Section <bold>26B-4-903</bold> is amended to read:</secline><catline lineno="41"><bold>26B-4-903<parens/>. Electronic health record system study.</bold></catline><subsection ssid="17-null-1" dnum="1-o" numlevel="1" lineno="42" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>On or before June 30, 2025, the department shall convene a working group to study and <ln numlevel="1" lineno="43" slineno="1-4"/>develop recommendations regarding the electronic health record system used in <ln numlevel="1" lineno="44" slineno="1-5"/>connection with providing inmates with comprehensive health care, including:<subsection ssid="17-null-2" dnum="a-o" numlevel="1" lineno="45" slineno="1-6" level="2"><display>(a)</display>identification of the department's electronic health record system requirements;</subsection><subsection ssid="17-null-3" dnum="b-o" numlevel="1" lineno="46" slineno="1-7" level="2"><display>(b)</display>an analysis of what features of an electronic health record system are needed to <ln numlevel="1" lineno="47" slineno="1-8"/>maximize the implementation, effectiveness, and efficiency of the waiver described <ln numlevel="1" lineno="48" slineno="1-9"/>in Section <xref depth="3" refnumber="26B-3-217">26B-3-217</xref>; and</subsection><subsection ssid="17-null-4" dnum="c-o" numlevel="1" lineno="49" slineno="1-10" level="2"><display>(c)</display>a determination of whether the department's current electronic health record system <ln numlevel="1" lineno="50" slineno="1-11"/>meets the requirements and includes the features identified under Subsections <xref tempid="993" depth="4" refnumber="(1)(a)">(1)(a)</xref> <ln numlevel="1" lineno="51" slineno="1-12"/>and (b).</subsection></subsection><subsection ssid="17-null-5" dnum="2-o" numlevel="1" lineno="52" slineno="1-13" level="1"><display>(2)</display>The working group described in Subsection <xref tempid="872" depth="4" refnumber="(1)">(1)</xref> shall include department staff as <ln numlevel="1" lineno="53" slineno="1-14"/>determined by the director.</subsection><subsection ssid="17-null-6" dnum="3-o" numlevel="1" lineno="54" slineno="1-15" level="1"><display>(3)</display>The working group shall provide recommendations regarding the electronic health <ln numlevel="1" lineno="55" slineno="1-16"/>record system to the Health and Human Services Interim Committee on or before the <ln numlevel="1" lineno="56" slineno="1-17"/>date of the committee's meeting in November 2025.</subsection><subsection ssid="17-7" dnum="_-o:4-i" numlevel="1" lineno="57" slineno="1-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">By no later than December 31, 2026, the department shall enter into a contract, in <ln numlevel="1" lineno="58" slineno="1-19"/>accordance with Title 63G, Chapter 6a, Utah Procurement Code, for an electronic health <ln numlevel="1" lineno="59" slineno="1-20"/>record system that meets the requirements and has the features identified in accordance <ln numlevel="1" lineno="60" slineno="1-21"/>with Subsections <xref depth="4" refnumber="26B-4-903(1)(a)">(1)(a)</xref> and <xref depth="4" refnumber="26B-4-903(b)">(b)</xref>.</amend></subsection></section></bsec><bsec buid="1" num="26B-4-905" type="enact" src="code" uid="C26B-4-S905_2025050720250507" sort="26B04 09050020250507" numlevel="1" lineno="61" slineno="2-1" sn="2"><section numlevel="1" lineno="62" slineno="2-2" number="26B-4-905" type="enact"><secline lineno="61">Section 2. Section <bold>26B-4-905</bold> is enacted to read:</secline><catline lineno="62"><bold>26B-4-905<parens/>. Nonlapsing funds.</bold></catline><subsection ssid="1-null-7" dnum="_-o:1-i" numlevel="1" lineno="63" slineno="2-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">Funds appropriated by the Legislature to the department for the purpose of paying for <ln numlevel="1" lineno="64" slineno="2-4"/>unanticipated high-cost correctional health care:</amend><subsection ssid="1-null-8" dnum="_-o:a-i" numlevel="1" lineno="65" slineno="2-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="end">are nonlapsing; and</amend></subsection><subsection ssid="1-null-9" dnum="_-o:b-i" numlevel="1" lineno="66" slineno="2-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="16" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">may only be used to pay for health care costs that meet the definition of <ln numlevel="1" lineno="67" slineno="2-7"/>unanticipated high-cost correctional health care.