Section <bold>53E-1-102</bold> is amended to read:</secline><catline lineno="33"><bold>53E-1-102<parens/>. Public education code definitions.</bold></catline><sectionText lineno="34"><tab/>Unless otherwise indicated, as used in this title, <xref depth="0" refnumber="53F" start="0">Title 53F, Public Education System -- <ln numlevel="1" lineno="35" slineno="1-4"/>Funding</xref>, and <xref depth="0" refnumber="53G" start="0">Title 53G, Public Education System -- Local Administration</xref>:</sectionText><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="36" slineno="1-5" level="1"><display>(1)</display>"Bullying" means the same as that term is defined in Section <xref depth="3" refnumber="53G-9-601">53G-9-601</xref>.</subsection><subsection ssid="1-null-2" dnum="2-o" numlevel="1" lineno="37" slineno="1-6" level="1"><display>(2)</display>"Charter agreement" means an agreement made in accordance with Section <xref depth="3" refnumber="53G-5-303" start="0">53G-5-303</xref> <ln numlevel="1" lineno="38" slineno="1-7"/>that authorizes the operation of a charter school.</subsection><subsection ssid="1-null-3" dnum="3-o" numlevel="1" lineno="39" slineno="1-8" level="1"><display>(3)</display>"Charter school governing board" means the board that governs a charter school.</subsection><subsection ssid="1-null-4" dnum="4-o" numlevel="1" lineno="40" slineno="1-9" level="1"><display>(4)</display>"District school" means a public school under the control of a local school board.</subsection><subsection ssid="1-29" dnum="_-o:5-i" numlevel="1" lineno="41" slineno="1-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1004" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="end">"Home-based student" means a school-age student who:</amend><subsection ssid="1-31" dnum="_-o:a-i" numlevel="1" lineno="42" slineno="1-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="end">receives instruction outside of a public school;</amend></subsection><subsection ssid="1-32" dnum="_-o:b-i" numlevel="1" lineno="43" slineno="1-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">is not enrolled full-time in a public school; and</amend></subsection><subsection ssid="1-33" dnum="_-o:c-i" numlevel="1" lineno="44" slineno="1-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="22" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="end">receives, directly or indirectly, public funds to pay for all or part of the student's <ln numlevel="1" lineno="45" slineno="1-14"/>educational expenses, including:</amend><subsection ssid="1-34" dnum="_-o:i-i" numlevel="1" lineno="46" slineno="1-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="27" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="end">scholarship programs under:</amend><subsection ssid="1-45" dnum="_-o:A-i" numlevel="1" lineno="47" slineno="1-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="82" groupid="64" style="1" owner="jchristopherson" level="1" amendtag="end">Title 53E, Chapter 7, Part 4, Carson Smith Opportunity Scholarship;</amend></subsection><subsection ssid="1-46" dnum="_-o:B-i" numlevel="1" lineno="48" slineno="1-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="87" groupid="68" style="1" owner="jchristopherson" level="1" amendtag="end">Title 53F, Chapter 6, Part 4, Utah Fits All Scholarship Program; or</amend></subsection><subsection ssid="1-56" dnum="_-o:B-i" numlevel="1" lineno="54" slineno="1-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1015" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="139" groupid="109" style="1" owner="jchristopherson" level="1" amendtag="end">Title 53F, Chapter 6, Part 5, Utah Private Course Choice Empowerment; or</amend></subsection></subsection><subsection ssid="1-38" dnum="_-o:iv-i" numlevel="1" lineno="55" slineno="1-24" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="47" groupid="36" style="1" owner="jchristopherson" level="1" amendtag="end">any other program using public taxpayer dollars for educational services or <ln numlevel="1" lineno="56" slineno="1-25"/>materials.</amend></subsection></subsection></subsection><subsection ssid="1-47" dnum="_-o:6-i" numlevel="1" lineno="57" slineno="1-26" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1017" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><subsection ssid="1-57" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="88" groupid="69" style="1" owner="jchristopherson" level="1" amendtag="end">"Home school" means an instructional setting in which a school-age child receives <ln numlevel="1" lineno="58" slineno="1-27"/>education as described in Section <xref depth="3" refnumber="53G-6-204">53G-6-204</xref>, where:</amend><subsection ssid="1-48" dnum="_-o:i-i" numlevel="1" lineno="59" slineno="1-28" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1019" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="95" groupid="74" style="1" owner="jchristopherson" level="1" amendtag="end">the child's parent or legal guardian is solely responsible for:</amend><subsection ssid="1-49" dnum="_-o:A-i" numlevel="1" lineno="60" slineno="1-29" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1020" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="100" groupid="78" style="1" owner="jchristopherson" level="1" amendtag="end">curriculum selection;</amend></subsection><subsection ssid="1-50" dnum="_-o:B-i" numlevel="1" lineno="61" slineno="1-30" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1021" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="105" groupid="82" style="1" owner="jchristopherson" level="1" amendtag="end">instructional delivery; and</amend></subsection><subsection ssid="1-51" dnum="_-o:C-i" numlevel="1" lineno="62" slineno="1-31" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1022" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="110" groupid="86" style="1" owner="jchristopherson" level="1" amendtag="end">evaluation of learning; and</amend></subsection></subsection><subsection ssid="1-52" dnum="_-o:ii-i" numlevel="1" lineno="63" slineno="1-32" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1023" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="115" groupid="90" style="1" owner="jchristopherson" level="1" amendtag="end">no public taxpayer funding is used for educational services, materials, or <ln numlevel="1" lineno="64" slineno="1-33"/>instruction.</amend></subsection></subsection><subsection ssid="1-58" dnum="_-o:b-i" numlevel="1" lineno="65" slineno="1-34" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1024" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="145" groupid="112" style="1" owner="jchristopherson" level="1" amendtag="end">"Home school" includes a home-based microschool, as that term is defined in <ln numlevel="1" lineno="66" slineno="1-35"/>Section <xref depth="3" refnumber="53G-6-201">53G-6-201</xref>, and other cooperative educational arrangements, if the <ln numlevel="1" lineno="67" slineno="1-36"/>home-based microschool or other cooperative educational arrangements meet the <ln numlevel="1" lineno="68" slineno="1-37"/>requirements of this subsection.