Section <bold>63G-2-305</bold> is amended to read:</secline><catline lineno="30"><bold>63G-2-305<parens/>. Protected records.</bold></catline><sectionText lineno="31"><tab/>The following records are protected if properly classified by a governmental entity:</sectionText><subsection ssid="19-null-1" dnum="1-o" numlevel="1" lineno="32" slineno="1-4" level="1"><display>(1)</display>trade secrets as defined in Section <xref depth="3" refnumber="13-24-2">13-24-2</xref> if the person submitting the trade secret has <ln numlevel="1" lineno="33" slineno="1-5"/>provided the governmental entity with the information specified in Section <xref depth="3" refnumber="63G-2-309">63G-2-309</xref>;</subsection><subsection ssid="19-null-2" dnum="2-o" numlevel="1" lineno="34" slineno="1-6" level="1"><display>(2)</display>commercial information or nonindividual financial information obtained from a person <ln numlevel="1" lineno="35" slineno="1-7"/>if:<subsection ssid="19-null-3" dnum="a-o" numlevel="1" lineno="36" slineno="1-8" level="2"><display>(a)</display>disclosure of the information could reasonably be expected to result in unfair <ln numlevel="1" lineno="37" slineno="1-9"/>competitive injury to the person submitting the information or would impair the <ln numlevel="1" lineno="38" slineno="1-10"/>ability of the governmental entity to obtain necessary information in the future;</subsection><subsection ssid="19-null-4" dnum="b-o" numlevel="1" lineno="39" slineno="1-11" level="2"><display>(b)</display>the person submitting the information has a greater interest in prohibiting access than <ln numlevel="1" lineno="40" slineno="1-12"/>the public in obtaining access; and</subsection><subsection ssid="19-null-5" dnum="c-o" numlevel="1" lineno="41" slineno="1-13" level="2"><display>(c)</display>the person submitting the information has provided the governmental entity with the <ln numlevel="1" lineno="42" slineno="1-14"/>information specified in Section <xref depth="3" refnumber="63G-2-309">63G-2-309</xref>;</subsection></subsection><subsection ssid="19-null-6" dnum="3-o" numlevel="1" lineno="43" slineno="1-15" level="1"><display>(3)</display>commercial or financial information acquired or prepared by a governmental entity to <ln numlevel="1" lineno="44" slineno="1-16"/>the extent that disclosure would lead to financial speculations in currencies, securities, or <ln numlevel="1" lineno="45" slineno="1-17"/>commodities that will interfere with a planned transaction by the governmental entity or <ln numlevel="1" lineno="46" slineno="1-18"/>cause substantial financial injury to the governmental entity or state economy;</subsection><subsection ssid="19-null-7" dnum="4-o" numlevel="1" lineno="47" slineno="1-19" level="1"><display>(4)</display>records, the disclosure of which could cause commercial injury to, or confer a <ln numlevel="1" lineno="48" slineno="1-20"/>competitive advantage upon a potential or actual competitor of, a commercial project <ln numlevel="1" lineno="49" slineno="1-21"/>entity as defined in Subsection <xref depth="4" refnumber="11-13-103(4)">11-13-103(4)</xref>;</subsection><subsection ssid="19-null-8" dnum="5-o" numlevel="1" lineno="50" slineno="1-22" level="1"><display>(5)</display>test questions and answers to be used in future license, certification, registration, <ln numlevel="1" lineno="51" slineno="1-23"/>employment, or academic examinations;</subsection><subsection ssid="19-null-9" dnum="6-o" numlevel="1" lineno="52" slineno="1-24" level="1"><display>(6)</display>records, the disclosure of which would impair governmental procurement proceedings <ln numlevel="1" lineno="53" slineno="1-25"/>or give an unfair advantage to any person proposing to enter into a contract or agreement <ln numlevel="1" lineno="54" slineno="1-26"/>with a governmental entity, except, subject to Subsections <xref depth="4" refnumber="63G-2-305(1)">(1)</xref> and <xref depth="4" refnumber="63G-2-305(2)">(2)</xref>, that this <ln numlevel="1" lineno="55" slineno="1-27"/>Subsection <xref depth="4" refnumber="63G-2-305(6)">(6)</xref> does not restrict the right of a person to have access to, after the contract <ln numlevel="1" lineno="56" slineno="1-28"/>or grant has been awarded and signed by all parties:<subsection ssid="19-null-10" dnum="a-o" numlevel="1" lineno="57" slineno="1-29" level="2"><display>(a)</display>a bid, proposal, application, or other information submitted to or by a governmental <ln numlevel="1" lineno="58" slineno="1-30"/>entity in response to:<subsection ssid="19-null-11" dnum="i-o" numlevel="1" lineno="59" slineno="1-31" level="3"><display>(i)</display>an invitation for bids;</subsection><subsection ssid="19-null-12" dnum="ii-o" numlevel="1" lineno="60" slineno="1-32" level="3"><display>(ii)</display>a request for proposals;</subsection><subsection ssid="19-null-13" dnum="iii-o" numlevel="1" lineno="61" slineno="1-33" level="3"><display>(iii)</display>a request for quotes;</subsection><subsection ssid="19-null-14" dnum="iv-o" numlevel="1" lineno="62" slineno="1-34" level="3"><display>(iv)</display>a grant; or</subsection><subsection ssid="19-null-15" dnum="v-o" numlevel="1" lineno="63" slineno="1-35" level="3"><display>(v)</display>other similar document; or</subsection></subsection><subsection ssid="19-null-16" dnum="b-o" numlevel="1" lineno="64" slineno="1-36" level="2"><display>(b)</display>an unsolicited proposal, as defined in Section <xref depth="3" refnumber="63G-6a-712">63G-6a-712</xref>;</subsection></subsection><subsection ssid="19-null-17" dnum="7-o" numlevel="1" lineno="65" slineno="1-37" level="1"><display>(7)</display>information submitted to or by a governmental entity in response to a request for <ln numlevel="1" lineno="66" slineno="1-38"/>information, except, subject to Subsections <xref depth="4" refnumber="63G-2-305(1)">(1)</xref> and <xref depth="4" refnumber="63G-2-305(2)">(2)</xref>, that this Subsection <xref depth="4" refnumber="63G-2-305(7)">(7)</xref> does not <ln numlevel="1" lineno="67" slineno="1-39"/>restrict the right of a person to have access to the information, after:<subsection ssid="19-null-18" dnum="a-o" numlevel="1" lineno="68" slineno="1-40" level="2"><display>(a)</display>a contract directly relating to the subject of the request for information has been <ln numlevel="1" lineno="69" slineno="1-41"/>awarded and signed by all parties; or</subsection><subsection ssid="19-null-19" dnum="b-o" numlevel="1" lineno="70" slineno="1-42" level="2" space="false"><display>(b)</display><subsection ssid="19-null-20" dnum="i-o" level="3" placement="sameline"><display>(i)</display>a final determination is made not to enter into a contract that relates to the <ln numlevel="1" lineno="71" slineno="1-43"/>subject of the request for information; and</subsection><subsection ssid="19-null-21" dnum="ii-o" numlevel="1" lineno="72" slineno="1-44" level="3"><display>(ii)</display>at least two years have passed after the day on which the request for information <ln numlevel="1" lineno="73" slineno="1-45"/>is issued;</subsection></subsection></subsection><subsection ssid="19-null-22" dnum="8-o" numlevel="1" lineno="74" slineno="1-46" level="1"><display>(8)</display>records that would identify real property or the appraisal or estimated value of real or <ln numlevel="1" lineno="75" slineno="1-47"/>personal property, including intellectual property, under consideration for public <ln numlevel="1" lineno="76" slineno="1-48"/>acquisition before any rights to the property are acquired unless:<subsection ssid="19-null-23" dnum="a-o" numlevel="1" lineno="77" slineno="1-49" level="2"><display>(a)</display>public interest in obtaining access to the information is greater than or equal to the <ln numlevel="1" lineno="78" slineno="1-50"/>governmental entity's need to acquire the property on the best terms possible;</subsection><subsection ssid="19-null-24" dnum="b-o" numlevel="1" lineno="79" slineno="1-51" level="2"><display>(b)</display>the information has already been disclosed to persons not employed by or under a <ln numlevel="1" lineno="80" slineno="1-52"/>duty of confidentiality to the entity;</subsection><subsection ssid="19-null-25" dnum="c-o" numlevel="1" lineno="81" slineno="1-53" level="2"><display>(c)</display>in the case of records that would identify property, potential sellers of the described <ln numlevel="1" lineno="82" slineno="1-54"/>property have already learned of the governmental entity's plans to acquire the <ln numlevel="1" lineno="83" slineno="1-55"/>property;</subsection><subsection ssid="19-null-26" dnum="d-o" numlevel="1" lineno="84" slineno="1-56" level="2"><display>(d)</display>in the case of records that would identify the appraisal or estimated value of <ln numlevel="1" lineno="85" slineno="1-57"/>property, the potential sellers have already learned of the governmental entity's <ln numlevel="1" lineno="86" slineno="1-58"/>estimated value of the