Section <bold>76-2-309</bold> is amended to read:</secline><catline lineno="25"><bold>76-2-309<parens/>. Justified use of force.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="26" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>An individual who uses or threatens to use force as permitted in Section <xref depth="3" refnumber="76-2-402" start="0">76-2-402</xref>, <xref depth="3" refnumber="76-2-404" start="0"><ln numlevel="1" lineno="27" slineno="1-4"/>76-2-404</xref>, <xref depth="3" refnumber="76-2-405" start="0">76-2-405</xref>, <xref depth="3" refnumber="76-2-406" start="0">76-2-406</xref>, <xref depth="3" refnumber="76-2-407" start="0">76-2-407</xref>, or <xref depth="3" refnumber="76-2-408" start="0">76-2-408</xref> is justified in that conduct.</subsection><subsection ssid="1-null-2" dnum="2-o" numlevel="1" lineno="28" slineno="1-5" level="1"><display>(2)</display>The pretrial justification hearing process described in Subsections <xref depth="4" refnumber="76-2-309(3)(a)" start="0">(3)(a)</xref> and <xref depth="4" refnumber="76-2-309(3)(b)" start="0">(b)</xref> does <ln numlevel="1" lineno="29" slineno="1-6"/>not apply if:<subsection ssid="1-null-3" dnum="a-o" numlevel="1" lineno="30" slineno="1-7" level="2" space="false"><display>(a)</display><subsection ssid="1-null-4" dnum="i-o" level="3" placement="sameline"><display>(i)</display>the individual against whom force was used or threatened is a law enforcement <ln numlevel="1" lineno="31" slineno="1-8"/>officer, as defined in Section <xref depth="3" refnumber="53-13-103" start="0">53-13-103</xref>;</subsection><subsection ssid="1-null-5" dnum="ii-o" numlevel="1" lineno="32" slineno="1-9" level="3"><display>(ii)</display>the officer was acting lawfully in the performance of the officer's official duties; <ln numlevel="1" lineno="33" slineno="1-10"/>and</subsection><subsection ssid="1-null-6" dnum="iii-o" numlevel="1" lineno="34" slineno="1-11" level="3" space="false"><display>(iii)</display><subsection ssid="1-null-7" dnum="A-o" level="4" placement="sameline"><display>(A)</display>the officer was identified as an officer by the officer in accordance with <ln numlevel="1" lineno="35" slineno="1-12"/>applicable law; or</subsection><subsection ssid="1-null-8" dnum="B-o" numlevel="1" lineno="36" slineno="1-13" level="4"><display>(B)</display>the individual using or threatening to use force knew or reasonably should <ln numlevel="1" lineno="37" slineno="1-14"/>have known that the officer was a law enforcement officer; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="24" groupid="21" style="2" owner="jchristopherson" level="1" deltag="both">or</amend><amendoutend style="2"/></subsection></subsection></subsection><subsection ssid="1-null-9" dnum="b-o" numlevel="1" lineno="38" slineno="1-15" level="2"><display>(b)</display>the charge filed against the defendant for which the defendant seeks a pretrial <ln numlevel="1" lineno="39" slineno="1-16"/>justification hearing is an infraction, a class B or C misdemeanor, or a domestic <ln numlevel="1" lineno="40" slineno="1-17"/>violence offense as defined in Section <xref depth="3" refnumber="77-36-1" start="0">77-36-1</xref><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="12" groupid="11" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; or</amend></subsection><subsection ssid="1-20" dnum="_-o:c-i" numlevel="1" lineno="41" slineno="1-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="23" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="end">the defendant used force and did not report the use of that force to law enforcement <ln numlevel="1" lineno="42" slineno="1-19"/>as soon as the defendant was not in imminent danger.</amend></subsection></subsection><subsection ssid="1-null-10" dnum="3-o" numlevel="1" lineno="43" slineno="1-20" level="1" space="false"><display>(3)</display><subsection ssid="1-null-11" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Upon motion of the defendant filed in accordance with Rule 12 of the Utah Rules <ln numlevel="1" lineno="44" slineno="1-21"/>of Criminal Procedure, the court shall hear evidence on the issue of justification <ln numlevel="1" lineno="45" slineno="1-22"/>under this section and shall determine as a matter of fact and law whether the <ln numlevel="1" lineno="46" slineno="1-23"/>defendant was justified in the use or threatened use of force.