Section <bold>26B-3-114</bold> is amended to read:</secline><catline lineno="21"><bold>26B-3-114<parens/>. Department standards for eligibility under Medicaid -- Funds for <ln numlevel="1" lineno="22" slineno="1-3"/>abortions.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="23" slineno="1-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="1-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The department <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="7" groupid="6" style="2" owner="jchristopherson" level="1" deltag="both">may</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">shall</amend> develop standards and administer policies relating to <ln numlevel="1" lineno="24" slineno="1-5"/>eligibility under the Medicaid program if the standards and policies comply with <ln numlevel="1" lineno="25" slineno="1-6"/>Section <xref depth="3" refnumber="26B-3-108">26B-3-108</xref>.</subsection><subsection ssid="1-7" dnum="_-o:b-i" numlevel="1" lineno="26" slineno="1-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1002" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="5" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="end">Except as provided in Subsection <xref depth="4" refnumber="26B-3-114(1)(c)">(1)(c)</xref>, under the standards established in <ln numlevel="1" lineno="27" slineno="1-8"/>accordance with Subsection <xref depth="4" refnumber="26B-3-114(1)(a)">(1)(a)</xref>, a provider or a provider's affiliate may not be an <ln numlevel="1" lineno="28" slineno="1-9"/>eligible Medicaid provider if the provider or the provider's affiliate:</amend><subsection ssid="1-8" dnum="_-o:i-i" numlevel="1" lineno="29" slineno="1-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1003" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="end">performs an elective abortion, as that term is defined in Section <xref depth="3" refnumber="76-7-301">76-7-301</xref>; and</amend></subsection><subsection ssid="1-9" dnum="_-o:ii-i" numlevel="1" lineno="30" slineno="1-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1004" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="end">has an annual revenue of $500,000,000.</amend></subsection></subsection><subsection ssid="1-11" dnum="_-o:c-i" numlevel="1" lineno="31" slineno="1-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="24" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="end">The restriction described in Subsection <xref depth="4" refnumber="26B-3-114(1)(b)">(1)(b)</xref> does not apply to a hospital.</amend></subsection></subsection><subsection ssid="1-null-3" dnum="b-o:2-i" numlevel="1" lineno="32" slineno="1-13" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1006" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="both" space="true">(2)</amend></display>An applicant receiving Medicaid assistance may be limited to particular types of <ln numlevel="1" lineno="33" slineno="1-14"/>care or services or to payment of part or all costs of care determined to be medically <ln numlevel="1" lineno="34" slineno="1-15"/>necessary.</subsection><subsection ssid="1-null-4" dnum="2-o:3-i" numlevel="1" lineno="35" slineno="1-16" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1007" style="2" owner="o" level="1" deltag="both">(2)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="both" space="true">(3)</amend></display>The department may not provide any funds for medical, hospital, or other medical <ln numlevel="1" lineno="36" slineno="1-17"/>expenditures or medical services to otherwise eligible persons where the purpose of the <ln numlevel="1" lineno="37" slineno="1-18"/>assistance is to perform an abortion, unless the life of the mother would be endangered if <ln numlevel="1" lineno="38" slineno="1-19"/>an abortion were not performed.</subsection><subsection ssid="1-null-5" dnum="3-o:4-i" numlevel="1" lineno="39" slineno="1-20" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1008" style="2" owner="o" level="1" deltag="both">(3)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="both" space="true">(4)</amend></display>Any employee of the department who authorizes payment for an abortion contrary <ln numlevel="1" lineno="40" slineno="1-21"/>to the provisions of this section is guilty of a class B misdemeanor and subject to <ln numlevel="1" lineno="41" slineno="1-22"/>forfeiture of office.