Wilcox</sponsorhead><otherSponsorhead>Senate Sponsor: </otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill amends provisions related to public safety data.</gd><hphead lineno="6">Highlighted Provisions:</hphead><hp numlevel="1" lineno="7" slineno="0-7">This bill:<hl numlevel="1" lineno="8" slineno="0-8" level="1">removes a report required to be submitted by the Bureau of Criminal Identification to the <ln numlevel="1" lineno="9" slineno="0-9"/>Law Enforcement and Criminal Justice Interim Committee regarding attempted weapons <ln numlevel="1" lineno="10" slineno="0-10"/>purchases by individuals who are restricted from purchasing, possessing, or transferring <ln numlevel="1" lineno="11" slineno="0-11"/>a firearm as a result of a conviction for an offense involving domestic violence and <ln numlevel="1" lineno="12" slineno="0-12"/>requires the report to be submitted to the State Commission on Criminal and Juvenile <ln numlevel="1" lineno="13" slineno="0-13"/>Justice (commission) to be included in the public safety portal;</hl><hl numlevel="1" lineno="14" slineno="0-14" level="1">removes a report required to be submitted by the Division of Juvenile Justice and Youth <ln numlevel="1" lineno="15" slineno="0-15"/>Services to the Law Enforcement and Criminal Justice Interim Committee regarding <ln numlevel="1" lineno="16" slineno="0-16"/>data of sexual assaults in detention and secure care facilities and requires the report to be <ln numlevel="1" lineno="17" slineno="0-17"/>submitted to the commission to be included in the public safety portal;</hl><hl numlevel="1" lineno="18" slineno="0-18" level="1">removes a report required to be submitted by the Department of Corrections to the Law <ln numlevel="1" lineno="19" slineno="0-19"/>Enforcement and Criminal Justice Interim Committee regarding data of sexual assaults <ln numlevel="1" lineno="20" slineno="0-20"/>in correctional facilities and requires the report to be submitted to the commission to be <ln numlevel="1" lineno="21" slineno="0-21"/>included in the public safety portal;</hl><hl numlevel="1" lineno="22" slineno="0-22" level="1">requires institutions of higher education to provide data of crime in student housing to the <ln numlevel="1" lineno="23" slineno="0-23"/>commission to be included in the public safety portal;</hl><hl numlevel="1" lineno="24" slineno="0-24" level="1"> requires the multi-agency strike force to combat violent and other major felony crimes to <ln numlevel="1" lineno="25" slineno="0-25"/>submit the strike force's annual report to the commission to be included in the public <ln numlevel="1" lineno="26" slineno="0-26"/>safety portal;</hl><hl numlevel="1" lineno="27" slineno="0-27" level="1">requires the commission to include a report from the Board of Pardons and Parole <ln numlevel="1" lineno="28" slineno="0-28"/>regarding metrics of offenders in the public safety portal;</hl><hl numlevel="1" lineno="29" slineno="0-29" level="1">requires the Prosecutor Conduct Commission to provide the Prosecutor Conduct <ln numlevel="1" lineno="30" slineno="0-30"/>Commission's annual report on prosecutorial complaints to the commission to be <ln numlevel="1" lineno="31" slineno="0-31"/>included in the public safety portal;</hl><hl numlevel="1" lineno="32" slineno="0-32" level="1">requires the Department of Public Safety and the Bureau of Forensic Services to provide <ln numlevel="1" lineno="33" slineno="0-33"/>an annual report on sexual assault kits to the commission to be included in the public <ln numlevel="1" lineno="34" slineno="0-34"/>safety portal;</hl><hl numlevel="1" lineno="35" slineno="0-35" level="1">requires the Sentencing Commission to annually provide the master offense list and <ln numlevel="1" lineno="36" slineno="0-36"/>collateral consequences guide to the commission to be included in the public safety <ln numlevel="1" lineno="37" slineno="0-37"/>portal;</hl><hl numlevel="1" lineno="38" slineno="0-38" level="1">adds requirements for the commission regarding the public safety portal;</hl><hl numlevel="1" lineno="39" slineno="0-39" level="1">clarifies that the commission is not required to provide records in response to a record <ln numlevel="1" lineno="40" slineno="0-40"/>request under the Government Records Access and Management Act for records <ln numlevel="1" lineno="41" slineno="0-41"/>received by the commission for the public safety portal;</hl><hl numlevel="1" lineno="42" slineno="0-42" level="1">requires entities involved in criminal justice to provide anonymized criminal justice <ln numlevel="1" lineno="43" slineno="0-43"/>information to researchers in certain circumstances; Section <bold>53-5a-602</bold> is amended to read:</secline><catline lineno="71"><bold>53-5a-602<parens/>. Criminal background check prior to purchase of a firearm -- Fee -- <ln numlevel="1" lineno="72" slineno="1-3"/>Exemption for concealed firearm permit holders and law enforcement officers.</bold></catline><subsection ssid="5-null-1" dnum="1-o" numlevel="1" lineno="73" slineno="1-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="5-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>To establish personal identification and residence in this state for purposes of this <ln numlevel="1" lineno="74" slineno="1-5"/>part, a dealer shall require an individual receiving a firearm to present one photo <ln numlevel="1" lineno="75" slineno="1-6"/>identification on a form issued by a governmental agency of the state.</subsection><subsection ssid="5-null-3" dnum="b-o" numlevel="1" lineno="76" slineno="1-7" level="2"><display>(b)</display>A dealer may not accept a driving privilege card issued under Section <xref depth="3" refnumber="53-3-207" start="0">53-3-207</xref> as <ln numlevel="1" lineno="77" slineno="1-8"/>proof of identification for the purpose of establishing personal identification and <ln numlevel="1" lineno="78" slineno="1-9"/>residence in this state as required under this Subsection <xref depth="4" refnumber="76-10-526(1)">(1)</xref>.</subsection></subsection><subsection ssid="5-null-4" dnum="2-o" numlevel="1" lineno="79" slineno="1-10" level="1" space="false"><display>(2)</display><subsection ssid="5-null-5" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A criminal history background check is required for the sale of a firearm by a <ln numlevel="1" lineno="80" slineno="1-11"/>licensed firearm dealer in the state.</subsection><subsection ssid="5-null-6" dnum="b-o" numlevel="1" lineno="81" slineno="1-12" level="2"><display>(b)</display>Subsection <xref depth="4" refnumber="76-10-526(2)(a)">(2)(a)</xref> does not apply to the sale of a firearm to a Federal Firearms <ln numlevel="1" lineno="82" slineno="1-13"/>Licensee.</subsection></subsection><subsection ssid="5-null-7" dnum="3-o" numlevel="1" lineno="83" slineno="1-14" level="1" space="false"><display>(3)</display><subsection ssid="5-null-8" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An individual purchasing a firearm from a dealer shall consent in writing to a <ln numlevel="1" lineno="84" slineno="1-15"/>criminal background check, on a form provided by the bureau.</subsection><subsection ssid="5-null-9" dnum="b-o" numlevel="1" lineno="85" slineno="1-16" level="2"><display>(b)</display>The form shall contain the following information:<subsection ssid="5-null-10" dnum="i-o" numlevel="1" lineno="86" slineno="1-17" level="3"><display>(i)</display>the dealer identification number;</subsection><subsection ssid="5-null-11" dnum="ii-o" numlevel="1" lineno="87" slineno="1-18" level="3"><display>(ii)</display>the name and address of the individual receiving the firearm;</subsection><subsection ssid="5-null-12" dnum="iii-o" numlevel="1" lineno="88" slineno="1-19" level="3"><display>(iii)</display>the date of birth, height, weight, eye color, and hair color of the individual <ln numlevel="1" lineno="89" slineno="1-20"/>receiving the firearm; and</subsection><subsection ssid="5-null-13" dnum="iv-o" numlevel="1" lineno="90" slineno="1-21" level="3"><display>(iv)</display>the social security number or any other identification number of the individual <ln numlevel="1" lineno="91" slineno="1-22"/>receiving the firearm.</subsection></subsection></subsection><subsection ssid="5-null-14" dnum="4-o" numlevel="1" lineno="92" slineno="1-23" level="1" space="false"><display>(4)</display><subsection ssid="5-null-15" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The dealer shall send the information required by Subsection <xref depth="4" refnumber="76-10-526(3)">(3)</xref> to the bureau <ln numlevel="1" lineno="93" slineno="1-24"/>immediately upon its receipt by the dealer.</subsection><subsection ssid="5-null-16" dnum="b-o" numlevel="1" lineno="94" slineno="1-25" level="2"><display>(b)</display>A dealer may not sell or transfer a firearm to an individual until the dealer has <ln numlevel="1" lineno="95" slineno="1-26"/>provided the bureau with the information in Subsection <xref depth="4" refnumber="76-10-526(3)">(3)</xref> and has received approval <ln numlevel="1" lineno="96" slineno="1-27"/>from the bureau under Subsection <xref depth="4" refnumber="76-10-526(6)">(6)</xref>.</subsection></subsection><subsection ssid="5-null-17" dnum="5-o" numlevel="1" lineno="97" slineno="1-28" level="1"><display>(5)</display>The dealer shall make a request for criminal history background information by <ln numlevel="1" lineno="98" slineno="1-29"/>telephone or other electronic means to the bureau and shall receive approval or denial of <ln numlevel="1" lineno="99" slineno="1-30"/>the inquiry by telephone or other electronic means.</subsection><subsection ssid="5-null-18" dnum="6-o" numlevel="1" lineno="100" slineno="1-31" level="1"><display>(6)</display>When the dealer calls for or requests a criminal history background check, the bureau <ln numlevel="1" lineno="101" slineno="1-32"/>shall:<subsection ssid="5-null-19" dnum="a-o" numlevel="1" lineno="102" slineno="1-33" level="2"><display>(a)</display>review the criminal history files, including juvenile court records, and the temporary <ln numlevel="1" lineno="103" slineno="1-34"/>restricted file created under Section <xref depth="3" refnumber="53-5a-504">53-5a-504</xref>, to determine if the individual is <ln numlevel="1" lineno="104" slineno="1-35"/>prohibited from purchasing, possessing, or transferring a firearm by state or federal <ln numlevel="1" lineno="105" slineno="1-36"/>law;</subsection><subsection ssid="5-null-20" dnum="b-o" numlevel="1" lineno="106" slineno="1-37" level="2"><display>(b)</display>inform the dealer that:<subsection ssid="5-null-21" dnum="i-o" numlevel="1" lineno="107" slineno="1-38" level="3"><display>(i)</display>the records indicate the individual is prohibited; or</subsection><subsection ssid="5-null-22" dnum="ii-o" numlevel="1" lineno="108" slineno="1-39" level="3"><display>(ii)</display>the individual is approved for purchasing, possessing, or transferring a firearm;</subsection></subsection><subsection ssid="5-null-23" dnum="c-o" numlevel="1" lineno="109" slineno="1-40" level="2"><display>(c)</display>provide the dealer with a unique transaction number for that inquiry; and</subsection><subsection ssid="5-null-24" dnum="d-o" numlevel="1" lineno="110" slineno="1-41" level="2"><display>(d)</display>provide a response to the requesting dealer during the call for a criminal background <ln numlevel="1" lineno="111" slineno="1-42"/>check, or by return call, or other electronic means, without delay, except in case of <ln numlevel="1" lineno="112" slineno="1-43"/>electronic failure or other circumstances beyond the control of the bureau, the bureau <ln numlevel="1" lineno="113" slineno="1-44"/>shall advise the dealer of the reason for the delay and give the dealer an estimate of <ln numlevel="1" lineno="114" slineno="1-45"/>the length of the delay.</subsection></subsection><subsection ssid="5-null-25" dnum="7-o" numlevel="1" lineno="115" slineno="1-46" level="1" space="false"><display>(7)</display><subsection ssid="5-null-26" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The bureau may not maintain any records of the criminal history background <ln numlevel="1" lineno="116" slineno="1-47"/>check longer than 20 days from the date of the dealer's request, if the bureau <ln numlevel="1" lineno="117" slineno="1-48"/>determines that the individual receiving the firearm is not prohibited from <ln numlevel="1" lineno="118" slineno="1-49"/>purchasing, possessing, or transferring the firearm under state or federal law.</subsection><subsection ssid="5-null-27" dnum="b-o" numlevel="1" lineno="119" slineno="1-50" level="2"><display>(b)</display>However, the bureau shall maintain a log of requests containing the dealer's federal <ln numlevel="1" lineno="120" slineno="1-51"/>firearms number, the transaction number, and the transaction date for a period of 12 <ln numlevel="1" lineno="121" slineno="1-52"/>months.</subsection></subsection><subsection ssid="5-null-28" dnum="8-o" numlevel="1" lineno="122" slineno="1-53" level="1" space="false"><display>(8)</display><subsection ssid="5-null-29" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If the criminal history background check discloses information indicating that the <ln numlevel="1" lineno="123" slineno="1-54"/>individual attempting to purchase the firearm is prohibited from purchasing, <ln numlevel="1" lineno="124" slineno="1-55"/>possessing, or transferring a firearm, the bureau shall:<subsection ssid="5-null-30" dnum="i-o" numlevel="1" lineno="125" slineno="1-56" level="3" tab="1"><display>(i)</display>within 24 hours after determining that the purchaser is prohibited from purchasing, <ln numlevel="1" lineno="126" slineno="1-57"/>possessing, or transferring a firearm, notify the law enforcement agency in the <ln numlevel="1" lineno="127" slineno="1-58"/>jurisdiction where the dealer is located; and</subsection><subsection ssid="5-null-31" dnum="ii-o" numlevel="1" lineno="128" slineno="1-59" level="3" tab="1"><display>(ii)</display>inform the law enforcement agency in the jurisdiction where the individual <ln numlevel="1" lineno="129" slineno="1-60"/>resides.</subsection></subsection><subsection ssid="5-null-32" dnum="b-o" numlevel="1" lineno="130" slineno="1-61" level="2"><display>(b)</display>Subsection <xref depth="4" refnumber="76-10-526(8)(a)">(8)(a)</xref> does not apply to an individual prohibited from purchasing a <ln numlevel="1" lineno="131" slineno="1-62"/>firearm solely due to placement on the temporary restricted list under Section <xref depth="3" refnumber="53-5a-504"><ln numlevel="1" lineno="132" slineno="1-63"/>53-5a-504</xref>.