Abbott</sponsorhead><otherSponsorhead>Senate Sponsor: Todd Weiler</otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill amends provisions related to competency evaluations.</gd><hphead lineno="6">Highlighted Provisions:</hphead><hp numlevel="1" lineno="7" slineno="0-7">This bill:<hl numlevel="1" lineno="8" slineno="0-8" level="1">requires that when a court orders two competency evaluations, the evaluations must be <ln numlevel="1" lineno="9" slineno="0-9"/>ordered in the same order; </hl><hl numlevel="1" lineno="10" slineno="0-10" level="1">provides that a court may order the Department of Health and Human Services to conduct <ln numlevel="1" lineno="11" slineno="0-11"/>additional or updated competency evaluations under certain circumstances;</hl><hl numlevel="1" lineno="12" slineno="0-12" level="1">permits a defendant to be transferred to a clinical or inpatient setting for a competency <ln numlevel="1" lineno="13" slineno="0-13"/>evaluation;</hl><hl numlevel="1" lineno="14" slineno="0-14" level="1">clarifies that certain provisions do not apply to progress toward competency evaluations;</hl><hl numlevel="1" lineno="15" slineno="0-15" level="1">amends a provision related to a report of a progress toward competency evaluation; </hl><hl numlevel="1" lineno="16" slineno="0-16" level="1">provides for the portability of an involuntary medication order when an individual is <ln numlevel="1" lineno="17" slineno="0-17"/>transferred between facilities; </hl><hl numlevel="1" lineno="18" slineno="0-18" level="1">defines terms; and</hl><hl numlevel="1" lineno="19" slineno="0-19" level="1">makes technical and conforming changes.</hl></hp><moni numlevel="1" lineno="20" slineno="0-20" display="none">Money Appropriated in this Bill:</moni><moniNone lineno="21">None</moniNone><oc numlevel="1" lineno="22" slineno="0-22">Other Special Clauses:</oc><ocNone lineno="23">None</ocNone><sa numlevel="1" lineno="24" slineno="0-24">Utah Code Sections Affected:<saamd numlevel="1" lineno="25" slineno="0-25"><snhead>AMENDS:</snhead><sn num="77-15-5" src="code" uid="C77-15-S5_2026050620260506" buid="2" sort="77 15 00050020260506" numlevel="1" lineno="26" slineno="0-26"><bold>77-15-5</bold>, as last amended by Laws of Utah 2025, Chapter 46</sn><sn num="77-15-6" src="code" uid="C77-15-S6_2026050620260506" buid="3" sort="77 15 00060020260506" numlevel="1" lineno="27" slineno="0-27"><bold>77-15-6</bold>, as last amended by Laws of Utah 2025, Chapter 46</sn></saamd><saent numlevel="1" lineno="28" slineno="0-28"><snhead>ENACTS:</snhead><sn num="77-15-10" src="code" uid="C77-15-S10_2026050620260506" buid="8" sort="77 15 00100020260506" numlevel="1" lineno="29" slineno="0-29"><bold>77-15-10</bold>, Utah Code Annotated 1953</sn></saent></sa></lt><enacthead lineno="30"/><enact numlevel="1" lineno="31" slineno="0-31">Be it enacted by the Legislature of the state of Utah:</enact><bdy><bsec buid="2" num="77-15-5" type="amend" src="code" uid="C77-15-S5_2026050620260506" sort="77 15 00050020260506" numlevel="1" lineno="32" slineno="1-1" sn="1"><section number="77-15-5" numlevel="1" lineno="33" slineno="1-2" type="amend"><secline lineno="32">Section 1. Section <bold>77-15-5</bold> is amended to read:</secline><catline lineno="33"><bold>77-15-5<parens/>. Order for hearing -- Stay of other proceedings -- Examinations of <ln numlevel="1" lineno="34" slineno="1-3"/>defendant -- Scope of examination and report.</bold></catline><subsection ssid="2-null-1" dnum="1-o" numlevel="1" lineno="35" slineno="1-4" level="1" placement="noreturn"><display>(1)</display>A court in which criminal proceedings are pending shall stay all criminal proceedings, if:<subsection ssid="2-null-2" dnum="a-o" numlevel="1" lineno="36" slineno="1-5" level="2"><display>(a)</display>a petition is filed under Section <xref depth="3" refnumber="77-15-3" start="0">77-15-3</xref> or <xref depth="3" refnumber="77-15-3.5" start="0">77-15-3.5</xref>; or</subsection><subsection ssid="2-null-3" dnum="b-o" numlevel="1" lineno="37" slineno="1-6" level="2"><display>(b)</display>the court raises the issue of the defendant's competency under Section <xref depth="3" refnumber="77-15-4" start="0">77-15-4</xref>.</subsection></subsection><subsection ssid="2-null-4" dnum="2-o" numlevel="1" lineno="38" slineno="1-7" level="1"><display>(2)</display>The court in which the petition described in Subsection <xref depth="4" refnumber="77-15-5(1)(a)" start="0">(1)(a)</xref> is filed:<subsection ssid="2-null-5" dnum="a-o" numlevel="1" lineno="39" slineno="1-8" level="2"><display>(a)</display>shall inform the court in which criminal proceedings are pending of the petition, if <ln numlevel="1" lineno="40" slineno="1-9"/>the petition is not filed in the court in which criminal proceedings are pending;</subsection><subsection ssid="2-null-6" dnum="b-o" numlevel="1" lineno="41" slineno="1-10" level="2"><display>(b)</display>shall review the allegations of incompetency;</subsection><subsection ssid="2-null-7" dnum="c-o" numlevel="1" lineno="42" slineno="1-11" level="2"><display>(c)</display>may hold a limited hearing solely for the purpose of determining the sufficiency of <ln numlevel="1" lineno="43" slineno="1-12"/>the petition, if the court finds the petition is not clearly sufficient on its face;</subsection><subsection ssid="2-null-8" dnum="d-o" numlevel="1" lineno="44" slineno="1-13" level="2"><display>(d)</display>shall hold a hearing, if the petition is opposed by either party; and</subsection><subsection ssid="2-null-9" dnum="e-o" numlevel="1" lineno="45" slineno="1-14" level="2"><display>(e)</display>may not order an examination of the defendant or order a hearing on the mental <ln numlevel="1" lineno="46" slineno="1-15"/>condition of the defendant unless the court finds that the allegations in the petition <ln numlevel="1" lineno="47" slineno="1-16"/>raise a bona fide doubt as to the defendant's competency to stand trial.</subsection></subsection><subsection ssid="2-null-10" dnum="3-o" numlevel="1" lineno="48" slineno="1-17" level="1" space="false"><display>(3)</display><subsection ssid="2-null-11" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="2-118" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1" placement="sameline"><display><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>If the court finds that there is a bona fide doubt as to the defendant's <ln numlevel="1" lineno="49" slineno="1-18"/>competency to stand trial, the court shall order the department to have one or two <ln numlevel="1" lineno="50" slineno="1-19"/>forensic evaluators complete a competency evaluation for the defendant in <ln numlevel="1" lineno="51" slineno="1-20"/>accordance with Subsection <xref depth="4" refnumber="77-15-5(3)(b)" start="0">(3)(b)</xref> and provide a report to the court regarding the <ln numlevel="1" lineno="52" slineno="1-21"/>competency of the defendant to stand trial.</subsection><subsection ssid="2-119" dnum="_-o:ii-i" numlevel="1" lineno="53" slineno="1-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1012" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="21" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="end">If the court orders two competency evaluations, the competency evaluations must <ln numlevel="1" lineno="54" slineno="1-23"/>be ordered in the same order.</amend></subsection></subsection><subsection ssid="2-null-12" dnum="b-o" numlevel="1" lineno="55" slineno="1-24" level="2"><display>(b)</display>The court shall order the department to have the defendant evaluated by one forensic <ln numlevel="1" lineno="56" slineno="1-25"/>evaluator unless:<subsection ssid="2-null-13" dnum="i-o" numlevel="1" lineno="57" slineno="1-26" level="3"><display>(i)</display>the defendant is charged with a capital felony; or</subsection><subsection ssid="2-null-14" dnum="ii-o" numlevel="1" lineno="58" slineno="1-27" level="3"><display>(ii)</display>the defendant is charged with a felony that is not a capital felony, and the court <ln numlevel="1" lineno="59" slineno="1-28"/>determines, based on the allegations in the petition, that good cause exists to order <ln numlevel="1" lineno="60" slineno="1-29"/>two competency evaluations.</subsection></subsection><subsection ssid="2-null-15" dnum="c-o" numlevel="1" lineno="61" slineno="1-30" level="2" space="false"><display>(c)</display><subsection ssid="2-null-16" dnum="i-o" level="3" placement="sameline"><display>(i)</display>This section does not prohibit a party from seeking an additional forensic <ln numlevel="1" lineno="62" slineno="1-31"/>evaluator to conduct a competency evaluation of the defendant.</subsection><subsection ssid="2-null-17" dnum="ii-o" numlevel="1" lineno="63" slineno="1-32" level="3"><display>(ii)</display>If a party seeks an additional competency evaluation under this Subsection <xref depth="4" refnumber="77-15-5(3)(c)" start="0">(3)(c)</xref>, <ln numlevel="1" lineno="64" slineno="1-33"/>the party shall:<subsection ssid="2-null-18" dnum="A-o" numlevel="1" lineno="65" slineno="1-34" level="4"><display>(A)</display>select the additional forensic evaluator; and</subsection><subsection ssid="2-null-19" dnum="B-o" numlevel="1" lineno="66" slineno="1-35" level="4"><display>(B)</display>pay the costs of the additional forensic evaluator.</subsection></subsection></subsection><subsection ssid="2-121" dnum="_-o:d-i" numlevel="1" lineno="67" slineno="1-36" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1021" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><subsection ssid="2-122" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1022" style="1" owner="i" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="36" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="end">After the court receives the reports of all evaluations ordered under this <ln numlevel="1" lineno="68" slineno="1-37"/>Subsection <xref depth="4" refnumber="77-15-5(3)">(3)</xref>, the court may order the department to conduct an additional <ln numlevel="1" lineno="69" slineno="1-38"/>evaluation or an updated evaluation:</amend><subsection ssid="2-124" dnum="_-o:A-i" numlevel="1" lineno="70" slineno="1-39" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1023" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="54" groupid="39" style="1" owner="jchristopherson" level="1" amendtag="end">upon motion of a party or the court's own motion; and</amend></subsection><subsection ssid="2-128" dnum="_-o:B-i" numlevel="1" lineno="71" slineno="1-40" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1024" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="69" groupid="50" style="1" owner="jchristopherson" level="1" amendtag="end">if the court finds good cause based on:</amend><subsection ssid="2-129" dnum="_-o:I-i" numlevel="1" lineno="72" slineno="1-41" ea="amend" anum="0" owner="jchristopherson" style="1" level="5"><display><amend anum="0" ea="amend" pairid="1025" style="1" owner="i" level="1" amendtag="start">(I)</amend></display><amend anum="0" ea="amend" pairid="75" groupid="55" style="1" owner="jchristopherson" level="1" amendtag="end">a change in circumstances; or</amend></subsection><subsection ssid="2-130" dnum="_-o:II-i" numlevel="1" lineno="73" slineno="1-42" ea="amend" anum="0" owner="jchristopherson" style="1" level="5"><display><amend anum="0" ea="amend" pairid="1026" style="1" owner="i" level="1" amendtag="start">(II)</amend></display><amend anum="0" ea="amend" pairid="80" groupid="59" style="1" owner="jchristopherson" level="1" amendtag="end">the receipt of new information that was not previously considered and that <ln numlevel="1" lineno="74" slineno="1-43"/>could materially affect the determination of the defendant's competency to <ln numlevel="1" lineno="75" slineno="1-44"/>stand trial.