Virtual Currency Kiosks</headpart><catline lineno="49"><bold>7-29-201<parens/>. Definitions.</bold></catline><sectionText lineno="50"><para/><amend anum="0" ea="amend" pairid="7" groupid="5" style="1" owner="ahaskell" level="1" amendtag="both">As used in this part:</amend></sectionText><subsection ssid="22-2" dnum="_-o:1-i" numlevel="1" lineno="51" slineno="1-5" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1000" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="9" style="1" owner="ahaskell" level="1" amendtag="end">"Blockchain analytics" means the analysis of data from blockchains or publicly <ln numlevel="1" lineno="52" slineno="1-6"/>distributed ledgers, including associated transaction information to provide risk-specific <ln numlevel="1" lineno="53" slineno="1-7"/>information about virtual currency transactions and virtual currency addresses.</amend></subsection><subsection ssid="22-3" dnum="_-o:2-i" numlevel="1" lineno="54" slineno="1-8" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1001" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="13" style="1" owner="ahaskell" level="1" amendtag="end">"Transaction hash" means a unique identifier made up of a string of characters that act <ln numlevel="1" lineno="55" slineno="1-9"/>as a record and provide proof the transaction was verified and added to the blockchain.</amend></subsection><subsection ssid="22-4" dnum="_-o:3-i" numlevel="1" lineno="56" slineno="1-10" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1002" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="22" groupid="17" style="1" owner="ahaskell" level="1" amendtag="end">"Virtual currency" means a digital representation of value that is used as a medium of <ln numlevel="1" lineno="57" slineno="1-11"/>exchange, unit of account, or store of value and is not money, whether or not <ln numlevel="1" lineno="58" slineno="1-12"/>denominated in money.</amend></subsection><subsection ssid="22-5" dnum="_-o:4-i" numlevel="1" lineno="59" slineno="1-13" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1003" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="27" groupid="21" style="1" owner="ahaskell" level="1" amendtag="end">"Virtual currency address" means an alphanumeric identifier associated with a virtual <ln numlevel="1" lineno="60" slineno="1-14"/>currency wallet identifying the location to which a virtual currency transaction may be <ln numlevel="1" lineno="61" slineno="1-15"/>sent.</amend></subsection><subsection ssid="22-6" dnum="_-o:5-i" numlevel="1" lineno="62" slineno="1-16" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1004" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="32" groupid="25" style="1" owner="ahaskell" level="1" amendtag="end">"Virtual currency kiosk" means an electronic terminal acting as a mechanical agent of <ln numlevel="1" lineno="63" slineno="1-17"/>the virtual currency kiosk operator to enable the virtual currency kiosk operator to <ln numlevel="1" lineno="64" slineno="1-18"/>facilitate the exchange of virtual currency for money, bank credit, or other virtual <ln numlevel="1" lineno="65" slineno="1-19"/>currency.</amend></subsection><subsection ssid="22-7" dnum="_-o:6-i" numlevel="1" lineno="66" slineno="1-20" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="37" groupid="29" style="1" owner="ahaskell" level="1" amendtag="end">"Virtual currency kiosk operator" means a person that operates a virtual currency kiosk <ln numlevel="1" lineno="67" slineno="1-21"/>in this state.</amend></subsection><subsection ssid="22-8" dnum="_-o:7-i" numlevel="1" lineno="68" slineno="1-22" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="start">(7)</amend></display><amend anum="0" ea="amend" pairid="42" groupid="33" style="1" owner="ahaskell" level="1" amendtag="end">"Virtual currency kiosk transaction" means a transaction conducted or performed, in <ln numlevel="1" lineno="69" slineno="1-23"/>whole or in part, by electronic means via a virtual currency kiosk to purchase virtual <ln numlevel="1" lineno="70" slineno="1-24"/>currency with fiat currency or to sell virtual currency for fiat currency.</amend></subsection><subsection ssid="22-9" dnum="_-o:8-i" numlevel="1" lineno="71" slineno="1-25" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="start">(8)</amend></display><amend anum="0" ea="amend" pairid="47" groupid="37" style="1" owner="ahaskell" level="1" amendtag="end">"Virtual currency wallet" means a software application or other mechanism providing a <ln numlevel="1" lineno="72" slineno="1-26"/>means to hold, store, or transfer virtual currency.</amend></subsection></section></bsec><bsec buid="24" num="7-29-202" type="enact" src="code" uid="C7-29-S202_2026050620260506" sort="07 29 02020020260506" numlevel="1" lineno="73" slineno="2-1" sn="2"><section numlevel="1" lineno="74" slineno="2-2" number="7-29-202" type="enact"><secline lineno="73">Section 2. Section <bold>7-29-202</bold> is enacted to read:</secline><catline lineno="74"><bold>7-29-202<parens/>. Virtual currency kiosk operators -- Licensing requirement -- <ln numlevel="1" lineno="75" slineno="2-3"/>Registration.