Stratton</otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill amends provisions regarding the accessibility of sensitive material through digital <ln numlevel="1" lineno="6" slineno="0-6"/>instructional material in a school setting.</gd><hphead lineno="7">Highlighted Provisions:</hphead><hp numlevel="1" lineno="8" slineno="0-8">This bill:<hl numlevel="1" lineno="9" slineno="0-9" level="1">defines a term;</hl><hl numlevel="1" lineno="10" slineno="0-10" level="1">prohibits a Local Education Agency (LEA) from providing certain materials to students <ln numlevel="1" lineno="11" slineno="0-11"/>that have been removed statewide;</hl><hl numlevel="1" lineno="12" slineno="0-12" level="1">requires an LEA to review instructional material an LEA adds to the LEA's collection of <ln numlevel="1" lineno="13" slineno="0-13"/>instructional material;</hl><hl numlevel="1" lineno="14" slineno="0-14" level="1">enacts certain prohibitions on a vendor of digital instructional material; and</hl><hl numlevel="1" lineno="15" slineno="0-15" level="1">makes technical and conforming changes.</hl></hp><moni numlevel="1" lineno="16" slineno="0-16" display="none">Money Appropriated in this Bill:</moni><moniNone lineno="17">None</moniNone><oc numlevel="1" lineno="18" slineno="0-18">Other Special Clauses:<ocl type="effdate" sort="2" numlevel="1" lineno="19" slineno="0-19">This bill provides a special effective date.</ocl></oc><sa numlevel="1" lineno="20" slineno="0-20">Utah Code Sections Affected:<saamd numlevel="1" lineno="21" slineno="0-21"><snhead>AMENDS:</snhead><sn num="53G-10-103" src="code" uid="C53G-10-S103_2026070120260701" buid="1" sort="53G10 01030020260701" numlevel="1" lineno="22" slineno="0-22"><bold>53G-10-103</bold>, as last amended by Laws of Utah 2025, Chapter 173</sn></saamd></sa></lt><enacthead lineno="23"/><enact numlevel="1" lineno="24" slineno="0-24">Be it enacted by the Legislature of the state of Utah:</enact><bdy><bsec buid="1" num="53G-10-103" type="amend" src="code" uid="C53G-10-S103_2026070120260701" sort="53G10 01030020260701" numlevel="1" lineno="25" slineno="1-1" sn="1"><section number="53G-10-103" numlevel="1" lineno="26" slineno="1-2" type="amend"><secline lineno="25">Section 1. Section <bold>53G-10-103</bold> is amended to read:</secline><catline lineno="26"><bold>53G-10-103<parens/>. Sensitive instructional materials.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="27" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="1-252" dnum="_-o:a-i" numlevel="1" lineno="28" slineno="1-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1001" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="40" groupid="33" style="1" owner="jchristopherson" level="1" amendtag="end">"Contracting entity" means the entity, including the LEA governing board, the state <ln numlevel="1" lineno="29" slineno="1-5"/>board, or UETN, that contracts with a vendor for a given digital instructional <ln numlevel="1" lineno="30" slineno="1-6"/>material, including a digital database.</amend></subsection><subsection ssid="1-null-2" dnum="a-o:b-i" numlevel="1" lineno="31" slineno="1-7" level="2" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1002" style="2" owner="o" level="1" deltag="both">(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1003" style="1" owner="i" level="1" amendtag="both" space="true">(b)</amend></display><subsection ssid="1-null-3" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"Instructional material" means a material, regardless of format, used:<subsection ssid="1-null-4" dnum="A-o" numlevel="1" lineno="32" slineno="1-8" level="4" tab="1"><display>(A)</display>as or in place of textbooks to deliver curriculum within the state curriculum <ln numlevel="1" lineno="33" slineno="1-9"/>framework for courses of study by students; or</subsection><subsection ssid="1-null-5" dnum="B-o" numlevel="1" lineno="34" slineno="1-10" level="4" tab="1"><display>(B)</display>to support a student's learning in any school setting.</subsection></subsection><subsection ssid="1-null-6" dnum="ii-o" numlevel="1" lineno="35" slineno="1-11" level="3"><display>(ii)</display>"Instructional material" includes reading materials, handouts, videos, digital <ln numlevel="1" lineno="36" slineno="1-12"/>materials, websites, online applications, and live presentations.</subsection><subsection ssid="1-null-7" dnum="iii-o" numlevel="1" lineno="37" slineno="1-13" level="3"><display>(iii)</display>"Instructional material" does not mean exclusively library materials.</subsection></subsection><subsection ssid="1-null-8" dnum="b-o:c-i" numlevel="1" lineno="38" slineno="1-14" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1008" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="both" space="true">(c)</amend></display>"LEA governing board" means:<subsection ssid="1-null-9" dnum="i-o" numlevel="1" lineno="39" slineno="1-15" level="3"><display>(i)</display>for a school district, the local school board;</subsection><subsection ssid="1-null-10" dnum="ii-o" numlevel="1" lineno="40" slineno="1-16" level="3"><display>(ii)</display>for a charter school, the charter school governing board; or</subsection><subsection ssid="1-null-11" dnum="iii-o" numlevel="1" lineno="41" slineno="1-17" level="3"><display>(iii)</display>for the Utah Schools for the Deaf and the Blind, the state board.