Peck</sponsorhead><otherSponsorhead>Senate Sponsor: </otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill amends and enacts provisions regarding the accessibility of sensitive material <ln numlevel="1" lineno="6" slineno="0-6"/>through digital instructional material in a school setting.</gd><hphead lineno="7">Highlighted Provisions:</hphead><hp numlevel="1" lineno="8" slineno="0-8">This bill:<hl numlevel="1" lineno="9" slineno="0-9" level="1">defines terms;</hl><hl numlevel="1" lineno="10" slineno="0-10" level="1">includes information regarding sensitive material in the information the state board <ln numlevel="1" lineno="11" slineno="0-11"/>provides through a certain parent portal;</hl><hl numlevel="1" lineno="12" slineno="0-12" level="1">requires each local education agency (LEA) to:<hl numlevel="1" lineno="13" slineno="0-13" level="2">provide certain information to parents at the time of student registration each year;</hl><hl numlevel="1" lineno="14" slineno="0-14" level="2">provide certain information to school staff;</hl><hl numlevel="1" lineno="15" slineno="0-15" level="2">utilize certain tools to identify sensitive material;</hl><hl numlevel="1" lineno="16" slineno="0-16" level="2">prioritize certain books in a school library; and</hl><hl numlevel="1" lineno="17" slineno="0-17" level="2">maintain a section on the homepage of the LEA's website regarding sensitive material <ln numlevel="1" lineno="18" slineno="0-18"/>reporting;</hl></hl><hl numlevel="1" lineno="19" slineno="0-19" level="1">requires the state board, an LEA, or the Utah Education and Telehealth Network (UETN) <ln numlevel="1" lineno="20" slineno="0-20"/>to rescind certain contracts if a vendor does not remove access to digital sensitive <ln numlevel="1" lineno="21" slineno="0-21"/>material after a number of instances;</hl><hl numlevel="1" lineno="22" slineno="0-22" level="1">requires the state board, an LEA, or UETN to:<hl numlevel="1" lineno="23" slineno="0-23" level="2">remove access to digital instructional material that a vendor provides after a certain <ln numlevel="1" lineno="24" slineno="0-24"/>threshold of violations;</hl><hl numlevel="1" lineno="25" slineno="0-25" level="2">provide certain notice to each vendor with which the entity contracts to provide digital <ln numlevel="1" lineno="26" slineno="0-26"/>instructional material in a school setting; and</hl><hl numlevel="1" lineno="27" slineno="0-27" level="2">ensure that any database or school-provided device which a student may access uses a <ln numlevel="1" lineno="28" slineno="0-28"/>filter or other software to prohibit access to sensitive material;</hl></hl><hl numlevel="1" lineno="29" slineno="0-29" level="1">creates a private right of action; and</hl><hl numlevel="1" lineno="30" slineno="0-30" level="1">makes technical and conforming changes.</hl></hp><moni numlevel="1" lineno="31" slineno="0-31" display="none">Money Appropriated in this Bill:</moni><moniNone lineno="32">None</moniNone><oc numlevel="1" lineno="33" slineno="0-33">Other Special Clauses:<ocl type="effdate" sort="2" numlevel="1" lineno="34" slineno="0-34">This bill provides a special effective date.</ocl></oc><sa numlevel="1" lineno="35" slineno="0-35">Utah Code Sections Affected:<saamd numlevel="1" lineno="36" slineno="0-36"><snhead>AMENDS:</snhead><sn num="53G-6-806" src="code" uid="C53G-6-S806_2026070120260701" buid="2" sort="53G06 08060020260701" numlevel="1" lineno="37" slineno="0-37"><bold>53G-6-806</bold>, as last amended by Laws of Utah 2024, Chapter 21</sn><sn num="53G-10-103" src="code" uid="C53G-10-S103_2026070120260701" buid="1" sort="53G10 01030020260701" numlevel="1" lineno="38" slineno="0-38"><bold>53G-10-103</bold>, as last amended by Laws of Utah 2025, Chapter 173</sn></saamd><saent numlevel="1" lineno="39" slineno="0-39"><snhead>ENACTS:</snhead><sn num="53G-10-308" src="code" uid="C53G-10-S308_2026070120260701" buid="7" sort="53G10 03080020260701" numlevel="1" lineno="40" slineno="0-40"><bold>53G-10-308</bold>, Utah Code Annotated 1953</sn></saent></sa></lt><enacthead lineno="41"/><enact numlevel="1" lineno="42" slineno="0-42">Be it enacted by the Legislature of the state of Utah:</enact><bdy><bsec buid="2" num="53G-6-806" type="amend" src="code" uid="C53G-6-S806_2026070120260701" sort="53G06 08060020260701" numlevel="1" lineno="43" slineno="1-1" sn="1"><section number="53G-6-806" numlevel="1" lineno="44" slineno="1-2" type="amend"><secline lineno="43">Section 1. Section <bold>53G-6-806</bold> is amended to read:</secline><catline lineno="44"><bold>53G-6-806<parens/>. Parent portal. </bold></catline><subsection ssid="2-null-1" dnum="1-o" numlevel="1" lineno="45" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="2-null-2" dnum="a-o" numlevel="1" lineno="46" slineno="1-4" level="2"><display>(a)</display>"Parent portal" means the posting the state board is required to provide under this <ln numlevel="1" lineno="47" slineno="1-5"/>section.</subsection><subsection ssid="2-null-3" dnum="b-o" numlevel="1" lineno="48" slineno="1-6" level="2"><display>(b)</display>"School" means a public elementary or secondary school, including a charter school.</subsection></subsection><subsection ssid="2-null-4" dnum="2-o" numlevel="1" lineno="49" slineno="1-7" level="1" space="false"><display>(2)</display><subsection ssid="2-null-5" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The state board shall post information that allows a parent of a student enrolled in <ln numlevel="1" lineno="50" slineno="1-8"/>a school to:<subsection ssid="2-null-6" dnum="i-o" numlevel="1" lineno="51" slineno="1-9" level="3" tab="1"><display>(i)</display>access an LEA's policies required by Sections <xref depth="3" refnumber="53G-9-203">53G-9-203</xref> and <xref depth="3" refnumber="53G-9-605">53G-9-605</xref>;</subsection><subsection ssid="2-null-7" dnum="ii-o" numlevel="1" lineno="52" slineno="1-10" level="3" tab="1"><display>(ii)</display>be informed of resources and steps to follow when a student has been the subject, <ln numlevel="1" lineno="53" slineno="1-11"/>perpetrator, or bystander of bullying, cyber-bullying, hazing, retaliation, or <ln numlevel="1" lineno="54" slineno="1-12"/>abusive conduct such as:<subsection ssid="2-null-8" dnum="A-o" numlevel="1" lineno="55" slineno="1-13" level="4"><display>(A)</display>resources for the student, including short-term mental health services;</subsection><subsection ssid="2-null-9" dnum="B-o" numlevel="1" lineno="56" slineno="1-14" level="4"><display>(B)</display>options for the student to make changes to the student's educational <ln numlevel="1" lineno="57" slineno="1-15"/>environment;</subsection><subsection ssid="2-null-10" dnum="C-o" numlevel="1" lineno="58" slineno="1-16" level="4"><display>(C)</display>options for alternative school enrollment;</subsection><subsection ssid="2-null-11" dnum="D-o" numlevel="1" lineno="59" slineno="1-17" level="4"><display>(D)</display>options for differentiated start or stop times;</subsection><subsection ssid="2-null-12" dnum="E-o" numlevel="1" lineno="60" slineno="1-18" level="4"><display>(E)</display>options for differentiated exit and entrance locations; and</subsection><subsection ssid="2-null-13" dnum="F-o" numlevel="1" lineno="61" slineno="1-19" level="4"><display>(F)</display>the designated employee for an LEA who addresses incidents of bullying, <ln numlevel="1" lineno="62" slineno="1-20"/>cyber-bullying, hazing, retaliation, and abusive conduct;</subsection></subsection><subsection ssid="2-null-14" dnum="iii-o" numlevel="1" lineno="63" slineno="1-21" level="3" tab="1"><display>(iii)</display>be informed of the steps and resources for filing a grievance with a school or <ln numlevel="1" lineno="64" slineno="1-22"/>LEA regarding bullying, cyber-bullying, hazing, or retaliation;</subsection><subsection ssid="2-null-15" dnum="iv-o" numlevel="1" lineno="65" slineno="1-23" level="3" tab="1"><display>(iv)</display>be informed of the steps and resources for seeking accommodations under the <ln numlevel="1" lineno="66" slineno="1-24"/>Americans with Disabilities Act of 1990, 42 U.S.C. <amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both">Sec. </amend>12101 et seq<amend anum="0" ea="amend" pairid="8" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="both">.</amend>;</subsection><subsection ssid="2-null-16" dnum="v-o" numlevel="1" lineno="67" slineno="1-25" level="3" tab="1"><display>(v)</display>be informed of the steps and resources for seeking accommodations under state or <ln numlevel="1" lineno="68" slineno="1-26"/>federal law regarding religious accommodations;</subsection><subsection ssid="2-38" dnum="_-o:vi-i" numlevel="1" lineno="69" slineno="1-27" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="start">(vi)</amend></display><amend anum="0" ea="amend" pairid="5" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="end">receive information regarding the reporting of sensitive material, as described in <ln numlevel="1" lineno="70" slineno="1-28"/>Section <xref depth="3" refnumber="53G-10-103">53G-10-103</xref>;</amend></subsection><subsection ssid="2-null-17" dnum="vi-o:vii-i" numlevel="1" lineno="71" slineno="1-29" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1017" style="2" owner="o" level="1" deltag="both">(vi)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="both" space="true">(vii)</amend></display>be informed of the steps and resources for filing a grievance for an alleged <ln numlevel="1" lineno="72" slineno="1-30"/>violation of state or federal law, including:<subsection ssid="2-null-18" dnum="A-o" numlevel="1" lineno="73" slineno="1-31" level="4"><display>(A)</display>Title VI of the Civil Rights Act of 1964, 42 U.S.C. Sec. 2000d-2000d-4;</subsection><subsection ssid="2-null-19" dnum="B-o" numlevel="1" lineno="74" slineno="1-32" level="4"><display>(B)</display>Title IX of the Education Amendments of 1972, 20 U.S.C. Sec. 1681-1688;</subsection><subsection ssid="2-null-20" dnum="C-o" numlevel="1" lineno="75" slineno="1-33" level="4"><display>(C)</display>Section 504 of