and</hl><hl numlevel="1" lineno="14" slineno="0-14" level="2">victim;</hl></hl><hl numlevel="1" lineno="15" slineno="0-15" level="1">requires the board, if considering whether to parole an offender who has previously been <ln numlevel="1" lineno="16" slineno="0-16"/>paroled and had the offender's parole terminated due to a new criminal offense, to <ln numlevel="1" lineno="17" slineno="0-17"/>consider the facts and circumstances of the new criminal offense in determining whether <ln numlevel="1" lineno="18" slineno="0-18"/>the offender should be paroled again;</hl><hl numlevel="1" lineno="19" slineno="0-19" level="1">prohibits the board, when determining whether parole should be granted or terminated for <ln numlevel="1" lineno="20" slineno="0-20"/>an offender, from considering prison capacity, bed availability, or institutional <ln numlevel="1" lineno="21" slineno="0-21"/>population levels;</hl><hl numlevel="1" lineno="22" slineno="0-22" level="1">prohibits the board from paroling an offender who has not completed any ordered <ln numlevel="1" lineno="23" slineno="0-23"/>treatment or programing while incarcerated;</hl><hl numlevel="1" lineno="24" slineno="0-24" level="1">allows the board to only consider a pardon for an offender who has committed an offense <ln numlevel="1" lineno="25" slineno="0-25"/>that requires the offender to register on the Sex, Kidnap, and Child Abuse Offender <ln numlevel="1" lineno="26" slineno="0-26"/>Registry (the registry) if:<hl numlevel="1" lineno="27" slineno="0-27" level="2">for a sex offender required to register on the registry for 10 years, 10 years have <ln numlevel="1" lineno="28" slineno="0-28"/>passed from when the sex offender entered the community after the sex offender's <ln numlevel="1" lineno="29" slineno="0-29"/>conviction; or</hl><hl numlevel="1" lineno="30" slineno="0-30" level="2">for a sex offender required to register on the registry for the sex offender's lifetime, 20 <ln numlevel="1" lineno="31" slineno="0-31"/>years have passed from when the sex offender entered the community after the sex <ln numlevel="1" lineno="32" slineno="0-32"/>offender's conviction;</hl></hl><hl numlevel="1" lineno="33" slineno="0-33" level="1">prohibits the board from re-paroling an offender who has been charged with committing a <ln numlevel="1" lineno="34" slineno="0-34"/>violent felony during the offender's previous parole;</hl><hl numlevel="1" lineno="35" slineno="0-35" level="1">prohibits an offender from taking possession of a written statement, or a copy of the <ln numlevel="1" lineno="36" slineno="0-36"/>written statement, from a victim of the offender's offense that is written to the board;</hl><hl numlevel="1" lineno="37" slineno="0-37" level="1">adds to the requirements for the board to meet before the board may parole an offender <ln numlevel="1" lineno="38" slineno="0-38"/>before the offender's minimum term of imprisonment has been met; Section <bold>77-27-1</bold> is amended to read:</secline><catline lineno="61"><bold>77-27-1<parens/>. Definitions.</bold></catline><sectionText lineno="62"><tab/>As used in this chapter:</sectionText><subsection ssid="9-null-1" dnum="1-o" numlevel="1" lineno="63" slineno="1-4" level="1"><display>(1)</display>"Appearance" means any opportunity to address the board, a board member, a panel, or <ln numlevel="1" lineno="64" slineno="1-5"/>hearing officer, including an interview.</subsection><subsection ssid="9-null-2" dnum="2-o" numlevel="1" lineno="65" slineno="1-6" level="1"><display>(2)</display>"Board" means the Board of Pardons and Parole.</subsection><subsection ssid="9-null-3" dnum="3-o" numlevel="1" lineno="66" slineno="1-7" level="1" space="false"><display>(3)</display><subsection ssid="9-null-4" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Case action plan" means a document developed by the Department of <ln numlevel="1" lineno="67" slineno="1-8"/>Corrections that identifies the program priorities for the treatment of the offender.</subsection><subsection ssid="9-null-5" dnum="b-o" numlevel="1" lineno="68" slineno="1-9" level="2"><display>(b)</display>"Case action plan" includes the criminal risk factors as determined by a risk and <ln numlevel="1" lineno="69" slineno="1-10"/>needs assessment conducted by the department.</subsection></subsection><subsection ssid="9-null-6" dnum="4-o" numlevel="1" lineno="70" slineno="1-11" level="1"><display>(4)</display>"Commission" means the State Commission on Criminal and Juvenile Justice created in <ln numlevel="1" lineno="71" slineno="1-12"/>Section <xref depth="3" refnumber="63M-7-201" start="0">63M-7-201</xref>.</subsection><subsection ssid="9-null-7" dnum="5-o" numlevel="1" lineno="72" slineno="1-13" level="1"><display>(5)</display>"Commutation" is the change from a greater to a lesser punishment after conviction.</subsection><subsection ssid="9-null-8" dnum="6-o" numlevel="1" lineno="73" slineno="1-14" level="1"><display>(6)</display>"Criminal accounts receivable" means the same as that term is defined in Section <xref depth="3" refnumber="77-32b-102" start="0"><ln numlevel="1" lineno="74" slineno="1-15"/>77-32b-102</xref>.</subsection><subsection ssid="9-null-9" dnum="7-o" numlevel="1" lineno="75" slineno="1-16" level="1"><display>(7)</display>"Criminal risk factors" means a person's characteristics and behaviors that:<subsection ssid="9-null-10" dnum="a-o" numlevel="1" lineno="76" slineno="1-17" level="2"><display>(a)</display>affect that person's risk of engaging in criminal behavior; and</subsection><subsection ssid="9-null-11" dnum="b-o" numlevel="1" lineno="77" slineno="1-18" level="2"><display>(b)</display>are diminished when addressed by effective treatment, supervision, and other support <ln numlevel="1" lineno="78" slineno="1-19"/>resources resulting in reduced risk of criminal behavior.</subsection></subsection><subsection ssid="9-null-12" dnum="8-o" numlevel="1" lineno="79" slineno="1-20" level="1" space="false"><display>(8)</display><subsection ssid="9-null-13" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Deliberative process" means the board or any number of the board's individual <ln numlevel="1" lineno="80" slineno="1-21"/>members together engaging in discussions, whether written or verbal, regarding a <ln numlevel="1" lineno="81" slineno="1-22"/>parole, a pardon, a commutation, termination of sentence, or fines, fees, or restitution <ln numlevel="1" lineno="82" slineno="1-23"/>in an individual case.</subsection><subsection ssid="9-null-14" dnum="b-o" numlevel="1" lineno="83" slineno="1-24" level="2"><display>(b)</display>"Deliberative process" includes the votes, mental processes, written notes, and <ln numlevel="1" lineno="84" slineno="1-25"/>recommendations of individual board members and staff.</subsection><subsection ssid="9-null-15" dnum="c-o" numlevel="1" lineno="85" slineno="1-26" level="2"><display>(c)</display>"Deliberative process" does not include:<subsection ssid="9-null-16" dnum="i-o" numlevel="1" lineno="86" slineno="1-27" level="3"><display>(i)</display>a hearing where the offender is present;</subsection><subsection ssid="9-null-17" dnum="ii-o" numlevel="1" lineno="87" slineno="1-28" level="3"><display>(ii)</display>any factual record the board is considering, including records of the offender's <ln numlevel="1" lineno="88" slineno="1-29"/>criminal convictions, records regarding the offender's current or previous <ln numlevel="1" lineno="89" slineno="1-30"/>incarceration and supervision, and records regarding the offender's physical or <ln numlevel="1" lineno="90" slineno="1-31"/>mental health;</subsection><subsection ssid="9-null-18" dnum="iii-o" numlevel="1" lineno="91" slineno="1-32" level="3"><display>(iii)</display>recommendations regarding the offender's incarceration or supervision from any <ln numlevel="1" lineno="92" slineno="1-33"/>other individual, governmental entity, or agency;</subsection><subsection ssid="9-null-19" dnum="iv-o" numlevel="1" lineno="93" slineno="1-34" level="3"><display>(iv)</display>testimony received by the board regarding the offender, whether written or <ln numlevel="1" lineno="94" slineno="1-35"/>verbal; or</subsection><subsection ssid="9-null-20" dnum="v-o" numlevel="1" lineno="95" slineno="1-36" level="3"><display>(v)</display>the board's decision or rationale for the decision.</subsection></subsection></subsection><subsection ssid="9-null-21" dnum="9-o" numlevel="1" lineno="96" slineno="1-37" level="1"><display>(9)</display>"Department" means the Department of Corrections.</subsection><subsection ssid="9-null-22" dnum="10-o" numlevel="1" lineno="97" slineno="1-38" level="1"><display>(10)</display>"Expiration" means when the maximum sentence has run.</subsection><subsection ssid="9-null-23" dnum="11-o" numlevel="1" lineno="98" slineno="1-39" level="1"><display>(11)</display>"Family" means any individual related to the victim as a spouse, child, sibling, parent, <ln numlevel="1" lineno="99" slineno="1-40"/>or grandparent, or the victim's legal guardian.</subsection><subsection ssid="9-null-24" dnum="12-o" numlevel="1" lineno="100" slineno="1-41" level="1"><display>(12)</display>"Hearing" or "full hearing" means an appearance before the board, a panel, a board <ln numlevel="1" lineno="101" slineno="1-42"/>member or hearing examiner, at which an offender or inmate is afforded an opportunity <ln numlevel="1" lineno="102" slineno="1-43"/>to be present and address the board.</subsection><subsection ssid="9-null-25" dnum="13-o" numlevel="1" lineno="103" slineno="1-44" level="1"><display>(13)</display>"Location," in reference to a hearing, means the physical location at which the board, a <ln numlevel="1" lineno="104" slineno="1-45"/>panel, a board member, or a hearing examiner is conducting the hearing, regardless of <ln numlevel="1" lineno="105" slineno="1-46"/>the location of any person participating by electronic means.</subsection><subsection ssid="9-null-26" dnum="14-o" numlevel="1" lineno="106" slineno="1-47" level="1"><display>(14)</display>"Open session" means any hearing, before the board, a panel, a board member, or a <ln numlevel="1" lineno="107" slineno="1-48"/>hearing examiner, that is open to the public, regardless of the location of any person <ln numlevel="1" lineno="108" slineno="1-49"/>participating by electronic means.</subsection><subsection ssid="9-null-27" dnum="15-o" numlevel="1" lineno="109" slineno="1-50" level="1"><display>(15)</display>"Panel" means members of the board assigned by the chairperson to a particular case.