</amend></subsection></subsection><subsection ssid="1-null-10" dnum="_-o:2-i" numlevel="1" lineno="68" slineno="2-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="21" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="end">In any year that the department uses funds for the purpose described in Subsection <xref tempid="221" depth="4" refnumber="(1)">(1)</xref>, <ln numlevel="1" lineno="69" slineno="2-9"/>the department shall provide a report to the Social Services Appropriations <ln numlevel="1" lineno="70" slineno="2-10"/>Subcommittee and the Health and Human Services Interim Committee that includes:</amend><subsection ssid="1-null-11" dnum="_-o:a-i" numlevel="1" lineno="71" slineno="2-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="end">the amount expended; and</amend></subsection><subsection ssid="1-null-12" dnum="_-o:b-i" numlevel="1" lineno="72" slineno="2-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1012" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="31" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="end">the balance of unexpended funds appropriated to the department for unanticipated <ln numlevel="1" lineno="73" slineno="2-13"/>high-cost correctional health care.</amend></subsection></subsection></section></bsec><bsec buid="2" num="26B-4-906" type="enact" src="code" uid="C26B-4-S906_2025050720250507" sort="26B04 09060020250507" numlevel="1" lineno="74" slineno="3-1" sn="3"><section numlevel="1" lineno="75" slineno="3-2" number="26B-4-906" type="enact"><secline lineno="74">Section 3. Section <bold>26B-4-906</bold> is enacted to read:</secline><catline lineno="75"><bold>26B-4-906<parens/>. Treatment for opioid use disorder.</bold></catline><subsection ssid="2-null-5" dnum="_-o:1-i" numlevel="1" lineno="76" slineno="3-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1013" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="73" groupid="57" style="1" owner="jchristopherson" level="1" amendtag="end">As used in this section, "CMS" means the Centers for Medicare and Medicaid Services <ln numlevel="1" lineno="77" slineno="3-4"/>within the United States Department of Health and Human Services.</amend></subsection><subsection ssid="2-17" dnum="_-o:2-i" numlevel="1" lineno="78" slineno="3-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1014" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="70" groupid="55" style="1" owner="jchristopherson" level="1" amendtag="end">The department, in consultation with the Department of Corrections, shall prepare and <ln numlevel="1" lineno="79" slineno="3-6"/>implement a plan to provide, in accordance with current medical standards, opioid use <ln numlevel="1" lineno="80" slineno="3-7"/>disorder treatment to inmates who suffer from opioid use disorder:</amend><subsection ssid="2-15" dnum="_-o:a-i" numlevel="1" lineno="81" slineno="3-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1015" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="59" groupid="46" style="1" owner="jchristopherson" level="1" amendtag="end">for up to 90 days after the first day on which the inmate is incarcerated in a <ln numlevel="1" lineno="82" slineno="3-9"/>correctional facility; and</amend></subsection><subsection ssid="2-13" dnum="_-o:b-i" numlevel="1" lineno="83" slineno="3-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="53" groupid="41" style="1" owner="jchristopherson" level="1" amendtag="end">for up to 90 days immediately before the date on which the inmate is released from a <ln numlevel="1" lineno="84" slineno="3-11"/>correctional facility, if CMS grants a request for a waiver, or a request to amend a <ln numlevel="1" lineno="85" slineno="3-12"/>waiver, that the department requests in accordance with Section <xref depth="3" refnumber="26B-3-217">26B-3-217</xref>.</amend></subsection></subsection><subsection ssid="2-null-6" dnum="_-o:3-i" numlevel="1" lineno="86" slineno="3-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1017" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="13" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="end">The plan described in Subsection <xref depth="4" refnumber="26B-4-906(2)">(2)</xref> shall include the use of medication assisted <ln numlevel="1" lineno="87" slineno="3-14"/>treatment as medically necessary.</amend></subsection><subsection ssid="2-null-7" dnum="_-o:4-i" numlevel="1" lineno="88" slineno="3-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="19" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="end">The department shall consult and may contract with addiction specialists at the <ln numlevel="1" lineno="89" slineno="3-16"/>Huntsman Mental Health Institute to prepare and implement the plan described in <ln numlevel="1" lineno="90" slineno="3-17"/>Subsection <xref depth="4" refnumber="26B-4-906(2)">(2)</xref>.</amend></subsection><subsection ssid="2-null-8" dnum="_-o:5-i" numlevel="1" lineno="91" slineno="3-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1019" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="28" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="end">The department shall provide an annual report on the preparation and implementation of <ln numlevel="1" lineno="92" slineno="3-19"/>the plan described in Subsection <xref depth="4" refnumber="26B-4-906(2)">(2)</xref> to the Health and Human Services Interim <ln numlevel="1" lineno="93" slineno="3-20"/>Committee on or before the date of the committee's August interim meeting.