</subsection></subsection><subsection ssid="1-null-12" dnum="c-o:d-i" numlevel="1" lineno="42" slineno="1-18" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1012" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1013" style="1" owner="i" level="1" amendtag="both" space="true">(d)</amend></display>"Material" means the same as that term is defined in Section <xref depth="3" refnumber="76-5c-101">76-5c-101</xref>.</subsection><subsection ssid="1-null-13" dnum="d-o:e-i" numlevel="1" lineno="43" slineno="1-19" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1013" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1014" style="1" owner="i" level="1" amendtag="both" space="true">(e)</amend></display>"Minor" means any person less than 18 years old.</subsection><subsection ssid="1-null-14" dnum="e-o:f-i" numlevel="1" lineno="44" slineno="1-20" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1014" style="2" owner="o" level="1" deltag="both">(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1015" style="1" owner="i" level="1" amendtag="both" space="true">(f)</amend></display>"Objective sensitive material" means an instructional material that constitutes <ln numlevel="1" lineno="45" slineno="1-21"/>pornographic or indecent material, as that term is defined in Section <xref depth="3" refnumber="76-5c-208">76-5c-208</xref>, under <ln numlevel="1" lineno="46" slineno="1-22"/>the non-discretionary standards described in Subsections <xref depth="4" refnumber="76-5c-207(1)(a)(i)(a)">76-5c-207(1)(a)(i)(A)</xref>, (B), <ln numlevel="1" lineno="47" slineno="1-23"/>or (C).</subsection><subsection ssid="1-null-15" dnum="f-o:g-i" numlevel="1" lineno="48" slineno="1-24" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1015" style="2" owner="o" level="1" deltag="both">(f)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="both" space="true">(g)</amend></display>"Public school" means:<subsection ssid="1-null-16" dnum="i-o" numlevel="1" lineno="49" slineno="1-25" level="3"><display>(i)</display>a district school;</subsection><subsection ssid="1-null-17" dnum="ii-o" numlevel="1" lineno="50" slineno="1-26" level="3"><display>(ii)</display>a charter school; or</subsection><subsection ssid="1-null-18" dnum="iii-o" numlevel="1" lineno="51" slineno="1-27" level="3"><display>(iii)</display>the Utah Schools for the Deaf and the Blind.</subsection></subsection><subsection ssid="1-null-19" dnum="g-o:h-i" numlevel="1" lineno="52" slineno="1-28" level="2" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1019" style="2" owner="o" level="1" deltag="both">(g)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1020" style="1" owner="i" level="1" amendtag="both" space="true">(h)</amend></display><subsection ssid="1-null-20" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"School setting" means, for a public school:<subsection ssid="1-null-21" dnum="A-o" numlevel="1" lineno="53" slineno="1-29" level="4" tab="1"><display>(A)</display>in a classroom;</subsection><subsection ssid="1-null-22" dnum="B-o" numlevel="1" lineno="54" slineno="1-30" level="4" tab="1"><display>(B)</display>in a school library; or</subsection><subsection ssid="1-null-23" dnum="C-o" numlevel="1" lineno="55" slineno="1-31" level="4" tab="1"><display>(C)</display>on school property.</subsection></subsection><subsection ssid="1-null-24" dnum="ii-o" numlevel="1" lineno="56" slineno="1-32" level="3"><display>(ii)</display>"School setting" includes the following activities that an organization or <ln numlevel="1" lineno="57" slineno="1-33"/>individual or organization outside of a public school conducts, if a public school <ln numlevel="1" lineno="58" slineno="1-34"/>or an LEA sponsors or requires the activity:<subsection ssid="1-null-25" dnum="A-o" numlevel="1" lineno="59" slineno="1-35" level="4"><display>(A)</display>an assembly;</subsection><subsection ssid="1-null-26" dnum="B-o" numlevel="1" lineno="60" slineno="1-36" level="4"><display>(B)</display>a guest lecture;</subsection><subsection ssid="1-null-27" dnum="C-o" numlevel="1" lineno="61" slineno="1-37" level="4"><display>(C)</display>a live presentation; or</subsection><subsection ssid="1-null-28" dnum="D-o" numlevel="1" lineno="62" slineno="1-38" level="4"><display>(D)</display>an event.</subsection></subsection></subsection><subsection ssid="1-null-29" dnum="h-o:i-i" numlevel="1" lineno="63" slineno="1-39" level="2" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1029" style="2" owner="o" level="1" deltag="both">(h)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1030" style="1" owner="i" level="1" amendtag="both" space="true">(i)</amend></display><subsection ssid="1-null-30" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"Sensitive material" means an instructional material that constitutes <ln numlevel="1" lineno="64" slineno="1-40"/>objective sensitive material or subjective sensitive material.