Section <bold>53-5d-102</bold> is amended to read:</secline><headchap number="53-5d" numlevel="1" lineno="28" slineno="1-2">5d. Lawful Commerce in Arms Act</headchap><catline lineno="29"><bold>53-5d-102<parens/>. Definitions.</bold></catline><sectionText lineno="30"><tab/>As used in this chapter:</sectionText><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="31" slineno="1-5" level="1"><display>(1)</display>"Ammunition" means a bullet, a cartridge case, primer, propellant powder, or other <ln numlevel="1" lineno="32" slineno="1-6"/>ammunition designed for use in any firearm, either as an individual component part or in <ln numlevel="1" lineno="33" slineno="1-7"/>a completely assembled cartridge.</subsection><subsection ssid="3-24" dnum="_-o:2-i" numlevel="1" lineno="34" slineno="1-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1001" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="10" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="end">"Antique firearm" means the same as that term is defined in Section <xref depth="3" refnumber="76-11-101">76-11-101</xref>.</amend></subsection><subsection ssid="3-23" dnum="_-o:3-i" numlevel="1" lineno="35" slineno="1-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1002" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">"Firearm" means the same as that term is defined in Section <xref depth="3" refnumber="76-11-101">76-11-101</xref>.</amend></subsection><subsection ssid="3-null-2" dnum="2-o:4-i" numlevel="1" lineno="36" slineno="1-10" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1003" style="2" owner="o" level="1" deltag="both">(2)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1004" style="1" owner="i" level="1" amendtag="both" space="true">(4)</amend></display>"Manufacturer" means, with respect to a qualified product, a person who is engaged <ln numlevel="1" lineno="37" slineno="1-11"/>in the business of manufacturing a qualified product and who is licensed to engage in <ln numlevel="1" lineno="38" slineno="1-12"/>business as a manufacturer under 18 U.S.C. Chapter 44.</subsection><subsection ssid="3-null-3" dnum="3-o:5-i" numlevel="1" lineno="39" slineno="1-13" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1004" style="2" owner="o" level="1" deltag="both">(3)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="both" space="true">(5)</amend></display>"Negligent entrustment" means the supplying of a qualified product by a seller for <ln numlevel="1" lineno="40" slineno="1-14"/>use by another person when the seller knows, or reasonably should know, the person to <ln numlevel="1" lineno="41" slineno="1-15"/>whom the product is supplied is likely to, and does, use the product in a manner <ln numlevel="1" lineno="42" slineno="1-16"/>involving unreasonable risk of physical injury to the person or others.</subsection><subsection ssid="3-null-4" dnum="4-o:6-i" numlevel="1" lineno="43" slineno="1-17" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1005" style="2" owner="o" level="1" deltag="both">(4)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="both" space="true">(6)</amend></display>"Person" means the same as that term is defined in Section <xref depth="3" refnumber="68-3-12.5" start="0">68-3-12.5</xref>.</subsection><subsection ssid="3-null-5" dnum="5-o:7-i" numlevel="1" lineno="44" slineno="1-18" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1006" style="2" owner="o" level="1" deltag="both">(5)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="both" space="true">(7)</amend></display><subsection ssid="3-null-6" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Qualified civil liability action" means a civil action or proceeding or an <ln numlevel="1" lineno="45" slineno="1-19"/>administrative proceeding brought by any person against a manufacturer or seller of a <ln numlevel="1" lineno="46" slineno="1-20"/>qualified product, or a trade association, for damages, punitive damages, injunctive or <ln numlevel="1" lineno="47" slineno="1-21"/>declaratory relief, abatement, restitution, fines, or penalties, or other relief, resulting <ln numlevel="1" lineno="48" slineno="1-22"/>from the criminal or unlawful misuse of a qualified product by the person or a third <ln numlevel="1" lineno="49" slineno="1-23"/>party.