Section <bold>72-10-401</bold> is amended to read:</secline><catline lineno="22"><bold>72-10-401<parens/>. Definitions.</bold></catline><sectionText lineno="23"><tab/>As used in this part:</sectionText><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="24" slineno="1-4" level="1" space="false"><display>(1)</display><subsection ssid="1-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Airport" means any publicly used area of land or water that is used, or intended <ln numlevel="1" lineno="25" slineno="1-5"/>to be used, for the landing and take-off of aircraft and utilized or to be utilized in the <ln numlevel="1" lineno="26" slineno="1-6"/>interest of the public for these purposes.</subsection><subsection ssid="1-null-3" dnum="b-o" numlevel="1" lineno="27" slineno="1-7" level="2"><display>(b)</display>"Airport" includes a vertiport if the vertiport is open for public use.</subsection><subsection ssid="1-21" dnum="_-o:c-i" numlevel="1" lineno="28" slineno="1-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1003" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">"Airport" includes a flight park.</amend></subsection></subsection><subsection ssid="1-null-4" dnum="2-o" numlevel="1" lineno="29" slineno="1-9" level="1"><display>(2)</display>"Airport hazard" means any structure, tree, object of natural growth, or use of land that <ln numlevel="1" lineno="30" slineno="1-10"/>potentially obstructs or otherwise impacts the safe and efficient utilization of the <ln numlevel="1" lineno="31" slineno="1-11"/>navigable airspace required for the flight of aircraft in landing or take-off at an airport.</subsection><subsection ssid="1-null-5" dnum="3-o" numlevel="1" lineno="32" slineno="1-12" level="1"><display>(3)</display>"Airport influence area" means land located:<subsection ssid="1-null-6" dnum="a-o" numlevel="1" lineno="33" slineno="1-13" level="2"><display>(a)</display>within 5,000 feet of an airport runway;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="41" groupid="35" style="2" owner="jchristopherson" level="1" deltag="both"> or</amend><amendoutend style="2"/></subsection><subsection ssid="1-null-7" dnum="b-o" numlevel="1" lineno="34" slineno="1-14" level="2"><display>(b)</display>within 500 feet of a vertiport that is open for public use<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="16" groupid="14" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="13" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; or</amend></subsection><subsection ssid="1-22" dnum="_-o:c-i" numlevel="1" lineno="35" slineno="1-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="end">within 1,000 feet of the boundary of a flight park.</amend></subsection></subsection><subsection ssid="1-null-8" dnum="4-o" numlevel="1" lineno="36" slineno="1-16" level="1"><display>(4)</display>"Airport overlay zone" means a secondary zoning district designed to protect the public <ln numlevel="1" lineno="37" slineno="1-17"/>health, safety, and welfare near an airport that:<subsection ssid="1-null-9" dnum="a-o" numlevel="1" lineno="38" slineno="1-18" level="2"><display>(a)</display>applies land use regulation in addition to the primary zoning district land use <ln numlevel="1" lineno="39" slineno="1-19"/>regulation of property used as an airport and property within an airport influence area;</subsection><subsection ssid="1-null-10" dnum="b-o" numlevel="1" lineno="40" slineno="1-20" level="2"><display>(b)</display>may extend beyond the airport influence area;</subsection><subsection ssid="1-null-11" dnum="c-o" numlevel="1" lineno="41" slineno="1-21" level="2"><display>(c)</display>ensures airport utility as a public asset;</subsection><subsection ssid="1-null-12" dnum="d-o" numlevel="1" lineno="42" slineno="1-22" level="2"><display>(d)</display>protects property owner land values near an airport through compatible land use <ln numlevel="1" lineno="43" slineno="1-23"/>regulations as recommended by the Federal Aviation Administration; and</subsection><subsection ssid="1-null-13" dnum="e-o" numlevel="1" lineno="44" slineno="1-24" level="2"><display>(e)</display>protects aircraft occupant safety through protection of navigable airspace.