevel="1" lineno="49" slineno="2-4"/>engineer:<subsection ssid="5-null-2" dnum="a-o" numlevel="1" lineno="50" slineno="2-5" level="2"><display>(a)</display>within 20 days after the notice is published, if the adjudicative proceeding is <ln numlevel="1" lineno="51" slineno="2-6"/>informal; and</subsection><subsection ssid="5-null-3" dnum="b-o" numlevel="1" lineno="52" slineno="2-7" level="2"><display>(b)</display>within 30 days after the notice is published, if the adjudicative proceeding is formal.</subsection></subsection><subsection ssid="5-null-4" dnum="2-o" numlevel="1" lineno="53" slineno="2-8" level="1"><display>(2)</display>The state engineer shall<amend anum="0" ea="amend" pairid="13" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="both">:</amend><subsection ssid="5-6" dnum="_-o:a-i" numlevel="1" lineno="54" slineno="2-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1013" style="1" owner="i" level="1" amendtag="both">(a)</amend></display> consider <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="30" groupid="27" style="2" owner="jchristopherson" level="1" deltag="both">the</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="29" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a</amend> protest<amend anum="0" ea="amend" pairid="21" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="both"> only to the extent the protest addresses a basis for which the <ln numlevel="1" lineno="55" slineno="2-10"/>state engineer may approve or reject the application;</amend> and <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="25" groupid="22" style="2" owner="jchristopherson" level="1" deltag="both">shall</amend><amendoutend style="2"/> </subsection><subsection ssid="5-8" dnum="_-o:b-i" numlevel="1" lineno="56" slineno="2-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1014" style="1" owner="i" level="1" amendtag="both">(b)</amend></display>approve or reject the application.</subsection></subsection></section></bsec><bsec buid="2" num="73-3-8" type="amend" src="code" uid="C73-3-S8_2026050620260506" sort="73 03 00080020260506" numlevel="1" lineno="57" slineno="3-1" sn="3"><section number="73-3-8" numlevel="1" lineno="58" slineno="3-2" type="amend"><secline lineno="57">Section 3. Section <bold>73-3-8</bold> is amended to read:</secline><catline lineno="58"><bold>73-3-8<parens/>. Approval or rejection of application -- Requirements for approval -- <ln numlevel="1" lineno="59" slineno="3-3"/>Application for specified period of time -- Filing of royalty contract for removal of salt or <ln numlevel="1" lineno="60" slineno="3-4"/>minerals -- Request for agency action.</bold></catline><subsection ssid="2-null-1" dnum="1-o" numlevel="1" lineno="61" slineno="3-5" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="2-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="103" groupid="89" style="2" owner="jchristopherson" level="1" deltag="both">It shall be the duty of the</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="86" groupid="72" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">The</amend> state engineer <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="104" groupid="90" style="2" owner="jchristopherson" level="1" deltag="both">to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="87" groupid="73" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">shall</amend> approve an application if <ln numlevel="1" lineno="62" slineno="3-6"/>there is reason to believe that:<subsection ssid="2-null-3" dnum="i-o" numlevel="1" lineno="63" slineno="3-7" level="3" tab="1"><display>(i)</display>for an application to appropriate, there is unappropriated water in the proposed <ln numlevel="1" lineno="64" slineno="3-8"/>source;</subsection><subsection ssid="2-null-4" dnum="ii-o" numlevel="1" lineno="65" slineno="3-9" level="3" tab="1"><display>(ii)</display>the proposed use will not impair existing rights<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="2" style="2" owner="jchristopherson" level="1" deltag="both"> or interfere with the more <ln numlevel="1" lineno="66" slineno="3-10"/>beneficial use of the water</amend><amendoutend style="2"/>;</subsection><subsection ssid="2-null-5" dnum="iii-o" numlevel="1" lineno="67" slineno="3-11" level="3" tab="1"><display>(iii)</display>the proposed plan:<subsection ssid="2-null-6" dnum="A-o" numlevel="1" lineno="68" slineno="3-12" level="4"><display>(A)</display>is physically and economically feasible, unless the application is filed by the <ln numlevel="1" lineno="69" slineno="3-13"/>United States Bureau of Reclamation; and</subsection><subsection ssid="2-null-7" dnum="B-o" numlevel="1" lineno="70" slineno="3-14" level="4"><display>(B)</display>would not prove detrimental to the public welfare;</subsection></subsection><subsection ssid="2-null-8" dnum="iv-o" numlevel="1" lineno="71" slineno="3-15" level="3" tab="1"><display>(iv)</display>the applicant has the financial ability to complete the proposed works;</subsection><subsection ssid="2-null-9" dnum="v-o" numlevel="1" lineno="72" slineno="3-16" level="3" tab="1"><display>(v)</display>the application was filed in good faith and not for purposes of speculation or <ln numlevel="1" lineno="73" slineno="3-17"/>monopoly; and</subsection><subsection ssid="2-null-10" dnum="vi-o" numlevel="1" lineno="74" slineno="3-18" level="3" tab="1"><display>(vi)</display>if applicable, the application complies with a groundwater management plan <ln numlevel="1" lineno="75" slineno="3-19"/>adopted under Section <xref depth="3" refnumber="73-5-15">73-5-15</xref>.