McKell</otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill addresses provisions related to supervision of offenders.</gd><hphead lineno="6">Highlighted Provisions:</hphead><hp numlevel="1" lineno="7" slineno="0-7">This bill:<hl numlevel="1" lineno="8" slineno="0-8" level="1">allows a court to order the Division of Adult Probation and Parole to supervise an <ln numlevel="1" lineno="9" slineno="0-9"/>individual convicted of class B misdemeanors if the Division of Adult Probation and <ln numlevel="1" lineno="10" slineno="0-10"/>Parole consents to supervise the individual;</hl><hl numlevel="1" lineno="11" slineno="0-11" level="1">requires the board, if considering whether to parole an offender who has previously been <ln numlevel="1" lineno="12" slineno="0-12"/>paroled and had the offender's parole revoked due to a new criminal offense, to consider <ln numlevel="1" lineno="13" slineno="0-13"/>the facts and circumstances of the new criminal offense in determining whether the <ln numlevel="1" lineno="14" slineno="0-14"/>offender should be paroled again;</hl><hl numlevel="1" lineno="15" slineno="0-15" level="1">allows the board, with certain exceptions, to only consider a pardon for an offender who <ln numlevel="1" lineno="16" slineno="0-16"/>has committed an offense that requires the offender to register on the Sex, Kidnap, and <ln numlevel="1" lineno="17" slineno="0-17"/>Child Abuse Offender Registry (the registry) if:<hl numlevel="1" lineno="18" slineno="0-18" level="2">for a sex offender required to register on the registry for 10 years, 10 years have <ln numlevel="1" lineno="19" slineno="0-19"/>passed from when the sex offender entered the community after the sex offender's <ln numlevel="1" lineno="20" slineno="0-20"/>conviction; or</hl><hl numlevel="1" lineno="21" slineno="0-21" level="2">for a sex offender required to register on the registry for the sex offender's lifetime, 20 <ln numlevel="1" lineno="22" slineno="0-22"/>years have passed from when the sex offender entered the community after the sex <ln numlevel="1" lineno="23" slineno="0-23"/>offender's conviction; and</hl></hl><hl numlevel="1" lineno="24" slineno="0-24" level="1">adds to the requirements for the board to meet before the board may parole an offender <ln numlevel="1" lineno="25" slineno="0-25"/>before the offender's minimum term of imprisonment has been met.</hl></hp><moni numlevel="1" lineno="26" slineno="0-26" display="none">Money Appropriated in this Bill:</moni><moniNone lineno="27">None</moniNone><oc numlevel="1" lineno="28" slineno="0-28">Other Special Clauses:</oc><ocNone lineno="29">None</ocNone><sa numlevel="1" lineno="30" slineno="0-30">Utah Code Sections Affected:<saamd numlevel="1" lineno="31" slineno="0-31"><snhead>AMENDS:</snhead><sn num="64-14-204" src="code" uid="C64-14-S204_2026050620260506" buid="17" sort="64 14 02040020260506" numlevel="1" lineno="32" slineno="0-32"><bold>64-14-204</bold>, as renumbered and amended by Laws of Utah 2025, Chapter 214</sn><sn num="77-18-105" src="code" uid="C77-18-S105_2026050620260506" buid="19" sort="77 18 01050020260506" numlevel="1" lineno="33" slineno="0-33"><bold>77-18-105</bold>, as last amended by Laws of Utah 2025, First Special Session, Chapter 17</sn><sn num="77-27-5" src="code" uid="C77-27-S5_2026050620260506" buid="1" sort="77 27 00050020260506" numlevel="1" lineno="34" slineno="0-34"><bold>77-27-5</bold>, as last amended by Laws of Utah 2025, Chapters 476, 526</sn><sn num="77-27-9" src="code" uid="C77-27-S9_2026050620260506" buid="11" sort="77 27 00090020260506" numlevel="1" lineno="35" slineno="0-35"><bold>77-27-9</bold>, as last amended by Laws of Utah 2022, Chapter 430</sn></saamd><saent numlevel="1" lineno="36" slineno="0-36"><snhead>ENACTS:</snhead><sn num="77-27-5.6" src="code" uid="C77-27-S5.6_2026050620260506" buid="7" sort="77 27 00050620260506" numlevel="1" lineno="37" slineno="0-37"><bold>77-27-5.6</bold>, Utah Code Annotated 1953</sn></saent><sarep numlevel="1" lineno="38" slineno="0-38"><snhead>REPEALS:</snhead><sn num="77-27-31" src="code" uid="C77-27-S31_2026050620260506" buid="3" sort="77 27 00310020260506" numlevel="1" lineno="39" slineno="0-39"><bold>77-27-31</bold>, as enacted by Laws of Utah 1980, Chapter 15</sn></sarep></sa></lt><enacthead lineno="40"/><enact numlevel="1" lineno="41" slineno="0-41">Be it enacted by the Legislature of the state of Utah:</enact><bdy><bsec buid="17" num="64-14-204" type="amend" src="code" uid="C64-14-S204_2026050620260506" sort="64 14 02040020260506" numlevel="1" lineno="42" slineno="1-1" sn="1"><section number="64-14-204" numlevel="1" lineno="43" slineno="1-2" type="amend"><secline lineno="42">Section 1. Section <bold>64-14-204</bold> is amended to read:</secline><catline lineno="43"><bold>64-14-204<parens/>. Supervision of sentenced offenders placed in community -- <ln numlevel="1" lineno="44" slineno="1-3"/>Rulemaking -- POST certified parole or probation officers and peace officers -- Duties -- <ln numlevel="1" lineno="45" slineno="1-4"/>Supervision fee -- Coordination with local mental health authority.</bold></catline><subsection ssid="17-null-1" dnum="1-o" numlevel="1" lineno="46" slineno="1-5" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="17-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The division, except as otherwise provided by law, shall supervise a sentenced <ln numlevel="1" lineno="47" slineno="1-6"/>offender placed in the community if the offender:<subsection ssid="17-null-3" dnum="i-o" numlevel="1" lineno="48" slineno="1-7" level="3" tab="1" space="false"><display>(i)</display><subsection ssid="17-null-4" dnum="A-o" level="4" placement="sameline"><display>(A)</display>is placed on probation by a court;</subsection><subsection ssid="17-null-5" dnum="B-o" numlevel="1" lineno="49" slineno="1-8" level="4"><display>(B)</display>is released on parole by the Board of Pardons and Parole; or</subsection><subsection ssid="17-null-6" dnum="C-o" numlevel="1" lineno="50" slineno="1-9" level="4"><display>(C)</display>is accepted for supervision under the terms of the Interstate Compact for the <ln numlevel="1" lineno="51" slineno="1-10"/>Supervision of Parolees and Probationers; and</subsection></subsection><subsection ssid="17-null-7" dnum="ii-o" numlevel="1" lineno="52" slineno="1-11" level="3" tab="1"><display>(ii)</display>has been convicted of:<subsection ssid="17-null-8" dnum="A-o" numlevel="1" lineno="53" slineno="1-12" level="4"><display>(A)</display>a felony;</subsection><subsection ssid="17-null-9" dnum="B-o" numlevel="1" lineno="54" slineno="1-13" level="4"><display>(B)</display>a class A misdemeanor when an element of the offense is the use or attempted <ln numlevel="1" lineno="55" slineno="1-14"/>use of physical force against an individual or property;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="26" groupid="23" style="2" owner="ahaskell" level="1" deltag="both"> or</amend><amendoutend style="2"/></subsection><subsection ssid="17-null-10" dnum="C-o" numlevel="1" lineno="56" slineno="1-15" level="4"><display>(C)</display>notwithstanding Subsection <xref depth="4" refnumber="64-13-21(1)(a)(ii)(b)">(1)(a)(ii)(B)</xref>, a class A misdemeanor if the <ln numlevel="1" lineno="57" slineno="1-16"/>division is ordered by a court to supervise the offender under Section <xref depth="3" refnumber="77-18-105">77-18-105</xref><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="25" groupid="22" style="2" owner="ahaskell" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="23" groupid="20" style="1" owner="ahaskell" level="1" amendtag="both" space="true">; <ln numlevel="1" lineno="58" slineno="1-17"/>or</amend></subsection><subsection ssid="17-76" dnum="_-o:D-i" numlevel="1" lineno="59" slineno="1-18" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="start">(D)</amend></display><amend anum="0" ea="amend" pairid="22" groupid="19" style="1" owner="ahaskell" level="1" amendtag="end">a class B misdemeanor if the division is ordered by a court to supervise the <ln numlevel="1" lineno="60" slineno="1-19"/>offender under Section <xref depth="3" refnumber="77-18-105">77-18-105</xref> and the division consents to supervise the <ln numlevel="1" lineno="61" slineno="1-20"/>offender.</amend></subsection></subsection></subsection><subsection ssid="17-null-11" dnum="b-o" numlevel="1" lineno="62" slineno="1-21" level="2"><display>(b)</display>If a sentenced offender participates in substance use treatment or a residential <ln numlevel="1" lineno="63" slineno="1-22"/>vocational or life skills program, as defined in Section <xref depth="3" refnumber="13-53-102">13-53-102</xref>, while under <ln numlevel="1" lineno="64" slineno="1-23"/>supervision on probation or parole, the division shall monitor the offender's <ln numlevel="1" lineno="65" slineno="1-24"/>compliance with and completion of the treatment or program.</subsection><subsection ssid="17-null-12" dnum="c-o" numlevel="1" lineno="66" slineno="1-25" level="2"><display>(c)</display>The department shall establish standards for:<subsection ssid="17-null-13" dnum="i-o" numlevel="1" lineno="67" slineno="1-26" level="3"><display>(i)</display>the supervision of offenders in accordance with the adult sentencing and <ln numlevel="1" lineno="68" slineno="1-27"/>supervision length guidelines, as defined in Section <xref depth="3" refnumber="63M-7-401.1">63M-7-401.1</xref>, giving priority, <ln numlevel="1" lineno="69" slineno="1-28"/>based on available resources, to felony offenders and offenders sentenced under <ln numlevel="1" lineno="70" slineno="1-29"/>Subsection <xref depth="3" refnumber="58-37-8">58-37-8</xref><xref refnumber="58-37-8(2)(b)(ii)" depth="4"> (2)(b)(ii)</xref>; and</subsection><subsection ssid="17-null-14" dnum="ii-o" numlevel="1" lineno="71" slineno="1-30" level="3"><display>(ii)</display>the monitoring described in Subsection <xref depth="4" refnumber="64-13-21(1)(b)">(1)(b)</xref>.</subsection></subsection></subsection><subsection ssid="17-null-15" dnum="2-o" numlevel="1" lineno="72" slineno="1-31" level="1"><display>(2)</display>The division shall apply the graduated and evidence-based responses established in the <ln numlevel="1" lineno="73" slineno="1-32"/>adult sentencing and supervision length guidelines, as defined in Section <xref depth="3" refnumber="63M-7-401.1">63M-7-401.1</xref>, <ln numlevel="1" lineno="74" slineno="1-33"/>to facilitate a prompt and appropriate response to an individual's violation of the terms of <ln numlevel="1" lineno="75" slineno="1-34"/>probation or parole, including:<subsection ssid="17-null-16" dnum="a-o" numlevel="1" lineno="76" slineno="1-35" level="2"><display>(a)</display>sanctions to be used in response to a violation of the terms of probation or parole; and</subsection><subsection ssid="17-null-17" dnum="b-o" numlevel="1" lineno="77" slineno="1-36" level="2"><display>(b)</display>requesting approval from the court or Board of Pardons and Parole to impose a <ln numlevel="1" lineno="78" slineno="1-37"/>sanction for an individual's violation of the terms of probation or parole, for a period <ln numlevel="1" lineno="79" slineno="1-38"/>of incarceration of not more than three consecutive days and not more than a total of <ln numlevel="1" lineno="80" slineno="1-39"/>six days within a period of 30 days.</subsection></subsection><subsection ssid="17-null-18" dnum="3-o" numlevel="1" lineno="81" slineno="1-40" level="1"><display>(3)</display>The division shall implement a program of graduated incentives as established in the <ln numlevel="1" lineno="82" slineno="1-41"/>adult sentencing and supervision length guidelines, as defined in Section <xref depth="3" refnumber="63M-7-401.1">63M-7-401.1</xref> <ln numlevel="1" lineno="83" slineno="1-42"/>to facilitate the department's prompt and appropriate response to an offender's:<subsection ssid="17-null-19" dnum="a-o" numlevel="1" lineno="84" slineno="1-43" level="2"><display>(a)</display>compliance with the terms of probation or parole; or</subsection><subsection ssid="17-null-20" dnum="b-o" numlevel="1" lineno="85" slineno="1-44" level="2"><display>(b)</display>positive conduct that exceeds those terms.