Ward</sponsorhead><otherSponsorhead>Senate Sponsor: Lincoln Fillmore</otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill deals with regulation of certain land uses in residential zones. </gd><hphead lineno="6">Highlighted Provisions:</hphead><hp numlevel="1" lineno="7" slineno="0-7">This bill:<hl numlevel="1" lineno="8" slineno="0-8" level="1">defines terms; </hl><hl numlevel="1" lineno="9" slineno="0-9" level="1">provides that a person may make a request to a municipality or county in regard to a <ln numlevel="1" lineno="10" slineno="0-10"/>proposed land use that conforms with a preferred land use regulation;</hl><hl numlevel="1" lineno="11" slineno="0-11" level="1">requires a municipality or county to determine if a request conforms with a preferred land <ln numlevel="1" lineno="12" slineno="0-12"/>use regulation and provide notice of the determination to the applicant;</hl><hl numlevel="1" lineno="13" slineno="0-13" level="1">authorizes a planning commission or legislative body to deny a request, under certain <ln numlevel="1" lineno="14" slineno="0-14"/>conditions, that conforms with a preferred land use regulation;</hl><hl numlevel="1" lineno="15" slineno="0-15" level="1">provides that if a planning commission or legislative body does not deny a request that <ln numlevel="1" lineno="16" slineno="0-16"/>conforms with a preferred land use regulation within 30 days, the request becomes a <ln numlevel="1" lineno="17" slineno="0-17"/>permitted use;</hl><hl numlevel="1" lineno="18" slineno="0-18" level="1">provides that a municipality's or county's determination that a request does not meet <ln numlevel="1" lineno="19" slineno="0-19"/>statutory requirements for a preferred land use regulation is an administrative act;</hl><hl numlevel="1" lineno="20" slineno="0-20" level="1">provides that a planning commission's decision to deny a request that conforms with a <ln numlevel="1" lineno="21" slineno="0-21"/>preferred land use regulation is an administrative act;</hl><hl numlevel="1" lineno="22" slineno="0-22" level="1">provides that a legislative body's decision to deny a request that conforms with a preferred <ln numlevel="1" lineno="23" slineno="0-23"/>land use regulation is a legislative act; and </hl><hl numlevel="1" lineno="24" slineno="0-24" level="1">makes technical and conforming changes.</hl></hp><moni numlevel="1" lineno="25" slineno="0-25" display="none">Money Appropriated in this Bill:</moni><moniNone lineno="26">None</moniNone><oc numlevel="1" lineno="27" slineno="0-27">Other Special Clauses:</oc><ocNone lineno="28">None</ocNone><sa numlevel="1" lineno="29" slineno="0-29">Utah Code Sections Affected:<saent numlevel="1" lineno="30" slineno="0-30"><snhead>ENACTS:</snhead><sn num="10-21-304" src="code" uid="C10-21-S304_2026050620260506" buid="21" sort="10 21 03040020260506" numlevel="1" lineno="31" slineno="0-31"><bold>10-21-304</bold>, Utah Code Annotated 1953</sn><sn num="17-80-304" src="code" uid="C17-80-S304_2026050620260506" buid="23" sort="17 80 03040020260506" numlevel="1" lineno="32" slineno="0-32"><bold>17-80-304</bold>, Utah Code Annotated 1953</sn></saent></sa></lt><enacthead lineno="33"/><enact numlevel="1" lineno="34" slineno="0-34">Be it enacted by the Legislature of the state of Utah:</enact><bdy><bsec buid="21" num="10-21-304" type="enact" src="code" uid="C10-21-S304_2026050620260506" sort="10 21 03040020260506" numlevel="1" lineno="35" slineno="1-1" sn="1"><section numlevel="1" lineno="36" slineno="1-2" number="10-21-304" type="enact"><secline lineno="35">Section 1. Section <bold>10-21-304</bold> is enacted to read:</secline><catline lineno="36"><bold>10-21-304<parens/>. Definitions -- Conformity with a preferred land use regulation a <ln numlevel="1" lineno="37" slineno="1-3"/>permitted use under certain circumstances.</bold></catline><subsection ssid="21-5-185" dnum="_-o:1-i" numlevel="1" lineno="38" slineno="1-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1000" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">As used in this section:</amend><subsection ssid="21-5-186" dnum="_-o:a-i" numlevel="1" lineno="39" slineno="1-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1001" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="389" groupid="292" style="1" owner="jchristopherson" level="1" amendtag="end">"Application" means a land use application.</amend></subsection><subsection ssid="21-5-187" dnum="_-o:b-i" numlevel="1" lineno="40" slineno="1-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1002" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="768" groupid="572" style="1" owner="jchristopherson" level="1" amendtag="end">"Area mean purchase price" means the mean purchase price of a single-family <ln numlevel="1" lineno="41" slineno="1-7"/>residential unit sold in a county, as determined by the county or a municipality in the <ln numlevel="1" lineno="42" slineno="1-8"/>county based on publicly available data, during:</amend><subsection ssid="21-5-188" dnum="_-o:i-i" numlevel="1" lineno="43" slineno="1-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1003" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="773" groupid="576" style="1" owner="jchristopherson" level="1" amendtag="end">the immediately preceding calendar year; or</amend></subsection><subsection ssid="21-5-189" dnum="_-o:ii-i" numlevel="1" lineno="44" slineno="1-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1004" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="785" groupid="586" style="1" owner="jchristopherson" level="1" amendtag="end">the calendar year immediately before the calendar year described in Subsection <xref depth="4" refnumber="10-9a-702.1(1)(b)(i)"><ln numlevel="1" lineno="45" slineno="1-11"/>(1)(b)(i)</xref>.