</amend></subsection></subsection><subsection ssid="1-30" dnum="_-o:7-i" numlevel="1" lineno="69" slineno="1-38" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1025" style="1" owner="i" level="1" amendtag="start">(7)</amend></display><amend anum="0" ea="amend" pairid="5" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">"Home school student" means a school-age student who:</amend><subsection ssid="1-39" dnum="_-o:a-i" numlevel="1" lineno="70" slineno="1-39" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1026" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="52" groupid="40" style="1" owner="jchristopherson" level="1" amendtag="end">is excused from enrollment in a public school under Section <xref depth="3" refnumber="53G-6-204">53G-6-204</xref>; and</amend></subsection><subsection ssid="1-40" dnum="_-o:b-i" numlevel="1" lineno="71" slineno="1-40" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1027" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="119" groupid="94" style="1" owner="jchristopherson" level="1" amendtag="end">receives instruction through a home school.</amend></subsection></subsection><subsection ssid="1-null-5" dnum="5-o:8-i" numlevel="1" lineno="72" slineno="1-41" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1028" style="2" owner="o" level="1" deltag="both">(5)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1029" style="1" owner="i" level="1" amendtag="both" space="true">(8)</amend></display>"Individualized education program" or "IEP" means a written statement for a <ln numlevel="1" lineno="73" slineno="1-42"/>student with a disability that is developed, reviewed, and revised in accordance with the <ln numlevel="1" lineno="74" slineno="1-43"/>Individuals with Disabilities Education Act, 20 U.S.C. and</subsection><subsection ssid="1-null-20" dnum="c-o" numlevel="1" lineno="91" slineno="1-60" level="2"><display>(c)</display><xref depth="0" refnumber="53G" start="0">Title 53G, Public Education System -- Local Administration</xref>.</subsection></subsection><subsection ssid="1-null-21" dnum="12-o:15-i" numlevel="1" lineno="92" slineno="1-61" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1044" style="2" owner="o" level="1" deltag="both">(12)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1045" style="1" owner="i" level="1" amendtag="both" space="true">(15)</amend></display>"Section 504 accommodation plan" means a plan developed in accordance with <ln numlevel="1" lineno="93" slineno="1-62"/>Section 504 of the Rehabilitation Act of 1973, 29 U.S.C. Sec. 701 et seq., for a student <ln numlevel="1" lineno="94" slineno="1-63"/>with a disability, to meet the student's educational needs and ensure equitable access to a <ln numlevel="1" lineno="95" slineno="1-64"/>free appropriate public education.</subsection><subsection ssid="1-null-22" dnum="13-o:16-i" numlevel="1" lineno="96" slineno="1-65" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1045" style="2" owner="o" level="1" deltag="both">(13)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1046" style="1" owner="i" level="1" amendtag="both" space="true">(16)</amend></display>"School nurse" means a registered nurse:<subsection ssid="1-null-23" dnum="a-o" numlevel="1" lineno="97" slineno="1-66" level="2"><display>(a)</display>who holds:<subsection ssid="1-null-24" dnum="i-o" numlevel="1" lineno="98" slineno="1-67" level="3"><display>(i)</display>a license under <xref depth="1" refnumber="58-31b" start="0">Title 58, Chapter 31b, Nurse Practice Act</xref>; or</subsection><subsection ssid="1-null-25" dnum="ii-o" numlevel="1" lineno="99" slineno="1-68" level="3"><display>(ii)</display>a multistate license as that term is defined in Section <xref depth="3" refnumber="58-31e-102" start="0">58-31e-102</xref>; and</subsection></subsection><subsection ssid="1-null-26" dnum="b-o" numlevel="1" lineno="100" slineno="1-69" level="2"><display>(b)</display>whose primary role is the care of a defined group of students enrolled in the public <ln numlevel="1" lineno="101" slineno="1-70"/>school system.</subsection></subsection><subsection ssid="1-null-27" dnum="14-o:17-i" numlevel="1" lineno="102" slineno="1-71" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1050" style="2" owner="o" level="1" deltag="both">(14)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1051" style="1" owner="i" level="1" amendtag="both" space="true">(17)</amend></display>"State board" means the State Board of Education.</subsection><subsection ssid="1-null-28" dnum="15-o:18-i" numlevel="1" lineno="103" slineno="1-72" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1051" style="2" owner="o" level="1" deltag="both">(15)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1052" style="1" owner="i" level="1" amendtag="both" space="true">(18)</amend></display>"State superintendent" means the state superintendent of public instruction <ln numlevel="1" lineno="104" slineno="1-73"/>appointed under Section <xref depth="3" refnumber="53E-3-301" start="0">53E-3-301</xref>.</subsection></section></bsec><bsec buid="3" num="53E-7-401" type="amend" src="code" uid="C53E-7-S401_2026050620260506" sort="53E07 04010020260506" numlevel="1" lineno="105" slineno="2-1" sn="2"><section number="53E-7-401" numlevel="1" lineno="106" slineno="2-2" type="amend"><secline lineno="105">Section 2. Section <bold>53E-7-401</bold> is amended to read:</secline><catline lineno="106"><bold>53E-7-401<parens/>. Definitions.</bold></catline><sectionText lineno="107"><tab/>As used in this part:</sectionText><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="108" slineno="2-4" level="1"><display>(1)</display>"The Carson Smith Opportunity Scholarship Program" or "program" means the program <ln numlevel="1" lineno="109" slineno="2-5"/>established in Section <xref depth="3" refnumber="53E-7-402">53E-7-402</xref>.</subsection><subsection ssid="3-null-2" dnum="2-o" numlevel="1" lineno="110" slineno="2-6" level="1"><display>(2)</display>"Eligible student" means:<subsection ssid="3-null-3" dnum="a-o" numlevel="1" lineno="111" slineno="2-7" level="2"><display>(a)</display>a student who:<subsection ssid="3-null-4" dnum="i-o" numlevel="1" lineno="112" slineno="2-8" level="3"><display>(i)</display>is: <subsection ssid="3-null-5" dnum="A-o" numlevel="1" lineno="113" slineno="2-9" level="4"><display>(A)</display>eligible to participate in public school, in kindergarten, or grades 1 through 12;</subsection><subsection ssid="3-null-6" dnum="B-o" numlevel="1" lineno="114" slineno="2-10" level="4"><display>(B)</display>enrolled in a qualifying school as defined in Subsection <xref depth="4" refnumber="53E-7-401(11)">(11)</xref>;</subsection><subsection ssid="3-null-7" dnum="C-o" numlevel="1" lineno="115" slineno="2-11" level="4"><display>(C)</display>a home-based scholarship student as defined in Subsection <xref depth="4" refnumber="53E-7-401(6)">(6)</xref>; or</subsection><subsection ssid="3-null-8" dnum="D-o" numlevel="1" lineno="116" slineno="2-12" level="4"><display>(D)</display>at least three years old before September 2 of the year the scholarship is <ln numlevel="1" lineno="117" slineno="2-13"/>awarded;</subsection></subsection><subsection ssid="3-null-9" dnum="ii-o" numlevel="1" lineno="118" slineno="2-14" level="3"><display>(ii)</display>is a resident of the state;</subsection><subsection ssid="3-null-10" dnum="iii-o" numlevel="1" lineno="119" slineno="2-15" level="3"><display>(iii)</display>has a qualified disability identified under 20 U.S.C. Sec. 