</amend></subsection></section></bsec><bsec buid="6" num="63I-2-264" type="amend" src="code" uid="C63I-2-S264_2025050720250507" sort="63I02 02640020250507" numlevel="1" lineno="94" slineno="4-1" sn="4"><section number="63I-2-264" numlevel="1" lineno="95" slineno="4-2" type="amend"><secline lineno="94">Section 4. Section <bold>63I-2-264</bold> is amended to read:</secline><catline lineno="95"><bold>63I-2-264<parens/>. Repeal dates: Title 64.</bold></catline><sectionText lineno="96"><tab/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="6" groupid="6" style="2" owner="jchristopherson" level="1" deltag="both">Section <xref depth="3" refnumber="64-13-25.1">64-13-25.1</xref>(4)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Subsection 64-13-25.1(5)</amend>, regarding reporting on continuation or <ln numlevel="1" lineno="97" slineno="4-4"/>discontinuation of a medication assisted treatment plan, is repealed July 1, 2026.</sectionText></section></bsec><bsec buid="32" num="63J-1-315" type="amend" src="code" uid="C63J-1-S315_2026050620260506" sort="63J01 03150020260506" numlevel="1" lineno="98" slineno="5-1" sn="5"><section number="63J-1-315" numlevel="1" lineno="99" slineno="5-2" type="amend"><secline lineno="98">Section 5. Section <bold>63J-1-315</bold> is amended to read:</secline><catline lineno="99"><bold>63J-1-315<parens/>. Medicaid Growth Reduction and Budget Stabilization Account -- <ln numlevel="1" lineno="100" slineno="5-3"/>Transfers of Medicaid growth savings -- Base budget adjustments.</bold></catline><subsection ssid="32-null-1" dnum="1-o" numlevel="1" lineno="101" slineno="5-4" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="32-null-2" dnum="a-o" numlevel="1" lineno="102" slineno="5-5" level="2"><display>(a)</display>"Department" means the Department of Health and Human Services created in <ln numlevel="1" lineno="103" slineno="5-6"/>Section <xref depth="3" refnumber="26B-1-201">26B-1-201</xref>.</subsection><subsection ssid="32-null-3" dnum="b-o" numlevel="1" lineno="104" slineno="5-7" level="2"><display>(b)</display>"Division" means the Division of Integrated Healthcare created in Section <xref depth="3" refnumber="26B-3-102">26B-3-102</xref>.</subsection><subsection ssid="32-null-4" dnum="c-o" numlevel="1" lineno="105" slineno="5-8" level="2"><display>(c)</display>"General Fund revenue surplus" means a situation where actual General Fund <ln numlevel="1" lineno="106" slineno="5-9"/>revenues collected in a completed fiscal year exceed the estimated revenues for the <ln numlevel="1" lineno="107" slineno="5-10"/>General Fund for that fiscal year that were adopted by the Executive Appropriations <ln numlevel="1" lineno="108" slineno="5-11"/>Committee of the Legislature.</subsection><subsection ssid="32-null-5" dnum="d-o" numlevel="1" lineno="109" slineno="5-12" level="2"><display>(d)</display>"Medicaid growth savings" means the Medicaid growth target minus Medicaid <ln numlevel="1" lineno="110" slineno="5-13"/>program expenditures, if Medicaid program expenditures are less than the Medicaid <ln numlevel="1" lineno="111" slineno="5-14"/>growth target.</subsection><subsection ssid="32-null-6" dnum="e-o" numlevel="1" lineno="112" slineno="5-15" level="2"><display>(e)</display>"Medicaid growth target" means Medicaid program expenditures for the previous <ln numlevel="1" lineno="113" slineno="5-16"/>year multiplied by 1.08.</subsection><subsection ssid="32-null-7" dnum="f-o" numlevel="1" lineno="114" slineno="5-17" level="2"><display>(f)</display>"Medicaid program" is as defined in Section <xref depth="3" refnumber="26B-3-101">26B-3-101</xref>.</subsection><subsection ssid="32-null-8" dnum="g-o" numlevel="1" lineno="115" slineno="5-18" level="2"><display>(g)</display>"Medicaid program expenditures" means total state revenue expended for the <ln numlevel="1" lineno="116" slineno="5-19"/>Medicaid program from the General Fund, including restricted accounts within the <ln numlevel="1" lineno="117" slineno="5-20"/>General Fund, during a fiscal year.</subsection><subsection ssid="32-null-9" dnum="h-o" numlevel="1" lineno="118" slineno="5-21" level="2"><display>(h)</display>"Medicaid program expenditures for the previous year" means total state revenue <ln numlevel="1" lineno="119" slineno="5-22"/>expended for the Medicaid program from the General Fund, including restricted <ln numlevel="1" lineno="120" slineno="5-23"/>accounts within the General Fund, during the fiscal year immediately <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="14" groupid="12" style="2" owner="jchristopherson" level="1" deltag="both">preceding</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="13" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="121" slineno="5-24"/>before</amend> a fiscal year for which Medicaid program expenditures are calculated.