</amend></subsection></subsection></subsection><subsection ssid="2-131" dnum="_-o:ii-i" numlevel="1" lineno="76" slineno="1-45" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1027" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="85" groupid="63" style="1" owner="jchristopherson" level="1" amendtag="end">An additional or updated evaluation that the department conducts as ordered by <ln numlevel="1" lineno="77" slineno="1-46"/>the court as described in Subsection <xref depth="4" refnumber="77-15-5(3)(d)(i)">(3)(d)(i)</xref>, may, at the discretion of the <ln numlevel="1" lineno="78" slineno="1-47"/>department, be limited to addressing the change in circumstances or new <ln numlevel="1" lineno="79" slineno="1-48"/>information described in Subsection <xref depth="4" refnumber="77-15-5(3)(d)(i)(b)(ii)">(3)(d)(i)(B)(II)</xref>.</amend></subsection><subsection ssid="2-132" dnum="_-o:iii-i" numlevel="1" lineno="80" slineno="1-49" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1028" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="98" groupid="67" style="1" owner="jchristopherson" level="1" amendtag="end">This Subsection <xref depth="4" refnumber="77-15-5(3)(d)">(3)(d)</xref> does not prohibit or limit a party from seeking an <ln numlevel="1" lineno="81" slineno="1-50"/>additional competency evaluation under Subsection <xref depth="4" refnumber="77-15-5(3)(c)">(3)(c)</xref> or Subsection <xref depth="4" refnumber="77-15-5(11)">(11)</xref>.</amend></subsection></subsection><subsection ssid="2-null-20" dnum="d-o:e-i" numlevel="1" lineno="82" slineno="1-51" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1029" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1030" style="1" owner="i" level="1" amendtag="both" space="true">(e)</amend></display>The stipulation by parties to a bona fide doubt as to the defendant's competency <ln numlevel="1" lineno="83" slineno="1-52"/>to stand trial alone may not take the place of a competency evaluation ordered under <ln numlevel="1" lineno="84" slineno="1-53"/>this Subsection <xref depth="4" refnumber="77-15-5(3)" start="0">(3)</xref>.</subsection><subsection ssid="2-null-21" dnum="e-o:f-i" numlevel="1" lineno="85" slineno="1-54" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1030" style="2" owner="o" level="1" deltag="both">(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1031" style="1" owner="i" level="1" amendtag="both" space="true">(f)</amend></display>In accordance with state licensing laws, the court may only order the department <ln numlevel="1" lineno="86" slineno="1-55"/>to provide an initial evaluation and progress toward competency evaluation for a <ln numlevel="1" lineno="87" slineno="1-56"/>defendant who is located within the state.</subsection></subsection><subsection ssid="2-null-22" dnum="4-o" numlevel="1" lineno="88" slineno="1-57" level="1" space="false"><display>(4)</display><subsection ssid="2-null-23" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If the petition or other information sufficiently raises concerns that the defendant <ln numlevel="1" lineno="89" slineno="1-58"/>may have an intellectual disability, at least one forensic evaluator who is experienced <ln numlevel="1" lineno="90" slineno="1-59"/>in assessments of intellectual disabilities shall conduct a competency evaluation.</subsection><subsection ssid="2-null-24" dnum="b-o" numlevel="1" lineno="91" slineno="1-60" level="2"><display>(b)</display>The petitioner or other party, as directed by the court or requested by the department, <ln numlevel="1" lineno="92" slineno="1-61"/>shall provide to the forensic evaluator nonmedical information and materials relevant <ln numlevel="1" lineno="93" slineno="1-62"/>to a determination of the defendant's competency, including the charging document, <ln numlevel="1" lineno="94" slineno="1-63"/>arrest or incident reports pertaining to the charged offense, known criminal history <ln numlevel="1" lineno="95" slineno="1-64"/>information, and known prior mental health evaluations and treatments.</subsection><subsection ssid="2-null-25" dnum="c-o" numlevel="1" lineno="96" slineno="1-65" level="2"><display>(c)</display>For purposes of a competency evaluation, a custodian of mental health records <ln numlevel="1" lineno="97" slineno="1-66"/>pertaining to the defendant, including the defendant's prior mental health evaluations <ln numlevel="1" lineno="98" slineno="1-67"/>or records relating to the defendant's substance use disorder, may provide the records <ln numlevel="1" lineno="99" slineno="1-68"/>to:<subsection ssid="2-null-26" dnum="i-o" numlevel="1" lineno="100" slineno="1-69" level="3"><display>(i)</display>with the defendant's consent, a forensic evaluator or the department on the <ln numlevel="1" lineno="101" slineno="1-70"/>department's request; or</subsection><subsection ssid="2-null-27" dnum="ii-o" numlevel="1" lineno="102" slineno="1-71" level="3"><display>(ii)</display>a forensic evaluator by court order.</subsection></subsection><subsection ssid="2-null-28" dnum="d-o" numlevel="1" lineno="103" slineno="1-72" level="2"><display>(d)</display>A court order under Subsection <xref depth="4" refnumber="77-15-5(4)(c)" start="0">(4)(c)</xref> shall include a protective order that expires <ln numlevel="1" lineno="104" slineno="1-73"/>180 days after the day on which:<subsection ssid="2-null-29" dnum="i-o" numlevel="1" lineno="105" slineno="1-74" level="3"><display>(i)</display>the defendant is found guilty;</subsection><subsection ssid="2-null-30" dnum="ii-o" numlevel="1" lineno="106" slineno="1-75" level="3"><display>(ii)</display>the defendant enters a guilty plea;</subsection><subsection ssid="2-null-31" dnum="iii-o" numlevel="1" lineno="107" slineno="1-76" level="3"><display>(iii)</display>the court sentences the defendant; or</subsection><subsection ssid="2-null-32" dnum="iv-o" numlevel="1" lineno="108" slineno="1-77" level="3"><display>(iv)</display>if the case is appealed, the day on which the final appeal is resolved.</subsection></subsection><subsection ssid="2-null-33" dnum="e-o" numlevel="1" lineno="109" slineno="1-78" level="2" space="false"><display>(e)</display><subsection ssid="2-null-34" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Except as otherwise provided by law and in Subsections <xref depth="4" refnumber="77-15-5(4)(e)(ii)" start="0">(4)(e)(ii)</xref> and <xref depth="4" refnumber="77-15-5(4)(f)" start="0">(4)(f)</xref>, <ln numlevel="1" lineno="110" slineno="1-79"/>the court shall order the forensic evaluator to destroy all records subject to the <ln numlevel="1" lineno="111" slineno="1-80"/>protective order within the 180 day period described in Subsection <xref depth="4" refnumber="77-15-5(4)(d)" start="0">(4)(d)</xref>.</subsection><subsection ssid="2-null-35" dnum="ii-o" numlevel="1" lineno="112" slineno="1-81" level="3"><display>(ii)</display>A forensic evaluator is not required to destroy the records subject to the <ln numlevel="1" lineno="113" slineno="1-82"/>protective order if destroying the records is a violation of ethical standards to <ln numlevel="1" lineno="114" slineno="1-83"/>which the forensic evaluator is subject for occupational licensing.</subsection></subsection><subsection ssid="2-null-36" dnum="f-o" numlevel="1" lineno="115" slineno="1-84" level="2"><display>(f)</display>The court may extend the protective order described in Subsection <xref depth="4" refnumber="77-15-5(4)(d)" start="0">(4)(d)</xref> if:<subsection ssid="2-null-37" dnum="i-o" numlevel="1" lineno="116" slineno="1-85" level="3"><display>(i)</display>the court finds the defendant incompetent to proceed without a substantial <ln numlevel="1" lineno="117" slineno="1-86"/>probability that the defendant will become competent in the foreseeable future;</subsection><subsection ssid="2-null-38" dnum="ii-o" numlevel="1" lineno="118" slineno="1-87" level="3"><display>(ii)</display>the prosecutor or another individual indicates to the court that the prosecutor or <ln numlevel="1" lineno="119" slineno="1-88"/>other individual will seek civil commitment of the defendant under Section <xref depth="3" refnumber="77-15-6" start="0"><ln numlevel="1" lineno="120" slineno="1-89"/>77-15-6</xref>; and</subsection><subsection ssid="2-null-39" dnum="iii-o" numlevel="1" lineno="121" slineno="1-90" level="3"><display>(iii)</display>the court orders the records be maintained and used only for the purposes of <ln numlevel="1" lineno="122" slineno="1-91"/>examining the defendant in connection with the petition for civil commitment.</subsection></subsection><subsection ssid="2-null-40" dnum="g-o" numlevel="1" lineno="123" slineno="1-92" level="2"><display>(g)</display>An order for a competency evaluation may not contain an order for any other inquiry <ln numlevel="1" lineno="124" slineno="1-93"/>into the mental state of the defendant that is not described in this Subsection <xref depth="4" refnumber="77-15-5(4)" start="0">(4)</xref>.</subsection></subsection><subsection ssid="2-null-41" dnum="5-o" numlevel="1" lineno="125" slineno="1-94" level="1" space="false"><display>(5)</display><subsection ssid="2-114" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1051" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>Pending a competency evaluation, unless the court or the department directs <ln numlevel="1" lineno="126" slineno="1-95"/>otherwise, the defendant shall be retained in the same custody or status that the <ln numlevel="1" lineno="127" slineno="1-96"/>defendant was in at the time the examination was ordered.</subsection><subsection ssid="2-115" dnum="_-o:b-i" numlevel="1" lineno="128" slineno="1-97" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1052" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="end">If clinically appropriate, based on the department's recommendation and request, the <ln numlevel="1" lineno="129" slineno="1-98"/>defendant may be transferred to a clinical or inpatient setting temporarily for the <ln numlevel="1" lineno="130" slineno="1-99"/>purpose of the competency evaluation.</amend></subsection><subsection ssid="2-133" dnum="_-o:c-i" numlevel="1" lineno="131" slineno="1-100" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1053" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="102" groupid="70" style="1" owner="jchristopherson" level="1" amendtag="end">If the department transfers the defendant as described Subsection <xref depth="4" refnumber="77-15-5(5)(b)">(5)(b)</xref>, the <ln numlevel="1" lineno="132" slineno="1-101"/>department shall provide notice of the transfer to the court and the parties.