Battered person mitigation.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="25" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="1-null-2" dnum="a-o" numlevel="1" lineno="26" slineno="1-4" level="2"><display>(a)</display>"Abuse" means the same as that term is defined in Section <xref depth="3" refnumber="78B-7-102" start="0">78B-7-102</xref>.</subsection><subsection ssid="1-null-3" dnum="b-o:_-i" numlevel="1" lineno="27" slineno="1-5" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1002" style="2" owner="o" level="1" deltag="start">(b)</amend></display><amend anum="0" ea="erase" pairid="10" groupid="6" style="2" owner="jchristopherson" level="1" deltag="end">"Cohabitant" means:</amend><amendoutend style="2"/><subsection ssid="1-null-4" dnum="i-o:_-i" numlevel="1" lineno="28" slineno="1-6" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1003" style="2" owner="o" level="1" deltag="start">(i)</amend></display><amend anum="0" ea="erase" pairid="11" groupid="7" style="2" owner="jchristopherson" level="1" deltag="end">the same as that term is defined in Section <xref depth="3" refnumber="78B-7-102" start="0">78B-7-102</xref>; or</amend><amendoutend style="2"/></subsection><subsection ssid="1-null-5" dnum="ii-o:_-i" numlevel="1" lineno="29" slineno="1-7" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1004" style="2" owner="o" level="1" deltag="start">(ii)</amend></display><amend anum="0" ea="erase" pairid="14" groupid="10" style="2" owner="jchristopherson" level="1" deltag="end">the relationship of a minor and a natural parent, an adoptive parent, a stepparent, <ln numlevel="1" lineno="30" slineno="1-8"/>or an individual living with the minor's natural parent as if a stepparent to the <ln numlevel="1" lineno="31" slineno="1-9"/>minor.</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="1-21" dnum="_-o:b-i" numlevel="1" lineno="32" slineno="1-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><subsection ssid="1-27" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="20" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="end">"Cohabitant" means the same as the term is defined in Section <xref depth="3" refnumber="78B-7-102">78B-7-102</xref>.</amend></subsection><subsection ssid="1-22" dnum="_-o:ii-i" numlevel="1" lineno="33" slineno="1-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="25" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="end">"Cohabitant" includes, notwithstanding the definition in Section <xref depth="3" refnumber="78B-7-102">78B-7-102</xref>, an <ln numlevel="1" lineno="34" slineno="1-12"/>individual who is:</amend><subsection ssid="1-23" dnum="_-o:A-i" numlevel="1" lineno="35" slineno="1-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="30" groupid="23" style="1" owner="jchristopherson" level="1" amendtag="end">a minor when the minor's parent or stepparent, or an individual living with the <ln numlevel="1" lineno="36" slineno="1-14"/>minor's parent as if a stepparent to the minor, committed the criminal offense; <ln numlevel="1" lineno="37" slineno="1-15"/>or</amend></subsection><subsection ssid="1-24" dnum="_-o:B-i" numlevel="1" lineno="38" slineno="1-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="35" groupid="27" style="1" owner="jchristopherson" level="1" amendtag="end">a parent or stepparent of a minor, or an individual living with a parent of a <ln numlevel="1" lineno="39" slineno="1-17"/>minor as if a stepparent to the minor, when the minor committed the criminal <ln numlevel="1" lineno="40" slineno="1-18"/>offense.</amend></subsection></subsection></subsection><subsection ssid="1-26" dnum="_-o:c-i" numlevel="1" lineno="41" slineno="1-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="41" groupid="32" style="1" owner="jchristopherson" level="1" amendtag="end">"Minor" means an individual who is younger than 18 years old.