</subsection><subsection ssid="1-null-6" dnum="4-o:5-i" numlevel="1" lineno="42" slineno="1-23" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1009" style="2" owner="o" level="1" deltag="both">(4)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="both" space="true">(5)</amend></display>Any person or organization that, under the guise of other medical treatment, <ln numlevel="1" lineno="43" slineno="1-24"/>provides an abortion under auspices of the Medicaid program is guilty of a third degree <ln numlevel="1" lineno="44" slineno="1-25"/>felony and subject to forfeiture of license to practice medicine or authority to provide <ln numlevel="1" lineno="45" slineno="1-26"/>medical services and treatment.</subsection></section></bsec><bsec buid="3" num="76-7-301" type="amend" src="code" uid="C76-7-S301_2026050620260506" sort="76 07 03010020260506" numlevel="1" lineno="46" slineno="2-1" sn="2"><section number="76-7-301" numlevel="1" lineno="47" slineno="2-2" type="amend"><secline lineno="46">Section 2. Section <bold>76-7-301</bold> is amended to read:</secline><catline lineno="47"><bold>76-7-301<parens/>. Definitions.</bold></catline><sectionText lineno="48"><tab/>As used in this part:</sectionText><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="49" slineno="2-4" level="1" space="false"><display>(1)</display><subsection ssid="3-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Abortion" means the act, by a physician, of using an instrument, or prescribing a <ln numlevel="1" lineno="50" slineno="2-5"/>drug, with the intent to cause the death of an unborn child of a woman known to be <ln numlevel="1" lineno="51" slineno="2-6"/>pregnant, except as permitted under this part.</subsection><subsection ssid="3-null-3" dnum="b-o" numlevel="1" lineno="52" slineno="2-7" level="2"><display>(b)</display>"Abortion" does not include:<subsection ssid="3-null-4" dnum="i-o" numlevel="1" lineno="53" slineno="2-8" level="3"><display>(i)</display>removal of a dead unborn child;</subsection><subsection ssid="3-null-5" dnum="ii-o" numlevel="1" lineno="54" slineno="2-9" level="3"><display>(ii)</display>removal of an ectopic pregnancy; or</subsection><subsection ssid="3-null-6" dnum="iii-o" numlevel="1" lineno="55" slineno="2-10" level="3"><display>(iii)</display>the killing or attempted killing of an unborn child without the consent of the <ln numlevel="1" lineno="56" slineno="2-11"/>pregnant woman, unless:<subsection ssid="3-null-7" dnum="A-o" numlevel="1" lineno="57" slineno="2-12" level="4"><display>(A)</display>the killing or attempted killing is done through a medical procedure carried <ln numlevel="1" lineno="58" slineno="2-13"/>out by a physician or through a substance used under the direction of a <ln numlevel="1" lineno="59" slineno="2-14"/>physician; and</subsection><subsection ssid="3-null-8" dnum="B-o" numlevel="1" lineno="60" slineno="2-15" level="4"><display>(B)</display>the physician is unable to obtain the consent due to a medical emergency.</subsection></subsection></subsection></subsection><subsection ssid="3-null-9" dnum="2-o" numlevel="1" lineno="61" slineno="2-16" level="1"><display>(2)</display>"Abortion clinic" means the same as that term is defined in Section <xref depth="3" refnumber="26B-2-201">26B-2-201</xref>.</subsection><subsection ssid="3-null-10" dnum="3-o" numlevel="1" lineno="62" slineno="2-17" level="1"><display>(3)</display>"Abuse" means the same as that term is defined in Section <xref depth="3" refnumber="80-1-102">80-1-102</xref>.</subsection><subsection ssid="3-null-11" dnum="4-o" numlevel="1" lineno="63" slineno="2-18" level="1"><display>(4)</display>"Department" means the Department of Health and Human Services.</subsection><subsection ssid="3-null-12" dnum="5-o" numlevel="1" lineno="64" slineno="2-19" level="1"><display>(5)</display>"Down syndrome" means a genetic condition associated with an extra chromosome 21, <ln numlevel="1" lineno="65" slineno="2-20"/>in whole or in part, or an effective trisomy for chromosome 21.