140(3) as determined by:<subsection ssid="3-null-11" dnum="A-o" numlevel="1" lineno="120" slineno="2-16" level="4"><display>(A)</display>having an IEP within the previous three years; or</subsection><subsection ssid="3-null-12" dnum="B-o" numlevel="1" lineno="121" slineno="2-17" level="4"><display>(B)</display>a multidisciplinary team evaluation described in Subsection <xref depth="4" refnumber="53E-7-401(7)">(7)</xref>; and</subsection></subsection><subsection ssid="3-null-13" dnum="iv-o" numlevel="1" lineno="122" slineno="2-18" level="3"><display>(iv)</display>during the school year for which the student is applying for the scholarship, is <ln numlevel="1" lineno="123" slineno="2-19"/>not:<subsection ssid="3-null-14" dnum="A-o" numlevel="1" lineno="124" slineno="2-20" level="4"><display>(A)</display>a student who receives a scholarship under the Carson Smith Scholarship <ln numlevel="1" lineno="125" slineno="2-21"/>Program created in Section <xref depth="3" refnumber="53F-4-302">53F-4-302</xref>; or</subsection><subsection ssid="3-null-15" dnum="B-o" numlevel="1" lineno="126" slineno="2-22" level="4"><display>(B)</display>enrolled as a public school student; or</subsection></subsection></subsection><subsection ssid="3-null-16" dnum="b-o" numlevel="1" lineno="127" slineno="2-23" level="2"><display>(b)</display>a student who:<subsection ssid="3-null-17" dnum="i-o" numlevel="1" lineno="128" slineno="2-24" level="3"><display>(i)</display>meets the requirement of Subsections <xref depth="4" refnumber="53E-7-401(2)(a)(i)">(2)(a)(i)</xref> and <xref depth="4" refnumber="53E-7-401(ii)">(ii)</xref>; and</subsection><subsection ssid="3-null-18" dnum="ii-o" numlevel="1" lineno="129" slineno="2-25" level="3"><display>(ii)</display>is a sibling of and resides in the same household as a student described in <ln numlevel="1" lineno="130" slineno="2-26"/>Subsection <xref depth="4" refnumber="53E-7-401(2)(a)">(2)(a)</xref> if:<subsection ssid="3-null-19" dnum="A-o" numlevel="1" lineno="131" slineno="2-27" level="4"><display>(A)</display>the student described in Subsection <xref depth="4" refnumber="53E-7-401(2)(a)">(2)(a)</xref> is a scholarship student and has <ln numlevel="1" lineno="132" slineno="2-28"/>verified enrollment or intent to enroll at a qualifying school or participate in <ln numlevel="1" lineno="133" slineno="2-29"/>services provided by a qualifying provider; and</subsection><subsection ssid="3-null-20" dnum="B-o" numlevel="1" lineno="134" slineno="2-30" level="4"><display>(B)</display>the sibling is applying for a scholarship to attend the same qualifying school <ln numlevel="1" lineno="135" slineno="2-31"/>or participate in the same services provided by a qualifying provider.</subsection></subsection></subsection></subsection><subsection ssid="3-null-21" dnum="3-o" numlevel="1" lineno="136" slineno="2-32" level="1" space="false"><display>(3)</display><subsection ssid="3-null-22" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Employee" means an individual working in a position in which the individual's <ln numlevel="1" lineno="137" slineno="2-33"/>salary, wages, pay, or compensation, including as a contractor, is paid from:<subsection ssid="3-null-23" dnum="i-o" numlevel="1" lineno="138" slineno="2-34" level="3" tab="1"><display>(i)</display>program donations to a scholarship granting organization; or</subsection><subsection ssid="3-null-24" dnum="ii-o" numlevel="1" lineno="139" slineno="2-35" level="3" tab="1"><display>(ii)</display>scholarship money allocated to a qualifying school or qualifying provider by a <ln numlevel="1" lineno="140" slineno="2-36"/>scholarship granting organization under Section <xref depth="3" refnumber="53E-7-405">53E-7-405</xref>.</subsection></subsection><subsection ssid="3-null-25" dnum="b-o" numlevel="1" lineno="141" slineno="2-37" level="2"><display>(b)</display>"Employee" does not include an individual who volunteers at the scholarship <ln numlevel="1" lineno="142" slineno="2-38"/>granting organization, qualifying school, or qualifying provider.</subsection></subsection><subsection ssid="3-null-26" dnum="4-o" numlevel="1" lineno="143" slineno="2-39" level="1"><display>(4)</display>"Family income" means the annual income of the parent, parents, legal guardian, or <ln numlevel="1" lineno="144" slineno="2-40"/>legal guardians with whom a scholarship student lives.</subsection><subsection ssid="3-null-27" dnum="5-o" numlevel="1" lineno="145" slineno="2-41" level="1"><display>(5)</display>"Federal poverty level" means the poverty level as defined by the most recently revised <ln numlevel="1" lineno="146" slineno="2-42"/>poverty income guidelines published by the United States Department of Health and <ln numlevel="1" lineno="147" slineno="2-43"/>Human Services in the Federal Register.</subsection><subsection ssid="3-null-28" dnum="6-o" numlevel="1" lineno="148" slineno="2-44" level="1"><display>(6)</display>"Home-based scholarship student" means a student who:<subsection ssid="3-null-29" dnum="a-o:_-i" numlevel="1" lineno="149" slineno="2-45" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1080" style="2" owner="o" level="1" deltag="start">(a)</amend></display><amend anum="0" ea="erase" pairid="2" groupid="2" style="2" owner="jchristopherson" level="1" deltag="end">is eligible to participate in public school, in kindergarten or grades 1 through 12;</amend><amendoutend style="2"/></subsection><subsection ssid="3-null-30" dnum="b-o:a-i" numlevel="1" lineno="150" slineno="2-46" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1081" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1082" style="1" owner="i" level="1" amendtag="both" space="true">(a)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="4" groupid="4" style="2" owner="jchristopherson" level="1" deltag="both">is excused from enrollment in an LEA in accordance with Section <xref depth="3" refnumber="53G-6-204">53G-6-204</xref> to <ln numlevel="1" lineno="151" slineno="2-47"/>attend a home school</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">is a home-based student as defined in Section <xref depth="3" refnumber="53E-1-102">53E-1-102</xref></amend>; and</subsection><subsection ssid="3-null-31" dnum="c-o:b-i" numlevel="1" lineno="152" slineno="2-48" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1082" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1083" style="1" owner="i" level="1" amendtag="both" space="true">(b)</amend></display>receives a benefit from a scholarship under the program.</subsection></subsection><subsection ssid="3-null-32" dnum="7-o" numlevel="1" lineno="153" slineno="2-49" level="1"><display>(7)</display>"Multidisciplinary evaluation team" means two or more individuals:<subsection ssid="3-null-33" dnum="a-o" numlevel="1" lineno="154" slineno="2-50" level="2"><display>(a)</display>who are qualified in two or more separate disciplines or professions; and</subsection><subsection ssid="3-null-34" dnum="b-o" numlevel="1" lineno="155" slineno="2-51" level="2"><display>(b)</display>who evaluate a child.