</subsection><subsection ssid="1-null-31" dnum="ii-o" numlevel="1" lineno="65" slineno="1-41" level="3"><display>(ii)</display>"Sensitive material" does not include an instructional material:<subsection ssid="1-null-32" dnum="A-o" numlevel="1" lineno="66" slineno="1-42" level="4"><display>(A)</display>that an LEA selects under Section <xref depth="3" refnumber="53G-10-402">53G-10-402</xref>;</subsection><subsection ssid="1-null-33" dnum="B-o" numlevel="1" lineno="67" slineno="1-43" level="4"><display>(B)</display>for a concurrent enrollment course that contains sensitive material and for <ln numlevel="1" lineno="68" slineno="1-44"/>which a parent receives notice from the course provider of the material before <ln numlevel="1" lineno="69" slineno="1-45"/>enrollment of the parent's child and gives the parent's consent by enrolling the <ln numlevel="1" lineno="70" slineno="1-46"/>parent's child;</subsection><subsection ssid="1-null-34" dnum="C-o" numlevel="1" lineno="71" slineno="1-47" level="4"><display>(C)</display>for medical courses;</subsection><subsection ssid="1-null-35" dnum="D-o" numlevel="1" lineno="72" slineno="1-48" level="4"><display>(D)</display>for family and consumer science courses; or</subsection><subsection ssid="1-null-36" dnum="E-o" numlevel="1" lineno="73" slineno="1-49" level="4"><display>(E)</display>for another course the state board exempts in state board rule.</subsection></subsection><subsection ssid="1-null-37" dnum="iii-o" numlevel="1" lineno="74" slineno="1-50" level="3"><display>(iii)</display>"Subjective sensitive material" means an instructional material that constitutes <ln numlevel="1" lineno="75" slineno="1-51"/>pornographic or indecent material, as that term is defined in Section <xref depth="3" refnumber="76-5c-208">76-5c-208</xref>, <ln numlevel="1" lineno="76" slineno="1-52"/>under the following factor-balancing standards:<subsection ssid="1-null-38" dnum="A-o" numlevel="1" lineno="77" slineno="1-53" level="4"><display>(A)</display>material that is harmful to minors under Section <xref depth="3" refnumber="76-5c-101">76-5c-101</xref>;</subsection><subsection ssid="1-null-39" dnum="B-o" numlevel="1" lineno="78" slineno="1-54" level="4"><display>(B)</display>material that is pornographic under Section <xref depth="3" refnumber="76-5c-101">76-5c-101</xref>; or</subsection><subsection ssid="1-null-40" dnum="C-o" numlevel="1" lineno="79" slineno="1-55" level="4"><display>(C)</display>material that includes certain fondling or other erotic touching under <ln numlevel="1" lineno="80" slineno="1-56"/>Subsection <xref depth="4" refnumber="76-5c-207(1)(a)(i)(d)">76-5c-207(1)(a)(i)(D)</xref>.</subsection></subsection></subsection><subsection ssid="1-253" dnum="_-o:j-i" numlevel="1" lineno="81" slineno="1-57" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1041" style="1" owner="i" level="1" amendtag="start">(j)</amend></display><amend anum="0" ea="amend" pairid="45" groupid="37" style="1" owner="jchristopherson" level="1" amendtag="end">"UETN" means the Utah Education and Telehealth Network, created in Section <xref depth="3" refnumber="53H-4-213.1"><ln numlevel="1" lineno="82" slineno="1-58"/>53H-4-213.1</xref>.</amend></subsection><subsection ssid="1-248" dnum="_-o:k-i" numlevel="1" lineno="83" slineno="1-59" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1042" style="1" owner="i" level="1" amendtag="start">(k)</amend></display><amend anum="0" ea="amend" pairid="15" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="end">"Vendor" means an entity that provides digital instructional material to students in a <ln numlevel="1" lineno="84" slineno="1-60"/>school setting:</amend><subsection ssid="1-250" dnum="_-o:i-i" numlevel="1" lineno="85" slineno="1-61" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1043" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="21" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="end">under contract with a contracting entity; or</amend></subsection><subsection ssid="1-251" dnum="_-o:ii-i" numlevel="1" lineno="86" slineno="1-62" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1044" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="end">through donating the digital instructional material.</amend></subsection></subsection></subsection><subsection ssid="1-null-41" dnum="2-o" numlevel="1" lineno="87" slineno="1-63" level="1" space="false"><display>(2)</display><subsection ssid="1-null-42" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Sensitive materials are prohibited in the school setting.</subsection><subsection ssid="1-null-43" dnum="b-o" numlevel="1" lineno="88" slineno="1-64" level="2"><display>(b)</display>A public school or an LEA may not:<subsection ssid="1-null-44" dnum="i-o" numlevel="1" lineno="89" slineno="1-65" level="3"><display>(i)</display>adopt, use, distribute, provide a student access to, or maintain in the school setting, <ln numlevel="1" lineno="90" slineno="1-66"/>sensitive materials; or</subsection><subsection ssid="1-null-45" dnum="ii-o" numlevel="1" lineno="91" slineno="1-67" level="3"><display>(ii)</display>permit a speaker or presenter in the school setting to display or distribute <ln numlevel="1" lineno="92" slineno="1-68"/>sensitive materials.