</subsection><subsection ssid="5-null-33" dnum="c-o" numlevel="1" lineno="133" slineno="1-64" level="2"><display>(c)</display>A law enforcement agency that receives information from the bureau under <ln numlevel="1" lineno="134" slineno="1-65"/>Subsection <xref depth="4" refnumber="76-10-526(8)(a)">(8)(a)</xref> shall provide a report before August 1 of each year to the bureau <ln numlevel="1" lineno="135" slineno="1-66"/>that includes:<subsection ssid="5-null-34" dnum="i-o" numlevel="1" lineno="136" slineno="1-67" level="3"><display>(i)</display>based on the information the bureau provides to the law enforcement agency under <ln numlevel="1" lineno="137" slineno="1-68"/>Subsection <xref depth="4" refnumber="76-10-526(8)(a)">(8)(a)</xref>, the number of cases that involve an individual who is <ln numlevel="1" lineno="138" slineno="1-69"/>prohibited from purchasing, possessing, or transferring a firearm as a result of a <ln numlevel="1" lineno="139" slineno="1-70"/>conviction for an offense involving domestic violence; and</subsection><subsection ssid="5-null-35" dnum="ii-o" numlevel="1" lineno="140" slineno="1-71" level="3"><display>(ii)</display>of the cases described in Subsection <xref depth="4" refnumber="76-10-526(8)(c)(i)">(8)(c)(i)</xref>:<subsection ssid="5-null-36" dnum="A-o" numlevel="1" lineno="141" slineno="1-72" level="4"><display>(A)</display>the number of cases the law enforcement agency investigates; and</subsection><subsection ssid="5-null-37" dnum="B-o" numlevel="1" lineno="142" slineno="1-73" level="4"><display>(B)</display>the number of cases the law enforcement agency investigates that result in a <ln numlevel="1" lineno="143" slineno="1-74"/>criminal charge.</subsection></subsection></subsection><subsection ssid="5-null-38" dnum="d-o" numlevel="1" lineno="144" slineno="1-75" level="2"><display>(d)</display>The bureau shall:<subsection ssid="5-null-39" dnum="i-o" numlevel="1" lineno="145" slineno="1-76" level="3"><display>(i)</display>compile the information from the reports described in Subsection <xref depth="4" refnumber="76-10-526(8)(c)">(8)(c)</xref>;</subsection><subsection ssid="5-null-40" dnum="ii-o" numlevel="1" lineno="146" slineno="1-77" level="3"><display>(ii)</display>omit or redact any identifying information in the compilation; and</subsection><subsection ssid="5-null-41" dnum="iii-o" numlevel="1" lineno="147" slineno="1-78" level="3"><display>(iii)</display>submit the compilation to the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="2" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both">Law Enforcement and Criminal Justice Interim <ln numlevel="1" lineno="148" slineno="1-79"/>Committee</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="4" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">State Commission on Criminal and Juvenile Justice created in Section <xref depth="3" refnumber="63M-7-201"><ln numlevel="1" lineno="149" slineno="1-80"/>63M-7-201</xref></amend> before November 1 of each year.</subsection></subsection></subsection><subsection ssid="5-null-42" dnum="9-o" numlevel="1" lineno="150" slineno="1-81" level="1"><display>(9)</display>If an individual is denied the right to purchase a firearm under this section, the <ln numlevel="1" lineno="151" slineno="1-82"/>individual may review the individual's criminal history information and may challenge <ln numlevel="1" lineno="152" slineno="1-83"/>or amend the information as provided in Section <xref depth="3" refnumber="53-10-108" start="0">53-10-108</xref>.</subsection><subsection ssid="5-null-43" dnum="10-o" numlevel="1" lineno="153" slineno="1-84" level="1"><display>(10)</display>The bureau shall make rules in accordance with <xref depth="1" refnumber="63G-3" start="0">Title 63G, Chapter 3, Utah <ln numlevel="1" lineno="154" slineno="1-85"/>Administrative Rulemaking Act</xref>, to ensure the identity, confidentiality, and security of <ln numlevel="1" lineno="155" slineno="1-86"/>all records provided by the bureau under this part are in conformance with the <ln numlevel="1" lineno="156" slineno="1-87"/>requirements of the Brady Handgun Violence Prevention Act, Pub. L. No. 103-159, 107 <ln numlevel="1" lineno="157" slineno="1-88"/>Stat. 1536 (1993).</subsection><subsection ssid="5-null-44" dnum="11-o" numlevel="1" lineno="158" slineno="1-89" level="1" space="false"><display>(11)</display><subsection ssid="5-null-45" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A dealer shall collect a criminal history background check fee for the sale of a <ln numlevel="1" lineno="159" slineno="1-90"/>firearm under this section.</subsection><subsection ssid="5-null-46" dnum="b-o" numlevel="1" lineno="160" slineno="1-91" level="2"><display>(b)</display>The fee described under Subsection <xref depth="4" refnumber="76-10-526(11)(a)">(11)(a)</xref> remains in effect until changed by the <ln numlevel="1" lineno="161" slineno="1-92"/>bureau through the process described in Section <xref depth="3" refnumber="63J-1-504" start="0">63J-1-504</xref>.</subsection><subsection ssid="5-null-47" dnum="c-o" numlevel="1" lineno="162" slineno="1-93" level="2" space="false"><display>(c)</display><subsection ssid="5-null-48" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The dealer shall forward at one time all fees collected for criminal history <ln numlevel="1" lineno="163" slineno="1-94"/>background checks performed during the month to the bureau by the last day of <ln numlevel="1" lineno="164" slineno="1-95"/>the month following the sale of a firearm.</subsection><subsection ssid="5-null-49" dnum="ii-o" numlevel="1" lineno="165" slineno="1-96" level="3"><display>(ii)</display>The bureau shall deposit the fees in the General Fund as dedicated credits to <ln numlevel="1" lineno="166" slineno="1-97"/>cover the cost of administering and conducting the criminal history background <ln numlevel="1" lineno="167" slineno="1-98"/>check program.</subsection></subsection></subsection><subsection ssid="5-null-50" dnum="12-o" numlevel="1" lineno="168" slineno="1-99" level="1" space="false"><display>(12)</display><subsection ssid="5-null-51" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An individual with a concealed firearm permit issued under Section <xref depth="3" refnumber="53-5a-303">53-5a-303</xref> or <ln numlevel="1" lineno="169" slineno="1-100"/>a provisional concealed firearm permit issued under Section <xref depth="3" refnumber="53-5a-304">53-5a-304</xref> is exempt <ln numlevel="1" lineno="170" slineno="1-101"/>from the background check and corresponding fee required in this section for the <ln numlevel="1" lineno="171" slineno="1-102"/>purchase of a firearm if:<subsection ssid="5-null-52" dnum="i-o" numlevel="1" lineno="172" slineno="1-103" level="3" tab="1"><display>(i)</display>the individual presents the individual's concealed firearm permit to the dealer prior <ln numlevel="1" lineno="173" slineno="1-104"/>to purchase of the firearm; and</subsection><subsection ssid="5-null-53" dnum="ii-o" numlevel="1" lineno="174" slineno="1-105" level="3" tab="1"><display>(ii)</display>the dealer verifies with the bureau that the individual's concealed firearm permit <ln numlevel="1" lineno="175" slineno="1-106"/>is valid.</subsection></subsection><subsection ssid="5-null-54" dnum="b-o" numlevel="1" lineno="176" slineno="1-107" level="2"><display>(b)</display>An individual with a temporary permit to carry a concealed firearm issued under <ln numlevel="1" lineno="177" slineno="1-108"/>Section <xref depth="3" refnumber="53-5a-305">53-5a-305</xref> is not exempt from a background check and the corresponding fee <ln numlevel="1" lineno="178" slineno="1-109"/>required in this section for the purchase of a firearm.</subsection></subsection><subsection ssid="5-null-55" dnum="13-o" numlevel="1" lineno="179" slineno="1-110" level="1" space="false"><display>(13)</display><subsection ssid="5-null-56" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A law enforcement officer, as defined in Section <xref depth="3" refnumber="53-13-103" start="0">53-13-103</xref>, is exempt from the <ln numlevel="1" lineno="180" slineno="1-111"/>background check fee required in this section for the purchase of a personal firearm <ln numlevel="1" lineno="181" slineno="1-112"/>to be carried while off-duty if the law enforcement officer verifies current <ln numlevel="1" lineno="182" slineno="1-113"/>employment by providing a letter of good standing from the officer's commanding <ln numlevel="1" lineno="183" slineno="1-114"/>officer and current law enforcement photo identification.</subsection><subsection ssid="5-null-57" dnum="b-o" numlevel="1" lineno="184" slineno="1-115" level="2"><display>(b)</display>Subsection <xref depth="4" refnumber="76-10-526(13)(a)">(13)(a)</xref> may only be used by a law enforcement officer to purchase a <ln numlevel="1" lineno="185" slineno="1-116"/>personal firearm once in a 24-month period.</subsection></subsection><subsection ssid="5-null-58" dnum="14-o" numlevel="1" lineno="186" slineno="1-117" level="1"><display>(14)</display>A dealer engaged in the business of selling, leasing, or otherwise transferring a firearm <ln numlevel="1" lineno="187" slineno="1-118"/>shall:<subsection ssid="5-null-59" dnum="a-o" numlevel="1" lineno="188" slineno="1-119" level="2"><display>(a)</display>make the firearm safety brochure described in Subsection <xref depth="4" refnumber="26B-5-211(3)" start="0">26B-5-211(3)</xref> available to <ln numlevel="1" lineno="189" slineno="1-120"/>a customer free of charge; and</subsection><subsection ssid="5-null-60" dnum="b-o" numlevel="1" lineno="190" slineno="1-121" level="2"><display>(b)</display>at the time of purchase, distribute a cable-style gun lock provided to the dealer under <ln numlevel="1" lineno="191" slineno="1-122"/>Subsection <xref depth="4" refnumber="26B-5-211(3)" start="0">26B-5-211(3)</xref> to a customer purchasing a shotgun, short barreled shotgun, <ln numlevel="1" lineno="192" slineno="1-123"/>short barreled rifle, rifle, or another firearm that federal law does not require be <ln numlevel="1" lineno="193" slineno="1-124"/>accompanied by a gun lock at the time of purchase.</subsection></subsection></section></bsec><bsec buid="19" num="53-10-910" type="amend" src="code" uid="C53-10-S910_2026050620260506" sort="53 10 09100020260506" numlevel="1" lineno="194" slineno="2-1" sn="2"><section number="53-10-910" numlevel="1" lineno="195" slineno="2-2" type="amend"><secline lineno="194">Section 2. Section <bold>53-10-910</bold> is amended to read:</secline><catline lineno="195"><bold>53-10-910<parens/>. Reporting requirement.</bold></catline><sectionText lineno="196"><tab/>The Department of Public Safety and the Utah Bureau of Forensic Services shall report <ln numlevel="1" lineno="197" slineno="2-4"/>by July 31 of each year to<amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both"> the State Commission on Criminal and Juvenile Justice created in <ln numlevel="1" lineno="198" slineno="2-5"/>Section <xref depth="3" refnumber="63M-7-201">63M-7-201</xref>,</amend> the Law Enforcement and Criminal Justice Interim Committee<amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both">,</amend> and the <ln numlevel="1" lineno="199" slineno="2-6"/>Criminal Justice Appropriations Subcommittee regarding:</sectionText><subsection ssid="19-null-1" dnum="1-o" numlevel="1" lineno="200" slineno="2-7" level="1"><display>(1)</display>the timelines set for testing all sexual assault kits submitted to the Utah Bureau of <ln numlevel="1" lineno="201" slineno="2-8"/>Forensic Services as provided in Subsection <xref depth="4" refnumber="53-10-903(2)" start="0">53-10-903(2)</xref>;</subsection><subsection ssid="19-null-2" dnum="2-o" numlevel="1" lineno="202" slineno="2-9" level="1"><display>(2)</display>the goals established in Section <xref depth="3" refnumber="53-10-909" start="0">53-10-909</xref>;</subsection><subsection ssid="19-null-3" dnum="3-o" numlevel="1" lineno="203" slineno="2-10" level="1"><display>(3)</display>the status of meeting those goals;</subsection><subsection ssid="19-null-4" dnum="4-o" numlevel="1" lineno="204" slineno="2-11" level="1"><display>(4)</display>the number of sexual assault kits that are sent to the Utah Bureau of Forensic Services <ln numlevel="1" lineno="205" slineno="2-12"/>for testing;</subsection><subsection ssid="19-null-5" dnum="5-o" numlevel="1" lineno="206" slineno="2-13" level="1"><display>(5)</display>the number of restricted kits held by law enforcement;</subsection><subsection ssid="19-null-6" dnum="6-o" numlevel="1" lineno="207" slineno="2-14" level="1"><display>(6)</display>the number of sexual assault kits that are not processed in accordance with the timelines <ln numlevel="1" lineno="208" slineno="2-15"/>established in this part; and</subsection><subsection ssid="19-null-7" dnum="7-o" numlevel="1" lineno="209" slineno="2-16" level="1"><display>(7)</display>future appropriations requests that will ensure that all DNA cases can be processed <ln numlevel="1" lineno="210" slineno="2-17"/>according to the timelines established by this part.</subsection></section></bsec><bsec buid="33" num="53H-7-603" type="amend" src="code" uid="C53H-7-S603_2026050620260506" sort="53H07 06030020260506" numlevel="1" lineno="211" slineno="3-1" sn="3"><section number="53H-7-603" numlevel="1" lineno="212" slineno="3-2" type="amend"><secline lineno="211">Section 3. Section <bold>53H-7-603</bold> is amended to read:</secline><catline lineno="212"><bold>53H-7-603<parens/>. Student housing crime reporting.</bold></catline><subsection ssid="33-null-1" dnum="1-o" numlevel="1" lineno="213" slineno="3-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="33-null-2" dnum="a-o" numlevel="1" lineno="214" slineno="3-4" level="2"><display>(a)</display>"Campus law enforcement" means an institution's police department.</subsection><subsection ssid="33-null-3" dnum="b-o" numlevel="1" lineno="215" slineno="3-5" level="2"><display>(b)</display>"Crime statistics" means the number of each of the crimes in 34 C.F.R. Sec. <ln numlevel="1" lineno="216" slineno="3-6"/>668.46(c)(1) that are reported to a local police agency or campus law enforcement, <ln numlevel="1" lineno="217" slineno="3-7"/>listed by type of crime.</subsection><subsection ssid="33-null-4" dnum="c-o" numlevel="1" lineno="218" slineno="3-8" level="2" space="false"><display>(c)</display><subsection ssid="33-null-5" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"Institution noncampus housing facility" means a building or property that:<subsection ssid="33-null-6" dnum="A-o" numlevel="1" lineno="219" slineno="3-9" level="4" tab="1"><display>(A)</display>is used for housing students;</subsection><subsection ssid="33-null-7" dnum="B-o" numlevel="1" lineno="220" slineno="3-10" level="4" tab="1"><display>(B)</display>is not part of the institution's campus; and</subsection><subsection ssid="33-null-8" dnum="C-o" numlevel="1" lineno="221" slineno="3-11" level="4" tab="1"><display>(C)</display>the institution owns, manages, controls, or leases;</subsection></subsection><subsection ssid="33-null-9" dnum="ii-o" numlevel="1" lineno="222" slineno="3-12" level="3"><display>(ii)</display>"Institution noncampus housing facility" includes real property that is adjacent to, <ln numlevel="1" lineno="223" slineno="3-13"/>and is used in direct support of, the building or property described in Subsection <xref depth="4" refnumber="53H-7-603(1)(c)(i)"><ln numlevel="1" lineno="224" slineno="3-14"/>(1)(c)(i)</xref>.</subsection></subsection><subsection ssid="33-null-10" dnum="d-o" numlevel="1" lineno="225" slineno="3-15" level="2"><display>(d)</display>"Local law enforcement agency" means a state or local law enforcement agency <ln numlevel="1" lineno="226" slineno="3-16"/>other than campus law enforcement.