</subsection></subsection><subsection ssid="17-null-21" dnum="4-o" numlevel="1" lineno="86" slineno="1-45" level="1" space="false"><display>(4)</display><subsection ssid="17-null-22" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The department shall, in collaboration with the State Commission on Criminal and <ln numlevel="1" lineno="87" slineno="1-46"/>Juvenile Justice and the Division of Substance Use and Mental Health, create <ln numlevel="1" lineno="88" slineno="1-47"/>standards and procedures for the collection of information, including cost savings <ln numlevel="1" lineno="89" slineno="1-48"/>related to recidivism reduction and the reduction in the number of inmates, related to <ln numlevel="1" lineno="90" slineno="1-49"/>the use of the graduated and evidence-based responses and graduated incentives, and <ln numlevel="1" lineno="91" slineno="1-50"/>offenders' outcomes.</subsection><subsection ssid="17-null-23" dnum="b-o" numlevel="1" lineno="92" slineno="1-51" level="2"><display>(b)</display>The collected information shall be provided to the State Commission on Criminal <ln numlevel="1" lineno="93" slineno="1-52"/>and Juvenile Justice not less frequently than annually on or before August 31.</subsection></subsection><subsection ssid="17-null-24" dnum="5-o" numlevel="1" lineno="94" slineno="1-53" level="1"><display>(5)</display>Employees of the division who are POST certified as law enforcement officers or <ln numlevel="1" lineno="95" slineno="1-54"/>correctional officers and who are designated as parole and probation officers by the <ln numlevel="1" lineno="96" slineno="1-55"/>executive director have the following duties:<subsection ssid="17-null-25" dnum="a-o" numlevel="1" lineno="97" slineno="1-56" level="2"><display>(a)</display>monitoring, investigating, and supervising a parolee's or probationer's compliance <ln numlevel="1" lineno="98" slineno="1-57"/>with the conditions of the parole or probation agreement;</subsection><subsection ssid="17-null-26" dnum="b-o" numlevel="1" lineno="99" slineno="1-58" level="2"><display>(b)</display>investigating or apprehending any offender who has escaped from the custody of the <ln numlevel="1" lineno="100" slineno="1-59"/>department or absconded from supervision by the division;</subsection><subsection ssid="17-null-27" dnum="c-o" numlevel="1" lineno="101" slineno="1-60" level="2"><display>(c)</display>supervising any offender during transportation; or</subsection><subsection ssid="17-null-28" dnum="d-o" numlevel="1" lineno="102" slineno="1-61" level="2"><display>(d)</display>collecting DNA specimens when the specimens are required under Section <xref depth="3" refnumber="53-10-404">53-10-404</xref>.</subsection></subsection><subsection ssid="17-null-29" dnum="6-o" numlevel="1" lineno="103" slineno="1-62" level="1" space="false"><display>(6)</display><subsection ssid="17-null-30" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="17-null-31" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>A monthly supervision fee of $30 shall be collected from each offender on <ln numlevel="1" lineno="104" slineno="1-63"/>probation or parole.</subsection><subsection ssid="17-null-32" dnum="ii-o" numlevel="1" lineno="105" slineno="1-64" level="3" tab="1"><display>(ii)</display>The fee described in Subsection <xref depth="4" refnumber="64-13-21(6)(a)(i)">(6)(a)(i)</xref> may be suspended or waived by the <ln numlevel="1" lineno="106" slineno="1-65"/>division upon a showing by the offender that imposition would create a substantial <ln numlevel="1" lineno="107" slineno="1-66"/>hardship or if the offender owes restitution to a victim.</subsection></subsection><subsection ssid="17-null-33" dnum="b-o" numlevel="1" lineno="108" slineno="1-67" level="2" space="false"><display>(b)</display><subsection ssid="17-null-34" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The department shall make rules in accordance with Title 63G, Chapter 3, Utah <ln numlevel="1" lineno="109" slineno="1-68"/>Administrative Rulemaking Act, specifying the criteria for suspension or waiver <ln numlevel="1" lineno="110" slineno="1-69"/>of the supervision fee and the circumstances under which an offender may request <ln numlevel="1" lineno="111" slineno="1-70"/>a hearing.</subsection><subsection ssid="17-null-35" dnum="ii-o" numlevel="1" lineno="112" slineno="1-71" level="3"><display>(ii)</display>In determining whether the imposition of the supervision fee would constitute a <ln numlevel="1" lineno="113" slineno="1-72"/>substantial hardship, the division shall consider the financial resources of the <ln numlevel="1" lineno="114" slineno="1-73"/>offender and the burden that the fee would impose, with regard to the offender's <ln numlevel="1" lineno="115" slineno="1-74"/>other obligations.</subsection></subsection><subsection ssid="17-null-36" dnum="c-o" numlevel="1" lineno="116" slineno="1-75" level="2"><display>(c)</display>The division shall deposit money received from the monthly supervision fee <ln numlevel="1" lineno="117" slineno="1-76"/>established in this Subsection <xref depth="4" refnumber="64-13-21(6)">(6)</xref> into the General Fund as a parole and probation <ln numlevel="1" lineno="118" slineno="1-77"/>dedicated credit to be used to cover costs incurred in the collection of the fee and in <ln numlevel="1" lineno="119" slineno="1-78"/>the development of offender supervision programs.</subsection></subsection><subsection ssid="17-null-37" dnum="7-o" numlevel="1" lineno="120" slineno="1-79" level="1" space="false"><display>(7)</display><subsection ssid="17-null-38" dnum="a-o" level="2" placement="sameline"><display>(a)</display>For offenders placed on probation under Section <xref depth="3" refnumber="77-18-105">77-18-105</xref> or parole under <ln numlevel="1" lineno="121" slineno="1-80"/>Subsection <xref depth="4" refnumber="76-3-202(2)(a)">76-3-202(2)(a)</xref> on or after October 1, 2015, but before January 1, 2019, <ln numlevel="1" lineno="122" slineno="1-81"/>the division shall establish a program allowing an offender to earn a reduction credit <ln numlevel="1" lineno="123" slineno="1-82"/>of 30 days from the offender's period of probation or parole for each month the <ln numlevel="1" lineno="124" slineno="1-83"/>offender complies with the terms of the offender's probation or parole agreement, <ln numlevel="1" lineno="125" slineno="1-84"/>including the case action plan.</subsection><subsection ssid="17-null-39" dnum="b-o" numlevel="1" lineno="126" slineno="1-85" level="2" space="false"><display>(b)</display><subsection ssid="17-null-40" dnum="i-o" level="3" placement="sameline"><display>(i)</display>For offenders placed on probation under Section <xref depth="3" refnumber="77-18-105">77-18-105</xref> or parole under <ln numlevel="1" lineno="127" slineno="1-86"/>Section <xref depth="3" refnumber="76-3-202">76-3-202</xref> on or after July 1, 2026, the division shall establish a program, <ln numlevel="1" lineno="128" slineno="1-87"/>consistent with the adult sentencing and supervision length guidelines, as defined <ln numlevel="1" lineno="129" slineno="1-88"/>in Section <xref depth="3" refnumber="63M-7-401.1">63M-7-401.1</xref>, to provide incentives for an offender that maintains <ln numlevel="1" lineno="130" slineno="1-89"/>eligible employment, as defined in Section <xref depth="3" refnumber="64-13g-101">64-13g-101</xref>.</subsection><subsection ssid="17-null-41" dnum="ii-o" numlevel="1" lineno="131" slineno="1-90" level="3"><display>(ii)</display>The program under Subsection <xref depth="4" refnumber="64-13-21(7)(b)(i)">(7)(b)(i)</xref> may include a credit towards the <ln numlevel="1" lineno="132" slineno="1-91"/>reduction of the length of supervision for an offender at a rate of up to 30 days for <ln numlevel="1" lineno="133" slineno="1-92"/>each month that the offender maintains eligible employment, as defined in Section <xref depth="3" refnumber="64-13g-101"><ln numlevel="1" lineno="134" slineno="1-93"/>64-13g-101</xref>.</subsection><subsection ssid="17-null-42" dnum="iii-o" numlevel="1" lineno="135" slineno="1-94" level="3"><display>(iii)</display>A court, or the Board of Pardons and Parole, is not required to grant a request for <ln numlevel="1" lineno="136" slineno="1-95"/>termination of supervision under the program described in this Subsection <xref depth="4" refnumber="64-13-21(7)(b)">(7)(b)</xref> if <ln numlevel="1" lineno="137" slineno="1-96"/>the court, or the Board of Pardons and Parole, finds that:<subsection ssid="17-null-43" dnum="A-o" numlevel="1" lineno="138" slineno="1-97" level="4"><display>(A)</display>the offender presents a substantial risk to public safety;</subsection><subsection ssid="17-null-44" dnum="B-o" numlevel="1" lineno="139" slineno="1-98" level="4"><display>(B)</display>termination would prevent the offender from completing risk reduction <ln numlevel="1" lineno="140" slineno="1-99"/>programming or treatment; or</subsection><subsection ssid="17-null-45" dnum="C-o" numlevel="1" lineno="141" slineno="1-100" level="4"><display>(C)</display>the eligibility criteria for termination of supervision, as established in the adult <ln numlevel="1" lineno="142" slineno="1-101"/>sentencing and supervision length guidelines, as defined in Section <xref depth="3" refnumber="63M-7-401.1"><ln numlevel="1" lineno="143" slineno="1-102"/>63M-7-401.1</xref>, have not been met.</subsection></subsection><subsection ssid="17-null-46" dnum="iv-o" numlevel="1" lineno="144" slineno="1-103" level="3"><display>(iv)</display>This Subsection <xref depth="4" refnumber="64-13-21(7)(b)">(7)(b)</xref> does not prohibit the division, or another supervision <ln numlevel="1" lineno="145" slineno="1-104"/>services provider, from requesting termination of supervision based on the <ln numlevel="1" lineno="146" slineno="1-105"/>eligibility criteria in the adult sentencing and supervision length guidelines, as <ln numlevel="1" lineno="147" slineno="1-106"/>defined in Section <xref depth="3" refnumber="63M-7-401.1">63M-7-401.1</xref>.</subsection></subsection><subsection ssid="17-null-47" dnum="c-o" numlevel="1" lineno="148" slineno="1-107" level="2"><display>(c)</display>The division shall:<subsection ssid="17-null-48" dnum="i-o" numlevel="1" lineno="149" slineno="1-108" level="3"><display>(i)</display>maintain a record of credits earned by an offender under this Subsection <xref depth="4" refnumber="64-13-21(7)">(7)</xref>; and</subsection><subsection ssid="17-null-49" dnum="ii-o" numlevel="1" lineno="150" slineno="1-109" level="3"><display>(ii)</display>request from the court or the Board of Pardons and Parole the termination of <ln numlevel="1" lineno="151" slineno="1-110"/>probation or parole not fewer than 30 days prior to the termination date that <ln numlevel="1" lineno="152" slineno="1-111"/>reflects the credits earned under this Subsection <xref depth="4" refnumber="64-13-21(7)">(7)</xref>.</subsection></subsection><subsection ssid="17-null-50" dnum="d-o" numlevel="1" lineno="153" slineno="1-112" level="2"><display>(d)</display>This Subsection <xref depth="4" refnumber="64-13-21(7)">(7)</xref> does not prohibit the division from requesting a termination date <ln numlevel="1" lineno="154" slineno="1-113"/>earlier than the termination date established by earned credits under Subsection <xref depth="4" refnumber="64-13-21(7)(c)">(7)(c)</xref>.</subsection><subsection ssid="17-null-51" dnum="e-o" numlevel="1" lineno="155" slineno="1-114" level="2"><display>(e)</display>The court or the Board of Pardons and Parole shall terminate an offender's probation <ln numlevel="1" lineno="156" slineno="1-115"/>or parole upon completion of the period of probation or parole accrued by time <ln numlevel="1" lineno="157" slineno="1-116"/>served and credits earned under this Subsection <xref depth="4" refnumber="64-13-21(7)">(7)</xref> unless the court or the Board of <ln numlevel="1" lineno="158" slineno="1-117"/>Pardons and Parole finds that termination would interrupt the completion of a <ln numlevel="1" lineno="159" slineno="1-118"/>necessary treatment program, in which case the termination of probation or parole <ln numlevel="1" lineno="160" slineno="1-119"/>shall occur when the treatment program is completed.