Peck</sponsorhead><otherSponsorhead>Senate Sponsor: Brady Brammer</otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill amends provisions relating to liability for obscenity, a child sex doll, or child <ln numlevel="1" lineno="6" slineno="0-6"/>sexual abuse material.</gd><hphead lineno="7">Highlighted Provisions:</hphead><hp numlevel="1" lineno="8" slineno="0-8">This bill:<hl numlevel="1" lineno="9" slineno="0-9" level="1">defines terms;</hl><hl numlevel="1" lineno="10" slineno="0-10" level="1">provides that an individual has a cause of action if a person exposes the individual to or <ln numlevel="1" lineno="11" slineno="0-11"/>depicts the individual in obscenity or child sexual abuse material;</hl><hl numlevel="1" lineno="12" slineno="0-12" level="1">provides that an individual has a cause of action if a person depicts or intends to depict <ln numlevel="1" lineno="13" slineno="0-13"/>the individual's likeness as a minor on a child sex doll;</hl><hl numlevel="1" lineno="14" slineno="0-14" level="1">provides requirements for an individual bringing an action under provisions this bill <ln numlevel="1" lineno="15" slineno="0-15"/>enacts;</hl><hl numlevel="1" lineno="16" slineno="0-16" level="1">provides the relief a court may grant an individual bringing an action under the provisions <ln numlevel="1" lineno="17" slineno="0-17"/>this bill enacts;</hl><hl numlevel="1" lineno="18" slineno="0-18" level="1">provides that an entity that provides access to the internet is not liable under the <ln numlevel="1" lineno="19" slineno="0-19"/>provisions this bill enacts, if the entity did not create the content;</hl><hl numlevel="1" lineno="20" slineno="0-20" level="1">authorizes an individual to bring an action regardless of whether conduct has resulted in a <ln numlevel="1" lineno="21" slineno="0-21"/>criminal conviction;</hl><hl numlevel="1" lineno="22" slineno="0-22" level="1">provides a severability clause; and</hl><hl numlevel="1" lineno="23" slineno="0-23" level="1">makes technical changes.</hl></hp><moni numlevel="1" lineno="24" slineno="0-24" display="none">Money Appropriated in this Bill:</moni><moniNone lineno="25">None</moniNone><oc numlevel="1" lineno="26" slineno="0-26">Other Special Clauses:</oc><ocNone lineno="27">None</ocNone><sa numlevel="1" lineno="28" slineno="0-28">Utah Code Sections Affected:<saamd numlevel="1" lineno="29" slineno="0-29"><snhead>AMENDS:</snhead><sn num="76-5b-201" src="code" uid="C76-5b-S201_2026050620260506" buid="5" sort="76 05b02010020260506" numlevel="1" lineno="30" slineno="0-30"><bold>76-5b-201</bold>, as last amended by Laws of Utah 2025, Chapters 173, 223 and 320</sn><sn num="78B-3-1001" src="code" uid="C78B-3-S1001_2026050620260506" buid="1" sort="78B03 10010020260506" numlevel="1" lineno="31" slineno="0-31"><bold>78B-3-1001</bold>, as enacted by Laws of Utah 2023, Chapter 262</sn></saamd><saent numlevel="1" lineno="32" slineno="0-32"><snhead>ENACTS:</snhead><sn num="78B-3-1004" src="code" uid="C78B-3-S1004_2026050620260506" buid="3" sort="78B03 10040020260506" numlevel="1" lineno="33" slineno="0-33"><bold>78B-3-1004</bold>, Utah Code Annotated 1953</sn></saent></sa></lt><enacthead lineno="34"/><enact numlevel="1" lineno="35" slineno="0-35">Be it enacted by the Legislature of the state of Utah:</enact><bdy><bsec buid="5" num="76-5b-201" type="amend" src="code" uid="C76-5b-S201_2026050620260506" sort="76 05b02010020260506" numlevel="1" lineno="36" slineno="1-1" sn="1"><section number="76-5b-201" numlevel="1" lineno="37" slineno="1-2" type="amend"><secline lineno="36">Section 1. Section <bold>76-5b-201</bold> is amended to read:</secline><catline lineno="37"><bold>76-5b-201<parens/>. Sexual exploitation of a minor -- Offenses.</bold></catline><subsection ssid="5-null-1" dnum="1-o" numlevel="1" lineno="38" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>Terms defined in Section <xref depth="3" refnumber="76-1-101.5">76-1-101.5</xref> apply to this section.</subsection><subsection ssid="5-null-2" dnum="2-o" numlevel="1" lineno="39" slineno="1-4" level="1"><display>(2)</display>An actor commits sexual exploitation of a minor when the actor knowingly possesses, <ln numlevel="1" lineno="40" slineno="1-5"/>views, accesses with the intent to view, or maintains access with the intent to view, child <ln numlevel="1" lineno="41" slineno="1-6"/>sexual abuse material.</subsection><subsection ssid="5-null-3" dnum="3-o" numlevel="1" lineno="42" slineno="1-7" level="1" space="false"><display>(3)</display><subsection ssid="5-null-4" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A violation of Subsection <xref depth="4" refnumber="76-5b-201(2)">(2)</xref> is a second degree felony.</subsection><subsection ssid="5-null-5" dnum="b-o" numlevel="1" lineno="43" slineno="1-8" level="2"><display>(b)</display>It is a separate offense under this section:<subsection ssid="5-null-6" dnum="i-o" numlevel="1" lineno="44" slineno="1-9" level="3"><display>(i)</display>for each minor depicted in the child sexual abuse material; and</subsection><subsection ssid="5-null-7" dnum="ii-o" numlevel="1" lineno="45" slineno="1-10" level="3"><display>(ii)</display>for each time the same minor is depicted in different child sexual abuse material.