</subsection><subsection ssid="33-null-11" dnum="e-o" numlevel="1" lineno="227" slineno="3-17" level="2" space="false"><display>(e)</display><subsection ssid="33-null-12" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"On-campus housing facility" means a building or property that is:<subsection ssid="33-null-13" dnum="A-o" numlevel="1" lineno="228" slineno="3-18" level="4" tab="1"><display>(A)</display>used for housing students; and</subsection><subsection ssid="33-null-14" dnum="B-o" numlevel="1" lineno="229" slineno="3-19" level="4" tab="1"><display>(B)</display>part of the institution's campus.</subsection></subsection><subsection ssid="33-null-15" dnum="ii-o" numlevel="1" lineno="230" slineno="3-20" level="3"><display>(ii)</display>"On-campus housing facility" includes real property that is:<subsection ssid="33-null-16" dnum="A-o" numlevel="1" lineno="231" slineno="3-21" level="4"><display>(A)</display>adjacent to the on-campus housing facility; and</subsection><subsection ssid="33-null-17" dnum="B-o" numlevel="1" lineno="232" slineno="3-22" level="4"><display>(B)</display>used in direct support of the on-campus housing facility.</subsection></subsection></subsection><subsection ssid="33-null-18" dnum="f-o" numlevel="1" lineno="233" slineno="3-23" level="2"><display>(f)</display>"Student housing" means:<subsection ssid="33-null-19" dnum="i-o" numlevel="1" lineno="234" slineno="3-24" level="3"><display>(i)</display>an institution noncampus housing facility;</subsection><subsection ssid="33-null-20" dnum="ii-o" numlevel="1" lineno="235" slineno="3-25" level="3"><display>(ii)</display>an on-campus housing facility; or</subsection><subsection ssid="33-null-21" dnum="iii-o" numlevel="1" lineno="236" slineno="3-26" level="3"><display>(iii)</display>a student organization noncampus housing facility.</subsection></subsection><subsection ssid="33-null-22" dnum="g-o" numlevel="1" lineno="237" slineno="3-27" level="2"><display>(g)</display>"Student organization" means the same as that term is defined in Section <xref depth="3" refnumber="53H-7-101">53H-7-101</xref>.</subsection><subsection ssid="33-null-23" dnum="h-o" numlevel="1" lineno="238" slineno="3-28" level="2"><display>(h)</display>"Student organization noncampus housing facility" means a building or property that:<subsection ssid="33-null-24" dnum="i-o" numlevel="1" lineno="239" slineno="3-29" level="3"><display>(i)</display>is used for housing students;</subsection><subsection ssid="33-null-25" dnum="ii-o" numlevel="1" lineno="240" slineno="3-30" level="3"><display>(ii)</display>is not part of the institution's campus; and</subsection><subsection ssid="33-null-26" dnum="iii-o" numlevel="1" lineno="241" slineno="3-31" level="3" space="false"><display>(iii)</display><subsection ssid="33-null-27" dnum="A-o" level="4" placement="sameline"><display>(A)</display>a student organization owns, manages, controls, or leases; or</subsection><subsection ssid="33-null-28" dnum="B-o" numlevel="1" lineno="242" slineno="3-32" level="4"><display>(B)</display>is real property that is adjacent to the student organization noncampus housing <ln numlevel="1" lineno="243" slineno="3-33"/>facility and is used in direct support of the noncampus housing facility.</subsection></subsection></subsection></subsection><subsection ssid="33-null-29" dnum="2-o" numlevel="1" lineno="244" slineno="3-34" level="1"><display>(2)</display>An institution with the types of housing facilities described in this Subsection <xref refnumber="53B-28-403(2)" depth="4">(2)</xref> shall:<subsection ssid="33-null-30" dnum="a-o" numlevel="1" lineno="245" slineno="3-35" level="2"><display>(a)</display>create a report of crime statistics aggregated by:<subsection ssid="33-null-31" dnum="i-o" numlevel="1" lineno="246" slineno="3-36" level="3"><display>(i)</display>on-campus housing facility, identified and listed individually using the institution's <ln numlevel="1" lineno="247" slineno="3-37"/>system for inventorying institution facilities;</subsection><subsection ssid="33-null-32" dnum="ii-o" numlevel="1" lineno="248" slineno="3-38" level="3"><display>(ii)</display>institution noncampus housing facility, identified and listed individually using the <ln numlevel="1" lineno="249" slineno="3-39"/>institution's system for inventorying institution facilities; and</subsection><subsection ssid="33-null-33" dnum="iii-o" numlevel="1" lineno="250" slineno="3-40" level="3"><display>(iii)</display>student organization noncampus housing facilities, identified and listed <ln numlevel="1" lineno="251" slineno="3-41"/>individually using the institution's system for identifying student organization <ln numlevel="1" lineno="252" slineno="3-42"/>noncampus housing facilities;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="14" groupid="12" style="2" owner="jchristopherson" level="1" deltag="both"> and</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="33-null-34" dnum="b-o" numlevel="1" lineno="253" slineno="3-43" level="2"><display>(b)</display>report annually to the Education Interim Committee and the Law Enforcement and <ln numlevel="1" lineno="254" slineno="3-44"/>Criminal Justice Interim Committee, at or before the committee's  November <ln numlevel="1" lineno="255" slineno="3-45"/>meetings, on crime statistics aggregated by housing facility as described in <xref tempid="353" depth="4" refnumber="Subsection(2)(a)"><ln numlevel="1" lineno="256" slineno="3-46"/>Subsection(2)(a)</xref><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="8" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="33-39" dnum="_-o:c-i" numlevel="1" lineno="257" slineno="3-47" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1101" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="end">on or before November 1 of each year, provide the crime statistics aggregated by <ln numlevel="1" lineno="258" slineno="3-48"/>housing facility as described in Subsection <xref depth="4" refnumber="53H-7-603(2)(a)">(2)(a)</xref> to the State Commission on <ln numlevel="1" lineno="259" slineno="3-49"/>Criminal and Juvenile Justice created in Section <xref depth="3" refnumber="63M-7-201">63M-7-201</xref>.</amend></subsection></subsection><subsection ssid="33-null-35" dnum="3-o" numlevel="1" lineno="260" slineno="3-50" level="1"><display>(3)</display>An institution that does not have the types of housing described in Subsection <xref refnumber="53B-28-403(2)" depth="4">(2)</xref> shall <ln numlevel="1" lineno="261" slineno="3-51"/>report the crime statistics as required by 20 U.S.C. Section 1092(f), the Jeanne Clery <ln numlevel="1" lineno="262" slineno="3-52"/>Disclosure of Campus Security Policy and Campus Crime Statistics Act, to the entities <ln numlevel="1" lineno="263" slineno="3-53"/>specified in Subsection <xref depth="4" refnumber="53B-28-403(2)">(2)</xref>.</subsection><subsection ssid="33-null-36" dnum="4-o" numlevel="1" lineno="264" slineno="3-54" level="1"><display>(4)</display>Upon request from an institution, a local law enforcement agency shall provide to the <ln numlevel="1" lineno="265" slineno="3-55"/>institution crime statistics for each student housing facility over which the local law <ln numlevel="1" lineno="266" slineno="3-56"/>enforcement agency has jurisdiction.</subsection><subsection ssid="33-null-37" dnum="5-o" numlevel="1" lineno="267" slineno="3-57" level="1"><display>(5)</display>Except as provided in Section <xref depth="3" refnumber="53H-7-503">53H-7-503</xref>, when campus law enforcement receives a <ln numlevel="1" lineno="268" slineno="3-58"/>complaint or report of a crime that campus law enforcement reasonably determines <ln numlevel="1" lineno="269" slineno="3-59"/>occurred outside of campus law enforcement's jurisdiction, campus law enforcement <ln numlevel="1" lineno="270" slineno="3-60"/>shall share any record of the complaint or report with the local law enforcement agency <ln numlevel="1" lineno="271" slineno="3-61"/>with jurisdiction.</subsection></section></bsec><bsec buid="37" num="63A-16-1002" type="amend" src="code" uid="C63A-16-S1002_2026050620260506" sort="63A16 10020020260506" numlevel="1" lineno="272" slineno="4-1" sn="4"><section number="63A-16-1002" numlevel="1" lineno="274" slineno="4-3" type="amend"><secline lineno="272">Section 4. Governance of Technology</headchap><catline lineno="274"><bold>63A-16-1002<parens/>. Public safety portal.</bold></catline><subsection ssid="37-null-1" dnum="1-o" numlevel="1" lineno="275" slineno="4-4" level="1" placement="noreturn"><display>(1)</display>The commission shall oversee the creation and management of a public safety portal for <ln numlevel="1" lineno="276" slineno="4-5"/>information and data required to be reported to the commission and accessible to all <ln ssid="37-null-3" dnum="3-o" numlevel="1" lineno="280" slineno="4-9" level="1"><display>(3)</display>The division, in collaboration with the commission, shall create:<subsection ssid="37-null-4" dnum="a-o" numlevel="1" lineno="281" slineno="4-10" level="2"><display>(a)</display>master standards and formats for information submitted to the public safety portal;</subsection><subsection ssid="37-null-5" dnum="b-o" numlevel="1" lineno="282" slineno="4-11" level="2"><display>(b)</display>a gateway, bridge, website, or other method for reporting entities to provide the <ln numlevel="1" lineno="283" slineno="4-12"/>information;</subsection><subsection ssid="37-null-6" dnum="c-o" numlevel="1" lineno="284" slineno="4-13" level="2"><display>(c)</display>a master data management index or system to assist in the retrieval of information <ln numlevel="1" lineno="285" slineno="4-14"/>from the public safety portal;</subsection><subsection ssid="37-null-7" dnum="d-o" numlevel="1" lineno="286" slineno="4-15" level="2"><display>(d)</display>a protocol for accessing information in the public safety portal that complies with <ln numlevel="1" lineno="287" slineno="4-16"/>state or</amend></subsection><subsection ssid="24-37" dnum="_-o:viii-i" numlevel="1" lineno="382" slineno="5-33" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1178" style="1" owner="i" level="1" amendtag="start">(viii)</amend></display><amend anum="0" ea="amend" pairid="163" groupid="126" style="1" owner="jchristopherson" level="1" amendtag="end">formal discipline, reclassification, or relocation of an individual who is <ln numlevel="1" lineno="383" slineno="5-34"/>incarcerated.</amend></subsection></subsection><subsection ssid="24-41" dnum="_-o:b-i" numlevel="1" lineno="384" slineno="5-35" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1179" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="180" groupid="137" style="1" owner="jchristopherson" level="1" amendtag="end">"Criminal justice information" includes anonymized demographic information <ln numlevel="1" lineno="385" slineno="5-36"/>related to the information described in Subsection <xref depth="4" refnumber="63A-16-1301(2)(a)">(2)(a)</xref>.</amend></subsection></subsection><subsection ssid="24-1" dnum="_-o:3-i" numlevel="1" lineno="386" slineno="5-37" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1180" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="13" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="end">"Criminal justice researcher" means a person that conducts research and statistical <ln numlevel="1" lineno="387" slineno="5-38"/>analysis regarding criminal justice information.</amend></subsection><subsection ssid="24-8" dnum="_-o:4-i" numlevel="1" lineno="388" slineno="5-39" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1181" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="43" groupid="34" style="1" owner="jchristopherson" level="1" amendtag="end">"Institutional review board" means a board, committee, or other group that:</amend><subsection ssid="24-42" dnum="_-o:a-i" numlevel="1" lineno="389" slineno="5-40" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1182" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="189" groupid="141" style="1" owner="jchristopherson" level="1" amendtag="end">reviews, approves initiation of, and conducts periodic review of research; Criminal justice information sharing with researcher.</bold></catline><subsection ssid="26-1" dnum="_-o:1-i" numlevel="1" lineno="410" slineno="6-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1194" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">Notwithstanding Title 63G, Chapter 2, Government Records Access and Management <ln numlevel="1" lineno="411" slineno="6-4"/>Act, if a criminal justice researcher submits a written request to a covered entity for <ln numlevel="1" lineno="412" slineno="6-5"/>criminal justice information that complies with the requirements described in Subsection <xref depth="4" refnumber="63A-16-1302(3)"><ln numlevel="1" lineno="413" slineno="6-6"/>(3)</xref>, the covered entity shall provide the requested criminal justice information to the <ln numlevel="1" lineno="414" slineno="6-7"/>criminal justice researcher.</amend></subsection><subsection ssid="26-11" dnum="_-o:2-i" numlevel="1" lineno="415" slineno="6-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1195" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="57" groupid="45" style="1" owner="jchristopherson" level="1" amendtag="end">A release of criminal justice information under this section is not considered a release of <ln numlevel="1" lineno="416" slineno="6-9"/>data, records, or information to the public under Title 63G, Chapter 2, Government <ln numlevel="1" lineno="417" slineno="6-10"/>Records Access and Management Act, and does not waive the right of the covered entity <ln numlevel="1" lineno="418" slineno="6-11"/>to assert that data, records, or information are private or controlled records under Title <ln numlevel="1" lineno="419" slineno="6-12"/>63G, Chapter 2, Government Records Access and Management Act.