property; or</subsection><subsection ssid="19-null-27" dnum="e-o" numlevel="1" lineno="87" slineno="1-59" level="2"><display>(e)</display>the property under consideration for public acquisition is a single family residence <ln numlevel="1" lineno="88" slineno="1-60"/>and the governmental entity seeking to acquire the property has initiated negotiations <ln numlevel="1" lineno="89" slineno="1-61"/>to acquire the property as required under Section <xref depth="3" refnumber="78B-6-505">78B-6-505</xref>;</subsection></subsection><subsection ssid="19-null-28" dnum="9-o" numlevel="1" lineno="90" slineno="1-62" level="1"><display>(9)</display>records prepared in contemplation of sale, exchange, lease, rental, or other compensated <ln numlevel="1" lineno="91" slineno="1-63"/>transaction of real or personal property including intellectual property, which, if <ln numlevel="1" lineno="92" slineno="1-64"/>disclosed prior to completion of the transaction, would reveal the appraisal or estimated <ln numlevel="1" lineno="93" slineno="1-65"/>value of the subject property, unless:<subsection ssid="19-null-29" dnum="a-o" numlevel="1" lineno="94" slineno="1-66" level="2"><display>(a)</display>the public interest in access is greater than or equal to the interests in restricting <ln numlevel="1" lineno="95" slineno="1-67"/>access, including the governmental entity's interest in maximizing the financial <ln numlevel="1" lineno="96" slineno="1-68"/>benefit of the transaction; or</subsection><subsection ssid="19-null-30" dnum="b-o" numlevel="1" lineno="97" slineno="1-69" level="2"><display>(b)</display>when prepared by or on behalf of a governmental entity, appraisals or estimates of <ln numlevel="1" lineno="98" slineno="1-70"/>the value of the subject property have already been disclosed to persons not <ln numlevel="1" lineno="99" slineno="1-71"/>employed by or under a duty of confidentiality to the entity;</subsection></subsection><subsection ssid="19-null-31" dnum="10-o" numlevel="1" lineno="100" slineno="1-72" level="1"><display>(10)</display>records created or maintained for civil, criminal, or administrative enforcement <ln numlevel="1" lineno="101" slineno="1-73"/>purposes or audit purposes, or for discipline, licensing, certification, or registration <ln numlevel="1" lineno="102" slineno="1-74"/>purposes, if release of the records:<subsection ssid="19-null-32" dnum="a-o" numlevel="1" lineno="103" slineno="1-75" level="2"><display>(a)</display>reasonably could be expected to interfere with investigations undertaken for <ln numlevel="1" lineno="104" slineno="1-76"/>enforcement, discipline, licensing, certification, or registration purposes;</subsection><subsection ssid="19-null-33" dnum="b-o" numlevel="1" lineno="105" slineno="1-77" level="2"><display>(b)</display>reasonably could be expected to interfere with audits, disciplinary, or enforcement <ln numlevel="1" lineno="106" slineno="1-78"/>proceedings;</subsection><subsection ssid="19-null-34" dnum="c-o" numlevel="1" lineno="107" slineno="1-79" level="2"><display>(c)</display>would create a danger of depriving a person of a right to a fair trial or impartial <ln numlevel="1" lineno="108" slineno="1-80"/>hearing;</subsection><subsection ssid="19-null-35" dnum="d-o" numlevel="1" lineno="109" slineno="1-81" level="2"><display>(d)</display>reasonably could be expected to disclose the identity of a source who is not generally <ln numlevel="1" lineno="110" slineno="1-82"/>known outside of government and, in the case of a record compiled in the course of <ln numlevel="1" lineno="111" slineno="1-83"/>an investigation, disclose information furnished by a source not generally known <ln numlevel="1" lineno="112" slineno="1-84"/>outside of government if disclosure would compromise the source; or</subsection><subsection ssid="19-null-36" dnum="e-o" numlevel="1" lineno="113" slineno="1-85" level="2"><display>(e)</display>reasonably could be expected to disclose investigative or audit techniques, <ln numlevel="1" lineno="114" slineno="1-86"/>procedures, policies, or orders not generally known outside of government if <ln numlevel="1" lineno="115" slineno="1-87"/>disclosure would interfere with enforcement or audit efforts;</subsection></subsection><subsection ssid="19-null-37" dnum="11-o" numlevel="1" lineno="116" slineno="1-88" level="1"><display>(11)</display>records the disclosure of which would jeopardize the life or safety of an individual;</subsection><subsection ssid="19-null-38" dnum="12-o" numlevel="1" lineno="117" slineno="1-89" level="1"><display>(12)</display>records the disclosure of which would jeopardize the security of governmental <ln numlevel="1" lineno="118" slineno="1-90"/>property, governmental programs, or governmental recordkeeping systems from <ln numlevel="1" lineno="119" slineno="1-91"/>damage, theft, or other appropriation or use contrary to law or public policy;</subsection><subsection ssid="19-null-39" dnum="13-o" numlevel="1" lineno="120" slineno="1-92" level="1"><display>(13)</display>records that, if disclosed, would jeopardize the security or safety of a correctional <ln numlevel="1" lineno="121" slineno="1-93"/>facility, or records relating to incarceration, treatment, probation, or parole, that would <ln numlevel="1" lineno="122" slineno="1-94"/>interfere with the control and supervision of an offender's incarceration, treatment, <ln numlevel="1" lineno="123" slineno="1-95"/>probation, or parole;</subsection><subsection ssid="19-null-40" dnum="14-o" numlevel="1" lineno="124" slineno="1-96" level="1"><display>(14)</display>records that, if disclosed, would reveal recommendations made to the Board of <ln numlevel="1" lineno="125" slineno="1-97"/>Pardons and Parole by an employee of or contractor for the Department of Corrections, <ln numlevel="1" lineno="126" slineno="1-98"/>the Board of Pardons and Parole, or the Department of Health and Human Services that <ln numlevel="1" lineno="127" slineno="1-99"/>are based on the employee's or contractor's supervision, diagnosis, or treatment of any <ln numlevel="1" lineno="128" slineno="1-100"/>person within the board's jurisdiction;</subsection><subsection ssid="19-null-41" dnum="15-o" numlevel="1" lineno="129" slineno="1-101" level="1"><display>(15)</display>records and audit workpapers that identify audit, collection, and operational procedures <ln numlevel="1" lineno="130" slineno="1-102"/>and methods used by the State Tax Commission, if disclosure would interfere with <ln numlevel="1" lineno="131" slineno="1-103"/>audits or collections;</subsection><subsection ssid="19-null-42" dnum="16-o" numlevel="1" lineno="132" slineno="1-104" level="1"><display>(16)</display>records of a governmental audit agency relating to an ongoing or planned audit until <ln numlevel="1" lineno="133" slineno="1-105"/>the final audit is released;</subsection><subsection ssid="19-null-43" dnum="17-o" numlevel="1" lineno="134" slineno="1-106" level="1"><display>(17)</display>records that are subject to the attorney client privilege;</subsection><subsection ssid="19-null-44" dnum="18-o" numlevel="1" lineno="135" slineno="1-107" level="1"><display>(18)</display>records prepared for or by an attorney, consultant, surety, indemnitor, insurer, <ln numlevel="1" lineno="136" slineno="1-108"/>employee, or agent of a governmental entity for, or in anticipation of, litigation or a <ln numlevel="1" lineno="137" slineno="1-109"/>judicial, quasi-judicial, or administrative proceeding;</subsection><subsection ssid="19-null-45" dnum="19-o" numlevel="1" lineno="138" slineno="1-110" level="1" space="false"><display>(19)</display><subsection ssid="19-null-46" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="19-null-47" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>personal files of a state legislator, including personal correspondence to or <ln numlevel="1" lineno="139" slineno="1-111"/>from a member of the Legislature; and</subsection><subsection ssid="19-null-48" dnum="ii-o" numlevel="1" lineno="140" slineno="1-112" level="3" tab="1"><display>(ii)</display>notwithstanding Subsection <xref depth="4" refnumber="63G-2-305(19)(a)(i)">(19)(a)(i)</xref>, correspondence that gives notice of <ln numlevel="1" lineno="141" slineno="1-113"/>legislative action or policy may not be classified as protected under this section; <ln numlevel="1" lineno="142" slineno="1-114"/>and</subsection></subsection><subsection ssid="19-null-49" dnum="b-o" numlevel="1" lineno="143" slineno="1-115" level="2" space="false"><display>(b)</display><subsection ssid="19-null-50" dnum="i-o" level="3" placement="sameline"><display>(i)</display>an internal communication that is part of the deliberative process in connection <ln numlevel="1" lineno="144" slineno="1-116"/>with the preparation of legislation between:<subsection ssid="19-null-51" dnum="A-o" numlevel="1" lineno="145" slineno="1-117" level="4" tab="1"><display>(A)</display>members of a legislative