</subsection></subsection><subsection ssid="3-null-35" dnum="8-o" numlevel="1" lineno="156" slineno="2-52" level="1"><display>(8)</display>"Officer" means:<subsection ssid="3-null-36" dnum="a-o" numlevel="1" lineno="157" slineno="2-53" level="2"><display>(a)</display>a member of the board of a scholarship granting organization, qualifying school, or <ln numlevel="1" lineno="158" slineno="2-54"/>qualifying provider; or</subsection><subsection ssid="3-null-37" dnum="b-o" numlevel="1" lineno="159" slineno="2-55" level="2"><display>(b)</display>the chief administrative officer of a scholarship granting organization<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="5" style="2" owner="jchristopherson" level="1" deltag="both"> </amend><amendoutend style="2"/>, qualifying <ln numlevel="1" lineno="160" slineno="2-56"/>school, or qualifying provider.</subsection></subsection><subsection ssid="3-null-38" dnum="9-o" numlevel="1" lineno="161" slineno="2-57" level="1"><display>(9)</display>"Program donation" means a donation to the program under Section <xref depth="3" refnumber="53E-7-405">53E-7-405</xref>.</subsection><subsection ssid="3-null-39" dnum="10-o" numlevel="1" lineno="162" slineno="2-58" level="1"><display>(10)</display>"Qualifying provider" means:<subsection ssid="3-null-40" dnum="a-o" numlevel="1" lineno="163" slineno="2-59" level="2"><display>(a)</display>an entity that:<subsection ssid="3-null-41" dnum="i-o" numlevel="1" lineno="164" slineno="2-60" level="3"><display>(i)</display>is not a public school and is autonomous and not an agent of the state, in <ln numlevel="1" lineno="165" slineno="2-61"/>accordance with Section <xref depth="3" refnumber="53E-7-406">53E-7-406</xref>; and</subsection><subsection ssid="3-null-42" dnum="ii-o" numlevel="1" lineno="166" slineno="2-62" level="3"><display>(ii)</display>meets the requirement described in Section <xref depth="3" refnumber="53E-7-403">53E-7-403</xref>; and</subsection></subsection><subsection ssid="3-null-43" dnum="b-o" numlevel="1" lineno="167" slineno="2-63" level="2"><display>(b)</display>is an eligible service provider approved by the scholarship granting organization in <ln numlevel="1" lineno="168" slineno="2-64"/>accordance with Section <xref depth="3" refnumber="53E-7-408.5">53E-7-408.5</xref>.</subsection></subsection><subsection ssid="3-null-44" dnum="11-o" numlevel="1" lineno="169" slineno="2-65" level="1"><display>(11)</display>"Qualifying school" means a private school that:<subsection ssid="3-null-45" dnum="a-o" numlevel="1" lineno="170" slineno="2-66" level="2"><display>(a)</display>provides kindergarten, elementary, or secondary education;</subsection><subsection ssid="3-null-46" dnum="b-o" numlevel="1" lineno="171" slineno="2-67" level="2"><display>(b)</display>is approved by the state board under Section <xref depth="3" refnumber="53E-7-408">53E-7-408</xref>; and</subsection><subsection ssid="3-null-47" dnum="c-o" numlevel="1" lineno="172" slineno="2-68" level="2"><display>(c)</display>meets the requirements described in Section <xref depth="3" refnumber="53E-7-403">53E-7-403</xref>.</subsection></subsection><subsection ssid="3-null-48" dnum="12-o" numlevel="1" lineno="173" slineno="2-69" level="1"><display>(12)</display>"Relative" means a father, mother, husband, wife, son, daughter, sister, brother, uncle, <ln numlevel="1" lineno="174" slineno="2-70"/>aunt, nephew, niece, first cousin, mother-in-law, father-in-law, brother-in-law, <ln numlevel="1" lineno="175" slineno="2-71"/>sister-in-law, son-in-law, or daughter-in-law.</subsection><subsection ssid="3-null-49" dnum="13-o" numlevel="1" lineno="176" slineno="2-72" level="1"><display>(13)</display>"Scholarship" means a grant awarded to an eligible student:<subsection ssid="3-null-50" dnum="a-o" numlevel="1" lineno="177" slineno="2-73" level="2"><display>(a)</display>by a scholarship granting organization out of program donations; and</subsection><subsection ssid="3-null-51" dnum="b-o" numlevel="1" lineno="178" slineno="2-74" level="2"><display>(b)</display>for the purpose of paying for a scholarship expense.</subsection></subsection><subsection ssid="3-null-52" dnum="14-o" numlevel="1" lineno="179" slineno="2-75" level="1"><display>(14)</display>"Scholarship expense" means an expense that a parent or eligible student incurs in the <ln numlevel="1" lineno="180" slineno="2-76"/>education of the eligible student for goods or a service that a qualifying school or <ln numlevel="1" lineno="181" slineno="2-77"/>qualifying provider provides or facilitates, including:<subsection ssid="3-null-53" dnum="a-o" numlevel="1" lineno="182" slineno="2-78" level="2"><display>(a)</display>published tuition and fees of a qualifying school or qualifying provider;</subsection><subsection ssid="3-null-54" dnum="b-o" numlevel="1" lineno="183" slineno="2-79" level="2"><display>(b)</display>fees and instructional materials at a technical college;</subsection><subsection ssid="3-null-55" dnum="c-o" numlevel="1" lineno="184" slineno="2-80" level="2"><display>(c)</display>tutoring services;</subsection><subsection ssid="3-null-56" dnum="d-o" numlevel="1" lineno="185" slineno="2-81" level="2"><display>(d)</display>fees for after-school or summer education programs;</subsection><subsection ssid="3-null-57" dnum="e-o" numlevel="1" lineno="186" slineno="2-82" level="2"><display>(e)</display>textbooks, curricula, or other instructional materials, including any supplemental <ln numlevel="1" lineno="187" slineno="2-83"/>materials or associated online instruction that a curriculum, qualifying provider, or a <ln numlevel="1" lineno="188" slineno="2-84"/>qualifying school recommends;</subsection><subsection ssid="3-null-58" dnum="f-o" numlevel="1" lineno="189" slineno="2-85" level="2"><display>(f)</display>educational software and applications;</subsection><subsection ssid="3-null-59" dnum="g-o" numlevel="1" lineno="190" slineno="2-86" level="2"><display>(g)</display>supplies or other equipment related to an eligible student's educational needs;</subsection><subsection ssid="3-null-60" dnum="h-o" numlevel="1" lineno="191" slineno="2-87" level="2"><display>(h)</display>computer hardware or other technological devices that are intended primarily for an <ln numlevel="1" lineno="192" slineno="2-88"/>eligible student's educational needs;</subsection><subsection ssid="3-null-61" dnum="i-o" numlevel="1" lineno="193" slineno="2-89" level="2"><display>(i)</display>fees for the following examinations, or for a preparation course for the following <ln numlevel="1" lineno="194" slineno="2-90"/>examinations, that the scholarship granting organization approves:<subsection ssid="3-null-62" dnum="i-o" numlevel="1" lineno="195" slineno="2-91" level="3"><display>(i)</display>a national norm-referenced or standardized assessment described in Section <xref depth="3" refnumber="53F-6-410"><ln numlevel="1" lineno="196" slineno="2-92"/>53F-6-410</xref>, an advanced placement examination, or another similar assessment;</subsection><subsection ssid="3-null-63" dnum="ii-o" numlevel="1" lineno="197" slineno="2-93" level="3"><display>(ii)</display>a state-recognized industry certification examination; and</subsection><subsection ssid="3-null-64" dnum="iii-o" numlevel="1" lineno="198" slineno="2-94" level="3"><display>(iii)</display>an examination related to college or university admission;</subsection></subsection><subsection ssid="3-null-65" dnum="j-o" numlevel="1" lineno="199" slineno="2-95" level="2"><display>(j)</display>educational services for students