</amend></subsection><subsection ssid="26-13" dnum="_-o:3-i" numlevel="1" lineno="420" slineno="6-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1196" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="63" groupid="50" style="1" owner="jchristopherson" level="1" amendtag="end">Before a criminal justice researcher may gain access to criminal justice information <ln numlevel="1" lineno="421" slineno="6-14"/>under this section, the criminal justice researcher shall:</amend><subsection ssid="26-16" dnum="_-o:a-i" numlevel="1" lineno="422" slineno="6-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1197" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="76" groupid="59" style="1" owner="jchristopherson" level="1" amendtag="end">agree that any personally identifiable information or confidential information <ln numlevel="1" lineno="423" slineno="6-16"/>inadvertently provided by a covered entity may not be used for any purpose; and</amend></subsection><subsection ssid="26-14" dnum="_-o:b-i" numlevel="1" lineno="424" slineno="6-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1198" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="66" groupid="52" style="1" owner="jchristopherson" level="1" amendtag="end">certify that:</amend><subsection ssid="26-22" dnum="_-o:i-i" numlevel="1" lineno="425" slineno="6-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1199" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="101" groupid="78" style="1" owner="jchristopherson" level="1" amendtag="end">the criminal justice researcher's institutional review board has approved the <ln numlevel="1" lineno="426" slineno="6-19"/>research or project that is the basis of the request;</amend></subsection><subsection ssid="26-15" dnum="_-o:ii-i" numlevel="1" lineno="427" slineno="6-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1200" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="69" groupid="54" style="1" owner="jchristopherson" level="1" amendtag="end">the criminal justice researcher has security protocols and systems in place to <ln numlevel="1" lineno="428" slineno="6-21"/>prevent unauthorized access to criminal justice information in the criminal justice <ln numlevel="1" lineno="429" slineno="6-22"/>researcher's possession or criminal justice information to which the criminal <ln numlevel="1" lineno="430" slineno="6-23"/>justice researcher has access; and</amend></subsection><subsection ssid="26-23" dnum="_-o:iii-i" numlevel="1" lineno="431" slineno="6-24" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1201" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="106" groupid="82" style="1" owner="jchristopherson" level="1" amendtag="end">the security protocols and systems described in Subsection <xref depth="4" refnumber="63A-16-1302(3)(b)(ii)">(3)(b)(ii)</xref> have been <ln numlevel="1" lineno="432" slineno="6-25"/>approved by the criminal justice researcher's institutional review board.</amend></subsection></subsection></subsection><subsection ssid="26-17" dnum="_-o:4-i" numlevel="1" lineno="433" slineno="6-26" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1202" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="80" groupid="62" style="1" owner="jchristopherson" level="1" amendtag="end">The attorney general shall issue guidance for covered entities regarding compliance with <ln numlevel="1" lineno="434" slineno="6-27"/>this part, including a process for:</amend><subsection ssid="26-24" dnum="_-o:a-i" numlevel="1" lineno="435" slineno="6-28" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1203" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="111" groupid="86" style="1" owner="jchristopherson" level="1" amendtag="end">identifying criminal justice researchers who meet the requirements of this part; and</amend></subsection><subsection ssid="26-25" dnum="_-o:b-i" numlevel="1" lineno="436" slineno="6-29" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1204" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="116" groupid="90" style="1" owner="jchristopherson" level="1" amendtag="end">sharing criminal justice information with criminal justice researchers.</amend></subsection></subsection><subsection ssid="26-20" dnum="_-o:5-i" numlevel="1" lineno="437" slineno="6-30" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1205" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="90" groupid="69" style="1" owner="jchristopherson" level="1" amendtag="end">A covered entity may assess reasonable fees, not to exceed actual costs, for the search, <ln numlevel="1" lineno="438" slineno="6-31"/>retrieval, and sharing of criminal justice information requested under this part.</amend></subsection></section></bsec><bsec buid="39" num="63G-2-201" type="amend" src="code" uid="C63G-2-S201_2026050620260506" sort="63G02 02010020260506" numlevel="1" lineno="439" slineno="7-1" sn="7"><section number="63G-2-201" numlevel="1" lineno="440" slineno="7-2" type="amend"><secline lineno="439">Section 7. Section <bold>63G-2-201</bold> is amended to read:</secline><catline lineno="440"><bold>63G-2-201<parens/>. Provisions relating to records -- Public records -- Private, controlled, <ln numlevel="1" lineno="441" slineno="7-3"/>protected, and other restricted records -- Disclosure and nondisclosure of records -- <ln numlevel="1" lineno="442" slineno="7-4"/>Certified copy of record -- Limits on obligation to respond to record request.</bold></catline><subsection ssid="39-null-1" dnum="1-o" numlevel="1" lineno="443" slineno="7-5" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="39-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="63G-2-201(1)(b)" start="0">(1)(b)</xref>, a person has the right to inspect a public <ln numlevel="1" lineno="444" slineno="7-6"/>record free of charge, and the right to take a copy of a public record during normal <ln numlevel="1" lineno="445" slineno="7-7"/>working hours, subject to Sections <xref depth="3" refnumber="63G-2-203" start="0">63G-2-203</xref> and <xref depth="3" refnumber="63G-2-204" start="0">63G-2-204</xref>.</subsection><subsection ssid="39-null-3" dnum="b-o" numlevel="1" lineno="446" slineno="7-8" level="2"><display>(b)</display>A right under Subsection <xref depth="4" refnumber="63G-2-201(1)(a)" start="0">(1)(a)</xref> does not apply with respect to a record:<subsection ssid="39-null-4" dnum="i-o" numlevel="1" lineno="447" slineno="7-9" level="3"><display>(i)</display>a copy of which the governmental entity has already provided to the person;</subsection><subsection ssid="39-null-5" dnum="ii-o" numlevel="1" lineno="448" slineno="7-10" level="3"><display>(ii)</display>that is the subject of a records request that the governmental entity is not required <ln numlevel="1" lineno="449" slineno="7-11"/>to fill under Subsection <xref depth="4" refnumber="63G-2-201(7)(a)(v)" start="0">(7)(a)(v)</xref>; or</subsection><subsection ssid="39-null-6" dnum="iii-o" numlevel="1" lineno="450" slineno="7-12" level="3" space="false"><display>(iii)</display><subsection ssid="39-null-7" dnum="A-o" level="4" placement="sameline"><display>(A)</display>that is accessible only by a computer or other electronic device owned or <ln numlevel="1" lineno="451" slineno="7-13"/>controlled by the governmental entity;</subsection><subsection ssid="39-null-8" dnum="B-o" numlevel="1" lineno="452" slineno="7-14" level="4"><display>(B)</display>that is part of an electronic file that also contains a record that is private, <ln numlevel="1" lineno="453" slineno="7-15"/>controlled, or protected; and</subsection><subsection ssid="39-null-9" dnum="C-o" numlevel="1" lineno="454" slineno="7-16" level="4"><display>(C)</display>that the governmental entity cannot readily segregate from the part of the <ln numlevel="1" lineno="455" slineno="7-17"/>electronic file that contains a private, controlled, or protected record.</subsection></subsection></subsection></subsection><subsection ssid="39-null-10" dnum="2-o" numlevel="1" lineno="456" slineno="7-18" level="1"><display>(2)</display>A record is public unless otherwise expressly provided by statute.</subsection><subsection ssid="39-null-11" dnum="3-o" numlevel="1" lineno="457" slineno="7-19" level="1"><display>(3)</display>The following records are not public:<subsection ssid="39-null-12" dnum="a-o" numlevel="1" lineno="458" slineno="7-20" level="2"><display>(a)</display>a record that is private, controlled, or protected under Sections <xref depth="3" refnumber="63G-2-302" start="0">63G-2-302</xref>, <xref depth="3" refnumber="63G-2-303" start="0">63G-2-303</xref>, <xref depth="3" refnumber="63G-2-304" start="0"><ln numlevel="1" lineno="459" slineno="7-21"/>63G-2-304</xref>, and <xref depth="3" refnumber="63G-2-305" start="0">63G-2-305</xref>; and</subsection><subsection ssid="39-null-13" dnum="b-o" numlevel="1" lineno="460" slineno="7-22" level="2"><display>(b)</display>a record to which access is restricted pursuant to court rule, another state statute, <ln numlevel="1" lineno="461" slineno="7-23"/>federal statute, or federal regulation, including records for which access is governed <ln numlevel="1" lineno="462" slineno="7-24"/>or restricted as a condition of participation in a state or federal program or for <ln numlevel="1" lineno="463" slineno="7-25"/>receiving state or federal funds.</subsection></subsection><subsection ssid="39-null-14" dnum="4-o" numlevel="1" lineno="464" slineno="7-26" level="1"><display>(4)</display>Only a record specified in Section <xref depth="3" refnumber="63G-2-302" start="0">63G-2-302</xref>, <xref depth="3" refnumber="63G-2-303" start="0">63G-2-303</xref>, <xref depth="3" refnumber="63G-2-304" start="0">63G-2-304</xref>, or <xref depth="3" refnumber="63G-2-305" start="0">63G-2-305</xref> <ln numlevel="1" lineno="465" slineno="7-27"/>may be classified private, controlled, or protected.</subsection><subsection ssid="39-null-15" dnum="5-o" numlevel="1" lineno="466" slineno="7-28" level="1" space="false"><display>(5)</display><subsection ssid="39-null-16" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A governmental entity may not disclose a record that is private, controlled, or <ln numlevel="1" lineno="467" slineno="7-29"/>protected to any person except as provided in Subsection <xref depth="4" refnumber="63G-2-201(5)(b)" start="0">(5)(b)</xref>, Subsection <xref depth="4" refnumber="63G-2-201(5)(c)" start="0">(5)(c)</xref>, <ln numlevel="1" lineno="468" slineno="7-30"/>Section <xref depth="3" refnumber="63G-2-202" start="0">63G-2-202</xref>, <xref depth="3" refnumber="63G-2-206" start="0">63G-2-206</xref>, or <xref depth="3" refnumber="63G-2-303" start="0">63G-2-303</xref>.</subsection><subsection ssid="39-null-17" dnum="b-o" numlevel="1" lineno="469" slineno="7-31" level="2"><display>(b)</display>A governmental entity may disclose a record that is private under Subsection <xref depth="4" refnumber="63G-2-302(2)" start="0"><ln numlevel="1" lineno="470" slineno="7-32"/>63G-2-302(2)</xref> or protected under Section <xref depth="3" refnumber="63G-2-305" start="0">63G-2-305</xref> to persons other than those <ln numlevel="1" lineno="471" slineno="7-33"/>specified in Section <xref depth="3" refnumber="63G-2-202" start="0">63G-2-202</xref> or <xref depth="3" refnumber="63G-2-206" start="0">63G-2-206</xref> if the head of a governmental entity, or <ln numlevel="1" lineno="472" slineno="7-34"/>a designee, determines that:<subsection ssid="39-null-18" dnum="i-o" numlevel="1" lineno="473" slineno="7-35" level="3"><display>(i)</display>there is no interest in restricting access to the record; or</subsection><subsection ssid="39-null-19" dnum="ii-o" numlevel="1" lineno="474" slineno="7-36" level="3"><display>(ii)</display>the interests favoring access are greater than or equal to the interest favoring <ln numlevel="1" lineno="475" slineno="7-37"/>restriction of access.</subsection></subsection><subsection ssid="39-null-20" dnum="c-o" numlevel="1" lineno="476" slineno="7-38" level="2"><display>(c)</display>In addition to the disclosure under Subsection <xref depth="4" refnumber="63G-2-201(5)(b)" start="0">(5)(b)</xref>, a governmental entity may <ln numlevel="1" lineno="477" slineno="7-39"/>disclose a record that is protected under Subsection <xref depth="4" refnumber="63G-2-305(51)" start="0">63G-2-305(51)</xref> if:<subsection ssid="39-null-21" dnum="i-o" numlevel="1" lineno="478" slineno="7-40" level="3"><display>(i)</display>the head of the governmental entity, or a designee, determines that the disclosure:<subsection ssid="39-null-22" dnum="A-o" numlevel="1" lineno="479" slineno="7-41" level="4"><display>(A)</display>is mutually beneficial to:<subsection ssid="39-null-23" dnum="I-o" numlevel="1" lineno="480" slineno="7-42" level="5"><display>(I)</display>the subject of the record;</subsection><subsection ssid="39-null-24" dnum="II-o" numlevel="1" lineno="481" slineno="7-43" level="5"><display>(II)</display>the governmental entity; and</subsection><subsection ssid="39-null-25" dnum="III-o" numlevel="1" lineno="482" slineno="7-44" level="5"><display>(III)</display>the public; and</subsection></subsection><subsection ssid="39-null-26" dnum="B-o" numlevel="1" lineno="483" slineno="7-45" level="4"><display>(B)</display>serves a public purpose related to:<subsection ssid="39-null-27" dnum="I-o" numlevel="1" lineno="484" slineno="7-46" level="5"><display>(I)</display>public safety; or</subsection><subsection ssid="39-null-28" dnum="II-o" numlevel="1" lineno="485" slineno="7-47" level="5"><display>(II)</display>consumer protection; and</subsection></subsection></subsection><subsection ssid="39-null-29" dnum="ii-o" numlevel="1" lineno="486" slineno="7-48" level="3"><display>(ii)</display>the person who receives the record from the governmental entity agrees not to use <ln numlevel="1" lineno="487" slineno="7-49"/>or allow the use of the record for advertising or solicitation purposes.</subsection></subsection></subsection><subsection ssid="39-null-30" dnum="6-o" numlevel="1" lineno="488" slineno="7-50" level="1"><display>(6)</display>A governmental entity shall provide a person with a certified copy of a record if:<subsection ssid="39-null-31" dnum="a-o" numlevel="1" lineno="489" slineno="7-51" level="2"><display>(a)</display>the person requesting the record has a right to inspect it;</subsection><subsection ssid="39-null-32" dnum="b-o" numlevel="1" lineno="490" slineno="7-52" level="2"><display>(b)</display>the person identifies the record with reasonable specificity; and</subsection><subsection ssid="39-null-33" dnum="c-o" numlevel="1" lineno="491" slineno="7-53" level="2"><display>(c)</display>the person pays the lawful fees.