</subsection><subsection ssid="3-50" dnum="_-o:6-i" numlevel="1" lineno="66" slineno="2-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1022" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">"Elective abortion" means an abortion other than:</amend><subsection ssid="3-51" dnum="_-o:a-i" numlevel="1" lineno="67" slineno="2-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1023" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="10" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="end">removal of a dead fetus;</amend></subsection><subsection ssid="3-52" dnum="_-o:b-i" numlevel="1" lineno="68" slineno="2-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1024" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="15" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">removal of an ectopic pregnancy;</amend></subsection><subsection ssid="3-53" dnum="_-o:c-i" numlevel="1" lineno="69" slineno="2-24" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1025" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="20" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="end">an abortion that is necessary to avert the death of a woman;</amend></subsection><subsection ssid="3-54" dnum="_-o:d-i" numlevel="1" lineno="70" slineno="2-25" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1026" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="25" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="end">an abortion that is necessary to avert a serious physical risk of substantial impairment <ln numlevel="1" lineno="71" slineno="2-26"/>of a major bodily function of a woman;</amend></subsection><subsection ssid="3-55" dnum="_-o:e-i" numlevel="1" lineno="72" slineno="2-27" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1027" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="30" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="end">an abortion of a fetus that has a defect that is uniformly diagnosable and uniformly <ln numlevel="1" lineno="73" slineno="2-28"/>lethal; or</amend></subsection><subsection ssid="3-56" dnum="_-o:f-i" numlevel="1" lineno="74" slineno="2-29" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1028" style="1" owner="i" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="35" groupid="28" style="1" owner="jchristopherson" level="1" amendtag="end">an abortion where the woman is pregnant as a result of rape or incest.</amend></subsection></subsection><subsection ssid="3-null-13" dnum="6-o:7-i" numlevel="1" lineno="75" slineno="2-30" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1029" style="2" owner="o" level="1" deltag="both">(6)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1030" style="1" owner="i" level="1" amendtag="both" space="true">(7)</amend></display>"Gestational age" means the age of an unborn child as calculated from the first day <ln numlevel="1" lineno="76" slineno="2-31"/>of the last menstrual period of the pregnant woman.</subsection><subsection ssid="3-null-14" dnum="7-o:8-i" numlevel="1" lineno="77" slineno="2-32" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1030" style="2" owner="o" level="1" deltag="both">(7)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1031" style="1" owner="i" level="1" amendtag="both" space="true">(8)</amend></display>"Hospital" means:<subsection ssid="3-null-15" dnum="a-o" numlevel="1" lineno="78" slineno="2-33" level="2"><display>(a)</display>a general hospital licensed by the department according to Title 26B, Chapter 2, Part <ln numlevel="1" lineno="79" slineno="2-34"/>2, Health Care Facility Licensing and Inspection; and</subsection><subsection ssid="3-null-16" dnum="b-o" numlevel="1" lineno="80" slineno="2-35" level="2"><display>(b)</display>a clinic or other medical facility to the extent that such clinic or other medical facility <ln numlevel="1" lineno="81" slineno="2-36"/>is certified by the department as providing equipment and personnel sufficient in <ln numlevel="1" lineno="82" slineno="2-37"/>quantity and quality to provide the same degree of safety to the pregnant woman and <ln numlevel="1" lineno="83" slineno="2-38"/>the unborn child as would be provided for the particular medical procedures <ln numlevel="1" lineno="84" slineno="2-39"/>undertaken by a general hospital licensed by the department.</subsection></subsection><subsection ssid="3-null-17" dnum="8-o:9-i" numlevel="1" lineno="85" slineno="2-40" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1033" style="2" owner="o" level="1" deltag="both">(8)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1034" style="1" owner="i" level="1" amendtag="both" space="true">(9)</amend></display>"Information module" means the pregnancy termination information module <ln numlevel="1" lineno="86" slineno="2-41"/>prepared by the department.