body;</subsection><subsection ssid="19-null-52" dnum="B-o" numlevel="1" lineno="146" slineno="1-118" level="4" tab="1"><display>(B)</display>a member of a legislative body and a member of the legislative body's staff; or</subsection><subsection ssid="19-null-53" dnum="C-o" numlevel="1" lineno="147" slineno="1-119" level="4" tab="1"><display>(C)</display>members of a legislative body's staff; and</subsection></subsection><subsection ssid="19-null-54" dnum="ii-o" numlevel="1" lineno="148" slineno="1-120" level="3"><display>(ii)</display>notwithstanding Subsection <xref depth="4" refnumber="63G-2-305(19)(b)(i)">(19)(b)(i)</xref>, a communication that gives notice of <ln numlevel="1" lineno="149" slineno="1-121"/>legislative action or policy may not be classified as protected under this section;</subsection></subsection></subsection><subsection ssid="19-null-55" dnum="20-o" numlevel="1" lineno="150" slineno="1-122" level="1" space="false"><display>(20)</display><subsection ssid="19-null-56" dnum="a-o" level="2" placement="sameline"><display>(a)</display>records in the custody or control of the Office of Legislative Research and <ln numlevel="1" lineno="151" slineno="1-123"/>General Counsel, that, if disclosed, would reveal a particular legislator's <ln numlevel="1" lineno="152" slineno="1-124"/>contemplated legislation or contemplated course of action before the legislator has <ln numlevel="1" lineno="153" slineno="1-125"/>elected to support the legislation or course of action, or made the legislation or course <ln numlevel="1" lineno="154" slineno="1-126"/>of action public; and</subsection><subsection ssid="19-null-57" dnum="b-o" numlevel="1" lineno="155" records requesting the legislation be maintained as protected <ln numlevel="1" lineno="158" slineno="1-130"/>records until such time as the legislator elects to make the legislation or course of <ln numlevel="1" lineno="159" slineno="1-131"/>action public;</subsection></subsection><subsection ssid="19-null-58" dnum="21-o" numlevel="1" lineno="160" slineno="1-132" level="1"><display>(21)</display>a research request from a legislator to a legislative staff member and research findings <ln numlevel="1" lineno="161" slineno="1-133"/>prepared in response to the request;</subsection><subsection ssid="19-null-59" dnum="22-o" numlevel="1" lineno="162" slineno="1-134" level="1"><display>(22)</display>drafts, unless otherwise classified as public;</subsection><subsection ssid="19-null-60" dnum="23-o" numlevel="1" lineno="163" slineno="1-135" level="1"><display>(23)</display>records concerning a governmental entity's strategy about:<subsection ssid="19-null-61" dnum="a-o" numlevel="1" lineno="164" slineno="1-136" level="2"><display>(a)</display>collective bargaining; or</subsection><subsection ssid="19-null-62" dnum="b-o" numlevel="1" lineno="165" slineno="1-137" level="2"><display>(b)</display>imminent or pending litigation;</subsection></subsection><subsection ssid="19-null-63" dnum="24-o" numlevel="1" lineno="166" slineno="1-138" level="1"><display>(24)</display>records of investigations of loss occurrences and analyses of loss occurrences that may <ln numlevel="1" lineno="167" slineno="1-139"/>be covered by the Risk Management Fund, the Employers' Reinsurance Fund, the <ln numlevel="1" lineno="168" slineno="1-140"/>Uninsured Employers' Fund, or similar divisions in other governmental entities;</subsection><subsection ssid="19-null-64" dnum="25-o" numlevel="1" lineno="169" slineno="1-141" level="1"><display>(25)</display>records, other than personnel evaluations, that contain a personal recommendation <ln numlevel="1" lineno="170" slineno="1-142"/>concerning an individual if disclosure would constitute a clearly unwarranted invasion <ln numlevel="1" lineno="171" slineno="1-143"/>of personal privacy, or disclosure is not in the public interest;</subsection><subsection ssid="19-null-65" dnum="26-o" numlevel="1" lineno="172" slineno="1-144" level="1"><display>(26)</display>records that reveal the location of historic, prehistoric, paleontological, or biological <ln numlevel="1" lineno="173" slineno="1-145"/>resources that if known would jeopardize the security of those resources or of valuable <ln numlevel="1" lineno="174" slineno="1-146"/>historic, scientific, educational, or cultural information;</subsection><subsection ssid="19-null-66" dnum="27-o" numlevel="1" lineno="175" slineno="1-147" level="1"><display>(27)</display>records of independent state agencies if the disclosure of the records would conflict <ln numlevel="1" lineno="176" slineno="1-148"/>with the fiduciary obligations of the agency;</subsection><subsection ssid="19-null-67" dnum="28-o" numlevel="1" lineno="177" slineno="1-149" level="1"><display>(28)</display>records of an institution of higher education defined in Section <xref depth="3" refnumber="53H-1-101">53H-1-101</xref> regarding <ln numlevel="1" lineno="178" slineno="1-150"/>tenure evaluations, appointments, applications for admissions, retention decisions, and <ln numlevel="1" lineno="179" slineno="1-151"/>promotions, which could be properly discussed in a meeting closed in accordance with <ln numlevel="1" lineno="180" slineno="1-152"/>Title <xref depth="1" refnumber="52-4">52, Chapter 4</xref>, Open and Public Meetings Act, provided that records of the final <ln numlevel="1" lineno="181" slineno="1-153"/>decisions about tenure, appointments, retention, promotions, or those students admitted, <ln numlevel="1" lineno="182" slineno="1-154"/>may not be classified as protected under this section;</subsection><subsection ssid="19-null-68" dnum="29-o" numlevel="1" lineno="183" slineno="1-155" level="1"><display>(29)</display>records of the governor's office, including budget recommendations, legislative <ln numlevel="1" lineno="184" slineno="1-156"/>proposals, and policy statements, that if disclosed would reveal the governor's <ln numlevel="1" lineno="185" slineno="1-157"/>contemplated policies or contemplated courses of action before the governor has <ln numlevel="1" lineno="186" slineno="1-158"/>implemented or rejected those policies or courses of action or made them public;</subsection><subsection ssid="19-null-69" dnum="30-o" numlevel="1" lineno="187" slineno="1-159" level="1"><display>(30)</display>records of the Office of the Legislative Fiscal Analyst relating to budget analysis, <ln numlevel="1" lineno="188" slineno="1-160"/>revenue estimates, and fiscal notes of proposed legislation before issuance of the final <ln numlevel="1" lineno="189" slineno="1-161"/>recommendations in these areas;</subsection><subsection ssid="19-null-70" dnum="31-o" numlevel="1" lineno="190" slineno="1-162" level="1"><display>(31)</display>records provided by the United States or by a government entity outside the state that <ln numlevel="1" lineno="191" slineno="1-163"/>are given to the governmental entity with a requirement that they be managed as <ln numlevel="1" lineno="192" slineno="1-164"/>protected records if the providing entity certifies that the record would not be subject to <ln numlevel="1" lineno="193" slineno="1-165"/>public disclosure if retained by it;</subsection><subsection ssid="19-null-71" dnum="32-o" numlevel="1" lineno="194" slineno="1-166" level="1"><display>(32)</display>transcripts, minutes, recordings, or reports of the closed portion of a meeting of a <ln numlevel="1" lineno="195" slineno="1-167"/>public body except as provided in Section <xref depth="3" refnumber="52-4-206">52-4-206</xref>;</subsection><subsection ssid="19-null-72" dnum="33-o" numlevel="1" lineno="196" slineno="1-168" level="1"><display>(33)</display>records that would reveal the contents of settlement negotiations but not including final <ln numlevel="1" lineno="197" slineno="1-169"/>settlements or empirical data to the extent that they are not otherwise exempt from <ln numlevel="1" lineno="198" slineno="1-170"/>disclosure;</subsection><subsection ssid="19-null-73" dnum="34-o" numlevel="1" lineno="199" slineno="1-171" level="1"><display>(34)</display>memoranda prepared by staff and used in the decision-making process by an <ln numlevel="1" lineno="200" slineno="1-172"/>administrative law judge, a member of the Board of Pardons and Parole, or a member of <ln numlevel="1" lineno="201" slineno="1-173"/>any other body charged by law with performing a quasi-judicial function;</subsection><subsection ssid="19-null-74" dnum="35-o" numlevel="1" lineno="202" slineno="1-174" level="1"><display>(35)</display>records that would reveal negotiations regarding assistance or incentives offered by or <ln numlevel="1" lineno="203" slineno="1-175"/>requested from a governmental entity for the purpose of encouraging a person to expand <ln numlevel="1" lineno="204" slineno="1-176"/>or locate a business in Utah, but only if disclosure would result in actual economic harm <ln numlevel="1" lineno="205" slineno="1-177"/>to the person or place the governmental entity at a