the Rehabilitation Act of 1973, 29 U.S.C. Sec. 794; and</subsection><subsection ssid="2-null-21" dnum="D-o" numlevel="1" lineno="76" slineno="1-34" level="4"><display>(D)</display>Title II of the Americans with Disabilities Act of 1990, 42 U.S.C. Sec. <ln numlevel="1" lineno="77" slineno="1-35"/>12131-12165;</subsection></subsection><subsection ssid="2-null-22" dnum="vii-o:viii-i" numlevel="1" lineno="78" slineno="1-36" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1022" style="2" owner="o" level="1" deltag="both">(vii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1023" style="1" owner="i" level="1" amendtag="both" space="true">(viii)</amend></display>receive information about constitutional rights and freedoms afforded to <ln numlevel="1" lineno="79" slineno="1-37"/>families in public education;</subsection><subsection ssid="2-null-23" dnum="viii-o:ix-i" numlevel="1" lineno="80" slineno="1-38" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1023" style="2" owner="o" level="1" deltag="both">(viii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1024" style="1" owner="i" level="1" amendtag="both" space="true">(ix)</amend></display>be informed of how to access an internal audit hotline if established by the <ln numlevel="1" lineno="81" slineno="1-39"/>state board; and</subsection><subsection ssid="2-null-24" dnum="ix-o:x-i" numlevel="1" lineno="82" slineno="1-40" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1024" style="2" owner="o" level="1" deltag="both">(ix)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1025" style="1" owner="i" level="1" amendtag="both" space="true">(x)</amend></display>be informed of services for military families.</subsection></subsection><subsection ssid="2-null-25" dnum="b-o" numlevel="1" lineno="83" slineno="1-41" level="2"><display>(b)</display>In addition to the information required under Subsection <xref depth="4" refnumber="53G-6-806(2)(a)">(2)(a)</xref>, the state board:<subsection ssid="2-null-26" dnum="i-o" numlevel="1" lineno="84" slineno="1-42" level="3"><display>(i)</display>shall include in the parent portal:<subsection ssid="2-null-27" dnum="A-o" numlevel="1" lineno="85" slineno="1-43" level="4"><display>(A)</display>the comparison tool created under Section <xref depth="3" refnumber="53G-6-805">53G-6-805</xref>; </subsection><subsection ssid="2-null-28" dnum="B-o" numlevel="1" lineno="86" slineno="1-44" level="4"><display>(B)</display>school level safety data, including data points described in Section <xref depth="3" refnumber="53E-3-516">53E-3-516</xref>; <ln numlevel="1" lineno="87" slineno="1-45"/>and</subsection><subsection ssid="2-null-29" dnum="C-o" numlevel="1" lineno="88" slineno="1-46" level="4"><display>(C)</display>a link to the public safety portal described in Section <xref depth="3" refnumber="63A-16-1002">63A-16-1002</xref>; and</subsection></subsection><subsection ssid="2-null-30" dnum="ii-o" numlevel="1" lineno="89" slineno="1-47" level="3"><display>(ii)</display>may include in the parent portal other information that the state board determines <ln numlevel="1" lineno="90" slineno="1-48"/>is helpful to parents.</subsection></subsection></subsection><subsection ssid="2-null-31" dnum="3-o" numlevel="1" lineno="91" slineno="1-49" level="1" space="false"><display>(3)</display><subsection ssid="2-null-32" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The state board shall post the parent portal at a location that is easily located by a <ln numlevel="1" lineno="92" slineno="1-50"/>parent.</subsection><subsection ssid="2-null-33" dnum="b-o" numlevel="1" lineno="93" slineno="1-51" level="2"><display>(b)</display>The state board shall update the parent portal at least annually.</subsection><subsection ssid="2-null-34" dnum="c-o" numlevel="1" lineno="94" slineno="1-52" level="2"><display>(c)</display>In accordance with state and federal law, the state board may collaborate with a <ln numlevel="1" lineno="95" slineno="1-53"/>third-party to provide safety data visualization in comparison to other states' data.</subsection></subsection><subsection ssid="2-null-35" dnum="4-o" numlevel="1" lineno="96" slineno="1-54" level="1"><display>(4)</display>An LEA shall annually notify each of the following of how to access the parent portal:<subsection ssid="2-null-36" dnum="a-o" numlevel="1" lineno="97" slineno="1-55" level="2"><display>(a)</display>a parent of a student; and</subsection><subsection ssid="2-null-37" dnum="b-o" numlevel="1" lineno="98" slineno="1-56" level="2"><display>(b)</display>a teacher, principal, or other professional staff within the LEA.</subsection></subsection></section></bsec><bsec buid="1" num="53G-10-103" type="amend" src="code" uid="C53G-10-S103_2026070120260701" sort="53G10 01030020260701" numlevel="1" lineno="99" slineno="2-1" sn="2"><section number="53G-10-103" numlevel="1" lineno="100" slineno="2-2" type="amend"><secline lineno="99">Section 2. Section <bold>53G-10-103</bold> is amended to read:</secline><catline lineno="100"><bold>53G-10-103<parens/>. Sensitive instructional materials.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="101" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="1-152" dnum="_-o:a-i" numlevel="1" lineno="102" slineno="2-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1039" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="164" groupid="119" style="1" owner="jchristopherson" level="1" amendtag="end">"Contracting entity" means  the entity, including the LEA governing board, the state <ln numlevel="1" lineno="103" slineno="2-5"/>board, or UETN, that contracts with a vendor for a given digital instructional <ln numlevel="1" lineno="104" slineno="2-6"/>material, including a digital database.</amend></subsection><subsection ssid="1-null-2" dnum="a-o:b-i" numlevel="1" lineno="105" slineno="2-7" level="2" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1040" style="2" owner="o" level="1" deltag="both">(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1041" style="1" owner="i" level="1" amendtag="both" space="true">(b)</amend></display><subsection ssid="1-null-3" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"Instructional material" means a material, regardless of format, used:<subsection ssid="1-null-4" dnum="A-o" numlevel="1" lineno="106" slineno="2-8" level="4" tab="1"><display>(A)</display>as or in place of textbooks to deliver curriculum within the state curriculum <ln numlevel="1" lineno="107" slineno="2-9"/>framework for courses of study by students; or</subsection><subsection ssid="1-null-5" dnum="B-o" numlevel="1" lineno="108" slineno="2-10" level="4" tab="1"><display>(B)</display>to support a student's learning in any school setting.</subsection></subsection><subsection ssid="1-null-6" dnum="ii-o" numlevel="1" lineno="109" slineno="2-11" level="3"><display>(ii)</display>"Instructional material" includes reading materials, handouts, videos, digital <ln numlevel="1" lineno="110" slineno="2-12"/>materials, websites, online applications, and live presentations.</subsection><subsection ssid="1-null-7" dnum="iii-o" numlevel="1" lineno="111" slineno="2-13" level="3"><display>(iii)</display>"Instructional material" does not mean exclusively library materials.</subsection></subsection><subsection ssid="1-null-8" dnum="b-o:c-i" numlevel="1" lineno="112" slineno="2-14" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1046" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1047" style="1" owner="i" level="1" amendtag="both" space="true">(c)</amend></display>"LEA governing board" means<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="7" groupid="5" style="2" owner="jchristopherson" level="1" deltag="both">:</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="6" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"> the same as that term is defined in Section <xref depth="3" refnumber="53E-1-102"><ln numlevel="1" lineno="113" slineno="2-15"/>53E-1-102</xref>.</amend><subsection ssid="1-null-9" dnum="i-o:_-i" numlevel="1" lineno="114" slineno="2-16" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1047" style="2" owner="o" level="1" deltag="start">(i)</amend></display><amend anum="0" ea="erase" pairid="10" groupid="7" style="2" owner="jchristopherson" level="1" deltag="end">for a school district, the local school board;</amend><amendoutend style="2"/></subsection><subsection ssid="1-null-10" dnum="ii-o:_-i" numlevel="1" lineno="115" slineno="2-17" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1048" style="2" owner="o" level="1" deltag="start">(ii)</amend></display><amend anum="0" ea="erase" pairid="13" groupid="9" style="2" owner="jchristopherson" level="1" deltag="end">for a charter school, the charter school governing board; or</amend><amendoutend style="2"/></subsection><subsection ssid="1-null-11" dnum="iii-o:_-i" numlevel="1" lineno="116" slineno="2-18" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1049" style="2" owner="o" level="1" deltag="start">(iii)</amend></display><amend anum="0" ea="erase" pairid="16" groupid="11" style="2" owner="jchristopherson" level="1" deltag="end">for the Utah Schools for the Deaf and the Blind, the state board.</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="1-null-12" dnum="c-o:d-i" numlevel="1" lineno="117" slineno="2-19" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1050" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1051" style="1" owner="i" level="1" amendtag="both" space="true">(d)</amend></display>"Material" means the same as that term is defined in Section <xref depth="3" refnumber="76-5c-101">76-5c-101</xref>.</subsection><subsection ssid="1-null-13" dnum="d-o:e-i" numlevel="1" lineno="118" slineno="2-20" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1051" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1052" style="1" owner="i" level="1" amendtag="both" space="true">(e)</amend></display>"Minor" means any person less than 18 years old.