</amend></subsection><subsection ssid="1-25" dnum="_-o:d-i" numlevel="1" lineno="42" slineno="1-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="44" groupid="34" style="1" owner="jchristopherson" level="1" amendtag="end">"Parent" means an individual with an established parent-child relationship as <ln numlevel="1" lineno="43" slineno="1-21"/>described in Section <xref depth="3" refnumber="81-5-201">81-5-201</xref>.</amend></subsection></subsection><subsection ssid="1-null-6" dnum="2-o" numlevel="1" lineno="44" slineno="1-22" level="1" space="false"><display>(2)</display><subsection ssid="1-null-7" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An individual is entitled to battered person mitigation if:<subsection ssid="1-null-8" dnum="i-o" numlevel="1" lineno="45" slineno="1-23" level="3" tab="1"><display>(i)</display>the individual committed a criminal offense that was not legally justified;</subsection><subsection ssid="1-null-9" dnum="ii-o" numlevel="1" lineno="46" slineno="1-24" level="3" tab="1"><display>(ii)</display>the individual committed the criminal offense against a cohabitant who <ln numlevel="1" lineno="47" slineno="1-25"/>demonstrated a pattern of abuse against the individual or another cohabitant of the <ln numlevel="1" lineno="48" slineno="1-26"/>individual; and</subsection><subsection ssid="1-null-10" dnum="iii-o" numlevel="1" lineno="49" slineno="1-27" level="3" tab="1"><display>(iii)</display>the individual reasonably believed that the criminal offense was necessary to end <ln numlevel="1" lineno="50" slineno="1-28"/>the pattern of abuse.</subsection></subsection><subsection ssid="1-null-11" dnum="b-o" numlevel="1" lineno="51" slineno="1-29" level="2"><display>(b)</display>A reasonable belief under Subsection <xref depth="4" refnumber="76-2-409(2)(a)" start="0">(2)(a)</xref> is determined from the viewpoint of a <ln numlevel="1" lineno="52" slineno="1-30"/>reasonable person in the individual's circumstances, as the individual's circumstances <ln numlevel="1" lineno="53" slineno="1-31"/>are perceived by the individual.</subsection></subsection><subsection ssid="1-null-12" dnum="3-o" numlevel="1" lineno="54" slineno="1-32" level="1"><display>(3)</display>An individual claiming mitigation under Subsection <xref depth="4" refnumber="76-2-409(2)(a)" start="0">(2)(a)</xref> has the burden of proving, by <ln numlevel="1" lineno="55" slineno="1-33"/>clear and convincing evidence, each element that would entitle the individual to <ln numlevel="1" lineno="56" slineno="1-34"/>mitigation under Subsection <xref depth="4" refnumber="76-2-409(2)(a)" start="0">(2)(a)</xref>.</subsection><subsection ssid="1-null-13" dnum="4-o" numlevel="1" lineno="57" slineno="1-35" level="1"><display>(4)</display>Mitigation under Subsection <xref depth="4" refnumber="76-2-409(2)(a)" start="0">(2)(a)</xref> results in a one-step reduction of the level of offense <ln numlevel="1" lineno="58" slineno="1-36"/>of which the individual is convicted.</subsection><subsection ssid="1-null-14" dnum="5-o" numlevel="1" lineno="59" slineno="1-37" level="1" space="false"><display>(5)</display><subsection ssid="1-null-15" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If the trier of fact is a jury, an individual is not entitled to mitigation under <ln numlevel="1" lineno="60" slineno="1-38"/>Subsection <xref depth="4" refnumber="76-2-409(2)(a)" start="0">(2)(a)</xref> unless the jury:<subsection ssid="1-null-16" dnum="i-o" numlevel="1" lineno="61" slineno="1-39" level="3" tab="1"><display>(i)</display>finds the individual proved, in accordance with Subsection <xref depth="4" refnumber="76-2-409(3)" start="0">(3)</xref>, that the individual <ln numlevel="1" lineno="62" slineno="1-40"/>is entitled to mitigation by unanimous vote; and</subsection><subsection ssid="1-null-17" dnum="ii-o" numlevel="1" lineno="63" slineno="1-41" level="3" tab="1"><display>(ii)</display>returns a special verdict for the reduced charge at the same time the jury returns <ln numlevel="1" lineno="64" slineno="1-42"/>the general verdict.