</subsection><subsection ssid="9-null-28" dnum="16-o" numlevel="1" lineno="110" slineno="1-51" level="1"><display>(16)</display>"Pardon" means:<subsection ssid="9-null-29" dnum="a-o" numlevel="1" lineno="111" slineno="1-52" level="2"><display>(a)</display>an act of grace that forgives a criminal conviction and restores the rights and <ln numlevel="1" lineno="112" slineno="1-53"/>privileges forfeited by or because of the criminal conviction;</subsection><subsection ssid="9-null-30" dnum="b-o" numlevel="1" lineno="113" slineno="1-54" level="2"><display>(b)</display>the release of an offender from the entire punishment prescribed for a criminal <ln numlevel="1" lineno="114" slineno="1-55"/>offense and from disabilities that are a consequence of the criminal conviction; and</subsection><subsection ssid="9-null-31" dnum="c-o" numlevel="1" lineno="115" slineno="1-56" level="2"><display>(c)</display>the reinstatement of any civil rights lost as a consequence of conviction or <ln numlevel="1" lineno="116" slineno="1-57"/>punishment for a criminal offense.</subsection></subsection><subsection ssid="9-null-32" dnum="17-o" numlevel="1" lineno="117" slineno="1-58" level="1"><display>(17)</display>"Parole" means a release from imprisonment on prescribed conditions which, if <ln numlevel="1" lineno="118" slineno="1-59"/>satisfactorily performed by the parolee, enables the parolee to obtain a termination of the <ln numlevel="1" lineno="119" slineno="1-60"/>parolee's sentence.</subsection><subsection ssid="9-null-33" dnum="18-o" numlevel="1" lineno="120" slineno="1-61" level="1"><display>(18)</display>"Payment schedule" means the same as that term is defined in Section <xref depth="3" refnumber="77-32b-102" start="0">77-32b-102</xref>.</subsection><subsection ssid="9-null-34" dnum="19-o" numlevel="1" lineno="121" slineno="1-62" level="1"><display>(19)</display>"Pecuniary damages" means the same as that term is defined in Section <xref depth="3" refnumber="77-38b-102" start="0">77-38b-102</xref>.</subsection><subsection ssid="9-null-35" dnum="20-o" numlevel="1" lineno="122" slineno="1-63" level="1"><display>(20)</display>"Probation" means an act of grace by the court suspending the imposition or execution <ln numlevel="1" lineno="123" slineno="1-64"/>of a convicted offender's sentence upon prescribed conditions.</subsection><subsection ssid="9-null-36" dnum="21-o" numlevel="1" lineno="124" slineno="1-65" level="1"><display>(21)</display>"Remit" or "remission" means the same as that term is defined in Section <xref depth="3" refnumber="77-32b-102" start="0">77-32b-102</xref>.</subsection><subsection ssid="9-null-37" dnum="22-o" numlevel="1" lineno="125" slineno="1-66" level="1"><display>(22)</display>"Reprieve" or "respite" means the temporary suspension of the execution of the <ln numlevel="1" lineno="126" slineno="1-67"/>sentence.</subsection><subsection ssid="9-null-38" dnum="23-o" numlevel="1" lineno="127" slineno="1-68" level="1"><display>(23)</display>"Restitution" means the same as that term is defined in Section <xref depth="3" refnumber="77-38b-102" start="0">77-38b-102</xref>.</subsection><subsection ssid="9-null-39" dnum="24-o" numlevel="1" lineno="128" slineno="1-69" level="1"><display>(24)</display>"Termination" means the act of discharging from parole or concluding the sentence of <ln numlevel="1" lineno="129" slineno="1-70"/>imprisonment before the expiration of the sentence.</subsection><subsection ssid="9-null-40" dnum="25-o" numlevel="1" lineno="130" slineno="1-71" level="1"><display>(25)</display>"Victim" means:<subsection ssid="9-null-41" dnum="a-o" numlevel="1" lineno="131" slineno="1-72" level="2"><display>(a)</display>a person against whom the defendant committed a felony or class A misdemeanor <ln numlevel="1" lineno="132" slineno="1-73"/>offense for which a hearing is held under this chapter; or</subsection><subsection ssid="9-null-42" dnum="b-o" numlevel="1" lineno="133" slineno="1-74" level="2"><display>(b)</display>the victim's family if the victim is deceased as a result of the offense for which a <ln numlevel="1" lineno="134" slineno="1-75"/>hearing is held under this chapter.</subsection></subsection><subsection ssid="9-43" dnum="_-o:26-i" numlevel="1" lineno="135" slineno="1-76" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1042" style="1" owner="i" level="1" amendtag="start">(26)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">"Violent felony" means the same as that term is defined in Section <xref depth="3" refnumber="76-3-203.5">76-3-203.5</xref>.</amend></subsection></section></bsec><bsec buid="1" num="77-27-5" type="amend" src="code" uid="C77-27-S5_2026050620260506" sort="77 27 00050020260506" numlevel="1" lineno="136" slineno="2-1" sn="2"><section number="77-27-5" numlevel="1" lineno="137" slineno="2-2" type="amend"><secline lineno="136">Section 2. Section <bold>77-27-5</bold> is amended to read:</secline><catline lineno="137"><bold>77-27-5<parens/>. Board of Pardons and Parole authority.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="138" slineno="2-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="1-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Subject to this chapter and other laws of the state, and except for a conviction for <ln numlevel="1" lineno="139" slineno="2-4"/>treason or impeachment, the board shall determine by majority decision when and <ln numlevel="1" lineno="140" slineno="2-5"/>under what conditions an offender's conviction may be pardoned or commuted.</subsection><subsection ssid="1-null-3" dnum="b-o" numlevel="1" lineno="141" slineno="2-6" level="2"><display>(b)</display>The board shall determine by majority decision when and under what conditions an <ln numlevel="1" lineno="142" slineno="2-7"/>offender committed to serve a sentence at a penal or correctional facility, which is <ln numlevel="1" lineno="143" slineno="2-8"/>under the jurisdiction of the department, may:<subsection ssid="1-null-4" dnum="i-o" numlevel="1" lineno="144" slineno="2-9" level="3"><display>(i)</display>be released upon parole;</subsection><subsection ssid="1-null-5" dnum="ii-o" numlevel="1" lineno="145" slineno="2-10" level="3"><display>(ii)</display>have a fine or forfeiture remitted;</subsection><subsection ssid="1-null-6" dnum="iii-o" numlevel="1" lineno="146" slineno="2-11" level="3"><display>(iii)</display>have the offender's criminal accounts receivable remitted in accordance with <ln numlevel="1" lineno="147" slineno="2-12"/>Section <xref depth="3" refnumber="77-32b-105">77-32b-105</xref> or <xref depth="3" refnumber="77-32b-106">77-32b-106</xref>;</subsection><subsection ssid="1-null-7" dnum="iv-o" numlevel="1" lineno="148" slineno="2-13" level="3"><display>(iv)</display>have the offender's payment schedule modified in accordance with Section <xref depth="3" refnumber="77-32b-103"><ln numlevel="1" lineno="149" slineno="2-14"/>77-32b-103</xref>; or</subsection><subsection ssid="1-null-8" dnum="v-o" numlevel="1" lineno="150" slineno="2-15" level="3"><display>(v)</display>have the offender's sentence terminated.</subsection></subsection><subsection ssid="1-null-9" dnum="c-o" numlevel="1" lineno="151" slineno="2-16" level="2"><display>(c)</display>The board shall prioritize public safety when making a determination under <ln numlevel="1" lineno="152" slineno="2-17"/>Subsection <xref depth="4" refnumber="77-27-5(1)(a)">(1)(a)</xref> or <xref depth="4" refnumber="77-27-5(1)(b)">(1)(b)</xref>.</subsection><subsection ssid="1-null-10" dnum="d-o" numlevel="1" lineno="153" slineno="2-18" level="2" space="false"><display>(d)</display><subsection ssid="1-null-11" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The board may sit together or in panels to conduct hearings.</subsection><subsection ssid="1-null-12" dnum="ii-o" numlevel="1" lineno="154" slineno="2-19" level="3"><display>(ii)</display>The chair shall appoint members to the panels in any combination and in <ln numlevel="1" lineno="155" slineno="2-20"/>accordance with rules made by the board in accordance with Title 63G, Chapter 3, <ln numlevel="1" lineno="156" slineno="2-21"/>Utah Administrative Rulemaking Act.</subsection><subsection ssid="1-null-13" dnum="iii-o" numlevel="1" lineno="157" slineno="2-22" level="3"><display>(iii)</display>The chair may participate on any panel and when doing so is chair of the panel.</subsection><subsection ssid="1-null-14" dnum="iv-o" numlevel="1" lineno="158" slineno="2-23" level="3"><display>(iv)</display>The chair of the board may designate the chair for any other panel.</subsection></subsection><subsection ssid="1-null-15" dnum="e-o" numlevel="1" lineno="159" slineno="2-24" level="2" space="false"><display>(e)</display><subsection ssid="1-null-16" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Except after a hearing before the board, or the board's appointed examiner, in <ln numlevel="1" lineno="160" slineno="2-25"/>an open session, the board may not:<subsection ssid="1-null-17" dnum="A-o" numlevel="1" lineno="161" slineno="2-26" level="4" tab="1"><display>(A)</display>remit a fine or forfeiture for an offender or the offender's criminal accounts <ln numlevel="1" lineno="162" slineno="2-27"/>receivable;</subsection><subsection ssid="1-null-18" dnum="B-o" numlevel="1" lineno="163" slineno="2-28" level="4" tab="1"><display>(B)</display>release the offender on parole; or</subsection><subsection ssid="1-null-19" dnum="C-o" numlevel="1" lineno="164" slineno="2-29" level="4" tab="1"><display>(C)</display>commute, pardon, or terminate an offender's sentence.</subsection></subsection><subsection ssid="1-null-20" dnum="ii-o" numlevel="1" lineno="165" slineno="2-30" level="3"><display>(ii)</display>An action taken under this Subsection <xref depth="4" refnumber="77-27-5(1)">(1)</xref> other than by a majority of the board <ln numlevel="1" lineno="166" slineno="2-31"/>shall be affirmed by a majority of the board.</subsection></subsection><subsection ssid="1-null-21" dnum="f-o" numlevel="1" lineno="167" slineno="2-32" level="2"><display>(f)</display>A commutation or pardon may be granted only after a full hearing before the board.</subsection></subsection><subsection ssid="1-null-22" dnum="2-o:_-i" numlevel="1" lineno="168" slineno="2-33" ea="erase" anum="0" owner="jchristopherson" style="2" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1064" style="2" owner="o" level="1" deltag="start">(2)</amend></display><subsection ssid="1-null-23" dnum="a-o:_-i" ea="erase" anum="0" owner="jchristopherson" style="2" level="2" placement="sameline"><display><amend anum="0" ea="erase" pairid="1065" style="2" owner="o" level="1">(a)</amend></display><amend anum="0" ea="erase" pairid="42" groupid="31" style="2" owner="jchristopherson" level="1" deltag="end">In the case of a hearing, timely prior notice of the time and location of the <ln numlevel="1" lineno="169" slineno="2-34"/>hearing shall be given to the offender.