Section <bold>26B-4-903</bold> is amended to read:</secline><catline lineno="48"><bold>26B-4-903<parens/>. Electronic health record system study.</bold></catline><subsection ssid="17-null-1" dnum="1-o" numlevel="1" lineno="49" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>On or before June 30, 2025, the department shall convene a working group to study and <ln numlevel="1" lineno="50" slineno="1-4"/>develop recommendations regarding the electronic health record system used in <ln numlevel="1" lineno="51" slineno="1-5"/>connection with providing inmates with comprehensive health care, including:<subsection ssid="17-null-2" dnum="a-o" numlevel="1" lineno="52" slineno="1-6" level="2"><display>(a)</display>identification of the department's electronic health record system requirements;</subsection><subsection ssid="17-null-3" dnum="b-o" numlevel="1" lineno="53" slineno="1-7" level="2"><display>(b)</display>an analysis of what features of an electronic health record system are needed to <ln numlevel="1" lineno="54" slineno="1-8"/>maximize the implementation, effectiveness, and efficiency of the waiver described <ln numlevel="1" lineno="55" slineno="1-9"/>in Section <xref depth="3" refnumber="26B-3-217">26B-3-217</xref>; and</subsection><subsection ssid="17-null-4" dnum="c-o" numlevel="1" lineno="56" slineno="1-10" level="2"><display>(c)</display>a determination of whether the department's current electronic health record system <ln numlevel="1" lineno="57" slineno="1-11"/>meets the requirements and includes the features identified under Subsections <xref tempid="993" depth="4" refnumber="(1)(a)">(1)(a)</xref> <ln numlevel="1" lineno="58" slineno="1-12"/>and (b).</subsection></subsection><subsection ssid="17-null-5" dnum="2-o" numlevel="1" lineno="59" slineno="1-13" level="1"><display>(2)</display>The working group described in Subsection <xref tempid="872" depth="4" refnumber="(1)">(1)</xref> shall include department staff as <ln numlevel="1" lineno="60" slineno="1-14"/>determined by the director.</subsection><subsection ssid="17-null-6" dnum="3-o" numlevel="1" lineno="61" slineno="1-15" level="1"><display>(3)</display>The working group shall provide recommendations regarding the electronic health <ln numlevel="1" lineno="62" slineno="1-16"/>record system to the Health and Human Services Interim Committee on or before the <ln numlevel="1" lineno="63" slineno="1-17"/>date of the committee's meeting in November 2025.</subsection><subsection ssid="17-7" dnum="_-o:4-i" numlevel="1" lineno="64" slineno="1-18" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="ahaskell" level="1" amendtag="end">By no later than December 31, 2026, the department shall enter into a contract, in <ln numlevel="1" lineno="65" slineno="1-19"/>accordance with Title 63G, Chapter 6a, Utah Procurement Code, for an electronic health <ln numlevel="1" lineno="66" slineno="1-20"/>record system that meets the requirements and has the features identified in accordance <ln numlevel="1" lineno="67" slineno="1-21"/>with Subsections <xref depth="4" refnumber="26B-4-903(1)(a)">(1)(a)</xref> and <xref depth="4" refnumber="26B-4-903(b)">(b)</xref>.</amend></subsection></section></bsec><bsec buid="1" num="26B-4-905" type="enact" src="code" uid="C26B-4-S905_2025050720250507" sort="26B04 09050020250507" numlevel="1" lineno="68" slineno="2-1" sn="2"><section numlevel="1" lineno="69" slineno="2-2" number="26B-4-905" type="enact"><secline lineno="68">Section 2. Section <bold>26B-4-905</bold> is enacted to read:</secline><catline lineno="69"><bold>26B-4-905<parens/>. Nonlapsing funds.</bold></catline><subsection ssid="1-null-7" dnum="_-o:1-i" numlevel="1" lineno="70" slineno="2-3" ea="amend" anum="0" owner="ahaskell" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="ahaskell" level="1" amendtag="end">Funds appropriated by the Legislature to the department for the purpose of paying for <ln numlevel="1" lineno="71" slineno="2-4"/>unanticipated high-cost correctional health care:</amend><subsection ssid="1-null-8" dnum="_-o:a-i" numlevel="1" lineno="72" slineno="2-5" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="8" style="1" owner="ahaskell" level="1" amendtag="end">are nonlapsing; and</amend></subsection><subsection ssid="1-null-9" dnum="_-o:b-i" numlevel="1" lineno="73" slineno="2-6" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="16" groupid="12" style="1" owner="ahaskell" level="1" amendtag="end">may only be used to pay for health care costs that meet the definition of <ln numlevel="1" lineno="74" slineno="2-7"/>unanticipated high-cost correctional health care.</amend></subsection></subsection><subsection ssid="1-null-10" dnum="_-o:2-i" numlevel="1" lineno="75" slineno="2-8" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="21" groupid="16" style="1" owner="ahaskell" level="1" amendtag="end">In any year that the department uses funds for the purpose described in Subsection <xref tempid="221" depth="4" refnumber="(1)">(1)</xref>, <ln numlevel="1" lineno="76" slineno="2-9"/>the department shall provide a report to the Social Services Appropriations <ln numlevel="1" lineno="77" slineno="2-10"/>Subcommittee and the Health and Human Services Interim Committee that includes:</amend><subsection ssid="1-null-11" dnum="_-o:a-i" numlevel="1" lineno="78" slineno="2-11" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="20" style="1" owner="ahaskell" level="1" amendtag="end">the amount expended; and</amend></subsection><subsection ssid="1-null-12" dnum="_-o:b-i" numlevel="1" lineno="79" slineno="2-12" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1012" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="31" groupid="24" style="1" owner="ahaskell" level="1" amendtag="end">the balance of unexpended funds appropriated to the department for unanticipated <ln numlevel="1" lineno="80" slineno="2-13"/>high-cost correctional health care.</amend></subsection></subsection></section></bsec><bsec buid="2" num="26B-4-906" type="enact" src="code" uid="C26B-4-S906_2025050720250507" sort="26B04 09060020250507" numlevel="1" lineno="81" slineno="3-1" sn="3"><section numlevel="1" lineno="82" slineno="3-2" number="26B-4-906" type="enact"><secline lineno="81">Section 3. Section <bold>26B-4-906</bold> is enacted to read:</secline><catline lineno="82"><bold>26B-4-906<parens/>. Treatment for substance use disorder.</bold></catline><subsection ssid="2-null-5" dnum="_-o:1-i" numlevel="1" lineno="83" slineno="3-3" ea="amend" anum="0" owner="ahaskell" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1013" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="ahaskell" level="1" amendtag="end">The department, in consultation with the Department of Corrections, shall prepare and <ln numlevel="1" lineno="84" slineno="3-4"/>implement a plan to provide, in accordance with current medical standards, substance <ln numlevel="1" lineno="85" slineno="3-5"/>use disorder treatment to all inmates who suffer from a substance use disorder.