Section <bold>20A-9-403</bold> is amended to read:</secline><catline lineno="39"><bold>20A-9-403<parens/>. Regular primary elections.</bold></catline><subsection ssid="6-null-136" dnum="1-o" numlevel="1" lineno="40" slineno="1-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="6-null-137" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Candidates for elective office that are to be filled at the next regular general <ln numlevel="1" lineno="41" slineno="1-4"/>election shall be nominated in a regular primary election by direct vote of the people <ln numlevel="1" lineno="42" slineno="1-5"/>in the manner prescribed in this section.  The regular primary election is held on the <ln numlevel="1" lineno="43" slineno="1-6"/>date specified in Section <xref depth="3" refnumber="20A-1-201.5">20A-1-201.5</xref>.  Nothing in this section shall affect a <ln numlevel="1" lineno="44" slineno="1-7"/>candidate's ability to qualify for a regular general election's ballot as an unaffiliated <ln numlevel="1" lineno="45" slineno="1-8"/>candidate under Section <xref depth="3" refnumber="20A-9-501">20A-9-501</xref> or to participate in a regular general election as a <ln numlevel="1" lineno="46" slineno="1-9"/>write-in candidate under Section <xref depth="3" refnumber="20A-9-601">20A-9-601</xref>.</subsection><subsection ssid="6-null-138" dnum="b-o" numlevel="1" lineno="47" slineno="1-10" level="2"><display>(b)</display>Each registered political party that chooses to have the names of the registered <ln numlevel="1" lineno="48" slineno="1-11"/>political party's candidates for elective office featured with party affiliation on the <ln numlevel="1" lineno="49" slineno="1-12"/>ballot at a regular general election shall comply with the requirements of this section <ln numlevel="1" lineno="50" slineno="1-13"/>and shall nominate the registered political party's candidates for elective office in the <ln numlevel="1" lineno="51" slineno="1-14"/>manner described in this section.</subsection><subsection ssid="6-null-139" dnum="c-o" numlevel="1" lineno="52" slineno="1-15" level="2"><display>(c)</display>A filing officer may not permit an official ballot at a regular general election to be <ln numlevel="1" lineno="53" slineno="1-16"/>produced or used if the ballot denotes affiliation between a registered political party <ln numlevel="1" lineno="54" slineno="1-17"/>or any other political group and a candidate for elective office who is not nominated <ln numlevel="1" lineno="55" slineno="1-18"/>in the manner prescribed in this section or in Subsection <xref depth="4" refnumber="20A-9-202(4)">20A-9-202(4)</xref>.</subsection><subsection ssid="6-null-140" dnum="d-o" numlevel="1" lineno="56" slineno="1-19" level="2"><display>(d)</display>Unless noted otherwise, the dates in this section refer to those that occur in each <ln numlevel="1" lineno="57" slineno="1-20"/>even-numbered year in which a regular general election will be held.</subsection></subsection><subsection ssid="6-null-141" dnum="2-o" numlevel="1" lineno="58" slineno="1-21" level="1" space="false"><display>(2)</display><subsection ssid="6-null-142" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Each registered political party, in a statement filed with the lieutenant governor, <ln numlevel="1" lineno="59" slineno="1-22"/>shall:<subsection ssid="6-null-143" dnum="i-o" numlevel="1" lineno="60" slineno="1-23" level="3" tab="1"><display>(i)</display>either declare the registered political party's intent to participate in the next regular <ln numlevel="1" lineno="61" slineno="1-24"/>primary election or declare that the registered political party chooses not to have <ln numlevel="1" lineno="62" slineno="1-25"/>the names of the registered political party's candidates for elective office featured <ln numlevel="1" lineno="63" slineno="1-26"/>on the ballot at the next regular general election; and</subsection><subsection ssid="6-null-144" dnum="ii-o" numlevel="1" lineno="64" slineno="1-27" level="3" tab="1"><display>(ii)</display>if the registered political party participates in the upcoming regular primary <ln numlevel="1" lineno="65" slineno="1-28"/>election, identify one or more registered political parties whose members may <ln numlevel="1" lineno="66" slineno="1-29"/>vote for the registered political party's candidates and whether individuals <ln numlevel="1" lineno="67" slineno="1-30"/>identified as unaffiliated with a political party may vote for the registered political <ln numlevel="1" lineno="68" slineno="1-31"/>party's candidates.</subsection></subsection><subsection ssid="6-null-145" dnum="b-o" numlevel="1" lineno="69" slineno="1-32" level="2" space="false"><display>(b)</display><subsection ssid="6-null-146" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A registered political party that is a continuing political party shall file the <ln numlevel="1" lineno="70" slineno="1-33"/>statement described in Subsection <xref depth="4" refnumber="20A-9-403(2)(a)">(2)(a)</xref> with the lieutenant governor no later than <ln numlevel="1" lineno="71" slineno="1-34"/>5 p.m. on November 30 of each odd-numbered year.</subsection><subsection ssid="6-null-147" dnum="ii-o" numlevel="1" lineno="72" slineno="1-35" level="3"><display>(ii)</display>An organization that is seeking to become a registered political party under <ln numlevel="1" lineno="73" slineno="1-36"/>Section <xref depth="3" refnumber="20A-8-103">20A-8-103</xref> shall file the statement described in Subsection <xref depth="4" refnumber="20A-9-403(2)(a)">(2)(a)</xref> at the <ln numlevel="1" lineno="74" slineno="1-37"/>time that the registered political party files the petition described in Section <xref depth="3" refnumber="20A-8-103"><ln numlevel="1" lineno="75" slineno="1-38"/>20A-8-103</xref>.</subsection></subsection></subsection><subsection ssid="6-null-148" dnum="3-o" numlevel="1" lineno="76" slineno="1-39" level="1" space="false"><display>(3)</display><subsection ssid="6-null-149" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="20A-9-403(3)(e)">(3)(e)</xref>, an individual who submits a declaration <ln numlevel="1" lineno="77" slineno="1-40"/>of candidacy under Section <xref depth="3" refnumber="20A-9-202">20A-9-202</xref> shall appear as a candidate for elective office <ln numlevel="1" lineno="78" slineno="1-41"/>on the regular primary ballot of the registered political party listed on the declaration <ln numlevel="1" lineno="79" slineno="1-42"/>of candidacy only if the individual is certified by the appropriate filing officer as <ln numlevel="1" lineno="80" slineno="1-43"/>having submitted a nomination petition that was:<subsection ssid="6-null-150" dnum="i-o" numlevel="1" lineno="81" slineno="1-44" level="3" tab="1"><display>(i)</display>circulated and completed in accordance with Section <xref depth="3" refnumber="20A-9-405">20A-9-405</xref>; and</subsection><subsection ssid="6-null-151" dnum="ii-o" numlevel="1" lineno="82" slineno="1-45" level="3" tab="1"><display>(ii)</display>signed by at least 2% of the registered political party's members who reside in the <ln numlevel="1" lineno="83" slineno="1-46"/>political division of the office that the individual seeks.</subsection></subsection><subsection ssid="6-null-152" dnum="b-o" numlevel="1" lineno="84" slineno="1-47" level="2" space="false"><display>(b)</display><subsection ssid="6-null-153" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A candidate for elective office shall, in accordance with Section <xref depth="3" refnumber="20A-9-408.3">20A-9-408.3</xref>, <ln numlevel="1" lineno="85" slineno="1-48"/>submit signatures for a nomination petition to the appropriate filing officer for <ln numlevel="1" lineno="86" slineno="1-49"/>verification and certification no later than 5 p.m. on March 31.</subsection><subsection ssid="6-null-154" dnum="ii-o" numlevel="1" lineno="87" slineno="1-50" level="3"><display>(ii)</display>A candidate may supplement the candidate's submissions at any time on or before <ln numlevel="1" lineno="88" slineno="1-51"/>the filing deadline.</subsection></subsection><subsection ssid="6-null-155" dnum="c-o" numlevel="1" lineno="89" slineno="1-52" level="2" space="false"><display>(c)</display><subsection ssid="6-null-156" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The lieutenant governor shall determine for each elective office the total <ln numlevel="1" lineno="90" slineno="1-53"/>number of signatures that must be submitted under Subsection <xref depth="4" refnumber="20A-9-403(3)(a)(ii)">(3)(a)(ii)</xref> or <xref depth="4" refnumber="20A-9-408(8)"><ln numlevel="1" lineno="91" slineno="1-54"/>20A-9-408(8)</xref> by counting the aggregate number of individuals residing in each <ln numlevel="1" lineno="92" slineno="1-55"/>elective office's political division who have designated a particular registered <ln numlevel="1" lineno="93" slineno="1-56"/>political party on the individuals' voter registration forms on or before November <ln numlevel="1" lineno="94" slineno="1-57"/>15 of each odd-numbered year.</subsection><subsection ssid="6-null-157" dnum="ii-o" numlevel="1" lineno="95" slineno="1-58" level="3"><display>(ii)</display>The lieutenant governor shall publish the determination for each elective office <ln numlevel="1" lineno="96" slineno="1-59"/>no later than November 30 of each odd-numbered year.</subsection></subsection><subsection ssid="6-null-158" dnum="d-o" numlevel="1" lineno="97" slineno="1-60" level="2"><display>(d)</display>The filing officer shall:<subsection ssid="6-null-159" dnum="i-o" numlevel="1" lineno="98" slineno="1-61" level="3"><display>(i)</display>except as otherwise provided in Section <xref depth="3" refnumber="20A-21-201">20A-21-201</xref>, and in accordance with <ln numlevel="1" lineno="99" slineno="1-62"/>Section <xref depth="3" refnumber="20A-9-408.3">20A-9-408.3</xref>, verify signatures on nomination petitions in a transparent <ln numlevel="1" lineno="100" slineno="1-63"/>and orderly manner, no later than 14 calendar days after the day on which a <ln numlevel="1" lineno="101" slineno="1-64"/>candidate submits the signatures to the filing officer;</subsection><subsection ssid="6-null-160" dnum="ii-o" numlevel="1" lineno="102" slineno="1-65" level="3"><display>(ii)</display>for <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="126" groupid="109" style="2" owner="jchristopherson" level="1" deltag="both">all qualifying candidates for elective office who submit nomination petitions <ln numlevel="1" lineno="103" slineno="1-66"/>to the filing officer, issue certifications referenced</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="122" groupid="105" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">each qualifying candidate for <ln numlevel="1" lineno="104" slineno="1-67"/>elective office who submits a nomination petition to the filing officer, issue the <ln numlevel="1" lineno="105" slineno="1-68"/>certification described</amend> in Subsection <xref depth="4" refnumber="20A-9-403(3)(a)">(3)(a)</xref> no later than the deadline described in <ln numlevel="1" lineno="106" slineno="1-69"/>Subsection <xref depth="4" refnumber="20A-9-202(1)(b)">20A-9-202(1)(b)</xref>;</subsection><subsection ssid="6-null-161" dnum="iii-o" numlevel="1" lineno="107" slineno="1-70" level="3"><display>(iii)</display>consider <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="129" groupid="112" style="2" owner="jchristopherson" level="1" deltag="both">active and inactive voters eligible to sign nomination petitions</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="128" groupid="111" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">an <ln numlevel="1" lineno="108" slineno="1-71"/>active voter and inactive voter eligible to sign a nomination petition</amend>;</subsection><subsection ssid="6-null-162" dnum="iv-o" numlevel="1" lineno="109" slineno="1-72" level="3"><display>(iv)</display>consider an individual who signs a nomination petition a member of a registered <ln numlevel="1" lineno="110" slineno="1-73"/>political party for purposes of Subsection <xref depth="4" refnumber="20A-9-403(3)(a)(ii)">(3)(a)(ii)</xref> if the individual has designated <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="47" groupid="39" style="2" owner="jchristopherson" level="1" deltag="both"><ln numlevel="1" lineno="111" slineno="1-74"/>that</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="45" groupid="37" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the</amend> registered political party as the individual's party membership on the <ln numlevel="1" lineno="112" slineno="1-75"/>individual's voter registration form; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="139" groupid="122" style="2" owner="jchristopherson" level="1" deltag="both">and</amend><amendoutend style="2"/></subsection><subsection ssid="6-null-163" dnum="v-o" numlevel="1" lineno="113" slineno="1-76" level="3"><display>(v)</display>except as otherwise provided in Section <xref depth="3" refnumber="20A-21-201">20A-21-201</xref> and with the assistance of <ln numlevel="1" lineno="114" slineno="1-77"/>the county clerk as applicable, use the procedures described in Section <xref depth="3" refnumber="20A-1-1002">20A-1-1002</xref> <ln numlevel="1" lineno="115" slineno="1-78"/>to verify submitted nomination petition signatures, or use statistical sampling <ln numlevel="1" lineno="116" slineno="1-79"/>procedures to verify submitted nomination petition signatures in accordance with <ln numlevel="1" lineno="117" slineno="1-80"/>rules made under Subsection <xref depth="4" refnumber="20A-9-403(3)(f)">(3)(f)</xref><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="140" groupid="123" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="149" groupid="131" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="6-199" dnum="_-o:vi-i" numlevel="1" lineno="118" slineno="1-81" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1028" style="1" owner="i" level="1" amendtag="start">(vi)</amend></display><amend anum="0" ea="amend" pairid="154" groupid="134" style="1" owner="jchristopherson" level="1" amendtag="end">subject to Subsection <xref refnumber="7-null-155">20A-9-405(11)</xref>, no later than five business days after the <ln numlevel="1" lineno="119" slineno="1-82"/>day on which the signature of an individual who signs a nomination petition is <ln numlevel="1" lineno="120" slineno="1-83"/>verified under Subsection <xref depth="4" refnumber="20A-9-403(3)(d)(v)">(3)(d)(v)</xref> or Section <xref depth="3" refnumber="20A-21-201">20A-21-201</xref>, post the individual's <ln numlevel="1" lineno="121" slineno="1-84"/>name and date of signature on the lieutenant governor's website, in a conspicuous <ln numlevel="1" lineno="122" slineno="1-85"/>location designated by the lieutenant governor, for at least 90 calendar days after <ln numlevel="1" lineno="123" slineno="1-86"/>the date of the primary election.