</subsection></subsection><subsection ssid="2-null-11" dnum="b-o:_-i" numlevel="1" lineno="76" slineno="3-20" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1025" style="2" owner="o" level="1" deltag="start">(b)</amend></display><amend anum="0" ea="erase" pairid="4" groupid="3" style="2" owner="jchristopherson" level="1" deltag="end">If the state engineer, because of information in the state engineer's possession <ln numlevel="1" lineno="77" slineno="3-21"/>obtained either by the state engineer's own investigation or otherwise, has reason to <ln numlevel="1" lineno="78" slineno="3-22"/>believe that an application will interfere with the water's more beneficial use for <ln numlevel="1" lineno="79" slineno="3-23"/>irrigation, municipal and industrial, domestic or culinary, stock watering, power or <ln numlevel="1" lineno="80" slineno="3-24"/>mining development, or manufacturing, or will unreasonably affect public recreation <ln numlevel="1" lineno="81" slineno="3-25"/>or the natural stream environment, or will prove detrimental to the public welfare, the <ln numlevel="1" lineno="82" slineno="3-26"/>state engineer shall withhold approval or rejection of the application until the state <ln numlevel="1" lineno="83" slineno="3-27"/>engineer has investigated the matter.</amend><amendoutend style="2"/></subsection><subsection ssid="2-null-12" dnum="c-o:b-i" numlevel="1" lineno="84" slineno="3-28" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1026" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1027" style="1" owner="i" level="1" amendtag="both" space="true">(b)</amend></display>If an application does not meet the requirements of this section, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="107" groupid="93" style="2" owner="jchristopherson" level="1" deltag="both">it shall be <ln numlevel="1" lineno="85" slineno="3-29"/>rejected</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="89" groupid="75" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the state engineer shall reject the application</amend>.</subsection></subsection><subsection ssid="2-null-13" dnum="2-o" numlevel="1" lineno="86" slineno="3-30" level="1" space="false"><display>(2)</display><subsection ssid="2-null-14" dnum="a-o" level="2" placement="sameline"><display>(a)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="108" groupid="94" style="2" owner="jchristopherson" level="1" deltag="both">An </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="90" groupid="76" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">The state engineer may approve an </amend>application to appropriate water for <ln numlevel="1" lineno="87" slineno="3-31"/>industrial, power, mining development, manufacturing purposes, agriculture, or <ln numlevel="1" lineno="88" slineno="3-32"/>municipal purposes<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="152" groupid="136" style="2" owner="jchristopherson" level="1" deltag="both"> may be approved</amend><amendoutend style="2"/> for a specific and certain period from the time <ln numlevel="1" lineno="89" slineno="3-33"/>the water is placed to beneficial use under the application, but in no event may<amend anum="0" ea="amend" pairid="91" groupid="77" style="1" owner="jchristopherson" level="1" amendtag="both"> the <ln numlevel="1" lineno="90" slineno="3-34"/>state engineer grant</amend> an application<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="153" groupid="137" style="2" owner="jchristopherson" level="1" deltag="both"> be granted</amend><amendoutend style="2"/> for a period of time less than that <ln numlevel="1" lineno="91" slineno="3-35"/>ordinarily needed to satisfy the essential and primary purpose of the application or <ln numlevel="1" lineno="92" slineno="3-36"/>until the water is no longer available as determined by the state engineer.</subsection><subsection ssid="2-null-15" dnum="b-o" numlevel="1" lineno="93" slineno="3-37" level="2"><display>(b)</display>At the expiration of the period fixed by the state engineer the water shall revert to the <ln numlevel="1" lineno="94" slineno="3-38"/>public and is subject to appropriation as provided by this title.</subsection><subsection ssid="2-null-16" dnum="c-o" numlevel="1" lineno="95" slineno="3-39" level="2"><display>(c)</display>No later than 60 calendar days before the expiration date of the fixed time period, the <ln numlevel="1" lineno="96" slineno="3-40"/>state engineer shall send notice by mail or by any form of electronic communication <ln numlevel="1" lineno="97" slineno="3-41"/>through which receipt is verifiable, to the applicant of record.</subsection><subsection ssid="2-null-17" dnum="d-o" numlevel="1" lineno="98" slineno="3-42" level="2"><display>(d)</display>Except as provided by Subsection <xref depth="4" refnumber="73-3-8(2)(e)">(2)(e)</xref>, the state engineer may extend <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="111" groupid="97" style="2" owner="jchristopherson" level="1" deltag="both">any</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="92" groupid="78" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a</amend> <ln numlevel="1" lineno="99" slineno="3-43"/>limited water right upon a showing that:<subsection ssid="2-null-18" dnum="i-o" numlevel="1" lineno="100" slineno="3-44" level="3"><display>(i)</display>the essential purpose of the original application has not been satisfied;</subsection><subsection ssid="2-null-19" dnum="ii-o" numlevel="1" lineno="101" slineno="3-45" level="3"><display>(ii)</display>the need for an extension is not the result of any default or neglect by the <ln numlevel="1" lineno="102" slineno="3-46"/>applicant; and</subsection><subsection ssid="2-null-20" dnum="iii-o" numlevel="1" lineno="103" slineno="3-47" level="3"><display>(iii)</display>the water is still available.</subsection></subsection><subsection ssid="2-null-21" dnum="e-o" numlevel="1" lineno="104" slineno="3-48" level="2"><display>(e)</display>An extension <amend anum="0" ea="amend" pairid="94" groupid="80" style="1" owner="jchristopherson" level="1" amendtag="both">under Subsection <xref refnumber="2-null-17">(2)(d)</xref> </amend>may not exceed the time necessary to satisfy <ln numlevel="1" lineno="105" slineno="3-49"/>the primary purpose of the original application.