</subsection><subsection ssid="3-null-18" dnum="9-o:10-i" numlevel="1" lineno="87" slineno="2-42" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1034" style="2" owner="o" level="1" deltag="both">(9)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1035" style="1" owner="i" level="1" amendtag="both" space="true">(10)</amend></display>"Medical emergency" means a life threatening physical condition aggravated by, <ln numlevel="1" lineno="88" slineno="2-43"/>caused by, or arising from a pregnancy that places the pregnant woman at risk of death, <ln numlevel="1" lineno="89" slineno="2-44"/>or poses a serious risk of substantial impairment of a major bodily function, unless the <ln numlevel="1" lineno="90" slineno="2-45"/>abortion is performed or induced.</subsection><subsection ssid="3-null-19" dnum="10-o:11-i" numlevel="1" lineno="91" slineno="2-46" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1035" style="2" owner="o" level="1" deltag="both">(10)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1036" style="1" owner="i" level="1" amendtag="both" space="true">(11)</amend></display>"Minor" means an individual who is:<subsection ssid="3-null-20" dnum="a-o" numlevel="1" lineno="92" slineno="2-47" level="2"><display>(a)</display>under 18 years old;</subsection><subsection ssid="3-null-21" dnum="b-o" numlevel="1" lineno="93" slineno="2-48" level="2"><display>(b)</display>unmarried; and</subsection><subsection ssid="3-null-22" dnum="c-o" numlevel="1" lineno="94" slineno="2-49" level="2"><display>(c)</display>not emancipated.</subsection></subsection><subsection ssid="3-null-23" dnum="11-o:12-i" numlevel="1" lineno="95" slineno="2-50" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1039" style="2" owner="o" level="1" deltag="both">(11)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1040" style="1" owner="i" level="1" amendtag="both" space="true">(12)</amend></display><subsection ssid="3-null-24" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Partial birth abortion" means an abortion in which the person performing <ln numlevel="1" lineno="96" slineno="2-51"/>the abortion:<subsection ssid="3-null-25" dnum="i-o" numlevel="1" lineno="97" slineno="2-52" level="3" tab="1"><display>(i)</display>deliberately and intentionally vaginally delivers a living fetus until, in the case of a <ln numlevel="1" lineno="98" slineno="2-53"/>head first presentation, the entire fetal head is outside the body of the mother, or, <ln numlevel="1" lineno="99" slineno="2-54"/>in the case of breech presentation, any part of the fetal trunk past the navel is <ln numlevel="1" lineno="100" slineno="2-55"/>outside the body of the mother, for the purpose of performing an overt act that the <ln numlevel="1" lineno="101" slineno="2-56"/>person knows will kill the partially delivered living fetus; and</subsection><subsection ssid="3-null-26" dnum="ii-o" numlevel="1" lineno="102" slineno="2-57" level="3" tab="1"><display>(ii)</display>performs the overt act, other than completion of delivery, that kills the partially <ln numlevel="1" lineno="103" slineno="2-58"/>living fetus.</subsection></subsection><subsection ssid="3-null-27" dnum="b-o" numlevel="1" lineno="104" slineno="2-59" level="2"><display>(b)</display>"Partial birth abortion" does not include the dilation and evacuation procedure <ln numlevel="1" lineno="105" slineno="2-60"/>involving dismemberment prior to removal, the suction curettage procedure, or the <ln numlevel="1" lineno="106" slineno="2-61"/>suction aspiration procedure for abortion.</subsection></subsection><subsection ssid="3-null-28" dnum="12-o:13-i" numlevel="1" lineno="107" slineno="2-62" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1044" style="2" owner="o" level="1" deltag="both">(12)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1045" style="1" owner="i" level="1" amendtag="both" space="true">(13)</amend></display>"Perinatal hospice" means comprehensive support to the mother and her family <ln numlevel="1" lineno="108" slineno="2-63"/>from the time of the diagnosis of a lethal fetal anomaly, through the time of the child's <ln numlevel="1" lineno="109" slineno="2-64"/>birth, and through the postpartum period, that:<subsection ssid="3-null-29" dnum="a-o" numlevel="1" lineno="110" slineno="2-65" level="2"><display>(a)</display>focuses on alleviating fear and ensuring that the woman and her family experience <ln numlevel="1" lineno="111" slineno="2-66"/>the life and death of a child in a comfortable and supportive environment; and</subsection><subsection ssid="3-null-30" dnum="b-o" numlevel="1" lineno="112" slineno="2-67" level="2"><display>(b)</display>may include counseling or medical care by:<subsection ssid="3-null-31" dnum="i-o" numlevel="1" lineno="113" slineno="2-68" level="3"><display>(i)</display>maternal-fetal medical specialists;</subsection><subsection