</subsection><subsection ssid="1-null-14" dnum="e-o:f-i" numlevel="1" lineno="119" slineno="2-21" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1052" style="2" owner="o" level="1" deltag="both">(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1053" style="1" owner="i" level="1" amendtag="both" space="true">(f)</amend></display>"Objective sensitive material" means an instructional material that constitutes <ln numlevel="1" lineno="120" slineno="2-22"/>pornographic or indecent material, as that term is defined in Section <xref depth="3" refnumber="76-5c-208">76-5c-208</xref>, under <ln numlevel="1" lineno="121" slineno="2-23"/>the non-discretionary standards described in Subsections <xref depth="4" refnumber="76-5c-207(1)(a)(i)(a)">76-5c-207(1)(a)(i)(A)</xref>, (B), <ln numlevel="1" lineno="122" slineno="2-24"/>or (C).</subsection><subsection ssid="1-null-15" dnum="f-o:g-i" numlevel="1" lineno="123" slineno="2-25" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1053" style="2" owner="o" level="1" deltag="both">(f)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1054" style="1" owner="i" level="1" amendtag="both" space="true">(g)</amend></display>"Public school" means:<subsection ssid="1-null-16" dnum="i-o" numlevel="1" lineno="124" slineno="2-26" level="3"><display>(i)</display>a district school;</subsection><subsection ssid="1-null-17" dnum="ii-o" numlevel="1" lineno="125" slineno="2-27" level="3"><display>(ii)</display>a charter school; or</subsection><subsection ssid="1-null-18" dnum="iii-o" numlevel="1" lineno="126" slineno="2-28" level="3"><display>(iii)</display>the Utah Schools for the Deaf and the Blind.</subsection></subsection><subsection ssid="1-null-19" dnum="g-o:h-i" numlevel="1" lineno="127" slineno="2-29" level="2" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1057" style="2" owner="o" level="1" deltag="both">(g)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1058" style="1" owner="i" level="1" amendtag="both" space="true">(h)</amend></display><subsection ssid="1-null-20" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"School setting" means, for a public school:<subsection ssid="1-null-21" dnum="A-o" numlevel="1" lineno="128" slineno="2-30" level="4" tab="1"><display>(A)</display>in a classroom;</subsection><subsection ssid="1-null-22" dnum="B-o" numlevel="1" lineno="129" slineno="2-31" level="4" tab="1"><display>(B)</display>in a school library; or</subsection><subsection ssid="1-null-23" dnum="C-o" numlevel="1" lineno="130" slineno="2-32" level="4" tab="1"><display>(C)</display>on school property.</subsection></subsection><subsection ssid="1-null-24" dnum="ii-o" numlevel="1" lineno="131" slineno="2-33" level="3"><display>(ii)</display>"School setting" includes the following activities that an organization or <ln numlevel="1" lineno="132" slineno="2-34"/>individual or organization outside of a public school conducts, if a public school <ln numlevel="1" lineno="133" slineno="2-35"/>or an LEA sponsors or requires the activity:<subsection ssid="1-null-25" dnum="A-o" numlevel="1" lineno="134" slineno="2-36" level="4"><display>(A)</display>an assembly;</subsection><subsection ssid="1-null-26" dnum="B-o" numlevel="1" lineno="135" slineno="2-37" level="4"><display>(B)</display>a guest lecture;</subsection><subsection ssid="1-null-27" dnum="C-o" numlevel="1" lineno="136" slineno="2-38" level="4"><display>(C)</display>a live presentation; or</subsection><subsection ssid="1-null-28" dnum="D-o" numlevel="1" lineno="137" slineno="2-39" level="4"><display>(D)</display>an event.</subsection></subsection></subsection><subsection ssid="1-null-29" dnum="h-o:i-i" numlevel="1" lineno="138" slineno="2-40" level="2" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1067" style="2" owner="o" level="1" deltag="both">(h)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1068" style="1" owner="i" level="1" amendtag="both" space="true">(i)</amend></display><subsection ssid="1-null-30" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"Sensitive material" means an instructional material that constitutes <ln numlevel="1" lineno="139" slineno="2-41"/>objective sensitive material or subjective sensitive material.</subsection><subsection ssid="1-null-31" dnum="ii-o" numlevel="1" lineno="140" slineno="2-42" level="3"><display>(ii)</display>"Sensitive material" does not include an instructional material:<subsection ssid="1-null-32" dnum="A-o" numlevel="1" lineno="141" slineno="2-43" level="4"><display>(A)</display>that an LEA selects under Section <xref depth="3" refnumber="53G-10-402">53G-10-402</xref>;</subsection><subsection ssid="1-null-33" dnum="B-o" numlevel="1" lineno="142" slineno="2-44" level="4"><display>(B)</display>for a concurrent enrollment course that contains sensitive material and for <ln numlevel="1" lineno="143" slineno="2-45"/>which a parent receives notice from the course provider of the material before <ln numlevel="1" lineno="144" slineno="2-46"/>enrollment of the parent's child and gives the parent's consent by enrolling the <ln numlevel="1" lineno="145" slineno="2-47"/>parent's child;</subsection><subsection ssid="1-null-34" dnum="C-o" numlevel="1" lineno="146" slineno="2-48" level="4"><display>(C)</display>for medical courses;</subsection><subsection ssid="1-null-35" dnum="D-o" numlevel="1" lineno="147" slineno="2-49" level="4"><display>(D)</display>for family and consumer science courses; or</subsection><subsection ssid="1-null-36" dnum="E-o" numlevel="1" lineno="148" slineno="2-50" level="4"><display>(E)</display>for another course the state board exempts in state board rule.</subsection></subsection><subsection ssid="1-null-37" dnum="iii-o" numlevel="1" lineno="149" slineno="2-51" level="3"><display>(iii)</display>"Subjective sensitive material" means an instructional material that constitutes <ln numlevel="1" lineno="150" slineno="2-52"/>pornographic or indecent material, as that term is defined in Section <xref depth="3" refnumber="76-5c-208">76-5c-208</xref>, <ln numlevel="1" lineno="151" slineno="2-53"/>under the following factor-balancing standards:<subsection ssid="1-null-38" dnum="A-o" numlevel="1" lineno="152" slineno="2-54" level="4"><display>(A)</display>material that is harmful to minors under Section <xref depth="3" refnumber="76-5c-101">76-5c-101</xref>;</subsection><subsection ssid="1-null-39" dnum="B-o" numlevel="1" lineno="153" slineno="2-55" level="4"><display>(B)</display>material that is pornographic under Section <xref depth="3" refnumber="76-5c-101">76-5c-101</xref>; or</subsection><subsection ssid="1-null-40" dnum="C-o" numlevel="1" lineno="154" slineno="2-56" level="4"><display>(C)</display>material that includes certain fondling or other erotic touching under <ln numlevel="1" lineno="155" slineno="2-57"/>Subsection <xref depth="4" refnumber="76-5c-207(1)(a)(i)(d)">76-5c-207(1)(a)(i)(D)</xref>.</subsection></subsection></subsection><subsection ssid="1-116" dnum="_-o:j-i" numlevel="1" lineno="156" slineno="2-58" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1079" style="1" owner="i" level="1" amendtag="start">(j)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">"UETN" means the Utah Education and Telehealth Network, created in Section <xref depth="3" refnumber="53H-4-213.1"><ln numlevel="1" lineno="157" slineno="2-59"/>53H-4-213.1</xref>.</amend></subsection><subsection ssid="1-117" dnum="_-o:k-i" numlevel="1" lineno="158" slineno="2-60" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1080" style="1" owner="i" level="1" amendtag="start">(k)</amend></display><amend anum="0" ea="amend" pairid="29" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="end">"Vendor" means an entity that provides digital instructional material to students in a <ln numlevel="1" lineno="159" slineno="2-61"/>school setting:</amend><subsection ssid="1-119" dnum="_-o:i-i" numlevel="1" lineno="160" slineno="2-62" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1081" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="34" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="end">under a contract with a contracting entity; or</amend></subsection><subsection ssid="1-120" dnum="_-o:ii-i" numlevel="1" lineno="161" slineno="2-63" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1082" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="39" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="end">through donating the digital instructional material.</amend></subsection></subsection></subsection><subsection ssid="1-null-41" dnum="2-o" numlevel="1" lineno="162" slineno="2-64" level="1" space="false"><display>(2)</display><subsection ssid="1-null-42" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Sensitive materials are prohibited in the school setting.</subsection><subsection ssid="1-null-43" dnum="b-o" numlevel="1" lineno="163" slineno="2-65" level="2"><display>(b)</display>A public school or an LEA may not:<subsection ssid="1-null-44" dnum="i-o" numlevel="1" lineno="164" slineno="2-66" level="3"><display>(i)</display>adopt, use, distribute, provide a student access to, or maintain in the school setting, <ln numlevel="1" lineno="165" slineno="2-67"/>sensitive materials; or</subsection><subsection ssid="1-null-45" dnum="ii-o" numlevel="1" lineno="166" slineno="2-68" level="3"><display>(ii)</display>permit a speaker or presenter in the school setting to display or distribute <ln numlevel="1" lineno="167" slineno="2-69"/>sensitive materials.</subsection></subsection><subsection ssid="1-null-46" dnum="c-o" numlevel="1" lineno="168" slineno="2-70" level="2"><display>(c)</display>In evaluating, selecting, or otherwise considering action related to a given <ln numlevel="1" lineno="169" slineno="2-71"/>instructional material under this section, each public school and each LEA shall <ln numlevel="1" lineno="170" slineno="2-72"/>prioritize protecting children from the harmful effects of illicit pornography over <ln numlevel="1" lineno="171" slineno="2-73"/>other considerations in evaluating instructional material.