</subsection><subsection ssid="1-null-12" dnum="b-o" numlevel="1" lineno="47" slineno="1-24" level="2"><display>(b)</display>At the pretrial justification hearing, after the defendant makes a prima facie claim of <ln numlevel="1" lineno="48" slineno="1-25"/>justification, the state has the burden to prove by clear and convincing evidence that <ln numlevel="1" lineno="49" slineno="1-26"/>the defendant's use or threatened use of force was not justified.</subsection><subsection ssid="1-null-13" dnum="c-o" numlevel="1" lineno="50" slineno="1-27" level="2" space="false"><display>(c)</display><subsection ssid="1-null-14" dnum="i-o" level="3" placement="sameline"><display>(i)</display>If the court determines that the state has not met the state's burden described in <ln numlevel="1" lineno="51" slineno="1-28"/>Subsection <xref depth="4" refnumber="76-2-309(3)(b)" start="0">(3)(b)</xref>, the court shall dismiss the charge with prejudice.</subsection><subsection ssid="1-null-15" dnum="ii-o" numlevel="1" lineno="52" slineno="1-29" level="3"><display>(ii)</display>The state may appeal a court's order dismissing a charge under Subsection <xref depth="4" refnumber="76-2-309(3)(c)(i)" start="0"><ln numlevel="1" lineno="53" slineno="1-30"/>(3)(c)(i)</xref> in accordance with Section <xref depth="3" refnumber="77-18a-1" start="0">77-18a-1</xref>.</subsection><subsection ssid="1-null-16" dnum="iii-o" numlevel="1" lineno="54" slineno="1-31" level="3"><display>(iii)</display>If a court determines after the pretrial justification hearing that the state has met <ln numlevel="1" lineno="55" slineno="1-32"/>the state's burden described in Subsection <xref depth="4" refnumber="76-2-309(3)(b)" start="0">(3)(b)</xref>, the issue of justification may be <ln numlevel="1" lineno="56" slineno="1-33"/>raised by the defendant to the jury at trial and, if raised by the defendant, the state <ln numlevel="1" lineno="57" slineno="1-34"/>shall have the burden to prove beyond a reasonable doubt that the defendant's use <ln numlevel="1" lineno="58" slineno="1-35"/>or threatened use of force was not justified.</subsection><subsection ssid="1-null-17" dnum="iv-o" numlevel="1" lineno="59" slineno="1-36" level="3"><display>(iv)</display>At trial, a court's determination that the state met the state's burden under <ln numlevel="1" lineno="60" slineno="1-37"/>Subsection <xref depth="4" refnumber="76-2-309(3)(c)(iii)" start="0">(3)(c)(iii)</xref> is not admissible and may not be referenced by the <ln numlevel="1" lineno="61" slineno="1-38"/>prosecution.</subsection></subsection></subsection></section></bsec><bsec buid="2" num="76-2-402" type="amend" src="code" uid="C76-2-S402_2026050620260506" sort="76 02 04020020260506" numlevel="1" lineno="62" slineno="2-1" sn="2"><section number="76-2-402" numlevel="1" lineno="63" slineno="2-2" type="amend"><secline lineno="62">Section 2. Section <bold>76-2-402</bold> is amended to read:</secline><catline lineno="63"><bold>76-2-402<parens/>. Force in defense of person -- Forcible felony defined.</bold></catline><subsection ssid="2-null-1" dnum="1-o" numlevel="1" lineno="64" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="2-null-2" dnum="a-o" numlevel="1" lineno="65" slineno="2-4" level="2"><display>(a)</display>"Forcible felony" means aggravated assault, mayhem, aggravated murder, murder, <ln numlevel="1" lineno="66" slineno="2-5"/>manslaughter, kidnapping and aggravated kidnapping, rape, forcible sodomy, rape of <ln numlevel="1" lineno="67" slineno="2-6"/>a child, object rape, object rape of a child, sexual abuse of a child, aggravated sexual <ln numlevel="1" lineno="68" slineno="2-7"/>abuse of a child, and aggravated sexual assault as defined in <xref depth="1" refnumber="76-5" start="1">Chapter 5, Offenses <ln numlevel="1" lineno="69" slineno="2-8"/>Against the Individual</xref>, and arson, robbery, and burglary as defined in <xref depth="1" refnumber="76-6" start="1">Chapter 6, <ln numlevel="1" lineno="70" slineno="2-9"/>Offenses Against Property</xref>.