</subsection></subsection><subsection ssid="39-null-34" dnum="7-o" numlevel="1" lineno="492" slineno="7-54" level="1" space="false"><display>(7)</display><subsection ssid="39-null-35" dnum="a-o" level="2" placement="sameline"><display>(a)</display>In response to a request, a governmental entity is not required to:<subsection ssid="39-null-36" dnum="i-o" numlevel="1" lineno="493" slineno="7-55" level="3" tab="1"><display>(i)</display>create a record;</subsection><subsection ssid="39-null-37" dnum="ii-o" numlevel="1" lineno="494" slineno="7-56" level="3" tab="1"><display>(ii)</display>compile, format, manipulate, package, summarize, or tailor information;</subsection><subsection ssid="39-null-38" dnum="iii-o" numlevel="1" lineno="495" slineno="7-57" level="3" tab="1"><display>(iii)</display>provide a record in a particular format, medium, or program not currently <ln numlevel="1" lineno="496" slineno="7-58"/>maintained by the governmental entity;</subsection><subsection ssid="39-null-39" dnum="iv-o" numlevel="1" lineno="497" slineno="7-59" level="3" tab="1"><display>(iv)</display>fulfill a person's records request if the request unreasonably duplicates prior <ln numlevel="1" lineno="498" slineno="7-60"/>records requests from that person;</subsection><subsection ssid="39-null-40" dnum="v-o" numlevel="1" lineno="499" slineno="7-61" level="3" tab="1"><display>(v)</display>fill a person's records request if:<subsection ssid="39-null-41" dnum="A-o" numlevel="1" lineno="500" slineno="7-62" level="4"><display>(A)</display>the record requested is:<subsection ssid="39-null-42" dnum="I-o" numlevel="1" lineno="501" slineno="7-63" level="5"><display>(I)</display>publicly accessible online; or</subsection><subsection ssid="39-null-43" dnum="II-o" numlevel="1" lineno="502" slineno="7-64" level="5"><display>(II)</display>included in a public publication or product produced by the governmental <ln numlevel="1" lineno="503" slineno="7-65"/>entity receiving the request; and</subsection></subsection><subsection ssid="39-null-44" dnum="B-o" numlevel="1" lineno="504" slineno="7-66" level="4"><display>(B)</display>the governmental entity:<subsection ssid="39-null-45" dnum="I-o" numlevel="1" lineno="505" slineno="7-67" level="5"><display>(I)</display>specifies to the person requesting the record where the record is accessible <ln numlevel="1" lineno="506" slineno="7-68"/>online; or</subsection><subsection ssid="39-null-46" dnum="II-o" numlevel="1" lineno="507" slineno="7-69" level="5"><display>(II)</display>provides the person requesting the record with the public publication or <ln numlevel="1" lineno="508" slineno="7-70"/>product and specifies where the record can be found in the public <ln numlevel="1" lineno="509" slineno="7-71"/>publication or product; or</subsection></subsection></subsection><subsection ssid="39-null-47" dnum="vi-o" numlevel="1" lineno="510" slineno="7-72" level="3" tab="1"><display>(vi)</display>fulfill a person's records request if:<subsection ssid="39-null-48" dnum="A-o" numlevel="1" lineno="511" slineno="7-73" level="4"><display>(A)</display>the person has been determined under Section <xref depth="3" refnumber="63G-2-209" start="0">63G-2-209</xref> to be a vexatious <ln numlevel="1" lineno="512" slineno="7-74"/>requester;</subsection><subsection ssid="39-null-49" dnum="B-o" numlevel="1" lineno="513" slineno="7-75" level="4"><display>(B)</display>the order of the director of the Government Records Office determining the <ln numlevel="1" lineno="514" slineno="7-76"/>person to be a vexatious requester provides that the governmental entity is not <ln numlevel="1" lineno="515" slineno="7-77"/>required to fulfill a request from the person for a period of time; and</subsection><subsection ssid="39-null-50" dnum="C-o" numlevel="1" lineno="516" slineno="7-78" level="4"><display>(C)</display>the period of time described in Subsection <xref depth="4" refnumber="63G-2-201(7)(a)(vi)(B)" start="0">(7)(a)(vi)(B)</xref> has not expired.</subsection></subsection></subsection><subsection ssid="39-null-51" dnum="b-o" numlevel="1" lineno="517" slineno="7-79" level="2"><display>(b)</display>A governmental entity shall conduct a reasonable search for a requested record.</subsection></subsection><subsection ssid="39-null-52" dnum="8-o" numlevel="1" lineno="518" slineno="7-80" level="1" space="false"><display>(8)</display><subsection ssid="39-null-53" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Although not required to do so, a governmental entity may, upon request from the <ln numlevel="1" lineno="519" slineno="7-81"/>person who submitted the records request, compile, format, manipulate, package, <ln numlevel="1" lineno="520" slineno="7-82"/>summarize, or tailor information or provide a record in a format, medium, or program <ln numlevel="1" lineno="521" slineno="7-83"/>not currently maintained by the governmental entity.</subsection><subsection ssid="39-null-54" dnum="b-o" numlevel="1" lineno="522" slineno="7-84" level="2"><display>(b)</display>In determining whether to fulfill a request described in Subsection <xref depth="4" refnumber="63G-2-201(8)(a)" start="0">(8)(a)</xref>, a <ln numlevel="1" lineno="523" slineno="7-85"/>governmental entity may consider whether the governmental entity is able to fulfill <ln numlevel="1" lineno="524" slineno="7-86"/>the request without unreasonably interfering with the governmental entity's duties <ln numlevel="1" lineno="525" slineno="7-87"/>and responsibilities.</subsection><subsection ssid="39-null-55" dnum="c-o" numlevel="1" lineno="526" slineno="7-88" level="2"><display>(c)</display>A governmental entity may require a person who makes a request under Subsection <xref depth="4" refnumber="63G-2-201(8)(a)" start="0"><ln numlevel="1" lineno="527" slineno="7-89"/>(8)(a)</xref> to pay the governmental entity, in accordance with Section <xref depth="3" refnumber="63G-2-203" start="0">63G-2-203</xref>, for <ln numlevel="1" lineno="528" slineno="7-90"/>providing the information or record as requested.</subsection></subsection><subsection ssid="39-null-56" dnum="9-o" numlevel="1" lineno="529" slineno="7-91" level="1" space="false"><display>(9)</display><subsection ssid="39-null-57" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Notwithstanding any other provision of this chapter, and subject to Subsection <xref depth="4" refnumber="63G-2-201(9)(b)" start="0"><ln numlevel="1" lineno="530" slineno="7-92"/>(9)(b)</xref>, a governmental entity is not required to respond to, or provide a record in <ln numlevel="1" lineno="531" slineno="7-93"/>response to, a record request if the request is submitted by or in behalf of an <ln numlevel="1" lineno="532" slineno="7-94"/>individual who is on parole or confined in a jail or other correctional facility <ln numlevel="1" lineno="533" slineno="7-95"/>following the individual's conviction.</subsection><subsection ssid="39-null-58" dnum="b-o" numlevel="1" lineno="534" slineno="7-96" level="2"><display>(b)</display>Subsection <xref depth="4" refnumber="63G-2-201(9)(a)" start="0">(9)(a)</xref> does not apply to:<subsection ssid="39-null-59" dnum="i-o" numlevel="1" lineno="535" slineno="7-97" level="3"><display>(i)</display>the first five record requests submitted to the governmental entity by or in behalf <ln numlevel="1" lineno="536" slineno="7-98"/>of an individual described in Subsection <xref depth="4" refnumber="63G-2-201(9)(a)" start="0">(9)(a)</xref> during any calendar year <ln numlevel="1" lineno="537" slineno="7-99"/>requesting only a record that contains a specific reference to the individual; or</subsection><subsection ssid="39-null-60" dnum="ii-o" numlevel="1" lineno="538" slineno="7-100" level="3"><display>(ii)</display>a record request that is submitted by an attorney of an individual described in <ln numlevel="1" lineno="539" slineno="7-101"/>Subsection <xref depth="4" refnumber="63G-2-201(9)(a)" start="0">(9)(a)</xref>.</subsection></subsection></subsection><subsection ssid="39-null-61" dnum="10-o" numlevel="1" lineno="540" slineno="7-102" level="1" space="false"><display>(10)</display><subsection ssid="39-null-62" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A governmental entity may allow a person requesting more than 50 pages of <ln numlevel="1" lineno="541" slineno="7-103"/>records to copy the records if:<subsection ssid="39-null-63" dnum="i-o" numlevel="1" lineno="542" slineno="7-104" level="3" tab="1"><display>(i)</display>the records are contained in files that do not contain records that are exempt from <ln numlevel="1" lineno="543" slineno="7-105"/>disclosure, or the records may be segregated to remove private, protected, or <ln numlevel="1" lineno="544" slineno="7-106"/>controlled information from disclosure; and</subsection><subsection ssid="39-null-64" dnum="ii-o" numlevel="1" lineno="545" slineno="7-107" level="3" tab="1"><display>(ii)</display>the governmental entity provides reasonable safeguards to protect the public from <ln numlevel="1" lineno="546" slineno="7-108"/>the potential for loss of a public record.</subsection></subsection><subsection ssid="39-null-65" dnum="b-o" numlevel="1" lineno="547" slineno="7-109" level="2"><display>(b)</display>If the requirements of Subsection <xref depth="4" refnumber="63G-2-201(10)(a)" start="0">(10)(a)</xref> are met, the governmental entity may:<subsection ssid="39-null-66" dnum="i-o" numlevel="1" lineno="548" slineno="7-110" level="3"><display>(i)</display>provide the requester with the facilities for copying the requested records and <ln numlevel="1" lineno="549" slineno="7-111"/>require that the requester make the copies; or</subsection><subsection ssid="39-null-67" dnum="ii-o" numlevel="1" lineno="550" slineno="7-112" level="3"><display>(ii)</display>allow the requester to provide the requester's own copying facilities and personnel <ln numlevel="1" lineno="551" slineno="7-113"/>to make the copies at the governmental entity's offices and waive the fees for <ln numlevel="1" lineno="552" slineno="7-114"/>copying the records.</subsection></subsection></subsection><subsection ssid="39-null-68" dnum="11-o" numlevel="1" lineno="553" slineno="7-115" level="1" space="false"><display>(11)</display><subsection ssid="39-null-69" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A governmental entity that owns an intellectual property right and that offers the <ln numlevel="1" lineno="554" slineno="7-116"/>intellectual property right for sale or license may control by ordinance or policy the <ln numlevel="1" lineno="555" slineno="7-117"/>duplication and distribution of the material based on terms the governmental entity <ln numlevel="1" lineno="556" slineno="7-118"/>considers to be in the public interest.</subsection><subsection ssid="39-null-70" dnum="b-o" numlevel="1" lineno="557" slineno="7-119" level="2"><display>(b)</display>Nothing in this chapter shall be construed to limit or impair the rights or protections <ln numlevel="1" lineno="558" slineno="7-120"/>granted to the governmental entity under federal copyright or patent law as a result of <ln numlevel="1" lineno="559" slineno="7-121"/>its ownership of the intellectual property right.</subsection></subsection><subsection ssid="39-null-71" dnum="12-o" numlevel="1" lineno="560" slineno="7-122" level="1"><display>(12)</display>A governmental entity may not use the physical form, electronic or otherwise, in <ln numlevel="1" lineno="561" slineno="7-123"/>which a record is stored to deny, or unreasonably hinder the rights of a person to inspect <ln numlevel="1" lineno="562" slineno="7-124"/>and receive a copy of a record under this chapter.</subsection><subsection ssid="39-null-72" dnum="13-o" numlevel="1" lineno="563" slineno="7-125" level="1"><display>(13)</display>Subject to the requirements of Subsection <xref depth="4" refnumber="63G-2-201(7)" start="0">(7)</xref>, a governmental entity shall provide <ln numlevel="1" lineno="564" slineno="7-126"/>access to an electronic copy of a record in lieu of providing access to its paper <ln numlevel="1" lineno="565" slineno="7-127"/>equivalent if:<subsection ssid="39-null-73" dnum="a-o" numlevel="1" lineno="566" slineno="7-128" level="2"><display>(a)</display>the person making the request requests or states a preference for an electronic copy;</subsection><subsection ssid="39-null-74" dnum="b-o" numlevel="1" lineno="567" slineno="7-129" level="2"><display>(b)</display>the governmental entity currently maintains the record in an electronic format that is <ln numlevel="1" lineno="568" slineno="7-130"/>reproducible and may be provided without reformatting or conversion; and</subsection><subsection ssid="39-null-75" dnum="c-o" numlevel="1" lineno="569" slineno="7-131" level="2"><display>(c)</display>the electronic copy of the record:<subsection ssid="39-null-76" dnum="i-o" numlevel="1" lineno="570" slineno="7-132" level="3"><display>(i)</display>does not disclose other records that are exempt from disclosure; or</subsection><subsection ssid="39-null-77" dnum="ii-o" numlevel="1" lineno="571" slineno="7-133" level="3"><display>(ii)</display>may be segregated to protect private, protected, or controlled information from <ln numlevel="1" lineno="572" slineno="7-134"/>disclosure without the undue expenditure of public resources or funds.</subsection></subsection></subsection><subsection ssid="39-null-78" dnum="14-o" numlevel="1" lineno="573" slineno="7-135" level="1"><display>(14)</display>In determining whether a record is properly classified as private under Subsection <xref depth="4" refnumber="63G-2-302(2)(d)" start="0"><ln numlevel="1" lineno="574" slineno="7-136"/>63G-2-302(2)(d)</xref>, the governmental entity, the director of the Government Records <ln numlevel="1" lineno="575" slineno="7-137"/>Office, local appeals board, or court shall consider and weigh:<subsection ssid="39-null-79" dnum="a-o" numlevel="1" lineno="576" slineno="7-138" level="2"><display>(a)</display>any personal privacy interests, including those in images, that would be affected by <ln numlevel="1" lineno="577" slineno="7-139"/>disclosure of the records in question; and</subsection><subsection ssid="39-null-80" dnum="b-o" numlevel="1" lineno="578" slineno="7-140" level="2"><display>(b)</display>any public interests served by disclosure.</subsection></subsection><subsection ssid="39-81" dnum="_-o:15-i" numlevel="1" lineno="579" slineno="7-141" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1286" style="1" owner="i" level="1" amendtag="start">(15)</amend></display><amend anum="0" ea="amend" pairid="5" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="end">Notwithstanding any other provision of this chapter, the State Commission on <ln numlevel="1" lineno="580" slineno="7-142"/>Criminal and Juvenile Justice created in Section <xref depth="3" refnumber="63M-7-201">63M-7-201</xref>:</amend><subsection ssid="39-83" dnum="_-o:a-i" numlevel="1" lineno="581" slineno="7-143" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1287" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="10" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="end">is not required to provide a record in response to a record request that requests <ln numlevel="1" lineno="582" slineno="7-144"/>records received by the State Commission on Criminal and Juvenile Justice under <ln numlevel="1" lineno="583" slineno="7-145"/>Section <xref depth="3" refnumber="63A-16-1002">63A-16-1002</xref>; and</amend></subsection><subsection ssid="39-84" dnum="_-o:b-i" numlevel="1" lineno="584" slineno="7-146" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1288" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="15" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">shall inform the person making a record request for a record described in Subsection <xref depth="4" refnumber="63G-2-201(15)(a)"><ln numlevel="1" lineno="585" slineno="7-147"/>(15)(a)</xref> of the governmental entity from which the State Commission on Criminal and <ln numlevel="1" lineno="586" slineno="7-148"/>Juvenile Justice received the record.</amend></subsection></subsection></section></bsec><bsec buid="21" num="63M-7-405" type="amend" src="code" uid="C63M-7-S405_2026050620260506" sort="63M07 04050020260506" numlevel="1" lineno="587" slineno="8-1" sn="8"><section number="63M-7-405" numlevel="1" lineno="588" slineno="8-2" type="amend"><secline lineno="587">Section 8. Section <bold>63M-7-405</bold> is amended to read:</secline><catline lineno="588"><bold>63M-7-405<parens/>. Master offense list -- Collateral consequences guide.</bold></catline><subsection ssid="21-null-1" dnum="1-o" numlevel="1" lineno="589" slineno="8-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="21-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The sentencing commission shall create a master offense list.