</subsection><subsection ssid="1-null-47" dnum="d-o" numlevel="1" lineno="172" slineno="2-74" level="2"><display>(d)</display>If an instructional material constitutes objective sensitive material:<subsection ssid="1-null-48" dnum="i-o" numlevel="1" lineno="173" slineno="2-75" level="3"><display>(i)</display>a public school or an LEA is not required to engage in a review under a subjective <ln numlevel="1" lineno="174" slineno="2-76"/>sensitive material standard; and</subsection><subsection ssid="1-null-49" dnum="ii-o" numlevel="1" lineno="175" slineno="2-77" level="3"><display>(ii)</display>the outcome of a subjective sensitive material evaluation has no bearing on the <ln numlevel="1" lineno="176" slineno="2-78"/>non-discretionary objective sensitive material conclusion.</subsection></subsection></subsection><subsection ssid="1-null-50" dnum="3-o" numlevel="1" lineno="177" slineno="2-79" level="1" space="false"><display>(3)</display><subsection ssid="1-null-51" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="53G-10-103(3)(b)">(3)(b)</xref>, the following individuals may initiate a <ln numlevel="1" lineno="178" slineno="2-80"/>sensitive material review under this section:<subsection ssid="1-null-52" dnum="i-o" numlevel="1" lineno="179" slineno="2-81" level="3" tab="1"><display>(i)</display>an employee of the relevant LEA;</subsection><subsection ssid="1-null-53" dnum="ii-o" numlevel="1" lineno="180" slineno="2-82" level="3" tab="1"><display>(ii)</display>a student who is enrolled in the relevant LEA;</subsection><subsection ssid="1-null-54" dnum="iii-o" numlevel="1" lineno="181" slineno="2-83" level="3" tab="1"><display>(iii)</display>a parent of a child who is enrolled in the relevant LEA; or</subsection><subsection ssid="1-null-55" dnum="iv-o" numlevel="1" lineno="182" slineno="2-84" level="3" tab="1"><display>(iv)</display>a member of the relevant LEA governing board.</subsection></subsection><subsection ssid="1-null-56" dnum="b-o" numlevel="1" lineno="183" slineno="2-85" level="2" space="false"><display>(b)</display><subsection ssid="1-null-57" dnum="i-o" level="3" placement="sameline"><display>(i)</display>As used in this Subsection <xref depth="4" refnumber="53G-10-103(3)(b)">(3)(b)</xref>, "unsuccessful challenge" means an allegation <ln numlevel="1" lineno="184" slineno="2-86"/>that a given instructional material constitutes sensitive material that the LEA <ln numlevel="1" lineno="185" slineno="2-87"/>concludes to be erroneous, either on direct review or on appeal to the LEA <ln numlevel="1" lineno="186" slineno="2-88"/>governing board, resulting in the retention of the given instructional material.</subsection><subsection ssid="1-null-58" dnum="ii-o" numlevel="1" lineno="187" slineno="2-89" level="3"><display>(ii)</display>Notwithstanding Subsection <xref depth="4" refnumber="53G-10-103(3)(a)">(3)(a)</xref>, after an individual makes three unsuccessful <ln numlevel="1" lineno="188" slineno="2-90"/>challenges during a given academic year, the individual may not trigger a <ln numlevel="1" lineno="189" slineno="2-91"/>sensitive material review under this section during the remainder of the given <ln numlevel="1" lineno="190" slineno="2-92"/>academic year.</subsection></subsection></subsection><subsection ssid="1-null-59" dnum="4-o" numlevel="1" lineno="191" slineno="2-93" level="1"><display>(4)</display>Upon receipt of an allegation from an individual described in Subsection <xref depth="4" refnumber="53G-10-103(3)(a)">(3)(a)</xref>, an LEA <ln numlevel="1" lineno="192" slineno="2-94"/>shall:<subsection ssid="1-null-60" dnum="a-o" numlevel="1" lineno="193" slineno="2-95" level="2" space="false"><display>(a)</display><subsection ssid="1-null-61" dnum="i-o" level="3" placement="sameline"><display>(i)</display>make an initial determination as to whether the allegation presents a plausible <ln numlevel="1" lineno="194" slineno="2-96"/>claim that the challenged instructional material constitutes sensitive material, <ln numlevel="1" lineno="195" slineno="2-97"/>including whether the allegation includes excerpts and other evidence to support <ln numlevel="1" lineno="196" slineno="2-98"/>the allegation; and</subsection><subsection ssid="1-null-62" dnum="ii-o" numlevel="1" lineno="197" slineno="2-99" level="3"><display>(ii)</display>if the LEA determines that the allegation presents a plausible claim that the <ln numlevel="1" lineno="198" slineno="2-100"/>challenged instructional material constitutes sensitive material under Subsection <xref depth="4" refnumber="53G-10-103(4)(a)(i)"><ln numlevel="1" lineno="199" slineno="2-101"/>(4)(a)(i)</xref>, immediately remove the challenged material from any school setting that <ln numlevel="1" lineno="200" slineno="2-102"/>provides student access to the challenged material until the LEA completes the <ln numlevel="1" lineno="201" slineno="2-103"/>LEA's full review of the challenged material under this section;</subsection></subsection><subsection ssid="1-null-63" dnum="b-o" numlevel="1" lineno="202" slineno="2-104" level="2" space="false"><display>(b)</display><subsection ssid="1-null-64" dnum="i-o" level="3" placement="sameline"><display>(i)</display>engage in a review of the allegations and the challenged instructional material <ln numlevel="1" lineno="203" slineno="2-105"/>using the objective sensitive material standards; and</subsection><subsection ssid="1-null-65" dnum="ii-o" numlevel="1" lineno="204" slineno="2-106" level="3"><display>(ii)</display>if the LEA makes a determination that the challenged instructional material <ln numlevel="1" lineno="205" slineno="2-107"/>constitutes objective sensitive material, ensure that the material remains <ln numlevel="1" lineno="206" slineno="2-108"/>inaccessible to students in any school setting;</subsection></subsection><subsection ssid="1-null-66" dnum="c-o" numlevel="1" lineno="207" slineno="2-109" level="2"><display>(c)</display>only if the LEA makes a determination that the challenged instructional material <ln numlevel="1" lineno="208" slineno="2-110"/>does not constitute objective sensitive material:<subsection ssid="1-null-67" dnum="i-o" numlevel="1" lineno="209" slineno="2-111" level="3"><display>(i)</display>review the allegations and the challenged instructional material under the <ln numlevel="1" lineno="210" slineno="2-112"/>subjective material standards, ensuring that the review includes parents who are <ln numlevel="1" lineno="211" slineno="2-113"/>reflective of the members of the school's community when determining if an <ln numlevel="1" lineno="212" slineno="2-114"/>instructional material is subjective sensitive material;</subsection><subsection ssid="1-null-68" dnum="ii-o" numlevel="1" lineno="213" slineno="2-115" level="3"><display>(ii)</display>allow student access to the challenged instructional material during the LEA's <ln numlevel="1" lineno="214" slineno="2-116"/>subjective sensitive material review if the student's parent gives consent regarding <ln numlevel="1" lineno="215" slineno="2-117"/>the specific challenged instructional material; and</subsection><subsection ssid="1-null-69" dnum="iii-o" numlevel="1" lineno="216" slineno="2-118" level="3"><display>(iii)</display>if the LEA makes a determination that the challenged instructional material <ln numlevel="1" lineno="217" slineno="2-119"/>constitutes subjective sensitive material, ensure that the material is inaccessible to <ln numlevel="1" lineno="218" slineno="2-120"/>students in any school setting, including the termination of the parent consent <ln numlevel="1" lineno="219" slineno="2-121"/>option described in Subsection <xref depth="4" refnumber="53G-10-103(4)(c)(ii)">(4)(c)(ii)</xref>; and</subsection></subsection><subsection ssid="1-null-70" dnum="d-o" numlevel="1" lineno="220" slineno="2-122" level="2"><display>(d)</display>communicate to the state board<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="52" groupid="40" style="2" owner="jchristopherson" level="1" deltag="both"> </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="50" groupid="38" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">:</amend><subsection ssid="1-122" dnum="_-o:i-i" numlevel="1" lineno="221" slineno="2-123" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1113" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>the allegation<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="61" groupid="48" style="2" owner="jchristopherson" level="1" deltag="both"> and </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="59" groupid="46" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">;</amend></subsection><subsection ssid="1-123" dnum="_-o:ii-i" numlevel="1" lineno="222" slineno="2-124" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1114" style="1" owner="i" level="1" amendtag="both">(ii)</amend></display>the LEA's final determination regarding the allegation and the challenged <ln numlevel="1" lineno="223" slineno="2-125"/>instructional material<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="70" groupid="56" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="68" groupid="54" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="1-124" dnum="_-o:iii-i" numlevel="1" lineno="224" slineno="2-126" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1115" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="71" groupid="57" style="1" owner="jchristopherson" level="1" amendtag="end">if the challenged instructional material is digital material, the vendor providing <ln numlevel="1" lineno="225" slineno="2-127"/>access to the digital material.</amend></subsection></subsection></subsection><subsection ssid="1-null-71" dnum="5-o" numlevel="1" lineno="226" slineno="2-128" level="1" space="false"><display>(5)</display><subsection ssid="1-null-72" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An individual described in Subsection <xref depth="4" refnumber="53G-10-103(3)(a)">(3)(a)</xref> may appeal an LEA's decision <ln numlevel="1" lineno="227" slineno="2-129"/>regarding a sensitive material review, regardless of whether the LEA removed or <ln numlevel="1" lineno="228" slineno="2-130"/>retained the challenged instructional material, to the LEA governing board.