</subsection><subsection ssid="3-null-7" dnum="b-o" numlevel="1" lineno="50" slineno="1-24" level="2"><display>(b)</display>"Qualified civil liability action" does not include:<subsection ssid="3-null-8" dnum="i-o" numlevel="1" lineno="51" slineno="1-25" level="3"><display>(i)</display>an action brought against a transferor convicted under 18 U.S.C. Sec. 924(h) or <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="23" groupid="18" style="2" owner="jchristopherson" level="1" deltag="both"><ln numlevel="1" lineno="52" slineno="1-26"/>Section <xref refnumber="76-11-302" depth="4">76-11-302</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="22" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Section <xref depth="3" refnumber="76-11-216">76-11-216</xref></amend> by a party directly harmed by the conduct <ln numlevel="1" lineno="53" slineno="1-27"/>of which the transferee was convicted;</subsection><subsection ssid="3-null-9" dnum="ii-o" numlevel="1" lineno="54" slineno="1-28" level="3"><display>(ii)</display>an action brought against a seller for negligent entrustment or negligence per se;</subsection><subsection ssid="3-null-10" dnum="iii-o" numlevel="1" lineno="55" slineno="1-29" level="3"><display>(iii)</display>an action in which a manufacturer or seller of a qualified product knowingly <ln numlevel="1" lineno="56" slineno="1-30"/>violated a state or federal statute applicable to the sale or marketing of the <ln numlevel="1" lineno="57" slineno="1-31"/>product, and the violation was a proximate cause of the harm for which relief is <ln numlevel="1" lineno="58" slineno="1-32"/>sought, including:<subsection ssid="3-null-11" dnum="A-o" numlevel="1" lineno="59" slineno="1-33" level="4"><display>(A)</display>any incident in which the manufacturer or seller knowingly made any false <ln numlevel="1" lineno="60" slineno="1-34"/>entry in, or failed to make appropriate entry in, any record required to be kept <ln numlevel="1" lineno="61" slineno="1-35"/>under federal or state law with respect to the qualified product, or aided, <ln numlevel="1" lineno="62" slineno="1-36"/>abetted, or conspired with any person in making any false or fictitious oral or <ln numlevel="1" lineno="63" slineno="1-37"/>written statement with respect to any fact material to the lawfulness of the sale <ln numlevel="1" lineno="64" slineno="1-38"/>or other disposition of a qualified product; or</subsection><subsection ssid="3-null-12" dnum="B-o" numlevel="1" lineno="65" slineno="1-39" level="4"><display>(B)</display>any case in which the manufacturer or seller aided, abetted, or conspired with <ln numlevel="1" lineno="66" slineno="1-40"/>any other person to sell or otherwise dispose of a qualified product, knowing, <ln numlevel="1" lineno="67" slineno="1-41"/>or having reasonable cause to believe, that the actual buyer of the qualified <ln numlevel="1" lineno="68" slineno="1-42"/>product was prohibited from possessing or receiving a firearm or ammunition <ln numlevel="1" lineno="69" slineno="1-43"/>under 18 U.S.C. Sec. 922(g) or (n) or Title 76, Chapter 11, Part 3, Persons <ln numlevel="1" lineno="70" slineno="1-44"/>Restricted Regarding Dangerous Weapons;</subsection></subsection><subsection ssid="3-null-13" dnum="iv-o" numlevel="1" lineno="71" slineno="1-45" level="3"><display>(iv)</display>an action for breach of contract or warranty in connection with the purchase of <ln numlevel="1" lineno="72" slineno="1-46"/>the product;</subsection><subsection ssid="3-null-14" dnum="v-o" numlevel="1" lineno="73" slineno="1-47" level="3"><display>(v)</display>an action for death, physical injuries, or property damage resulting directly from a <ln numlevel="1" lineno="74" slineno="1-48"/>defect in design or manufacture of the product, when used as intended or in a <ln numlevel="1" lineno="75" slineno="1-49"/>reasonably foreseeable manner, except that where the discharge of the product <ln numlevel="1" lineno="76" slineno="1-50"/>was caused by a volitional act that constituted a criminal offense, then the act shall <ln numlevel="1" lineno="77" slineno="1-51"/>be considered the sole proximate cause of any resulting death, personal injuries, or <ln numlevel="1" lineno="78" slineno="1-52"/>property damage; or</subsection><subsection ssid="3-null-15" dnum="vi-o" numlevel="1" lineno="79" slineno="1-53" level="3"><display>(vi)</display>an action or proceeding commenced to enforce the provisions of 18 U.S.C. <ln numlevel="1" lineno="80" slineno="1-54"/>Chapter 44, 26 U.S.C. Chapter 53, or Title 76, Chapter 11, Weapons.