</amend></subsection></subsection><subsection ssid="2-null-42" dnum="6-o" numlevel="1" lineno="133" slineno="1-102" level="1"><display>(6)</display>In the conduct of a competency evaluation and in a report to the court, a forensic <ln numlevel="1" lineno="134" slineno="1-103"/>evaluator shall consider and address, in addition to any other factors determined to be <ln numlevel="1" lineno="135" slineno="1-104"/>relevant by the forensic evaluator:<subsection ssid="2-null-43" dnum="a-o" numlevel="1" lineno="136" slineno="1-105" level="2"><display>(a)</display>the impact of the defendant's mental illness or intellectual disability on the <ln numlevel="1" lineno="137" slineno="1-106"/>defendant's present ability to:<subsection ssid="2-null-44" dnum="i-o" numlevel="1" lineno="138" slineno="1-107" level="3"><display>(i)</display>rationally and factually understand the criminal proceedings against the defendant; <ln numlevel="1" lineno="139" slineno="1-108"/>and</subsection><subsection ssid="2-null-45" dnum="ii-o" numlevel="1" lineno="140" slineno="1-109" level="3"><display>(ii)</display>consult with the defendant's legal counsel with a reasonable degree of rational <ln numlevel="1" lineno="141" slineno="1-110"/>understanding in order to assist in the defense;</subsection></subsection><subsection ssid="2-null-46" dnum="b-o" numlevel="1" lineno="142" slineno="1-111" level="2"><display>(b)</display>in making the determinations described in Subsection <xref depth="4" refnumber="77-15-5(6)(a)" start="0">(6)(a)</xref>, the forensic evaluator <ln numlevel="1" lineno="143" slineno="1-112"/>shall consider, as applicable the defendant's present ability to:<subsection ssid="2-null-47" dnum="i-o" numlevel="1" lineno="144" slineno="1-113" level="3"><display>(i)</display>understand the charges or allegations against the defendant;</subsection><subsection ssid="2-null-48" dnum="ii-o" numlevel="1" lineno="145" slineno="1-114" level="3"><display>(ii)</display>communicate facts, events, and states of mind;</subsection><subsection ssid="2-null-49" dnum="iii-o" numlevel="1" lineno="146" slineno="1-115" level="3"><display>(iii)</display>understand the range of possible penalties associated with the charges or <ln numlevel="1" lineno="147" slineno="1-116"/>allegations against the defendant;</subsection><subsection ssid="2-null-50" dnum="iv-o" numlevel="1" lineno="148" slineno="1-117" level="3"><display>(iv)</display>engage in reasoned choice of legal strategies and options;</subsection><subsection ssid="2-null-51" dnum="v-o" numlevel="1" lineno="149" slineno="1-118" level="3"><display>(v)</display>understand the adversarial nature of the proceedings against the defendant;</subsection><subsection ssid="2-null-52" dnum="vi-o" numlevel="1" lineno="150" slineno="1-119" level="3"><display>(vi)</display>manifest behavior sufficient to allow the court to proceed; and</subsection><subsection ssid="2-null-53" dnum="vii-o" numlevel="1" lineno="151" slineno="1-120" level="3"><display>(vii)</display>testify relevantly, if applicable; and</subsection></subsection><subsection ssid="2-null-54" dnum="c-o" numlevel="1" lineno="152" slineno="1-121" level="2"><display>(c)</display>whether the defendant is exhibiting false or exaggerated physical or psychological <ln numlevel="1" lineno="153" slineno="1-122"/>symptoms relevant to the defendant's capacity to stand trial.</subsection></subsection><subsection ssid="2-null-55" dnum="7-o" numlevel="1" lineno="154" slineno="1-123" level="1"><display>(7)</display>Upon a determination that the defendant is incompetent to proceed, the forensic <ln numlevel="1" lineno="155" slineno="1-124"/>evaluator shall indicate in the report to the court:<subsection ssid="2-null-56" dnum="a-o" numlevel="1" lineno="156" slineno="1-125" level="2"><display>(a)</display>the factors that contribute to the defendant's incompetency, including the nature of <ln numlevel="1" lineno="157" slineno="1-126"/>the defendant's mental illness or intellectual disability, if any, and its relationship to <ln numlevel="1" lineno="158" slineno="1-127"/>the factors contributing to the defendant's incompetency;</subsection><subsection ssid="2-null-57" dnum="b-o" numlevel="1" lineno="159" slineno="1-128" level="2"><display>(b)</display>whether there is a substantial probability that:<subsection ssid="2-null-58" dnum="i-o" numlevel="1" lineno="160" slineno="1-129" level="3"><display>(i)</display>restoration treatment may bring the defendant to competency to stand trial in the <ln numlevel="1" lineno="161" slineno="1-130"/>foreseeable future; or</subsection><subsection ssid="2-null-59" dnum="ii-o" numlevel="1" lineno="162" slineno="1-131" level="3"><display>(ii)</display>the defendant cannot become competent to stand trial in the foreseeable future;</subsection></subsection><subsection ssid="2-null-60" dnum="c-o" numlevel="1" lineno="163" slineno="1-132" level="2"><display>(c)</display>whether the defendant would benefit from restoration treatment; and</subsection><subsection ssid="2-null-61" dnum="d-o" numlevel="1" lineno="164" slineno="1-133" level="2"><display>(d)</display>if the forensic evaluator makes the determination under Subsection <xref depth="4" refnumber="77-15-5(7)(b)(i)" start="0">(7)(b)(i)</xref> or <xref depth="4" refnumber="77-15-5(7)(c)" start="0">(7)(c)</xref>, <ln numlevel="1" lineno="165" slineno="1-134"/>an explanation of the reason for the determination and a summary of the treatment <ln numlevel="1" lineno="166" slineno="1-135"/>provided to the defendant in the past.</subsection></subsection><subsection ssid="2-null-62" dnum="8-o" numlevel="1" lineno="167" slineno="1-136" level="1" space="false"><display>(8)</display><subsection ssid="2-null-63" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A forensic evaluator shall provide an initial report to the court and the prosecuting <ln numlevel="1" lineno="168" slineno="1-137"/>and defense attorneys within 30 days of the receipt of the court's order.  The report <ln numlevel="1" lineno="169" slineno="1-138"/>shall inform the court of the examiner's opinion concerning the competency of the <ln numlevel="1" lineno="170" slineno="1-139"/>defendant to stand trial.</subsection><subsection ssid="2-null-64" dnum="b-o" numlevel="1" lineno="171" slineno="1-140" level="2" space="false"><display>(b)</display><subsection ssid="2-null-65" dnum="i-o" level="3" placement="sameline"><display>(i)</display>If the forensic evaluator is unable to complete the report in the time specified in <ln numlevel="1" lineno="172" slineno="1-141"/>Subsection <xref depth="4" refnumber="77-15-5(8)(a)" start="0">(8)(a)</xref>, the forensic evaluator shall give written notice to the court.</subsection><subsection ssid="2-null-66" dnum="ii-o" numlevel="1" lineno="173" slineno="1-142" level="3"><display>(ii)</display>A forensic evaluator who provides the notice described in Subsection <xref depth="4" refnumber="77-15-5(8)(b)(i)" start="0">(8)(b)(i)</xref> <ln numlevel="1" lineno="174" slineno="1-143"/>shall receive a 15-day extension, giving the forensic evaluator a total of 45 days <ln numlevel="1" lineno="175" slineno="1-144"/>after the day on which the forensic evaluator received the court's order to conduct <ln numlevel="1" lineno="176" slineno="1-145"/>a competency evaluation and file a report.</subsection><subsection ssid="2-null-67" dnum="iii-o" numlevel="1" lineno="177" slineno="1-146" level="3"><display>(iii)</display>The court may further extend the deadline for completion of the evaluation and <ln numlevel="1" lineno="178" slineno="1-147"/>report if the court determines that there is good cause for the extension.</subsection><subsection ssid="2-null-68" dnum="iv-o" numlevel="1" lineno="179" slineno="1-148" level="3"><display>(iv)</display>Upon receipt of an extension described in Subsection <xref depth="4" refnumber="77-15-5(8)(b)(iii)" start="0">(8)(b)(iii)</xref>, the forensic <ln numlevel="1" lineno="180" slineno="1-149"/>evaluator shall file the report as soon as reasonably possible.</subsection></subsection></subsection><subsection ssid="2-null-69" dnum="9-o" numlevel="1" lineno="181" slineno="1-150" level="1"><display>(9)</display>Any written report submitted by a forensic evaluator shall:<subsection ssid="2-null-70" dnum="a-o" numlevel="1" lineno="182" slineno="1-151" level="2"><display>(a)</display>identify the case ordered for evaluation by the case number;</subsection><subsection ssid="2-null-71" dnum="b-o" numlevel="1" lineno="183" slineno="1-152" level="2"><display>(b)</display>describe the procedures, techniques, and tests used in the examination and the <ln numlevel="1" lineno="184" slineno="1-153"/>purpose or purposes for each, the time spent by the forensic evaluator with the <ln numlevel="1" lineno="185" slineno="1-154"/>defendant for purposes of the examination, and the compensation to be paid to the <ln numlevel="1" lineno="186" slineno="1-155"/>evaluator for the report;</subsection><subsection ssid="2-null-72" dnum="c-o" numlevel="1" lineno="187" slineno="1-156" level="2"><display>(c)</display>state the forensic evaluator's clinical observations, findings, and opinions on each <ln numlevel="1" lineno="188" slineno="1-157"/>factor described in Subsection <xref depth="4" refnumber="77-15-5(6)" start="0">(6)</xref>; and</subsection><subsection ssid="2-null-73" dnum="d-o" numlevel="1" lineno="189" slineno="1-158" level="2"><display>(d)</display>identify the sources of information used by the forensic evaluator and present the <ln numlevel="1" lineno="190" slineno="1-159"/>basis for the forensic evaluator's clinical findings and opinions.</subsection></subsection><subsection ssid="2-null-74" dnum="10-o" numlevel="1" lineno="191" slineno="1-160" level="1" space="false"><display>(10)</display><subsection ssid="2-null-75" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Any statement made by the defendant in the course of any competency <ln numlevel="1" lineno="192" slineno="1-161"/>examination, whether the examination is with or without the consent of the <ln numlevel="1" lineno="193" slineno="1-162"/>defendant, any testimony by a forensic evaluator based upon the statement, and any <ln numlevel="1" lineno="194" slineno="1-163"/>other fruits of the statement may not be admitted in evidence against the defendant in <ln numlevel="1" lineno="195" slineno="1-164"/>any criminal proceeding except on an issue respecting mental condition on which the <ln numlevel="1" lineno="196" slineno="1-165"/>defendant has introduced evidence, unless the evidence is relevant to a determination <ln numlevel="1" lineno="197" slineno="1-166"/>of the defendant's competency.</subsection><subsection ssid="2-null-76" dnum="b-o" numlevel="1" lineno="198" slineno="1-167" level="2"><display>(b)</display>Before examining the defendant, the forensic evaluator shall specifically advise the <ln numlevel="1" lineno="199" slineno="1-168"/>defendant of the limits of confidentiality as provided under Subsection <xref depth="4" refnumber="77-15-5(10)(a)" start="0">(10)(a)</xref>.</subsection></subsection><subsection ssid="2-null-77" dnum="11-o" numlevel="1" lineno="200" slineno="1-169" level="1" space="false"><display>(11)</display><subsection ssid="2-null-78" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Upon receipt of the forensic evaluators' reports, the court shall set a date for a <ln numlevel="1" lineno="201" slineno="1-170"/>competency hearing. The hearing shall be held not less than five and not more than <ln numlevel="1" lineno="202" slineno="1-171"/>15 days after the day on which the court received the forensic evaluators' reports, <ln numlevel="1" lineno="203" slineno="1-172"/>unless for good cause the court sets a later date.</subsection><subsection ssid="2-null-79" dnum="b-o" numlevel="1" lineno="204" slineno="1-173" level="2"><display>(b)</display>Any person directed by the department to conduct the competency evaluation may be <ln numlevel="1" lineno="205" slineno="1-174"/>subpoenaed to testify at the hearing.</subsection><subsection ssid="2-null-80" dnum="c-o" numlevel="1" lineno="206" slineno="1-175" level="2"><display>(c)</display>The court may call any forensic evaluator to testify at the hearing who is not called <ln numlevel="1" lineno="207" slineno="1-176"/>by the parties. If the court calls a forensic evaluator, counsel for the parties may <ln numlevel="1" lineno="208" slineno="1-177"/>cross-examine the forensic evaluator.</subsection><subsection ssid="2-null-81" dnum="d-o" numlevel="1" lineno="209" slineno="1-178" level="2" space="false"><display>(d)</display><subsection ssid="2-null-82" dnum="i-o" level="3" placement="sameline"><display>(i)</display>If the forensic evaluators are in conflict as to the competency of the defendant, <ln numlevel="1" lineno="210" slineno="1-179"/>all forensic evaluators should be called to testify at the hearing if reasonably <ln numlevel="1" lineno="211" slineno="1-180"/>available.