ssid="3-null-32" dnum="ii-o" numlevel="1" lineno="114" slineno="2-69" level="3"><display>(ii)</display>obstetricians;</subsection><subsection ssid="3-null-33" dnum="iii-o" numlevel="1" lineno="115" slineno="2-70" level="3"><display>(iii)</display>neonatologists;</subsection><subsection ssid="3-null-34" dnum="iv-o" numlevel="1" lineno="116" slineno="2-71" level="3"><display>(iv)</display>anesthesia specialists;</subsection><subsection ssid="3-null-35" dnum="v-o" numlevel="1" lineno="117" slineno="2-72" level="3"><display>(v)</display>psychiatrists, psychologists, or other mental health providers;</subsection><subsection ssid="3-null-36" dnum="vi-o" numlevel="1" lineno="118" slineno="2-73" level="3"><display>(vi)</display>clergy;</subsection><subsection ssid="3-null-37" dnum="vii-o" numlevel="1" lineno="119" slineno="2-74" level="3"><display>(vii)</display>social workers; or</subsection><subsection ssid="3-null-38" dnum="viii-o" numlevel="1" lineno="120" slineno="2-75" level="3"><display>(viii)</display>specialty nurses.</subsection></subsection></subsection><subsection ssid="3-null-39" dnum="13-o:14-i" numlevel="1" lineno="121" slineno="2-76" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1055" style="2" owner="o" level="1" deltag="both">(13)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1056" style="1" owner="i" level="1" amendtag="both" space="true">(14)</amend></display>"Physician" means:<subsection ssid="3-null-40" dnum="a-o" numlevel="1" lineno="122" slineno="2-77" level="2"><display>(a)</display>a medical doctor licensed to practice medicine and surgery under Title 58, Chapter 67, <ln numlevel="1" lineno="123" slineno="2-78"/>Utah Medical Practice Act;</subsection><subsection ssid="3-null-41" dnum="b-o" numlevel="1" lineno="124" slineno="2-79" level="2"><display>(b)</display>an osteopathic physician licensed to practice osteopathic medicine under Title 58, <ln numlevel="1" lineno="125" slineno="2-80"/>Chapter 68, Utah Osteopathic Medical Practice Act; or</subsection><subsection ssid="3-null-42" dnum="c-o" numlevel="1" lineno="126" slineno="2-81" level="2"><display>(c)</display>a physician employed by the federal government who has qualifications similar to an <ln numlevel="1" lineno="127" slineno="2-82"/>individual described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="38" groupid="31" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="76-7-301(13)(a)">(13)(a)</xref> or <xref depth="4" refnumber="76-7-301(b)">(b)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="37" groupid="30" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(14)(a) or (b)</amend>.</subsection></subsection><subsection ssid="3-null-43" dnum="14-o:15-i" numlevel="1" lineno="128" slineno="2-83" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1059" style="2" owner="o" level="1" deltag="both">(14)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1060" style="1" owner="i" level="1" amendtag="both" space="true">(15)</amend></display><subsection ssid="3-null-44" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Severe brain abnormality" means a malformation or defect that causes an <ln numlevel="1" lineno="129" slineno="2-84"/>individual to live in a mentally vegetative state.</subsection><subsection ssid="3-null-45" dnum="b-o" numlevel="1" lineno="130" slineno="2-85" level="2"><display>(b)</display>"Severe brain abnormality" does not include:<subsection ssid="3-null-46" dnum="i-o" numlevel="1" lineno="131" slineno="2-86" level="3"><display>(i)</display>Down syndrome;</subsection><subsection ssid="3-null-47" dnum="ii-o" numlevel="1" lineno="132" slineno="2-87" level="3"><display>(ii)</display>spina bifida;</subsection><subsection ssid="3-null-48" dnum="iii-o" numlevel="1" lineno="133" slineno="2-88" level="3"><display>(iii)</display>cerebral palsy; or</subsection><subsection ssid="3-null-49" dnum="iv-o" numlevel="1" lineno="134" slineno="2-89" level="3"><display>(iv)</display>any other malformation, defect, or condition that does not cause an individual to <ln numlevel="1" lineno="135" slineno="2-90"/>live in a mentally vegetative state.</subsection></subsection></subsection></section></bsec><bsec buid="4" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="136" slineno="3-1" sn="3"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="136">Section 3.  <bold>Effective Date.</bold></secline><sectionText lineno="137"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>1-12-26 3:08 PM</tm></rev></foot></leg>