</amend></subsection><subsection ssid="2-null-6" dnum="_-o:2-i" numlevel="1" lineno="86" slineno="3-6" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1014" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="13" groupid="10" style="1" owner="ahaskell" level="1" amendtag="end">The plan described in Subsection <xref tempid="440" depth="4" refnumber="(1)">(1)</xref> shall include the use of medication assisted <ln numlevel="1" lineno="87" slineno="3-7"/>treatment as medically necessary.</amend></subsection><subsection ssid="2-null-7" dnum="_-o:3-i" numlevel="1" lineno="88" slineno="3-8" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1015" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="19" groupid="15" style="1" owner="ahaskell" level="1" amendtag="end">The department shall consult and may contract with addiction specialists at the <ln numlevel="1" lineno="89" slineno="3-9"/>Huntsman Mental Health Institute to prepare and implement the plan described in <ln numlevel="1" lineno="90" slineno="3-10"/>Subsection <xref tempid="981" depth="4" refnumber="(1)">(1)</xref>.</amend></subsection><subsection ssid="2-null-8" dnum="_-o:4-i" numlevel="1" lineno="91" slineno="3-11" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="28" groupid="21" style="1" owner="ahaskell" level="1" amendtag="end">The department shall provide an annual report on the preparation and implementation of <ln numlevel="1" lineno="92" slineno="3-12"/>the plan described in Subsection <xref tempid="412" depth="4" refnumber="(1)">(1)</xref> to the Health and Human Services Interim <ln numlevel="1" lineno="93" slineno="3-13"/>Committee on or before the date of the committee's August interim meeting.</amend></subsection></section></bsec><bsec buid="6" num="63I-2-264" type="amend" src="code" uid="C63I-2-S264_2025050720250507" sort="63I02 02640020250507" numlevel="1" lineno="94" slineno="4-1" sn="4"><section number="63I-2-264" numlevel="1" lineno="95" slineno="4-2" type="amend"><secline lineno="94">Section 4. Medication assisted treatment plan.</bold></catline><subsection ssid="4-null-15" dnum="1-o" numlevel="1" lineno="100" slineno="5-3" level="1" placement="noreturn"><display>(1)</display>As used in this section, "medication assisted treatment plan" means a prescription plan <ln numlevel="1" lineno="101" slineno="5-4"/>to use a medication, such as buprenorphine, methadone, or naltrexone, to treat substance <ln numlevel="1" lineno="102" slineno="5-5"/>use withdrawal symptoms or an opioid use disorder.</subsection><subsection ssid="4-null-16" dnum="2-o" numlevel="1" lineno="103" slineno="5-6" level="1"><display>(2)</display>In collaboration with the Department of Health and Human Services the department <ln numlevel="1" lineno="104" slineno="5-7"/>may cooperate with medical personnel to continue a medication assisted treatment plan <ln numlevel="1" lineno="105" slineno="5-8"/>for an inmate who had an active medication assisted treatment plan within the last six <ln numlevel="1" lineno="106" slineno="5-9"/>months before being committed to the custody of the department.</subsection><subsection ssid="4-null-17" dnum="_-o:3-i" numlevel="1" lineno="107" slineno="5-10" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1019" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="ahaskell" level="1" amendtag="end">The department shall cooperate with the Department of Health and Human Services and <ln numlevel="1" lineno="108" slineno="5-11"/>relevant medical personnel in providing medication assisted treatment in accordance <ln numlevel="1" lineno="109" slineno="5-12"/>with the substance use disorder plan described in Subsection <xref refnumber="26B-4-906(1)" depth="4">26B-4-906(1)</xref>.</amend></subsection><subsection ssid="4-null-18" dnum="3-o:4-i" numlevel="1" lineno="110" slineno="5-13" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1020" style="2" owner="o" level="1" deltag="both">(3)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1021" style="1" owner="i" level="1" amendtag="both" space="true">(4)</amend></display>A medication used for a medication assisted treatment plan under Subsection <xref depth="4" refnumber="64-13-25.1(2)">(2)</xref>:<subsection ssid="4-null-19" dnum="a-o" numlevel="1" lineno="111" slineno="5-14" level="2"><display>(a)</display>shall be an oral, short-acting medication unless the chief administrative officer or <ln numlevel="1" lineno="112" slineno="5-15"/>other medical personnel who is familiar with the inmate's medication assisted <ln numlevel="1" lineno="113" slineno="5-16"/>treatment plan determines that a long-acting, non-oral medication will provide a <ln numlevel="1" lineno="114" slineno="5-17"/>greater benefit to the individual receiving treatment;</subsection><subsection ssid="4-null-20" dnum="b-o" numlevel="1" lineno="115" slineno="5-18" level="2"><display>(b)</display>may be administered to an inmate under the direction of the chief administrative <ln numlevel="1" lineno="116" slineno="5-19"/>officer of the correctional facility;</subsection><subsection ssid="4-null-21" dnum="c-o" numlevel="1" lineno="117" slineno="5-20" level="2"><display>(c)</display>may, as funding permits, be paid for by the department or the Department of Health <ln numlevel="1" lineno="118" slineno="5-21"/>and Human Services; and</subsection><subsection ssid="4-null-22" dnum="d-o" numlevel="1" lineno="119" slineno="5-22" level="2"><display>(d)</display>may be left or stored at a correctional facility at the discretion of the chief <ln numlevel="1" lineno="120" slineno="5-23"/>administrative officer of the correctional facility.</subsection></subsection><subsection ssid="4-null-23" dnum="4-o:5-i" numlevel="1" lineno="121" slineno="5-24" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1025" style="2" owner="o" level="1" deltag="both">(4)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1026" style="1" owner="i" level="1" amendtag="both" space="true">(5)</amend></display>Before November 30 each year, the Department of Health and Human Services <ln numlevel="1" lineno="122" slineno="5-25"/>shall provide a report to the Health and Human Services Interim Committee that details, <ln numlevel="1" lineno="123" slineno="5-26"/>for each category, the number of individuals in the custody of the department who, in <ln numlevel="1" lineno="124" slineno="5-27"/>the preceding 12 months:<subsection ssid="4-null-24" dnum="a-o" numlevel="1" lineno="125" slineno="5-28" level="2"><display>(a)</display>had an active medication assisted treatment plan within the six months preceding <ln numlevel="1" lineno="126" slineno="5-29"/>commitment to the custody of the department;</subsection><subsection ssid="4-null-25" dnum="b-o" numlevel="1" lineno="127" slineno="5-30" level="2"><display>(b)</display>continued a medication assisted treatment plan following commitment to the custody <ln numlevel="1" lineno="128" slineno="5-31"/>of the department; and</subsection><subsection ssid="4-null-26" dnum="c-o" numlevel="1" lineno="129" slineno="5-32" level="2"><display>(c)</display>discontinued a medication assisted treatment plan prior to, at the time of, or after <ln numlevel="1" lineno="130" slineno="5-33"/>commitment to the custody of the department and, as available, the type of <ln numlevel="1" lineno="131" slineno="5-34"/>medication discontinued and the reason for the discontinuation.