</amend></subsection></subsection><subsection ssid="21-5-190" dnum="_-o:c-i" numlevel="1" lineno="46" slineno="1-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="158" groupid="117" style="1" owner="jchristopherson" level="1" amendtag="end">"Preferred land use regulation" means a regulation described in Subsection <xref tempid="669">(2)</xref>:</amend><subsection ssid="21-5-191" dnum="_-o:i-i" numlevel="1" lineno="47" slineno="1-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="616" groupid="456" style="1" owner="jchristopherson" level="1" amendtag="end">that the Legislature finds:</amend><subsection ssid="21-5-192" dnum="_-o:A-i" numlevel="1" lineno="48" slineno="1-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="596" groupid="440" style="1" owner="jchristopherson" level="1" amendtag="end">would advance the state's objective of lowering the average cost of housing by <ln numlevel="1" lineno="49" slineno="1-15"/>enabling the construction of homes that are smaller and less expensive;</amend></subsection><subsection ssid="21-5-193" dnum="_-o:B-i" numlevel="1" lineno="50" slineno="1-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="600" groupid="443" style="1" owner="jchristopherson" level="1" amendtag="end">allows for some permitting of individual projects that are unlikely to adversely <ln numlevel="1" lineno="51" slineno="1-17"/>affect nearby property owners, the public, or the communities in which the <ln numlevel="1" lineno="52" slineno="1-18"/>projects are built; and</amend></subsection><subsection ssid="21-5-194" dnum="_-o:C-i" numlevel="1" lineno="53" slineno="1-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="605" groupid="447" style="1" owner="jchristopherson" level="1" amendtag="end">maintains the local land use authority's jurisdiction over which projects are <ln numlevel="1" lineno="54" slineno="1-20"/>permitted to be built within the local land use authority's boundaries; and</amend></subsection></subsection><subsection ssid="21-5-195" dnum="_-o:ii-i" numlevel="1" lineno="55" slineno="1-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="610" groupid="451" style="1" owner="jchristopherson" level="1" amendtag="end">that, as applied to a property owner in a municipality, is not a permitted use under <ln numlevel="1" lineno="56" slineno="1-22"/>the municipality's zoning regulations, land use ordinances, or building standards.</amend></subsection></subsection><subsection ssid="21-5-196" dnum="_-o:d-i" numlevel="1" lineno="57" slineno="1-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="485" groupid="363" style="1" owner="jchristopherson" level="1" amendtag="end">"Request" means a written submission from a property owner, or a person acting on <ln numlevel="1" lineno="58" slineno="1-24"/>a property owner's behalf, seeking that a municipality accept a preferred land use <ln numlevel="1" lineno="59" slineno="1-25"/>regulation on a specific parcel as part of a simultaneous or upcoming application.</amend></subsection><subsection ssid="21-5-197" dnum="_-o:e-i" numlevel="1" lineno="60" slineno="1-26" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1012" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="700" groupid="519" style="1" owner="jchristopherson" level="1" amendtag="end">"Setback" means the required distance between the property line of a lot or parcel <ln numlevel="1" lineno="61" slineno="1-27"/>and the location where a structure is allowed to be placed under an adopted land use <ln numlevel="1" lineno="62" slineno="1-28"/>regulation.</amend></subsection><subsection ssid="21-5-198" dnum="_-o:f-i" numlevel="1" lineno="63" slineno="1-29" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1013" style="1" owner="i" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="754" groupid="561" style="1" owner="jchristopherson" level="1" amendtag="end">"Starter home" means a single-family residential unit that:</amend><subsection ssid="21-5-199" dnum="_-o:i-i" numlevel="1" lineno="64" slineno="1-30" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1014" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="759" groupid="565" style="1" owner="jchristopherson" level="1" amendtag="end">is sold to an initial owner-occupier for an amount equal to or less than the area <ln numlevel="1" lineno="65" slineno="1-31"/>mean purchase price of a single-family residential unit;</amend></subsection><subsection ssid="21-5-200" dnum="_-o:ii-i" numlevel="1" lineno="66" slineno="1-32" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1015" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="786" groupid="587" style="1" owner="jchristopherson" level="1" amendtag="end">is deed restricted to be owner-occupied for two years following the day on which <ln numlevel="1" lineno="67" slineno="1-33"/>the unit is first sold;</amend></subsection><subsection ssid="21-5-201" dnum="_-o:iii-i" numlevel="1" lineno="68" slineno="1-34" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="784" groupid="585" style="1" owner="jchristopherson" level="1" amendtag="end">has a minimum of two parking spots, covered or uncovered; and</amend></subsection><subsection ssid="21-5-202" dnum="_-o:iv-i" numlevel="1" lineno="69" slineno="1-35" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1017" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="792" groupid="592" style="1" owner="jchristopherson" level="1" amendtag="end">is