and</hl><hl numlevel="1" lineno="11" slineno="0-11" level="2"> a pharmacist or pharmacy intern to dispense ivermectin pursuant to a standard <ln numlevel="1" lineno="12" slineno="0-12"/>prescription drug order, without a patient-specific prescription;</hl></hl><hl numlevel="1" lineno="13" slineno="0-13" level="1">limits liability for:<hl numlevel="1" lineno="14" slineno="0-14" level="2"> a physician who issues a standard prescription drug order for ivermectin; Section <bold>26B-4-501</bold> is amended to read:</secline><catline lineno="38"><bold>26B-4-501<parens/>. Definitions.</bold></catline><sectionText lineno="39"><tab/>As used in this part:</sectionText><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="40" slineno="1-4" level="1"><display>(1)</display>"Controlled substance" means the same as that term is defined in Title 58, Chapter 37, <ln numlevel="1" lineno="41" slineno="1-5"/>Utah Controlled Substances Act.</subsection><subsection ssid="3-null-2" dnum="2-o" numlevel="1" lineno="42" slineno="1-6" level="1"><display>(2)</display>"Critical access hospital" means a critical access hospital that meets the criteria of 42 <ln numlevel="1" lineno="43" slineno="1-7"/>U.S.C. Sec. 1395i-4(c)(2).</subsection><subsection ssid="3-null-3" dnum="3-o" numlevel="1" lineno="44" slineno="1-8" level="1"><display>(3)</display>"Designated facility" means:<subsection ssid="3-null-4" dnum="a-o" numlevel="1" lineno="45" slineno="1-9" level="2"><display>(a)</display>a freestanding urgent care center;</subsection><subsection ssid="3-null-5" dnum="b-o" numlevel="1" lineno="46" slineno="1-10" level="2"><display>(b)</display>a general acute hospital; or</subsection><subsection ssid="3-null-6" dnum="c-o" numlevel="1" lineno="47" slineno="1-11" level="2"><display>(c)</display>a critical access hospital.</subsection></subsection><subsection ssid="3-null-7" dnum="4-o" numlevel="1" lineno="48" slineno="1-12" level="1"><display>(4)</display>"Dispense" means the same as that term is defined in Section <xref depth="3" refnumber="58-17b-102">58-17b-102</xref>.</subsection><subsection ssid="3-null-8" dnum="5-o" numlevel="1" lineno="49" slineno="1-13" level="1"><display>(5)</display>"Division" means the Division of Professional Licensing created in Section <xref depth="3" refnumber="58-1-103">58-1-103</xref>.</subsection><subsection ssid="3-null-9" dnum="6-o" numlevel="1" lineno="50" slineno="1-14" level="1"><display>(6)</display>"Emergency contraception" means the use of a substance, approved by the United States <ln numlevel="1" lineno="51" slineno="1-15"/>Food and Drug Administration, to prevent pregnancy after sexual intercourse.</subsection><subsection ssid="3-null-10" dnum="7-o" numlevel="1" lineno="52" slineno="1-16" level="1"><display>(7)</display>"Freestanding urgent care center" means the same as that term is defined in Section <xref depth="3" refnumber="59-12-801"><ln numlevel="1" lineno="53" slineno="1-17"/>59-12-801</xref>.</subsection><subsection ssid="3-null-11" dnum="8-o" numlevel="1" lineno="54" slineno="1-18" level="1"><display>(8)</display>"General acute hospital" means the same as that term is defined in Section <xref depth="3" refnumber="26B-2-201">26B-2-201</xref>.</subsection><subsection ssid="3-null-12" dnum="9-o" numlevel="1" lineno="55" slineno="1-19" level="1"><display>(9)</display>"Health care facility" means a hospital, a hospice inpatient residence, a nursing facility, <ln numlevel="1" lineno="56" slineno="1-20"/>a dialysis treatment facility, an assisted living residence, an entity that provides home- <ln numlevel="1" lineno="57" slineno="1-21"/>and community-based services, a hospice or home health care agency, or another facility <ln numlevel="1" lineno="58" slineno="1-22"/>that provides or contracts to provide health care services, which facility is licensed under <ln numlevel="1" lineno="59" slineno="1-23"/>Chapter 2, Part 2, Health Care Facility Licensing and Inspection.