Section <bold>81-5-105</bold> is amended to read:</secline><catline lineno="25"><bold>81-5-105<parens/>. General requirements for parentage action or settlement -- Filing <ln numlevel="1" lineno="26" slineno="1-3"/>parentage with the Office of Vital Records and Statistics.</bold></catline><subsection ssid="13-null-1" dnum="1-o" numlevel="1" lineno="27" slineno="1-4" level="1" placement="noreturn"><display>(1)</display>A court shall, without adjudicating parentage, dismiss a petition that is filed under this <ln numlevel="1" lineno="28" slineno="1-5"/>chapter by an unmarried biological father if the unmarried biological father is not <ln numlevel="1" lineno="29" slineno="1-6"/>entitled to consent to the adoption of the child as described in Section <xref depth="3" refnumber="81-13-213">81-13-213</xref>.</subsection><subsection ssid="13-null-2" dnum="2-o" numlevel="1" lineno="30" slineno="1-7" level="1"><display>(2)</display>The standard of proof in a trial to establish parentage is "by clear and convincing <ln numlevel="1" lineno="31" slineno="1-8"/>evidence."</subsection><subsection ssid="13-null-3" dnum="3-o" numlevel="1" lineno="32" slineno="1-9" level="1"><display>(3)</display>Utah Rule of Civil Procedure 55, Default, applies to a parentage action commenced <ln numlevel="1" lineno="33" slineno="1-10"/>under this chapter.</subsection><subsection ssid="13-null-4" dnum="4-o" numlevel="1" lineno="34" slineno="1-11" level="1"><display>(4)</display>An agreement of settlement with an alleged father is binding only when approved by the <ln numlevel="1" lineno="35" slineno="1-12"/>tribunal.</subsection><subsection ssid="13-null-5" dnum="5-o" numlevel="1" lineno="36" slineno="1-13" level="1"><display>(5)</display>If a parentage action is brought under this chapter, the obligor's liabilities for past <ln numlevel="1" lineno="37" slineno="1-14"/>support are limited to <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="19" groupid="15" style="2" owner="jchristopherson" level="1" deltag="both">the period of four years preceding the commencement of an action</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="18" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="38" slineno="1-15"/>a period of one year before the filing of the parentage action</amend>.</subsection><subsection ssid="13-null-6" dnum="6-o" numlevel="1" lineno="39" slineno="1-16" level="1" space="false"><display>(6)</display><subsection ssid="13-null-7" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If the tribunal determines that an alleged father is a parent of the child, the tribunal <ln numlevel="1" lineno="40" slineno="1-17"/>may upon the tribunal's own motion, or upon motion of the alleged father, order <ln numlevel="1" lineno="41" slineno="1-18"/>parent-time rights in accordance with Title 81, Chapter 9, Custody, Parent-time, and <ln numlevel="1" lineno="42" slineno="1-19"/>Visitation, as the tribunal considers appropriate under the circumstances.</subsection><subsection ssid="13-null-8" dnum="b-o" numlevel="1" lineno="43" slineno="1-20" level="2"><display>(b)</display>Parent-time rights may not be granted to an alleged father if the child has been <ln numlevel="1" lineno="44" slineno="1-21"/>subsequently adopted.</subsection></subsection><subsection ssid="13-null-9" dnum="7-o" numlevel="1" lineno="45" slineno="1-22" level="1"><display>(7)</display>A party to an action under this chapter has a continuing obligation to keep the tribunal <ln numlevel="1" lineno="46" slineno="1-23"/>informed of the party's current address.</subsection><subsection ssid="13-null-10" dnum="8-o" numlevel="1" lineno="47" slineno="1-24" level="1"><display>(8)</display>A proceeding under this chapter is subject to other laws of this state governing the <ln numlevel="1" lineno="48" slineno="1-25"/>health, safety, privacy, and liberty of a child or other individual who could be <ln numlevel="1" lineno="49" slineno="1-26"/>jeopardized by disclosure of identifying information, including address, telephone <ln numlevel="1" lineno="50" slineno="1-27"/>number, place of employment, social security number, the child's day-care facility, or <ln numlevel="1" lineno="51" slineno="1-28"/>school.</subsection><subsection ssid="13-null-11" dnum="9-o" numlevel="1" lineno="52" slineno="1-29" level="1"><display>(9)</display>An adjudication of parentage or declaration of paternity shall be filed with the Office of <ln numlevel="1" lineno="53" slineno="1-30"/>Vital Records and Statistics in accordance with Section <xref depth="3" refnumber="26B-8-104">26B-8-104</xref>.