</subsection><subsection ssid="1-null-73" dnum="b-o" numlevel="1" lineno="229" slineno="2-131" level="2"><display>(b)</display>An LEA governing board shall vote in a public board meeting to decide the outcome <ln numlevel="1" lineno="230" slineno="2-132"/>of a sensitive material review appeal, clearly identifying:<subsection ssid="1-null-74" dnum="i-o" numlevel="1" lineno="231" slineno="2-133" level="3"><display>(i)</display>the board's rationale for the decision; and</subsection><subsection ssid="1-null-75" dnum="ii-o" numlevel="1" lineno="232" slineno="2-134" level="3"><display>(ii)</display>the board's determination on each component of the statutory and any additional <ln numlevel="1" lineno="233" slineno="2-135"/>policy standards the board uses to reach the board's conclusions.</subsection></subsection></subsection><subsection ssid="1-null-76" dnum="6-o" numlevel="1" lineno="234" slineno="2-136" level="1"><display>(6)</display>An LEA governing board may not enact rules or policies that prevent the LEA <ln numlevel="1" lineno="235" slineno="2-137"/>governing board from:<subsection ssid="1-null-77" dnum="a-o" numlevel="1" lineno="236" slineno="2-138" level="2"><display>(a)</display>revisiting a previous decision;</subsection><subsection ssid="1-null-78" dnum="b-o" numlevel="1" lineno="237" slineno="2-139" level="2"><display>(b)</display>reviewing a recommendation of LEA personnel or a parent-related committee <ln numlevel="1" lineno="238" slineno="2-140"/>regarding a challenged instructional material; or</subsection><subsection ssid="1-null-79" dnum="c-o" numlevel="1" lineno="239" slineno="2-141" level="2"><display>(c)</display>reconsidering a challenged instructional material if the LEA governing board <ln numlevel="1" lineno="240" slineno="2-142"/>receives additional information regarding the material.</subsection></subsection><subsection ssid="1-null-80" dnum="7-o" numlevel="1" lineno="241" slineno="2-143" level="1" space="false"><display>(7)</display><subsection ssid="1-null-81" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="53G-10-103(7)(d)">(7)(d)</xref>, if the threshold described in Subsection <xref depth="4" refnumber="53G-10-103(7)(b)"><ln numlevel="1" lineno="242" slineno="2-144"/>(7)(b)</xref> is met, each LEA statewide shall remove the relevant instructional material <ln numlevel="1" lineno="243" slineno="2-145"/>from student access.</subsection><subsection ssid="1-null-82" dnum="b-o" numlevel="1" lineno="244" slineno="2-146" level="2"><display>(b)</display>The requirement described in Subsection <xref depth="4" refnumber="53G-10-103(7)(a)">(7)(a)</xref> to remove a given material from <ln numlevel="1" lineno="245" slineno="2-147"/>student access applies if the following number of LEAs makes a determination that a <ln numlevel="1" lineno="246" slineno="2-148"/>given instructional material constitutes objective sensitive material:<subsection ssid="1-null-83" dnum="i-o" numlevel="1" lineno="247" slineno="2-149" level="3"><display>(i)</display>at least three school districts; or</subsection><subsection ssid="1-null-84" dnum="ii-o" numlevel="1" lineno="248" slineno="2-150" level="3"><display>(ii)</display>at least two school districts and five charter schools.</subsection></subsection><subsection ssid="1-null-85" dnum="c-o" numlevel="1" lineno="249" slineno="2-151" level="2"><display>(c)</display>The state board shall:<subsection ssid="1-null-86" dnum="i-o" numlevel="1" lineno="250" slineno="2-152" level="3"><display>(i)</display>aggregate allegations and LEA determinations described in Subsection <xref depth="4" refnumber="53G-10-103(4)(d)">(4)(d)</xref>; and</subsection><subsection ssid="1-null-87" dnum="ii-o" numlevel="1" lineno="251" slineno="2-153" level="3"><display>(ii)</display>no later than 10 school days after the day on which the condition described in <ln numlevel="1" lineno="252" slineno="2-154"/>Subsection <xref depth="4" refnumber="53G-10-103(7)(b)">(7)(b)</xref> occurs, communicate to all LEAs the application of the <ln numlevel="1" lineno="253" slineno="2-155"/>requirement described in Subsection <xref depth="4" refnumber="53G-10-103(7)(a)">(7)(a)</xref> to remove the material from student <ln numlevel="1" lineno="254" slineno="2-156"/>access.</subsection></subsection><subsection ssid="1-null-88" dnum="d-o" numlevel="1" lineno="255" slineno="2-157" level="2" space="false"><display>(d)</display><subsection ssid="1-null-89" dnum="i-o" level="3" placement="sameline"><display>(i)</display>When the threshold described in Subsection <xref depth="4" refnumber="53G-10-103(7)(b)">(7)(b)</xref> is met for a given <ln numlevel="1" lineno="256" slineno="2-158"/>instructional material, in addition to making the communication described in <ln numlevel="1" lineno="257" slineno="2-159"/>Subsection <xref depth="4" refnumber="53G-10-103(7)(c)">(7)(c)</xref>, the state board may:<subsection ssid="1-null-90" dnum="A-o" numlevel="1" lineno="258" slineno="2-160" level="4" tab="1"><display>(A)</display>place the material on the agenda of a public board meeting within 60 days <ln numlevel="1" lineno="259" slineno="2-161"/>after the day on which the state board makes the communication to LEAs <ln numlevel="1" lineno="260" slineno="2-162"/>under Subsection <xref depth="4" refnumber="53G-10-103(7)(c)">(7)(c)</xref>; and</subsection><subsection ssid="1-null-91" dnum="B-o" numlevel="1" lineno="261" slineno="2-163" level="4" tab="1"><display>(B)</display>at the specified state board meeting, vote to overturn the application of the <ln numlevel="1" lineno="262" slineno="2-164"/>requirement described in Subsection <xref depth="4" refnumber="53G-10-103(7)(a)">(7)(a)</xref> to remove a given material from <ln numlevel="1" lineno="263" slineno="2-165"/>student access statewide.</subsection></subsection><subsection ssid="1-null-92" dnum="ii-o" numlevel="1" lineno="264" slineno="2-166" level="3"><display>(ii)</display>If the state board votes to overturn the application of the statewide removal <ln numlevel="1" lineno="265" slineno="2-167"/>requirement described in Subsection <xref depth="4" refnumber="53G-10-103(7)(a)">(7)(a)</xref> under Subsection <xref depth="4" refnumber="53G-10-103(7)(d)(i)">(7)(d)(i)</xref>:<subsection ssid="1-null-93" dnum="A-o" numlevel="1" lineno="266" slineno="2-168" level="4"><display>(A)</display>the statewide removal requirement described in Subsection <xref depth="4" refnumber="53G-10-103(7)(a)">(7)(a)</xref> no longer <ln numlevel="1" lineno="267" slineno="2-169"/>applies;</subsection><subsection ssid="1-null-94" dnum="B-o" numlevel="1" lineno="268" slineno="2-170" level="4"><display>(B)</display>an LEA may choose to return the given material to student access; and</subsection><subsection ssid="1-null-95" dnum="C-o" numlevel="1" lineno="269" slineno="2-171" level="4"><display>(C)</display>nothing affects the findings of an LEA governing board regarding removal of <ln numlevel="1" lineno="270" slineno="2-172"/>the given material within the board's LEA.</subsection></subsection></subsection><subsection ssid="1-null-96" dnum="e-o" numlevel="1" lineno="271" slineno="2-173" level="2"><display>(e)</display>This Subsection <xref depth="4" refnumber="53G-10-103(7)">(7)</xref> applies to sensitive materials that LEAs remove from student <ln numlevel="1" lineno="272" slineno="2-174"/>access, regardless of whether:<subsection ssid="1-null-97" dnum="i-o" numlevel="1" lineno="273" slineno="2-175" level="3"><display>(i)</display>the sensitive material determinations occur in the same academic year; or</subsection><subsection ssid="1-null-98" dnum="ii-o" numlevel="1" lineno="274" slineno="2-176" level="3"><display>(ii)</display>a sensitive material determination occurred before July 1, 2024.</subsection></subsection><subsection ssid="1-125" dnum="_-o:f-i" numlevel="1" lineno="275" slineno="2-177" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1144" style="1" owner="i" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="72" groupid="58" style="1" owner="jchristopherson" level="1" amendtag="end">Each LEA, the state board, and UETN shall remove student access that the LEA, <ln numlevel="1" lineno="276" slineno="2-178"/>state board, or UETN facilitates to any material that a vendor provides if three <ln numlevel="1" lineno="277" slineno="2-179"/>separate items of digital instructional material that the vendor provides are subject to <ln numlevel="1" lineno="278" slineno="2-180"/>statewide removal under this section.</amend></subsection></subsection><subsection ssid="1-null-99" dnum="8-o" numlevel="1" lineno="279" slineno="2-181" level="1"><display>(8)</display>The state board shall:<subsection ssid="1-null-100" dnum="a-o" numlevel="1" lineno="280" slineno="2-182" level="2"><display>(a)</display>in consultation with the Office of the Attorney General, provide guidance and <ln numlevel="1" lineno="281" slineno="2-183"/>training to support public schools in identifying instructional materials that meet the <ln numlevel="1" lineno="282" slineno="2-184"/>definition of sensitive materials under this section;</subsection><subsection ssid="1-null-101" dnum="b-o" numlevel="1" lineno="283" slineno="2-185" level="2"><display>(b)</display>establish a process through which an individual described in Subsection <xref depth="4" refnumber="53G-10-103(3)(a)">(3)(a)</xref> may <ln numlevel="1" lineno="284" slineno="2-186"/>report to the state board an allegation that an LEA is out of compliance with this <ln numlevel="1" lineno="285" slineno="2-187"/>section; and</subsection><subsection ssid="1-null-102" dnum="c-o" numlevel="1" lineno="286" slineno="2-188" level="2"><display>(c)</display>annually report to the Education Interim Committee, at or before the November <ln numlevel="1" lineno="287" slineno="2-189"/>interim meeting, on implementation and compliance with this section, including:<subsection ssid="1-null-103" dnum="i-o" numlevel="1" lineno="288" slineno="2-190" level="3"><display>(i)</display>any policy the state board or an LEA adopts to implement or