</subsection></subsection></subsection><subsection ssid="5-null-8" dnum="4-o" numlevel="1" lineno="46" slineno="1-11" level="1"><display>(4)</display>For a charge of violating this section, it is an affirmative defense that:<subsection ssid="5-null-9" dnum="a-o" numlevel="1" lineno="47" slineno="1-12" level="2"><display>(a)</display>the defendant:<subsection ssid="5-null-10" dnum="i-o" numlevel="1" lineno="48" slineno="1-13" level="3"><display>(i)</display>did not solicit the child sexual abuse material from the minor depicted in the child <ln numlevel="1" lineno="49" slineno="1-14"/>sexual abuse material;</subsection><subsection ssid="5-null-11" dnum="ii-o" numlevel="1" lineno="50" slineno="1-15" level="3"><display>(ii)</display>is not more than two years older than the minor depicted in the child sexual abuse <ln numlevel="1" lineno="51" slineno="1-16"/>material; and</subsection><subsection ssid="5-null-12" dnum="iii-o" numlevel="1" lineno="52" slineno="1-17" level="3"><display>(iii)</display>upon request of a law enforcement agent or the minor depicted in the child <ln numlevel="1" lineno="53" slineno="1-18"/>sexual abuse material, removes from an electronic device or destroys the child <ln numlevel="1" lineno="54" slineno="1-19"/>sexual abuse material and all copies of the child sexual abuse material in the <ln numlevel="1" lineno="55" slineno="1-20"/>defendant's possession; and</subsection></subsection><subsection ssid="5-null-13" dnum="b-o" numlevel="1" lineno="56" slineno="1-21" level="2"><display>(b)</display>the child sexual abuse material does not depict an offense under Chapter 5, Part 4, <ln numlevel="1" lineno="57" slineno="1-22"/>Sexual Offenses, other than Section <xref depth="3" refnumber="76-5-417">76-5-417</xref>, <xref depth="3" refnumber="76-5-418">76-5-418</xref>, <xref depth="3" refnumber="76-5-419">76-5-419</xref>, or <xref depth="3" refnumber="76-5-420">76-5-420</xref>.</subsection></subsection><subsection ssid="5-null-14" dnum="5-o" numlevel="1" lineno="58" slineno="1-23" level="1"><display>(5)</display>In proving a violation of this section in relation to an identifiable minor, proof of the <ln numlevel="1" lineno="59" slineno="1-24"/>actual identity of the identifiable minor is not required.</subsection><subsection ssid="5-null-15" dnum="6-o" numlevel="1" lineno="60" slineno="1-25" level="1"><display>(6)</display>The following are not criminally or civilly liable under this section when acting in good <ln numlevel="1" lineno="61" slineno="1-26"/>faith compliance with Section <xref depth="3" refnumber="77-4-201">77-4-201</xref><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both"> or <xref depth="3" refnumber="78B-3-1004">78B-3-1004</xref></amend>:<subsection ssid="5-null-16" dnum="a-o" numlevel="1" lineno="62" slineno="1-27" level="2"><display>(a)</display>an entity or an employee, director, officer, or agent of an entity when acting within <ln numlevel="1" lineno="63" slineno="1-28"/>the scope of employment, for the good faith performance of:<subsection ssid="5-null-17" dnum="i-o" numlevel="1" lineno="64" slineno="1-29" level="3"><display>(i)</display>reporting or data preservation duties required under federal or state law; or</subsection><subsection ssid="5-null-18" dnum="ii-o" numlevel="1" lineno="65" slineno="1-30" level="3"><display>(ii)</display>implementing a policy of attempting to prevent the presence of child sexual abuse <ln numlevel="1" lineno="66" slineno="1-31"/>material on tangible or intangible property, or of detecting and reporting the <ln numlevel="1" lineno="67" slineno="1-32"/>presence of child sexual abuse material on the property;</subsection></subsection><subsection ssid="5-null-19" dnum="b-o" numlevel="1" lineno="68" slineno="1-33" level="2"><display>(b)</display>a law enforcement officer, a civilian employee of a law enforcement agency, or an <ln numlevel="1" lineno="69" slineno="1-34"/>independent contractor who is contracted with a law enforcement agency, acting <ln numlevel="1" lineno="70" slineno="1-35"/>within the scope of a criminal investigation;</subsection><subsection ssid="5-null-20" dnum="c-o" numlevel="1" lineno="71" slineno="1-36" level="2"><display>(c)</display>an employee of a court who may be required to view child sexual abuse material <ln numlevel="1" lineno="72" slineno="1-37"/>during the course of and within the scope of the employee's employment;</subsection><subsection ssid="5-null-21" dnum="d-o" numlevel="1" lineno="73" slineno="1-38" level="2"><display>(d)</display>a juror who may be required to view child sexual abuse material during the course of <ln numlevel="1" lineno="74" slineno="1-39"/>the individual's service as a juror;</subsection><subsection ssid="5-null-22" dnum="e-o" numlevel="1" lineno="75" slineno="1-40" level="2"><display>(e)</display>an attorney or <amend anum="0" ea="amend" pairid="11" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="both">agent