</subsection><subsection ssid="3-null-13" dnum="10-o" numlevel="1" lineno="60" slineno="1-24" level="1"><display>(10)</display>"Health care provider" means:<subsection ssid="3-null-14" dnum="a-o" numlevel="1" lineno="61" slineno="1-25" level="2"><display>(a)</display>a physician, as defined in Section <xref depth="3" refnumber="58-67-102">58-67-102</xref>;</subsection><subsection ssid="3-null-15" dnum="b-o" numlevel="1" lineno="62" slineno="1-26" level="2"><display>(b)</display>an advanced practice registered nurse, as defined in Section <xref depth="3" refnumber="58-31b-102">58-31b-102</xref>;</subsection><subsection ssid="3-null-16" dnum="c-o" numlevel="1" lineno="63" slineno="1-27" level="2"><display>(c)</display>a physician assistant, as defined in Section <xref depth="3" refnumber="58-70a-102">58-70a-102</xref>; or</subsection><subsection ssid="3-null-17" dnum="d-o" numlevel="1" lineno="64" slineno="1-28" level="2"><display>(d)</display>an individual licensed to engage in the practice of dentistry, as defined in Section <xref depth="3" refnumber="58-69-102"><ln numlevel="1" lineno="65" slineno="1-29"/>58-69-102</xref>.</subsection></subsection><subsection ssid="3-null-18" dnum="11-o" numlevel="1" lineno="66" slineno="1-30" level="1"><display>(11)</display>"Increased risk" means risk exceeding the risk typically experienced by an individual <ln numlevel="1" lineno="67" slineno="1-31"/>who is not using, and is not likely to use, an opiate.</subsection><subsection ssid="3-58" dnum="_-o:12-i" numlevel="1" lineno="68" slineno="1-32" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="start">(12)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">"Ivermectin" means the prescription anti-parasitic drug approved by the United States <ln numlevel="1" lineno="69" slineno="1-33"/>Food and Drug Administration for use in humans.</amend></subsection><subsection ssid="3-null-19" dnum="12-o:13-i" numlevel="1" lineno="70" slineno="1-34" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1019" style="2" owner="o" level="1" deltag="both">(12)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1020" style="1" owner="i" level="1" amendtag="both" space="true">(13)</amend></display>"Opiate" means the same as that term is defined in Section <xref depth="3" refnumber="58-37-2">58-37-2</xref>.</subsection><subsection ssid="3-null-20" dnum="13-o:14-i" numlevel="1" lineno="71" slineno="1-35" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1020" style="2" owner="o" level="1" deltag="both">(13)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1021" style="1" owner="i" level="1" amendtag="both" space="true">(14)</amend></display>"Opiate antagonist" means naloxone hydrochloride or any similarly acting drug <ln numlevel="1" lineno="72" slineno="1-36"/>that is not a controlled substance and that is approved by the federal Food and Drug <ln numlevel="1" lineno="73" slineno="1-37"/>Administration for the diagnosis or treatment of an opiate-related drug overdose.</subsection><subsection ssid="3-null-21" dnum="14-o:15-i" numlevel="1" lineno="74" slineno="1-38" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1021" style="2" owner="o" level="1" deltag="both">(14)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1022" style="1" owner="i" level="1" amendtag="both" space="true">(15)</amend></display>"Opiate-related drug overdose event" means an acute condition, including a <ln numlevel="1" lineno="75" slineno="1-39"/>decreased level of consciousness or respiratory depression resulting from the <ln numlevel="1" lineno="76" slineno="1-40"/>consumption or use of a controlled substance, or another substance with which a <ln numlevel="1" lineno="77" slineno="1-41"/>controlled substance was combined, and that a person would reasonably believe to <ln numlevel="1" lineno="78" slineno="1-42"/>require medical assistance.