Ballard</sponsorhead><otherSponsorhead>Senate Sponsor: Brady Brammer</otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill concerns provisions relating to offenders.</gd><hphead lineno="6">Highlighted Provisions:</hphead><hp numlevel="1" lineno="7" slineno="0-7">This bill:<hl numlevel="1" lineno="8" slineno="0-8" level="1">requires a county jail to assist certain county jail inmates in obtaining a current driver <ln numlevel="1" lineno="9" slineno="0-9"/>license or state-issued identification;</hl><hl numlevel="1" lineno="10" slineno="0-10" level="1">requires a substance abuse treatment program to provide the results of a participant's drug <ln numlevel="1" lineno="11" slineno="0-11"/>test to the participant's supervising probation or parole officer under certain conditions;</hl><hl numlevel="1" lineno="12" slineno="0-12" level="1">requires the Driver License Division to coordinate with a county jail in providing a <ln numlevel="1" lineno="13" slineno="0-13"/>county inmate with a driver license certificate or a temporary regular identification card;</hl><hl numlevel="1" lineno="14" slineno="0-14" level="1">requires the Department of Corrections to:<hl numlevel="1" lineno="15" slineno="0-15" level="2">identify and provide information and resources regarding post-incarceration housing; <ln numlevel="1" lineno="16" slineno="0-16"/>and</hl><hl numlevel="1" lineno="17" slineno="0-17" level="2">provide annual data to the State Commission on Criminal and Juvenile Justice <ln numlevel="1" lineno="18" slineno="0-18"/>concerning the types of, and usage of, various incentives offered to inmates;</hl></hl><hl numlevel="1" lineno="19" slineno="0-19" level="1">requires the Division of Adult Probation and Parole to track and annually report <ln numlevel="1" lineno="20" slineno="0-20"/>information concerning the housing of offenders currently on parole; </hl><hl numlevel="1" lineno="21" slineno="0-21" level="1">standardizes the health information disclosure provisions between the substance abuse <ln numlevel="1" lineno="22" slineno="0-22"/>treatment requirements and the probation and parole requirements; Assistance with identification records for certain county inmates.</bold></catline><subsection ssid="35-9-68" dnum="_-o:1-i" numlevel="1" lineno="45" slineno="1-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1000" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">For a county inmate sentenced to serve at least six months in a county jail, the county <ln numlevel="1" lineno="46" slineno="1-4"/>jail shall:</amend><subsection ssid="35-9-69" dnum="_-o:a-i" numlevel="1" lineno="47" slineno="1-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1001" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="21" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">determine whether the county inmate has a current state-issued driver license or <ln numlevel="1" lineno="48" slineno="1-6"/>state-issued identification card; and</amend></subsection><subsection ssid="35-9-70" dnum="_-o:b-i" numlevel="1" lineno="49" slineno="1-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1002" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="16" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="end">if the county inmate does not possess a document described in Subsection <xref depth="4" refnumber="17-72-411(1)(a)">(1)(a)</xref>:</amend><subsection ssid="35-9-71" dnum="_-o:i-i" numlevel="1" lineno="50" slineno="1-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1003" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="122" groupid="82" style="1" owner="jchristopherson" level="1" amendtag="end">inform the county inmate that a document listed in Subsection <xref depth="4" refnumber="17-72-411(1)(a)">(1)(a)</xref> may be <ln numlevel="1" lineno="51" slineno="1-9"/>required to obtain employment upon release;</amend></subsection><subsection ssid="35-9-72" dnum="_-o:ii-i" numlevel="1" lineno="52" slineno="1-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1004" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="125" groupid="84" style="1" owner="jchristopherson" level="1" amendtag="end">inquire whether the county inmate would like to:</amend><subsection ssid="35-91" dnum="_-o:A-i" numlevel="1" lineno="53" slineno="1-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="166" groupid="115" style="1" owner="jchristopherson" level="1" amendtag="end">apply to renew, or obtain a duplicate of, a state-issued driver license; or</amend></subsection><subsection ssid="35-92" dnum="_-o:B-i" numlevel="1" lineno="54" slineno="1-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="171" groupid="119" style="1" owner="jchristopherson" level="1" amendtag="end">apply for a state-issued identification card or extend a state-issued <ln numlevel="1" lineno="55" slineno="1-13"/>identification card; and</amend></subsection></subsection><subsection ssid="35-9-73" dnum="_-o:iii-i" numlevel="1" lineno="56" slineno="1-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" space="false"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><subsection ssid="35-9-74" dnum="_-o:A-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" placement="sameline"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1">(A)</amend></display><amend anum="0" ea="amend" pairid="140" groupid="95" style="1" owner="jchristopherson" level="1" amendtag="end">subject to Subsection <xref depth="4" refnumber="17-72-411(4)">(4)</xref>, if the county inmate accepts assistance in <ln numlevel="1" lineno="57" slineno="1-15"/>obtaining a document described in Subsection <xref depth="4" refnumber="17-72-411(1)(a)">(1)(a)</xref>, provide the assistance <ln numlevel="1" lineno="58" slineno="1-16"/>described in Subsection <xref depth="4" refnumber="17-72-411(2)">(2)</xref> as soon as practicable after the date on which the <ln numlevel="1" lineno="59" slineno="1-17"/>inmate accepts assistance; or</amend></subsection><subsection ssid="35-9-75" dnum="_-o:B-i" numlevel="1" lineno="60" slineno="1-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="136" groupid="92" style="1" owner="jchristopherson" level="1" amendtag="end">if the county inmate refuses assistance in obtaining a document described in <ln numlevel="1" lineno="61" slineno="1-19"/>Subsection <xref depth="4" refnumber="17-72-411(1)(a)">(1)(a)</xref>, maintain a record of the county inmate's refusal in the <ln numlevel="1" lineno="62" slineno="1-20"/>county jail's electronic file management system.</amend></subsection></subsection></subsection></subsection><subsection ssid="35-9-76" dnum="_-o:2-i" numlevel="1" lineno="63" slineno="1-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="82" groupid="55" style="1" owner="jchristopherson" level="1" amendtag="end">If a county inmate accepts assistance in obtaining a current state-issued identification <ln numlevel="1" lineno="64" slineno="1-22"/>card or to renew, or obtain a duplicate of, a state-issued driver license, as described in <ln numlevel="1" lineno="65" slineno="1-23"/>Subsection <xref depth="4" refnumber="17-72-411(1)(b)(iii)(a)">(1)(b)(iii)(A)</xref>, the county jail shall coordinate with the Driver License <ln numlevel="1" lineno="66" slineno="1-24"/>Division to:</amend><subsection ssid="35-9-77" dnum="_-o:a-i" numlevel="1" lineno="67" slineno="1-25" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><subsection ssid="35-9-78" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1012" style="1" owner="i" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="88" groupid="59" style="1" owner="jchristopherson" level="1" amendtag="end">obtain a duplicate of the county inmate's state-issued driver license, as <ln numlevel="1" lineno="68" slineno="1-26"/>described in Section <xref depth="3" refnumber="53-3-215">53-3-215</xref>; or</amend></subsection><subsection ssid="35-9-79" dnum="_-o:ii-i" numlevel="1" lineno="69" slineno="1-27" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1013" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="91" groupid="61" style="1" owner="jchristopherson" level="1" amendtag="end">renew the county inmate's state-issued driver license, if the county inmate meets <ln numlevel="1" lineno="70" slineno="1-28"/>the criteria listed in Section <xref depth="3" refnumber="53-3-214">53-3-214</xref>; or</amend></subsection></subsection><subsection ssid="35-9-80" dnum="_-o:b-i" numlevel="1" lineno="71" slineno="1-29" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1014" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><subsection ssid="35-9-81" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1015" style="1" owner="i" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="97" groupid="65" style="1" owner="jchristopherson" level="1" amendtag="end">extend the county inmate's state-issued regular identification card, as described <ln numlevel="1" lineno="72" slineno="1-30"/>in Section <xref depth="3" refnumber="53-3-807">53-3-807</xref>; or</amend></subsection><subsection ssid="35-9-82" dnum="_-o:ii-i" numlevel="1" lineno="73" slineno="1-31" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="100" groupid="67" style="1" owner="jchristopherson" level="1" amendtag="end">issue the county inmate a temporary regular identification card as described in <ln numlevel="1" lineno="74" slineno="1-32"/>Subsection <xref depth="4" refnumber="53-3-805(11)">53-3-805(11)</xref>, unless the county inmate plans to live outside this state <ln numlevel="1" lineno="75" slineno="1-33"/>immediately upon release.</amend></subsection></subsection></subsection><subsection ssid="35-9-83" dnum="_-o:3-i" numlevel="1" lineno="76" slineno="1-34" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1017" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><subsection ssid="35-9-84" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="161" groupid="111" style="1" owner="jchristopherson" level="1" amendtag="end">For a county inmate receiving assistance under Subsection <xref depth="4" refnumber="17-72-411(2)">(2)</xref>, the county jail <ln numlevel="1" lineno="77" slineno="1-35"/>shall ensure that at least seven days before the county inmate's release, the county <ln numlevel="1" lineno="78" slineno="1-36"/>inmate meets with the Driver License Division to be issued a duplicate driver license, <ln numlevel="1" lineno="79" slineno="1-37"/>a renewed driver license, an extended regular identification card, or a temporary <ln numlevel="1" lineno="80" slineno="1-38"/>regular identification card, as described in Subsection <xref depth="4" refnumber="17-72-411(2)">(2)</xref>.</amend></subsection><subsection ssid="35-9-85" dnum="_-o:b-i" numlevel="1" lineno="81" slineno="1-39" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1019" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="150" groupid="103" style="1" owner="jchristopherson" level="1" amendtag="end">Before the county inmate meets with the Driver License Division, as described in <ln numlevel="1" lineno="82" slineno="1-40"/>Subsection <xref depth="4" refnumber="17-72-411(3)(a)">(3)(a)</xref>, the county jail shall ensure that the county inmate is provided all <ln numlevel="1" lineno="83" slineno="1-41"/>the required documentation and information that the county jail possesses for the <ln numlevel="1" lineno="84" slineno="1-42"/>county inmate to obtain a document listed in Subsection <xref depth="4" refnumber="17-72-411(2)">(2)</xref>, including:</amend><subsection ssid="35-9-86" dnum="_-o:i-i" numlevel="1" lineno="85" slineno="1-43" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1020" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="151" groupid="104" style="1" owner="jchristopherson" level="1" amendtag="end">all personal identification documentation; and</amend></subsection><subsection ssid="35-9-87" dnum="_-o:ii-i" numlevel="1" lineno="86" slineno="1-44" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1021" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="154" groupid="106" style="1" owner="jchristopherson" level="1" amendtag="end">a voucher for payment toward any one of the documents listed in Subsection <xref depth="4" refnumber="17-72-411(2)">(2)</xref>, <ln numlevel="1" lineno="87" slineno="1-45"/>up to the cost of a temporary regular identification card described in Subsection <xref depth="4" refnumber="53-3-805(11)"><ln numlevel="1" lineno="88" slineno="1-46"/>53-3-805(11)</xref>.</amend></subsection></subsection></subsection><subsection ssid="35-9-88" dnum="_-o:4-i" numlevel="1" lineno="89" slineno="1-47" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1022" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="end">The requirements of this section do not apply if the county inmate is not:</amend><subsection ssid="35-9-89" dnum="_-o:a-i" numlevel="1" lineno="90" slineno="1-48" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1023" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="27" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="end">a citizen of the United States; or</amend></subsection><subsection ssid="35-9-90" dnum="_-o:b-i" numlevel="1" lineno="91" slineno="1-49" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1024" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="30" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="end">a lawful resident of the United States who has legal authorization to work in the <ln numlevel="1" lineno="92" slineno="1-50"/>United States.</amend></subsection></subsection></section></bsec><bsec buid="24" num="26B-2-136" type="enact" src="code" uid="C26B-2-S136_2026050620260506" sort="26B02 01360020260506" numlevel="1" lineno="93" slineno="2-1" sn="2"><section numlevel="1" lineno="94" slineno="2-2" number="26B-2-136" type="enact"><secline lineno="93">Section 2, Section <bold>26B-2-136</bold> is enacted to read:</secline><catline lineno="94"><bold>26B-2-136. Drug test result disclosure requirements for substance abuse <ln numlevel="1" lineno="95" slineno="2-3"/>treatment programs.</bold></catline><sectionText lineno="96"><para/><amend anum="0" ea="amend" pairid="10" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="both">A substance abuse treatment program shall provide the results of a drug test for a <ln numlevel="1" lineno="97" slineno="2-5"/>participant in the substance abuse treatment program who is on probation or parole to the <ln numlevel="1" lineno="98" slineno="2-6"/>probation or parole officer assigned to supervise the participant if:</amend></sectionText><subsection ssid="24-4" dnum="_-o:1-i" numlevel="1" lineno="99" slineno="2-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1025" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="20" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="end">the participant's supervising probation or parole officer requests the drug test results; and</amend></subsection><subsection ssid="24-5" dnum="_-o:2-i" numlevel="1" lineno="100" slineno="2-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1026" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="25" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="end">the participant has signed a waiver, in compliance with federal health information <ln numlevel="1" lineno="101" slineno="2-9"/>disclosure laws, that allows the substance abuse treatment program to notify the <ln numlevel="1" lineno="102" slineno="2-10"/>participant's supervising probation or parole officer regarding the participant's drug test <ln numlevel="1" lineno="103" slineno="2-11"/>results.</amend></subsection></section></bsec><bsec buid="29" num="53-3-214" type="amend" src="code" uid="C53-3-S214_2026050620260506" sort="53 03 02140020260506" numlevel="1" lineno="104" slineno="3-1" sn="3"><section number="53-3-214" numlevel="1" lineno="105" slineno="3-2" type="amend"><secline lineno="104">Section 3, Section <bold>53-3-214</bold> is amended to read:</secline><catline lineno="105"><bold>53-3-214. Renewal -- Fees required -- Extension without examination.</bold></catline><subsection ssid="29-null-1" dnum="1-o" numlevel="1" lineno="106" slineno="3-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="29-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The holder of a valid license may renew the holder's license and any endorsement <ln numlevel="1" lineno="107" slineno="3-4"/>to the license by applying:<subsection ssid="29-null-3" dnum="i-o" numlevel="1" lineno="108" slineno="3-5" level="3" tab="1"><display>(i)</display>at any time within six months before the license expires; or</subsection><subsection ssid="29-null-4" dnum="ii-o" numlevel="1" lineno="109" slineno="3-6" level="3" tab="1"><display>(ii)</display>more than six months prior to the expiration date if the applicant furnishes proof <ln numlevel="1" lineno="110" slineno="3-7"/>that the applicant will be absent from the state during the six-month period prior to <ln numlevel="1" lineno="111" slineno="3-8"/>the expiration of the license.</subsection></subsection><subsection ssid="29-null-5" dnum="b-o" numlevel="1" lineno="112" slineno="3-9" level="2"><display>(b)</display>The application for a renewal of, extension of, or any endorsement to a license shall <ln numlevel="1" lineno="113" slineno="3-10"/>be accompanied by a fee under Section <xref depth="3" refnumber="53-3-105" start="0">53-3-105</xref>.</subsection></subsection><subsection ssid="29-null-6" dnum="2-o" numlevel="1" lineno="114" slineno="3-11" level="1" space="false"><display>(2)</display><subsection ssid="29-null-7" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided under Subsections <xref depth="4" refnumber="53-3-214(2)(b)" start="0">(2)(b)</xref> and <xref depth="4" refnumber="53-3-214(3)" start="0">(3)</xref>, upon application for renewal <ln numlevel="1" lineno="115" slineno="3-12"/>of a regular license certificate, provisional license, and any endorsement to a regular <ln numlevel="1" lineno="116" slineno="3-13"/>license certificate, the division shall reexamine each applicant as if for an original <ln numlevel="1" lineno="117" slineno="3-14"/>license and endorsement to the license, if applicable.