or </amend>employee of an attorney who is required to view child sexual <ln numlevel="1" lineno="76" slineno="1-41"/>abuse material during the course of a judicial process and while acting within the <ln numlevel="1" lineno="77" slineno="1-42"/>scope of employment<amend anum="0" ea="amend" pairid="12" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both"> or agency relationship</amend>;</subsection><subsection ssid="5-null-23" dnum="f-o" numlevel="1" lineno="78" slineno="1-43" level="2"><display>(f)</display>an employee of the Department of Health and Human Services who is required to <ln numlevel="1" lineno="79" slineno="1-44"/>view child sexual abuse material within the scope of the employee's employment;</subsection><subsection ssid="5-null-24" dnum="g-o" numlevel="1" lineno="80" slineno="1-45" level="2"><display>(g)</display>an employee, independent contractor, or designated interviewer of a Children's <ln numlevel="1" lineno="81" slineno="1-46"/>Justice Center, who is required to view child sexual abuse material within the scope <ln numlevel="1" lineno="82" slineno="1-47"/>of the employee's, independent contractor's, or designated interviewer's scope of <ln numlevel="1" lineno="83" slineno="1-48"/>employment or assignment;<amend anum="0" ea="amend" pairid="14" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="both"> or</amend></subsection><subsection ssid="5-null-25" dnum="h-o" numlevel="1" lineno="84" slineno="1-49" level="2"><display>(h)</display>an attorney who is required to view child sexual abuse material within the scope of <ln numlevel="1" lineno="85" slineno="1-50"/>the attorney's responsibility to represent the Department of Health and Human <ln numlevel="1" lineno="86" slineno="1-51"/>Services, including the divisions and offices within the Department of Health and <ln numlevel="1" lineno="87" slineno="1-52"/>Human Services.</subsection></subsection></section></bsec><bsec buid="1" num="78B-3-1001" type="amend" src="code" uid="C78B-3-S1001_2026050620260506" sort="78B03 10010020260506" numlevel="1" lineno="88" slineno="2-1" sn="2"><section number="78B-3-1001" numlevel="1" lineno="89" slineno="2-2" type="amend"><secline lineno="88">Section 2. Section <bold>78B-3-1001</bold> is amended to read:</secline><catline lineno="89"><bold>78B-3-1001<parens/>. Definitions.</bold></catline><sectionText lineno="90"><tab/>As used in this chapter:</sectionText><subsection ssid="1-39" dnum="_-o:1-i" numlevel="1" lineno="91" slineno="2-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1025" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="54" owner="jchristopherson" level="1" amendtag="end">"Child sexual abuse material" means the same as that term is defined in Section <xref depth="3" refnumber="76-5b-103"><ln numlevel="1" lineno="93" slineno="2-6"/>76-5b-103</xref>.</amend></subsection><subsection ssid="1-null-1" dnum="1-o:3-i" numlevel="1" lineno="94" slineno="2-7" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1027" style="2" owner="o" level="1" deltag="both">(1)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1028" style="1" owner="i" level="1" amendtag="both" space="true">(3)</amend></display>"Commercial entity" includes <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="70" groupid="51" style="2" owner="jchristopherson" level="1" deltag="both">corporations, limited liability companies, <ln numlevel="1" lineno="95" slineno="2-8"/>partnerships, limited partnerships, sole proprietorships, or other legally recognized <ln numlevel="1" lineno="96" slineno="2-9"/>entities</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="67" groupid="48" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a corporation, limited liability company, partnership, sole proprietorship, or <ln numlevel="1" lineno="97" slineno="2-10"/>other legally recognized entity</amend>.</subsection><subsection ssid="1-26" dnum="_-o:4-i" numlevel="1" lineno="98" slineno="2-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1028" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="8" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="end">"Cloud service provider" means a commercial entity that offers data storage, computing <ln numlevel="1" lineno="99" slineno="2-12"/>power, or other digital infrastructure resources to a person through the internet.