Section <bold>53F-2-504</bold> is amended to read:</secline><catline lineno="25"><bold>53F-2-504<parens><paren sort="00" type="original" show="true" display="space"><effect>Effective </effect><date>07/01/26</date></paren><paren sort="00" type="original" show="true"><effect>Partially Repealed </effect><date>07/01/26</date></paren></parens>. Salary Supplement <ln numlevel="1" lineno="26" slineno="1-3"/>for Highly Needed Educators.</bold></catline><subsection ssid="5-null-1" dnum="1-o" numlevel="1" lineno="27" slineno="1-4" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="5-null-2" dnum="a-o" numlevel="1" lineno="28" slineno="1-5" level="2"><display>(a)</display>"Eligible teacher" means a teacher<amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="ahaskell" level="1" amendtag="both"> or licensed education professional, including a <ln numlevel="1" lineno="29" slineno="1-6"/>speech-language pathologist or speech-language technician,</amend> who:<subsection ssid="5-null-3" dnum="i-o" numlevel="1" lineno="30" slineno="1-7" level="3"><display>(i)</display>has a qualifying assignment;</subsection><subsection ssid="5-null-4" dnum="ii-o" numlevel="1" lineno="31" slineno="1-8" level="3"><display>(ii)</display>qualifies for the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="43" groupid="42" style="2" owner="ahaskell" level="1" deltag="both">teacher's</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="29" groupid="28" style="1" owner="ahaskell" level="1" amendtag="both" space="true">individual's</amend> assignment in accordance with an LEA's <ln numlevel="1" lineno="32" slineno="1-9"/>policy described in Subsection <xref depth="4" refnumber="53F-2-504(2)">(2)</xref>; and</subsection><subsection ssid="5-null-5" dnum="iii-o" numlevel="1" lineno="33" slineno="1-10" level="3" space="false"><display>(iii)</display><subsection ssid="5-null-6" dnum="A-o" level="4" placement="sameline"><display>(A)</display>is a new employee; or</subsection><subsection ssid="5-null-7" dnum="B-o" numlevel="1" lineno="34" slineno="1-11" level="4"><display>(B)</display>has not received an unsatisfactory rating on the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="44" groupid="43" style="2" owner="ahaskell" level="1" deltag="both">teacher's</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="30" groupid="29" style="1" owner="ahaskell" level="1" amendtag="both" space="true">individual's</amend> three <ln numlevel="1" lineno="35" slineno="1-12"/>most recent evaluations.</subsection></subsection></subsection><subsection ssid="5-null-8" dnum="b-o" numlevel="1" lineno="36" slineno="1-13" level="2"><display>(b)</display>"High-needs area" means at least two and up to five <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="8" groupid="8" style="2" owner="ahaskell" level="1" deltag="both">teaching </amend><amendoutend style="2"/>assignments that an <ln numlevel="1" lineno="37" slineno="1-14"/>LEA designates in a policy as challenging to fill or retain.</subsection><subsection ssid="5-null-9" dnum="c-o" numlevel="1" lineno="38" slineno="1-15" level="2"><display>(c)</display>"Program" means the Salary Supplement for Highly Needed Educators program.</subsection><subsection ssid="5-null-10" dnum="d-o" numlevel="1" lineno="39" slineno="1-16" level="2"><display>(d)</display>"Qualifying assignment" means <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="45" groupid="44" style="2" owner="ahaskell" level="1" deltag="both">a teacher who is assigned to a high-needs area</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="31" groupid="30" style="1" owner="ahaskell" level="1" amendtag="both" space="true">an <ln numlevel="1" lineno="40" slineno="1-17"/>assignment to a high-needs area</amend>.</subsection></subsection><subsection ssid="5-null-11" dnum="2-o" numlevel="1" lineno="41" slineno="1-18" level="1" space="false"><display>(2)</display><subsection ssid="5-null-12" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An LEA shall create a policy describing the administration of the Salary <ln numlevel="1" lineno="42" slineno="1-19"/>Supplement for Highly Needed Educators program within the LEA, including:<subsection ssid="5-null-13" dnum="i-o" numlevel="1" lineno="43" slineno="1-20" level="3" tab="1"><display>(i)</display>identifying the LEA's high-needs areas;</subsection><subsection ssid="5-null-14" dnum="ii-o" numlevel="1" lineno="44" slineno="1-21" level="3" tab="1"><display>(ii)</display>the amount of the salary supplement;</subsection><subsection