</subsection><subsection ssid="17-null-52" dnum="f-o" numlevel="1" lineno="161" slineno="1-120" level="2"><display>(f)</display>The department shall report annually to the State Commission on Criminal and <ln numlevel="1" lineno="162" slineno="1-121"/>Juvenile Justice on or before August 31:<subsection ssid="17-null-53" dnum="i-o" numlevel="1" lineno="163" slineno="1-122" level="3"><display>(i)</display>the number of offenders who have earned probation or parole credits under this <ln numlevel="1" lineno="164" slineno="1-123"/>Subsection <xref depth="4" refnumber="64-13-21(7)">(7)</xref> in one or more months of the preceding fiscal year and the <ln numlevel="1" lineno="165" slineno="1-124"/>percentage of the offenders on probation or parole during that time that this <ln numlevel="1" lineno="166" slineno="1-125"/>number represents;</subsection><subsection ssid="17-null-54" dnum="ii-o" numlevel="1" lineno="167" slineno="1-126" level="3"><display>(ii)</display>the average number of credits earned by those offenders who earned credits;</subsection><subsection ssid="17-null-55" dnum="iii-o" numlevel="1" lineno="168" slineno="1-127" level="3"><display>(iii)</display>the number of offenders who earned credits by county of residence while on <ln numlevel="1" lineno="169" slineno="1-128"/>probation or parole;</subsection><subsection ssid="17-null-56" dnum="iv-o" numlevel="1" lineno="170" slineno="1-129" level="3"><display>(iv)</display>the cost savings associated with sentencing reform programs and practices; and</subsection><subsection ssid="17-null-57" dnum="v-o" numlevel="1" lineno="171" slineno="1-130" level="3"><display>(v)</display>a description of how the savings will be invested in treatment and <ln numlevel="1" lineno="172" slineno="1-131"/>early-intervention programs and practices at the county and state levels.</subsection></subsection></subsection><subsection ssid="17-null-58" dnum="8-o" numlevel="1" lineno="173" slineno="1-132" level="1" space="false"><display>(8)</display><subsection ssid="17-null-59" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The department shall coordinate with a local mental health authority to complete <ln numlevel="1" lineno="174" slineno="1-133"/>the requirements of this Subsection <xref refnumber="64-13-21(8)" depth="4">(8)</xref> for an offender who:<subsection ssid="17-null-60" dnum="i-o" numlevel="1" lineno="175" slineno="1-134" level="3" tab="1"><display>(i)</display>is a habitual offender as that term is defined in Section <xref depth="3" refnumber="77-18-102">77-18-102</xref>;</subsection><subsection ssid="17-null-61" dnum="ii-o" numlevel="1" lineno="176" slineno="1-135" level="3" tab="1"><display>(ii)</display>has a mental illness as that term is defined in Section <xref depth="3" refnumber="26B-5-301">26B-5-301</xref>; and</subsection><subsection ssid="17-null-62" dnum="iii-o" numlevel="1" lineno="177" slineno="1-136" level="3" tab="1"><display>(iii)</display>based on a risk and needs assessment:<subsection ssid="17-null-63" dnum="A-o" numlevel="1" lineno="178" slineno="1-137" level="4"><display>(A)</display>is at a high risk of reoffending; and</subsection><subsection ssid="17-null-64" dnum="B-o" numlevel="1" lineno="179" slineno="1-138" level="4"><display>(B)</display>has risk factors that may be addressed by available community-based services.</subsection></subsection></subsection><subsection ssid="17-null-65" dnum="b-o" numlevel="1" lineno="180" slineno="1-139" level="2"><display>(b)</display>For an offender described in Subsection <xref depth="4" refnumber="64-13-21(8)(a)">(8)(a)</xref>, at any time clinically appropriate or <ln numlevel="1" lineno="181" slineno="1-140"/>at least three months before termination of an offender's parole or expiration of an <ln numlevel="1" lineno="182" slineno="1-141"/>offender's sentence, the department shall coordinate with the Department of Health <ln numlevel="1" lineno="183" slineno="1-142"/>and Human Services and the relevant local mental health authority to provide <ln numlevel="1" lineno="184" slineno="1-143"/>applicable clinical assessments and transitional treatment planning and services for <ln numlevel="1" lineno="185" slineno="1-144"/>the offender so that the offender may receive appropriate treatment and support <ln numlevel="1" lineno="186" slineno="1-145"/>services after the termination of parole or expiration of sentence.</subsection><subsection ssid="17-null-66" dnum="c-o" numlevel="1" lineno="187" slineno="1-146" level="2"><display>(c)</display>The local mental health authority may determine whether the offender:<subsection ssid="17-null-67" dnum="i-o" numlevel="1" lineno="188" slineno="1-147" level="3"><display>(i)</display>meets the criteria for civil commitment;</subsection><subsection ssid="17-null-68" dnum="ii-o" numlevel="1" lineno="189" slineno="1-148" level="3"><display>(ii)</display>meets the criteria for assisted outpatient treatment; or</subsection><subsection ssid="17-null-69" dnum="iii-o" numlevel="1" lineno="190" slineno="1-149" level="3"><display>(iii)</display>would benefit from assignment to an assertive community treatment team or <ln numlevel="1" lineno="191" slineno="1-150"/>available community-based services.</subsection></subsection><subsection ssid="17-null-70" dnum="d-o" numlevel="1" lineno="192" slineno="1-151" level="2"><display>(d)</display>Based on the local mental health authority's determination under Subsection <xref refnumber="64-13-21(8)(c)" depth="4">(8)(c)</xref>, <ln numlevel="1" lineno="193" slineno="1-152"/>the local mental health authority shall, as appropriate:<subsection ssid="17-null-71" dnum="i-o" numlevel="1" lineno="194" slineno="1-153" level="3"><display>(i)</display>initiate an involuntary commitment court proceeding;</subsection><subsection ssid="17-null-72" dnum="ii-o" numlevel="1" lineno="195" slineno="1-154" level="3"><display>(ii)</display>file a written application for assisted outpatient treatment; or</subsection><subsection ssid="17-null-73" dnum="iii-o" numlevel="1" lineno="196" slineno="1-155" level="3"><display>(iii)</display>seek to have the offender assigned to an assertive community treatment team or <ln numlevel="1" lineno="197" slineno="1-156"/>available community-based services.</subsection></subsection><subsection ssid="17-null-74" dnum="e-o" numlevel="1" lineno="198" slineno="1-157" level="2"><display>(e)</display>On or before November 1, 2025, the department shall provide a report to the Law <ln numlevel="1" lineno="199" slineno="1-158"/>Enforcement and Criminal Justice Interim Committee regarding any proposed <ln numlevel="1" lineno="200" slineno="1-159"/>changes to the requirements in this Subsection <xref refnumber="64-13-21(8)" depth="4">(8)</xref>, including whether the <ln numlevel="1" lineno="201" slineno="1-160"/>requirements of this Subsection <xref depth="4" refnumber="64-13-21(8)">(8)</xref> should also apply to any other category of <ln numlevel="1" lineno="202" slineno="1-161"/>offenders.</subsection></subsection></section></bsec><bsec buid="19" num="77-18-105" type="amend" src="code" uid="C77-18-S105_2026050620260506" sort="77 18 01050020260506" numlevel="1" lineno="203" slineno="2-1" sn="2"><section number="77-18-105" numlevel="1" lineno="204" slineno="2-2" type="amend"><secline lineno="203">Section 2. Section <bold>77-18-105</bold> is amended to read:</secline><catline lineno="204"><bold>77-18-105<parens/>. Pleas held in abeyance -- Suspension of a sentence -- Probation -- <ln numlevel="1" lineno="205" slineno="2-3"/>Supervision -- Terms and conditions of probation -- Time periods for probation -- Bench <ln numlevel="1" lineno="206" slineno="2-4"/>supervision for payments on criminal accounts receivable.</bold></catline><subsection ssid="19-null-1" dnum="1-o" numlevel="1" lineno="207" slineno="2-5" level="1" placement="noreturn"><display>(1)</display>If a defendant enters a plea of guilty or no contest in conjunction with a plea in <ln numlevel="1" lineno="208" slineno="2-6"/>abeyance agreement, the court may hold the plea in abeyance:<subsection ssid="19-null-2" dnum="a-o" numlevel="1" lineno="209" slineno="2-7" level="2"><display>(a)</display>in accordance with Chapter 2a, Pleas in Abeyance; and</subsection><subsection ssid="19-null-3" dnum="b-o" numlevel="1" lineno="210" slineno="2-8" level="2"><display>(b)</display>under the terms of the plea in abeyance agreement.</subsection></subsection><subsection ssid="19-null-4" dnum="2-o" numlevel="1" lineno="211" slineno="2-9" level="1"><display>(2)</display>If a defendant is convicted, the court:<subsection ssid="19-null-5" dnum="a-o" numlevel="1" lineno="212" slineno="2-10" level="2"><display>(a)</display>shall impose a sentence in accordance with Section <xref depth="3" refnumber="76-3-201">76-3-201</xref>; and</subsection><subsection ssid="19-null-6" dnum="b-o" numlevel="1" lineno="213" slineno="2-11" level="2"><display>(b)</display>subject to Subsection <xref depth="4" refnumber="77-18-105(5)">(5)</xref>, may suspend the execution of the sentence and place the <ln numlevel="1" lineno="214" slineno="2-12"/>defendant:<subsection ssid="19-null-7" dnum="i-o" numlevel="1" lineno="215" slineno="2-13" level="3"><display>(i)</display>on probation under the supervision of the division;</subsection><subsection ssid="19-null-8" dnum="ii-o" numlevel="1" lineno="216" slineno="2-14" level="3"><display>(ii)</display>on probation under the supervision of an agency of a local government or a <ln numlevel="1" lineno="217" slineno="2-15"/>private organization; or</subsection><subsection ssid="19-null-9" dnum="iii-o" numlevel="1" lineno="218" slineno="2-16" level="3"><display>(iii)</display>on court probation under the jurisdiction of the sentencing court.</subsection></subsection></subsection><subsection ssid="19-null-10" dnum="3-o" numlevel="1" lineno="219" slineno="2-17" level="1" space="false"><display>(3)</display><subsection ssid="19-null-11" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The legal custody of all probationers under the supervision of the division is with <ln numlevel="1" lineno="220" slineno="2-18"/>the department.</subsection><subsection ssid="19-null-12" dnum="b-o" numlevel="1" lineno="221" slineno="2-19" level="2"><display>(b)</display>The legal custody of all probationers under the jurisdiction of the sentencing court is <ln numlevel="1" lineno="222" slineno="2-20"/>vested as ordered by the court.</subsection><subsection ssid="19-null-13" dnum="c-o" numlevel="1" lineno="223" slineno="2-21" level="2"><display>(c)</display>The court has continuing jurisdiction over all probationers.</subsection></subsection><subsection ssid="19-null-14" dnum="4-o" numlevel="1" lineno="224" slineno="2-22" level="1" space="false"><display>(4)</display><subsection ssid="19-null-15" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Court probation may include an administrative level of services, including <ln numlevel="1" lineno="225" slineno="2-23"/>notification to the sentencing court of scheduled periodic reviews of the probationer's <ln numlevel="1" lineno="226" slineno="2-24"/>compliance with conditions.</subsection><subsection ssid="19-null-16" dnum="b-o" numlevel="1" lineno="227" slineno="2-25" level="2"><display>(b)</display>Supervised probation services provided by the division, an agency of a local <ln numlevel="1" lineno="228" slineno="2-26"/>government, or a private organization shall specifically address the defendant's risk <ln numlevel="1" lineno="229" slineno="2-27"/>of reoffending as identified by a screening or an assessment.