Section <bold>73-10-32.5</bold> is amended to read:</secline><catline lineno="22"><bold>73-10-32.5<parens/>. Culinary water pricing structure.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="23" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="1-null-2" dnum="a-o" numlevel="1" lineno="24" slineno="1-4" level="2"><display>(a)</display>"Public water system" means the same as that term is defined in Section <xref depth="3" refnumber="19-4-102">19-4-102</xref>.</subsection><subsection ssid="1-null-3" dnum="b-o" numlevel="1" lineno="25" slineno="1-5" level="2"><display>(b)</display>"Retail water supplier" means the same as that term is defined in Section <xref depth="3" refnumber="19-4-102" start="0">19-4-102</xref>.</subsection><subsection ssid="1-null-4" dnum="c-o" numlevel="1" lineno="26" slineno="1-6" level="2" space="false"><display>(c)</display><subsection ssid="1-null-5" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"Water conservation effort" means a program that is designed to incentivize, <ln numlevel="1" lineno="27" slineno="1-7"/>encourage, or result in reduced water usage or more efficient use of water.</subsection><subsection ssid="1-null-6" dnum="ii-o" numlevel="1" lineno="28" slineno="1-8" level="3"><display>(ii)</display>"Water conservation effort" includes the costs associated with designing, <ln numlevel="1" lineno="29" slineno="1-9"/>implementing, and operating a program described in Subsection <xref tempid="170" depth="4" refnumber="73-10-32.5(1)(c)(i)">(1)(c)(i)</xref>.</subsection></subsection><subsection ssid="1-null-7" dnum="d-o" numlevel="1" lineno="30" slineno="1-10" level="2"><display>(d)</display>"Wholesale water supplier" means the same as that term is defined in Section <xref depth="3" refnumber="19-4-102"><ln numlevel="1" lineno="31" slineno="1-11"/>19-4-102</xref>.</subsection></subsection><subsection ssid="1-null-8" dnum="2-o" numlevel="1" lineno="32" slineno="1-12" level="1"><display>(2)</display>A retail water supplier shall:<subsection ssid="1-null-9" dnum="a-o" numlevel="1" lineno="33" slineno="1-13" level="2"><display>(a)</display>consider water conservation, including at least one water conservation effort, in <ln numlevel="1" lineno="34" slineno="1-14"/>setting water rates with the goal of encouraging efficient water use and eliminating <ln numlevel="1" lineno="35" slineno="1-15"/>wasteful or excessive water use;</subsection><subsection ssid="1-null-10" dnum="b-o" numlevel="1" lineno="36" slineno="1-16" level="2"><display>(b)</display>establish a culinary water rate structure that:<subsection ssid="1-null-11" dnum="i-o" numlevel="1" lineno="37" slineno="1-17" level="3"><display>(i)</display>incorporates increasing block units of water used; </subsection><subsection ssid="1-34" dnum="_-o:ii-i" numlevel="1" lineno="38" slineno="1-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">for a retail water supplier that provides culinary water for outdoor use, <ln numlevel="1" lineno="39" slineno="1-19"/>incorporates by July 1, 2027, at least three increasing block units in the water rate <ln numlevel="1" lineno="40" slineno="1-20"/>structure for a customer classification that primarily serves residential customers <ln numlevel="1" lineno="41" slineno="1-21"/>and receives culinary water for outdoor use, including:</amend><subsection ssid="1-35" dnum="_-o:A-i" numlevel="1" lineno="42" slineno="1-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1012" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="8" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="end">at least one block unit of water representing efficient indoor water use;</amend></subsection><subsection ssid="1-36" dnum="_-o:B-i" numlevel="1" lineno="43" slineno="1-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1013" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="13" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="end">at least one block unit of water representing efficient water use that includes <ln numlevel="1" lineno="44" slineno="1-24"/>outdoor water use; and</amend></subsection><subsection ssid="1-37" dnum="_-o:C-i" numlevel="1" lineno="45" slineno="1-25" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1014" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="18" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="end">at least one block unit of water representing wasteful or excessive water use;</amend></subsection></subsection><subsection ssid="1-null-12" dnum="ii-o:iii-i" numlevel="1" lineno="46" slineno="1-26" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1015" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="both" space="true">(iii)</amend></display>provides for an increase in the rate charged for additional block units of <ln numlevel="1" lineno="47" slineno="1-27"/>water used as usage increases from one block unit to the next<amend anum="0" ea="amend" pairid="20" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="both"> that is sufficient to <ln numlevel="1" lineno="48" slineno="1-28"/>provide a clear price signal or financial incentive to a customer to consider <ln numlevel="1" lineno="49" slineno="1-29"/>reducing the customer's water use</amend>;</subsection><subsection ssid="1-null-13" dnum="iii-o:iv-i" numlevel="1" lineno="50" slineno="1-30" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1016" style="2" owner="o" level="1" deltag="both">(iii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1017" style="1" owner="i" level="1" amendtag="both" space="true">(iv)</amend></display>by July 1, 2027, includes one or more water conservation efforts as an <ln numlevel="1" lineno="51" slineno="1-31"/>element in determining the rate charged for at least the highest usage block unit of <ln numlevel="1" lineno="52" slineno="1-32"/>water for a customer classification that primarily serves residential customers; and</subsection><subsection ssid="1-null-14" dnum="iv-o:v-i" numlevel="1" lineno="53" slineno="1-33" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1017" style="2" owner="o" level="1" deltag="both">(iv)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="both" space="true">(v)</amend></display>is