</subsection><subsection ssid="3-null-22" dnum="15-o:16-i" numlevel="1" lineno="79" slineno="1-43" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1022" style="2" owner="o" level="1" deltag="both">(15)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1023" style="1" owner="i" level="1" amendtag="both" space="true">(16)</amend></display>"Overdose outreach provider" means:<subsection ssid="3-null-23" dnum="a-o" numlevel="1" lineno="80" slineno="1-44" level="2"><display>(a)</display>a law enforcement agency;</subsection><subsection ssid="3-null-24" dnum="b-o" numlevel="1" lineno="81" slineno="1-45" level="2"><display>(b)</display>a fire department;</subsection><subsection ssid="3-null-25" dnum="c-o" numlevel="1" lineno="82" slineno="1-46" level="2"><display>(c)</display>an emergency medical service provider, as defined in Section <xref depth="3" refnumber="53-2d-101">53-2d-101</xref>;</subsection><subsection ssid="3-null-26" dnum="d-o" numlevel="1" lineno="83" slineno="1-47" level="2"><display>(d)</display>emergency medical service personnel, as defined in Section <xref depth="3" refnumber="53-2d-101">53-2d-101</xref>;</subsection><subsection ssid="3-null-27" dnum="e-o" numlevel="1" lineno="84" slineno="1-48" level="2"><display>(e)</display>an organization providing treatment or recovery services for drug or alcohol use;</subsection><subsection ssid="3-null-28" dnum="f-o" numlevel="1" lineno="85" slineno="1-49" level="2"><display>(f)</display>an organization providing support services for an individual, or a family of an <ln numlevel="1" lineno="86" slineno="1-50"/>individual, with a substance use disorder;</subsection><subsection ssid="3-null-29" dnum="g-o" numlevel="1" lineno="87" slineno="1-51" level="2"><display>(g)</display>a certified peer support specialist, as defined in Section <xref depth="3" refnumber="26B-5-610">26B-5-610</xref>;</subsection><subsection ssid="3-null-30" dnum="h-o" numlevel="1" lineno="88" slineno="1-52" level="2"><display>(h)</display>an organization providing substance use or mental health services under contract <ln numlevel="1" lineno="89" slineno="1-53"/>with a local substance abuse authority, as defined in Section <xref depth="3" refnumber="26B-5-101">26B-5-101</xref>, or a local <ln numlevel="1" lineno="90" slineno="1-54"/>mental health authority, as defined in Section <xref depth="3" refnumber="26B-5-101">26B-5-101</xref>;</subsection><subsection ssid="3-null-31" dnum="i-o" numlevel="1" lineno="91" slineno="1-55" level="2"><display>(i)</display>an organization providing services to the homeless;</subsection><subsection ssid="3-null-32" dnum="j-o" numlevel="1" lineno="92" slineno="1-56" level="2"><display>(j)</display>a local health department;</subsection><subsection ssid="3-null-33" dnum="k-o" numlevel="1" lineno="93" slineno="1-57" level="2"><display>(k)</display>an individual licensed to practice under:<subsection ssid="3-null-34" dnum="i-o" numlevel="1" lineno="94" slineno="1-58" level="3"><display>(i)</display>Title 58, Chapter 17b, Pharmacy Practice Act;</subsection><subsection ssid="3-null-35" dnum="ii-o" numlevel="1" lineno="95" slineno="1-59" level="3"><display>(ii)</display>Title 58, Chapter 60, Part 2, Social Worker Licensing Act; or</subsection><subsection ssid="3-null-36" dnum="iii-o" numlevel="1" lineno="96" slineno="1-60" level="3"><display>(iii)</display>Title 58, Chapter 60, Part 5, Substance Use Disorder Counselor Act; or</subsection></subsection><subsection ssid="3-null-37" dnum="l-o" numlevel="1" lineno="97" slineno="1-61" level="2"><display>(l)</display>an individual.</subsection></subsection><subsection ssid="3-null-38" dnum="16-o:17-i" numlevel="1" lineno="98" slineno="1-62" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1038" style="2" owner="o" level="1" deltag="both">(16)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1039" style="1" owner="i" level="1" amendtag="both" space="true">(17)</amend></display>"Patient counseling" means the same as that term is defined in Section <xref depth="3" refnumber="58-17b-102"><ln numlevel="1" lineno="99" slineno="1-63"/>58-17b-102</xref>.</subsection><subsection ssid="3-null-39" dnum="17-o:18-i" numlevel="1" lineno="100" slineno="1-64" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1039" style="2" owner="o" level="1" deltag="both">(17)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1040" style="1" owner="i" level="1" amendtag="both" space="true">(18)</amend></display>"Pharmacist" means the same as that term is defined in Section <xref depth="3" refnumber="58-17b-102">58-17b-102</xref>.