</subsection><subsection ssid="2-null-3" dnum="b-o" numlevel="1" lineno="71" slineno="2-10" level="2"><display>(b)</display>"Forcible felony" includes any other felony offense that involves the use of force or <ln numlevel="1" lineno="72" slineno="2-11"/>violence against an individual that poses a substantial danger of death or serious <ln numlevel="1" lineno="73" slineno="2-12"/>bodily injury.</subsection><subsection ssid="2-null-4" dnum="c-o" numlevel="1" lineno="74" slineno="2-13" level="2"><display>(c)</display>"Forcible felony" does not include burglary of a vehicle, as defined in Section <xref depth="3" refnumber="76-6-204" start="0"><ln numlevel="1" lineno="75" slineno="2-14"/>76-6-204</xref>, unless the vehicle is occupied at the time unlawful entry is made or <ln numlevel="1" lineno="76" slineno="2-15"/>attempted.</subsection></subsection><subsection ssid="2-null-5" dnum="2-o" numlevel="1" lineno="77" slineno="2-16" level="1" space="false"><display>(2)</display><subsection ssid="2-null-6" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An individual is justified in threatening or using force against another individual <ln numlevel="1" lineno="78" slineno="2-17"/>when and to the extent that the individual reasonably believes that force or a threat of <ln numlevel="1" lineno="79" slineno="2-18"/>force is necessary to defend the individual or another individual against the imminent <ln numlevel="1" lineno="80" slineno="2-19"/>use of unlawful force.</subsection><subsection ssid="2-null-7" dnum="b-o" numlevel="1" lineno="81" slineno="2-20" level="2"><display>(b)</display>An individual is justified in using force intended or likely to cause death or serious <ln numlevel="1" lineno="82" slineno="2-21"/>bodily injury only if the individual reasonably believes that force is necessary to <ln numlevel="1" lineno="83" slineno="2-22"/>prevent death or serious bodily injury to the individual or another individual as a <ln numlevel="1" lineno="84" slineno="2-23"/>result of imminent use of unlawful force, or to prevent the commission of a forcible <ln numlevel="1" lineno="85" slineno="2-24"/>felony.</subsection></subsection><subsection ssid="2-null-8" dnum="3-o" numlevel="1" lineno="86" slineno="2-25" level="1" space="false"><display>(3)</display><subsection ssid="2-null-9" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An individual is not justified in using force under the circumstances specified in <ln numlevel="1" lineno="87" slineno="2-26"/>Subsection <xref depth="4" refnumber="76-2-402(2)" start="0">(2)</xref> if the individual:<subsection ssid="2-null-10" dnum="i-o" numlevel="1" lineno="88" slineno="2-27" level="3" tab="1"><display>(i)</display>initially provokes the use of force against another individual with the intent to use <ln numlevel="1" lineno="89" slineno="2-28"/>force as an excuse to inflict bodily harm upon the other individual;</subsection><subsection ssid="2-null-11" dnum="ii-o" numlevel="1" lineno="90" slineno="2-29" level="3" tab="1"><display>(ii)</display>is attempting to commit, committing, or fleeing after the commission or <ln numlevel="1" lineno="91" slineno="2-30"/>attempted commission of a felony , unless the use of force is a reasonable <ln numlevel="1" lineno="92" slineno="2-31"/>response to factors unrelated to the commission, attempted commission, or fleeing <ln numlevel="1" lineno="93" slineno="2-32"/>after the commission of that felony ; or</subsection><subsection ssid="2-null-12" dnum="iii-o" numlevel="1" lineno="94" slineno="2-33" level="3" tab="1"><display>(iii)</display>was the aggressor or was engaged in a combat by agreement, unless the <ln numlevel="1" lineno="95" slineno="2-34"/>individual withdraws from the encounter and effectively communicates to the <ln numlevel="1" lineno="96" slineno="2-35"/>other individual the intent to withdraw from the encounter and, notwithstanding, <ln numlevel="1" lineno="97" slineno="2-36"/>the other individual continues or threatens to continue the use of unlawful force.