</amend><amendoutend style="2"/></subsection><subsection ssid="1-null-24" dnum="b-o:_-i" numlevel="1" lineno="170" slineno="2-35" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1066" style="2" owner="o" level="1" deltag="start">(b)</amend></display><amend anum="0" ea="erase" pairid="10" groupid="8" style="2" owner="jchristopherson" level="1" deltag="end">The county or district attorney's office responsible for prosecution of the case, the <ln numlevel="1" lineno="171" slineno="2-36"/>sentencing court, and law enforcement officials responsible for the defendant's arrest <ln numlevel="1" lineno="172" slineno="2-37"/>and conviction shall be notified of any board hearings through the board's website.</amend><amendoutend style="2"/></subsection><subsection ssid="1-null-25" dnum="c-o:_-i" numlevel="1" lineno="173" slineno="2-38" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1067" style="2" owner="o" level="1" deltag="start">(c)</amend></display><amend anum="0" ea="erase" pairid="13" groupid="10" style="2" owner="jchristopherson" level="1" deltag="end">Whenever possible, the victim or the victim's representative, if designated, shall be <ln numlevel="1" lineno="174" slineno="2-39"/>notified of original hearings and any hearing after that if notification is requested and <ln numlevel="1" lineno="175" slineno="2-40"/>current contact information has been provided to the board.</amend><amendoutend style="2"/></subsection><subsection ssid="1-null-26" dnum="d-o:_-i" numlevel="1" lineno="176" slineno="2-41" ea="erase" anum="0" owner="jchristopherson" style="2" level="2" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1068" style="2" owner="o" level="1" deltag="start">(d)</amend></display><subsection ssid="1-null-27" dnum="i-o:_-i" ea="erase" anum="0" owner="jchristopherson" style="2" level="3" placement="sameline"><display><amend anum="0" ea="erase" pairid="1069" style="2" owner="o" level="1">(i)</amend></display><amend anum="0" ea="erase" pairid="20" groupid="14" style="2" owner="jchristopherson" level="1" deltag="end">Notice to the victim or the victim's representative shall include information <ln numlevel="1" lineno="177" slineno="2-42"/>provided in Section <xref depth="3" refnumber="77-27-9.5">77-27-9.5</xref>, and any related rules made by the board under that <ln numlevel="1" lineno="178" slineno="2-43"/>section.</amend><amendoutend style="2"/></subsection><subsection ssid="1-null-28" dnum="ii-o:_-i" numlevel="1" lineno="179" slineno="2-44" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1070" style="2" owner="o" level="1" deltag="start">(ii)</amend></display><amend anum="0" ea="erase" pairid="23" groupid="17" style="2" owner="jchristopherson" level="1" deltag="end">The information under Subsection <xref depth="4" refnumber="77-27-5(2)(d)(i)">(2)(d)(i)</xref> shall be provided in terms that are <ln numlevel="1" lineno="180" slineno="2-45"/>reasonable for the lay person to understand.</amend><amendoutend style="2"/></subsection></subsection></subsection><subsection ssid="1-90" dnum="_-o:2-i" numlevel="1" lineno="181" slineno="2-46" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1071" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><subsection ssid="1-104" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1072" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="118" groupid="92" style="1" owner="jchristopherson" level="1" amendtag="end">If a hearing is held in accordance with Subsection <xref depth="4" refnumber="77-27-5(1)">(1)</xref>, the board anum="0" ea="amend" pairid="181" groupid="130" style="1" owner="jchristopherson" level="1" amendtag="end">timely notice as described in Subsection <xref refnumber="1-97">(2)(b)</xref> of an upcoming hearing related to <ln numlevel="1" lineno="184" slineno="2-49"/>an offender to:</amend><subsection ssid="1-94" dnum="_-o:A-i" numlevel="1" lineno="185" slineno="2-50" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1075" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="139" groupid="107" style="1" owner="jchristopherson" level="1" amendtag="end">the county or district attorney's office responsible for prosecution of the <ln numlevel="1" lineno="186" slineno="2-51"/>offender's case;</amend></subsection><subsection ssid="1-95" dnum="_-o:B-i" numlevel="1" lineno="187" slineno="2-52" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1076" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="142" groupid="109" style="1" owner="jchristopherson" level="1" amendtag="end">the court that sentenced the offender; and</amend></subsection><subsection ssid="1-96" dnum="_-o:C-i" numlevel="1" lineno="188" slineno="2-53" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1077" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="145" groupid="111" style="1" owner="jchristopherson" level="1" amendtag="end">the law enforcement agency that initially arrested the offender; and</amend></subsection></subsection><subsection ssid="1-105" dnum="_-o:iii-i" numlevel="1" lineno="189" slineno="2-54" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1078" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="186" groupid="134" style="1" owner="jchristopherson" level="1" amendtag="end">timely notice to the victim or the victim's representative of the time and location <ln numlevel="1" lineno="190" slineno="2-55"/>of the upcoming hearing that meets the requirements described in Section <xref depth="3" refnumber="77-27-9.5"><ln numlevel="1" lineno="191" slineno="2-56"/>77-27-9.5</xref>.</amend></subsection></subsection><subsection ssid="1-97" dnum="_-o:b-i" numlevel="1" lineno="192" slineno="2-57" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1079" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><subsection ssid="1-106" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1080" style="1" owner="i" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="148" groupid="113" style="1" owner="jchristopherson" level="1" amendtag="end">Except as provided in Subsection <xref depth="4" refnumber="77-27-5(2)(b)(ii)">(2)(b)(ii)</xref>, the board shall provide the <ln numlevel="1" lineno="193" slineno="2-58"/>notification described in Subsection <xref tempid="313">(2)(a)(ii)</xref> at least 30 days before the day on <ln numlevel="1" lineno="194" slineno="2-59"/>which the hearing will be held to the county or district attorney's office, the court, <ln numlevel="1" lineno="195" slineno="2-60"/>and the law enforcement agency by:</amend><subsection ssid="1-98" dnum="_-o:A-i" numlevel="1" lineno="196" slineno="2-61" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1081" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="151" groupid="115" style="1" owner="jchristopherson" level="1" amendtag="end">publishing the notification on the board's website;</amend></subsection><subsection ssid="1-99" dnum="_-o:B-i" numlevel="1" lineno="197" slineno="2-62" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1082" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="154" groupid="117" style="1" owner="jchristopherson" level="1" amendtag="end">emailing a notification to the applicable attorney's office, court, and law <ln numlevel="1" lineno="198" slineno="2-63"/>enforcement agency;</amend></subsection><subsection ssid="1-100" dnum="_-o:C-i" numlevel="1" lineno="199" slineno="2-64" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1083" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="157" groupid="119" style="1" owner="jchristopherson" level="1" amendtag="end">sending through certified mail a written copy of the notification to the <ln numlevel="1" lineno="200" slineno="2-65"/>applicable attorney's office, court, and law enforcement agency; and</amend></subsection><subsection ssid="1-101" dnum="_-o:D-i" numlevel="1" lineno="201" slineno="2-66" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1084" style="1" owner="i" level="1" amendtag="start">(D)</amend></display><amend anum="0" ea="amend" pairid="160" groupid="121" style="1" owner="jchristopherson" level="1" amendtag="end">if applicable, sending the notification through a secure electronic portal that <ln numlevel="1" lineno="202" slineno="2-67"/>the board and the applicable attorney's office, court, or law enforcement agency <ln numlevel="1" lineno="203" slineno="2-68"/>share.</amend></subsection></subsection><subsection ssid="1-102" dnum="_-o:ii-i" numlevel="1" lineno="204" slineno="2-69" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1085" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="163" groupid="123" style="1" owner="jchristopherson" level="1" amendtag="end">If the board determines that circumstances require an expedited hearing resulting <ln numlevel="1" lineno="205" slineno="2-70"/>in the board being unable to comply with the 30-day requirement described in <ln numlevel="1" lineno="206" slineno="2-71"/>Subsection <xref depth="4" refnumber="77-27-5(2)(b)(i)">(2)(b)(i)</xref>, the board:</amend><subsection ssid="1-108" dnum="_-o:A-i" numlevel="1" lineno="207" slineno="2-72" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1086" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="208" groupid="150" style="1" owner="jchristopherson" level="1" amendtag="end">is not required to comply with the 30-day notification requirement; and</amend></subsection><subsection ssid="1-109" dnum="_-o:B-i" numlevel="1" lineno="208" slineno="2-73" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1087" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="213" groupid="154" style="1" owner="jchristopherson" level="1" amendtag="end">shall, in addition to the requirements of Subsections <xref depth="4" refnumber="77-27-5(2)(b)(i)(a)">(2)(b)(i)(A)</xref> through <xref depth="4" refnumber="77-27-5(d)">(D)</xref>, <ln numlevel="1" lineno="209" slineno="2-74"/>verbally notify the applicable attorney's office, court, and law enforcement <ln numlevel="1" lineno="210" slineno="2-75"/>agency as soon as practicable to inform the attorney's office, court, and law <ln numlevel="1" lineno="211" slineno="2-76"/>enforcement agency of the upcoming hearing.</amend></subsection></subsection></subsection></subsection><subsection ssid="1-null-29" dnum="3-o" numlevel="1" lineno="212" slineno="2-77" level="1" space="false"><display>(3)</display><subsection ssid="1-null-30" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A decision by the board is final and not subject for judicial review if the decision <ln numlevel="1" lineno="213" slineno="2-78"/>is regarding:<subsection ssid="1-null-31" dnum="i-o" numlevel="1" lineno="214" slineno="2-79" level="3" tab="1"><display>(i)</display>a pardon, parole, commutation, or termination of an offender's sentence;</subsection><subsection ssid="1-null-32" dnum="ii-o" numlevel="1" lineno="215" slineno="2-80" level="3" tab="1"><display>(ii)</display>restitution, the modification of an offender's payment schedule for restitution, or <ln numlevel="1" lineno="216" slineno="2-81"/>an order for costs; or</subsection><subsection ssid="1-null-33" dnum="iii-o" numlevel="1" lineno="217" slineno="2-82" level="3" tab="1"><display>(iii)</display>the remission of an offender's criminal accounts receivable or a fine or forfeiture.