Section <bold>51-9-201</bold> is amended to read:</secline><catline lineno="31"><bold>51-9-201<parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>07/01/26</date></paren></parens>. Creation of Tobacco Settlement Restricted <ln numlevel="1" lineno="32" slineno="1-3"/>Account.</bold></catline><subsection ssid="8-null-1" dnum="1-o" numlevel="1" lineno="33" slineno="1-4" level="1" placement="noreturn"><display>(1)</display>There is created within the General Fund a restricted account known as the "Tobacco <ln numlevel="1" lineno="34" slineno="1-5"/>Settlement Restricted Account."</subsection><subsection ssid="8-null-2" dnum="2-o" numlevel="1" lineno="35" slineno="1-6" level="1"><display>(2)</display>The account shall earn interest.</subsection><subsection ssid="8-null-3" dnum="3-o" numlevel="1" lineno="36" slineno="1-7" level="1"><display>(3)</display>The account shall consist of:<subsection ssid="8-null-4" dnum="a-o" numlevel="1" lineno="37" slineno="1-8" level="2"><display>(a)</display>on and after July 1, 2007, 60% of all funds of every kind that are received by the <ln numlevel="1" lineno="38" slineno="1-9"/>state that are related to the settlement agreement that the state entered into with <ln numlevel="1" lineno="39" slineno="1-10"/>leading tobacco manufacturers on November 23, 1998; and</subsection><subsection ssid="8-null-5" dnum="b-o" numlevel="1" lineno="40" slineno="1-11" level="2"><display>(b)</display>interest earned on the account.</subsection></subsection><subsection ssid="8-null-6" dnum="4-o" numlevel="1" lineno="41" slineno="1-12" level="1" space="false"><display>(4)</display><subsection ssid="8-22" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>To the extent that funds will be available for appropriation in a given fiscal year, <ln numlevel="1" lineno="42" slineno="1-13"/>those funds shall be appropriated from the account in the following order:<subsection ssid="8-null-7" dnum="a-o:i-i" numlevel="1" lineno="43" slineno="1-14" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1007" style="2" owner="o" level="1" deltag="both">(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="both" space="true">(i)</amend></display>$66,600 to the Office of the Attorney General for ongoing enforcement and <ln numlevel="1" lineno="44" slineno="1-15"/>defense of the Tobacco Settlement Agreement;</subsection><subsection ssid="8-null-8" dnum="b-o:ii-i" numlevel="1" lineno="45" slineno="1-16" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1008" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="both" space="true">(ii)</amend></display>$18,500 to the State Tax Commission for ongoing enforcement of business <ln numlevel="1" lineno="46" slineno="1-17"/>compliance with the Tobacco Tax Settlement Agreement;</subsection><subsection ssid="8-null-9" dnum="c-o:iii-i" numlevel="1" lineno="47" slineno="1-18" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1009" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="both" space="true">(iii)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="25" groupid="23" style="2" owner="jchristopherson" level="1" deltag="both">$11,022,900</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="22" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">$11,250,600</amend> to the Department of Health and Human Services <ln numlevel="1" lineno="48" slineno="1-19"/>for:<subsection ssid="8-null-10" dnum="i-o:A-i" numlevel="1" lineno="49" slineno="1-20" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1010" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="both" space="true">(A)</amend></display>children in the Medicaid program created in <xref depth="1" refnumber="26B-3" start="0">Title 26B, Chapter 3, Health <ln numlevel="1" lineno="50" slineno="1-21"/>Care - Administration and Assistance</xref>, and the <amend anum="0" ea="amend" pairid="88" groupid="68" style="1" owner="jchristopherson" level="1" amendtag="both">Utah </amend>Children's Health <ln numlevel="1" lineno="51" slineno="1-22"/>Insurance Program created in Section <xref depth="3" refnumber="26B-3-902" start="0">26B-3-902</xref>; and</subsection><subsection