</amend></subsection></subsection><subsection ssid="6-null-164" dnum="e-o" numlevel="1" lineno="124" slineno="1-87" level="2"><display>(e)</display>Notwithstanding any other provision in this Subsection <xref depth="4" refnumber="20A-9-403(3)">(3)</xref>, a candidate for lieutenant <ln numlevel="1" lineno="125" slineno="1-88"/>governor may appear on the regular primary ballot of a registered political party <ln numlevel="1" lineno="126" slineno="1-89"/>without submitting <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="179" groupid="159" style="2" owner="jchristopherson" level="1" deltag="both">nomination petitions</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="167" groupid="147" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a nomination petition</amend> if the candidate files <ln numlevel="1" lineno="127" slineno="1-90"/>a declaration of candidacy and complies with Subsection <xref depth="4" refnumber="20A-9-202(3)">20A-9-202(3)</xref>.</subsection><subsection ssid="6-null-165" dnum="f-o" numlevel="1" lineno="128" slineno="1-91" level="2"><display>(f)</display>In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the <ln numlevel="1" lineno="129" slineno="1-92"/>director of elections, within the Office of the Lieutenant Governor, may make rules <ln numlevel="1" lineno="130" slineno="1-93"/>that:<subsection ssid="6-null-166" dnum="i-o" numlevel="1" lineno="131" slineno="1-94" level="3"><display>(i)</display>provide for the use of statistical sampling procedures that:<subsection ssid="6-null-167" dnum="A-o" numlevel="1" lineno="132" slineno="1-95" level="4"><display>(A)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="180" groupid="160" style="2" owner="jchristopherson" level="1" deltag="both">filing officers are</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="169" groupid="149" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a filing officer is</amend> required to use to verify signatures under <ln numlevel="1" lineno="133" slineno="1-96"/>Subsection <xref depth="4" refnumber="20A-9-403(3)(d)">(3)(d)</xref>; and</subsection><subsection ssid="6-null-168" dnum="B-o" numlevel="1" lineno="134" slineno="1-97" level="4"><display>(B)</display>reflect a bona fide effort to determine the validity of a candidate's entire <ln numlevel="1" lineno="135" slineno="1-98"/>submission, using widely recognized statistical sampling techniques; and</subsection></subsection><subsection ssid="6-null-169" dnum="ii-o" numlevel="1" lineno="136" slineno="1-99" level="3"><display>(ii)</display>provide for the transparent, orderly, and timely submission, verification, and <ln numlevel="1" lineno="137" slineno="1-100"/>certification of nomination petition signatures.</subsection></subsection><subsection ssid="6-null-170" dnum="g-o" numlevel="1" lineno="138" slineno="1-101" level="2"><display>(g)</display>The county clerk shall:<subsection ssid="6-null-171" dnum="i-o" numlevel="1" lineno="139" slineno="1-102" level="3"><display>(i)</display>review the declarations of candidacy filed by candidates for local boards of <ln numlevel="1" lineno="140" slineno="1-103"/>education to determine if more than two candidates have filed for the same seat;</subsection><subsection ssid="6-null-172" dnum="ii-o" numlevel="1" lineno="141" slineno="1-104" level="3"><display>(ii)</display>place the names of all candidates who have filed a declaration of candidacy for a <ln numlevel="1" lineno="142" slineno="1-105"/>local board of education seat on the nonpartisan section of the ballot if more than <ln numlevel="1" lineno="143" slineno="1-106"/>two candidates have filed for the same seat; and</subsection><subsection ssid="6-null-173" dnum="iii-o" numlevel="1" lineno="144" slineno="1-107" level="3"><display>(iii)</display>place the local board of education candidates' names on the ballot in accordance <ln numlevel="1" lineno="145" slineno="1-108"/>with Sections <xref depth="3" refnumber="20A-6-109">20A-6-109</xref> and <xref depth="3" refnumber="20A-6-110">20A-6-110</xref>.</subsection></subsection></subsection><subsection ssid="6-null-180" dnum="4-o" numlevel="1" lineno="146" slineno="1-109" level="1" space="false"><display>(4)</display><subsection ssid="6-null-181" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Before the deadline described in Subsection <xref depth="4" refnumber="20A-9-409(4)(c)">20A-9-409(4)(c)</xref>, the lieutenant <ln numlevel="1" lineno="147" slineno="1-110"/>governor shall provide to <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="185" groupid="165" style="2" owner="jchristopherson" level="1" deltag="both">the county clerks</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="172" groupid="152" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">each county clerk</amend>:<subsection ssid="6-null-182" dnum="i-o" numlevel="1" lineno="148" slineno="1-111" level="3" tab="1"><display>(i)</display>a list of the names of all candidates for federal, constitutional, multi-county, single <ln numlevel="1" lineno="149" slineno="1-112"/>county, and county offices who have received certifications under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="138" groupid="121" style="2" owner="jchristopherson" level="1" deltag="both">(3)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="137" groupid="120" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="20A-9-403(3)(a)"><ln numlevel="1" lineno="150" slineno="1-113"/>(3)(a)</xref></amend>, along with instructions on how <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="193" groupid="173" style="2" owner="jchristopherson" level="1" deltag="both">those</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="192" groupid="172" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the</amend> names shall appear on the <ln numlevel="1" lineno="151" slineno="1-114"/>primary election ballot in accordance with Sections <xref depth="3" refnumber="20A-6-109">20A-6-109</xref> and <xref depth="3" refnumber="20A-6-110">20A-6-110</xref>; <ln numlevel="1" lineno="152" slineno="1-115"/>and</subsection><subsection ssid="6-null-183" dnum="ii-o" numlevel="1" lineno="153" slineno="1-116" level="3" tab="1"><display>(ii)</display>a list of unopposed candidates for elective office who have been nominated by a <ln numlevel="1" lineno="154" slineno="1-117"/>registered political party under Subsection <xref depth="4" refnumber="20A-9-403(5)(c)">(5)(c)</xref> and <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="190" groupid="170" style="2" owner="jchristopherson" level="1" deltag="both">instruct the county clerks</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="177" groupid="157" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="155" slineno="1-118"/>instructions</amend> to exclude the unopposed candidates from the primary election ballot.</subsection></subsection><subsection ssid="6-null-184" dnum="b-o" numlevel="1" lineno="156" slineno="1-119" level="2"><display>(b)</display>A candidate for lieutenant governor and a candidate for governor campaigning as <ln numlevel="1" lineno="157" slineno="1-120"/>joint-ticket running mates shall appear jointly on the primary election ballot.</subsection><subsection ssid="6-null-185" dnum="c-o" numlevel="1" lineno="158" slineno="1-121" level="2" format="full"><display>(c)</display>After the county clerk receives the certified list from the lieutenant governor under <ln numlevel="1" lineno="159" slineno="1-122"/>Subsection <xref depth="4" refnumber="20A-9-403(4)(a)">(4)(a)</xref>, the county clerk shall post or publish a primary election notice in <ln numlevel="1" lineno="160" slineno="1-123"/>substantially the following form:<eol numlevel="1" lineno="161" slineno="1-124"/><para/>"Notice is given that a primary election will be held Tuesday, June ____, <ln numlevel="1" lineno="162" slineno="1-125"/>________(year), to nominate party candidates for the parties and candidates for nonpartisan <ln numlevel="1" lineno="163" slineno="1-126"/>local school board positions listed on the primary ballot.  The polling place for voting precinct <ln numlevel="1" lineno="164" slineno="1-127"/>____ is ____.  The polls will open at 7 a.m. and continue open until 8 p.m. of the same day.  <ln numlevel="1" lineno="165" slineno="1-128"/>Attest: county clerk."</subsection></subsection><subsection ssid="6-null-186" dnum="5-o" numlevel="1" lineno="166" slineno="1-129" level="1" space="false"><display>(5)</display><subsection ssid="6-null-187" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A candidate who, at the regular primary election, receives the highest number of <ln numlevel="1" lineno="167" slineno="1-130"/>votes cast for the office sought by the candidate is:<subsection ssid="6-null-188" dnum="i-o" numlevel="1" lineno="168" slineno="1-131" level="3" tab="1"><display>(i)</display>nominated for that office by the candidate's registered political party; or</subsection><subsection ssid="6-null-189" dnum="ii-o" numlevel="1" lineno="169" slineno="1-132" level="3" tab="1"><display>(ii)</display>for a nonpartisan local school board position, nominated for that office.</subsection></subsection><subsection ssid="6-null-190" dnum="b-o" numlevel="1" lineno="170" slineno="1-133" level="2"><display>(b)</display>If two or more candidates are to be elected to the office at the regular general <ln numlevel="1" lineno="171" slineno="1-134"/>election, those party candidates equal in number to positions to be filled who receive <ln numlevel="1" lineno="172" slineno="1-135"/>the highest number of votes at the regular primary election are the nominees of the <ln numlevel="1" lineno="173" slineno="1-136"/>candidates' party for those positions.</subsection><subsection ssid="6-null-191" dnum="c-o" numlevel="1" lineno="174" slineno="1-137" level="2" space="false"><display>(c)</display><subsection ssid="6-null-192" dnum="i-o" level="3" placement="sameline"><display>(i)</display>As used in this Subsection <xref depth="4" refnumber="20A-9-403(5)(c)">(5)(c)</xref>, a candidate is "unopposed" if:<subsection ssid="6-null-193" dnum="A-o" numlevel="1" lineno="175" slineno="1-138" level="4" tab="1"><display>(A)</display>no individual other than the candidate receives a certification under <ln numlevel="1" lineno="176" slineno="1-139"/>Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="135" groupid="118" style="2" owner="jchristopherson" level="1" deltag="both">(3)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="134" groupid="117" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="20A-9-403(3)(a)">(3)(a)</xref></amend> for the regular primary election ballot of the candidate's <ln numlevel="1" lineno="177" slineno="1-140"/>registered political party for a particular elective office; or</subsection><subsection ssid="6-null-194" dnum="B-o" numlevel="1" lineno="178" slineno="1-141" level="4" tab="1"><display>(B)</display>for an office where more than one individual is to be elected or nominated, the <ln numlevel="1" lineno="179" slineno="1-142"/>number of candidates who receive certification under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="132" groupid="115" style="2" owner="jchristopherson" level="1" deltag="both">(3)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="131" groupid="114" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="20A-9-403(3)(a)">(3)(a)</xref></amend> for <ln numlevel="1" lineno="180" slineno="1-143"/>the regular primary election of the candidate's registered political party does <ln numlevel="1" lineno="181" slineno="1-144"/>not exceed the total number of candidates to be elected or nominated for that <ln numlevel="1" lineno="182" slineno="1-145"/>office.</subsection></subsection><subsection ssid="6-null-195" dnum="ii-o" numlevel="1" lineno="183" slineno="1-146" level="3"><display>(ii)</display>A candidate who is unopposed for an elective office in the regular primary <ln numlevel="1" lineno="184" slineno="1-147"/>election of a registered political party is nominated by the party for that office <ln numlevel="1" lineno="185" slineno="1-148"/>without appearing on the primary election ballot.</subsection></subsection></subsection><subsection ssid="6-null-196" dnum="6-o" numlevel="1" lineno="186" slineno="1-149" level="1"><display>(6)</display>The expense of providing all ballots, blanks, or other supplies to be used at any primary <ln numlevel="1" lineno="187" slineno="1-150"/>election provided for by this section, and all expenses necessarily incurred in the <ln numlevel="1" lineno="188" slineno="1-151"/>preparation for or the conduct of that primary election shall be paid out of the treasury of <ln numlevel="1" lineno="189" slineno="1-152"/>the county or state, in the same manner as for the regular general elections.</subsection><subsection ssid="6-null-197" dnum="7-o" numlevel="1" lineno="190" slineno="1-153" level="1"><display>(7)</display>An individual may not file a declaration of candidacy for a registered political party of <ln numlevel="1" lineno="191" slineno="1-154"/>which the individual is not a member, except to the extent that the registered political <ln numlevel="1" lineno="192" slineno="1-155"/>party permits otherwise under the registered political party's bylaws.</subsection></section></bsec><bsec buid="7" num="20A-9-405" type="amend" src="code" uid="C20A-9-S405_2027010120270101" sort="20A09 04050020270101" numlevel="1" lineno="194" slineno="2-2" sn="2"><flags numlevel="1" lineno="193" slineno="2-1">The following section is affected by a coordination clause at the end of this bill.</flags><section number="20A-9-405" numlevel="1" lineno="195" slineno="2-3" type="amend"><secline lineno="194">Section 2. Section <bold>20A-9-405</bold> is amended to read:</secline><catline lineno="195"><bold>20A-9-405<parens/>. Nomination petitions for regular primary elections.</bold></catline><subsection ssid="7-null-110" dnum="1-o" numlevel="1" lineno="196" slineno="2-4" level="1" placement="noreturn"><display>(1)</display>This section applies to the form and circulation of nomination petitions for regular <ln numlevel="1" lineno="197" slineno="2-5"/>primary elections described in Subsection <xref depth="4" refnumber="20A-9-403(3)(a)" start="0">20A-9-403(3)(a)</xref><amend anum="0" ea="amend" pairid="81" groupid="66" style="1" owner="jchristopherson" level="1" amendtag="both"> and Section <xref depth="3" refnumber="20A-9-408">20A-9-408</xref></amend>.