</subsection><subsection ssid="19-null-17" dnum="c-o" numlevel="1" lineno="230" slineno="2-28" level="2"><display>(c)</display>If a court orders supervised probation and determines that a public probation <ln numlevel="1" lineno="231" slineno="2-29"/>provider is unavailable or inappropriate to supervise the defendant, the court shall <ln numlevel="1" lineno="232" slineno="2-30"/>make available to the defendant the list of private probation providers prepared by a <ln numlevel="1" lineno="233" slineno="2-31"/>criminal justice coordinating council under Section <xref depth="3" refnumber="17E-2-201">17E-2-201</xref>.</subsection></subsection><subsection ssid="19-null-18" dnum="5-o" numlevel="1" lineno="234" slineno="2-32" level="1" space="false"><display>(5)</display><subsection ssid="19-null-19" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Before ordering supervised probation, the court shall consider the supervision <ln numlevel="1" lineno="235" slineno="2-33"/>costs to the defendant for each entity that can supervise the defendant.</subsection><subsection ssid="19-null-20" dnum="b-o" numlevel="1" lineno="236" slineno="2-34" level="2" space="false"><display>(b)</display><subsection ssid="19-null-21" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A court may order an agency of a local government to supervise the probation <ln numlevel="1" lineno="237" slineno="2-35"/>for an individual convicted of any crime if:<subsection ssid="19-null-22" dnum="A-o" numlevel="1" lineno="238" slineno="2-36" level="4" tab="1"><display>(A)</display>the agency has the capacity to supervise the individual; and</subsection><subsection ssid="19-null-23" dnum="B-o" numlevel="1" lineno="239" slineno="2-37" level="4" tab="1"><display>(B)</display>the individual's supervision needs will be met by the agency.</subsection></subsection><subsection ssid="19-null-24" dnum="ii-o" numlevel="1" lineno="240" slineno="2-38" level="3"><display>(ii)</display>A court may only order:<subsection ssid="19-null-25" dnum="A-o" numlevel="1" lineno="241" slineno="2-39" level="4"><display>(A)</display><amend anum="0" ea="amend" pairid="14" groupid="12" style="1" owner="ahaskell" level="1" amendtag="both">except as provided in Subsection <xref depth="4" refnumber="77-18-105(5)(b)(iii)">(5)(b)(iii)</xref>, </amend>the division to supervise the <ln numlevel="1" lineno="242" slineno="2-40"/>probation for an individual convicted of a class A misdemeanor or any felony; <ln numlevel="1" lineno="243" slineno="2-41"/>or</subsection><subsection ssid="19-null-26" dnum="B-o" numlevel="1" lineno="244" slineno="2-42" level="4"><display>(B)</display>a private organization to supervise the probation for an individual convicted of <ln numlevel="1" lineno="245" slineno="2-43"/>a class A, B, or C misdemeanor or an infraction.</subsection></subsection><subsection ssid="19-63" dnum="_-o:iii-i" numlevel="1" lineno="246" slineno="2-44" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1101" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="15" style="1" owner="ahaskell" level="1" amendtag="end">A court may order the division to supervise the probation for an individual <ln numlevel="1" lineno="247" slineno="2-45"/>convicted of a class B misdemeanor if the division consents to supervise the <ln numlevel="1" lineno="248" slineno="2-46"/>offender.</amend></subsection></subsection><subsection ssid="19-null-27" dnum="c-o" numlevel="1" lineno="249" slineno="2-47" level="2"><display>(c)</display>A court may not order a specific private organization to supervise an individual <ln numlevel="1" lineno="250" slineno="2-48"/>unless there is only one private organization that can provide the specific supervision <ln numlevel="1" lineno="251" slineno="2-49"/>services required to meet the individual's supervision needs.</subsection></subsection><subsection ssid="19-null-28" dnum="6-o" numlevel="1" lineno="252" slineno="2-50" level="1" space="false"><display>(6)</display><subsection ssid="19-null-29" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If a defendant is placed on probation, the court may order the defendant as a <ln numlevel="1" lineno="253" slineno="2-51"/>condition of the defendant's probation:<subsection ssid="19-null-30" dnum="i-o" numlevel="1" lineno="254" slineno="2-52" level="3" tab="1"><display>(i)</display>to provide for the support of persons for whose support the defendant is legally <ln numlevel="1" lineno="255" slineno="2-53"/>liable;</subsection><subsection ssid="19-null-31" dnum="ii-o" numlevel="1" lineno="256" slineno="2-54" level="3" tab="1"><display>(ii)</display>to participate in available treatment programs, including any treatment program in <ln numlevel="1" lineno="257" slineno="2-55"/>which the defendant is currently participating if the program is acceptable to the <ln numlevel="1" lineno="258" slineno="2-56"/>court;</subsection><subsection ssid="19-null-32" dnum="iii-o" numlevel="1" lineno="259" slineno="2-57" level="3" tab="1"><display>(iii)</display>be voluntarily admitted to the custody of the Division of Substance Use and <ln numlevel="1" lineno="260" slineno="2-58"/>Mental Health for treatment at the Utah State Hospital in accordance with Section <xref depth="3" refnumber="77-18-106"><ln numlevel="1" lineno="261" slineno="2-59"/>77-18-106</xref>;</subsection><subsection ssid="19-null-33" dnum="iv-o" numlevel="1" lineno="262" slineno="2-60" level="3" tab="1"><display>(iv)</display>if the defendant is on probation for a felony offense, to serve a period of time as <ln numlevel="1" lineno="263" slineno="2-61"/>an initial condition of probation that does not exceed one year in a county jail <ln numlevel="1" lineno="264" slineno="2-62"/>designated by the department, after considering any recommendation by the court <ln numlevel="1" lineno="265" slineno="2-63"/>as to which jail the court finds most appropriate;</subsection><subsection ssid="19-null-34" dnum="v-o" numlevel="1" lineno="266" slineno="2-64" level="3" tab="1"><display>(v)</display>to serve a term of home confinement in accordance with Section <xref depth="3" refnumber="77-18-107">77-18-107</xref>;</subsection><subsection ssid="19-null-35" dnum="vi-o" numlevel="1" lineno="267" slineno="2-65" level="3" tab="1"><display>(vi)</display>to participate in compensatory service programs, including the compensatory <ln numlevel="1" lineno="268" slineno="2-66"/>service program described in Section <xref depth="3" refnumber="76-3-410">76-3-410</xref>;</subsection><subsection ssid="19-null-36" dnum="vii-o" numlevel="1" lineno="269" slineno="2-67" level="3" tab="1"><display>(vii)</display>to pay for the costs of investigation, probation, or treatment services;</subsection><subsection ssid="19-null-37" dnum="viii-o" numlevel="1" lineno="270" slineno="2-68" level="3" tab="1"><display>(viii)</display>to pay restitution to a victim with interest in accordance with Chapter 38b, <ln numlevel="1" lineno="271" slineno="2-69"/>Crime Victims Restitution Act; or</subsection><subsection ssid="19-null-38" dnum="ix-o" numlevel="1" lineno="272" slineno="2-70" level="3" tab="1"><display>(ix)</display>to comply with other terms and conditions the court considers appropriate to <ln numlevel="1" lineno="273" slineno="2-71"/>ensure public safety or increase a defendant's likelihood of success on probation.</subsection></subsection><subsection ssid="19-null-39" dnum="b-o" numlevel="1" lineno="274" slineno="2-72" level="2"><display>(b)</display>If a defendant is placed on probation and a condition of the defendant's probation is <ln numlevel="1" lineno="275" slineno="2-73"/>routine or random drug testing, the defendant shall sign a waiver consistent with the <ln numlevel="1" lineno="276" slineno="2-74"/>Health Insurance Portability and Accountability Act, 42 U.S.C. Sec. 1320d et seq., <ln numlevel="1" lineno="277" slineno="2-75"/>allowing the treatment provider conducting the drug testing to notify the defendant's <ln numlevel="1" lineno="278" slineno="2-76"/>supervising probation officer regarding the results of the defendant's drug testing.</subsection><subsection ssid="19-null-40" dnum="c-o" numlevel="1" lineno="279" slineno="2-77" level="2" space="false"><display>(c)</display><subsection ssid="19-null-41" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Notwithstanding Subsection <xref depth="4" refnumber="77-18-105(6)(a)(iv)">(6)(a)(iv)</xref>, the court may modify the probation of a <ln numlevel="1" lineno="280" slineno="2-78"/>defendant to include a period of time that is served in a county jail immediately <ln numlevel="1" lineno="281" slineno="2-79"/>before the termination of probation as long as that period of time does not exceed <ln numlevel="1" lineno="282" slineno="2-80"/>one year.</subsection><subsection ssid="19-null-42" dnum="ii-o" numlevel="1" lineno="283" slineno="2-81" level="3"><display>(ii)</display>If a defendant is ordered to serve time in a county jail as a sanction for a <ln numlevel="1" lineno="284" slineno="2-82"/>probation violation, the one-year limitation described in Subsection <xref depth="4" refnumber="77-18-105(6)(a)(iv)">(6)(a)(iv)</xref> or <xref depth="4" refnumber="77-18-105(6)(c)(i)"><ln numlevel="1" lineno="285" slineno="2-83"/>(6)(c)(i)</xref> does not apply to the period of time that the court orders the defendant to <ln numlevel="1" lineno="286" slineno="2-84"/>serve in a county jail under this Subsection <xref depth="4" refnumber="77-18-105(6)(c)(ii)">(6)(c)(ii)</xref>.</subsection></subsection></subsection><subsection ssid="19-null-43" dnum="7-o" numlevel="1" lineno="287" slineno="2-85" level="1" space="false"><display>(7)</display><subsection ssid="19-null-44" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="77-18-105(7)(b)">(7)(b)</xref>, probation of an individual placed on <ln numlevel="1" lineno="288" slineno="2-86"/>probation after December 31, 2018:<subsection ssid="19-null-45" dnum="i-o" numlevel="1" lineno="289" slineno="2-87" level="3" tab="1"><display>(i)</display>may not exceed the individual's maximum sentence;</subsection><subsection ssid="19-null-46" dnum="ii-o" numlevel="1" lineno="290" slineno="2-88" level="3" tab="1"><display>(ii)</display>shall be for a period of time that is in accordance with the adult sentencing and <ln numlevel="1" lineno="291" slineno="2-89"/>supervision length guidelines, as defined in Section <xref depth="3" refnumber="63M-7-401.1">63M-7-401.1</xref>, to the extent the <ln numlevel="1" lineno="292" slineno="2-90"/>guidelines are consistent with the requirements of the law; and</subsection><subsection ssid="19-null-47" dnum="iii-o" numlevel="1" lineno="293" slineno="2-91" level="3" tab="1"><display>(iii)</display>shall be terminated in accordance with the adult sentencing and supervision <ln numlevel="1" lineno="294" slineno="2-92"/>length guidelines, as defined in Section <xref depth="3" refnumber="63M-7-401.1">63M-7-401.1</xref>, to the extent the guidelines <ln numlevel="1" lineno="295" slineno="2-93"/>are consistent with the requirements of the law.</subsection></subsection><subsection ssid="19-null-48" dnum="b-o" numlevel="1" lineno="296" slineno="2-94" level="2"><display>(b)</display>Probation of an individual placed on probation after December 31, 2018, whose <ln numlevel="1" lineno="297" slineno="2-95"/>maximum sentence is one year or less, may not exceed 36 months.</subsection><subsection ssid="19-null-49" dnum="c-o" numlevel="1" lineno="298" slineno="2-96" level="2"><display>(c)</display>Probation of an individual placed on probation on or after October 1, 2015, but <ln numlevel="1" lineno="299" slineno="2-97"/>before January 1, 2019, may be terminated at any time at the discretion of the court <ln numlevel="1" lineno="300" slineno="2-98"/>or upon completion without violation of 36 months probation in felony or class A <ln numlevel="1" lineno="301" slineno="2-99"/>misdemeanor cases, 12 months in cases of class B or C misdemeanors or infractions, <ln numlevel="1" lineno="302" slineno="2-100"/>or as allowed in accordance with Section <xref depth="3" refnumber="64-13-21">64-13-21</xref> regarding earned credits.</subsection><subsection ssid="19-null-50" dnum="d-o" numlevel="1" lineno="303" slineno="2-101" level="2"><display>(d)</display>This Subsection <xref depth="4" refnumber="77-18-105(7)">(7)</xref> does not apply to the probation of an individual convicted of an <ln numlevel="1" lineno="304" slineno="2-102"/>offense for criminal nonsupport under Section <xref depth="3" refnumber="76-7-201">76-7-201</xref>.