based on a generally accepted rate setting method, including a standard or <ln numlevel="1" lineno="54" slineno="1-34"/>method established by the American Water Works Association;</subsection></subsection><subsection ssid="1-null-15" dnum="c-o" numlevel="1" lineno="55" slineno="1-35" level="2"><display>(c)</display>provide in customer billing notices, or in a notice that is distributed to customers at <ln numlevel="1" lineno="56" slineno="1-36"/>least annually, block unit rates and the customer's billing cycle; </subsection><subsection ssid="1-null-16" dnum="d-o" numlevel="1" lineno="57" slineno="1-37" level="2"><display>(d)</display>include individual customer water usage in customer billing notices; and</subsection><subsection ssid="1-null-17" dnum="e-o" numlevel="1" lineno="58" slineno="1-38" level="2"><display>(e)</display>consider urban farming that improves food security, reduces pollution, and creates <ln numlevel="1" lineno="59" slineno="1-39"/>green spaces in setting rates.</subsection></subsection><subsection ssid="1-null-18" dnum="3-o" numlevel="1" lineno="60" slineno="1-40" level="1"><display>(3)</display>This section does not prohibit:<subsection ssid="1-null-19" dnum="a-o" numlevel="1" lineno="61" slineno="1-41" level="2"><display>(a)</display>a public water system with 500 or fewer service connections from taking an action or <ln numlevel="1" lineno="62" slineno="1-42"/>adopting a culinary water rate structure described in Subsection <xref depth="4" refnumber="73-10-32.5(2)">(2)</xref>; or</subsection><subsection ssid="1-null-20" dnum="b-o" numlevel="1" lineno="63" slineno="1-43" level="2"><display>(b)</display>a retail water supplier from including water conservation and a water conservation <ln numlevel="1" lineno="64" slineno="1-44"/>effort as an element in setting rates for customer classifications that do not primarily <ln numlevel="1" lineno="65" slineno="1-45"/>serve residential customers.</subsection></subsection><subsection ssid="1-null-21" dnum="4-o" numlevel="1" lineno="66" slineno="1-46" level="1"><display>(4)</display>A public water system:<subsection ssid="1-null-22" dnum="a-o" numlevel="1" lineno="67" slineno="1-47" level="2"><display>(a)</display>is not required to establish or show that the portion of the rate designed to encourage <ln numlevel="1" lineno="68" slineno="1-48"/>water conservation, and fund a water conservation effort, within the highest usage <ln numlevel="1" lineno="69" slineno="1-49"/>block unit of water for a customer classification:<subsection ssid="1-null-23" dnum="i-o" numlevel="1" lineno="70" slineno="1-50" level="3"><display>(i)</display>is based on the public water system's actual cost of service;</subsection><subsection ssid="1-null-24" dnum="ii-o" numlevel="1" lineno="71" slineno="1-51" level="3"><display>(ii)</display>has a reasonable basis when compared to rates the public water system charges:<subsection ssid="1-null-25" dnum="A-o" numlevel="1" lineno="72" slineno="1-52" level="4"><display>(A)</display>for other block units of water within a customer classification; or</subsection><subsection ssid="1-null-26" dnum="B-o" numlevel="1" lineno="73" slineno="1-53" level="4"><display>(B)</display>for block units of water in other customer classifications; or</subsection></subsection><subsection ssid="1-null-27" dnum="iii-o" numlevel="1" lineno="74" slineno="1-54" level="3"><display>(iii)</display>is limited to a reasonable profit or return on investment;</subsection></subsection><subsection ssid="1-null-28" dnum="b-o" numlevel="1" lineno="75" slineno="1-55" level="2"><display>(b)</display>may include in a customer billing a fee, surcharge, penalty, or other charge that is <ln numlevel="1" lineno="76" slineno="1-56"/>collected pursuant to an agreement between the public water system and the <ln numlevel="1" lineno="77" slineno="1-57"/>wholesale water supplier from whom the public water system purchases water; and</subsection><subsection ssid="1-null-29" dnum="c-o" numlevel="1" lineno="78" slineno="1-58" level="2"><display>(c)</display>if the public water system is a for-profit entity, may not use revenue from the highest <ln numlevel="1" lineno="79" slineno="1-59"/>usage block unit of water designed to encourage water conservation to pay profits or <ln numlevel="1" lineno="80" slineno="1-60"/>dividends to the public water system's investors or owners.</subsection></subsection><subsection ssid="1-null-30" dnum="5-o" numlevel="1" lineno="81" slineno="1-61" level="1"><display>(5)</display>The use of revenue collected from the portion of any block unit of water designed to <ln numlevel="1" lineno="82" slineno="1-62"/>encourage water conservation may include funding water conservation efforts that are <ln numlevel="1" lineno="83" slineno="1-63"/>shared with or administered by another public water system or a wholesale water <ln numlevel="1" lineno="84" slineno="1-64"/>supplier.</subsection><subsection ssid="1-null-31" dnum="6-o" numlevel="1" lineno="85" slineno="1-65" level="1"><display>(6)</display>The adoption and implementation of that portion of a public water system's water rate <ln numlevel="1" lineno="86" slineno="1-66"/>that includes water conservation as an element in determining the rate charged for the <ln numlevel="1" lineno="87" slineno="1-67"/>highest usage block unit of water, as provided in this section, is conclusively presumed:<subsection ssid="1-null-32" dnum="a-o" numlevel="1" lineno="88" slineno="1-68" level="2"><display>(a)</display>to be reasonable; and</subsection><subsection ssid="1-null-33" dnum="b-o" numlevel="1" lineno="89" slineno="1-69" level="2"><display>(b)</display>to reflect the reasonable estimated cost of delivering the service for which the fee <ln numlevel="1" lineno="90" slineno="1-70"/>was paid.</subsection></subsection></section></bsec><bsec buid="2" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="91" slineno="2-1" sn="2"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="91">Section 2.  <bold>Effective Date.</bold></secline><sectionText lineno="92"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>1-6-26 1:27 PM</tm></rev></foot></leg>