</subsection></subsection><subsection ssid="1-null-46" dnum="c-o" numlevel="1" lineno="93" slineno="1-69" level="2"><display>(c)</display>In evaluating, selecting, or otherwise considering action related to a given <ln numlevel="1" lineno="94" slineno="1-70"/>instructional material under this section, each public school and each LEA shall <ln numlevel="1" lineno="95" slineno="1-71"/>prioritize protecting children from the harmful effects of illicit pornography over <ln numlevel="1" lineno="96" slineno="1-72"/>other considerations in evaluating instructional material.</subsection><subsection ssid="1-null-47" dnum="d-o" numlevel="1" lineno="97" slineno="1-73" level="2"><display>(d)</display>If an instructional material constitutes objective sensitive material:<subsection ssid="1-null-48" dnum="i-o" numlevel="1" lineno="98" slineno="1-74" level="3"><display>(i)</display>a public school or an LEA is not required to engage in a review under a subjective <ln numlevel="1" lineno="99" slineno="1-75"/>sensitive material standard; and</subsection><subsection ssid="1-null-49" dnum="ii-o" numlevel="1" lineno="100" slineno="1-76" level="3"><display>(ii)</display>the outcome of a subjective sensitive material evaluation has no bearing on the <ln numlevel="1" lineno="101" slineno="1-77"/>non-discretionary objective sensitive material conclusion.</subsection></subsection></subsection><subsection ssid="1-null-50" dnum="3-o" numlevel="1" lineno="102" slineno="1-78" level="1" space="false"><display>(3)</display><subsection ssid="1-null-51" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="53G-10-103(3)(b)">(3)(b)</xref>, the following individuals may initiate a <ln numlevel="1" lineno="103" slineno="1-79"/>sensitive material review under this section:<subsection ssid="1-null-52" dnum="i-o" numlevel="1" lineno="104" slineno="1-80" level="3" tab="1"><display>(i)</display>an employee of the relevant LEA;</subsection><subsection ssid="1-null-53" dnum="ii-o" numlevel="1" lineno="105" slineno="1-81" level="3" tab="1"><display>(ii)</display>a student who is enrolled in the relevant LEA;</subsection><subsection ssid="1-null-54" dnum="iii-o" numlevel="1" lineno="106" slineno="1-82" level="3" tab="1"><display>(iii)</display>a parent of a child who is enrolled in the relevant LEA; or</subsection><subsection ssid="1-null-55" dnum="iv-o" numlevel="1" lineno="107" slineno="1-83" level="3" tab="1"><display>(iv)</display>a member of the relevant LEA governing board.</subsection></subsection><subsection ssid="1-null-56" dnum="b-o" numlevel="1" lineno="108" slineno="1-84" level="2" space="false"><display>(b)</display><subsection ssid="1-null-57" dnum="i-o" level="3" placement="sameline"><display>(i)</display>As used in this Subsection <xref depth="4" refnumber="53G-10-103(3)(b)">(3)(b)</xref>, "unsuccessful challenge" means an allegation <ln numlevel="1" lineno="109" slineno="1-85"/>that a given instructional material constitutes sensitive material that the LEA <ln numlevel="1" lineno="110" slineno="1-86"/>concludes to be erroneous, either on direct review or on appeal to the LEA <ln numlevel="1" lineno="111" slineno="1-87"/>governing board, resulting in the retention of the given instructional material.</subsection><subsection ssid="1-null-58" dnum="ii-o" numlevel="1" lineno="112" slineno="1-88" level="3"><display>(ii)</display>Notwithstanding Subsection <xref depth="4" refnumber="53G-10-103(3)(a)">(3)(a)</xref>, after an individual makes three unsuccessful <ln numlevel="1" lineno="113" slineno="1-89"/>challenges during a given academic year, the individual may not trigger a <ln numlevel="1" lineno="114" slineno="1-90"/>sensitive material review under this section during the remainder of the given <ln numlevel="1" lineno="115" slineno="1-91"/>academic year.</subsection></subsection></subsection><subsection ssid="1-null-59" dnum="4-o" numlevel="1" lineno="116" slineno="1-92" level="1"><display>(4)</display>Upon receipt of an allegation from an individual described in Subsection <xref depth="4" refnumber="53G-10-103(3)(a)">(3)(a)</xref>, an LEA <ln numlevel="1" lineno="117" slineno="1-93"/>shall:<subsection ssid="1-null-60" dnum="a-o" numlevel="1" lineno="118" slineno="1-94" level="2" space="false"><display>(a)</display><subsection ssid="1-null-61" dnum="i-o" level="3" placement="sameline"><display>(i)</display>make an initial determination as to whether the allegation presents a plausible <ln numlevel="1" lineno="119" slineno="1-95"/>claim that the challenged instructional material constitutes sensitive material, <ln numlevel="1" lineno="120" slineno="1-96"/>including whether the allegation includes excerpts and other evidence to support <ln numlevel="1" lineno="121" slineno="1-97"/>the allegation; and</subsection><subsection ssid="1-null-62" dnum="ii-o" numlevel="1" lineno="122" slineno="1-98" level="3"><display>(ii)</display>if the LEA determines that the allegation presents a plausible claim that the <ln numlevel="1" lineno="123" slineno="1-99"/>challenged instructional material constitutes sensitive material under Subsection <xref depth="4" refnumber="53G-10-103(4)(a)(i)"><ln numlevel="1" lineno="124" slineno="1-100"/>(4)(a)(i)</xref>, immediately remove the challenged