with disabilities from a licensed or accredited <ln numlevel="1" lineno="200" slineno="2-96"/>practitioner or provider, including occupational, behavioral, physical, audiology, or <ln numlevel="1" lineno="201" slineno="2-97"/>speech-language therapies;</subsection><subsection ssid="3-null-66" dnum="k-o" numlevel="1" lineno="202" slineno="2-98" level="2"><display>(k)</display>contracted services that the scholarship granting organization approves and that an <ln numlevel="1" lineno="203" slineno="2-99"/>LEA provides, including individual classes, after-school tutoring services, <ln numlevel="1" lineno="204" slineno="2-100"/>transportation, or fees or costs associated with participation in extracurricular <ln numlevel="1" lineno="205" slineno="2-101"/>activities;</subsection><subsection ssid="3-null-67" dnum="l-o" numlevel="1" lineno="206" slineno="2-102" level="2"><display>(l)</display>ride fees or fares for a fee-for-service transportation provider to transport the eligible <ln numlevel="1" lineno="207" slineno="2-103"/>student to and from a qualifying school or qualifying provider, not to exceed $750 in <ln numlevel="1" lineno="208" slineno="2-104"/>a given school year;</subsection><subsection ssid="3-null-68" dnum="m-o" numlevel="1" lineno="209" slineno="2-105" level="2"><display>(m)</display>expenses related to extracurricular activities, field trips, educational supplements, <ln numlevel="1" lineno="210" slineno="2-106"/>and other educational experiences; or</subsection><subsection ssid="3-null-69" dnum="n-o" numlevel="1" lineno="211" slineno="2-107" level="2"><display>(n)</display>the scholarship granting organization approves in accordance with Subsection <xref depth="3" refnumber="53E-7-405"><ln numlevel="1" lineno="212" slineno="2-108"/>53E-7-405</xref>(3).</subsection></subsection><subsection ssid="3-null-70" dnum="15-o" numlevel="1" lineno="213" slineno="2-109" level="1"><display>(15)</display>"Scholarship granting organization" means an organization that is:<subsection ssid="3-null-71" dnum="a-o" numlevel="1" lineno="214" slineno="2-110" level="2"><display>(a)</display>qualified as tax exempt under Section 501(c)(3), Internal Revenue Code; and</subsection><subsection ssid="3-null-72" dnum="b-o" numlevel="1" lineno="215" slineno="2-111" level="2"><display>(b)</display>recognized through an agreement with the state board as a scholarship granting <ln numlevel="1" lineno="216" slineno="2-112"/>organization, as described in Section <xref depth="3" refnumber="53E-7-404">53E-7-404</xref>.</subsection></subsection><subsection ssid="3-null-73" dnum="16-o" numlevel="1" lineno="217" slineno="2-113" level="1"><display>(16)</display>"Scholarship student" means an eligible student, including a home-based scholarship <ln numlevel="1" lineno="218" slineno="2-114"/>student, who receives a scholarship under this part.</subsection><subsection ssid="3-null-74" dnum="17-o" numlevel="1" lineno="219" slineno="2-115" level="1"><display>(17)</display>"Value of the weighted pupil unit" means the amount established each year in the <ln numlevel="1" lineno="220" slineno="2-116"/>enacted public education budget that is multiplied by the number of weighted pupil units <ln numlevel="1" lineno="221" slineno="2-117"/>to yield the funding level for the basic state-supported school program.</subsection></section></bsec><bsec buid="26" num="53E-7-405" type="amend" src="code" uid="C53E-7-S405_2026050620260506" sort="53E07 04050020260506" numlevel="1" lineno="222" slineno="3-1" sn="3"><section number="53E-7-405" numlevel="1" lineno="223" slineno="3-2" type="amend"><secline lineno="222">Section 3. Section <bold>53E-7-405</bold> is amended to read:</secline><catline lineno="223"><bold>53E-7-405<parens/>. Program donations -- Scholarship granting organization <ln numlevel="1" lineno="224" slineno="3-3"/>requirements -- Legislative appropriations.</bold></catline><subsection ssid="26-null-1" dnum="1-o" numlevel="1" lineno="225" slineno="3-4" level="1" placement="noreturn"><display>(1)</display>A person that makes a donation to a scholarship granting organization to help fund <ln numlevel="1" lineno="226" slineno="3-5"/>scholarships through the program may be eligible to receive a nonrefundable tax credit <ln numlevel="1" lineno="227" slineno="3-6"/>as described in Sections <xref depth="3" refnumber="59-7-625">59-7-625</xref> and <xref depth="3" refnumber="59-10-1041">59-10-1041</xref>.</subsection><subsection ssid="26-null-2" dnum="2-o" numlevel="1" lineno="228" slineno="3-7" level="1"><display>(2)</display>In accordance with Section <xref depth="3" refnumber="53E-7-404">53E-7-404</xref>, an organization may enter into an agreement <ln numlevel="1" lineno="229" slineno="3-8"/>with the state board to be a scholarship granting organization.</subsection><subsection ssid="26-null-3" dnum="3-o" numlevel="1" lineno="230" slineno="3-9" level="1"><display>(3)</display>A scholarship granting organization shall:<subsection ssid="26-null-4" dnum="a-o" numlevel="1" lineno="231" slineno="3-10" level="2"><display>(a)</display>accept program donations and allow a person that makes a program donation to <ln numlevel="1" lineno="232" slineno="3-11"/>designate a qualifying school or qualifying provider to which the donation shall be <ln numlevel="1" lineno="233" slineno="3-12"/>directed for scholarships;</subsection><subsection ssid="26-null-5" dnum="b-o" numlevel="1" lineno="234" slineno="3-13" level="2"><display>(b)</display>adopt an application process in accordance with Subsection <xref depth="4" refnumber="53E-7-405(5)">(5)</xref>;</subsection><subsection ssid="26-null-6" dnum="c-o" numlevel="1" lineno="235" slineno="3-14" level="2"><display>(c)</display>review scholarship applications and determine scholarship awards;</subsection><subsection ssid="26-null-7" dnum="d-o" numlevel="1" lineno="236" slineno="3-15" level="2"><display>(d)</display>allocate scholarship money to a scholarship student's parent or, on the parent's <ln numlevel="1" lineno="237" slineno="3-16"/>behalf, to a qualifying school or qualifying provider in which the scholarship student <ln numlevel="1" lineno="238" slineno="3-17"/>is enrolled or participates;</subsection><subsection ssid="26-null-8" dnum="e-o" numlevel="1" lineno="239" slineno="3-18" level="2"><display>(e)</display>adopt a process, with state board approval, that allows a parent to use a scholarship to <ln numlevel="1" lineno="240" slineno="3-19"/>pay for a nontuition scholarship expense for the scholarship student;</subsection><subsection ssid="26-null-9" dnum="f-o" numlevel="1" lineno="241" slineno="3-20" level="2"><display>(f)</display>ensure that during the state fiscal year:<subsection ssid="26-null-10" dnum="i-o" numlevel="1" lineno="242" slineno="3-21" level="3"><display>(i)</display>at least 92% of the scholarship granting organization's revenue from program <ln numlevel="1" lineno="243" slineno="3-22"/>donations and other funding sources are spent on scholarships;</subsection><subsection ssid="26-null-11" dnum="ii-o" numlevel="1" lineno="244" slineno="3-23" level="3"><display>(ii)</display>up to 5% of the scholarship granting organization's revenue from program <ln numlevel="1" lineno="245" slineno="3-24"/>donations and other funding sources are spent on administration of the