competitive disadvantage, but this <ln numlevel="1" lineno="206" slineno="1-178"/>section may not be used to restrict access to a record evidencing a final contract;</subsection><subsection ssid="19-null-75" dnum="36-o" numlevel="1" lineno="207" slineno="1-179" level="1"><display>(36)</display>materials to which access must be limited for purposes of securing or maintaining the <ln numlevel="1" lineno="208" slineno="1-180"/>governmental entity's proprietary protection of intellectual property rights including <ln numlevel="1" lineno="209" slineno="1-181"/>patents, copyrights, and trade secrets;</subsection><subsection ssid="19-null-76" dnum="37-o" numlevel="1" lineno="210" slineno="1-182" level="1"><display>(37)</display>the name of a donor or a prospective donor to a governmental entity, including an <ln numlevel="1" lineno="211" slineno="1-183"/>institution of higher education defined in Section <xref depth="3" refnumber="53H-1-101">53H-1-101</xref>, and other information <ln numlevel="1" lineno="212" slineno="1-184"/>concerning the donation that could reasonably be expected to reveal the identity of the <ln numlevel="1" lineno="213" slineno="1-185"/>donor, provided that:<subsection ssid="19-null-77" dnum="a-o" numlevel="1" lineno="214" slineno="1-186" level="2"><display>(a)</display>the donor requests anonymity in writing;</subsection><subsection ssid="19-null-78" dnum="b-o" numlevel="1" lineno="215" slineno="1-187" level="2"><display>(b)</display>any terms, conditions, restrictions, or privileges relating to the donation may not be <ln numlevel="1" lineno="216" slineno="1-188"/>classified protected by the governmental entity under this Subsection <xref depth="4" refnumber="63G-2-305(37)">(37)</xref>; and</subsection><subsection ssid="19-null-79" dnum="c-o" numlevel="1" lineno="217" slineno="1-189" level="2"><display>(c)</display>except for an institution of higher education defined in Section <xref depth="3" refnumber="53H-1-101">53H-1-101</xref>, the <ln numlevel="1" lineno="218" slineno="1-190"/>governmental unit to which the donation is made is primarily engaged in educational, <ln numlevel="1" lineno="219" slineno="1-191"/>charitable, or artistic endeavors, and has no regulatory or legislative authority over <ln numlevel="1" lineno="220" slineno="1-192"/>the donor, a member of the donor's immediate family, or any entity owned or <ln numlevel="1" lineno="221" slineno="1-193"/>controlled by the donor or the donor's immediate family;</subsection></subsection><subsection ssid="19-null-80" dnum="38-o" numlevel="1" lineno="222" slineno="1-194" level="1"><display>(38)</display>accident reports, except as provided in Sections <xref depth="3" refnumber="41-6a-404">41-6a-404</xref>, <xref depth="3" refnumber="41-12a-202">41-12a-202</xref>, and <xref depth="3" refnumber="73-18-13">73-18-13</xref>;</subsection><subsection ssid="19-null-81" dnum="39-o" numlevel="1" lineno="223" slineno="1-195" level="1"><display>(39)</display>a notification of workers' compensation insurance coverage described in Section <xref depth="3" refnumber="34A-2-205"><ln numlevel="1" lineno="224" slineno="1-196"/>34A-2-205</xref>;</subsection><subsection ssid="19-null-82" dnum="40-o" numlevel="1" lineno="225" slineno="1-197" level="1"><display>(40)</display>subject to Subsections <xref mobile phone number, if:<subsection ssid="19-null-117" dnum="a-o" numlevel="1" lineno="290" slineno="1-262" level="2"><display>(a)</display>the individual is required to provide the information in that provides goods or services for, medical or scientific research that is:<subsection ssid="19-null-126" dnum="a-o" numlevel="1" lineno="306" slineno="1-278" level="2"><display>(a)</display>conducted within the state system of higher education, as described in Section <xref depth="3" refnumber="53H-1-102"><ln numlevel="1" lineno="307" slineno="1-279"/>53H-1-102</xref>; and</subsection><subsection ssid="19-null-127" dnum="b-o" numlevel="1" lineno="308" slineno="1-280" level="2"><display>(b)</display>conducted using animals;</subsection></subsection><subsection ssid="19-null-128" dnum="54-o" numlevel="1" lineno="309" slineno="1-281" level="1"><display>(54)</display>in accordance with Section <xref depth="3" refnumber="78A-12-203">78A-12-203</xref>, any record of the Judicial Performance <ln numlevel="1" lineno="310" slineno="1-282"/>Evaluation Commission concerning an individual commissioner's vote, in relation to <ln numlevel="1" lineno="311" slineno="1-283"/>whether a judge meets or exceeds minimum performance standards under Subsection <xref depth="4" refnumber="78A-12-203(4)"><ln numlevel="1" numlevel="1" lineno="323" slineno="1-295"/>of Water Resources or the Board of Water Resources; or</subsection><subsection ssid="19-null-134" dnum="b-o" numlevel="1" lineno="324" slineno="1-296" level="2"><display>(b)</display>an outline of an emergency response plan in possession of the state or a county or <ln numlevel="1" lineno="325" slineno="1-297"/>municipality;</subsection></subsection><subsection ssid="19-null-135" dnum="59-o" numlevel="1" lineno="326" slineno="1-298" level="1"><display>(59)</display>the following records in the custody or control of the Office of Inspector General of <ln numlevel="1" lineno="327" slineno="1-299"/>Medicaid Services, created in Section <xref depth="3" refnumber="63A-13-201">63A-13-201</xref>:<subsection ssid="19-null-136" dnum="a-o" numlevel="1" lineno="328" slineno="1-300" level="2"><display>(a)</display>records that would disclose information relating to allegations of personal <ln numlevel="1" lineno="329" slineno="1-301"/>misconduct, gross mismanagement, or illegal activity of a person if the information <ln numlevel="1" lineno="330" slineno="1-302"/>or allegation cannot be corroborated by the Office of Inspector General of Medicaid <ln numlevel="1" lineno="331" slineno="1-303"/>Services through other documents or evidence, and the records relating to the <ln numlevel="1" lineno="332" slineno="1-304"/>allegation are not relied upon by the Office of Inspector General of Medicaid <ln numlevel="1" lineno="333" slineno="1-305"/>Services in preparing a final investigation report or final audit report;</subsection><subsection ssid="19-null-137" dnum="b-o" numlevel="1" lineno="334" slineno="1-306" entity of the United States, if the <ln numlevel="1" lineno="339" slineno="1-311"/>information was disclosed on the condition that the identity of the person be <ln numlevel="1" lineno="340" slineno="1-312"/>protected;</subsection><subsection ssid="19-null-138" dnum="c-o" numlevel="1" lineno="341" slineno="1-313" level="2"><display>(c)</display>before the time that an investigation or audit is completed and the final investigation <ln numlevel="1" lineno="342" slineno="1-314"/>or final audit report is released, records or drafts circulated to a person who is not an <ln numlevel="1" lineno="343" slineno="1-315"/>employee or head of a governmental entity for the person's response or information;</subsection><subsection ssid="19-null-139" dnum="d-o" numlevel="1" lineno="344" slineno="1-316" level="2"><display>(d)</display>records that would disclose an outline or part of any investigation, audit survey plan, <ln numlevel="1" lineno="345" slineno="1-317"/>or audit program; or</subsection><subsection ssid="19-null-140" dnum="e-o" numlevel="1" lineno="346" slineno="1-318" level="2"><display>(e)</display>requests for an investigation or audit, if disclosure would risk circumvention of an <ln numlevel="1" lineno="347" slineno="1-319"/>investigation or audit;</subsection></subsection><subsection ssid="19-null-141" dnum="60-o" numlevel="1" lineno="348" slineno="1-320" level="1"><display>(60)</display>records that reveal methods used by the Office of Inspector General of Medicaid <ln numlevel="1" lineno="349" slineno="1-321"/>Services, the fraud unit, or the Department of Health and Human Services, to discover <ln numlevel="1" lineno="350" slineno="1-322"/>Medicaid fraud, waste, or abuse;</subsection><subsection ssid="19-null-142" dnum="61-o" numlevel="1" lineno="351" slineno="1-323" level="1"><display>(61)</display>information provided to the Department of Health and Human Services or the Division <ln numlevel="1" lineno="352" slineno="1-324"/>of Professional Licensing under Subsections <xref depth="4" refnumber="58-67-304(3)">58-67-304(3)</xref> and <xref depth="4" refnumber="63G-2-305(4)">(4)</xref> and Subsections <xref depth="4" refnumber="58-68-304(3)"><ln numlevel="1" lineno="353" slineno="1-325"/>58-68-304(3)</xref> and <xref depth="4" refnumber="63G-2-305(4)">(4)</xref>;</subsection><subsection ssid="19-null-143" dnum="62-o" numlevel="1" lineno="354" slineno="1-326" level="1"><display>(62)</display>a record described in Section <xref depth="3" refnumber="63G-12-210">63G-12-210</xref>;</subsection><subsection ssid="19-null-144" dnum="63-o" numlevel="1" lineno="355" slineno="1-327" level="1"><display>(63)</display>captured