</bold></catline><subsection ssid="24-1" dnum="_-o:1-i" numlevel="1" lineno="76" slineno="2-4" ea="amend" anum="0" owner="ahaskell" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="5" style="1" owner="ahaskell" level="1" amendtag="end">Notwithstanding Subsection <xref depth="4" refnumber="7-25-102(9)(b)">7-25-102(9)(b)</xref>, an individual or entity that operates a <ln numlevel="1" lineno="77" slineno="2-5"/>virtual currency kiosk in this state shall:</amend><subsection ssid="24-2" dnum="_-o:a-i" numlevel="1" lineno="78" slineno="2-6" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="9" style="1" owner="ahaskell" level="1" amendtag="end">obtain a license under Title 7, Chapter 25, Money Transmitter Act;</amend></subsection><subsection ssid="24-3" dnum="_-o:b-i" numlevel="1" lineno="79" slineno="2-7" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="13" style="1" owner="ahaskell" level="1" amendtag="end">register each virtual currency kiosk with the department;</amend></subsection><subsection ssid="24-4" dnum="_-o:c-i" numlevel="1" lineno="80" slineno="2-8" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="22" groupid="17" style="1" owner="ahaskell" level="1" amendtag="end">pay the license fee required by Section <xref depth="3" refnumber="7-1-401">7-1-401</xref>; and</amend></subsection><subsection ssid="24-5" dnum="_-o:d-i" numlevel="1" lineno="81" slineno="2-9" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1012" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="27" groupid="21" style="1" owner="ahaskell" level="1" amendtag="end">comply with the requirements of this part.</amend></subsection></subsection><subsection ssid="24-6" dnum="_-o:2-i" numlevel="1" lineno="82" slineno="2-10" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1013" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="32" groupid="25" style="1" owner="ahaskell" level="1" amendtag="end">For purposes of Title 7, Chapter 25, Money Transmitter Act, the operation of a virtual <ln numlevel="1" lineno="83" slineno="2-11"/>currency kiosk constitutes money transmission, regardless of whether the transactions <ln numlevel="1" lineno="84" slineno="2-12"/>involve blockchain tokens.</amend></subsection></section></bsec><bsec buid="25" num="7-29-203" type="enact" src="code" uid="C7-29-S203_2026050620260506" sort="07 29 02030020260506" numlevel="1" lineno="85" slineno="3-1" sn="3"><section numlevel="1" lineno="86" slineno="3-2" number="7-29-203" type="enact"><secline lineno="85">Section 3. Section <bold>7-29-203</bold> is enacted to read:</secline><catline lineno="86"><bold>7-29-203<parens/>. Transaction limits -- Fee restrictions -- Blockchain analytics.</bold></catline><subsection ssid="25-1" dnum="_-o:1-i" numlevel="1" lineno="87" slineno="3-3" ea="amend" anum="0" owner="ahaskell" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1014" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="5" style="1" owner="ahaskell" level="1" amendtag="end">A virtual currency kiosk operator may not:</amend><subsection ssid="25-5" dnum="_-o:a-i" numlevel="1" lineno="88" slineno="3-4" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1015" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="27" groupid="21" style="1" owner="ahaskell" level="1" amendtag="end">accept virtual currency kiosk transactions from a single customer that exceed a <ln numlevel="1" lineno="89" slineno="3-5"/>cumulative total of $1,000 of cash or the equivalent in virtual currency per calendar <ln numlevel="1" lineno="90" slineno="3-6"/>day in this state via one or more virtual currency kiosks operated by the same virtual <ln numlevel="1" lineno="91" slineno="3-7"/>currency kiosk operator;</amend></subsection><subsection ssid="25-2" dnum="_-o:b-i" numlevel="1" lineno="92" slineno="3-8" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="9" style="1" owner="ahaskell" level="1" amendtag="end">accept virtual currency kiosk transactions that exceed a cumulative total of $2,000 of <ln numlevel="1" lineno="93" slineno="3-9"/>cash or the equivalent in virtual currency from a customer who has completed fewer <ln numlevel="1" lineno="94" slineno="3-10"/>than five virtual currency kiosk transactions with the virtual currency kiosk operator; <ln numlevel="1" lineno="95" slineno="3-11"/>and</amend></subsection><subsection ssid="25-3" dnum="_-o:c-i" numlevel="1" lineno="96" slineno="3-12" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1017" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="13" style="1" owner="ahaskell" level="1" amendtag="end">charge a fee that exceeds 3% of the transaction amount for any virtual currency kiosk <ln numlevel="1" lineno="97" slineno="3-13"/>transaction.</amend></subsection></subsection><subsection ssid="25-4" dnum="_-o:2-i" numlevel="1" lineno="98" slineno="3-14" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="22" groupid="17" style="1" owner="ahaskell" level="1" amendtag="end">A virtual currency kiosk operator shall implement blockchain analytics to identify and <ln numlevel="1" lineno="99" slineno="3-15"/>block transactions to known fraudulent virtual currency addresses.</amend></subsection></section></bsec><bsec buid="26" num="7-29-204" type="enact" src="code" uid="C7-29-S204_2026050620260506" sort="07 29 02040020260506" numlevel="1" lineno="100" slineno="4-1" sn="4"><section numlevel="1" lineno="101" slineno="4-2" number="7-29-204" type="enact"><secline lineno="100">Section 4. Disclosures and warnings -- Receipt requirements.</bold></catline><subsection ssid="26-1" dnum="_-o:1-i" numlevel="1" lineno="102" slineno="4-3" ea="amend" anum="0" owner="ahaskell" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1019" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="5" style="1" owner="ahaskell" level="1" amendtag="end">A virtual currency kiosk operator shall disclose in a clear, conspicuous, and easily <ln numlevel="1" lineno="103" slineno="4-4"/>readable manner in the chosen language of the customer, all relevant terms and <ln numlevel="1" lineno="104" slineno="4-5"/>conditions generally associated with the products, services, and activities of the virtual <ln numlevel="1" lineno="105" slineno="4-6"/>currency kiosk operator and virtual currency.