</subsection><subsection ssid="32-null-10" dnum="i-o" numlevel="1" lineno="122" slineno="5-25" level="2"><display>(i)</display>"Operating deficit" means that, at the end of the fiscal year, the unassigned fund <ln numlevel="1" lineno="123" slineno="5-26"/>balance in the General Fund is less than zero.</subsection><subsection ssid="32-null-11" dnum="j-o" numlevel="1" lineno="124" slineno="5-27" level="2"><display>(j)</display>"State revenue" means revenue other than federal revenue.</subsection><subsection ssid="32-null-12" dnum="k-o" numlevel="1" lineno="125" slineno="5-28" level="2"><display>(k)</display>"State revenue expended for the Medicaid program" includes money transferred or <ln numlevel="1" lineno="126" slineno="5-29"/>appropriated to the Medicaid Growth Reduction and Budget Stabilization Account <ln numlevel="1" lineno="127" slineno="5-30"/>only to the extent the money is appropriated for the Medicaid program by the <ln numlevel="1" lineno="128" slineno="5-31"/>Legislature.</subsection></subsection><subsection ssid="32-null-13" dnum="2-o" numlevel="1" lineno="129" slineno="5-32" level="1"><display>(2)</display>There is created within the General Fund a restricted account to be known as the <ln numlevel="1" lineno="130" slineno="5-33"/>Medicaid Growth Reduction and Budget Stabilization Account.</subsection><subsection ssid="32-null-14" dnum="3-o" numlevel="1" lineno="131" slineno="5-34" level="1" space="false"><display>(3)</display><subsection ssid="32-null-15" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The following shall be deposited into the Medicaid Growth Reduction and Budget <ln numlevel="1" lineno="132" slineno="5-35"/>Stabilization Account:<subsection ssid="32-null-16" dnum="i-o" numlevel="1" lineno="133" slineno="5-36" level="3" tab="1"><display>(i)</display>deposits described in Subsection <xref depth="4" refnumber="63J-1-315(4)">(4)</xref>;</subsection><subsection ssid="32-null-17" dnum="ii-o" numlevel="1" lineno="134" slineno="5-37" level="3" tab="1"><display>(ii)</display>beginning July 1, 2024, any general funds appropriated to the department for the <ln numlevel="1" lineno="135" slineno="5-38"/>state plan for medical assistance or for Medicaid administration by the Division of <ln numlevel="1" lineno="136" slineno="5-39"/>Integrated Healthcare that are not expended by the department in the fiscal year <ln numlevel="1" lineno="137" slineno="5-40"/>for which the general funds were appropriated and which are not otherwise <ln numlevel="1" lineno="138" slineno="5-41"/>designated as nonlapsing shall lapse into the Medicaid Growth Reduction and <ln numlevel="1" lineno="139" slineno="5-42"/>Budget Stabilization Account;</subsection><subsection ssid="32-null-18" dnum="iii-o" numlevel="1" lineno="140" slineno="5-43" level="3" tab="1"><display>(iii)</display>beginning July 1, 2024, any unused state funds that are associated with the <ln numlevel="1" lineno="141" slineno="5-44"/>Medicaid program from the Department of Workforce Services;</subsection><subsection ssid="32-null-19" dnum="iv-o" numlevel="1" lineno="142" slineno="5-45" level="3" tab="1"><display>(iv)</display>beginning July 1, 2024, any penalties imposed and collected under:<subsection ssid="32-null-20" dnum="A-o" numlevel="1" lineno="143" slineno="5-46" level="4"><display>(A)</display>Section <xref depth="3" refnumber="17B-2a-818.5">17B-2a-818.5</xref>;</subsection><subsection ssid="32-null-21" dnum="B-o" numlevel="1" lineno="144" slineno="5-47" level="4"><display>(B)</display>Section <xref depth="3" refnumber="19-1-206">19-1-206</xref>;</subsection><subsection ssid="32-null-22" dnum="C-o" numlevel="1" lineno="145" slineno="5-48" level="4"><display>(C)</display>Section <xref depth="3" refnumber="63A-5b-607">63A-5b-607</xref>;</subsection><subsection ssid="32-null-23" dnum="D-o" numlevel="1" lineno="146" slineno="5-49" level="4"><display>(D)</display>Section <xref depth="3" refnumber="63C-9-403">63C-9-403</xref>;</subsection><subsection ssid="32-null-24" dnum="E-o" numlevel="1" lineno="147" slineno="5-50" level="4"><display>(E)</display>Section <xref depth="3" refnumber="72-6-107.5">72-6-107.5</xref>; or</subsection><subsection ssid="32-null-25" dnum="F-o" numlevel="1" lineno="148" slineno="5-51" level="4"><display>(F)</display>Section <xref depth="3" refnumber="79-2-404">79-2-404</xref>; and</subsection></subsection><subsection ssid="32-null-26" dnum="v-o" numlevel="1" lineno="149" slineno="5-52" level="3" tab="1"><display>(v)</display>at the close of fiscal year 2024, the Division of Finance shall transfer any existing <ln numlevel="1" lineno="150" slineno="5-53"/>balance in the Medicaid Restricted Account created in Section <xref depth="3" refnumber="26B-1-309">26B-1-309</xref> into the <ln numlevel="1" lineno="151" slineno="5-54"/>Medicaid Growth Reduction and Budget Stabilization Account.