ssid="5-null-15" dnum="iii-o" numlevel="1" lineno="45" slineno="1-22" level="3" tab="1"><display>(iii)</display>establishing an appeals process for <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="46" groupid="45" style="2" owner="ahaskell" level="1" deltag="both">a teacher</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="32" groupid="31" style="1" owner="ahaskell" level="1" amendtag="both" space="true">an individual</amend> to follow if the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="47" groupid="46" style="2" owner="ahaskell" level="1" deltag="both"><ln numlevel="1" lineno="46" slineno="1-23"/>teacher</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="33" groupid="32" style="1" owner="ahaskell" level="1" amendtag="both" space="true">individual</amend> does not receive a salary supplement, including:<subsection ssid="5-null-16" dnum="A-o" numlevel="1" lineno="47" slineno="1-24" level="4"><display>(A)</display>allowing <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="48" groupid="47" style="2" owner="ahaskell" level="1" deltag="both">a teacher</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="34" groupid="33" style="1" owner="ahaskell" level="1" amendtag="both" space="true">an individual</amend> to appeal eligibility as an eligible teacher <ln numlevel="1" lineno="48" slineno="1-25"/>with a qualifying assignment on the basis that the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="49" groupid="48" style="2" owner="ahaskell" level="1" deltag="both">teacher</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="35" groupid="34" style="1" owner="ahaskell" level="1" amendtag="both" space="true">individual</amend> has <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="11" groupid="11" style="2" owner="ahaskell" level="1" deltag="both">a <ln numlevel="1" lineno="49" slineno="1-26"/>teaching assignment</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="7" style="1" owner="ahaskell" level="1" amendtag="both" space="true">an assignment</amend> that is substantially equivalent to a <ln numlevel="1" lineno="50" slineno="1-27"/>high-needs area; and</subsection><subsection ssid="5-null-17" dnum="B-o" numlevel="1" lineno="51" slineno="1-28" level="4"><display>(B)</display>requiring <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="50" groupid="49" style="2" owner="ahaskell" level="1" deltag="both">a teacher</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="36" groupid="35" style="1" owner="ahaskell" level="1" amendtag="both" space="true">an individual</amend> to provide transcripts and other <ln numlevel="1" lineno="52" slineno="1-29"/>documentation to the LEA governing board in order for the LEA governing <ln numlevel="1" lineno="53" slineno="1-30"/>board to determine if the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="51" groupid="50" style="2" owner="ahaskell" level="1" deltag="both">teacher</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="37" groupid="36" style="1" owner="ahaskell" level="1" amendtag="both" space="true">individual</amend> is an eligible teacher with a <ln numlevel="1" lineno="54" slineno="1-31"/>qualifying <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="52" groupid="51" style="2" owner="ahaskell" level="1" deltag="both">teaching </amend><amendoutend style="2"/>background;</subsection></subsection><subsection ssid="5-null-18" dnum="iv-o" numlevel="1" lineno="55" slineno="1-32" level="3" tab="1"><display>(iv)</display>a process for determining if <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="54" groupid="53" style="2" owner="ahaskell" level="1" deltag="both">a teacher</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="38" groupid="37" style="1" owner="ahaskell" level="1" amendtag="both" space="true">an individual</amend> is an eligible teacher, <ln numlevel="1" lineno="56" slineno="1-33"/>including a verification process; and</subsection><subsection ssid="5-null-19" dnum="v-o" numlevel="1" lineno="57" slineno="1-34" level="3" tab="1"><display>(v)</display>a process for certifying a list of eligible teachers <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="55" groupid="54" style="2" owner="ahaskell" level="1" deltag="both">to be awarded</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="39" groupid="38" style="1" owner="ahaskell" level="1" amendtag="both" space="true">whom the LEA <ln numlevel="1" lineno="58" slineno="1-35"/>awards</amend> a salary supplement under this section.