and</hl><hl numlevel="1" lineno="14" slineno="0-14" level="2">the physician is presumed to have lacked informed consent for purposes of  the Utah <ln numlevel="1" lineno="15" slineno="0-15"/>Health Care Malpractice Act;</hl></hl><hl numlevel="1" lineno="16" slineno="0-16" level="1">defines terms; Section <bold>26B-5-401</bold> is amended to read:</secline><catline lineno="34"><bold>26B-5-401<parens/>. Definitions.</bold></catline><sectionText lineno="35"><tab/>In addition to the definitions in Section <xref depth="3" refnumber="26B-5-301" start="0">26B-5-301</xref>, as used in this part:</sectionText><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="36" slineno="1-4" level="1"><display>(1)</display><amend anum="0" ea="amend" pairid="5" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both">"Catatonia" means the same as that term is defined in the current edition of the <ln numlevel="1" lineno="37" slineno="1-5"/>Diagnostic and Statistical Manual of Mental Disorders published by the American <ln numlevel="1" lineno="38" slineno="1-6"/>Psychiatric Association.</amend></subsection><subsection ssid="1-14" dnum="_-o:2-i" numlevel="1" lineno="39" slineno="1-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1001" style="1" owner="i" level="1" amendtag="both">(2)</amend></display>"Child" means a person under 18 years old.</subsection><subsection ssid="1-null-2" dnum="2-o:3-i" numlevel="1" lineno="40" slineno="1-8" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1002" style="2" owner="o" level="1" deltag="both">(2)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1003" style="1" owner="i" level="1" amendtag="both" space="true">(3)</amend></display>"Commit" and "commitment" mean the transfer of physical custody in accordance <ln numlevel="1" lineno="41" slineno="1-9"/>with the requirements of this part.</subsection><subsection ssid="1-16" dnum="_-o:4-i" numlevel="1" lineno="42" slineno="1-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1003" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><subsection ssid="1-17" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1004" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="22" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="end">"Electroconvulsive therapy" means the use of a device, including a pulse <ln numlevel="1" lineno="43" slineno="1-11"/>generator and stimulation electrodes, to treat mental disorders and psychiatric <ln numlevel="1" lineno="44" slineno="1-12"/>disturbances by inducing in the patient a major motor seizure by applying a brief <ln numlevel="1" lineno="45" slineno="1-13"/>intense electrical current to the patient's head.</amend></subsection><subsection ssid="1-19" dnum="_-o:b-i" numlevel="1" lineno="46" slineno="1-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="28" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="end">"Electroconvulsive therapy" includes treatment known as electroshock therapy or <ln numlevel="1" lineno="47" slineno="1-15"/>shock treatment.</amend></subsection></subsection><subsection ssid="1-null-3" dnum="3-o:5-i" numlevel="1" lineno="48" slineno="1-16" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1006" style="2" owner="o" level="1" deltag="both">(3)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="both" space="true">(5)</amend></display>"Legal custody" means:<subsection ssid="1-null-4" dnum="a-o" numlevel="1" lineno="49" slineno="1-17" level="2"><display>(a)</display>the right to determine where and with whom the child shall live;</subsection><subsection ssid="1-null-5" dnum="b-o" numlevel="1" lineno="50" slineno="1-18" level="2"><display>(b)</display>the right to participate in all treatment decisions and to consent or withhold consent <ln numlevel="1" lineno="51" slineno="1-19"/>for treatment in which a constitutionally protected liberty or privacy interest may be <ln numlevel="1" lineno="52" slineno="1-20"/>affected, including antipsychotic medication, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="33" groupid="24" style="2" owner="jchristopherson" level="1" deltag="both">electroshock</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="32" groupid="23" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">electroconvulsive</amend> <ln numlevel="1" lineno="53" slineno="1-21"/>therapy, and psychosurgery; and</subsection><subsection ssid="1-null-6" dnum="c-o" numlevel="1" lineno="54" slineno="1-22" level="2"><display>(c)</display>the right to authorize surgery or other extraordinary medical care.</subsection></subsection><subsection ssid="1-null-7" dnum="4-o:6-i" numlevel="1" lineno="55" slineno="1-23" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1010" style="2" owner="o" level="1" deltag="both">(4)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="both" space="true">(6)</amend></display>"Physical custody" means:<subsection ssid="1-null-8" dnum="a-o" numlevel="1" lineno="56" slineno="1-24" level="2"><display>(a)</display>placement of a child in any residential or inpatient setting;</subsection><subsection ssid="1-null-9" dnum="b-o" numlevel="1" lineno="57" slineno="1-25" level="2"><display>(b)</display>the right to physical custody of a child;</subsection><subsection ssid="1-null-10" dnum="c-o" numlevel="1" lineno="58" slineno="1-26" level="2"><display>(c)</display>the right and duty to protect the child; and</subsection><subsection ssid="1-null-11" dnum="d-o" numlevel="1" lineno="59" slineno="1-27" level="2"><display>(d)</display>the duty to provide, or insure that the child is provided with, adequate food, clothing, <ln numlevel="1" lineno="60" slineno="1-28"/>shelter, and ordinary medical care.</subsection></subsection><subsection ssid="1-null-12" dnum="5-o:7-i" numlevel="1" lineno="61" slineno="1-29" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1015" style="2" owner="o" level="1" deltag="both">(5)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="both" space="true">(7)</amend></display>"Residential" means any out-of-home placement made by a local mental health <ln numlevel="1" lineno="62" slineno="1-30"/>authority, but does not include out-of-home respite care.</subsection><subsection ssid="1-null-13" dnum="6-o:8-i" numlevel="1" lineno="63" slineno="1-31" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1016" style="2" owner="o" level="1" deltag="both">(6)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1017" style="1" owner="i" level="1" amendtag="both" space="true">(8)</amend></display>"Respite care" means temporary, periodic relief provided to parents or guardians <ln numlevel="1" lineno="64" slineno="1-32"/>from the daily care of children with serious emotional disorders for the limited time <ln numlevel="1" lineno="65" slineno="1-33"/>periods designated by the division.</subsection></section></bsec><bsec buid="2" num="26B-5-402" type="amend" src="code" uid="C26B-5-S402_2026050620260506" sort="26B05 04020020260506" numlevel="1" lineno="66" slineno="2-1" sn="2"><section number="26B-5-402" numlevel="1" lineno="67" slineno="2-2" type="amend"><secline lineno="66">Section 2. Section <bold>26B-5-402</bold> is amended to read:</secline><catline lineno="67"><bold>26B-5-402<parens/>. Treatment and commitment of minors in the public mental health <ln numlevel="1" lineno="68" slineno="2-3"/>system.</bold></catline><sectionText lineno="69"><tab/>A child is entitled to due process proceedings, in accordance with the requirements of <ln numlevel="1" lineno="70" slineno="2-5"/>this part, whenever the child:</sectionText><subsection ssid="2-null-1" dnum="1-o" numlevel="1" lineno="71" slineno="2-6" level="1"><display>(1)</display>may receive or receives services through the public mental health system and is placed, <ln numlevel="1" lineno="72" slineno="2-7"/>by a local mental health authority, in a physical setting where <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="4" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both">his</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="3" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the child's</amend> liberty <ln numlevel="1" lineno="73" slineno="2-8"/>interests are restricted, including residential and inpatient placements; or</subsection><subsection ssid="2-null-2" dnum="2-o" numlevel="1" lineno="74" slineno="2-9" level="1"><display>(2)</display>receives treatment in which a constitutionally protected privacy or liberty interest may <ln numlevel="1" lineno="75" slineno="2-10"/>be affected, including the administration of antipsychotic medication, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="7" groupid="6" style="2" owner="jchristopherson" level="1" deltag="both">electroshock</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="76" slineno="2-11"/>electroconvulsive</amend> therapy, and psychosurgery.</subsection></section></bsec><bsec buid="3" num="26B-5-403" type="amend" src="code" uid="C26B-5-S403_2026050620260506" sort="26B05 04030020260506" numlevel="1" lineno="77" slineno="3-1" sn="3"><section number="26B-5-403" numlevel="1" lineno="78" slineno="3-2" type="amend"><secline lineno="77">Section 3. Section <bold>26B-5-403</bold> is amended to read:</secline><catline lineno="78"><bold>26B-5-403<parens/>. Residential and inpatient settings -- Commitment proceeding -- <ln numlevel="1" lineno="79" slineno="3-3"/>Child in physical custody of local mental health authority.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="80" slineno="3-4" level="1" placement="noreturn"><display>(1)</display>A child may receive services from a local mental health authority in an inpatient or <ln numlevel="1" lineno="81" slineno="3-5"/>residential setting only after a commitment proceeding, for the purpose of transferring <ln numlevel="1" lineno="82" slineno="3-6"/>physical custody, has been conducted in accordance with the requirements of this <ln numlevel="1" lineno="83" slineno="3-7"/>section.</subsection><subsection ssid="3-null-2" dnum="2-o" numlevel="1" lineno="84" slineno="3-8" level="1" space="false"><display>(2)</display><subsection ssid="3-59" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1021" style="1" owner="i" level="1" amendtag="both">(a)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="194" groupid="159" style="2" owner="jchristopherson" level="1" deltag="both">That </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="191" groupid="156" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">The </amend>commitment proceeding <amend anum="0" ea="amend" pairid="192" groupid="157" style="1" owner="jchristopherson" level="1" amendtag="both">described in Subsection <xref refnumber="3-null-1">(1)</xref> </amend>shall be initiated <ln numlevel="1" lineno="85" slineno="3-9"/>by a petition for commitment, and shall be a careful, diagnostic inquiry, conducted by <ln numlevel="1" lineno="86" slineno="3-10"/>a neutral and detached fact finder, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="276" groupid="235" style="2" owner="jchristopherson" level="1" deltag="both">pursuant to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="275" groupid="234" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">in accordance with</amend> the procedures and <ln numlevel="1" lineno="87" slineno="3-11"/>requirements of this section. </subsection><subsection ssid="3-60" dnum="_-o:b-i" numlevel="1" lineno="88" slineno="3-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1022" style="1" owner="i" level="1" amendtag="both">(b)</amend></display>If the findings described in Subsection <xref depth="4" refnumber="26B-5-403(4)">(4)</xref> exist, the proceeding shall result in the <ln numlevel="1" lineno="89" slineno="3-13"/>transfer of physical custody to the appropriate local mental health authority, and the <ln numlevel="1" lineno="90" slineno="3-14"/>child may be placed in an inpatient or residential setting.