</subsection></subsection></subsection><subsection ssid="3-null-16" dnum="6-o:8-i" numlevel="1" lineno="81" slineno="1-55" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1017" style="2" owner="o" level="1" deltag="both">(6)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="both" space="true">(8)</amend></display>"Qualified product" means a firearm<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="15" groupid="11" style="2" owner="jchristopherson" level="1" deltag="both"> or</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="14" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">,</amend> antique firearm<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="16" groupid="12" style="2" owner="jchristopherson" level="1" deltag="both">, as defined in Section <xref depth="3" refnumber="76-11-101"><ln numlevel="1" lineno="82" slineno="1-56"/>76-11-101</xref></amend><amendoutend style="2"/>, ammunition, or a component part of a firearm or ammunition.</subsection><subsection ssid="3-null-17" dnum="7-o:9-i" numlevel="1" lineno="83" slineno="1-57" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1018" style="2" owner="o" level="1" deltag="both">(7)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1019" style="1" owner="i" level="1" amendtag="both" space="true">(9)</amend></display>"Seller" means, with respect to a qualified product, a federal firearms licensee, as <ln numlevel="1" lineno="84" slineno="1-58"/>defined in Section <xref depth="3" refnumber="53-5a-601">53-5a-601</xref>.</subsection><subsection ssid="3-null-18" dnum="8-o:10-i" numlevel="1" lineno="85" slineno="1-59" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1019" style="2" owner="o" level="1" deltag="both">(8)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1020" style="1" owner="i" level="1" amendtag="both" space="true">(10)</amend></display>"Trade association" means:<subsection ssid="3-null-19" dnum="a-o" numlevel="1" lineno="86" slineno="1-60" level="2"><display>(a)</display>any corporation, unincorporated association, federation, business league, or <ln numlevel="1" lineno="87" slineno="1-61"/>professional or business organization not organized or operated for profit and no part <ln numlevel="1" lineno="88" slineno="1-62"/>of the net earnings of which inures to the benefit of any private shareholder or <ln numlevel="1" lineno="89" slineno="1-63"/>individual;</subsection><subsection ssid="3-null-20" dnum="b-o" numlevel="1" lineno="90" slineno="1-64" level="2"><display>(b)</display>an organization described in 26 U.S.C. Sec. 501(c)(6) and exempt from tax under 26 <ln numlevel="1" lineno="91" slineno="1-65"/>U.S.C. Sec. 501(a); and</subsection><subsection ssid="3-null-21" dnum="c-o" numlevel="1" lineno="92" slineno="1-66" level="2"><display>(c)</display>an organization, two or more members of which are manufacturers or sellers of a <ln numlevel="1" lineno="93" slineno="1-67"/>qualified product.</subsection></subsection><subsection ssid="3-null-22" dnum="9-o:11-i" numlevel="1" lineno="94" slineno="1-68" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1023" style="2" owner="o" level="1" deltag="both">(9)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1024" style="1" owner="i" level="1" amendtag="both" space="true">(11)</amend></display>"Unlawful misuse" means conduct that violates a statute, ordinance, or regulation <ln numlevel="1" lineno="95" slineno="1-69"/>as <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="20" groupid="15" style="2" owner="jchristopherson" level="1" deltag="both">it</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="19" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the conduct</amend> relates to the use of a qualified product.</subsection></section></bsec><bsec buid="5" num="53-5d-103" type="amend" src="code" uid="C53-5d-S103_2026050620260506" sort="53 05d01030020260506" numlevel="1" lineno="96" slineno="2-1" sn="2"><section number="53-5d-103" numlevel="1" lineno="97" slineno="2-2" type="amend"><secline lineno="96">Section 2. Section <bold>53-5d-103</bold> is amended to read:</secline><catline lineno="97"><bold>53-5d-103<parens/>. Limitations on liability.