built:</amend><subsection ssid="21-5-203" dnum="_-o:A-i" numlevel="1" lineno="70" slineno="1-36" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="799" groupid="596" style="1" owner="jchristopherson" level="1" amendtag="end">on a lot of any size;</amend></subsection><subsection ssid="21-5-204" dnum="_-o:B-i" numlevel="1" lineno="71" slineno="1-37" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1019" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="816" groupid="610" style="1" owner="jchristopherson" level="1" amendtag="end">without meeting a minimum number of livable square feet;</amend></subsection><subsection ssid="21-5-205" dnum="_-o:C-i" numlevel="1" lineno="72" slineno="1-38" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1020" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="804" groupid="600" style="1" owner="jchristopherson" level="1" amendtag="end">with any floor area ratio;</amend></subsection><subsection ssid="21-5-206" dnum="_-o:D-i" numlevel="1" lineno="73" slineno="1-39" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1021" style="1" owner="i" level="1" amendtag="start">(D)</amend></display><amend anum="0" ea="amend" pairid="818" groupid="612" style="1" owner="jchristopherson" level="1" amendtag="end">with any setbacks, if the setbacks meet minimum safety codes; and</amend></subsection><subsection ssid="21-5-207" dnum="_-o:E-i" numlevel="1" lineno="74" slineno="1-40" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1022" style="1" owner="i" level="1" amendtag="start">(E)</amend></display><amend anum="0" ea="amend" pairid="831" groupid="623" style="1" owner="jchristopherson" level="1" amendtag="end">with any building materials of any appearance, if the building materials meet <ln numlevel="1" lineno="75" slineno="1-41"/>minimum safety codes.</amend></subsection></subsection></subsection></subsection><subsection ssid="21-5-208" dnum="_-o:2-i" numlevel="1" lineno="76" slineno="1-42" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1023" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="396" groupid="298" style="1" owner="jchristopherson" level="1" amendtag="end">The following are preferred land use regulations in an area zoned for residential use:</amend><subsection ssid="21-5-209" dnum="_-o:a-i" numlevel="1" lineno="77" slineno="1-43" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1024" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="440" groupid="333" style="1" owner="jchristopherson" level="1" amendtag="end">regulations that permit a person to build a starter home; or</amend></subsection><subsection ssid="21-5-210" dnum="_-o:b-i" numlevel="1" lineno="78" slineno="1-44" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1025" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="445" groupid="337" style="1" owner="jchristopherson" level="1" amendtag="end">for lot size requirements, a minimum of 5,400 square feet.</amend></subsection></subsection><subsection ssid="21-5-217" dnum="_-o:3-i" numlevel="1" lineno="79" slineno="1-45" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1026" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><subsection ssid="21-5-218" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1027" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="504" groupid="377" style="1" owner="jchristopherson" level="1" amendtag="end">A person may submit a request that a municipality accept a preferred land use <ln numlevel="1" lineno="80" slineno="1-46"/>regulation, notwithstanding a conflicting municipal regulation, as part of an <ln numlevel="1" lineno="81" slineno="1-47"/>application or an upcoming application to develop a specific residential property as <ln numlevel="1" lineno="82" slineno="1-48"/>described in this Subsection <xref tempid="461">(3)</xref>.</amend></subsection><subsection ssid="21-5-219" dnum="_-o:b-i" numlevel="1" lineno="83" slineno="1-49" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1028" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="631" groupid="468" style="1" owner="jchristopherson" level="1" amendtag="end">A request shall include:</amend><subsection ssid="21-5-220" dnum="_-o:i-i" numlevel="1" lineno="84" slineno="1-50" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1029" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="636" groupid="472" style="1" owner="jchristopherson" level="1" amendtag="end">a written description or drawn sketch describing the anticipated development plan; <ln numlevel="1" lineno="85" slineno="1-51"/>and</amend></subsection><subsection ssid="21-5-221" dnum="_-o:ii-i" numlevel="1" lineno="86" slineno="1-52" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1030" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="641" groupid="476" style="1" owner="jchristopherson" level="1" amendtag="end">a specific reference to the preferred land use regulation the person is seeking.</amend></subsection></subsection><subsection ssid="21-5-222" dnum="_-o:c-i" numlevel="1" lineno="87" slineno="1-53" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1031" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="524" groupid="390" style="1" owner="jchristopherson" level="1" amendtag="end">A municipality may require supporting information from a person making a request <ln numlevel="1" lineno="88" slineno="1-54"/>only as strictly necessary to determine whether the request meets the requirements of <ln numlevel="1" lineno="89" slineno="1-55"/>this section.