</subsection></subsection><subsection ssid="3-null-3" dnum="3-o" numlevel="1" lineno="91" slineno="3-15" level="1"><display>(3)</display>The neutral and detached fact finder who conducts the inquiry:<subsection ssid="3-null-4" dnum="a-o" numlevel="1" lineno="92" slineno="3-16" level="2"><display>(a)</display>shall be a designated examiner; and</subsection><subsection ssid="3-null-5" dnum="b-o" numlevel="1" lineno="93" slineno="3-17" level="2"><display>(b)</display>may not profit, financially or otherwise, from the commitment or physical placement <ln numlevel="1" lineno="94" slineno="3-18"/>of the child in that setting.</subsection></subsection><subsection ssid="3-null-6" dnum="4-o" numlevel="1" lineno="95" slineno="3-19" level="1"><display>(4)</display>Upon determination by a <amend anum="0" ea="amend" pairid="26" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="both">neutral and detached </amend>fact finder that the following <ln numlevel="1" lineno="96" slineno="3-20"/>circumstances clearly exist, the <amend anum="0" ea="amend" pairid="266" groupid="225" style="1" owner="jchristopherson" level="1" amendtag="both">neutral and detached </amend>fact finder may order that the child <ln numlevel="1" lineno="97" slineno="3-21"/>be committed to the physical custody of a local mental health authority:<subsection ssid="3-null-7" dnum="a-o" numlevel="1" lineno="98" slineno="3-22" level="2"><display>(a)</display>the child has a mental illness;</subsection><subsection ssid="3-null-8" dnum="b-o" numlevel="1" lineno="99" slineno="3-23" level="2"><display>(b)</display>the child demonstrates a reasonable fear of the risk of substantial danger to self or <ln numlevel="1" lineno="100" slineno="3-24"/>others;</subsection><subsection ssid="3-null-9" dnum="c-o" numlevel="1" lineno="101" slineno="3-25" level="2"><display>(c)</display>the child will benefit from care and treatment by the local mental health authority; <ln numlevel="1" lineno="102" slineno="3-26"/>and</subsection><subsection ssid="3-null-10" dnum="d-o" numlevel="1" lineno="103" slineno="3-27" level="2"><display>(d)</display>there is no appropriate less-restrictive alternative.</subsection></subsection><subsection ssid="3-null-11" dnum="5-o" numlevel="1" lineno="104" slineno="3-28" level="1" space="false"><display>(5)</display><subsection ssid="3-null-12" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The commitment proceeding before the neutral and detached fact finder shall be <ln numlevel="1" lineno="105" slineno="3-29"/>conducted in as informal manner as possible and in a physical setting that is not <ln numlevel="1" lineno="106" slineno="3-30"/>likely to have a harmful effect on the child.</subsection><subsection ssid="3-null-13" dnum="b-o" numlevel="1" lineno="107" slineno="3-31" level="2"><display>(b)</display>The child, the child's parent or legal guardian, the petitioner, and a representative of <ln numlevel="1" lineno="108" slineno="3-32"/>the appropriate local mental health authority:<subsection ssid="3-null-14" dnum="i-o" numlevel="1" lineno="109" slineno="3-33" level="3"><display>(i)</display>shall receive informal notice of the date and time of the proceeding; and</subsection><subsection ssid="3-null-15" dnum="ii-o" numlevel="1" lineno="110" slineno="3-34" level="3"><display>(ii)</display>may appear and address the petition for commitment.</subsection></subsection><subsection ssid="3-null-16" dnum="c-o" numlevel="1" lineno="111" slineno="3-35" level="2"><display>(c)</display>The neutral and detached fact finder may, in the <amend anum="0" ea="amend" pairid="267" groupid="226" style="1" owner="jchristopherson" level="1" amendtag="both">neutral and detached </amend>fact finder's <ln numlevel="1" lineno="112" slineno="3-36"/>discretion, receive the testimony of any other person.</subsection><subsection ssid="3-null-17" dnum="d-o" numlevel="1" lineno="113" slineno="3-37" level="2"><display>(d)</display>The <amend anum="0" ea="amend" pairid="27" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="both">neutral and detached </amend>fact finder may allow a child to waive the child's right to be <ln numlevel="1" lineno="114" slineno="3-38"/>present at the commitment proceeding, for good cause shown. If that right is waived, <ln numlevel="1" lineno="115" slineno="3-39"/>the purpose of the waiver shall be made a matter of record at the proceeding.</subsection><subsection ssid="3-null-18" dnum="e-o" numlevel="1" lineno="116" slineno="3-40" level="2"><display>(e)</display>At the time of the commitment proceeding, the appropriate local mental health <ln numlevel="1" lineno="117" slineno="3-41"/>authority, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="203" groupid="168" style="2" owner="jchristopherson" level="1" deltag="both">its </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="201" groupid="166" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the local mental health authority's </amend>designee, or the psychiatrist who <ln numlevel="1" lineno="118" slineno="3-42"/>has been in charge of the child's care prior to the commitment proceeding, shall <ln numlevel="1" lineno="119" slineno="3-43"/>provide the neutral and detached fact finder with the following information, as it <ln numlevel="1" lineno="120" slineno="3-44"/>relates to the period of current admission:<subsection ssid="3-null-19" dnum="i-o" numlevel="1" lineno="121" slineno="3-45" level="3"><display>(i)</display>the petition for commitment;</subsection><subsection ssid="3-null-20" dnum="ii-o" numlevel="1" lineno="122" slineno="3-46" level="3"><display>(ii)</display>the admission notes;</subsection><subsection ssid="3-null-21" dnum="iii-o" numlevel="1" lineno="123" slineno="3-47" level="3"><display>(iii)</display>the child's diagnosis;</subsection><subsection ssid="3-null-22" dnum="iv-o" numlevel="1" lineno="124" slineno="3-48" level="3"><display>(iv)</display>physicians' orders;</subsection><subsection ssid="3-null-23" dnum="v-o" numlevel="1" lineno="125" slineno="3-49" level="3"><display>(v)</display>progress notes;</subsection><subsection ssid="3-null-24" dnum="vi-o" numlevel="1" lineno="126" slineno="3-50" level="3"><display>(vi)</display>nursing notes; and</subsection><subsection ssid="3-null-25" dnum="vii-o" numlevel="1" lineno="127" slineno="3-51" level="3"><display>(vii)</display>medication records.</subsection></subsection><subsection ssid="3-null-26" dnum="f-o" numlevel="1" lineno="128" slineno="3-52" level="2"><display>(f)</display>The information described in Subsection <xref depth="4" refnumber="26B-5-403(5)(e)">(5)(e)</xref> shall also be provided to the child's <ln numlevel="1" lineno="129" slineno="3-53"/>parent or legal guardian upon written request.</subsection><subsection ssid="3-null-27" dnum="g-o" numlevel="1" lineno="130" slineno="3-54" level="2" space="false"><display>(g)</display><subsection ssid="3-null-28" dnum="i-o" level="3" placement="sameline" space="false"><display>(i)</display><subsection ssid="3-61" dnum="_-o:A-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1" placement="sameline"><display><amend anum="0" ea="amend" pairid="1049" style="1" owner="i" level="1" amendtag="both">(A)</amend></display>The neutral and detached fact finder's decision of commitment shall state <ln numlevel="1" lineno="131" slineno="3-55"/>the duration of the commitment. </subsection><subsection ssid="3-62" dnum="_-o:B-i" numlevel="1" lineno="132" slineno="3-56" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1050" style="1" owner="i" level="1" amendtag="both">(B)</amend></display>Any commitment to the physical custody of a local mental health authority <ln numlevel="1" lineno="133" slineno="3-57"/>may not exceed 180 days. </subsection><subsection ssid="3-63" dnum="_-o:C-i" numlevel="1" lineno="134" slineno="3-58" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1051" style="1" owner="i" level="1" amendtag="both">(C)</amend></display>Prior to expiration of the commitment, and if further commitment is sought, a <ln numlevel="1" lineno="135" slineno="3-59"/>hearing shall be conducted in the same manner as the initial commitment <ln numlevel="1" lineno="136" slineno="3-60"/>proceeding, in accordance with the requirements of this section.</subsection></subsection><subsection ssid="3-null-29" dnum="ii-o" numlevel="1" lineno="137" slineno="3-61" level="3"><display>(ii)</display>At the conclusion of the hearing and subsequently in writing, when a decision for <ln numlevel="1" lineno="138" slineno="3-62"/>commitment is made, the neutral and detached fact finder shall inform the child <ln numlevel="1" lineno="139" slineno="3-63"/>and the child's parent or legal guardian of that decision and of the reasons for <ln numlevel="1" lineno="140" slineno="3-64"/>ordering commitment.</subsection><subsection ssid="3-null-30" dnum="iii-o" numlevel="1" lineno="141" slineno="3-65" level="3"><display>(iii)</display>The neutral and detached fact finder shall state in writing the basis of the <ln numlevel="1" lineno="142" slineno="3-66"/>decision, with specific reference to each of the criteria described in Subsection <xref depth="4" refnumber="26B-5-403(4)">(4)</xref>, <ln numlevel="1" lineno="143" slineno="3-67"/>as a matter of record.</subsection></subsection></subsection><subsection ssid="3-null-31" dnum="6-o" numlevel="1" lineno="144" slineno="3-68" level="1" space="false"><display>(6)</display><subsection ssid="3-64" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1055" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>A child may be temporarily committed for a maximum of 72 hours, excluding <ln numlevel="1" lineno="145" slineno="3-69"/>Saturdays, Sundays, and legal holidays, to the physical custody of a local mental <ln numlevel="1" lineno="146" slineno="3-70"/>health authority in accordance with the procedures described in Section <xref depth="3" refnumber="26B-5-331">26B-5-331</xref> <ln numlevel="1" lineno="147" slineno="3-71"/>and upon satisfaction of the risk factors described in Subsection <xref depth="4" refnumber="26B-5-403(4)">(4)</xref>. </subsection><subsection ssid="3-65" dnum="_-o:b-i" numlevel="1" lineno="148" slineno="3-72" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1056" style="1" owner="i" level="1" amendtag="both">(b)</amend></display>A child who is temporarily committed shall be released at the expiration of the 72 <ln numlevel="1" lineno="149" slineno="3-73"/>hours unless the procedures and findings required by this section for the commitment <ln numlevel="1" lineno="150" slineno="3-74"/>of a child are satisfied.</subsection></subsection><subsection ssid="3-null-32" dnum="7-o" numlevel="1" lineno="151" slineno="3-75" level="1" space="false"><display>(7)</display><subsection ssid="3-66" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1058" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>A local mental health authority shall have physical custody of each child <ln numlevel="1" lineno="152" slineno="3-76"/>committed to <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="256" groupid="215" style="2" owner="jchristopherson" level="1" deltag="both">it</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="249" groupid="208" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the local mental health authority</amend> under this section. </subsection><subsection ssid="3-67" dnum="_-o:b-i" numlevel="1" lineno="153" slineno="3-77" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1059" style="1" owner="i" level="1" amendtag="both">(b)</amend></display>The parent or legal guardian of a child committed to the physical custody of a local <ln numlevel="1" lineno="154" slineno="3-78"/>mental health authority under this section, retains legal custody of the child, unless <ln numlevel="1" lineno="155" slineno="3-79"/>legal custody has been otherwise modified by a court of competent jurisdiction. </subsection><subsection ssid="3-68" dnum="_-o:c-i" numlevel="1" lineno="156" slineno="3-80" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1060" style="1" owner="i" level="1" amendtag="both">(c)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="257" groupid="216" style="2" owner="jchristopherson" level="1" deltag="both">In cases when </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="250" groupid="209" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">If </amend>the Division of Child and Family Services or the Division of <ln numlevel="1" lineno="157" slineno="3-81"/>Juvenile Justice and Youth Services has legal custody of a child<amend anum="0" ea="amend" pairid="251" groupid="210" style="1" owner="jchristopherson" level="1" amendtag="both"> committed to the <ln numlevel="1" lineno="158" slineno="3-82"/>physical custody of a local mental health authority under this section</amend>, that division <ln numlevel="1" lineno="159" slineno="3-83"/>shall retain legal custody for purposes of this part.