</subsection></subsection><subsection ssid="1-null-18" dnum="b-o" numlevel="1" lineno="65" slineno="1-43" level="2"><display>(b)</display>A nonunanimous vote by the jury on the question of mitigation under Subsection <xref depth="4" refnumber="76-2-409(2)(a)" start="0"><ln numlevel="1" lineno="66" slineno="1-44"/>(2)(a)</xref> does not result in a hung jury.</subsection></subsection><subsection ssid="1-null-19" dnum="6-o" numlevel="1" lineno="67" slineno="1-45" level="1"><display>(6)</display>An individual intending to claim mitigation under Subsection <xref depth="4" refnumber="76-2-409(2)(a)" start="0">(2)(a)</xref> at the individual's <ln numlevel="1" lineno="68" slineno="1-46"/>trial shall give notice of the individual's intent to claim mitigation under Subsection <xref depth="4" refnumber="76-2-409(2)(a)" start="0"><ln numlevel="1" lineno="69" slineno="1-47"/>(2)(a)</xref> to the prosecuting agency at least 30 days before the individual's trial.</subsection></section></bsec><bsec buid="2" num="78B-7-102" type="amend" src="code" uid="C78B-7-S102_2026050620260506" sort="78B07 01020020260506" numlevel="1" lineno="70" slineno="2-1" sn="2"><section number="78B-7-102" numlevel="1" lineno="71" slineno="2-2" type="amend"><secline lineno="70">Section 2, Section <bold>78B-7-102</bold> is amended to read:</secline><catline lineno="71"><bold>78B-7-102. Definitions for chapter.</bold></catline><sectionText lineno="72"><tab/>As used in this chapter:</sectionText><subsection ssid="2-null-1" dnum="1-o" numlevel="1" lineno="73" slineno="2-4" level="1"><display>(1)</display>"Abuse" means, except as provided in Section <xref depth="3" refnumber="78B-7-201" start="0">78B-7-201</xref>, intentionally or knowingly <ln numlevel="1" lineno="74" slineno="2-5"/>causing or attempting to cause another individual physical harm or intentionally or <ln numlevel="1" lineno="75" slineno="2-6"/>knowingly placing another individual in reasonable fear of imminent physical harm.</subsection><subsection ssid="2-null-2" dnum="2-o" numlevel="1" lineno="76" slineno="2-7" level="1"><display>(2)</display>"Affinity" means the same as that term is defined in Section <xref depth="3" refnumber="76-1-101.5" start="0">76-1-101.5</xref>.</subsection><subsection ssid="2-null-3" dnum="3-o" numlevel="1" lineno="77" slineno="2-8" level="1"><display>(3)</display>"Canadian domestic violence protection order" means the same as that term is defined in <ln numlevel="1" lineno="78" slineno="2-9"/>Section <xref depth="3" refnumber="78B-7-1201">78B-7-1201</xref>.</subsection><subsection ssid="2-null-4" dnum="4-o" numlevel="1" lineno="79" slineno="2-10" level="1"><display>(4)</display>"Child" means an individual who is younger than 18 years old.</subsection><subsection ssid="2-null-5" dnum="5-o" numlevel="1" lineno="80" slineno="2-11" level="1"><display>(5)</display>"Civil protective order" means an order issued, subsequent to a hearing on the petition, <ln numlevel="1" lineno="81" slineno="2-12"/>of which the petitioner and respondent have been given notice, under:<subsection ssid="2-null-6" dnum="a-o" numlevel="1" lineno="82" slineno="2-13" level="2"><display>(a)</display><xref depth="2" refnumber="78B-7-2" start="2">Part 2, Child Protective Orders</xref>;</subsection><subsection ssid="2-null-7" dnum="b-o" numlevel="1" lineno="83" slineno="2-14" level="2"><display>(b)</display><xref depth="2" refnumber="78B-7-4" start="2">Part 4, Dating Violence Protective Orders</xref>;</subsection><subsection ssid="2-null-8" dnum="c-o" numlevel="1" lineno="84" slineno="2-15" level="2"><display>(c)</display><xref depth="2" refnumber="78B-7-5" start="2">Part 5, Sexual Violence Protective Orders</xref>;</subsection><subsection ssid="2-null-9" dnum="d-o" numlevel="1" lineno="85" slineno="2-16" level="2"><display>(d)</display><xref depth="2" refnumber="78B-7-6" start="2">Part 6, Cohabitant Abuse Protective Orders</xref>; or</subsection><subsection ssid="2-null-10" dnum="e-o" numlevel="1" lineno="86" slineno="2-17" level="2"><display>(e)</display><xref depth="2" refnumber="78B-7-11" start="2">Part 11, Workplace Violence Protective Orders</xref>.