</subsection><subsection ssid="7-null-111" dnum="2-o" numlevel="1" lineno="198" slineno="2-6" level="1"><display>(2)</display>A candidate for elective office, and the agents of the candidate, may not circulate <ln numlevel="1" lineno="199" slineno="2-7"/>nomination petitions until the candidate has submitted a declaration of candidacy in <ln numlevel="1" lineno="200" slineno="2-8"/>accordance with Subsection <xref depth="4" refnumber="20A-9-202(1)" start="0">20A-9-202(1)</xref>.</subsection><subsection ssid="7-null-112" dnum="3-o" numlevel="1" lineno="201" slineno="2-9" level="1"><display>(3)</display>For the manual candidate qualification process, the nomination petitions shall be in <ln numlevel="1" lineno="202" slineno="2-10"/>substantially the following form:<subsection ssid="7-null-113" dnum="a-o" numlevel="1" lineno="203" slineno="2-11" level="2"><display>(a)</display>the petition shall be printed on paper 8-1/2 inches long and 11 inches wide;</subsection><subsection ssid="7-null-114" dnum="b-o" numlevel="1" lineno="204" slineno="2-12" level="2"><display>(b)</display>the petition shall be ruled with a horizontal line 3/4 inch from the top, with the space <ln numlevel="1" lineno="205" slineno="2-13"/>above that line blank for purposes of binding;</subsection><subsection ssid="7-null-115" dnum="c-o" numlevel="1" lineno="206" slineno="2-14" level="2"><display>(c)</display>the petition shall be headed by a caption stating the purpose of the petition and the <ln numlevel="1" lineno="207" slineno="2-15"/>name of the proposed candidate;</subsection><subsection ssid="7-null-116" dnum="d-o" numlevel="1" lineno="208" slineno="2-16" level="2"><display>(d)</display>the petition shall feature the word "Warning" followed by the following statement in <ln numlevel="1" lineno="209" slineno="2-17"/>no less than eight-point, single leaded type: "It is a class A misdemeanor for anyone <ln numlevel="1" lineno="210" slineno="2-18"/>to knowingly sign a nomination petition with any name other than the person's own <ln numlevel="1" lineno="211" slineno="2-19"/>name, or more than once for the same candidate, or if the person is not registered to <ln numlevel="1" lineno="212" slineno="2-20"/>vote in this state.";</subsection><subsection ssid="7-null-119" dnum="e-o" numlevel="1" lineno="213" slineno="2-21" level="2"><display>(e)</display>the petition shall feature 10 lines spaced one-half inch apart and consecutively <ln numlevel="1" lineno="214" slineno="2-22"/>numbered one through 10;</subsection><subsection ssid="7-null-120" dnum="f-o" numlevel="1" lineno="215" slineno="2-23" level="2"><display>(f)</display>the signature portion of the petition shall be divided into columns headed by the <ln numlevel="1" lineno="216" slineno="2-24"/>following titles:<subsection ssid="7-null-121" dnum="i-o" numlevel="1" lineno="217" slineno="2-25" level="3"><display>(i)</display>Registered Voter's Printed Name;</subsection><subsection ssid="7-null-122" dnum="ii-o" numlevel="1" lineno="218" slineno="2-26" level="3"><display>(ii)</display>Signature of Registered Voter;</subsection><subsection ssid="7-null-123" dnum="iii-o" numlevel="1" lineno="219" slineno="2-27" level="3"><display>(iii)</display>Party Affiliation of Registered Voter;</subsection><subsection ssid="7-null-124" dnum="iv-o" numlevel="1" lineno="220" slineno="2-28" level="3"><display>(iv)</display>Birth Date or Age (Optional);</subsection><subsection ssid="7-null-125" dnum="v-o" numlevel="1" lineno="221" slineno="2-29" level="3"><display>(v)</display>Street Address, City, Zip Code; and</subsection><subsection ssid="7-null-126" dnum="vi-o" numlevel="1" lineno="222" slineno="2-30" level="3"><display>(vi)</display>Date of Signature; and</subsection></subsection><subsection ssid="7-null-127" dnum="g-o" numlevel="1" lineno="223" slineno="2-31" level="2"><display>(g)</display>a photograph of the candidate may appear on the nomination petition.</subsection></subsection><subsection ssid="7-null-128" dnum="4-o" numlevel="1" lineno="224" slineno="2-32" level="1"><display>(4)</display>For the electronic candidate qualification process, the lieutenant governor shall design <ln numlevel="1" lineno="225" slineno="2-33"/>an electronic form, using progressive screens, that includes:<subsection ssid="7-null-129" dnum="a-o" numlevel="1" lineno="226" slineno="2-34" level="2" format="full"><display>(a)</display>the following warning:<eol numlevel="1" lineno="227" slineno="2-35"/><para/>"Warning: It is a class A misdemeanor for anyone to knowingly sign a nomination <ln numlevel="1" lineno="228" slineno="2-36"/>petition with any name other than the person's own name, or more than once for the same <ln numlevel="1" lineno="229" slineno="2-37"/>candidate, or if the person is not registered to vote in this state."; and</subsection><subsection ssid="7-null-131" dnum="b-o" numlevel="1" lineno="230" slineno="2-38" level="2"><display>(b)</display>the following information for each individual who signs the petition:<subsection ssid="7-null-132" dnum="i-o" numlevel="1" lineno="231" slineno="2-39" level="3"><display>(i)</display>name;</subsection><subsection ssid="7-null-133" dnum="ii-o" numlevel="1" lineno="232" slineno="2-40" level="3"><display>(ii)</display>party affiliation;</subsection><subsection ssid="7-null-134" dnum="iii-o" numlevel="1" lineno="233" slineno="2-41" level="3"><display>(iii)</display>date of birth or age, (optional);</subsection><subsection ssid="7-null-135" dnum="iv-o" numlevel="1" lineno="234" slineno="2-42" level="3"><display>(iv)</display>street address, city, zip code;</subsection><subsection ssid="7-null-136" dnum="v-o" numlevel="1" lineno="235" slineno="2-43" level="3"><display>(v)</display>date of signature;</subsection><subsection ssid="7-null-137" dnum="vi-o" numlevel="1" lineno="236" slineno="2-44" level="3"><display>(vi)</display>other information required under Section <xref depth="3" refnumber="20A-21-201" start="0">20A-21-201</xref>; and</subsection><subsection ssid="7-null-138" dnum="vii-o" numlevel="1" lineno="237" slineno="2-45" level="3"><display>(vii)</display>other information required by the lieutenant governor.</subsection></subsection></subsection><subsection ssid="7-null-139" dnum="5-o" numlevel="1" lineno="238" slineno="2-46" level="1" format="full"><display>(5)</display>For the manual candidate qualification process, if one or more nomination petitions are <ln numlevel="1" lineno="239" slineno="2-47"/>bound together, a page shall be bound to the nomination petition(s) that features the following <ln numlevel="1" lineno="240" slineno="2-48"/>printed verification statement to be signed and dated by the petition circulator:<eol numlevel="1" lineno="241" slineno="2-49"/><para/>"Verification<eol numlevel="1" lineno="242" slineno="2-50"/><para/>State of Utah, County of ____<eol numlevel="1" lineno="243" slineno="2-51"/><para/>I, ____, of ____, hereby state that:<eol numlevel="1" lineno="244" slineno="2-52"/><para/>I am at least 18 years old;<eol numlevel="1" lineno="245" slineno="2-53"/><para/>All the names that appear on the signature sheets bound to this page were, to the best of <ln numlevel="1" lineno="246" slineno="2-54"/>my knowledge, signed by the persons who professed to be the persons whose names appear on <ln numlevel="1" lineno="247" slineno="2-55"/>the signature sheets, and each of them signed the person's name on the signature sheets in my <ln numlevel="1" lineno="248" slineno="2-56"/>presence;<eol numlevel="1" lineno="249" slineno="2-57"/><para/>I believe that each has printed and signed the person's name and written the person's <ln numlevel="1" lineno="250" slineno="2-58"/>street address correctly, and that each signer is registered to vote in Utah."</subsection><subsection ssid="7-null-140" dnum="6-o" numlevel="1" lineno="251" slineno="2-59" level="1"><display>(6)</display>The lieutenant governor shall prepare and make public model nomination petition forms <ln numlevel="1" lineno="252" slineno="2-60"/>and associated instructions.</subsection><subsection ssid="7-null-141" dnum="7-o" numlevel="1" lineno="253" slineno="2-61" level="1"><display>(7)</display>A nomination petition circulator:<subsection ssid="7-null-142" dnum="a-o" numlevel="1" lineno="254" slineno="2-62" level="2"><display>(a)</display>must be at least 18 years old; and</subsection><subsection ssid="7-null-143" dnum="b-o" numlevel="1" lineno="255" slineno="2-63" level="2"><display>(b)</display>may affiliate with any political party.</subsection></subsection><subsection ssid="7-null-144" dnum="8-o" numlevel="1" lineno="256" slineno="2-64" level="1"><display>(8)</display>It is unlawful for any person to:<subsection ssid="7-null-145" dnum="a-o" numlevel="1" lineno="257" slineno="2-65" level="2"><display>(a)</display>knowingly sign the nomination petition described in this section or Section <xref depth="3" refnumber="20A-9-408" start="0"><ln numlevel="1" lineno="258" slineno="2-66"/>20A-9-408</xref>:<subsection ssid="7-null-146" dnum="i-o" numlevel="1" lineno="259" slineno="2-67" level="3"><display>(i)</display>with any name other than the person's own name;</subsection><subsection ssid="7-null-147" dnum="ii-o" numlevel="1" lineno="260" slineno="2-68" level="3"><display>(ii)</display>more than once for the same candidate; or</subsection><subsection ssid="7-null-148" dnum="iii-o" numlevel="1" lineno="261" slineno="2-69" level="3"><display>(iii)</display>if the person is not registered to vote in this state;</subsection></subsection><subsection ssid="7-null-149" dnum="b-o" numlevel="1" lineno="262" slineno="2-70" level="2"><display>(b)</display>sign the verification of a signature for a nomination petition if the person:<subsection ssid="7-null-150" dnum="i-o" numlevel="1" lineno="263" slineno="2-71" level="3"><display>(i)</display>has not witnessed the signing by those persons whose names appear on the <ln numlevel="1" lineno="264" slineno="2-72"/>nomination petition; or</subsection><subsection ssid="7-null-151" dnum="ii-o" numlevel="1" lineno="265" slineno="2-73" level="3"><display>(ii)</display>knows that a person whose signature appears on the nomination petition is not <ln numlevel="1" lineno="266" slineno="2-74"/>registered to vote in this state;</subsection></subsection><subsection ssid="7-null-152" dnum="c-o" numlevel="1" lineno="267" slineno="2-75" level="2"><display>(c)</display>pay compensation to any person to sign a nomination petition; or</subsection><subsection ssid="7-null-153" dnum="d-o" numlevel="1" lineno="268" slineno="2-76" level="2"><display>(d)</display>pay compensation to any person to circulate a nomination petition, if the <ln numlevel="1" lineno="269" slineno="2-77"/>compensation is based directly on the number of signatures submitted to a filing <ln numlevel="1" lineno="270" slineno="2-78"/>officer rather than on the number of signatures verified or on some other basis.</subsection></subsection><subsection ssid="7-null-154" dnum="9-o" numlevel="1" lineno="271" slineno="2-79" level="1"><display>(9)</display>Any person violating Subsection <xref depth="4" refnumber="20A-9-405(8)" start="0">(8)</xref> is guilty of a class A misdemeanor.</subsection><subsection ssid="7-167" dnum="_-o:10-i" numlevel="1" lineno="272" slineno="2-80" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1099" style="1" owner="i" level="1" amendtag="start">(10)</amend></display><amend anum="0" ea="amend" pairid="96" groupid="78" style="1" owner="jchristopherson" level="1" amendtag="end">If a person whose signature appears on a nomination petition notifies the filing officer <ln numlevel="1" lineno="273" slineno="2-81"/>that the person did not sign the nomination petition, the filing officer shall, after making <ln numlevel="1" lineno="274" slineno="2-82"/>a reasonable attempt to determine the accuracy of the person's allegation, but no later <ln numlevel="1" lineno="275" slineno="2-83"/>than three business days after the day on which the allegation is received, notify the <ln numlevel="1" lineno="276" slineno="2-84"/>county or district attorney of:</amend><subsection ssid="7-168" dnum="_-o:a-i" numlevel="1" lineno="277" slineno="2-85" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1100" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="100" groupid="81" style="1" owner="jchristopherson" level="1" amendtag="end">the nature of the allegation; and</amend></subsection><subsection ssid="7-null-163" dnum="_-o:ii-i" numlevel="1" lineno="303" slineno="2-111" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1115" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="44" groupid="35" style="1" owner="jchristopherson" level="1" amendtag="end">update the nomination petition signature totals.</amend></subsection></subsection><subsection ssid="7-null-164" dnum="_-o:b-i" numlevel="1" lineno="304" slineno="2-112" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1116" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="49" groupid="39" style="1" owner="jchristopherson" level="1" amendtag="end">The filing officer shall comply with Subsection <xref depth="4" refnumber="20A-9-405(12)(a)">(12)(a)</xref> no later than 5 p.m. the day <ln numlevel="1" lineno="305" slineno="2-113"/>before the day of:</amend><subsection ssid="7-178" dnum="_-o:i-i" numlevel="1" lineno="306" slineno="2-114" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1117" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="159" groupid="129" style="1" owner="jchristopherson" level="1" amendtag="end">if the candidate to which the petition relates is seeking the nomination of a <ln numlevel="1" lineno="307" slineno="2-115"/>registered political party that is not a qualified political party, the deadline <ln numlevel="1" lineno="308" slineno="2-116"/>described in Subsection <xref depth="4" refnumber="20A-9-202(1)(b)">20A-9-202(1)(b)</xref>; or</amend></subsection><subsection ssid="7-179" dnum="_-o:ii-i" numlevel="1" lineno="309" slineno="2-117" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1118" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="164" groupid="133" style="1" owner="jchristopherson" level="1" amendtag="end">if the candidate to which the petition relates is seeking the nomination of a <ln numlevel="1" lineno="310" slineno="2-118"/>qualified political party, the convention described in Subsection <xref depth="4" refnumber="20A-9-408(11)">20A-9-408(11)</xref><ln numlevel="1" lineno="311" slineno="2-119"/>((c).