Section <bold>20A-7-201</bold> is amended to read:</secline><catline lineno="26"><bold>20A-7-201<parens/>. Statewide initiatives -- Signature requirements -- Submission to the <ln numlevel="1" lineno="27" slineno="1-3"/>Legislature or to a vote of the people.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="28" slineno="1-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="1-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A person seeking to have an initiative submitted to the Legislature for approval or <ln numlevel="1" lineno="29" slineno="1-5"/>rejection shall, after filing an initiative application, obtain:<subsection ssid="1-null-3" dnum="i-o" numlevel="1" lineno="30" slineno="1-6" level="3" tab="1"><display>(i)</display>legal signatures equal to <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="5" style="2" owner="jchristopherson" level="1" deltag="both">4%</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">8%</amend> of the number of active voters in the state on <ln numlevel="1" lineno="31" slineno="1-7"/>January 1 immediately following the last regular general election; and</subsection><subsection ssid="1-null-4" dnum="ii-o" numlevel="1" lineno="32" slineno="1-8" level="3" tab="1"><display>(ii)</display>from at least 26 Utah State Senate districts, legal signatures equal to <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="6" groupid="6" style="2" owner="jchristopherson" level="1" deltag="both">4%</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">8%</amend> of <ln numlevel="1" lineno="33" slineno="1-9"/>the number of active voters in that district on January 1 immediately following the <ln numlevel="1" lineno="34" slineno="1-10"/>last regular general election.</subsection></subsection><subsection ssid="1-null-5" dnum="b-o" numlevel="1" lineno="35" slineno="1-11" level="2"><display>(b)</display>If, at any time not less than 10 calendar days before the beginning of the next annual <ln numlevel="1" lineno="36" slineno="1-12"/>general session of the Legislature, the lieutenant governor declares that an initiative <ln numlevel="1" lineno="37" slineno="1-13"/>petition designated under Subsection <xref depth="4" refnumber="20A-7-202(2)(c)(i)" start="0">20A-7-202(2)(c)(i)</xref> for submission to the <ln numlevel="1" lineno="38" slineno="1-14"/>Legislature is signed by a sufficient number of voters to meet the requirements of <ln numlevel="1" lineno="39" slineno="1-15"/>Subsection <xref depth="4" refnumber="20A-7-201(1)(a)" start="0">(1)(a)</xref>, the lieutenant governor shall deliver a copy of the initiative <ln numlevel="1" lineno="40" slineno="1-16"/>petition, the text of the proposed law, and the cover sheet described in Subsection <xref depth="4" refnumber="20A-7-201(1)(c)" start="0"><ln numlevel="1" lineno="41" slineno="1-17"/>(1)(c)</xref> to the president of the Senate, the speaker of the House, and the director of the <ln numlevel="1" lineno="42" slineno="1-18"/>Office of Legislative Research and General Counsel.</subsection><subsection ssid="1-null-6" dnum="c-o" numlevel="1" lineno="43" slineno="1-19" level="2"><display>(c)</display>The lieutenant governor shall prepare a cover sheet for a petition declared sufficient <ln numlevel="1" lineno="44" slineno="1-20"/>under Subsection <xref depth="4" refnumber="20A-7-201(1)(b)" start="0">(1)(b)</xref> that contains:<subsection ssid="1-null-7" dnum="i-o" numlevel="1" lineno="45" slineno="1-21" level="3"><display>(i)</display>the number of active voters in the state on January 1 immediately following the <ln numlevel="1" lineno="46" slineno="1-22"/>last regular general election;</subsection><subsection ssid="1-null-8" dnum="ii-o" numlevel="1" lineno="47" slineno="1-23" level="3"><display>(ii)</display>the number of active voters in each Utah State Senate district on January 1 <ln numlevel="1" lineno="48" slineno="1-24"/>immediately following the last regular general election;</subsection><subsection ssid="1-null-9" dnum="iii-o" numlevel="1" lineno="49" slineno="1-25" level="3"><display>(iii)</display>the total number of certified signatures obtained for the initiative petition; and</subsection><subsection ssid="1-null-10" dnum="iv-o" numlevel="1" lineno="50" slineno="1-26" level="3"><display>(iv)</display>the total number of certified signatures obtained from each Utah State Senate <ln numlevel="1" lineno="51" slineno="1-27"/>district for the initiative petition.</subsection></subsection></subsection><subsection ssid="1-null-11" dnum="2-o" numlevel="1" lineno="52" slineno="1-28" level="1" space="false"><display>(2)</display><subsection ssid="1-null-12" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A person seeking to have an initiative submitted to a vote of the people for <ln numlevel="1" lineno="53" slineno="1-29"/>approval or rejection shall, after filing an initiative application, obtain:<subsection ssid="1-null-13" dnum="i-o" numlevel="1" lineno="54" slineno="1-30" level="3" tab="1"><display>(i)</display>legal signatures equal to 8% of the number of active voters in the state on January <ln numlevel="1" lineno="55" slineno="1-31"/>1 immediately following the last regular general election; and</subsection><subsection ssid="1-null-14" dnum="ii-o" numlevel="1" lineno="56" slineno="1-32" level="3" tab="1"><display>(ii)</display>from at least 26 Utah State Senate districts, legal signatures equal to 8% of the <ln numlevel="1" lineno="57" slineno="1-33"/>number of active voters in that district on January 1 immediately following the <ln numlevel="1" lineno="58" slineno="1-34"/>last regular general election.