</subsection></subsection><subsection ssid="1-null-34" dnum="b-o" numlevel="1" lineno="218" slineno="2-83" level="2"><display>(b)</display>Deliberative processes are not public and the board is exempt from Title 52, Chapter <ln numlevel="1" lineno="219" slineno="2-84"/>4, Open and Public Meetings Act, when the board is engaged in the board's <ln numlevel="1" lineno="220" slineno="2-85"/>deliberative process.</subsection><subsection ssid="1-null-35" dnum="c-o" numlevel="1" lineno="221" slineno="2-86" level="2"><display>(c)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="229" groupid="166" style="2" owner="jchristopherson" level="1" deltag="both">Pursuant to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="228" groupid="165" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">In accordance with</amend> Subsection <xref tempid="729">63G-2-103(25)(b)(xii)</xref>, records of the <ln numlevel="1" lineno="222" slineno="2-87"/>deliberative process are exempt from Title 63G, Chapter 2, Government Records <ln numlevel="1" lineno="223" slineno="2-88"/>Access and Management Act.</subsection><subsection ssid="1-null-36" dnum="d-o" numlevel="1" lineno="224" slineno="2-89" level="2"><display>(d)</display>Unless it will interfere with a constitutional right, deliberative processes are not <ln numlevel="1" lineno="225" slineno="2-90"/>subject to disclosure, including discovery.</subsection><subsection ssid="1-null-37" dnum="e-o" numlevel="1" lineno="226" slineno="2-91" level="2"><display>(e)</display>Nothing in this section prevents the obtaining or enforcement of a civil judgment.</subsection></subsection><subsection ssid="1-null-38" dnum="4-o" numlevel="1" lineno="227" slineno="2-92" level="1" space="false"><display>(4)</display><subsection ssid="1-null-39" dnum="a-o" level="2" placement="sameline"><display>(a)</display>This chapter <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="7" groupid="6" style="2" owner="jchristopherson" level="1" deltag="both">may not be construed as a denial of or limitation of</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">does not deny or <ln numlevel="1" lineno="228" slineno="2-93"/>limit</amend> the governor's power to grant respite or reprieves in all cases of convictions for <ln numlevel="1" lineno="229" slineno="2-94"/>offenses against the state, except treason or conviction on impeachment.</subsection><subsection ssid="1-null-40" dnum="b-o" numlevel="1" lineno="230" slineno="2-95" level="2"><display>(b)</display>Notwithstanding Subsection <xref depth="4" refnumber="77-27-5(4)(a)">(4)(a)</xref>, respites or reprieves may not extend beyond the <ln numlevel="1" lineno="231" slineno="2-96"/>next session of the board.</subsection><subsection ssid="1-null-41" dnum="c-o" numlevel="1" lineno="232" slineno="2-97" level="2"><display>(c)</display>At the next session of the board, the board:<subsection ssid="1-null-42" dnum="i-o" numlevel="1" lineno="233" slineno="2-98" level="3"><display>(i)</display>shall continue or terminate the respite or reprieve; or</subsection><subsection ssid="1-null-43" dnum="ii-o" numlevel="1" lineno="234" slineno="2-99" level="3"><display>(ii)</display>may commute the punishment or pardon the offense as provided.</subsection></subsection><subsection ssid="1-null-44" dnum="d-o" numlevel="1" lineno="235" slineno="2-100" level="2"><display>(d)</display>In the case of conviction for treason, the governor may suspend execution of the <ln numlevel="1" lineno="236" slineno="2-101"/>sentence until the case is reported to the Legislature at the Legislature's next session.</subsection><subsection ssid="1-null-45" dnum="e-o" numlevel="1" lineno="237" slineno="2-102" level="2"><display>(e)</display>The Legislature shall pardon or commute the sentence or direct the sentence's <ln numlevel="1" lineno="238" slineno="2-103"/>execution.</subsection></subsection><subsection ssid="1-null-46" dnum="5-o" numlevel="1" lineno="239" slineno="2-104" level="1" space="false"><display>(5)</display><subsection ssid="1-null-47" dnum="a-o" level="2" placement="sameline"><display>(a)</display>In determining when, where, and under what conditions an offender serving a <ln numlevel="1" lineno="240" slineno="2-105"/>sentence may be paroled or pardoned, have a fine or forfeiture remitted, have the <ln numlevel="1" lineno="241" slineno="2-106"/>offender's criminal accounts receivable remitted, or have the offender's sentence <ln numlevel="1" lineno="242" slineno="2-107"/>commuted or terminated, the board shall:<subsection ssid="1-null-48" dnum="i-o" numlevel="1" lineno="243" slineno="2-108" level="3" tab="1"><display>(i)</display>consider whether the offender has made restitution ordered by the court under <ln numlevel="1" lineno="244" slineno="2-109"/>Section <xref depth="3" refnumber="77-38b-205">77-38b-205</xref>, or is prepared to pay restitution as a condition of any parole, <ln numlevel="1" lineno="245" slineno="2-110"/>pardon, remission of a criminal accounts receivable or a fine or forfeiture, or a <ln numlevel="1" lineno="246" slineno="2-111"/>commutation or termination of the offender's sentence;</subsection><subsection ssid="1-null-49" dnum="ii-o" numlevel="1" lineno="247" slineno="2-112" level="3" tab="1"><display>(ii)</display>except as provided in Subsection <xref depth="4" refnumber="77-27-5(5)(b)">(5)(b)</xref>, develop and use a list of criteria for <ln numlevel="1" lineno="248" slineno="2-113"/>making determinations under this Subsection <xref depth="4" refnumber="77-27-5(5)">(5)</xref>;</subsection><subsection ssid="1-null-50" dnum="iii-o" numlevel="1" lineno="249" slineno="2-114" level="3" tab="1"><display>(iii)</display>consider information provided by the department regarding an offender's <ln numlevel="1" lineno="250" slineno="2-115"/>individual case action plan;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="200" groupid="143" style="2" owner="jchristopherson" level="1" deltag="both"> and</amend><amendoutend style="2"/></subsection><subsection ssid="1-null-51" dnum="iv-o" numlevel="1" lineno="251" slineno="2-116" level="3" tab="1"><display>(iv)</display>review an offender's status within 60 days after the day on which the board <ln numlevel="1" lineno="252" slineno="2-117"/>receives notice from the department that the offender has completed all of the <ln numlevel="1" lineno="253" slineno="2-118"/>offender's case action plan components that relate to activities that can be <ln numlevel="1" lineno="254" slineno="2-119"/>accomplished while the offender is imprisoned<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="203" groupid="146" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="198" groupid="141" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="1-107" dnum="_-o:v-i" numlevel="1" lineno="255" slineno="2-120" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1111" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="197" groupid="140" style="1" owner="jchristopherson" level="1" amendtag="end">if considering whether to parole an offender who has previously been paroled and <ln numlevel="1" lineno="256" slineno="2-121"/>had the parole terminated due to the commission of a new criminal offense by the <ln numlevel="1" lineno="257" slineno="2-122"/>offender, consider the facts and circumstances of the new criminal offense when <ln numlevel="1" lineno="258" slineno="2-123"/>determining whether the offender should be paroled again.</amend></subsection></subsection><subsection ssid="1-null-52" dnum="b-o" numlevel="1" lineno="259" slineno="2-124" level="2"><display>(b)</display>The board shall determine whether to remit an offender's criminal accounts <ln numlevel="1" lineno="260" slineno="2-125"/>receivable under this Subsection <xref depth="4" refnumber="77-27-5(5)">(5)</xref> in accordance with Section <xref depth="3" refnumber="77-32b-105">77-32b-105</xref> or <xref depth="3" refnumber="77-32b-106"><ln numlevel="1" lineno="261" slineno="2-126"/>77-32b-106</xref>.</subsection></subsection><subsection ssid="1-null-53" dnum="6-o" numlevel="1" lineno="262" slineno="2-127" level="1"><display>(6)</display>In determining whether parole may be terminated, the board shall consider:<subsection ssid="1-null-54" dnum="a-o" numlevel="1" lineno="263" slineno="2-128" level="2"><display>(a)</display>the offense committed by the parolee; and</subsection><subsection ssid="1-null-55" dnum="b-o" numlevel="1" lineno="264" slineno="2-129" level="2"><display>(b)</display>the parole period under Section <xref depth="3" refnumber="76-3-202">76-3-202</xref>, and in accordance with Section <xref depth="3" refnumber="77-27-13">77-27-13</xref>.</subsection></subsection><subsection ssid="1-null-56" dnum="7-o" numlevel="1" lineno="265" slineno="2-130" level="1"><display>(7)</display>For an offender placed on parole after December 31, 2018, the board shall terminate <ln numlevel="1" lineno="266" slineno="2-131"/>parole in accordance with the adult sentencing and supervision length guidelines, as <ln numlevel="1" lineno="267" slineno="2-132"/>defined in Section <xref depth="3" refnumber="63M-7-401.1">63M-7-401.1</xref>, to the extent the guidelines are consistent with the <ln numlevel="1" lineno="268" slineno="2-133"/>requirements of the law.</subsection><subsection ssid="1-null-57" dnum="8-o" numlevel="1" lineno="269" slineno="2-134" level="1" space="false"><display>(8)</display><subsection ssid="1-112" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1118" style="1" owner="i" level="1" amendtag="both">(a)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="110" groupid="85" style="2" owner="jchristopherson" level="1" deltag="both">The</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="107" groupid="82" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">When determining whether parole should be granted or terminated for an <ln numlevel="1" lineno="270" slineno="2-135"/>offender, the</amend> board may not<amend anum="0" ea="amend" pairid="98" groupid="74" style="1" owner="jchristopherson" level="1" amendtag="both">:</amend><subsection ssid="1-87" dnum="_-o:i-i" numlevel="1" lineno="271" slineno="2-136" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1119" style="1" owner="i" level="1" amendtag="both">(i)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="111" groupid="86" style="2" owner="jchristopherson" level="1" deltag="both"> </amend><amendoutend style="2"/>rely solely on an algorithm or a risk assessment tool score<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="112" groupid="87" style="2" owner="jchristopherson" level="1" deltag="both"> in determining <ln numlevel="1" lineno="272" slineno="2-137"/>whether parole should be granted or terminated for an offender.