</amend></subsection><subsection ssid="21-5-223" dnum="_-o:d-i" numlevel="1" lineno="90" slineno="1-56" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1032" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="657" groupid="489" style="1" owner="jchristopherson" level="1" amendtag="end">A municipality may not require a person making a request to:</amend><subsection ssid="21-5-224" dnum="_-o:i-i" numlevel="1" lineno="91" slineno="1-57" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1033" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="663" groupid="493" style="1" owner="jchristopherson" level="1" amendtag="end">submit engineering plans, drawings, plats, or will-serve letters; or</amend></subsection><subsection ssid="21-5-225" dnum="_-o:ii-i" numlevel="1" lineno="92" slineno="1-58" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1034" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="669" groupid="498" style="1" owner="jchristopherson" level="1" amendtag="end">conform with all other municipal regulations or standards that the municipality <ln numlevel="1" lineno="93" slineno="1-59"/>normally requires to accept or process a complete land use application.</amend></subsection></subsection></subsection><subsection ssid="21-5-226" dnum="_-o:4-i" numlevel="1" lineno="94" slineno="1-60" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1035" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><subsection ssid="21-5-227" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1036" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="64" groupid="47" style="1" owner="jchristopherson" level="1" amendtag="end">No later than five business days after the day on which a municipality receives a <ln numlevel="1" lineno="95" slineno="1-61"/>request, municipal staff shall determine if the request conforms with Subsection <xref tempid="932">(3)</xref> <ln numlevel="1" lineno="96" slineno="1-62"/>regardless of whether the request conforms with the applicable land use regulation <ln numlevel="1" lineno="97" slineno="1-63"/>otherwise governing the parcel at issue.</amend></subsection><subsection ssid="21-5-228" dnum="_-o:b-i" numlevel="1" lineno="98" slineno="1-64" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1037" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="82" groupid="58" style="1" owner="jchristopherson" level="1" amendtag="end">If a request conforms with Subsection <xref depth="4" refnumber="10-9a-702.1(3)">(3)</xref>, the municipality shall, within one business <ln numlevel="1" lineno="99" slineno="1-65"/>day, provide notice of the determination to the applicant.</amend></subsection></subsection><subsection ssid="21-5-229" dnum="_-o:5-i" numlevel="1" lineno="100" slineno="1-66" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1038" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><subsection ssid="21-5-230" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1039" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="469" groupid="353" style="1" owner="jchristopherson" level="1" amendtag="end">If a municipality determines that a request does not conform with Subsection <xref tempid="236">(3)</xref>, <ln numlevel="1" lineno="101" slineno="1-67"/>or if the request lacks information the municipality requires under Subsection <xref tempid="653">(3)(c)</xref>, <ln numlevel="1" lineno="102" slineno="1-68"/>the municipality shall no later than five business days after the day on which the <ln numlevel="1" lineno="103" slineno="1-69"/>municipality receives the request, deny the request and provide to the applicant:</amend><subsection ssid="21-5-231" dnum="_-o:i-i" numlevel="1" lineno="104" slineno="1-70" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1040" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="470" groupid="354" style="1" owner="jchristopherson" level="1" amendtag="end">notice of the determination and denial; and</amend></subsection><subsection ssid="21-5-232" dnum="_-o:ii-i" numlevel="1" lineno="105" slineno="1-71" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1041" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="473" groupid="356" style="1" owner="jchristopherson" level="1" amendtag="end">the reasoning for the determination.</amend></subsection></subsection><subsection ssid="21-5-233" dnum="_-o:b-i" numlevel="1" lineno="106" slineno="1-72" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1042" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="675" groupid="501" style="1" owner="jchristopherson" level="1" amendtag="end">The municipality may not use the person's failure to submit a complete land use <ln numlevel="1" lineno="107" slineno="1-73"/>application as the basis to deny a request.</amend></subsection><subsection ssid="21-5-234" dnum="_-o:c-i" numlevel="1" lineno="108" slineno="1-74" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1043" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="574" groupid="422" style="1" owner="jchristopherson" level="1" amendtag="end">A denial and determination under this Subsection <xref tempid="399">(5)</xref> is an administrative act.</amend></subsection><subsection ssid="21-5-235" dnum="_-o:d-i" numlevel="1" lineno="109" slineno="1-75" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1044" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="578" groupid="425" style="1" owner="jchristopherson" level="1" amendtag="end">A person that receives a denial and determination under this Subsection <xref tempid="1009">(5)</xref> may <ln numlevel="1" lineno="110" slineno="1-76"/>submit a new request that addresses the reasoning for the denial, which shall begin a <ln numlevel="1" lineno="111" slineno="1-77"/>new 30-day time period.