</subsection><subsection ssid="3-null-40" dnum="18-o:19-i" numlevel="1" lineno="101" slineno="1-65" level="1"><display><amendoutstart style="2"/><amend slineno="1-73"/>Administration to prevent pregnancy.</subsection><subsection ssid="3-null-48" dnum="b-o" numlevel="1" lineno="110" slineno="1-74" level="2"><display>(b)</display>"Self-administered hormonal contraceptive" includes an oral hormonal contraceptive, <ln numlevel="1" lineno="111" slineno="1-75"/>a hormonal vaginal ring, and a hormonal contraceptive patch.</subsection><subsection ssid="3-null-49" dnum="c-o" numlevel="1" lineno="112" slineno="1-76" level="2"><display>(c)</display>"Self-administered hormonal contraceptive" does not include any drug intended to <ln numlevel="1" lineno="113" slineno="1-77"/>induce an abortion, as that term is defined in Section <xref depth="3" refnumber="76-7-301">76-7-301</xref>.</subsection></subsection><subsection ssid="3-null-50" dnum="23-o:24-i" numlevel="1" lineno="114" slineno="1-78" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1050" style="2" owner="o" level="1" Section <bold>26B-4-517</bold> is enacted to read:</secline><catline lineno="128"><bold>26B-4-517<parens/>. Authorization to dispense ivermectin.</bold></catline><sectionText lineno="129"><para/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both">Notwithstanding Title 58, Chapter 17b, Pharmacy Practice Act, a person licensed under <ln numlevel="1" lineno="130" slineno="3-4"/>Title 58, Chapter 17b, Pharmacy Practice Act, to dispense ivermectin may dispense ivermectin:</amend></sectionText><subsection ssid="7-1" dnum="_-o:1-i" numlevel="1" lineno="131" slineno="3-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1058" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="end">to a patient who is 18 years old or older;</amend></subsection><subsection ssid="7-2" dnum="_-o:2-i" numlevel="1" lineno="132" slineno="3-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1059" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="end">pursuant to a standing prescription drug order issued in accordance with Section <xref depth="3" refnumber="26B-4-518"><ln numlevel="1" lineno="133" slineno="3-7"/>26B-4-518</xref>;</amend></subsection><subsection ssid="7-3" dnum="_-o:3-i" numlevel="1" lineno="134" slineno="3-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1060" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="10" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="end">without any other prescription drug order from a person licensed to prescribe <ln numlevel="1" lineno="135" slineno="3-9"/>ivermectin; and</amend></subsection><subsection ssid="7-4" dnum="_-o:4-i" numlevel="1" lineno="136" slineno="3-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1061" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="end">in accordance with the dispensing guidelines in Section <xref depth="3" refnumber="26B-4-519">26B-4-519</xref>.</amend></subsection></section></bsec><bsec buid="9" num="26B-4-518" type="enact" src="code" uid="C26B-4-S518_2026050620260506" sort="26B04 05180020260506" numlevel="1" lineno="137" slineno="4-1" sn="4"><section numlevel="1" lineno="138" slineno="4-2" number="26B-4-518" type="enact"><secline lineno="137">Section 4. Section <bold>26B-4-518</bold> is enacted to read:</secline><catline lineno="138"><bold>26B-4-518<parens/>. Standing prescription drug orders for ivermectin.