</amend></subsection></subsection></subsection></section></bsec><bsec buid="20" num="20A-9-406" type="amend" src="code" uid="C20A-9-S406_2026050620260506" sort="20A09 04060020260506" numlevel="1" lineno="312" slineno="3-1" sn="3"><section number="20A-9-406" numlevel="1" lineno="313" slineno="3-2" type="amend"><secline lineno="312">Section 3. Section <bold>20A-9-406</bold> is amended to read:</secline><catline lineno="313"><bold>20A-9-406<parens/>. Qualified political party -- Requirements and exemptions.</bold></catline><sectionText lineno="314"><tab/>The following provisions apply to a qualified political party:</sectionText><subsection ssid="20-null-1" dnum="1-o" numlevel="1" lineno="315" slineno="3-4" level="1"><display>(1)</display>the qualified political party shall, no later than 5 p.m. on the first Monday of October of <ln numlevel="1" lineno="316" slineno="3-5"/>each odd-numbered year, certify to the lieutenant governor the identity of one or more <ln numlevel="1" lineno="317" slineno="3-6"/>registered political parties whose members may vote for the qualified political party's <ln numlevel="1" lineno="318" slineno="3-7"/>candidates and whether unaffiliated voters may vote for the qualified political party's <ln numlevel="1" lineno="319" slineno="3-8"/>candidates;</subsection><subsection ssid="20-null-2" dnum="2-o" numlevel="1" lineno="320" slineno="3-9" level="1"><display>(2)</display>the following provisions do not apply to a nomination for the qualified political party:<subsection ssid="20-null-3" dnum="a-o" numlevel="1" lineno="321" slineno="3-10" level="2"><display>(a)</display>Subsections <xref depth="4" refnumber="20A-9-403(1)" start="0">20A-9-403(1)</xref> through <xref depth="4" refnumber="20A-9-403(3)(b)" start="0">(3)(b)</xref> and Subsections <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="12" groupid="11" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="20A-9-406(3)(d)(ii)">(3)(d)(ii)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="11" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="20A-9-403(3)(d)(ii)"><ln numlevel="1" lineno="322" slineno="3-11"/>20A-9-403(3)(d)(ii)</xref></amend> through <xref depth="4" refnumber="20A-9-403(4)(a)" start="0">(4)(a)</xref>;<amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both"> and</amend></subsection><subsection ssid="20-null-4" dnum="b-o" numlevel="1" lineno="323" slineno="3-12" level="2"><display>(b)</display>Subsection <xref depth="4" refnumber="20A-9-403(5)(c)" start="0">20A-9-403(5)(c)</xref><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="7" groupid="6" style="2" owner="jchristopherson" level="1" deltag="both">; and</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">.</amend></subsection><subsection ssid="20-null-5" dnum="c-o:_-i" numlevel="1" lineno="324" slineno="3-13" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1123" style="2" owner="o" level="1" deltag="start">(c)</amend></display><amend anum="0" ea="erase" pairid="8" groupid="7" style="2" owner="jchristopherson" level="1" deltag="end">Section <xref depth="3" refnumber="20A-9-405" start="0">20A-9-405</xref>;</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="20-null-6" dnum="3-o" numlevel="1" lineno="325" slineno="3-14" level="1"><display>(3)</display>an individual may only seek the nomination of the qualified political party by using a <ln numlevel="1" lineno="326" slineno="3-15"/>method described in Section <xref depth="3" refnumber="20A-9-407" start="0">20A-9-407</xref>, Section <xref depth="3" refnumber="20A-9-408" start="0">20A-9-408</xref>, or both;</subsection><subsection ssid="20-null-7" dnum="4-o" numlevel="1" lineno="327" slineno="3-16" level="1"><display>(4)</display>the qualified political party shall comply with the provisions of Sections <xref depth="3" refnumber="20A-9-407" start="0">20A-9-407</xref>, <xref depth="3" refnumber="20A-9-408" start="0"><ln numlevel="1" lineno="328" slineno="3-17"/>20A-9-408</xref>, and <xref depth="3" refnumber="20A-9-409" start="0">20A-9-409</xref>;</subsection><subsection ssid="20-null-8" dnum="5-o" numlevel="1" lineno="329" slineno="3-18" level="1"><display>(5)</display>notwithstanding Subsection <xref depth="4" refnumber="20A-6-301(1)(a)" start="0">20A-6-301(1)(a)</xref>, <xref depth="4" refnumber="20A-6-301(1)(e)" start="0">(1)(e)</xref>, or <xref depth="4" refnumber="20A-6-301(2)(a)" start="0">(2)(a)</xref>, each election officer shall <ln numlevel="1" lineno="330" slineno="3-19"/>ensure that a ballot described in Section <xref depth="3" refnumber="20A-6-301" start="0">20A-6-301</xref> includes each individual nominated <ln numlevel="1" lineno="331" slineno="3-20"/>by a qualified political party:<subsection ssid="20-null-9" dnum="a-o" numlevel="1" lineno="332" slineno="3-21" level="2"><display>(a)</display>under the qualified political party's name, if any; or</subsection><subsection ssid="20-null-10" dnum="b-o" numlevel="1" lineno="333" slineno="3-22" level="2"><display>(b)</display>under the title of the qualified registered political party as designated by the qualified <ln numlevel="1" lineno="334" slineno="3-23"/>political party in the certification described in Subsection <xref depth="4" refnumber="20A-9-406(1)" start="0">(1)</xref>, or, if none is <ln numlevel="1" lineno="335" slineno="3-24"/>designated, then under some suitable title;</subsection></subsection><subsection ssid="20-null-11" dnum="6-o" numlevel="1" lineno="336" slineno="3-25" level="1"><display>(6)</display>notwithstanding Subsection <xref depth="4" refnumber="20A-6-302(1)(a)" start="0">20A-6-302(1)(a)</xref>, each election officer shall ensure, for <ln numlevel="1" lineno="337" slineno="3-26"/>ballots in regular general elections, that each candidate who is nominated by the <ln numlevel="1" lineno="338" slineno="3-27"/>qualified political party is listed by party;</subsection><subsection ssid="20-null-12" dnum="7-o" numlevel="1" lineno="339" slineno="3-28" level="1"><display>(7)</display>notwithstanding Subsection <xref depth="4" refnumber="20A-6-304(1)(e)" start="0">20A-6-304(1)(e)</xref>, each election officer shall ensure that the <ln numlevel="1" lineno="340" slineno="3-29"/>party designation of each candidate who is nominated by the qualified political party is <ln numlevel="1" lineno="341" slineno="3-30"/>displayed adjacent to the candidate's name on a mechanical ballot;</subsection><subsection ssid="20-null-13" dnum="8-o" numlevel="1" lineno="342" slineno="3-31" level="1"><display>(8)</display>"candidates for elective office," defined in Subsection <xref depth="4" refnumber="20A-9-101(1)(a)" start="0">20A-9-101(1)(a)</xref>, also includes an <ln numlevel="1" lineno="343" slineno="3-32"/>individual who files a declaration of candidacy under Section <xref depth="3" refnumber="20A-9-407" start="0">20A-9-407</xref> or <xref depth="3" refnumber="20A-9-408" start="0">20A-9-408</xref> <ln numlevel="1" lineno="344" slineno="3-33"/>to run in a regular general election for a federal office, constitutional office, multicounty <ln numlevel="1" lineno="345" slineno="3-34"/>office, or county office;</subsection><subsection ssid="20-null-14" dnum="9-o" numlevel="1" lineno="346" slineno="3-35" level="1"><display>(9)</display>an individual who is nominated by, or seeking the nomination of, the qualified political <ln numlevel="1" lineno="347" slineno="3-36"/>party is not required to comply with Subsection <xref depth="4" refnumber="20A-9-201(1)(c)" start="0">20A-9-201(1)(c)</xref>;</subsection><subsection ssid="20-null-15" dnum="10-o" numlevel="1" lineno="348" slineno="3-37" level="1"><display>(10)</display>notwithstanding Subsection <xref depth="4" refnumber="20A-9-403(3)" start="0">20A-9-403(3)</xref>, the qualified political party is entitled to <ln numlevel="1" lineno="349" slineno="3-38"/>have each of the qualified political party's candidates for elective office appear on the <ln numlevel="1" lineno="350" slineno="3-39"/>primary ballot of the qualified political party with an indication that each candidate is a <ln numlevel="1" lineno="351" slineno="3-40"/>candidate for the qualified political party;</subsection><subsection ssid="20-null-16" dnum="11-o" numlevel="1" lineno="352" slineno="3-41" level="1"><display>(11)</display>notwithstanding Subsection <xref depth="4" refnumber="20A-9-403(4)(a)" start="0">20A-9-403(4)(a)</xref>, the lieutenant governor shall include on <ln numlevel="1" lineno="353" slineno="3-42"/>the list provided by the lieutenant governor to the county clerks:<subsection ssid="20-null-17" dnum="a-o" numlevel="1" lineno="354" slineno="3-43" level="2"><display>(a)</display>the names of all candidates of the qualified political party for federal, constitutional, <ln numlevel="1" lineno="355" slineno="3-44"/>multicounty, and county offices; and</subsection><subsection ssid="20-null-18" dnum="b-o" numlevel="1" lineno="356" slineno="3-45" level="2"><display>(b)</display>the names of unopposed candidates for elective office who have been nominated by <ln numlevel="1" lineno="357" slineno="3-46"/>the qualified political party and instruct the county clerks to exclude such candidates <ln numlevel="1" lineno="358" slineno="3-47"/>from the primary-election ballot;</subsection></subsection><subsection ssid="20-null-19" dnum="12-o" numlevel="1" lineno="359" slineno="3-48" level="1"><display>(12)</display>notwithstanding Subsection <xref depth="4" refnumber="20A-9-403(5)(c)" start="0">20A-9-403(5)(c)</xref>, a candidate who is unopposed for an <ln numlevel="1" lineno="360" slineno="3-49"/>elective office in the regular primary election of the qualified political party is <ln numlevel="1" lineno="361" slineno="3-50"/>nominated by the party for that office without appearing on the primary ballot; and</subsection><subsection ssid="20-null-20" dnum="13-o" numlevel="1" lineno="362" slineno="3-51" level="1"><display>(13)</display>notwithstanding the provisions of Subsections <xref depth="4" refnumber="20A-9-403(1)" start="0">20A-9-403(1)</xref> and <xref depth="4" refnumber="20A-9-403(2)" start="0">(2)</xref> and Section <xref depth="3" refnumber="20A-9-405" start="0"><ln numlevel="1" lineno="363" slineno="3-52"/>20A-9-405</xref>, the qualified political party is entitled to have the names of its candidates for <ln numlevel="1" lineno="364" slineno="3-53"/>elective office featured with party affiliation on the ballot at a regular general election.</subsection></section></bsec><bsec buid="23" num="20A-9-408" type="amend" src="code" uid="C20A-9-S408_2026050620260506" sort="20A09 04080020260506" numlevel="1" lineno="365" slineno="4-1" sn="4"><section number="20A-9-408" numlevel="1" lineno="366" slineno="4-2" type="amend"><secline lineno="365">Section 4. Section <bold>20A-9-408</bold> is amended to read:</secline><catline lineno="366"><bold>20A-9-408<parens/>. Signature-gathering process to seek the nomination of a qualified <ln numlevel="1" lineno="367" slineno="4-3"/>political party -- Removal of signature.</bold></catline><subsection ssid="23-null-1" dnum="1-o" numlevel="1" lineno="368" slineno="4-4" level="1" placement="noreturn"><display>(1)</display>This section describes the requirements for a member of a qualified political party who <ln numlevel="1" lineno="369" slineno="4-5"/>is seeking the nomination of the qualified political party for an elective office through <ln numlevel="1" lineno="370" slineno="4-6"/>the signature-gathering process described in this section.</subsection><subsection ssid="23-null-2" dnum="2-o" numlevel="1" lineno="371" slineno="4-7" level="1"><display>(2)</display>Notwithstanding Subsection <xref depth="4" refnumber="20A-9-201(7)(a)" start="0">20A-9-201(7)(a)</xref>, the form of the declaration of candidacy <ln numlevel="1" lineno="372" slineno="4-8"/>for a member of a qualified political party who is nominated by, or who is seeking the <ln numlevel="1" lineno="373" slineno="4-9"/>nomination of, the qualified political party under this section shall be substantially as <ln numlevel="1" lineno="374" slineno="4-10"/>described in Section <xref depth="3" refnumber="20A-9-408.5" start="0">20A-9-408.5</xref>.</subsection><subsection ssid="23-null-3" dnum="3-o" numlevel="1" lineno="375" slineno="4-11" level="1"><display>(3)</display>Notwithstanding Subsection <xref depth="4" refnumber="20A-9-202(1)(a)" start="0">20A-9-202(1)(a)</xref>, and except as provided in Subsection <xref depth="4" refnumber="20A-9-202(4)" start="0"><ln numlevel="1" lineno="376" slineno="4-12"/>20A-9-202(4)</xref>, a member of a qualified political party who, under this section, is seeking <ln numlevel="1" lineno="377" slineno="4-13"/>the nomination of the qualified political party for an elective office that is to be filled at <ln numlevel="1" lineno="378" slineno="4-14"/>the next general election shall:<subsection ssid="23-null-4" dnum="a-o" numlevel="1" lineno="379" slineno="4-15" level="2"><display>(a)</display>except to the extent otherwise provided in Subsection <xref depth="4" refnumber="20A-9-408(13)(a)">(13)(a)</xref>, during the applicable <ln numlevel="1" lineno="380" slineno="4-16"/>declaration of candidacy filing period described in Section <xref depth="3" refnumber="20A-9-201.5" start="0">20A-9-201.5</xref>, and before <ln numlevel="1" lineno="381" slineno="4-17"/>gathering signatures under this section, file with the filing officer on a form approved <ln numlevel="1" lineno="382" slineno="4-18"/>by the lieutenant governor a notice of intent to gather signatures for candidacy that <ln numlevel="1" lineno="383" slineno="4-19"/>includes:<subsection ssid="23-null-5" dnum="i-o" numlevel="1" lineno="384" slineno="4-20" level="3"><display>(i)</display>the name of the member who will attempt to become a candidate for a registered <ln numlevel="1" lineno="385" slineno="4-21"/>political party under this section;</subsection><subsection ssid="23-null-6" dnum="ii-o" numlevel="1" lineno="386" slineno="4-22" level="3"><display>(ii)</display>the name of the registered political party for which the member is seeking <ln numlevel="1" lineno="387" slineno="4-23"/>nomination;</subsection><subsection ssid="23-null-7" dnum="iii-o" numlevel="1" lineno="388" slineno="4-24" level="3"><display>(iii)</display>the office for which the member is seeking to become a candidate;</subsection><subsection ssid="23-null-8" dnum="iv-o" numlevel="1" lineno="389" slineno="4-25" level="3"><display>(iv)</display>the address and telephone number of the member; and</subsection><subsection ssid="23-null-9" dnum="v-o" numlevel="1" lineno="390" slineno="4-26" level="3"><display>(v)</display>other information required by the lieutenant governor;</subsection></subsection><subsection ssid="23-null-10" dnum="b-o" numlevel="1" lineno="391" slineno="4-27" level="2"><display>(b)</display>except as provided in Subsection <xref depth="4" refnumber="20A-9-202(1)(c)" start="0">20A-9-202(1)(c)</xref>, file a declaration of candidacy, in <ln numlevel="1" lineno="392" slineno="4-28"/>person, with the filing officer during the applicable declaration of candidacy filing <ln numlevel="1" lineno="393" slineno="4-29"/>period described in Section <xref depth="3" refnumber="20A-9-201.5" start="0">20A-9-201.5</xref>; and</subsection><subsection ssid="23-null-11" dnum="c-o" numlevel="1" lineno="394" slineno="4-30" level="2"><display>(c)</display>pay the filing fee.