</subsection></subsection></section></bsec><bsec buid="23" num="64-13-39" type="amend" src="code" uid="C64-13-S39_2026050620260506" sort="64 13 00390020260506" numlevel="1" lineno="132" slineno="6-1" sn="6"><section number="64-13-39" numlevel="1" lineno="133" slineno="6-2" type="amend"><secline lineno="132">Section 6. Section <bold>64-13-39</bold> is amended to read:</secline><catline lineno="133"><bold>64-13-39<parens/>. Inspections to ensure <ln numlevel="1" lineno="143" slineno="6-12"/>compliance and accreditation shall be conducted by staff of the national commission.</amend><amendoutend style="2"/><subsection ssid="23-3" dnum="_-o:a-i" numlevel="1" lineno="144" slineno="6-13" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1033" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="10" style="1" owner="ahaskell" level="1" amendtag="end">"Covered health care facility" means a health care facility owned or operated by the <ln numlevel="1" lineno="145" slineno="6-14"/>department.</amend></subsection><subsection ssid="23-4" dnum="_-o:b-i" numlevel="1" lineno="146" slineno="6-15" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1034" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="14" style="1" owner="ahaskell" level="1" amendtag="end">"Health care facility" means the same as that term is defined in Section <xref depth="3" refnumber="26B-2-201">26B-2-201</xref>.</amend></subsection></subsection><subsection ssid="23-5" dnum="_-o:3-i" numlevel="1" lineno="147" slineno="6-16" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1035" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="21" groupid="17" style="1" owner="ahaskell" level="1" amendtag="end">The accreditation described in Subsection <xref depth="4" refnumber="64-13-39(2)">(2)</xref> includes accreditation in:</amend><subsection ssid="23-6" dnum="_-o:a-i" numlevel="1" lineno="148" slineno="6-17" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1036" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="31" groupid="26" style="1" owner="ahaskell" level="1" amendtag="end">health services;</amend></subsection><subsection ssid="23-7" dnum="_-o:b-i" numlevel="1" lineno="149" slineno="6-18" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1037" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="36" groupid="30" style="1" owner="ahaskell" level="1" amendtag="end">mental health services; and</amend></subsection><subsection ssid="23-8" dnum="_-o:c-i" numlevel="1" lineno="150" slineno="6-19" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1038" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="42" groupid="35" style="1" owner="ahaskell" level="1" amendtag="end">opioid treatment programs.</amend></subsection></subsection><subsection ssid="23-9" dnum="_-o:4-i" numlevel="1" lineno="151" slineno="6-20" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1039" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="48" groupid="40" style="1" owner="ahaskell" level="1" amendtag="end">For any accreditation described in Subsection <xref depth="4" refnumber="64-13-39(3)">(3)</xref> for which a covered health care <ln numlevel="1" lineno="152" slineno="6-21"/>facility does not meet the requirements on or before the May 6, 2026, the covered health <ln numlevel="1" lineno="153" slineno="6-22"/>care facility shall apply for and meet the requirements for accreditation on or before <ln numlevel="1" lineno="154" slineno="6-23"/>December 31, 2027.</amend></subsection></section></bsec><bsec buid="13" num="77-27-5" type="amend" src="code" uid="C77-27-S5_2026050620260506" sort="77 27 00050020260506" numlevel="1" lineno="155" slineno="7-1" sn="7"><section number="77-27-5" numlevel="1" lineno="156" slineno="7-2" type="amend"><secline lineno="155">Section 7. Section <bold>77-27-5</bold> is amended to read:</secline><catline lineno="156"><bold>77-27-5<parens/>. Board of Pardons and Parole authority.</bold></catline><subsection ssid="13-null-1" dnum="1-o" numlevel="1" lineno="157" slineno="7-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="13-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Subject to this chapter and other laws of the state, and except for a conviction for <ln numlevel="1" lineno="158" slineno="7-4"/>treason or impeachment, the board shall determine by majority decision when and <ln numlevel="1" lineno="159" slineno="7-5"/>under what conditions an offender's conviction may be pardoned or commuted.</subsection><subsection ssid="13-null-3" dnum="b-o" numlevel="1" lineno="160" slineno="7-6" level="2"><display>(b)</display>The board shall determine by majority decision when and under what conditions an <ln numlevel="1" lineno="161" slineno="7-7"/>offender committed to serve a sentence at a penal or correctional facility, which is <ln numlevel="1" lineno="162" slineno="7-8"/>under the jurisdiction of the department, may:<subsection ssid="13-null-4" dnum="i-o" numlevel="1" lineno="163" slineno="7-9" level="3"><display>(i)</display>be released upon parole;</subsection><subsection ssid="13-null-5" dnum="ii-o" numlevel="1" lineno="164" slineno="7-10" level="3"><display>(ii)</display>have a fine or forfeiture remitted;</subsection><subsection ssid="13-null-6" dnum="iii-o" numlevel="1" lineno="165" slineno="7-11" level="3"><display>(iii)</display>have the offender's criminal accounts receivable remitted in accordance with <ln numlevel="1" lineno="166" slineno="7-12"/>Section <xref depth="3" refnumber="77-32b-105">77-32b-105</xref> or <xref depth="3" refnumber="77-32b-106">77-32b-106</xref>;</subsection><subsection ssid="13-null-7" dnum="iv-o" numlevel="1" lineno="167" slineno="7-13" level="3"><display>(iv)</display>have the offender's payment schedule modified in accordance with Section <xref depth="3" refnumber="77-32b-103"><ln numlevel="1" lineno="168" slineno="7-14"/>77-32b-103</xref>; or</subsection><subsection ssid="13-null-8" dnum="v-o" numlevel="1" lineno="169" slineno="7-15" level="3"><display>(v)</display>have the offender's sentence terminated.