</subsection><subsection ssid="29-null-8" dnum="b-o" numlevel="1" lineno="118" slineno="3-15" level="2"><display>(b)</display>Except as provided under Subsection <xref depth="4" refnumber="53-3-214(2)(c)" start="0">(2)(c)</xref>, upon application for renewal of a <ln numlevel="1" lineno="119" slineno="3-16"/>limited-term license certificate, limited-term provisional license certificate, and any <ln numlevel="1" lineno="120" slineno="3-17"/>endorsement to a limited-term license certificate, the division shall:<subsection ssid="29-null-9" dnum="i-o" numlevel="1" lineno="121" slineno="3-18" level="3"><display>(i)</display>reexamine each applicant as if for an original limited-term license certificate and <ln numlevel="1" lineno="122" slineno="3-19"/>endorsement to the limited-term license certificate, if applicable; and</subsection><subsection ssid="29-null-10" dnum="ii-o" numlevel="1" lineno="123" slineno="3-20" level="3"><display>(ii)</display>verify through valid documentary evidence that the status by which the individual <ln numlevel="1" lineno="124" slineno="3-21"/>originally qualified for the limited-term license certificate has been extended by <ln numlevel="1" lineno="125" slineno="3-22"/>the United States Citizenship and Immigration Services or other authorized <ln numlevel="1" lineno="126" slineno="3-23"/>agency of the United States Department of Homeland Security.</subsection></subsection><subsection ssid="29-null-11" dnum="c-o" numlevel="1" lineno="127" slineno="3-24" level="2"><display>(c)</display>The division may waive any or all portions of the test designed to demonstrate the <ln numlevel="1" lineno="128" slineno="3-25"/>applicant's ability to exercise ordinary and reasonable control driving a motor vehicle.</subsection></subsection><subsection ssid="29-null-12" dnum="3-o" numlevel="1" lineno="129" slineno="3-26" level="1" space="false"><display>(3)</display><subsection ssid="29-null-13" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="29-null-14" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>Except as provided under Subsections <xref depth="4" refnumber="53-3-214(3)(b)" start="0">(3)(b)</xref> and <xref depth="4" refnumber="53-3-214(3)(c)" start="0">(c)</xref>, the division may renew <ln numlevel="1" lineno="130" slineno="3-27"/>or extend a regular license certificate or any endorsement to the regular license <ln numlevel="1" lineno="131" slineno="3-28"/>certificate for eight years without examination for licensees whose driving records <ln numlevel="1" lineno="132" slineno="3-29"/>for the eight years immediately preceding the determination of eligibility for <ln numlevel="1" lineno="133" slineno="3-30"/>extension show:<subsection ssid="29-null-15" dnum="A-o" numlevel="1" lineno="134" slineno="3-31" level="4" tab="2"><display>(A)</display>no suspensions;</subsection><subsection ssid="29-null-16" dnum="B-o" numlevel="1" lineno="135" slineno="3-32" level="4" tab="2"><display>(B)</display>no revocations;</subsection><subsection ssid="29-null-17" dnum="C-o" numlevel="1" lineno="136" slineno="3-33" level="4" tab="2"><display>(C)</display>no conviction for reckless driving under Section <xref depth="3" refnumber="41-6a-528" start="0">41-6a-528</xref>; and</subsection><subsection ssid="29-null-18" dnum="D-o" numlevel="1" lineno="137" slineno="3-34" level="4" tab="2"><display>(D)</display>no more than six reportable violations in the preceding eight years.</subsection></subsection><subsection ssid="29-null-19" dnum="ii-o" numlevel="1" lineno="138" slineno="3-35" level="3" tab="1"><display>(ii)</display>Except as provided under Subsections <xref depth="4" refnumber="53-3-214(3)(b)" start="0">(3)(b)</xref> and <xref depth="4" refnumber="53-3-214(3)(c)" start="0">(c)</xref>, the division may renew or <ln numlevel="1" lineno="139" slineno="3-36"/>extend a provisional license and any endorsement to a provisional license for eight <ln numlevel="1" lineno="140" slineno="3-37"/>years without examination for licensees whose driving records for the five years <ln numlevel="1" lineno="141" slineno="3-38"/>immediately preceding the determination of eligibility for extension show:<subsection ssid="29-null-20" dnum="A-o" numlevel="1" lineno="142" slineno="3-39" level="4"><display>(A)</display>no suspensions;</subsection><subsection ssid="29-null-21" dnum="B-o" numlevel="1" lineno="143" slineno="3-40" level="4"><display>(B)</display>no revocations;</subsection><subsection ssid="29-null-22" dnum="C-o" numlevel="1" lineno="144" slineno="3-41" level="4"><display>(C)</display>no conviction for reckless driving under Section <xref depth="3" refnumber="41-6a-528" start="0">41-6a-528</xref>; and</subsection><subsection ssid="29-null-23" dnum="D-o" numlevel="1" lineno="145" slineno="3-42" level="4"><display>(D)</display>no more than four reportable violations in the preceding five years.</subsection></subsection><subsection ssid="29-null-24" dnum="iii-o" numlevel="1" lineno="146" slineno="3-43" level="3" tab="1"><display>(iii)</display>Except as provided under Subsections <xref depth="4" refnumber="53-3-214(3)(b)" start="0">(3)(b)</xref> and <xref depth="4" refnumber="53-3-214(3)(c)" start="0">(c)</xref>, the division may renew or <ln numlevel="1" lineno="147" slineno="3-44"/>extend a limited term license and any endorsement to a limited term license for <ln numlevel="1" lineno="148" slineno="3-45"/>five years without examination for licensees whose driving records for the five <ln numlevel="1" lineno="149" slineno="3-46"/>years immediately preceding the determination of eligibility for extension show:<subsection ssid="29-null-25" dnum="A-o" numlevel="1" lineno="150" slineno="3-47" level="4"><display>(A)</display>no suspensions;</subsection><subsection ssid="29-null-26" dnum="B-o" numlevel="1" lineno="151" slineno="3-48" level="4"><display>(B)</display>no revocations;</subsection><subsection ssid="29-null-27" dnum="C-o" numlevel="1" lineno="152" slineno="3-49" level="4"><display>(C)</display>no conviction for reckless driving under Section <xref depth="3" refnumber="41-6a-528" start="0">41-6a-528</xref>; and</subsection><subsection ssid="29-null-28" dnum="D-o" numlevel="1" lineno="153" slineno="3-50" level="4"><display>(D)</display>no more than four reportable violations in the preceding five years.</subsection></subsection></subsection><subsection ssid="29-null-29" dnum="b-o" numlevel="1" lineno="154" slineno="3-51" level="2"><display>(b)</display>Except as provided in Subsection <xref depth="4" refnumber="53-3-214(3)(g)" start="0">(3)(g)</xref>, after the expiration of a regular license <ln numlevel="1" lineno="155" slineno="3-52"/>certificate, a new regular license certificate and any endorsement to a regular license <ln numlevel="1" lineno="156" slineno="3-53"/>certificate may not be issued until the person has again passed the tests under Section <xref depth="3" refnumber="53-3-206" start="0"><ln numlevel="1" lineno="157" slineno="3-54"/>53-3-206</xref> and paid the required fee.</subsection><subsection ssid="29-null-30" dnum="c-o" numlevel="1" lineno="158" slineno="3-55" level="2"><display>(c)</display>After the expiration of a limited-term license certificate, a new limited-term license <ln numlevel="1" lineno="159" slineno="3-56"/>certificate and any endorsement to a limited-term license certificate may not be <ln numlevel="1" lineno="160" slineno="3-57"/>issued until the person has:<subsection ssid="29-null-31" dnum="i-o" numlevel="1" lineno="161" slineno="3-58" level="3"><display>(i)</display>again passed the tests under Section <xref depth="3" refnumber="53-3-206" start="0">53-3-206</xref> and paid the required fee; and</subsection><subsection ssid="29-null-32" dnum="ii-o" numlevel="1" lineno="162" slineno="3-59" level="3"><display>(ii)</display>presented documentary evidence that the status by which the individual originally <ln numlevel="1" lineno="163" slineno="3-60"/>qualified for the limited-term license certificate has been extended by the United <ln numlevel="1" lineno="164" slineno="3-61"/>States Citizenship and Immigration Services or other authorized agency of the <ln numlevel="1" lineno="165" slineno="3-62"/>United States Department of Homeland Security.</subsection></subsection><subsection ssid="29-null-33" dnum="d-o" numlevel="1" lineno="166" slineno="3-63" level="2"><display>(d)</display>A person 65 years <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="20" groupid="18" style="2" owner="jchristopherson" level="1" deltag="both">of age</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="19" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">old</amend> or older shall take and pass the eye examination <ln numlevel="1" lineno="167" slineno="3-64"/>specified in Section <xref depth="3" refnumber="53-3-206" start="0">53-3-206</xref>.</subsection><subsection ssid="29-null-34" dnum="e-o" numlevel="1" lineno="168" slineno="3-65" level="2"><display>(e)</display>An extension may not be granted to any person:<subsection ssid="29-null-35" dnum="i-o" numlevel="1" lineno="169" slineno="3-66" level="3"><display>(i)</display>who is identified by the division as having a medical impairment that may <ln numlevel="1" lineno="170" slineno="3-67"/>represent a hazard to public safety;</subsection><subsection ssid="29-null-36" dnum="ii-o" numlevel="1" lineno="171" slineno="3-68" level="3"><display>(ii)</display>holding a CDL or limited-term CDL issued under <xref depth="2" refnumber="53-3-4" start="2">Part 4, Uniform Commercial <ln numlevel="1" lineno="172" slineno="3-69"/>Driver License Act</xref>;</subsection><subsection ssid="29-null-37" dnum="iii-o" numlevel="1" lineno="173" slineno="3-70" level="3"><display>(iii)</display>who is holding a limited-term license certificate; or</subsection><subsection ssid="29-null-38" dnum="iv-o" numlevel="1" lineno="174" slineno="3-71" level="3"><display>(iv)</display>who is holding a driving privilege card issued in accordance with Section <xref depth="3" refnumber="53-3-207" start="0"><ln numlevel="1" lineno="175" slineno="3-72"/>53-3-207</xref>.</subsection></subsection><subsection ssid="29-null-39" dnum="f-o" numlevel="1" lineno="176" slineno="3-73" level="2"><display>(f)</display>The division shall allow extensions:<subsection ssid="29-null-40" dnum="i-o" numlevel="1" lineno="177" slineno="3-74" level="3"><display>(i)</display>by mail, electronic means, or other means as determined by the division at the <ln numlevel="1" lineno="178" slineno="3-75"/>appropriate extension fee rate under Section <xref depth="3" refnumber="53-3-105" start="0">53-3-105</xref>;</subsection><subsection ssid="29-null-41" dnum="ii-o" numlevel="1" lineno="179" slineno="3-76" level="3"><display>(ii)</display>only if the applicant qualifies under this section; and</subsection><subsection ssid="29-null-42" dnum="iii-o" numlevel="1" lineno="180" slineno="3-77" level="3"><display>(iii)</display>for only one extension.</subsection></subsection><subsection ssid="29-null-43" dnum="g-o" numlevel="1" lineno="181" slineno="3-78" level="2"><display>(g)</display>The division may waive any or all portions of the test designed to demonstrate the <ln numlevel="1" lineno="182" slineno="3-79"/>applicant's ability to exercise ordinary and reasonable control driving a motor vehicle.</subsection></subsection><subsection ssid="29-null-44" dnum="4-o" numlevel="1" lineno="183" slineno="3-80" level="1"><display>(4)</display>In accordance with this section, the division shall coordinate with<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="7" groupid="7" style="2" owner="jchristopherson" level="1" deltag="both"> </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="5" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">:</amend><subsection ssid="29-46" dnum="_-o:a-i" numlevel="1" lineno="184" slineno="3-81" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1071" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>the Department of Corrections in providing an inmate with access to a driver license <ln numlevel="1" lineno="185" slineno="3-82"/>certificate as described in Section <xref depth="3" refnumber="64-13-10.6" start="0">64-13-10.6</xref><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="15" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="29-47" dnum="_-o:b-i" numlevel="1" lineno="186" slineno="3-83" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1072" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="end">a county jail in providing a county inmate with access to a driver license certificate <ln numlevel="1" lineno="187" slineno="3-84"/>as described in Section <xref depth="3" refnumber="17-72-411">17-72-411</xref>.</amend></subsection></subsection></section></bsec><bsec buid="27" num="53-3-805" type="amend" src="code" uid="C53-3-S805_2026050620260506" sort="53 03 08050020260506" numlevel="1" lineno="188" slineno="4-1" sn="4"><section number="53-3-805" numlevel="1" lineno="189" slineno="4-2" type="amend"><secline lineno="188">Section 4, Section <bold>53-3-805</bold> is amended to read:</secline><catline lineno="189"><bold>53-3-805. Identification card -- Contents -- Specifications.</bold></catline><subsection ssid="27-null-1" dnum="1-o" numlevel="1" lineno="190" slineno="4-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="27-null-2" dnum="a-o" numlevel="1" lineno="191" slineno="4-4" level="2"><display>(a)</display>"Authorized guardian" means the same as that term is defined in Section <xref depth="3" refnumber="53-3-207" start="0">53-3-207</xref>.</subsection><subsection ssid="27-null-3" dnum="b-o" numlevel="1" lineno="192" slineno="4-5" level="2"><display>(b)</display>"Health care professional" means the same as that term is defined in Section <xref depth="3" refnumber="53-3-207" start="0">53-3-207</xref>.</subsection><subsection ssid="27-null-4" dnum="c-o" numlevel="1" lineno="193" slineno="4-6" level="2"><display>(c)</display>"Invisible condition" means the same as that term is defined in Section <xref depth="3" refnumber="53-3-207" start="0">53-3-207</xref>.</subsection><subsection ssid="27-null-5" dnum="d-o" numlevel="1" lineno="194" slineno="4-7" level="2"><display>(d)</display>"Invisible condition identification symbol" means the same as that term is defined in <ln numlevel="1" lineno="195" slineno="4-8"/>Section <xref depth="3" refnumber="53-3-207" start="0">53-3-207</xref>.</subsection></subsection><subsection ssid="27-null-6" dnum="2-o" numlevel="1" lineno="196" slineno="4-9" level="1" space="false"><display>(2)</display><subsection ssid="27-null-7" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The division shall issue an identification card that bears:<subsection ssid="27-null-8" dnum="i-o" numlevel="1" lineno="197" slineno="4-10" level="3" tab="1"><display>(i)</display>the distinguishing number assigned to the individual by the division;</subsection><subsection ssid="27-null-9" dnum="ii-o" numlevel="1" lineno="198" slineno="4-11" level="3" tab="1"><display>(ii)</display>the name, birth date, and Utah residence address of the individual;</subsection><subsection ssid="27-null-10" dnum="iii-o" numlevel="1" lineno="199" slineno="4-12" level="3" tab="1"><display>(iii)</display>a brief description of the individual for the purpose of identification;</subsection><subsection ssid="27-null-11" dnum="iv-o" numlevel="1" lineno="200" slineno="4-13" level="3" tab="1"><display>(iv)</display>a photograph of the individual;</subsection><subsection ssid="27-null-12" dnum="v-o" numlevel="1" lineno="201" slineno="4-14" level="3" tab="1"><display>(v)</display>a photograph or other facsimile of the individual's signature;</subsection><subsection ssid="27-null-13" dnum="vi-o" numlevel="1" lineno="202" slineno="4-15" level="3" tab="1"><display>(vi)</display>an indication whether the individual intends to make an anatomical gift under <xref depth="2" refnumber="26B-8-3" start="0"><ln numlevel="1" lineno="203" slineno="4-16"/>Title 26B, Chapter 8, Part 3, Revised Uniform Anatomical Gift Act</xref>; and</subsection><subsection ssid="27-null-14" dnum="vii-o" numlevel="1" lineno="204" slineno="4-17" level="3" tab="1"><display>(vii)</display>if the individual states that the individual is a veteran of the United States <ln numlevel="1" lineno="205" slineno="4-18"/>military on the application for an identification card in accordance with Section <xref depth="3" refnumber="53-3-804" start="0"><ln numlevel="1" lineno="206" slineno="4-19"/>53-3-804</xref> and provides verification that the individual received an honorable or <ln numlevel="1" lineno="207" slineno="4-20"/>general discharge from the United States Armed Forces, an indication that the <ln numlevel="1" lineno="208" slineno="4-21"/>individual is a United States military veteran for a regular identification card or a <ln numlevel="1" lineno="209" slineno="4-22"/>limited-term identification card issued on or after July 1, 2011.</subsection></subsection><subsection ssid="27-null-15" dnum="b-o" numlevel="1" lineno="210" slineno="4-23" level="2"><display>(b)</display>An identification card issued by the division may not bear the individual's social <ln numlevel="1" lineno="211" slineno="4-24"/>security number or place of birth.</subsection></subsection><subsection ssid="27-null-16" dnum="3-o" numlevel="1" lineno="212" slineno="4-25" level="1" space="false"><display>(3)</display><subsection ssid="27-null-17" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The card shall be of an impervious material, resistant to wear, damage, and <ln numlevel="1" lineno="213" slineno="4-26"/>alteration.</subsection><subsection ssid="27-null-18" dnum="b-o" numlevel="1" lineno="214" slineno="4-27" level="2"><display>(b)</display>Except as provided under Section <xref depth="3" refnumber="53-3-806" start="0">53-3-806</xref>, the size, form, and color of the card is <ln numlevel="1" lineno="215" slineno="4-28"/>prescribed by the commissioner.</subsection></subsection><subsection ssid="27-null-19" dnum="4-o" numlevel="1" lineno="216" slineno="4-29" level="1"><display>(4)</display>At the applicant's request, the card may include a statement that the applicant has a <ln numlevel="1" lineno="217" slineno="4-30"/>special medical problem or allergies to certain drugs, for the purpose of medical <ln numlevel="1" lineno="218" slineno="4-31"/>treatment.