</subsection></subsection><subsection ssid="19-null-51" dnum="8-o" numlevel="1" lineno="305" slineno="2-103" level="1" space="false"><display>(8)</display><subsection ssid="19-null-52" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Notwithstanding Subsection <xref depth="4" refnumber="77-18-105(7)">(7)</xref>, if there is an unpaid balance of the criminal <ln numlevel="1" lineno="306" slineno="2-104"/>accounts receivable for the defendant upon termination of the probation period for <ln numlevel="1" lineno="307" slineno="2-105"/>the defendant under Subsection <xref depth="4" refnumber="77-18-105(7)">(7)</xref>, the court may require the defendant to continue <ln numlevel="1" lineno="308" slineno="2-106"/>to make payments towards the criminal accounts receivable in accordance with the <ln numlevel="1" lineno="309" slineno="2-107"/>payment schedule established by the court under Section <xref depth="3" refnumber="77-32b-103">77-32b-103</xref>.</subsection><subsection ssid="19-null-53" dnum="b-o" numlevel="1" lineno="310" slineno="2-108" level="2"><display>(b)</display>A court may not require the defendant to make payments as described in Subsection <xref depth="4" refnumber="77-18-105(8)(a)"><ln numlevel="1" lineno="311" slineno="2-109"/>(8)(a)</xref> beyond the expiration of the defendant's sentence.</subsection><subsection ssid="19-null-54" dnum="c-o" numlevel="1" lineno="312" slineno="2-110" level="2"><display>(c)</display>If the court requires a defendant to continue to pay in accordance with the payment <ln numlevel="1" lineno="313" slineno="2-111"/>schedule for the criminal accounts receivable under this Subsection <xref depth="4" refnumber="77-18-105(8)">(8)</xref> and the <ln numlevel="1" lineno="314" slineno="2-112"/>defendant defaults on the criminal accounts receivable, the court shall proceed with <ln numlevel="1" lineno="315" slineno="2-113"/>an order for a civil judgment of restitution and a civil accounts receivable for the <ln numlevel="1" lineno="316" slineno="2-114"/>defendant as described in Section <xref depth="3" refnumber="77-18-114">77-18-114</xref>.</subsection><subsection ssid="19-null-55" dnum="d-o" numlevel="1" lineno="317" slineno="2-115" level="2" space="false"><display>(d)</display><subsection ssid="19-null-56" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Upon a motion from the prosecuting attorney, the victim, or upon the court's <ln numlevel="1" lineno="318" slineno="2-116"/>own motion, the court may require a defendant to show cause as to why the <ln numlevel="1" lineno="319" slineno="2-117"/>defendant's failure to pay in accordance with the payment schedule should not be <ln numlevel="1" lineno="320" slineno="2-118"/>treated as contempt of court.</subsection><subsection ssid="19-null-57" dnum="ii-o" numlevel="1" lineno="321" slineno="2-119" level="3"><display>(ii)</display>A court may hold a defendant in contempt for failure to make payments for a <ln numlevel="1" lineno="322" slineno="2-120"/>criminal accounts receivable in accordance with Title <xref depth="2" refnumber="78B-6-3">78B, Chapter 6, Part 3</xref>, <ln numlevel="1" lineno="323" slineno="2-121"/>Contempt.</subsection></subsection><subsection ssid="19-null-58" dnum="e-o" numlevel="1" lineno="324" slineno="2-122" level="2"><display>(e)</display>This Subsection <xref depth="4" refnumber="77-18-105(8)">(8)</xref> does not apply to the probation of an individual convicted of an <ln numlevel="1" lineno="325" slineno="2-123"/>offense for criminal nonsupport under Section <xref depth="3" refnumber="76-7-201">76-7-201</xref>.</subsection></subsection><subsection ssid="19-null-59" dnum="9-o" numlevel="1" lineno="326" slineno="2-124" level="1"><display>(9)</display>When making any decision regarding probation:<subsection ssid="19-null-60" dnum="a-o" numlevel="1" lineno="327" slineno="2-125" level="2"><display>(a)</display>the court shall consider information provided by the Department of Corrections <ln numlevel="1" lineno="328" slineno="2-126"/>regarding a defendant's individual case action plan, including any progress the <ln numlevel="1" lineno="329" slineno="2-127"/>defendant has made in satisfying the case action plan's completion requirements; and</subsection><subsection ssid="19-null-61" dnum="b-o" numlevel="1" lineno="330" slineno="2-128" level="2"><display>(b)</display>the court may not rely solely on an algorithm or a risk assessment tool score.</subsection></subsection></section></bsec><bsec buid="1" num="77-27-5" type="amend" src="code" uid="C77-27-S5_2026050620260506" sort="77 27 00050020260506" numlevel="1" lineno="331" slineno="3-1" sn="3"><section number="77-27-5" numlevel="1" lineno="332" slineno="3-2" type="amend"><secline lineno="331">Section 3. Section <bold>77-27-5</bold> is amended to read:</secline><catline lineno="332"><bold>77-27-5<parens/>. Board of Pardons and Parole authority.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="333" slineno="3-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="1-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Subject to this chapter and other laws of the state, and except for a conviction for <ln numlevel="1" lineno="334" slineno="3-4"/>treason or impeachment, the board shall determine by majority decision when and <ln numlevel="1" lineno="335" slineno="3-5"/>under what conditions an offender's conviction may be pardoned or commuted.</subsection><subsection ssid="1-null-3" dnum="b-o" numlevel="1" lineno="336" slineno="3-6" level="2"><display>(b)</display>The board shall determine by majority decision when and under what conditions an <ln numlevel="1" lineno="337" slineno="3-7"/>offender committed to serve a sentence at a penal or correctional facility, which is <ln numlevel="1" lineno="338" slineno="3-8"/>under the jurisdiction of the department, may:<subsection ssid="1-null-4" dnum="i-o" numlevel="1" lineno="339" slineno="3-9" level="3"><display>(i)</display>be released upon parole;</subsection><subsection ssid="1-null-5" dnum="ii-o" numlevel="1" lineno="340" slineno="3-10" level="3"><display>(ii)</display>have a fine or forfeiture remitted;</subsection><subsection ssid="1-null-6" dnum="iii-o" numlevel="1" lineno="341" slineno="3-11" level="3"><display>(iii)</display>have the offender's criminal accounts receivable remitted in accordance with <ln numlevel="1" lineno="342" slineno="3-12"/>Section <xref depth="3" refnumber="77-32b-105">77-32b-105</xref> or <xref depth="3" refnumber="77-32b-106">77-32b-106</xref>;</subsection><subsection ssid="1-null-7" dnum="iv-o" numlevel="1" lineno="343" slineno="3-13" level="3"><display>(iv)</display>have the offender's payment schedule modified in accordance with Section <xref depth="3" refnumber="77-32b-103"><ln numlevel="1" lineno="344" slineno="3-14"/>77-32b-103</xref>; or</subsection><subsection ssid="1-null-8" dnum="v-o" numlevel="1" lineno="345" slineno="3-15" level="3"><display>(v)</display>have the offender's sentence terminated.</subsection></subsection><subsection ssid="1-null-9" dnum="c-o" numlevel="1" lineno="346" slineno="3-16" level="2"><display>(c)</display>The board shall prioritize public safety when making a determination under <ln numlevel="1" lineno="347" slineno="3-17"/>Subsection <xref depth="4" refnumber="77-27-5(1)(a)">(1)(a)</xref> or <xref depth="4" refnumber="77-27-5(1)(b)">(1)(b)</xref>.</subsection><subsection ssid="1-null-10" dnum="d-o" numlevel="1" lineno="348" slineno="3-18" level="2" space="false"><display>(d)</display><subsection ssid="1-null-11" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The board may sit together or in panels to conduct hearings.</subsection><subsection ssid="1-null-12" dnum="ii-o" numlevel="1" lineno="349" slineno="3-19" level="3"><display>(ii)</display>The chair shall appoint members to the panels in any combination and in <ln numlevel="1" lineno="350" slineno="3-20"/>accordance with rules made by the board in accordance with Title 63G, Chapter 3, <ln numlevel="1" lineno="351" slineno="3-21"/>Utah Administrative Rulemaking Act.</subsection><subsection ssid="1-null-13" dnum="iii-o" numlevel="1" lineno="352" slineno="3-22" level="3"><display>(iii)</display>The chair may participate on any panel and when doing so is chair of the panel.</subsection><subsection ssid="1-null-14" dnum="iv-o" numlevel="1" lineno="353" slineno="3-23" level="3"><display>(iv)</display>The chair of the board may designate the chair for any other panel.</subsection></subsection><subsection ssid="1-null-15" dnum="e-o" numlevel="1" lineno="354" slineno="3-24" level="2" space="false"><display>(e)</display><subsection ssid="1-null-16" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Except after a hearing before the board, or the board's appointed examiner, in <ln numlevel="1" lineno="355" slineno="3-25"/>an open session, the board may not:<subsection ssid="1-null-17" dnum="A-o" numlevel="1" lineno="356" slineno="3-26" level="4" tab="1"><display>(A)</display>remit a fine or forfeiture for an offender or the offender's criminal accounts <ln numlevel="1" lineno="357" slineno="3-27"/>receivable;</subsection><subsection ssid="1-null-18" dnum="B-o" numlevel="1" lineno="358" slineno="3-28" level="4" tab="1"><display>(B)</display>release the offender on parole; or</subsection><subsection ssid="1-null-19" dnum="C-o" numlevel="1" lineno="359" slineno="3-29" level="4" tab="1"><display>(C)</display>commute, pardon, or terminate an offender's sentence.</subsection></subsection><subsection ssid="1-null-20" dnum="ii-o" numlevel="1" lineno="360" slineno="3-30" level="3"><display>(ii)</display>An action taken under this Subsection <xref depth="4" refnumber="77-27-5(1)">(1)</xref> other than by a majority of the board <ln numlevel="1" lineno="361" slineno="3-31"/>shall be affirmed by a majority of the board.</subsection></subsection><subsection ssid="1-null-21" dnum="f-o" numlevel="1" lineno="362" slineno="3-32" level="2"><display>(f)</display>A commutation or pardon may be granted only after a full hearing before the board.</subsection></subsection><subsection ssid="1-null-22" dnum="2-o" numlevel="1" lineno="363" slineno="3-33" level="1" space="false"><display>(2)</display><subsection ssid="1-null-23" dnum="a-o" level="2" placement="sameline"><display>(a)</display>In the case of a hearing, timely prior notice of the time and location of the hearing <ln numlevel="1" lineno="364" slineno="3-34"/>shall be given to the offender.</subsection><subsection ssid="1-null-24" dnum="b-o" numlevel="1" lineno="365" slineno="3-35" level="2"><display>(b)</display>The county or district attorney's office responsible for prosecution of the case, the <ln numlevel="1" lineno="366" slineno="3-36"/>sentencing court, and law enforcement officials responsible for the defendant's arrest <ln numlevel="1" lineno="367" slineno="3-37"/>and conviction shall be notified of any board hearings through the board's website.</subsection><subsection ssid="1-null-25" dnum="c-o" numlevel="1" lineno="368" slineno="3-38" level="2"><display>(c)</display>Whenever possible, the victim or the victim's representative, if designated, shall be <ln numlevel="1" lineno="369" slineno="3-39"/>notified of original hearings and any hearing after that if notification is requested and <ln numlevel="1" lineno="370" slineno="3-40"/>current contact information has been provided to the board.</subsection><subsection ssid="1-null-26" dnum="d-o" numlevel="1" lineno="371" slineno="3-41" level="2" space="false"><display>(d)</display><subsection ssid="1-null-27" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Notice to the victim or the victim's representative shall include information <ln numlevel="1" lineno="372" slineno="3-42"/>provided in Section <xref depth="3" refnumber="77-27-9.5">77-27-9.5</xref>, and any related rules made by the board under that <ln numlevel="1" lineno="373" slineno="3-43"/>section.