ssid="8-null-11" dnum="ii-o:B-i" numlevel="1" lineno="52" slineno="1-23" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1011" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1012" style="1" owner="i" level="1" amendtag="both" space="true">(B)</amend></display>for restoration of dental benefits in the Children's Health Insurance <ln numlevel="1" lineno="53" slineno="1-24"/>Program;</subsection></subsection><subsection ssid="8-null-12" dnum="d-o:iv-i" numlevel="1" lineno="54" slineno="1-25" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1012" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1013" style="1" owner="i" level="1" amendtag="both" space="true">(iv)</amend></display>$3,277,100 to the Department of Health and Human Services for alcohol, <ln numlevel="1" lineno="55" slineno="1-26"/>tobacco, and other drug prevention, reduction, cessation, and control programs <ln numlevel="1" lineno="56" slineno="1-27"/>that promote unified messages and make use of media outlets, including radio, <ln numlevel="1" lineno="57" slineno="1-28"/>newspaper, billboards, and television, and with a preference in funding given to <ln numlevel="1" lineno="58" slineno="1-29"/>tobacco-related programs;</subsection><subsection ssid="8-null-13" dnum="e-o:v-i" numlevel="1" lineno="59" slineno="1-30" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1013" style="2" owner="o" level="1" deltag="both">(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1014" style="1" owner="i" level="1" amendtag="both" space="true">(v)</amend></display>$193,700 to the Administrative Office of the Courts and <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="26" groupid="24" style="2" owner="jchristopherson" level="1" deltag="both">$2,325,400</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="23" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="60" slineno="1-31"/>$1,101,300</amend> to the Department of Health and Human Services for the statewide <ln numlevel="1" lineno="61" slineno="1-32"/>expansion of the drug court program;</subsection><subsection ssid="8-null-14" dnum="f-o:vi-i" numlevel="1" lineno="62" slineno="1-33" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1014" style="2" owner="o" level="1" deltag="both">(f)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1015" style="1" owner="i" level="1" amendtag="both" space="true">(vi)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="27" groupid="25" style="2" owner="jchristopherson" level="1" deltag="both">$4,000,000</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="24" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">$1,063,400</amend> to the Utah Board of Higher Education for the <ln numlevel="1" lineno="63" slineno="1-34"/>University of Utah Health Sciences Center to benefit the health and well-being of <ln numlevel="1" lineno="64" slineno="1-35"/>Utah citizens through in-state research, treatment, and educational activities; and</subsection><subsection ssid="8-null-15" dnum="g-o:vii-i" numlevel="1" lineno="65" slineno="1-36" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1015" style="2" owner="o" level="1" deltag="both">(g)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="both" space="true">(vii)</amend></display>any remaining funds as directed by the Legislature through appropriation.</subsection></subsection><subsection ssid="8-25" dnum="_-o:b-i" numlevel="1" lineno="66" slineno="1-37" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><subsection ssid="8-32" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1017" style="1" owner="i" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="63" groupid="52" style="1" owner="jchristopherson" level="1" amendtag="end">As used in this subsection, "discretionary appropriation" means a legislative <ln numlevel="1" lineno="67" slineno="1-38"/>appropriation that is:</amend><subsection ssid="8-26" dnum="_-o:A-i" numlevel="1" lineno="68" slineno="1-39" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="66" groupid="54" style="1" owner="jchristopherson" level="1" amendtag="end">an ongoing appropriation from the Tobacco Settlement Restricted Account to <ln numlevel="1" lineno="69" slineno="1-40"/>a program described in Subsections <xref depth="4" refnumber="51-9-201(4)(a)(i)">(4)(a)(i)</xref> through <xref depth="4" refnumber="51-9-201(vi)">(vi)</xref>; and</amend></subsection><subsection ssid="8-27" dnum="_-o:B-i" numlevel="1" lineno="70" slineno="1-41" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1019" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="69" groupid="56" style="1" owner="jchristopherson" level="1" amendtag="end">in addition to the amount listed in Subsection <xref depth="4" refnumber="51-9-201(4)(a)">(4)(a)</xref> for that program.