plate data that is obtained through an automatic license plate reader system <ln dnum="64-o" numlevel="1" lineno="357" slineno="1-329" level="1"><display>(64)</display>an audio or video recording created by a body-worn camera, as that term is defined in <ln numlevel="1" lineno="358" slineno="1-330"/>Section <xref depth="3" refnumber="77-7a-103">77-7a-103</xref>, that records sound or images inside a hospital or health care facility <ln numlevel="1" lineno="359" slineno="1-331"/>as those terms are defined in Section <xref depth="3" refnumber="78B-3-403">78B-3-403</xref>, inside a clinic of a health care provider, <ln numlevel="1" lineno="360" slineno="1-332"/>as that term is defined in Section <xref depth="3" refnumber="78B-3-403">78B-3-403</xref>, or inside a human service program as that <ln numlevel="1" lineno="361" slineno="1-333"/>term is defined in Section <xref depth="3" refnumber="26B-2-101">26B-2-101</xref>, except for recordings that:<subsection ssid="19-null-146" dnum="a-o" numlevel="1" lineno="362" slineno="1-334" level="2"><display>(a)</display>depict the commission of an alleged crime;</subsection><subsection ssid="19-null-147" dnum="b-o" numlevel="1" lineno="363" slineno="1-335" level="2"><display>(b)</display>record any encounter between a law enforcement officer and a person that results in <ln numlevel="1" lineno="364" slineno="1-336"/>death or bodily injury, or includes an instance when an officer fires a weapon;</subsection><subsection ssid="19-null-148" dnum="c-o" numlevel="1" lineno="365" slineno="1-337" level="2"><display>(c)</display>record any encounter that is the subject of a complaint or a legal proceeding against a <ln numlevel="1" lineno="366" slineno="1-338"/>law enforcement officer or law enforcement agency;</subsection><subsection ssid="19-null-149" dnum="d-o" numlevel="1" lineno="367" slineno="1-339" level="2"><display>(d)</display>contain an officer involved critical incident as defined in Subsection <xref depth="4" refnumber="76-2-408(1)(f)">76-2-408(1)(f)</xref>; <ln numlevel="1" lineno="368" slineno="1-340"/>or</subsection><subsection ssid="19-null-150" dnum="e-o" numlevel="1" lineno="369" slineno="1-341" level="2"><display>(e)</display>have been requested for reclassification as a public record by a subject or authorized <ln numlevel="1" lineno="370" slineno="1-342"/>agent of a subject featured in the recording;</subsection></subsection><subsection ssid="19-null-151" dnum="65-o" numlevel="1" lineno="371" slineno="1-343" level="1"><display>(65)</display>a record pertaining to the search process for a president of an institution of higher <ln numlevel="1" lineno="372" slineno="1-344"/>education described in Section <xref depth="3" refnumber="53H-3-302">53H-3-302</xref>;</subsection><subsection ssid="19-null-152" dnum="66-o" numlevel="1" lineno="373" slineno="1-345" level="1"><display>(66)</display>an audio recording that is:<subsection ssid="19-null-153" dnum="a-o" numlevel="1" lineno="374" slineno="1-346" level="2"><display>(a)</display>produced by an audio recording device that is used in conjunction with a device or <ln numlevel="1" lineno="375" slineno="1-347"/>piece of equipment designed or intended for resuscitating an individual or for treating <ln numlevel="1" lineno="376" slineno="1-348"/>an individual with a life-threatening condition;</subsection><subsection ssid="19-null-154" dnum="b-o" numlevel="1" lineno="377" slineno="1-349" level="2"><display>(b)</display>produced during an emergency event when an individual employed to provide law <ln numlevel="1" lineno="378" slineno="1-350"/>enforcement, fire protection, paramedic, emergency medical, or other first responder <ln numlevel="1" lineno="379" slineno="1-351"/>service:<subsection ssid="19-null-155" dnum="i-o" numlevel="1" lineno="380" slineno="1-352" level="3"><display>(i)</display>is responding to an individual needing resuscitation or with a life-threatening <ln numlevel="1" lineno="381" slineno="1-353"/>condition; and</subsection><subsection ssid="19-null-156" dnum="ii-o" numlevel="1" lineno="382" slineno="1-354" level="3"><display>(ii)</display>uses a device or piece of equipment designed or intended for resuscitating an <ln numlevel="1" lineno="383" slineno="1-355"/>individual or for treating an individual with a life-threatening condition; and</subsection></subsection><subsection ssid="19-null-157" dnum="c-o" numlevel="1" lineno="384" slineno="1-356" level="2"><display>(c)</display>intended and used for purposes of training emergency responders how to improve <ln numlevel="1" lineno="385" slineno="1-357"/>their response to an emergency situation;</subsection></subsection><subsection ssid="19-null-158" dnum="67-o" numlevel="1" lineno="386" slineno="1-358" level="1"><display>(67)</display>records submitted by or prepared in relation to an applicant seeking a recommendation <ln numlevel="1" lineno="387" slineno="1-359"/>by the Research and General Counsel Subcommittee, the Budget Subcommittee, or the <ln numlevel="1" lineno="388" slineno="1-360"/>Legislative Audit Subcommittee, established under Section <xref depth="3" refnumber="36-12-8">36-12-8</xref>, for an employment <ln numlevel="1" lineno="389" slineno="1-361"/>position with the Legislature;</subsection><subsection ssid="19-null-159" dnum="68-o" numlevel="1" lineno="390" slineno="1-362" level="1"><display>(68)</display>work papers as defined in Section <xref depth="3" refnumber="31A-2-204">31A-2-204</xref>;</subsection><subsection ssid="19-null-160" dnum="69-o" numlevel="1" lineno="391" slineno="1-363" level="1"><display>(69)</display>a record made available to Adult Protective Services or a law enforcement agency <ln numlevel="1" lineno="392" slineno="1-364"/>under Section <xref depth="3" refnumber="61-1-206">61-1-206</xref>;</subsection><subsection ssid="19-null-161" dnum="70-o" numlevel="1" lineno="393" slineno="1-365" level="1"><display>(70)</display>a record submitted to the Insurance Department in accordance with Section <xref depth="3" refnumber="31A-37-201"><ln numlevel="1" lineno="394" slineno="1-366"/>31A-37-201</xref>;</subsection><subsection ssid="19-null-162" dnum="71-o" numlevel="1" lineno="395" slineno="1-367" level="1"><display>(71)</display>a record described in Section dnum="80-o" numlevel="1" lineno="418" slineno="1-390" level="1"><display>(80)</display>an image taken of an individual during the process of booking the individual into jail, <ln numlevel="1" lineno="419" slineno="1-391"/>unless:<subsection ssid="19-null-177" dnum="a-o" numlevel="1" lineno="420" slineno="1-392" level="2"><display>(a)</display>the individual is convicted of a criminal offense based upon the conduct for which <ln numlevel="1" lineno="421" slineno="1-393"/>the individual was incarcerated at the time the image was taken;</subsection><subsection ssid="19-null-178" dnum="b-o" numlevel="1" lineno="422" slineno="1-394" level="2"><display>(b)</display>a law enforcement agency releases or disseminates the image:<subsection ssid="19-null-179" dnum="i-o" numlevel="1" lineno="423" slineno="1-395" level="3"><display>(i)</display>after determining that  the individual is a fugitive or an imminent threat to an <ln numlevel="1" lineno="424" slineno="1-396"/>individual or to public safety and releasing or disseminating the image will assist <ln numlevel="1" lineno="425" slineno="1-397"/>in apprehending the individual or reducing or eliminating the threat; or</subsection><subsection ssid="19-null-180" dnum="ii-o" numlevel="1" lineno="426" slineno="1-398" level="3"><display>(ii)</display>to a potential witness or other individual with direct knowledge of events relevant <ln numlevel="1" lineno="427" slineno="1-399"/>to a criminal investigation or criminal proceeding for the purpose of identifying or <ln numlevel="1" lineno="428" slineno="1-400"/>locating an individual in connection with the criminal investigation or criminal <ln numlevel="1" lineno="429" slineno="1-401"/>proceeding;</subsection></subsection><subsection ssid="19-null-181" dnum="c-o" numlevel="1" lineno="430" slineno="1-402" level="2"><display>(c)</display>a judge orders the release or dissemination of the image based on a finding that the <ln numlevel="1" lineno="431" slineno="1-403"/>release or dissemination is in furtherance of a legitimate law enforcement interest; or</subsection><subsection ssid="19-null-182" dnum="d-o" numlevel="1" lineno="432" slineno="1-404" level="2"><display>(d)</display>the image is displayed to a person who is permitted to view the image under Section <xref depth="3" refnumber="17-72-802"><ln numlevel="1" lineno="433" slineno="1-405"/>17-72-802</xref>;</subsection></subsection><subsection ssid="19-null-183" dnum="81-o" numlevel="1" lineno="434" slineno="1-406" level="1"><display>(81)</display>a record:<subsection ssid="19-null-184" dnum="a-o" numlevel="1" lineno="435" slineno="1-407" level="2"><display>(a)</display>concerning an interstate claim