</subsection><subsection ssid="2-null-22" dnum="f-o" numlevel="1" lineno="106" slineno="3-50" level="2"><display>(f)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="151" groupid="135" style="2" owner="jchristopherson" level="1" deltag="both">A</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="150" groupid="134" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">An applicant shall file a</amend> request for extension of <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="133" groupid="119" style="2" owner="jchristopherson" level="1" deltag="both">the</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="129" groupid="115" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a</amend> fixed time period <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="154" groupid="138" style="2" owner="jchristopherson" level="1" deltag="both">must be <ln numlevel="1" lineno="107" slineno="3-51"/>filed </amend><amendoutend style="2"/>in writing in the office of the state engineer on or before the expiration date of <ln numlevel="1" lineno="108" slineno="3-52"/>the application.</subsection></subsection><subsection ssid="2-null-23" dnum="3-o" numlevel="1" lineno="109" slineno="3-53" level="1" space="false"><display>(3)</display><subsection ssid="2-null-24" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Before the approval of <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="135" groupid="121" style="2" owner="jchristopherson" level="1" deltag="both">any</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="130" groupid="116" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">an</amend> application to divert water from <amend anum="0" ea="amend" pairid="131" groupid="117" style="1" owner="jchristopherson" level="1" amendtag="both">a </amend>navigable <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="137" groupid="123" style="2" owner="jchristopherson" level="1" deltag="both">lakes <ln numlevel="1" lineno="110" slineno="3-54"/>or streams</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="132" groupid="118" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">lake or stream</amend> of the state that contemplates the recovery of salts and <ln numlevel="1" lineno="111" slineno="3-55"/>other minerals or elements, as defined in Section <xref depth="3" refnumber="65A-17-101">65A-17-101</xref>, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="115" groupid="101" style="2" owner="jchristopherson" level="1" deltag="both">therefrom</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="96" groupid="82" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">from the <ln numlevel="1" lineno="112" slineno="3-56"/>navigable lake or stream</amend> by precipitation or otherwise, the applicant shall file with <ln numlevel="1" lineno="113" slineno="3-57"/>the state engineer a copy of:<subsection ssid="2-null-25" dnum="i-o" numlevel="1" lineno="114" slineno="3-58" level="3" tab="1"><display>(i)</display> a contract for the payment of royalties to the state; and</subsection><subsection ssid="2-null-26" dnum="ii-o" numlevel="1" lineno="115" slineno="3-59" level="3" tab="1"><display>(ii)</display>any mineral lease.</subsection></subsection><subsection ssid="2-null-27" dnum="b-o" numlevel="1" lineno="116" slineno="3-60" level="2"><display>(b)</display>The <amend anum="0" ea="amend" pairid="97" groupid="83" style="1" owner="jchristopherson" level="1" amendtag="both">state engineer shall reverse the </amend>approval of an application <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="155" groupid="139" style="2" owner="jchristopherson" level="1" deltag="both">shall be reversed </amend><amendoutend style="2"/>if <ln numlevel="1" lineno="117" slineno="3-61"/>the applicant fails to comply with terms of the royalty contract or mineral lease.</subsection></subsection><subsection ssid="2-null-28" dnum="4-o" numlevel="1" lineno="118" slineno="3-62" level="1" space="false"><display>(4)</display><subsection ssid="2-null-29" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The state engineer shall investigate <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="117" groupid="103" style="2" owner="jchristopherson" level="1" deltag="both">all</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="98" groupid="84" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a</amend> temporary change <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="119" groupid="105" style="2" owner="jchristopherson" level="1" deltag="both">applications</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="99" groupid="85" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="119" slineno="3-63"/>application</amend>.</subsection><subsection ssid="2-85" dnum="_-o:b-i" numlevel="1" lineno="120" slineno="3-64" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1044" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="141" groupid="126" style="1" owner="jchristopherson" level="1" amendtag="end">The state engineer is not required to publish notice of a temporary change application <ln numlevel="1" lineno="121" slineno="3-65"/>under Section <xref depth="3" refnumber="73-3-6">73-3-6</xref>.</amend></subsection><subsection ssid="2-null-30" dnum="b-o:c-i" numlevel="1" lineno="122" slineno="3-66" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1045" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1046" style="1" owner="i" level="1" amendtag="both" space="true">(c)</amend></display>The state engineer shall:<subsection ssid="2-null-31" dnum="i-o" numlevel="1" lineno="123" slineno="3-67" level="3"><display>(i)</display>approve the temporary change if the state engineer finds there is reason to believe <ln numlevel="1" lineno="124" slineno="3-68"/>that the temporary change <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="121" groupid="107" style="2" owner="jchristopherson" level="1" deltag="both">will</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="100" groupid="86" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">does</amend> not impair an existing right; and</subsection><subsection ssid="2-null-32" dnum="ii-o" numlevel="1" lineno="125" slineno="3-69" level="3"><display>(ii)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="148" groupid="132" style="2" owner="jchristopherson" level="1" deltag="both">deny </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="147" groupid="131" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">reject </amend>the temporary change if the state engineer finds there is reason to <ln numlevel="1" lineno="126" slineno="3-70"/>believe the temporary change would impair an existing right.