</amend></subsection></subsection><subsection ssid="8-28" dnum="_-o:ii-i" numlevel="1" lineno="71" slineno="1-42" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1020" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="72" groupid="58" style="1" owner="jchristopherson" level="1" amendtag="end">If, after making each distribution listed in Subsection <xref depth="4" refnumber="51-9-201(4)(a)(i)">(4)(a)(i)</xref> through <xref depth="4" refnumber="51-9-201(vi)">(vi)</xref>, the <ln numlevel="1" lineno="72" slineno="1-43"/>amount remaining in the Tobacco Settlement Restricted Account is insufficient to <ln numlevel="1" lineno="73" slineno="1-44"/>cover the total amount of discretionary appropriations, the Legislature shall make <ln numlevel="1" lineno="74" slineno="1-45"/>the discretionary appropriations:</amend><subsection ssid="8-29" dnum="_-o:A-i" numlevel="1" lineno="75" slineno="1-46" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1021" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="75" groupid="60" style="1" owner="jchristopherson" level="1" amendtag="end">sequentially in the order the programs are listed under Subsection <xref depth="4" refnumber="51-9-201(4)(a)(i)">(4)(a)(i)</xref> <ln numlevel="1" lineno="76" slineno="1-47"/>through <xref depth="4" refnumber="51-9-201(vi)">(vi)</xref>;</amend></subsection><subsection ssid="8-30" dnum="_-o:B-i" numlevel="1" lineno="77" slineno="1-48" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1022" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="78" groupid="62" style="1" owner="jchristopherson" level="1" amendtag="end">in full or, if insufficient funds are available to satisfy the discretionary <ln numlevel="1" lineno="78" slineno="1-49"/>appropriation, in part; and</amend></subsection><subsection ssid="8-31" dnum="_-o:C-i" numlevel="1" lineno="79" slineno="1-50" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1023" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="81" groupid="64" style="1" owner="jchristopherson" level="1" amendtag="end">until the available funds in the Tobacco Settlement Restricted Account for <ln numlevel="1" lineno="80" slineno="1-51"/>discretionary appropriations are exhausted.</amend></subsection></subsection><subsection ssid="8-23" dnum="_-o:iii-i" numlevel="1" lineno="81" slineno="1-52" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1024" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="57" groupid="47" style="1" owner="jchristopherson" level="1" amendtag="end">If, after all discretionary appropriations are reduced to zero in accordance with <ln numlevel="1" lineno="82" slineno="1-53"/>Subsection <xref depth="4" refnumber="51-9-201(4)(b)(ii)">(4)(b)(ii)</xref>, the amount in the Tobacco Settlement Restricted Account is <ln numlevel="1" lineno="83" slineno="1-54"/>insufficient to cover the distributions described in Subsection <xref depth="4" refnumber="51-9-201(4)(a)(i)">(4)(a)(i)</xref> through <xref depth="4" refnumber="51-9-201(vi)">(vi)</xref>, <ln numlevel="1" lineno="84" slineno="1-55"/>the Division of Finance shall make the distributions described in Subsections <xref depth="4" refnumber="51-9-201(4)(a)(i)"><ln numlevel="1" lineno="85" slineno="1-56"/>(4)(a)(i)</xref> through <xref depth="4" refnumber="51-9-201(vi)">(vi)</xref>:</amend><subsection ssid="8-19" dnum="_-o:A-i" numlevel="1" lineno="86" slineno="1-57" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1025" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="34" groupid="31" style="1" owner="jchristopherson" level="1" amendtag="end">sequentially in the order of priority the distributions are listed under <ln numlevel="1" lineno="87" slineno="1-58"/>Subsection <xref depth="4" refnumber="51-9-201(4)(a)">(4)(a)</xref>;</amend></subsection><subsection ssid="8-20" dnum="_-o:B-i" numlevel="1" lineno="88" slineno="1-59" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1026" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="37" groupid="33" style="1" owner="jchristopherson" level="1" amendtag="end">in full or, if insufficient funds are available to satisfy the next distribution in <ln numlevel="1" lineno="89" slineno="1-60"/>the sequence, in part; Electronic Cigarette Substance and Nicotine <ln numlevel="1" lineno="94" slineno="2-3"/>Product Proceeds Restricted Account.