</subsection></subsection><subsection ssid="13-null-9" dnum="c-o" numlevel="1" lineno="170" slineno="7-16" level="2"><display>(c)</display>The board shall prioritize public safety when making a determination under <ln numlevel="1" lineno="171" slineno="7-17"/>Subsection <xref depth="4" refnumber="77-27-5(1)(a)">(1)(a)</xref> or <xref depth="4" refnumber="77-27-5(1)(b)">(1)(b)</xref>.</subsection><subsection ssid="13-null-10" dnum="d-o" numlevel="1" lineno="172" slineno="7-18" level="2" space="false"><display>(d)</display><subsection ssid="13-null-11" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The board may sit together or in panels to conduct hearings.</subsection><subsection ssid="13-null-12" dnum="ii-o" numlevel="1" lineno="173" slineno="7-19" level="3"><display>(ii)</display>The chair shall appoint members to the panels in any combination and in <ln numlevel="1" lineno="174" slineno="7-20"/>accordance with rules made by the board in accordance with Title 63G, Chapter 3, <ln numlevel="1" lineno="175" slineno="7-21"/>Utah Administrative Rulemaking Act.</subsection><subsection ssid="13-null-13" dnum="iii-o" numlevel="1" lineno="176" slineno="7-22" level="3"><display>(iii)</display>The chair may participate on any panel and when doing so is chair of the panel.</subsection><subsection ssid="13-null-14" dnum="iv-o" numlevel="1" lineno="177" slineno="7-23" level="3"><display>(iv)</display>The chair of the board may designate the chair for any other panel.</subsection></subsection><subsection ssid="13-null-15" dnum="e-o" numlevel="1" lineno="178" slineno="7-24" level="2" space="false"><display>(e)</display><subsection ssid="13-null-16" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Except after a hearing before the board, or the board's appointed examiner, in <ln numlevel="1" lineno="179" slineno="7-25"/>an open session, the board may not:<subsection ssid="13-null-17" dnum="A-o" numlevel="1" lineno="180" slineno="7-26" level="4" tab="1"><display>(A)</display>remit a fine or forfeiture for an offender or the offender's criminal accounts <ln numlevel="1" lineno="181" slineno="7-27"/>receivable;</subsection><subsection ssid="13-null-18" dnum="B-o" numlevel="1" lineno="182" slineno="7-28" level="4" tab="1"><display>(B)</display>release the offender on parole; or</subsection><subsection ssid="13-null-19" dnum="C-o" numlevel="1" lineno="183" slineno="7-29" level="4" tab="1"><display>(C)</display>commute, pardon, or terminate an offender's sentence.</subsection></subsection><subsection ssid="13-null-20" dnum="ii-o" numlevel="1" lineno="184" slineno="7-30" level="3"><display>(ii)</display>An action taken under this Subsection <xref depth="4" refnumber="77-27-5(1)">(1)</xref> other than by a majority of the board <ln numlevel="1" lineno="185" slineno="7-31"/>shall be affirmed by a majority of the board.</subsection></subsection><subsection ssid="13-null-21" dnum="f-o" numlevel="1" lineno="186" slineno="7-32" level="2"><display>(f)</display>A commutation or pardon may be granted only after a full hearing before the board.</subsection></subsection><subsection ssid="13-null-22" dnum="2-o" numlevel="1" lineno="187" slineno="7-33" level="1" space="false"><display>(2)</display><subsection ssid="13-null-23" dnum="a-o" level="2" placement="sameline"><display>(a)</display>In the case of a hearing, timely prior notice of the time and location of the hearing <ln numlevel="1" lineno="188" slineno="7-34"/>shall be given to the offender.</subsection><subsection ssid="13-null-24" dnum="b-o" numlevel="1" lineno="189" slineno="7-35" level="2"><display>(b)</display>The county or district attorney's office responsible for prosecution of the case, the <ln numlevel="1" lineno="190" slineno="7-36"/>sentencing court, and law enforcement officials responsible for the defendant's arrest <ln numlevel="1" lineno="191" slineno="7-37"/>and conviction shall be notified of any board hearings through the board's website.</subsection><subsection ssid="13-null-25" dnum="c-o" numlevel="1" lineno="192" slineno="7-38" level="2"><display>(c)</display>Whenever possible, the victim or the victim's representative, if designated, shall be <ln numlevel="1" lineno="193" slineno="7-39"/>notified of original hearings and any hearing after that if notification is requested and <ln numlevel="1" lineno="194" slineno="7-40"/>current contact information has been provided to the board.</subsection><subsection ssid="13-null-26" dnum="d-o" numlevel="1" lineno="195" slineno="7-41" level="2" space="false"><display>(d)</display><subsection ssid="13-null-27" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Notice to the victim or the victim's representative shall include information <ln numlevel="1" lineno="196" slineno="7-42"/>provided in Section <xref depth="3" refnumber="77-27-9.5">77-27-9.5</xref>, and any related rules made by the board under that <ln numlevel="1" lineno="197" slineno="7-43"/>section.</subsection><subsection ssid="13-null-28" dnum="ii-o" numlevel="1" lineno="198" slineno="7-44" level="3"><display>(ii)</display>The information under Subsection <xref depth="4" refnumber="77-27-5(2)(d)(i)">(2)(d)(i)</xref> shall be provided in terms that are <ln numlevel="1" lineno="199" slineno="7-45"/>reasonable for the lay person to understand.</subsection></subsection></subsection><subsection ssid="13-null-29" dnum="3-o" numlevel="1" lineno="200" slineno="7-46" level="1" space="false"><display>(3)</display><subsection ssid="13-null-30" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A decision by the board is final and not subject for judicial review if the decision <ln numlevel="1" lineno="201" slineno="7-47"/>is regarding:<subsection ssid="13-null-31" dnum="i-o" numlevel="1" lineno="202" slineno="7-48" level="3" tab="1"><display>(i)</display>a pardon, parole, commutation, or termination of an offender's sentence;</subsection><subsection ssid="13-null-32" dnum="ii-o" numlevel="1" lineno="203" slineno="7-49" level="3" tab="1"><display>(ii)</display>restitution, the modification of an offender's payment schedule for restitution, or <ln numlevel="1" lineno="204" slineno="7-50"/>an order for costs; or</subsection><subsection ssid="13-null-33" dnum="iii-o" numlevel="1" lineno="205" slineno="7-51" level="3" tab="1"><display>(iii)</display>the remission of an offender's criminal accounts receivable or a fine or forfeiture.</subsection></subsection><subsection ssid="13-null-34" dnum="b-o" numlevel="1" lineno="206" slineno="7-52" level="2"><display>(b)</display>Deliberative processes are not public and the board is exempt from Title 52, Chapter <ln numlevel="1" lineno="207" slineno="7-53"/>4, Open and Public Meetings Act, when the board is engaged in the board's <ln numlevel="1" lineno="208" slineno="7-54"/>deliberative process.