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="108" groupid="83" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">;</amend></subsection><subsection ssid="1-88" dnum="_-o:ii-i" numlevel="1" lineno="273" slineno="2-138" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1120" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="106" groupid="81" style="1" owner="jchristopherson" level="1" amendtag="end">consider prison capacity, bed availability, or institutional population levels; or</amend></subsection><subsection ssid="1-111" dnum="_-o:iii-i" numlevel="1" lineno="274" slineno="2-139" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1121" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="218" groupid="158" style="1" owner="jchristopherson" level="1" amendtag="end">parole an offender who has not completed treatment or programming that was <ln numlevel="1" lineno="275" slineno="2-140"/>ordered to be completed while the offender is incarcerated.</amend></subsection></subsection><subsection ssid="1-113" dnum="_-o:b-i" numlevel="1" lineno="276" slineno="2-141" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1122" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="226" groupid="163" style="1" owner="jchristopherson" level="1" amendtag="end">Subsection <xref tempid="1028">(8)(a)(ii)</xref> does not apply to decisions on releases made under Section <xref depth="3" refnumber="64-13-38"><ln numlevel="1" lineno="277" slineno="2-142"/>64-13-38</xref>.</amend></subsection></subsection><subsection ssid="1-null-58" dnum="9-o" numlevel="1" lineno="278" slineno="2-143" level="1"><display>(9)</display>The board may intervene as a limited-purpose party in a judicial or administrative <ln numlevel="1" lineno="279" slineno="2-144"/>proceeding, including a criminal action, to seek:<subsection ssid="1-null-59" dnum="a-o" numlevel="1" lineno="280" slineno="2-145" level="2"><display>(a)</display>correction of an order that has or will impact the board's jurisdiction; or</subsection><subsection ssid="1-null-60" dnum="b-o" numlevel="1" lineno="281" slineno="2-146" level="2"><display>(b)</display>clarification regarding an order that may impact the board's jurisdiction.</subsection></subsection><subsection ssid="1-null-61" dnum="10-o" numlevel="1" lineno="282" slineno="2-147" level="1"><display>(10)</display>A motion to intervene brought under Subsection <xref depth="4" refnumber="77-27-5(9)(a)">(9)(a)</xref> shall be raised within 60 days <ln numlevel="1" lineno="283" slineno="2-148"/>after the day on which a court enters the order that lineno="296" slineno="3-13"/>53-29-203(1)(a)</xref>, 10 years have passed after the later of:</amend><subsection ssid="7-10" dnum="_-o:i-i" numlevel="1" lineno="297" slineno="3-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1134" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="53" groupid="40" style="1" owner="jchristopherson" level="1" amendtag="end">the day on which the offender was placed on probation;</amend></subsection><subsection ssid="7-11" dnum="_-o:ii-i" numlevel="1" lineno="298" slineno="3-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1135" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="58" groupid="44" style="1" owner="jchristopherson" level="1" amendtag="end">the day on which the offender was released from incarceration to parole;</amend></subsection><subsection ssid="7-12" dnum="_-o:iii-i" numlevel="1" lineno="299" slineno="3-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1136" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="63" groupid="48" style="1" owner="jchristopherson" level="1" amendtag="end">the day on which the offender's sentence was terminated without parole;</amend></subsection><subsection ssid="7-13" dnum="_-o:iv-i" numlevel="1" lineno="300" slineno="3-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1137" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="68" groupid="52" style="1" owner="jchristopherson" level="1" amendtag="end">the day on which the offender entered a community-based residential program; or</amend></subsection><subsection ssid="7-14" dnum="_-o:v-i" numlevel="1" lineno="301" slineno="3-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1138" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="73" groupid="56" style="1" owner="jchristopherson" level="1" amendtag="end">for a minor, the day on which the division's custody of the offender was <ln numlevel="1" lineno="302" slineno="3-19"/>terminated; or</amend></subsection></subsection><subsection ssid="7-26" dnum="_-o:b-i" numlevel="1" lineno="303" slineno="3-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1139" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="80" groupid="61" style="1" owner="jchristopherson" level="1" amendtag="end">for an offender who is required to register for the offender's lifetime under <ln numlevel="1" lineno="304" slineno="3-21"/>Subsection <xref depth="4" refnumber="53-29-203(1)(b)">53-29-203(1)(b)</xref>, 20 years have passed after the later of:</amend><subsection ssid="7-18" dnum="_-o:i-i" numlevel="1" lineno="305" slineno="3-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1140" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="86" groupid="65" style="1" owner="jchristopherson" level="1" amendtag="end">the day on which the offender was placed on probation;</amend></subsection><subsection ssid="7-19" dnum="_-o:ii-i" numlevel="1" lineno="306" slineno="3-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1141" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="92" groupid="70" style="1" owner="jchristopherson" level="1" amendtag="end">the day on which the offender was released from incarceration to parole;</amend></subsection><subsection ssid="7-20" dnum="_-o:iii-i" numlevel="1" lineno="307" slineno="3-24" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1142" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="98" groupid="74" style="1" owner="jchristopherson" level="1" amendtag="end">the day on which the offender's sentence was terminated without parole;</amend></subsection><subsection ssid="7-21" dnum="_-o:iv-i" numlevel="1" lineno="308" slineno="3-25" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1143" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="103" groupid="78" style="1" owner="jchristopherson" level="1" amendtag="end">the day on which the offender entered a community-based residential program; or</amend></subsection><subsection ssid="7-22" dnum="_-o:v-i" numlevel="1" lineno="309" slineno="3-26" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1144" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="108" groupid="82" style="1" owner="jchristopherson" level="1" amendtag="end">for a minor, the day on which the division's custody of the offender was <ln numlevel="1" lineno="310" slineno="3-27"/>terminated.</amend></subsection></subsection></subsection></section></bsec><bsec buid="11" num="77-27-9" type="amend" src="code" uid="C77-27-S9_2026050620260506" sort="77 27 00090020260506" numlevel="1" lineno="311" slineno="4-1" sn="4"><section number="77-27-9" numlevel="1" lineno="312" slineno="4-2" type="amend"><secline lineno="311">Section 4. Section <bold>77-27-9</bold> is amended to read:</secline><catline lineno="312"><bold>77-27-9<parens/>. Parole proceedings.</bold></catline><subsection ssid="11-null-1" dnum="1-o" numlevel="1" lineno="313" slineno="4-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="11-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The Board of Pardons and Parole may parole any offender or terminate the <ln numlevel="1" lineno="314" slineno="4-4"/>sentence of any offender committed to a penal or correctional facility under the <ln numlevel="1" lineno="315" slineno="4-5"/>jurisdiction of the Department of Corrections except as provided in Subsection <xref depth="4" refnumber="77-27-9(2)" start="0">(2)</xref>.</subsection><subsection ssid="11-null-3" dnum="b-o" numlevel="1" lineno="316" slineno="4-6" level="2"><display>(b)</display>The board may not release any offender before the minimum term has been served <ln numlevel="1" lineno="317" slineno="4-7"/>unless the board<amend anum="0" ea="amend" pairid="39" groupid="32" style="1" owner="jchristopherson" level="1" amendtag="both">:</amend><subsection ssid="11-41" dnum="_-o:i-i" numlevel="1" lineno="318" slineno="4-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1148" style="1" owner="i" level="1" amendtag="both">(i)</amend></display> finds mitigating circumstances which justify the release<amend anum="0" ea="amend" pairid="57" groupid="48" style="1" owner="jchristopherson" level="1" amendtag="both">;</amend></subsection><subsection ssid="11-43" dnum="_-o:ii-i" numlevel="1" lineno="319" slineno="4-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1149" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="56" groupid="47" style="1" owner="jchristopherson" level="1" m-anum="0" m-ea="amend" m-pairid="41" m-groupid="34" m-style="1" m-owner="jchristopherson" m-level="1" amendtag="end">finds by clear and convincing evidence that the offender is no longer a threat to <ln numlevel="1" lineno="320" slineno="4-10"/>public safety;</amend> and</subsection><subsection ssid="11-42" dnum="_-o:iii-i" numlevel="1" lineno="321" slineno="4-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1150" style="1" owner="i" level="1" amendtag="both">(iii)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="51" groupid="43" style="2" owner="jchristopherson" level="1" deltag="both"> unless the board has granted</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="50" groupid="42" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">holds</amend> a full hearing, in open session, after <ln numlevel="1" lineno="322" slineno="4-12"/>previous notice of the time and location of the hearing, and recorded the <ln numlevel="1" lineno="323" slineno="4-13"/>proceedings and decisions of the board.</subsection></subsection><subsection ssid="11-null-4" dnum="c-o" numlevel="1" lineno="324" slineno="4-14" level="2"><display>(c)</display>The board may not parole any offender or terminate the sentence of any offender <ln numlevel="1" lineno="325" slineno="4-15"/>unless the board has granted a full hearing, in open session, after previous notice of <ln numlevel="1" lineno="326" slineno="4-16"/>the time and location of the hearing, and recorded the proceedings and decisions of <ln numlevel="1" lineno="327" slineno="4-17"/>the board.</subsection><subsection ssid="11-null-5" dnum="d-o" numlevel="1" lineno="328" slineno="4-18" level="2"><display>(d)</display>The release of an offender shall be at the initiative of the board, which shall consider <ln numlevel="1" lineno="329" slineno="4-19"/>each case as the offender becomes eligible.  