</subsection><subsection ssid="21-null-3" dnum="b-o" numlevel="1" lineno="590" slineno="8-4" level="2"><display>(b)</display>On or before June 30 of each year, the sentencing commission shall:<subsection ssid="21-null-4" dnum="i-o" numlevel="1" lineno="591" slineno="8-5" level="3"><display>(i)</display>after the last day of the general legislative session, update the master offense list;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="0" groupid="0" style="2" owner="jchristopherson" level="1" deltag="both"> <ln numlevel="1" lineno="592" slineno="8-6"/>and</amend><amendoutend style="2"/></subsection><subsection ssid="21-26" dnum="_-o:ii-i" numlevel="1" lineno="593" slineno="8-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1293" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">provide the master offense list to the commission; and</amend></subsection><subsection ssid="21-null-5" dnum="ii-o:iii-i" numlevel="1" lineno="594" slineno="8-8" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1294" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1295" style="1" owner="i" level="1" amendtag="both" space="true">(iii)</amend></display>present the updated master offense list to the Law Enforcement and <ln numlevel="1" lineno="595" slineno="8-9"/>Criminal Justice Interim Committee.</subsection></subsection></subsection><subsection ssid="21-null-6" dnum="2-o" numlevel="1" lineno="596" slineno="8-10" level="1" space="false"><display>(2)</display><subsection ssid="21-null-7" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The sentencing commission shall:<subsection ssid="21-null-8" dnum="i-o" numlevel="1" lineno="597" slineno="8-11" level="3" tab="1"><display>(i)</display>identify any provision of state law, including the Utah Constitution, and any <ln numlevel="1" lineno="598" slineno="8-12"/>administrative rule that imposes a collateral consequence;</subsection><subsection ssid="21-null-9" dnum="ii-o" numlevel="1" lineno="599" slineno="8-13" level="3" tab="1"><display>(ii)</display>prepare and compile a guide that contains all the provisions identified in <ln numlevel="1" lineno="600" slineno="8-14"/>Subsection <xref depth="4" refnumber="63M-7-405(2)(a)(i)">(2)(a)(i)</xref>; and</subsection><subsection ssid="21-null-10" dnum="iii-o" numlevel="1" lineno="601" slineno="8-15" level="3" tab="1"><display>(iii)</display>update the guide described in Subsection <xref depth="4" refnumber="63M-7-405(2)(a)(ii)">(2)(a)(ii)</xref> annually.</subsection></subsection><subsection ssid="21-null-11" dnum="b-o" numlevel="1" lineno="602" slineno="8-16" level="2"><display>(b)</display>The sentencing commission shall state in the guide described in Subsection <xref depth="4" refnumber="63M-7-405(2)(a)">(2)(a)</xref> <ln numlevel="1" lineno="603" slineno="8-17"/>that:<subsection ssid="21-null-12" dnum="i-o" numlevel="1" lineno="604" slineno="8-18" level="3"><display>(i)</display>the guide has not been enacted into law;</subsection><subsection ssid="21-null-13" dnum="ii-o" numlevel="1" lineno="605" slineno="8-19" level="3"><display>(ii)</display>the guide does not have the force of law;</subsection><subsection ssid="21-null-14" dnum="iii-o" numlevel="1" lineno="606" slineno="8-20" level="3"><display>(iii)</display>the guide is for informational purposes only;</subsection><subsection ssid="21-null-15" dnum="iv-o" numlevel="1" lineno="607" slineno="8-21" level="3"><display>(iv)</display>an error or omission in the guide, or in any reference in the guide:<subsection ssid="21-null-16" dnum="A-o" numlevel="1" lineno="608" slineno="8-22" level="4"><display>(A)</display>has no effect on a plea, an adjudication, a conviction, a sentence, or a <ln numlevel="1" lineno="609" slineno="8-23"/>disposition; and</subsection><subsection ssid="21-null-17" dnum="B-o" numlevel="1" lineno="610" slineno="8-24" level="4"><display>(B)</display>does not prevent a collateral consequence from being imposed;</subsection></subsection><subsection ssid="21-null-18" dnum="v-o" numlevel="1" lineno="611" slineno="8-25" level="3"><display>(v)</display>any laws or regulations for a county, a municipality, another state, or the United <ln numlevel="1" lineno="612" slineno="8-26"/>States, imposing a collateral consequence are not included in the guide; and</subsection><subsection ssid="21-null-19" dnum="vi-o" numlevel="1" lineno="613" slineno="8-27" level="3"><display>(vi)</display>the guide does not include any provision of state law or any administrative rule <ln numlevel="1" lineno="614" slineno="8-28"/>imposing a collateral consequence that is enacted on or after March 31 of each <ln numlevel="1" lineno="615" slineno="8-29"/>year.</subsection></subsection><subsection ssid="21-null-20" dnum="c-o" numlevel="1" lineno="616" slineno="8-30" level="2"><display>(c)</display>The sentencing commission shall:<subsection ssid="21-null-21" dnum="i-o" numlevel="1" lineno="617" slineno="8-31" level="3"><display>(i)</display>place the statements described in Subsection <xref depth="4" refnumber="63M-7-405(2)(b)">(2)(b)</xref> in a prominent place at the <ln numlevel="1" lineno="618" slineno="8-32"/>beginning of the guide; and</subsection><subsection ssid="21-null-22" dnum="ii-o" numlevel="1" lineno="619" slineno="8-33" level="3"><display>(ii)</display>make the guide available to the public on the sentencing commission's website.</subsection></subsection><subsection ssid="21-null-23" dnum="d-o" numlevel="1" lineno="620" slineno="8-34" level="2"><display>(d)</display>The sentencing commission shall:<subsection ssid="21-null-24" dnum="i-o" numlevel="1" lineno="621" slineno="8-35" level="3"><display>(i)</display>present the updated guide described in Subsection <xref depth="4" refnumber="63M-7-405(2)(a)(iii)">(2)(a)(iii)</xref> annually to the Law <ln numlevel="1" lineno="622" slineno="8-36"/>Enforcement and Criminal Justice Interim Committee;</subsection><subsection ssid="21-27" dnum="_-o:ii-i" numlevel="1" lineno="623" slineno="8-37" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1314" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="8" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="end">provide the updated guide described in Subsection <xref tempid="263">(2)(a)(iii)</xref> annually to the <ln numlevel="1" lineno="624" slineno="8-38"/>commission;</amend> and</subsection><subsection ssid="21-null-25" dnum="ii-o:iii-i" numlevel="1" lineno="625" slineno="8-39" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1315" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1316" style="1" owner="i" level="1" amendtag="both" space="true">(iii)</amend></display>identify and recommend legislation on collateral consequences to the Law <ln numlevel="1" lineno="626" slineno="8-40"/>Enforcement and Criminal Justice Interim Committee.</subsection></subsection></subsection></section></bsec><bsec buid="17" num="63M-7-1106" type="amend" src="code" uid="C63M-7-S1106_2026050620260506" sort="63M07 11060020260506" numlevel="1" lineno="627" slineno="9-1" sn="9"><section number="63M-7-1106" numlevel="1" lineno="628" slineno="9-2" type="amend"><secline lineno="627">Section 9. Section <bold>63M-7-1106</bold> is amended to read:</secline><catline lineno="628"><bold>63M-7-1106<parens/>. Annual reporting requirement to Legislature.</bold></catline><subsection ssid="17-null-1" dnum="1-o" numlevel="1" lineno="629" slineno="9-3" level="1" placement="noreturn"><display>(1)</display>Before November 1 of each year, the commission shall report to the<amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both"> State Commission <ln numlevel="1" lineno="630" slineno="9-4"/>on Criminal and Juvenile Justice created in Section <xref depth="3" refnumber="63M-7-201">63M-7-201</xref>, the</amend> Law Enforcement <ln numlevel="1" lineno="631" slineno="9-5"/>and Criminal Justice Interim Committee<amend anum="0" ea="amend" pairid="8" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="both">,</amend> and the Judiciary Interim Committee on:<subsection ssid="17-null-2" dnum="a-o" numlevel="1" lineno="632" slineno="9-6" level="2"><display>(a)</display>the number of complaints received;</subsection><subsection ssid="17-null-3" dnum="b-o" numlevel="1" lineno="633" slineno="9-7" level="2"><display>(b)</display>the general nature of the complaints;</subsection><subsection ssid="17-null-4" dnum="c-o" numlevel="1" lineno="634" slineno="9-8" level="2"><display>(c)</display>the number of complaints dismissed without an investigation;</subsection><subsection ssid="17-null-5" dnum="d-o" numlevel="1" lineno="635" slineno="9-9" level="2"><display>(d)</display>the number of complaints investigated;</subsection><subsection ssid="17-null-6" dnum="e-o" numlevel="1" lineno="636" slineno="9-10" level="2"><display>(e)</display>the general findings and outcomes of investigations; and</subsection><subsection ssid="17-null-7" dnum="f-o" numlevel="1" lineno="637" slineno="9-11" level="2"><display>(f)</display>the name of any prosecuting agency that refused, without reasonable cause, to <ln numlevel="1" lineno="638" slineno="9-12"/>cooperate in an investigation by the commission.</subsection></subsection><subsection ssid="17-null-8" dnum="2-o" numlevel="1" lineno="639" slineno="9-13" level="1"><display>(2)</display>The commission may not include any personal identifying information regarding a <ln numlevel="1" lineno="640" slineno="9-14"/>prosecuting attorney in a report described in Subsection <xref tempid="123" depth="4" refnumber="(1)">(1)</xref>.</subsection></section></bsec><bsec buid="9" num="64-13-47" type="amend" src="code" uid="C64-13-S47_2026050620260506" sort="64 13 00470020260506" numlevel="1" lineno="641" slineno="10-1" sn="10"><section number="64-13-47" numlevel="1" lineno="642" slineno="10-2" type="amend"><secline lineno="641">Section 10. Prison Sexual Assault Prevention Program.</bold></catline><subsection ssid="9-null-1" dnum="1-o" numlevel="1" lineno="643" slineno="10-3" level="1" placement="noreturn"><display>(1)</display>The department shall, in accordance with <xref depth="1" refnumber="63G-3" start="0">Title 63G, Chapter 3, Utah Administrative <ln numlevel="1" lineno="644" slineno="10-4"/>Rulemaking Act</xref>, make rules establishing policies and procedures regarding sexual <ln numlevel="1" lineno="645" slineno="10-5"/>assaults that occur in correctional facilities.</subsection><subsection ssid="9-null-2" dnum="2-o" numlevel="1" lineno="646" slineno="10-6" level="1"><display>(2)</display>The rules described in Subsection <xref depth="4" refnumber="64-13-47(1)" start="0">(1)</xref> shall:<subsection ssid="9-null-3" dnum="a-o" numlevel="1" lineno="647" slineno="10-7" level="2"><display>(a)</display>require education and training, including:<subsection ssid="9-null-4" dnum="i-o" numlevel="1" lineno="648" slineno="10-8" level="3"><display>(i)</display>providing to inmates, at intake and periodically, department-approved, <ln numlevel="1" lineno="649" slineno="10-9"/>easy-to-understand information developed by the department on sexual assault <ln numlevel="1" lineno="650" slineno="10-10"/>prevention, treatment, reporting, and counseling in consultation with community <ln numlevel="1" lineno="651" slineno="10-11"/>groups with expertise in sexual assault prevention, treatment, reporting, and <ln numlevel="1" lineno="652" slineno="10-12"/>counseling; and</subsection><subsection ssid="9-null-5" dnum="ii-o" numlevel="1" lineno="653" slineno="10-13" level="3"><display>(ii)</display>providing sexual-assault-specific training to department mental health <ln numlevel="1" lineno="654" slineno="10-14"/>professionals and all employees who have direct contact with inmates regarding <ln numlevel="1" lineno="655" slineno="10-15"/>treatment and methods of prevention and investigation;</subsection></subsection><subsection ssid="9-null-6" dnum="b-o" numlevel="1" lineno="656" slineno="10-16" level="2"><display>(b)</display>require reporting of sexual assault, including:<subsection ssid="9-null-7" dnum="i-o" numlevel="1" lineno="657" slineno="10-17" level="3"><display>(i)</display>ensuring the confidentiality of inmate sexual assault complaints and the protection <ln numlevel="1" lineno="658" slineno="10-18"/>of inmates who make complaints of sexual assault; and</subsection><subsection ssid="9-null-8" dnum="ii-o" numlevel="1" lineno="659" slineno="10-19" level="3"><display>(ii)</display>prohibiting retaliation and disincentives for reporting sexual assault;</subsection></subsection><subsection ssid="9-null-9" dnum="c-o" numlevel="1" lineno="660" slineno="10-20" level="2"><display>(c)</display>require safety and care for victims, including:<subsection ssid="9-null-10" dnum="i-o" numlevel="1" lineno="661" slineno="10-21" level="3"><display>(i)</display>providing, in situations in which there is reason to believe that a sexual assault has <ln numlevel="1" lineno="662" slineno="10-22"/>occurred, reasonable and appropriate measures to ensure the victim's safety by <ln numlevel="1" lineno="663" slineno="10-23"/>separating the victim from the assailant, if known;</subsection><subsection ssid="9-null-11" dnum="ii-o" numlevel="1" lineno="664" slineno="10-24" level="3"><display>(ii)</display>providing acute trauma care for sexual assault victims, including treatment of <ln numlevel="1" lineno="665" slineno="10-25"/>injuries, HIV prophylaxis measures, and testing for sexually transmitted infections;</subsection><subsection ssid="9-null-12" dnum="iii-o" numlevel="1" lineno="666" slineno="10-26" level="3"><display>(iii)</display>providing confidential mental health counseling for victims of sexual assault, <ln numlevel="1" lineno="667" slineno="10-27"/>including access to outside community groups or victim advocates that have <ln numlevel="1" lineno="668" slineno="10-28"/>expertise in sexual assault counseling, and enable confidential communication <ln numlevel="1" lineno="669" slineno="10-29"/>between inmates and those organizations and advocates; and</subsection><subsection ssid="9-null-13" dnum="iv-o" numlevel="1" lineno="670" slineno="10-30" level="3"><display>(iv)</display>monitoring victims of sexual assault for suicidal impulses, post-traumatic stress <ln numlevel="1" lineno="671" slineno="10-31"/>disorder, depression, and other mental health consequences resulting from the <ln numlevel="1" lineno="672" slineno="10-32"/>sexual assault;</subsection></subsection><subsection ssid="9-null-14" dnum="d-o" numlevel="1" lineno="673" slineno="10-33" level="2"><display>(d)</display>require investigations and staff discipline, including:<subsection ssid="9-null-15" dnum="i-o" numlevel="1" lineno="674" slineno="10-34" level="3"><display>(i)</display>requiring all employees to report any knowledge, suspicion, or information <ln numlevel="1" lineno="675" slineno="10-35"/>regarding an incident of sexual assault to the executive director or designee, and <ln numlevel="1" lineno="676" slineno="10-36"/>require disciplinary action for employees who fail to report as required;</subsection><subsection ssid="9-null-16" dnum="ii-o" numlevel="1" lineno="677" slineno="10-37" level="3"><display>(ii)</display>requiring investigations described in Subsection <xref depth="4" refnumber="64-13-47(3)" start="0">(3)</xref>;</subsection><subsection ssid="9-null-17" dnum="iii-o" numlevel="1" lineno="678" slineno="10-38" level="3"><display>(iii)</display>requiring corrections investigators to submit all completed sexual assault <ln numlevel="1" lineno="679" slineno="10-39"/>allegations to the executive director or the executive director's designee, who must <ln numlevel="1" lineno="680" slineno="10-40"/>then submit any substantiated findings that may constitute a crime under state law <ln numlevel="1" lineno="681" slineno="10-41"/>to the district attorney with jurisdiction over the facility in which the alleged <ln numlevel="1" lineno="682" slineno="10-42"/>sexual assault occurred; and</subsection><subsection ssid="9-null-18" dnum="iv-o" numlevel="1" lineno="683" slineno="10-43" level="3"><display>(iv)</display>requiring employees to be subject to disciplinary sanctions up to and including <ln numlevel="1" lineno="684" slineno="10-44"/>termination for violating agency sexual assault policies, with termination the <ln numlevel="1" lineno="685" slineno="10-45"/>presumptive disciplinary sanction for employees who have engaged in sexual <ln numlevel="1" lineno="686" slineno="10-46"/>assault, consistent with constitutional due process protections and state personnel <ln numlevel="1" lineno="687" slineno="10-47"/>laws and rules; and</subsection></subsection><subsection ssid="9-null-19" dnum="e-o" numlevel="1" lineno="688" slineno="10-48" level="2"><display>(e)</display>require data collection and reporting, including as provided in Subsection <xref depth="4" refnumber="64-13-47(4)" start="0">(4)</xref>.