</subsection><subsection ssid="27-null-20" dnum="5-o" numlevel="1" lineno="219" slineno="4-32" level="1" space="false"><display>(5)</display><subsection ssid="27-null-21" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The division shall include or affix an invisible condition identification symbol on <ln numlevel="1" lineno="220" slineno="4-33"/>an individual's identification card if the individual or the individual's authorized <ln numlevel="1" lineno="221" slineno="4-34"/>guardian, on a form prescribed by the department:<subsection ssid="27-null-22" dnum="i-o" numlevel="1" lineno="222" slineno="4-35" level="3" tab="1"><display>(i)</display>requests the division to include the invisible condition identification symbol;</subsection><subsection ssid="27-null-23" dnum="ii-o" numlevel="1" lineno="223" slineno="4-36" level="3" tab="1"><display>(ii)</display>provides written verification from a health care professional that the individual is <ln numlevel="1" lineno="224" slineno="4-37"/>an individual with an invisible condition; and</subsection><subsection ssid="27-null-24" dnum="iii-o" numlevel="1" lineno="225" slineno="4-38" level="3" tab="1"><display>(iii)</display>submits a signed waiver of liability for the release of any medical information to:<subsection ssid="27-null-25" dnum="A-o" numlevel="1" lineno="226" slineno="4-39" level="4"><display>(A)</display>the department;</subsection><subsection ssid="27-null-26" dnum="B-o" numlevel="1" lineno="227" slineno="4-40" level="4"><display>(B)</display>any person who has access to the individual's medical information as recorded <ln numlevel="1" lineno="228" slineno="4-41"/>on the individual's driving record or the Utah Criminal Justice Information <ln numlevel="1" lineno="229" slineno="4-42"/>System under this chapter; </subsection><subsection ssid="27-null-27" dnum="C-o" numlevel="1" lineno="230" slineno="4-43" level="4"><display>(C)</display>any other person who may view or receive notice of the individual's medical <ln numlevel="1" lineno="231" slineno="4-44"/>information by seeing the individual's identification card or the individual's <ln numlevel="1" lineno="232" slineno="4-45"/>information in the Utah Criminal Justice Information System;</subsection><subsection ssid="27-null-28" dnum="D-o" numlevel="1" lineno="233" slineno="4-46" level="4"><display>(D)</display>a local law enforcement agency that receives a copy of the form described in <ln numlevel="1" lineno="234" slineno="4-47"/>this Subsection <xref depth="4" refnumber="53-3-805(5)(a)" start="0">(5)(a)</xref> and enters the contents of the form into the local law <ln numlevel="1" lineno="235" slineno="4-48"/>enforcement agency's record management system or computer-aided dispatch <ln numlevel="1" lineno="236" slineno="4-49"/>system; and</subsection><subsection ssid="27-null-29" dnum="E-o" numlevel="1" lineno="237" slineno="4-50" level="4"><display>(E)</display>a dispatcher who accesses the information regarding the individual's invisible <ln numlevel="1" lineno="238" slineno="4-51"/>condition through the use of a local law enforcement agency's record <ln numlevel="1" lineno="239" slineno="4-52"/>management system or computer-aided dispatch system.</subsection></subsection></subsection><subsection ssid="27-null-30" dnum="b-o" numlevel="1" lineno="240" slineno="4-53" level="2"><display>(b)</display>As part of the form described in Subsection <xref depth="4" refnumber="53-3-805(5)(a)" start="0">(5)(a)</xref>, the department shall advise the <ln numlevel="1" lineno="241" slineno="4-54"/>individual or the individual's authorized guardian that by submitting the request and <ln numlevel="1" lineno="242" slineno="4-55"/>signed waiver, the individual or the individual's authorized guardian consents to the <ln numlevel="1" lineno="243" slineno="4-56"/>release of the individual's medical information to any person described in Subsection <xref depth="4" refnumber="53-3-805(5)(a)(iii)" start="0"><ln numlevel="1" lineno="244" slineno="4-57"/>(5)(a)(iii)</xref>, even if the person is otherwise ineligible to access the individual's medical <ln numlevel="1" lineno="245" slineno="4-58"/>information under state or federal law.</subsection><subsection ssid="27-null-31" dnum="c-o" numlevel="1" lineno="246" slineno="4-59" level="2"><display>(c)</display>The division may not:<subsection ssid="27-null-32" dnum="i-o" numlevel="1" lineno="247" slineno="4-60" level="3"><display>(i)</display>charge a fee to include the invisible condition identification symbol on the <ln numlevel="1" lineno="248" slineno="4-61"/>individual's identification card; or</subsection><subsection ssid="27-null-33" dnum="ii-o" numlevel="1" lineno="249" slineno="4-62" level="3"><display>(ii)</display>after including the invisible condition identification symbol on the individual's <ln numlevel="1" lineno="250" slineno="4-63"/>previously issued identification card, require the individual to provide subsequent <ln numlevel="1" lineno="251" slineno="4-64"/>written verification described in Subsection <xref depth="4" refnumber="53-3-805(5)(a)(ii)" start="0">(5)(a)(ii)</xref> to include the invisible <ln numlevel="1" lineno="252" slineno="4-65"/>condition identification symbol on the individual's extended identification card.</subsection></subsection><subsection ssid="27-null-34" dnum="d-o" numlevel="1" lineno="253" slineno="4-66" level="2"><display>(d)</display>The division shall confirm with the Division of Professional Licensing that the health <ln numlevel="1" lineno="254" slineno="4-67"/>care professional described in Subsection <xref depth="4" refnumber="53-3-805(5)(a)(ii)" start="0">(5)(a)(ii)</xref> holds a current state license.</subsection><subsection ssid="27-null-35" dnum="e-o" numlevel="1" lineno="255" slineno="4-68" level="2"><display>(e)</display>The inclusion of an invisible condition identification symbol on an individual's <ln numlevel="1" lineno="256" slineno="4-69"/>identification card in accordance with Subsection <xref depth="4" refnumber="53-3-805(5)(a)" start="0">(5)(a)</xref> does not confer any legal <ln numlevel="1" lineno="257" slineno="4-70"/>rights or privileges on the individual, including parking privileges for individuals <ln numlevel="1" lineno="258" slineno="4-71"/>with disabilities under Section <xref depth="3" refnumber="41-1a-414" start="0">41-1a-414</xref>.</subsection><subsection ssid="27-null-36" dnum="f-o" numlevel="1" lineno="259" slineno="4-72" level="2"><display>(f)</display>For each individual issued an identification card under this section that includes an <ln numlevel="1" lineno="260" slineno="4-73"/>invisible condition identification symbol, the division shall include in the division's <ln numlevel="1" lineno="261" slineno="4-74"/>database a brief description of the nature of the individual's invisible condition in the <ln numlevel="1" lineno="262" slineno="4-75"/>individual's record and provide the brief description to the Utah Criminal Justice <ln numlevel="1" lineno="263" slineno="4-76"/>Information System.</subsection><subsection ssid="27-null-37" dnum="g-o" numlevel="1" lineno="264" slineno="4-77" level="2"><display>(g)</display>Except as provided in this section, the division may not release the information <ln numlevel="1" lineno="265" slineno="4-78"/>described in Subsection <xref depth="4" refnumber="53-3-805(5)(f)" start="0">(5)(f)</xref>.</subsection><subsection ssid="27-null-38" dnum="h-o" numlevel="1" lineno="266" slineno="4-79" level="2"><display>(h)</display>Within 30 days after the day on which the division receives an individual's or the <ln numlevel="1" lineno="267" slineno="4-80"/>individual's authorized guardian's written request, the division shall:<subsection ssid="27-null-39" dnum="i-o" numlevel="1" lineno="268" slineno="4-81" level="3"><display>(i)</display>remove from the individual's record in the division's database the invisible <ln numlevel="1" lineno="269" slineno="4-82"/>condition identification symbol and the brief description described in Subsection <xref depth="4" refnumber="53-3-805(5)(f)" start="0"><ln numlevel="1" lineno="270" slineno="4-83"/>(5)(f)</xref>; and</subsection><subsection ssid="27-null-40" dnum="ii-o" numlevel="1" lineno="271" slineno="4-84" level="3"><display>(ii)</display>provide the individual's updated record to the Utah Criminal Justice Information <ln numlevel="1" lineno="272" slineno="4-85"/>System.</subsection></subsection></subsection><subsection ssid="27-null-41" dnum="6-o" numlevel="1" lineno="273" slineno="4-86" level="1" space="false"><display>(6)</display><subsection ssid="27-null-42" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If the division receives a notification from a court as provided in Section <xref depth="3" refnumber="41-6a-505"><ln numlevel="1" lineno="274" slineno="4-87"/>41-6a-505</xref>, <xref depth="3" refnumber="41-6a-509">41-6a-509</xref>, <xref depth="3" refnumber="76-5-102.1">76-5-102.1</xref>, or <xref depth="3" refnumber="76-5-207">76-5-207</xref>, that an individual is an interdicted <ln numlevel="1" lineno="275" slineno="4-88"/>person, the division:<subsection ssid="27-null-43" dnum="i-o" numlevel="1" lineno="276" slineno="4-89" level="3" tab="1"><display>(i)</display>may accept an application from the individual for an identification card that <ln numlevel="1" lineno="277" slineno="4-90"/>includes an interdicted person identifier; and</subsection><subsection ssid="27-null-44" dnum="ii-o" numlevel="1" lineno="278" slineno="4-91" level="3" tab="1"><display>(ii)</display>if the individual submits an application and qualifies for an identification card, <ln numlevel="1" lineno="279" slineno="4-92"/>may provide an identification card with the interdicted person identifier.</subsection></subsection><subsection ssid="27-null-45" dnum="b-o" numlevel="1" lineno="280" slineno="4-93" level="2" space="false"><display>(b)</display><subsection ssid="27-null-46" dnum="i-o" level="3" placement="sameline"><display>(i)</display>An individual may voluntarily apply for an identification card that includes an <ln numlevel="1" lineno="281" slineno="4-94"/>interdicted person identifier.</subsection><subsection ssid="27-null-47" dnum="ii-o" numlevel="1" lineno="282" slineno="4-95" level="3"><display>(ii)</display>An individual that voluntarily applies for an identification card with an <ln numlevel="1" lineno="283" slineno="4-96"/>interdicted person identifier may not apply for another identification card without <ln numlevel="1" lineno="284" slineno="4-97"/>the interdicted person identifier for at least 30 days after the application for the <ln numlevel="1" lineno="285" slineno="4-98"/>identification card with the interdicted person identifier.</subsection></subsection><subsection ssid="27-null-48" dnum="c-o" numlevel="1" lineno="286" slineno="4-99" level="2"><display>(c)</display>The division may not provide to an individual an identification card without the <ln numlevel="1" lineno="287" slineno="4-100"/>interdicted person identifier during the time period the court has designated the <ln numlevel="1" lineno="288" slineno="4-101"/>person as an interdicted person.</subsection><subsection ssid="27-null-49" dnum="d-o" numlevel="1" lineno="289" slineno="4-102" level="2"><display>(d)</display>The division may charge an administrative fee as described in Subsection <xref depth="4" refnumber="53-3-105(40)"><ln numlevel="1" lineno="290" slineno="4-103"/>53-3-105(40)</xref> to an individual to process and provide an identification card with an <ln numlevel="1" lineno="291" slineno="4-104"/>interdicted person identifier.</subsection><subsection ssid="27-null-50" dnum="e-o" numlevel="1" lineno="292" slineno="4-105" level="2"><display>(e)</display>An individual who is designated as an interdicted person by a court is subject to the <ln numlevel="1" lineno="293" slineno="4-106"/>identification card fee and other fees necessary to administer the identification card <ln numlevel="1" lineno="294" slineno="4-107"/>with an interdicted person identifier.</subsection></subsection><subsection ssid="27-null-51" dnum="7-o" numlevel="1" lineno="295" slineno="4-108" level="1"><display>(7)</display>As provided in Section <xref depth="3" refnumber="63G-2-302" start="0">63G-2-302</xref>, the information described in Subsection <xref depth="4" refnumber="53-3-805(5)(a)" start="0">(5)(a)</xref> is a <ln numlevel="1" lineno="296" slineno="4-109"/>private record for purposes of <xref depth="1" refnumber="63G-2" start="0">Title 63G, Chapter 2, Government Records Access and <ln numlevel="1" lineno="297" slineno="4-110"/>Management Act</xref>.</subsection><subsection ssid="27-null-52" dnum="8-o" numlevel="1" lineno="298" slineno="4-111" level="1" space="false"><display>(8)</display><subsection ssid="27-null-53" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The indication of intent under Subsection <xref depth="4" refnumber="53-3-804(2)(j)" start="0">53-3-804(2)(j)</xref> shall be authenticated by <ln numlevel="1" lineno="299" slineno="4-112"/>the applicant in accordance with division rule.</subsection><subsection ssid="27-null-54" dnum="b-o" numlevel="1" lineno="300" slineno="4-113" level="2" space="false"><display>(b)</display><subsection ssid="27-null-55" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Notwithstanding <xref depth="1" refnumber="63G-2" start="0">Title 63G, Chapter 2, Government Records Access and <ln numlevel="1" lineno="301" slineno="4-114"/>Management Act</xref>, the division may, upon request, release to an organ procurement <ln numlevel="1" lineno="302" slineno="4-115"/>organization, as defined in Section <xref depth="3" refnumber="26B-8-301" start="0">26B-8-301</xref>, the names and addresses of all <ln numlevel="1" lineno="303" slineno="4-116"/>individuals who under Subsection <xref depth="4" refnumber="53-3-804(2)(j)" start="0">53-3-804(2)(j)</xref> indicate that they intend to make <ln numlevel="1" lineno="304" slineno="4-117"/>an anatomical gift.</subsection><subsection ssid="27-null-56" dnum="ii-o" numlevel="1" lineno="305" slineno="4-118" level="3"><display>(ii)</display>An organ procurement organization may use released information only to:<subsection ssid="27-null-57" dnum="A-o" numlevel="1" lineno="306" slineno="4-119" level="4"><display>(A)</display>obtain additional information for an anatomical gift registry; and</subsection><subsection ssid="27-null-58" dnum="B-o" numlevel="1" lineno="307" slineno="4-120" level="4"><display>(B)</display>inform applicants of anatomical gift options, procedures, and benefits.</subsection></subsection></subsection></subsection><subsection ssid="27-null-59" dnum="9-o" numlevel="1" lineno="308" slineno="4-121" level="1"><display>(9)</display>Notwithstanding <xref depth="1" refnumber="63G-2" start="0">Title 63G, Chapter 2, Government Records Access and Management <ln numlevel="1" lineno="309" slineno="4-122"/>Act</xref>, the division may release to the Department of Veterans and Military Affairs the <ln numlevel="1" lineno="310" slineno="4-123"/>names and addresses of all individuals who indicate their status as a veteran under <ln numlevel="1" lineno="311" slineno="4-124"/>Subsection <xref depth="4" refnumber="53-3-804(2)(l)" start="0">53-3-804(2)(l)</xref>.</subsection><subsection ssid="27-null-60" dnum="10-o" numlevel="1" lineno="312" slineno="4-125" level="1"><display>(10)</display>The division and the division's employees are not liable, as a result of false or <ln numlevel="1" lineno="313" slineno="4-126"/>inaccurate information provided under Subsection <xref depth="4" refnumber="53-3-804(2)(j)" start="0">53-3-804(2)(j)</xref> or <xref depth="4" refnumber="53-3-804(2)(l)" start="0">(l)</xref>, for direct or <ln numlevel="1" lineno="314" slineno="4-127"/>indirect:<subsection ssid="27-null-61" dnum="a-o" numlevel="1" lineno="315" slineno="4-128" level="2"><display>(a)</display>loss;</subsection><subsection ssid="27-null-62" dnum="b-o" numlevel="1" lineno="316" slineno="4-129" level="2"><display>(b)</display>detriment; or</subsection><subsection ssid="27-null-63" dnum="c-o" numlevel="1" lineno="317" slineno="4-130" level="2"><display>(c)</display>injury.</subsection></subsection><subsection ssid="27-null-64" dnum="11-o" numlevel="1" lineno="318" slineno="4-131" level="1" space="false"><display>(11)</display><subsection ssid="27-null-65" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The division may issue a temporary regular identification card to an individual <ln numlevel="1" lineno="319" slineno="4-132"/>while the individual obtains the required documentation to establish verification of <ln numlevel="1" lineno="320" slineno="4-133"/>the information described in Subsections <xref depth="4" refnumber="53-3-804(2)(a)" start="0">53-3-804(2)(a)</xref>, <xref depth="4" refnumber="53-3-804(2)(b)" start="0">(b)</xref>, <xref depth="4" refnumber="53-3-804(2)(c)" start="0">(c)</xref>, <xref depth="4" refnumber="53-3-804(2)(d)" start="0">(d)</xref>, and <xref depth="4" refnumber="53-3-804(2)(i)(i)" start="0">(i)(i)</xref>.</subsection><subsection ssid="27-null-66" dnum="b-o" numlevel="1" lineno="321" slineno="4-134" level="2"><display>(b)</display>A temporary regular identification card issued under this Subsection <xref depth="4" refnumber="53-3-805(11)">(11)</xref> shall be <ln numlevel="1" lineno="322" slineno="4-135"/>recognized and grant the individual the same privileges as a regular identification <ln numlevel="1" lineno="323" slineno="4-136"/>card.</subsection><subsection ssid="27-null-67" dnum="c-o" numlevel="1" lineno="324" slineno="4-137" level="2"><display>(c)</display>A temporary regular identification card issued under this Subsection <xref depth="4" refnumber="53-3-805(11)">(11)</xref> is invalid:<subsection ssid="27-null-68" dnum="i-o" numlevel="1" lineno="325" slineno="4-138" level="3"><display>(i)</display>when the individual's regular identification card has been issued;</subsection><subsection ssid="27-null-69" dnum="ii-o" numlevel="1" lineno="326" slineno="4-139" level="3"><display>(ii)</display>when, for good cause, an applicant's application for a regular identification card <ln numlevel="1" lineno="327" slineno="4-140"/>has been refused; or</subsection><subsection ssid="27-null-70" dnum="iii-o" numlevel="1" lineno="328" slineno="4-141" level="3"><display>(iii)</display>upon expiration of the temporary regular identification card.</subsection></subsection><subsection ssid="27-null-71" dnum="d-o" numlevel="1" lineno="329" slineno="4-142" level="2"><display>(d)</display>The division shall coordinate with<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="7" groupid="7" style="2" owner="jchristopherson" level="1" deltag="both"> </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="5" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">:</amend><subsection ssid="27-73" dnum="_-o:i-i" numlevel="1" lineno="330" slineno="4-143" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1144" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>the Department of Corrections in providing an inmate with a temporary regular <ln numlevel="1" lineno="331" slineno="4-144"/>identification card as described in Section <xref depth="3" refnumber="64-13-10.6" start="0">64-13-10.6</xref><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="15" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="27-74" dnum="_-o:ii-i" numlevel="1" lineno="332" slineno="4-145" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1145" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="14" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="end">a county jail in providing a county inmate with a temporary regular identification <ln numlevel="1" lineno="333" slineno="4-146"/>card as described in Section <xref depth="3" refnumber="17-72-411">17-72-411</xref>.