</subsection></subsection><subsection ssid="2-null-11" dnum="6-o" numlevel="1" lineno="87" slineno="2-18" level="1"><display>(6)</display>"Civil stalking injunction" means a stalking injunction issued under <xref depth="2" refnumber="78B-7-7" start="2">Part 7, Civil <ln numlevel="1" lineno="88" slineno="2-19"/>Stalking Injunctions</xref>.</subsection><subsection ssid="2-null-12" dnum="7-o" numlevel="1" lineno="89" slineno="2-20" level="1" space="false"><display>(7)</display><subsection ssid="2-null-13" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Cohabitant" means<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="26" groupid="21" style="2" owner="jchristopherson" level="1" deltag="both"> an emancipated individual under Section <xref depth="3" refnumber="15-2-1" start="0">15-2-1</xref> or an <ln numlevel="1" lineno="90" slineno="2-21"/>individual who is 16 years old or older who</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="50" groupid="42" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">:</amend><subsection ssid="2-81" dnum="_-o:i-i" numlevel="1" lineno="91" slineno="2-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1039" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="51" groupid="43" style="1" owner="jchristopherson" level="1" amendtag="end">an individual who is emancipated under Section <xref depth="3" refnumber="15-2-1">15-2-1</xref>, or an individual who is 16 <ln numlevel="1" lineno="92" slineno="2-23"/>years old or older, when the individual</amend>:<subsection ssid="2-null-14" dnum="i-o:A-i" numlevel="1" lineno="93" slineno="2-24" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1040" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1041" style="1" owner="i" level="1" amendtag="both" space="true">(A)</amend></display>is or was a spouse of the other party;</subsection><subsection ssid="2-null-15" dnum="ii-o:B-i" numlevel="1" lineno="94" slineno="2-25" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1041" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1042" style="1" owner="i" level="1" amendtag="both" space="true">(B)</amend></display>is or was living as if a spouse of the other party;</subsection><subsection ssid="2-null-16" dnum="iii-o:C-i" numlevel="1" lineno="95" slineno="2-26" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1042" style="2" owner="o" level="1" deltag="both">(iii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1043" style="1" owner="i" level="1" amendtag="both" space="true">(C)</amend></display>is related by blood or marriage to the other party as the individual's parent<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="63" groupid="52" style="2" owner="jchristopherson" level="1" deltag="both"><ln numlevel="1" lineno="96" slineno="2-27"/>, grandparent, sibling, or any other individual related to the individual </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="69" groupid="57" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"> or <ln numlevel="1" lineno="97" slineno="2-28"/>grandparent;</amend></subsection><subsection ssid="2-82" dnum="_-o:D-i" numlevel="1" lineno="98" slineno="2-29" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1043" style="1" owner="i" level="1" amendtag="start">(D)</amend></display><amend anum="0" ea="amend" pairid="68" groupid="56" style="1" owner="jchristopherson" level="1" amendtag="end">is related </amend>by consanguinity or affinity to the second degree<amend anum="0" ea="amend" pairid="79" groupid="66" style="1" owner="jchristopherson" level="1" amendtag="both"> to the other party</amend>;</subsection><subsection ssid="2-null-17" dnum="iv-o:E-i" numlevel="1" lineno="99" slineno="2-30" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1044" style="2" owner="o" level="1" deltag="both">(iv)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1045" style="1" owner="i" level="1" amendtag="both" space="true">(E)</amend></display>has or had one or more children in common with the other party;</subsection><subsection