program;</subsection><subsection ssid="26-null-12" dnum="iii-o" numlevel="1" lineno="246" slineno="3-25" level="3"><display>(iii)</display>up to 3% of the scholarship granting organization's revenue from program <ln numlevel="1" lineno="247" slineno="3-26"/>donations and other funding sources are spent on marketing and fundraising costs; <ln numlevel="1" lineno="248" slineno="3-27"/>and</subsection><subsection ssid="26-null-13" dnum="iv-o" numlevel="1" lineno="249" slineno="3-28" level="3"><display>(iv)</display>all revenue from interest or investments is spent on scholarships;</subsection></subsection><subsection ssid="26-null-14" dnum="g-o" numlevel="1" lineno="250" slineno="3-29" level="2"><display>(g)</display>carry forward no more than 60% of the scholarship granting organization's funds, <ln numlevel="1" lineno="251" slineno="3-30"/>less funds for a scholarship that has been awarded, and funds expended for <ln numlevel="1" lineno="252" slineno="3-31"/>administration and marketing, from the state fiscal year in which the scholarship <ln numlevel="1" lineno="253" slineno="3-32"/>granting organization received the funds to the following state fiscal year;</subsection><subsection ssid="26-null-15" dnum="h-o" numlevel="1" lineno="254" slineno="3-33" level="2"><display>(h)</display>at the end of a state fiscal year, remit to the state treasurer donation amounts greater <ln numlevel="1" lineno="255" slineno="3-34"/>than the amount described in Subsection <xref depth="4" refnumber="53E-7-405(3)(g)">(3)(g)</xref>;</subsection><subsection ssid="26-null-16" dnum="i-o" numlevel="1" lineno="256" slineno="3-35" level="2"><display>(i)</display>prohibit a scholarship granting organization employee or officer from handling, <ln numlevel="1" lineno="257" slineno="3-36"/>managing, or processing program donations or other funds, if, based on a criminal <ln numlevel="1" lineno="258" slineno="3-37"/>background check conducted by the state board in accordance with Section <xref depth="3" refnumber="53E-7-404">53E-7-404</xref>, <ln numlevel="1" lineno="259" slineno="3-38"/>the state board identifies the employee or officer as posing a risk to the appropriate <ln numlevel="1" lineno="260" slineno="3-39"/>use of program donations or other funds;</subsection><subsection ssid="26-null-17" dnum="j-o" numlevel="1" lineno="261" slineno="3-40" level="2"><display>(j)</display>ensure that a scholarship can be transferred during the school year to a different <ln numlevel="1" lineno="262" slineno="3-41"/>qualifying school or qualifying provider that accepts the scholarship student;</subsection><subsection ssid="26-null-18" dnum="k-o" numlevel="1" lineno="263" slineno="3-42" level="2"><display>(k)</display>report to the state board on or before November 1 of each year the following <ln numlevel="1" lineno="264" slineno="3-43"/>information, prepared by a certified public accountant:<subsection ssid="26-null-19" dnum="i-o" numlevel="1" lineno="265" slineno="3-44" level="3"><display>(i)</display>the name and address of the scholarship granting organization;</subsection><subsection ssid="26-null-20" dnum="ii-o" numlevel="1" lineno="266" slineno="3-45" level="3"><display>(ii)</display>the total number and total dollar amount of program donations and other funding <ln numlevel="1" lineno="267" slineno="3-46"/>sources that the scholarship granting organization received during the previous <ln numlevel="1" lineno="268" slineno="3-47"/>calendar year;</subsection><subsection ssid="26-null-21" dnum="iii-o" numlevel="1" lineno="269" slineno="3-48" level="3" space="false"><display>(iii)</display><subsection ssid="26-null-22" dnum="A-o" level="4" placement="sameline"><display>(A)</display>the total number and total dollar amount of scholarships the scholarship <ln numlevel="1" lineno="270" slineno="3-49"/>granting organization awarded during the previous state fiscal year to eligible <ln numlevel="1" lineno="271" slineno="3-50"/>students described in Subsection <xref depth="4" refnumber="53E-7-401(2)(a)">53E-7-401(2)(a)</xref>; and</subsection><subsection ssid="26-null-23" dnum="B-o" numlevel="1" lineno="272" slineno="3-51" level="4"><display>(B)</display>the total number and total dollar amount of scholarships the scholarship <ln numlevel="1" lineno="273" slineno="3-52"/>granting organization awarded during the previous state fiscal year to eligible <ln numlevel="1" lineno="274" slineno="3-53"/>students described in Subsection <xref depth="4" refnumber="53E-7-401(2)(b)">53E-7-401(2)(b)</xref>; and</subsection></subsection><subsection ssid="26-null-24" dnum="iv-o" numlevel="1" lineno="275" slineno="3-54" level="3"><display>(iv)</display>the percentage of first-time scholarship recipients who were enrolled in a public <ln numlevel="1" lineno="276" slineno="3-55"/>school during the previous school year or who entered kindergarten or a higher <ln numlevel="1" lineno="277" slineno="3-56"/>grade for the first time in Utah;</subsection></subsection><subsection ssid="26-null-25" dnum="l-o" numlevel="1" lineno="278" slineno="3-57" level="2"><display>(l)</display>issue tax credit certificates as described in Section <xref depth="3" refnumber="53E-7-407">53E-7-407</xref>; and</subsection><subsection ssid="26-null-26" dnum="m-o" numlevel="1" lineno="279" slineno="3-58" level="2" space="false"><display>(m)</display><subsection ssid="26-null-27" dnum="i-o" level="3" placement="sameline"><display>(i)</display>require a parent to notify a scholarship granting organization if the parent's <ln numlevel="1" lineno="280" slineno="3-59"/>scholarship recipient:<subsection ssid="26-null-28" dnum="A-o" numlevel="1" lineno="281" slineno="3-60" level="4" tab="1"><display>(A)</display>receives scholarship money for tuition expenses; and</subsection><subsection ssid="26-null-29" dnum="B-o" numlevel="1" lineno="282" slineno="3-61" level="4" tab="1"><display>(B)</display>does not have continuing enrollment and attendance at a qualifying school; or</subsection></subsection><subsection ssid="26-null-30" dnum="ii-o" numlevel="1" lineno="283" slineno="3-62" level="3"><display>(ii)</display>has transitioned to be a <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="5" style="2" owner="jchristopherson" level="1" deltag="both">home-based</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">home school</amend> student<amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both"> as defined in Section <xref depth="3" refnumber="53E-1-102"><ln numlevel="1" lineno="284" slineno="3-63"/>53E-1-102</xref></amend>.</subsection></subsection></subsection><subsection ssid="26-null-31" dnum="4-o" numlevel="1" lineno="285" slineno="3-64" level="1"><display>(4)</display>The state treasurer shall deposit the money described in Subsection <xref depth="4" refnumber="53E-7-405(3)(h)">(3)(h)</xref> into the <ln numlevel="1" lineno="286" slineno="3-65"/>Income Tax Fund.</subsection><subsection ssid="26-null-32" dnum="5-o" numlevel="1" lineno="287" slineno="3-66" level="1" space="false"><display>(5)</display><subsection ssid="26-null-33" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An application for a scholarship shall contain an acknowledgment by the <ln numlevel="1" lineno="288" slineno="3-67"/>applicant's parent that the qualifying school or qualifying provider selected by the <ln numlevel="1" lineno="289" slineno="3-68"/>parent for the applicant to attend or participate in using a scholarship is capable of <ln numlevel="1" lineno="290" slineno="3-69"/>providing the level of disability services required for the student.