</amend></subsection></subsection></subsection></section></bsec><bsec buid="18" num="64-13-6" type="amend" src="code" uid="C64-13-S6_2026050620260506" sort="64 13 00060020260506" numlevel="1" lineno="334" slineno="5-1" sn="5"><section number="64-13-6" numlevel="1" lineno="335" slineno="5-2" type="amend"><secline lineno="334">Section 5, Section <bold>64-13-6</bold> is amended to read:</secline><catline lineno="335"><bold>64-13-6. Department duties.</bold></catline><subsection ssid="18-null-1" dnum="1-o" numlevel="1" lineno="336" slineno="5-3" level="1" placement="noreturn"><display>(1)</display>The department shall:<subsection ssid="18-null-2" dnum="a-o" numlevel="1" lineno="337" slineno="5-4" level="2"><display>(a)</display>protect the public through institutional care and confinement, and supervision in the <ln numlevel="1" lineno="338" slineno="5-5"/>community of offenders where appropriate;</subsection><subsection ssid="18-null-3" dnum="b-o" numlevel="1" lineno="339" slineno="5-6" level="2"><display>(b)</display>implement court-ordered punishment of offenders;</subsection><subsection ssid="18-null-4" dnum="c-o" numlevel="1" lineno="340" slineno="5-7" level="2"><display>(c)</display>provide evidence-based and evidence-informed program opportunities for offenders <ln numlevel="1" lineno="341" slineno="5-8"/>designed to reduce offenders' criminogenic and recidivism risks, including <ln numlevel="1" lineno="342" slineno="5-9"/>behavioral, cognitive, educational, and career-readiness program opportunities;</subsection><subsection ssid="18-null-5" dnum="d-o" numlevel="1" lineno="343" slineno="5-10" level="2"><display>(d)</display>ensure that offender participation in all program opportunities described in <ln numlevel="1" lineno="344" slineno="5-11"/>Subsection <xref depth="4" refnumber="64-13-6(1)(c)">(1)(c)</xref> is voluntary;</subsection><subsection ssid="18-null-6" dnum="e-o" numlevel="1" lineno="345" slineno="5-12" level="2"><display>(e)</display>where appropriate, utilize offender volunteers as mentors in the program <ln numlevel="1" lineno="346" slineno="5-13"/>opportunities described in Subsection <xref depth="4" refnumber="64-13-6(1)(c)">(1)(c)</xref>;</subsection><subsection ssid="18-null-7" dnum="f-o" numlevel="1" lineno="347" slineno="5-14" level="2"><display>(f)</display>provide treatment for sex offenders who are found to be treatable based upon criteria <ln numlevel="1" lineno="348" slineno="5-15"/>developed by the department;</subsection><subsection ssid="18-null-8" dnum="g-o" numlevel="1" lineno="349" slineno="5-16" level="2"><display>(g)</display>provide the results of ongoing clinical assessment of sex offenders and objective <ln numlevel="1" lineno="350" slineno="5-17"/>diagnostic testing to sentencing and release authorities;</subsection><subsection ssid="18-null-9" dnum="h-o" numlevel="1" lineno="351" slineno="5-18" level="2"><display>(h)</display>manage programs that take into account the needs and interests of victims, where <ln numlevel="1" lineno="352" slineno="5-19"/>reasonable;</subsection><subsection ssid="18-null-10" dnum="i-o" numlevel="1" lineno="353" slineno="5-20" level="2"><display>(i)</display>through the Division of Adult Probation and Parole created in Section <xref depth="3" refnumber="64-14-202">64-14-202</xref>, <ln numlevel="1" lineno="354" slineno="5-21"/>supervise probationers and parolees as directed by statute and implemented by the <ln numlevel="1" lineno="355" slineno="5-22"/>courts and the Board of Pardons and Parole;</subsection><subsection ssid="18-null-11" dnum="j-o" numlevel="1" lineno="356" slineno="5-23" level="2"><display>(j)</display>subject to Subsection <xref depth="4" refnumber="64-13-6(2)">(2)</xref>, investigate criminal conduct involving offenders <ln numlevel="1" lineno="357" slineno="5-24"/>incarcerated in a state correctional facility;</subsection><subsection ssid="18-null-12" dnum="k-o" numlevel="1" lineno="358" slineno="5-25" level="2"><display>(k)</display>cooperate and exchange information with other state, local, and federal law <ln numlevel="1" lineno="359" slineno="5-26"/>enforcement agencies to achieve greater success in prevention and detection of crime <ln numlevel="1" lineno="360" slineno="5-27"/>and apprehension of criminals;</subsection><subsection ssid="18-null-13" dnum="l-o" numlevel="1" lineno="361" slineno="5-28" level="2"><display>(l)</display>implement the provisions of Title <xref depth="1" refnumber="77-28c">77, Chapter 28c</xref>, Interstate Compact for Adult <ln numlevel="1" lineno="362" slineno="5-29"/>Offender Supervision;</subsection><subsection ssid="18-null-14" dnum="m-o" numlevel="1" lineno="363" slineno="5-30" level="2"><display>(m)</display>establish a case action plan based on appropriate validated risk, needs, and <ln numlevel="1" lineno="364" slineno="5-31"/>responsivity assessments for each offender as follows:<subsection ssid="18-null-15" dnum="i-o" numlevel="1" lineno="365" slineno="5-32" level="3" space="false"><display>(i)</display><subsection ssid="18-null-16" dnum="A-o" level="4" placement="sameline"><display>(A)</display>if an offender is to be supervised in the community, the department shall <ln numlevel="1" lineno="366" slineno="5-33"/>establish a case action plan for the offender no later than 60 days after the day <ln numlevel="1" lineno="367" slineno="5-34"/>on which the department's community supervision of the offender begins; and</subsection><subsection ssid="18-null-17" dnum="B-o" numlevel="1" lineno="368" slineno="5-35" level="4"><display>(B)</display>if the offender is committed to the custody of the department, the department <ln numlevel="1" lineno="369" slineno="5-36"/>shall establish a case action plan for the offender no later than 90 days after the <ln numlevel="1" lineno="370" slineno="5-37"/>day on which the offender is committed to the custody of the department;</subsection></subsection><subsection ssid="18-null-18" dnum="ii-o" numlevel="1" lineno="371" slineno="5-38" level="3"><display>(ii)</display>each case action plan shall:<subsection ssid="18-null-19" dnum="A-o" numlevel="1" lineno="372" slineno="5-39" level="4"><display>(A)</display>integrate an individualized, evidence-based, and evidence-informed treatment <ln numlevel="1" lineno="373" slineno="5-40"/>and program plan with clearly defined completion requirements; and</subsection><subsection ssid="18-null-20" dnum="B-o" numlevel="1" lineno="374" slineno="5-41" level="4"><display>(B)</display>require that a case manager will:<subsection ssid="18-null-21" dnum="I-o" numlevel="1" lineno="375" slineno="5-42" level="5"><display>(I)</display>ensure that an assessment of the education level, occupational interests, and <ln numlevel="1" lineno="376" slineno="5-43"/>aptitudes of the inmate has been completed;</subsection><subsection ssid="18-null-22" dnum="II-o" numlevel="1" lineno="377" slineno="5-44" level="5"><display>(II)</display>refer the inmate to a higher education student advisor at an institution <ln numlevel="1" lineno="378" slineno="5-45"/>offering programs consistent with the inmate's interests and aptitudes for <ln numlevel="1" lineno="379" slineno="5-46"/>advisement on educational preferences and plans;</subsection><subsection ssid="18-null-23" dnum="III-o" numlevel="1" lineno="380" slineno="5-47" level="5"><display>(III)</display>incorporate the inmate's interests, aptitudes, and student advisement into <ln numlevel="1" lineno="381" slineno="5-48"/>an education plan consistent with the guidance provided by the Higher <ln numlevel="1" lineno="382" slineno="5-49"/>Education and Corrections Council created in Section <xref depth="3" refnumber="53H-1-604">53H-1-604</xref>; and</subsection><subsection ssid="18-null-24" dnum="IV-o" numlevel="1" lineno="383" slineno="5-50" level="5"><display>(IV)</display>refer the inmate to the student advisor at the institution called for in the <ln numlevel="1" lineno="384" slineno="5-51"/>case action plan for guidance and assistance with the education process;</subsection></subsection></subsection><subsection ssid="18-null-25" dnum="iii-o" numlevel="1" lineno="385" slineno="5-52" level="3"><display>(iii)</display>the department shall share each newly established case action plan with the <ln numlevel="1" lineno="386" slineno="5-53"/>sentencing and release authority within 30 days after the day on which the case <ln numlevel="1" lineno="387" slineno="5-54"/>action plan is established; and</subsection><subsection ssid="18-null-26" dnum="iv-o" numlevel="1" lineno="388" slineno="5-55" level="3"><display>(iv)</display>the department shall share any changes to a case action plan, including any <ln numlevel="1" lineno="389" slineno="5-56"/>change in an offender's risk assessment, with the sentencing and release authority <ln numlevel="1" lineno="390" slineno="5-57"/>within 30 days after the day of the change;</subsection></subsection><subsection ssid="18-null-27" dnum="n-o" numlevel="1" lineno="391" slineno="5-58" level="2"><display>(n)</display>ensure that an inmate has reasonable access to legal research;</subsection><subsection ssid="18-null-28" dnum="o-o" numlevel="1" lineno="392" slineno="5-59" level="2"><display>(o)</display>ensure that any training or certification required of a public official or public <ln numlevel="1" lineno="393" slineno="5-60"/>employee, as those terms are defined in Section <xref depth="3" refnumber="63G-22-102">63G-22-102</xref>, complies with Title <xref depth="1" refnumber="63G-22"><ln numlevel="1" lineno="394" slineno="5-61"/>63G, Chapter 22</xref>, State Training and Certification Requirements, if the training or <ln numlevel="1" lineno="395" slineno="5-62"/>certification is required:<subsection ssid="18-null-29" dnum="i-o" numlevel="1" lineno="396" slineno="5-63" level="3"><display>(i)</display>under this title;</subsection><subsection ssid="18-null-30" dnum="ii-o" numlevel="1" lineno="397" slineno="5-64" level="3"><display>(ii)</display>by the department; or</subsection><subsection ssid="18-null-31" dnum="iii-o" numlevel="1" lineno="398" slineno="5-65" level="3"><display>(iii)</display>by an agency or division within the department;</subsection></subsection><subsection ssid="18-null-32" dnum="p-o" numlevel="1" lineno="399" slineno="5-66" level="2"><display>(p)</display>when reporting on statewide recidivism, include the metrics and requirements <ln numlevel="1" lineno="400" slineno="5-67"/>described in Section <xref depth="3" refnumber="63M-7-102">63M-7-102</xref>;</subsection><subsection ssid="18-null-33" dnum="q-o" numlevel="1" lineno="401" slineno="5-68" level="2"><display>(q)</display>create a reentry division that focuses on the successful reentry of inmates into the <ln numlevel="1" lineno="402" slineno="5-69"/>community, which shall include:<subsection ssid="18-null-34" dnum="i-o" numlevel="1" lineno="403" slineno="5-70" level="3"><display>(i)</display>screening and assessments for an inmate's risks and needs;</subsection><subsection ssid="18-null-35" dnum="ii-o" numlevel="1" lineno="404" slineno="5-71" level="3"><display>(ii)</display>individualized plans and case management;</subsection><subsection ssid="18-null-36" dnum="iii-o" numlevel="1" lineno="405" slineno="5-72" level="3"><display>(iii)</display>quality treatment, education, and job preparation;</subsection><subsection ssid="18-null-37" dnum="iv-o" numlevel="1" lineno="406" slineno="5-73" level="3"><display>(iv)</display>community partnerships; and</subsection><subsection ssid="18-null-38" dnum="v-o" numlevel="1" lineno="407" slineno="5-74" level="3"><display>(v)</display>comprehensive release planning before the inmate's release, including:<subsection ssid="18-null-39" dnum="A-o" numlevel="1" lineno="408" slineno="5-75" level="4"><display>(A)</display>coordination with support services;</subsection><subsection ssid="18-72" dnum="_-o:B-i" numlevel="1" lineno="409" slineno="5-76" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1185" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="3" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="end">information and resources for post-incarceration housing;</amend> and</subsection><subsection ssid="18-null-40" dnum="B-o:C-i" numlevel="1" lineno="410" slineno="5-77" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1186" style="2" owner="o" level="1" deltag="both">(B)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1187" style="1" owner="i" level="1" amendtag="both" space="true">(C)</amend></display>coordination with one or more family members or friends, if the inmate <ln numlevel="1" lineno="411" slineno="5-78"/>has given permission to contact specific individuals for this purpose;</subsection></subsection></subsection><subsection ssid="18-null-41" dnum="r-o" numlevel="1" lineno="412" slineno="5-79" level="2"><display>(r)</display>coordinate with the Board of Pardons and Parole regarding inmate records that are <ln numlevel="1" lineno="413" slineno="5-80"/>necessary for the Board of Pardons and Parole to make necessary determinations <ln numlevel="1" lineno="414" slineno="5-81"/>regarding an inmate; and</subsection><subsection ssid="18-null-42" dnum="s-o" numlevel="1" lineno="415" slineno="5-82" level="2"><display>(s)</display>ensure that inmate records regarding discipline, programs, and other relevant metrics <ln numlevel="1" lineno="416" slineno="5-83"/>are:<subsection ssid="18-null-43" dnum="i-o" numlevel="1" lineno="417" slineno="5-84" level="3"><display>(i)</display>complete and updated in a timely manner; and</subsection><subsection ssid="18-null-44" dnum="ii-o" numlevel="1" lineno="418" slineno="5-85" level="3"><display>(ii)</display>when applicable, shared with the Board of Pardons and Parole in a timely manner.</subsection></subsection></subsection><subsection ssid="18-null-45" dnum="2-o" numlevel="1" lineno="419" slineno="5-86" level="1"><display>(2)</display>In accordance with department policy, the department may conduct criminal <ln numlevel="1" lineno="420" slineno="5-87"/>investigations regarding an allegation that:<subsection ssid="18-null-46" dnum="a-o" numlevel="1" lineno="421" slineno="5-88" level="2"><display>(a)</display>an offender has committed a criminal offense; or</subsection><subsection ssid="18-null-47" dnum="b-o" numlevel="1" lineno="422" slineno="5-89" level="2"><display>(b)</display>an employee of the department has committed a criminal offense.</subsection></subsection><subsection ssid="18-null-48" dnum="3-o" numlevel="1" lineno="423" slineno="5-90" level="1" space="false"><display>(3)</display><subsection ssid="18-null-49" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The executive director of the department, or the executive director's designee if <ln numlevel="1" lineno="424" slineno="5-91"/>the designee possesses expertise in correctional programming, shall consult at least <ln numlevel="1" lineno="425" slineno="5-92"/>annually with cognitive and career-readiness staff experts from the Utah system of <ln numlevel="1" lineno="426" slineno="5-93"/>higher education and the State Board of Education to review the department's <ln numlevel="1" lineno="427" slineno="5-94"/>evidence-based and evidence-informed treatment and program opportunities.</subsection><subsection ssid="18-null-50" dnum="b-o" numlevel="1" lineno="428" slineno="5-95" level="2"><display>(b)</display>Beginning in the 2022 interim, the department shall provide an annual report to the <ln numlevel="1" lineno="429" slineno="5-96"/>Law Enforcement and Criminal Justice Interim Committee regarding:<subsection ssid="18-null-51" dnum="i-o" numlevel="1" lineno="430" slineno="5-97" level="3"><display>(i)</display>the department's implementation of and offender participation in evidence-based <ln numlevel="1" lineno="431" slineno="5-98"/>and evidence-informed treatment and program opportunities designed to reduce <ln numlevel="1" lineno="432" slineno="5-99"/>the criminogenic and recidivism risks of offenders over time; and</subsection><subsection ssid="18-null-52" dnum="ii-o" numlevel="1" lineno="433" slineno="5-100" level="3"><display>(ii)</display>the progress of the department's implementation of the inmate program <ln numlevel="1" lineno="434" slineno="5-101"/>requirements described in Section <xref depth="3" refnumber="64-13-50">64-13-50</xref>.</subsection></subsection></subsection><subsection ssid="18-null-53" dnum="4-o" numlevel="1" lineno="435" slineno="5-102" level="1" space="false"><display>(4)</display><subsection ssid="18-null-54" dnum="a-o" level="2" placement="sameline"><display>(a)</display>As used in this Subsection <xref depth="4" refnumber="64-13-6(4)">(4)</xref>:<subsection ssid="18-null-55" dnum="i-o" numlevel="1" lineno="436" slineno="5-103" level="3" tab="1"><display>(i)</display>"Accounts receivable" means any amount owed by an offender arising from a <ln numlevel="1" lineno="437" slineno="5-104"/>criminal judgment that has not been paid.</subsection><subsection ssid="18-null-56" dnum="ii-o" numlevel="1" lineno="438" slineno="5-105" level="3" tab="1"><display>(ii)</display>"Accounts receivable" includes unpaid fees, overpayments, fines, forfeitures, <ln numlevel="1" lineno="439" slineno="5-106"/>surcharges, costs, interest, penalties, restitution to victims, third-party claims, <ln numlevel="1" lineno="440" slineno="5-107"/>claims, reimbursement of a reward, and damages that an offender is ordered to <ln numlevel="1" lineno="441" slineno="5-108"/>pay.</subsection></subsection><subsection ssid="18-null-57" dnum="b-o" numlevel="1" lineno="442" slineno="5-109" level="2"><display>(b)</display>The department shall collect and disburse, with any interest and any other costs <ln numlevel="1" lineno="443" slineno="5-110"/>assessed under Section <xref depth="3" refnumber="64-14-204">64-14-204</xref>, an accounts receivable for an offender during:<subsection ssid="18-null-58" dnum="i-o" numlevel="1" lineno="444" slineno="5-111" level="3"><display>(i)</display>the parole period and any extension of that period in accordance with Subsection <xref depth="4" refnumber="64-13-6(4)(c)"><ln numlevel="1" lineno="445" slineno="5-112"/>(4)(c)</xref>; and</subsection><subsection ssid="18-null-59" dnum="ii-o" numlevel="1" lineno="446" slineno="5-113" level="3"><display>(ii)</display>the probation period for which the court orders supervised probation and any <ln numlevel="1" lineno="447" slineno="5-114"/>extension of that period by the department in accordance with Subsection <xref depth="4" refnumber="77-18-105(7)"><ln numlevel="1" lineno="448" slineno="5-115"/>77-18-105(7)</xref>.