</subsection></subsection><subsection ssid="3-null-33" dnum="8-o" numlevel="1" lineno="160" slineno="3-84" level="1" space="false"><display>(8)</display><subsection ssid="3-69" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1062" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>The cost of caring for and maintaining a child in the physical custody of a local <ln numlevel="1" lineno="161" slineno="3-85"/>mental health authority shall be assessed to and paid by the child's parents, according <ln numlevel="1" lineno="162" slineno="3-86"/>to their ability to pay. </subsection><subsection ssid="3-70" dnum="_-o:b-i" numlevel="1" lineno="163" slineno="3-87" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1063" style="1" owner="i" level="1" amendtag="both">(b)</amend></display>For purposes of this section, the Division of Child and Family Services or the <ln numlevel="1" lineno="164" slineno="3-88"/>Division of Juvenile Justice and Youth Services shall be financially responsible, in <ln numlevel="1" lineno="165" slineno="3-89"/>addition to the child's parents, if the child is in the legal custody of either of those <ln numlevel="1" lineno="166" slineno="3-90"/>divisions at the time the child is committed to the physical custody of a local mental <ln numlevel="1" lineno="167" slineno="3-91"/>health authority under this section, unless Medicaid regulation or contract provisions <ln numlevel="1" lineno="168" slineno="3-92"/>specify otherwise. </subsection><subsection ssid="3-71" dnum="_-o:c-i" numlevel="1" lineno="169" slineno="3-93" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1064" style="1" owner="i" level="1" amendtag="both">(c)</amend></display>The Office of Recovery Services shall assist <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="258" groupid="217" style="2" owner="jchristopherson" level="1" deltag="both">those</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="252" groupid="211" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the</amend> divisions<amend anum="0" ea="amend" pairid="253" groupid="212" style="1" owner="jchristopherson" level="1" amendtag="both"> described in <ln numlevel="1" lineno="170" slineno="3-94"/>Subsection <xref refnumber="3-null-33">(8)</xref>(b)</amend> in collecting the costs assessed pursuant to this section.</subsection></subsection><subsection ssid="3-null-34" dnum="9-o" numlevel="1" lineno="171" slineno="3-95" level="1" space="false"><display>(9)</display><subsection ssid="3-72" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1066" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>Whenever application is made for commitment of a minor to a local mental health <ln numlevel="1" lineno="172" slineno="3-96"/>authority under any provision of this section by a person other than the child's parent <ln numlevel="1" lineno="173" slineno="3-97"/>or guardian, the local mental health authority or <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="204" groupid="169" style="2" owner="jchristopherson" level="1" deltag="both">its</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="202" groupid="167" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the local mental health authority's</amend> <ln numlevel="1" lineno="174" slineno="3-98"/>designee shall notify the child's parent or guardian. </subsection><subsection ssid="3-73" dnum="_-o:b-i" numlevel="1" lineno="175" slineno="3-99" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1067" style="1" owner="i" level="1" amendtag="both">(b)</amend></display>The parents shall be provided sufficient time to prepare and appear at any scheduled <ln numlevel="1" lineno="176" slineno="3-100"/>proceeding.</subsection></subsection><subsection ssid="3-null-35" dnum="10-o" numlevel="1" lineno="177" slineno="3-101" level="1" space="false"><display>(10)</display><subsection ssid="3-null-36" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="3-74" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1" placement="sameline"><display><amend anum="0" ea="amend" pairid="1070" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>Each child committed pursuant to this section is entitled to an appeal within <ln numlevel="1" lineno="178" slineno="3-102"/>30 days after any order for commitment. </subsection><subsection ssid="3-75" dnum="_-o:ii-i" numlevel="1" lineno="179" slineno="3-103" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1071" style="1" owner="i" level="1" amendtag="both">(ii)</amend></display>The appeal <amend anum="0" ea="amend" pairid="230" groupid="191" style="1" owner="jchristopherson" level="1" amendtag="both">described in Subsection <xref tempid="1090">(10)(a)(i)</xref> </amend>may be brought on the child's own <ln numlevel="1" lineno="180" slineno="3-104"/>petition or on petition of the child's parent or legal guardian, to the juvenile court <ln numlevel="1" lineno="181" slineno="3-105"/>in the district where the child resides or is currently physically located. <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="234" groupid="194" style="2" owner="jchristopherson" level="1" deltag="both">With <ln numlevel="1" lineno="182" slineno="3-106"/>regard to a child in the custody of the Division of Child and Family Services or <ln numlevel="1" lineno="183" slineno="3-107"/>the Division of Juvenile Justice and Youth Services, the attorney general's office <ln numlevel="1" lineno="184" slineno="3-108"/>shall handle the appeal, otherwise the appropriate county attorney's office is <ln numlevel="1" lineno="185" slineno="3-109"/>responsible for appeals brought pursuant to this Subsection (10)(a).</amend><amendoutend style="2"/></subsection><subsection ssid="3-98" dnum="_-o:iii-i" numlevel="1" lineno="186" slineno="3-110" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1072" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="233" groupid="193" style="1" owner="jchristopherson" level="1" amendtag="end">Except as provided in Subsection <xref tempid="678">(10)(a)(iv)</xref>, the appropriate county attorney's <ln numlevel="1" lineno="187" slineno="3-111"/>office is responsible for appeals brought under this Subsection <xref refnumber="3-null-36">(10)(a)</xref>.</amend></subsection><subsection ssid="3-99" dnum="_-o:iv-i" numlevel="1" lineno="188" slineno="3-112" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1073" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="254" groupid="213" style="1" owner="jchristopherson" level="1" amendtag="end">The attorney general's office shall handle appeals regarding a child in the custody <ln numlevel="1" lineno="189" slineno="3-113"/>of the Division of Child and Family Services or the Division of Juvenile Justice <ln numlevel="1" lineno="190" slineno="3-114"/>and Youth Services.</amend></subsection></subsection><subsection ssid="3-null-37" dnum="b-o" numlevel="1" lineno="191" slineno="3-115" level="2" space="false"><display>(b)</display><subsection ssid="3-76" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1075" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>Upon receipt of the petition for appeal, the court shall appoint a designated <ln numlevel="1" lineno="192" slineno="3-116"/>examiner previously unrelated to the case, to conduct an examination of the child <ln numlevel="1" lineno="193" slineno="3-117"/>in accordance with the criteria described in Subsection <xref depth="4" refnumber="26B-5-403(4)">(4)</xref>, and file a written <ln numlevel="1" lineno="194" slineno="3-118"/>report with the court.  </subsection><subsection ssid="3-77" dnum="_-o:ii-i" numlevel="1" lineno="195" slineno="3-119" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1076" style="1" owner="i" level="1" amendtag="both">(ii)</amend></display>The court shall then conduct an appeal hearing to determine whether the findings <ln numlevel="1" lineno="196" slineno="3-120"/>described in Subsection <xref depth="4" refnumber="26B-5-403(4)">(4)</xref> exist by clear and convincing evidence.</subsection></subsection><subsection ssid="3-null-38" dnum="c-o" numlevel="1" lineno="197" slineno="3-121" level="2"><display>(c)</display>Prior to the time of the appeal hearing, the appropriate local mental health authority, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="218" groupid="181" style="2" owner="jchristopherson" level="1" deltag="both"><ln numlevel="1" lineno="198" slineno="3-122"/>its</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="217" groupid="180" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the local mental health authority's</amend> designee, or the mental health professional who <ln numlevel="1" lineno="199" slineno="3-123"/>has been in charge of the child's care prior to commitment, shall provide the court <ln numlevel="1" lineno="200" slineno="3-124"/>and the designated examiner for the appeal hearing with the following information, as <ln numlevel="1" lineno="201" slineno="3-125"/>it relates to the period of current admission:<subsection ssid="3-null-39" dnum="i-o" numlevel="1" lineno="202" slineno="3-126" level="3"><display>(i)</display>the original petition for commitment;</subsection><subsection ssid="3-null-40" dnum="ii-o" numlevel="1" lineno="203" slineno="3-127" level="3"><display>(ii)</display>admission notes;</subsection><subsection ssid="3-null-41" dnum="iii-o" numlevel="1" lineno="204" slineno="3-128" level="3"><display>(iii)</display>diagnosis;</subsection><subsection ssid="3-null-42" dnum="iv-o" numlevel="1" lineno="205" slineno="3-129" level="3"><display>(iv)</display>physicians' orders;</subsection><subsection ssid="3-null-43" dnum="v-o" numlevel="1" lineno="206" slineno="3-130" level="3"><display>(v)</display>progress notes;</subsection><subsection ssid="3-null-44" dnum="vi-o" numlevel="1" lineno="207" slineno="3-131" level="3"><display>(vi)</display>nursing notes; and</subsection><subsection ssid="3-null-45" dnum="vii-o" numlevel="1" lineno="208" slineno="3-132" level="3"><display>(vii)</display>medication records.</subsection></subsection><subsection ssid="3-null-46" dnum="d-o" numlevel="1" lineno="209" slineno="3-133" level="2"><display>(d)</display>Both the neutral and detached fact finder and the designated examiner appointed for <ln numlevel="1" lineno="210" slineno="3-134"/>the appeal hearing shall be provided with an opportunity to review the most current <ln numlevel="1" lineno="211" slineno="3-135"/>information described in Subsection <xref depth="4" refnumber="26B-5-403(10)(c)">(10)(c)</xref> prior to the appeal hearing.