</bold></catline><sectionText lineno="139"><para/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both">A physician who is licensed to prescribe ivermectin, including a physician acting in the <ln numlevel="1" lineno="140" slineno="4-4"/>physician's capacity as an employee of the department, or a medical director of a local health <ln numlevel="1" lineno="141" slineno="4-5"/>department, may issue a standing prescription drug order authorizing the dispensing of <ln numlevel="1" lineno="142" slineno="4-6"/>ivermectin under Section <xref depth="3" refnumber="26B-4-517">26B-4-517</xref> in accordance with protocol that:</amend></sectionText><subsection ssid="9-1" dnum="_-o:1-i" numlevel="1" lineno="143" slineno="4-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1062" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="13" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="end">requires the physician to specify the persons, by professional license number, authorized <ln numlevel="1" lineno="144" slineno="4-8"/>to dispense ivermectin;</amend></subsection><subsection ssid="9-2" dnum="_-o:2-i" numlevel="1" lineno="145" slineno="4-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1063" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="end">requires the physician to review at least annually the dispensing practices of those <ln numlevel="1" lineno="146" slineno="4-10"/>authorized by the physician to dispense ivermectin; and</amend></subsection><subsection ssid="9-3" dnum="_-o:3-i" numlevel="1" lineno="147" slineno="4-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1064" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="19" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="end">is approved by the Division of Professional Licensing within the Department of <ln numlevel="1" lineno="148" slineno="4-12"/>Commerce by administrative rule made in accordance with Title 63G, Chapter 3, Utah <ln numlevel="1" lineno="149" slineno="4-13"/>Administrative Rulemaking Act.</amend></subsection></section></bsec><bsec buid="10" num="26B-4-519" type="enact" src="code" uid="C26B-4-S519_2026050620260506" sort="26B04 05190020260506" numlevel="1" lineno="150" slineno="5-1" sn="5"><section numlevel="1" lineno="151" slineno="5-2" number="26B-4-519" type="enact"><secline lineno="150">Section 5. Guidelines for dispensing ivermectin.</bold></catline><subsection ssid="10-2" dnum="_-o:1-i" numlevel="1" lineno="152" slineno="5-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1065" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="79" groupid="55" style="1" owner="jchristopherson" level="1" amendtag="end">As used in this section:</amend><subsection ssid="10-14" dnum="_-o:a-i" numlevel="1" lineno="153" slineno="5-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1066" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="78" groupid="54" style="1" owner="jchristopherson" level="1" amendtag="end">"Board of Pharmacy" means the Utah State Board of Pharmacy created in Section <xref depth="3" refnumber="58-17b-201"><ln numlevel="1" lineno="154" slineno="5-5"/>58-17b-201</xref>.</amend></subsection><subsection ssid="10-15" dnum="_-o:b-i" numlevel="1" lineno="155" slineno="5-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1067" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="86" groupid="61" style="1" owner="jchristopherson" level="1" amendtag="end">"Medical Licensing Board" means the Medical Licensing Board created in Section <xref depth="3" refnumber="58-67-201"><ln numlevel="1" lineno="156" slineno="5-7"/>58-67-201</xref>.</amend></subsection></subsection><subsection ssid="10-13" dnum="_-o:2-i" numlevel="1" lineno="157" slineno="5-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1068" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="72" groupid="49" style="1" owner="jchristopherson" level="1" amendtag="end">Before a pharmacist or pharmacy intern dispenses ivermectin under Section <xref depth="3" refnumber="26B-4-517">26B-4-517</xref>, <ln numlevel="1" lineno="158" slineno="5-9"/>the pharmacist or pharmacy intern:</amend><subsection ssid="10-6" dnum="_-o:a-i" numlevel="1" lineno="159" slineno="5-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1069" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="31" groupid="23" style="1" owner="jchristopherson" level="1" amendtag="end">shall obtain from the patient a completed screening risk assessment questionnaire <ln numlevel="1" lineno="160" slineno="5-11"/>described in Subsection <xref tempid="565">(4)(a)</xref>; and</amend></subsection><subsection ssid="10-7" dnum="_-o:b-i" numlevel="1" lineno="161" slineno="5-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1070" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="36" groupid="27" style="1" owner="jchristopherson" level="1" amendtag="end">if the results of the screening risk assessment questionnaire described in Subsection <xref tempid="934"><ln numlevel="1" lineno="162" slineno="5-13"/>(2)(a)</xref> indicate that it is unsafe to dispense ivermectin to a patient, may not dispense <ln numlevel="1" lineno="163" slineno="5-14"/>the ivermectin to the patient.