</subsection></subsection><subsection ssid="2-null-13" dnum="b-o" numlevel="1" lineno="98" slineno="2-37" level="2"><display>(b)</display>For purposes of Subsection <xref depth="4" refnumber="76-2-402(3)(a)(iii)" start="0">(3)(a)(iii)</xref> the following do not, alone, constitute "combat <ln numlevel="1" lineno="99" slineno="2-38"/>by agreement":<subsection ssid="2-null-14" dnum="i-o" numlevel="1" lineno="100" slineno="2-39" level="3"><display>(i)</display>voluntarily entering into or remaining in an ongoing relationship; or</subsection><subsection ssid="2-null-15" dnum="ii-o" numlevel="1" lineno="101" slineno="2-40" level="3"><display>(ii)</display>entering or remaining in a place where one has a legal right to be.</subsection></subsection></subsection><subsection ssid="2-null-16" dnum="4-o" numlevel="1" lineno="102" slineno="2-41" level="1"><display>(4)</display>Except as provided in Subsection <xref depth="4" refnumber="76-2-402(3)(a)(iii)" start="0">(3)(a)(iii)</xref>:<subsection ssid="2-null-17" dnum="a-o" numlevel="1" lineno="103" slineno="2-42" level="2"><display>(a)</display>an individual does not have a duty to retreat from the force or threatened force <ln numlevel="1" lineno="104" slineno="2-43"/>described in Subsection <xref depth="4" refnumber="76-2-402(2)" start="0">(2)</xref> in a place where that individual has lawfully entered or <ln numlevel="1" lineno="105" slineno="2-44"/>remained; and</subsection><subsection ssid="2-null-18" dnum="b-o" numlevel="1" lineno="106" slineno="2-45" level="2"><display>(b)</display>the failure of an individual to retreat under the provisions of Subsection <xref depth="4" refnumber="76-2-402(4)(a)" start="0">(4)(a)</xref> is not <ln numlevel="1" lineno="107" slineno="2-46"/>a relevant factor in determining whether the individual who used or threatened force <ln numlevel="1" lineno="108" slineno="2-47"/>acted reasonably.</subsection></subsection><subsection ssid="2-null-19" dnum="5-o" numlevel="1" lineno="109" slineno="2-48" level="1"><display>(5)</display>In determining imminence or reasonableness under Subsection <xref depth="4" refnumber="76-2-402(2)" start="0">(2)</xref>, the trier of fact may <ln numlevel="1" lineno="110" slineno="2-49"/>consider:<subsection ssid="2-null-20" dnum="a-o" numlevel="1" lineno="111" slineno="2-50" level="2"><display>(a)</display>the nature of the danger;</subsection><subsection ssid="2-null-21" dnum="b-o" numlevel="1" lineno="112" slineno="2-51" level="2"><display>(b)</display>the immediacy of the danger;</subsection><subsection ssid="2-null-22" dnum="c-o" numlevel="1" lineno="113" slineno="2-52" level="2"><display>(c)</display>the probability that the unlawful force would result in death or serious bodily injury;</subsection><subsection ssid="2-null-23" dnum="d-o" numlevel="1" lineno="114" slineno="2-53" level="2"><display>(d)</display>the other individual's prior violent acts or violent propensities;</subsection><subsection ssid="2-null-24" dnum="e-o" numlevel="1" lineno="115" slineno="2-54" level="2"><display>(e)</display>any patterns of abuse or violence in the parties' relationship; and</subsection><subsection ssid="2-null-25" dnum="f-o" numlevel="1" lineno="116" slineno="2-55" level="2"><display>(f)</display>any other relevant factors.</subsection></subsection><subsection ssid="2-26" dnum="_-o:6-i" numlevel="1" lineno="117" slineno="2-56" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1043" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">An individual described in Subsection <xref depth="4" refnumber="76-2-402(2)">(2)</xref> shall report the individual's use of force to <ln numlevel="1" lineno="118" slineno="2-57"/>law enforcement as soon as the individual is not in imminent danger.</amend></subsection></section></bsec><bsec buid="3" num="76-2-405" type="amend" src="code" uid="C76-2-S405_2026050620260506" sort="76 02 04050020260506" numlevel="1" lineno="119" slineno="3-1" sn="3"><section number="76-2-405" numlevel="1" lineno="120" slineno="3-2" type="amend"><secline lineno="119">Section 3. Force or deadly force in defense of habitation, vehicle, or place of <ln numlevel="1" lineno="121" slineno="3-3"/>business or employment.