material from any school setting that <ln numlevel="1" lineno="125" slineno="1-101"/>provides student access to the challenged material until the LEA completes the <ln numlevel="1" lineno="126" slineno="1-102"/>LEA's full review of the challenged material under this section;</subsection></subsection><subsection ssid="1-null-63" dnum="b-o" numlevel="1" lineno="127" slineno="1-103" level="2" space="false"><display>(b)</display><subsection ssid="1-null-64" dnum="i-o" level="3" placement="sameline"><display>(i)</display>engage in a review of the allegations and the challenged instructional material <ln numlevel="1" lineno="128" slineno="1-104"/>using the objective sensitive material standards; and</subsection><subsection ssid="1-null-65" dnum="ii-o" numlevel="1" lineno="129" slineno="1-105" level="3"><display>(ii)</display>if the LEA makes a determination that the challenged instructional material <ln numlevel="1" lineno="130" slineno="1-106"/>constitutes objective sensitive material, ensure that the material remains <ln numlevel="1" lineno="131" slineno="1-107"/>inaccessible to students in any school setting;</subsection></subsection><subsection ssid="1-null-66" dnum="c-o" numlevel="1" lineno="132" slineno="1-108" level="2"><display>(c)</display>only if the LEA makes a determination that the challenged instructional material <ln numlevel="1" lineno="133" slineno="1-109"/>does not constitute objective sensitive material:<subsection ssid="1-null-67" dnum="i-o" numlevel="1" lineno="134" slineno="1-110" level="3"><display>(i)</display>review the allegations and the challenged instructional material under the <ln numlevel="1" lineno="135" slineno="1-111"/>subjective material standards, ensuring that the review includes parents who are <ln numlevel="1" lineno="136" slineno="1-112"/>reflective of the members of the school's community when determining if an <ln numlevel="1" lineno="137" slineno="1-113"/>instructional material is subjective sensitive material;</subsection><subsection ssid="1-null-68" dnum="ii-o" numlevel="1" lineno="138" slineno="1-114" level="3"><display>(ii)</display>allow student access to the challenged instructional material during the LEA's <ln numlevel="1" lineno="139" slineno="1-115"/>subjective sensitive material review if the student's parent gives consent regarding <ln numlevel="1" lineno="140" slineno="1-116"/>the specific challenged instructional material; and</subsection><subsection ssid="1-null-69" dnum="iii-o" numlevel="1" lineno="141" slineno="1-117" level="3"><display>(iii)</display>if the LEA makes a determination that the challenged instructional material <ln numlevel="1" lineno="142" slineno="1-118"/>constitutes subjective sensitive material, ensure that the material is inaccessible to <ln numlevel="1" lineno="143" slineno="1-119"/>students in any school setting, including the termination of the parent consent <ln numlevel="1" lineno="144" slineno="1-120"/>option described in Subsection <xref depth="4" refnumber="53G-10-103(4)(c)(ii)">(4)(c)(ii)</xref>; and</subsection></subsection><subsection ssid="1-null-70" dnum="d-o" numlevel="1" lineno="145" slineno="1-121" level="2"><display>(d)</display>communicate to the state board the allegation and the LEA's final determination <ln numlevel="1" lineno="146" slineno="1-122"/>regarding the allegation and the challenged instructional material.</subsection></subsection><subsection ssid="1-null-71" dnum="5-o" numlevel="1" lineno="147" slineno="1-123" level="1" space="false"><display>(5)</display><subsection ssid="1-null-72" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An individual described in Subsection <xref depth="4" refnumber="53G-10-103(3)(a)">(3)(a)</xref> may appeal an LEA's decision <ln numlevel="1" lineno="148" slineno="1-124"/>regarding a sensitive material review, regardless of whether the LEA removed or <ln numlevel="1" lineno="149" slineno="1-125"/>retained the challenged instructional material, to the LEA governing board.</subsection><subsection ssid="1-null-73" dnum="b-o" numlevel="1" lineno="150" slineno="1-126" level="2"><display>(b)</display>An LEA governing board shall vote in a public board meeting to decide the outcome <ln numlevel="1" lineno="151" slineno="1-127"/>of a sensitive material review appeal, clearly identifying:<subsection ssid="1-null-74" dnum="i-o" numlevel="1" lineno="152" slineno="1-128" level="3"><display>(i)</display>the board's rationale for the decision; and</subsection><subsection ssid="1-null-75" dnum="ii-o" numlevel="1" lineno="153" slineno="1-129" level="3"><display>(ii)</display>the board's determination on each component of the statutory and any additional <ln numlevel="1" lineno="154" slineno="1-130"/>policy standards the board uses to reach the board's conclusions.