</amend></subsection></subsection><subsection ssid="21-5-236" dnum="_-o:6-i" numlevel="1" lineno="112" slineno="1-78" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1045" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="583" groupid="429" style="1" owner="jchristopherson" level="1" amendtag="end">A planning commission or legislative body may, within 30 calendar days of the day on <ln numlevel="1" lineno="113" slineno="1-79"/>which a person submits a request that is not timely denied under Subsection <xref tempid="1073">(5)</xref>, act to <ln numlevel="1" lineno="114" slineno="1-80"/>deny the request:</amend><subsection ssid="21-5-237" dnum="_-o:a-i" numlevel="1" lineno="115" slineno="1-81" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1046" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="322" groupid="240" style="1" owner="jchristopherson" level="1" amendtag="end">if the planning commission or legislative body determines, for any reason, that the <ln numlevel="1" lineno="116" slineno="1-82"/>benefit to the person and community would be outweighed by the negative effect to <ln numlevel="1" lineno="117" slineno="1-83"/>others in the community;</amend></subsection><subsection ssid="21-5-238" dnum="_-o:b-i" numlevel="1" lineno="118" slineno="1-84" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1047" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="829" groupid="621" style="1" owner="jchristopherson" level="1" amendtag="end">if the planning commission or legislative body makes a finding on the record <ln numlevel="1" lineno="119" slineno="1-85"/>regarding the determination described in Subsection <xref depth="4" refnumber="10-9a-702.1(6)(a)">(6)(a)</xref>;</amend></subsection><subsection ssid="21-5-239" dnum="_-o:c-i" numlevel="1" lineno="120" slineno="1-86" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1048" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="181" groupid="133" style="1" owner="jchristopherson" level="1" amendtag="end">in a public meeting of the planning commission or legislative body; or</amend></subsection><subsection ssid="23-9-218" dnum="_-o:ii-i" numlevel="1" lineno="153" slineno="2-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1065" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="680" groupid="473" style="1" owner="jchristopherson" level="1" amendtag="end">the calendar year immediately before the calendar year described in Subsection <xref depth="4" refnumber="17-27a-702.1(1)(b)(i)"><ln numlevel="1" lineno="154" slineno="2-11"/>(1)(b)(i)</xref>.</amend></subsection></subsection><subsection ssid="23-9-219" dnum="_-o:c-i" numlevel="1" lineno="155" slineno="2-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1066" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="427" groupid="294" style="1" owner="jchristopherson" level="1" amendtag="end">"Preferred land use regulation" means a regulation described in Subsection <xref tempid="236">(2)</xref>:</amend><subsection ssid="23-9-220" dnum="_-o:i-i" numlevel="1" lineno="156" slineno="2-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1067" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="432" groupid="298" style="1" owner="jchristopherson" level="1" amendtag="end">that the Legislature finds:</amend><subsection ssid="23-9-221" dnum="_-o:A-i" numlevel="1" lineno="157" slineno="2-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1068" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="603" groupid="418" style="1" owner="jchristopherson" level="1" amendtag="end">advances the state's objective of lowering the average cost of housing by <ln numlevel="1" lineno="158" slineno="2-15"/>enabling the construction of homes that are smaller and less expensive;</amend></subsection><subsection ssid="23-9-222" dnum="_-o:B-i" numlevel="1" lineno="159" slineno="2-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1069" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="606" groupid="420" style="1" owner="jchristopherson" level="1" amendtag="end">allows for some permitting of individual projects that are unlikely to adversely <ln numlevel="1" lineno="160" slineno="2-17"/>affect nearby property owners, the public, or the communities in which the <ln numlevel="1" lineno="161" slineno="2-18"/>projects are built; and</amend></subsection><subsection ssid="23-9-223" dnum="_-o:C-i" numlevel="1" lineno="162" slineno="2-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1070" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="609" groupid="422" style="1" owner="jchristopherson" level="1" amendtag="end">maintains the local land use authority's jurisdiction over which projects are <ln numlevel="1" lineno="163" slineno="2-20"/>permitted to be built within the local land use authority's boundaries; and</amend></subsection></subsection><subsection ssid="23-9-224" dnum="_-o:ii-i" numlevel="1" lineno="164" slineno="2-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1071" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="451" groupid="312" style="1" owner="jchristopherson" level="1" amendtag="end">that, as applied to a property owner in an unincorporated county, is not a <ln numlevel="1" lineno="165" slineno="2-22"/>permitted use under the county's zoning regulations, land use ordinances, or <ln numlevel="1" lineno="166" slineno="2-23"/>building standards.