</amend></subsection><subsection ssid="26-2" dnum="_-o:2-i" numlevel="1" lineno="106" slineno="4-7" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1020" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="9" style="1" owner="ahaskell" level="1" amendtag="end">The virtual currency kiosk operator shall receive acknowledgment of receipt of all <ln numlevel="1" lineno="107" slineno="4-8"/>disclosures required under this section via confirmation of consent.</amend></subsection><subsection ssid="26-3" dnum="_-o:3-i" numlevel="1" lineno="108" slineno="4-9" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1021" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="13" style="1" owner="ahaskell" level="1" amendtag="end">Each virtual currency kiosk shall include a fraud prevention warning in English and <ln numlevel="1" lineno="109" slineno="4-10"/>Spanish, written prominently and in bold type.</amend></subsection><subsection ssid="26-4" dnum="_-o:4-i" numlevel="1" lineno="110" slineno="4-11" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1022" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="22" groupid="17" style="1" owner="ahaskell" level="1" amendtag="end">The fraud prevention warning described in Subsection <xref depth="4" refnumber="7-29-204(3)">(3)</xref> shall state in substantially the <ln numlevel="1" lineno="111" slineno="4-12"/>following form: "WARNING: CONSUMER FRAUD OFTEN STARTS WITH <ln numlevel="1" lineno="112" slineno="4-13"/>CONTACT FROM A STRANGER WHO IS INITIATING A DISHONEST SCHEME <ln numlevel="1" lineno="113" slineno="4-14"/>THAT FREQUENTLY TARGETS VULNERABLE POPULATIONS, INCLUDING <ln numlevel="1" lineno="114" slineno="4-15"/>THE ELDERLY. IF YOU BELIEVE YOU ARE BEING SCAMMED, CALL A <ln numlevel="1" lineno="115" slineno="4-16"/>LOCAL LAW ENFORCEMENT OFFICER BEFORE ANY TRANSACTION. <ln numlevel="1" lineno="116" slineno="4-17"/>TRANSACTIONS CONDUCTED ON THIS VIRTUAL CURRENCY KIOSK ARE <ln numlevel="1" lineno="117" slineno="4-18"/>IRREVERSIBLE. PROTECT YOURSELF FROM FRAUD. NEVER SEND MONEY <ln numlevel="1" lineno="118" slineno="4-19"/>TO SOMEONE YOU DO NOT KNOW."</amend></subsection><subsection ssid="26-10" dnum="_-o:5-i" numlevel="1" lineno="119" slineno="4-20" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1023" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="52" groupid="41" style="1" owner="ahaskell" level="1" amendtag="end">After the completion of each transaction, the virtual currency kiosk operator shall <ln numlevel="1" lineno="120" slineno="4-21"/>provide an individual with a choice of a physical or digital receipt in the language <ln numlevel="1" lineno="121" slineno="4-22"/>chosen by the customer.</amend></subsection><subsection ssid="26-11" dnum="_-o:6-i" numlevel="1" lineno="122" slineno="4-23" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1024" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="57" groupid="45" style="1" owner="ahaskell" level="1" amendtag="end">The receipt described in Subsection <xref depth="4" refnumber="7-29-204(5)">(5)</xref> shall contain:</amend><subsection ssid="26-12" dnum="_-o:a-i" numlevel="1" lineno="123" slineno="4-24" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1025" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="62" groupid="49" style="1" owner="ahaskell" level="1" amendtag="end">the virtual currency kiosk operator's name and contact information, including a <ln numlevel="1" lineno="124" slineno="4-25"/>telephone number to answer questions and register complaints;</amend></subsection><subsection ssid="26-13" dnum="_-o:b-i" numlevel="1" lineno="125" slineno="4-26" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1026" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="67" groupid="53" style="1" owner="ahaskell" level="1" amendtag="end">the relevant state and local law enforcement or government agency for reporting <ln numlevel="1" lineno="126" slineno="4-27"/>fraud;</amend></subsection><subsection ssid="26-15" dnum="_-o:c-i" numlevel="1" lineno="127" slineno="4-28" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1027" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="77" groupid="61" style="1" owner="ahaskell" level="1" amendtag="end">the type, value, date, and precise time of the transaction;</amend></subsection><subsection ssid="26-14" dnum="_-o:d-i" numlevel="1" lineno="128" slineno="4-29" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1028" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="72" groupid="57" style="1" owner="ahaskell" level="1" amendtag="end">the transaction hash;</amend></subsection><subsection ssid="26-16" dnum="_-o:e-i" numlevel="1" lineno="129" slineno="4-30" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1029" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="82" groupid="65" style="1" owner="ahaskell" level="1" amendtag="end">each applicable virtual currency address;</amend></subsection><subsection ssid="26-17" dnum="_-o:f-i" numlevel="1" lineno="130" slineno="4-31" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1030" style="1" owner="i" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="87" groupid="69" style="1" owner="ahaskell" level="1" amendtag="end">the transaction amount in both virtual currency and United States dollars;</amend></subsection><subsection ssid="26-18" dnum="_-o:g-i" numlevel="1" lineno="131" slineno="4-32" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1031" style="1" owner="i" level="1" amendtag="start">(g)</amend></display><amend anum="0" ea="amend" pairid="92" groupid="73" style="1" owner="ahaskell" level="1" amendtag="end">all fees charged;</amend></subsection><subsection ssid="26-19" dnum="_-o:h-i" numlevel="1" lineno="132" slineno="4-33" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" exchange rate of the virtual currency to United States dollars;</amend></subsection><subsection