</subsection></subsection><subsection ssid="18-null-60" dnum="c-o" numlevel="1" lineno="449" slineno="5-116" level="2" space="false"><display>(c)</display><subsection ssid="18-null-61" dnum="i-o" level="3" placement="sameline"><display>(i)</display>If an offender has an unpaid balance of the offender's accounts receivable at the <ln numlevel="1" lineno="450" slineno="5-117"/>time that the offender's sentence expires or terminates, the department shall be <ln numlevel="1" lineno="451" slineno="5-118"/>referred to the sentencing court for the sentencing court to enter a civil judgment <ln numlevel="1" lineno="452" slineno="5-119"/>of restitution and a civil accounts receivable as described in Section <xref depth="3" refnumber="77-18-114">77-18-114</xref>.</subsection><subsection ssid="18-null-62" dnum="ii-o" numlevel="1" lineno="453" slineno="5-120" level="3"><display>(ii)</display>If the board makes an order for restitution within 60 days from the day on which <ln numlevel="1" lineno="454" slineno="5-121"/>the offender's sentence expires or terminates, the board shall refer the order for <ln numlevel="1" lineno="455" slineno="5-122"/>restitution to the sentencing court to be entered as a civil judgment of restitution as <ln numlevel="1" lineno="456" slineno="5-123"/>described in Section <xref depth="3" refnumber="77-18-114">77-18-114</xref>.</subsection></subsection><subsection ssid="18-null-63" dnum="d-o" numlevel="1" lineno="457" slineno="5-124" level="2"><display>(d)</display>This Subsection <xref depth="4" refnumber="64-13-6(4)">(4)</xref> only applies to offenders sentenced before July 1, 2021.</subsection></subsection><subsection ssid="18-null-64" dnum="5-o" numlevel="1" lineno="458" slineno="5-125" level="1" space="false"><display>(5)</display><subsection ssid="18-null-65" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The department may procure or adopt technology services to facilitate the <ln numlevel="1" lineno="459" slineno="5-126"/>coordination of services and enhance accountability with agencies, local partners, and <ln numlevel="1" lineno="460" slineno="5-127"/>community-based organizations that are involved with assisting individuals on <ln numlevel="1" lineno="461" slineno="5-128"/>probation or parole.</subsection><subsection ssid="18-null-66" dnum="b-o" numlevel="1" lineno="462" slineno="5-129" level="2"><display>(b)</display>If possible, the technology services described in Subsection <xref depth="4" refnumber="64-13-6(5)(a)">(5)(a)</xref> shall:<subsection ssid="18-null-67" dnum="i-o" numlevel="1" lineno="463" slineno="5-130" level="3"><display>(i)</display>maintain a single, secure client record with a unique identifier to ensure seamless <ln numlevel="1" lineno="464" slineno="5-131"/>coordination and reduce duplication of services;</subsection><subsection ssid="18-null-68" dnum="ii-o" numlevel="1" lineno="465" slineno="5-132" level="3"><display>(ii)</display>notify authorized users of incoming service requests or referrals;</subsection><subsection ssid="18-null-69" dnum="iii-o" numlevel="1" lineno="466" slineno="5-133" level="3"><display>(iii)</display>provide secure access to information necessary to understanding and addressing <ln numlevel="1" lineno="467" slineno="5-134"/>the needs of an individual, including the individual's service and care history;</subsection><subsection ssid="18-null-70" dnum="iv-o" numlevel="1" lineno="468" slineno="5-135" level="3"><display>(iv)</display>allow authorized users to exchange information with referring or collaborating <ln numlevel="1" lineno="469" slineno="5-136"/>organizations through a secure and live chat feature; and</subsection><subsection ssid="18-null-71" dnum="v-o" numlevel="1" lineno="470" slineno="5-137" level="3"><display>(v)</display>send and track individual referrals, store referral outcomes, and document <ln numlevel="1" lineno="471" slineno="5-138"/>services provided.</subsection></subsection></subsection></section></bsec><bsec buid="20" num="64-13-10.6" type="amend" src="code" uid="C64-13-S10.6_2026050620260506" sort="64 13 00100620260506" numlevel="1" lineno="472" slineno="6-1" sn="6"><section number="64-13-10.6" numlevel="1" lineno="473" slineno="6-2" type="amend"><secline lineno="472">Section 6, Section <bold>64-13-10.6</bold> is amended to read:</secline><catline lineno="473"><bold>64-13-10.6. Transition and reentry of an inmate at termination of incarceration.</bold></catline><subsection ssid="20-null-1" dnum="1-o" numlevel="1" lineno="474" slineno="6-3" level="1" placement="noreturn"><display>(1)</display>The department shall evaluate the case action plan and update the case action plan as <ln numlevel="1" lineno="475" slineno="6-4"/>necessary to prepare for the offender's transition from incarceration to release, including:<subsection ssid="20-null-2" dnum="a-o" numlevel="1" lineno="476" slineno="6-5" level="2"><display>(a)</display>establishing the supervision level and program needs, based on the offender's <ln numlevel="1" lineno="477" slineno="6-6"/>criminal risk factors;</subsection><subsection ssid="20-null-3" dnum="b-o" numlevel="1" lineno="478" slineno="6-7" level="2"><display>(b)</display>identifying barriers to the offender's ability to obtain housing, food, clothing, and <ln numlevel="1" lineno="479" slineno="6-8"/>transportation;</subsection><subsection ssid="20-null-4" dnum="c-o" numlevel="1" lineno="480" slineno="6-9" level="2"><display>(c)</display>identifying community-based treatment resources that are reasonably accessible to <ln numlevel="1" lineno="481" slineno="6-10"/>the offender;</subsection><subsection ssid="20-35" dnum="_-o:d-i" numlevel="1" lineno="482" slineno="6-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1222" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">identifying and providing resources for post-incarceration housing;</amend></subsection><subsection ssid="20-null-5" dnum="d-o:e-i" numlevel="1" lineno="483" slineno="6-12" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1223" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1224" style="1" owner="i" level="1" amendtag="both" space="true">(e)</amend></display>establishing the initial supervision procedures and strategy for the offender's <ln numlevel="1" lineno="484" slineno="6-13"/>parole officer; and</subsection><subsection ssid="20-null-6" dnum="e-o:f-i" numlevel="1" lineno="485" slineno="6-14" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1224" style="2" owner="o" level="1" deltag="both">(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1225" style="1" owner="i" level="1" amendtag="both" space="true">(f)</amend></display>ensuring that the offender has access to the web portal described in Section <xref depth="3" refnumber="35A-2-204" start="0"><ln numlevel="1" lineno="486" slineno="6-15"/>35A-2-204</xref> a minimum of 30 days before the offender's anticipated release date.</subsection></subsection><subsection ssid="20-null-7" dnum="2-o" numlevel="1" lineno="487" slineno="6-16" level="1"><display>(2)</display>The department shall notify the Board of Pardons and Parole not fewer than 30 days <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="16" groupid="15" style="2" owner="jchristopherson" level="1" deltag="start"><ln numlevel="1" lineno="488" slineno="6-17"/>prior</amend><amend anum="0" ea="erase" pairid="18" groupid="17" style="2" owner="jchristopherson" level="1" deltag="end"> to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="15" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">before</amend> an offender's release of:<subsection ssid="20-null-8" dnum="a-o" numlevel="1" lineno="489" slineno="6-18" level="2"><display>(a)</display>the offender's case action plan; and</subsection><subsection ssid="20-null-9" dnum="b-o" numlevel="1" lineno="490" slineno="6-19" level="2"><display>(b)</display>any specific conditions of parole necessary to better facilitate transition to the <ln numlevel="1" lineno="491" slineno="6-20"/>community.</subsection></subsection><subsection ssid="20-null-10" dnum="3-o" numlevel="1" lineno="492" slineno="6-21" level="1" space="false"><display>(3)</display><subsection ssid="20-null-11" dnum="a-o" level="2" placement="sameline"><display>(a)</display>At least six months before the projected date of an inmate's release from <ln numlevel="1" lineno="493" slineno="6-22"/>incarceration, if practicable, the department shall follow the procedures described in <ln numlevel="1" lineno="494" slineno="6-23"/>Section <xref depth="3" refnumber="64-13-10.4" start="0">64-13-10.4</xref>.</subsection><subsection ssid="20-null-12" dnum="b-o" numlevel="1" lineno="495" slineno="6-24" level="2"><display>(b)</display>If the department is notified of the inmate's release and the remaining term of <ln numlevel="1" lineno="496" slineno="6-25"/>incarceration is for less than six months, the department shall follow the procedures <ln numlevel="1" lineno="497" slineno="6-26"/>described in Section <xref depth="3" refnumber="64-13-10.4" start="0">64-13-10.4</xref> as soon as practicable after the department receives <ln numlevel="1" lineno="498" slineno="6-27"/>notification of the inmate's release date.</subsection></subsection><subsection ssid="20-null-13" dnum="4-o" numlevel="1" lineno="499" slineno="6-28" level="1"><display>(4)</display>If the inmate's term of incarceration is for longer than six months, the department shall <ln numlevel="1" lineno="500" slineno="6-29"/>follow procedures described in Section <xref depth="3" refnumber="64-13-10.4" start="0">64-13-10.4</xref>:<subsection ssid="20-null-14" dnum="a-o" numlevel="1" lineno="501" slineno="6-30" level="2"><display>(a)</display>approximately six months before the date of the inmate's anticipated release, if the <ln numlevel="1" lineno="502" slineno="6-31"/>inmate's term of incarceration is for longer than six months; or</subsection><subsection ssid="20-null-15" dnum="b-o" numlevel="1" lineno="503" slineno="6-32" level="2"><display>(b)</display>as soon as possible, upon notification of the inmate's release, if the release is in <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="13" groupid="12" style="2" owner="jchristopherson" level="1" deltag="both"><ln numlevel="1" lineno="504" slineno="6-33"/>shorter</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="12" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">less</amend> than six months.</subsection></subsection><subsection ssid="20-null-16" dnum="5-o" numlevel="1" lineno="505" slineno="6-34" level="1" space="false"><display>(5)</display><subsection ssid="20-null-17" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If an inmate accepts assistance in obtaining a current state-issued identification <ln numlevel="1" lineno="506" slineno="6-35"/>card or driver license, as described in Subsection <xref depth="4" refnumber="64-13-10.4(4)" start="0">64-13-10.4(4)</xref>, the department shall <ln numlevel="1" lineno="507" slineno="6-36"/>coordinate with the Driver License Division to:<subsection ssid="20-null-18" dnum="i-o" numlevel="1" lineno="508" slineno="6-37" level="3" tab="1" space="false"><display>(i)</display><subsection ssid="20-null-19" dnum="A-o" level="4" placement="sameline"><display>(A)</display>obtain a duplicate of the inmate's state-issued driver license, as described in <ln numlevel="1" lineno="509" slineno="6-38"/>Section <xref depth="3" refnumber="53-3-215" start="0">53-3-215</xref>; or</subsection><subsection ssid="20-null-20" dnum="B-o" numlevel="1" lineno="510" slineno="6-39" level="4"><display>(B)</display>renew the inmate's state-issued driver license, if the inmate meets the criteria <ln numlevel="1" lineno="511" slineno="6-40"/>listed in Section <xref depth="3" refnumber="53-3-214" start="0">53-3-214</xref>; or</subsection></subsection><subsection ssid="20-null-21" dnum="ii-o" numlevel="1" lineno="512" slineno="6-41" level="3" tab="1" space="false"><display>(ii)</display><subsection ssid="20-null-22" dnum="A-o" level="4" placement="sameline"><display>(A)</display>extend the inmate's state-issued regular identification card, as described in <ln numlevel="1" lineno="513" slineno="6-42"/>Section <xref depth="3" refnumber="53-3-807" start="0">53-3-807</xref>; or</subsection><subsection ssid="20-null-23" dnum="B-o" numlevel="1" lineno="514" slineno="6-43" level="4"><display>(B)</display>issue the inmate a temporary regular identification card as described in <ln numlevel="1" lineno="515" slineno="6-44"/>Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="7" groupid="6" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="53-3-805(10)" start="0">53-3-805(10)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="53-3-805(11)">53-3-805(11)</xref></amend>, unless the inmate will live outside this <ln numlevel="1" lineno="516" slineno="6-45"/>state immediately upon release.</subsection></subsection></subsection><subsection ssid="20-null-24" dnum="b-o" numlevel="1" lineno="517" slineno="6-46" level="2" space="false"><display>(b)</display><subsection ssid="20-null-25" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Subject to Subsection <xref depth="4" refnumber="64-13-10.6(5)(b)(ii)" start="0">(5)(b)(ii)</xref>, the department shall ensure that within the last <ln numlevel="1" lineno="518" slineno="6-47"/>seven days of the inmate's incarceration, the inmate meets with the Driver License <ln numlevel="1" lineno="519" slineno="6-48"/>Division to be issued a duplicate driver license, a renewed driver license, an <ln numlevel="1" lineno="520" slineno="6-49"/>extended regular identification card, or a temporary regular identification card, as <ln numlevel="1" lineno="521" slineno="6-50"/>described in Subsection <xref depth="4" refnumber="64-13-10.6(5)(a)" start="0">(5)(a)</xref>.</subsection><subsection ssid="20-null-26" dnum="ii-o" numlevel="1" lineno="522" slineno="6-51" level="3"><display>(ii)</display>If an inmate is released from a facility other than a state correctional facility, the <ln numlevel="1" lineno="523" slineno="6-52"/>department shall coordinate with that correctional facility and the Driver License <ln numlevel="1" lineno="524" slineno="6-53"/>Division in assisting the inmate in meeting with the Driver License Division.</subsection></subsection><subsection ssid="20-null-27" dnum="c-o" numlevel="1" lineno="525" slineno="6-54" level="2"><display>(c)</display>Before the inmate meets with the Driver License Division, as described in Subsection <xref depth="4" refnumber="64-13-10.6(5)(b)(i)" start="0"><ln numlevel="1" lineno="526" slineno="6-55"/>(5)(b)(i)</xref>, the department shall ensure that the inmate is provided all required <ln numlevel="1" lineno="527" slineno="6-56"/>documentation and information the department possesses for the inmate to obtain a <ln numlevel="1" lineno="528" slineno="6-57"/>document listed in Subsection <xref depth="4" refnumber="64-13-10.6(5)(a)" start="0">(5)(a)</xref>, including:<subsection ssid="20-null-28" dnum="i-o" numlevel="1" lineno="529" slineno="6-58" level="3"><display>(i)</display>all personal identification documentation; and</subsection><subsection ssid="20-null-29" dnum="ii-o" numlevel="1" lineno="530" slineno="6-59" level="3"><display>(ii)</display>a voucher for payment toward any one of the documents listed in Subsection <xref depth="4" refnumber="64-13-10.6(5)(a)" start="0"><ln numlevel="1" lineno="531" slineno="6-60"/>(5)(a)</xref>, up to the cost of a temporary regular identification card described in <ln numlevel="1" lineno="532" slineno="6-61"/>Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="53-3-805(10)" start="0">53-3-805(10)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="9" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="53-3-805(11)">53-3-805(11)</xref></amend>.</subsection></subsection></subsection><subsection ssid="20-null-30" dnum="6-o" numlevel="1" lineno="533" slineno="6-62" level="1" space="false"><display>(6)</display><subsection ssid="20-null-31" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Subsections <xref depth="4" refnumber="64-13-10.6(4)" start="0">(4)</xref> and <xref depth="4" refnumber="64-13-10.6(5)" start="0">(5)</xref> do not apply to an inmate that is not:<subsection ssid="20-null-32" dnum="i-o" numlevel="1" lineno="534" slineno="6-63" level="3" tab="1"><display>(i)</display>a citizen of the United States; or</subsection><subsection ssid="20-null-33" dnum="ii-o" numlevel="1" lineno="535" slineno="6-64" level="3" tab="1"><display>(ii)</display>a lawful resident of the United States and has legal authorization to work in the <ln numlevel="1" lineno="536" slineno="6-65"/>United States.</subsection></subsection><subsection ssid="20-null-34" dnum="b-o" numlevel="1" lineno="537" slineno="6-66" level="2"><display>(b)</display>An inmate described in Subsection <xref refnumber="64-13-10.6(6)(a)" depth="4">(6)(a)</xref> may be subject to the department's <ln numlevel="1" lineno="538" slineno="6-67"/>notification requirements under Section <xref depth="3" refnumber="64-13-10.7">64-13-10.7</xref>.</subsection></subsection></section></bsec><bsec buid="11" num="64-13-45" type="amend" src="code" uid="C64-13-S45_2026050620260506" sort="64 13 00450020260506" numlevel="1" lineno="539" slineno="7-1" sn="7"><section number="64-13-45" numlevel="1" lineno="540" slineno="7-2" type="amend"><secline lineno="539">Section 7, Section <bold>64-13-45</bold> is amended to read:</secline><catline lineno="540"><bold>64-13-45. Department reporting requirements.</bold></catline><subsection ssid="11-null-1" dnum="1-o" numlevel="1" lineno="541" slineno="7-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="11-null-2" dnum="a-o" numlevel="1" lineno="542" slineno="7-4" level="2"><display>(a)</display>"Biological sex at birth" means the same as that term is defined in Section <xref depth="3" refnumber="26B-8-101">26B-8-101</xref>.