</amend></subsection></subsection><subsection ssid="23-9-225" dnum="_-o:d-i" numlevel="1" lineno="167" slineno="2-24" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1072" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="291" groupid="199" style="1" owner="jchristopherson" level="1" amendtag="end">"Request" means a written submission from a property owner, or a person acting on <ln numlevel="1" lineno="168" slineno="2-25"/>a property owner's behalf, seeking that a county accept a preferred land use <ln numlevel="1" lineno="169" slineno="2-26"/>regulation on a specific parcel as part of a simultaneous or upcoming application.</amend></subsection><subsection ssid="23-9-226" dnum="_-o:e-i" numlevel="1" lineno="170" slineno="2-27" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1073" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="599" groupid="415" style="1" owner="jchristopherson" level="1" amendtag="end">"Setback" means the required distance between the property line of a lot or parcel <ln numlevel="1" lineno="171" slineno="2-28"/>and the location where a structure is allowed to be placed under an adopted land use <ln numlevel="1" lineno="172" slineno="2-29"/>regulation.</amend></subsection><subsection ssid="23-9-227" dnum="_-o:f-i" numlevel="1" lineno="173" slineno="2-30" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1074" style="1" owner="i" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="687" groupid="478" style="1" owner="jchristopherson" level="1" amendtag="end">"Starter home" means a single-family residential unit that:</amend><subsection ssid="23-9-228" dnum="_-o:i-i" numlevel="1" lineno="174" slineno="2-31" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1075" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="688" groupid="479" style="1" owner="jchristopherson" level="1" amendtag="end">is sold to an initial owner-occupier for an amount equal to or less than the area <ln numlevel="1" lineno="175" slineno="2-32"/>mean purchase price of a single-family residential unit;</amend></subsection><subsection ssid="23-9-229" dnum="_-o:ii-i" numlevel="1" lineno="176" slineno="2-33" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1076" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="691" groupid="481" style="1" owner="jchristopherson" level="1" amendtag="end">is deed restricted to be owner-occupied for two years following the day on which <ln numlevel="1" lineno="177" slineno="2-34"/>the unit is first sold;</amend></subsection><subsection ssid="23-9-230" dnum="_-o:iii-i" numlevel="1" lineno="178" slineno="2-35" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1077" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="694" groupid="483" style="1" owner="jchristopherson" level="1" amendtag="end">has a minimum of two parking spots, covered or uncovered; and</amend></subsection><subsection ssid="23-9-231" dnum="_-o:iv-i" numlevel="1" lineno="179" slineno="2-36" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1078" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="697" groupid="485" style="1" owner="jchristopherson" level="1" amendtag="end">is built:</amend><subsection ssid="23-9-232" dnum="_-o:A-i" numlevel="1" lineno="180" slineno="2-37" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1079" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="700" groupid="487" style="1" owner="jchristopherson" level="1" amendtag="end">on a lot of any size;</amend></subsection><subsection ssid="23-9-233" dnum="_-o:B-i" numlevel="1" lineno="181" slineno="2-38" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1080" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="703" groupid="489" style="1" owner="jchristopherson" level="1" amendtag="end">without meeting a minimum number of livable square feet;</amend></subsection><subsection ssid="23-9-234" dnum="_-o:C-i" numlevel="1" lineno="182" slineno="2-39" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1081" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="706" groupid="491" style="1" owner="jchristopherson" level="1" amendtag="end">with any floor area ratio;</amend></subsection><subsection ssid="23-9-235" dnum="_-o:D-i" numlevel="1" lineno="183" slineno="2-40" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1082" style="1" owner="i" level="1" amendtag="start">(D)</amend></display><amend anum="0" ea="amend" pairid="709" groupid="493" style="1" owner="jchristopherson" level="1" amendtag="end">with any setbacks, if the setbacks meet minimum safety codes; and</amend></subsection><subsection ssid="23-9-236" dnum="_-o:E-i" numlevel="1" lineno="184" slineno="2-41" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1083" style="1" owner="i" level="1" amendtag="start">(E)</amend></display><amend anum="0" ea="amend" pairid="712" groupid="495" style="1" owner="jchristopherson" level="1" amendtag="end">with any building materials of any appearance, if the building materials meet <ln numlevel="1" lineno="185" slineno="2-42"/>minimum safety codes.