</subsection></subsection><subsection ssid="9-null-20" dnum="3-o" numlevel="1" lineno="689" slineno="10-49" level="1" space="false"><display>(3)</display><subsection ssid="9-null-21" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An investigator trained in the investigation of sex crimes shall conduct the <ln numlevel="1" lineno="690" slineno="10-50"/>investigation of a sexual assault involving an inmate.</subsection><subsection ssid="9-null-22" dnum="b-o" numlevel="1" lineno="691" slineno="10-51" level="2"><display>(b)</display>The investigation shall include:<subsection ssid="9-null-23" dnum="i-o" numlevel="1" lineno="692" slineno="10-52" level="3"><display>(i)</display>using a forensic rape kit, if appropriate;</subsection><subsection ssid="9-null-24" dnum="ii-o" numlevel="1" lineno="693" slineno="10-53" level="3"><display>(ii)</display>questioning suspects and witnesses; and</subsection><subsection ssid="9-null-25" dnum="iii-o" numlevel="1" lineno="694" slineno="10-54" level="3"><display>(iii)</display>gathering and preserving relevant evidence.</subsection></subsection></subsection><subsection ssid="9-null-26" dnum="4-o" numlevel="1" lineno="695" slineno="10-55" level="1"><display>(4)</display>The department shall:<subsection ssid="9-null-27" dnum="a-o" numlevel="1" lineno="696" slineno="10-56" level="2"><display>(a)</display>collect and report data regarding all allegations of sexual assault from each <ln numlevel="1" lineno="697" slineno="10-57"/>correctional facility in accordance with the federal Prison Rape Elimination Act of <ln numlevel="1" lineno="698" slineno="10-58"/>2003, Pub. L 108-79, as amended; and</subsection><subsection ssid="9-null-28" dnum="b-o" numlevel="1" lineno="699" slineno="10-59" level="2"><display>(b)</display>annually report the data described in Subsection <xref depth="4" refnumber="64-13-47(4)(a)" start="0">(4)(a)</xref> to the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both">Law Enforcement and <ln numlevel="1" lineno="700" slineno="10-60"/>Criminal Justice Interim Committee</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the State Commission on Criminal and Juvenile <ln numlevel="1" lineno="701" slineno="10-61"/>Justice created in Section <xref depth="3" refnumber="63M-7-201">63M-7-201</xref></amend>.</subsection></subsection></section></bsec><bsec buid="13" num="67-5-22.7" type="amend" src="code" uid="C67-5-S22.7_2026050620260506" sort="67 05 00220720260506" numlevel="1" lineno="702" slineno="11-1" sn="11"><section number="67-5-22.7" numlevel="1" lineno="703" slineno="11-2" type="amend"><secline lineno="702">Section 11. Section <bold>67-5-22.7</bold> is amended to read:</secline><catline lineno="703"><bold>67-5-22.7<parens/>. Multi-agency strike force to combat violent and other major felony <ln numlevel="1" lineno="704" slineno="11-3"/>crimes associated with illegal immigration and human trafficking -- Fraudulent <ln numlevel="1" lineno="705" slineno="11-4"/>Documents Identification Unit.</bold></catline><subsection ssid="13-null-1" dnum="1-o" numlevel="1" lineno="706" slineno="11-5" level="1" placement="noreturn"><display>(1)</display>The Office of the Attorney General is authorized to administer and coordinate the <ln numlevel="1" lineno="707" slineno="11-6"/>operation of a multi-agency strike force to combat violent and other major felony crimes <ln numlevel="1" lineno="708" slineno="11-7"/>committed within the state that are associated with illegal immigration and human <ln numlevel="1" lineno="709" slineno="11-8"/>trafficking.</subsection><subsection ssid="13-null-2" dnum="2-o" numlevel="1" lineno="710" slineno="11-9" level="1"><display>(2)</display>The office shall invite officers of the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="11" groupid="10" style="2" owner="jchristopherson" level="1" deltag="both">U.S.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="10" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">United States</amend> Immigration and Customs <ln numlevel="1" lineno="711" slineno="11-10"/>Enforcement and state and local law enforcement personnel to participate in this <ln numlevel="1" lineno="712" slineno="11-11"/>mutually supportive, multi-agency strike force to more effectively utilize their combined <ln numlevel="1" lineno="713" slineno="11-12"/>skills, expertise, and resources.</subsection><subsection ssid="13-null-3" dnum="3-o" numlevel="1" lineno="714" slineno="11-13" level="1"><display>(3)</display>The strike force shall focus its efforts on detecting, investigating, deterring, and <ln numlevel="1" lineno="715" slineno="11-14"/>eradicating violent and other major felony criminal activity related to illegal <ln numlevel="1" lineno="716" slineno="11-15"/>immigration and human trafficking.</subsection><subsection ssid="13-null-4" dnum="4-o" numlevel="1" lineno="717" slineno="11-16" level="1"><display>(4)</display>In conjunction with the strike force and subject to available funding, the Office of the <ln numlevel="1" lineno="718" slineno="11-17"/>Attorney General shall establish a Fraudulent Documents Identification Unit:<subsection ssid="13-null-5" dnum="a-o" numlevel="1" lineno="719" slineno="11-18" level="2"><display>(a)</display>for the primary purpose of investigating, apprehending, and prosecuting individuals <ln numlevel="1" lineno="720" slineno="11-19"/>or entities that participate in the sale or distribution of fraudulent documents used for <ln numlevel="1" lineno="721" slineno="11-20"/>identification purposes;</subsection><subsection ssid="13-null-6" dnum="b-o" numlevel="1" lineno="722" slineno="11-21" level="2"><display>(b)</display>to specialize in fraudulent identification documents created and prepared for <ln numlevel="1" lineno="723" slineno="11-22"/>individuals who are unlawfully residing within the state; and</subsection><subsection ssid="13-null-7" dnum="c-o" numlevel="1" lineno="724" slineno="11-23" level="2"><display>(c)</display>to administer the Identity Theft Victims Restricted Account created under Subsection <xref depth="4" refid="C67-5-S22.7_1800010118000101" refnumber="67-5-22.7(5)" start="0"><ln numlevel="1" lineno="725" slineno="11-24"/>(5)</xref>.</subsection></subsection><subsection ssid="13-null-8" dnum="5-o" numlevel="1" lineno="726" slineno="11-25" level="1" space="false"><display>(5)</display><subsection ssid="13-null-9" dnum="a-o" level="2" placement="sameline"><display>(a)</display>There is created a restricted account in the General Fund known as the "Identity <ln numlevel="1" lineno="727" slineno="11-26"/>Theft Victims Restricted Account."</subsection><subsection ssid="13-null-10" dnum="b-o" numlevel="1" lineno="728" slineno="11-27" level="2"><display>(b)</display>The Identity Theft Victims Restricted Account shall consist of money appropriated <ln numlevel="1" lineno="729" slineno="11-28"/>to the Identity Theft Victims Restricted Account by the Legislature.</subsection><subsection ssid="13-null-11" dnum="c-o" numlevel="1" lineno="730" slineno="11-29" level="2"><display>(c)</display>Subject to appropriations from the Legislature, beginning on the program start date, <ln numlevel="1" lineno="731" slineno="11-30"/>as defined in Section <xref depth="3" refid="C63G-12-S102_1800010118000101" refnumber="63G-12-102" start="0">63G-12-102</xref>, the Fraudulent Documents Identification Unit may <ln numlevel="1" lineno="732" slineno="11-31"/>expend the money in the Identity Theft Victims Restricted Account to pay a claim as <ln numlevel="1" lineno="733" slineno="11-32"/>provided in this Subsection <xref depth="4" refid="C67-5-S22.7_1800010118000101" refnumber="67-5-22.7(5)" start="0">(5)</xref> to a person who is a victim of identity theft <ln numlevel="1" lineno="734" slineno="11-33"/>prosecuted under Section <xref depth="3" refnumber="76-11-215">76-11-215</xref> or <xref depth="3" refid="C76-6-S1102_1800010118000101" refnumber="76-6-1102" start="0">76-6-1102</xref>.</subsection><subsection ssid="13-null-12" dnum="d-o" numlevel="1" lineno="735" slineno="11-34" level="2"><display>(d)</display>To obtain payment from the Identity Theft Victims Restricted Account, a person <ln numlevel="1" lineno="736" slineno="11-35"/>shall file a claim with the Fraudulent Documents Identification Unit by no later than <ln numlevel="1" lineno="737" slineno="11-36"/>one year after the day on which an individual is convicted, pleads guilty to, pleads no <ln numlevel="1" lineno="738" slineno="11-37"/>contest to, pleads guilty in a similar manner to, or resolved by diversion or its <ln numlevel="1" lineno="739" slineno="11-38"/>equivalent an offense under Section <xref depth="3" refnumber="76-11-215">76-11-215</xref> or <xref depth="3" refid="C76-6-S1102_1800010118000101" refnumber="76-6-1102" start="0">76-6-1102</xref> for the theft of the <ln numlevel="1" lineno="740" slineno="11-39"/>identity of the person filing the claim.</subsection><subsection ssid="13-null-13" dnum="e-o" numlevel="1" lineno="741" slineno="11-40" level="2"><display>(e)</display>A claim filed under this Subsection <xref depth="4" refid="C67-5-S22.7_1800010118000101" refnumber="67-5-22.7(5)" start="0">(5)</xref> shall include evidence satisfactory to the <ln numlevel="1" lineno="742" slineno="11-41"/>Fraudulent Documents Identification Unit:<subsection ssid="13-null-14" dnum="i-o" numlevel="1" lineno="743" slineno="11-42" level="3"><display>(i)</display>that the person is the victim of identity theft described in Subsection <xref depth="4" refid="C67-5-S22.7_1800010118000101" refnumber="67-5-22.7(5)(d)" start="0">(5)(d)</xref>; and</subsection><subsection ssid="13-null-15" dnum="ii-o" numlevel="1" lineno="744" slineno="11-43" level="3"><display>(ii)</display>of the actual damages experienced by the person as a result of the identity theft <ln numlevel="1" lineno="745" slineno="11-44"/>that are not recovered from a public or private source.</subsection></subsection><subsection ssid="13-null-16" dnum="f-o" numlevel="1" lineno="746" slineno="11-45" level="2"><display>(f)</display>The Fraudulent Documents Identification Unit shall pay a claim from the Identity <ln numlevel="1" lineno="747" slineno="11-46"/>Theft Victims Restricted Account:<subsection ssid="13-null-17" dnum="i-o" numlevel="1" lineno="748" slineno="11-47" level="3"><display>(i)</display>if the Fraudulent Documents Identification Unit determines that the person has <ln numlevel="1" lineno="749" slineno="11-48"/>provided sufficient evidence to meet the requirements of Subsection <xref depth="4" refid="C67-5-S22.7_1800010118000101" refnumber="67-5-22.7(5)(e)" start="0">(5)(e)</xref>;</subsection><subsection ssid="13-null-18" dnum="ii-o" numlevel="1" lineno="750" slineno="11-49" level="3"><display>(ii)</display>in the order that claims are filed with the Fraudulent Documents Identification <ln numlevel="1" lineno="751" slineno="11-50"/>Unit; and</subsection><subsection ssid="13-null-19" dnum="iii-o" numlevel="1" lineno="752" slineno="11-51" level="3"><display>(iii)</display>to the extent that it there is money in the Identity Theft Victims Restricted <ln numlevel="1" lineno="753" slineno="11-52"/>Account.</subsection></subsection><subsection ssid="13-null-20" dnum="g-o" numlevel="1" lineno="754" slineno="11-53" level="2"><display>(g)</display>If there is insufficient money in the Identity Theft Victims Restrict Account when a <ln numlevel="1" lineno="755" slineno="11-54"/>claim is filed under this Subsection <xref depth="4" refid="C67-5-S22.7_1800010118000101" refnumber="67-5-22.7(5)" start="0">(5)</xref> to pay the claim in full, the Fraudulent <ln numlevel="1" lineno="756" slineno="11-55"/>Documents Identification Unit may pay a claim when there is sufficient money in the <ln numlevel="1" lineno="757" slineno="11-56"/>account to pay the claim in the order that the claims are filed.</subsection></subsection><subsection ssid="13-null-21" dnum="6-o" numlevel="1" lineno="758" slineno="11-57" level="1"><display>(6)</display>The strike force shall make an annual report on <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="8" groupid="7" style="2" owner="jchristopherson" level="1" deltag="both">its</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the strike force's</amend> activities to the <ln numlevel="1" lineno="759" slineno="11-58"/>governor<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both"> and</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">, the State Commission on Criminal and Juvenile Justice created in <ln numlevel="1" lineno="760" slineno="11-59"/>Section <xref depth="3" refnumber="63M-7-201">63M-7-201</xref>, and</amend> the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="4" groupid="4" style="2" owner="jchristopherson" level="1" deltag="both">Legislature's </amend><amendoutend style="2"/>Law Enforcement and Criminal Justice <ln numlevel="1" lineno="761" slineno="11-60"/>Interim Committee by December 1, together with any proposed recommendations for <ln numlevel="1" lineno="762" slineno="11-61"/>modifications to this section.</subsection></section></bsec><bsec buid="15" num="77-27-32" type="amend" src="code" uid="C77-27-S32_2026050620260506" sort="77 27 00320020260506" numlevel="1" lineno="763" slineno="12-1" sn="12"><section number="77-27-32" numlevel="1" lineno="764" slineno="12-2" type="amend"><secline lineno="763">Section 12. Section <bold>77-27-32</bold> is amended to read:</secline><catline lineno="764"><bold>77-27-32<parens/>. Reporting requirements.