</subsection></subsection><subsection ssid="23-null-12" dnum="4-o" numlevel="1" lineno="395" slineno="4-31" level="1"><display>(4)</display>Notwithstanding Subsection <xref depth="4" refnumber="20A-9-202(2)(a)" start="0">20A-9-202(2)(a)</xref>, a member of a qualified political party <ln numlevel="1" lineno="396" slineno="4-32"/>who, under this section, is seeking the nomination of the qualified political party for the <ln numlevel="1" lineno="397" slineno="4-33"/>office of district attorney within a multicounty prosecution district that is to be filled at <ln numlevel="1" lineno="398" slineno="4-34"/>the next general election shall:<subsection ssid="23-null-13" dnum="a-o" numlevel="1" lineno="399" slineno="4-35" level="2"><display>(a)</display>during the applicable declaration of candidacy filing period described in Section <xref depth="3" refnumber="20A-9-201.5" start="0"><ln numlevel="1" lineno="400" slineno="4-36"/>20A-9-201.5</xref>, and before gathering signatures under this section, file with the filing <ln numlevel="1" lineno="401" slineno="4-37"/>officer on a form approved by the lieutenant governor a notice of intent to gather <ln numlevel="1" lineno="402" slineno="4-38"/>signatures for candidacy that includes:<subsection ssid="23-null-14" dnum="i-o" numlevel="1" lineno="403" slineno="4-39" level="3"><display>(i)</display>the name of the member who will attempt to become a candidate for a registered <ln numlevel="1" lineno="404" slineno="4-40"/>political party under this section;</subsection><subsection ssid="23-null-15" dnum="ii-o" numlevel="1" lineno="405" slineno="4-41" level="3"><display>(ii)</display>the name of the registered political party for which the member is seeking <ln numlevel="1" lineno="406" slineno="4-42"/>nomination;</subsection><subsection ssid="23-null-16" dnum="iii-o" numlevel="1" lineno="407" slineno="4-43" level="3"><display>(iii)</display>the office for which the member is seeking to become a candidate;</subsection><subsection ssid="23-null-17" dnum="iv-o" numlevel="1" lineno="408" slineno="4-44" level="3"><display>(iv)</display>the address and telephone number of the member; and</subsection><subsection ssid="23-null-18" dnum="v-o" numlevel="1" lineno="409" slineno="4-45" level="3"><display>(v)</display>other information required by the lieutenant governor;</subsection></subsection><subsection ssid="23-null-19" dnum="b-o" numlevel="1" lineno="410" slineno="4-46" level="2"><display>(b)</display>except as provided in Subsection <xref depth="4" refnumber="20A-9-202(1)(c)" start="0">20A-9-202(1)(c)</xref>, file a declaration of candidacy, in <ln numlevel="1" lineno="411" slineno="4-47"/>person, with the filing officer during the applicable declaration of candidacy filing <ln numlevel="1" lineno="412" slineno="4-48"/>period described in Section <xref depth="3" refnumber="20A-9-201.5" start="0">20A-9-201.5</xref>; and</subsection><subsection ssid="23-null-20" dnum="c-o" numlevel="1" lineno="413" slineno="4-49" level="2"><display>(c)</display>pay the filing fee.</subsection></subsection><subsection ssid="23-null-21" dnum="5-o" numlevel="1" lineno="414" slineno="4-50" level="1"><display>(5)</display>Notwithstanding Subsection <xref depth="4" refnumber="20A-9-202(3)(a)(iii)" start="0">20A-9-202(3)(a)(iii)</xref>, a lieutenant governor candidate who <ln numlevel="1" lineno="415" slineno="4-51"/>files as the joint-ticket running mate of an individual who is nominated by a qualified <ln numlevel="1" lineno="416" slineno="4-52"/>political party, under this section, for the office of governor shall, during the applicable <ln numlevel="1" lineno="417" slineno="4-53"/>declaration of candidacy filing period described in Section <xref depth="3" refnumber="20A-9-201.5" start="0">20A-9-201.5</xref>, file a <ln numlevel="1" lineno="418" slineno="4-54"/>declaration of candidacy and submit a letter from the candidate for governor that names <ln numlevel="1" lineno="419" slineno="4-55"/>the lieutenant governor candidate as a joint-ticket running mate.</subsection><subsection ssid="23-null-22" dnum="6-o" numlevel="1" lineno="420" slineno="4-56" level="1"><display>(6)</display>The lieutenant governor shall ensure that the certification described in Subsection <xref depth="4" refnumber="20A-9-701(1)" start="0"><ln numlevel="1" lineno="421" slineno="4-57"/>20A-9-701(1)</xref> also includes the name of each candidate nominated by a qualified <ln numlevel="1" lineno="422" slineno="4-58"/>political party under this section.</subsection><subsection ssid="23-null-23" dnum="7-o" numlevel="1" lineno="423" slineno="4-59" level="1"><display>(7)</display>Notwithstanding Subsection <xref depth="4" refnumber="20A-9-701(2)" start="0">20A-9-701(2)</xref>, the ballot shall, for each candidate who is <ln numlevel="1" lineno="424" slineno="4-60"/>nominated by a qualified political party under this section, designate the qualified <ln numlevel="1" lineno="425" slineno="4-61"/>political party that nominated the candidate.</subsection><subsection ssid="23-null-24" dnum="8-o" numlevel="1" lineno="426" slineno="4-62" level="1"><display>(8)</display>A member of a qualified political party may seek the nomination of the qualified <ln numlevel="1" lineno="427" slineno="4-63"/>political party for an elective office by:<subsection ssid="23-null-25" dnum="a-o" numlevel="1" lineno="428" slineno="4-64" level="2"><display>(a)</display>complying with the requirements described in this section; and</subsection><subsection ssid="23-null-26" dnum="b-o" numlevel="1" lineno="429" slineno="4-65" level="2"><display>(b)</display>collecting signatures, on a form approved by the lieutenant governor that complies <ln numlevel="1" lineno="430" slineno="4-66"/>with Subsection <xref depth="4" refnumber="20A-9-405(3)" start="0">20A-9-405(3)</xref>, during the period beginning on the day on which the <ln numlevel="1" lineno="431" slineno="4-67"/>member files a notice of intent to gather signatures and ending at the applicable <ln numlevel="1" lineno="432" slineno="4-68"/>deadline described in Subsection <xref tempid="127" depth="4" refnumber="20A-9-408(12)">(12)</xref>, in the following amounts:<subsection ssid="23-null-27" dnum="i-o" numlevel="1" lineno="433" slineno="4-69" level="3"><display>(i)</display>for a statewide race, 28,000 signatures of registered voters in the state who are <ln numlevel="1" lineno="434" slineno="4-70"/>permitted by the qualified political party to vote for the qualified political party's <ln numlevel="1" lineno="435" slineno="4-71"/>candidates in a primary election;</subsection><subsection ssid="23-null-28" dnum="ii-o" numlevel="1" lineno="436" slineno="4-72" level="3"><display>(ii)</display>except as provided in Subsection <xref depth="4" refnumber="20A-9-408(13)(b)">(13)(b)</xref>, for a congressional district race, 7,000 <ln numlevel="1" lineno="437" slineno="4-73"/>signatures of registered voters who are residents of the congressional district and <ln numlevel="1" lineno="438" slineno="4-74"/>are permitted by the qualified political party to vote for the qualified political <ln numlevel="1" lineno="439" slineno="4-75"/>party's candidates in a primary election;</subsection><subsection ssid="23-null-29" dnum="iii-o" numlevel="1" lineno="440" slineno="4-76" level="3"><display>(iii)</display>for a state Senate district race, 2,000 signatures of registered voters who are <ln numlevel="1" lineno="441" slineno="4-77"/>residents of the state Senate district and are permitted by the qualified political <ln numlevel="1" lineno="442" slineno="4-78"/>party to vote for the qualified political party's candidates in a primary election;</subsection><subsection ssid="23-null-30" dnum="iv-o" numlevel="1" lineno="443" slineno="4-79" level="3"><display>(iv)</display>for a state House district race, 1,000 signatures of registered voters who are <ln numlevel="1" lineno="444" slineno="4-80"/>residents of the state House district and are permitted by the qualified political <ln numlevel="1" lineno="445" slineno="4-81"/>party to vote for the qualified political party's candidates in a primary election;</subsection><subsection ssid="23-null-31" dnum="v-o" numlevel="1" lineno="446" slineno="4-82" level="3"><display>(v)</display>for a State Board of Education race, the lesser of:<subsection ssid="23-null-32" dnum="A-o" numlevel="1" lineno="447" slineno="4-83" level="4"><display>(A)</display>2,000 signatures of registered voters who are residents of the State Board of <ln numlevel="1" lineno="448" slineno="4-84"/>Education district and are permitted by the qualified political party to vote for <ln numlevel="1" lineno="449" slineno="4-85"/>the qualified political party's candidates in a primary election; or</subsection><subsection ssid="23-null-33" dnum="B-o" numlevel="1" lineno="450" slineno="4-86" level="4"><display>(B)</display>3% of the registered voters of the qualified political party who are residents of <ln numlevel="1" lineno="451" slineno="4-87"/>the applicable State Board of Education district; and</subsection></subsection><subsection ssid="23-null-34" dnum="vi-o" numlevel="1" lineno="452" slineno="4-88" level="3"><display>(vi)</display>for a county office race, signatures of 3% of the registered voters who are <ln numlevel="1" lineno="453" slineno="4-89"/>residents of the area permitted to vote for the county office and are permitted by <ln numlevel="1" lineno="454" slineno="4-90"/>the qualified political party to vote for the qualified political party's candidates in <ln numlevel="1" lineno="455" slineno="4-91"/>a primary election.</subsection></subsection></subsection><subsection ssid="23-null-35" dnum="9-o" numlevel="1" lineno="456" slineno="4-92" level="1" space="false"><display>(9)</display><subsection ssid="23-null-36" dnum="a-o" level="2" placement="sameline"><display>(a)</display>This Subsection <xref depth="4" refnumber="20A-9-408(9)" start="0">(9)</xref> applies only to the manual candidate qualification process.</subsection><subsection ssid="23-null-37" dnum="b-o" numlevel="1" lineno="457" slineno="4-93" level="2"><display>(b)</display>In order for a member of the qualified political party to qualify as a candidate for the <ln numlevel="1" lineno="458" slineno="4-94"/>qualified political party's nomination for an elective office under this section, using <ln numlevel="1" lineno="459" slineno="4-95"/>the manual candidate qualification process, the member shall:<subsection ssid="23-null-38" dnum="i-o" numlevel="1" lineno="460" slineno="4-96" level="3"><display>(i)</display>collect the signatures on a form approved by the lieutenant governor, using the <ln numlevel="1" lineno="461" slineno="4-97"/>same circulation and verification requirements described in Sections <xref depth="3" refnumber="20A-7-105" start="0">20A-7-105</xref> <ln numlevel="1" lineno="462" slineno="4-98"/>and <xref depth="3" refnumber="20A-7-204" start="0">20A-7-204</xref>; and</subsection><subsection ssid="23-null-39" dnum="ii-o" numlevel="1" lineno="463" slineno="4-99" level="3"><display>(ii)</display>in accordance with Section <xref depth="3" refnumber="20A-9-408.3">20A-9-408.3</xref>, submit the signatures to the election <ln numlevel="1" lineno="464" slineno="4-100"/>officer before the applicable deadline described in Subsection <xref tempid="247" depth="4" refnumber="20A-9-408(12)">(12)</xref>.</subsection></subsection><subsection ssid="23-null-40" dnum="c-o" numlevel="1" lineno="465" slineno="4-101" level="2"><display>(c)</display>Upon timely receipt of the signatures described in Subsections <xref depth="4" refnumber="20A-9-408(8)" start="0">(8)</xref> and <xref depth="4" refnumber="20A-9-408(9)(b)" start="0">(9)(b)</xref>, and in <ln numlevel="1" lineno="466" slineno="4-102"/>accordance with Section <xref depth="3" refnumber="20A-9-408.3">20A-9-408.3</xref>, the election officer shall, no later than the <ln numlevel="1" lineno="467" slineno="4-103"/>earlier of 14 calendar days after the day on which the election officer receives the <ln numlevel="1" lineno="468" slineno="4-104"/>signatures, or one day before the day on which the qualified political party holds the <ln numlevel="1" lineno="469" slineno="4-105"/>convention to select a nominee for the elective office to which the signature packets <ln numlevel="1" lineno="470" slineno="4-106"/>relate:<subsection ssid="23-null-41" dnum="i-o" numlevel="1" lineno="471" slineno="4-107" level="3"><display>(i)</display>check the name of each individual who completes the verification for a signature <ln numlevel="1" lineno="472" slineno="4-108"/>packet to determine whether each individual is at least 18 years old;</subsection><subsection ssid="23-null-42" dnum="ii-o" numlevel="1" lineno="473" slineno="4-109" level="3"><display>(ii)</display>submit the name of each individual described in Subsection <xref depth="4" refnumber="20A-9-408(9)(c)(i)" start="0">(9)(c)(i)</xref> who is not at <ln numlevel="1" lineno="474" slineno="4-110"/>least 18 years old to the attorney general and the county attorney;</subsection><subsection ssid="23-null-43" dnum="iii-o" numlevel="1" lineno="475" slineno="4-111" level="3"><display>(iii)</display>with the assistance of the county clerk as applicable, determine whether each <ln numlevel="1" lineno="476" slineno="4-112"/>signer is a registered voter who is qualified to sign the petition, using the same <ln numlevel="1" lineno="477" slineno="4-113"/>method, described in Section <xref depth="3" refnumber="20A-1-1002" start="0">20A-1-1002</xref>, used to verify a signature on a petition; <ln numlevel="1" lineno="478" slineno="4-114"/>and</subsection><subsection ssid="23-null-44" dnum="iv-o" numlevel="1" lineno="479" slineno="4-115" level="3"><display>(iv)</display>certify whether each name is that of a registered voter who is qualified to sign the <ln numlevel="1" lineno="480" slineno="4-116"/>signature packet.