</subsection></subsection></subsection><subsection ssid="1-null-76" dnum="6-o" numlevel="1" lineno="155" slineno="1-131" level="1"><display>(6)</display>An LEA governing board may not enact rules or policies that prevent the LEA <ln numlevel="1" lineno="156" slineno="1-132"/>governing board from:<subsection ssid="1-null-77" dnum="a-o" numlevel="1" lineno="157" slineno="1-133" level="2"><display>(a)</display>revisiting a previous decision;</subsection><subsection ssid="1-null-78" dnum="b-o" numlevel="1" lineno="158" slineno="1-134" level="2"><display>(b)</display>reviewing a recommendation of LEA personnel or a parent-related committee <ln numlevel="1" lineno="159" slineno="1-135"/>regarding a challenged instructional material; or</subsection><subsection ssid="1-null-79" dnum="c-o" numlevel="1" lineno="160" slineno="1-136" level="2"><display>(c)</display>reconsidering a challenged instructional material if the LEA governing board <ln numlevel="1" lineno="161" slineno="1-137"/>receives additional information regarding the material.</subsection></subsection><subsection ssid="1-null-80" dnum="7-o" numlevel="1" lineno="162" slineno="1-138" level="1" space="false"><display>(7)</display><subsection ssid="1-null-81" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="53G-10-103(7)(d)">(7)(d)</xref>, if the threshold described in Subsection <xref depth="4" refnumber="53G-10-103(7)(b)"><ln numlevel="1" lineno="163" slineno="1-139"/>(7)(b)</xref> is met, each LEA statewide shall remove the relevant instructional material <ln numlevel="1" lineno="164" slineno="1-140"/>from student access.</subsection><subsection ssid="1-null-82" dnum="b-o" numlevel="1" lineno="165" slineno="1-141" level="2"><display>(b)</display>The requirement described in Subsection <xref depth="4" refnumber="53G-10-103(7)(a)">(7)(a)</xref> to remove a given material from <ln numlevel="1" lineno="166" slineno="1-142"/>student access applies if the following number of LEAs makes a determination that a <ln numlevel="1" lineno="167" slineno="1-143"/>given instructional material constitutes objective sensitive material:<subsection ssid="1-null-83" dnum="i-o" numlevel="1" lineno="168" slineno="1-144" level="3"><display>(i)</display>at least three school districts; or</subsection><subsection ssid="1-null-84" dnum="ii-o" numlevel="1" lineno="169" slineno="1-145" level="3"><display>(ii)</display>at least two school districts and five charter schools.</subsection></subsection><subsection ssid="1-null-85" dnum="c-o" numlevel="1" lineno="170" slineno="1-146" level="2"><display>(c)</display>The state board shall:<subsection ssid="1-null-86" dnum="i-o" numlevel="1" lineno="171" slineno="1-147" level="3"><display>(i)</display>aggregate allegations and LEA determinations described in Subsection <xref depth="4" refnumber="53G-10-103(4)(d)">(4)(d)</xref>; and</subsection><subsection ssid="1-null-87" dnum="ii-o" numlevel="1" lineno="172" slineno="1-148" level="3"><display>(ii)</display>no later than 10 school days after the day on which the condition described in <ln numlevel="1" lineno="173" slineno="1-149"/>Subsection <xref depth="4" refnumber="53G-10-103(7)(b)">(7)(b)</xref> occurs, communicate to all LEAs the application of the <ln numlevel="1" lineno="174" slineno="1-150"/>requirement described in Subsection <xref depth="4" refnumber="53G-10-103(7)(a)">(7)(a)</xref> to remove the material from student <ln numlevel="1" lineno="175" slineno="1-151"/>access.</subsection></subsection><subsection ssid="1-null-88" dnum="d-o" numlevel="1" lineno="176" slineno="1-152" level="2" space="false"><display>(d)</display><subsection ssid="1-null-89" dnum="i-o" level="3" placement="sameline"><display>(i)</display>When the threshold described in Subsection <xref depth="4" refnumber="53G-10-103(7)(b)">(7)(b)</xref> is met for a given <ln numlevel="1" lineno="177" slineno="1-153"/>instructional material, in addition to making the communication described in <ln numlevel="1" lineno="178" slineno="1-154"/>Subsection <xref depth="4" refnumber="53G-10-103(7)(c)">(7)(c)</xref>, the state board may:<subsection ssid="1-null-90" dnum="A-o" numlevel="1" lineno="179" slineno="1-155" level="4" tab="1"><display>(A)</display>place the material on the agenda of a public board meeting within 60 days <ln numlevel="1" lineno="180" slineno="1-156"/>after the day on which the state board makes the communication to LEAs <ln numlevel="1" lineno="181" slineno="1-157"/>under Subsection <xref depth="4" refnumber="53G-10-103(7)(c)">(7)(c)</xref>; and</subsection><subsection ssid="1-null-91" dnum="B-o" numlevel="1" lineno="182" slineno="1-158" level="4" tab="1"><display>(B)</display>at the specified state board meeting, vote to overturn the application of the <ln numlevel="1" lineno="183" slineno="1-159"/>requirement described in Subsection <xref depth="4" refnumber="53G-10-103(7)(a)">(7)(a)</xref> to remove a given material from <ln numlevel="1" lineno="184" slineno="1-160"/>student access statewide.