</subsection></section></bsec><bsec buid="17" num="81-5-606" type="repreenact" src="code" uid="C81-5-S606_2026050620260506" sort="81 05 06060020260506" numlevel="1" lineno="54" slineno="2-1" sn="2"><section numlevel="1" lineno="55" slineno="2-2" number="81-5-606" type="repreenact"><secline lineno="54">Section 2. Section <bold>81-5-606</bold> is repealed and reenacted to read:</secline><catline lineno="55"><bold>81-5-606<parens/>. Statute of limitations for parentage action.</bold></catline><subsection ssid="17-1" dnum="_-o:1-i" numlevel="1" lineno="56" slineno="2-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="31" groupid="23" style="1" owner="jchristopherson" level="1" amendtag="end">Except as provided in Subsections <xref tempid="928">(2)</xref> and (3), a person may only bring a proceeding to <ln numlevel="1" lineno="57" slineno="2-4"/>adjudicate parentage of a child before the child is 18 years old.</amend></subsection><subsection ssid="17-16" dnum="_-o:2-i" numlevel="1" lineno="58" slineno="2-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1012" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="78" groupid="61" style="1" owner="jchristopherson" level="1" amendtag="end">For a child who is born on or after May 6, 2026, the child may only bring a proceeding <ln numlevel="1" lineno="59" slineno="2-6"/>to adjudicate the child's parentage before the child is 26 years old.</amend></subsection><subsection ssid="17-4" dnum="_-o:3-i" numlevel="1" lineno="60" slineno="2-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1013" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="39" groupid="30" style="1" owner="jchristopherson" level="1" amendtag="end">For a child who is born before May 6, 2026, the child may only bring a proceeding to <ln numlevel="1" lineno="61" slineno="2-8"/>adjudicate the child's parentage within the later of:</amend><subsection ssid="17-8" dnum="_-o:a-i" numlevel="1" lineno="62" slineno="2-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1014" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="44" groupid="34" style="1" owner="jchristopherson" level="1" amendtag="end">the child reaching 26 years old; or</amend></subsection><subsection ssid="17-9" dnum="_-o:b-i" numlevel="1" lineno="63" slineno="2-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1015" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="50" groupid="39" style="1" owner="jchristopherson" level="1" amendtag="end">three years after May 6, 2026.</amend></subsection></subsection><subsection ssid="17-10" dnum="_-o:4-i" numlevel="1" lineno="64" slineno="2-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="58" groupid="45" style="1" owner="jchristopherson" level="1" amendtag="end">This section does not:</amend><subsection ssid="17-13" dnum="_-o:a-i" numlevel="1" lineno="65" slineno="2-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1017" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="63" groupid="49" style="1" owner="jchristopherson" level="1" amendtag="end">prevent the birth mother of a child and the alleged father of a child from signing a <ln numlevel="1" lineno="66" slineno="2-13"/>declaration of paternity as described in Part 3, Voluntary Declaration of Paternity, to <ln numlevel="1" lineno="67" slineno="2-14"/>establish the paternity of the child after the child is 18 years old; or</amend></subsection><subsection ssid="17-14" dnum="_-o:b-i" numlevel="1" lineno="68" slineno="2-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="68" groupid="53" style="1" owner="jchristopherson" level="1" amendtag="end">apply to a proceeding to challenge a declaration of paternity under Section <xref depth="3" refnumber="81-5-307">81-5-307</xref>.</amend></subsection></subsection></section></bsec><bsec buid="19" num="81-5-607" type="amend" src="code" uid="C81-5-S607_2026050620260506" sort="81 05 06070020260506" numlevel="1" lineno="69" slineno="3-1" sn="3"><section number="81-5-607" numlevel="1" lineno="70" slineno="3-2" type="amend"><secline lineno="69">Section 3. Section <bold>81-5-607</bold> is amended to read:</secline><catline lineno="70"><bold>81-5-607<parens/>. Parentage action for child having presumed father.