</subsection></subsection><subsection ssid="2-86" dnum="_-o:d-i" numlevel="1" lineno="127" slineno="3-71" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1048" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="145" groupid="129" style="1" owner="jchristopherson" level="1" amendtag="end">If the state engineer rejects a temporary change application, the applicant may file a <ln numlevel="1" lineno="128" slineno="3-72"/>permanent or fixed time change application.</amend></subsection></subsection><subsection ssid="2-null-33" dnum="5-o" numlevel="1" lineno="129" slineno="3-73" level="1" space="false"><display>(5)</display><subsection ssid="2-null-34" dnum="a-o" level="2" placement="sameline"><display>(a)</display>With respect to a change application for a permanent or fixed time change:<subsection ssid="2-null-35" dnum="i-o" numlevel="1" lineno="130" slineno="3-74" level="3" tab="1"><display>(i)</display>the state engineer shall follow the same procedures provided in this title for <ln numlevel="1" lineno="131" slineno="3-75"/>approving an application to appropriate water; and</subsection><subsection ssid="2-null-36" dnum="ii-o" numlevel="1" lineno="132" slineno="3-76" level="3" tab="1"><display>(ii)</display>the rights and duties of a change applicant are the same as the rights and duties of <ln numlevel="1" lineno="133" slineno="3-77"/>a person who applies to appropriate water under this title.</subsection></subsection><subsection ssid="2-null-37" dnum="b-o" numlevel="1" lineno="134" slineno="3-78" level="2"><display>(b)</display>The state engineer may waive notice for a permanent or fixed time change <ln numlevel="1" lineno="135" slineno="3-79"/>application if the application only involves a change in point of diversion of 660 feet <ln numlevel="1" lineno="136" slineno="3-80"/>or less.</subsection><subsection ssid="2-null-38" dnum="c-o" numlevel="1" lineno="137" slineno="3-81" level="2"><display>(c)</display>The state engineer may condition approval of a change application, including to:<subsection ssid="2-null-39" dnum="i-o" numlevel="1" lineno="138" slineno="3-82" level="3"><display>(i)</display> prevent an enlargement of the quantity of water depleted by the nature of the <ln numlevel="1" lineno="139" slineno="3-83"/>proposed use when compared with the nature of the currently approved use of <ln numlevel="1" lineno="140" slineno="3-84"/>water proposed to be changed; and</subsection><subsection ssid="2-null-40" dnum="ii-o" numlevel="1" lineno="141" slineno="3-85" level="3"><display>(ii)</display>ensure that the recognition and subsequent use of saved water, as defined in <ln numlevel="1" lineno="142" slineno="3-86"/>Section <xref depth="3" refnumber="73-3-3">73-3-3</xref>:<subsection ssid="2-null-41" dnum="A-o" numlevel="1" lineno="143" slineno="3-87" level="4"><display>(A)</display>is quantified, reported, and verified;</subsection><subsection ssid="2-null-42" dnum="B-o" numlevel="1" lineno="144" slineno="3-88" level="4"><display>(B)</display>does not lead to an enlargement of the depletion or diversion amounts in the <ln numlevel="1" lineno="145" slineno="3-89"/>underlying water right that serves as the basis of the saved water, or an increase <ln numlevel="1" lineno="146" slineno="3-90"/>in the authorized number of irrigated acres unless depletion is accounted for <ln numlevel="1" lineno="147" slineno="3-91"/>and regulated in the condition;</subsection><subsection ssid="2-null-43" dnum="C-o" numlevel="1" lineno="148" slineno="3-92" level="4"><display>(C)</display>is limited to the net decrease in depletion and net reduction in diversion of the <ln numlevel="1" lineno="149" slineno="3-93"/>underlying water right that serves as the basis of the saved water;</subsection><subsection ssid="2-null-44" dnum="D-o" numlevel="1" lineno="150" slineno="3-94" level="4"><display>(D)</display>is limited to the volume of water that <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="123" groupid="109" style="2" owner="jchristopherson" level="1" deltag="both">will be</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="101" groupid="87" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">is</amend> sustained over time from the <ln numlevel="1" lineno="151" slineno="3-95"/>net decrease in depletion or net reduction in diversion of the underlying water <ln numlevel="1" lineno="152" slineno="3-96"/>right that serves as the basis of the saved water;</subsection><subsection ssid="2-null-45" dnum="E-o" numlevel="1" lineno="153" slineno="3-97" level="4"><display>(E)</display>does not violate an existing water agreement; and</subsection><subsection ssid="2-null-46" dnum="F-o" numlevel="1" lineno="154" slineno="3-98" level="4"><display>(F)</display>when based solely on a net reduction in diversion, the subsequent use is <ln numlevel="1" lineno="155" slineno="3-99"/>limited to nonconsumptive beneficial uses and does not increase the depletion <ln numlevel="1" lineno="156" slineno="3-100"/>allowed by the underlying water right that serves as the basis of the saved <ln numlevel="1" lineno="157" slineno="3-101"/>water or otherwise cause quantity impairment to an existing water right when <ln numlevel="1" lineno="158" slineno="3-102"/>the saved water is beneficially used separate from the underlying water right.</subsection></subsection></subsection><subsection ssid="2-null-47" dnum="d-o" numlevel="1" lineno="159" slineno="3-103" level="2"><display>(d)</display>Except for an application proposing to quantify saved water, a condition described in <ln numlevel="1" lineno="160" slineno="3-104"/>Subsection <xref depth="4" refnumber="73-3-8(5)(c)">(5)(c)</xref> may not include a reduction in the currently approved diversion <ln numlevel="1" lineno="161" slineno="3-105"/>rate of water under the water right identified in the change application solely to <ln numlevel="1" lineno="162" slineno="3-106"/>account for the difference in depletion under the nature of the proposed use when <ln numlevel="1" lineno="163" slineno="3-107"/>compared with the nature of the currently approved use.