</subsection></subsection><subsection ssid="32-null-27" dnum="b-o" numlevel="1" lineno="152" slineno="5-55" level="2"><display>(b)</display>In addition to the deposits described in Subsection <xref depth="4" refnumber="63J-1-315(3)(a)">(3)(a)</xref>, the Legislature may <ln numlevel="1" lineno="153" slineno="5-56"/>appropriate money into the Medicaid Growth Reduction and Budget Stabilization <ln numlevel="1" lineno="154" slineno="5-57"/>Account.</subsection></subsection><subsection ssid="32-null-28" dnum="4-o" numlevel="1" lineno="155" slineno="5-58" level="1" space="false"><display>(4)</display><subsection ssid="32-null-29" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="32-null-30" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>Except as provided in Subsection <xref depth="4" refnumber="63J-1-315(7)">(7)</xref>, if, at the end of a fiscal year, there is a <ln numlevel="1" lineno="156" slineno="5-59"/>General Fund revenue surplus, the Division of Finance shall transfer an amount <ln numlevel="1" lineno="157" slineno="5-60"/>equal to Medicaid growth savings from the General Fund to the Medicaid Growth <ln numlevel="1" lineno="158" slineno="5-61"/>Reduction and Budget Stabilization Account.</subsection><subsection ssid="32-null-31" dnum="ii-o" numlevel="1" lineno="159" slineno="5-62" level="3" tab="1"><display>(ii)</display>If the amount transferred is reduced to prevent an operating deficit, as provided in <ln numlevel="1" lineno="160" slineno="5-63"/>Subsection <xref depth="4" refnumber="63J-1-315(7)">(7)</xref>, the Legislature shall include, to the extent revenue is available, an <ln numlevel="1" lineno="161" slineno="5-64"/>amount equal to the reduction as an appropriation from the General Fund to the <ln numlevel="1" lineno="162" slineno="5-65"/>account in the base budget for the second fiscal year following the fiscal year for <ln numlevel="1" lineno="163" slineno="5-66"/>which the reduction was made.</subsection></subsection><subsection ssid="32-null-32" dnum="b-o" numlevel="1" lineno="164" slineno="5-67" level="2"><display>(b)</display>If, at the end of a fiscal year, there is not a General Fund revenue surplus, the <ln numlevel="1" lineno="165" slineno="5-68"/>Legislature shall include, to the extent revenue is available, an amount equal to <ln numlevel="1" lineno="166" slineno="5-69"/>Medicaid growth savings as an appropriation from the General Fund to the account in <ln numlevel="1" lineno="167" slineno="5-70"/>the base budget for the second fiscal year following the fiscal year for which the <ln numlevel="1" lineno="168" slineno="5-71"/>reduction was made.</subsection><subsection ssid="32-null-33" dnum="c-o" numlevel="1" lineno="169" slineno="5-72" level="2"><display>(c)</display>Subsections <xref depth="4" refnumber="63J-1-315(4)(a)">(4)(a)</xref> and <xref depth="4" refnumber="63J-1-315(4)(b)">(4)(b)</xref> apply only to the fiscal year in which the department <ln numlevel="1" lineno="170" slineno="5-73"/>implements the proposal developed under Section <xref depth="3" refnumber="26B-3-202">26B-3-202</xref> to reduce the long-term <ln numlevel="1" lineno="171" slineno="5-74"/>growth in state expenditures for the Medicaid program, and to each fiscal year after <ln numlevel="1" lineno="172" slineno="5-75"/>that year.</subsection></subsection><subsection ssid="32-null-34" dnum="5-o" numlevel="1" lineno="173" slineno="5-76" level="1"><display>(5)</display>The Division of Finance shall calculate the amount to be transferred under Subsection <xref depth="4" refnumber="63J-1-315(4)"><ln numlevel="1" lineno="174" slineno="5-77"/>(4)</xref>:<subsection ssid="32-null-35" dnum="a-o" numlevel="1" lineno="175" slineno="5-78" level="2"><display>(a)</display>before transferring revenue from the General Fund revenue surplus to:<subsection ssid="32-null-36" dnum="i-o" numlevel="1" lineno="176" slineno="5-79" level="3"><display>(i)</display>the General Fund Budget Reserve Account under Section <xref depth="3" refnumber="63J-1-312">63J-1-312</xref>;</subsection><subsection ssid="32-null-37" dnum="ii-o" numlevel="1" lineno="177" slineno="5-80" level="3"><display>(ii)</display>the Utah Wildfire Fund created in Section <xref depth="3" refnumber="65A-8-217">65A-8-217</xref>, as described in Section <xref depth="3" refnumber="63J-1-314"><ln numlevel="1" lineno="178" slineno="5-81"/>63J-1-314</xref>; and</subsection><subsection