</amend></subsection></subsection></subsection></subsection><subsection ssid="23-9-237" dnum="_-o:2-i" numlevel="1" lineno="186" slineno="2-43" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1084" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="612" groupid="424" style="1" owner="jchristopherson" level="1" amendtag="end">The following are preferred land use regulations in an area zoned for residential use:</amend><subsection ssid="23-9-238" dnum="_-o:a-i" numlevel="1" lineno="187" slineno="2-44" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1085" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="613" groupid="425" style="1" owner="jchristopherson" level="1" amendtag="end">regulations that permit a person to build a starter home; or</amend></subsection><subsection ssid="23-9-239" dnum="_-o:b-i" numlevel="1" lineno="188" slineno="2-45" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1086" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="616" groupid="427" style="1" owner="jchristopherson" level="1" amendtag="end">for lot size requirements, a minimum of 5,400 square feet.</amend></subsection></subsection><subsection ssid="23-9-246" dnum="_-o:3-i" numlevel="1" lineno="189" slineno="2-46" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1087" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><subsection ssid="23-9-247" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1088" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="481" groupid="334" style="1" owner="jchristopherson" level="1" amendtag="end">A person may submit a request that a county accept a preferred land use <ln numlevel="1" lineno="190" slineno="2-47"/>regulation, notwithstanding a conflicting county regulation, as part of an application <ln numlevel="1" lineno="191" slineno="2-48"/>or an upcoming application to develop a specific residential property as described in <ln numlevel="1" lineno="192" slineno="2-49"/>this Subsection <xref depth="4" refnumber="17-27a-702.1(3)">(3)</xref>.</amend></subsection><subsection ssid="23-9-248" dnum="_-o:b-i" numlevel="1" lineno="193" slineno="2-50" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1089" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="484" groupid="336" style="1" owner="jchristopherson" level="1" amendtag="end">A request shall include:</amend><subsection ssid="23-9-249" dnum="_-o:i-i" numlevel="1" lineno="194" slineno="2-51" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1090" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="487" groupid="338" style="1" owner="jchristopherson" level="1" amendtag="end">a written description or drawn sketch describing the anticipated development plan; <ln numlevel="1" lineno="195" slineno="2-52"/>and</amend></subsection><subsection ssid="23-9-250" dnum="_-o:ii-i" numlevel="1" lineno="196" slineno="2-53" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1091" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="490" groupid="340" style="1" owner="jchristopherson" level="1" amendtag="end">a specific reference to the preferred land use regulation the person is seeking.</amend></subsection></subsection><subsection ssid="23-9-251" dnum="_-o:c-i" numlevel="1" lineno="197" slineno="2-54" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1092" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="479" groupid="332" style="1" owner="jchristopherson" level="1" amendtag="end">A county may require supporting information from a person making a request only as <ln numlevel="1" lineno="198" slineno="2-55"/>strictly necessary to determine whether the request meets the requirements of this <ln numlevel="1" lineno="199" slineno="2-56"/>section.</amend></subsection><subsection ssid="23-9-252" dnum="_-o:d-i" numlevel="1" lineno="200" slineno="2-57" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1093" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="503" groupid="349" style="1" owner="jchristopherson" level="1" amendtag="end">A county may not require a person making a request to:</amend><subsection ssid="23-9-253" dnum="_-o:i-i" numlevel="1" lineno="201" slineno="2-58" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1094" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="504" groupid="350" style="1" owner="jchristopherson" level="1" amendtag="end">submit engineering plans, drawings, plats, or will-serve letters; or</amend></subsection><subsection ssid="23-9-254" dnum="_-o:ii-i" numlevel="1" lineno="202" slineno="2-59" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1095" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="507" groupid="352" style="1" owner="jchristopherson" level="1" amendtag="end">conform with all other county regulations or standards that the county normally <ln numlevel="1" lineno="203" slineno="2-60"/>requires to accept or process a complete land use application.</amend></subsection></subsection></subsection><subsection ssid="23-9-255" dnum="_-o:4-i" numlevel="1" lineno="204" slineno="2-61" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1096" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><subsection ssid="23-9-256" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1097" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="519" groupid="361" style="1" owner="jchristopherson" level="1" amendtag="end">No later than five business days after the day on which a county receives a <ln numlevel="1" lineno="205" slineno="2-62"/>request, county staff shall determine if the request conforms with Subsection <xref depth="4" refnumber="17-27a-702.1(3)">(3)</xref> <ln numlevel="1" lineno="206" slineno="2-63"/>regardless of whether the request conforms with the applicable land use regulation <ln numlevel="1" lineno="207" slineno="2-64"/>otherwise governing the parcel at issue.