However, a prisoner may submit the <ln numlevel="1" lineno="330" slineno="4-20"/>prisoner's own application, subject to the rules of the board promulgated in <ln numlevel="1" lineno="331" slineno="4-21"/>accordance with <xref depth="1" refnumber="63G-3" start="0">Title 63G, Chapter 3, Utah Administrative Rulemaking Act</xref>.</subsection></subsection><subsection ssid="11-null-6" dnum="2-o" numlevel="1" lineno="332" slineno="4-22" level="1" space="false"><display>(2)</display><subsection ssid="11-null-7" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An individual sentenced to prison <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="68" groupid="59" style="2" owner="jchristopherson" level="1" deltag="both">prior to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="64" groupid="55" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">before</amend> April 29, 1996, for a first <ln numlevel="1" lineno="333" slineno="4-23"/>degree felony involving child kidnapping, a violation of Section <xref depth="3" refnumber="76-5-301.1" start="0">76-5-301.1</xref>; <ln numlevel="1" lineno="334" slineno="4-24"/>aggravated kidnapping, a violation of Section <xref depth="3" refnumber="76-5-302" start="0">76-5-302</xref>; rape of a child, a violation of <ln numlevel="1" lineno="335" slineno="4-25"/>Section <xref depth="3" refnumber="76-5-402.1" start="0">76-5-402.1</xref>; object rape of a child, a violation of Section <xref depth="3" refnumber="76-5-402.3" start="0">76-5-402.3</xref>; sodomy <ln numlevel="1" lineno="336" slineno="4-26"/>upon a child, a violation of Section <xref depth="3" refnumber="76-5-403.1" start="0">76-5-403.1</xref>; aggravated sexual abuse of a child, a <ln numlevel="1" lineno="337" slineno="4-27"/>violation of Section <xref depth="3" refnumber="76-5-404.3" start="0">76-5-404.3</xref>; aggravated sexual assault, a violation of Section <xref depth="3" refnumber="76-5-405" start="0"><ln numlevel="1" lineno="338" slineno="4-28"/>76-5-405</xref>; or a prior offense as described in Section <xref depth="3" refnumber="76-3-407" start="0">76-3-407</xref>, may not be eligible for <ln numlevel="1" lineno="339" slineno="4-29"/>release on parole by the Board of Pardons and Parole until the offender has fully <ln numlevel="1" lineno="340" slineno="4-30"/>completed serving the minimum mandatory sentence imposed by the court.  This <ln numlevel="1" lineno="341" slineno="4-31"/>Subsection <xref depth="4" refnumber="77-27-9(2)(a)" start="0">(2)(a)</xref> supersedes any other provision of law.</subsection><subsection ssid="11-null-8" dnum="b-o" numlevel="1" lineno="342" slineno="4-32" level="2"><display>(b)</display>The board may not parole any offender or commute or terminate the sentence of any <ln numlevel="1" lineno="343" slineno="4-33"/>offender before the offender has served the minimum term for the offense, if the <ln numlevel="1" lineno="344" slineno="4-34"/>offender was sentenced <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="69" groupid="60" style="2" owner="jchristopherson" level="1" deltag="both">prior to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="65" groupid="56" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">before</amend> April 29, 1996, and if:<subsection ssid="11-null-9" dnum="i-o" numlevel="1" lineno="345" slineno="4-35" level="3"><display>(i)</display>the offender was convicted of forcible sexual abuse, forcible sodomy, rape, <ln numlevel="1" lineno="346" slineno="4-36"/>aggravated assault, kidnapping, aggravated kidnapping, or aggravated sexual <ln numlevel="1" lineno="347" slineno="4-37"/>assault as defined in <xref depth="1" refnumber="76-5" start="0">Title 76, Chapter 5, Offenses Against the Individual</xref>; and</subsection><subsection ssid="11-null-10" dnum="ii-o" numlevel="1" lineno="348" slineno="4-38" level="3"><display>(ii)</display>the victim of the offense was under 18 years old at the time the offense was <ln numlevel="1" lineno="349" slineno="4-39"/>committed.</subsection></subsection><subsection ssid="11-null-11" dnum="c-o" numlevel="1" lineno="350" slineno="4-40" level="2"><display>(c)</display>For a crime committed on or after April 29, 1996, but before January 1, 2019, the <ln numlevel="1" lineno="351" slineno="4-41"/>board may parole any offender under Subsections <xref depth="4" refnumber="77-27-9(2)(b)(i)" start="0">(2)(b)(i)</xref> and <xref depth="4" refnumber="77-27-9(2)(b)(ii)" start="0">(ii)</xref> for lifetime parole <ln numlevel="1" lineno="352" slineno="4-42"/>as provided in this section.</subsection><subsection ssid="11-null-12" dnum="d-o" numlevel="1" lineno="353" slineno="4-43" level="2"><display>(d)</display>The board may not pardon or parole any offender or commute or terminate the <ln numlevel="1" lineno="354" slineno="4-44"/>sentence of any offender who is sentenced to life in prison without parole except as <ln numlevel="1" lineno="355" slineno="4-45"/>provided in Subsection <xref depth="4" refnumber="77-27-9(7)" start="0">(7)</xref>.</subsection><subsection ssid="11-null-13" dnum="e-o" numlevel="1" lineno="356" slineno="4-46" level="2"><display>(e)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="30" groupid="24" style="2" owner="jchristopherson" level="1" deltag="both">On or after April 27, 1992, the</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="32" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">The</amend> board may commute a sentence of death only to <ln numlevel="1" lineno="357" slineno="4-47"/>a sentence of life in prison without parole.</subsection><subsection ssid="11-null-14" dnum="f-o" numlevel="1" lineno="358" slineno="4-48" level="2"><display>(f)</display>The restrictions imposed in Subsections <xref depth="4" refnumber="77-27-9(2)(d)" start="0">(2)(d)</xref> and <xref depth="4" refnumber="77-27-9(2)(e)" start="0">(e)</xref> apply to all cases that come <ln numlevel="1" lineno="359" slineno="4-49"/>before the Board of Pardons and Parole on or after April 27, 1992.</subsection><subsection ssid="11-null-15" dnum="g-o" numlevel="1" lineno="360" slineno="4-50" level="2"><display>(g)</display>The board may not parole any offender convicted of a homicide unless:<subsection ssid="11-null-16" dnum="i-o" numlevel="1" lineno="361" slineno="4-51" level="3"><display>(i)</display>the remains of the victim have been recovered; or</subsection><subsection ssid="11-null-17" dnum="ii-o" numlevel="1" lineno="362" slineno="4-52" level="3"><display>(ii)</display>the offender can demonstrate by a preponderance of the evidence that the <ln numlevel="1" lineno="363" slineno="4-53"/>offender has cooperated in good faith in efforts to locate the remains.</subsection></subsection><subsection ssid="11-null-18" dnum="h-o" numlevel="1" lineno="364" slineno="4-54" level="2"><display>(h)</display>Subsection <xref depth="4" refnumber="77-27-9(2)(g)" start="0">(2)(g)</xref> applies to any offender convicted of a homicide after February 25, <ln numlevel="1" lineno="365" slineno="4-55"/>2021, or any offender who was incarcerated in a correctional facility on or after <ln numlevel="1" lineno="366" slineno="4-56"/>February 25, 2021, for a homicide offense.</subsection><subsection ssid="11-31" dnum="_-o:i-i" numlevel="1" lineno="367" slineno="4-57" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1166" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">The board may not re-parole an offender from a period of incarceration imposed by a <ln numlevel="1" lineno="368" slineno="4-58"/>conviction if:</amend><subsection ssid="11-32" dnum="_-o:i-i" numlevel="1" lineno="369" slineno="4-59" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1167" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="9" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="end">the offender has previously been paroled under that conviction; and</amend></subsection><subsection ssid="11-33" dnum="_-o:ii-i" numlevel="1" lineno="370" slineno="4-60" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1168" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="end">the offender's previous parole was revoked because the offender was charged <ln numlevel="1" lineno="371" slineno="4-61"/>with committing a violent felony during the time the offender was paroled.</amend></subsection></subsection></subsection><subsection ssid="11-null-19" dnum="3-o" numlevel="1" lineno="372" slineno="4-62" level="1"><display>(3)</display>The board may rescind:<subsection ssid="11-null-20" dnum="a-o" numlevel="1" lineno="373" slineno="4-63" level="2"><display>(a)</display>an inmate's prison release date <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="70" groupid="61" style="2" owner="jchristopherson" level="1" deltag="both">prior to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="66" groupid="57" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">before</amend> the inmate being released from <ln numlevel="1" lineno="374" slineno="4-64"/>custody; or</subsection><subsection ssid="11-null-21" dnum="b-o" numlevel="1" lineno="375" slineno="4-65" level="2"><display>(b)</display>an offender's termination date from parole <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="71" groupid="62" style="2" owner="jchristopherson" level="1" deltag="both">prior to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="67" groupid="58" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">before</amend> the offender being <ln numlevel="1" lineno="376" slineno="4-66"/>terminated from parole.</subsection></subsection><subsection ssid="11-null-22" dnum="4-o" numlevel="1" lineno="377" slineno="4-67" level="1" space="false"><display>(4)</display><subsection ssid="11-null-23" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The board may issue subpoenas to compel the attendance of witnesses and the <ln numlevel="1" lineno="378" slineno="4-68"/>production of evidence, to administer oaths, and to take testimony for the purpose of <ln numlevel="1" lineno="379" slineno="4-69"/>any investigation by the board or any of the board's members or by a designated <ln numlevel="1" lineno="380" slineno="4-70"/>hearing examiner in the performance of the board's duties.</subsection><subsection ssid="11-null-24" dnum="b-o" numlevel="1" lineno="381" slineno="4-71" level="2"><display>(b)</display>A person who willfully disobeys a properly served subpoena issued by the board is <ln numlevel="1" lineno="382" slineno="4-72"/>guilty of a class B misdemeanor.</subsection></subsection><subsection ssid="11-null-25" dnum="5-o" numlevel="1" lineno="383" slineno="4-73" level="1" space="false"><display>(5)</display><subsection ssid="11-null-26" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The board may adopt rules consistent with law for the board's government, <ln numlevel="1" lineno="384" slineno="4-74"/>meetings and hearings, the conduct of proceedings before the board, the parole and <ln numlevel="1" lineno="385" slineno="4-75"/>pardon of offenders, the commutation and termination of sentences, and the general <ln numlevel="1" lineno="386" slineno="4-76"/>conditions under which parole may be granted and revoked.