</subsection><subsection ssid="3-null-47" dnum="e-o" numlevel="1" lineno="212" slineno="3-136" level="2" space="false"><display>(e)</display><subsection ssid="3-78" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1087" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>The <amend anum="0" ea="amend" pairid="255" groupid="214" style="1" owner="jchristopherson" level="1" amendtag="both">court shall notify the </amend>child, the child's parent or legal guardian, the person <ln numlevel="1" lineno="213" slineno="3-137"/>who submitted the original petition for commitment, and a representative of the <ln numlevel="1" lineno="214" slineno="3-138"/>appropriate local mental health authority <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="260" groupid="219" style="2" owner="jchristopherson" level="1" deltag="both">shall be notified by the court </amend><amendoutend style="2"/>of the <ln numlevel="1" lineno="215" slineno="3-139"/>date and time of the appeal hearing. </subsection><subsection ssid="3-79" dnum="_-o:ii-i" numlevel="1" lineno="216" slineno="3-140" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1088" style="1" owner="i" level="1" amendtag="both">(ii)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="195" groupid="160" style="2" owner="jchristopherson" level="1" deltag="both">Those persons </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="193" groupid="158" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">The persons described in Subsection <xref tempid="954">(10)(e)(i)</xref> </amend>shall be afforded <ln numlevel="1" lineno="217" slineno="3-141"/>an opportunity to appear at the hearing. </subsection><subsection ssid="3-80" dnum="_-o:iii-i" numlevel="1" lineno="218" slineno="3-142" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1089" style="1" owner="i" level="1" amendtag="both">(iii)</amend></display>In reaching its decision, the court shall review the record and findings of the <ln numlevel="1" lineno="219" slineno="3-143"/>neutral and detached fact finder, the report of the designated examiner appointed <ln numlevel="1" lineno="220" slineno="3-144"/>pursuant to Subsection <xref depth="4" refnumber="26B-5-403(10)(b)">(10)(b)</xref>, and may, in <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="207" groupid="172" style="2" owner="jchristopherson" level="1" deltag="both">its</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="206" groupid="171" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the court's</amend> discretion, allow or <ln numlevel="1" lineno="221" slineno="3-145"/>require the testimony of the neutral and detached fact finder, the designated <ln numlevel="1" lineno="222" slineno="3-146"/>examiner, the child, the child's parent or legal guardian, the person who brought <ln numlevel="1" lineno="223" slineno="3-147"/>the initial petition for commitment, or any other person whose testimony the court <ln numlevel="1" lineno="224" slineno="3-148"/>deems relevant. </subsection><subsection ssid="3-81" dnum="_-o:iv-i" numlevel="1" lineno="225" slineno="3-149" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1090" style="1" owner="i" level="1" amendtag="both">(iv)</amend></display>The court may allow the child to waive the right to appear at the appeal hearing, <ln numlevel="1" lineno="226" slineno="3-150"/>for good cause shown. </subsection><subsection ssid="3-82" dnum="_-o:v-i" numlevel="1" lineno="227" slineno="3-151" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1091" style="1" owner="i" level="1" amendtag="both">(v)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="198" groupid="163" style="2" owner="jchristopherson" level="1" deltag="both">If that waiver is granted</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="197" groupid="162" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">If the court grants the waiver described in Subsection <xref depth="4" refnumber="26B-5-403(10)(e)(iv)"><ln numlevel="1" lineno="228" slineno="3-152"/>(10)(e)(iv)</xref></amend>, the purpose shall be made a part of the court's record.</subsection></subsection></subsection><subsection ssid="3-null-48" dnum="11-o" numlevel="1" lineno="229" slineno="3-153" level="1"><display>(11)</display>Each local mental health authority has an affirmative duty to conduct periodic <ln numlevel="1" lineno="230" slineno="3-154"/>evaluations of the mental health and treatment progress of every child committed to <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="214" groupid="178" style="2" owner="jchristopherson" level="1" deltag="both">its</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="212" groupid="176" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="231" slineno="3-155"/>the local mental health authority's</amend> physical custody under this section, and to release any <ln numlevel="1" lineno="232" slineno="3-156"/>child who has sufficiently improved so that the criteria justifying commitment no longer <ln numlevel="1" lineno="233" slineno="3-157"/>exist.</subsection><subsection ssid="3-null-49" dnum="12-o" numlevel="1" lineno="234" slineno="3-158" level="1" space="false"><display>(12)</display><subsection ssid="3-null-50" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="3-83" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1" placement="sameline"><display><amend anum="0" ea="amend" pairid="1095" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>A local mental health authority or <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="110" groupid="85" style="2" owner="jchristopherson" level="1" deltag="both">its</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="107" groupid="82" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the local mental health authority's</amend> <ln numlevel="1" lineno="235" slineno="3-159"/>designee, in conjunction with the child's current treating mental health <ln numlevel="1" lineno="236" slineno="3-160"/>professional may release an improved child to a less restrictive environment, as <ln numlevel="1" lineno="237" slineno="3-161"/>they determine appropriate. </subsection><subsection ssid="3-84" dnum="_-o:ii-i" numlevel="1" lineno="238" slineno="3-162" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1096" style="1" owner="i" level="1" amendtag="both">(ii)</amend></display>Whenever the local mental health authority or <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="130" groupid="102" style="2" owner="jchristopherson" level="1" deltag="both">its</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="127" groupid="99" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the local mental health <ln numlevel="1" lineno="239" slineno="3-163"/>authority's</amend> designee, and the child's current treating mental health professional, <ln numlevel="1" lineno="240" slineno="3-164"/>determine that the conditions justifying commitment no longer exist, the child <ln numlevel="1" lineno="241" slineno="3-165"/>shall be discharged and released to the child's parent or legal guardian. </subsection><subsection ssid="3-85" dnum="_-o:iii-i" numlevel="1" lineno="242" slineno="3-166" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1097" style="1" owner="i" level="1" amendtag="both">(iii)</amend></display>With regard to a child who is in the physical custody of the State Hospital, the <ln numlevel="1" lineno="243" slineno="3-167"/>treating psychiatrist or clinical director of the State Hospital shall be the child's <ln numlevel="1" lineno="244" slineno="3-168"/>current treating mental health professional.</subsection></subsection><subsection ssid="3-null-51" dnum="b-o" numlevel="1" lineno="245" slineno="3-169" level="2"><display>(b)</display>A local mental health authority or <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="131" groupid="103" style="2" owner="jchristopherson" level="1" deltag="both">its</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="128" groupid="100" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the local mental health authority's</amend> designee, in <ln numlevel="1" lineno="246" slineno="3-170"/>conjunction with the child's current treating mental health professional, is authorized <ln numlevel="1" lineno="247" slineno="3-171"/>to issue a written order for the immediate placement of a child not previously <ln numlevel="1" lineno="248" slineno="3-172"/>released from an order of commitment into a more restrictive environment, if the <ln numlevel="1" lineno="249" slineno="3-173"/>local authority or <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="132" groupid="104" style="2" owner="jchristopherson" level="1" deltag="both">its</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="129" groupid="101" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the local authority's</amend> designee and the child's current treating <ln numlevel="1" lineno="250" slineno="3-174"/>mental health professional has reason to believe that the less restrictive environment <ln numlevel="1" lineno="251" slineno="3-175"/>in which the child has been placed is exacerbating the child's mental illness, or <ln numlevel="1" lineno="252" slineno="3-176"/>increasing the risk of harm to self or others.</subsection><subsection ssid="3-null-52" dnum="c-o" numlevel="1" lineno="253" slineno="3-177" level="2" space="false"><display>(c)</display><subsection ssid="3-86" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1100" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>The written order described in Subsection <xref depth="4" refnumber="26B-5-403(12)(b)">(12)(b)</xref> shall include the reasons for <ln numlevel="1" lineno="254" slineno="3-178"/>placement in a more restrictive environment and shall authorize any peace officer <ln numlevel="1" lineno="255" slineno="3-179"/>to take the child into physical custody and transport the child to a facility <ln numlevel="1" lineno="256" slineno="3-180"/>designated by the appropriate local mental health authority in conjunction with the <ln numlevel="1" lineno="257" slineno="3-181"/>child's current treating mental health professional. </subsection><subsection ssid="3-87" dnum="_-o:ii-i" numlevel="1" lineno="258" slineno="3-182" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1101" style="1" owner="i" level="1" amendtag="both">(ii)</amend></display>Prior to admission to the more restrictive environment, copies of the order shall <ln numlevel="1" lineno="259" slineno="3-183"/>be personally delivered to the child, the child's parent or legal guardian, the <ln numlevel="1" lineno="260" slineno="3-184"/>administrator of the more restrictive environment, or the administrator's designee, <ln numlevel="1" lineno="261" slineno="3-185"/>and the child's former treatment provider or facility.</subsection></subsection><subsection ssid="3-null-53" dnum="d-o" numlevel="1" lineno="262" slineno="3-186" level="2" space="false"><display>(d)</display><subsection ssid="3-89" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1103" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>If the child has been in a less restrictive environment for more than 30 days and <ln numlevel="1" lineno="263" slineno="3-187"/>is aggrieved by the change to a more restrictive environment, the child or the <ln numlevel="1" lineno="264" slineno="3-188"/>child's representative may request a review within 30 days of the change, by a <ln numlevel="1" lineno="265" slineno="3-189"/>neutral and detached fact finder as described in Subsection <xref depth="4" refnumber="26B-5-403(3)">(3)</xref>. </subsection><subsection ssid="3-88" dnum="_-o:ii-i" numlevel="1" lineno="266" slineno="3-190" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1104" style="1" owner="i" level="1" amendtag="both">(ii)</amend></display>The <amend anum="0" ea="amend" pairid="155" groupid="123" style="1" owner="jchristopherson" level="1" amendtag="both">neutral and detached </amend>fact finder shall determine whether:<subsection ssid="3-null-54" dnum="i-o:A-i" numlevel="1" lineno="267" slineno="3-191" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1105" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1106" style="1" owner="i" level="1" amendtag="both" space="true">(A)</amend></display>the less restrictive environment in which the child has been placed is <ln numlevel="1" lineno="268" slineno="3-192"/>exacerbating the child's mental illness or increasing the risk of harm to self or <ln numlevel="1" lineno="269" slineno="3-193"/>others; or</subsection><subsection ssid="3-null-55" dnum="ii-o:B-i" numlevel="1" lineno="270" slineno="3-194" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1106" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1107" style="1" owner="i" level="1" amendtag="both" space="true">(B)</amend></display>the less restrictive environment in which the child has been placed is not <ln numlevel="1" lineno="271" slineno="3-195"/>exacerbating the child's mental illness or increasing the risk of harm to self or <ln numlevel="1" lineno="272" slineno="3-196"/>others, in which case the <amend anum="0" ea="amend" pairid="156" groupid="124" style="1" owner="jchristopherson" level="1" amendtag="both">neutral and detached </amend>fact finder shall designate that <ln numlevel="1" lineno="273" slineno="3-197"/>the child remain in the less restrictive environment.