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="122" slineno="3-4" level="1" placement="noreturn"><display>(1)</display>Except as provided in Subsection <xref depth="4" refnumber="76-2-405(2)">(2)</xref>, an actor is justified in using force against an <ln numlevel="1" lineno="123" slineno="3-5"/>individual when and to the extent that the actor reasonably believes that the force is <ln numlevel="1" lineno="124" slineno="3-6"/>necessary to prevent or terminate the individual's unlawful entry into the actor's vehicle <ln numlevel="1" lineno="125" slineno="3-7"/>or unlawful entry or attack upon the actor's habitation or place of business or <ln numlevel="1" lineno="126" slineno="3-8"/>employment.</subsection><subsection ssid="3-null-2" dnum="2-o" numlevel="1" lineno="127" slineno="3-9" level="1"><display>(2)</display>An actor is justified in using force against the individual described in Subsection <xref depth="4" refnumber="76-2-405(1)">(1)</xref> that <ln numlevel="1" lineno="128" slineno="3-10"/>is intended or likely to cause death or serious bodily injury to the individual only if:<subsection ssid="3-null-3" dnum="a-o" numlevel="1" lineno="129" slineno="3-11" level="2" space="false"><display>(a)</display><subsection ssid="3-null-4" dnum="i-o" level="3" placement="sameline"><display>(i)</display>the entry is made or attempted in a violent and tumultuous manner, <ln numlevel="1" lineno="130" slineno="3-12"/>surreptitiously, or by stealth; and</subsection><subsection ssid="3-null-5" dnum="ii-o" numlevel="1" lineno="131" slineno="3-13" level="3"><display>(ii)</display>the actor reasonably believes:<subsection ssid="3-null-6" dnum="A-o" numlevel="1" lineno="132" slineno="3-14" level="4"><display>(A)</display>that the entry is attempted or made for the purpose of assaulting or <ln numlevel="1" lineno="133" slineno="3-15"/>perpetrating personal violence against any individual who dwells in or is <ln numlevel="1" lineno="134" slineno="3-16"/>present in the habitation or is present in the vehicle, or place of business or <ln numlevel="1" lineno="135" slineno="3-17"/>employment; and</subsection><subsection ssid="3-null-7" dnum="B-o" numlevel="1" lineno="136" slineno="3-18" level="4"><display>(B)</display>that the force is necessary to prevent the assault or perpetration of personal <ln numlevel="1" lineno="137" slineno="3-19"/>violence; or</subsection></subsection></subsection><subsection ssid="3-null-8" dnum="b-o" numlevel="1" lineno="138" slineno="3-20" level="2"><display>(b)</display>the actor reasonably believes that:<subsection ssid="3-null-9" dnum="i-o" numlevel="1" lineno="139" slineno="3-21" level="3"><display>(i)</display>the entry is made or attempted for the purpose of committing a felony in the <ln numlevel="1" lineno="140" slineno="3-22"/>habitation; and</subsection><subsection ssid="3-null-10" dnum="ii-o" numlevel="1" lineno="141" slineno="3-23" level="3"><display>(ii)</display>the force is necessary to prevent the commission of the felony.</subsection></subsection></subsection><subsection ssid="3-null-11" dnum="3-o" numlevel="1" lineno="142" slineno="3-24" level="1" space="false"><display>(3)</display><subsection ssid="3-null-12" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An actor who uses force or deadly force against an individual to defend the actor's <ln numlevel="1" lineno="143" slineno="3-25"/>habitation is presumed for the purpose of both civil and criminal cases to have acted <ln numlevel="1" lineno="144" slineno="3-26"/>reasonably and had a reasonable fear of imminent peril of death or serious bodily <ln numlevel="1" lineno="145" slineno="3-27"/>injury if the entry or attempted entry is:<subsection ssid="3-null-13" dnum="i-o" numlevel="1" lineno="146" slineno="3-28" level="3" tab="1"><display>(i)</display> unlawful; and</subsection><subsection ssid="3-null-14" dnum="ii-o" numlevel="1" lineno="147" slineno="3-29" level="3" tab="1"><display>(ii)</display> made or attempted:<subsection ssid="3-null-15" dnum="A-o" numlevel="1" lineno="148" slineno="3-30" level="4"><display>(A)</display>by use of force;</subsection><subsection ssid="3-null-16" dnum="B-o" numlevel="1" lineno="149" slineno="3-31" level="4"><display>(B)</display>in a violent and tumultuous manner;</subsection><subsection ssid="3-null-17" dnum="C-o" numlevel="1" lineno="150" slineno="3-32" level="4"><display>(C)</display>surreptitiously or by stealth; or</subsection><subsection ssid="3-null-18" dnum="D-o" numlevel="1" lineno="151" slineno="3-33" level="4"><display>(D)</display>for the purpose of committing a felony.