</subsection><subsection ssid="13-null-35" dnum="c-o" numlevel="1" lineno="209" slineno="7-55" level="2"><display>(c)</display>Pursuant to Subsection <xref tempid="729">63G-2-103(25)(b)(xii)</xref>, records of the deliberative process are <ln numlevel="1" lineno="210" slineno="7-56"/>exempt from Title 63G, Chapter 2, Government Records Access and Management <ln numlevel="1" lineno="211" slineno="7-57"/>Act.</subsection><subsection ssid="13-null-36" dnum="d-o" numlevel="1" lineno="212" slineno="7-58" level="2"><display>(d)</display>Unless it will interfere with a constitutional right, deliberative processes are not <ln numlevel="1" lineno="213" slineno="7-59"/>subject to disclosure, including discovery.</subsection><subsection ssid="13-null-37" dnum="e-o" numlevel="1" lineno="214" slineno="7-60" level="2"><display>(e)</display>Nothing in this section prevents the obtaining or enforcement of a civil judgment.</subsection></subsection><subsection ssid="13-null-38" dnum="4-o" numlevel="1" lineno="215" slineno="7-61" level="1" space="false"><display>(4)</display><subsection ssid="13-null-39" dnum="a-o" level="2" placement="sameline"><display>(a)</display>This chapter may not be construed as a denial of or limitation of the governor's <ln numlevel="1" lineno="216" slineno="7-62"/>power to grant respite or reprieves in all cases of convictions for offenses against the <ln numlevel="1" lineno="217" slineno="7-63"/>state, except treason or conviction on impeachment.</subsection><subsection ssid="13-null-40" dnum="b-o" numlevel="1" lineno="218" slineno="7-64" level="2"><display>(b)</display>Notwithstanding Subsection <xref depth="4" refnumber="77-27-5(4)(a)">(4)(a)</xref>, respites or reprieves may not extend beyond the <ln numlevel="1" lineno="219" slineno="7-65"/>next session of the board.</subsection><subsection ssid="13-null-41" dnum="c-o" numlevel="1" lineno="220" slineno="7-66" level="2"><display>(c)</display>At the next session of the board, the board:<subsection ssid="13-null-42" dnum="i-o" numlevel="1" lineno="221" slineno="7-67" level="3"><display>(i)</display>shall continue or terminate the respite or reprieve; or</subsection><subsection ssid="13-null-43" dnum="ii-o" numlevel="1" lineno="222" slineno="7-68" level="3"><display>(ii)</display>may commute the punishment or pardon the offense as provided.</subsection></subsection><subsection ssid="13-null-44" dnum="d-o" numlevel="1" lineno="223" slineno="7-69" level="2"><display>(d)</display>In the case of conviction for treason, the governor may suspend execution of the <ln numlevel="1" lineno="224" slineno="7-70"/>sentence until the case is reported to the Legislature at the Legislature's next session.</subsection><subsection ssid="13-null-45" dnum="e-o" numlevel="1" lineno="225" slineno="7-71" level="2"><display>(e)</display>The Legislature shall pardon or commute the sentence or direct the sentence's <ln numlevel="1" lineno="226" slineno="7-72"/>execution.</subsection></subsection><subsection ssid="13-null-46" dnum="5-o" numlevel="1" lineno="227" slineno="7-73" level="1" space="false"><display>(5)</display><subsection ssid="13-null-47" dnum="a-o" level="2" placement="sameline"><display>(a)</display>In determining when, where, and under what conditions an offender serving a <ln numlevel="1" lineno="228" slineno="7-74"/>sentence may be paroled or pardoned, have a fine or forfeiture remitted, have the <ln numlevel="1" lineno="229" slineno="7-75"/>offender's criminal accounts receivable remitted, or have the offender's sentence <ln numlevel="1" lineno="230" slineno="7-76"/>commuted or terminated, the board shall:<subsection ssid="13-null-48" dnum="i-o" numlevel="1" lineno="231" slineno="7-77" level="3" tab="1"><display>(i)</display>consider whether the offender has made restitution ordered by the court under <ln numlevel="1" lineno="232" slineno="7-78"/>Section <xref depth="3" refnumber="77-38b-205">77-38b-205</xref>, or is prepared to pay restitution as a condition of any parole, <ln numlevel="1" lineno="233" slineno="7-79"/>pardon, remission of a criminal accounts receivable or a fine or forfeiture, or a <ln numlevel="1" lineno="234" slineno="7-80"/>commutation or termination of the offender's sentence;</subsection><subsection ssid="13-null-49" dnum="ii-o" numlevel="1" lineno="235" slineno="7-81" level="3" tab="1"><display>(ii)</display>except as provided in Subsection <xref depth="4" refnumber="77-27-5(5)(b)">(5)(b)</xref>, develop and use a list of criteria for <ln numlevel="1" lineno="236" slineno="7-82"/>making determinations under this Subsection <xref depth="4" refnumber="77-27-5(5)">(5)</xref>;</subsection><subsection ssid="13-null-50" dnum="iii-o" numlevel="1" lineno="237" slineno="7-83" level="3" tab="1"><display>(iii)</display>consider information provided by the department regarding an offender's <ln numlevel="1" lineno="238" slineno="7-84"/>individual case action plan; and</subsection><subsection ssid="13-null-51" dnum="iv-o" numlevel="1" lineno="239" slineno="7-85" level="3" tab="1"><display>(iv)</display>review an offender's status within 60 days after the day on which the board <ln numlevel="1" lineno="240" slineno="7-86"/>receives notice from the department that the offender has completed all of the <ln numlevel="1" lineno="241" slineno="7-87"/>offender's case action plan components that relate to activities that can be <ln numlevel="1" lineno="242" slineno="7-88"/>accomplished while the offender is imprisoned.</subsection></subsection><subsection ssid="13-null-52" dnum="b-o" numlevel="1" lineno="243" slineno="7-89" level="2"><display>(b)</display>The board shall determine whether to remit an offender's criminal accounts <ln numlevel="1" lineno="244" slineno="7-90"/>receivable under this Subsection <xref depth="4" refnumber="77-27-5(5)">(5)</xref> in accordance with Section <xref depth="3" refnumber="77-32b-105">77-32b-105</xref> or <xref depth="3" refnumber="77-32b-106"><ln numlevel="1" lineno="245" slineno="7-91"/>77-32b-106</xref>.</subsection><subsection ssid="13-62" dnum="_-o:c-i" numlevel="1" lineno="246" slineno="7-92" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1092" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="ahaskell" level="1" amendtag="end">When determining when and under what conditions an offender serving a sentence <ln numlevel="1" lineno="247" slineno="7-93"/>may be paroled, the board may consider designated examiners' reports with <ln numlevel="1" lineno="248" slineno="7-94"/>Subsection <xref depth="4" refnumber="77-27-7(5)(b)">77-27-7(5)(b)</xref>.