</amend></subsection><subsection ssid="1-null-2" dnum="2-o:5-i" numlevel="1" lineno="100" slineno="2-13" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1029" style="2" owner="o" level="1" deltag="both">(2)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1030" style="1" owner="i" level="1" amendtag="both" space="true">(5)</amend></display>"Digitized identification card" means a data file available on any mobile device <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="82" groupid="62" style="2" owner="jchristopherson" level="1" deltag="both"><ln numlevel="1" lineno="101" slineno="2-14"/>which</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="79" groupid="59" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">that</amend> has connectivity to the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="119" groupid="97" style="2" owner="jchristopherson" level="1" deltag="both">Internet</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="117" groupid="95" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">internet</amend> through a state-approved application <ln numlevel="1" lineno="102" slineno="2-15"/>that<amend anum="0" ea="amend" pairid="80" groupid="60" style="1" owner="jchristopherson" level="1" amendtag="both">:</amend><subsection ssid="1-42" dnum="_-o:a-i" numlevel="1" lineno="103" slineno="2-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1030" style="1" owner="i" level="1" amendtag="both">(a)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="90" groupid="69" style="2" owner="jchristopherson" level="1" deltag="both"> </amend><amendoutend style="2"/>allows the mobile device to download the data file from a state agency or an <ln numlevel="1" lineno="104" slineno="2-17"/>authorized agent of a state agency that contains all of the data elements visible on the <ln numlevel="1" lineno="105" slineno="2-18"/>face and back of a license or identification card<amend anum="0" ea="amend" pairid="89" groupid="68" style="1" owner="jchristopherson" level="1" amendtag="both">;</amend> and<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="91" groupid="70" style="2" owner="jchristopherson" level="1" deltag="both"> </amend><amendoutend style="2"/></subsection><subsection ssid="1-43" dnum="_-o:b-i" numlevel="1" lineno="106" slineno="2-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1031" style="1" owner="i" level="1" amendtag="both">(b)</amend></display>displays the current status of the license or identification card.</subsection></subsection><subsection ssid="1-null-3" dnum="3-o:6-i" numlevel="1" lineno="107" slineno="2-20" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1032" style="2" owner="o" level="1" deltag="both">(3)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1033" style="1" owner="i" level="1" amendtag="both" space="true">(6)</amend></display>"Distribute" means to issue, sell, give, provide, deliver, transfer, transmute, <ln numlevel="1" lineno="108" slineno="2-21"/>circulate, or disseminate by any means.</subsection><subsection ssid="1-null-4" dnum="4-o:7-i" numlevel="1" lineno="109" slineno="2-22" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1033" style="2" owner="o" level="1" deltag="both">(4)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1034" style="1" owner="i" level="1" amendtag="both" space="true">(7)</amend></display>"Internet" means the international computer network of both federal and <ln numlevel="1" lineno="110" slineno="2-23"/>non-federal interoperable packet switched data networks.</subsection><subsection ssid="1-27" dnum="_-o:8-i" numlevel="1" lineno="111" slineno="2-24" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1034" style="1" owner="i" level="1" amendtag="start">(8)</amend></display><amend anum="0" ea="amend" pairid="9" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="end">"Internet service provider" means a commercial entity that connects a person to the <ln numlevel="1" lineno="112" slineno="2-25"/>internet by providing or installing technology including cable, wireless, or fiber-optic <ln numlevel="1" lineno="113" slineno="2-26"/>technology.</amend></subsection><subsection ssid="1-null-5" dnum="5-o:9-i" numlevel="1" lineno="114" slineno="2-27" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1035" style="2" owner="o" level="1" deltag="both">(5)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1036" style="1" owner="i" level="1" amendtag="both" space="true">(9)</amend></display>"Material harmful to minors" <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="71" groupid="52" style="2" owner="jchristopherson" level="1" deltag="both">is defined as all of the following</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="68" groupid="49" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">means</amend>:<subsection ssid="1-null-6" dnum="a-o" numlevel="1" lineno="115" slineno="2-28" level="2"><display>(a)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="103" groupid="82" style="2" owner="jchristopherson" level="1" deltag="both">any </amend><amendoutend style="2"/>material that the average person, applying contemporary community standards, <ln numlevel="1" lineno="116" slineno="2-29"/>would find, taking the material as a whole and with respect to minors, is designed to <ln numlevel="1" lineno="117" slineno="2-30"/>appeal to, or is designed to pander to, the prurient interest;</subsection><subsection ssid="1-null-7" dnum="b-o" numlevel="1" lineno="118" slineno="2-31" level="2"><display>(b)</display>material that exploits, is devoted to, or principally consists of descriptions of actual, <ln numlevel="1" lineno="119" slineno="2-32"/>simulated, or animated display or depiction of any of the following, in a manner <ln numlevel="1" lineno="120" slineno="2-33"/>patently offensive with respect to minors:<subsection