ssid="32-null-38" dnum="iii-o" numlevel="1" lineno="179" slineno="5-82" level="3"><display>(iii)</display>the State Disaster Recovery Restricted Account under Section <xref depth="3" refnumber="63J-1-314">63J-1-314</xref>;</subsection></subsection><subsection ssid="32-null-39" dnum="b-o" numlevel="1" lineno="180" slineno="5-83" level="2"><display>(b)</display>before earmarking revenue from the General Fund revenue surplus to the Industrial <ln numlevel="1" lineno="181" slineno="5-84"/>Assistance Account under Section <xref depth="3" refnumber="63N-3-106">63N-3-106</xref>; and</subsection><subsection ssid="32-null-40" dnum="c-o" numlevel="1" lineno="182" slineno="5-85" level="2"><display>(c)</display>before making any other year-end contingency appropriations, year-end set-asides, or <ln numlevel="1" lineno="183" slineno="5-86"/>other year-end transfers required by law.</subsection></subsection><subsection ssid="32-null-41" dnum="6-o" numlevel="1" lineno="184" slineno="5-87" level="1" space="false"><display>(6)</display><subsection ssid="32-null-42" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If, at the close of any fiscal year, there appears to be insufficient money to pay <ln numlevel="1" lineno="185" slineno="5-88"/>additional debt service for any bonded debt authorized by the Legislature, the <ln numlevel="1" lineno="186" slineno="5-89"/>Division of Finance may hold back from any General Fund revenue surplus money <ln numlevel="1" lineno="187" slineno="5-90"/>sufficient to pay the additional debt service requirements resulting from issuance of <ln numlevel="1" lineno="188" slineno="5-91"/>bonded debt that was authorized by the Legislature.</subsection><subsection ssid="32-null-43" dnum="b-o" numlevel="1" lineno="189" slineno="5-92" level="2"><display>(b)</display>The Division of Finance may not spend the hold back amount for debt service under <ln numlevel="1" lineno="190" slineno="5-93"/>Subsection <xref depth="4" refnumber="63J-1-315(6)(a)">(6)(a)</xref> unless and until it is appropriated by the Legislature.</subsection><subsection ssid="32-null-44" dnum="c-o" numlevel="1" lineno="191" slineno="5-94" level="2"><display>(c)</display>If, after calculating the amount for transfer under Subsection <xref depth="4" refnumber="63J-1-315(4)">(4)</xref>, the remaining <ln numlevel="1" lineno="192" slineno="5-95"/>General Fund revenue surplus is insufficient to cover the hold back for debt service <ln numlevel="1" lineno="193" slineno="5-96"/>required by Subsection <xref depth="4" refnumber="63J-1-315(6)(a)">(6)(a)</xref>, the Division of Finance shall reduce the transfer to the <ln numlevel="1" lineno="194" slineno="5-97"/>Medicaid Growth Reduction and Budget Stabilization Account by the amount <ln numlevel="1" lineno="195" slineno="5-98"/>necessary to cover the debt service hold back.</subsection><subsection ssid="32-null-45" dnum="d-o" numlevel="1" lineno="196" slineno="5-99" level="2"><display>(d)</display>Notwithstanding Subsections <xref depth="4" refnumber="63J-1-315(4)">(4)</xref> and <xref depth="4" refnumber="63J-1-315(5)">(5)</xref>, the Division of Finance shall hold back the <ln numlevel="1" lineno="197" slineno="5-100"/>General Fund balance for debt service authorized by this Subsection <xref depth="4" refnumber="63J-1-315(6)">(6)</xref> before <ln numlevel="1" lineno="198" slineno="5-101"/>making any transfers to the Medicaid Growth Reduction and Budget Stabilization <ln numlevel="1" lineno="199" slineno="5-102"/>Account or any other designation or allocation of General Fund revenue surplus.</subsection></subsection><subsection ssid="32-null-46" dnum="7-o" numlevel="1" lineno="200" slineno="5-103" level="1"><display>(7)</display>Notwithstanding Subsections <xref depth="4" refnumber="63J-1-315(4)">(4)</xref> and <xref depth="4" refnumber="63J-1-315(5)">(5)</xref>, if, at the end of a fiscal year, the Division of <ln numlevel="1" lineno="201" slineno="5-104"/>Finance determines that an operating deficit exists and that holding back earmarks to the <ln numlevel="1" lineno="202" slineno="5-105"/>Industrial Assistance Account under Section <xref depth="3" refnumber="63N-3-106">63N-3-106</xref>, transfers to the Utah Wildfire <ln numlevel="1" lineno="203" slineno="5-106"/>Fund and  State Disaster Recovery Restricted Account under Section <xref depth="3" refnumber="63J-1-314">63J-1-314</xref>, <ln numlevel="1" lineno="204" slineno="5-107"/>transfers to the General Fund Budget Reserve Account under Section <xref depth="3" refnumber="63J-1-312">63J-1-312</xref>, or <ln numlevel="1" lineno="205" slineno="5-108"/>earmarks and transfers to more than one of those accounts, in that order, does not <ln numlevel="1" lineno="206" slineno="5-109"/>eliminate the operating deficit, the Division of Finance may reduce the transfer to the <ln numlevel="1" lineno="207" slineno="5-110"/>Medicaid Growth Reduction and Budget Stabilization Account by the amount necessary <ln numlevel="1" lineno="208" slineno="5-111"/>to eliminate the operating deficit.