</amend></subsection></subsection><subsection ssid="10-10" dnum="_-o:3-i" numlevel="1" lineno="164" slineno="5-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1071" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="53" groupid="35" style="1" owner="jchristopherson" level="1" amendtag="end">A pharmacist or pharmacy intern who dispenses ivermectin under Section <xref depth="3" refnumber="26B-4-517">26B-4-517</xref>, <ln numlevel="1" lineno="165" slineno="5-16"/>shall provide the patient with the standardized fact sheet described in Subsection <xref tempid="793">(4)</xref>(b).</amend></subsection><subsection ssid="10-12" dnum="_-o:4-i" numlevel="1" lineno="166" slineno="5-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1072" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="65" groupid="45" style="1" owner="jchristopherson" level="1" amendtag="end">The division, in collaboration with the Board of Pharmacy and the Medical Licensing <ln numlevel="1" lineno="167" slineno="5-18"/>Board, shall make rules in accordance with Title 63G, Chapter 3, Utah Administrative <ln numlevel="1" lineno="168" slineno="5-19"/>Rulemaking Act, to establish:</amend><subsection ssid="10-16" dnum="_-o:a-i" numlevel="1" lineno="169" slineno="5-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1073" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="100" groupid="67" style="1" owner="jchristopherson" level="1" amendtag="end">a screening risk assessment questionnaire to determine a patient's suitability for <ln numlevel="1" lineno="170" slineno="5-21"/>treatment with ivermectin that:</amend><subsection ssid="10-17" dnum="_-o:i-i" numlevel="1" lineno="171" slineno="5-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1074" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="106" groupid="72" style="1" owner="jchristopherson" level="1" amendtag="end">identifies contraindications;</amend></subsection><subsection ssid="10-18" dnum="_-o:ii-i" numlevel="1" lineno="172" slineno="5-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1075" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="111" groupid="76" style="1" owner="jchristopherson" level="1" amendtag="end">assesses risk factors;</amend></subsection><subsection ssid="10-19" dnum="_-o:iii-i" numlevel="1" lineno="173" slineno="5-24" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1076" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="116" groupid="80" style="1" owner="jchristopherson" level="1" amendtag="end">ensures the informed consent of the patient to whom ivermectin is dispensed; and</amend></subsection><subsection ssid="10-20" dnum="_-o:iv-i" numlevel="1" lineno="174" slineno="5-25" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1077" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="122" groupid="85" style="1" owner="jchristopherson" level="1" amendtag="end">assists a pharmacist or pharmacy intern in determining whether dispensing <ln numlevel="1" lineno="175" slineno="5-26"/>ivermectin to the patient is appropriate; and</amend></subsection></subsection><subsection ssid="10-21" dnum="_-o:b-i" numlevel="1" lineno="176" slineno="5-27" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1078" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="131" groupid="91" style="1" owner="jchristopherson" level="1" amendtag="end">a standardized fact sheet that includes:</amend><subsection