ssid="1-null-8" dnum="i-o" numlevel="1" lineno="121" slineno="2-34" level="3"><display>(i)</display>pubic hair, anus, vulva, genitals, or nipple of the female breast;</subsection><subsection ssid="1-null-9" dnum="ii-o" numlevel="1" lineno="122" slineno="2-35" level="3"><display>(ii)</display>touching, caressing, or fondling of nipples, breasts, buttocks, anuses, or genitals; <ln numlevel="1" lineno="123" slineno="2-36"/>or</subsection><subsection ssid="1-null-10" dnum="iii-o" numlevel="1" lineno="124" slineno="2-37" level="3"><display>(iii)</display>sexual intercourse, masturbation, sodomy, bestiality, oral copulation, <ln numlevel="1" lineno="125" slineno="2-38"/>flagellation, excretory functions, exhibitions, or any other sexual act; and</subsection></subsection><subsection ssid="1-null-11" dnum="c-o" numlevel="1" lineno="126" slineno="2-39" level="2"><display>(c)</display>the material taken as a whole lacks serious literary, artistic, political, or scientific <ln numlevel="1" lineno="127" slineno="2-40"/>value for minors.</subsection></subsection><subsection ssid="1-null-12" dnum="6-o:10-i" numlevel="1" lineno="128" slineno="2-41" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1042" style="2" owner="o" level="1" deltag="both">(6)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1043" style="1" owner="i" level="1" amendtag="both" space="true">(10)</amend></display>"Minor" means <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="72" groupid="53" style="2" owner="jchristopherson" level="1" deltag="both">any person</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="69" groupid="50" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">an individual</amend> under 18 years old.</subsection><subsection ssid="1-null-13" dnum="7-o:11-i" numlevel="1" lineno="129" slineno="2-42" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1043" style="2" owner="o" level="1" deltag="both">(7)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1044" style="1" owner="i" level="1" amendtag="both" space="true">(11)</amend></display>"News-gathering organization" means any of the following:<subsection ssid="1-null-14" dnum="a-o" numlevel="1" lineno="130" slineno="2-43" level="2"><display>(a)</display>an employee of a newspaper, news publication, or news source, printed or on an <ln numlevel="1" lineno="131" slineno="2-44"/>online or mobile platform, of current news and public interest, while operating as an <ln numlevel="1" lineno="132" slineno="2-45"/>employee as provided in this <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="105" groupid="84" style="2" owner="jchristopherson" level="1" deltag="both">subsection</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="98" groupid="77" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Subsection <xref depth="4" refnumber="78B-3-1001(11)">(11)</xref></amend>, who can provide <ln numlevel="1" lineno="133" slineno="2-46"/>documentation of <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="107" groupid="86" style="2" owner="jchristopherson" level="1" deltag="both">such</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="99" groupid="78" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the</amend> employment with the newspaper, news publication, or <ln numlevel="1" lineno="134" slineno="2-47"/>news source; or</subsection><subsection ssid="1-null-15" dnum="b-o" numlevel="1" lineno="135" slineno="2-48" level="2"><display>(b)</display>an employee of a radio broadcast station, television broadcast station, cable <ln numlevel="1" lineno="136" slineno="2-49"/>television operator, or wire service while operating as an employee as provided in <ln numlevel="1" lineno="137" slineno="2-50"/>this <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="109" groupid="88" style="2" owner="jchristopherson" level="1" deltag="both">subsection</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="100" groupid="79" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Subsection <xref depth="4" refnumber="78B-3-1001(11)">(11)</xref></amend>, who can provide documentation of <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="111" groupid="90" style="2" owner="jchristopherson" level="1" deltag="both">such</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="101" groupid="80" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the</amend> <ln numlevel="1" lineno="138" slineno="2-51"/>employment.