</subsection></subsection><subsection ssid="2-null-48" dnum="6-o" numlevel="1" lineno="164" slineno="3-108" level="1" space="false"><display>(6)</display><subsection ssid="2-null-49" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="73-3-8(6)(b)">(6)(b)</xref>, the state engineer shall reject a <ln numlevel="1" lineno="165" slineno="3-109"/>permanent or fixed time change application if the person proposing to make the <ln numlevel="1" lineno="166" slineno="3-110"/>change is unable to meet the burden described in Subsection <xref depth="4" refnumber="73-3-3(5)">73-3-3(5)</xref>.</subsection><subsection ssid="2-null-50" dnum="b-o" numlevel="1" lineno="167" slineno="3-111" level="2"><display>(b)</display>If otherwise proper, the state engineer may approve a change application upon one or <ln numlevel="1" lineno="168" slineno="3-112"/>more of the following conditions:<subsection ssid="2-null-51" dnum="i-o" numlevel="1" lineno="169" slineno="3-113" level="3"><display>(i)</display>for part of the water involved;</subsection><subsection ssid="2-null-52" dnum="ii-o" numlevel="1" lineno="170" slineno="3-114" level="3"><display>(ii)</display>that the applicant acquire a conflicting right; or</subsection><subsection ssid="2-null-53" dnum="iii-o" numlevel="1" lineno="171" slineno="3-115" level="3"><display>(iii)</display>that the applicant provide and implement a plan approved by the state engineer to <ln numlevel="1" lineno="172" slineno="3-116"/>mitigate impairment of an existing right.</subsection></subsection><subsection ssid="2-null-54" dnum="c-o" numlevel="1" lineno="173" slineno="3-117" level="2" space="false"><display>(c)</display><subsection ssid="2-null-55" dnum="i-o" level="3" placement="sameline"><display>(i)</display>There is a rebuttable presumption of quantity impairment, as defined in Section <xref depth="3" refnumber="73-3-3"><ln numlevel="1" lineno="174" slineno="3-118"/>73-3-3</xref>, to the extent that, for a period of at least seven consecutive years, a portion <ln numlevel="1" lineno="175" slineno="3-119"/>of the right identified in a change application <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="124" groupid="110" style="2" owner="jchristopherson" level="1" deltag="both">has not been</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="102" groupid="88" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">is not</amend>:<subsection ssid="2-null-56" dnum="A-o" numlevel="1" lineno="176" slineno="3-120" level="4" tab="1"><display>(A)</display>diverted from the approved point of diversion; or</subsection><subsection ssid="2-null-57" dnum="B-o" numlevel="1" lineno="177" slineno="3-121" level="4" tab="1"><display>(B)</display>beneficially used at the approved place of use.</subsection></subsection><subsection ssid="2-null-58" dnum="ii-o" numlevel="1" lineno="178" slineno="3-122" level="3"><display>(ii)</display>The rebuttable presumption described in Subsection <xref depth="4" refnumber="73-3-8(6)(c)(i)">(6)(c)(i)</xref> does not apply if the <ln numlevel="1" lineno="179" slineno="3-123"/>beneficial use requirement is excused by:<subsection ssid="2-null-59" dnum="A-o" numlevel="1" lineno="180" slineno="3-124" level="4"><display>(A)</display>Subsection <xref depth="4" refnumber="73-1-4(2)(e)">73-1-4(2)(e)</xref>;</subsection><subsection ssid="2-null-60" dnum="B-o" numlevel="1" lineno="181" slineno="3-125" level="4"><display>(B)</display>an approved nonuse application under Subsection <xref depth="4" refnumber="73-1-4(2)(b)">73-1-4(2)(b)</xref>;</subsection><subsection ssid="2-null-61" dnum="C-o" numlevel="1" lineno="182" slineno="3-126" level="4"><display>(C)</display>Subsection <xref depth="4" refnumber="73-3-30(7)">73-3-30(7)</xref>; or</subsection><subsection ssid="2-null-62" dnum="D-o" numlevel="1" lineno="183" slineno="3-127" level="4"><display>(D)</display>the passage of time under Subsection <xref depth="4" refnumber="73-1-4(2)(c)(i)">73-1-4(2)(c)(i)</xref>.</subsection></subsection></subsection><subsection ssid="2-null-63" dnum="d-o" numlevel="1" lineno="184" slineno="3-128" level="2"><display>(d)</display>The state engineer may not consider quantity impairment based on the conditions <ln numlevel="1" lineno="185" slineno="3-129"/>described in Subsection <xref depth="4" refnumber="73-3-8(6)(c)">(6)(c)</xref> unless the issue is raised in a:<subsection ssid="2-null-64" dnum="i-o" numlevel="1" lineno="186" slineno="3-130" level="3"><display>(i)</display>timely protest that identifies which of the protestant's existing rights the protestant <ln numlevel="1" lineno="187" slineno="3-131"/>reasonably believes will experience quantity impairment; or</subsection><subsection ssid="2-null-65" dnum="ii-o" numlevel="1" lineno="188" slineno="3-132" level="3"><display>(ii)</display>written notice provided by the state engineer to the applicant within 90 days after <ln numlevel="1" lineno="189" slineno="3-133"/>the change application is filed.</subsection></subsection><subsection ssid="2-null-66" dnum="e-o" numlevel="1" lineno="190" slineno="3-134" level="2"><display>(e)</display>The written notice described in Subsection <xref depth="4" refnumber="73-3-8(6)(d)(ii)">(6)(d)(ii)</xref> shall:<subsection ssid="2-null-67" dnum="i-o" numlevel="1" lineno="191" slineno="3-135" level="3"><display>(i)</display>specifically identify an existing right the state engineer reasonably believes may <ln numlevel="1" lineno="192" slineno="3-136"/>experience quantity impairment; and</subsection><subsection ssid="2-null-68" dnum="ii-o" numlevel="1" lineno="193" slineno="3-137" level="3"><display>(ii)</display>be mailed to the owner of an identified right, as shown by the state engineer's <ln numlevel="1" lineno="194" slineno="3-138"/>records, if the owner has not protested the change application.</subsection></subsection><subsection ssid="2-null-69" dnum="f-o" numlevel="1" lineno="195" slineno="3-139" level="2"><display>(f)</display>The state engineer is not required to include all rights the state engineer believes may <ln numlevel="1" lineno="196" slineno="3-140"/>be impaired by the proposed change in the written notice described in Subsection <xref depth="4" refnumber="73-3-8(6)(d)(ii)"><ln numlevel="1" lineno="197" slineno="3-141"/>(6)(d)(ii)</xref>.