comply with this <ln numlevel="1" lineno="289" slineno="2-191"/>section;</subsection><subsection ssid="1-null-104" dnum="ii-o" numlevel="1" lineno="290" slineno="2-192" level="3"><display>(ii)</display>any rule the state board makes to implement or comply with this section; and</subsection><subsection ssid="1-null-105" dnum="iii-o" numlevel="1" lineno="291" slineno="2-193" level="3"><display>(iii)</display>any complaints an LEA or the state board receives regarding a violation of this <ln numlevel="1" lineno="292" slineno="2-194"/>section, including:<subsection ssid="1-null-106" dnum="A-o" numlevel="1" lineno="293" slineno="2-195" level="4"><display>(A)</display>action taken in response to a complaint described in this Subsection <xref depth="4" refnumber="53G-10-103(8)(c)(iii)">(8)(c)(iii)</xref>;</subsection><subsection ssid="1-null-107" dnum="B-o" numlevel="1" lineno="294" slineno="2-196" level="4"><display>(B)</display>if an LEA retains an instructional material for which the LEA or the state <ln numlevel="1" lineno="295" slineno="2-197"/>board receives a complaint, the LEA's rationale for retaining the instructional <ln numlevel="1" lineno="296" slineno="2-198"/>material; and</subsection><subsection ssid="1-null-108" dnum="C-o" numlevel="1" lineno="297" slineno="2-199" level="4"><display>(C)</display>compliance failures that the state board identifies through the reporting <ln numlevel="1" lineno="298" slineno="2-200"/>process described in Subsection <xref depth="4" refnumber="53G-10-103(8)(b)">(8)(b)</xref> and other investigations or research<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="341" groupid="253" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="339" groupid="251" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">;</amend></subsection></subsection></subsection><subsection ssid="1-182" dnum="_-o:d-i" numlevel="1" lineno="299" slineno="2-201" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1155" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="427" groupid="321" style="1" owner="jchristopherson" level="1" amendtag="end">on an annual basis, develop and make available to each LEA a consolidated list of <ln numlevel="1" lineno="300" slineno="2-202"/>books that have been subject to removal or restriction from student access in public <ln numlevel="1" lineno="301" slineno="2-203"/>schools; and</amend></subsection><subsection ssid="1-198" dnum="_-o:e-i" numlevel="1" lineno="302" slineno="2-204" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1156" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="421" groupid="316" style="1" owner="jchristopherson" level="1" amendtag="end">in accordance with Title 63G, Chapter 6a, Utah Procurement Code, and subject to <ln numlevel="1" lineno="303" slineno="2-205"/>legislative appropriations, qualify and contract with one established book reviewer to <ln numlevel="1" lineno="304" slineno="2-206"/>provide a service to an LEA that:</amend><subsection ssid="1-201" dnum="_-o:i-i" numlevel="1" lineno="305" slineno="2-207" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1157" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="439" groupid="331" style="1" owner="jchristopherson" level="1" amendtag="end">identifies relevant page numbers and excerpts that potentially contain sensitive <ln numlevel="1" lineno="306" slineno="2-208"/>material; and</amend></subsection><subsection ssid="1-202" dnum="_-o:ii-i" numlevel="1" lineno="307" slineno="2-209" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1158" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="444" groupid="335" style="1" owner="jchristopherson" level="1" amendtag="end">uses technology, including artificial intelligence assisted analysis, to screen the <ln numlevel="1" lineno="308" slineno="2-210"/>instructional materials described in Subsection <xref depth="4" refnumber="53G-10-103(8)(e)(i)">(8)(e)(i)</xref> for violations of this <ln numlevel="1" lineno="309" slineno="2-211"/>section.</amend></subsection></subsection></subsection><subsection ssid="1-null-109" dnum="9-o" numlevel="1" lineno="310" slineno="2-212" level="1"><display>(9)</display>The state shall defend, indemnify, and hold harmless a person acting under color of state <ln numlevel="1" lineno="311" slineno="2-213"/>law to enforce this section for any claims or damages, including court costs and attorney <ln numlevel="1" lineno="312" slineno="2-214"/>fees, that:<subsection ssid="1-null-110" dnum="a-o" numlevel="1" lineno="313" slineno="2-215" level="2"><display>(a)</display>a person brings or incurs as a result of this section; and</subsection><subsection ssid="1-null-111" dnum="b-o" numlevel="1" lineno="314" slineno="2-216" level="2"><display>(b)</display>is not covered by the person's insurance policies or any coverage agreement that the <ln numlevel="1" lineno="315" slineno="2-217"/>State Risk Management Fund issues.</subsection></subsection><subsection ssid="1-null-112" dnum="10-o" numlevel="1" lineno="316" slineno="2-218" level="1"><display>(10)</display>Subject to prioritization of the Audit Subcommittee created in Section <xref depth="3" refnumber="36-12-8">36-12-8</xref>, the <ln numlevel="1" lineno="317" slineno="2-219"/>Office of the Legislative Auditor General shall:<subsection ssid="1-null-113" dnum="a-o" numlevel="1" lineno="318" slineno="2-220" level="2"><display>(a)</display>conduct an audit of each school district's compliance with this section, ensuring the <ln numlevel="1" lineno="319" slineno="2-221"/>completion of all school district audits before November 2028; and</subsection><subsection ssid="1-null-114" dnum="b-o" numlevel="1" lineno="320" slineno="2-222" level="2"><display>(b)</display>annually report to the Education Interim Committee regarding completed sensitive <ln numlevel="1" lineno="321" slineno="2-223"/>material audits under this Subsection <xref depth="4" refnumber="53G-10-103(10)">(10)</xref>.</subsection></subsection><subsection ssid="1-130" dnum="_-o:11-i" numlevel="1" lineno="322" slineno="2-224" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1165" style="1" owner="i" level="1" amendtag="start">(11)</amend></display><amend anum="0" ea="amend" pairid="171" groupid="125" style="1" owner="jchristopherson" level="1" amendtag="end">Each LEA shall:</amend><subsection ssid="1-131" dnum="_-o:a-i" numlevel="1" lineno="323" slineno="2-225" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1166" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="97" groupid="74" style="1" owner="jchristopherson" level="1" amendtag="end">at the time of student registration each year, provide to parents a direct link to the <ln numlevel="1" lineno="324" slineno="2-226"/>LEA's website that addresses sensitive material reporting described in Subsection <xref depth="4" refnumber="53G-10-103(11)(b)"><ln numlevel="1" lineno="325" slineno="2-227"/>(11)(b)</xref>;</amend></subsection><subsection ssid="1-199" dnum="_-o:b-i" numlevel="1" lineno="326" slineno="2-228" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1167" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="434" groupid="327" style="1" owner="jchristopherson" level="1" amendtag="end">use the list described in Subsection <xref depth="4" refnumber="53G-10-103(8)(d)">(8)(d)</xref> as a reference tool when reviewing library <ln numlevel="1" lineno="327" slineno="2-229"/>materials or instructional materials the LEA maintains;</amend></subsection><subsection ssid="1-180" dnum="_-o:c-i" numlevel="1" lineno="328" slineno="2-230" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1168" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="316" groupid="234" style="1" owner="jchristopherson" level="1" amendtag="end">provide training to each school on how to utilize the artificial intelligence tool the <ln numlevel="1" lineno="329" slineno="2-231"/>state board procures under Subsection <xref depth="4" refnumber="53G-10-103(8)(e)">(8)(e)</xref>;</amend></subsection><subsection ssid="1-134" dnum="_-o:d-i" numlevel="1" lineno="330" slineno="2-232" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1169" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="106" groupid="80" style="1" owner="jchristopherson" level="1" amendtag="end">ensure that the LEA website maintains an easily accessible and clearly visible <ln numlevel="1" lineno="331" slineno="2-233"/>section on the website's homepage for reporting violations of law regarding sensitive <ln numlevel="1" lineno="332" slineno="2-234"/>material;</amend></subsection><subsection ssid="1-178" dnum="_-o:e-i" numlevel="1" lineno="333" slineno="2-235" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1170" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="307" groupid="227" style="1" owner="jchristopherson" level="1" amendtag="end">use communication and training tools the state board provides to implement the <ln numlevel="1" lineno="334" slineno="2-236"/>requirements of this section;</amend></subsection><subsection ssid="1-175" dnum="_-o:f-i" numlevel="1" lineno="335" slineno="2-237" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1171" style="1" owner="i" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="292" groupid="215" style="1" owner="jchristopherson" level="1" amendtag="end">adopt a policy to ensure timely communication with all school staff regarding:</amend><subsection ssid="1-176" dnum="_-o:i-i" numlevel="1" lineno="336" slineno="2-238" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1172" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="298" groupid="220" style="1" owner="jchristopherson" level="1" amendtag="end">the LEA's process for identifying, reviewing, and addressing sensitive materials in <ln numlevel="1" lineno="337" slineno="2-239"/>accordance with this section; and</amend></subsection><subsection ssid="1-177" dnum="_-o:ii-i" numlevel="1" lineno="338" slineno="2-240" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1173" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="303" groupid="224" style="1" owner="jchristopherson" level="1" amendtag="end">any