</subsection></subsection><subsection ssid="1-28" dnum="_-o:12-i" numlevel="1" lineno="139" slineno="2-52" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1046" style="1" owner="i" level="1" amendtag="start">(12)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="end">"Obscenity" means a material or performance that:</amend><subsection ssid="1-32" dnum="_-o:a-i" numlevel="1" lineno="140" slineno="2-53" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1047" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="27" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="end">the average individual, applying contemporary community standards, finds that, <ln numlevel="1" lineno="141" slineno="2-54"/>taken as a whole, the material or performance appeals to prurient interest in sex;</amend></subsection><subsection ssid="1-33" dnum="_-o:b-i" numlevel="1" lineno="142" slineno="2-55" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1048" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="32" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="end">is patently offensive in the description or depiction of nudity, sexual conduct, sexual <ln numlevel="1" lineno="143" slineno="2-56"/>excitement, sadomasochistic abuse, or excretion; and</amend></subsection><subsection ssid="1-34" dnum="_-o:c-i" numlevel="1" lineno="144" slineno="2-57" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1049" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="37" groupid="28" style="1" owner="jchristopherson" level="1" amendtag="end">taken as a whole, does not have serious literary, artistic, political, or scientific value.</amend></subsection></subsection><subsection ssid="1-null-16" dnum="8-o:13-i" numlevel="1" lineno="145" slineno="2-58" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1050" style="2" owner="o" level="1" deltag="both">(8)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1051" style="1" owner="i" level="1" amendtag="both" space="true">(13)</amend></display>"Publish" means to communicate or make information available to another <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="113" groupid="92" style="2" owner="jchristopherson" level="1" deltag="both">person</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="102" groupid="81" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="146" slineno="2-59"/>individual</amend> or entity on a publicly available <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="121" groupid="99" style="2" owner="jchristopherson" level="1" deltag="both">Internet </amend><amendoutend style="2"/>website.</subsection><subsection ssid="1-null-17" dnum="9-o:14-i" numlevel="1" lineno="147" slineno="2-60" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1051" style="2" owner="o" level="1" deltag="both">(9)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1052" style="1" owner="i" level="1" amendtag="both" space="true">(14)</amend></display>"Reasonable age verification methods" means verifying that the person seeking to <ln numlevel="1" lineno="148" slineno="2-61"/>access the material is 18 years old or older by using any of the following methods:<subsection ssid="1-null-18" dnum="a-o" numlevel="1" lineno="149" slineno="2-62" level="2"><display>(a)</display>use of a digitized information card as defined in this section;</subsection><subsection ssid="1-null-19" dnum="b-o" numlevel="1" lineno="150" slineno="2-63" level="2"><display>(b)</display>verification through an independent, third-party age verification service that <ln numlevel="1" lineno="151" slineno="2-64"/>compares the personal information entered by the individual who is seeking access to <ln numlevel="1" lineno="152" slineno="2-65"/>the material that is available from a commercially available database, or aggregate of <ln numlevel="1" lineno="153" slineno="2-66"/>databases, that is regularly used by government agencies and businesses for the <ln numlevel="1" lineno="154" slineno="2-67"/>purpose of age and identity verification; or</subsection><subsection ssid="1-null-20" dnum="c-o" numlevel="1" lineno="155" slineno="2-68" level="2"><display>(c)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="124" groupid="102" style="2" owner="jchristopherson" level="1" deltag="both">any </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="118" groupid="96" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a </amend>commercially reasonable method that relies on public or private transactional <ln numlevel="1" lineno="156" slineno="2-69"/>data to verify the age of the person attempting to access the material.</subsection></subsection><subsection ssid="1-30" dnum="_-o:15-i" numlevel="1" lineno="157" slineno="2-70" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1055" style="1" owner="i" level="1" amendtag="start">(15)</amend></display><amend anum="0" ea="amend" pairid="22" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="end">"Search engine" means an internet service that enables an individual to search for <ln numlevel="1" lineno="158" slineno="2-71"/>information on the internet by entering a search term.</amend></subsection><subsection ssid="1-null-21" dnum="10-o:16-i" numlevel="1" lineno="159" slineno="2-72" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1056" style="2" owner="o" level="1" deltag="both">(10)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1057" style="1" owner="i" level="1" amendtag="both" space="true">(16)</amend></display>"Substantial portion" means more than 33-1/3% of total material on a website, <ln numlevel="1" lineno="160" slineno="2-73"/>which meets the definition of "material harmful to minors" as defined in this section.