</bold></catline><subsection ssid="5-null-1" dnum="1-o" numlevel="1" lineno="95" slineno="2-4" level="1" placement="noreturn"><display>(1)</display>There is created within the General Fund a restricted account known as the "Electronic <ln numlevel="1" lineno="96" slineno="2-5"/>Cigarette Substance and Nicotine Product Proceeds Restricted Account."</subsection><subsection ssid="5-null-2" dnum="2-o" numlevel="1" lineno="97" slineno="2-6" level="1"><display>(2)</display>The Electronic Cigarette Substance and Nicotine Product Proceeds Restricted Account <ln numlevel="1" lineno="98" slineno="2-7"/>consists of:<subsection ssid="5-null-3" dnum="a-o" numlevel="1" lineno="99" slineno="2-8" level="2"><display>(a)</display>revenue collected from the tax imposed by Section <xref depth="3" refnumber="59-14-804">59-14-804</xref>;</subsection><subsection ssid="5-null-4" dnum="b-o" numlevel="1" lineno="100" slineno="2-9" level="2"><display>(b)</display>fees and penalties collected under Section <xref depth="3" refnumber="59-14-810">59-14-810</xref>;</subsection><subsection ssid="5-null-5" dnum="c-o" numlevel="1" lineno="101" slineno="2-10" level="2"><display>(c)</display>all money received by the attorney general or the Department of Commerce as a <ln numlevel="1" lineno="102" slineno="2-11"/>result of any judgment, settlement, or compromise of claims pertaining to alleged <ln numlevel="1" lineno="103" slineno="2-12"/>violations of law related to the manufacture, marketing, distribution, or sale of <ln numlevel="1" lineno="104" slineno="2-13"/>electronic cigarette products, as defined in Section <xref depth="3" refnumber="76-9-1101">76-9-1101</xref>:<subsection ssid="5-null-6" dnum="i-o" numlevel="1" lineno="105" slineno="2-14" level="3"><display>(i)</display>if the total amount of the judgment, settlement, or compromise received by the <ln numlevel="1" lineno="106" slineno="2-15"/>state exceeds $1,000,000; and</subsection><subsection ssid="5-null-7" dnum="ii-o" numlevel="1" lineno="107" slineno="2-16" level="3"><display>(ii)</display>after reimbursement to the attorney general and the Department of Commerce for <ln numlevel="1" lineno="108" slineno="2-17"/>expenses related to the matters described in this Subsection <xref depth="4" refnumber="59-14-807(2)(c)">(2)(c)</xref>; and</subsection></subsection><subsection ssid="5-null-8" dnum="d-o" numlevel="1" lineno="109" slineno="2-18" level="2"><display>(d)</display>amounts appropriated by the Legislature.</subsection></subsection><subsection ssid="5-null-9" dnum="3-o" numlevel="1" lineno="110" slineno="2-19" level="1" space="false"><display>(3)</display><subsection ssid="5-null-10" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Subject to Subsections <xref depth="4" refnumber="59-14-807(3)(b)">(3)(b)</xref> and <xref depth="4" refnumber="59-14-807(c)">(c)</xref>, for each fiscal year and subject to <ln numlevel="1" lineno="111" slineno="2-20"/>appropriation by the Legislature, the Division of Finance shall distribute from the <ln numlevel="1" lineno="112" slineno="2-21"/>Electronic Cigarette Substance and Nicotine Product Proceeds Restricted Account:<subsection ssid="5-null-11" dnum="i-o" numlevel="1" lineno="113" slineno="2-22" level="3" tab="1"><display>(i)</display>$2,000,000 to the Department of Health and Human Services for enforcement <ln numlevel="1" lineno="114" slineno="2-23"/>services aimed at disrupting organizations and networks that provide tobacco <ln numlevel="1" lineno="115" slineno="2-24"/>products, electronic cigarette products, nicotine products, or other illegal <ln numlevel="1" lineno="116" slineno="2-25"/>controlled substances to minors, which the Department of Health and Human <ln numlevel="1" lineno="117" slineno="2-26"/>Services shall allocate to the local health departments using the formula created in <ln