</subsection><subsection ssid="11-null-27" dnum="b-o" numlevel="1" lineno="387" slineno="4-77" level="2"><display>(b)</display>The rules shall ensure an adequate opportunity for victims to participate at hearings <ln numlevel="1" lineno="388" slineno="4-78"/>held under this chapter, as provided in Section <xref depth="3" refnumber="77-27-9.5" start="0">77-27-9.5</xref>.</subsection><subsection ssid="11-null-28" dnum="c-o" numlevel="1" lineno="389" slineno="4-79" level="2"><display>(c)</display>The rules may allow the board to establish reasonable and equitable time limits on <ln numlevel="1" lineno="390" slineno="4-80"/>the presentations by all participants in hearings held under this chapter.</subsection></subsection><subsection ssid="11-null-29" dnum="6-o" numlevel="1" lineno="391" slineno="4-81" level="1"><display>(6)</display>The board does not provide counseling or therapy for victims as a part of their <ln numlevel="1" lineno="392" slineno="4-82"/>participation in any hearing under this chapter.</subsection><subsection ssid="11-null-30" dnum="7-o" numlevel="1" lineno="393" slineno="4-83" level="1"><display>(7)</display>The board may parole a person sentenced to life in prison without parole if the board <ln numlevel="1" lineno="394" slineno="4-84"/>finds by clear and convincing evidence that the person is permanently incapable of being <ln numlevel="1" lineno="395" slineno="4-85"/>a threat to the safety of society.</subsection></section></bsec><bsec buid="5" num="77-27-9.5" type="amend" src="code" uid="C77-27-S9.5_2026050620260506" sort="77 27 00090520260506" numlevel="1" lineno="396" slineno="5-1" sn="5"><section number="77-27-9.5" numlevel="1" lineno="397" slineno="5-2" type="amend"><secline lineno="396">Section 5. Section <bold>77-27-9.5</bold> is amended to read:</secline><catline lineno="397"><bold>77-27-9.5<parens/>. Victim rights regarding hearings.</bold></catline><subsection ssid="5-null-1" dnum="1-o:_-i" numlevel="1" lineno="398" slineno="5-3" ea="erase" anum="0" owner="jchristopherson" style="2" level="1" placement="noreturn"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1181" style="2" owner="o" level="1" deltag="start">(1)</amend></display><amend anum="0" ea="erase" pairid="19" groupid="15" style="2" owner="jchristopherson" level="1" deltag="end">As used in this section, "hearing" means a hearing for a parole grant or revocation, or a <ln numlevel="1" lineno="399" slineno="5-4"/>rehearing of either of these if the offender is present.</amend><amendoutend style="2"/></subsection><subsection ssid="5-null-2" dnum="2-o:1-i" numlevel="1" lineno="400" slineno="5-5" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1182" style="2" owner="o" level="1" deltag="both">(2)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1183" style="1" owner="i" level="1" amendtag="both" space="true">(1)</amend></display><subsection ssid="5-null-3" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="23" groupid="19" style="2" owner="jchristopherson" level="1" deltag="both">(2)(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="22" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="77-27-9.5(1)(b)">(1)(b)</xref></amend>, when a hearing is held <ln numlevel="1" lineno="401" slineno="5-6"/>regarding any offense committed by the defendant that involved the victim, the <ln numlevel="1" lineno="402" slineno="5-7"/>victim may attend the hearing to present the victim's views concerning the decisions <ln numlevel="1" lineno="403" slineno="5-8"/>to be made regarding the defendant.</subsection><subsection ssid="5-null-4" dnum="b-o" numlevel="1" lineno="404" slineno="5-9" level="2" space="false"><display>(b)</display><subsection ssid="5-null-5" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The victim may not attend a redetermination or special attention hearing if the <ln numlevel="1" lineno="405" slineno="5-10"/>offender is not present.</subsection><subsection ssid="5-null-6" dnum="ii-o" numlevel="1" lineno="406" slineno="5-11" level="3"><display>(ii)</display>At that redetermination or special attention hearing, the board shall give <ln numlevel="1" lineno="407" slineno="5-12"/>consideration to any presentation previously given by the victim regarding that <ln numlevel="1" lineno="408" slineno="5-13"/>offender.</subsection></subsection></subsection><subsection ssid="5-null-7" dnum="3-o:2-i" numlevel="1" lineno="409" slineno="5-14" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1187" style="2" owner="o" level="1" deltag="both">(3)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1188" style="1" owner="i" level="1" amendtag="both" space="true">(2)</amend></display><subsection ssid="5-null-8" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="5-32" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1" placement="sameline"><display><amend anum="0" ea="amend" pairid="1189" style="1" owner="i" level="1" amendtag="both">(i)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="20" groupid="16" style="2" owner="jchristopherson" level="1" deltag="both">The</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="17" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Except as provided in Subsection <xref tempid="197">(2)(a)(ii)</xref>, the</amend> board shall <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="5" style="2" owner="jchristopherson" level="1" deltag="both">send <ln numlevel="1" lineno="410" slineno="5-15"/>timely</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">provide</amend> notice of the hearing to the victim as provided in <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="94" groupid="71" style="2" owner="jchristopherson" level="1" deltag="both">Subsection (3)(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="26" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="411" slineno="5-16"/>Subsections <xref depth="4" refnumber="77-27-9.5(2)(b)">(2)(b)</xref> through <xref depth="4" refnumber="77-27-9.5(e)">(e)</xref> at least 30 days before the day on which the hearing <ln numlevel="1" lineno="412" slineno="5-17"/>will be held</amend>.</subsection><subsection ssid="5-33" dnum="_-o:ii-i" numlevel="1" lineno="413" slineno="5-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1190" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="end">If the board determines that circumstances require an expedited hearing resulting <ln numlevel="1" lineno="414" slineno="5-19"/>in the board being unable to comply with the 30-day notice requirement described <ln numlevel="1" lineno="415" slineno="5-20"/>in Subsection <xref depth="4" refnumber="77-27-9.5(2)(a)(i)">(2)(a)(i)</xref>, the board is not required to comply with the 30-day notice <ln numlevel="1" lineno="416" slineno="5-21"/>requirement but shall send the notice to the victim as soon as practicable to ensure <ln numlevel="1" lineno="417" slineno="5-22"/>that the victim has adequate notice of the upcoming hearing.</amend></subsection></subsection><subsection ssid="5-null-9" dnum="b-o" numlevel="1" lineno="418" slineno="5-23" level="2"><display>(b)</display>The notice <amend anum="0" ea="amend" pairid="18" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="both">described in Subsection <xref refnumber="5-null-8">(2)(a)</xref> </amend>shall<amend anum="0" ea="amend" pairid="34" groupid="30" style="1" owner="jchristopherson" level="1" amendtag="both"> be provided in terms that a reasonable <ln numlevel="1" lineno="419" slineno="5-24"/>lay person can understand and</amend> include:<subsection ssid="5-null-10" dnum="i-o" numlevel="1" lineno="420" slineno="5-25" level="3"><display>(i)</display>the date, time, and location of the hearing;</subsection><subsection ssid="5-null-11" dnum="ii-o" numlevel="1" lineno="421" slineno="5-26" level="3"><display>(ii)</display>a clear statement of the reason for the hearing, including all offenses involved;</subsection><subsection ssid="5-null-12" dnum="iii-o" numlevel="1" lineno="422" slineno="5-27" level="3"><display>(iii)</display>the statutes and rules applicable to the victim's participation in the hearing;</subsection><subsection ssid="5-null-13" dnum="iv-o" numlevel="1" lineno="423" slineno="5-28" level="3"><display>(iv)</display>the address and telephone number of an office or person the victim may contact <ln numlevel="1" lineno="424" slineno="5-29"/>for further explanation of the procedure regarding victim participation in the <ln numlevel="1" lineno="425" slineno="5-30"/>hearing; and</subsection><subsection ssid="5-null-14" dnum="v-o" numlevel="1" lineno="426" slineno="5-31" level="3"><display>(v)</display>specific information about how, when, and where the victim may obtain the <ln numlevel="1" lineno="427" slineno="5-32"/>results of the hearing.</subsection></subsection><subsection ssid="5-null-15" dnum="c-o" numlevel="1" lineno="428" slineno="5-33" level="2"><display>(c)</display>The board may notify a victim through the board's website or through the mail or <ln numlevel="1" lineno="429" slineno="5-34"/>other electronic means available to the board.</subsection><subsection ssid="5-null-16" dnum="d-o" numlevel="1" lineno="430" slineno="5-35" level="2"><display>(d)</display>If the victim requests that a notification occur using a specific method offered by the <ln numlevel="1" lineno="431" slineno="5-36"/>board, the board shall make reasonable efforts to accommodate that request.</subsection><subsection ssid="5-null-17" dnum="e-o" numlevel="1" lineno="432" slineno="5-37" level="2"><display>(e)</display>If the victim is deceased, or the board is otherwise unable to contact the victim, the <ln numlevel="1" lineno="433" slineno="5-38"/>board shall make reasonable efforts to notify the victim's immediate family of the <ln numlevel="1" lineno="434" slineno="5-39"/>hearing.</subsection><subsection ssid="5-null-18" dnum="f-o" numlevel="1" lineno="435" slineno="5-40" level="2"><display>(f)</display>The victim may communicate with the board for consideration of continuance of the <ln numlevel="1" lineno="436" slineno="5-41"/>hearing if travel or other significant conflict prohibits the victim's attendance at the <ln numlevel="1" lineno="437" slineno="5-42"/>hearing.