ssid="2-null-18" dnum="v-o:F-i" numlevel="1" lineno="100" slineno="2-31" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1045" style="2" owner="o" level="1" deltag="both">(v)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1046" style="1" owner="i" level="1" amendtag="both" space="true">(F)</amend></display>is the biological parent of the other party's unborn minor child;</subsection><subsection ssid="2-null-19" dnum="vi-o:G-i" numlevel="1" lineno="101" slineno="2-32" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1046" style="2" owner="o" level="1" deltag="both">(vi)</amend><amendoutend style="2"/><amend anum="0" ea="amend" deltag="both">(vii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1048" style="1" owner="i" level="1" amendtag="both" space="true">(H)</amend></display>is or was in a consensual sexual relationship with the other party<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="58" groupid="49" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="57" groupid="48" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; or</amend></subsection></subsection><subsection ssid="2-76" dnum="_-o:ii-i" numlevel="1" lineno="103" slineno="2-34" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1048" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="18" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="end">an individual who is 18 years old or older and is the sibling, stepsibling, or foster <ln numlevel="1" lineno="104" slineno="2-35"/>sibling of the other party when the other party is a child.</amend></subsection></subsection><subsection ssid="2-77" dnum="_-o:b-i" numlevel="1" lineno="105" slineno="2-36" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1049" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="22" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="end">"Cohabitant" does not groupid="4" style="2" owner="jchristopherson" level="1" deltag="end">"Cohabitant" does not include:</amend><amendoutend style="2"/><subsection ssid="2-null-22" dnum="i-o:_-i" numlevel="1" lineno="113" slineno="2-44" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1055" style="2" owner="o" level="1" deltag="start">(i)</amend></display><amend anum="0" ea="erase" pairid="7" groupid="5" style="2" owner="jchristopherson" level="1" deltag="end">the relationship of natural parent, adoptive parent, or step-parent to a minor child; <ln numlevel="1" lineno="114" slineno="2-45"/>or</amend><amendoutend style="2"/></subsection><subsection ssid="2-null-23" dnum="ii-o:_-i" numlevel="1" lineno="115" foster siblings who are under <ln numlevel="1" lineno="116" slineno="2-47"/>18 years old.</amend><amendoutend style="2"/></subsection></subsection></subsection><subsection ssid="2-null-24" dnum="8-o" numlevel="1" lineno="117" slineno="2-48" level="1"><display>(8)</display>"Consanguinity" means the same as that term is defined in Section <xref depth="3" refnumber="76-1-101.5" start="0">76-1-101.5</xref>.</subsection><subsection ssid="2-null-25" dnum="9-o" numlevel="1" lineno="118" slineno="2-49" level="1"><display>(9)</display>"Criminal protective order" means an order issued under <xref depth="2" refnumber="78B-7-8" start="2">Part 8, Criminal Protective <ln numlevel="1" lineno="119" slineno="2-50"/>Orders</xref>.</subsection><subsection ssid="2-null-26" dnum="10-o" numlevel="1" lineno="120" slineno="2-51" level="1"><display>(10)</display>"Criminal stalking injunction" means a stalking injunction issued under <xref depth="2" refnumber="78B-7-9" start="2">Part 9, <ln numlevel="1" lineno="121" slineno="2-52"/>Criminal Stalking Injunctions</xref>.</subsection><subsection ssid="2-null-27" dnum="11-o" numlevel="1" lineno="122" slineno="2-53" level="1"><display>(11)</display>"Court clerk" means a district court clerk.