</subsection><subsection ssid="26-null-34" dnum="b-o" numlevel="1" lineno="291" slineno="3-70" level="2" format="full"><display>(b)</display>A scholarship application form shall contain the following statement:<eol numlevel="1" lineno="292" slineno="3-71"/><para/>"I acknowledge that:<eol numlevel="1" lineno="293" slineno="3-72"/>(1) A private school may not provide the same level of disability services that are provided <ln numlevel="1" lineno="294" slineno="3-73"/>in a public school;<eol numlevel="1" lineno="295" slineno="3-74"/>(2) I will assume full financial responsibility for the education of my scholarship recipient <ln numlevel="1" lineno="296" slineno="3-75"/>if I accept this scholarship;<eol numlevel="1" lineno="297" slineno="3-76"/>(3) Acceptance of this scholarship has the same effect as a parental refusal to consent to <ln numlevel="1" lineno="298" slineno="3-77"/>services as described in 24 C.F.R. Sec. 300.300, issued under the Individuals with Disabilities <ln numlevel="1" lineno="299" slineno="3-78"/>Education Act, 20 U.S.C. Sec. 1400 et seq.; and<eol numlevel="1" lineno="300" slineno="3-79"/>(4) My child may return to a public school at any time."</subsection><subsection ssid="26-null-35" dnum="c-o" numlevel="1" lineno="301" slineno="3-80" level="2"><display>(c)</display>Upon acceptance of a scholarship, the parent assumes full financial responsibility for <ln numlevel="1" lineno="302" slineno="3-81"/>the education of the scholarship recipient.</subsection><subsection ssid="26-null-36" dnum="d-o" numlevel="1" lineno="303" slineno="3-82" level="2"><display>(d)</display>Acceptance of a scholarship has the same effect as a parental refusal to consent to <ln numlevel="1" lineno="304" slineno="3-83"/>services as described in 24 C.F.R. Sec. 300.300, issued under the Individuals with <ln numlevel="1" lineno="305" slineno="3-84"/>Disabilities Education Act, 20 U.S.C. Sec. 1400 et seq.</subsection><subsection ssid="26-null-37" dnum="e-o" numlevel="1" lineno="306" slineno="3-85" level="2"><display>(e)</display>The creation of the program or granting of a scholarship does not:<subsection ssid="26-null-38" dnum="i-o" numlevel="1" lineno="307" slineno="3-86" level="3"><display>(i)</display>imply that a public school did not provide a free and appropriate public education <ln numlevel="1" lineno="308" slineno="3-87"/>for a student; or</subsection><subsection ssid="26-null-39" dnum="ii-o" numlevel="1" lineno="309" slineno="3-88" level="3"><display>(ii)</display>constitute a waiver or admission by the state.</subsection></subsection></subsection><subsection ssid="26-null-40" dnum="6-o" numlevel="1" lineno="310" slineno="3-89" level="1"><display>(6)</display>A scholarship granting organization shall demonstrate the scholarship granting <ln numlevel="1" lineno="311" slineno="3-90"/>organization's financial accountability by annually submitting to the state board a <ln numlevel="1" lineno="312" slineno="3-91"/>financial information report that:<subsection ssid="26-null-41" dnum="a-o" numlevel="1" lineno="313" slineno="3-92" level="2"><display>(a)</display>complies with the uniform financial accounting standards described in Section <xref depth="3" refnumber="53E-7-404"><ln numlevel="1" lineno="314" slineno="3-93"/>53E-7-404</xref>; and</subsection><subsection ssid="26-null-42" dnum="b-o" numlevel="1" lineno="315" slineno="3-94" level="2"><display>(b)</display>is prepared by a certified public accountant.</subsection></subsection><subsection ssid="26-null-43" dnum="7-o" numlevel="1" lineno="316" slineno="3-95" level="1" space="false"><display>(7)</display><subsection ssid="26-null-44" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If a scholarship granting organization allocates $500,000 or more in scholarships <ln numlevel="1" lineno="317" slineno="3-96"/>annually through the program, the scholarship granting organization shall:<subsection ssid="26-null-45" dnum="i-o" numlevel="1" lineno="318" slineno="3-97" level="3" tab="1"><display>(i)</display>contract for an annual audit, conducted by a certified public accountant who is <ln numlevel="1" lineno="319" slineno="3-98"/>independent from:<subsection ssid="26-null-46" dnum="A-o" numlevel="1" lineno="320" slineno="3-99" level="4"><display>(A)</display>the scholarship granting organization; and</subsection><subsection ssid="26-null-47" dnum="B-o" numlevel="1" lineno="321" slineno="3-100" level="4"><display>(B)</display>the scholarship granting organization's accounts and records pertaining to <ln numlevel="1" lineno="322" slineno="3-101"/>program donations and other funding sources; and</subsection></subsection><subsection ssid="26-null-48" dnum="ii-o" numlevel="1" lineno="323" slineno="3-102" level="3" tab="1"><display>(ii)</display>in accordance with Subsection <xref depth="4" refnumber="53E-7-405(7)(b)">(7)(b)</xref>, report the results of the audit to the state <ln numlevel="1" lineno="324" slineno="3-103"/>board for review.</subsection></subsection><subsection ssid="26-null-49" dnum="b-o" numlevel="1" lineno="325" slineno="3-104" level="2"><display>(b)</display>For the report described in Subsection <xref depth="4" refnumber="53E-7-405(7)(a)(ii)">(7)(a)(ii)</xref>, the scholarship granting <ln numlevel="1" lineno="326" slineno="3-105"/>organization shall:<subsection ssid="26-null-50" dnum="i-o" numlevel="1" lineno="327" slineno="3-106" level="3"><display>(i)</display>include the scholarship granting organization's financial statements in a format <ln numlevel="1" lineno="328" slineno="3-107"/>that meets generally accepted accounting standards; and</subsection><subsection ssid="26-null-51" dnum="ii-o" numlevel="1" lineno="329" slineno="3-108" level="3"><display>(ii)</display>submit the report to the state board no later than November 1.</subsection></subsection><subsection ssid="26-null-52" dnum="c-o" numlevel="1" lineno="330" slineno="3-109" level="2"><display>(c)</display>The certified public accountant shall conduct an audit described in Subsection <xref depth="4" refnumber="53E-7-405(7)(a)(i)"><ln numlevel="1" lineno="331" slineno="3-110"/>(7)(a)(i)</xref> in accordance with generally accepted auditing standards and rules made by <ln numlevel="1" lineno="332" slineno="3-111"/>the state board.</subsection><subsection ssid="26-null-53" dnum="d-o" numlevel="1" lineno="333" slineno="3-112" level="2" space="false"><display>(d)</display><subsection ssid="26-null-54" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The state board shall review a report submitted under this section and may <ln numlevel="1" lineno="334" slineno="3-113"/>request that the scholarship granting organization revise or supplement the report <ln numlevel="1" lineno="335" slineno="3-114"/>if the report is not in compliance with the provisions of this Subsection <xref depth="4" refnumber="53E-7-405(7)">(7)</xref> or rules <ln numlevel="1" lineno="336" slineno="3-115"/>adopted by the state board.