</subsection></subsection><subsection ssid="5-null-20" dnum="b-o" numlevel="1" lineno="59" slineno="1-36" level="2"><display>(b)</display>An LEA shall update the policy described in Subsection <xref depth="4" refnumber="53F-2-504(2)(a)">(2)(a)</xref> annually and provide <ln numlevel="1" lineno="60" slineno="1-37"/>notice of any changes to <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="56" groupid="55" style="2" owner="ahaskell" level="1" deltag="both">teachers</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="40" groupid="39" style="1" owner="ahaskell" level="1" amendtag="both" space="true">potential eligible teachers</amend> within the LEA.</subsection></subsection><subsection ssid="5-null-21" dnum="3-o" numlevel="1" lineno="61" slineno="1-38" level="1"><display>(3)</display>Subject to legislative appropriations and an LEA having the policy described in <ln numlevel="1" lineno="62" slineno="1-39"/>Subsection <xref depth="4" refnumber="53F-2-504(2)">(2)</xref>, the state board shall allocate funding appropriated for the Salary <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="61" groupid="58" style="2" owner="ahaskell" level="1" deltag="both"><ln numlevel="1" lineno="63" slineno="1-40"/>Supplements</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="60" groupid="57" style="1" owner="ahaskell" level="1" amendtag="both" space="true">Supplement</amend> for Highly Needed Educators program in accordance with this <ln numlevel="1" lineno="64" slineno="1-41"/>section by:<subsection ssid="5-null-22" dnum="a-o" numlevel="1" lineno="65" slineno="1-42" level="2"><display>(a)</display>for charter schools:<subsection ssid="5-null-23" dnum="i-o" numlevel="1" lineno="66" slineno="1-43" level="3"><display>(i)</display>distributing an amount that is equal to the product of:<subsection ssid="5-null-24" dnum="A-o" numlevel="1" lineno="67" slineno="1-44" level="4"><display>(A)</display>charter school enrollment on October 1 in the prior year, or, for a new charter <ln numlevel="1" lineno="68" slineno="1-45"/>school, projected enrollment for a charter school in the charter school's first <ln numlevel="1" lineno="69" slineno="1-46"/>year of operations, divided by enrollment on October 1 in public schools <ln numlevel="1" lineno="70" slineno="1-47"/>statewide in the prior year; and</subsection><subsection ssid="5-null-25" dnum="B-o" numlevel="1" lineno="71" slineno="1-48" level="4"><display>(B)</display>the total amount available for distribution; and</subsection></subsection><subsection ssid="5-null-26" dnum="ii-o" numlevel="1" lineno="72" slineno="1-49" level="3"><display>(ii)</display>allocating to each charter school:<subsection ssid="5-null-27" dnum="A-o" numlevel="1" lineno="73" slineno="1-50" level="4"><display>(A)</display>an equally divided portion of 20% of the amount described in Subsection <xref depth="4" refnumber="53F-2-504(3)(a)(i)"><ln numlevel="1" lineno="74" slineno="1-51"/>(3)(a)(i)</xref>; and</subsection><subsection ssid="5-null-28" dnum="B-o" numlevel="1" lineno="75" slineno="1-52" level="4"><display>(B)</display>80% of the amount described in Subsection <xref depth="4" refnumber="53F-2-504(3)(a)(i)">(3)(a)(i)</xref> on a per-student basis;<marker pairid="57"> and</marker></subsection></subsection></subsection><subsection ssid="5-null-29" dnum="b-o" numlevel="1" lineno="76" slineno="1-53" level="2"><display>(b)</display>for school districts and the Utah Schools for the Deaf and the Blind<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="67" groupid="61" style="2" owner="ahaskell" level="1" deltag="both">:</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="71" groupid="63" style="1" owner="ahaskell" level="1" amendtag="both" space="true">,</amend><subsection ssid="5-null-30" dnum="i-o:_-i" numlevel="1" lineno="77" slineno="1-54" ea="erase" anum="0" owner="ahaskell" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1029" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/></display>distributing the remainder of funds available for distribution after the distribution <ln numlevel="1" lineno="78" slineno="1-55"/>to charter schools under Subsection <xref depth="4" refnumber="53F-2-504(3)(a)(i)">(3)(a)(i)</xref> by allocating to each school district:<subsection ssid="5-null-31" dnum="A-o:i-i" numlevel="1" lineno="79" slineno="1-56" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1030" style="2" owner="o" level="1" deltag="both">(A)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1031" style="1" owner="i" level="1" amendtag="both" space="true">(i)</amend></display>an equally divided portion of 20% of the amount described in Subsection <xref depth="4" refnumber="53F-2-504(3)(b)(i)"><ln numlevel="1" lineno="80" slineno="1-57"/>(3)(b)(i)</xref>; and</subsection><subsection ssid="5-null-32" dnum="B-o:ii-i" numlevel="1" lineno="81" slineno="1-58" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1031" style="2" owner="o" level="1" deltag="both">(B)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1032" style="1" owner="i" level="1" amendtag="both" space="true">(ii)</amend></display>80% of the amount described in Subsection <xref depth="4" refnumber="53F-2-504(3)(b)(i)">(3)(b)(i)</xref> on a per-student basis<marker pairid="58">.