</bold></catline><subsection ssid="19-null-1" dnum="1-o" numlevel="1" lineno="71" slineno="3-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="19-null-2" dnum="a-o:_-i" ea="erase" anum="0" owner="jchristopherson" style="2" level="2" placement="sameline"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1020" style="2" owner="o" level="1" deltag="start">(a)</amend></display><amend anum="0" ea="erase" pairid="3" groupid="2" style="2" owner="jchristopherson" level="1" deltag="end">Parentage of a child conceived or born during a marriage with a presumed father, <ln numlevel="1" lineno="72" slineno="3-4"/>as described in Subsection <xref depth="3" refnumber="81-5-204">81-5-204</xref>(1)(a), (b), or (c) may be raised by the presumed <ln numlevel="1" lineno="73" slineno="3-5"/>father, the birth mother, or a child support services agency at any time before filing <ln numlevel="1" lineno="74" slineno="3-6"/>an action for divorce or in the pleadings at the time of the divorce of the parents.</amend><amendoutend style="2"/></subsection><subsection ssid="19-20" dnum="_-o:a-i" numlevel="1" lineno="75" slineno="3-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1021" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="6" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">Subject to Subsection <xref depth="4" refnumber="81-5-606(1)">81-5-606(1)</xref>, a man, a birth mother, or a child support services <ln numlevel="1" lineno="76" slineno="3-8"/>agency may raise the parentage of a child at any time before filing an action for <ln numlevel="1" lineno="77" slineno="3-9"/>divorce, or in the pleadings at the time of the divorce of the man and birth mother if:</amend><subsection ssid="19-21" dnum="_-o:i-i" numlevel="1" lineno="78" slineno="3-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1022" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="13" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="end">the child was conceived or born during a marriage between the man and birth <ln numlevel="1" lineno="79" slineno="3-11"/>mother; and</amend></subsection><subsection ssid="19-22" dnum="_-o:ii-i" numlevel="1" lineno="80" slineno="3-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1023" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="18" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">the man is the presumed father of the child under Subsection <xref depth="4" refnumber="81-5-204(1)(a)">81-5-204(1)(a)</xref>, (b), <ln numlevel="1" lineno="81" slineno="3-13"/>or (c).</amend></subsection></subsection><subsection ssid="19-null-3" dnum="b-o" numlevel="1" lineno="82" slineno="3-14" level="2" space="false"><display>(b)</display><subsection ssid="19-null-4" dnum="i-o" level="3" placement="sameline"><display>(i)</display>If the issue is raised <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="28" groupid="22" style="2" owner="jchristopherson" level="1" deltag="both">prior to </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="27" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">before </amend>the adjudication, genetic testing may be <ln numlevel="1" lineno="83" slineno="3-15"/>ordered by the tribunal in accordance with Section <xref depth="3" refnumber="81-5-608">81-5-608</xref>.  </subsection><subsection ssid="19-null-5" dnum="ii-o" numlevel="1" lineno="84" slineno="3-16" level="3"><display>(ii)</display>Failure of the birth mother of the child to appear for testing may result in an order <ln numlevel="1" lineno="85" slineno="3-17"/>allowing a motherless calculation of parentage.  </subsection><subsection ssid="19-null-6" dnum="iii-o" numlevel="1" lineno="86" slineno="3-18" level="3"><display>(iii)</display>Failure of the birth mother to make the child available may not result in a <ln numlevel="1" lineno="87" slineno="3-19"/>determination that the presumed father is not the father, but shall allow for <ln numlevel="1" lineno="88" slineno="3-20"/>appropriate proceedings to compel the cooperation of the birth mother.  </subsection><subsection ssid="19-null-7" dnum="iv-o" numlevel="1" lineno="89" slineno="3-21" level="3"><display>(iv)</display>If the question of parentage has been raised in the pleadings in a divorce and the <ln numlevel="1" lineno="90" slineno="3-22"/>tribunal addresses the issue and enters an order, the parties are estopped from <ln numlevel="1" lineno="91" slineno="3-23"/>raising the issue again, and the order of the tribunal may not be challenged on the <ln numlevel="1" lineno="92" slineno="3-24"/>basis of material mistake of fact.