to the use of waters in the Colorado River system;</subsection><subsection ssid="19-null-185" dnum="b-o" numlevel="1" lineno="436" slineno="1-408" level="2"><display>(b)</display>relating to a judicial proceeding, administrative proceeding, or negotiation with a <ln numlevel="1" lineno="437" slineno="1-409"/>representative from another state or the federal government as provided in Section <xref depth="3" refnumber="63M-14-205"><ln numlevel="1" lineno="438" slineno="1-410"/>63M-14-205</xref>; and</subsection><subsection ssid="19-null-186" dnum="c-o" numlevel="1" lineno="439" slineno="1-411" level="2"><display>(c)</display>the disclosure of which would:<subsection ssid="19-null-187" dnum="i-o" numlevel="1" lineno="440" slineno="1-412" level="3"><display>(i)</display>reveal a legal strategy relating to the state's claim to the use of the water in the <ln numlevel="1" lineno="441" slineno="1-413"/>Colorado River system;</subsection><subsection ssid="19-null-188" dnum="ii-o" numlevel="1" lineno="442" slineno="1-414" level="3"><display>(ii)</display>harm the ability of the Colorado River Authority of Utah or river commissioner to <ln numlevel="1" lineno="443" slineno="1-415"/>negotiate the best terms and conditions regarding the use of water in the Colorado <ln numlevel="1" lineno="444" slineno="1-416"/>River system; or</subsection><subsection ssid="19-null-189" dnum="iii-o" numlevel="1" lineno="445" slineno="1-417" level="3"><display>(iii)</display>give an advantage to another state or to the federal government in negotiations <ln numlevel="1" lineno="446" slineno="1-418"/>regarding the use of water in the Colorado River system;</subsection></subsection></subsection><subsection ssid="19-null-190" dnum="82-o" numlevel="1" lineno="447" slineno="1-419" level="1"><display>(82)</display>any part of an application described in Section <xref depth="3" refnumber="63N-16-201">63N-16-201</xref> that the Governor's Office <ln numlevel="1" lineno="448" slineno="1-420"/>of Economic Opportunity determines is nonpublic, confidential information that if <ln numlevel="1" lineno="449" slineno="1-421"/>disclosed would result in actual economic harm to the applicant, but this Subsection <xref depth="4" refnumber="63G-2-305(82)">(82)</xref> <ln numlevel="1" lineno="450" slineno="1-422"/>may not be used to restrict access to a record evidencing a final contract or approval <ln numlevel="1" lineno="451" slineno="1-423"/>decision;</subsection><subsection ssid="19-null-191" dnum="83-o" numlevel="1" lineno="452" slineno="1-424" level="1"><display>(83)</display>the following records of a drinking water or wastewater facility:<subsection ssid="19-null-192" dnum="a-o" numlevel="1" lineno="453" slineno="1-425" level="2"><display>(a)</display>an engineering or architectural drawing of the drinking water or wastewater facility; <ln numlevel="1" lineno="454" slineno="1-426"/>and</subsection><subsection ssid="19-null-193" dnum="b-o" numlevel="1" lineno="455" slineno="1-427" level="2"><display>(b)</display>except as provided in Section <xref depth="3" refnumber="63G-2-106">63G-2-106</xref>, a record detailing tools or processes the <ln numlevel="1" lineno="456" slineno="1-428"/>drinking water or wastewater facility uses to secure, or prohibit access to, the records <ln numlevel="1" lineno="457" slineno="1-429"/>described in Subsection <xref depth="4" refnumber="63G-2-305(83)(a)">(83)(a)</xref>;</subsection></subsection><subsection ssid="19-null-194" dnum="84-o" numlevel="1" lineno="458" slineno="1-430" level="1"><display>(84)</display>a statement that an employee of a governmental entity provides to the governmental <ln numlevel="1" lineno="459" slineno="1-431"/>entity as part of the governmental entity's personnel or administrative investigation into <ln numlevel="1" lineno="460" slineno="1-432"/>potential misconduct involving the employee if the governmental entity:<subsection ssid="19-null-195" dnum="a-o" numlevel="1" lineno="461" slineno="1-433" level="2"><display>(a)</display>requires the statement under threat of employment disciplinary action, including <ln numlevel="1" lineno="462" slineno="1-434"/>possible termination of employment, for the employee's refusal to provide the <ln numlevel="1" lineno="463" slineno="1-435"/>statement; and</subsection><subsection ssid="19-null-196" dnum="b-o" numlevel="1" lineno="464" slineno="1-436" level="2"><display>(b)</display>provides the employee assurance that the statement cannot be used against the <ln numlevel="1" lineno="465" slineno="1-437"/>employee in any criminal proceeding;</subsection></subsection><subsection ssid="19-null-197" dnum="85-o" numlevel="1" lineno="466" slineno="1-438" level="1"><display>(85)</display>any part of an application for a Utah Fits All Scholarship account described in Section <xref depth="3" refnumber="53F-6-402"><ln numlevel="1" lineno="467" slineno="1-439"/>53F-6-402</xref> or other information identifying a scholarship student as defined in Section <xref depth="3" refnumber="53F-6-401"><ln numlevel="1" lineno="468" slineno="1-440"/>53F-6-401</xref>; </subsection><subsection ssid="19-null-198" dnum="86-o" numlevel="1" lineno="469" slineno="1-441" level="1"><display>(86)</display>a record:<subsection ssid="19-null-199" dnum="a-o" numlevel="1" lineno="470" slineno="1-442" level="2"><display>(a)</display>concerning a claim to the use of waters in the Great Salt Lake;</subsection><subsection ssid="19-null-200" dnum="b-o" numlevel="1" lineno="471" slineno="1-443" level="2"><display>(b)</display>relating to a judicial proceeding, administrative proceeding, or negotiation with a <ln numlevel="1" lineno="472" slineno="1-444"/>person concerning the claim, including a representative from another state or the <ln numlevel="1" lineno="473" slineno="1-445"/>federal government; and</subsection><subsection ssid="19-null-201" dnum="c-o" numlevel="1" lineno="474" slineno="1-446" level="2"><display>(c)</display>the disclosure of which would:<subsection ssid="19-null-202" dnum="i-o" numlevel="1" lineno="475" slineno="1-447" level="3"><display>(i)</display>reveal a legal strategy relating to the state's claim to the use of the water in the <ln numlevel="1" lineno="476" slineno="1-448"/>Great Salt Lake;</subsection><subsection ssid="19-null-203" dnum="ii-o" numlevel="1" lineno="477" slineno="1-449" level="3"><display>(ii)</display>harm the ability of the Great Salt Lake commissioner to negotiate the best terms <ln numlevel="1" lineno="478" slineno="1-450"/>and conditions regarding the use of water in the Great Salt Lake; or</subsection><subsection ssid="19-null-204" dnum="iii-o" numlevel="1" lineno="479" slineno="1-451" level="3"><display>(iii)</display>give an advantage to another person including another state or to the federal <ln numlevel="1" lineno="480" slineno="1-452"/>government in negotiations regarding the use of water in the Great Salt Lake;</subsection></subsection></subsection><subsection ssid="19-null-205" dnum="87-o" numlevel="1" lineno="481" slineno="1-453" level="1"><display>(87)</display>a consumer complaint described in Section <xref depth="3" refnumber="13-2-11">13-2-11</xref>, unless the consumer complaint is <ln numlevel="1" lineno="482" slineno="1-454"/>reclassified as public as described in Subsection <xref depth="3" refnumber="13-2-11">13-2-11</xref>(4);</subsection><subsection ssid="19-null-206" dnum="88-o" numlevel="1" lineno="483" slineno="1-455" level="1"><display>(88)</display>a record of the Utah water agent, appointed under Section <xref depth="3" refnumber="73-10g-702">73-10g-702</xref>:<subsection ssid="19-null-207" dnum="a-o" numlevel="1" lineno="484" slineno="1-456" level="2"><display>(a)</display>concerning a claim to the use of waters;</subsection><subsection ssid="19-null-208" dnum="b-o" numlevel="1" lineno="485" slineno="1-457" level="2"><display>(b)</display>relating to a judicial proceeding, administrative proceeding, or negotiation with a <ln numlevel="1" lineno="486" slineno="1-458"/>representative from another state, a tribe, the federal government, or other <ln numlevel="1" lineno="487" slineno="1-459"/>government entity as provided in <xref depth="2" refnumber="73-10g-7">Title </xref>73, Ch<xref depth="2" refnumber="63G-10g-7">apter </xref>10g, Part 7, Utah Water Agent; <ln numlevel="1" lineno="488" slineno="1-460"/>and</subsection><subsection ssid="19-null-209" dnum="c-o" numlevel="1" lineno="489" slineno="1-461" level="2"><display>(c)</display>the disclosure of which would:<subsection ssid="19-null-210" dnum="i-o" numlevel="1" lineno="490" slineno="1-462" level="3"><display>(i)</display>reveal a legal strategy relating to the state's claim to the use of the water;</subsection><subsection ssid="19-null-211" dnum="ii-o" numlevel="1" lineno="491" slineno="1-463" level="3"><display>(ii)</display>harm the ability of the Utah water agent to negotiate the best terms and conditions <ln numlevel="1" lineno="492" slineno="1-464"/>regarding the use of water; or</subsection><subsection ssid="19-null-212" dnum="iii-o" numlevel="1" lineno="493" slineno="1-465" lineno="517" slineno="3-7"/>committed by a judge other than the chief justice of the Supreme Court, the <ln numlevel="1" lineno="518" slineno="3-8"/>commission shall immediately refer the allegation and any information relevant to <ln numlevel="1" lineno="519" slineno="3-9"/>the potential criminal violation to the chief justice of the Supreme Court.