</marker></subsection></subsection></subsection></subsection><subsection ssid="5-null-33" dnum="c-o:4-i" numlevel="1" lineno="82" slineno="1-59" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1032" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1033" style="1" owner="i" level="1" amendtag="both" space="true">(4)</amend></display>An LEA shall use funds described in Subsections <xref depth="4" refnumber="53F-2-504(3)(a)">(3)(a)</xref> and <xref depth="4" refnumber="53F-2-504(3)(b)">(3)(b)</xref> to pay the LEA's <ln numlevel="1" lineno="83" slineno="1-60"/>proportional part of an eligible teacher's salary supplement if:<subsection ssid="5-null-34" dnum="i-o:a-i" numlevel="1" lineno="84" slineno="1-61" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1033" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1034" style="1" owner="i" level="1" amendtag="both" space="true">(a)</amend></display>the eligible teacher is an employee of a regional education service agency, as <ln numlevel="1" lineno="85" slineno="1-62"/>defined in Section <xref depth="3" refnumber="53G-4-410">53G-4-410</xref>; and</subsection><subsection ssid="5-null-35" dnum="ii-o:b-i" numlevel="1" lineno="86" slineno="1-63" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1034" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1035" style="1" owner="i" level="1" amendtag="both" space="true">(b)</amend></display>the LEA is a member of the regional education service agency that employs the <ln numlevel="1" lineno="87" slineno="1-64"/>eligible teacher.</subsection></subsection><subsection ssid="5-null-36" dnum="4-o:5-i" numlevel="1" lineno="88" slineno="1-65" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1035" style="2" owner="o" level="1" deltag="both">(4)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1036" style="1" owner="i" level="1" amendtag="both" space="true">(5)</amend></display><subsection ssid="5-null-37" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An LEA shall include employer-paid benefits in the amount of each salary <ln numlevel="1" lineno="89" slineno="1-66"/>supplement.</subsection><subsection ssid="5-null-38" dnum="b-o" numlevel="1" lineno="90" slineno="1-67" level="2"><display>(b)</display>Employer-paid benefits are an addition to the salary supplement amount <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="5" style="2" owner="ahaskell" level="1" deltag="both">established <ln numlevel="1" lineno="91" slineno="1-68"/>by an LEA</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="ahaskell" level="1" amendtag="both" space="true">an LEA establishes</amend> under Subsection <xref depth="4" refnumber="53F-2-504(2)">(2)</xref>.</subsection></subsection><subsection ssid="5-null-39" dnum="5-o:6-i" numlevel="1" lineno="92" slineno="1-69" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1038" style="2" owner="o" level="1" deltag="both">(5)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1039" style="1" owner="i" level="1" amendtag="both" space="true">(6)</amend></display>The salary supplement is part of an eligible teacher's base pay, subject to eligible <ln numlevel="1" lineno="93" slineno="1-70"/>teacher's qualification as an eligible teacher every year, semester, or quarter.</subsection><subsection ssid="5-null-40" dnum="6-o:7-i" numlevel="1" lineno="94" slineno="1-71" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1039" style="2" owner="o" level="1" deltag="both">(6)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1040" style="1" owner="i" level="1" amendtag="both" space="true">(7)</amend></display>The state board shall annually report to the Education Interim Committee:<subsection ssid="5-null-41" dnum="a-o" numlevel="1" lineno="95" slineno="1-72" level="2"><display>(a)</display>which <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="13" groupid="13" style="2" owner="ahaskell" level="1" deltag="both">teaching </amend><amendoutend style="2"/>assignments LEAs have designated as high-needs; and</subsection><subsection ssid="5-null-42" dnum="b-o" numlevel="1" lineno="96" slineno="1-73" level="2"><display>(b)</display>the number of eligible teachers.