numlevel="1" lineno="118" slineno="2-27"/>accordance with Section <xref depth="3" refnumber="26A-1-116">26A-1-116</xref>;</subsection><subsection ssid="5-null-12" dnum="ii-o" numlevel="1" lineno="119" slineno="2-28" level="3" tab="1"><display>(ii)</display>$1,180,000 to the Department of Public Safety for law enforcement officers <ln numlevel="1" lineno="120" slineno="2-29"/>aimed at disrupting organizations and networks that provide tobacco products, <ln numlevel="1" lineno="121" slineno="2-30"/>electronic cigarette products, nicotine products, and other illegal controlled <ln numlevel="1" lineno="122" slineno="2-31"/>substances to minors;</subsection><subsection ssid="5-null-13" dnum="iii-o" numlevel="1" lineno="123" slineno="2-32" level="3" tab="1"><display>(iii)</display>$1,000,000 to the Department of Health and Human Services for enforcement <ln numlevel="1" lineno="124" slineno="2-33"/>services aimed at disrupting organizations and networks that provide tobacco <ln numlevel="1" lineno="125" slineno="2-34"/>products, electronic cigarette products, nicotine products, and other illegal <ln numlevel="1" lineno="126" slineno="2-35"/>controlled substances to minors;</subsection><subsection ssid="5-null-14" dnum="iv-o" numlevel="1" lineno="127" slineno="2-36" level="3" tab="1"><display>(iv)</display>$3,000,000 to the Department of Health and Human Services for community <ln numlevel="1" lineno="128" slineno="2-37"/>partner prevention programs, which the Department of Health and Human <ln numlevel="1" lineno="129" slineno="2-38"/>Services shall allocate to the local health departments using the formula created in <ln numlevel="1" lineno="130" slineno="2-39"/>accordance with Section <xref depth="3" refnumber="26A-1-116">26A-1-116</xref>;</subsection><subsection ssid="5-null-15" dnum="v-o" numlevel="1" lineno="131" slineno="2-40" level="3" tab="1"><display>(v)</display>$1,000,000 to the Department of Health and Human Services for statewide <ln numlevel="1" lineno="132" slineno="2-41"/>cessation programs and prevention education;</subsection><subsection ssid="5-null-16" dnum="vi-o" numlevel="1" lineno="133" slineno="2-42" level="3" tab="1"><display>(vi)</display>$2,000,000 to the Department of Health and Human Services for alcohol, <ln numlevel="1" lineno="134" slineno="2-43"/>tobacco, and other drug prevention, reduction, cessation, and control programs <ln numlevel="1" lineno="135" slineno="2-44"/>that promote unified messages and make use of media outlets, including radio, <ln numlevel="1" lineno="136" slineno="2-45"/>newspaper, billboards, and television; and</subsection><subsection ssid="5-null-17" dnum="vii-o" numlevel="1" lineno="137" slineno="2-46" level="3" tab="1"><display>(vii)</display>$5,084,200 to the State Board of Education for school-based prevention <ln numlevel="1" lineno="138" slineno="2-47"/>programs.</subsection></subsection><subsection ssid="5-73" dnum="_-o:b-i" numlevel="1" lineno="139" slineno="2-48" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1045" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><subsection ssid="5-80" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1046" style="1" owner="i" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="14" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="end">As used in this subsection, "discretionary appropriation" means a legislative <ln numlevel="1" lineno="140" slineno="2-49"/>appropriation that is:</amend><subsection ssid="5-74" dnum="_-o:A-i" numlevel="1" lineno="141" slineno="2-50" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1047" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="15" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="end">an ongoing appropriation from the Electronic Cigarette Substance and <ln numlevel="1" lineno="142" slineno="2-51"/>Nicotine Product Proceeds Restricted Account to a program described in <ln numlevel="1" lineno="143" slineno="2-52"/>Subsection <xref depth="4" refnumber="59-14-807(3)(a)">(3)(a)</xref>; and</amend></subsection><subsection ssid="5-75" dnum="_-o:B-i" numlevel="1" lineno="144" slineno="2-53" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1048" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="18" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="end">in addition to the amount listed in Subsection <xref depth="4" refnumber="59-14-807(3)(a)">(3)(a)</xref> for that program.