</subsection></subsection><subsection ssid="5-null-19" dnum="4-o:3-i" numlevel="1" lineno="438" slineno="5-43" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1201" style="2" owner="o" level="1" deltag="both">(4)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1202" style="1" owner="i" level="1" amendtag="both" space="true">(3)</amend></display>The victim, or family members if the victim is deceased or unable to attend due to <ln numlevel="1" lineno="439" slineno="5-44"/>physical incapacity, may:<subsection ssid="5-null-20" dnum="a-o" numlevel="1" lineno="440" slineno="5-45" level="2"><display>(a)</display>attend the hearing to observe;</subsection><subsection ssid="5-null-21" dnum="b-o" numlevel="1" lineno="441" slineno="5-46" level="2"><display>(b)</display>make a statement to the board, or the board's appointed examiner, in person or <ln numlevel="1" lineno="442" slineno="5-47"/>through a representative appointed by the victim or the victim's family; and</subsection><subsection ssid="5-null-22" dnum="c-o" numlevel="1" lineno="443" slineno="5-48" level="2"><display>(c)</display>remain present for the hearing if the victim appoints another to make a statement on <ln numlevel="1" lineno="444" slineno="5-49"/>the victim's behalf.</subsection></subsection><subsection ssid="5-null-23" dnum="5-o:4-i" numlevel="1" lineno="445" slineno="5-50" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1205" style="2" owner="o" level="1" deltag="both">(5)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1206" style="1" owner="i" level="1" amendtag="both" space="true">(4)</amend></display>The statement may be presented:<subsection ssid="5-null-24" dnum="a-o" numlevel="1" lineno="446" slineno="5-51" level="2"><display>(a)</display>as a written statement, which may also be read aloud, if the presenter desires; or</subsection><subsection ssid="5-null-25" dnum="b-o" numlevel="1" lineno="447" slineno="5-52" level="2"><display>(b)</display>as an oral statement presented by the person selected under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="29" groupid="25" style="2" owner="jchristopherson" level="1" deltag="both">(4)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="27" groupid="23" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="77-27-9.5(3)">(3)</xref></amend>.</subsection></subsection><subsection ssid="5-null-26" dnum="6-o:5-i" numlevel="1" lineno="448" slineno="5-53" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1208" style="2" owner="o" level="1" deltag="both">(6)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1209" style="1" owner="i" level="1" amendtag="both" space="true">(5)</amend></display>The victim may be accompanied by a member of his family or another individual, <ln numlevel="1" lineno="449" slineno="5-54"/>present to provide emotional support to the victim.</subsection><subsection ssid="5-null-27" dnum="7-o:6-i" numlevel="1" lineno="450" slineno="5-55" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1209" style="2" owner="o" level="1" deltag="both">(7)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1210" style="1" owner="i" level="1" amendtag="both" space="true">(6)</amend></display>The victim may, upon request, testify outside the presence of the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="41" groupid="36" style="2" owner="jchristopherson" level="1" deltag="both">defendant</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="40" groupid="35" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="451" slineno="5-56"/>offender</amend> but a separate hearing may not be held for this purpose.</subsection><subsection ssid="5-null-28" dnum="8-o:7-i" numlevel="1" lineno="452" slineno="5-57" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1210" style="2" owner="o" level="1" deltag="both">(8)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1211" style="1" owner="i" level="1" amendtag="both" space="true">(7)</amend></display><subsection ssid="5-null-29" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If a victim does not attend a hearing, the victim may provide a written <ln numlevel="1" lineno="453" slineno="5-58"/>statement that complies with board rules.</subsection><subsection ssid="5-null-30" dnum="b-o" numlevel="1" lineno="454" slineno="5-59" level="2"><display>(b)</display>If the victim does not offer a verbal or written statement at the time of the hearing, <ln numlevel="1" lineno="455" slineno="5-60"/>the board shall consider any statement from the victim that was previously provided <ln numlevel="1" lineno="456" slineno="5-61"/>to the board.</subsection><subsection ssid="5-null-31" dnum="c-o" numlevel="1" lineno="457" slineno="5-62" level="2"><display>(c)</display>The board may not afford a written statement provided by a victim less weight than a <ln numlevel="1" lineno="458" slineno="5-63"/>verbal statement solely because the statement is written.</subsection></subsection><subsection ssid="5-34" dnum="_-o:8-i" numlevel="1" lineno="459" slineno="5-64" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1214" style="1" owner="i" level="1" amendtag="start">(8)</amend></display><subsection ssid="5-35" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1215" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="38" groupid="33" style="1" owner="jchristopherson" level="1" amendtag="end">If a victim or a family members of a victim provides a written statement:</amend><subsection ssid="5-42" dnum="_-o:i-i" numlevel="1" lineno="460" slineno="5-65" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1216" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="88" groupid="66" style="1" owner="jchristopherson" level="1" amendtag="end">the statement and any copy of the statement shall remain in the care, custody, and <ln numlevel="1" lineno="461" slineno="5-66"/>control of the board; and</amend></subsection><subsection ssid="5-43" dnum="_-o:ii-i" numlevel="1" lineno="462" slineno="5-67" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1217" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="93" groupid="70" style="1" owner="jchristopherson" level="1" amendtag="end">the board may not allow an offender to take possession of the written statement or <ln numlevel="1" lineno="463" slineno="5-68"/>copy of the written statement.</amend></subsection></subsection><subsection ssid="5-36" dnum="_-o:b-i" numlevel="1" lineno="464" slineno="5-69" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1218" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="49" groupid="41" style="1" owner="jchristopherson" level="1" amendtag="end">Subject to Subsection <xref refnumber="5-39">(8)(c)</xref>, before a hearing in which the written statement <ln numlevel="1" lineno="465" slineno="5-70"/>described in Subsection <xref refnumber="5-35">(8)(a)</xref> is relevant, the board shall allow the offender an <ln numlevel="1" lineno="466" slineno="5-71"/>adequate opportunity to view and examine the statement in a location determined by <ln numlevel="1" lineno="467" slineno="5-72"/>the board.</amend></subsection><subsection ssid="5-39" dnum="_-o:c-i" numlevel="1" lineno="468" slineno="5-73" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1219" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="65" groupid="54" style="1" owner="jchristopherson" level="1" amendtag="end">During any review under Subsection <xref refnumber="5-36">(8)(b)</xref>, the board shall ensure that the offender <ln numlevel="1" lineno="469" slineno="5-74"/>does not:</amend><subsection ssid="5-40" dnum="_-o:i-i" numlevel="1" lineno="470" slineno="5-75" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1220" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="78" groupid="58" style="1" owner="jchristopherson" level="1" amendtag="end">reproduce the written statement through any means; or</amend></subsection><subsection ssid="5-41" dnum="_-o:ii-i" numlevel="1" lineno="471" slineno="5-76" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1221" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="83" groupid="62" style="1" owner="jchristopherson" level="1" amendtag="end">retain or take possession of the written statement or a copy of the written <ln numlevel="1" lineno="472" slineno="5-77"/>statement.</amend></subsection></subsection></subsection></section></bsec><bsec buid="13" num="77-27-9.7" type="amend" src="code" uid="C77-27-S9.7_2026050620260506" sort="77 27 00090720260506" numlevel="1" lineno="473" slineno="6-1" sn="6"><section number="77-27-9.7" numlevel="1" lineno="474" slineno="6-2" type="amend"><secline lineno="473">Section 6. Section <bold>77-27-9.7</bold> is amended to read:</secline><catline lineno="474"><bold>77-27-9.7<parens/>. Victim right to notification of release -- Notice by board.</bold></catline><subsection ssid="13-null-1" dnum="1-o" numlevel="1" lineno="475" slineno="6-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="13-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>In accordance with Subsection <xref depth="3" refnumber="77-38-104">77-38-104</xref>(1)(p), the board shall notify a victim of <ln numlevel="1" lineno="476" slineno="6-4"/>the victim's right to be informed, upon request, of other releases of the offender under <ln numlevel="1" lineno="477" slineno="6-5"/>Section <xref depth="3" refnumber="64-13-14.7">64-13-14.7</xref>.</subsection><subsection ssid="13-null-3" dnum="b-o" numlevel="1" lineno="478" slineno="6-6" level="2"><display>(b)</display>The board may provide the notification to the victim as described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="3" refnumber="77-27-9.5"><ln numlevel="1" lineno="479" slineno="6-7"/>77-27-9.5</xref>(3)(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref refnumber="5-null-15">77-27-9.5(2)(c)</xref></amend>.</subsection></subsection><subsection ssid="13-null-4" dnum="2-o" numlevel="1" lineno="480" slineno="6-8" level="1"><display>(2)</display>The board may include the notification under Subsection <xref depth="4" refnumber="77-27-9.7(1)">(1)</xref> with the notification sent <ln numlevel="1" lineno="481" slineno="6-9"/>under Subsection <xref depth="3" refnumber="77-27-9.5">77-27-9.5</xref>(3).</subsection><subsection ssid="13-null-5" dnum="3-o" numlevel="1" lineno="482" slineno="6-10" level="1"><display>(3)</display>The board shall coordinate with the Department of Corrections to ensure notice under <ln numlevel="1" lineno="483" slineno="6-11"/>this section is provided to a victim.</subsection></section></bsec><bsec buid="3" type="repealer" src="code" sort="TRepealer" numlevel="1" lineno="484" slineno="7-1" sn="7"><secline>Section 7. <bold>Repealer.</bold></secline><rhead lineno="485"/><sectionText><repsec num="77-27-31" uid="C77-27-S31_2026050620260506" sort="77 27 00310020260506" src="code" sn="6" numlevel="1" lineno="486" slineno="7-3"><parens/>Short title.</repsec></sectionText></bsec><bsec buid="14" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="487" slineno="8-1" sn="8"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="487">Section 8.  <bold>Effective Date.</bold></secline><sectionText lineno="488"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>12-29-25 3:01 PM</tm></rev></foot></leg>