</subsection></subsection><subsection pairid="1226" style="2" owner="o" level="1" deltag="both">(B)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1227" style="1" owner="i" level="1" amendtag="both" space="true">(ii)</amend></display>If the local prosecuting attorney receiving the allegation of criminal <ln numlevel="1" lineno="526" slineno="3-16"/>misconduct of a judge practices before that judge on a regular basis, or has a <ln numlevel="1" lineno="527" slineno="3-17"/>conflict of interest in investigating the crime, the local prosecuting attorney shall <ln numlevel="1" lineno="528" slineno="3-18"/>refer the allegation of criminal misconduct to another local or state prosecutor <ln numlevel="1" lineno="529" slineno="3-19"/>who would not have the same disability or conflict.</subsection><subsection ssid="3-null-7" dnum="C-o:iii-i" numlevel="1" lineno="530" slineno="3-20" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1227" style="2" owner="o" level="1" deltag="both">(C)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1228" style="1" owner="i" level="1" amendtag="both" space="true">(iii)</amend></display>The commission may <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="39" groupid="32" style="2" owner="ahaskell" level="1" deltag="both">concurrently </amend><amendoutend style="2"/>proceed <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="30" groupid="27" style="2" owner="ahaskell" level="1" deltag="both">with its investigation of</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="29" groupid="26" style="1" owner="ahaskell" level="1" amendtag="both" space="true">to <ln numlevel="1" lineno="531" slineno="3-21"/>investigate</amend> the complaint without waiting for the resolution of the criminal <ln numlevel="1" lineno="532" slineno="3-22"/>investigation by the prosecuting attorney.</subsection></subsection><subsection ssid="3-null-8" dnum="b-o:c-i" numlevel="1" lineno="533" slineno="3-23" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1228" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1229" style="1" owner="i" level="1" amendtag="both" space="true">(c)</amend></display>The chief justice of the Supreme Court may place a judge on administrative <ln numlevel="1" lineno="534" slineno="3-24"/>leave with or without pay if the chief justice has a reasonable basis to believe that the <ln numlevel="1" lineno="535" slineno="3-25"/>alleged crime occurred, that the judge committed the crime, and that the crime was <ln numlevel="1" lineno="536" slineno="3-26"/>either a felony or a misdemeanor which conduct may be prejudicial to the <ln numlevel="1" lineno="537" slineno="3-27"/>administration of justice or which brings a judicial office into disrepute.</subsection><subsection ssid="3-19" dnum="_-o:d-i" numlevel="1" lineno="538" slineno="3-28" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1229" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="8" groupid="7" style="1" owner="ahaskell" level="1" amendtag="end">If the chief justice of the Supreme Court places a judge on administrative leave under <ln numlevel="1" lineno="539" slineno="3-29"/>Subsection <xref depth="4" refnumber="78A-11-106(1)(c)">(1)(c)</xref> without having received a referral from the commission as <ln numlevel="1" lineno="540" slineno="3-30"/>described in Subsection <xref refnumber="3-null-2">(1)(a)</xref>, the Administrative Office of the Courts shall <ln numlevel="1" lineno="541" slineno="3-31"/>immediately file a complaint against the judge with the commission.</amend></subsection></subsection><subsection ssid="3-null-9" dnum="2-o" numlevel="1" lineno="542" slineno="3-32" level="1" space="false"><display>(2)</display><subsection ssid="3-null-10" dnum="a-o" level="2" placement="sameline"><display>(a)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="105" groupid="86" style="2" owner="ahaskell" level="1" deltag="both">If</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="104" groupid="85" style="1" owner="ahaskell" level="1" amendtag="both" space="true">Except as provided in Subsection <xref depth="4" refnumber="78A-11-106(5)">(5)</xref>, if</amend> the commission, during the course of <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="17" groupid="16" style="2" owner="ahaskell" level="1" deltag="both"><ln numlevel="1" lineno="543" slineno="3-33"/>its</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="11" groupid="10" style="1" owner="ahaskell" level="1" amendtag="both" space="true">the commission's</amend> investigation into an allegation of judicial misconduct, receives <ln numlevel="1" lineno="544" slineno="3-34"/>information upon which a reasonable <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="19" groupid="18" style="2" owner="ahaskell" level="1" deltag="both">person</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="12" groupid="11" style="1" owner="ahaskell" level="1" amendtag="both" space="true">individual</amend> might conclude that a <ln numlevel="1" lineno="545" slineno="3-35"/>misdemeanor or felony under state or federal law has been committed by the chief <ln numlevel="1" lineno="546" slineno="3-36"/>justice of the Supreme Court, the commission shall immediately refer the allegation <ln numlevel="1" lineno="547" slineno="3-37"/>and any information relevant to the potential criminal violation to two justices of the <ln numlevel="1" lineno="548" slineno="3-38"/>Supreme Court and the local prosecuting attorney in accordance with Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="54" groupid="44" style="2" owner="ahaskell" level="1" deltag="both"><ln numlevel="1" lineno="549" slineno="3-39"/>(1)(a)(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="53" groupid="43" style="1" owner="ahaskell" level="1" amendtag="both" space="true"><xref depth="4" refnumber="78A-11-106(1)(b)(i)">(1)(b)(i)</xref></amend>.</subsection><subsection ssid="3-null-11" dnum="b-o" numlevel="1" lineno="550" slineno="3-40" level="2"><display>(b)</display>Two justices of the Supreme Court may place the chief justice of the Supreme Court <ln numlevel="1" lineno="551" slineno="3-41"/>on administrative leave with or without pay if the two justices have a reasonable <ln numlevel="1" lineno="552" slineno="3-42"/>basis to believe that the alleged crime occurred, that the chief justice committed the <ln numlevel="1" lineno="553" slineno="3-43"/>crime, and that the crime was either a felony or a misdemeanor which conduct may <ln numlevel="1" lineno="554" slineno="3-44"/>be prejudicial to the administration of justice or which brings a judicial office into <ln numlevel="1" lineno="555" slineno="3-45"/>disrepute.</subsection><subsection ssid="3-20" dnum="_-o:c-i" numlevel="1" lineno="556" slineno="3-46" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1233" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="25" groupid="22" style="1" owner="ahaskell" level="1" amendtag="end">If two justices of the Supreme Court place the chief justice of the Supreme Court on <ln numlevel="1" lineno="557" slineno="3-47"/>administrative leave under Subsection <xref refnumber="3-null-11">(2)(b)</xref> without having received a referral from <ln numlevel="1" lineno="558" slineno="3-48"/>the commission as described in Subsection <xref refnumber="3-null-10">(2)(a)</xref>, the Administrative Office of the <ln numlevel="1" lineno="559" slineno="3-49"/>Courts shall immediately file a complaint against the chief justice with the <ln numlevel="1" lineno="560" slineno="3-50"/>commission.</amend></subsection></subsection><subsection ssid="3-null-12" dnum="3-o" numlevel="1" lineno="561" slineno="3-51" level="1" space="false"><display>(3)</display><subsection ssid="3-null-13" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If a judge is or has been criminally charged or indicted for a class A misdemeanor <ln numlevel="1" lineno="562" slineno="3-52"/>or any felony under state or federal law and if the Supreme Court has not already <ln numlevel="1" lineno="563" slineno="3-53"/>acted under Subsection <xref depth="4" refnumber="78A-11-106(1)" start="0">(1)</xref> or <xref depth="4" refnumber="78A-11-106(2)" start="0">(2)</xref>, the appropriate member or members of the <ln numlevel="1" lineno="564" slineno="3-54"/>Supreme Court as provided in Subsection <xref depth="4" refnumber="78A-11-106(1)" start="0">(1)</xref> or <xref depth="4" refnumber="78A-11-106(2)" start="0">(2)</xref>, shall place the judge on <ln numlevel="1" lineno="565" slineno="3-55"/>administrative leave with or without pay pending the outcome of the criminal <ln numlevel="1" lineno="566" slineno="3-56"/>proceeding.