</amend></subsection></subsection><subsection ssid="13-null-53" dnum="6-o" numlevel="1" lineno="249" slineno="7-95" level="1"><display>(6)</display>In determining whether parole may be terminated, the board shall consider:<subsection ssid="13-null-54" dnum="a-o" numlevel="1" lineno="250" slineno="7-96" level="2"><display>(a)</display>the offense committed by the parolee; and</subsection><subsection ssid="13-null-55" dnum="b-o" numlevel="1" lineno="251" slineno="7-97" level="2"><display>(b)</display>the parole period under Section <xref depth="3" refnumber="76-3-202">76-3-202</xref>, and in accordance with Section <xref depth="3" refnumber="77-27-13">77-27-13</xref>.</subsection></subsection><subsection ssid="13-null-56" dnum="7-o" numlevel="1" lineno="252" slineno="7-98" level="1"><display>(7)</display>For an offender placed on parole after December 31, 2018, the board shall terminate <ln numlevel="1" lineno="253" slineno="7-99"/>parole in accordance with the adult sentencing and supervision length guidelines, as <ln numlevel="1" lineno="254" slineno="7-100"/>defined in Section <xref depth="3" refnumber="63M-7-401.1">63M-7-401.1</xref>, to the extent the guidelines are consistent with the <ln numlevel="1" lineno="255" slineno="7-101"/>requirements of the law.</subsection><subsection ssid="13-null-57" dnum="8-o" numlevel="1" lineno="256" slineno="7-102" level="1"><display>(8)</display>The board may not rely solely on an algorithm or a risk assessment tool score in <ln numlevel="1" lineno="257" slineno="7-103"/>determining whether parole should be granted or terminated for an offender.</subsection><subsection ssid="13-null-58" dnum="9-o" numlevel="1" lineno="258" slineno="7-104" level="1"><display>(9)</display>The board may intervene as a limited-purpose party in a judicial or administrative <ln numlevel="1" lineno="259" slineno="7-105"/>proceeding, including a criminal action, to seek:<subsection ssid="13-null-59" dnum="a-o" numlevel="1" lineno="260" slineno="7-106" level="2"><display>(a)</display>correction of an order that has or will impact the board's jurisdiction; or</subsection><subsection ssid="13-null-60" dnum="b-o" numlevel="1" lineno="261" slineno="7-107" level="2"><display>(b)</display>clarification regarding an order that may impact the board's jurisdiction.</subsection></subsection><subsection ssid="13-null-61" dnum="10-o" numlevel="1" lineno="262" slineno="7-108" level="1"><display>(10)</display>A motion to intervene brought under Subsection <xref depth="4" refnumber="77-27-5(9)(a)">(9)(a)</xref> shall be raised within 60 days <ln numlevel="1" lineno="263" slineno="7-109"/>after the day on which a court enters the order that impacts the board's jurisdiction.</subsection></section></bsec><bsec buid="10" num="77-27-7" type="amend" src="code" uid="C77-27-S7_2025050720250507" sort="77 27 00070020250507" numlevel="1" lineno="264" slineno="8-1" sn="8"><section number="77-27-7" numlevel="1" lineno="265" slineno="8-2" type="amend"><secline lineno="264">Section 8. Section <bold>77-27-7</bold> is amended to read:</secline><catline lineno="265"><bold>77-27-7<parens/>. Parole or hearing dates -- Interview -- Hearings -- Report of licensed <ln numlevel="1" lineno="266" slineno="8-3"/>mental health professional -- Mental competency -- Report of designated examiner -- <ln numlevel="1" lineno="267" slineno="8-4"/>Rulemaking authority.</bold></catline><subsection ssid="10-null-48" dnum="1-o" numlevel="1" lineno="268" slineno="8-5" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="10-null-49" dnum="a-o" level="2" placement="sameline"><display>(a)</display>For an offender serving a sentence upon conviction of a felony or class A <ln numlevel="1" lineno="269" slineno="8-6"/>misdemeanor offense, the board shall:<subsection ssid="10-null-50" dnum="i-o" numlevel="1" lineno="270" slineno="8-7" level="3" tab="1"><display>(i)</display>within six months after the day on which the offender is committed to the custody <ln numlevel="1" lineno="271" slineno="8-8"/>of the department, set a hearing date to establish the offender's release date or date <ln numlevel="1" lineno="272" slineno="8-9"/>for rehearing; and</subsection><subsection ssid="10-null-51" dnum="ii-o" numlevel="1" lineno="273" slineno="8-10" level="3" tab="1"><display>(ii)</display>promptly notify the offender of the date described in Subsection <xref depth="4" refnumber="77-27-7(1)(a)(i)">(1)(a)(i)</xref>.</subsection></subsection><subsection ssid="10-null-52" dnum="b-o" numlevel="1" lineno="274" slineno="8-11" level="2" space="false"><display>(b)</display><subsection ssid="10-null-53" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The board may delay setting the hearing date described in Subsection <xref depth="4" refnumber="77-27-7(1)(a)(i)">(1)(a)(i)</xref> <ln numlevel="1" lineno="275" slineno="8-12"/>if the offender has an additional pending criminal case at the time of the offender's <ln numlevel="1" lineno="276" slineno="8-13"/>commitment to the custody of the department.</subsection><subsection ssid="10-null-54" dnum="ii-o" numlevel="1" lineno="277" slineno="8-14" level="3"><display>(ii)</display>For purposes of Subsection <xref depth="4" refnumber="77-27-7(1)(b)(i)">(1)(b)(i)</xref>, a pending criminal case includes:<subsection ssid="10-null-55" dnum="A-o" numlevel="1" lineno="278" slineno="8-15" level="4"><display>(A)</display>uncharged conduct that is being screened for prosecution, unless one year has <ln numlevel="1" lineno="279" slineno="8-16"/>passed since the day on which the board was notified of the screening and no <ln numlevel="1" lineno="280" slineno="8-17"/>charge has been filed within that time period; and</subsection><subsection ssid="10-null-56" dnum="B-o" numlevel="1" lineno="281" slineno="8-18" level="4"><display>(B)</display>charged conduct that has not reached resolution.</subsection></subsection></subsection><subsection ssid="10-null-57" dnum="c-o" numlevel="1" lineno="282" slineno="8-19" level="2"><display>(c)</display>If the board delays setting the hearing date as described in Subsection <xref depth="4" refnumber="77-27-7(1)(b)">(1)(b)</xref>, the <ln numlevel="1" lineno="283" slineno="8-20"/>board shall set a hearing date no later than six months after the day on which the final <ln numlevel="1" lineno="284" slineno="8-21"/>criminal case described in Subsection <xref depth="4" refnumber="77-27-7(1)(b)">(1)(b)</xref> has been resolved.</subsection><subsection ssid="10-null-58" dnum="d-o" numlevel="1" lineno="285" slineno="8-22" level="2" space="false"><display>(d)</display><subsection ssid="10-null-59" dnum="i-o" level="3" placement="sameline"><display>(i)</display>If the board delays setting the hearing date as described in Subsection <xref depth="4" refnumber="77-27-7(1)(b)">(1)(b)</xref>, <ln numlevel="1" lineno="286" slineno="8-23"/>the board shall establish and use a process to monitor the progress of the pending <ln numlevel="1" lineno="287" slineno="8-24"/>criminal action by seeking or obtaining updates no less frequently than every six <ln numlevel="1" lineno="288" slineno="8-25"/>months.