</bold></catline><subsection ssid="5-null-1" dnum="1-o" numlevel="1" lineno="98" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>A manufacturer or seller of a qualified product, or trade association, is not subject to a <ln numlevel="1" lineno="99" slineno="2-4"/>qualified civil liability action regarding the unlawful misuse of a qualified product <ln numlevel="1" lineno="100" slineno="2-5"/>unless an injury or death results from an act or omission of the manufacturer, seller, or <ln numlevel="1" lineno="101" slineno="2-6"/>trade association that constitutes gross negligence, recklessness, or intentional <ln numlevel="1" lineno="102" slineno="2-7"/>misconduct.</subsection><subsection ssid="5-39" dnum="_-o:2-i" numlevel="1" lineno="103" slineno="2-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1025" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><subsection ssid="5-40" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1026" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="166" groupid="126" style="1" owner="jchristopherson" level="1" amendtag="end">A person may not bring a civil liability action against a manufacturer or seller that <ln numlevel="1" lineno="104" slineno="2-9"/>is based upon Subsection <xref depth="4" refnumber="53-5d-102(7)(b)(iii)">53-5d-102(7)(b)(iii)</xref>, concerning a statute applicable to the <ln numlevel="1" lineno="105" slineno="2-10"/>sale or marketing of a qualified product, unless:</amend><subsection ssid="5-41" dnum="_-o:i-i" numlevel="1" lineno="106" slineno="2-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1027" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="167" groupid="127" style="1" owner="jchristopherson" level="1" amendtag="end">the statute that is cited as the basis for the civil liability action:</amend><subsection ssid="5-42" dnum="_-o:A-i" numlevel="1" lineno="107" slineno="2-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1028" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="170" groupid="129" style="1" owner="jchristopherson" level="1" amendtag="end">explicitly regulates firearms or ammunition; and</amend></subsection><subsection ssid="5-43" dnum="_-o:B-i" numlevel="1" lineno="108" slineno="2-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1029" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="173" groupid="131" style="1" owner="jchristopherson" level="1" amendtag="end">provides clear and specific requirements that the manufacturer or seller is <ln numlevel="1" lineno="109" slineno="2-14"/>alleged in the civil liability action to have failed to have met; and</amend></subsection></subsection><subsection ssid="5-44" dnum="_-o:ii-i" numlevel="1" lineno="110" slineno="2-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1030" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="176" groupid="133" style="1" owner="jchristopherson" level="1" amendtag="end">the alleged violation of the statute described in Subsection <xref depth="4" refnumber="53-5d-103(2)(a)(i)">(2)(a)(i)</xref> is alleged to <ln numlevel="1" lineno="111" slineno="2-16"/>have directly caused the harm alleged in the civil liability action.</amend></subsection></subsection><subsection ssid="5-45" dnum="_-o:b-i" numlevel="1" lineno="112" slineno="2-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1031" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="179" groupid="135" style="1" owner="jchristopherson" level="1" amendtag="end">A general consumer protection statute, marketing statute, public nuisance statute, or <ln numlevel="1" lineno="113" slineno="2-18"/>other statute that does not meet the requirements described in Subsection <xref depth="4" refnumber="53-5d-103(2)(a)">(2)(a)</xref> may <ln numlevel="1" lineno="114" slineno="2-19"/>not be considered as a statute applicable to the sale or marketing of firearms or <ln numlevel="1" lineno="115" slineno="2-20"/>ammunition for purposes of Subsection <xref depth="4" refnumber="53-5d-102(7)(b)(iii)">53-5d-102(7)(b)(iii)</xref>.