ssid="26-20" dnum="_-o:i-i" numlevel="1" lineno="133" slineno="4-34" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1033" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="102" groupid="81" style="1" owner="ahaskell" level="1" amendtag="end">customer service contact information;</amend></subsection><subsection ssid="26-21" dnum="_-o:j-i" numlevel="1" lineno="134" slineno="4-35" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1034" style="1" owner="i" level="1" amendtag="start">(j)</amend></display><amend anum="0" ea="amend" pairid="107" groupid="85" style="1" owner="ahaskell" level="1" amendtag="end">the virtual currency kiosk operator's license information; and</amend></subsection><subsection ssid="26-22" dnum="_-o:k-i" numlevel="1" lineno="135" slineno="4-36" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1035" style="1" owner="i" level="1" amendtag="start">(k)</amend></display><amend anum="0" ea="amend" pairid="112" groupid="89" style="1" owner="ahaskell" level="1" amendtag="end">a statement of the virtual currency kiosk operator's refund policy.</amend></subsection></subsection><subsection ssid="26-24" dnum="_-o:7-i" numlevel="1" lineno="136" slineno="4-37" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1036" style="1" owner="i" level="1" amendtag="start">(7)</amend></display><amend anum="0" ea="amend" pairid="129" groupid="102" style="1" owner="ahaskell" level="1" amendtag="end">A virtual currency kiosk operator performing business in this state shall provide a <ln numlevel="1" lineno="137" slineno="4-38"/>toll-free customer service line, available 24 hours per day, seven days per week, and <ln numlevel="1" lineno="138" slineno="4-39"/>display the number for the toll-free customer service line on the virtual currency kiosk or <ln numlevel="1" lineno="139" slineno="4-40"/>the virtual currency kiosk screens.</amend></subsection></section></bsec><bsec buid="27" num="7-29-205" type="enact" src="code" uid="C7-29-S205_2026050620260506" sort="07 29 02050020260506" numlevel="1" lineno="140" slineno="5-1" sn="5"><section numlevel="1" lineno="141" slineno="5-2" number="7-29-205" type="enact"><secline lineno="140">Section 5. Section <bold>7-29-205</bold> is enacted to read:</secline><catline lineno="141"><bold>7-29-205<parens/>. Enforcement.</bold></catline><subsection ssid="27-3" dnum="_-o:1-i" numlevel="1" lineno="142" slineno="5-3" ea="amend" anum="0" owner="ahaskell" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1037" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="20" style="1" owner="ahaskell" level="1" amendtag="end">Subject to Title 63G, Chapter 4, Administrative Procedures Act, if the commissioner <ln numlevel="1" lineno="143" slineno="5-4"/>determines that a person is violating this part, the commissioner may:</amend><subsection ssid="27-7" dnum="_-o:a-i" numlevel="1" lineno="144" slineno="5-5" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1038" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="31" groupid="24" style="1" owner="ahaskell" level="1" amendtag="end">suspend, revoke, or refuse to renew the person's license under Title 7, Chapter 25, <ln numlevel="1" lineno="145" slineno="5-6"/>Money Transmitter Act;</amend></subsection><subsection ssid="27-8" dnum="_-o:b-i" numlevel="1" lineno="146" slineno="5-7" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1039" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="36" groupid="28" style="1" owner="ahaskell" level="1" amendtag="end">issue a cease and desist order;</amend></subsection><subsection ssid="27-9" dnum="_-o:c-i" numlevel="1" lineno="147" slineno="5-8" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1040" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="41" groupid="32" style="1" owner="ahaskell" level="1" amendtag="end">prohibit the person from operating a virtual currency kiosk in this state;</amend></subsection><subsection ssid="27-10" dnum="_-o:d-i" numlevel="1" lineno="148" slineno="5-9" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1041" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="46" groupid="36" style="1" owner="ahaskell" level="1" amendtag="end">impose an administrative fine not to exceed $1,000 per violation, except that the <ln numlevel="1" lineno="149" slineno="5-10"/>aggregate total of fines imposed under this part against a person in a calendar year <ln numlevel="1" lineno="150" slineno="5-11"/>may not exceed $30,000 for that calendar year; or</amend></subsection><subsection ssid="27-11" dnum="_-o:e-i" numlevel="1" lineno="151" slineno="5-12" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1042" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="51" groupid="40" style="1" owner="ahaskell" level="1" amendtag="end">take any combination of actions listed in this Subsection <xref depth="4" refnumber="7-29-205(1)">(1)</xref>.</amend></subsection></subsection><subsection ssid="27-12" dnum="_-o:2-i" numlevel="1" lineno="152" slineno="5-13" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1043" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="56" groupid="44" style="1" owner="ahaskell" level="1" amendtag="end">A violation of this part constitutes a deceptive act or practice under Title 13, Chapter 11, <ln numlevel="1" lineno="153" slineno="5-14"/>Utah Consumer Sales Practices Act.</amend></subsection><subsection ssid="27-13" dnum="_-o:3-i" numlevel="1" lineno="154" slineno="5-15" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1044" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="61" groupid="48" style="1" owner="ahaskell" level="1" amendtag="end">The attorney general may bring a civil action for injunctive relief to enforce this part.</amend></subsection></section></bsec><bsec buid="9" num="53-6-102" type="amend" src="code" uid="C53-6-S102_2026050620260506" sort="53 06 01020020260506" numlevel="1" lineno="155" slineno="6-1" sn="6"><section number="53-6-102" numlevel="1" lineno="156" slineno="6-2" type="amend"><secline lineno="155">Section 6. Section <bold>53-6-102</bold> is amended to read:</secline><catline lineno="156"><bold>53-6-102<parens/>. Definitions.