</subsection><subsection ssid="32-null-47" dnum="8-o" numlevel="1" lineno="209" slineno="5-112" level="1"><display>(8)</display>The Legislature may appropriate money from the Medicaid Growth Reduction and <ln numlevel="1" lineno="210" slineno="5-113"/>Budget Stabilization Account only:<subsection ssid="32-null-48" dnum="a-o" numlevel="1" lineno="211" slineno="5-114" level="2" space="false"><display>(a)</display><subsection ssid="32-53" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1068" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>for the Medicaid program; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="4" groupid="4" style="2" owner="jchristopherson" level="1" deltag="both">and</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="11" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">or</amend></subsection><subsection ssid="32-54" dnum="_-o:ii-i" numlevel="1" lineno="212" slineno="5-115" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1069" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="10" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="end">beginning on January 1, 2027, for an electronic health record system for which <ln numlevel="1" lineno="213" slineno="5-116"/>the department enters into a contract in accordance with S<marker pairid="16"/><marker pairid="17"/><marker pairid="18"/>ection <xref depth="3" refnumber="26B-4-903">26B-4-903</xref>; and</amend></subsection></subsection><subsection ssid="32-null-49" dnum="b-o" numlevel="1" lineno="214" slineno="5-117" level="2" space="false"><display>(b)</display><subsection ssid="32-null-50" dnum="i-o" level="3" placement="sameline"><display>(i)</display>if Medicaid program expenditures for the fiscal year for which the <ln numlevel="1" lineno="215" slineno="5-118"/>appropriation is made are estimated to be 108% or more of Medicaid program <ln numlevel="1" lineno="216" slineno="5-119"/>expenditures for the previous year; or</subsection><subsection ssid="32-null-51" dnum="ii-o" numlevel="1" lineno="217" slineno="5-120" level="3"><display>(ii)</display>if the amount of the appropriation is equal to or less than the balance in the <ln numlevel="1" lineno="218" slineno="5-121"/>Medicaid Growth Reduction and Budget Stabilization Account that comprises <ln numlevel="1" lineno="219" slineno="5-122"/>deposits described in Subsections <xref depth="4" refnumber="63J-1-315(3)(a)(ii)">(3)(a)(ii)</xref> through <xref depth="4" refnumber="63J-1-315(v)">(v)</xref> and appropriations <ln numlevel="1" lineno="220" slineno="5-123"/>described in Subsection <xref depth="4" refnumber="63J-1-315(3)(b)">(3)(b)</xref>.</subsection></subsection></subsection><subsection ssid="32-null-52" dnum="9-o" numlevel="1" lineno="221" slineno="5-124" level="1"><display>(9)</display>The Division of Finance shall deposit interest or other earnings derived from investment <ln numlevel="1" lineno="222" slineno="5-125"/>of Medicaid Growth Reduction and Budget Stabilization Account money into the <ln numlevel="1" lineno="223" slineno="5-126"/>General Fund.</subsection></section></bsec><bsec buid="4" num="64-13-25.1" type="amend" src="code" uid="C64-13-S25.1_2025050720250507" sort="64 13 00250120250507" numlevel="1" lineno="224" slineno="6-1" sn="6"><section number="64-13-25.1" numlevel="1" lineno="225" slineno="6-2" type="amend"><secline lineno="224">Section 6. Section <bold>64-13-25.1</bold> is amended to read:</secline><catline lineno="225"><bold>64-13-25.1<parens/>. Medication assisted treatment plan.</bold></catline><subsection ssid="4-null-15" dnum="1-o" numlevel="1" lineno="226" slineno="6-3" level="1" placement="noreturn"><display>(1)</display>As used in this section, "medication assisted treatment plan" means a prescription plan <ln numlevel="1" lineno="227" slineno="6-4"/>to use a medication, such as buprenorphine, methadone, or naltrexone, to treat substance <ln numlevel="1" lineno="228" slineno="6-5"/>use withdrawal symptoms or an opioid use disorder.</subsection><subsection ssid="4-null-16" dnum="2-o" numlevel="1" lineno="229" slineno="6-6" level="1"><display>(2)</display>In collaboration with the Department of Health and Human Services the department <ln numlevel="1" lineno="230" slineno="6-7"/>may cooperate with medical personnel to continue a medication assisted treatment plan <ln numlevel="1" lineno="231" slineno="6-8"/>for an inmate who had an active medication assisted treatment plan within the last six <ln numlevel="1" lineno="232" slineno="6-9"/>months before being committed to the custody of the department.