</amend></subsection></subsection><subsection ssid="5-76" dnum="_-o:ii-i" numlevel="1" lineno="145" slineno="2-54" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1049" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="end">If, after making each distribution listed in Subsection <xref depth="4" refnumber="59-14-807(3)(a)">(3)(a)</xref>, the amount <ln numlevel="1" lineno="146" slineno="2-55"/>remaining in the Electronic Cigarette Substance and Nicotine Product Proceeds <ln numlevel="1" lineno="147" slineno="2-56"/>Restricted Account is insufficient to cover the total amount of discretionary <ln numlevel="1" lineno="148" slineno="2-57"/>appropriations, the Legislature shall make the discretionary appropriations:</amend><subsection ssid="5-77" dnum="_-o:A-i" numlevel="1" lineno="149" slineno="2-58" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1050" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="27" groupid="23" style="1" owner="jchristopherson" level="1" amendtag="end">sequentially in the order the programs are listed under Subsection <xref depth="4" refnumber="59-14-807(3)(a)">(3)(a)</xref>;</amend></subsection><subsection ssid="5-78" dnum="_-o:B-i" numlevel="1" lineno="150" slineno="2-59" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1051" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="30" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="end">in full or, if insufficient funds are available to satisfy the discretionary <ln numlevel="1" lineno="151" slineno="2-60"/>appropriation, in part; and</amend></subsection><subsection ssid="5-79" dnum="_-o:C-i" numlevel="1" lineno="152" slineno="2-61" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1052" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="33" groupid="27" style="1" owner="jchristopherson" level="1" amendtag="end">until the available funds in the Electronic Cigarette Substance and Nicotine <ln numlevel="1" lineno="153" slineno="2-62"/>Product Proceeds Restricted Account for discretionary appropriations are <ln numlevel="1" lineno="154" slineno="2-63"/>exhausted.</amend></subsection></subsection><subsection ssid="5-null-18" dnum="b-o:iii-i" numlevel="1" lineno="155" slineno="2-64" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1053" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1054" style="1" owner="i" level="1" amendtag="both" space="true">(iii)</amend></display>If<amend anum="0" ea="amend" pairid="41" groupid="32" style="1" owner="jchristopherson" level="1" amendtag="both">, after all discretionary appropriations are reduced to zero in accordance <ln numlevel="1" lineno="156" slineno="2-65"/>with Subsection <xref depth="4" refnumber="59-14-807(3)(b)(ii)">(3)(b)(ii)</xref>,</amend> the amount in the Electronic Cigarette Substance and <ln numlevel="1" lineno="157" slineno="2-66"/>Nicotine Product Proceeds Restricted Account is insufficient to cover the <ln numlevel="1" lineno="158" slineno="2-67"/>distributions described in Subsection <xref depth="4" refnumber="59-14-807(3)(a)">(3)(a)</xref>, the Division of Finance shall make <ln numlevel="1" lineno="159" slineno="2-68"/>the distributions under Subsection <xref depth="4" refnumber="59-14-807(3)(a)">(3)(a)</xref>:<subsection ssid="5-null-19" dnum="i-o:A-i" numlevel="1" lineno="160" slineno="2-69" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1054" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1055" style="1" owner="i" level="1" amendtag="both" space="true">(A)</amend></display>sequentially in the order of priority the distributions are listed under <ln numlevel="1" lineno="161" slineno="2-70"/>Subsection <xref depth="4" refnumber="59-14-807(3)(a)">(3)(a)</xref>;</subsection><subsection ssid="5-null-20" dnum="ii-o:B-i" numlevel="1" lineno="162" slineno="2-71" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1055" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1056" style="1" owner="i" level="1" amendtag="both" space="true">(B)</amend></display>in full or, if insufficient funds are available to satisfy the next distribution <ln numlevel="1" lineno="163" slineno="2-72"/>in the sequence, in part; and</subsection><subsection ssid="5-null-21" dnum="iii-o:C-i" numlevel="1" lineno="164" slineno="2-73" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1056" style="2" owner="o" level="1" deltag="both">(iii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1057" style="1" owner="i" level="1" amendtag="both" space="true">(C)</amend></display>until the available funds in the Electronic Cigarette Substance and <ln numlevel="1" lineno="165" slineno="2-74"/>Nicotine Product Proceeds Restricted Account are exhausted.