</subsection><subsection ssid="2-null-28" dnum="12-o" numlevel="1" lineno="123" slineno="2-54" level="1" space="false"><display>(12)</display><subsection ssid="2-null-29" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Dating partner" means an individual who:<subsection ssid="2-null-30" dnum="i-o" numlevel="1" lineno="124" slineno="2-55" level="3" tab="1" space="false"><display>(i)</display><subsection ssid="2-null-31" dnum="A-o" level="4" placement="sameline"><display>(A)</display>is an emancipated individual under Section <xref depth="3" refnumber="15-2-1" start="0">15-2-1</xref> or <xref depth="1" refnumber="80-7" start="0">Title 80, Chapter 7, <ln numlevel="1" lineno="125" slineno="2-56"/>Emancipation</xref>; or</subsection><subsection ssid="2-null-32" dnum="B-o" numlevel="1" lineno="126" slineno="2-57" level="4"><display>(B)</display>is 18 years old or older; and</subsection></subsection><subsection ssid="2-null-33" dnum="ii-o" numlevel="1" lineno="127" slineno="2-58" level="3" tab="1"><display>(ii)</display>is, or has been, in a dating relationship with the other party.</subsection></subsection><subsection ssid="2-null-34" dnum="b-o" numlevel="1" lineno="128" slineno="2-59" level="2"><display>(b)</display>"Dating partner" does not include an intimate partner.</subsection></subsection><subsection ssid="2-null-35" dnum="13-o" numlevel="1" lineno="129" slineno="2-60" level="1" space="false"><display>(13)</display><subsection ssid="2-null-36" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Dating relationship" means a social relationship of a romantic or intimate <ln numlevel="1" lineno="130" slineno="2-61"/>nature, or a relationship which has romance or intimacy as a goal by one or both <ln numlevel="1" lineno="131" slineno="2-62"/>parties, regardless of whether the relationship involves sexual intimacy.</subsection><subsection ssid="2-null-37" dnum="b-o" numlevel="1" lineno="132" slineno="2-63" level="2"><display>(b)</display>"Dating relationship" does not include casual fraternization in a business, <ln numlevel="1" lineno="133" slineno="2-64"/>educational, or social context.</subsection><subsection ssid="2-null-38" dnum="c-o" numlevel="1" lineno="134" slineno="2-65" level="2"><display>(c)</display>In determining, based on a totality of the circumstances, whether a dating <ln numlevel="1" lineno="135" slineno="2-66"/>relationship exists:<subsection ssid="2-null-39" dnum="i-o" numlevel="1" lineno="136" slineno="2-67" level="3"><display>(i)</display>all relevant factors shall be considered, including:<subsection ssid="2-null-40" dnum="A-o" numlevel="1" lineno="137" slineno="2-68" level="4"><display>(A)</display>whether the parties developed interpersonal bonding above a mere casual <ln numlevel="1" lineno="138" slineno="2-69"/>fraternization;</subsection><subsection ssid="2-null-41" dnum="B-o" numlevel="1" lineno="139" slineno="2-70" level="4"><display>(B)</display>the length of the parties' relationship;</subsection><subsection ssid="2-null-42" dnum="C-o" numlevel="1" lineno="140" slineno="2-71" level="4"><display>(C)</display>the nature and the frequency of the parties' interactions, including <ln numlevel="1" lineno="141" slineno="2-72"/>communications indicating that the parties intended to begin a dating <ln numlevel="1" lineno="142" slineno="2-73"/>relationship;</subsection><subsection ssid="2-null-43" dnum="D-o" numlevel="1" lineno="143" slineno="2-74" level="4"><display>(D)</display>the ongoing expectations of the parties, individual or jointly, with respect to <ln numlevel="1" lineno="144" slineno="2-75"/>the relationship;</subsection><subsection ssid="2-null-44" dnum="E-o" numlevel="1" lineno="145" slineno="2-76" level="4"><display>(E)</display>whether, by statement or conduct, the parties demonstrated an affirmation of <ln numlevel="1" lineno="146" slineno="2-77"/>their relationship to others; and</subsection><subsection ssid="2-null-45" dnum="F-o" numlevel="1" lineno="147" slineno="2-78" level="4"><display>(F)</display>whether other reasons exist that support or detract from a finding that a dating <ln numlevel="1" lineno="148" slineno="2-79"/>relationship exists; and</subsection></subsection><subsection ssid="2-null-46" dnum="ii-o" numlevel="1" lineno="149" slineno="2-80" level="3"><display>(ii)</display>it is not necessary that all, or a particular number, of the factors described in <ln numlevel="1" lineno="150" slineno="2-81"/>Subsection <xref depth="4" refnumber="78B-7-102(13)(c)(i)">(13)(c)(i)</xref> are found to support the existence of a dating relationship.