ssid="10-22" dnum="_-o:i-i" numlevel="1" lineno="177" slineno="5-28" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1079" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="137" groupid="96" style="1" owner="jchristopherson" level="1" amendtag="end">the indications and contraindications for the use of ivermectin;</amend></subsection><subsection ssid="10-23" dnum="_-o:ii-i" numlevel="1" lineno="178" slineno="5-29" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1080" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="142" groupid="100" style="1" owner="jchristopherson" level="1" amendtag="end">the appropriate administration of ivermectin;</amend></subsection><subsection ssid="10-24" dnum="_-o:iii-i" numlevel="1" lineno="179" slineno="5-30" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1081" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="147" groupid="104" style="1" owner="jchristopherson" level="1" amendtag="end">when the patient should see a health care provider for follow-up care or seek <ln numlevel="1" lineno="180" slineno="5-31"/>emergency medical care; and</amend></subsection><subsection ssid="10-26" dnum="_-o:iv-i" numlevel="1" lineno="181" slineno="5-32" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1082" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="153" groupid="109" style="1" owner="jchristopherson" level="1" amendtag="end">any other information the division, the Board of Pharmacy, and the Medical <ln numlevel="1" lineno="182" slineno="5-33"/>Licensing Board deem appropriate.</amend></subsection></subsection></subsection></section></bsec><bsec buid="14" num="26B-4-520" type="enact" src="code" uid="C26B-4-S520_2026050620260506" sort="26B04 05200020260506" numlevel="1" lineno="183" slineno="6-1" sn="6"><section numlevel="1" lineno="184" slineno="6-2" number="26B-4-520" type="enact"><secline lineno="183">Section 6. Ivermectin -- Immunity from liability -- Exclusion from unlawful or <ln numlevel="1" lineno="191" slineno="7-3"/>unprofessional conduct.</bold></catline><subsection ssid="1-1" dnum="_-o:1-i" numlevel="1" lineno="192" slineno="7-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1083" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">As used in this section, "ivermectin" means the same as that term is defined in Section <xref depth="3" refnumber="26B-4-501"><ln numlevel="1" lineno="193" slineno="7-5"/>26B-4-501</xref>.</amend></subsection><subsection ssid="1-3" dnum="_-o:2-i" numlevel="1" lineno="194" slineno="7-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1084" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="end">A person licensed under this chapter that dispenses ivermectin pursuant to a standing <ln numlevel="1" lineno="195" slineno="7-7"/>prescription drug order issued in accordance with Section <xref depth="3" refnumber="26B-4-518">26B-4-518</xref>, is not liable for <ln numlevel="1" lineno="196" slineno="7-8"/>any civil damages for actions authorized by Sections <xref depth="3" refnumber="26B-4-517">26B-4-517</xref> and <xref depth="3" refnumber="26B-4-519">26B-4-519</xref>, except <ln numlevel="1" lineno="197" slineno="7-9"/>for damages resulting from gross negligence or willful misconduct.</amend></subsection><subsection ssid="1-4" dnum="_-o:3-i" numlevel="1" lineno="198" slineno="7-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1085" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="23" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="end">It is not unprofessional conduct or unlawful conduct for a licensee under this chapter to <ln numlevel="1" lineno="199" slineno="7-11"/>dispense ivermectin pursuant to a standing prescription drug order issued in accordance <ln numlevel="1" lineno="200" slineno="7-12"/>with Section <xref depth="3" refnumber="26B-4-518">26B-4-518</xref>.</amend></subsection></section></bsec><bsec buid="16" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="201" slineno="8-1" sn="8"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="201">Section 8.  <bold>Effective Date.</bold></secline><sectionText lineno="202"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>12-29-25 11:22 AM</tm></rev></foot></leg>