</subsection></subsection><subsection ssid="1-null-92" dnum="ii-o" numlevel="1" lineno="185" slineno="1-161" level="3"><display>(ii)</display>If the state board votes to overturn the application of the statewide removal <ln numlevel="1" lineno="186" slineno="1-162"/>requirement described in Subsection <xref depth="4" refnumber="53G-10-103(7)(a)">(7)(a)</xref> under Subsection <xref depth="4" refnumber="53G-10-103(7)(d)(i)">(7)(d)(i)</xref>:<subsection ssid="1-null-93" dnum="A-o" numlevel="1" lineno="187" slineno="1-163" level="4"><display>(A)</display>the statewide removal requirement described in Subsection <xref depth="4" refnumber="53G-10-103(7)(a)">(7)(a)</xref> no longer <ln numlevel="1" lineno="188" slineno="1-164"/>applies;</subsection><subsection ssid="1-null-94" dnum="B-o" numlevel="1" lineno="189" slineno="1-165" level="4"><display>(B)</display>an LEA may choose to return the given material to student access; and</subsection><subsection ssid="1-null-95" dnum="C-o" numlevel="1" lineno="190" slineno="1-166" level="4"><display>(C)</display>nothing affects the findings of an LEA governing board regarding removal of <ln numlevel="1" lineno="191" slineno="1-167"/>the given material within the board's LEA.</subsection></subsection></subsection><subsection ssid="1-246" dnum="_-o:e-i" numlevel="1" lineno="192" slineno="1-168" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1100" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="end">An LEA may not make available for student use an instructional material that has <ln numlevel="1" lineno="193" slineno="1-169"/>been removed statewide through the process described in this Subsection <xref depth="4" refnumber="53G-10-103(7)">(7)</xref>.</amend></subsection><subsection ssid="1-null-96" dnum="e-o:f-i" numlevel="1" lineno="194" slineno="1-170" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1101" style="2" owner="o" level="1" deltag="both">(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1102" style="1" owner="i" level="1" amendtag="both" space="true">(f)</amend></display>This Subsection <xref depth="4" refnumber="53G-10-103(7)">(7)</xref> applies to sensitive materials that LEAs remove from student <ln numlevel="1" lineno="195" slineno="1-171"/>access, regardless of whether:<subsection ssid="1-null-97" dnum="i-o" numlevel="1" lineno="196" slineno="1-172" level="3"><display>(i)</display>the sensitive material determinations occur in the same academic year; or</subsection><subsection ssid="1-null-98" dnum="ii-o" numlevel="1" lineno="197" slineno="1-173" level="3"><display>(ii)</display>a sensitive material determination occurred before July 1, 2024.</subsection></subsection></subsection><subsection ssid="1-244" dnum="_-o:8-i" numlevel="1" lineno="198" slineno="1-174" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1104" style="1" owner="i" level="1" amendtag="start">(8)</amend></display><amend anum="0" ea="amend" pairid="0" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="end">An LEA shall review each instructional material the LEA adds to the LEA's collection <ln numlevel="1" lineno="199" slineno="1-175"/>of instructional materials before making the instructional material available for student <ln numlevel="1" lineno="200" slineno="1-176"/>use to ensure the instructional material does not contain sensitive material.</amend></subsection><subsection ssid="1-null-99" dnum="8-o:9-i" numlevel="1" lineno="201" slineno="1-177" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1105" style="2" owner="o" level="1" deltag="both">(8)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1106" style="1" owner="i" level="1" amendtag="both" space="true">(9)</amend></display>The state board shall:<subsection ssid="1-null-100" dnum="a-o" numlevel="1" lineno="202" slineno="1-178" level="2"><display>(a)</display>in consultation with the Office of the Attorney General, provide guidance and <ln numlevel="1" lineno="203" slineno="1-179"/>training to support public schools in identifying instructional materials that meet the <ln numlevel="1" lineno="204" slineno="1-180"/>definition of sensitive materials under this section;</subsection><subsection ssid="1-null-101" dnum="b-o" numlevel="1" lineno="205" slineno="1-181" level="2"><display>(b)</display>establish a process through which an individual described in Subsection <xref depth="4" refnumber="53G-10-103(3)(a)">(3)(a)</xref> may <ln numlevel="1" lineno="206" slineno="1-182"/>report to the state board an allegation that an LEA is out of compliance with this <ln numlevel="1" lineno="207" slineno="1-183"/>section; and</subsection><subsection ssid="1-null-102" dnum="c-o" numlevel="1" lineno="208" slineno="1-184" level="2"><display>(c)</display>annually report to the Education Interim Committee, at or before the November <ln numlevel="1" lineno="209" slineno="1-185"/>interim meeting, on implementation and compliance with this section, including:<subsection ssid="1-null-103" dnum="i-o" numlevel="1" lineno="210" slineno="1-186" level="3"><display>(i)</display>any policy the state board or an LEA adopts to implement or comply with this <ln numlevel="1" lineno="211" slineno="1-187"/>section;</subsection><subsection ssid="1-null-104" dnum="ii-o" numlevel="1" lineno="212" slineno="1-188" level="3"><display>(ii)</display>any rule the state board makes to implement or comply with this section; and</subsection><subsection ssid="1-null-105" dnum="iii-o" numlevel="1" lineno="213" slineno="1-189" level="3"><display>(iii)</display>any complaints an LEA or the state board receives regarding a violation of this <ln numlevel="1" lineno="214" slineno="1-190"/>section, including:<subsection ssid="1-null-106" dnum="A-o" numlevel="1" lineno="215" slineno="1-191" level="4"><display>(A)</display>action taken in