</subsection></subsection></subsection><subsection ssid="3-null-56" dnum="e-o" numlevel="1" lineno="274" slineno="3-198" level="2"><display>(e)</display>Nothing in this section prevents a local mental health authority or <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="161" groupid="129" style="2" owner="jchristopherson" level="1" deltag="both">its</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="157" groupid="125" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the local <ln numlevel="1" lineno="275" slineno="3-199"/>mental health authority's</amend> designee, in conjunction with the child's current mental <ln numlevel="1" lineno="276" slineno="3-200"/>health professional, from discharging a child from commitment or from placing a <ln numlevel="1" lineno="277" slineno="3-201"/>child in an environment that is less restrictive than that designated by the neutral and <ln numlevel="1" lineno="278" slineno="3-202"/>detached fact finder.</subsection></subsection><subsection ssid="3-null-57" dnum="13-o" numlevel="1" lineno="279" slineno="3-203" level="1" space="false"><display>(13)</display><subsection ssid="3-90" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1109" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>Each local mental health authority or <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="162" groupid="130" style="2" owner="jchristopherson" level="1" deltag="both">its</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="158" groupid="126" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the local mental health authority's</amend> <ln numlevel="1" lineno="280" slineno="3-204"/>designee, in conjunction with the child's current treating mental health professional <ln numlevel="1" lineno="281" slineno="3-205"/>shall discharge any child who, in the opinion of <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="268" groupid="227" style="2" owner="jchristopherson" level="1" deltag="both">that local authority</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="270" groupid="229" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the local mental <ln numlevel="1" lineno="282" slineno="3-206"/>health authority</amend>, or <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="166" groupid="134" style="2" owner="jchristopherson" level="1" deltag="both">its</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="160" groupid="128" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the local mental health authority's</amend> designee, and the child's <ln numlevel="1" lineno="283" slineno="3-207"/>current treating mental health professional, no longer meets the criteria specified in <ln numlevel="1" lineno="284" slineno="3-208"/>Subsection <xref depth="4" refnumber="26B-5-403(4)">(4)</xref>, except as provided <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="263" groupid="222" style="2" owner="jchristopherson" level="1" deltag="both">by</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="262" groupid="221" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">in</amend> Section <xref depth="3" refnumber="26B-5-405">26B-5-405</xref>. </subsection><subsection ssid="3-91" dnum="_-o:b-i" numlevel="1" lineno="285" slineno="3-209" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1110" style="1" owner="i" level="1" amendtag="both">(b)</amend></display>The local <amend anum="0" ea="amend" pairid="178" groupid="144" style="1" owner="jchristopherson" level="1" amendtag="both">mental health </amend>authority and the <amend anum="0" ea="amend" pairid="179" groupid="145" style="1" owner="jchristopherson" level="1" amendtag="both">child's current treating </amend>mental health <ln numlevel="1" lineno="286" slineno="3-210"/>professional shall assure that any further supportive services required to meet the <ln numlevel="1" lineno="287" slineno="3-211"/>child's needs upon release will be provided.</subsection></subsection><subsection ssid="3-null-58" dnum="14-o" numlevel="1" lineno="288" slineno="3-212" level="1" space="false"><display>(14)</display><subsection ssid="3-92" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1112" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>Even though a child has been committed to the physical custody of a local <ln numlevel="1" lineno="289" slineno="3-213"/>mental health authority under this section, the child is still entitled to additional due <ln numlevel="1" lineno="290" slineno="3-214"/>process proceedings, in accordance with Section <xref depth="3" refnumber="26B-5-404">26B-5-404</xref>, before any treatment <ln numlevel="1" lineno="291" slineno="3-215"/>that may affect a constitutionally protected liberty or privacy interest is administered. </subsection><subsection ssid="3-93" dnum="_-o:b-i" numlevel="1" lineno="292" slineno="3-216" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1113" style="1" owner="i" level="1" amendtag="both">(b)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="187" groupid="152" style="2" owner="jchristopherson" level="1" deltag="both">Those treatments include, but are not limited to,</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="186" groupid="151" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">The treatments described in <ln numlevel="1" lineno="293" slineno="3-217"/>Subsection <xref refnumber="3-92">(14)(a)</xref> include</amend> antipsychotic medication, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="273" groupid="232" style="2" owner="jchristopherson" level="1" deltag="both">electroshock</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="272" groupid="231" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">electroconvulsive</amend> <ln numlevel="1" lineno="294" slineno="3-218"/>therapy, and psychosurgery.</subsection></subsection></section></bsec><bsec buid="4" num="26B-5-404" type="amend" src="code" uid="C26B-5-S404_2026050620260506" sort="26B05 04040020260506" numlevel="1" lineno="295" slineno="4-1" sn="4"><section number="26B-5-404" numlevel="1" lineno="296" slineno="4-2" type="amend"><secline lineno="295">Section 4. Section <bold>26B-5-404</bold> is amended to read:</secline><catline lineno="296"><bold>26B-5-404<parens/>. Invasive treatment -- Due process proceedings.</bold></catline><subsection ssid="4-null-1" dnum="1-o" numlevel="1" lineno="297" slineno="4-3" level="1" placement="noreturn"><display>(1)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="83" groupid="77" style="2" owner="jchristopherson" level="1" deltag="both">For purposes requirements of this section apply to all children receiving services or treatment <ln numlevel="1" lineno="301" slineno="4-7"/>from a local mental health authority, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="12" groupid="11" style="2" owner="jchristopherson" level="1" deltag="both">its</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="8" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the local mental health authority's</amend> designee, or <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="13" groupid="12" style="2" owner="jchristopherson" level="1" deltag="both"><ln numlevel="1" lineno="302" slineno="4-8"/>its</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="9" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the local mental health authority's</amend> provider regardless of whether a local mental <ln numlevel="1" lineno="303" slineno="4-9"/>health authority has physical custody of the child or the child is receiving outpatient <ln numlevel="1" lineno="304" slineno="4-10"/>treatment from the local <amend anum="0" ea="amend" pairid="21" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="both">mental health </amend>authority, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="14" groupid="13" style="2" owner="jchristopherson" level="1" deltag="both">its</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="10" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the local mental health authority's</amend> <ln numlevel="1" lineno="305" slineno="4-11"/>designee, or <amend anum="0" ea="amend" pairid="11" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both">the local mental health authority's </amend>provider.</subsection><subsection ssid="4-13" dnum="_-o:3-i" numlevel="1" lineno="306" slineno="4-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1116" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="62" groupid="56" style="1" owner="jchristopherson" level="1" amendtag="end">A child to whom this section applies may only receive electroconvulsive therapy if the <ln numlevel="1" <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="24" groupid="22" style="2" owner="jchristopherson" level="1" deltag="both">children</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="22" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a child</amend> prior to any invasive treatment as follows:<subsection ssid="4-null-5" dnum="i-o" numlevel="1" lineno="311" slineno="4-17" level="3" tab="1"><display>(i)</display>with regard to antipsychotic medications, if either the parent or child disagrees <ln numlevel="1" lineno="312" slineno="4-18"/>with that treatment, a due process proceeding shall be held in compliance with the <ln numlevel="1" lineno="313" slineno="4-19"/>procedures established under this Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="73" groupid="67" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="26B-5-404(3)" start="0">(3)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="69" groupid="63" style="1" owner="jchristopherson" level="1" amendtag="both" <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="74" groupid="68" style="2" owner="jchristopherson" level="1" deltag="both">electroshock</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="70" groupid="64" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">electroconvulsive</amend> therapy, a due <ln numlevel="1" lineno="315" slineno="4-21"/>process proceeding shall be conducted pursuant to the procedures established <ln numlevel="1" lineno="316" slineno="4-22"/>under this Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="76" groupid="70" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="26B-5-404(3)" start="0">(3)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="71" groupid="65" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(4)</amend>, regardless of whether the parent or child agree or <ln numlevel="1" lineno="317" slineno="4-23"/>disagree with the treatment; and</subsection><subsection ssid="4-null-7" dnum="iii-o" numlevel="1" lineno="318" slineno="4-24" level="3" tab="1"><display>(iii)</display>other possible invasive treatments may be conducted unless either the parent or <ln numlevel="1" lineno="319" slineno="4-25"/>child disagrees with the treatment, in which case a due process proceeding shall be <ln numlevel="1" lineno="320" slineno="4-26"/>conducted pursuant to the procedures established under this Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="77" groupid="71" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="26B-5-404(3)" start="0">(3)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="72" groupid="66" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(4)</amend>.