</subsection></subsection></subsection><subsection ssid="3-null-19" dnum="b-o" numlevel="1" lineno="152" slineno="3-34" level="2"><display>(b)</display>An actor who uses force or deadly force against an individual to defend the actor's <ln numlevel="1" lineno="153" slineno="3-35"/>vehicle or place of business or employment is presumed for the purpose of both civil <ln numlevel="1" lineno="154" slineno="3-36"/>and criminal cases to have acted reasonably and had a reasonable fear of imminent <ln numlevel="1" lineno="155" slineno="3-37"/>peril of death or serious bodily injury if:<subsection ssid="3-null-20" dnum="i-o" numlevel="1" lineno="156" slineno="3-38" level="3"><display>(i)</display>the actor knew or had reason to believe that the individual:<subsection ssid="3-null-21" dnum="A-o" numlevel="1" lineno="157" slineno="3-39" level="4"><display>(A)</display>entered, or attempted to enter, unlawfully and with force, the actor's occupied <ln numlevel="1" lineno="158" slineno="3-40"/>vehicle or place of business or employment; or</subsection><subsection ssid="3-null-22" dnum="B-o" numlevel="1" lineno="159" slineno="3-41" level="4"><display>(B)</display>removed, or attempted to remove, unlawfully and with force, the actor from <ln numlevel="1" lineno="160" slineno="3-42"/>the actor's vehicle or place of business or employment; and</subsection></subsection><subsection ssid="3-null-23" dnum="ii-o" numlevel="1" lineno="161" slineno="3-43" level="3"><display>(ii)</display>the actor:<subsection ssid="3-null-24" dnum="A-o" numlevel="1" lineno="162" slineno="3-44" level="4"><display>(A)</display>did not provoke the individual; and</subsection><subsection ssid="3-null-25" dnum="B-o" numlevel="1" lineno="163" slineno="3-45" level="4"><display>(B)</display>was not otherwise engaged in criminal activity, other than a traffic offense, at <ln numlevel="1" lineno="164" slineno="3-46"/>the time the force was used.</subsection></subsection></subsection><subsection ssid="3-null-26" dnum="c-o" numlevel="1" lineno="165" slineno="3-47" level="2"><display>(c)</display>The presumption in Subsection <xref depth="4" refnumber="76-2-405(3)(b)">(3)(b)</xref> applies to an actor's use of force or deadly <ln numlevel="1" lineno="166" slineno="3-48"/>force against an individual to protect a third person if:<subsection ssid="3-null-27" dnum="i-o" numlevel="1" lineno="167" slineno="3-49" level="3"><display>(i)</display>under the circumstances as the actor believes them to be, the actor would be <ln numlevel="1" lineno="168" slineno="3-50"/>justified under Subsection <xref depth="4" refnumber="76-2-405(3)(b)">(3)(b)</xref> in using force or deadly force to protect the actor <ln numlevel="1" lineno="169" slineno="3-51"/>against the unlawful force or unlawful deadly force that the actor reasonably <ln numlevel="1" lineno="170" slineno="3-52"/>believes to be threatening the third person the actor seeks to protect; and</subsection><subsection ssid="3-null-28" dnum="ii-o" numlevel="1" lineno="171" slineno="3-53" level="3"><display>(ii)</display>the actor reasonably believes that the actor's intervention is immediately <ln numlevel="1" lineno="172" slineno="3-54"/>necessary to protect the third person.</subsection></subsection></subsection><subsection ssid="3-29" dnum="_-o:4-i" numlevel="1" lineno="173" slineno="3-55" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1072" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">An actor described in Subsection <xref depth="4" refnumber="76-2-405(1)">(1)</xref> shall report the actor's use of force to law <ln numlevel="1" lineno="174" slineno="3-56"/>enforcement as soon as the actor is not in imminent danger.</amend></subsection></section></bsec><bsec buid="4" num="76-2-406" type="amend" src="code" uid="C76-2-S406_2026050620260506" sort="76 02 04060020260506" numlevel="1" lineno="175" slineno="4-1" sn="4"><section number="76-2-406" numlevel="1" lineno="176" slineno="4-2" type="amend"><secline lineno="175">Section 4. Section <bold>76-2-406</bold> is amended to read:</secline><catline lineno="176"><bold>76-2-406<parens/>. Force in defense of property -- Affirmative defense.