</subsection></subsection><subsection ssid="23-81" dnum="_-o:d-i" numlevel="1" lineno="481" slineno="4-117" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1183" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="31" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="end">Subject to Subsection <xref depth="4" refnumber="20A-9-405(11)">20A-9-405(11)</xref>, an election officer shall, no later than five <ln numlevel="1" lineno="482" slineno="4-118"/>business days after the day on which the signature of an individual who signs a <ln numlevel="1" lineno="483" slineno="4-119"/>petition is certified under Subsection <xref depth="4" refnumber="20A-9-408(9)(c)(iv)">(9)(c)(iv)</xref>, post the individual's name and date of <ln numlevel="1" lineno="484" slineno="4-120"/>signature on the lieutenant governor's website, in a conspicuous location designated <ln numlevel="1" lineno="485" slineno="4-121"/>by the lieutenant governor, for at least 90 calendar days after the date of the primary <ln numlevel="1" lineno="486" slineno="4-122"/>election.</amend></subsection><subsection ssid="23-null-45" dnum="d-o:_-i" numlevel="1" lineno="487" slineno="4-123" ea="erase" anum="0" owner="jchristopherson" style="2" level="2" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1184" style="2" owner="o" level="1" deltag="start">(d)</amend></display><subsection ssid="23-null-46" dnum="i-o:_-i" ea="erase" anum="0" owner="jchristopherson" style="2" level="3" placement="sameline"><display><amend anum="0" ea="erase" pairid="1185" style="2" owner="o" level="1">(i)</amend></display><amend anum="0" ea="erase" pairid="15" groupid="11" style="2" owner="jchristopherson" level="1" deltag="end">A registered voter who physically signs a form under Subsections <xref depth="4" refnumber="20A-9-408(8)" start="0">(8)</xref> and <xref depth="4" refnumber="20A-9-408(9)(b)" start="0"><ln numlevel="1" lineno="488" slineno="4-124"/>(9)(b)</xref> may have the voter's signature removed from the form by, no later than 5 <ln numlevel="1" lineno="489" slineno="4-125"/>p.m. three business days after the day on which the member submits the signature <ln numlevel="1" lineno="490" slineno="4-126"/>form to the election officer, submitting to the election officer a statement <ln numlevel="1" lineno="491" slineno="4-127"/>requesting that the voter's signature be removed.</amend><amendoutend style="2"/></subsection><subsection ssid="23-null-47" dnum="ii-o:_-i" numlevel="1" lineno="492" slineno="4-128" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1186" style="2" owner="o" level="1" deltag="start">(ii)</amend></display><amend anum="0" ea="erase" pairid="20" groupid="16" style="2" owner="jchristopherson" level="1" deltag="end">A statement described in Subsection <xref depth="4" refnumber="20A-9-408(9)(d)(i)" start="0">(9)(d)(i)</xref> shall comply with the requirements <ln numlevel="1" lineno="493" slineno="4-129"/>described in Subsection <xref depth="4" refnumber="20A-1-1003(2)" start="0">20A-1-1003(2)</xref>.</amend><amendoutend style="2"/></subsection><subsection ssid="23-null-48" dnum="iii-o:_-i" numlevel="1" lineno="494" slineno="4-130" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1187" style="2" owner="o" level="1" deltag="start">(iii)</amend></display><amend anum="0" ea="erase" pairid="25" groupid="21" style="2" owner="jchristopherson" level="1" deltag="end">With the assistance of the county clerk as applicable, the election officer shall <ln numlevel="1" lineno="495" slineno="4-131"/>use the procedures described in Subsection <xref depth="4" refnumber="20A-1-1003(3)" start="0">20A-1-1003(3)</xref> to determine whether <ln numlevel="1" lineno="496" slineno="4-132"/>to remove an individual's signature after receiving a timely, valid statement <ln numlevel="1" lineno="497" slineno="4-133"/>requesting removal of the signature.</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="23-null-49" dnum="e-o" numlevel="1" lineno="498" slineno="4-134" level="2" space="false"><display>(e)</display><subsection ssid="23-null-50" dnum="i-o" level="3" placement="sameline"><display>(i)</display>An election officer shall, in accordance with this Subsection <xref refnumber="20A-9-408(9)(e)" depth="4">(9)(e)</xref> and rules <ln numlevel="1" lineno="499" slineno="4-135"/>made under Section <xref depth="3" refnumber="20A-3a-106">20A-3a-106</xref>, conduct regular audits of signature comparisons <ln numlevel="1" lineno="500" slineno="4-136"/>made between signatures gathered under this section and voter signatures <ln numlevel="1" lineno="501" slineno="4-137"/>maintained by the election officer.</subsection><subsection ssid="23-null-51" dnum="ii-o" numlevel="1" lineno="502" slineno="4-138" level="3"><display>(ii)</display>An individual who conducts an audit of signature comparisons under this section <ln numlevel="1" lineno="503" slineno="4-139"/>may not audit the individual's own work.</subsection><subsection ssid="23-null-52" dnum="iii-o" numlevel="1" lineno="504" slineno="4-140" level="3"><display>(iii)</display>The election officer shall:<subsection ssid="23-null-53" dnum="A-o" numlevel="1" lineno="505" slineno="4-141" level="4"><display>(A)</display>audit 1% of all signature comparisons described in Subsection <xref depth="4" refnumber="20A-9-408(9)(e)(i)">(9)(e)(i)</xref> to <ln numlevel="1" lineno="506" slineno="4-142"/>determine the accuracy of the comparisons made;</subsection><subsection ssid="23-null-54" dnum="B-o" numlevel="1" lineno="507" slineno="4-143" level="4"><display>(B)</display>record the individuals who conducted the audit;</subsection><subsection ssid="23-null-55" dnum="C-o" numlevel="1" lineno="508" slineno="4-144" level="4"><display>(C)</display>record the audit results;</subsection><subsection ssid="23-null-56" dnum="D-o" numlevel="1" lineno="509" slineno="4-145" level="4"><display>(D)</display>provide additional training or staff reassignments, as needed, based on the <ln numlevel="1" lineno="510" slineno="4-146"/>results of an audit described in Subsection <xref tempid="614" depth="4" refnumber="20A-9-408(9)(e)(i)">(9)(e)(i)</xref>; and</subsection><subsection ssid="23-null-57" dnum="E-o" numlevel="1" lineno="511" slineno="4-147" level="4"><display>(E)</display>record any remedial action taken.</subsection></subsection><subsection ssid="23-null-58" dnum="iv-o" numlevel="1" lineno="512" slineno="4-148" level="3"><display>(iv)</display>The audit results described in Subsection <xref depth="4" refnumber="20A-9-408(9)(e)(iii)(c)">(9)(e)(iii)(C)</xref> are a public record.</subsection></subsection><subsection ssid="23-null-59" dnum="f-o" numlevel="1" lineno="513" slineno="4-149" level="2"><display>(f)</display>An election officer who certifies signatures under Subsection <xref refnumber="20A-9-408(9)(c)" depth="4">(9)(c)</xref> or  <xref refnumber="20A-9-403(3)(d)" depth="4"><ln numlevel="1" lineno="514" slineno="4-150"/>20A-9-403(3)(d)</xref> shall, after certifying enough signatures to establish that a candidate <ln numlevel="1" lineno="515" slineno="4-151"/>has reached the applicable signature threshold described in Subsection <xref refnumber="20A-9-408(8)" depth="4">(8)</xref> or <xref refnumber="20A-9-403(3)(a)" depth="4"><ln numlevel="1" lineno="516" slineno="4-152"/>20A-9-403(3)(a)</xref>, as applicable, continue to certify signatures submitted for the <ln numlevel="1" lineno="517" slineno="4-153"/>candidate in excess of the number of signatures required, until the election officer <ln numlevel="1" lineno="518" slineno="4-154"/>either:<subsection ssid="23-null-60" dnum="i-o" numlevel="1" lineno="519" slineno="4-155" level="3"><display>(i)</display>certifies signatures equal to 110% of the applicable signature threshold; or</subsection><subsection ssid="23-null-61" dnum="ii-o" numlevel="1" lineno="520" slineno="4-156" level="3"><display>(ii)</display>has reviewed all signatures submitted for the candidate before reaching an <ln numlevel="1" lineno="521" slineno="4-157"/>amount equal to 110% of the applicable signature threshold.</subsection></subsection></subsection><subsection ssid="23-null-62" dnum="10-o" numlevel="1" lineno="522" slineno="4-158" level="1" space="false"><display>(10)</display><subsection ssid="23-null-63" dnum="a-o" level="2" placement="sameline"><display>(a)</display>This Subsection <xref depth="4" refnumber="20A-9-408(10)" start="0">(10)</xref> applies only to the electronic candidate qualification <ln numlevel="1" lineno="523" slineno="4-159"/>process.</subsection><subsection ssid="23-null-64" dnum="b-o" numlevel="1" lineno="524" slineno="4-160" level="2"><display>(b)</display>In order for a member of the qualified political party to qualify as a candidate for the <ln numlevel="1" lineno="525" slineno="4-161"/>qualified political party's nomination for an elective office under this section, the <ln numlevel="1" lineno="526" slineno="4-162"/>member shall, before the deadline described in Subsection <xref tempid="182" depth="4" refnumber="20A-9-408(12)">(12)</xref>, collect signatures <ln numlevel="1" lineno="527" slineno="4-163"/>electronically:<subsection ssid="23-null-65" dnum="i-o" numlevel="1" lineno="528" slineno="4-164" level="3"><display>(i)</display>in accordance with Section <xref depth="3" refnumber="20A-21-201" start="0">20A-21-201</xref>; and</subsection><subsection ssid="23-null-66" dnum="ii-o" numlevel="1" lineno="529" slineno="4-165" level="3"><display>(ii)</display>using progressive screens, in a format approved by the lieutenant governor, that <ln numlevel="1" lineno="530" slineno="4-166"/>complies with Subsection <xref depth="4" refnumber="20A-9-405(4)" start="0">20A-9-405(4)</xref>.</subsection></subsection><subsection ssid="23-null-67" dnum="c-o" numlevel="1" lineno="531" slineno="4-167" level="2"><display>(c)</display>Upon timely receipt of the signatures described in Subsections <xref depth="4" refnumber="20A-9-408(8)" start="0">(8)</xref> and <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="38" groupid="30" style="2" owner="jchristopherson" level="1" deltag="both">(9)(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="37" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(10)(b)</amend>, <ln numlevel="1" lineno="532" slineno="4-168"/>the election officer shall, no later than the earlier of 14 calendar days after the day on <ln numlevel="1" lineno="533" slineno="4-169"/>which the election officer receives the signatures, or one day before the day on which <ln numlevel="1" lineno="534" slineno="4-170"/>the qualified political party holds the convention to select a nominee for the elective <ln numlevel="1" lineno="535" slineno="4-171"/>office to which the signature packets relate:<subsection ssid="23-null-68" dnum="i-o" numlevel="1" lineno="536" slineno="4-172" level="3"><display>(i)</display>check the name of each individual who completes the verification for a signature <ln numlevel="1" lineno="537" slineno="4-173"/>to determine whether each individual is at least 18 years old; and</subsection><subsection ssid="23-null-69" dnum="ii-o" numlevel="1" lineno="538" slineno="4-174" level="3"><display>(ii)</display>submit the name of each individual described in Subsection <xref depth="4" refnumber="20A-9-408(10)(c)(i)" start="0">(10)(c)(i)</xref> who is not <ln numlevel="1" lineno="539" slineno="4-175"/>at least 18 years old to the attorney general and the county attorney.</subsection></subsection><subsection ssid="23-82" dnum="_-o:d-i" numlevel="1" lineno="540" slineno="4-176" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1209" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="36" groupid="28" style="1" owner="jchristopherson" level="1" amendtag="end">Subject to Subsection <xref depth="4" refnumber="20A-9-405(11)">20A-9-405(11)</xref>, an election officer shall, no later than five <ln numlevel="1" lineno="541" slineno="4-177"/>business days after the day on which the signature of an individual who signs a <ln numlevel="1" lineno="542" slineno="4-178"/>petition is certified under Section <xref depth="3" refnumber="20A-21-201">20A-21-201</xref>, post the name and date of signature of <ln numlevel="1" lineno="543" slineno="4-179"/>the individual on the lieutenant governor's website, in a conspicuous location <ln numlevel="1" lineno="544" slineno="4-180"/>designated by the lieutenant governor, for at least 90 calendar days after the date of <ln numlevel="1" lineno="545" slineno="4-181"/>the primary election.</amend></subsection></subsection><subsection ssid="23-null-70" dnum="11-o" numlevel="1" lineno="546" slineno="4-182" level="1" space="false"><display>(11)</display><subsection ssid="23-null-71" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An individual may not gather signatures under this section until after the <ln numlevel="1" lineno="547" slineno="4-183"/>individual files a notice of intent to gather signatures for candidacy described in this <ln numlevel="1" lineno="548" slineno="4-184"/>section.</subsection><subsection ssid="23-null-72" dnum="b-o" numlevel="1" lineno="549" slineno="4-185" level="2"><display>(b)</display>An individual who files a notice of intent to gather signatures for candidacy, <ln numlevel="1" lineno="550" slineno="4-186"/>described in Subsection <xref depth="4" refnumber="20A-9-408(3)(a)" start="0">(3)(a)</xref> or <xref depth="4" refnumber="20A-9-408(4)(a)" start="0">(4)(a)</xref>, is, beginning on the day on which the <ln numlevel="1" lineno="551" slineno="4-187"/>individual files the notice of intent to gather signatures for candidacy:<subsection ssid="23-null-73" dnum="i-o" numlevel="1" lineno="552" slineno="4-188" level="3"><display>(i)</display>required to comply with the reporting requirements that a candidate for office is <ln numlevel="1" lineno="553" slineno="4-189"/>required to comply with; and</subsection><subsection ssid="23-null-74" dnum="ii-o" numlevel="1" lineno="554" slineno="4-190" level="3"><display>(ii)</display>subject to the same enforcement provisions, and civil and criminal penalties, that <ln numlevel="1" lineno="555" slineno="4-191"/>apply to a candidate for office in relation to the reporting requirements described <ln numlevel="1" lineno="556" slineno="4-192"/>in Subsection <xref depth="4" refnumber="20A-9-408(11)(b)(i)" start="0">(11)(b)(i)</xref>.</subsection></subsection><subsection ssid="23-null-75" dnum="c-o" numlevel="1" lineno="557" slineno="4-193" level="2"><display>(c)</display>Upon timely receipt of the signatures described in Subsections <xref depth="4" refnumber="20A-9-408(8)" start="0">(8)</xref> and <xref depth="4" refnumber="20A-9-408(9)(b)" start="0">(9)(b)</xref>, or <ln numlevel="1" lineno="558" slineno="4-194"/>Subsections <xref depth="4" refnumber="20A-9-408(8)" start="0">(8)</xref> and <xref depth="4" refnumber="20A-9-408(10)(b)" start="0">(10)(b)</xref>, the election officer shall, no later than the day before the <ln numlevel="1" lineno="559" slineno="4-195"/>day on which the qualified political party holds the convention to select a nominee <ln numlevel="1" lineno="560" slineno="4-196"/>for the elective office to which the signature packets relate, notify the qualified <ln numlevel="1" lineno="561" slineno="4-197"/>political party and the lieutenant governor of the name of each member of the <ln numlevel="1" lineno="562" slineno="4-198"/>qualified political party who qualifies as a nominee of the qualified political party, <ln numlevel="1" lineno="563" slineno="4-199"/>under this section, for the elective office to which the convention relates.