</subsection><subsection ssid="1-null-28" dnum="ii-o" numlevel="1" lineno="374" slineno="3-44" level="3"><display>(ii)</display>The information under Subsection <xref depth="4" refnumber="77-27-5(2)(d)(i)">(2)(d)(i)</xref> shall be provided in terms that are <ln numlevel="1" lineno="375" slineno="3-45"/>reasonable for the lay person to understand.</subsection></subsection></subsection><subsection ssid="1-null-29" dnum="3-o" numlevel="1" lineno="376" slineno="3-46" level="1" space="false"><display>(3)</display><subsection ssid="1-null-30" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A decision by the board is final and not subject for judicial review if the decision <ln numlevel="1" lineno="377" slineno="3-47"/>is regarding:<subsection ssid="1-null-31" dnum="i-o" numlevel="1" lineno="378" slineno="3-48" level="3" tab="1"><display>(i)</display>a pardon, parole, commutation, or termination of an offender's sentence;</subsection><subsection ssid="1-null-32" dnum="ii-o" numlevel="1" lineno="379" slineno="3-49" level="3" tab="1"><display>(ii)</display>restitution, the modification of an offender's payment schedule for restitution, or <ln numlevel="1" lineno="380" slineno="3-50"/>an order for costs; or</subsection><subsection ssid="1-null-33" dnum="iii-o" numlevel="1" lineno="381" slineno="3-51" level="3" tab="1"><display>(iii)</display>the remission of an offender's criminal accounts receivable or a fine or forfeiture.</subsection></subsection><subsection ssid="1-null-34" dnum="b-o" numlevel="1" lineno="382" slineno="3-52" level="2"><display>(b)</display>Deliberative processes are not public and the board is exempt from Title 52, Chapter <ln numlevel="1" lineno="383" slineno="3-53"/>4, Open and Public Meetings Act, when the board is engaged in the board's <ln numlevel="1" lineno="384" slineno="3-54"/>deliberative process.</subsection><subsection ssid="1-null-35" dnum="c-o" numlevel="1" lineno="385" slineno="3-55" level="2"><display>(c)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="229" groupid="166" style="2" owner="ahaskell" level="1" deltag="both">Pursuant to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="228" groupid="165" style="1" owner="ahaskell" level="1" amendtag="both" space="true">In accordance with</amend> Subsection <xref tempid="729">63G-2-103(25)(b)(xii)</xref>, records of the <ln numlevel="1" lineno="386" slineno="3-56"/>deliberative process are exempt from Title 63G, Chapter 2, Government Records <ln numlevel="1" lineno="387" slineno="3-57"/>Access and Management Act.</subsection><subsection ssid="1-null-36" dnum="d-o" numlevel="1" lineno="388" slineno="3-58" level="2"><display>(d)</display>Unless it will interfere with a constitutional right, deliberative processes are not <ln numlevel="1" lineno="389" slineno="3-59"/>subject to disclosure, including discovery.</subsection><subsection ssid="1-null-37" dnum="e-o" numlevel="1" lineno="390" slineno="3-60" level="2"><display>(e)</display>Nothing in this section prevents the obtaining or enforcement of a civil judgment.</subsection></subsection><subsection ssid="1-null-38" dnum="4-o" numlevel="1" lineno="391" slineno="3-61" level="1" space="false"><display>(4)</display><subsection ssid="1-null-39" dnum="a-o" level="2" placement="sameline"><display>(a)</display>This chapter <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="7" groupid="6" style="2" owner="ahaskell" level="1" deltag="both">may not be construed as a denial of or limitation of</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="ahaskell" level="1" amendtag="both" space="true">does not deny or <ln numlevel="1" lineno="392" slineno="3-62"/>limit</amend> the governor's power to grant respite or reprieves in all cases of convictions for <ln numlevel="1" lineno="393" slineno="3-63"/>offenses against the state, except treason or conviction on impeachment.</subsection><subsection ssid="1-null-40" dnum="b-o" numlevel="1" lineno="394" slineno="3-64" level="2"><display>(b)</display>Notwithstanding Subsection <xref depth="4" refnumber="77-27-5(4)(a)">(4)(a)</xref>, respites or reprieves may not extend beyond the <ln numlevel="1" lineno="395" slineno="3-65"/>next session of the board.</subsection><subsection ssid="1-null-41" dnum="c-o" numlevel="1" lineno="396" slineno="3-66" level="2"><display>(c)</display>At the next session of the board, the board:<subsection ssid="1-null-42" dnum="i-o" numlevel="1" lineno="397" slineno="3-67" level="3"><display>(i)</display>shall continue or terminate the respite or reprieve; or</subsection><subsection ssid="1-null-43" dnum="ii-o" numlevel="1" lineno="398" slineno="3-68" level="3"><display>(ii)</display>may commute the punishment or pardon the offense as provided.</subsection></subsection><subsection ssid="1-null-44" dnum="d-o" numlevel="1" lineno="399" slineno="3-69" level="2"><display>(d)</display>In the case of conviction for treason, the governor may suspend execution of the <ln numlevel="1" lineno="400" slineno="3-70"/>sentence until the case is reported to the Legislature at the Legislature's next session.</subsection><subsection ssid="1-null-45" dnum="e-o" numlevel="1" lineno="401" slineno="3-71" level="2"><display>(e)</display>The Legislature shall pardon or commute the sentence or direct the sentence's <ln numlevel="1" lineno="402" slineno="3-72"/>execution.</subsection></subsection><subsection ssid="1-null-46" dnum="5-o" numlevel="1" lineno="403" slineno="3-73" level="1" space="false"><display>(5)</display><subsection ssid="1-null-47" dnum="a-o" level="2" placement="sameline"><display>(a)</display>In determining when, where, and under what conditions an offender serving a <ln numlevel="1" lineno="404" slineno="3-74"/>sentence may be paroled or pardoned, have a fine or forfeiture remitted, have the <ln numlevel="1" lineno="405" slineno="3-75"/>offender's criminal accounts receivable remitted, or have the offender's sentence <ln numlevel="1" lineno="406" slineno="3-76"/>commuted or terminated, the board shall:<subsection ssid="1-null-48" dnum="i-o" numlevel="1" lineno="407" slineno="3-77" level="3" tab="1"><display>(i)</display>consider whether the offender has made restitution ordered by the court under <ln numlevel="1" lineno="408" slineno="3-78"/>Section <xref depth="3" refnumber="77-38b-205">77-38b-205</xref>, or is prepared to pay restitution as a condition of any parole, <ln numlevel="1" lineno="409" slineno="3-79"/>pardon, remission of a criminal accounts receivable or a fine or forfeiture, or a <ln numlevel="1" lineno="410" slineno="3-80"/>commutation or termination of the offender's sentence;</subsection><subsection ssid="1-null-49" dnum="ii-o" numlevel="1" lineno="411" slineno="3-81" level="3" tab="1"><display>(ii)</display>except as provided in Subsection <xref depth="4" refnumber="77-27-5(5)(b)">(5)(b)</xref>, develop and use a list of criteria for <ln numlevel="1" lineno="412" slineno="3-82"/>making determinations under this Subsection <xref depth="4" refnumber="77-27-5(5)">(5)</xref>;</subsection><subsection ssid="1-null-50" dnum="iii-o" numlevel="1" lineno="413" slineno="3-83" level="3" tab="1"><display>(iii)</display>consider information provided by the department regarding an offender's <ln numlevel="1" lineno="414" slineno="3-84"/>individual case action plan;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="200" groupid="143" style="2" owner="ahaskell" level="1" deltag="both"> and</amend><amendoutend style="2"/></subsection><subsection ssid="1-null-51" dnum="iv-o" numlevel="1" lineno="415" slineno="3-85" level="3" tab="1"><display>(iv)</display>review an offender's status within 60 days after the day on which the board <ln numlevel="1" lineno="416" slineno="3-86"/>receives notice from the department that the offender has completed all of the <ln numlevel="1" lineno="417" slineno="3-87"/>offender's case action plan components that relate to activities that can be <ln numlevel="1" lineno="418" slineno="3-88"/>accomplished while the offender is imprisoned<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="203" groupid="146" style="2" owner="ahaskell" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="198" groupid="141" style="1" owner="ahaskell" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="1-107" dnum="_-o:v-i" numlevel="1" lineno="419" slineno="3-89" ea="amend" anum="0" owner="ahaskell" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1188" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="197" groupid="140" style="1" owner="ahaskell" level="1" amendtag="end">if considering whether to parole an offender who has previously been paroled and <ln numlevel="1" lineno="420" slineno="3-90"/>had the parole revoked due to the commission of a new criminal offense by the <ln numlevel="1" lineno="421" slineno="3-91"/>offender, consider the facts and circumstances of the new criminal offense when <ln numlevel="1" lineno="422" slineno="3-92"/>determining whether the offender should be paroled again.</amend></subsection></subsection><subsection ssid="1-null-52" dnum="b-o" numlevel="1" lineno="423" slineno="3-93" level="2"><display>(b)</display>The board shall determine whether to remit an offender's criminal accounts <ln numlevel="1" lineno="424" slineno="3-94"/>receivable under this Subsection <xref depth="4" refnumber="77-27-5(5)">(5)</xref> in accordance with Section <xref depth="3" refnumber="77-32b-105">77-32b-105</xref> or <xref depth="3" refnumber="77-32b-106"><ln numlevel="1" lineno="425" slineno="3-95"/>77-32b-106</xref>.</subsection></subsection><subsection ssid="1-null-53" dnum="6-o" numlevel="1" lineno="426" slineno="3-96" level="1"><display>(6)</display>In determining whether parole may be terminated, the board shall consider:<subsection ssid="1-null-54" dnum="a-o" numlevel="1" lineno="427" slineno="3-97" level="2"><display>(a)</display>the offense committed by the parolee; and</subsection><subsection ssid="1-null-55" dnum="b-o" numlevel="1" lineno="428" slineno="3-98" level="2"><display>(b)</display>the parole period under Section <xref depth="3" refnumber="76-3-202">76-3-202</xref>, and in accordance with Section <xref depth="3" refnumber="77-27-13">77-27-13</xref>.</subsection></subsection><subsection ssid="1-null-56" dnum="7-o" numlevel="1" lineno="429" slineno="3-99" level="1"><display>(7)</display>For an offender placed on parole after December 31, 2018, the board shall terminate <ln numlevel="1" lineno="430" slineno="3-100"/>parole in accordance with the adult sentencing and supervision length guidelines, as <ln numlevel="1" lineno="431" slineno="3-101"/>defined in Section <xref depth="3" refnumber="63M-7-401.1">63M-7-401.1</xref>, to the extent the guidelines are consistent with the <ln numlevel="1" lineno="432" slineno="3-102"/>requirements of the law.</subsection><subsection ssid="1-null-57" dnum="8-o" numlevel="1" lineno="433" slineno="3-103" level="1"><display>(8)</display>The board may not rely solely on an algorithm or a risk assessment tool score in <ln numlevel="1" lineno="434" slineno="3-104"/>determining whether parole should be granted or terminated for an offender.</subsection><subsection ssid="1-null-58" dnum="9-o" numlevel="1" lineno="435" slineno="3-105" level="1"><display>(9)</display>The board may intervene as a limited-purpose party in a judicial or administrative <ln numlevel="1" lineno="436" slineno="3-106"/>proceeding, including a criminal action, to seek:<subsection ssid="1-null-59" dnum="a-o" numlevel="1" lineno="437" slineno="3-107" level="2"><display>(a)</display>correction of an order that has or will impact the board's jurisdiction; or</subsection><subsection ssid="1-null-60" dnum="b-o" numlevel="1" lineno="438" slineno="3-108" level="2"><display>(b)</display>clarification regarding an order that may impact the board's jurisdiction.</subsection></subsection><subsection ssid="1-null-61" dnum="10-o" numlevel="1" lineno="439" slineno="3-109" level="1"><display>(10)</display>A motion to intervene brought under Subsection <xref depth="4" refnumber="77-27-5(9)(a)">(9)(a)</xref> shall be raised within 60 days <ln numlevel="1" lineno="440" slineno="3-110"/>after the day on which a court enters the order that impacts the board's jurisdiction.