</subsection><subsection ssid="11-null-3" dnum="b-o" numlevel="1" lineno="543" slineno="7-5" level="2" space="false"><display>(b)</display><subsection ssid="11-null-4" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"In-custody death" means an inmate death that occurs while the inmate is in the <ln numlevel="1" lineno="544" slineno="7-6"/>custody of the department.</subsection><subsection ssid="11-null-5" dnum="ii-o" numlevel="1" lineno="545" slineno="7-7" level="3"><display>(ii)</display>"In-custody death" includes an inmate death that occurs while the inmate is:<subsection ssid="11-null-6" dnum="A-o" numlevel="1" lineno="546" slineno="7-8" level="4"><display>(A)</display>being transported for medical care; or</subsection><subsection ssid="11-null-7" dnum="B-o" numlevel="1" lineno="547" slineno="7-9" level="4"><display>(B)</display>receiving medical care outside of a correctional facility, other than a county <ln numlevel="1" lineno="548" slineno="7-10"/>jail.</subsection></subsection></subsection><subsection ssid="11-null-8" dnum="c-o" numlevel="1" lineno="549" slineno="7-11" level="2"><display>(c)</display>"Inmate" means an individual who is processed or booked into custody or housed in <ln numlevel="1" lineno="550" slineno="7-12"/>the department or a correctional facility other than a county jail.</subsection><subsection ssid="11-null-9" dnum="d-o" numlevel="1" lineno="551" slineno="7-13" level="2"><display>(d)</display>"Opiate" means the same as that term is defined in Section <xref depth="3" refnumber="58-37-2">58-37-2</xref>.</subsection><subsection ssid="11-null-10" dnum="e-o" numlevel="1" lineno="552" slineno="7-14" level="2"><display>(e)</display>"Transgender inmate" means the same as that term is defined in Section <xref depth="3" refnumber="64-13-7">64-13-7</xref>.</subsection></subsection><subsection ssid="11-null-11" dnum="2-o" numlevel="1" lineno="553" slineno="7-15" level="1"><display>(2)</display>The department shall submit a report to the Commission on Criminal and Juvenile <ln numlevel="1" lineno="554" slineno="7-16"/>Justice created in Section <xref depth="3" refnumber="63M-7-201">63M-7-201</xref> before June 15 of each year that includes:<subsection ssid="11-null-12" dnum="a-o" numlevel="1" lineno="555" slineno="7-17" level="2"><display>(a)</display>the number of in-custody deaths that occurred during the preceding calendar year, <ln numlevel="1" lineno="556" slineno="7-18"/>including:<subsection ssid="11-null-13" dnum="i-o" numlevel="1" lineno="557" slineno="7-19" level="3"><display>(i)</display>the known, or discoverable on reasonable inquiry, causes and contributing factors <ln numlevel="1" lineno="558" slineno="7-20"/>of each of the in-custody deaths described in Subsection <xref depth="4" refnumber="64-13-45(2)(a)">(2)(a)</xref>; and</subsection><subsection ssid="11-null-14" dnum="ii-o" numlevel="1" lineno="559" slineno="7-21" level="3"><display>(ii)</display>the department's policy for notifying an inmate's next of kin after the inmate's <ln numlevel="1" lineno="560" slineno="7-22"/>in-custody death;</subsection></subsection><subsection ssid="11-null-15" dnum="b-o" numlevel="1" lineno="561" slineno="7-23" level="2"><display>(b)</display>the department policies, procedures, and protocols:<subsection ssid="11-null-16" dnum="i-o" numlevel="1" lineno="562" slineno="7-24" level="3"><display>(i)</display>for treatment of an inmate experiencing withdrawal from alcohol or substance use, <ln numlevel="1" lineno="563" slineno="7-25"/>including use of opiates;</subsection><subsection ssid="11-null-17" dnum="ii-o" numlevel="1" lineno="564" slineno="7-26" level="3"><display>(ii)</display>that relate to the department's provision, or lack of provision, of medications used <ln numlevel="1" lineno="565" slineno="7-27"/>to treat, mitigate, or address an inmate's symptoms of withdrawal, including <ln numlevel="1" lineno="566" slineno="7-28"/>methadone and all forms of buprenorphine and naltrexone; and</subsection><subsection ssid="11-null-18" dnum="iii-o" numlevel="1" lineno="567" slineno="7-29" level="3"><display>(iii)</display>that relate to screening, assessment, and treatment of an inmate for a substance <ln numlevel="1" lineno="568" slineno="7-30"/>use disorder or mental health disorder;</subsection></subsection><subsection ssid="11-null-19" dnum="c-o" numlevel="1" lineno="569" slineno="7-31" level="2"><display>(c)</display>the number of inmates who gave birth and were restrained in accordance with <ln numlevel="1" lineno="570" slineno="7-32"/>Section <xref depth="3" refnumber="64-13-46">64-13-46</xref>, including:<subsection ssid="11-null-20" dnum="i-o" numlevel="1" lineno="571" slineno="7-33" level="3"><display>(i)</display>the types of restraints used; and</subsection><subsection ssid="11-null-21" dnum="ii-o" numlevel="1" lineno="572" slineno="7-34" level="3"><display>(ii)</display>whether the use of restraints was to prevent escape or to ensure the safety of the <ln numlevel="1" lineno="573" slineno="7-35"/>inmate, medical or corrections staff, or the public;</subsection></subsection><subsection ssid="11-null-22" dnum="d-o" numlevel="1" lineno="574" slineno="7-36" level="2"><display>(d)</display>the number of transgender inmates that are assigned to a living area with inmates <ln numlevel="1" lineno="575" slineno="7-37"/>whose biological sex at birth do not correspond with the transgender inmate's <ln numlevel="1" lineno="576" slineno="7-38"/>biological sex at birth in accordance with Section <xref depth="3" refnumber="64-13-7">64-13-7</xref>, including:<subsection ssid="11-null-23" dnum="i-o" numlevel="1" lineno="577" slineno="7-39" level="3"><display>(i)</display>the results of the individualized security analysis conducted for each transgender <ln numlevel="1" lineno="578" slineno="7-40"/>inmate in accordance with Subsection <xref depth="4" refnumber="64-13-7(5)(a)">64-13-7(5)(a)</xref>; and</subsection><subsection ssid="11-null-24" dnum="ii-o" numlevel="1" lineno="579" slineno="7-41" level="3"><display>(ii)</display>a detailed explanation regarding how the security conditions described in <ln numlevel="1" lineno="580" slineno="7-42"/>Subsection <xref depth="4" refnumber="64-13-7(5)(b)">64-13-7(5)(b)</xref> are met for each transgender inmate;</subsection></subsection><subsection ssid="11-null-25" dnum="e-o" numlevel="1" lineno="581" slineno="7-43" level="2"><display>(e)</display>the number of transgender inmates that were:<subsection ssid="11-null-26" dnum="i-o" numlevel="1" lineno="582" slineno="7-44" level="3"><display>(i)</display>assigned to a living area with inmates whose biological sex at birth do not <ln numlevel="1" lineno="583" slineno="7-45"/>correspond with the transgender inmate's biological sex at birth; and</subsection><subsection ssid="11-null-27" dnum="ii-o" numlevel="1" lineno="584" slineno="7-46" level="3"><display>(ii)</display>removed and assigned to a living area with inmates whose biological sex at birth <ln numlevel="1" lineno="585" slineno="7-47"/>corresponds with the transgender inmate's biological sex at birth in accordance <ln numlevel="1" lineno="586" slineno="7-48"/>with Subsection <xref depth="4" refnumber="64-13-7(6)">64-13-7(6)</xref>; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="0" groupid="0" style="2" owner="jchristopherson" level="1" deltag="both">and</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="11-null-28" dnum="f-o" numlevel="1" lineno="587" slineno="7-49" level="2"><display>(f)</display>any report the department provides or is required to provide under federal law or <ln numlevel="1" lineno="588" slineno="7-50"/>regulation relating to inmate deaths<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1" groupid="1" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="9" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="11-34" dnum="_-o:g-i" numlevel="1" lineno="589" slineno="7-51" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1281" style="1" owner="i" level="1" amendtag="start">(g)</amend></display><amend anum="0" ea="amend" pairid="8" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="end">data on financial condition incentives and incentives that may reduce sentence length <ln numlevel="1" lineno="590" slineno="7-52"/>that are offered to inmates, including:</amend><subsection ssid="11-35" dnum="_-o:i-i" numlevel="1" lineno="591" slineno="7-53" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1282" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="15" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">the types of incentives that currently exist; and</amend></subsection><subsection ssid="11-36" dnum="_-o:ii-i" numlevel="1" lineno="592" slineno="7-54" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1283" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="20" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="end">for each type of incentive described in Subsection <xref depth="4" refnumber="64-13-45(2)(g)(i)">(2)(g)(i)</xref>:</amend><subsection ssid="11-37" dnum="_-o:A-i" numlevel="1" lineno="593" slineno="7-55" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1284" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="25" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="end">the number of inmates who have used each type during the previous calendar <ln numlevel="1" lineno="594" slineno="7-56"/>year;</amend></subsection><subsection ssid="11-38" dnum="_-o:B-i" numlevel="1" lineno="595" slineno="7-57" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1285" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="40" groupid="31" style="1" owner="jchristopherson" level="1" amendtag="end">the number of incentives the department issued during the previous calendar <ln numlevel="1" lineno="596" slineno="7-58"/>year; and</amend></subsection><subsection ssid="11-39" dnum="_-o:C-i" numlevel="1" lineno="597" slineno="7-59" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1286" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="39" groupid="30" style="1" owner="jchristopherson" level="1" amendtag="end">the methods by which the department provided information regarding each <ln numlevel="1" lineno="598" slineno="7-60"/>type of incentive during the previous calendar year.</amend></subsection></subsection></subsection></subsection><subsection ssid="11-null-29" dnum="3-o" numlevel="1" lineno="599" slineno="7-61" level="1"><display>(3)</display>The Commission on Criminal and Juvenile Justice shall:<subsection ssid="11-null-30" dnum="a-o" numlevel="1" lineno="600" slineno="7-62" level="2"><display>(a)</display>compile the information from the reports described in Subsection <xref depth="4" refnumber="64-13-45(2)">(2)</xref>;</subsection><subsection ssid="11-null-31" dnum="b-o" numlevel="1" lineno="601" slineno="7-63" level="2"><display>(b)</display>omit or redact any identifying information of an inmate in the compilation to the <ln numlevel="1" lineno="602" slineno="7-64"/>extent omission or redaction is necessary to comply with state and federal law<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="41" groupid="32" style="2" owner="jchristopherson" level="1" deltag="both"> </amend><amendoutend style="2"/>; and</subsection><subsection ssid="11-null-32" dnum="c-o" numlevel="1" lineno="603" slineno="7-65" level="2"><display>(c)</display>submit the compilation to the Law Enforcement and Criminal Justice Interim <ln numlevel="1" lineno="604" slineno="7-66"/>Committee and the Utah Substance Use and Mental Health Advisory Committee <ln numlevel="1" lineno="605" slineno="7-67"/>before November 1 of each year.</subsection></subsection><subsection ssid="11-null-33" dnum="4-o" numlevel="1" lineno="606" slineno="7-68" level="1"><display>(4)</display>The Commission on Criminal and Juvenile Justice may not provide access to or use the <ln numlevel="1" lineno="607" slineno="7-69"/>department's policies, procedures, or protocols submitted under this section in a manner <ln numlevel="1" lineno="608" slineno="7-70"/>or for a purpose not described in this section.</subsection></section></bsec><bsec buid="13" num="64-14-203" type="amend" src="code" uid="C64-14-S203_2026050620260506" sort="64 14 02030020260506" numlevel="1" lineno="609" slineno="8-1" sn="8"><section number="64-14-203" numlevel="1" lineno="610" slineno="8-2" type="amend"><secline lineno="609">Section 8, Section <bold>64-14-203</bold> is amended to read:</secline><catline lineno="610"><bold>64-14-203. Duties of division.</bold></catline><subsection ssid="13-null-1" dnum="1-o" numlevel="1" lineno="611" slineno="8-3" level="1" placement="noreturn"><display>(1)</display>The division shall:<subsection ssid="13-null-2" dnum="a-o" numlevel="1" lineno="612" slineno="8-4" level="2"><display>(a)</display>assist the department in fulfilling the department's duty to supervise, as described in <ln numlevel="1" lineno="613" slineno="8-5"/>Subsection <xref refnumber="64-13-6(1)(i)" depth="4">64-13-6(1)(i)</xref>, probationers and parolees as directed by statute and <ln numlevel="1" lineno="614" slineno="8-6"/>implemented by the courts and the Board of Pardons and Parole;</subsection><subsection ssid="13-null-3" dnum="b-o" numlevel="1" lineno="615" slineno="8-7" level="2"><display>(b)</display>comply with the requirements described in this part;</subsection><subsection ssid="13-null-4" dnum="c-o" numlevel="1" lineno="616" slineno="8-8" level="2"><display>(c)</display>supply the information described in Section <xref depth="3" refnumber="53-10-209">53-10-209</xref> that is required to be <ln numlevel="1" lineno="617" slineno="8-9"/>submitted to the Criminal Investigations and Technical Services Division created in <ln numlevel="1" lineno="618" slineno="8-10"/>Subsection <xref tempid="129" depth="4" refnumber="53-10-103(2)">53-10-103(2)</xref>;</subsection><subsection ssid="13-null-5" dnum="d-o" numlevel="1" lineno="619" slineno="8-11" level="2"><display>(d)</display>comply with the use of funds requirement for outpatient treatment services for those <ln numlevel="1" lineno="620" slineno="8-12"/>convicted of an offense under Title 76, Chapter 5, Part 4, Sexual Offenses, as <ln numlevel="1" lineno="621" slineno="8-13"/>described in Subsection <xref refnumber="59-27-105(4)(c)" depth="4">59-27-105(4)(c)</xref>;</subsection><subsection ssid="13-null-6" dnum="e-o" numlevel="1" lineno="622" slineno="8-14" level="2"><display>(e)</display>monitor the status of an offender with a mental condition who has been placed on <ln numlevel="1" lineno="623" slineno="8-15"/>parole as described in Subsection <xref refnumber="77-16a-205(4)" depth="4">77-16a-205(4)</xref>;</subsection><subsection ssid="13-null-7" dnum="f-o" numlevel="1" lineno="624" slineno="8-16" level="2"><display>(f)</display>comply with the requirements described in Title 77, Chapter 18, The Judgment;</subsection><subsection ssid="13-null-8" dnum="g-o" numlevel="1" lineno="625" slineno="8-17" level="2"><display>(g)</display>in accordance with the adult sentencing and supervision length guidelines described <ln numlevel="1" lineno="626" slineno="8-18"/>in Section <xref depth="3" refnumber="63M-7-404.3">63M-7-404.3</xref>, notify the Board of Pardons and Parole of parole violations;</subsection><subsection ssid="13-null-9" dnum="h-o" numlevel="1" lineno="627" slineno="8-19" level="2"><display>(h)</display>for an individual who is on probation for a domestic violence offense that the <ln numlevel="1" lineno="628" slineno="8-20"/>division is supervising, report to the court and notify the victim of the domestic <ln numlevel="1" lineno="629" slineno="8-21"/>violence offense if the individual fails to comply with any condition imposed by the <ln numlevel="1" lineno="630" slineno="8-22"/>court or commits a violation of a sentencing protective order as required by <ln numlevel="1" lineno="631" slineno="8-23"/>Subsection <xref refnumber="77-36-5.1(4)" depth="4">77-36-5.1(4)</xref>;</subsection><subsection ssid="13-null-10" dnum="i-o" numlevel="1" lineno="632" slineno="8-24" level="2"><display>(i)</display>comply with the notice requirement to a prosecuting agency described in Subsection <xref depth="4" refnumber="77-38-3(6)"><ln numlevel="1" lineno="633" slineno="8-25"/>77-38-3(6)</xref> if the division is the moving party on a motion for modification of any <ln numlevel="1" lineno="634" slineno="8-26"/>determination made at any of the criminal justice hearings provided in Subsections <xref depth="4" refnumber="77-38-2(5)(a)"><ln numlevel="1" lineno="635" slineno="8-27"/>77-38-2(5)(a)</xref> through (g);</subsection><subsection ssid="13-null-11" dnum="j-o" numlevel="1" lineno="636" slineno="8-28" level="2"><display>(j)</display>collect restitution information in preparing a presentence investigation report as <ln numlevel="1" lineno="637" slineno="8-29"/>described in Section <xref depth="3" refnumber="77-38b-203">77-38b-203</xref>;</subsection><subsection ssid="13-null-12" dnum="k-o" numlevel="1" lineno="638" slineno="8-30" level="2"><display>(k)</display>for an individual under supervision by the division who violates a sentencing <ln numlevel="1" lineno="639" slineno="8-31"/>protective order issued under Title 78B, Chapter 7, Part 8, Criminal Protective <ln numlevel="1" lineno="640" slineno="8-32"/>Orders, report the violation to the court and notify the victim protected by the order <ln numlevel="1" lineno="641" slineno="8-33"/>of the violation as required by Section <xref depth="3" refnumber="78B-7-807">78B-7-807</xref>; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="4" style="2" owner="jchristopherson" level="1" deltag="both">and</amend><amendoutend style="2"/></subsection><subsection ssid="13-17" dnum="_-o:l-i" numlevel="1" lineno="642" slineno="8-34" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1304" style="1" owner="i" level="1" amendtag="start">(l)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">track and report annually, on or before August 31, to the State Commission on <ln numlevel="1" lineno="643" slineno="8-35"/>Criminal and Juvenile Justice, the following housing data as of July 1 of each year <ln numlevel="1" lineno="644" slineno="8-36"/>for individuals who are currently under parole supervision:</amend><subsection ssid="13-18" dnum="_-o:i-i" numlevel="1" lineno="645" slineno="8-37" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1305" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="10" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="end">the number of individuals who are living in a residential treatment center;</amend></subsection><subsection ssid="13-19" dnum="_-o:ii-i" numlevel="1" lineno="646" slineno="8-38" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1306" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="15" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">the number of individuals who report not having any residence;</amend></subsection><subsection ssid="13-20" dnum="_-o:iii-i" numlevel="1" lineno="647" slineno="8-39" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1307" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="20" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="end">the number of individuals who are living in a homeless shelter;</amend></subsection><subsection ssid="13-21" dnum="_-o:iv-i" numlevel="1" lineno="648" slineno="8-40" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1308" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="25" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="end">the number of individuals who are living in a private residence; and</amend></subsection><subsection ssid="13-23" dnum="_-o:v-i" numlevel="1" lineno="649" slineno="8-41" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1309" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="32" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="end">the number of individuals for whom the division does not have current housing <ln numlevel="1" lineno="650" slineno="8-42"/>information; and</amend></subsection></subsection><subsection ssid="13-null-13" dnum="l-o:m-i" numlevel="1" lineno="651" slineno="8-43" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1310" style="2" owner="o" level="1" deltag="both">(l)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1311" style="1" owner="i" level="1" amendtag="both" space="true">(m)</amend></display>comply with any other requirement established by applicable statute or <ln numlevel="1" lineno="652" slineno="8-44"/>regulation or a directive from the executive director.