</subsection><subsection ssid="23-null-76" dnum="d-o" numlevel="1" lineno="564" slineno="4-200" level="2"><display>(d)</display>Upon receipt of a notice of intent to gather signatures for candidacy described in this <ln numlevel="1" lineno="565" slineno="4-201"/>section, the lieutenant governor shall post the notice of intent to gather signatures for <ln numlevel="1" lineno="566" slineno="4-202"/>candidacy on the lieutenant governor's website in the same location that the <ln numlevel="1" lineno="567" slineno="4-203"/>lieutenant governor posts a declaration of candidacy.</subsection></subsection><subsection ssid="23-null-77" dnum="12-o" numlevel="1" lineno="568" slineno="4-204" level="1"><display>(12)</display>The deadline before which a member of a qualified political party must collect and <ln numlevel="1" lineno="569" slineno="4-205"/>submit signatures to the election officer under this section is 5 p.m. on the last business <ln numlevel="1" lineno="570" slineno="4-206"/>day that is at least 14 calendar days before the day on which the qualified political <ln numlevel="1" lineno="571" slineno="4-207"/>party's convention for the office begins.</subsection><subsection ssid="23-null-78" dnum="13-o" numlevel="1" lineno="572" slineno="4-208" level="1"><display>(13)</display>For the 2026 election year only, an individual who desires to gather signatures to seek <ln numlevel="1" lineno="573" slineno="4-209"/>the nomination of a qualified political party for the office of United States representative <ln numlevel="1" lineno="574" slineno="4-210"/>shall:<subsection ssid="23-null-79" dnum="a-o" numlevel="1" lineno="575" slineno="4-211" level="2"><display>(a)</display>in accordance with Subsection <xref depth="4" refnumber="20A-9-408(3)(a)">(3)(a)</xref>, file a notice of intent to gather signatures <ln numlevel="1" lineno="576" slineno="4-212"/>during the period beginning at 8 a.m. on the first business day of January and ending <ln numlevel="1" lineno="577" slineno="4-213"/>at 5 p.m. on March 13, 2026; and</subsection><subsection ssid="23-null-80" dnum="b-o" numlevel="1" lineno="578" slineno="4-214" level="2"><display>(b)</display>during the period beginning on the day on which the individual files the notice of <ln numlevel="1" lineno="579" slineno="4-215"/>intent to gather signatures and ending at 5 p.m. on March 13, 2026, on a form <ln numlevel="1" lineno="580" slineno="4-216"/>approved by the lieutenant governor that complies with Subsection <xref depth="4" refnumber="20A-9-405(3)">20A-9-405(3)</xref>, <ln numlevel="1" lineno="581" slineno="4-217"/>collect 7,000 signatures of registered voters who are residents of the state and are <ln numlevel="1" lineno="582" slineno="4-218"/>permitted by the qualified political party to vote for the qualified political party's <ln numlevel="1" lineno="583" slineno="4-219"/>candidates in a primary election.</subsection></subsection></section></bsec><bsec buid="26" num="20A-9-502" type="amend" src="code" uid="C20A-9-S502_2026050620260506" sort="20A09 05020020260506" numlevel="1" lineno="585" slineno="5-2" sn="5"><flags numlevel="1" lineno="584" slineno="5-1">The following section is affected by a coordination clause at the end of this bill.</flags><section number="20A-9-502" numlevel="1" lineno="586" slineno="5-3" type="amend"><secline lineno="585">Section 5. Section <bold>20A-9-502</bold> is amended to read:</secline><catline lineno="586"><bold>20A-9-502<parens/>. Certificate of nomination -- Contents -- Circulation -- Verification -- <ln numlevel="1" lineno="587" slineno="5-4"/>Criminal penalty -- Removal of petition signature.</bold></catline><subsection ssid="26-null-1" dnum="1-o" numlevel="1" lineno="588" slineno="5-5" level="1" placement="noreturn"><display>(1)</display>The candidate shall:<subsection ssid="26-null-2" dnum="a-o" numlevel="1" lineno="589" slineno="5-6" level="2" format="full"><display>(a)</display>prepare a certificate of nomination in substantially the following form:<eol numlevel="1" lineno="590" slineno="5-7"/><para/>"State of Utah, County of ______________________________________________<eol numlevel="1" lineno="591" slineno="5-8"/><para/>I, ______________, declare my intention of becoming an unaffiliated candidate for the <ln numlevel="1" lineno="592" slineno="5-9"/>political group designated as ____ for the office of ____.  I do solemnly swear that I can <ln numlevel="1" lineno="593" slineno="5-10"/>qualify to hold that office both legally and constitutionally if selected, and that I reside at ____ <ln numlevel="1" lineno="594" slineno="5-11"/>Street, in the city of ____, county of ____, state of ______, zip code ____, phone ____, and <ln numlevel="1" lineno="595" slineno="5-12"/>that I am providing, or have provided, the required number of holographic signatures of <ln numlevel="1" lineno="596" slineno="5-13"/>registered voters required by law; that as a candidate at the next election I will not knowingly <ln numlevel="1" lineno="597" slineno="5-14"/>violate any election or campaign law; that, if filing via a designated agent for an office other <ln numlevel="1" lineno="598" slineno="5-15"/>than president of the United States, I will be out of the state of Utah during the entire candidate <ln numlevel="1" lineno="599" slineno="5-16"/>filing period; I will file all campaign financial disclosure reports as required by law; and I <ln numlevel="1" lineno="600" slineno="5-17"/>understand that failure to do so will result in my disqualification as a candidate for this office <ln numlevel="1" lineno="601" slineno="5-18"/>and removal of my name from the ballot.<eol numlevel="1" lineno="602" slineno="5-19"/><para/><right>__________________________________________</right><eol numlevel="1" lineno="603" slineno="5-20"/><para/><right>Subscribed and sworn to before me this ______(month\day\year).</right><eol numlevel="1" lineno="604" slineno="5-21"/><para/><right>__________________________________________</right><eol numlevel="1" lineno="605" slineno="5-22"/><para/><right>Notary Public (or other officer</right><eol numlevel="1" lineno="606" slineno="5-23"/><para/><right>qualified to administer oaths)";</right></subsection><subsection ssid="26-null-3" dnum="b-o" numlevel="1" lineno="607" slineno="5-24" level="2"><display>(b)</display>for each signature packet, bind signature sheets to a copy of the certificate of <ln numlevel="1" lineno="608" slineno="5-25"/>nomination and the circulator verification, that:<subsection ssid="26-null-4" dnum="i-o" numlevel="1" lineno="609" slineno="5-26" level="3"><display>(i)</display>are printed on sheets of paper 8-1/2 inches long and 11 inches wide;</subsection><subsection ssid="26-null-5" dnum="ii-o" numlevel="1" lineno="610" slineno="5-27" level="3"><display>(ii)</display>are ruled with a horizontal line 3/4 inch from the top, with the space above that <ln numlevel="1" lineno="611" slineno="5-28"/>line blank for the purpose of binding;</subsection><subsection ssid="26-null-6" dnum="iii-o" numlevel="1" lineno="612" slineno="5-29" level="3"><display>(iii)</display>contain the name of the proposed candidate and the words "Unaffiliated <ln numlevel="1" lineno="613" slineno="5-30"/>Candidate Certificate of Nomination Petition" printed directly below the <ln numlevel="1" lineno="614" slineno="5-31"/>horizontal line;</subsection><subsection ssid="26-null-7" dnum="iv-o" numlevel="1" lineno="615" slineno="5-32" level="3"><display>(iv)</display>contain the word "Warning" printed directly under the words described in <ln numlevel="1" lineno="616" slineno="5-33"/>Subsection <xref depth="4" refnumber="20A-9-502(1)(b)(iii)">(1)(b)(iii)</xref>;</subsection><subsection ssid="26-null-8" dnum="v-o" numlevel="1" lineno="617" slineno="5-34" level="3" format="full"><display>(v)</display>contain, to the right of the word "Warning," the following statement printed in not less than <ln numlevel="1" lineno="618" slineno="5-35"/>eight-point, single leaded type:<eol numlevel="1" lineno="619" slineno="5-36"/><para/>"It is a class A misdemeanor for anyone to knowingly sign a certificate of nomination <ln numlevel="1" lineno="620" slineno="5-37"/>signature sheet with any name other than the person's own name or more than once for the <ln numlevel="1" lineno="621" slineno="5-38"/>same candidate or if the person is not registered to vote in this state and does not intend to <ln numlevel="1" lineno="622" slineno="5-39"/>become registered to vote in this state before the county clerk certifies the signatures.";</subsection><subsection ssid="26-null-9" dnum="vi-o" numlevel="1" lineno="623" slineno="5-40" level="3" format="full"><display>(vi)</display>contain the following statement directly under the statement described in Subsection <xref depth="4" refnumber="20A-9-502(1)(b)(v)"><ln numlevel="1" lineno="624" slineno="5-41"/>(1)(b)(v)</xref>:<eol numlevel="1" lineno="625" slineno="5-42"/><para/>"Each signer says:<eol numlevel="1" lineno="626" slineno="5-43"/><para/>I have personally signed this petition with a holographic signature;<eol numlevel="1" lineno="627" slineno="5-44"/><para/>I am registered to vote in Utah or intend to become registered to vote in Utah before the <ln numlevel="1" lineno="628" slineno="5-45"/>county clerk certifies my signature; and</subsection><subsection ssid="26-null-11" dnum="viii-o" numlevel="1" lineno="632" slineno="5-49" level="3"><display>(viii)</display>be vertically divided into columns as follows:<subsection ssid="26-null-12" dnum="A-o" numlevel="1" lineno="633" slineno="5-50" level="4"><display>(A)</display>the first column shall appear at the extreme left of the sheet, be 5/8 inch wide, <ln numlevel="1" lineno="634" slineno="5-51"/>be headed with "For Office Use Only," and be subdivided with a light vertical <ln numlevel="1" lineno="635" slineno="5-52"/>line down the middle;</subsection><subsection ssid="26-null-13" dnum="B-o" numlevel="1" lineno="636" slineno="5-53" level="4"><display>(B)</display>the next column shall be 2-1/2 inches wide, headed "Registered Voter's <ln numlevel="1" lineno="637" slineno="5-54"/>Printed Name (must be legible to be counted)";</subsection><subsection ssid="26-null-14" dnum="C-o" numlevel="1" lineno="638" slineno="5-55" level="4"><display>(C)</display>the next column shall be 2-1/2 inches wide, headed "Holographic Signature of <ln numlevel="1" lineno="639" slineno="5-56"/>Registered Voter";</subsection><subsection ssid="26-null-15" dnum="D-o" numlevel="1" lineno="640" slineno="5-57" level="4"><display>(D)</display>the next column shall be one inch wide, headed "Birth Date or Age <ln numlevel="1" lineno="641" slineno="5-58"/>(Optional)";</subsection><subsection ssid="26-null-16" dnum="E-o" numlevel="1" lineno="642" slineno="5-59" level="4"><display>(E)</display>the final column shall be 4-3/8 inches wide, headed "Street Address, City, Zip <ln numlevel="1" lineno="643" slineno="5-60"/>Code"; and</subsection><subsection ssid="26-null-17" dnum="F-o" numlevel="1" lineno="644" slineno="5-61" level="4"><display>(F)</display>at the bottom of the sheet, contain the following statement: "Birth date or age <ln numlevel="1" lineno="645" slineno="5-62"/>information is not required, but it may be used to verify your identity with <ln numlevel="1" lineno="646" slineno="5-63"/>voter registration records.  If you choose not to provide it, your signature may <ln numlevel="1" lineno="647" slineno="5-64"/>not be certified as a valid signature if you change your address before petition <ln numlevel="1" lineno="648" slineno="5-65"/>signatures are certified or if the information you provide does not match your <ln numlevel="1" lineno="649" slineno="5-66"/>voter registration records."; and</subsection><subsection ssid="26-null-23" dnum="ii-o" numlevel="1" lineno="669" slineno="5-86" level="3" tab="1"><display>(ii)</display>verifies each signature sheet by completing the verification bound to one or more <ln numlevel="1" lineno="670" slineno="5-87"/>signature sheets that are bound together.</subsection></subsection><subsection ssid="26-null-24" dnum="b-o" numlevel="1" lineno="671" slineno="5-88" level="2"><display>(b)</display>A person may not sign the circulator verification if the person signed a signature <ln numlevel="1" lineno="672" slineno="5-89"/>sheet bound to the verification.</subsection></subsection><subsection ssid="26-null-25" dnum="4-o" numlevel="1" lineno="673" slineno="5-90" level="1" space="false"><display>(4)</display><subsection ssid="26-null-26" dnum="a-o" level="2" placement="sameline"><display>(a)</display>It is unlawful for any person to:<subsection ssid="26-null-27" dnum="i-o" numlevel="1" lineno="674" slineno="5-91" level="3" tab="1"><display>(i)</display>knowingly sign a certificate of nomination signature sheet:<subsection ssid="26-null-28" dnum="A-o" numlevel="1" lineno="675" slineno="5-92" level="4"><display>(A)</display>with any name other than the person's own name;</subsection><subsection ssid="26-null-29" dnum="B-o" numlevel="1" lineno="676" slineno="5-93" level="4"><display>(B)</display>more than once for the same candidate; or</subsection><subsection ssid="26-null-30" dnum="C-o" numlevel="1" lineno="677" slineno="5-94" level="4"><display>(C)</display>if the person is not registered to vote in this state and does not intend to <ln numlevel="1" lineno="678" slineno="5-95"/>become registered to vote in this state before the county clerk certifies the <ln numlevel="1" lineno="679" slineno="5-96"/>signatures; or</subsection></subsection><subsection ssid="26-null-31" dnum="ii-o" numlevel="1" lineno="680" slineno="5-97" level="3" tab="1"><display>(ii)</display>sign the verification of a certificate of nomination signature sheet if the person:<subsection ssid="26-null-32" dnum="A-o" numlevel="1" lineno="681" slineno="5-98" level="4"><display>(A)</display>has not witnessed the signing by those persons whose names appear on the <ln numlevel="1" lineno="682" slineno="5-99"/>certificate of nomination signature sheet; or</subsection><subsection ssid="26-null-33" dnum="B-o" numlevel="1" lineno="683" slineno="5-100" level="4"><display>(B)</display>knows that a person whose signature appears on the certificate of nomination <ln numlevel="1" lineno="684" slineno="5-101"/>signature sheet is not registered to vote in this state and does not intend to <ln numlevel="1" lineno="685" slineno="5-102"/>become registered to vote in this state.