</subsection><subsection ssid="2-null-83" dnum="ii-o" numlevel="1" lineno="212" slineno="1-181" level="3"><display>(ii)</display>A conflict in the opinions of the forensic evaluators does not require the <ln numlevel="1" lineno="213" slineno="1-182"/>appointment of an additional forensic evaluator unless the court finds good cause <ln numlevel="1" lineno="214" slineno="1-183"/>for the appointment.</subsection><subsection ssid="2-null-84" dnum="iii-o" numlevel="1" lineno="215" slineno="1-184" level="3"><display>(iii)</display>If a party seeks an additional competency evaluation under this Subsection <xref depth="4" refnumber="77-15-5(11)">(11)</xref>, <ln numlevel="1" lineno="216" slineno="1-185"/>that party shall:<subsection ssid="2-null-85" dnum="A-o" numlevel="1" lineno="217" slineno="1-186" level="4"><display>(A)</display>select the additional forensic evaluator; and</subsection><subsection ssid="2-null-86" dnum="B-o" numlevel="1" lineno="218" slineno="1-187" level="4"><display>(B)</display>pay the costs of the additional forensic evaluator.</subsection></subsection></subsection></subsection><subsection ssid="2-null-87" dnum="12-o" numlevel="1" lineno="219" slineno="1-188" level="1" space="false"><display>(12)</display><subsection ssid="2-null-88" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="2-null-89" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>A defendant shall be presumed competent to stand trial unless the court, by <ln numlevel="1" lineno="220" slineno="1-189"/>a preponderance of the evidence, finds the defendant incompetent to proceed.</subsection><subsection ssid="2-null-90" dnum="ii-o" numlevel="1" lineno="221" slineno="1-190" level="3" tab="1"><display>(ii)</display>The burden of proof is upon the proponent of incompetency at the hearing.</subsection></subsection><subsection ssid="2-null-91" dnum="b-o" numlevel="1" lineno="222" slineno="1-191" level="2"><display>(b)</display>An adjudication of incompetent to proceed does not operate as an adjudication of <ln numlevel="1" lineno="223" slineno="1-192"/>incompetency to give informed consent for medical treatment or for any other <ln numlevel="1" lineno="224" slineno="1-193"/>purpose, unless specifically set forth in the court order.</subsection></subsection><subsection ssid="2-null-92" dnum="13-o" numlevel="1" lineno="225" slineno="1-194" level="1"><display>(13)</display>In determining the defendant's competency to stand trial, the court shall consider the <ln numlevel="1" lineno="226" slineno="1-195"/>totality of the circumstances, including:<subsection ssid="2-null-93" dnum="a-o" numlevel="1" lineno="227" slineno="1-196" level="2"><display>(a)</display>the petition;</subsection><subsection ssid="2-null-94" dnum="b-o" numlevel="1" lineno="228" slineno="1-197" level="2"><display>(b)</display>the defendant's criminal and arrest history;</subsection><subsection ssid="2-null-95" dnum="c-o" numlevel="1" lineno="229" slineno="1-198" level="2"><display>(c)</display>prior mental health evaluations and treatments provided to the court by the defendant;</subsection><subsection ssid="2-null-96" dnum="d-o" numlevel="1" lineno="230" slineno="1-199" level="2"><display>(d)</display>subject to Subsection <xref depth="4" refnumber="77-15-5(15)" start="0">(15)</xref>, whether the defendant was found incompetent to proceed <ln numlevel="1" lineno="231" slineno="1-200"/>in a criminal action unrelated to the charged offense for which the petition is filed;</subsection><subsection ssid="2-null-97" dnum="e-o" numlevel="1" lineno="232" slineno="1-201" level="2"><display>(e)</display>the testimony of lay witnesses, if any;</subsection><subsection ssid="2-null-98" dnum="f-o" numlevel="1" lineno="233" slineno="1-202" level="2"><display>(f)</display>the forensic evaluator's testimony and report;</subsection><subsection ssid="2-null-99" dnum="g-o" numlevel="1" lineno="234" slineno="1-203" level="2"><display>(g)</display>the materials on which the forensic evaluator's report is based; and</subsection><subsection ssid="2-null-100" dnum="h-o" numlevel="1" lineno="235" slineno="1-204" level="2"><display>(h)</display>any other relevant evidence or consideration bearing on the competency of the <ln numlevel="1" lineno="236" slineno="1-205"/>defendant.</subsection></subsection><subsection ssid="2-null-101" dnum="14-o" numlevel="1" lineno="237" slineno="1-206" level="1"><display>(14)</display>If the court finds the defendant incompetent to proceed:<subsection ssid="2-null-102" dnum="a-o" numlevel="1" lineno="238" slineno="1-207" level="2"><display>(a)</display>the court shall issue the order described in Subsection <xref depth="4" refnumber="77-15-6(1)" start="0">77-15-6(1)</xref>, which shall:<subsection ssid="2-null-103" dnum="i-o" numlevel="1" lineno="239" slineno="1-208" level="3"><display>(i)</display>include findings addressing each of the factors in Subsection <xref depth="4" refnumber="77-15-5(6)(a)" start="0">(6)(a)</xref>;</subsection><subsection ssid="2-null-104" dnum="ii-o" numlevel="1" lineno="240" slineno="1-209" level="3"><display>(ii)</display>include a transportation order, if necessary;</subsection><subsection ssid="2-null-105" dnum="iii-o" numlevel="1" lineno="241" slineno="1-210" level="3"><display>(iii)</display>be accompanied by the forensic evaluators' reports, any psychiatric, <ln numlevel="1" lineno="242" slineno="1-211"/>psychological, or social work reports submitted to the court relative to the mental <ln numlevel="1" lineno="243" slineno="1-212"/>condition of the defendant, and any other documents made available to the court <ln numlevel="1" lineno="244" slineno="1-213"/>by either the defense or the prosecution, pertaining to the defendant's current or <ln numlevel="1" lineno="245" slineno="1-214"/>past mental condition; and</subsection><subsection ssid="2-null-106" dnum="iv-o" numlevel="1" lineno="246" slineno="1-215" level="3"><display>(iv)</display>be sent by the court to the department; and</subsection></subsection><subsection ssid="2-null-107" dnum="b-o" numlevel="1" lineno="247" slineno="1-216" level="2"><display>(b)</display>the prosecuting attorney shall provide to the department:<subsection ssid="2-null-108" dnum="i-o" numlevel="1" lineno="248" slineno="1-217" level="3"><display>(i)</display>the charging document and probable cause statement, if any;</subsection><subsection ssid="2-null-109" dnum="ii-o" numlevel="1" lineno="249" slineno="1-218" level="3"><display>(ii)</display>arrest or incident reports prepared by law enforcement and pertaining to the <ln numlevel="1" lineno="250" slineno="1-219"/>charged offense; and</subsection><subsection ssid="2-null-110" dnum="iii-o" numlevel="1" lineno="251" slineno="1-220" level="3"><display>(iii)</display>additional supporting documents.</subsection></subsection></subsection><subsection ssid="2-null-111" dnum="15-o" numlevel="1" lineno="252" slineno="1-221" level="1"><display>(15)</display>The court may not find the defendant incompetent to proceed based solely on a court <ln numlevel="1" lineno="253" slineno="1-222"/>having ordered the release of the defendant under Section <xref depth="3" refnumber="77-15-3.5" start="0">77-15-3.5</xref> or Section <xref depth="3" refnumber="77-15-6" start="0">77-15-6</xref> <ln numlevel="1" lineno="254" slineno="1-223"/>in an unrelated criminal action if the court in the unrelated criminal action ordered the <ln numlevel="1" lineno="255" slineno="1-224"/>release more than one year before the day on which the petition described in Subsection <xref depth="4" refnumber="77-15-5(13)(a)" start="0"><ln numlevel="1" lineno="256" slineno="1-225"/>(13)(a)</xref> is filed.</subsection><subsection ssid="2-null-112" dnum="16-o" numlevel="1" lineno="257" slineno="1-226" level="1"><display>(16)</display>The court may make any reasonable order to ensure compliance with this section.</subsection><subsection ssid="2-null-113" dnum="17-o" numlevel="1" lineno="258" slineno="1-227" level="1"><display>(17)</display>Failure to comply with this section does not result in the dismissal of criminal charges.</subsection><subsection ssid="2-120" dnum="_-o:18-i" numlevel="1" lineno="259" slineno="1-228" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1126" style="1" owner="i" level="1" amendtag="start">(18)</amend></display><amend anum="0" ea="amend" pairid="27" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="end">This section does not apply to progress toward competency evaluations.</amend></subsection></section></bsec><bsec buid="3" num="77-15-6" type="amend" src="code" uid="C77-15-S6_2026050620260506" sort="77 15 00060020260506" numlevel="1" lineno="260" slineno="2-1" sn="2"><section number="77-15-6" numlevel="1" lineno="261" slineno="2-2" type="amend"><secline lineno="260">Section 2. Section <bold>77-15-6</bold> is amended to read:</secline><catline lineno="261"><bold>77-15-6<parens/>. Commitment on finding of incompetency to stand trial -- Subsequent <ln numlevel="1" lineno="262" slineno="2-3"/>hearings -- Notice to prosecuting attorneys.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="263" slineno="2-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="3-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="77-15-6(5)">(5)</xref>, if after a hearing a court finds a defendant to <ln numlevel="1" lineno="264" slineno="2-5"/>be incompetent to proceed, the court shall order the defendant committed to the <ln numlevel="1" lineno="265" slineno="2-6"/>department for restoration treatment.</subsection><subsection ssid="3-null-3" dnum="b-o" numlevel="1" lineno="266" slineno="2-7" level="2" space="false"><display>(b)</display><subsection ssid="3-null-4" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Except as provided in Subsection <xref depth="4" refnumber="77-15-6(1)(b)(ii)">(1)(b)(ii)</xref>, the court may recommend but may <ln numlevel="1" lineno="267" slineno="2-8"/>not order placement of a defendant who is found incompetent to proceed.</subsection><subsection ssid="3-null-5" dnum="ii-o" numlevel="1" lineno="268" slineno="2-9" level="3"><display>(ii)</display>The court may order that the defendant be placed in a secure setting rather than a <ln numlevel="1" lineno="269" slineno="2-10"/>nonsecure setting.</subsection></subsection><subsection ssid="3-null-6" dnum="c-o" numlevel="1" lineno="270" slineno="2-11" level="2"><display>(c)</display>Following restoration screening, the department's designee shall designate and <ln numlevel="1" lineno="271" slineno="2-12"/>inform the court of the specific placement and restoration treatment program for the <ln numlevel="1" lineno="272" slineno="2-13"/>defendant.</subsection><subsection ssid="3-null-7" dnum="d-o" numlevel="1" lineno="273" slineno="2-14" level="2"><display>(d)</display>Restoration treatment shall be of sufficient scope and duration to:<subsection ssid="3-null-8" dnum="i-o" numlevel="1" lineno="274" slineno="2-15" level="3"><display>(i)</display>restore the defendant to competency; or</subsection><subsection ssid="3-null-9" dnum="ii-o" numlevel="1" lineno="275" slineno="2-16" level="3"><display>(ii)</display>determine whether the defendant can be restored to competency in the foreseeable <ln numlevel="1" lineno="276" slineno="2-17"/>future.</subsection></subsection><subsection ssid="3-null-10" dnum="e-o" numlevel="1" lineno="277" slineno="2-18" level="2"><display>(e)</display>A defendant who a court determines is incompetent to proceed may not be held for <ln numlevel="1" lineno="278" slineno="2-19"/>restoration treatment longer than:<subsection ssid="3-null-11" dnum="i-o" numlevel="1" lineno="279" slineno="2-20" level="3"><display>(i)</display>the time reasonably necessary to determine that the defendant cannot become <ln numlevel="1" lineno="280" slineno="2-21"/>competent to stand trial in the foreseeable future; and</subsection><subsection ssid="3-null-12" dnum="ii-o" numlevel="1" lineno="281" slineno="2-22" level="3"><display>(ii)</display>the maximum period of incarceration that the defendant could receive if the <ln numlevel="1" lineno="282" slineno="2-23"/>defendant were convicted of the most severe offense of the offenses charged.