</bold></catline><subsection ssid="4-null-1" dnum="1-o" numlevel="1" lineno="177" slineno="4-3" level="1" placement="noreturn"><display>(1)</display>Except as provided in Section <xref depth="3" refnumber="76-2-405">76-2-405</xref>, an actor is justified in using force, other than <ln numlevel="1" lineno="178" slineno="4-4"/>deadly force, against another individual when and to the extent that the actor reasonably <ln numlevel="1" lineno="179" slineno="4-5"/>believes that force is necessary to prevent or terminate the individual's criminal <ln numlevel="1" lineno="180" slineno="4-6"/>interference with:<subsection ssid="4-null-2" dnum="a-o" numlevel="1" lineno="181" slineno="4-7" level="2"><display>(a)</display>real or personal property lawfully in the actor's possession;</subsection><subsection ssid="4-null-3" dnum="b-o" numlevel="1" lineno="182" slineno="4-8" level="2"><display>(b)</display>real or personal property lawfully in the possession of a member of the actor's <ln numlevel="1" lineno="183" slineno="4-9"/>immediate family;</subsection><subsection ssid="4-null-4" dnum="c-o" numlevel="1" lineno="184" slineno="4-10" level="2"><display>(c)</display>real or personal property belonging to an individual whose property the actor has a <ln numlevel="1" lineno="185" slineno="4-11"/>legal duty to protect; or</subsection><subsection ssid="4-null-5" dnum="d-o" numlevel="1" lineno="186" slineno="4-12" level="2"><display>(d)</display>personal property that the actor reasonably believes belongs to another person and <ln numlevel="1" lineno="187" slineno="4-13"/>that individual's criminal interference is meant to deprive the other person of the <ln numlevel="1" lineno="188" slineno="4-14"/>person's personal property.</subsection></subsection><subsection ssid="4-null-6" dnum="2-o" numlevel="1" lineno="189" slineno="4-15" level="1"><display>(2)</display>In determining reasonableness under Subsection <xref depth="4" refnumber="76-2-406(1)">(1)</xref>, the trier of fact shall, in addition to <ln numlevel="1" lineno="190" slineno="4-16"/>any other factors, consider the following factors:<subsection ssid="4-null-7" dnum="a-o" numlevel="1" lineno="191" slineno="4-17" level="2"><display>(a)</display>the apparent or perceived extent of the damage to the property;</subsection><subsection ssid="4-null-8" dnum="b-o" numlevel="1" lineno="192" slineno="4-18" level="2"><display>(b)</display>property damage previously caused by the other individual;</subsection><subsection ssid="4-null-9" dnum="c-o" numlevel="1" lineno="193" slineno="4-19" level="2"><display>(c)</display>threats of personal injury or damage to property that have been made previously by <ln numlevel="1" lineno="194" slineno="4-20"/>the other individual; and</subsection><subsection ssid="4-null-10" dnum="d-o" numlevel="1" lineno="195" slineno="4-21" level="2"><display>(d)</display>any patterns of abuse or violence between the actor and the individual.</subsection></subsection><subsection ssid="4-11" dnum="_-o:3-i" numlevel="1" lineno="196" slineno="4-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1083" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">An actor described in Subsection <xref depth="4" refnumber="76-2-406(1)">(1)</xref> shall report the actor's use of force to law <ln numlevel="1" lineno="197" slineno="4-23"/>enforcement as soon as the actor is not in imminent danger.</amend></subsection></section></bsec><bsec buid="5" num="76-2-407" type="amend" src="code" uid="C76-2-S407_2026050620260506" sort="76 02 04070020260506" numlevel="1" lineno="198" slineno="5-1" sn="5"><section number="76-2-407" numlevel="1" lineno="199" slineno="5-2" type="amend"><secline lineno="198">Section 5. Section <bold>76-2-407</bold> is amended to read:</secline><catline lineno="199"><bold>76-2-407<parens/>. Deadly force in defense of individuals on real property.