</subsection></subsection><subsection ssid="4-null-8" dnum="b-o" numlevel="1" lineno="321" slineno="4-27" level="2"><display>(b)</display>In <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="52" groupid="47" style="2" owner="jchristopherson" level="1" deltag="both">promulgating</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="49" groupid="44" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">making</amend> the rules <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="57" groupid="52" style="2" owner="jchristopherson" level="1" deltag="both">required by</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="56" groupid="51" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">described in</amend> Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="80" groupid="74" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="26B-5-404(3)(a)" start="0">(3)(a)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="79" groupid="73" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(4)(a)</amend>, <ln numlevel="1" lineno="322" slineno="4-28"/>the division shall<amend anum="0" ea="amend" pairid="36" groupid="32" style="1" owner="jchristopherson" level="1" amendtag="both">:</amend><subsection ssid="4-11" dnum="_-o:i-i" numlevel="1" lineno="323" slineno="4-29" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1123" style="1" owner="i" level="1" amendtag="both">(i)</amend></display> consider the advisability of utilizing an administrative law judge, court <ln numlevel="1" lineno="324" slineno="4-30"/>proceedings, a neutral and detached fact finder, and other methods of providing <ln numlevel="1" lineno="325" slineno="4-31"/>due process for the purposes of this section<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="41" groupid="37" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="40" groupid="36" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend>  </subsection><subsection ssid="4-12" dnum="_-o:ii-i" numlevel="1" lineno="326" slineno="4-32" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1124" style="1" owner="i" level="1" amendtag="both">(ii)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="54" groupid="49" style="2" owner="jchristopherson" level="1" deltag="both">The division shall also </amend><amendoutend style="2"/>establish the criteria and basis for slineno="5-11"/>Diagnostic and Statistical Manual of Mental Disorders published by the American <ln numlevel="1" lineno="339" slineno="5-12"/>Psychiatric Association.</amend></subsection><subsection ssid="12-133" dnum="_-o:f-i" numlevel="1" lineno="340" slineno="5-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1131" style="1" owner="i" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="689" groupid="513" style="1" owner="jchristopherson" level="1" amendtag="end">"Coercion" means influencing or attempting to influence an individual using force, <ln numlevel="1" lineno="341" slineno="5-14"/>threats, or intimidation.</amend></subsection><subsection ssid="12-78" dnum="_-o:g-i" numlevel="1" lineno="342" slineno="5-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1132" style="1" owner="i" level="1" slineno="5-18"/>disturbances by inducing in the patient a major motor seizure by applying a brief <ln numlevel="1" lineno="346" slineno="5-19"/>intense electrical current to the patient's head.</amend></subsection><subsection ssid="12-8" dnum="_-o:ii-i" numlevel="1" lineno="347" slineno="5-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1135" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="47" groupid="34" style="1" owner="jchristopherson" level="1" amendtag="end">"Electroconvulsive therapy" includes treatment known as electroshock therapy or <ln numlevel="1" lineno="348" slineno="5-21"/>shock treatment.</amend></subsection></subsection><subsection ssid="12-83" dnum="_-o:i-i" numlevel="1" lineno="349" slineno="5-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1136" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="413" groupid="311" style="1" owner="jchristopherson" level="1" amendtag="end">"Emancipated minor" means a minor who is emancipated under Section <xref depth="3" refnumber="80-7-105">80-7-105</xref>.</amend></subsection><subsection ssid="12-20" dnum="_-o:j-i" numlevel="1" lineno="350" slineno="5-23" ea="amend" anum="0" owner="jchristopherson" style="1" owner="jchristopherson" level="1" amendtag="end">the individual fully understands the information presented in required <ln numlevel="1" lineno="355" slineno="5-28"/>disclosures; amendtag="end">the individual agrees to the administration of electroconvulsive therapy.</amend></subsection></subsection></subsection><subsection ssid="12-89" dnum="_-o:k-i" numlevel="1" lineno="357" slineno="5-30" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1143" style="1" owner="i" level="1" amendtag="start">(k)</amend></display><amend anum="0" ea="amend" pairid="450" groupid="337" style="1" owner="jchristopherson" level="1" amendtag="end">"Memory assessment" means a screening test for mild cognitive impairment that <ln numlevel="1" lineno="358" slineno="5-31"/>assesses a patient's cognitive abilities, including memory, attention, language, and <ln numlevel="1" lineno="359" slineno="5-32"/>visuospatial skills.</amend></subsection><subsection ssid="12-4" dnum="_-o:l-i" numlevel="1" lineno="360" slineno="5-33" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1144" style="1" owner="i" level="1" amendtag="start">(l)</amend></display><amend anum="0" ea="amend" pairid="20" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="end">"Minor" means an individual who is younger than 18 years old.</amend></subsection><subsection ssid="12-64" dnum="_-o:m-i" numlevel="1" lineno="361" slineno="5-34" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1145" style="1" owner="i" level="1" amendtag="start">(m)</amend></display><amend anum="0" ea="amend" pairid="303" groupid="230" style="1" owner="jchristopherson" level="1" amendtag="end">"Physician" means an individual licensed under Chapter 67, Utah Medical Practice <ln numlevel="1" lineno="362" slineno="5-35"/>Act, or Chapter 68, Utah Osteopathic Medical Practice Act.</amend></subsection><subsection ssid="12-57" dnum="_-o:n-i" numlevel="1" lineno="363" slineno="5-36" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1146" style="1" owner="i" level="1" amendtag="start">(n)</amend></display><amend anum="0" ea="amend" pairid="285" groupid="216" style="1" owner="jchristopherson" level="1" amendtag="end">"Power of attorney for health care" means the same as that term is defined in Section <xref depth="3" refnumber="75A-9-101"><ln numlevel="1" lineno="364" slineno="5-37"/>75A-9-101</xref>.</amend></subsection><subsection ssid="12-24" dnum="_-o:o-i" numlevel="1" lineno="365" slineno="5-38" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1147" style="1" owner="i" level="1" amendtag="start">(o)</amend></display><amend anum="0" ea="amend" pairid="124" groupid="93" style="1" owner="jchristopherson" level="1" amendtag="end">"Psychiatrist" means in individual who:</amend><subsection ssid="12-25" dnum="_-o:i-i" numlevel="1" lineno="366" slineno="5-39" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1148" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="130" groupid="97" style="1" owner="jchristopherson" level="1" amendtag="end">is a physician; and</amend></subsection><subsection ssid="12-26" dnum="_-o:ii-i" numlevel="1" lineno="367" slineno="5-40" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1149" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="135" groupid="101" style="1" owner="jchristopherson" level="1" amendtag="end">is board eligible for a psychiatry specialization recognized by the American <ln numlevel="1" lineno="368" slineno="5-41"/>Board of Medical Specialists or the American Osteopathic Association's Bureau of <ln numlevel="1" lineno="369" slineno="5-42"/>Osteopathic Specialists.</amend></subsection></subsection><subsection ssid="12-65" dnum="_-o:p-i" numlevel="1" lineno="370" slineno="5-43" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1150" style="1" owner="i" level="1" amendtag="start">(p)</amend></display><amend anum="0" ea="amend" pairid="308" groupid="234" style="1" owner="jchristopherson" level="1" amendtag="end">"Required disclosures" means the information a physician is required to provide <ln numlevel="1" lineno="371" slineno="5-44"/>under Subsection <xref depth="4" refnumber="58-1-514(3)">(3)</xref>.</amend></subsection><subsection ssid="12-135" dnum="_-o:q-i" numlevel="1" lineno="372" slineno="5-45" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1151" style="1" owner="i" level="1" amendtag="start">(q)</amend></display><amend anum="0" ea="amend" pairid="693" groupid="516" style="1" owner="jchristopherson" level="1" amendtag="end">"Undue influence" means when a person uses a relationship or position of authority, <ln numlevel="1" lineno="373" slineno="5-46"/>trust, or confidence to influence an individual to make a decision by:</amend><subsection ssid="12-140" dnum="_-o:i-i" numlevel="1" lineno="374" slineno="5-47" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1152" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="705" groupid="526" style="1" owner="jchristopherson" level="1" amendtag="end">exploiting the trust, dependence, or fear of an individual;</amend></subsection><subsection ssid="12-141" dnum="_-o:ii-i" numlevel="1" lineno="375" slineno="5-48" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1153" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="704" groupid="525" style="1" owner="jchristopherson" level="1" amendtag="end">knowingly assisting or causing another to exploit the trust, dependence, or fear of <ln numlevel="1" lineno="376" slineno="5-49"/>the individual; or</amend></subsection><subsection ssid="12-142" dnum="_-o:iii-i" numlevel="1" lineno="377" slineno="5-50" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1154" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="713" groupid="532" style="1" owner="jchristopherson" level="1" amendtag="end">gaining control deceptively over the decision making of the individual.</amend></subsection></subsection></subsection><subsection ssid="12-61" dnum="_-o:2-i" numlevel="1" lineno="378" slineno="5-51" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1155" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="289" groupid="219" style="1" owner="jchristopherson" level="1" amendtag="end">Only a physician may administer electroconvulsive therapy.</amend></subsection><subsection ssid="12-66" dnum="_-o:3-i" numlevel="1" lineno="379" slineno="5-52" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1156" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="312" groupid="237" style="1" owner="jchristopherson" level="1" amendtag="end">Before administering electroconvulsive therapy to an individual, the physician shall <ln numlevel="1" lineno="380" slineno="5-53"/>provide to the individual giving informed consent the following information in a format <ln numlevel="1" lineno="381" slineno="5-54"/>that explicitly states in writing:</amend><subsection ssid="12-67" dnum="_-o:a-i" numlevel="1" lineno="382" slineno="5-55" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1157" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="324" groupid="247" style="1" owner="jchristopherson" level="1" amendtag="end">the nature and seriousness of the mental condition that requires treatment with <ln numlevel="1" lineno="383" slineno="5-56"/>electroconvulsive therapy;</amend></subsection><subsection ssid="12-68" dnum="_-o:b-i" numlevel="1" lineno="384" slineno="5-57" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1158" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="323" groupid="246" style="1" owner="jchristopherson" level="1" ea="amend" pairid="1181" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="512" groupid="385" style="1" owner="jchristopherson" level="1" amendtag="end">known current medical conditions that may increase the possibility of injury or <ln numlevel="1" lineno="421" slineno="5-94"/>death as a result of electroconvulsive therapy; and</amend></subsection><subsection ssid="12-101" dnum="_-o:vi-i" numlevel="1" lineno="422" slineno="5-95" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1182" style="1" owner="i" level="1" amendtag="start">(vi)</amend></display><amend anum="0" ea="amend" pairid="519" groupid="389" style="1" owner="jchristopherson" level="1" amendtag="end">a statement that electroconvulsive therapy is medically necessary by two <ln numlevel="1" lineno="423" slineno="5-96"/>physicians, including:</amend><subsection ssid="12-131" dnum="_-o:A-i" numlevel="1" lineno="424" slineno="5-97" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1183" style="1" owner="i" level="1" the minor, if appropriate given the <ln numlevel="1" lineno="452" slineno="5-125"/>minor's condition, before and after each administration of electroconvulsive therapy; <ln numlevel="1" lineno="453" slineno="5-126"/>and</amend></subsection><subsection ssid="12-145" dnum="_-o:f-i" numlevel="1" lineno="454" slineno="5-127" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1206" style="1" owner="i" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="726" groupid="542" style="1" owner="jchristopherson" level="1" amendtag="end">electroconvulsive therapy is ordered by a psychiatrist, or in consultation with a <ln numlevel="1" lineno="455" slineno="5-128"/>psychiatrist if the physician is not a psychiatrist.