</subsection></subsection></subsection><subsection ssid="3-null-13" dnum="2-o" numlevel="1" lineno="283" slineno="2-24" level="1" space="false"><display>(2)</display><subsection ssid="3-null-14" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A defendant who is receiving restoration treatment shall receive a progress toward <ln numlevel="1" lineno="284" slineno="2-25"/>competency evaluation, by:<subsection ssid="3-null-15" dnum="i-o" numlevel="1" lineno="285" slineno="2-26" level="3" tab="1"><display>(i)</display>a forensic evaluator, designated by the department; and</subsection><subsection ssid="3-null-16" dnum="ii-o" numlevel="1" lineno="286" slineno="2-27" level="3" tab="1"><display>(ii)</display>an additional forensic evaluator, if requested by a party and paid for by the <ln numlevel="1" lineno="287" slineno="2-28"/>requesting party.</subsection></subsection><subsection ssid="3-null-17" dnum="b-o" numlevel="1" lineno="288" slineno="2-29" level="2"><display>(b)</display>A forensic evaluator shall complete a progress toward competency evaluation and <ln numlevel="1" lineno="289" slineno="2-30"/>submit a report within 90 days after the day on which the forensic evaluator receives <ln numlevel="1" lineno="290" slineno="2-31"/>the commitment order from the department.</subsection><subsection ssid="3-null-18" dnum="c-o" numlevel="1" lineno="291" slineno="2-32" level="2"><display>(c)</display>The report shall:<subsection ssid="3-null-19" dnum="i-o" numlevel="1" lineno="292" slineno="2-33" level="3"><display>(i)</display>assess whether the defendant is exhibiting false or exaggerated physical or <ln numlevel="1" lineno="293" slineno="2-34"/>psychological symptoms;</subsection><subsection ssid="3-null-20" dnum="ii-o" numlevel="1" lineno="294" slineno="2-35" level="3"><display>(ii)</display>describe any diagnostic instruments, methods, and observations used by the <ln numlevel="1" lineno="295" slineno="2-36"/>evaluator to make the determination;</subsection><subsection ssid="3-null-21" dnum="iii-o" numlevel="1" lineno="296" slineno="2-37" level="3"><display>(iii)</display>describe the defendant's current mental illness or intellectual disability, if any;</subsection><subsection ssid="3-null-22" dnum="iv-o" numlevel="1" lineno="297" slineno="2-38" level="3"><display>(iv)</display>state the forensic evaluator's opinion as to the effect of any false or exaggerated <ln numlevel="1" lineno="298" slineno="2-39"/>symptoms on the defendant's competency to stand trial;</subsection><subsection ssid="3-null-23" dnum="v-o" numlevel="1" lineno="299" slineno="2-40" level="3"><display>(v)</display>assess the facility's or program's capacity to provide appropriate restoration <ln numlevel="1" lineno="300" slineno="2-41"/>treatment for the defendant;</subsection><subsection ssid="3-null-24" dnum="vi-o" numlevel="1" lineno="301" slineno="2-42" level="3"><display>(vi)</display>assess the nature of restoration treatment provided to the defendant;</subsection><subsection ssid="3-null-25" dnum="vii-o" numlevel="1" lineno="302" slineno="2-43" level="3"><display>(vii)</display>assess what progress the defendant has made toward competency restoration, <ln numlevel="1" lineno="303" slineno="2-44"/>with respect to the factors identified by the court in its initial order;</subsection><subsection ssid="3-null-26" dnum="viii-o" numlevel="1" lineno="304" slineno="2-45" level="3"><display>(viii)</display>assess whether the defendant can reasonably be restored to competency in the <ln numlevel="1" lineno="305" slineno="2-46"/>foreseeable future given the restoration treatment currently being provided and the <ln numlevel="1" lineno="306" slineno="2-47"/>facility's or program's capacity to provide appropriate restoration treatment for the <ln numlevel="1" lineno="307" slineno="2-48"/>defendant; <amend anum="0" ea="amend" pairid="7" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="both">and</amend></subsection><subsection ssid="3-null-27" dnum="ix-o" numlevel="1" lineno="308" slineno="2-49" level="3"><display>(ix)</display>assess the likelihood of restoration to competency, the amount of time estimated <ln numlevel="1" lineno="309" slineno="2-50"/>to achieve competency, or the amount of time estimated to determine whether <ln numlevel="1" lineno="310" slineno="2-51"/>restoration to competency may be achieved<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="4" groupid="4" style="2" owner="jchristopherson" level="1" deltag="both">; and</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="8" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">.</amend></subsection></subsection><subsection ssid="3-null-28" dnum="x-o:d-i" numlevel="1" lineno="311" slineno="2-52" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1154" style="2" owner="o" level="1" deltag="both">(x)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1155" style="1" owner="i" level="1" amendtag="start" space="true">(d)</amend></display><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="end">If clinically appropriate, a report concluding that the defendant is competent to <ln numlevel="1" lineno="312" slineno="2-53"/>proceed may </amend>include a statement by the facility's treating physician regarding:<subsection ssid="3-null-29" dnum="A-o:i-i" numlevel="1" lineno="313" slineno="2-54" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1155" style="2" owner="o" level="1" deltag="both">(A)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1156" style="1" owner="i" level="1" amendtag="both" space="true">(i)</amend></display>whether the defendant is taking any antipsychotic medication as prescribed;</subsection><subsection ssid="3-null-30" dnum="B-o:ii-i" numlevel="1" lineno="314" slineno="2-55" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1156" style="2" owner="o" level="1" deltag="both">(B)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1157" style="1" owner="i" level="1" amendtag="both" space="true">(ii)</amend></display>whether ongoing administration of antipsychotic medication is necessary to <ln numlevel="1" lineno="315" slineno="2-56"/>maintain the defendant's competency to stand trial;</subsection><subsection ssid="3-null-31" dnum="C-o:iii-i" numlevel="1" lineno="316" slineno="2-57" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1157" style="2" owner="o" level="1" deltag="both">(C)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1158" style="1" owner="i" level="1" amendtag="both" space="true">(iii)</amend></display>whether antipsychotic medication is substantially likely to maintain the <ln numlevel="1" lineno="317" slineno="2-58"/>defendant's competency to stand trial;</subsection><subsection ssid="3-null-32" dnum="D-o:iv-i" numlevel="1" lineno="318" slineno="2-59" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1158" style="2" owner="o" level="1" deltag="both">(D)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1159" style="1" owner="i" level="1" amendtag="both" space="true">(iv)</amend></display>whether antipsychotic medication is substantially unlikely to produce side <ln numlevel="1" lineno="319" slineno="2-60"/>effects which would significantly interfere with the defendant's ability to assist in <ln numlevel="1" lineno="320" slineno="2-61"/>the defendant's defense;</subsection><subsection ssid="3-null-33" dnum="E-o:v-i" numlevel="1" lineno="321" slineno="2-62" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1159" style="2" owner="o" level="1" deltag="both">(E)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1160" style="1" owner="i" level="1" amendtag="both" space="true">(v)</amend></display>that no less intrusive means are available, and whether any of those means <ln numlevel="1" lineno="322" slineno="2-63"/>have been attempted to render the defendant competent; and</subsection><subsection ssid="3-null-34" dnum="F-o:vi-i" numlevel="1" lineno="323" slineno="2-64" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1160" style="2" owner="o" level="1" deltag="both">(F)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1161" style="1" owner="i" level="1" amendtag="both" space="true">(vi)</amend></display>whether antipsychotic medication is medically appropriate and in the <ln numlevel="1" lineno="324" slineno="2-65"/>defendant's best medical interest in light of the defendant's medical condition.</subsection></subsection></subsection><subsection ssid="3-null-35" dnum="3-o" numlevel="1" lineno="325" slineno="2-66" level="1" space="false"><display>(3)</display><subsection ssid="3-null-36" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The court on its own motion or upon motion by either party or the department <ln numlevel="1" lineno="326" slineno="2-67"/>may appoint an additional forensic evaluator to conduct a progress toward <ln numlevel="1" lineno="327" slineno="2-68"/>competency evaluation.</subsection><subsection ssid="3-null-37" dnum="b-o" numlevel="1" lineno="328" slineno="2-69" level="2"><display>(b)</display>If the court appoints an additional forensic evaluator upon motion of a party, that <ln numlevel="1" lineno="329" slineno="2-70"/>party shall pay the costs of the additional forensic evaluator.</subsection></subsection><subsection ssid="3-null-38" dnum="4-o" numlevel="1" lineno="330" slineno="2-71" level="1" space="false"><display>(4)</display><subsection ssid="3-null-39" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Within 15 days after the day on which the court receives the forensic evaluator's <ln numlevel="1" lineno="331" slineno="2-72"/>report of the progress toward competency evaluation, the court shall hold a hearing to <ln numlevel="1" lineno="332" slineno="2-73"/>review the defendant's competency.</subsection><subsection ssid="3-null-40" dnum="b-o" numlevel="1" lineno="333" slineno="2-74" level="2"><display>(b)</display>At the hearing, the burden of proving that the defendant is competent to stand trial is <ln numlevel="1" lineno="334" slineno="2-75"/>on the proponent of competency.</subsection><subsection ssid="3-null-41" dnum="c-o" numlevel="1" lineno="335" slineno="2-76" level="2"><display>(c)</display>Following the hearing, the court shall determine by a preponderance of evidence <ln numlevel="1" lineno="336" slineno="2-77"/>whether the defendant:<subsection ssid="3-null-42" dnum="i-o" numlevel="1" lineno="337" slineno="2-78" level="3"><display>(i)</display>is competent to stand trial;</subsection><subsection ssid="3-null-43" dnum="ii-o" numlevel="1" lineno="338" slineno="2-79" level="3"><display>(ii)</display>is competent, but requires the ongoing administration of antipsychotic medication <ln numlevel="1" lineno="339" slineno="2-80"/>in order to maintain the defendant's competency to stand trial;</subsection><subsection ssid="3-null-44" dnum="iii-o" numlevel="1" lineno="340" slineno="2-81" level="3"><display>(iii)</display>is incompetent to proceed, with a substantial probability that the defendant may <ln numlevel="1" lineno="341" slineno="2-82"/>become competent in the foreseeable future; or</subsection><subsection ssid="3-null-45" dnum="iv-o" numlevel="1" lineno="342" slineno="2-83" level="3"><display>(iv)</display>is incompetent to proceed, without a substantial probability that the defendant <ln numlevel="1" lineno="343" slineno="2-84"/>may become competent in the foreseeable future.