</amend></subsection><subsection ssid="5-46" dnum="_-o:c-i" numlevel="1" lineno="116" slineno="2-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1032" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="182" groupid="137" style="1" owner="jchristopherson" level="1" amendtag="end">A court may not interpret Subsection <xref depth="4" refnumber="53-5d-102(7)(b)(iii)">53-5d-102(7)(b)(iii)</xref> broadly.</amend></subsection></subsection><subsection ssid="5-48" dnum="_-o:3-i" numlevel="1" lineno="117" slineno="2-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1033" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="188" groupid="141" style="1" owner="jchristopherson" level="1" amendtag="end">A person may not bring a negligent marketing claim against a manufacturer or seller of <ln numlevel="1" lineno="118" slineno="2-23"/>a qualified product unless:</amend><subsection ssid="5-49" dnum="_-o:a-i" numlevel="1" lineno="119" slineno="2-24" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1034" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="193" groupid="145" style="1" owner="jchristopherson" level="1" amendtag="end">the marketing practice directly targets individuals who are legally prohibited from <ln numlevel="1" lineno="120" slineno="2-25"/>owning a qualified product;</amend></subsection><subsection ssid="5-50" dnum="_-o:b-i" numlevel="1" lineno="121" slineno="2-26" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1035" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="198" groupid="149" style="1" owner="jchristopherson" level="1" amendtag="end">the marketing practice encourages or facilitates the unlawful use of a qualified <ln numlevel="1" lineno="122" slineno="2-27"/>product;</amend></subsection><subsection ssid="5-51" dnum="_-o:c-i" numlevel="1" lineno="123" slineno="2-28" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1036" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="203" groupid="153" style="1" owner="jchristopherson" level="1" amendtag="end">there is a direct and substantial causal link between the marketing practice and the <ln numlevel="1" lineno="124" slineno="2-29"/>harm suffered by the plaintiff; and</amend></subsection><subsection ssid="5-52" dnum="_-o:d-i" numlevel="1" lineno="125" slineno="2-30" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1037" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="208" groupid="157" style="1" owner="jchristopherson" level="1" amendtag="end">the marketing practice violates a state or federal statute that explicitly regulates the <ln numlevel="1" lineno="126" slineno="2-31"/>sale or marketing of a qualified product in a manner that constitutes a willful and <ln numlevel="1" lineno="127" slineno="2-32"/>knowing violation of the law. </amend></subsection></subsection><subsection ssid="5-null-2" dnum="2-o:4-i" numlevel="1" lineno="128" slineno="2-33" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1038" style="2" owner="o" level="1" deltag="both">(2)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1039" style="1" owner="i" level="1" amendtag="both" space="true">(4)</amend></display>A <amend anum="0" ea="amend" pairid="74" groupid="59" style="1" owner="jchristopherson" level="1" amendtag="both">court shall dismiss a </amend>civil liability action against a manufacturer, seller, or trade <ln numlevel="1" lineno="129" slineno="2-34"/>association that<amend anum="0" ea="amend" pairid="139" groupid="105" style="1" owner="jchristopherson" level="1" amendtag="both">:</amend><subsection ssid="5-36" dnum="_-o:a-i" numlevel="1" lineno="130" slineno="2-35" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1039" style="1" owner="i" level="1" amendtag="both">(a)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="148" groupid="113" style="2" owner="jchristopherson" level="1" deltag="both"> </amend><amendoutend style="2"/>does not allege any of the provisions of Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="67" groupid="53" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="53-5d-102(5)(b)" start="0">53-5d-102(5)(b)</xref> shall be <ln numlevel="1" lineno="131" slineno="2-36"/>dismissed.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="83" groupid="67" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref refnumber="3-null-7">53-5d-102(7)(b)</xref>;