</amend></subsection></subsection><subsection ssid="12-15" dnum="_-o:5-i" numlevel="1" lineno="456" slineno="5-129" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1207" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="78" groupid="59" style="1" owner="jchristopherson" level="1" amendtag="end">A physician may not administer electroconvulsive therapy to an adult unless:</amend><subsection ssid="12-19" dnum="_-o:a-i" numlevel="1" lineno="457" slineno="5-130" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1208" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><subsection ssid="12-50" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1209" style="1" owner="i" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="246" groupid="185" style="1" owner="jchristopherson" level="1" amendtag="end">the adult has capacity and gives informed consent for each administration of <ln numlevel="1" lineno="458" slineno="5-131"/>electroconvulsive therapy; or</amend></subsection><subsection ssid="12-51" dnum="_-o:ii-i" numlevel="1" lineno="459" slineno="5-132" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1210" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="250" groupid="188" style="1" owner="jchristopherson" level="1" amendtag="end">if the adult lacks capacity as determined under Title 75A, Chapter 9, Uniform <ln numlevel="1" lineno="460" slineno="5-133"/>Health Care Decisions Act:</amend><subsection ssid="12-55" dnum="_-o:A-i" numlevel="1" lineno="461" slineno="5-134" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1211" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="273" groupid="207" style="1" owner="jchristopherson" level="1" amendtag="end">the adult's agent or default surrogate gives informed consent for each <ln numlevel="1" lineno="462" slineno="5-135"/>administration of electroconvulsive therapy;</amend></subsection><subsection ssid="12-143" dnum="_-o:B-i" numlevel="1" lineno="463" slineno="5-136" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1212" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="718" groupid="536" style="1" owner="jchristopherson" level="1" amendtag="end">the adult's informed consent is expressed in an advance health care directive; <ln numlevel="1" lineno="464" slineno="5-137"/>or</amend></subsection><subsection ssid="12-153" dnum="_-o:C-i" numlevel="1" lineno="465" slineno="5-138" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1213" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="756" groupid="562" style="1" owner="jchristopherson" level="1" amendtag="end">a person described in Subsection <xref depth="4" refnumber="78B-3-406(6)">78B-3-406(6)</xref>, gives informed consent for <ln numlevel="1" lineno="466" slineno="5-139"/>each administration of electroconvulsive therapy;</amend></subsection></subsection></subsection><subsection ssid="12-21" dnum="_-o:b-i" numlevel="1" lineno="467" slineno="5-140" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1214" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="106" groupid="80" style="1" owner="jchristopherson" level="1" amendtag="end">the physician documents the following in the adult's record:</amend><subsection ssid="12-74" dnum="_-o:i-i" numlevel="1" lineno="468" slineno="5-141" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1215" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="359" groupid="272" style="1" owner="jchristopherson" level="1" amendtag="end">the clinical justification for the use of electroconvulsive therapy to treat the adult's <ln numlevel="1" lineno="469" slineno="5-142"/>condition;</amend></subsection><subsection ssid="12-99" dnum="_-o:ii-i" numlevel="1" lineno="470" slineno="5-143" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1216" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="506" groupid="380" style="1" owner="jchristopherson" level="1" amendtag="end">required disclosures;</amend></subsection><subsection ssid="12-75" dnum="_-o:iii-i" numlevel="1" lineno="471" slineno="5-144" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1217" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="364" groupid="276" style="1" owner="jchristopherson" level="1" amendtag="end">other, less intrusive therapies that:</amend><subsection ssid="12-76" dnum="_-o:A-i" numlevel="1" lineno="472" slineno="5-145" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1218" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="369" groupid="280" style="1" owner="jchristopherson" level="1" amendtag="end">were considered to treat the adult's condition; and</amend></subsection><subsection ssid="12-77" dnum="_-o:B-i" numlevel="1" lineno="473" slineno="5-146" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1219" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="374" groupid="284" style="1" owner="jchristopherson" level="1" amendtag="end">have been administered to the individual to treat the adult's condition, and the <ln numlevel="1" lineno="474" slineno="5-147"/>results of the treatment;</amend></subsection></subsection></subsection><subsection ssid="12-126" dnum="_-o:c-i" numlevel="1" lineno="475" slineno="5-148" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1220" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="661" groupid="491" style="1" owner="jchristopherson" level="1" amendtag="end">the individual giving informed consent for the administration of electroconvulsive <ln numlevel="1" lineno="476" slineno="5-149"/>therapy to the adult receives:</amend><subsection ssid="12-127" dnum="_-o:i-i" numlevel="1" lineno="477" slineno="5-150" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1221" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="667" groupid="496" style="1" owner="jchristopherson" level="1" amendtag="end">a copy of the written expression of informed consent; and</amend></subsection><subsection ssid="12-129" dnum="_-o:ii-i" numlevel="1" lineno="478" slineno="5-151" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1222" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="674" groupid="501" style="1" owner="jchristopherson" level="1" amendtag="end">an oral explanation of required disclosures in simple, nontechnical terms in the <ln numlevel="1" lineno="479" slineno="5-152"/>primary language of the individual giving informed consent;</amend></subsection></subsection><subsection ssid="12-88" dnum="_-o:d-i" numlevel="1" lineno="480" slineno="5-153" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1223" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="446" groupid="334" style="1" owner="jchristopherson" level="1" amendtag="end">the physician administers a memory assessment to the adult before and after each <ln numlevel="1" lineno="481" slineno="5-154"/>administration of electroconvulsive therapy; and</amend></subsection><subsection ssid="12-23" dnum="_-o:e-i" numlevel="1" lineno="482" slineno="5-155" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1224" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="117" groupid="89" style="1" owner="jchristopherson" level="1" amendtag="end">electroconvulsive therapy is ordered by a psychiatrist, or in consultation with a <ln numlevel="1" lineno="483" slineno="5-156"/>psychiatrist if the physician is not a psychiatrist.</amend></subsection></subsection><subsection ssid="12-114" dnum="_-o:6-i" numlevel="1" lineno="484" slineno="5-157" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1225" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="599" groupid="448" style="1" owner="jchristopherson" level="1" amendtag="end">Informed consent given as described in this section may be withdrawn at any time.</amend></subsection><subsection ssid="12-34" dnum="_-o:7-i" numlevel="1" lineno="485" slineno="5-158" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1226" style="1" owner="i" level="1" Subsection (7)(b), the requirements of this section apply in <ln numlevel="1" lineno="486" slineno="5-159"/>addition to any requirements described in Title 75A, Chapter 9, Uniform Health Care <ln numlevel="1" lineno="487" slineno="5-160"/>Decisions Act, and any other applicable provision of law.</amend></subsection><subsection ssid="12-36" dnum="_-o:b-i" numlevel="1" lineno="488" slineno="5-161" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1228" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="182" groupid="137" style="1" owner="jchristopherson" level="1" amendtag="end">If any provision of this section conflicts with any other provisions of law, the more <ln numlevel="1" lineno="489" slineno="5-162"/>specific or more restrictive law shall control.</amend></subsection></subsection><subsection ssid="12-5" dnum="_-o:8-i" numlevel="1" lineno="490" slineno="5-163" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1229" style="1" owner="i" level="1" amendtag="start">(8)</amend></display><amend anum="0" ea="amend" pairid="28" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="end">A violation of this section is unprofessional conduct.</amend></subsection><subsection ssid="12-6" dnum="_-o:9-i" numlevel="1" lineno="491" slineno="5-164" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1230" style="1" owner="i" level="1" amendtag="start">(9)</amend></display><amend anum="0" ea="amend" pairid="37" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="end">A rule adopted under this title that defines "unprofessional conduct" shall be consistent <ln numlevel="1" lineno="492" slineno="5-165"/>with this section.</amend></subsection></section></bsec><bsec buid="18" num="78B-3-406" type="amend" src="code" uid="C78B-3-S406_2026050620260506" sort="78B03 04060020260506" numlevel="1" lineno="493" slineno="6-1" sn="6"><section number="78B-3-406" numlevel="1" lineno="494" slineno="6-2" type="amend"><secline lineno="493">Section 6. Section <bold>78B-3-406</bold> is amended to read:</secline><catline lineno="494"><bold>78B-3-406<parens/>. Failure to obtain informed consent -- Proof required of patient -- <ln numlevel="1" lineno="495" slineno="6-3"/>Defenses -- Consent to health care.</bold></catline><subsection ssid="18-null-1" dnum="1-o" numlevel="1" lineno="496" slineno="6-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="18-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>When a person submits to health care rendered by a health care provider, it is <ln numlevel="1" lineno="497" slineno="6-5"/>presumed that actions taken by the health care provider are either expressly or <ln numlevel="1" lineno="498" slineno="6-6"/>impliedly authorized to be done.