</subsection></subsection></subsection><subsection ssid="3-null-46" dnum="5-o" numlevel="1" lineno="344" slineno="2-85" level="1" space="false"><display>(5)</display><subsection ssid="3-null-47" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If at any time the court determines that the defendant is competent to stand trial, <ln numlevel="1" lineno="345" slineno="2-86"/>the court shall:<subsection ssid="3-null-48" dnum="i-o" numlevel="1" lineno="346" slineno="2-87" level="3" tab="1"><display>(i)</display>proceed with the trial or other procedures as may be necessary to adjudicate the <ln numlevel="1" lineno="347" slineno="2-88"/>charges; </subsection><subsection ssid="3-null-49" dnum="ii-o" numlevel="1" lineno="348" slineno="2-89" level="3" tab="1"><display>(ii)</display>order that the defendant be returned to the placement and status that the defendant <ln numlevel="1" lineno="349" slineno="2-90"/>was in at the time when the petition for the adjudication of competency was filed <ln numlevel="1" lineno="350" slineno="2-91"/>or raised by the court, unless the court determines that placement of the defendant <ln numlevel="1" lineno="351" slineno="2-92"/>in a less restrictive environment is more appropriate;</subsection><subsection ssid="3-null-50" dnum="iii-o" numlevel="1" lineno="352" slineno="2-93" level="3" tab="1"><display>(iii)</display>order the ongoing administration of antipsychotic medication to the defendant for <ln numlevel="1" lineno="353" slineno="2-94"/>the purpose of maintaining the defendant's competency to stand trial, if the court <ln numlevel="1" lineno="354" slineno="2-95"/>finds that the administration of antipsychotic medication is necessary to maintain <ln numlevel="1" lineno="355" slineno="2-96"/>the defendant's competency to stand trial under Subsection <xref depth="4" refnumber="77-15-6(4)(c)(ii)">(4)(c)(ii)</xref>; and</subsection><subsection ssid="3-null-51" dnum="iv-o" numlevel="1" lineno="356" slineno="2-97" level="3" tab="1"><display>(iv)</display>require the agency, jail, or prison with custody over the defendant to report to the <ln numlevel="1" lineno="357" slineno="2-98"/>court any noncompliance with the court's orders under this Subsection <xref depth="4" refnumber="77-15-6(5)">(5)</xref> within <ln numlevel="1" lineno="358" slineno="2-99"/>48 hours of the noncompliance.</subsection></subsection><subsection ssid="3-null-52" dnum="b-o" numlevel="1" lineno="359" slineno="2-100" level="2"><display>(b)</display>If the court determines that the defendant is incompetent to proceed with a <ln numlevel="1" lineno="360" slineno="2-101"/>substantial probability that the defendant may become competent in the foreseeable <ln numlevel="1" lineno="361" slineno="2-102"/>future, the court may order that the defendant remain committed to the department or <ln numlevel="1" lineno="362" slineno="2-103"/>the department's designee for the purpose of restoration treatment.</subsection><subsection ssid="3-null-53" dnum="c-o" numlevel="1" lineno="363" slineno="2-104" level="2" space="false"><display>(c)</display><subsection ssid="3-null-54" dnum="i-o" level="3" placement="sameline"><display>(i)</display>If the court determines that the defendant is incompetent to proceed without a <ln numlevel="1" lineno="364" slineno="2-105"/>substantial probability that the defendant may become competent in the <ln numlevel="1" lineno="365" slineno="2-106"/>foreseeable future, the court shall order the defendant released from commitment <ln numlevel="1" lineno="366" slineno="2-107"/>to the department, unless the prosecutor or another individual informs the court <ln numlevel="1" lineno="367" slineno="2-108"/>that civil commitment proceedings pursuant to Title 26B, Chapter 5, Health Care - <ln numlevel="1" lineno="368" slineno="2-109"/>Substance Use and Mental Health, or Title 26B, Chapter 6, Part 4, Division of <ln numlevel="1" lineno="369" slineno="2-110"/>Services for People with Disabilities, will be initiated.</subsection><subsection ssid="3-null-55" dnum="ii-o" numlevel="1" lineno="370" slineno="2-111" level="3"><display>(ii)</display>The commitment proceedings must be initiated by a petition filed within seven <ln numlevel="1" lineno="371" slineno="2-112"/>days after the day on which the court makes the determination described in <ln numlevel="1" lineno="372" slineno="2-113"/>Subsection <xref depth="4" refnumber="77-15-6(4)(c)(iv)">(4)(c)(iv)</xref>, unless the court finds that there is good cause to delay the <ln numlevel="1" lineno="373" slineno="2-114"/>initiation of the civil commitment proceedings.</subsection><subsection ssid="3-null-56" dnum="iii-o" numlevel="1" lineno="374" slineno="2-115" level="3"><display>(iii)</display>The court may order the defendant to remain committed to the department until <ln numlevel="1" lineno="375" slineno="2-116"/>the civil commitment proceedings conclude.</subsection><subsection ssid="3-null-57" dnum="iv-o" numlevel="1" lineno="376" slineno="2-117" level="3"><display>(iv)</display>If the defendant is civilly committed and admitted to a secure setting, the <ln numlevel="1" lineno="377" slineno="2-118"/>department shall provide notice to the court that adjudicated the defendant <ln numlevel="1" lineno="378" slineno="2-119"/>incompetent to proceed and to the prosecution agency that prosecuted the case at <ln numlevel="1" lineno="379" slineno="2-120"/>least 15 days before any proposed release of the committed individual from the <ln numlevel="1" lineno="380" slineno="2-121"/>secure setting.</subsection><subsection ssid="3-null-58" dnum="v-o" numlevel="1" lineno="381" slineno="2-122" level="3"><display>(v)</display>If the prosecution agency that prosecuted the case intends to refile charges against <ln numlevel="1" lineno="382" slineno="2-123"/>the committed individual:<subsection ssid="3-null-59" dnum="A-o" numlevel="1" lineno="383" slineno="2-124" level="4"><display>(A)</display>the prosecution agency shall provide written notice of that intent to the <ln numlevel="1" lineno="384" slineno="2-125"/>department within 15 days after the department provides the notice described <ln numlevel="1" lineno="385" slineno="2-126"/>in Subsection <xref tempid="583" depth="4" refnumber="77-15-6(5)(c)(iv)">(5)(c)(iv)</xref>; and</subsection><subsection ssid="3-null-60" dnum="B-o" numlevel="1" lineno="386" slineno="2-127" level="4"><display>(B)</display>the department shall postpone release of the committed individual for at least <ln numlevel="1" lineno="387" slineno="2-128"/>30 days after the day on which the department receives the written notice of <ln numlevel="1" lineno="388" slineno="2-129"/>intent from the prosecution agency.</subsection></subsection><subsection ssid="3-null-61" dnum="vi-o" numlevel="1" lineno="389" slineno="2-130" level="3"><display>(vi)</display>If the prosecution agency that prosecuted the case refiles charges against the <ln numlevel="1" lineno="390" slineno="2-131"/>committed individual and the individual's competency is raised, the department <ln numlevel="1" lineno="391" slineno="2-132"/>shall postpone release of the individual until the competency proceedings <ln numlevel="1" lineno="392" slineno="2-133"/>conclude.</subsection></subsection></subsection><subsection ssid="3-null-62" dnum="6-o" numlevel="1" lineno="393" slineno="2-134" level="1" space="false"><display>(6)</display><subsection ssid="3-null-63" dnum="a-o" level="2" placement="sameline"><display>(a)</display>At any time following the court's order under Subsection <xref depth="4" refnumber="77-15-6(5)(a)(iii)">(5)(a)(iii)</xref>, the defendant, <ln numlevel="1" lineno="394" slineno="2-135"/>the prosecuting attorney, the department, the treating physician, or the agency, jail, or <ln numlevel="1" lineno="395" slineno="2-136"/>prison with custody over the defendant, may notify the court of the need to review <ln numlevel="1" lineno="396" slineno="2-137"/>the medication order under Subsection <xref depth="4" refnumber="77-15-6(5)(a)(iii)">(5)(a)(iii)</xref> for continued appropriateness and <ln numlevel="1" lineno="397" slineno="2-138"/>feasibility.</subsection><subsection ssid="3-null-64" dnum="b-o" numlevel="1" lineno="398" slineno="2-139" level="2"><display>(b)</display>The court shall set the matter for a hearing if the notification under Subsection <xref depth="4" refnumber="77-15-6(6)(a)">(6)(a)</xref> <ln numlevel="1" lineno="399" slineno="2-140"/>establishes good cause to review the matter.</subsection></subsection><subsection ssid="3-null-65" dnum="7-o" numlevel="1" lineno="400" slineno="2-141" level="1"><display>(7)</display>If a court, under Subsection <xref depth="4" refnumber="77-15-6(5)(b)">(5)(b)</xref>, extends a defendant's commitment, the court shall <ln numlevel="1" lineno="401" slineno="2-142"/>schedule a competency review hearing for the earlier of:<subsection ssid="3-null-66" dnum="a-o" numlevel="1" lineno="402" slineno="2-143" level="2"><display>(a)</display>the department's best estimate of when the defendant may be restored to competency; <ln numlevel="1" lineno="403" slineno="2-144"/>or</subsection><subsection ssid="3-null-67" dnum="b-o" numlevel="1" lineno="404" slineno="2-145" level="2"><display>(b)</display>three months after the day on which the court determined under Subsection <xref depth="4" refnumber="77-15-6(5)(b)">(5)(b)</xref> to <ln numlevel="1" lineno="405" slineno="2-146"/>extend the defendant's commitment.</subsection></subsection><subsection ssid="3-null-68" dnum="8-o" numlevel="1" lineno="406" slineno="2-147" level="1"><display>(8)</display>Unless the defendant is charged with a crime listed in Subsection <xref depth="4" refnumber="77-15-6(9)">(9)</xref>, if a defendant is <ln numlevel="1" lineno="407" slineno="2-148"/>incompetent to proceed by the day of the competency review hearing that follows the <ln numlevel="1" lineno="408" slineno="2-149"/>extension of a defendant's commitment, the court shall:<subsection ssid="3-null-69" dnum="a-o" numlevel="1" lineno="409" slineno="2-150" level="2"><display>(a)</display>order the defendant be:<subsection ssid="3-null-70" dnum="i-o" numlevel="1" lineno="410" slineno="2-151" level="3"><display>(i)</display>released or temporarily detained pending civil commitment proceedings as <ln numlevel="1" lineno="411" slineno="2-152"/>described in Subsection <xref depth="4" refnumber="77-15-6(5)(c)">(5)(c)</xref>; and</subsection><subsection ssid="3-null-71" dnum="ii-o" numlevel="1" lineno="412" slineno="2-153" level="3"><display>(ii)</display>terminate the defendant's commitment to the department for restoration treatment; <ln numlevel="1" lineno="413" slineno="2-154"/>or</subsection></subsection><subsection ssid="3-null-72" dnum="b-o" numlevel="1" lineno="414" slineno="2-155" level="2"><display>(b)</display>if the forensic evaluator reports to the court that there is a substantial probability that <ln numlevel="1" lineno="415" slineno="2-156"/>restoration treatment will bring the defendant to competency to stand trial in the <ln numlevel="1" lineno="416" slineno="2-157"/>foreseeable future, extend the defendant's commitment for restoration treatment up to <ln numlevel="1" lineno="417" slineno="2-158"/>45 additional days.</subsection></subsection><subsection ssid="3-null-73" dnum="9-o" numlevel="1" lineno="418" slineno="2-159" level="1"><display>(9)</display>If the defendant is charged with aggravated murder, murder, attempted murder, <ln numlevel="1" lineno="419" slineno="2-160"/>manslaughter, or a first degree felony and the court determines that the defendant is <ln numlevel="1" lineno="420" slineno="2-161"/>making reasonable progress towards restoration of competency at the time of the hearing <ln numlevel="1" lineno="421" slineno="2-162"/>held pursuant to Subsection <xref depth="4" refnumber="77-15-6(7)">(7)</xref>, the court may extend the commitment for a period not <ln numlevel="1" lineno="422" slineno="2-163"/>to exceed nine months for the purpose of restoration treatment, with a mandatory review <ln numlevel="1" lineno="423" slineno="2-164"/>hearing at the end of the nine-month period.