</subsection><subsection ssid="2-null-70" dnum="g-o" numlevel="1" lineno="198" slineno="3-142" level="2"><display>(g)</display>The owner of a right who receives the written notice described in Subsection <xref depth="4" refnumber="73-3-8(6)(d)(ii)"><ln numlevel="1" lineno="199" slineno="3-143"/>(6)(d)(ii)</xref> may not become a party to the administrative proceeding if the owner has <ln numlevel="1" lineno="200" slineno="3-144"/>not filed a timely protest.</subsection><subsection ssid="2-null-71" dnum="h-o" numlevel="1" lineno="201" slineno="3-145" level="2"><display>(h)</display>If a change applicant, the protestants, and the persons identified by the state engineer <ln numlevel="1" lineno="202" slineno="3-146"/>under Subsection <xref depth="4" refnumber="73-3-8(6)(d)(ii)">(6)(d)(ii)</xref> come to a written agreement regarding how the issue of <ln numlevel="1" lineno="203" slineno="3-147"/>quantity impairment shall be mitigated, the state engineer may incorporate the terms <ln numlevel="1" lineno="204" slineno="3-148"/>of the agreement into a change application approval.</subsection></subsection><subsection ssid="2-72" dnum="_-o:7-i" numlevel="1" lineno="205" slineno="3-149" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1088" style="1" owner="i" level="1" amendtag="start">(7)</amend></display><subsection ssid="2-77" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1089" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="33" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="end">To determine whether a proposed plan would not prove detrimental to the public <ln numlevel="1" lineno="206" slineno="3-150"/>welfare under Subsection <xref depth="4" refnumber="73-3-8(1)(a)(iii)">(1)(a)(iii)</xref>, the state engineer may only consider:</amend><subsection ssid="2-74" dnum="_-o:i-i" numlevel="1" lineno="207" slineno="3-151" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1090" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="18" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="end">the effect of the proposed plan on:</amend><subsection ssid="2-87" dnum="_-o:A-i" numlevel="1" lineno="208" slineno="3-152" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1091" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="160" groupid="143" style="1" owner="jchristopherson" level="1" amendtag="end">the beneficial use of water; or</amend></subsection><subsection ssid="2-75" dnum="_-o:B-i" numlevel="1" lineno="209" slineno="3-153" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1092" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="23" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="end">the quantity, quality, or availability of water; and</amend></subsection></subsection><subsection ssid="2-88" dnum="_-o:ii-i" numlevel="1" lineno="210" slineno="3-154" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1093" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="165" groupid="147" style="1" owner="jchristopherson" level="1" amendtag="end">other factors as specifically directed by statute.</amend></subsection></subsection><subsection ssid="2-78" dnum="_-o:b-i" numlevel="1" lineno="211" slineno="3-155" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1094" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="38" groupid="30" style="1" owner="jchristopherson" level="1" amendtag="end">The state engineer may not consider or rely on detriment to the public welfare under <ln numlevel="1" lineno="212" slineno="3-156"/>Subsection <xref depth="4" refnumber="73-3-8(1)(a)(iii)">(1)(a)(iii)</xref> as a basis for the rejection of an application if:</amend><subsection ssid="2-79" dnum="_-o:i-i" numlevel="1" lineno="213" slineno="3-157" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1095" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="43" groupid="34" style="1" owner="jchristopherson" level="1" amendtag="end">the prevention, regulation, or mitigation of the detrimental effect is reserved to, <ln numlevel="1" lineno="214" slineno="3-158"/>reasonably within the scope of authority of, or better suited to be addressed by <ln numlevel="1" lineno="215" slineno="3-159"/>another regulatory agency; or</amend></subsection><subsection ssid="2-81" dnum="_-o:ii-i" numlevel="1" lineno="216" slineno="3-160" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1096" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="53" groupid="42" style="1" owner="jchristopherson" level="1" amendtag="end">the factors supporting a finding of a detriment to the public welfare:</amend><subsection ssid="2-82" dnum="_-o:A-i" numlevel="1" lineno="217" slineno="3-161" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1097" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="58" groupid="46" style="1" owner="jchristopherson" level="1" amendtag="end">are not directly associated with the interests described in Subsection <xref depth="4" refnumber="73-3-8(7)(a)">(7)(a)</xref>; or</amend></subsection><subsection ssid="2-83" dnum="_-o:B-i" numlevel="1" lineno="218" slineno="3-162" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1098" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="63" groupid="50" style="1" owner="jchristopherson" level="1" amendtag="end">will have a negligible effect on the interests described in Subsection <xref depth="4" refnumber="73-3-8(7)(a)">(7)(a)</xref>.</amend></subsection></subsection></subsection></subsection></section></bsec><bsec buid="4" num="73-3-14" type="amend" src="code" uid="C73-3-S14_2026050620260506" sort="73 03 00140020260506" numlevel="1" lineno="219" slineno="4-1" sn="4"><section number="73-3-14" numlevel="1" lineno="220" slineno="4-2" type="amend"><secline lineno="219">Section 4. Section <bold>73-3-14</bold> is amended to read:</secline><catline lineno="220"><bold>73-3-14<parens/>. Judicial review of state engineer order.</bold></catline><subsection ssid="4-null-1" dnum="1-o" numlevel="1" lineno="221" slineno="4-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="4-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A person aggrieved by an order of the state engineer may obtain judicial review in <ln numlevel="1" lineno="222" slineno="4-4"/>accordance with <xref depth="1" refid="C63G-4_1800010118000101" refnumber="63G-4" start="0">Title 63G, Chapter 4, Administrative Procedures Act</xref>, and this <ln numlevel="1" lineno="223" slineno="4-5"/>section.