</subsection><subsection ssid="18-null-3" dnum="b-o" numlevel="1" lineno="499" slineno="6-7" level="2"><display>(b)</display>For a patient to recover damages from a health care provider in an action based upon <ln numlevel="1" lineno="500" slineno="6-8"/>the provider's failure to obtain informed consent, the patient must prove the following:<subsection ssid="18-null-4" dnum="i-o" numlevel="1" lineno="501" slineno="6-9" level="3"><display>(i)</display>that a provider-patient relationship existed between the patient and health care <ln numlevel="1" lineno="502" slineno="6-10"/>provider;</subsection><subsection ssid="18-null-5" dnum="ii-o" numlevel="1" lineno="503" slineno="6-11" level="3"><display>(ii)</display>the health care provider rendered health care to the patient;</subsection><subsection ssid="18-null-6" dnum="iii-o" numlevel="1" lineno="504" slineno="6-12" level="3"><display>(iii)</display>the patient suffered personal injuries arising out of the health care rendered;</subsection><subsection ssid="18-null-7" dnum="iv-o" numlevel="1" lineno="505" slineno="6-13" level="3"><display>(iv)</display>the health care rendered carried with it a substantial and significant risk of <ln numlevel="1" lineno="506" slineno="6-14"/>causing the patient serious harm;</subsection><subsection ssid="18-null-8" dnum="v-o" numlevel="1" lineno="507" slineno="6-15" level="3"><display>(v)</display>the patient was not informed of the substantial and significant risk;</subsection><subsection ssid="18-null-9" dnum="vi-o" numlevel="1" lineno="508" slineno="6-16" level="3"><display>(vi)</display>a reasonable, prudent person in the patient's position would not have consented to <ln numlevel="1" lineno="509" slineno="6-17"/>the health care rendered after having been fully informed as to all facts relevant to <ln numlevel="1" lineno="510" slineno="6-18"/>the decision to give consent; and</subsection><subsection ssid="18-null-10" dnum="vii-o" numlevel="1" lineno="511" slineno="6-19" level="3"><display>(vii)</display>the unauthorized part of the health care rendered was the proximate cause of <ln numlevel="1" lineno="512" slineno="6-20"/>personal injuries suffered by the patient.</subsection></subsection></subsection><subsection ssid="18-null-11" dnum="2-o" numlevel="1" lineno="513" slineno="6-21" level="1"><display>(2)</display>In determining what a reasonable, prudent person in the patient's position would do <ln numlevel="1" lineno="514" slineno="6-22"/>under the circumstances, the finder of fact shall use the viewpoint of the patient before <ln numlevel="1" lineno="515" slineno="6-23"/>health care was provided and before the occurrence of any personal injuries alleged to <ln numlevel="1" lineno="516" slineno="6-24"/>have arisen from said health care.</subsection><subsection ssid="18-null-12" dnum="3-o" numlevel="1" lineno="517" slineno="6-25" level="1"><display>(3)</display>It shall be a defense to any malpractice action against a health care provider based upon <ln numlevel="1" lineno="518" slineno="6-26"/>alleged failure to obtain informed consent if:<subsection ssid="18-null-13" dnum="a-o" numlevel="1" lineno="519" slineno="6-27" level="2"><display>(a)</display>the risk of the serious harm which the patient actually suffered was relatively minor;</subsection><subsection ssid="18-null-14" dnum="b-o" numlevel="1" lineno="520" slineno="6-28" level="2"><display>(b)</display>the risk of serious harm to the patient from the health care provider was commonly <ln numlevel="1" lineno="521" slineno="6-29"/>known to the public;</subsection><subsection ssid="18-null-15" dnum="c-o" numlevel="1" lineno="522" slineno="6-30" level="2"><display>(c)</display>the patient stated, prior to receiving the health care complained of, that he would <ln numlevel="1" lineno="523" slineno="6-31"/>accept the health care involved regardless of the risk; or that he did not want to be <ln numlevel="1" lineno="524" slineno="6-32"/>informed of the matters to which he would be entitled to be informed;</subsection><subsection ssid="18-null-16" dnum="d-o" numlevel="1" lineno="525" slineno="6-33" level="2"><display>(d)</display>the health care provider, after considering all of the attendant facts and <ln numlevel="1" lineno="526" slineno="6-34"/>circumstances, used reasonable discretion as to the manner and extent to which risks <ln numlevel="1" lineno="527" slineno="6-35"/>were disclosed, if the health care provider reasonably believed that additional <ln numlevel="1" lineno="528" slineno="6-36"/>disclosures could be expected to have a substantial and adverse effect on the patient's <ln numlevel="1" lineno="529" slineno="6-37"/>condition; or</subsection><subsection ssid="18-null-17" dnum="e-o" numlevel="1" lineno="530" slineno="6-38" level="2"><display>(e)</display>the patient or the patient's representative executed a written consent which sets forth <ln numlevel="1" lineno="531" slineno="6-39"/>the nature and purpose of the intended health care and which contains a declaration <ln numlevel="1" lineno="532" slineno="6-40"/>that the patient accepts the risk of substantial and serious harm, if any, in hopes of <ln numlevel="1" lineno="533" slineno="6-41"/>obtaining desired beneficial results of health care and which acknowledges that <ln numlevel="1" lineno="534" slineno="6-42"/>health care providers involved have explained the patient's condition and the <ln numlevel="1" lineno="535" slineno="6-43"/>proposed health care in a satisfactory manner and that all questions asked about the <ln numlevel="1" lineno="536" slineno="6-44"/>health care and its attendant risks have been answered in a manner satisfactory to the <ln numlevel="1" lineno="537" slineno="6-45"/>patient or the patient's representative.</subsection></subsection><subsection ssid="18-null-18" dnum="4-o" numlevel="1" lineno="538" slineno="6-46" level="1"><display>(4)</display>The written consent shall be a defense to an action against a health care provider based <ln numlevel="1" lineno="539" slineno="6-47"/>upon failure to obtain informed consent unless the patient proves that the person giving <ln numlevel="1" lineno="540" slineno="6-48"/>the consent lacked capacity to consent or shows by clear and convincing evidence that <ln numlevel="1" lineno="541" slineno="6-49"/>the execution of the written consent was induced by the defendant's affirmative acts of <ln numlevel="1" lineno="542" slineno="6-50"/>fraudulent misrepresentation or fraudulent omission to state material facts.</subsection><subsection ssid="18-null-19" dnum="5-o" numlevel="1" lineno="543" slineno="6-51" level="1"><display>(5)</display>This act may not be construed to prevent any person 18 years old or over from refusing <ln numlevel="1" lineno="544" slineno="6-52"/>to consent to health care for the patient's own person upon personal or religious grounds.</subsection><subsection ssid="18-null-20" dnum="6-o" numlevel="1" lineno="545" slineno="6-53" level="1"><display>(6)</display>Except as provided in Section <xref depth="3" refnumber="76-7-304.5">76-7-304.5</xref>, the following persons are authorized and <ln numlevel="1" lineno="546" slineno="6-54"/>empowered to consent to any health care not prohibited by law:<subsection ssid="18-null-21" dnum="a-o" numlevel="1" lineno="547" slineno="6-55" level="2"><display>(a)</display>any parent, whether an adult or a minor, for the parent's minor child;</subsection><subsection ssid="18-null-22" dnum="b-o" numlevel="1" lineno="548" slineno="6-56" level="2"><display>(b)</display>any married person, for a spouse;</subsection><subsection ssid="18-null-23" dnum="c-o" numlevel="1" lineno="549" slineno="6-57" level="2"><display>(c)</display>any person temporarily standing in loco parentis, whether formally serving or not, for <ln numlevel="1" lineno="550" slineno="6-58"/>the minor under that person's care and any guardian for the guardian's ward;</subsection><subsection ssid="18-null-24" dnum="d-o" numlevel="1" lineno="551" slineno="6-59" level="2"><display>(d)</display>any person 18 years old or older for that person's parent who is unable by reason of <ln numlevel="1" lineno="552" slineno="6-60"/>age, physical or mental condition, to provide such consent;</subsection><subsection ssid="18-null-25" dnum="e-o" numlevel="1" lineno="553" slineno="6-61" level="2"><display>(e)</display>any patient 18 years old or older;</subsection><subsection ssid="18-null-26" dnum="f-o" numlevel="1" lineno="554" slineno="6-62" level="2"><display>(f)</display>any female regardless of age or marital status, when given in connection with her <ln numlevel="1" lineno="555" slineno="6-63"/>pregnancy or childbirth;</subsection><subsection ssid="18-null-27" dnum="g-o" numlevel="1" lineno="556" slineno="6-64" level="2"><display>(g)</display>in the absence of a parent, any adult for the adult's minor brother or sister;</subsection><subsection ssid="18-null-28" dnum="h-o" numlevel="1" lineno="557" slineno="6-65" level="2"><display>(h)</display>in the absence of a parent, any grandparent for the grandparent's minor grandchild;</subsection><subsection ssid="18-null-29" dnum="i-o" numlevel="1" lineno="558" slineno="6-66" level="2"><display>(i)</display>an emancipated minor as provided in Section <xref depth="3" refnumber="80-7-105">80-7-105</xref>;</subsection><subsection ssid="18-null-30" dnum="j-o" numlevel="1" lineno="559" slineno="6-67" level="2"><display>(j)</display>a minor who has contracted a lawful marriage; </subsection><subsection ssid="18-null-31" dnum="k-o" numlevel="1" lineno="560" slineno="6-68" level="2"><display>(k)</display>an unaccompanied homeless minor, as that term is defined in the McKinney-Vento <ln numlevel="1" lineno="561" slineno="6-69"/>Homeless Assistance Act of 1987, Pub. L. 100-77, as amended, who is 15 years old <ln numlevel="1" lineno="562" slineno="6-70"/>or older; and</subsection><subsection ssid="18-null-32" dnum="l-o" numlevel="1" lineno="563" slineno="6-71" level="2"><display>(l)</display>a minor receiving tobacco and nicotine cessation services under Section <xref depth="3" refnumber="26B-7-522">26B-7-522</xref>.</subsection></subsection><subsection ssid="18-null-33" dnum="7-o" numlevel="1" lineno="564" slineno="6-72" level="1"><display>(7)</display>A person who in good faith consents or authorizes health care treatment or procedures <ln numlevel="1" lineno="565" slineno="6-73"/>for another as provided by this act may not be subject to civil liability.</subsection><subsection ssid="18-null-34" dnum="8-o" numlevel="1" lineno="566" slineno="6-74" level="1"><display>(8)</display>Notwithstanding any other provision of this section<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="5" style="2" owner="jchristopherson" level="1" deltag="both">,</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">:</amend> <subsection ssid="18-35" dnum="_-o:a-i" numlevel="1" lineno="567" slineno="6-75" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1265" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>if a health care provider fails to comply with the requirement in Section <xref depth="3" refnumber="58-1-509">58-1-509</xref>, <ln numlevel="1" lineno="568" slineno="6-76"/>the health care provider is presumed to have lacked informed consent with respect to <ln numlevel="1" lineno="569" slineno="6-77"/>the patient examination, as defined in Section <xref depth="3" refnumber="58-1-509">58-1-509</xref><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="14" groupid="13" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="12" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="18-36" dnum="_-o:b-i" numlevel="1" lineno="570" slineno="6-78" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1266" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="end">if a physician fails to comply with the requirements in Section <xref depth="3" refnumber="58-1-514">58-1-514</xref>, the <ln numlevel="1" lineno="571" slineno="6-79"/>physician is presumed to have lacked informed consent with respect to the <ln numlevel="1" lineno="572" slineno="6-80"/>administration of electroconvulsive therapy, as defined in Section <xref depth="3" refnumber="58-1-514">58-1-514</xref>.</amend></subsection></subsection></section></bsec><bsec buid="21" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="573" slineno="7-1" sn="7"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="573">Section 7.  <bold>Effective Date.</bold></secline><sectionText lineno="574"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>1-28-26 2:41 PM</tm></rev></foot></leg>