</subsection><subsection ssid="3-null-74" dnum="10-o" numlevel="1" lineno="424" slineno="2-165" level="1"><display>(10)</display>Unless the defendant is charged with aggravated murder or murder, if, at the <ln numlevel="1" lineno="425" slineno="2-166"/>nine-month review hearing described in Subsection <xref depth="4" refnumber="77-15-6(9)">(9)</xref>, the court determines that the <ln numlevel="1" lineno="426" slineno="2-167"/>defendant is incompetent to proceed, the court shall:<subsection ssid="3-null-75" dnum="a-o" numlevel="1" lineno="427" slineno="2-168" level="2" space="false"><display>(a)</display><subsection ssid="3-null-76" dnum="i-o" level="3" placement="sameline"><display>(i)</display>order the defendant be released or temporarily detained pending civil <ln numlevel="1" lineno="428" slineno="2-169"/>commitment proceedings as provided in Subsection <xref depth="4" refnumber="77-15-6(5)(c)">(5)(c)</xref>; and</subsection><subsection ssid="3-null-77" dnum="ii-o" numlevel="1" lineno="429" slineno="2-170" level="3"><display>(ii)</display>terminate the defendant's commitment to the department for restoration treatment; <ln numlevel="1" lineno="430" slineno="2-171"/>or</subsection></subsection><subsection ssid="3-null-78" dnum="b-o" numlevel="1" lineno="431" slineno="2-172" level="2"><display>(b)</display>if the forensic evaluator reports to the court that there is a substantial probability that <ln numlevel="1" lineno="432" slineno="2-173"/>restoration treatment will bring the defendant to competency to stand trial in the <ln numlevel="1" lineno="433" slineno="2-174"/>foreseeable future, extend the defendant's commitment for restoration treatment for <ln numlevel="1" lineno="434" slineno="2-175"/>up to 135 additional days.</subsection></subsection><subsection ssid="3-null-79" dnum="11-o" numlevel="1" lineno="435" slineno="2-176" level="1"><display>(11)</display>If the defendant is charged with aggravated murder or murder and the court determines <ln numlevel="1" lineno="436" slineno="2-177"/>that the defendant is making reasonable progress towards restoration of competency at <ln numlevel="1" lineno="437" slineno="2-178"/>the time of the nine-month review hearing described in Subsection <xref depth="4" refnumber="77-15-6(9)">(9)</xref>, the court may <ln numlevel="1" lineno="438" slineno="2-179"/>extend the commitment for a period not to exceed 24 months for the purpose of <ln numlevel="1" lineno="439" slineno="2-180"/>restoration treatment.</subsection><subsection ssid="3-null-80" dnum="12-o" numlevel="1" lineno="440" slineno="2-181" level="1"><display>(12)</display>If the court extends the defendant's commitment term under Subsection <xref depth="4" refnumber="77-15-6(11)">(11)</xref>, the court <ln numlevel="1" lineno="441" slineno="2-182"/>shall hold a hearing no less frequently than at 12-month intervals following the <ln numlevel="1" lineno="442" slineno="2-183"/>extension for the purpose of determining the defendant's competency status.</subsection><subsection ssid="3-null-81" dnum="13-o" numlevel="1" lineno="443" slineno="2-184" level="1"><display>(13)</display>If, at the end of the 24-month commitment period described in Subsection <xref depth="4" refnumber="77-15-6(11)">(11)</xref>, the <ln numlevel="1" lineno="444" slineno="2-185"/>court determines that the defendant is incompetent to proceed, the court shall:<subsection ssid="3-null-82" dnum="a-o" numlevel="1" lineno="445" slineno="2-186" level="2" space="false"><display>(a)</display><subsection ssid="3-null-83" dnum="i-o" level="3" placement="sameline"><display>(i)</display>order the defendant be released or temporarily detained pending civil <ln numlevel="1" lineno="446" slineno="2-187"/>commitment proceedings as provided in Subsection <xref depth="4" refnumber="77-15-6(5)(c)">(5)(c)</xref>; and</subsection><subsection ssid="3-null-84" dnum="ii-o" numlevel="1" lineno="447" slineno="2-188" level="3"><display>(ii)</display>terminate the defendant's commitment to the department for restoration treatment; <ln numlevel="1" lineno="448" slineno="2-189"/>or</subsection></subsection><subsection ssid="3-null-85" dnum="b-o" numlevel="1" lineno="449" slineno="2-190" level="2"><display>(b)</display>if the forensic evaluator reports to the court that there is a substantial probability that <ln numlevel="1" lineno="450" slineno="2-191"/>restoration treatment will bring the defendant to competency to stand trial in the <ln numlevel="1" lineno="451" slineno="2-192"/>foreseeable future, extend the defendant's commitment for restoration treatment for <ln numlevel="1" lineno="452" slineno="2-193"/>up to 12 additional months.</subsection></subsection><subsection ssid="3-null-86" dnum="14-o" numlevel="1" lineno="453" slineno="2-194" level="1" space="false"><display>(14)</display><subsection ssid="3-null-87" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Neither release from a pretrial incompetency commitment under the provisions <ln numlevel="1" lineno="454" slineno="2-195"/>of this section nor civil commitment requires dismissal of criminal charges.</subsection><subsection ssid="3-null-88" dnum="b-o" numlevel="1" lineno="455" slineno="2-196" level="2"><display>(b)</display>The court may retain jurisdiction over the criminal case and may order periodic <ln numlevel="1" lineno="456" slineno="2-197"/>reviews.</subsection></subsection><subsection ssid="3-null-89" dnum="15-o" numlevel="1" lineno="457" slineno="2-198" level="1"><display>(15)</display>A defendant who is civilly committed pursuant to Title 26B, Chapter 5, Health Care - <ln numlevel="1" lineno="458" slineno="2-199"/>Substance Use and Mental Health, or Title 26B, Chapter 6, Part 4, Division of Services <ln numlevel="1" lineno="459" slineno="2-200"/>for People with Disabilities, may still be adjudicated competent to stand trial under this <ln numlevel="1" lineno="460" slineno="2-201"/>chapter.</subsection><subsection ssid="3-null-90" dnum="16-o" numlevel="1" lineno="461" slineno="2-202" level="1" space="false"><display>(16)</display><subsection ssid="3-null-91" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The remedy for a violation of the time periods specified in this section, other <ln numlevel="1" lineno="462" slineno="2-203"/>than those specified in Subsection <xref depth="4" refnumber="77-15-6(5)(c)">(5)(c)</xref>, (8), (10), or (13), shall be a motion to <ln numlevel="1" lineno="463" slineno="2-204"/>compel the hearing, or mandamus, but not release from detention or dismissal of the <ln numlevel="1" lineno="464" slineno="2-205"/>criminal charges.</subsection><subsection ssid="3-null-92" dnum="b-o" numlevel="1" lineno="465" slineno="2-206" level="2"><display>(b)</display>The remedy for a violation of the time periods specified in Subsection <xref depth="4" refnumber="77-15-6(5)(c)">(5)(c)</xref>, (8), (9), <ln numlevel="1" lineno="466" slineno="2-207"/>or (13), or is not dismissal of the criminal charges.</subsection></subsection><subsection ssid="3-null-93" dnum="17-o" numlevel="1" lineno="467" slineno="2-208" level="1"><display>(17)</display>In cases in which the treatment of the defendant is precluded by court order for a <ln numlevel="1" lineno="468" slineno="2-209"/>period of time, that time period may not be considered in computing time limitations <ln numlevel="1" lineno="469" slineno="2-210"/>under this section.</subsection><subsection ssid="3-null-94" dnum="18-o" numlevel="1" lineno="470" slineno="2-211" level="1" space="false"><display>(18)</display><subsection ssid="3-null-95" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If, at any time, the defendant becomes competent to stand trial while the <ln numlevel="1" lineno="471" slineno="2-212"/>defendant is committed to the department, the clinical director of the Utah State <ln numlevel="1" lineno="472" slineno="2-213"/>Hospital, the department, or the department's designee shall certify that fact to the <ln numlevel="1" lineno="473" slineno="2-214"/>court.</subsection><subsection ssid="3-null-96" dnum="b-o" numlevel="1" lineno="474" slineno="2-215" level="2"><display>(b)</display>The court shall conduct a competency review hearing:<subsection ssid="3-null-97" dnum="i-o" numlevel="1" lineno="475" slineno="2-216" level="3"><display>(i)</display>within 15 working days after the day on which the court receives the certification <ln numlevel="1" lineno="476" slineno="2-217"/>described in Subsection <xref depth="4" refnumber="77-15-6(18)(a)">(18)(a)</xref>; or</subsection><subsection ssid="3-null-98" dnum="ii-o" numlevel="1" lineno="477" slineno="2-218" level="3"><display>(ii)</display>within 30 working days after the day on which the court receives the certification <ln numlevel="1" lineno="478" slineno="2-219"/>described in Subsection <xref depth="4" refnumber="77-15-6(18)(a)">(18)(a)</xref>, if the court determines that more than 15 working <ln numlevel="1" lineno="479" slineno="2-220"/>days are necessary for good cause related to the defendant's competency.</subsection></subsection></subsection><subsection ssid="3-null-99" dnum="19-o" numlevel="1" lineno="480" slineno="2-221" level="1"><display>(19)</display>The court may order a hearing at any time on the court's own motion or upon <ln numlevel="1" lineno="481" slineno="2-222"/>recommendations of the clinical director of the Utah State Hospital or other facility or <ln numlevel="1" lineno="482" slineno="2-223"/>the department.</subsection><subsection ssid="3-null-100" dnum="20-o" numlevel="1" lineno="483" slineno="2-224" level="1"><display>(20)</display>Notice of a hearing on competency to stand trial shall be given to the prosecuting <ln numlevel="1" lineno="484" slineno="2-225"/>attorney and all counsel of record.</subsection></section></bsec><bsec buid="8" num="77-15-10" type="enact" src="code" uid="C77-15-S10_2026050620260506" sort="77 15 00100020260506" numlevel="1" lineno="485" slineno="3-1" sn="3"><section numlevel="1" lineno="486" slineno="3-2" number="77-15-10" type="enact"><secline lineno="485">Section 3. Section <bold>77-15-10</bold> is enacted to read:</secline><catline lineno="486"><bold>77-15-10<parens/>. Involuntary medication order portability.</bold></catline><subsection ssid="8-1" dnum="_-o:1-i" numlevel="1" lineno="487" slineno="3-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1227" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">As used in this section:</amend><subsection ssid="8-3" dnum="_-o:a-i" numlevel="1" lineno="488" slineno="3-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1228" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="end">"Covered individual" means an individual subject to an involuntary medication order.</amend></subsection><subsection ssid="8-4" dnum="_-o:b-i" numlevel="1" lineno="489" slineno="3-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1229" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="14" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="end">"Facility" means:</amend><subsection ssid="8-5" dnum="_-o:i-i" numlevel="1" lineno="490" slineno="3-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1230" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">a county jail;</amend></subsection><subsection ssid="8-6" dnum="_-o:ii-i" numlevel="1" lineno="491" slineno="3-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1231" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="20" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="end">the Utah State Hospital established in Section <xref depth="3" refnumber="26B-5-302">26B-5-302</xref>; or</amend></subsection><subsection ssid="8-7" dnum="_-o:iii-i" numlevel="1" lineno="492" slineno="3-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1232" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="23" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="end">a facility where a covered individual is receiving treatment as described in <ln numlevel="1" lineno="493" slineno="3-9"/>Section <xref depth="3" refnumber="77-15-6.5">77-15-6.5</xref>.