</subsection></subsection><subsection ssid="19-null-8" dnum="c-o" numlevel="1" lineno="93" slineno="3-25" level="2"><display>(c)</display>If the presumed father seeks to rebut the presumption of parentage, then denial of a <ln numlevel="1" lineno="94" slineno="3-26"/>motion seeking an order for genetic testing or a decision to disregard genetic test <ln numlevel="1" lineno="95" slineno="3-27"/>results shall be based on a preponderance of the evidence.</subsection><subsection ssid="19-null-9" dnum="d-o" numlevel="1" lineno="96" slineno="3-28" level="2"><display>(d)</display>If the birth mother seeks to rebut the presumption of parentage, the birth mother has <ln numlevel="1" lineno="97" slineno="3-29"/>the burden to show by a preponderance of the evidence that it would be in the best <ln numlevel="1" lineno="98" slineno="3-30"/>interests of the child to disestablish the parent-child relationship.</subsection><subsection ssid="19-null-10" dnum="e-o" numlevel="1" lineno="99" slineno="3-31" level="2" space="false"><display>(e)</display><subsection ssid="19-null-11" dnum="i-o" level="3" placement="sameline"><display>(i)</display>If a child support services agency seeks to rebut the presumption of parentage <ln numlevel="1" lineno="100" slineno="3-32"/>and the presumed father opposes the rebuttal, the agency's request shall be denied.  </subsection><subsection ssid="19-null-12" dnum="ii-o" numlevel="1" lineno="101" slineno="3-33" level="3"><display>(ii)</display>Otherwise, the denial of the agency's motion seeking an order for genetic testing <ln numlevel="1" lineno="102" slineno="3-34"/>or a decision to disregard genetic test results shall be based on a preponderance of <ln numlevel="1" lineno="103" slineno="3-35"/>the evidence, taking into account the best interests of the child.</subsection></subsection></subsection><subsection ssid="19-null-13" dnum="2-o" numlevel="1" lineno="104" slineno="3-36" level="1"><display>(2)</display>For the presumption outside of marriage described in Subsection <xref refnumber="81-5-204(1)(d)" depth="4">81-5-204(1)(d)</xref>, the <ln numlevel="1" lineno="105" slineno="3-37"/>presumption may be rebutted at any time if the tribunal determines that the presumed <ln numlevel="1" lineno="106" slineno="3-38"/>father and the birth mother of the child neither cohabited nor engaged in sexual <ln numlevel="1" lineno="107" slineno="3-39"/>intercourse with each other during the probable time of conception.</subsection><subsection ssid="19-null-14" dnum="3-o" numlevel="1" lineno="108" slineno="3-40" level="1"><display>(3)</display>The presumption may be rebutted by:<subsection ssid="19-null-15" dnum="a-o" numlevel="1" lineno="109" slineno="3-41" level="2"><display>(a)</display>genetic test results that exclude the presumed father;</subsection><subsection ssid="19-null-16" dnum="b-o" numlevel="1" lineno="110" slineno="3-42" level="2"><display>(b)</display>genetic test results that rebuttably identify another man as the father in accordance <ln numlevel="1" lineno="111" slineno="3-43"/>with Section <xref depth="3" refnumber="81-5-505">81-5-505</xref>;</subsection><subsection ssid="19-null-17" dnum="c-o" numlevel="1" lineno="112" slineno="3-44" level="2"><display>(c)</display>evidence that the presumed father and the birth mother of the child neither cohabited <ln numlevel="1" lineno="113" slineno="3-45"/>nor engaged in sexual intercourse with each other during the probable time of <ln numlevel="1" lineno="114" slineno="3-46"/>conception; or</subsection><subsection ssid="19-null-18" dnum="d-o" numlevel="1" lineno="115" slineno="3-47" level="2"><display>(d)</display>an adjudication under this part.</subsection></subsection><subsection ssid="19-null-19" dnum="4-o" numlevel="1" lineno="116" slineno="3-48" level="1"><display>(4)</display>There is no presumption to rebut if the presumed father was properly served and there <ln numlevel="1" lineno="117" slineno="3-49"/>has been a final adjudication of the issue.</subsection></section></bsec><bsec buid="20" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="118" slineno="4-1" sn="4"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="118">Section 4.  <bold>Effective Date.</bold></secline><sectionText lineno="119"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6,