</subsection></subsection><subsection ssid="1-null-14" dnum="5-o" numlevel="1" lineno="45" slineno="1-25" level="1"><display>(5)</display>"Avigation easement" means an easement permitting unimpeded aircraft flights over <ln numlevel="1" lineno="46" slineno="1-26"/>property subject to the easement and includes the right:<subsection ssid="1-null-15" dnum="a-o" numlevel="1" lineno="47" slineno="1-27" level="2"><display>(a)</display>to create or increase noise or other effects that may result from the lawful operation <ln numlevel="1" lineno="48" slineno="1-28"/>of aircraft; and</subsection><subsection ssid="1-null-16" dnum="b-o" numlevel="1" lineno="49" slineno="1-29" level="2"><display>(b)</display>to prohibit or remove any obstruction to such overflight.</subsection></subsection><subsection ssid="1-23" dnum="_-o:6-i" numlevel="1" lineno="50" slineno="1-30" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="end">"Flight park" means an area:</amend><subsection ssid="1-24" dnum="_-o:a-i" numlevel="1" lineno="51" slineno="1-31" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1019" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="36" groupid="30" style="1" owner="jchristopherson" level="1" amendtag="end">used primarily for the landing and take-off of a hang glider, para glider, or similar <ln numlevel="1" lineno="52" slineno="1-32"/>nonmotorized aircraft;</amend></subsection><subsection ssid="1-25" dnum="_-o:b-i" numlevel="1" lineno="53" slineno="1-33" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1020" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="29" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="end">recognized by the Federal Aviation Administration as an airport; and</amend></subsection><subsection ssid="1-26" dnum="_-o:c-i" numlevel="1" lineno="54" slineno="1-34" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1021" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="40" groupid="34" style="1" owner="jchristopherson" level="1" amendtag="end">owned by the state or a political subdivision of the state.</amend></subsection></subsection><subsection ssid="1-null-17" dnum="6-o:7-i" numlevel="1" lineno="55" slineno="1-35" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1022" style="2" owner="o" level="1" deltag="both">(6)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1023" style="1" owner="i" level="1" amendtag="both" space="true">(7)</amend></display>"Land use regulation" means the same as that term is defined in Sections <xref depth="3" refnumber="10-20-102">10-20-102</xref> <ln numlevel="1" lineno="56" slineno="1-36"/>and <xref depth="3" refnumber="17-79-102">17-79-102</xref>.</subsection><subsection ssid="1-null-18" dnum="7-o:8-i" numlevel="1" lineno="57" slineno="1-37" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1023" style="2" owner="o" level="1" deltag="both">(7)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1024" style="1" owner="i" level="1" amendtag="both" space="true">(8)</amend></display>"Political subdivision" means any municipality, city, town, or county.</subsection><subsection ssid="1-null-19" dnum="8-o:9-i" numlevel="1" lineno="58" slineno="1-38" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1024" style="2" owner="o" level="1" deltag="both">(8)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1025" style="1" owner="i" level="1" amendtag="both" space="true">(9)</amend></display>"Structure" means any object constructed or installed by man, including buildings, <ln numlevel="1" lineno="59" slineno="1-39"/>towers, smokestacks, and overhead transmission lines.</subsection><subsection ssid="1-null-20" dnum="9-o:10-i" numlevel="1" lineno="60" slineno="1-40" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1025" style="2" owner="o" level="1" deltag="both">(9)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1026" style="1" owner="i" level="1" amendtag="both" space="true">(10)</amend></display>"Tree" means any object of natural growth.