response to a complaint described in this <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="35" groupid="28" style="2" owner="jchristopherson" level="1" deltag="both">Subsection <xref depth="4" refnumber="53G-10-103(8)(c)(iii)">(8)(c)(iii)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="31" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="216" slineno="1-192"/>Subsection <xref depth="4" refnumber="53G-10-103(9)(c)(iii)">(9)(c)(iii)</xref></amend>;</subsection><subsection ssid="1-null-107" dnum="B-o" numlevel="1" lineno="217" slineno="1-193" level="4"><display>(B)</display>if an LEA retains an instructional material for which the LEA or the state <ln numlevel="1" lineno="218" slineno="1-194"/>board receives a complaint, the LEA's rationale for retaining the instructional <ln numlevel="1" lineno="219" slineno="1-195"/>material; and</subsection><subsection ssid="1-null-108" dnum="C-o" numlevel="1" lineno="220" slineno="1-196" level="4"><display>(C)</display>compliance failures that the state board identifies through the reporting <ln numlevel="1" lineno="221" slineno="1-197"/>process described in <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="37" groupid="30" style="2" owner="jchristopherson" level="1" deltag="both">Subsection <xref depth="4" refnumber="53G-10-103(8)(b)">(8)(b)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="33" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Subsection <xref depth="4" refnumber="53G-10-103(9)(b)">(9)(b)</xref></amend> and other <ln numlevel="1" lineno="222" slineno="1-198"/>investigations or research.</subsection></subsection></subsection></subsection><subsection ssid="1-null-109" dnum="9-o:10-i" numlevel="1" lineno="223" slineno="1-199" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1115" style="2" owner="o" level="1" deltag="both">(9)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1116" style="1" owner="i" level="1" amendtag="both" space="true">(10)</amend></display>The state shall defend, indemnify, and hold harmless a person acting under color <ln numlevel="1" lineno="224" slineno="1-200"/>of state law to enforce this section for any claims or damages, including court costs and <ln numlevel="1" lineno="225" slineno="1-201"/>attorney fees, that:<subsection ssid="1-null-110" dnum="a-o" numlevel="1" lineno="226" slineno="1-202" level="2"><display>(a)</display>a person brings or incurs as a result of this section; and</subsection><subsection ssid="1-null-111" dnum="b-o" numlevel="1" lineno="227" slineno="1-203" level="2"><display>(b)</display>is not covered by the person's insurance policies or any coverage agreement that the <ln numlevel="1" lineno="228" slineno="1-204"/>State Risk Management Fund issues.</subsection></subsection><subsection ssid="1-247" dnum="_-o:11-i" numlevel="1" lineno="229" slineno="1-205" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1118" style="1" owner="i" level="1" amendtag="start">(11)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="end">A vendor may not sell or promote goods or services through a digital instructional <ln numlevel="1" lineno="230" slineno="1-206"/>material the vendor provides to a contracting entity.</amend></subsection><subsection ssid="1-null-112" dnum="10-o:12-i" numlevel="1" lineno="231" slineno="1-207" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1119" style="2" owner="o" level="1" deltag="both">(10)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1120" style="1" owner="i" level="1" amendtag="both" space="true">(12)</amend></display>Subject to prioritization of the Audit Subcommittee created in Section <xref depth="3" refnumber="36-12-8">36-12-8</xref>, <ln numlevel="1" lineno="232" slineno="1-208"/>the Office of the Legislative Auditor General shall:<subsection ssid="1-null-113" dnum="a-o" numlevel="1" lineno="233" slineno="1-209" level="2"><display>(a)</display>conduct an audit of each school district's compliance with this section, ensuring the <ln numlevel="1" lineno="234" slineno="1-210"/>completion of all school district audits before November 2028; and</subsection><subsection ssid="1-null-114" dnum="b-o" numlevel="1" lineno="235" slineno="1-211" level="2"><display>(b)</display>annually report to the Education Interim Committee regarding completed sensitive <ln numlevel="1" lineno="236" slineno="1-212"/>material audits under this <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="39" groupid="32" style="2" owner="jchristopherson" level="1" deltag="both">Subsection <xref depth="4" refnumber="53G-10-103(10)">(10)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="34" groupid="27" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Subsection <xref depth="4" refnumber="53G-10-103(12)">(12)</xref></amend>.</subsection></subsection></section></bsec><bsec buid="11" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="237" slineno="2-1" sn="2"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="237">Section 2.  <bold>Effective Date.</bold></secline><sectionText lineno="238"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="7/1/2026">July 1, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-12-26 8:35 AM</tm></rev></foot></leg>