</subsection><subsection ssid="1-null-22" dnum="11-o:17-i" numlevel="1" lineno="161" slineno="2-74" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1057" style="2" owner="o" level="1" deltag="both">(11)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1058" style="1" owner="i" level="1" amendtag="both" space="true">(17)</amend></display><subsection ssid="1-null-23" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Transactional data" means a sequence of information that documents an <ln numlevel="1" lineno="162" slineno="2-75"/>exchange, agreement, or transfer between an individual, commercial entity, or third <ln numlevel="1" lineno="163" slineno="2-76"/>party used for the purpose of satisfying a request or event.</subsection><subsection ssid="1-null-24" dnum="b-o" numlevel="1" lineno="164" slineno="2-77" level="2"><display>(b)</display>"Transactional data" includes records from mortgage, education, and employment <ln numlevel="1" lineno="165" slineno="2-78"/>entities.</subsection></subsection></section></bsec><bsec buid="3" num="78B-3-1004" type="enact" src="code" uid="C78B-3-S1004_2026050620260506" sort="78B03 10040020260506" numlevel="1" lineno="166" slineno="3-1" sn="3"><section numlevel="1" lineno="167" slineno="3-2" number="78B-3-1004" type="enact"><secline lineno="166">Section 3. Section <bold>78B-3-1004</bold> is enacted to read:</secline><catline lineno="167"><bold>78B-3-1004<parens/>. Liability for obscenity, child sexual abuse material, and a child sex <ln numlevel="1" lineno="168" slineno="3-3"/>doll -- Severability.</bold></catline><subsection ssid="3-5" dnum="_-o:1-i" numlevel="1" lineno="169" slineno="3-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1060" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="end">An individual has a right of action against a person that publishes or distributes <ln numlevel="1" lineno="170" slineno="3-5"/>obscenity or child sexual abuse material on the internet within the state, or possesses, <ln numlevel="1" lineno="171" slineno="3-6"/>purchases, or distributes a child sex doll in the state if:</amend><subsection ssid="3-17" dnum="_-o:a-i" numlevel="1" lineno="172" slineno="3-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1061" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="72" groupid="56" style="1" owner="jchristopherson" level="1" amendtag="end">the person is subject to personal jurisdiction in this state;</amend></subsection><subsection ssid="3-31" dnum="_-o:b-i" numlevel="1" lineno="173" slineno="3-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1062" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><subsection ssid="3-38" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1063" style="1" owner="i" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="129" groupid="97" style="1" owner="jchristopherson" level="1" amendtag="end">the obscenity, child sexual abuse material, or child sex doll depicts the <ln numlevel="1" lineno="174" slineno="3-9"/>individual or the individual's likeness;</amend></subsection><subsection ssid="3-37" dnum="_-o:ii-i" numlevel="1" lineno="175" slineno="3-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1064" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="160" groupid="117" style="1" owner="jchristopherson" level="1" amendtag="end">the person displays the obscenity or child sexual abuse material in a manner that <ln numlevel="1" lineno="176" slineno="3-11"/>makes the obscenity or child sexual abuse material accessible to the individual; or</amend></subsection><subsection ssid="3-44" dnum="_-o:iii-i" numlevel="1" lineno="177" slineno="3-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1065" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="188" groupid="137" style="1" owner="jchristopherson" level="1" amendtag="end">the person possesses, purchases, or distributes a child sex doll in the state; and</amend></subsection></subsection><subsection ssid="3-15" dnum="_-o:c-i" numlevel="1" lineno="178" slineno="3-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1066" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><subsection ssid="3-35" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1067" style="1" owner="i" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="64" groupid="50" style="1" owner="jchristopherson" level="1" amendtag="end">the individual bringing the action is a resident of this state; or</amend></subsection><subsection ssid="3-19" dnum="_-o:ii-i" numlevel="1" lineno="179" slineno="3-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1068" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="82" groupid="64" style="1" owner="jchristopherson" level="1" amendtag="end">the conduct described in Subsection <xref depth="4" refnumber="78B-3-1004(1)(b)">(1)(b)</xref> occurs in this state.