</subsection></subsection></subsection><subsection ssid="5-null-22" dnum="c-o" numlevel="1" lineno="166" slineno="2-75" level="2"><display>(c)</display>For each fiscal year and subject to appropriation by the Legislature, the Division of <ln numlevel="1" lineno="167" slineno="2-76"/>Finance shall distribute from the funds deposited under Section <xref depth="3" refnumber="59-14-810">59-14-810</xref> into the <ln numlevel="1" lineno="168" slineno="2-77"/>Electronic Cigarette Substance and Nicotine Product Proceeds Restricted Account:<subsection ssid="5-null-23" dnum="i-o" numlevel="1" lineno="169" slineno="2-78" level="3"><display>(i)</display>to the commission, in an amount equal to the amount necessary to create and <ln numlevel="1" lineno="170" slineno="2-79"/>maintain the registry described in Section <xref depth="3" refnumber="59-14-810">59-14-810</xref>;</subsection><subsection ssid="5-null-24" dnum="ii-o" numlevel="1" lineno="171" slineno="2-80" level="3"><display>(ii)</display>to the Department of Health and Human Services, in an amount necessary for <ln numlevel="1" lineno="172" slineno="2-81"/>completing duties described in Section <xref depth="3" refnumber="59-14-810">59-14-810</xref>; and</subsection><subsection ssid="5-null-25" dnum="iii-o" numlevel="1" lineno="173" slineno="2-82" level="3"><display>(iii)</display>to the Department of Health and Human Services, the remainder to be divided <ln numlevel="1" lineno="174" slineno="2-83"/>among the local health departments for inspection and enforcement described in <ln numlevel="1" lineno="175" slineno="2-84"/>Sections <xref depth="3" refnumber="26A-1-131">26A-1-131</xref> and <xref depth="3" refnumber="59-14-810">59-14-810</xref>.</subsection></subsection></subsection><subsection ssid="5-null-26" dnum="4-o" numlevel="1" lineno="176" slineno="2-85" level="1" space="false"><display>(4)</display><subsection ssid="5-null-27" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The local health departments shall use the money received in accordance with <ln numlevel="1" lineno="177" slineno="2-86"/>Subsection <xref depth="4" refnumber="59-14-807(3)(a)">(3)(a)</xref> for enforcing:<subsection ssid="5-null-28" dnum="i-o" numlevel="1" lineno="178" slineno="2-87" level="3" tab="1"><display>(i)</display>the regulation provisions described in Section <xref depth="3" refnumber="26B-7-505">26B-7-505</xref>;</subsection><subsection ssid="5-null-29" dnum="ii-o" numlevel="1" lineno="179" slineno="2-88" level="3" tab="1"><display>(ii)</display>the labeling requirement described in Section <xref depth="3" refnumber="26B-7-505">26B-7-505</xref>; and</subsection><subsection ssid="5-null-30" dnum="iii-o" numlevel="1" lineno="180" slineno="2-89" level="3" tab="1"><display>(iii)</display>the penalty provisions described in Section <xref depth="3" refnumber="26B-7-518">26B-7-518</xref>.</subsection></subsection><subsection ssid="5-null-31" dnum="b-o" numlevel="1" lineno="181" slineno="2-90" level="2"><display>(b)</display>The Department of Health and Human Services shall use the money received in <ln numlevel="1" lineno="182" slineno="2-91"/>accordance with Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">(3)(a)(v)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="6" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref refnumber="(3)(a)(vi)" depth="4">(3)(a)(vi)</xref></amend> for the Youth Electronic Cigarette, <ln numlevel="1" lineno="183" slineno="2-92"/>Marijuana, and Other Drug Prevention Program created in Section <xref depth="3" refnumber="26B-1-428">26B-1-428</xref>.