</amend></subsection><subsection ssid="23-9-257" dnum="_-o:b-i" numlevel="1" lineno="208" slineno="2-65" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1098" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="522" groupid="363" style="1" owner="jchristopherson" level="1" amendtag="end">If a request conforms with Subsection <xref depth="4" refnumber="17-27a-702.1(3)">(3)</xref>, the county shall, within one business day, <ln numlevel="1" lineno="209" slineno="2-66"/>provide notice of the determination to the applicant.</amend></subsection></subsection><subsection ssid="23-9-258" dnum="_-o:5-i" numlevel="1" lineno="210" slineno="2-67" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1099" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><subsection ssid="23-9-259" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1100" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="534" groupid="371" style="1" owner="jchristopherson" level="1" amendtag="end">If a county determines that a request does not conform with Subsection <xref depth="4" refnumber="17-27a-702.1(3)">(3)</xref>, or if <ln numlevel="1" lineno="211" slineno="2-68"/>the request lacks information the county requires under Subsection <xref depth="4" refnumber="17-27a-702.1(3)(c)">(3)(c)</xref>, the county <ln numlevel="1" lineno="212" slineno="2-69"/>shall no later than five business days after the day on which the county receives the <ln numlevel="1" lineno="213" slineno="2-70"/>request, deny the request and provide to the applicant:</amend><subsection ssid="23-9-260" dnum="_-o:i-i" numlevel="1" lineno="214" slineno="2-71" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1101" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="537" groupid="373" style="1" owner="jchristopherson" level="1" amendtag="end">notice of the determination and denial; and</amend></subsection><subsection ssid="23-9-261" dnum="_-o:ii-i" numlevel="1" lineno="215" slineno="2-72" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1102" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="540" groupid="375" style="1" owner="jchristopherson" level="1" amendtag="end">the reasoning for the determination.</amend></subsection></subsection><subsection ssid="23-9-262" dnum="_-o:b-i" numlevel="1" lineno="216" slineno="2-73" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1103" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="543" groupid="377" style="1" owner="jchristopherson" level="1" amendtag="end">The county may not use the person's failure to submit a complete land use <ln numlevel="1" lineno="217" slineno="2-74"/>application as the basis to deny a request.</amend></subsection><subsection ssid="23-9-263" dnum="_-o:c-i" numlevel="1" lineno="218" slineno="2-75" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1104" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="546" groupid="379" style="1" owner="jchristopherson" level="1" amendtag="end">A denial and determination under this Subsection <xref depth="4" refnumber="17-27a-702.1(5)">(5)</xref> is an administrative act.</amend></subsection><subsection ssid="23-9-264" dnum="_-o:d-i" numlevel="1" lineno="219" slineno="2-76" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1105" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="549" groupid="381" style="1" owner="jchristopherson" level="1" amendtag="end">A person that receives a denial and determination under this Subsection <xref depth="4" refnumber="17-27a-702.1(5)">(5)</xref> may <ln numlevel="1" lineno="220" slineno="2-77"/>submit a new request that addresses the reasoning for the denial, which shall begin a <ln numlevel="1" lineno="221" slineno="2-78"/>new 30-day time period.</amend></subsection></subsection><subsection ssid="23-9-265" dnum="_-o:6-i" numlevel="1" lineno="222" slineno="2-79" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1106" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="552" groupid="383" style="1" owner="jchristopherson" level="1" amendtag="end">A planning commission or legislative body may, within 30 calendar days of the day on <ln numlevel="1" lineno="223" slineno="2-80"/>which a person submits a request that is not timely denied under Subsection <xref depth="4" refnumber="17-27a-702.1(5)">(5)</xref>, act to <ln numlevel="1" lineno="224" slineno="2-81"/>deny the request:</amend><subsection ssid="23-9-266" dnum="_-o:a-i" numlevel="1" lineno="225" slineno="2-82" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1107" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="659" groupid="458" style="1" owner="jchristopherson" level="1" amendtag="end">if the planning commission or legislative body determines, for any reason, that the <ln numlevel="1" lineno="226" slineno="2-83"/>benefit to the person and community would be outweighed by the negative effect to <ln numlevel="1" lineno="227" slineno="2-84"/>others in the community;</amend></subsection><subsection ssid="23-9-267" dnum="_-o:b-i" numlevel="1" lineno="228" slineno="2-85" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1108" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="662" groupid="460" style="1" owner="jchristopherson" level="1" amendtag="end">if the planning commission or legislative body makes a finding on the record <ln numlevel="1" lineno="229" slineno="2-86"/>regarding the determination described in Subsection <xref depth="4" refnumber="17-27a-702.1(6)(a)">(6)(a)</xref>;</amend></subsection><subsection ssid="23-9-268" dnum="_-o:c-i" numlevel="1" lineno="230" slineno="2-87" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1109" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="665" groupid="462" style="1" owner="jchristopherson" level="1" amendtag="end">in a public meeting of the planning commission or legislative body;