</subsection><subsection ssid="4-null-17" dnum="_-o:3-i" numlevel="1" lineno="233" slineno="6-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1076" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">The department shall cooperate with the Department of Health and Human Services and <ln numlevel="1" lineno="234" slineno="6-11"/>relevant medical personnel in providing medication assisted treatment in accordance <ln numlevel="1" lineno="235" slineno="6-12"/>with the substance use disorder plan described in Subsection <xref depth="4" refnumber="64-13-25.1(2)">(2)</xref>.</amend></subsection><subsection ssid="4-null-18" dnum="3-o:4-i" numlevel="1" lineno="236" slineno="6-13" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1077" style="2" owner="o" level="1" deltag="both">(3)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1078" style="1" owner="i" level="1" amendtag="both" space="true">(4)</amend></display>A medication used for a medication assisted treatment plan under Subsection <xref depth="4" refnumber="64-13-25.1(2)">(2)</xref>:<subsection ssid="4-null-19" dnum="a-o" numlevel="1" lineno="237" slineno="6-14" level="2"><display>(a)</display>shall be an oral, short-acting medication unless the chief administrative officer or <ln numlevel="1" lineno="238" slineno="6-15"/>other medical personnel who is familiar with the inmate's medication assisted <ln numlevel="1" lineno="239" slineno="6-16"/>treatment plan determines that a long-acting, non-oral medication will provide a <ln numlevel="1" lineno="240" slineno="6-17"/>greater benefit to the individual receiving treatment;</subsection><subsection ssid="4-null-20" dnum="b-o" numlevel="1" lineno="241" slineno="6-18" level="2"><display>(b)</display>may be administered to an inmate under the direction of the chief administrative <ln numlevel="1" lineno="242" slineno="6-19"/>officer of the correctional facility;</subsection><subsection ssid="4-null-21" dnum="c-o" numlevel="1" lineno="243" slineno="6-20" level="2"><display>(c)</display>may, as funding permits, be paid for by the department or the Department of Health <ln numlevel="1" lineno="244" slineno="6-21"/>and Human Services; and</subsection><subsection ssid="4-null-22" dnum="d-o" numlevel="1" lineno="245" slineno="6-22" level="2"><display>(d)</display>may be left or stored at a correctional facility at the discretion of the chief <ln numlevel="1" lineno="246" slineno="6-23"/>administrative officer of the correctional facility.</subsection></subsection><subsection ssid="4-null-23" dnum="4-o:5-i" numlevel="1" lineno="247" slineno="6-24" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1082" style="2" owner="o" level="1" deltag="both">(4)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1083" style="1" owner="i" level="1" amendtag="both" space="true">(5)</amend></display>Before November 30 each year, the Department of Health and Human Services <ln numlevel="1" lineno="248" slineno="6-25"/>shall provide a report to the Health and Human Services Interim Committee that details, <ln numlevel="1" lineno="249" slineno="6-26"/>for each category, the number of individuals in the custody of the department who, in <ln numlevel="1" lineno="250" slineno="6-27"/>the preceding 12 months:<subsection ssid="4-null-24" dnum="a-o" numlevel="1" lineno="251" slineno="6-28" level="2"><display>(a)</display>had an active medication assisted treatment plan within the six months preceding <ln numlevel="1" lineno="252" slineno="6-29"/>commitment to the custody of the department;</subsection><subsection ssid="4-null-25" dnum="b-o" numlevel="1" lineno="253" slineno="6-30" level="2"><display>(b)</display>continued a medication assisted treatment plan following commitment to the custody <ln numlevel="1" lineno="254" slineno="6-31"/>of the department; and</subsection><subsection ssid="4-null-26" dnum="c-o" numlevel="1" lineno="255" slineno="6-32" level="2"><display>(c)</display>discontinued a medication assisted treatment plan prior to, at the time of, or after <ln numlevel="1" lineno="256" slineno="6-33"/>commitment to the custody of the department and, as available, the type of <ln numlevel="1" lineno="257" slineno="6-34"/>medication discontinued and the reason for the discontinuation.</subsection></subsection></section></bsec><bsec buid="40" type="uncod" untype="approp" src="uncod" uid="APP2027" sort="UP0002027" langlock="false" numlevel="1" lineno="258" slineno="7-1" sn="7"><section type="uncod" nodeid="2" fy="2027" untype="approp" display="false" src="uncod"><secline lineno="258">Section 7.  <bold>FY 2027 Appropriations.</bold></secline><sectionText lineno="259"><summary numlevel="1" lineno="259" slineno="7-2">The following sums of money are appropriated for the fiscal year beginning July 1, <ln numlevel="1" lineno="260" slineno="7-3"/>2026, and ending June 30, 2027.