</subsection></subsection><subsection ssid="13-null-14" dnum="2-o" numlevel="1" lineno="653" slineno="8-45" level="1"><display>(2)</display>The division may, in the course of supervising individuals on probation and parole:<subsection ssid="13-null-15" dnum="a-o" numlevel="1" lineno="654" slineno="8-46" level="2"><display>(a)</display>respond to an individual's violation of one or more terms of the probation or parole in <ln numlevel="1" lineno="655" slineno="8-47"/>accordance with the graduated and evidence-based processes established by the adult <ln numlevel="1" lineno="656" slineno="8-48"/>sentencing and supervision length guidelines, as defined in Section <xref depth="3" refnumber="63M-7-401.1">63M-7-401.1</xref>; and</subsection><subsection ssid="13-null-16" dnum="b-o" numlevel="1" lineno="657" slineno="8-49" level="2"><display>(b)</display>upon approval by the court or the Board of Pardons and Parole, impose as a sanction <ln numlevel="1" lineno="658" slineno="8-50"/>for an individual's violation of the terms of probation or parole a period of <ln numlevel="1" lineno="659" slineno="8-51"/>incarceration of not more than three consecutive days and not more than a total of six <ln numlevel="1" lineno="660" slineno="8-52"/>days within a period of 30 days.</subsection></subsection></section></bsec><bsec buid="33" num="77-18-105" type="amend" src="code" uid="C77-18-S105_2026050620260506" sort="77 18 01050020260506" numlevel="1" lineno="661" slineno="9-1" sn="9"><section number="77-18-105" numlevel="1" lineno="662" slineno="9-2" type="amend"><secline lineno="661">Section 9, Section <bold>77-18-105</bold> is amended to read:</secline><catline lineno="662"><bold>77-18-105. Pleas held in abeyance -- Suspension of a sentence -- Probation -- <ln numlevel="1" lineno="663" slineno="9-3"/>Supervision -- Terms and conditions of probation -- Time periods for probation -- Bench <ln numlevel="1" lineno="664" slineno="9-4"/>supervision for payments on criminal accounts receivable.</bold></catline><subsection ssid="33-null-1" dnum="1-o" numlevel="1" lineno="665" slineno="9-5" level="1" placement="noreturn"><display>(1)</display>If a defendant enters a plea of guilty or no contest in conjunction with a plea in <ln numlevel="1" lineno="666" slineno="9-6"/>abeyance agreement, the court may hold the plea in abeyance:<subsection ssid="33-null-2" dnum="a-o" numlevel="1" lineno="667" slineno="9-7" level="2"><display>(a)</display>in accordance with Chapter 2a, Pleas in Abeyance; and</subsection><subsection ssid="33-null-3" dnum="b-o" numlevel="1" lineno="668" slineno="9-8" level="2"><display>(b)</display>under the terms of the plea in abeyance agreement.</subsection></subsection><subsection ssid="33-null-4" dnum="2-o" numlevel="1" lineno="669" slineno="9-9" level="1"><display>(2)</display>If a defendant is convicted, the court:<subsection ssid="33-null-5" dnum="a-o" numlevel="1" lineno="670" slineno="9-10" level="2"><display>(a)</display>shall impose a sentence in accordance with Section <xref depth="3" refnumber="76-3-201">76-3-201</xref>; and</subsection><subsection ssid="33-null-6" dnum="b-o" numlevel="1" lineno="671" slineno="9-11" level="2"><display>(b)</display>subject to Subsection <xref depth="4" refnumber="77-18-105(5)">(5)</xref>, may suspend the execution of the sentence and place the <ln numlevel="1" lineno="672" slineno="9-12"/>defendant:<subsection ssid="33-null-7" dnum="i-o" numlevel="1" lineno="673" slineno="9-13" level="3"><display>(i)</display>on probation under the supervision of the division;</subsection><subsection ssid="33-null-8" dnum="ii-o" numlevel="1" lineno="674" slineno="9-14" level="3"><display>(ii)</display>on probation under the supervision of an agency of a local government or a <ln numlevel="1" lineno="675" slineno="9-15"/>private organization; or</subsection><subsection ssid="33-null-9" dnum="iii-o" numlevel="1" lineno="676" slineno="9-16" level="3"><display>(iii)</display>on court probation under the jurisdiction of the sentencing court.</subsection></subsection></subsection><subsection ssid="33-null-10" dnum="3-o" numlevel="1" lineno="677" slineno="9-17" level="1" space="false"><display>(3)</display><subsection ssid="33-null-11" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The legal custody of all probationers under the supervision of the division is with <ln numlevel="1" lineno="678" slineno="9-18"/>the department.</subsection><subsection ssid="33-null-12" dnum="b-o" numlevel="1" lineno="679" slineno="9-19" level="2"><display>(b)</display>The legal custody of all probationers under the jurisdiction of the sentencing court is <ln numlevel="1" lineno="680" slineno="9-20"/>vested as ordered by the court.</subsection><subsection ssid="33-null-13" dnum="c-o" numlevel="1" lineno="681" slineno="9-21" level="2"><display>(c)</display>The court has continuing jurisdiction over all probationers.</subsection></subsection><subsection ssid="33-null-14" dnum="4-o" numlevel="1" lineno="682" slineno="9-22" level="1" space="false"><display>(4)</display><subsection ssid="33-null-15" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Court probation may include an administrative level of services, including <ln numlevel="1" lineno="683" slineno="9-23"/>notification to the sentencing court of scheduled periodic reviews of the probationer's <ln numlevel="1" lineno="684" slineno="9-24"/>compliance with conditions.</subsection><subsection ssid="33-null-16" dnum="b-o" numlevel="1" lineno="685" slineno="9-25" level="2"><display>(b)</display>Supervised probation services provided by the division, an agency of a local <ln numlevel="1" lineno="686" slineno="9-26"/>government, or a private organization shall specifically address the defendant's risk <ln numlevel="1" lineno="687" slineno="9-27"/>of reoffending as identified by a screening or an assessment.</subsection><subsection ssid="33-null-17" dnum="c-o" numlevel="1" lineno="688" slineno="9-28" level="2"><display>(c)</display>If a court orders supervised probation and determines that a public probation <ln numlevel="1" lineno="689" slineno="9-29"/>provider is unavailable or inappropriate to supervise the defendant, the court shall <ln numlevel="1" lineno="690" slineno="9-30"/>make available to the defendant the list of private probation providers prepared by a <ln numlevel="1" lineno="691" slineno="9-31"/>criminal justice coordinating council under Section <xref depth="3" refnumber="17E-2-201">17E-2-201</xref>.</subsection></subsection><subsection ssid="33-null-18" dnum="5-o" numlevel="1" lineno="692" slineno="9-32" level="1" space="false"><display>(5)</display><subsection ssid="33-null-19" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Before ordering supervised probation, the court shall consider the supervision <ln numlevel="1" lineno="693" slineno="9-33"/>costs to the defendant for each entity that can supervise the defendant.</subsection><subsection ssid="33-null-20" dnum="b-o" numlevel="1" lineno="694" slineno="9-34" level="2" space="false"><display>(b)</display><subsection ssid="33-null-21" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A court may order an agency of a local government to supervise the probation <ln numlevel="1" lineno="695" slineno="9-35"/>for an individual convicted of any crime if:<subsection ssid="33-null-22" dnum="A-o" numlevel="1" lineno="696" slineno="9-36" level="4" tab="1"><display>(A)</display>the agency has the capacity to supervise the individual; and</subsection><subsection ssid="33-null-23" dnum="B-o" numlevel="1" lineno="697" slineno="9-37" level="4" tab="1"><display>(B)</display>the individual's supervision needs will be met by the agency.</subsection></subsection><subsection ssid="33-null-24" dnum="ii-o" numlevel="1" lineno="698" slineno="9-38" level="3"><display>(ii)</display>A court may only order:<subsection ssid="33-null-25" dnum="A-o" numlevel="1" lineno="699" slineno="9-39" level="4"><display>(A)</display>the division to supervise the probation for an individual convicted of a class A <ln numlevel="1" lineno="700" slineno="9-40"/>misdemeanor or any felony; or</subsection><subsection ssid="33-null-26" dnum="B-o" numlevel="1" lineno="701" slineno="9-41" level="4"><display>(B)</display>a private organization to supervise the probation for an individual convicted of <ln numlevel="1" lineno="702" slineno="9-42"/>a class A, B, or C misdemeanor or an infraction.</subsection></subsection></subsection><subsection ssid="33-null-27" dnum="c-o" numlevel="1" lineno="703" slineno="9-43" level="2"><display>(c)</display>A court may not order a specific private organization to supervise an individual <ln numlevel="1" lineno="704" slineno="9-44"/>unless there is only one private organization that can provide the specific supervision <ln numlevel="1" lineno="705" slineno="9-45"/>services required to meet the individual's supervision needs.</subsection></subsection><subsection ssid="33-null-28" dnum="6-o" numlevel="1" lineno="706" slineno="9-46" level="1" space="false"><display>(6)</display><subsection ssid="33-null-29" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If a defendant is placed on probation, the court may order the defendant as a <ln numlevel="1" lineno="707" slineno="9-47"/>condition of the defendant's probation:<subsection ssid="33-null-30" dnum="i-o" numlevel="1" lineno="708" slineno="9-48" level="3" tab="1"><display>(i)</display>to provide for the support of persons for whose support the defendant is legally <ln numlevel="1" lineno="709" slineno="9-49"/>liable;</subsection><subsection ssid="33-null-31" dnum="ii-o" numlevel="1" lineno="710" slineno="9-50" level="3" tab="1"><display>(ii)</display>to participate in available treatment programs, including any treatment program in <ln numlevel="1" lineno="711" slineno="9-51"/>which the defendant is currently participating if the program is acceptable to the <ln numlevel="1" lineno="712" slineno="9-52"/>court;</subsection><subsection ssid="33-null-32" dnum="iii-o" numlevel="1" lineno="713" slineno="9-53" level="3" tab="1"><display>(iii)</display>be voluntarily admitted to the custody of the Division of Substance Use and <ln numlevel="1" lineno="714" slineno="9-54"/>Mental Health for treatment at the Utah State Hospital in accordance with Section <xref depth="3" refnumber="77-18-106"><ln numlevel="1" lineno="715" slineno="9-55"/>77-18-106</xref>;</subsection><subsection ssid="33-null-33" dnum="iv-o" numlevel="1" lineno="716" slineno="9-56" level="3" tab="1"><display>(iv)</display>if the defendant is on probation for a felony offense, to serve a period of time as <ln numlevel="1" lineno="717" slineno="9-57"/>an initial condition of probation that does not exceed one year in a county jail <ln numlevel="1" lineno="718" slineno="9-58"/>designated by the department, after considering any recommendation by the court <ln numlevel="1" lineno="719" slineno="9-59"/>as to which jail the court finds most appropriate;</subsection><subsection ssid="33-null-34" dnum="v-o" numlevel="1" lineno="720" slineno="9-60" level="3" tab="1"><display>(v)</display>to serve a term of home confinement in accordance with Section <xref depth="3" refnumber="77-18-107">77-18-107</xref>;</subsection><subsection ssid="33-null-35" dnum="vi-o" numlevel="1" lineno="721" slineno="9-61" level="3" tab="1"><display>(vi)</display>to participate in compensatory service programs, including the compensatory <ln numlevel="1" lineno="722" slineno="9-62"/>service program described in Section <xref depth="3" refnumber="76-3-410">76-3-410</xref>;</subsection><subsection ssid="33-null-36" dnum="vii-o" numlevel="1" lineno="723" slineno="9-63" level="3" tab="1"><display>(vii)</display>to pay for the costs of investigation, probation, or treatment services;</subsection><subsection ssid="33-null-37" dnum="viii-o" numlevel="1" lineno="724" slineno="9-64" level="3" tab="1"><display>(viii)</display>to pay restitution to a victim with interest in accordance with Chapter 38b, <ln numlevel="1" lineno="725" slineno="9-65"/>Crime Victims Restitution Act; or</subsection><subsection ssid="33-null-38" dnum="ix-o" numlevel="1" lineno="726" slineno="9-66" level="3" tab="1"><display>(ix)</display>to comply with other terms and conditions the court considers appropriate to <ln numlevel="1" lineno="727" slineno="9-67"/>ensure public safety or increase a defendant's likelihood of success on probation.</subsection></subsection><subsection ssid="33-null-39" dnum="b-o" numlevel="1" lineno="728" slineno="9-68" level="2"><display>(b)</display>If a defendant is placed on probation and a condition of the defendant's probation is <ln numlevel="1" lineno="729" slineno="9-69"/>routine or random drug testing, the defendant shall sign a waiver<amend anum="0" ea="amend" pairid="5" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both">,</amend> <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both">consistent with the <ln numlevel="1" lineno="730" slineno="9-70"/>Health Insurance Portability and Accountability Act, 42 U.S.C. Sec. 1320d et seq., <ln numlevel="1" lineno="731" slineno="9-71"/>allowing</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">in compliance with federal health information disclosure laws, that allows</amend> <ln numlevel="1" lineno="732" slineno="9-72"/>the treatment provider conducting the drug testing to notify the defendant's <ln numlevel="1" lineno="733" slineno="9-73"/>supervising probation officer regarding the results of the defendant's drug testing.</subsection><subsection ssid="33-null-40" dnum="c-o" numlevel="1" lineno="734" slineno="9-74" level="2" space="false"><display>(c)</display><subsection ssid="33-null-41" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Notwithstanding Subsection <xref depth="4" refnumber="77-18-105(6)(a)(iv)">(6)(a)(iv)</xref>, the court may modify the probation of a <ln numlevel="1" lineno="735" slineno="9-75"/>defendant to include a period of time that is served in a county jail immediately <ln numlevel="1" lineno="736" slineno="9-76"/>before the termination of probation as long as that period of time does not exceed <ln numlevel="1" lineno="737" slineno="9-77"/>one year.</subsection><subsection ssid="33-null-42" dnum="ii-o" numlevel="1" lineno="738" slineno="9-78" level="3"><display>(ii)</display>If a defendant is ordered to serve time in a county jail as a sanction for a <ln numlevel="1" lineno="739" slineno="9-79"/>probation violation, the one-year limitation described in Subsection <xref depth="4" refnumber="77-18-105(6)(a)(iv)">(6)(a)(iv)</xref> or <xref depth="4" refnumber="77-18-105(6)(c)(i)"><ln numlevel="1" lineno="740" slineno="9-80"/>(6)(c)(i)</xref> does not apply to the period of time that the court orders the defendant to <ln numlevel="1" lineno="741" slineno="9-81"/>serve in a county jail under this Subsection <xref depth="4" refnumber="77-18-105(6)(c)(ii)">(6)(c)(ii)</xref>.</subsection></subsection></subsection><subsection ssid="33-null-43" dnum="7-o" numlevel="1" lineno="742" slineno="9-82" level="1" space="false"><display>(7)</display><subsection ssid="33-null-44" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="77-18-105(7)(b)">(7)(b)</xref>, probation of an individual placed on <ln numlevel="1" lineno="743" slineno="9-83"/>probation after December 31, 2018:<subsection ssid="33-null-45" dnum="i-o" numlevel="1" lineno="744" slineno="9-84" level="3" tab="1"><display>(i)</display>may not exceed the individual's maximum sentence;</subsection><subsection ssid="33-null-46" dnum="ii-o" numlevel="1" lineno="745" slineno="9-85" level="3" tab="1"><display>(ii)</display>shall be for a period of time that is in accordance with the adult sentencing and <ln numlevel="1" lineno="746" slineno="9-86"/>supervision length guidelines, as defined in Section <xref depth="3" refnumber="63M-7-401.1">63M-7-401.1</xref>, to the extent the <ln numlevel="1" lineno="747" slineno="9-87"/>guidelines are consistent with the requirements of the law; and</subsection><subsection ssid="33-null-47" dnum="iii-o" numlevel="1" lineno="748" slineno="9-88" level="3" tab="1"><display>(iii)</display>shall be terminated in accordance with the adult sentencing and supervision <ln numlevel="1" lineno="749" slineno="9-89"/>length guidelines, as defined in Section <xref depth="3" refnumber="63M-7-401.1">63M-7-401.1</xref>, to the extent the guidelines <ln numlevel="1" lineno="750" slineno="9-90"/>are consistent with the requirements of the law.</subsection></subsection><subsection ssid="33-null-48" dnum="b-o" numlevel="1" lineno="751" slineno="9-91" level="2"><display>(b)</display>Probation of an individual placed on probation after December 31, 2018, whose <ln numlevel="1" lineno="752" slineno="9-92"/>maximum sentence is one year or less, may not exceed 36 months.