</subsection></subsection></subsection><subsection ssid="26-null-34" dnum="b-o" numlevel="1" lineno="686" slineno="5-103" level="2"><display>(b)</display>Any person violating this Subsection <xref depth="4" refnumber="20A-9-502(4)">(4)</xref> is guilty of a class A misdemeanor.</subsection><subsection ssid="26-52" dnum="_-o:c-i" numlevel="1" lineno="687" slineno="5-104" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1255" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="8" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="end">If a person whose signature appears on a nomination petition notifies the county <ln numlevel="1" lineno="688" slineno="5-105"/>clerk that the person did not sign the nomination petition, the county clerk shall, after <ln numlevel="1" lineno="689" slineno="5-106"/>making a reasonable attempt to determine the accuracy of the person's allegation, but <ln numlevel="1" lineno="690" slineno="5-107"/>no later than three business days after the day on which the allegation is received, <ln numlevel="1" lineno="691" slineno="5-108"/>notify the county or district attorney of:</amend><subsection ssid="26-53" dnum="_-o:i-i" numlevel="1" lineno="692" slineno="5-109" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1256" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="9" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="end">the nature of the allegation; and</amend></subsection><subsection ssid="26-54" dnum="_-o:ii-i" numlevel="1" lineno="693" slineno="5-110" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1257" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="end">the name of, and available contact information for:</amend><subsection ssid="26-55" dnum="_-o:A-i" numlevel="1" lineno="694" slineno="5-111" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1258" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="15" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">the person making the allegation; and</amend></subsection><subsection ssid="26-56" dnum="_-o:B-i" numlevel="1" lineno="695" slineno="5-112" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1259" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="18" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="end">the person who collected the signature.</amend></subsection></subsection></subsection></subsection><subsection ssid="26-null-35" dnum="5-o" numlevel="1" lineno="696" slineno="5-113" level="1" space="false"><display>(5)</display><subsection ssid="26-null-36" dnum="a-o" level="2" placement="sameline"><display>(a)</display>To qualify for placement on the general election ballot, the candidate shall, no <ln numlevel="1" lineno="697" slineno="5-114"/>earlier than the start of the applicable declaration of candidacy period described in <ln numlevel="1" lineno="698" slineno="5-115"/>Section <xref depth="3" refnumber="20A-9-201.5">20A-9-201.5</xref> and no later than 5 p.m. on June 15 of the year in which the <ln numlevel="1" lineno="699" slineno="5-116"/>election will be held:<subsection ssid="26-null-37" dnum="i-o" numlevel="1" lineno="700" slineno="5-117" level="3" tab="1"><display>(i)</display>comply with Subsection <xref depth="4" refnumber="20A-9-503(1)">20A-9-503(1)</xref>; and</subsection><subsection ssid="26-null-38" dnum="ii-o" numlevel="1" lineno="701" slineno="5-118" level="3" tab="1"><display>(ii)</display>submit each signature packet to the county clerk where the majority of the <ln numlevel="1" lineno="702" slineno="5-119"/>signatures in the packet were collected, with signatures totaling:<subsection ssid="26-null-39" dnum="A-o" numlevel="1" lineno="703" slineno="5-120" level="4"><display>(A)</display>at least 1,000 registered voters residing within the state when the nomination <ln numlevel="1" lineno="704" slineno="5-121"/>is for an office to be filled by the voters of the entire state; or</subsection><subsection ssid="26-null-40" dnum="B-o" numlevel="1" lineno="705" slineno="5-122" level="4"><display>(B)</display>at least 300 registered voters residing within a political division or at least 5% <ln numlevel="1" lineno="706" slineno="5-123"/>of the registered voters residing within a political division, whichever is less, <ln numlevel="1" lineno="707" slineno="5-124"/>when the nomination is for an office to be filled by the voters of any political <ln numlevel="1" lineno="708" slineno="5-125"/>division smaller than the state.</subsection></subsection></subsection><subsection ssid="26-null-41" dnum="b-o" numlevel="1" lineno="709" slineno="5-126" level="2"><display>(b)</display>A candidate has not complied with Subsection <xref depth="4" refnumber="20A-9-502(5)(a)(ii)">(5)(a)(ii)</xref>, unless the county clerks <ln numlevel="1" lineno="710" slineno="5-127"/>verify that each required signature is a valid signature of a registered voter who is <ln numlevel="1" lineno="711" slineno="5-128"/>eligible to sign the signature packet and has not signed a signature packet to nominate <ln numlevel="1" lineno="712" slineno="5-129"/>another candidate for the same office.</subsection><subsection ssid="26-null-42" dnum="c-o" numlevel="1" lineno="713" slineno="5-130" level="2"><display>(c)</display>In reviewing the signature packets, the county clerk shall count and certify only those <ln numlevel="1" lineno="714" slineno="5-131"/>persons who signed with a holographic signature, who:<subsection ssid="26-null-43" dnum="i-o" numlevel="1" lineno="715" slineno="5-132" level="3"><display>(i)</display>are registered voters within the political division that the candidate seeks to <ln numlevel="1" lineno="716" slineno="5-133"/>represent; and</subsection><subsection ssid="26-null-44" dnum="ii-o" numlevel="1" lineno="717" slineno="5-134" level="3"><display>(ii)</display>did not sign any other certificate of nomination for that office.</subsection></subsection><subsection ssid="26-null-45" dnum="d-o" numlevel="1" lineno="718" slineno="5-135" level="2"><display>(d)</display>The county clerk shall count and certify the number of registered voters who validly <ln numlevel="1" lineno="719" slineno="5-136"/>signed a signature packet, no later than 30 calendar days after the day on which the <ln numlevel="1" lineno="720" slineno="5-137"/>candidate submits the signature packet.</subsection><subsection ssid="26-null-46" dnum="e-o" numlevel="1" lineno="721" slineno="5-138" level="2"><display>(e)</display>The candidate may supplement the signatures or amend the certificate of nomination <ln numlevel="1" lineno="722" slineno="5-139"/>or declaration of candidacy at any time on or before 5 p.m. on June 15 of the year in <ln numlevel="1" lineno="723" slineno="5-140"/>which the election will be held.</subsection><subsection ssid="26-null-47" dnum="f-o" numlevel="1" lineno="724" slineno="5-141" level="2"><display>(f)</display>The county clerk shall use the procedures described in Section <xref depth="3" refnumber="20A-1-1002">20A-1-1002</xref> to <ln numlevel="1" lineno="725" slineno="5-142"/>determine whether a signer is a registered voter who is qualified to sign the signature <ln numlevel="1" lineno="726" slineno="5-143"/>packet.</subsection></subsection><subsection ssid="26-57" dnum="_-o:6-i" numlevel="1" lineno="727" slineno="5-144" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1273" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="24" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="end">Subject to Subsection <xref depth="4" refnumber="20A-9-502(7)">(7)</xref>, the county clerk shall, no later than five business days after <ln numlevel="1" lineno="728" slineno="5-145"/>the day on which the signature of a voter who signs a signature packet is certified under <ln numlevel="1" lineno="729" slineno="5-146"/>Subsection <xref depth="4" refnumber="20A-9-502(5)(d)">(5)(d)</xref> or Section <xref depth="3" refnumber="20A-21-201">20A-21-201</xref>, post the voter's name and date of signature on <ln numlevel="1" lineno="730" slineno="5-147"/>the lieutenant governor's website, in a conspicuous location designated by the lieutenant <ln numlevel="1" lineno="731" slineno="5-148"/>governor, until at least the day of the deadline described in Subsection <ln numlevel="1" lineno="732" slineno="5-149"/>20A-9-403(3)(d)(vi).</amend></subsection><subsection ssid="26-null-48" dnum="6-o:7-i" numlevel="1" lineno="733" slineno="5-150" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1274" style="2" owner="o" level="1" deltag="both">(6)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1275" style="1" owner="i" level="1" amendtag="both" space="true">(7)</amend></display><subsection ssid="26-null-49" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A voter who signs a signature packet under this section may have the voter's <ln numlevel="1" lineno="734" slineno="5-151"/>signature removed from the signature packet by<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="25" groupid="19" style="2" owner="jchristopherson" level="1" deltag="both">, no later than 5 p.m. three business <ln numlevel="1" lineno="735" slineno="5-152"/>days after the day on which the candidate submits the signature packet to the county <ln numlevel="1" lineno="736" slineno="5-153"/>clerk, submitting to the county clerk a statement requesting that the voter's signature <ln numlevel="1" lineno="737" slineno="5-154"/>be removed.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="27" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"> submitting to the county clerk a statement requesting that the voter's <ln numlevel="1" lineno="738" slineno="5-155"/>signature be removed no later than 5 p.m. three business days after the day on which:</amend><subsection ssid="26-59" dnum="_-o:i-i" numlevel="1" lineno="739" slineno="5-156" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1276" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="34" groupid="27" style="1" owner="jchristopherson" level="1" amendtag="end">the candidate submits the signature packet to the county clerk under Subsection <xref depth="4" refnumber="20A-9-502(5)(a)"><ln numlevel="1" lineno="740" slineno="5-157"/>(5)(a)</xref>; or</amend></subsection><subsection ssid="26-60" dnum="_-o:ii-i" numlevel="1" lineno="741" slineno="5-158" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1277" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="37" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="end">if the voter electronically signed the nomination petition under Section <xref depth="3" refnumber="20A-21-201"><ln numlevel="1" lineno="742" slineno="5-159"/>20A-21-201</xref>:</amend><subsection ssid="26-61" dnum="_-o:A-i" numlevel="1" lineno="743" slineno="5-160" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1278" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="40" groupid="31" style="1" owner="jchristopherson" level="1" amendtag="end">the website defined in Section <xref depth="3" refnumber="20A-21-101">20A-21-101</xref> certifies the voter's signature under <ln numlevel="1" lineno="744" slineno="5-161"/>Subsection <xref depth="4" refnumber="20A-21-201(6)(a)">20A-21-201(6)(a)</xref>; or</amend></subsection><subsection ssid="26-62" dnum="_-o:B-i" numlevel="1" lineno="745" slineno="5-162" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1279" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="43" groupid="33" style="1" owner="jchristopherson" level="1" amendtag="end">the county clerk certifies the voter's signature under Subsection <xref depth="4" refnumber="20A-21-201(7)">20A-21-201(7)</xref>.</amend></subsection></subsection></subsection><subsection ssid="26-null-50" dnum="b-o" numlevel="1" lineno="746" slineno="5-163" level="2"><display>(b)</display>A statement described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="52" groupid="40" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="20A-9-502(7)(a)">(6)(a)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="51" groupid="39" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(7)(a)</amend> shall comply with the <ln numlevel="1" lineno="747" slineno="5-164"/>requirements described in Subsection <xref depth="4" refnumber="20A-1-1003(2)">20A-1-1003(2)</xref>.</subsection><subsection ssid="26-null-51" dnum="c-o" numlevel="1" lineno="748" slineno="5-165" level="2"><display>(c)</display>The county clerk shall use the procedures described in Subsection <xref depth="4" refnumber="20A-1-1003(3)">20A-1-1003(3)</xref> to <ln numlevel="1" lineno="749" slineno="5-166"/>determine whether to remove an individual's signature from a signature packet after <ln numlevel="1" lineno="750" slineno="5-167"/>receiving a timely, valid statement requesting removal of the signature.</subsection></subsection><subsection ssid="26-63" dnum="_-o:8-i" numlevel="1" lineno="751" slineno="5-168" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1282" style="1" owner="i" level="1" amendtag="start">(8)</amend></display><subsection ssid="26-70" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1283" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="70" groupid="52" style="1" owner="jchristopherson" level="1" amendtag="end">If a county clerk timely receives a statement requesting signature removal under <ln numlevel="1" lineno="752" slineno="5-169"/>Subsection <xref depth="4" refnumber="20A-9-502(7)(a)">(7)(a)</xref> and determines that the signature should be removed from the <ln numlevel="1" lineno="753" slineno="5-170"/>nomination petition under Subsection <xref depth="4" refnumber="20A-1-1003(3)">20A-1-1003(3)</xref>, the county clerk shall:</amend><subsection ssid="26-66" dnum="_-o:i-i" numlevel="1" lineno="754" slineno="5-171" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1284" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="61" groupid="46" style="1" owner="jchristopherson" level="1" amendtag="end">remove the voter's name and date of signature from the nomination petition and <ln numlevel="1" lineno="755" slineno="5-172"/>the posting described in Subsection <xref depth="4" refnumber="20A-9-502(6)">(6)</xref>; or"; and<eol numlevel="1" lineno="768" slineno="7-8"/>(2) Subsection 20A-9-502(7)(a)(ii)(A), enacted in H.B. 167, be amended to read:<eol numlevel="1" lineno="769" slineno="7-9"/>"(A) the system defined in Section 20A-21-101 certifies the voter's signature under <ln numlevel="1" lineno="770" slineno="7-10"/>Subsection 20A-21-201(6)(a);