</subsection></subsection></subsection><subsection ssid="2-null-47" dnum="14-o" numlevel="1" lineno="151" slineno="2-82" level="1"><display>(14)</display>"Dating violence" means:<subsection ssid="2-null-48" dnum="a-o" numlevel="1" lineno="152" slineno="2-83" level="2"><display>(a)</display>a criminal offense involving violence or physical harm, or threat of violence or <ln numlevel="1" lineno="153" slineno="2-84"/>physical harm, when committed by an individual against a dating partner; or</subsection><subsection ssid="2-null-49" dnum="b-o" numlevel="1" lineno="154" slineno="2-85" level="2"><display>(b)</display>an attempt, a conspiracy, or a solicitation by an individual to commit a criminal <ln numlevel="1" lineno="155" slineno="2-86"/>offense involving violence or physical harm against a dating partner of the individual.</subsection></subsection><subsection ssid="2-null-50" dnum="15-o" numlevel="1" lineno="156" slineno="2-87" level="1"><display>(15)</display>"Domestic violence" means the same as that term is defined in Section <xref depth="3" refnumber="77-36-1" start="0">77-36-1</xref>.</subsection><subsection ssid="2-null-51" dnum="16-o" numlevel="1" lineno="157" slineno="2-88" level="1"><display>(16)</display>"Ex parte civil protective order" means an order issued without notice to the <ln numlevel="1" lineno="158" slineno="2-89"/>respondent under:<subsection ssid="2-null-52" dnum="a-o" numlevel="1" lineno="159" slineno="2-90" level="2"><display>(a)</display><xref depth="2" refnumber="78B-7-2" start="2">Part 2, Child Protective Orders</xref>;</subsection><subsection ssid="2-null-53" dnum="b-o" numlevel="1" lineno="160" slineno="2-91" level="2"><display>(b)</display><xref depth="2" refnumber="78B-7-4" start="2">Part 4, Dating Violence Protective Orders</xref>;</subsection><subsection ssid="2-null-54" dnum="c-o" numlevel="1" lineno="161" slineno="2-92" level="2"><display>(c)</display><xref depth="2" refnumber="78B-7-5" start="2">Part 5, Sexual Violence Protective Orders</xref>;</subsection><subsection ssid="2-null-55" dnum="d-o" numlevel="1" lineno="162" slineno="2-93" level="2"><display>(d)</display><xref depth="2" refnumber="78B-7-6" start="2">Part 6, Cohabitant Abuse Protective Orders</xref>; or</subsection><subsection ssid="2-null-56" dnum="e-o" numlevel="1" lineno="163" slineno="2-94" level="2"><display>(e)</display><xref depth="2" refnumber="78B-7-11" start="2">Part 11, Workplace Violence Protective Orders</xref>.</subsection></subsection><subsection ssid="2-null-57" dnum="17-o" numlevel="1" lineno="164" slineno="2-95" level="1"><display>(17)</display>"Ex parte civil stalking injunction" means a stalking injunction issued without notice to <ln numlevel="1" lineno="165" slineno="2-96"/>the respondent under <xref depth="2" refnumber="78B-7-7" start="2">Part 7, Civil Stalking Injunctions</xref>.</subsection><subsection ssid="2-null-58" dnum="18-o" numlevel="1" lineno="166" slineno="2-97" level="1"><display>(18)</display>"Foreign protection order" means:<subsection ssid="2-null-59" dnum="a-o" numlevel="1" lineno="167" slineno="2-98" level="2"><display>(a)</display> the same as that term is defined in Section <xref depth="3" refnumber="78B-7-302" start="0">78B-7-302</xref>; or</subsection><subsection ssid="2-null-60" dnum="b-o" numlevel="1" lineno="168" slineno="2-99" level="2"><display>(b)</display>a Canadian domestic violence protection order.</subsection></subsection><subsection ssid="2-null-61" dnum="19-o" numlevel="1" lineno="169" slineno="2-100" level="1"><display>(19)</display>"Household animal" means an animal that is tamed and kept as a pet.</subsection><subsection ssid="2-null-62" dnum="20-o" numlevel="1" lineno="170" slineno="2-101" level="1"><display>(20)</display>"Intimate partner" means the same as that term is defined in 18 U.S.C.