</subsection><subsection ssid="3-null-14" dnum="b-o" numlevel="1" lineno="567" slineno="3-57" level="2"><display>(b)</display>The state court administrator shall, for the duration of the administrative leave, <ln numlevel="1" lineno="568" slineno="3-58"/>withhold all employer and employee contributions required under Sections <xref depth="3" refnumber="49-17-301" start="0">49-17-301</xref> <ln numlevel="1" lineno="569" slineno="3-59"/>and <xref depth="3" refnumber="49-18-301" start="0">49-18-301</xref>.</subsection><subsection ssid="3-null-15" dnum="c-o" numlevel="1" lineno="570" slineno="3-60" level="2"><display>(c)</display>If the judge is not convicted of the criminal charge, and if after an investigation and <ln numlevel="1" lineno="571" slineno="3-61"/>final disposition of the case by the Judicial Conduct Commission, the judge is <ln numlevel="1" lineno="572" slineno="3-62"/>reinstated by the Supreme Court as provided in Subsection <xref depth="4" refnumber="78A-11-106(4)" start="0">(4)</xref>, then the judge shall <ln numlevel="1" lineno="573" slineno="3-63"/>be paid the salary or compensation for the period of administrative leave, and all <ln numlevel="1" lineno="574" slineno="3-64"/>contributions withheld under Subsection <xref depth="4" refnumber="78A-11-106(3)(b)" start="0">(3)(b)</xref> shall be deposited in accordance with <ln numlevel="1" lineno="575" slineno="3-65"/>Sections <xref depth="3" refnumber="49-17-301" start="0">49-17-301</xref> and <xref depth="3" refnumber="49-18-301" start="0">49-18-301</xref>.</subsection></subsection><subsection ssid="3-null-16" dnum="4-o" numlevel="1" lineno="576" slineno="3-66" level="1"><display>(4)</display>The chief justice of the Supreme Court or two justices of the Supreme Court who <ln numlevel="1" lineno="577" slineno="3-67"/>ordered the judge on administrative leave shall order the reinstatement of the judge:<subsection ssid="3-null-17" dnum="a-o" numlevel="1" lineno="578" slineno="3-68" level="2"><display>(a)</display>if the prosecutor to whom the allegations are referred by the commission determines <ln numlevel="1" lineno="579" slineno="3-69"/>no charge or indictment should be filed; or</subsection><subsection ssid="3-null-18" dnum="b-o" numlevel="1" lineno="580" slineno="3-70" level="2"><display>(b)</display>after final disposition of the criminal case, if the judge is not convicted of a criminal <ln numlevel="1" lineno="581" slineno="3-71"/>charge and if the commission has not ordered the removal of the judge.</subsection></subsection><subsection ssid="3-28" dnum="_-o:5-i" numlevel="1" lineno="582" slineno="3-72" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1241" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="83" groupid="69" style="1" owner="ahaskell" level="1" amendtag="end">The commission is not required to refer an allegation of criminal misconduct to:</amend><subsection ssid="3-29" dnum="_-o:a-i" numlevel="1" lineno="583" slineno="3-73" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1242" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="87" groupid="72" style="1" owner="ahaskell" level="1" amendtag="end">the chief justice of the Supreme Court as described in Subsection <xref depth="4" refnumber="78A-11-106(1)(a)">(1)(a)</xref> if the <ln numlevel="1" lineno="584" slineno="3-74"/>Administrative Office of the Courts filed the complaint giving rise to the allegation as <ln numlevel="1" lineno="585" slineno="3-75"/>described in Subsection <xref depth="4" refnumber="78A-11-106(1)(d)">(1)(d)</xref>;</amend></subsection><subsection ssid="3-31" dnum="_-o:b-i" numlevel="1" lineno="586" slineno="3-76" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1243" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="101" groupid="83" style="1" owner="ahaskell" level="1" amendtag="end">two justices of the Supreme Court as described in Subsection <xref depth="4" refnumber="78A-11-106(2)(a)">(2)(a)</xref> if the <ln numlevel="1" lineno="587" slineno="3-77"/>Administrative Office of the Courts filed the complaint giving rise to the allegation as <ln numlevel="1" lineno="588" slineno="3-78"/>described in Subsection <xref depth="4" refnumber="78A-11-106(2)(c)">(2)(c)</xref>; or</amend></subsection><subsection ssid="3-30" dnum="_-o:c-i" numlevel="1" lineno="589" slineno="3-79" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1244" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="90" groupid="74" style="1" owner="ahaskell" level="1" amendtag="end">a prosecuting attorney as described in Subsection <xref depth="4" refnumber="78A-11-106(1)(b)">(1)(b)</xref> or <xref depth="4" refnumber="78A-11-106(2)(a)">(2)(a)</xref> if a prosecuting <ln numlevel="1" lineno="590" slineno="3-80"/>attorney filed the complaint giving rise to the allegation as described in Section <xref depth="3" refnumber="77-2-10"><ln numlevel="1" lineno="591" slineno="3-81"/>77-2-10</xref>.</amend></subsection></subsection></section></bsec><bsec buid="7" num="78A-11-114" type="enact" src="code" uid="C78A-11-S114_2026050620260506" sort="78A11 01140020260506" numlevel="1" lineno="592" slineno="4-1" sn="4"><section numlevel="1" lineno="593" slineno="4-2" number="78A-11-114" type="enact"><secline lineno="592">Section 4. Section <bold>78A-11-114</bold> is enacted to read:</secline><catline lineno="593"><bold>78A-11-114<parens/>. Annual reporting requirement to Legislature.</bold></catline><subsection ssid="7-2" dnum="_-o:1-i" numlevel="1" lineno="594" slineno="4-3" ea="amend" anum="0" owner="ahaskell" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1245" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="5" style="1" owner="ahaskell" level="1" amendtag="end">Before November 1 of each year, the commission shall report to the Judiciary Interim <ln numlevel="1" lineno="595" slineno="4-4"/>Committee on the following matters from the previous fiscal year:</amend><subsection ssid="7-1" dnum="_-o:a-i" numlevel="1" lineno="596" slineno="4-5" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1246" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="ahaskell" level="1" amendtag="end">the number of complaints received;</amend></subsection><subsection ssid="7-3" dnum="_-o:b-i" numlevel="1" lineno="597" slineno="4-6" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1247" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="15" groupid="10" style="1" owner="ahaskell" level="1" amendtag="end">the number of complaints resolved;</amend></subsection><subsection ssid="7-4" dnum="_-o:c-i" numlevel="1" lineno="598" slineno="4-7" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1248" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="20" groupid="14" style="1" owner="ahaskell" level="1" amendtag="end">a brief description of each of the commission's informal resolutions;</amend></subsection><subsection ssid="7-5" dnum="_-o:d-i" numlevel="1" lineno="599" slineno="4-8" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1249" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="25" groupid="18" style="1" owner="ahaskell" level="1" amendtag="end">a brief description of each final order issued by the Supreme Court under Subsection <xref tempid="494"><ln numlevel="1" lineno="600" slineno="4-9"/>78A-11-105(1)</xref>; and</amend></subsection><subsection ssid="7-6" dnum="_-o:e-i" numlevel="1" lineno="601" slineno="4-10" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1250" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="30" groupid="22" style="1" owner="ahaskell" level="1" amendtag="end">the publication of an annual report of commission activities.</amend></subsection></subsection><subsection ssid="7-7" dnum="_-o:2-i" numlevel="1" lineno="602" slineno="4-11" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1251" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="36" groupid="27" style="1" owner="ahaskell" level="1" amendtag="end">The commission may not include any personal identifying information regarding a <ln numlevel="1" lineno="603" slineno="4-12"/>judge in a report described in Subsection <xref depth="4" refnumber="78A-11-114(1)">(1)</xref>, except for information that is available in a <ln numlevel="1" lineno="604" slineno="4-13"/>final order issued by the Supreme Court under Subsection <xref depth="4" refnumber="78A-11-105(1)">78A-11-105(1)</xref>.</amend></subsection></section></bsec><bsec buid="20" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="605" slineno="5-1" sn="5"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="605">Section 5.  <bold>Effective Date.</bold></secline><sectionText lineno="606"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="ahaskell" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>1-7-26 4:01 PM</tm></rev></foot></leg>