</amend></subsection></subsection><subsection ssid="8-8" dnum="_-o:c-i" numlevel="1" lineno="494" slineno="3-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1233" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="end">"Involuntary medication order" means a court order for involuntary medication of a <ln numlevel="1" lineno="495" slineno="3-11"/>defendant that a court orders in accordance with Section <xref depth="3" refnumber="77-15-6.5">77-15-6.5</xref>.</amend></subsection><subsection ssid="8-9" dnum="_-o:d-i" numlevel="1" lineno="496" slineno="3-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1234" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="29" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="end">"Qualified medical professional" means an individual who is licensed as:</amend><subsection ssid="8-10" dnum="_-o:i-i" numlevel="1" lineno="497" slineno="3-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1235" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="32" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="end">a physician under Title 58, Chapter 67, Utah Medical Practice Act, or Title 58, <ln numlevel="1" lineno="498" slineno="3-14"/>Chapter 68, Utah Osteopathic Medical Practice Act;</amend></subsection><subsection ssid="8-11" dnum="_-o:ii-i" numlevel="1" lineno="499" slineno="3-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1236" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="35" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="end">a psychiatrist under Title 58, Chapter 67, Utah Medical Practice Act, or Title 58, <ln numlevel="1" lineno="500" slineno="3-16"/>Chapter 68, Utah Osteopathic Medical Practice Act;</amend></subsection><subsection ssid="8-12" dnum="_-o:iii-i" numlevel="1" lineno="501" slineno="3-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1237" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="38" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="end">a physician assistant under Title 58, Chapter 70a, Utah Physician Assistant Act; <ln numlevel="1" lineno="502" slineno="3-18"/>or</amend></subsection><subsection ssid="8-13" dnum="_-o:iv-i" numlevel="1" lineno="503" slineno="3-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1238" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="41" groupid="28" style="1" owner="jchristopherson" level="1" amendtag="end">a nurse practitioner under Title 58, Chapter 31b, Nurse Practice Act.</amend></subsection></subsection><subsection ssid="8-14" dnum="_-o:e-i" numlevel="1" lineno="504" slineno="3-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1239" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="44" groupid="30" style="1" owner="jchristopherson" level="1" amendtag="end">"Receiving facility" means a facility where a covered individual is being transferred.</amend></subsection><subsection ssid="8-15" dnum="_-o:f-i" numlevel="1" lineno="505" slineno="3-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1240" style="1" owner="i" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="47" groupid="32" style="1" owner="jchristopherson" level="1" amendtag="end">"Sending facility" means a facility where a covered individual is held or incarcerated.</amend></subsection></subsection><subsection ssid="8-16" dnum="_-o:2-i" numlevel="1" lineno="506" slineno="3-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1241" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="50" groupid="34" style="1" owner="jchristopherson" level="1" amendtag="end">An involuntary medication order remains valid and in effect when a covered individual <ln numlevel="1" lineno="507" slineno="3-23"/>is transferred from a sending facility to a receiving facility.</amend></subsection><subsection ssid="8-17" dnum="_-o:3-i" numlevel="1" lineno="508" slineno="3-24" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1242" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="53" groupid="36" style="1" owner="jchristopherson" level="1" amendtag="end">Before a receiving facility continues administering medication to an individual <ln numlevel="1" lineno="509" slineno="3-25"/>transferred from a sending facility under an involuntary medication order:</amend><subsection ssid="8-18" dnum="_-o:a-i" numlevel="1" lineno="510" slineno="3-26" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1243" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="56" groupid="38" style="1" owner="jchristopherson" level="1" amendtag="end">a qualified medical professional employed by the receiving facility shall:</amend><subsection ssid="8-19" dnum="_-o:i-i" numlevel="1" lineno="511" slineno="3-27" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1244" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="59" groupid="40" style="1" owner="jchristopherson" level="1" amendtag="end">review the covered individual's medical record from the sending facility and the <ln numlevel="1" lineno="512" slineno="3-28"/>involuntary medication order;</amend></subsection><subsection ssid="8-20" dnum="_-o:ii-i" numlevel="1" lineno="513" slineno="3-29" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1245" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="62" groupid="42" style="1" owner="jchristopherson" level="1" amendtag="end">conduct a face-to-face assessment of the covered individual's current mental and <ln numlevel="1" lineno="514" slineno="3-30"/>physical condition;</amend></subsection><subsection ssid="8-21" dnum="_-o:iii-i" numlevel="1" lineno="515" slineno="3-31" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1246" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="65" groupid="44" style="1" owner="jchristopherson" level="1" amendtag="end">assess whether the covered individual can be transitioned to receiving medication <ln numlevel="1" lineno="516" slineno="3-32"/>on a voluntary basis if the covered individual continues to need medication; and</amend></subsection></subsection><subsection ssid="8-22" dnum="_-o:b-i" numlevel="1" lineno="517" slineno="3-33" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1247" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="68" groupid="46" style="1" owner="jchristopherson" level="1" amendtag="end">the qualified medical professional shall document in the covered individual's medical <ln numlevel="1" lineno="518" slineno="3-34"/>record a signed statement affirming that:</amend><subsection ssid="8-23" dnum="_-o:i-i" numlevel="1" lineno="519" slineno="3-35" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1248" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="71" groupid="48" style="1" owner="jchristopherson" level="1" amendtag="end">the covered individual continues to suffer from a mental illness and, as a result of <ln numlevel="1" lineno="520" slineno="3-36"/>the mental illness, poses a likelihood of serious harm to the covered individual or <ln numlevel="1" lineno="521" slineno="3-37"/>others if treatment ordered in the involuntary medication order is discontinued; and</amend></subsection><subsection ssid="8-24" dnum="_-o:ii-i" numlevel="1" lineno="522" slineno="3-38" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1249" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="74" groupid="50" style="1" owner="jchristopherson" level="1" amendtag="end">the administration of psychiatric medication as ordered in the involuntary <ln numlevel="1" lineno="523" slineno="3-39"/>medication order is:</amend><subsection ssid="8-25" dnum="_-o:A-i" numlevel="1" lineno="524" slineno="3-40" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1250" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="77" groupid="52" style="1" owner="jchristopherson" level="1" amendtag="end">medically appropriate;</amend></subsection><subsection ssid="8-26" dnum="_-o:B-i" numlevel="1" lineno="525" slineno="3-41" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1251" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="80" groupid="54" style="1" owner="jchristopherson" level="1" amendtag="end">in the covered individual's best interest; and</amend></subsection><subsection ssid="8-27" dnum="_-o:C-i" numlevel="1" lineno="526" slineno="3-42" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1252" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="83" groupid="56" style="1" owner="jchristopherson" level="1" amendtag="end">the least restrictive treatment necessary to maintain the safety of the covered <ln numlevel="1" lineno="527" slineno="3-43"/>individual and others.</amend></subsection></subsection></subsection></subsection><subsection ssid="8-28" dnum="_-o:4-i" numlevel="1" lineno="528" slineno="3-44" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1253" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><subsection ssid="8-29" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1254" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="89" groupid="60" style="1" owner="jchristopherson" level="1" amendtag="end">A sending facility and receiving facility shall coordinate transfer of a covered <ln numlevel="1" lineno="529" slineno="3-45"/>individual's medication plan.</amend></subsection><subsection ssid="8-30" dnum="_-o:b-i" numlevel="1" lineno="530" slineno="3-46" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1255" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="92" groupid="62" style="1" owner="jchristopherson" level="1" amendtag="end">If the covered individual's medication is unavailable under the receiving facility's <ln numlevel="1" lineno="531" slineno="3-47"/>formulary, the medical director of the sending facility, or the medical director's <ln numlevel="1" lineno="532" slineno="3-48"/>designee, and the medical director of the receiving facility, or the medical director's <ln numlevel="1" lineno="533" slineno="3-49"/>designee, shall agree on a therapeutic equivalent or alternative that prevents <ln numlevel="1" lineno="534" slineno="3-50"/>interruption of the covered individual's treatment.</amend></subsection><subsection ssid="8-31" dnum="_-o:c-i" numlevel="1" lineno="535" slineno="3-51" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1256" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="95" groupid="64" style="1" owner="jchristopherson" level="1" amendtag="end">If the medical director of the receiving facility does not agree to a therapeutic <ln numlevel="1" lineno="536" slineno="3-52"/>equivalent or alternative described in Subsection <xref depth="4" refnumber="77-15-10(4)(b)">(4)(b)</xref>, the receiving facility may not <ln numlevel="1" lineno="537" slineno="3-53"/>continue to involuntarily medicate the covered individual unless the receiving facility <ln numlevel="1" lineno="538" slineno="3-54"/>seeks a new involuntary medication order under Section <xref depth="3" refnumber="77-15-6.5">77-15-6.5</xref>.</amend></subsection></subsection><subsection ssid="8-32" dnum="_-o:5-i" numlevel="1" lineno="539" slineno="3-55" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1257" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="98" groupid="66" style="1" owner="jchristopherson" level="1" amendtag="end">This section does not affect:</amend><subsection ssid="8-33" dnum="_-o:a-i" numlevel="1" lineno="540" slineno="3-56" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1258" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="101" groupid="68" style="1" owner="jchristopherson" level="1" amendtag="end">the rights of a covered individual under this chapter;