</subsection></subsection><subsection ssid="1-null-15" dnum="b-o" numlevel="1" lineno="59" slineno="1-35" level="2"><display>(b)</display>If an initiative petition meets the requirements of this part and the lieutenant <ln numlevel="1" lineno="60" slineno="1-36"/>governor declares that the initiative petition is signed by a sufficient number of voters <ln numlevel="1" lineno="61" slineno="1-37"/>to meet the requirements of Subsection <xref depth="4" refnumber="20A-7-201(2)(a)" start="0">(2)(a)</xref>, the lieutenant governor shall submit <ln numlevel="1" lineno="62" slineno="1-38"/>the proposed law to a vote of the people at the next regular general election:<subsection ssid="1-null-16" dnum="i-o" numlevel="1" lineno="63" slineno="1-39" level="3"><display>(i)</display>immediately after the application is filed under Section <xref depth="3" refnumber="20A-7-202" start="0">20A-7-202</xref>; and</subsection><subsection ssid="1-null-17" dnum="ii-o" numlevel="1" lineno="64" slineno="1-40" level="3"><display>(ii)</display>specified on the petition under Section <xref depth="3" refnumber="20A-7-203" start="0">20A-7-203</xref>.</subsection></subsection></subsection><subsection ssid="1-null-18" dnum="3-o" numlevel="1" lineno="65" slineno="1-41" level="1"><display>(3)</display>The lieutenant governor shall provide the following information to any interested person:<subsection ssid="1-null-19" dnum="a-o" numlevel="1" lineno="66" slineno="1-42" level="2"><display>(a)</display>the number of active voters in the state on January 1 immediately following the last <ln numlevel="1" lineno="67" slineno="1-43"/>regular general election; and</subsection><subsection ssid="1-null-20" dnum="b-o" numlevel="1" lineno="68" slineno="1-44" level="2"><display>(b)</display>for each Utah State Senate district, the number of active voters in that district on <ln numlevel="1" lineno="69" slineno="1-45"/>January 1 immediately following the last regular general election.</subsection></subsection></section></bsec><bsec buid="3" num="20A-7-208" type="amend" src="code" uid="C20A-7-S208_2026050620260506" sort="20A07 02080020260506" numlevel="1" lineno="70" slineno="2-1" sn="2"><section number="20A-7-208" numlevel="1" lineno="71" slineno="2-2" type="amend"><secline lineno="70">Section 2. Section <bold>20A-7-208</bold> is amended to read:</secline><catline lineno="71"><bold>20A-7-208<parens/>. Disposition of initiative petitions by the Legislature.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="72" slineno="2-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="3-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="20A-7-208(1)(b)" start="0">(1)(b)</xref>, when the lieutenant governor delivers an <ln numlevel="1" lineno="73" slineno="2-4"/>initiative petition to the Legislature, the law proposed by that initiative petition shall <ln numlevel="1" lineno="74" slineno="2-5"/>be either enacted or rejected without change or amendment by the Legislature.</subsection><subsection ssid="3-null-3" dnum="b-o" numlevel="1" lineno="75" slineno="2-6" level="2"><display>(b)</display>The speaker of the House and the president of the Senate may direct legislative staff <ln numlevel="1" lineno="76" slineno="2-7"/>to make technical corrections authorized by Section <xref depth="3" refnumber="36-12-12" start="0">36-12-12</xref>.</subsection><subsection ssid="3-null-4" dnum="c-o" numlevel="1" lineno="77" slineno="2-8" level="2"><display>(c)</display>If any law proposed by an initiative petition is enacted by the Legislature, the law is <ln numlevel="1" lineno="78" slineno="2-9"/>subject to referendum the same as other laws.</subsection></subsection><subsection ssid="3-null-5" dnum="2-o" numlevel="1" lineno="79" slineno="2-10" level="1"><display>(2)</display>If any law proposed by an intiative petition is not enacted by the Legislature, that <ln numlevel="1" lineno="80" slineno="2-11"/>proposed law shall be submitted to a vote of the people at the next regular general <ln numlevel="1" lineno="81" slineno="2-12"/>election<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="13" groupid="7" style="2" owner="jchristopherson" level="1" deltag="both"> if:</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="12" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">.</amend><subsection ssid="3-null-6" dnum="a-o:_-i" numlevel="1" lineno="82" slineno="2-13" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1025" style="2" owner="o" level="1" deltag="start">(a)</amend></display><amend anum="0" ea="erase" pairid="3" groupid="2" style="2" owner="jchristopherson" level="1" deltag="end">sufficient additional signatures to the petition are first obtained to bring the total <ln numlevel="1" lineno="83" slineno="2-14"/>number of signatures up to the number required by Subsection <xref depth="4" refnumber="20A-7-201(2)" start="0">20A-7-201(2)</xref>; and</amend><amendoutend style="2"/></subsection><subsection ssid="3-null-7" dnum="b-o:_-i" numlevel="1" lineno="84" slineno="2-15" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1026" style="2" owner="o" level="1" deltag="start">(b)</amend></display><amend anum="0" ea="erase" pairid="8" groupid="4" style="2" owner="jchristopherson" level="1" deltag="end">those additional signatures are verified, certified by the county clerks, and declared <ln numlevel="1" lineno="85" slineno="2-16"/>sufficient by the lieutenant governor as provided in Section <xref depth="3" refnumber="20A-7-105" start="0">20A-7-105</xref> and this part.</amend><amendoutend style="2"/></subsection></subsection></section></bsec><bsec buid="4" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="86" slineno="3-1" sn="3"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="86">Section 3.  <bold>Effective Date.</bold></secline><sectionText lineno="87"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>1-6-26 3:08 PM</tm></rev></foot></leg>