</amend></subsection></subsection></subsection><subsection ssid="3-6" dnum="_-o:2-i" numlevel="1" lineno="180" slineno="3-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1069" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="22" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="end">If an individual brings an action against a person in accordance with Subsection <xref depth="4" refnumber="78B-3-1004(1)">(1)</xref>, a <ln numlevel="1" lineno="181" slineno="3-16"/>court may award the individual:</amend><subsection ssid="3-7" dnum="_-o:a-i" numlevel="1" lineno="182" slineno="3-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1070" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="27" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="end">injunctive relief;</amend></subsection><subsection ssid="3-8" dnum="_-o:b-i" numlevel="1" lineno="183" slineno="3-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1071" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="32" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="end">nominal damages;</amend></subsection><subsection ssid="3-9" dnum="_-o:c-i" numlevel="1" lineno="184" slineno="3-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1072" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="37" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="end">actual damages;</amend></subsection><subsection ssid="3-13" dnum="_-o:d-i" numlevel="1" lineno="185" slineno="3-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1073" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="54" groupid="43" style="1" owner="jchristopherson" level="1" amendtag="end">punitive damages; and</amend></subsection><subsection ssid="3-10" dnum="_-o:e-i" numlevel="1" lineno="186" slineno="3-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1074" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="42" groupid="33" style="1" owner="jchristopherson" level="1" amendtag="end">reasonable attorney fees and court costs.</amend></subsection></subsection><subsection ssid="3-56" dnum="_-o:3-i" numlevel="1" lineno="187" slineno="3-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1075" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="245" groupid="176" style="1" owner="jchristopherson" level="1" amendtag="end">No internet service provider, affiliate or subsidiary of an internet service provider, <ln numlevel="1" lineno="188" slineno="3-23"/>search engine, or cloud service provider shall be held to have violated the provisions of <ln numlevel="1" lineno="189" slineno="3-24"/>this section solely for providing access or connection to or from a website or other <ln numlevel="1" lineno="190" slineno="3-25"/>information or content on the internet, or a facility, system, or network not under that <ln numlevel="1" lineno="191" slineno="3-26"/>provider's control, including transmission, downloading, storing, or providing access, to <ln numlevel="1" lineno="192" slineno="3-27"/>the extent that the internet service provider, affiliate or subsidiary of an internet service <ln numlevel="1" lineno="193" slineno="3-28"/>provider, search engine, or cloud service provider is not responsible for the creation of <ln numlevel="1" lineno="194" slineno="3-29"/>the content of the communication that constitutes obscenity or child sexual abuse <ln numlevel="1" lineno="195" slineno="3-30"/>material.</amend></subsection><subsection ssid="3-12" dnum="_-o:4-i" numlevel="1" lineno="196" slineno="3-31" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1076" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="52" groupid="41" style="1" owner="jchristopherson" level="1" amendtag="end">An individual with a claim under this section who satisfies the applicable standards for <ln numlevel="1" lineno="197" slineno="3-32"/>joinder or class action may combine the individual's claim with one or more individuals <ln numlevel="1" lineno="198" slineno="3-33"/>with a claim under this section into one action.</amend></subsection><subsection ssid="3-34" dnum="_-o:5-i" numlevel="1" lineno="199" slineno="3-34" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1077" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="150" groupid="111" style="1" owner="jchristopherson" level="1" amendtag="end">An individual may bring an action under this section regardless of whether the action <ln numlevel="1" lineno="200" slineno="3-35"/>that gives rise to a cause of action under Subsection <xref depth="4" refnumber="78B-3-1004(1)">(1)</xref> has resulted in a criminal <ln numlevel="1" lineno="201" slineno="3-36"/>conviction.</amend></subsection><subsection ssid="3-53" dnum="_-o:6-i" numlevel="1" lineno="202" slineno="3-37" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1078" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><subsection ssid="3-54" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1079" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="235" groupid="170" style="1" owner="jchristopherson" level="1" amendtag="end">If any provision of this section or the application of any provision to any person or <ln numlevel="1" lineno="203" slineno="3-38"/>circumstance is held invalid, the remainder of this section shall be given effect <ln numlevel="1" lineno="204" slineno="3-39"/>without the invalid provision or application.</amend></subsection><subsection ssid="3-55" dnum="_-o:b-i" numlevel="1" lineno="205" slineno="3-40" ea="amend"