</bold></catline><sectionText lineno="157"><tab/>As used in this chapter:</sectionText><subsection ssid="9-null-1" dnum="1-o" numlevel="1" lineno="158" slineno="6-4" level="1"><display>(1)</display>"Addiction" means the unlawful or habitual use of alcohol or a controlled substance <ln numlevel="1" lineno="159" slineno="6-5"/>which endangers public health and safety.</subsection><subsection ssid="9-null-2" dnum="2-o" numlevel="1" lineno="160" slineno="6-6" level="1"><display>(2)</display>"Certified academy" means a peace officer training institution certified in accordance <ln numlevel="1" lineno="161" slineno="6-7"/>with the standards developed under Section <xref depth="3" refid="C53-6-S105_1800010118000101" refnumber="53-6-105" start="0">53-6-105</xref>.</subsection><subsection ssid="9-null-3" dnum="3-o" numlevel="1" lineno="162" slineno="6-8" level="1"><display>(3)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="20" groupid="15" style="2" owner="ahaskell" level="1" deltag="both">"Council" means the Peace Officer Standards and Training Council created in Section <xref depth="3" refid="C53-6-S106_1800010118000101" refnumber="53-6-106" start="0"><ln numlevel="1" lineno="163" slineno="6-9"/>53-6-106</xref>.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="19" groupid="14" style="1" owner="ahaskell" level="1" amendtag="both" space="true">"Commission" means the State Commission on Criminal and Juvenile Justice <ln numlevel="1" lineno="164" slineno="6-10"/>created in Section <xref depth="3" refnumber="63M-7-201">63M-7-201</xref>.</amend></subsection><subsection ssid="9-null-4" dnum="4-o" numlevel="1" lineno="165" slineno="6-11" level="1"><display>(4)</display>"Conviction" means an adjudication of guilt regarding criminal conduct, including:<subsection ssid="9-null-5" dnum="a-o" numlevel="1" lineno="166" slineno="6-12" level="2"><display>(a)</display>a finding of guilt by a court or a jury;</subsection><subsection ssid="9-null-6" dnum="b-o" numlevel="1" lineno="167" slineno="6-13" level="2"><display>(b)</display>a guilty plea;</subsection><subsection ssid="9-null-7" dnum="c-o" numlevel="1" lineno="168" slineno="6-14" level="2"><display>(c)</display>a plea of nolo contendere;</subsection><subsection ssid="9-null-8" dnum="d-o" numlevel="1" lineno="169" slineno="6-15" level="2"><display>(d)</display>a plea which is held in abeyance pending the successful completion of:<subsection ssid="9-null-9" dnum="i-o" numlevel="1" lineno="170" slineno="6-16" level="3"><display>(i)</display>a probationary period; or</subsection><subsection ssid="9-null-10" dnum="ii-o" numlevel="1" lineno="171" slineno="6-17" level="3"><display>(ii)</display>a diversion agreement; or</subsection></subsection><subsection ssid="9-null-11" dnum="e-o" numlevel="1" lineno="172" slineno="6-18" level="2"><display>(e)</display>a conviction which has been expunged or dismissed.</subsection></subsection><subsection ssid="9-26" dnum="_-o:5-i" numlevel="1" lineno="173" slineno="6-19" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1056" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="28" groupid="20" style="1" owner="ahaskell" level="1" amendtag="end">"Council" means the Peace Officer Standards and Training Council created in Section <xref depth="3" refnumber="53-6-106"><ln numlevel="1" lineno="174" slineno="6-20"/>53-6-106</xref>.</amend></subsection><subsection ssid="9-21" dnum="_-o:6-i" numlevel="1" lineno="175" slineno="6-21" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1057" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="ahaskell" level="1" amendtag="end">"Cryptocurrency" means a digital asset that functions as a medium of exchange, a unit <ln numlevel="1" lineno="176" slineno="6-22"/>of account, or a store of value, and is secured by cryptography.</amend></subsection><subsection ssid="9-22" dnum="_-o:7-i" numlevel="1" lineno="177" slineno="6-23" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1058" style="1" owner="i" level="1" amendtag="start">(7)</amend></display><amend anum="0" ea="amend" pairid="9" groupid="7" style="1" owner="ahaskell" level="1" amendtag="end">"Cryptocurrency investigation" means a law enforcement investigation involving the <ln numlevel="1" lineno="178" slineno="6-24"/>tracing, analysis, or recovery of cryptocurrency or digital assets.</amend></subsection><subsection ssid="9-23" dnum="_-o:8-i" numlevel="1" lineno="179" slineno="6-25" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1059" style="1" owner="i" level="1" amendtag="start">(8)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="9" style="1" owner="ahaskell" level="1" amendtag="end">"Digital asset" means the same as that term is defined in Section <xref depth="3" refnumber="13-62-101">13-62-101</xref>.</amend></subsection><subsection ssid="9-null-12" dnum="5-o:9-i" numlevel="1" lineno="180" slineno="6-26" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1060" style="2" owner="o" level="1" deltag="both">(5)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1061" style="1" owner="i" level="1" amendtag="both" space="true">(9)</amend></display>"Director" means the director of the Peace Officer Standards and Training Division <ln numlevel="1" lineno="181" slineno="6-27"/>appointed under Section <xref depth="3" refid="C53-6-S104_1800010118000101" refnumber="53-6-104" start="0">53-6-104</xref>.