</subsection><subsection ssid="4-29" dnum="_-o:b-i" numlevel="1" lineno="224" slineno="4-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1101" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">A person is aggrieved by an order of the state engineer approving or rejecting an <ln numlevel="1" lineno="225" slineno="4-7"/>application under Section <xref depth="3" refnumber="73-3-8">73-3-8</xref> only if the person has suffered or will suffer a <ln numlevel="1" lineno="226" slineno="4-8"/>particularized injury from an action taken by the state engineer in accordance with <ln numlevel="1" lineno="227" slineno="4-9"/>Section <xref depth="3" refnumber="73-3-8">73-3-8</xref>.</amend></subsection><subsection ssid="4-null-3" dnum="b-o:c-i" numlevel="1" lineno="228" slineno="4-10" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1102" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1103" style="1" owner="i" level="1" amendtag="both" space="true">(c)</amend></display>Venue for judicial review of an informal adjudicative proceeding is in the <ln numlevel="1" lineno="229" slineno="4-11"/>county in which the water source or a portion of the water source is located.</subsection></subsection><subsection ssid="4-null-4" dnum="2-o" numlevel="1" lineno="230" slineno="4-12" level="1"><display>(2)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="17" groupid="16" style="2" owner="jchristopherson" level="1" deltag="both">The </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="12" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">A person who files a petition of judicial review shall join the </amend>state engineer <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="24" groupid="23" style="2" owner="jchristopherson" level="1" deltag="both">shall <ln numlevel="1" lineno="231" slineno="4-13"/>be joined </amend><amendoutend style="2"/>as a respondent in a petition to review the state engineer's decision, but <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="20" groupid="19" style="2" owner="jchristopherson" level="1" deltag="both">no</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="14" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a <ln numlevel="1" lineno="232" slineno="4-14"/>court may not award a</amend> judgment for costs or expenses of the litigation <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="25" groupid="24" style="2" owner="jchristopherson" level="1" deltag="both">may be rendered </amend><amendoutend style="2"/><ln numlevel="1" lineno="233" slineno="4-15"/>against the state engineer.</subsection><subsection ssid="4-null-5" dnum="3-o" numlevel="1" lineno="234" slineno="4-16" level="1"><display>(3)</display>A person who files a petition for judicial review as authorized in this section shall:<subsection ssid="4-null-6" dnum="a-o" numlevel="1" lineno="235" slineno="4-17" level="2"><display>(a)</display>name the state engineer as a respondent; and</subsection><subsection ssid="4-null-7" dnum="b-o" numlevel="1" lineno="236" slineno="4-18" level="2"><display>(b)</display>provide written notice in accordance with Subsection <xref depth="4" refid="C73-3-S14_1800010118000101" refnumber="73-3-14(5)" start="0">(5)</xref> to each person who filed a <ln numlevel="1" lineno="237" slineno="4-19"/>protest in accordance with Section <xref depth="3" refid="C73-3-S7_1800010118000101" refnumber="73-3-7" start="0">73-3-7</xref> of:<subsection ssid="4-null-8" dnum="i-o" numlevel="1" lineno="238" slineno="4-20" level="3"><display>(i)</display>the filing of the petition for judicial review; and</subsection><subsection ssid="4-null-9" dnum="ii-o" numlevel="1" lineno="239" slineno="4-21" level="3"><display>(ii)</display>the opportunity to intervene in accordance with Utah Rules of Civil Procedure, <ln numlevel="1" lineno="240" slineno="4-22"/>Rule 24.</subsection></subsection></subsection><subsection ssid="4-null-10" dnum="4-o" numlevel="1" lineno="241" slineno="4-23" level="1"><display>(4)</display>In addition to <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="22" groupid="21" style="2" owner="jchristopherson" level="1" deltag="both">the requirements of</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="15" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">complying with</amend> Subsection <xref depth="4" refid="C73-3-S14_1800010118000101" refnumber="73-3-14(3)" start="0">(3)</xref>, a protestant in the <ln numlevel="1" lineno="242" slineno="4-24"/>adjudicative proceeding who files a petition for judicial review shall also name as a <ln numlevel="1" lineno="243" slineno="4-25"/>respondent the person:<subsection ssid="4-null-11" dnum="a-o" numlevel="1" lineno="244" slineno="4-26" level="2"><display>(a)</display>who requested the adjudicative proceeding; or</subsection><subsection ssid="4-null-12" dnum="b-o" numlevel="1" lineno="245" slineno="4-27" level="2"><display>(b)</display>against whom the state engineer brought the adjudicative proceeding.</subsection></subsection><subsection ssid="4-null-13" dnum="5-o" numlevel="1" lineno="246" slineno="4-28" level="1"><display>(5)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="23" groupid="22" style="2" owner="jchristopherson" level="1" deltag="both">The </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="16" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">A </amend>written notice required by this section shall:<subsection ssid="4-null-14" dnum="a-o" numlevel="1" lineno="247" slineno="4-29" level="2"><display>(a)</display>be mailed:<subsection ssid="4-null-15" dnum="i-o" numlevel="1" lineno="248" slineno="4-30" level="3"><display>(i)</display>within the time provided for by Utah Rules of Civil Procedure, Rule 4(b); and</subsection><subsection ssid="4-null-16" dnum="ii-o" numlevel="1" lineno="249" slineno="4-31" level="3"><display>(ii)</display>to the address on record with the state engineer's office at the time the order is <ln numlevel="1" lineno="250" slineno="4-32"/>issued; and</subsection></subsection><subsection ssid="4-null-17" dnum="b-o" numlevel="1" lineno="251" slineno="4-33" level="2"><display>(b)</display>include:<subsection ssid="4-null-18" dnum="i-o" numlevel="1" lineno="252" slineno="4-34" level="3"><display>(i)</display>a copy of the petition; and</subsection><subsection ssid="4-null-19" dnum="ii-o" numlevel="1" lineno="253" slineno="4-35" level="3"><display>(ii)</display>the address of the court in which the petition is pending.