</subsection></section></bsec><bsec buid="7" num="77-27-5.6" type="enact" src="code" uid="C77-27-S5.6_2026050620260506" sort="77 27 00050620260506" numlevel="1" lineno="441" slineno="4-1" sn="4"><section numlevel="1" lineno="442" slineno="4-2" number="77-27-5.6" type="enact"><secline lineno="441">Section 4. Section <bold>77-27-5.6</bold> is enacted to read:</secline><catline lineno="442"><bold>77-27-5.6<parens/>. Pardon timelines for an offender on the Sex, Kidnap, and Child <ln numlevel="1" lineno="443" slineno="4-3"/>Abuse Offender Registry.</bold></catline><subsection ssid="7-1" dnum="_-o:1-i" numlevel="1" lineno="444" slineno="4-4" ea="amend" anum="0" owner="ahaskell" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1199" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="13" groupid="10" style="1" owner="ahaskell" level="1" amendtag="end">As used in this section:</amend><subsection ssid="7-16" dnum="_-o:a-i" numlevel="1" lineno="445" slineno="4-5" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1200" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="37" groupid="28" style="1" owner="ahaskell" level="1" amendtag="end">"Registry" means the Sex, Kidnap, and Child Abuse Offender Registry created in <ln numlevel="1" lineno="448" slineno="4-8"/>Section <xref depth="3" refnumber="53-29-102">53-29-102</xref>.</amend></subsection><subsection ssid="7-8" dnum="_-o:d-i" numlevel="1" lineno="449" slineno="4-9" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1203" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="42" groupid="32" style="1" owner="ahaskell" level="1" amendtag="end">"Sex offender" means the same as that term is defined in Section <xref depth="3" refnumber="53-29-101">53-29-101</xref>.</amend></subsection></subsection><subsection ssid="7-3" dnum="_-o:2-i" numlevel="1" lineno="450" slineno="4-10" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1204" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="14" groupid="11" style="1" owner="ahaskell" level="1" amendtag="end">The board may only consider issuing a pardon to an offender for an offense that requires <ln numlevel="1" lineno="451" slineno="4-11"/>the offender to register as a sex offender on the registry if:</amend><subsection ssid="7-25" dnum="_-o:a-i" numlevel="1" lineno="452" slineno="4-12" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1205" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="120" groupid="90" style="1" owner="ahaskell" level="1" amendtag="end">for an offender who is required to register for 10 years under Subsection <xref tempid="1010"><ln numlevel="1" lineno="453" slineno="4-13"/>53-29-203(1)(a)</xref>, 10 years have passed after the later of:</amend><subsection ssid="7-10" dnum="_-o:i-i" numlevel="1" lineno="454" slineno="4-14" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1206" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="53" groupid="40" style="1" owner="ahaskell" level="1" amendtag="end">the day on which the offender was placed on probation;</amend></subsection><subsection ssid="7-11" dnum="_-o:ii-i" numlevel="1" lineno="455" slineno="4-15" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1207" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="58" groupid="44" style="1" owner="ahaskell" level="1" amendtag="end">the day on which the offender was released from incarceration to parole;</amend></subsection><subsection ssid="7-12" dnum="_-o:iii-i" numlevel="1" lineno="456" slineno="4-16" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1208" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="63" groupid="48" style="1" owner="ahaskell" level="1" amendtag="end">the day on which the offender's sentence was terminated without parole;</amend></subsection><subsection ssid="7-13" dnum="_-o:iv-i" numlevel="1" lineno="457" slineno="4-17" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1209" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="68" groupid="52" style="1" owner="ahaskell" level="1" amendtag="end">the day on which the offender entered a community-based residential program; or</amend></subsection><subsection ssid="7-14" dnum="_-o:v-i" numlevel="1" lineno="458" slineno="4-18" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1210" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="73" groupid="56" style="1" owner="ahaskell" level="1" amendtag="end">for a minor, the day on which the division's custody of the offender was <ln numlevel="1" lineno="459" slineno="4-19"/>terminated; or</amend></subsection></subsection><subsection ssid="7-26" dnum="_-o:b-i" numlevel="1" lineno="460" slineno="4-20" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1211" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="80" groupid="61" style="1" owner="ahaskell" level="1" amendtag="end">for an offender who is required to register for the offender's lifetime under <ln numlevel="1" lineno="461" slineno="4-21"/>Subsection <xref depth="4" refnumber="53-29-203(1)(b)">53-29-203(1)(b)</xref>, 20 years have passed after the later of:</amend><subsection ssid="7-18" dnum="_-o:i-i" numlevel="1" lineno="462" slineno="4-22" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1212" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="86" groupid="65" style="1" owner="ahaskell" level="1" amendtag="end">the day on which the offender was placed on probation;</amend></subsection><subsection ssid="7-19" dnum="_-o:ii-i" numlevel="1" lineno="463" slineno="4-23" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1213" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="92" groupid="70" style="1" owner="ahaskell" level="1" amendtag="end">the day on which the offender was released from incarceration to parole;</amend></subsection><subsection ssid="7-20" dnum="_-o:iii-i" numlevel="1" lineno="464" slineno="4-24" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1214" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="98" groupid="74" style="1" owner="ahaskell" level="1" amendtag="end">the day on which the offender's sentence was terminated without parole;</amend></subsection><subsection ssid="7-21" dnum="_-o:iv-i" numlevel="1" lineno="465" slineno="4-25" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1215" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="103" groupid="78" style="1" owner="ahaskell" level="1" amendtag="end">the day on which the offender entered a community-based residential program; or</amend></subsection><subsection ssid="7-22" dnum="_-o:v-i" numlevel="1" lineno="466" slineno="4-26" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1216" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="108" groupid="82" style="1" owner="ahaskell" level="1" amendtag="end">for a minor, the day on which the division's custody of the offender was <ln numlevel="1" lineno="467" slineno="4-27"/>terminated.</amend></subsection></subsection></subsection><subsection ssid="7-28" dnum="_-o:3-i" numlevel="1" lineno="468" slineno="4-28" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1217" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="127" groupid="95" style="1" owner="ahaskell" level="1" amendtag="end">The timelines described in Subsection <xref depth="4" refnumber="77-27-5.6(2)">(2)</xref> do not apply to:</amend><subsection ssid="7-29" dnum="_-o:a-i" numlevel="1" lineno="469" slineno="4-29" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1218" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="132" groupid="99" style="1" owner="ahaskell" level="1" amendtag="end">an individual whose conviction was vacated, reversed, or amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="142" groupid="107" style="1" owner="ahaskell" level="1" amendtag="end">postconviction relief under Title 78B, Chapter 9, Postconviction Remedies Act; or</amend></subsection><subsection ssid="7-32" dnum="_-o:ii-i" numlevel="1" lineno="473" slineno="4-33" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1221" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="147" groupid="111" style="1" owner="ahaskell" level="1" amendtag="end">a writ of habeas corpus under 28 U.S.C. Section <bold>77-27-9</bold> is amended to read:</secline><catline lineno="475"><bold>77-27-9<parens/>. Parole proceedings.</bold></catline><subsection ssid="11-null-1" dnum="1-o" numlevel="1" lineno="476" slineno="5-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="11-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The Board of Pardons and Parole may parole any offender or terminate the <ln numlevel="1" lineno="477" slineno="5-4"/>sentence of any offender committed to a penal or correctional facility under the <ln numlevel="1" lineno="478" slineno="5-5"/>jurisdiction of the Department of Corrections except as provided in Subsection <xref depth="4" refnumber="77-27-9(2)" start="0">(2)</xref>.</subsection><subsection ssid="11-null-3" dnum="b-o" numlevel="1" lineno="479" slineno="5-6" level="2"><display>(b)</display>The board may not release any offender before the minimum term has been served <ln numlevel="1" lineno="480" slineno="5-7"/>unless the board<amend anum="0" ea="amend" pairid="39" groupid="32" style="1" owner="ahaskell" level="1" amendtag="both">:</amend><subsection ssid="11-41" dnum="_-o:i-i" numlevel="1" lineno="481" slineno="5-8" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1225" style="1" owner="i" level="1" amendtag="both">(i)</amend></display> finds mitigating circumstances which justify the release<amend anum="0" ea="amend" pairid="57" groupid="48" style="1" owner="ahaskell" level="1" amendtag="both">;</amend></subsection><subsection ssid="11-43" dnum="_-o:ii-i" numlevel="1" lineno="482" slineno="5-9" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1226" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="56" groupid="47" style="1" owner="ahaskell" level="1" m-anum="0" m-ea="amend" m-pairid="41" m-groupid="34" m-style="1" m-owner="ahaskell" m-level="1" amendtag="end">finds by clear and convincing evidence that the offender is no longer a threat to <ln numlevel="1" lineno="483" slineno="5-10"/>public safety;</amend> and</subsection><subsection ssid="11-42" dnum="_-o:iii-i" numlevel="1" lineno="484" slineno="5-11" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1227" style="1" owner="i" level="1" amendtag="both">(iii)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="51" groupid="43" style="2" owner="ahaskell" level="1" deltag="both"> unless the board has granted</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="50" groupid="42" style="1" owner="ahaskell" level="1" amendtag="both" space="true">holds</amend> a full hearing, in open session, after <ln numlevel="1" lineno="485" slineno="5-12"/>previous notice of the time and location of the hearing, and recorded the <ln numlevel="1" lineno="486" slineno="5-13"/>proceedings and decisions of the board.</subsection></subsection><subsection ssid="11-null-4" dnum="c-o" numlevel="1" lineno="487" slineno="5-14" level="2"><display>(c)</display>The board may not parole any offender or terminate the sentence of any offender <ln numlevel="1" lineno="488" slineno="5-15"/>unless the board has granted a full hearing, in open session, after previous notice of <ln numlevel="1" lineno="489" slineno="5-16"/>the time and location of the hearing, and recorded the proceedings and decisions of <ln numlevel="1" lineno="490" slineno="5-17"/>the board.</subsection><subsection ssid="11-null-5" dnum="d-o" numlevel="1" lineno="491" slineno="5-18" level="2"><display>(d)</display>The release of an offender shall be at the initiative of the board, which shall consider <ln numlevel="1" lineno="492" slineno="5-19"/>each case as the offender becomes eligible.  However, a prisoner may submit the <ln numlevel="1" lineno="493" slineno="5-20"/>prisoner's own application, subject to the rules of the board promulgated in <ln numlevel="1" lineno="494" slineno="5-21"/>accordance with <xref depth="1" refnumber="63G-3" start="0">Title 63G, Chapter 3, Utah Administrative Rulemaking Act</xref>.