</bold></catline><subsection ssid="5-null-1" dnum="1-o" numlevel="1" lineno="200" slineno="5-3" level="1" placement="noreturn"><display>(1)</display>As used in this section, "forcible felony" means the same as that term is defined in <ln numlevel="1" lineno="201" slineno="5-4"/>Section <xref depth="3" refnumber="76-2-402">76-2-402</xref>.</subsection><subsection ssid="5-null-2" dnum="2-o" numlevel="1" lineno="202" slineno="5-5" level="1"><display>(2)</display>An actor is justified in using force intended or likely to cause death or serious bodily <ln numlevel="1" lineno="203" slineno="5-6"/>injury against an individual in the actor's defense of another individual on real property <ln numlevel="1" lineno="204" slineno="5-7"/>other than the places or situations described in Section <xref depth="3" refnumber="76-2-405">76-2-405</xref> if:<subsection ssid="5-null-3" dnum="a-o" numlevel="1" lineno="205" slineno="5-8" level="2"><display>(a)</display>the actor is in lawful possession of the real property;</subsection><subsection ssid="5-null-4" dnum="b-o" numlevel="1" lineno="206" slineno="5-9" level="2"><display>(b)</display>the actor reasonably believes that the force is necessary to prevent or terminate the <ln numlevel="1" lineno="207" slineno="5-10"/>individual's trespass onto the real property;</subsection><subsection ssid="5-null-5" dnum="c-o" numlevel="1" lineno="208" slineno="5-11" level="2"><display>(c)</display>the individual's trespass is made or attempted by use of force or in a violent and <ln numlevel="1" lineno="209" slineno="5-12"/>tumultuous manner; and</subsection><subsection ssid="5-null-6" dnum="d-o" numlevel="1" lineno="210" slineno="5-13" level="2" space="false"><display>(d)</display><subsection ssid="5-null-7" dnum="i-o" level="3" placement="sameline"><display>(i)</display>the actor reasonably believes:<subsection ssid="5-null-8" dnum="A-o" numlevel="1" lineno="211" slineno="5-14" level="4" tab="1"><display>(A)</display>that the individual's trespass is attempted or made for the purpose of <ln numlevel="1" lineno="212" slineno="5-15"/>committing violence against an individual on the real property; and</subsection><subsection ssid="5-null-9" dnum="B-o" numlevel="1" lineno="213" slineno="5-16" level="4" tab="1"><display>(B)</display>that the force is necessary to prevent personal violence; or</subsection></subsection><subsection ssid="5-null-10" dnum="ii-o" numlevel="1" lineno="214" slineno="5-17" level="3"><display>(ii)</display>the actor reasonably believes that:<subsection ssid="5-null-11" dnum="A-o" numlevel="1" lineno="215" slineno="5-18" level="4"><display>(A)</display>the individual's trespass is made or attempted for the purpose of committing a <ln numlevel="1" lineno="216" slineno="5-19"/>forcible felony that poses imminent peril of death or serious bodily injury to an <ln numlevel="1" lineno="217" slineno="5-20"/>individual on the real property; and</subsection><subsection ssid="5-null-12" dnum="B-o" numlevel="1" lineno="218" slineno="5-21" level="4"><display>(B)</display>the force is necessary to prevent the commission of the forcible felony.</subsection></subsection></subsection></subsection><subsection ssid="5-null-13" dnum="3-o" numlevel="1" lineno="219" slineno="5-22" level="1"><display>(3)</display>An actor who uses deadly force in defense of an individual on real property under <ln numlevel="1" lineno="220" slineno="5-23"/>Subsection <xref depth="4" refnumber="76-2-407(2)">(2)</xref> is presumed for the purpose of both civil and criminal cases to have acted <ln numlevel="1" lineno="221" slineno="5-24"/>reasonably and had a reasonable fear of imminent peril of death or serious bodily injury <ln numlevel="1" lineno="222" slineno="5-25"/>if the trespass or attempted trespass:<subsection ssid="5-null-14" dnum="a-o" numlevel="1" lineno="223" slineno="5-26" level="2"><display>(a)</display>is unlawful; and</subsection><subsection ssid="5-null-15" dnum="b-o" numlevel="1" lineno="224" slineno="5-27" level="2"><display>(b)</display>is made or attempted:<subsection ssid="5-null-16" dnum="i-o" numlevel="1" lineno="225" slineno="5-28" level="3"><display>(i)</display>by use of force;</subsection><subsection ssid="5-null-17" dnum="ii-o" numlevel="1" lineno="226" slineno="5-29" level="3"><display>(ii)</display>in a violent and tumultuous manner;