</subsection><subsection ssid="9-null-13" dnum="6-o:10-i" numlevel="1" lineno="182" slineno="6-28" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1061" style="2" owner="o" level="1" deltag="both">(6)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1062" style="1" owner="i" level="1" amendtag="both" space="true">(10)</amend></display>"Dispatcher" means an employee of a public safety agency of the state or any of <ln numlevel="1" lineno="183" slineno="6-29"/>its political subdivisions and whose primary duties are to:<subsection ssid="9-null-14" dnum="a-o" numlevel="1" lineno="184" slineno="6-30" level="2" space="false"><display>(a)</display><subsection ssid="9-null-15" dnum="i-o" level="3" placement="sameline"><display>(i)</display>receive calls for one or a combination of, emergency police, fire, and medical <ln numlevel="1" lineno="185" slineno="6-31"/>services, and to dispatch the appropriate personnel and equipment in response to <ln numlevel="1" lineno="186" slineno="6-32"/>the calls; and</subsection><subsection ssid="9-null-16" dnum="ii-o" numlevel="1" lineno="187" slineno="6-33" level="3"><display>(ii)</display>in response to emergency calls, make urgent decisions affecting the life, health, <ln numlevel="1" lineno="188" slineno="6-34"/>and welfare of the public and public safety employees; ssid="7-null-1" dnum="1-o" numlevel="1" lineno="196" slineno="7-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="7-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The director shall:<subsection ssid="7-null-3" dnum="i-o" numlevel="1" lineno="197" slineno="7-5" level="3" tab="1" space="false"><display>(i)</display><subsection ssid="7-null-4" dnum="A-o" level="4" placement="sameline"><display>(A)</display>suggest and prepare subject material; and</subsection><subsection ssid="7-null-5" dnum="B-o" numlevel="1" lineno="198" slineno="7-6" level="4"><display>(B)</display>schedule instructors for basic training courses; or</subsection></subsection><subsection ssid="7-null-6" dnum="ii-o" numlevel="1" lineno="199" slineno="7-7" level="3" tab="1"><display>(ii)</display>review the material and instructor choices submitted by a certified academy.</subsection></subsection><subsection ssid="7-null-7" dnum="b-o" numlevel="1" lineno="200" slineno="7-8" level="2"><display>(b)</display>The subject material, instructors, and schedules shall be approved or disapproved by <ln numlevel="1" lineno="201" slineno="7-9"/>a majority vote of the council.</subsection></subsection><subsection ssid="7-null-8" dnum="2-o" numlevel="1" lineno="202" slineno="7-10" level="1"><display>(2)</display>The materials shall be reviewed and approved by the council on or before July 1st of <ln numlevel="1" lineno="203" slineno="7-11"/>each year and may from time to time be changed or amended by majority vote of the <ln numlevel="1" lineno="204" slineno="7-12"/>council.</subsection><subsection ssid="7-null-9" dnum="3-o" numlevel="1" lineno="205" slineno="7-13" level="1"><display>(3)</display>The basic training in a certified academy:<subsection ssid="7-null-10" dnum="a-o" numlevel="1" lineno="206" slineno="7-14" level="2"><display>(a)</display>shall be appropriate for the basic training of peace officers in the techniques of law <ln numlevel="1" lineno="207" slineno="7-15"/>enforcement in the discretion of the director; </subsection><subsection ssid="7-null-11" dnum="b-o" numlevel="1" lineno="208" slineno="7-16" level="2"><display>(b)</display>may not include the use of chokeholds, carotid restraints, or any act that impedes the <ln numlevel="1" lineno="209" slineno="7-17"/>breathing or circulation of blood likely to produce a loss of consciousness, as a valid <ln numlevel="1" lineno="210" slineno="7-18"/>method of restraint; and</subsection><subsection ssid="7-null-12" dnum="c-o" numlevel="1" lineno="211" slineno="7-19" level="2"><display>(c)</display>shall include instruction on identifying, responding to, and reporting a criminal <ln numlevel="1" lineno="212" slineno="7-20"/>offense that is motivated by a personal attribute as that term is defined in Section <xref depth="3" refnumber="76-3-203.14"><ln numlevel="1" lineno="213" slineno="7-21"/>76-3-203.14</xref>.</subsection></subsection><subsection ssid="7-null-13" dnum="4-o" numlevel="1" lineno="214" slineno="7-22" level="1" space="false"><display>(4)</display><subsection ssid="7-null-14" dnum="a-o" level="2" placement="sameline"><display>(a)</display>All peace officers shall satisfactorily complete the basic training course or the <ln numlevel="1" lineno="215" slineno="7-23"/>waiver process provided for in this chapter as well as annual certified training of not <ln numlevel="1" lineno="216" slineno="7-24"/>less than 40 hours as the director, with the advice and consent of the council, directs.</subsection><subsection ssid="7-null-15" dnum="b-o" numlevel="1" lineno="217" slineno="7-25" level="2"><display>(b)</display>A peace officer who fails to satisfactorily complete the annual training described in <ln numlevel="1" lineno="218" slineno="7-26"/>Subsection <xref depth="4" refnumber="53-6-202(4)(a)">(4)(a)</xref> shall automatically be prohibited from exercising peace officer <ln numlevel="1" lineno="219" slineno="7-27"/>powers until any deficiency is made up.</subsection><subsection ssid="7-null-16" dnum="c-o" numlevel="1" lineno="220" slineno="7-28" level="2"><display>(c)</display>The annual training described in Subsection <xref depth="4" refnumber="53-6-202(4)(a)">(4)(a)</xref> shall include training focused on <ln numlevel="1" lineno="221" slineno="7-29"/>arrest control and de-escalation training.