</subsection></section></bsec><bsec buid="5" num="72-10-403" type="amend" src="code" uid="C72-10-S403_2026050620260506" sort="72 10 04030020260506" numlevel="1" lineno="61" slineno="2-1" sn="2"><section number="72-10-403" numlevel="1" lineno="62" slineno="2-2" type="amend"><secline lineno="61">Section 2. Section <bold>72-10-403</bold> is amended to read:</secline><catline lineno="62"><bold>72-10-403<parens/>. Airport zoning regulations.</bold></catline><subsection ssid="5-null-1" dnum="1-o" numlevel="1" lineno="63" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>Flight of aircraft over the lands and waters of the state is lawful, unless:<subsection ssid="5-null-2" dnum="a-o" numlevel="1" lineno="64" slineno="2-4" level="2"><display>(a)</display>at such a low altitude as to interfere with the existing use to which the owner has put <ln numlevel="1" lineno="65" slineno="2-5"/>the land, water, or the airspace over the land or water; or</subsection><subsection ssid="5-null-3" dnum="b-o" numlevel="1" lineno="66" slineno="2-6" level="2"><display>(b)</display>so conducted as to be imminently dangerous to persons or property lawfully on the <ln numlevel="1" lineno="67" slineno="2-7"/>land or water beneath.</subsection></subsection><subsection ssid="5-null-4" dnum="2-o" numlevel="1" lineno="68" slineno="2-8" level="1"><display>(2)</display>In order to prevent the creation or establishment of airport hazards, each political <ln numlevel="1" lineno="69" slineno="2-9"/>subdivision located within an airport influence area, shall adopt, administer, and enforce <ln numlevel="1" lineno="70" slineno="2-10"/>land use regulations for the airport influence area, including an airport overlay zone, <ln numlevel="1" lineno="71" slineno="2-11"/>under the police power and in the manner and upon the conditions prescribed:<subsection ssid="5-null-5" dnum="a-o" numlevel="1" lineno="72" slineno="2-12" level="2"><display>(a)</display>in this part;</subsection><subsection ssid="5-null-6" dnum="b-o" numlevel="1" lineno="73" slineno="2-13" level="2"><display>(b)</display>Title 10, Chapter 20, Municipal Land Use, Development, and Management Act; and</subsection><subsection ssid="5-null-7" dnum="c-o" numlevel="1" lineno="74" slineno="2-14" level="2"><display>(c)</display>Title 17, Chapter 79, County Land Use, Development, and Management Act.</subsection></subsection><subsection ssid="5-null-8" dnum="3-o" numlevel="1" lineno="75" slineno="2-15" level="1" space="false"><display>(3)</display><subsection ssid="5-null-9" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Each political subdivision located within an airport influence area shall notify a <ln numlevel="1" lineno="76" slineno="2-16"/>person building on or developing land in an airport influence area, in writing, of <ln numlevel="1" lineno="77" slineno="2-17"/>aircraft overflights and associated noise.</subsection><subsection ssid="5-null-10" dnum="b-o" numlevel="1" lineno="78" slineno="2-18" level="2"><display>(b)</display>To promote the safe and efficient operation of the airport, a political subdivision <ln numlevel="1" lineno="79" slineno="2-19"/>located within an airport influence area:<subsection ssid="5-null-11" dnum="i-o" numlevel="1" lineno="80" slineno="2-20" level="3"><display>(i)</display>shall:<subsection ssid="5-null-12" dnum="A-o" numlevel="1" lineno="81" slineno="2-21" level="4"><display>(A)</display>adopt an airport overlay zone conforming to the requirements of this chapter <ln numlevel="1" lineno="82" slineno="2-22"/>and 14 C.F.R. Part 77; and</subsection><subsection ssid="5-null-13" dnum="B-o" numlevel="1" lineno="83" slineno="2-23" level="4"><display>(B)</display>require any proposed development within an airport influence area to conform <ln numlevel="1" lineno="84" slineno="2-24"/>with 14 C.F.R. Part 77; and</subsection></subsection><subsection ssid="5-null-14" dnum="ii-o" numlevel="1" lineno="85" slineno="2-25" level="3"><display>(ii)</display>may, as a condition to granting a building permit, subdivision plat, or a requested <ln numlevel="1" lineno="86" slineno="2-26"/>zoning change within an airport influence area, require a person building or <ln numlevel="1" lineno="87" slineno="2-27"/>developing land to grant or sell to the airport owner, at appraised fair market <ln numlevel="1" lineno="88" slineno="2-28"/>value, an avigation easement.