</subsection></subsection><subsection ssid="5-null-43" dnum="7-o:8-i" numlevel="1" lineno="97" slineno="1-74" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1042" style="2" owner="o" level="1" deltag="both">(7)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1043" style="1" owner="i" level="1" amendtag="both" space="true">(8)</amend></display>An LEA may increase the amount of funds the LEA provides to the LEA's<amend anum="0" ea="amend" pairid="41" groupid="40" style="1" owner="ahaskell" level="1" amendtag="both"> eligible</amend> <ln numlevel="1" lineno="98" slineno="1-75"/>teachers under the program if the LEA:<subsection ssid="5-null-44" dnum="a-o" numlevel="1" lineno="99" slineno="1-76" level="2"><display>(a)</display>first ensures proper distribution of funds the LEA receives under the program to the <ln numlevel="1" lineno="100" slineno="1-77"/>the LEA's <amend anum="0" ea="amend" pairid="42" groupid="41" style="1" owner="ahaskell" level="1" amendtag="both">eligible </amend>teachers; and</subsection><subsection ssid="5-null-45" dnum="b-o" numlevel="1" lineno="101" slineno="1-78" level="2"><display>(b)</display>experiences a carry forward or leftover balance.</subsection></subsection></section></bsec><bsec buid="1" num="53F-2-527" type="amend" src="code" uid="C53F-2-S527_2026070120260701" sort="53F02 05270020260701" numlevel="1" lineno="102" slineno="2-1" sn="2"><section number="53F-2-527" numlevel="1" lineno="103" slineno="2-2" type="amend"><secline lineno="102">Section 2. Section <bold>53F-2-527</bold> is amended to read:</secline><catline lineno="103"><bold>53F-2-527<parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>07/01/26</date></paren></parens>. Appropriations for teaching supplies and <ln numlevel="1" lineno="104" slineno="2-3"/>materials.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="105" slineno="2-4" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="1-null-2" dnum="a-o" numlevel="1" lineno="106" slineno="2-5" level="2"><display>(a)</display>"Classroom teacher" means a teacher <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="7" groupid="7" style="2" owner="ahaskell" level="1" deltag="both">who</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="5" groupid="5" style="1" owner="ahaskell" level="1" amendtag="both" space="true">or licensed education professional, <ln numlevel="1" lineno="107" slineno="2-6"/>including a speech-language pathologist or speech-language technician, that</amend>:<subsection ssid="1-null-3" dnum="i-o" numlevel="1" lineno="108" slineno="2-7" level="3"><display>(i)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="9" style="2" owner="ahaskell" level="1" deltag="both">is assigned by an LEA in </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="6" groupid="6" style="1" owner="ahaskell" level="1" amendtag="both" space="true">an LEA assigns to </amend>a permanent <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="17" groupid="16" style="2" owner="ahaskell" level="1" deltag="both">teacher</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="14" groupid="13" style="1" owner="ahaskell" level="1" amendtag="both" space="true">instructional <ln numlevel="1" lineno="109" slineno="2-8"/>or related service</amend> position filled by one teacher<amend anum="0" ea="amend" pairid="15" groupid="14" style="1" owner="ahaskell" level="1" amendtag="both">, speech-language pathologist, <ln numlevel="1" lineno="110" slineno="2-9"/>speech-language technician,</amend> or two or more job-sharing teachers <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="43" groupid="40" style="2" owner="ahaskell" level="1" deltag="both">employed by an <ln numlevel="1" lineno="111" slineno="2-10"/>LEA</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="41" groupid="38" style="1" owner="ahaskell" level="1" amendtag="both" space="true">an LEA employs</amend>;</subsection><subsection ssid="1-null-4" dnum="ii-o" numlevel="1" lineno="112" slineno="2-11" level="3"><display>(ii)</display>is licensed and paid on an LEA's salary schedule;</subsection><subsection ssid="1-null-5" dnum="iii-o" numlevel="1" lineno="113" slineno="2-12" level="3"><display>(iii)</display>is employed for an entire contract period; and</subsection><subsection