</subsection><subsection ssid="5-null-32" dnum="c-o" numlevel="1" lineno="184" slineno="2-93" level="2"><display>(c)</display>The local health departments shall use the money received in accordance with <ln numlevel="1" lineno="185" slineno="2-94"/>Subsection <xref depth="4" refnumber="59-14-807(3)(a)(iv)">(3)(a)(iv)</xref> to issue grants under the Electronic Cigarette, Marijuana, and <ln numlevel="1" lineno="186" slineno="2-95"/>Other Drug Prevention Grant Program created in Section <xref depth="3" refnumber="26A-1-129">26A-1-129</xref>.</subsection><subsection ssid="5-null-33" dnum="d-o" numlevel="1" lineno="187" slineno="2-96" level="2"><display>(d)</display>The State Board of Education shall use the money received in accordance with <ln numlevel="1" lineno="188" slineno="2-97"/>Subsection <xref depth="4" refnumber="59-14-807(3)(a)(vii)">(3)(a)(vii)</xref> to distribute to local education agencies to pay for:<subsection ssid="5-null-34" dnum="i-o" numlevel="1" lineno="189" slineno="2-98" level="3" space="false"><display>(i)</display><subsection ssid="5-null-35" dnum="A-o" level="4" placement="sameline"><display>(A)</display>stipends for positive behaviors specialists as described in Subsection <xref depth="4" refnumber="53G-10-407(4)(a)(i)"><ln numlevel="1" lineno="190" slineno="2-99"/>53G-10-407(4)(a)(i)</xref>;</subsection><subsection ssid="5-null-36" dnum="B-o" numlevel="1" lineno="191" slineno="2-100" level="4"><display>(B)</display>the cost of administering the positive behaviors plan as described in <ln numlevel="1" lineno="192" slineno="2-101"/>Subsection <xref depth="4" refnumber="53G-10-407(4)(a)(ii)">53G-10-407(4)(a)(ii)</xref>; and</subsection><subsection ssid="5-null-37" dnum="C-o" numlevel="1" lineno="193" slineno="2-102" level="4"><display>(C)</display>the cost of implementing an Underage Drinking and Substance Abuse <ln numlevel="1" lineno="194" slineno="2-103"/>Prevention Program in grade 4 or 5, as described in Subsection <xref depth="4" refnumber="53G-10-406(3)(b)"><ln numlevel="1" lineno="195" slineno="2-104"/>53G-10-406(3)(b)</xref>; or</subsection></subsection><subsection ssid="5-null-38" dnum="ii-o" numlevel="1" lineno="196" slineno="2-105" level="3"><display>(ii)</display>a comprehensive prevention plan, as that term is defined in Section <xref depth="3" refnumber="53F-2-525">53F-2-525</xref>.</subsection></subsection></subsection><subsection ssid="5-null-39" dnum="5-o" numlevel="1" lineno="197" slineno="2-106" level="1" space="false"><display>(5)</display><subsection ssid="5-null-40" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The fund shall earn interest.</subsection><subsection ssid="5-null-41" dnum="b-o" numlevel="1" lineno="198" slineno="2-107" level="2"><display>(b)</display>All interest earned on fund money shall be deposited into the fund.</subsection></subsection><subsection ssid="5-null-42" dnum="6-o" numlevel="1" lineno="199" slineno="2-108" level="1"><display>(6)</display>Subject to legislative appropriations, funds remaining in the Electronic Cigarette <ln numlevel="1" lineno="200" slineno="2-109"/>Substance and Nicotine Product Proceeds Restricted Account after the distribution <ln numlevel="1" lineno="201" slineno="2-110"/>described in Subsection <xref depth="4" refnumber="59-14-807(3)">(3)</xref> may only be used for:<subsection ssid="5-null-43" dnum="a-o" numlevel="1" lineno="202" slineno="2-111" level="2"><display>(a)</display>funding commission personnel to enforce compliance with the tax collection <ln numlevel="1" lineno="203" slineno="2-112"/>requirements of this part; and</subsection><subsection ssid="5-null-44" dnum="b-o" numlevel="1" lineno="204" slineno="2-113" level="2"><display>(b)</display>programs and activities related to the prevention and cessation of electronic cigarette, <ln numlevel="1" lineno="205" slineno="2-114"/>nicotine products, marijuana, and other drug use.</subsection></subsection></section></bsec><bsec buid="2" num="63I-1-259" type="amend" src="code" uid="C63I-1-S259_2026050620260506" sort="63I01 02590020260506" numlevel="1" lineno="206" slineno="3-1" sn="3"><section number="63I-1-259" numlevel="1" lineno="207" slineno="3-2" type="amend"><secline lineno="206">Section 3. Section <bold>63I-1-259</bold> is amended to read:</secline><catline lineno="207"><bold>63I-1-259<parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>05/06/26</date></paren></parens>.