updates, determinations, or guidance the local school board or state board <ln numlevel="1" lineno="339" slineno="2-241"/>issues relating to sensitive materials;</amend></subsection></subsection><subsection ssid="1-154" dnum="_-o:g-i" numlevel="1" lineno="340" slineno="2-242" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1174" style="1" owner="i" level="1" amendtag="start">(g)</amend></display><amend anum="0" ea="amend" pairid="176" groupid="129" style="1" owner="jchristopherson" level="1" amendtag="end">before the beginning of the 2026-2027 school year, adopt a policy for the selection of <ln numlevel="1" lineno="341" slineno="2-243"/>instructional materials that prevent potentially sensitive materials from entering a <ln numlevel="1" lineno="342" slineno="2-244"/>school, including:</amend><subsection ssid="1-193" dnum="_-o:i-i" numlevel="1" lineno="343" slineno="2-245" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1175" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="396" groupid="296" style="1" owner="jchristopherson" level="1" amendtag="end">materials in the school library;</amend></subsection><subsection ssid="1-194" dnum="_-o:ii-i" numlevel="1" lineno="344" slineno="2-246" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1176" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="401" groupid="300" style="1" owner="jchristopherson" level="1" amendtag="end">artificial intelligence tools the state board procures; and</amend></subsection><subsection ssid="1-195" dnum="_-o:iii-i" numlevel="1" lineno="345" slineno="2-247" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1177" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="406" groupid="304" style="1" owner="jchristopherson" level="1" amendtag="end">digital instructional materials; and</amend></subsection></subsection><subsection ssid="1-155" dnum="_-o:h-i" numlevel="1" lineno="346" slineno="2-248" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1178" style="1" owner="i" level="1" amendtag="start">(h)</amend></display><amend anum="0" ea="amend" pairid="188" groupid="139" style="1" owner="jchristopherson" level="1" amendtag="end">ensure that each LEA or school-provided device, database, or service that allows a <ln numlevel="1" lineno="347" slineno="2-249"/>student to access digital instructional material includes a filter or other software <ln numlevel="1" lineno="348" slineno="2-250"/>service:</amend><subsection ssid="1-156" dnum="_-o:i-i" numlevel="1" lineno="349" slineno="2-251" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1179" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="187" groupid="138" style="1" owner="jchristopherson" level="1" amendtag="end">that prohibits access to sensitive material;</amend></subsection><subsection ssid="1-158" dnum="_-o:ii-i" numlevel="1" lineno="350" slineno="2-252" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1180" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="201" groupid="148" style="1" owner="jchristopherson" level="1" amendtag="end">that uses blocked keyword lists; and</amend></subsection><subsection ssid="1-159" dnum="_-o:iii-i" numlevel="1" lineno="351" slineno="2-253" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1181" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="211" groupid="155" style="1" owner="jchristopherson" level="1" amendtag="end">for which LEA personnel decrypt websites to ensure the efficacy of the filtering, <ln numlevel="1" lineno="352" slineno="2-254"/>including any online school library and other encrypted websites that students <ln numlevel="1" lineno="353" slineno="2-255"/>commonly access.</amend></subsection></subsection></subsection><subsection ssid="1-135" dnum="_-o:12-i" numlevel="1" lineno="354" slineno="2-256" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1182" style="1" owner="i" level="1" amendtag="start">(12)</amend></display><subsection ssid="1-136" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1183" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="112" groupid="84" style="1" owner="jchristopherson" level="1" amendtag="end">The state board, an LEA, and UETN may refuse donations of materials by a <ln numlevel="1" lineno="355" slineno="2-257"/>vendor or nonprofit if the materials contain sensitive material.</amend></subsection><subsection ssid="1-137" dnum="_-o:b-i" numlevel="1" lineno="356" slineno="2-258" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1184" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><subsection ssid="1-191" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1185" style="1" owner="i" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="115" groupid="86" style="1" owner="jchristopherson" level="1" amendtag="end">In either of the following instances, the vendor shall eliminate the segment of <ln numlevel="1" lineno="357" slineno="2-259"/>the digital instructional material containing the objective sensitive material or <ln numlevel="1" lineno="358" slineno="2-260"/>otherwise remove access to the sensitive material:</amend><subsection ssid="1-139" dnum="_-o:A-i" numlevel="1" lineno="359" slineno="2-261" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1186" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="121" groupid="90" style="1" owner="jchristopherson" level="1" amendtag="end">for material under a contract of an LEA, the LEA governing board <ln numlevel="1" lineno="360" slineno="2-262"/>determining that the digital instructional material is or contains objective <ln numlevel="1" lineno="361" slineno="2-263"/>sensitive material; or</amend></subsection><subsection ssid="1-140" dnum="_-o:B-i" numlevel="1" lineno="362" slineno="2-264" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1187" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="124" groupid="92" style="1" owner="jchristopherson" level="1" amendtag="end">for material under a contract of the state board or UETN, an LEA reporting to <ln numlevel="1" lineno="363" slineno="2-265"/>the state board that the LEA governing board has determined that the digital <ln numlevel="1" lineno="364" slineno="2-266"/>instructional material is or contains objective sensitive material.</amend></subsection></subsection><subsection ssid="1-192" dnum="_-o:ii-i" numlevel="1" lineno="365" slineno="2-267" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1188" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="391" groupid="292" style="1" owner="jchristopherson" level="1" amendtag="end">A contracting entity shall, without any penalty or any further financial obligation, <ln numlevel="1" lineno="366" slineno="2-268"/>rescind or otherwise terminate a contract for a vendor to provide instructional <ln numlevel="1" lineno="367" slineno="2-269"/>material into which the contracting entity enters on or after July 1, 2027, after <ln numlevel="1" lineno="368" slineno="2-270"/>three instances of a vendor failing to comply with Subsection <xref depth="4" refnumber="53G-10-103(12)(b)(i)">(12)(b)(i)</xref>.</amend></subsection></subsection><subsection ssid="1-142" dnum="_-o:c-i" numlevel="1" lineno="369" slineno="2-271" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1189" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="130" groupid="96" style="1" owner="jchristopherson" level="1" amendtag="end">In any contract for a vendor to provide digital instructional material for which the <ln numlevel="1" lineno="370" slineno="2-272"/>parties negotiate terms and into which the parties enter on or after July 1, 2027, the <ln numlevel="1" lineno="371" slineno="2-273"/>contracting entity shall ensure that the contract contains:</amend><subsection ssid="1-143" dnum="_-o:i-i" numlevel="1" lineno="372" slineno="2-274" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1190" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="133" groupid="98" style="1" owner="jchristopherson" level="1" amendtag="end">notice provisions regarding the requirements and prohibitions regarding digital <ln numlevel="1" lineno="373" slineno="2-275"/>sensitive material in this section, including any relevant rule or policy of the <ln numlevel="1" lineno="374" slineno="2-276"/>contracting entity;</amend></subsection><subsection ssid="1-173" dnum="_-o:ii-i" numlevel="1" lineno="375" slineno="2-277" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1191" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="284" groupid="209" style="1" owner="jchristopherson" level="1" amendtag="end">provisions prohibiting vendors from, when a student is using instructional <ln numlevel="1" lineno="376" slineno="2-278"/>material:</amend><subsection ssid="1-189" dnum="_-o:A-i" numlevel="1" lineno="377" slineno="2-279" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1192" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="378" groupid="283" style="1" owner="jchristopherson" level="1" amendtag="end">advertising products or services to the student; or</amend></subsection><subsection ssid="1-190" dnum="_-o:B-i" numlevel="1" lineno="378" slineno="2-280" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1193" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="384" groupid="288" style="1" owner="jchristopherson" level="1" amendtag="end">allowing a third-party to advertise products or services to the student, either <ln numlevel="1" lineno="379" slineno="2-281"/>through direct advertisement or through the inclusion of advertising content <ln numlevel="1" lineno="380" slineno="2-282"/>within the instructional material;</amend></subsection></subsection><subsection ssid="1-144" dnum="_-o:iii-i" numlevel="1" lineno="381" slineno="2-283" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1194" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="136" groupid="100" style="1" owner="jchristopherson" level="1" amendtag="end">provisions prohibiting vendors from including live links or website addresses to <ln numlevel="1" lineno="382" slineno="2-284"/>sites or material outside the vendor's material that:</amend><subsection