</subsection></subsection><subsection ssid="7-null-17" dnum="5-o" numlevel="1" lineno="222" slineno="7-30" level="1" space="false"><display>(5)</display><subsection ssid="7-null-18" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Beginning July 1, 2024, all peace officers who are currently employed shall <ln numlevel="1" lineno="223" slineno="7-31"/>participate in a training at least every three years focused on the following:<subsection ssid="7-null-19" dnum="i-o" numlevel="1" lineno="224" slineno="7-32" level="3" tab="1"><display>(i)</display>mental health and other crisis intervention responses;</subsection><subsection ssid="7-null-20" dnum="ii-o" numlevel="1" lineno="225" slineno="7-33" level="3" tab="1"><display>(ii)</display>intervention responses for mental illnesses, autism spectrum disorder, and other <ln numlevel="1" lineno="226" slineno="7-34"/>neurological and developmental disorders; and</subsection><subsection ssid="7-null-21" dnum="iii-o" numlevel="1" lineno="227" slineno="7-35" level="3" tab="1"><display>(iii)</display>responses to sexual traumas and investigations of sexual assault and sexual abuse <ln numlevel="1" lineno="228" slineno="7-36"/>in accordance with Section <xref depth="3" refnumber="53-10-908">53-10-908</xref>.</subsection></subsection><subsection ssid="7-null-22" dnum="b-o" numlevel="1" lineno="229" slineno="7-37" level="2"><display>(b)</display>Any training in which a peace officer participates as described in Subsection <xref depth="4" refnumber="53-6-202(5)(a)">(5)(a)</xref> <ln numlevel="1" lineno="230" slineno="7-38"/>shall count toward the peace officer's 40-hour required annual training described in <ln numlevel="1" lineno="231" slineno="7-39"/>Subsection <xref depth="4" refnumber="53-6-202(4)(a)">(4)(a)</xref> for the year in which the peace officer participated in the training.</subsection></subsection><subsection ssid="7-null-23" dnum="6-o" numlevel="1" lineno="232" slineno="7-40" level="1" space="false"><display>(6)</display><subsection ssid="7-null-24" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The director or the director's designee, in coordination with the council, shall <ln numlevel="1" lineno="233" slineno="7-41"/>promulgate the standards for the trainings described in Subsection <xref depth="4" refnumber="53-6-202(4)">(4)</xref>.</subsection><subsection ssid="7-null-25" dnum="b-o" numlevel="1" lineno="234" slineno="7-42" level="2"><display>(b)</display>The chief law enforcement officer or executive officer of the peace officer's <ln numlevel="1" lineno="235" slineno="7-43"/>employing agency shall determine if a peace officer has complied with the standards <ln numlevel="1" lineno="236" slineno="7-44"/>established under Subsection <xref depth="4" refnumber="53-6-202(6)(a)">(6)(a)</xref>.</subsection></subsection><subsection ssid="7-26" dnum="_-o:7-i" numlevel="1" lineno="237" slineno="7-45" ea="amend" anum="0" owner="ahaskell" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1093" style="1" owner="i" level="1" amendtag="start">(7)</amend></display><subsection ssid="7-27" dnum="_-o:a-i" ea="amend" anum="0" owner="ahaskell" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1094" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="80" groupid="62" style="1" owner="ahaskell" level="1" amendtag="end">Beginning July 1, 2026, each local law enforcement agency shall ensure that at <ln numlevel="1" lineno="238" slineno="7-46"/>least one peace officer employed by the agency completes specialized cryptocurrency <ln numlevel="1" lineno="239" slineno="7-47"/>investigation training at least once every three years, focused on:</amend><subsection ssid="7-50" dnum="_-o:i-i" numlevel="1" lineno="240" slineno="7-48" ea="amend" anum="0" owner="ahaskell" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1095" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="115" groupid="90" style="1" owner="ahaskell" level="1" amendtag="end">advanced cryptocurrency tracing and blockchain analysis techniques;</amend></subsection><subsection ssid="7-51" dnum="_-o:ii-i" numlevel="1" lineno="241" slineno="7-49" ea="amend" anum="0" owner="ahaskell" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1096" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="120" groupid="94" style="1" owner="ahaskell" level="1" amendtag="end">digital asset seizure procedures and evidence preservation;</amend></subsection><subsection ssid="7-52" dnum="_-o:iii-i" numlevel="1" lineno="242" slineno="7-50" ea="amend" anum="0" owner="ahaskell" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1097" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="125" groupid="98" style="1" owner="ahaskell" level="1" amendtag="end">use of cryptocurrency investigation tools and software;</amend></subsection><subsection ssid="7-53" dnum="_-o:iv-i" numlevel="1" lineno="243" slineno="7-51" ea="amend" anum="0" owner="ahaskell" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1098" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="130" groupid="102" style="1" owner="ahaskell" level="1" amendtag="end">legal requirements for cryptocurrency search warrants and subpoenas;</amend></subsection><subsection ssid="7-54" dnum="_-o:v-i" numlevel="1" lineno="244" slineno="7-52" ea="amend" anum="0" owner="ahaskell" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1099" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="135" groupid="106" style="1" owner="ahaskell" level="1" amendtag="end">coordination with federal agencies and cryptocurrency exchanges; and</amend></subsection><subsection ssid="7-55" dnum="_-o:vi-i" numlevel="1" lineno="245" slineno="7-53" ea="amend" anum="0" owner="ahaskell" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1100" style="1" owner="i" level="1" amendtag="start">(vi)</amend></display><amend anum="0" ea="amend" pairid="140" groupid="110" style="1" owner="ahaskell" level="1" Training requirements.</bold></catline><subsection ssid="32-null-1" dnum="1-o" numlevel="1" lineno="384" slineno="11-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="32-null-2" dnum="a-o" numlevel="1" lineno="385" slineno="11-4" level="2"><display>(a)</display>"Council" means the Utah Prosecution Council created in Section <xref depth="3" refnumber="67-5a-1" start="0">67-5a-1</xref>.