</subsection></subsection><subsection ssid="11-null-6" dnum="2-o" numlevel="1" lineno="495" slineno="5-22" level="1" space="false"><display>(2)</display><subsection ssid="11-null-7" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An individual sentenced to prison <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="68" groupid="59" style="2" owner="ahaskell" level="1" deltag="both">prior to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="64" groupid="55" style="1" owner="ahaskell" level="1" amendtag="both" space="true">before</amend> April 29, 1996, for a first <ln numlevel="1" lineno="496" slineno="5-23"/>degree felony involving child kidnapping, a violation of Section <xref depth="3" refnumber="76-5-301.1" start="0">76-5-301.1</xref>; <ln numlevel="1" lineno="497" slineno="5-24"/>aggravated kidnapping, a violation of Section <xref depth="3" refnumber="76-5-302" start="0">76-5-302</xref>; rape of a child, a violation of <ln numlevel="1" lineno="498" slineno="5-25"/>Section <xref depth="3" refnumber="76-5-402.1" start="0">76-5-402.1</xref>; object rape of a child, a violation of Section <xref depth="3" refnumber="76-5-402.3" start="0">76-5-402.3</xref>; sodomy <ln numlevel="1" lineno="499" slineno="5-26"/>upon a child, a violation of Section <xref depth="3" refnumber="76-5-403.1" start="0">76-5-403.1</xref>; aggravated sexual abuse of a child, a <ln numlevel="1" lineno="500" slineno="5-27"/>violation of Section <xref depth="3" refnumber="76-5-404.3" start="0">76-5-404.3</xref>; aggravated sexual assault, a violation of Section <xref depth="3" refnumber="76-5-405" start="0"><ln numlevel="1" lineno="501" slineno="5-28"/>76-5-405</xref>; or a prior offense as described in Section <xref depth="3" refnumber="76-3-407" start="0">76-3-407</xref>, may not be eligible for <ln numlevel="1" lineno="502" slineno="5-29"/>release on parole by the Board of Pardons and Parole until the offender has fully <ln numlevel="1" lineno="503" slineno="5-30"/>completed serving the minimum mandatory sentence imposed by the court. <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="72" groupid="63" style="2" owner="ahaskell" level="1" deltag="both"> </amend><amendoutend style="2"/>This <ln numlevel="1" lineno="504" slineno="5-31"/>Subsection <xref depth="4" refnumber="77-27-9(2)(a)" start="0">(2)(a)</xref> supersedes any other provision of law.</subsection><subsection ssid="11-null-8" dnum="b-o" numlevel="1" lineno="505" slineno="5-32" level="2"><display>(b)</display>The board may not parole any offender or commute or terminate the sentence of any <ln numlevel="1" lineno="506" slineno="5-33"/>offender before the offender has served the minimum term for the offense, if the <ln numlevel="1" lineno="507" slineno="5-34"/>offender was sentenced <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="69" groupid="60" style="2" owner="ahaskell" level="1" deltag="both">prior to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="65" groupid="56" style="1" owner="ahaskell" level="1" amendtag="both" space="true">before</amend> April 29, 1996, and if:<subsection ssid="11-null-9" dnum="i-o" numlevel="1" lineno="508" slineno="5-35" level="3"><display>(i)</display>the offender was convicted of forcible sexual abuse, forcible sodomy, rape, <ln numlevel="1" lineno="509" slineno="5-36"/>aggravated assault, kidnapping, aggravated kidnapping, or aggravated sexual <ln numlevel="1" lineno="510" slineno="5-37"/>assault as defined in <xref depth="1" refnumber="76-5" start="0">Title 76, Chapter 5, Offenses Against the Individual</xref>; and</subsection><subsection ssid="11-null-10" dnum="ii-o" numlevel="1" lineno="511" slineno="5-38" level="3"><display>(ii)</display>the victim of the offense was under 18 years old at the time the offense was <ln numlevel="1" lineno="512" slineno="5-39"/>committed.</subsection></subsection><subsection ssid="11-null-11" dnum="c-o" numlevel="1" lineno="513" slineno="5-40" level="2"><display>(c)</display>For a crime committed on or after April 29, 1996, but before January 1, 2019, the <ln numlevel="1" lineno="514" slineno="5-41"/>board may parole any offender under Subsections <xref depth="4" refnumber="77-27-9(2)(b)(i)" start="0">(2)(b)(i)</xref> and <xref depth="4" refnumber="77-27-9(2)(b)(ii)" start="0">(ii)</xref> for lifetime parole <ln numlevel="1" lineno="515" slineno="5-42"/>as provided in this section.</subsection><subsection ssid="11-null-12" dnum="d-o" numlevel="1" lineno="516" slineno="5-43" level="2"><display>(d)</display>The board may not pardon or parole any offender or commute or terminate the <ln numlevel="1" lineno="517" slineno="5-44"/>sentence of any offender who is sentenced to life in prison without parole except as <ln numlevel="1" lineno="518" slineno="5-45"/>provided in Subsection <xref depth="4" refnumber="77-27-9(7)" start="0">(7)</xref>.</subsection><subsection ssid="11-null-13" dnum="e-o" numlevel="1" lineno="519" slineno="5-46" level="2"><display>(e)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="30" groupid="24" style="2" owner="ahaskell" level="1" deltag="both">On or after April 27, 1992, the</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="32" groupid="26" style="1" owner="ahaskell" level="1" amendtag="both" space="true">The</amend> board may commute a sentence of death only to <ln numlevel="1" lineno="520" slineno="5-47"/>a sentence of life in prison without parole.</subsection><subsection ssid="11-null-14" dnum="f-o" numlevel="1" lineno="521" slineno="5-48" level="2"><display>(f)</display>The restrictions imposed in Subsections <xref depth="4" refnumber="77-27-9(2)(d)" start="0">(2)(d)</xref> and <xref depth="4" refnumber="77-27-9(2)(e)" start="0">(e)</xref> apply to all cases that come <ln numlevel="1" lineno="522" slineno="5-49"/>before the Board of Pardons and Parole on or after April 27, 1992.</subsection><subsection ssid="11-null-15" dnum="g-o" numlevel="1" lineno="523" slineno="5-50" level="2"><display>(g)</display>The board may not parole any offender convicted of a homicide unless:<subsection ssid="11-null-16" dnum="i-o" numlevel="1" lineno="524" slineno="5-51" level="3"><display>(i)</display>the remains of the victim have been recovered; or</subsection><subsection ssid="11-null-17" dnum="ii-o" numlevel="1" lineno="525" slineno="5-52" level="3"><display>(ii)</display>the offender can demonstrate by a preponderance of the evidence that the <ln numlevel="1" lineno="526" slineno="5-53"/>offender has cooperated in good faith in efforts to locate the remains.</subsection></subsection><subsection ssid="11-null-18" dnum="h-o" numlevel="1" lineno="527" slineno="5-54" level="2"><display>(h)</display>Subsection <xref depth="4" refnumber="77-27-9(2)(g)" start="0">(2)(g)</xref> applies to any offender convicted of a homicide after February 25, <ln numlevel="1" lineno="528" slineno="5-55"/>2021, or any offender who was incarcerated in a correctional facility on or after <ln numlevel="1" lineno="529" slineno="5-56"/>February 25, 2021, for a homicide offense.</subsection></subsection><subsection ssid="11-null-19" dnum="3-o" numlevel="1" lineno="530" slineno="5-57" level="1"><display>(3)</display>The board may rescind:<subsection ssid="11-null-20" dnum="a-o" numlevel="1" lineno="531" slineno="5-58" level="2"><display>(a)</display>an inmate's prison release date <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="70" groupid="61" style="2" owner="ahaskell" level="1" deltag="both">prior to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="66" groupid="57" style="1" owner="ahaskell" level="1" amendtag="both" space="true">before</amend> the inmate being released from <ln numlevel="1" lineno="532" slineno="5-59"/>custody; or</subsection><subsection ssid="11-null-21" dnum="b-o" numlevel="1" lineno="533" slineno="5-60" level="2"><display>(b)</display>an offender's termination date from parole <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="71" groupid="62" style="2" owner="ahaskell" level="1" deltag="both">prior to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="67" groupid="58" style="1" owner="ahaskell" level="1" amendtag="both" space="true">before</amend> the offender being <ln numlevel="1" lineno="534" slineno="5-61"/>terminated from parole.</subsection></subsection><subsection ssid="11-null-22" dnum="4-o" numlevel="1" lineno="535" slineno="5-62" level="1" space="false"><display>(4)</display><subsection ssid="11-null-23" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The board may issue subpoenas to compel the attendance of witnesses and the <ln numlevel="1" lineno="536" slineno="5-63"/>production of evidence, to administer oaths, and to take testimony for the purpose of <ln numlevel="1" lineno="537" slineno="5-64"/>any investigation by the board or any of the board's members or by a designated <ln numlevel="1" lineno="538" slineno="5-65"/>hearing examiner in the performance of the board's duties.</subsection><subsection ssid="11-null-24" dnum="b-o" numlevel="1" lineno="539" slineno="5-66" level="2"><display>(b)</display>A person who willfully disobeys a properly served subpoena issued by the board is <ln numlevel="1" lineno="540" slineno="5-67"/>guilty of a class B misdemeanor.</subsection></subsection><subsection ssid="11-null-25" dnum="5-o" numlevel="1" lineno="541" slineno="5-68" level="1" space="false"><display>(5)</display><subsection ssid="11-null-26" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The board may adopt rules consistent with law for the board's government, <ln numlevel="1" lineno="542" slineno="5-69"/>meetings and hearings, the conduct of proceedings before the board, the parole and <ln numlevel="1" lineno="543" slineno="5-70"/>pardon of offenders, the commutation and termination of sentences, and the general <ln numlevel="1" lineno="544" slineno="5-71"/>conditions under which parole may be granted and revoked.</subsection><subsection ssid="11-null-27" dnum="b-o" numlevel="1" lineno="545" slineno="5-72" level="2"><display>(b)</display>The rules shall ensure an adequate opportunity for victims to participate at hearings <ln numlevel="1" lineno="546" slineno="5-73"/>held under this chapter, as provided in Section <xref depth="3" refnumber="77-27-9.5" start="0">77-27-9.5</xref>.</subsection><subsection ssid="11-null-28" dnum="c-o" numlevel="1" lineno="547" slineno="5-74" level="2"><display>(c)</display>The rules may allow the board to establish reasonable and equitable time limits on <ln numlevel="1" lineno="548" slineno="5-75"/>the presentations by all participants in hearings held under this chapter.</subsection></subsection><subsection ssid="11-null-29" dnum="6-o" numlevel="1" lineno="549" slineno="5-76" level="1"><display>(6)</display>The board does not provide counseling or therapy for victims as a part of their <ln numlevel="1" lineno="550" slineno="5-77"/>participation in any hearing under this chapter.</subsection><subsection ssid="11-null-30" dnum="7-o" numlevel="1" lineno="551" slineno="5-78" level="1"><display>(7)</display>The board may parole a person sentenced to life in prison without parole if the board <ln numlevel="1" lineno="552" slineno="5-79"/>finds by clear and convincing evidence that the person is permanently incapable of being <ln numlevel="1" lineno="553" slineno="5-80"/>a threat to the safety of society.</subsection></section></bsec><bsec buid="3" type="repealer" src="code" sort="TRepealer" numlevel="1" lineno="554" slineno="6-1" sn="6"><secline>Section 6. <bold>Repealer.</bold></secline><rhead lineno="555"/><sectionText><repsec num="77-27-31" uid="C77-27-S31_2026050620260506" sort="77 27 00310020260506" src="code" sn="7" numlevel="1" lineno="556" slineno="6-3"><parens/>Short title.</repsec></sectionText></bsec><bsec buid="22" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="557" slineno="7-1" sn="7"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="557">Section 7.  <bold>Effective Date.</bold></secline><sectionText lineno="558"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="ahaskell" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-10-26 3:55 PM</tm></rev></foot></leg>