ssid="1-145" dnum="_-o:A-i" numlevel="1" lineno="383" slineno="2-285" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1195" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="139" groupid="102" style="1" owner="jchristopherson" level="1" amendtag="end">contain objective sensitive material;</amend></subsection><subsection ssid="1-146" dnum="_-o:B-i" numlevel="1" lineno="384" slineno="2-286" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1196" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="142" groupid="104" style="1" owner="jchristopherson" level="1" amendtag="end">are not educationally focused;</amend></subsection><subsection ssid="1-160" dnum="_-o:C-i" numlevel="1" lineno="385" slineno="2-287" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1197" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="216" groupid="159" style="1" owner="jchristopherson" level="1" amendtag="end">advertise products or services; or</amend></subsection><subsection ssid="1-147" dnum="_-o:D-i" numlevel="1" lineno="386" slineno="2-288" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1198" style="1" owner="i" level="1" amendtag="start">(D)</amend></display><amend anum="0" ea="amend" pairid="145" groupid="106" style="1" owner="jchristopherson" level="1" amendtag="end">do not align with the state's academic core standards the state board <ln numlevel="1" lineno="387" slineno="2-289"/>establishes; and</amend></subsection></subsection><subsection ssid="1-148" dnum="_-o:iv-i" numlevel="1" lineno="388" slineno="2-290" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1199" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="148" groupid="108" style="1" owner="jchristopherson" level="1" amendtag="end">provisions requiring the vendor to notify the contracting entity of any update, <ln numlevel="1" lineno="389" slineno="2-291"/>modification, or addition to the digital instructional material the vendor provides <ln numlevel="1" lineno="390" slineno="2-292"/>that contains or constitutes objective sensitive material, including links to other <ln numlevel="1" lineno="391" slineno="2-293"/>material or websites from within the digital instructional material.</amend></subsection></subsection><subsection ssid="1-149" dnum="_-o:d-i" numlevel="1" lineno="392" slineno="2-294" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1200" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="151" groupid="110" style="1" owner="jchristopherson" level="1" amendtag="end">Before accepting donated digital instructional materials from a vendor, an LEA, the <ln numlevel="1" lineno="393" slineno="2-295"/>state board, or UETN shall provide notice to the vendor of the requirements and <ln numlevel="1" lineno="394" slineno="2-296"/>prohibitions regarding sensitive material in this section.</amend></subsection><subsection ssid="1-150" dnum="_-o:e-i" numlevel="1" lineno="395" slineno="2-297" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1201" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="154" groupid="112" style="1" owner="jchristopherson" level="1" amendtag="end">For digital instructional material that is found, through the processes described in this <ln numlevel="1" lineno="396" slineno="2-298"/>section, to contain sensitive material the state board, an LEA, or UETN shall:</amend><subsection ssid="1-196" dnum="_-o:i-i" numlevel="1" lineno="397" slineno="2-299" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1202" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="411" groupid="308" style="1" owner="jchristopherson" level="1" amendtag="end">remove the segment of digital instructional material from the relevant curriculum; <ln numlevel="1" lineno="398" slineno="2-300"/>or</amend></subsection><subsection ssid="1-197" dnum="_-o:ii-i" numlevel="1" lineno="399" slineno="2-301" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1203" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="416" groupid="312" style="1" owner="jchristopherson" level="1" amendtag="end">require the vendor to remove the segment of digital instructional material from <ln numlevel="1" lineno="400" slineno="2-302"/>the relevant curriculum.</amend></subsection></subsection></subsection><subsection ssid="1-161" dnum="_-o:13-i" numlevel="1" lineno="401" slineno="2-303" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1204" style="1" owner="i" level="1" amendtag="start">(13)</amend></display><subsection ssid="1-163" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1205" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="220" groupid="162" style="1" owner="jchristopherson" level="1" amendtag="end">A parent whose student is exposed to objective sensitive material has a private <ln numlevel="1" lineno="402" slineno="2-304"/>right of action against the LEA or vendor responsible for exposing the student to the <ln numlevel="1" lineno="403" slineno="2-305"/>objective sensitive material under this section.</amend></subsection><subsection ssid="1-162" dnum="_-o:b-i" numlevel="1" lineno="404" slineno="2-306" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1206" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="240" groupid="175" style="1" owner="jchristopherson" level="1" amendtag="end">If a parent prevails in an action under Subsection <xref depth="4" refnumber="53G-10-103(13)(a)">(13)(a)</xref>:</amend><subsection ssid="1-185" dnum="_-o:i-i" numlevel="1" lineno="405" slineno="2-307" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1207" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="353" groupid="262" style="1" owner="jchristopherson" level="1" amendtag="end">the court shall:</amend><subsection ssid="1-164" dnum="_-o:A-i" numlevel="1" lineno="406" slineno="2-308" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1208" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="239" groupid="174" style="1" owner="jchristopherson" level="1" amendtag="end">award reasonable costs to the parent; and</amend></subsection><subsection ssid="1-166" dnum="_-o:B-i" numlevel="1" lineno="407" slineno="2-309" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1209" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="251" groupid="184" style="1" owner="jchristopherson" level="1" amendtag="end">require the defendant to pay the parent's attorney fees; and</amend></subsection></subsection><subsection ssid="1-186" dnum="_-o:ii-i" numlevel="1" lineno="408" slineno="2-310" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1210" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="367" groupid="274" style="1" owner="jchristopherson" level="1" amendtag="end">the parent may recover:</amend><subsection ssid="1-187" dnum="_-o:A-i" numlevel="1" lineno="409" slineno="2-311" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1211" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="365" groupid="272" style="1" owner="jchristopherson" level="1" amendtag="end">actual damages; and</amend></subsection><subsection ssid="1-188" dnum="_-o:B-i" numlevel="1" lineno="410" slineno="2-312" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1212" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="373" groupid="279" style="1" owner="jchristopherson" level="1" amendtag="end">liquidated damages of $500 for each instance of objective sensitive material to <ln numlevel="1" lineno="411" slineno="2-313"/>which the parent's student is exposed in violation of this section.</amend></subsection></subsection></subsection><subsection ssid="1-167" dnum="_-o:c-i" numlevel="1" lineno="412" slineno="2-314" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1213" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="250" groupid="183" style="1" owner="jchristopherson" level="1" amendtag="end">Notwithstanding Subsection <xref depth="4" refnumber="53G-10-103(13)(a)">(13)(a)</xref>, a parent may not bring a civil action against an <ln numlevel="1" lineno="413" slineno="2-315"/>employee of the LEA in the employee's individual capacity.</amend></subsection></subsection></section></bsec><bsec buid="7" num="53G-10-308" type="enact" src="code" uid="C53G-10-S308_2026070120260701" sort="53G10 03080020260701" numlevel="1" lineno="414" slineno="3-1" sn="3"><section numlevel="1" lineno="415" slineno="3-2" number="53G-10-308" type="enact"><secline lineno="414">Section 3. Section <bold>53G-10-308</bold> is enacted to read:</secline><catline lineno="415"><bold>53G-10-308<parens/>. Academic rigor of books in a school library.</bold></catline><subsection ssid="7-11" dnum="_-o:1-i" numlevel="1" lineno="416" slineno="3-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1214" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="55" groupid="43" style="1" owner="jchristopherson" level="1" amendtag="end">As used in this section, "academically rigorous" means content that meaningfully <ln numlevel="1" lineno="417" slineno="3-4"/>advances core academic standards by requiring sustained comprehension, analysis, and <ln numlevel="1" lineno="418" slineno="3-5"/>subject-matter learning beyond materials intended primarily for entertainment.</amend></subsection><subsection ssid="7-10" dnum="_-o:2-i" numlevel="1" lineno="419" slineno="3-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1215" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="51" groupid="41" style="1" owner="jchristopherson" level="1" amendtag="end">An LEA shall require a school within the LEA to:</amend><subsection ssid="7-2" dnum="_-o:a-i" numlevel="1" lineno="420" slineno="3-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1216" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="end">prioritize the acquisition and accessibility of academically rigorous books including <ln numlevel="1" lineno="421" slineno="3-8"/>primary sources and scholarly works focused on:</amend><subsection ssid="7-3" dnum="_-o:i-i" numlevel="1" lineno="422" slineno="3-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1217" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="16" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">United States history;