</subsection><subsection ssid="10-null-60" dnum="ii-o" numlevel="1" lineno="289" slineno="8-26" level="3"><display>(ii)</display>The board shall establish the process described in Subsection <xref depth="4" refnumber="77-27-7(1)(d)(i)">(1)(d)(i)</xref> by creating <ln numlevel="1" lineno="290" slineno="8-27"/>rules in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking <ln numlevel="1" lineno="291" slineno="8-28"/>Act.</subsection></subsection><subsection ssid="10-null-61" dnum="e-o" numlevel="1" lineno="292" slineno="8-29" level="2"><display>(e)</display>When determining the hearing date under Subsection <xref depth="4" refnumber="77-27-7(1)(a)">(1)(a)</xref>, the board shall consider:<subsection ssid="10-null-62" dnum="i-o" numlevel="1" lineno="293" slineno="8-30" level="3"><display>(i)</display>the type and severity of offenses;</subsection><subsection ssid="10-null-63" dnum="ii-o" numlevel="1" lineno="294" slineno="8-31" level="3"><display>(ii)</display>prior criminal history;</subsection><subsection ssid="10-null-64" dnum="iii-o" numlevel="1" lineno="295" slineno="8-32" level="3"><display>(iii)</display>criminogenic risk factors; and</subsection><subsection ssid="10-null-65" dnum="iv-o" numlevel="1" lineno="296" slineno="8-33" level="3"><display>(iv)</display>evidence-based assessments.</subsection></subsection></subsection><subsection ssid="10-null-66" dnum="2-o" numlevel="1" lineno="297" slineno="8-34" level="1" space="false"><display>(2)</display><subsection ssid="10-null-67" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Before reaching a final decision to release an offender under this chapter, the chair <ln numlevel="1" lineno="298" slineno="8-35"/>shall cause the offender to appear before the board, the board's panel, or an appointed <ln numlevel="1" lineno="299" slineno="8-36"/>hearing officer, who shall personally interview the offender to consider the offender's <ln numlevel="1" lineno="300" slineno="8-37"/>fitness for release and verify as far as possible information furnished from other <ln numlevel="1" lineno="301" slineno="8-38"/>sources. </subsection><subsection ssid="10-null-68" dnum="b-o" numlevel="1" lineno="302" slineno="8-39" level="2"><display>(b)</display>An offender may waive a personal appearance before the board. </subsection><subsection ssid="10-null-69" dnum="c-o" numlevel="1" lineno="303" slineno="8-40" level="2" space="false"><display>(c)</display><subsection ssid="10-null-70" dnum="i-o" level="3" placement="sameline"><display>(i)</display>An offender outside of the state shall, if ordered by the board, submit to a <ln numlevel="1" lineno="304" slineno="8-41"/>courtesy hearing to be held by the appropriate authority in the jurisdiction in <ln numlevel="1" lineno="305" slineno="8-42"/>which the offender is housed in lieu of an appearance before the board. </subsection><subsection ssid="10-null-71" dnum="ii-o" numlevel="1" lineno="306" slineno="8-43" level="3"><display>(ii)</display>The offender shall be promptly notified in writing of the board's decision.</subsection></subsection></subsection><subsection ssid="10-null-72" dnum="3-o" numlevel="1" lineno="307" slineno="8-44" level="1" space="false"><display>(3)</display><subsection ssid="10-null-73" dnum="a-o" level="2" placement="sameline"><display>(a)</display>In the case of an offender convicted of violating or attempting to violate any of the <ln numlevel="1" lineno="308" slineno="8-45"/>provisions of Section <xref depth="3" refnumber="76-5-301.1">76-5-301.1</xref>, Subsection <xref depth="4" refnumber="76-5-302(2)(b)(vi)">76-5-302(2)(b)(vi)</xref>, Section <xref depth="3" refnumber="76-5-402">76-5-402</xref>, <xref depth="3" refnumber="76-5-402.1"><ln numlevel="1" lineno="309" slineno="8-46"/>76-5-402.1</xref>, <xref depth="3" refnumber="76-5-402.2">76-5-402.2</xref>, <xref depth="3" refnumber="76-5-402.3">76-5-402.3</xref>, <xref depth="3" refnumber="76-5-403">76-5-403</xref>, <xref depth="3" refnumber="76-5-403.1">76-5-403.1</xref>, <xref depth="3" refnumber="76-5-404">76-5-404</xref>, <xref depth="3" refnumber="76-5-404.1">76-5-404.1</xref>, <xref depth="3" refnumber="76-5-404.3"><ln numlevel="1" lineno="310" slineno="8-47"/>76-5-404.3</xref>, or <xref depth="3" refnumber="76-5-405">76-5-405</xref>, the chair may appoint one or more licensed mental health <ln numlevel="1" lineno="311" slineno="8-48"/>professionals who shall examine the offender within six months prior to a hearing at <ln numlevel="1" lineno="312" slineno="8-49"/>which an original parole date is granted on any offense listed in this Subsection <xref depth="4" refnumber="77-27-7(3)">(3)</xref>.</subsection><subsection ssid="10-null-74" dnum="b-o" numlevel="1" lineno="313" slineno="8-50" level="2" space="false"><display>(b)</display><subsection ssid="10-null-75" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The licensed mental health professional shall report in writing the results of the <ln numlevel="1" lineno="314" slineno="8-51"/>examination to the board prior to the hearing. </subsection><subsection ssid="10-null-76" dnum="ii-o" numlevel="1" lineno="315" slineno="8-52" level="3"><display>(ii)</display> The report of the appointed licensed mental health professional shall specifically <ln numlevel="1" lineno="316" slineno="8-53"/>address the question of the offender's current mental condition and attitudes as <ln numlevel="1" lineno="317" slineno="8-54"/>they relate to any danger the offender may pose to children or others if the <ln numlevel="1" lineno="318" slineno="8-55"/>offender is released on parole.</subsection></subsection></subsection><subsection ssid="10-null-77" dnum="4-o" numlevel="1" lineno="319" slineno="8-56" level="1"><display>(4)</display>A parolee may petition the board for termination of lifetime parole as provided in <ln numlevel="1" lineno="320" slineno="8-57"/>Section <xref depth="3" refnumber="76-3-202">76-3-202</xref> in the case of a parolee convicted of a first degree felony violation, or <ln numlevel="1" lineno="321" slineno="8-58"/>convicted of attempting to violate Section <xref depth="3" refnumber="76-5-301.1">76-5-301.1</xref>, Subsection <xref depth="4" refnumber="76-5-302(2)(b)(vi)">76-5-302(2)(b)(vi)</xref>, <ln numlevel="1" lineno="322" slineno="8-59"/>Section <xref depth="3" refnumber="76-5-402">76-5-402</xref>, <xref depth="3" refnumber="76-5-402.1">76-5-402.1</xref>, <xref depth="3" refnumber="76-5-402.2">76-5-402.2</xref>, <xref depth="3" refnumber="76-5-402.3">76-5-402.3</xref>, <xref depth="3" refnumber="76-5-403">76-5-403</xref>, <xref depth="3" refnumber="76-5-403.1">76-5-403.1</xref>, <xref depth="3" refnumber="76-5-404.1">76-5-404.1</xref>, <xref depth="3" refnumber="76-5-404.3"><ln numlevel="1" lineno="323" slineno="8-60"/>76-5-404.3</xref>, or <xref depth="3" refnumber="76-5-405">76-5-405</xref>, and released on parole before January 1, 2019.