</subsection><subsection ssid="32-18" dnum="_-o:b-i" numlevel="1" lineno="386" slineno="11-5" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1175" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="ahaskell" level="1" amendtag="end">"Digital asset" means the same as that term is defined in Section <xref depth="3" refnumber="13-62-101">13-62-101</xref>.</amend></subsection><subsection ssid="32-null-3" dnum="b-o:c-i" numlevel="1" lineno="387" slineno="11-6" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1176" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1177" style="1" owner="i" level="1" amendtag="both" space="true">(c)</amend></display>"Division" means the Peace Officers Standards and Training Division created in <ln numlevel="1" lineno="388" slineno="11-7"/>Section <xref depth="3" refnumber="53-6-103" start="0">53-6-103</xref>.</subsection></subsection><subsection ssid="32-null-4" dnum="2-o" numlevel="1" lineno="389" slineno="11-8" level="1"><display>(2)</display>To participate in the program, an agency shall have at least one employee who is <ln numlevel="1" lineno="390" slineno="11-9"/>certified by the division as an asset forfeiture specialist through the completion of an <ln numlevel="1" lineno="391" slineno="11-10"/>online asset forfeiture course by the division.</subsection><subsection ssid="32-null-5" dnum="3-o" numlevel="1" lineno="392" slineno="11-11" level="1"><display>(3)</display>The division shall:<subsection ssid="32-null-6" dnum="a-o" numlevel="1" lineno="393" slineno="11-12" level="2"><display>(a)</display>develop an online asset forfeiture specialist course that is available to an agency for <ln numlevel="1" lineno="394" slineno="11-13"/>certification purposes;</subsection><subsection ssid="32-null-7" dnum="b-o" numlevel="1" lineno="395" slineno="11-14" level="2"><display>(b)</display>certify an employee of an agency who meets the course requirements to be an asset <ln numlevel="1" lineno="396" slineno="11-15"/>forfeiture specialist;</subsection><subsection ssid="32-null-8" dnum="c-o" numlevel="1" lineno="397" slineno="11-16" level="2"><display>(c)</display>recertify, every 36 months, an employee who is designated as an asset forfeiture <ln numlevel="1" lineno="398" slineno="11-17"/>specialist by an agency;</subsection><subsection ssid="32-null-9" dnum="d-o" numlevel="1" lineno="399" slineno="11-18" level="2"><display>(d)</display>submit annually a report to the commission no later than April 30 that contains a list <ln numlevel="1" lineno="400" slineno="11-19"/>of the names of the employees and agencies participating in the certification courses;</subsection><subsection ssid="32-null-10" dnum="e-o" numlevel="1" lineno="401" slineno="11-20" level="2"><display>(e)</display>review and update the asset forfeiture specialist course each year to comply with <ln numlevel="1" lineno="402" slineno="11-21"/>state and federal law; and</subsection><subsection ssid="32-null-11" dnum="f-o" numlevel="1" lineno="403" slineno="11-22" level="2"><display>(f)</display>provide asset forfeiture training to all peace officers in basic training programs.</subsection></subsection><subsection ssid="32-null-12" dnum="4-o" numlevel="1" lineno="404" slineno="11-23" level="1"><display>(4)</display>To be reimbursed for costs under Subsection <xref depth="4" refnumber="77-11b-401(3)(b)" start="0">77-11b-401(3)(b)</xref>, a prosecuting agency <ln numlevel="1" lineno="405" slineno="11-24"/>shall have at least one employee who is certified by the council as an asset forfeiture <ln numlevel="1" lineno="406" slineno="11-25"/>specialist through the completion of an online asset forfeiture course.</subsection><subsection ssid="32-null-13" dnum="5-o" numlevel="1" lineno="407" slineno="11-26" level="1"><display>(5)</display>The council shall:<subsection ssid="32-null-14" dnum="a-o" numlevel="1" lineno="408" slineno="11-27" level="2"><display>(a)</display>develop an online asset forfeiture specialist course that is available to a prosecuting <ln numlevel="1" lineno="409" slineno="11-28"/>agency for certification purposes;</subsection><subsection ssid="32-20" dnum="_-o:b-i" numlevel="1" lineno="410" slineno="11-29" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1188" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="9" style="1" owner="ahaskell" level="1" amendtag="end">develop a digital asset specialist course that is available to a prosecuting agency for <ln numlevel="1" lineno="411" slineno="11-30"/>certification purposes;</amend></subsection><subsection ssid="32-null-15" dnum="b-o:c-i" numlevel="1" lineno="412" slineno="11-31" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1189" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1190" style="1" owner="i" level="1" amendtag="both" space="true">(c)</amend></display>certify an employee of a prosecuting agency who meets the course requirements <ln numlevel="1" lineno="413" slineno="11-32"/>to be an asset forfeiture specialist<amend anum="0" ea="amend" pairid="16" groupid="13" style="1" owner="ahaskell" level="1" amendtag="both"> or a digital asset specialist</amend>;</subsection><subsection ssid="32-null-16" dnum="c-o:d-i" numlevel="1" lineno="414" slineno="11-33" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1190" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1191" style="1" owner="i" level="1" amendtag="both" space="true">(d)</amend></display>submit annually a report to the commission no later than April 30 that contains a <ln numlevel="1" lineno="415" slineno="11-34"/>list of the names of the employees and prosecuting agencies participating in <ln numlevel="1" lineno="416" slineno="11-35"/>certification courses by the council;