</subsection></subsection></subsection><subsection ssid="5-null-15" dnum="4-o" numlevel="1" lineno="89" slineno="2-29" level="1"><display>(4)</display>If a political subdivision located within an airport influence area<amend anum="0" ea="amend" pairid="17" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="both"> related to an airport <ln numlevel="1" lineno="90" slineno="2-30"/>other than a flight park</amend> fails to adopt an airport overlay zone by December 31, 2024, <ln numlevel="1" lineno="91" slineno="2-31"/>then the following requirements shall apply in an airport influence area:<subsection ssid="5-null-16" dnum="a-o" numlevel="1" lineno="92" slineno="2-32" level="2"><display>(a)</display>each political subdivision located within an airport influence area shall notify a <ln numlevel="1" lineno="93" slineno="2-33"/>person building on or developing land within an airport influence area, in writing, of <ln numlevel="1" lineno="94" slineno="2-34"/>aircraft overflights and associated noise;</subsection><subsection ssid="5-null-17" dnum="b-o" numlevel="1" lineno="95" slineno="2-35" level="2"><display>(b)</display>as a condition to granting a building permit, subdivision plat, or a requested zoning <ln numlevel="1" lineno="96" slineno="2-36"/>change within an airport influence area, require the person building or developing <ln numlevel="1" lineno="97" slineno="2-37"/>land to grant or sell to the airport owner, at appraised fair market value, an avigation <ln numlevel="1" lineno="98" slineno="2-38"/>easement; and</subsection><subsection ssid="5-null-18" dnum="c-o" numlevel="1" lineno="99" slineno="2-39" level="2"><display>(c)</display>require a person building or developing land within an airport influence area conform <ln numlevel="1" lineno="100" slineno="2-40"/>to the requirements of this chapter and 14 C.F.R. Part 77.</subsection></subsection><subsection ssid="5-19" dnum="_-o:5-i" numlevel="1" lineno="101" slineno="2-41" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1044" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="end">If a political subdivision located within an airport influence area related to a flight park <ln numlevel="1" lineno="102" slineno="2-42"/>fails to adopt an airport overlay zone by December 31, 2026, then the following <ln numlevel="1" lineno="103" slineno="2-43"/>requirements shall apply in an airport influence area:</amend><subsection ssid="5-20" dnum="_-o:a-i" numlevel="1" lineno="104" slineno="2-44" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1045" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="8" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="end">each political subdivision located within an airport influence area shall notify a <ln numlevel="1" lineno="105" slineno="2-45"/>person building on or developing land within an airport influence area, in writing, of <ln numlevel="1" lineno="106" slineno="2-46"/>aircraft overflights and associated noise;</amend></subsection><subsection ssid="5-21" dnum="_-o:b-i" numlevel="1" lineno="107" slineno="2-47" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1046" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="end">as a condition to granting a building permit, subdivision plat, or a requested zoning <ln numlevel="1" lineno="108" slineno="2-48"/>change within an airport influence area, require the person building or developing <ln numlevel="1" lineno="109" slineno="2-49"/>land to grant or sell to the airport owner, at appraised fair market value, an avigation <ln numlevel="1" lineno="110" slineno="2-50"/>easement; and</amend></subsection><subsection ssid="5-22" dnum="_-o:c-i" numlevel="1" lineno="111" slineno="2-51" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1047" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="14" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="end">require a person building or developing land within an airport influence area to <ln numlevel="1" lineno="112" slineno="2-52"/>conform to the requirements of this chapter and 14 C.F.R.