</subsection><subsection ssid="10-null-78" dnum="5-o" numlevel="1" lineno="324" slineno="8-61" level="1" space="false"><display>(5)</display><subsection ssid="10-null-79" dnum="_-o:a-i" ea="amend" anum="0" owner="ahaskell" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1133" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>In a case in which an offender's mental competency is questioned by the board, <ln numlevel="1" lineno="325" slineno="8-62"/>the chair may appoint one or more licensed mental health professionals to examine <ln numlevel="1" lineno="326" slineno="8-63"/>the offender and report in writing to the board, specifically addressing the issue of <ln numlevel="1" lineno="327" slineno="8-64"/>competency.</subsection><subsection ssid="10-null-80" dnum="_-o:b-i" numlevel="1" lineno="328" slineno="8-65" ea="amend" anum="0" owner="ahaskell" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1134" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><subsection ssid="10-null-81" dnum="_-o:i-i" ea="amend" anum="0" owner="ahaskell" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1135" style="1" owner="i" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="10" style="1" owner="ahaskell" level="1" amendtag="end">In a case in which the board has reason to believe that an offender may have a <ln numlevel="1" lineno="329" slineno="8-66"/>mental illness, as that term is defined in Section <xref depth="3" refnumber="26B-5-301">26B-5-301</xref>, the chair may appoint <ln numlevel="1" lineno="330" slineno="8-67"/>two designated examiners, as that term is defined in Section <xref depth="3" refnumber="26B-5-301">26B-5-301</xref>, each of <ln numlevel="1" lineno="331" slineno="8-68"/>which shall examine the offender and prepare a report that includes the designated <ln numlevel="1" lineno="332" slineno="8-69"/>examiner's determinations regarding whether:</amend><subsection ssid="10-null-82" dnum="_-o:A-i" numlevel="1" lineno="333" slineno="8-70" ea="amend" anum="0" owner="ahaskell" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1136" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="40" groupid="33" style="1" owner="ahaskell" level="1" amendtag="end">the offender has a mental illness;</amend></subsection><subsection ssid="10-null-83" dnum="_-o:B-i" numlevel="1" lineno="334" slineno="8-71" ea="amend" anum="0" owner="ahaskell" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1137" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="46" groupid="37" style="1" owner="ahaskell" level="1" amendtag="end">there is no appropriate less-restrictive alternative to including assisted <ln numlevel="1" lineno="335" slineno="8-72"/>outpatient treatment as a condition of parole; and</amend></subsection><subsection ssid="10-null-84" dnum="_-o:C-i" numlevel="1" lineno="336" slineno="8-73" ea="amend" anum="0" owner="ahaskell" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1138" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="56" groupid="44" style="1" owner="ahaskell" level="1" amendtag="end">the offender lacks the ability to engage in a rational decision-making process <ln numlevel="1" lineno="337" slineno="8-74"/>regarding the acceptance of mental health treatment as demonstrated by <ln numlevel="1" lineno="338" slineno="8-75"/>evidence of an inability to weigh the possible risks of accepting or rejecting <ln numlevel="1" lineno="339" slineno="8-76"/>treatment, or the offender needs assisted outpatient treatment in order to <ln numlevel="1" lineno="340" slineno="8-77"/>prevent relapse or deterioration that is likely to result in the offender posing a <ln numlevel="1" lineno="341" slineno="8-78"/>substantial danger to self or others.</amend></subsection></subsection><subsection ssid="10-null-85" dnum="_-o:ii-i" numlevel="1" lineno="342" slineno="8-79" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1139" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="16" groupid="13" style="1" owner="ahaskell" level="1" amendtag="end">Based on the designated examiners' reports, the board may require assisted <ln numlevel="1" lineno="343" slineno="8-80"/>outpatient treatment as a condition of parole for an offender with a mental illness.</amend></subsection><subsection ssid="10-null-86" dnum="_-o:iii-i" numlevel="1" lineno="344" slineno="8-81" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1140" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="66" groupid="51" style="1" owner="ahaskell" level="1" amendtag="end">If assisted outpatient treatment is ordered, failure to continue treatment, except <ln numlevel="1" lineno="345" slineno="8-82"/>by agreement with the treatment provider and the board, is a basis for initiation of <ln numlevel="1" lineno="346" slineno="8-83"/>parole violation hearings by the board.</amend></subsection></subsection></subsection><subsection ssid="10-null-87" dnum="6-o" numlevel="1" lineno="347" slineno="8-84" level="1"><display>(6)</display>In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the <ln numlevel="1" lineno="348" slineno="8-85"/>board shall make rules governing:<subsection ssid="10-null-88" dnum="a-o" numlevel="1" lineno="349" slineno="8-86" level="2"><display>(a)</display>the hearing process;</subsection><subsection ssid="10-null-89" dnum="b-o" numlevel="1" lineno="350" slineno="8-87" level="2"><display>(b)</display>licensed mental health professional examinations;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="21" groupid="17" style="2" owner="ahaskell" level="1" deltag="both"> and</amend><amendoutend style="2"/></subsection><subsection ssid="10-null-90" dnum="_-o:c-i" numlevel="1" lineno="351" slineno="8-88" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1144" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="20" groupid="16" style="1" owner="ahaskell" level="1" amendtag="end">designated examiner examinations; and</amend></subsection><subsection ssid="10-null-91" dnum="c-o:d-i" numlevel="1" lineno="352" slineno="8-89" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1145" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1146" style="1" owner="i" level="1" amendtag="both" space="true">(d)</amend></display>parolee petitions for termination of parole.</subsection></subsection></section></bsec><bsec buid="24" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="353" slineno="9-1" sn="9"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="353">Section 9.  <bold>Effective Date.</bold></secline><sectionText lineno="354"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="ahaskell" level="1"