</subsection></subsection></subsection><subsection ssid="4-null-20" dnum="6-o" numlevel="1" lineno="254" slineno="4-36" level="1"><display>(6)</display>If a person who files a petition for judicial review fails to provide notice as required by <ln numlevel="1" lineno="255" slineno="4-37"/>this section, the court shall dismiss the petition without prejudice upon:<subsection ssid="4-null-21" dnum="a-o" numlevel="1" lineno="256" slineno="4-38" level="2"><display>(a)</display>the motion of a party;</subsection><subsection ssid="4-null-22" dnum="b-o" numlevel="1" lineno="257" slineno="4-39" level="2"><display>(b)</display>the special appearance of a person who:<subsection ssid="4-null-23" dnum="i-o" numlevel="1" lineno="258" slineno="4-40" level="3"><display>(i)</display>participated in the adjudicative proceeding; and</subsection><subsection ssid="4-null-24" dnum="ii-o" numlevel="1" lineno="259" slineno="4-41" level="3"><display>(ii)</display>is not a party; or</subsection></subsection><subsection ssid="4-null-25" dnum="c-o" numlevel="1" lineno="260" slineno="4-42" level="2"><display>(c)</display>the court's own motion.</subsection></subsection><subsection ssid="4-null-26" dnum="7-o" numlevel="1" lineno="261" slineno="4-43" level="1"><display>(7)</display>A person who files a petition for judicial review is not required to:<subsection ssid="4-null-27" dnum="a-o" numlevel="1" lineno="262" slineno="4-44" level="2"><display>(a)</display>notwithstanding Subsection <xref depth="4" refid="C63G-4-S401_1800010118000101" refnumber="63G-4-401(3)(b)" start="0">63G-4-401(3)(b)</xref>, name a respondent that is not required <ln numlevel="1" lineno="263" slineno="4-45"/>by this section; and</subsection><subsection ssid="4-null-28" dnum="b-o" numlevel="1" lineno="264" slineno="4-46" level="2"><display>(b)</display>notwithstanding Subsection <xref depth="4" refid="C63G-4-S402_1800010118000101" refnumber="63G-4-402(2)(a)(iv)" start="0">63G-4-402(2)(a)(iv)</xref>, identify all parties to the <ln numlevel="1" lineno="265" slineno="4-47"/>adjudicative proceeding.</subsection></subsection></section></bsec><bsec buid="7" num="73-3d-102" type="amend" src="code" uid="C73-3d-S102_2026050620260506" sort="73 03d01020020260506" numlevel="1" lineno="266" slineno="5-1" sn="5"><section number="73-3d-102" numlevel="1" lineno="267" slineno="5-2" type="amend"><secline lineno="266">Section 5. Section <bold>73-3d-102</bold> is amended to read:</secline><catline lineno="267"><bold>73-3d-102<parens/>. Scope of chapter.</bold></catline><subsection ssid="7-null-1" dnum="1-o" numlevel="1" lineno="268" slineno="5-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="7-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The powers vested in the governor under this chapter are in addition to, and not in <ln numlevel="1" lineno="269" slineno="5-4"/>lieu of, any other emergency powers otherwise statutorily vested in the governor, <ln numlevel="1" lineno="270" slineno="5-5"/>including the power of the governor to authorize the use of water sources as <ln numlevel="1" lineno="271" slineno="5-6"/>necessary for fire suppression under Subsection <xref depth="4" refnumber="53-2a-204(1)(o)" start="0">53-2a-204(1)(o)</xref>.</subsection><subsection ssid="7-null-3" dnum="b-o" numlevel="1" lineno="272" slineno="5-7" level="2"><display>(b)</display>An executive order of the governor declaring a temporary water shortage emergency <ln numlevel="1" lineno="273" slineno="5-8"/>under this chapter is not a declaration of a state of emergency under Section <xref depth="3" refnumber="53-2a-206" start="0"><ln numlevel="1" lineno="274" slineno="5-9"/>53-2a-206</xref> and is not subject to <xref depth="2" refnumber="53-2a-2" start="0">Title 53, Chapter 2a, Part 2, Disaster Response and <ln numlevel="1" lineno="275" slineno="5-10"/>Recovery Act</xref>. To exercise an authority granted under <xref depth="2" refnumber="53-2a-2" start="0">Title 53, Chapter 2a, Part 2, <ln numlevel="1" lineno="276" slineno="5-11"/>Disaster Response and Recovery Act</xref>, related to a declaration of a state of emergency, <ln numlevel="1" lineno="277" slineno="5-12"/>the governor shall issue an executive order that is separate from an executive order <ln numlevel="1" lineno="278" slineno="5-13"/>declaring a temporary water shortage emergency.</subsection></subsection><subsection ssid="7-null-4" dnum="2-o" numlevel="1" lineno="279" slineno="5-14" level="1"><display>(2)</display>Nothing in this chapter modifies:<subsection ssid="7-null-5" dnum="a-o" numlevel="1" lineno="280" slineno="5-15" level="2"><display>(a)</display>the statutory duties of the state engineer under this title; or</subsection><subsection ssid="7-null-6" dnum="b-o" numlevel="1" lineno="281" slineno="5-16" level="2"><display>(b)</display>except as specifically provided in an executive order declaring a temporary water <ln numlevel="1" lineno="282" slineno="5-17"/>shortage emergency, Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="73-3-1(5)(a)" start="0">73-3-1(5)(a)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref tempid="611">73-3-1(5)</xref></amend> or Section <xref depth="3" refnumber="73-3-21.1" start="0">73-3-21.1</xref>.</subsection></subsection><subsection ssid="7-null-7" dnum="3-o" numlevel="1" lineno="283" slineno="5-18" level="1"><display>(3)</display>Nothing in this chapter may be construed to extend or enlarge the powers of the <ln numlevel="1" lineno="284" slineno="5-19"/>governor except as specifically stated in this chapter.</subsection></section></bsec><bsec buid="8" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="285" slineno="6-1" sn="6"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="285">Section 6.  <bold>Effective Date.</bold></secline><sectionText lineno="286"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-2-26 7:26 AM</tm></rev></foot></leg>