ssid="1-null-6" dnum="iv-o" numlevel="1" lineno="114" slineno="2-13" level="3"><display>(iv)</display>is primarily responsible to provide instruction<amend anum="0" ea="amend" pairid="16" groupid="15" style="1" owner="ahaskell" level="1" amendtag="both">, therapy,</amend> or a combination of <ln numlevel="1" lineno="115" slineno="2-14"/>instructional<amend anum="0" ea="amend" pairid="20" groupid="18" style="1" owner="ahaskell" level="1" amendtag="both">, therapeutic,</amend> and counseling services to <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="25" groupid="23" style="2" owner="ahaskell" level="1" deltag="both">students in public schools</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="23" groupid="21" style="1" owner="ahaskell" level="1" amendtag="both" space="true">a <ln numlevel="1" lineno="116" slineno="2-15"/>student in a public school</amend>.</subsection></subsection><subsection ssid="1-null-7" dnum="b-o" numlevel="1" lineno="117" slineno="2-16" level="2"><display>(b)</display>"Teaching supplies and materials" means consumable and non-consumable items <ln numlevel="1" lineno="118" slineno="2-17"/>that are used for educational<amend anum="0" ea="amend" pairid="24" groupid="22" style="1" owner="ahaskell" level="1" amendtag="both"> or therapeutic</amend> purposes by <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="35" groupid="32" style="2" owner="ahaskell" level="1" deltag="both">teachers</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="31" groupid="28" style="1" owner="ahaskell" level="1" amendtag="both" space="true">a classroom teacher</amend> <ln numlevel="1" lineno="119" slineno="2-18"/>in <amend anum="0" ea="amend" pairid="32" groupid="29" style="1" owner="ahaskell" level="1" amendtag="both">a </amend>classroom <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="36" groupid="33" style="2" owner="ahaskell" level="1" deltag="both">activities</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="33" groupid="30" style="1" owner="ahaskell" level="1" amendtag="both" space="true">activity</amend> that <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="38" groupid="35" style="2" owner="ahaskell" level="1" deltag="both">are approved by the LEA</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="34" groupid="31" style="1" owner="ahaskell" level="1" amendtag="both" space="true">an LEA approves</amend>.</subsection></subsection><subsection ssid="1-null-8" dnum="2-o" numlevel="1" lineno="120" slineno="2-19" level="1"><display>(2)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="44" groupid="41" style="2" owner="ahaskell" level="1" deltag="both">For the fiscal year that begins on or after July 1, 2024, and except </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="42" groupid="39" style="1" owner="ahaskell" level="1" amendtag="both" space="true">Except </amend>as provided <ln numlevel="1" lineno="121" slineno="2-20"/>in Subsection <xref tempid="458" depth="4" refnumber="53F-2-527(3)">(3)</xref>, the state board shall distribute money appropriated for teaching <ln numlevel="1" lineno="122" slineno="2-21"/>supplies and materials as follows:<subsection ssid="1-null-9" dnum="a-o" numlevel="1" lineno="123" slineno="2-22" level="2"><display>(a)</display>$500 to each classroom teacher position for pre-kindergarten special education and <ln numlevel="1" lineno="124" slineno="2-23"/>kindergarten through grade 6; and</subsection><subsection ssid="1-null-10" dnum="b-o" numlevel="1" lineno="125" slineno="2-24" level="2"><display>(b)</display>$250 to each classroom teacher position for grades 7 through 12.</subsection></subsection><subsection ssid="1-null-11" dnum="3-o" numlevel="1" lineno="126" slineno="2-25" level="1"><display>(3)</display>If funding is insufficient to provide the per-teacher amounts described in Subsection <xref refnumber="53F-2-527(2)" depth="4">(2)</xref>, <ln numlevel="1" lineno="127" slineno="2-26"/>the state board may proportionally adjust the per-teacher amount based on the amount of <ln numlevel="1" lineno="128" slineno="2-27"/>available funding.</subsection></section></bsec><bsec buid="8" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="129" slineno="3-1" sn="3"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="129">Section 3.  <bold>Effective Date.</bold></secline><sectionText lineno="130"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="ahaskell" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="7/1/2026">July 1, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>1-22-26 12:10 PM</tm></rev></foot></leg>