</bold></catline><subsection ssid="15-null-1" dnum="1-o" numlevel="1" lineno="765" slineno="12-3" level="1" placement="noreturn"><display>(1)</display>The board shall publicly display metrics on the board's website, including:<subsection ssid="15-null-2" dnum="a-o" numlevel="1" lineno="766" slineno="12-4" level="2"><display>(a)</display>a measure of recidivism;</subsection><subsection ssid="15-null-3" dnum="b-o" numlevel="1" lineno="767" slineno="12-5" level="2"><display>(b)</display>a measure of time under board jurisdiction;</subsection><subsection ssid="15-null-4" dnum="c-o" numlevel="1" lineno="768" slineno="12-6" level="2"><display>(c)</display>a measure of prison releases by category;</subsection><subsection ssid="15-null-5" dnum="d-o" numlevel="1" lineno="769" slineno="12-7" level="2"><display>(d)</display>a measure of parole revocations;</subsection><subsection ssid="15-null-6" dnum="e-o" numlevel="1" lineno="770" slineno="12-8" level="2"><display>(e)</display>a measure of alignment of board decisions with the adult sentencing and supervision <ln numlevel="1" lineno="771" slineno="12-9"/>length guidelines, as defined in Section <xref depth="3" refnumber="63M-7-401.1">63M-7-401.1</xref>; and</subsection><subsection ssid="15-null-7" dnum="f-o" numlevel="1" lineno="772" slineno="12-10" level="2"><display>(f)</display>a measure of the aggregate reasons for departing from the guidelines described in <ln numlevel="1" lineno="773" slineno="12-11"/>Subsection <xref depth="4" refnumber="77-27-32(1)(e)">(1)(e)</xref>.</subsection></subsection><subsection ssid="15-null-8" dnum="2-o" numlevel="1" lineno="774" slineno="12-12" level="1"><display>(2)</display>On or before September 30 of each year, the board shall submit to <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="4" style="2" owner="jchristopherson" level="1" deltag="both">the commission and </amend><amendoutend style="2"/><ln numlevel="1" lineno="775" slineno="12-13"/>the Law Enforcement and Criminal Justice Interim Committee a report for the previous <ln numlevel="1" lineno="776" slineno="12-14"/>fiscal year that summarizes the metrics in Subsection <xref depth="4" refnumber="77-27-32(1)">(1)</xref>.</subsection><subsection ssid="15-9" dnum="_-o:3-i" numlevel="1" lineno="777" slineno="12-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1381" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">On or before November 1 of each year, the board shall submit the metrics described in <ln numlevel="1" lineno="778" slineno="12-16"/>Subsection <xref refnumber="15-null-1">(1)</xref> to the commission.</amend></subsection></section></bsec><bsec buid="7" num="80-5-202" type="amend" src="code" uid="C80-5-S202_2026050620260506" sort="80 05 02020020260506" numlevel="1" lineno="779" slineno="13-1" sn="13"><section number="80-5-202" numlevel="1" lineno="780" slineno="13-2" type="amend"><secline lineno="779">Section 13. Section <bold>80-5-202</bold> is amended to read:</secline><catline lineno="780"><bold>80-5-202<parens/>. Division rulemaking authority -- Reports on sexual assault.</bold></catline><subsection ssid="7-null-1" dnum="1-o" numlevel="1" lineno="781" slineno="13-3" level="1" placement="noreturn"><display>(1)</display>In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the <ln numlevel="1" lineno="782" slineno="13-4"/>division shall make rules to:<subsection ssid="7-null-2" dnum="a-o" numlevel="1" lineno="783" slineno="13-5" level="2"><display>(a)</display>establish standards for the admission of a minor to detention;</subsection><subsection ssid="7-null-3" dnum="b-o" numlevel="1" lineno="784" slineno="13-6" level="2"><display>(b)</display>describe good behavior for which credit may be earned under Subsection <xref depth="3" refnumber="80-6-704">80-6-704</xref><ln numlevel="1" lineno="785" slineno="13-7"/>(5);</subsection><subsection ssid="7-null-4" dnum="c-o" numlevel="1" lineno="786" slineno="13-8" level="2" format="full"><display>(c)</display>establish a formula, in consultation with the Office of the Legislative Fiscal Analyst, to <ln numlevel="1" lineno="787" slineno="13-9"/>calculate savings from General Fund appropriations under 2017 Laws of Utah, <eol numlevel="1" lineno="788" slineno="13-10"/>Chapter 330, resulting from the reduction in out-of-home placements for juvenile offenders <ln numlevel="1" lineno="789" slineno="13-11"/>with the division;</subsection><subsection ssid="7-null-5" dnum="d-o" numlevel="1" lineno="790" slineno="13-12" level="2"><display>(d)</display>establish policies and procedures regarding sexual assaults that occur in detention <ln numlevel="1" lineno="791" slineno="13-13"/>and secure care facilities; and</subsection><subsection ssid="7-null-6" dnum="e-o" numlevel="1" lineno="792" slineno="13-14" level="2"><display>(e)</display>establish the qualifications and conditions for services provided by the division under <ln numlevel="1" lineno="793" slineno="13-15"/>Section <xref depth="3" refnumber="80-6-809">80-6-809</xref>.</subsection></subsection><subsection ssid="7-null-7" dnum="2-o" numlevel="1" lineno="794" slineno="13-16" level="1"><display>(2)</display>In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the <ln numlevel="1" lineno="795" slineno="13-17"/>division may make rules:<subsection ssid="7-null-8" dnum="a-o" numlevel="1" lineno="796" slineno="13-18" level="2"><display>(a)</display>that govern the operation of prevention and early intervention programs, youth <ln numlevel="1" lineno="797" slineno="13-19"/>service programs, juvenile receiving centers, and other programs described in Section <xref depth="3" refnumber="80-5-401"><ln numlevel="1" lineno="798" slineno="13-20"/>80-5-401</xref>; and</subsection><subsection ssid="7-null-9" dnum="b-o" numlevel="1" lineno="799" slineno="13-21" level="2"><display>(b)</display>that govern the operation of detention and secure care facilities.</subsection></subsection><subsection ssid="7-null-10" dnum="3-o" numlevel="1" lineno="800" slineno="13-22" level="1"><display>(3)</display>A rule made by the division under Subsection <xref depth="4" refnumber="80-5-202(1)(a)">(1)(a)</xref>:<subsection ssid="7-null-11" dnum="a-o" numlevel="1" lineno="801" slineno="13-23" level="2"><display>(a)</display>may not permit secure detention based solely on the existence of multiple status <ln numlevel="1" lineno="802" slineno="13-24"/>offenses, misdemeanors, or infractions arising out of a single criminal episode; and</subsection><subsection ssid="7-null-12" dnum="b-o" numlevel="1" lineno="803" slineno="13-25" level="2"><display>(b)</display>shall prioritize use of home detention for a minor who might otherwise be held in <ln numlevel="1" lineno="804" slineno="13-26"/>secure detention.</subsection></subsection><subsection ssid="7-null-13" dnum="4-o" numlevel="1" lineno="805" slineno="13-27" level="1"><display>(4)</display>The rules described in Subsection <xref depth="4" refnumber="80-5-202(1)(d)">(1)(d)</xref> shall:<subsection ssid="7-null-14" dnum="a-o" numlevel="1" lineno="806" slineno="13-28" level="2"><display>(a)</display>require education and training, including:<subsection ssid="7-null-15" dnum="i-o" numlevel="1" lineno="807" slineno="13-29" level="3"><display>(i)</display>providing to minors detained in secure care and detention facilities, at intake and <ln numlevel="1" lineno="808" slineno="13-30"/>periodically, easy-to-understand information, which is developed and approved by <ln numlevel="1" lineno="809" slineno="13-31"/>the division, on sexual assault prevention, treatment, reporting, and counseling in <ln numlevel="1" lineno="810" slineno="13-32"/>consultation with community groups with expertise in sexual assault prevention, <ln numlevel="1" lineno="811" slineno="13-33"/>treatment, reporting, and counseling; and</subsection><subsection ssid="7-null-16" dnum="ii-o" numlevel="1" lineno="812" slineno="13-34" level="3"><display>(ii)</display>providing training specific to sexual assault to division mental health <ln numlevel="1" lineno="813" slineno="13-35"/>professionals and all division employees who have direct contact with minors <ln numlevel="1" lineno="814" slineno="13-36"/>regarding treatment and methods of prevention and investigation;</subsection></subsection><subsection ssid="7-null-17" dnum="b-o" numlevel="1" lineno="815" slineno="13-37" level="2"><display>(b)</display>require reporting of any incident of sexual assault, including:<subsection ssid="7-null-18" dnum="i-o" numlevel="1" lineno="816" slineno="13-38" level="3"><display>(i)</display>ensuring the confidentiality of sexual assault reports from minors and the <ln numlevel="1" lineno="817" slineno="13-39"/>protection of minors who report sexual assault; and</subsection><subsection ssid="7-null-19" dnum="ii-o" numlevel="1" lineno="818" slineno="13-40" level="3"><display>(ii)</display>prohibiting retaliation and disincentives for reporting sexual assault;</subsection></subsection><subsection ssid="7-null-20" dnum="c-o" numlevel="1" lineno="819" slineno="13-41" level="2"><display>(c)</display>require safety and care for minors who report sexual assault, including:<subsection ssid="7-null-21" dnum="i-o" numlevel="1" lineno="820" slineno="13-42" level="3"><display>(i)</display>providing, in situations in which there is reason to believe that a sexual assault has <ln numlevel="1" lineno="821" slineno="13-43"/>occurred, reasonable and appropriate measures to ensure the minor's safety by <ln numlevel="1" lineno="822" slineno="13-44"/>separating the minor from the minor's assailant, if known;</subsection><subsection ssid="7-null-22" dnum="ii-o" numlevel="1" lineno="823" slineno="13-45" level="3"><display>(ii)</display>providing acute trauma care for minors who report sexual assault, including <ln numlevel="1" lineno="824" slineno="13-46"/>treatment of injuries, HIV prophylaxis measures, and testing for sexually <ln numlevel="1" lineno="825" slineno="13-47"/>transmitted infections;</subsection><subsection ssid="7-null-23" dnum="iii-o" numlevel="1" lineno="826" slineno="13-48" level="3"><display>(iii)</display>providing confidential mental health counseling for minors who report sexual <ln numlevel="1" lineno="827" slineno="13-49"/>assault, including:<subsection ssid="7-null-24" dnum="A-o" numlevel="1" lineno="828" slineno="13-50" level="4"><display>(A)</display>access to outside community groups or victim advocates that have expertise in <ln numlevel="1" lineno="829" slineno="13-51"/>sexual assault counseling; and</subsection><subsection ssid="7-null-25" dnum="B-o" numlevel="1" lineno="830" slineno="13-52" level="4"><display>(B)</display>enabling confidential communication between minors and community groups <ln numlevel="1" lineno="831" slineno="13-53"/>and victim advocates; and</subsection></subsection><subsection ssid="7-null-26" dnum="iv-o" numlevel="1" lineno="832" slineno="13-54" level="3"><display>(iv)</display>monitoring minors who report sexual assault for suicidal impulses, <ln numlevel="1" lineno="833" slineno="13-55"/>post-traumatic stress disorder, depression, and other mental health consequences <ln numlevel="1" lineno="834" slineno="13-56"/>resulting from the sexual assault;</subsection></subsection><subsection ssid="7-null-27" dnum="d-o" numlevel="1" lineno="835" slineno="13-57" level="2"><display>(d)</display>require staff reporting of sexual assault and staff discipline for failure to report or for <ln numlevel="1" lineno="836" slineno="13-58"/>violating sexual assault policies, including:<subsection ssid="7-null-28" dnum="i-o" numlevel="1" lineno="837" slineno="13-59" level="3"><display>(i)</display>requiring all division employees to report any knowledge, suspicion, or <ln numlevel="1" lineno="838" slineno="13-60"/>information regarding an incident of sexual assault to the director or the director's <ln numlevel="1" lineno="839" slineno="13-61"/>designee;</subsection><subsection ssid="7-null-29" dnum="ii-o" numlevel="1" lineno="840" slineno="13-62" level="3"><display>(ii)</display>requiring disciplinary action for a division employee who fails to report as <ln numlevel="1" lineno="841" slineno="13-63"/>required; and</subsection><subsection ssid="7-null-30" dnum="iii-o" numlevel="1" lineno="842" slineno="13-64" level="3"><display>(iii)</display>requiring division employees to be subject to disciplinary sanctions up to and <ln numlevel="1" lineno="843" slineno="13-65"/>including termination for violating agency sexual assault policies, with <ln numlevel="1" lineno="844" slineno="13-66"/>termination the presumptive disciplinary sanction for division employees who <ln numlevel="1" lineno="845" slineno="13-67"/>have engaged in sexual assault, consistent with constitutional due process <ln numlevel="1" lineno="846" slineno="13-68"/>protections and state personnel laws and rules;</subsection></subsection><subsection ssid="7-null-31" dnum="e-o" numlevel="1" lineno="847" slineno="13-69" level="2"><display>(e)</display>require that any report of an incident of sexual assault be referred to the Division of <ln numlevel="1" lineno="848" slineno="13-70"/>Child and Family Services or a law enforcement agency with jurisdiction over the <ln numlevel="1" lineno="849" slineno="13-71"/>detention or secure care facility in which the alleged sexual assault occurred; and</subsection><subsection ssid="7-null-32" dnum="f-o" numlevel="1" lineno="850" slineno="13-72" level="2"><display>(f)</display>require data collection and reporting of all incidents of sexual assault from each <ln numlevel="1" lineno="851" slineno="13-73"/>detention and secure care facility.</subsection></subsection><subsection ssid="7-null-33" dnum="5-o" numlevel="1" lineno="852" slineno="13-74" level="1"><display>(5)</display>The division shall annually report the data described in <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="6" groupid="6" style="2" owner="jchristopherson" level="1" deltag="both">Section</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="5" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Subsection</amend> <xref depth="4" refnumber="80-5-202(4)(f)">(4)(f)</xref> to the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both"><ln numlevel="1" lineno="853" slineno="13-75"/>Law Enforcement and Criminal Justice Interim Committee</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">State Commission on <ln numlevel="1" lineno="854" slineno="13-76"/>Criminal and Juvenile Justice created in Section <xref depth="3" refnumber="63M-7-201">63M-7-201</xref></amend>.</subsection></section></bsec><bsec buid="28" type="repealer" src="code" sort="TRepealer" numlevel="1" lineno="855" slineno="14-1" sn="14"><secline>Section 14. <bold>Repealer.</bold></secline><rhead lineno="856"/><sectionText><repsec num="63A-16-101" uid="C63A-16-S101_2026050620260506" sort="63A16 01010020260506" src="code" sn="15" numlevel="1" lineno="857" slineno="14-3"><parens/>Title.</repsec></sectionText></bsec><bsec buid="43" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="858" slineno="15-1" sn="15"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="858">Section 15.  <bold>Effective Date.</bold></secline><sectionText lineno="859"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>1-9-26 3:36 PM</tm></rev></foot></leg>