</subsection><subsection ssid="33-null-49" dnum="c-o" numlevel="1" lineno="753" slineno="9-93" level="2"><display>(c)</display>Probation of an individual placed on probation on or after October 1, 2015, but <ln numlevel="1" lineno="754" slineno="9-94"/>before January 1, 2019, may be terminated at any time at the discretion of the court <ln numlevel="1" lineno="755" slineno="9-95"/>or upon completion without violation of 36 months probation in felony or class A <ln numlevel="1" lineno="756" slineno="9-96"/>misdemeanor cases, 12 months in cases of class B or C misdemeanors or infractions, <ln numlevel="1" lineno="757" slineno="9-97"/>or as allowed in accordance with Section <xref depth="3" refnumber="64-13-21">64-13-21</xref> regarding earned credits.</subsection><subsection ssid="33-null-50" dnum="d-o" numlevel="1" lineno="758" slineno="9-98" level="2"><display>(d)</display>This Subsection <xref depth="4" refnumber="77-18-105(7)">(7)</xref> does not apply to the probation of an individual convicted of an <ln numlevel="1" lineno="759" slineno="9-99"/>offense for criminal nonsupport under Section <xref depth="3" refnumber="76-7-201">76-7-201</xref>.</subsection></subsection><subsection ssid="33-null-51" dnum="8-o" numlevel="1" lineno="760" slineno="9-100" level="1" space="false"><display>(8)</display><subsection ssid="33-null-52" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Notwithstanding Subsection <xref depth="4" refnumber="77-18-105(7)">(7)</xref>, if there is an unpaid balance of the criminal <ln numlevel="1" lineno="761" slineno="9-101"/>accounts receivable for the defendant upon termination of the probation period for <ln numlevel="1" lineno="762" slineno="9-102"/>the defendant under Subsection <xref depth="4" refnumber="77-18-105(7)">(7)</xref>, the court may require the defendant to continue <ln numlevel="1" lineno="763" slineno="9-103"/>to make payments towards the criminal accounts receivable in accordance with the <ln numlevel="1" lineno="764" slineno="9-104"/>payment schedule established by the court under Section <xref depth="3" refnumber="77-32b-103">77-32b-103</xref>.</subsection><subsection ssid="33-null-53" dnum="b-o" numlevel="1" lineno="765" slineno="9-105" level="2"><display>(b)</display>A court may not require the defendant to make payments as described in Subsection <xref depth="4" refnumber="77-18-105(8)(a)"><ln numlevel="1" lineno="766" slineno="9-106"/>(8)(a)</xref> beyond the expiration of the defendant's sentence.</subsection><subsection ssid="33-null-54" dnum="c-o" numlevel="1" lineno="767" slineno="9-107" level="2"><display>(c)</display>If the court requires a defendant to continue to pay in accordance with the payment <ln numlevel="1" lineno="768" slineno="9-108"/>schedule for the criminal accounts receivable under this Subsection <xref depth="4" refnumber="77-18-105(8)">(8)</xref> and the <ln numlevel="1" lineno="769" slineno="9-109"/>defendant defaults on the criminal accounts receivable, the court shall proceed with <ln numlevel="1" lineno="770" slineno="9-110"/>an order for a civil judgment of restitution and a civil accounts receivable for the <ln numlevel="1" lineno="771" slineno="9-111"/>defendant as described in Section <xref depth="3" refnumber="77-18-114">77-18-114</xref>.</subsection><subsection ssid="33-null-55" dnum="d-o" numlevel="1" lineno="772" slineno="9-112" level="2" space="false"><display>(d)</display><subsection ssid="33-null-56" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Upon a motion from the prosecuting attorney, the victim, or upon the court's <ln numlevel="1" lineno="773" slineno="9-113"/>own motion, the court may require a defendant to show cause as to why the <ln numlevel="1" lineno="774" slineno="9-114"/>defendant's failure to pay in accordance with the payment schedule should not be <ln numlevel="1" lineno="775" slineno="9-115"/>treated as contempt of court.</subsection><subsection ssid="33-null-57" dnum="ii-o" numlevel="1" lineno="776" slineno="9-116" level="3"><display>(ii)</display>A court may hold a defendant in contempt for failure to make payments for a <ln numlevel="1" lineno="777" slineno="9-117"/>criminal accounts receivable in accordance with Title <xref depth="2" refnumber="78B-6-3">78B, Chapter 6, Part 3</xref>, <ln numlevel="1" lineno="778" slineno="9-118"/>Contempt.</subsection></subsection><subsection ssid="33-null-58" dnum="e-o" numlevel="1" lineno="779" slineno="9-119" level="2"><display>(e)</display>This Subsection <xref depth="4" refnumber="77-18-105(8)">(8)</xref> does not apply to the probation of an individual convicted of an <ln numlevel="1" lineno="780" slineno="9-120"/>offense for criminal nonsupport under Section <xref depth="3" refnumber="76-7-201">76-7-201</xref>.</subsection></subsection><subsection ssid="33-null-59" dnum="9-o" numlevel="1" lineno="781" slineno="9-121" level="1"><display>(9)</display>When making any decision regarding probation:<subsection ssid="33-null-60" dnum="a-o" numlevel="1" lineno="782" slineno="9-122" level="2"><display>(a)</display>the court shall consider information provided by the Department of Corrections <ln numlevel="1" lineno="783" slineno="9-123"/>regarding a defendant's individual case action plan, including any progress the <ln numlevel="1" lineno="784" slineno="9-124"/>defendant has made in satisfying the case action plan's completion requirements; and</subsection><subsection ssid="33-null-61" dnum="b-o" numlevel="1" lineno="785" slineno="9-125" level="2"><display>(b)</display>the court may not rely solely on an algorithm or a risk assessment tool score.</subsection></subsection></section></bsec><bsec buid="31" num="77-27-10" type="amend" src="code" uid="C77-27-S10_2026050620260506" sort="77 27 00100020260506" numlevel="1" lineno="786" slineno="10-1" sn="10"><section number="77-27-10" numlevel="1" lineno="787" slineno="10-2" type="amend"><secline lineno="786">Section 10, Section <bold>77-27-10</bold> is amended to read:</secline><catline lineno="787"><bold>77-27-10. Conditions of parole -- Inmate agreement to warrant -- Rulemaking -- <ln numlevel="1" lineno="788" slineno="10-3"/>Intensive early release parole program.</bold></catline><subsection ssid="31-null-1" dnum="1-o" numlevel="1" lineno="789" slineno="10-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="31-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>When the Board of Pardons and Parole releases an offender on parole, it shall, in <ln numlevel="1" lineno="790" slineno="10-5"/>accordance with Section <xref depth="3" refnumber="64-14-204">64-14-204</xref>, issue to the parolee a certificate setting forth the <ln numlevel="1" lineno="791" slineno="10-6"/>conditions of parole, including the graduated and evidence-based responses to a <ln numlevel="1" lineno="792" slineno="10-7"/>violation of a condition of parole established in the adult sentencing and supervision <ln numlevel="1" lineno="793" slineno="10-8"/>length guidelines, as defined in Section <xref depth="3" refnumber="63M-7-401.1">63M-7-401.1</xref>, which the offender shall accept <ln numlevel="1" lineno="794" slineno="10-9"/>and agree to as evidenced by the offender's signature affixed to the agreement.</subsection><subsection ssid="31-null-3" dnum="b-o" numlevel="1" lineno="795" slineno="10-10" level="2"><display>(b)</display>The parole agreement shall require that the inmate agree in writing that the board <ln numlevel="1" lineno="796" slineno="10-11"/>may issue a warrant and conduct a parole revocation hearing if:<subsection ssid="31-null-4" dnum="i-o" numlevel="1" lineno="797" slineno="10-12" level="3"><display>(i)</display>the board determines after the grant of parole that the inmate willfully provided to <ln numlevel="1" lineno="798" slineno="10-13"/>the board false or inaccurate information that the board finds was significant in the <ln numlevel="1" lineno="799" slineno="10-14"/>board's determination to grant parole; or</subsection><subsection ssid="31-null-5" dnum="ii-o" numlevel="1" lineno="800" slineno="10-15" level="3" space="false"><display>(ii)</display><subsection ssid="31-null-6" dnum="A-o" level="4" placement="sameline"><display>(A)</display>the inmate has engaged in criminal conduct prior to the granting of parole; <ln numlevel="1" lineno="801" slineno="10-16"/>and</subsection><subsection ssid="31-null-7" dnum="B-o" numlevel="1" lineno="802" slineno="10-17" level="4"><display>(B)</display>the board did not have information regarding the conduct at the time parole <ln numlevel="1" lineno="803" slineno="10-18"/>was granted.</subsection></subsection></subsection><subsection ssid="31-null-8" dnum="c-o" numlevel="1" lineno="804" slineno="10-19" level="2" space="false"><display>(c)</display><subsection ssid="31-null-9" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A copy of the agreement shall be delivered to the Department of Corrections <ln numlevel="1" lineno="805" slineno="10-20"/>and a copy shall be given to the parolee. </subsection><subsection ssid="31-null-10" dnum="ii-o" numlevel="1" lineno="806" slineno="10-21" level="3"><display>(ii)</display> The original agreement shall remain with the board's file.</subsection></subsection></subsection><subsection ssid="31-null-11" dnum="2-o" numlevel="1" lineno="807" slineno="10-22" level="1" space="false"><display>(2)</display><subsection ssid="31-null-12" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If an offender convicted of violating or attempting to violate Section <xref depth="3" refnumber="76-5-301.1">76-5-301.1</xref>, <xref depth="3" refnumber="76-5-302"><ln numlevel="1" lineno="808" slineno="10-23"/>76-5-302</xref>, <xref depth="3" refnumber="76-5-402">76-5-402</xref>, <xref depth="3" refnumber="76-5-402.1">76-5-402.1</xref>, <xref depth="3" refnumber="76-5-402.2">76-5-402.2</xref>, <xref depth="3" refnumber="76-5-402.3">76-5-402.3</xref>, <xref depth="3" refnumber="76-5-403">76-5-403</xref>, <xref depth="3" refnumber="76-5-403.1">76-5-403.1</xref>, <xref depth="3" refnumber="76-5-404"><ln numlevel="1" lineno="809" slineno="10-24"/>76-5-404</xref>, <xref depth="3" refnumber="76-5-404.1">76-5-404.1</xref>, <xref depth="3" refnumber="76-5-404.3">76-5-404.3</xref>, or <xref depth="3" refnumber="76-5-405">76-5-405</xref>, is released on parole, the board shall <ln numlevel="1" lineno="810" slineno="10-25"/>order outpatient mental health counseling and treatment as a condition of parole.</subsection><subsection ssid="31-null-13" dnum="b-o" numlevel="1" lineno="811" slineno="10-26" level="2"><display>(b)</display>The board shall develop standards and conditions of parole under this Subsection <xref depth="4" refnumber="77-27-10(2)">(2)</xref> <ln numlevel="1" lineno="812" slineno="10-27"/>in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act.</subsection><subsection ssid="31-null-14" dnum="c-o" numlevel="1" lineno="813" slineno="10-28" level="2"><display>(c)</display>This Subsection <xref depth="4" refnumber="77-27-10(2)">(2)</xref> does not apply to intensive early release parole.</subsection></subsection><subsection ssid="31-null-15" dnum="3-o" numlevel="1" lineno="814" slineno="10-29" level="1" space="false"><display>(3)</display><subsection ssid="31-null-16" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="31-null-17" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>In addition to the conditions set out in Subsection <xref depth="4" refnumber="77-27-10(1)">(1)</xref>, the board may place <ln numlevel="1" lineno="815" slineno="10-30"/>offenders in an intensive early release parole program. </subsection><subsection ssid="31-null-18" dnum="ii-o" numlevel="1" lineno="816" slineno="10-31" level="3" tab="1"><display>(ii)</display>The board shall determine the conditions of parole which are reasonably <ln numlevel="1" lineno="817" slineno="10-32"/>necessary to protect the community as well as to protect the interests of the <ln numlevel="1" lineno="818" slineno="10-33"/>offender and to assist the offender to lead a law-abiding life.</subsection></subsection><subsection ssid="31-null-19" dnum="b-o" numlevel="1" lineno="819" slineno="10-34" level="2"><display>(b)</display>The offender is eligible for this program only if the offender:<subsection ssid="31-null-20" dnum="i-o" numlevel="1" lineno="820" slineno="10-35" level="3"><display>(i)</display>has not been convicted of a sexual offense; or</subsection><subsection ssid="31-null-21" dnum="ii-o" numlevel="1" lineno="821" slineno="10-36" level="3"><display>(ii)</display>has not been sentenced <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="6" groupid="6" style="2" owner="jchristopherson" level="1" deltag="both">pursuant to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="5" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">in accordance with</amend> Section <xref depth="3" refnumber="76-3-406">76-3-406</xref>.</subsection></subsection><subsection ssid="31-null-22" dnum="c-o" numlevel="1" lineno="822" slineno="10-37" level="2"><display>(c)</display>The department shall:<subsection ssid="31-null-23" dnum="i-o" numlevel="1" lineno="823" slineno="10-38" level="3"><display>(i)</display>make rules in accordance with Title 63G, Chapter 3, Utah Administrative <ln numlevel="1" lineno="824" slineno="10-39"/>Rulemaking Act, for operation of the program;</subsection><subsection ssid="31-null-24" dnum="ii-o" numlevel="1" lineno="825" slineno="10-40" level="3"><display>(ii)</display>adopt and implement internal management policies for operation of the program;</subsection><subsection ssid="31-null-25" dnum="iii-o" numlevel="1" lineno="826" slineno="10-41" level="3"><display>(iii)</display>determine whether <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="7" groupid="7" style="2" owner="jchristopherson" level="1" deltag="both">or not </amend><amendoutend style="2"/>to refer an offender into this program within 120 days <ln numlevel="1" lineno="827" slineno="10-42"/>from the date the offender is committed to prison by the sentencing court; and</subsection><subsection ssid="31-null-26" dnum="iv-o" numlevel="1" lineno="828" slineno="10-43" level="3"><display>(iv)</display>make the final recommendation to the board regarding the placement of an <ln numlevel="1" lineno="829" slineno="10-44"/>offender into the program.</subsection></subsection><subsection ssid="31-null-27" dnum="d-o" numlevel="1" lineno="830" slineno="10-45" level="2"><display>(d)</display>The department may not consider credit for time served in a county jail awaiting trial <ln numlevel="1" lineno="831" slineno="10-46"/>or sentencing when calculating the 120-day period.</subsection><subsection ssid="31-null-28" dnum="e-o" numlevel="1" lineno="832" slineno="10-47" level="2"><display>(e)</display>The prosecuting attorney or sentencing court may refer an offender for consideration <ln numlevel="1" lineno="833" slineno="10-48"/>by the department for participation in the program.</subsection><subsection ssid="31-null-29" dnum="f-o" numlevel="1" lineno="834" slineno="10-49" level="2"><display>(f)</display>The board shall determine whether <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="8" groupid="8" style="2" owner="jchristopherson" level="1" deltag="both">or not </amend><amendoutend style="2"/>to place an offender into this program <ln numlevel="1" lineno="835" slineno="10-50"/>within 30 days of receiving the department's recommendation.</subsection></subsection><subsection ssid="31-null-30" dnum="4-o" numlevel="1" lineno="836" slineno="10-51" level="1"><display>(4)</display>This program shall be implemented by the department within the existing budget.</subsection><subsection ssid="31-null-31" dnum="5-o" numlevel="1" lineno="837" slineno="10-52" level="1"><display>(5)</display>In addition to the conditions of parole described in this section, and if a condition of the <ln numlevel="1" lineno="838" slineno="10-53"/>offender's parole is routine or random drug testing, the board shall order the offender to <ln numlevel="1" lineno="839" slineno="10-54"/>sign a waiver<amend anum="0" ea="amend" pairid="10" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both">,</amend> <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both">consistent with the Health Insurance Portability and Accountability Act, <ln numlevel="1" lineno="840" slineno="10-55"/>42 U.S.C. Sec. 1320d et seq., allowing</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">in compliance with federal health information <ln numlevel="1" lineno="841" slineno="10-56"/>disclosure laws, that allows</amend> the treatment provider conducting the drug testing to notify <ln numlevel="1" lineno="842" slineno="10-57"/>the offender's supervising parole officer regarding the results of the offender's drug <ln numlevel="1" lineno="843" slineno="10-58"/>testing.</subsection><subsection ssid="31-null-32" dnum="6-o" numlevel="1" lineno="844" slineno="10-59" level="1"><display>(6)</display>During the time the offender is on parole, the department shall collect from the offender <ln numlevel="1" lineno="845" slineno="10-60"/>the monthly supervision fee authorized by Section <xref depth="3" refnumber="64-14-204">64-14-204</xref>.</subsection><subsection ssid="31-null-33" dnum="7-o" numlevel="1" lineno="846" slineno="10-61" level="1"><display>(7)</display>When a parolee commits a violation of the parole agreement, the department may:<subsection ssid="31-null-34" dnum="a-o" numlevel="1" lineno="847" slineno="10-62" level="2"><display>(a)</display>respond in accordance with the graduated and evidence-based responses established <ln numlevel="1" lineno="848" slineno="10-63"/>in accordance with Section <xref depth="3" refnumber="64-14-204">64-14-204</xref>; or</subsection><subsection ssid="31-null-35" dnum="b-o" numlevel="1" lineno="849" slineno="10-64" level="2"><display>(b)</display>when the graduated and evidence-based responses established in accordance with <ln numlevel="1" lineno="850" slineno="10-65"/>Section <xref depth="3" refnumber="64-14-204">64-14-204</xref> indicate, refer the parolee to the Board of Pardons and Parole for <ln numlevel="1" lineno="851" slineno="10-66"/>revocation of parole.</subsection></subsection></section></bsec><bsec buid="36" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="852" slineno="11-1" sn="11"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="852">Section 11.  <bold>Effective Date.</bold></secline><sectionText lineno="853"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>1-12-26 3:00 PM</tm></rev></foot></leg>