</subsection><subsection ssid="26-null-55" dnum="ii-o" numlevel="1" lineno="337" slineno="3-116" level="3"><display>(ii)</display>A scholarship granting organization shall provide a revised report or supplement <ln numlevel="1" lineno="338" slineno="3-117"/>to the report no later than 45 days after the day on which the state board makes a <ln numlevel="1" lineno="339" slineno="3-118"/>request described in Subsection <xref depth="4" refnumber="53E-7-405(7)(d)(i)">(7)(d)(i)</xref>.</subsection></subsection></subsection><subsection ssid="26-null-56" dnum="8-o" numlevel="1" lineno="340" slineno="3-119" level="1" space="false"><display>(8)</display><subsection ssid="26-null-57" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A scholarship granting organization may not allocate scholarship money to a <ln numlevel="1" lineno="341" slineno="3-120"/>qualifying school or qualifying provider if:<subsection ssid="26-null-58" dnum="i-o" numlevel="1" lineno="342" slineno="3-121" level="3" tab="1"><display>(i)</display>the scholarship granting organization determines that the qualifying school or <ln numlevel="1" lineno="343" slineno="3-122"/>qualifying provider intentionally or substantially misrepresented information on <ln numlevel="1" lineno="344" slineno="3-123"/>overpayment;</subsection><subsection ssid="26-null-59" dnum="ii-o" numlevel="1" lineno="345" slineno="3-124" level="3" tab="1"><display>(ii)</display>the qualifying school or qualifying provider fails to refund an overpayment in a <ln numlevel="1" lineno="346" slineno="3-125"/>timely manner; or</subsection><subsection ssid="26-null-60" dnum="iii-o" numlevel="1" lineno="347" slineno="3-126" level="3" tab="1"><display>(iii)</display>the qualifying school or qualifying provider routinely fails to provide scholarship <ln numlevel="1" lineno="348" slineno="3-127"/>recipients with promised educational goods or services.</subsection></subsection><subsection ssid="26-null-61" dnum="b-o" numlevel="1" lineno="349" slineno="3-128" level="2"><display>(b)</display>A scholarship granting organization shall notify a scholarship recipient if the <ln numlevel="1" lineno="350" slineno="3-129"/>scholarship granting organization stops allocation of the recipient's scholarship <ln numlevel="1" lineno="351" slineno="3-130"/>money to a qualifying school or qualifying provider under Subsection <xref depth="4" refnumber="53E-7-405(8)(a)">(8)(a)</xref>.</subsection></subsection><subsection ssid="26-null-62" dnum="9-o" numlevel="1" lineno="352" slineno="3-131" level="1"><display>(9)</display>If a scholarship recipient transfers to another qualifying school or qualifying provider <ln numlevel="1" lineno="353" slineno="3-132"/>during the school year, the scholarship granting organization may prorate scholarship <ln numlevel="1" lineno="354" slineno="3-133"/>money between the qualifying schools or qualifying providers according to the time the <ln numlevel="1" lineno="355" slineno="3-134"/>scholarship recipient spends at each school or each provider.</subsection><subsection ssid="26-null-63" dnum="10-o" numlevel="1" lineno="356" slineno="3-135" level="1"><display>(10)</display>A scholarship granting organization may not:<subsection ssid="26-null-64" dnum="a-o" numlevel="1" lineno="357" slineno="3-136" level="2"><display>(a)</display>award a scholarship to a relative of the scholarship granting organization's officer; or</subsection><subsection ssid="26-null-65" dnum="b-o" numlevel="1" lineno="358" slineno="3-137" level="2"><display>(b)</display>allocate scholarship money to a qualifying school or qualifying provider at which the <ln numlevel="1" lineno="359" slineno="3-138"/>scholarship recipient has a relative who is an officer or an administrator of the <ln numlevel="1" lineno="360" slineno="3-139"/>qualifying school or qualifying provider.</subsection></subsection><subsection ssid="26-null-66" dnum="11-o" numlevel="1" lineno="361" slineno="3-140" level="1"><display>(11)</display>The Legislature may appropriate funds to the board to be distributed in an equal <ln numlevel="1" lineno="362" slineno="3-141"/>amount to each scholarship granting organization for the same purposes program <ln numlevel="1" lineno="363" slineno="3-142"/>donations are used.</subsection></section></bsec><bsec buid="13" num="53E-7-406" type="amend" src="code" uid="C53E-7-S406_2026050620260506" sort="53E07 04060020260506" numlevel="1" lineno="364" slineno="4-1" sn="4"><section number="53E-7-406" numlevel="1" lineno="365" slineno="4-2" type="amend"><secline lineno="364">Section 4. Section <bold>53E-7-406</bold> is amended to read:</secline><catline lineno="365"><bold>53E-7-406<parens/>. Qualifying school or qualifying provider regulatory autonomy -- <ln numlevel="1" lineno="366" slineno="4-3"/>Home school autonomy -- Student records -- Scholarship student status.</bold></catline><subsection ssid="13-null-1" dnum="1-o" numlevel="1" lineno="367" slineno="4-4" level="1" placement="noreturn"><display>(1)</display>Nothing in this part:<subsection ssid="13-null-2" dnum="a-o" numlevel="1" lineno="368" slineno="4-5" level="2"><display>(a)</display>except as expressly described in this part, grants additional authority to any state <ln numlevel="1" lineno="369" slineno="4-6"/>agency or LEA to regulate or control:<subsection ssid="13-null-3" dnum="i-o" numlevel="1" lineno="370" slineno="4-7" level="3"><display>(i)</display>a qualifying school, qualifying provider, or home school<amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both"> as defined in Section <xref depth="3" refnumber="53E-1-102"><ln numlevel="1" lineno="371" slineno="4-8"/>53E-1-102</xref></amend>; or</subsection><subsection ssid="13-null-4" dnum="ii-o" numlevel="1" lineno="372" slineno="4-9" level="3"><display>(ii)</display>students receiving education from a qualifying school, qualifying provider, or <ln numlevel="1" lineno="373" slineno="4-10"/>home school<amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both"> as defined in Section <xref depth="3" refnumber="53E-1-102">53E-1-102</xref></amend>;</subsection></subsection><subsection ssid="13-null-5" dnum="b-o" numlevel="1" lineno="374" slineno="4-11" level="2"><display>(b)</display>applies to or otherwise affects the freedom of choice of <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="8" groupid="8" style="2" owner="jchristopherson" level="1" deltag="both">an out-of-program</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a</amend> home <ln numlevel="1" lineno="375" slineno="4-12"/>school student,<amend anum="0" ea="amend" pairid="5" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both"> as defined in Section <xref depth="3" refnumber="53E-1-102">53E-1-102</xref></amend> including the curriculum, resources, <ln numlevel="1" lineno="376" slineno="4-13"/>developmental planning, or any other aspect of the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">out-of-program </amend><amendoutend style="2"/>home school <ln numlevel="1" lineno="377" slineno="4-14"/>student's education; or</subsection><subsection ssid="13-null-6" dnum="c-o" numlevel="1" lineno="378" slineno="4-15" level="2"><display>(c)</display>expands the regulatory authority of the state, a state office holder, or an LEA to <ln numlevel="1" lineno="379" slineno="4-16"/>impose any additional regulation of a qualifying school or qualifying provider <ln numlevel="1" lineno="380" slineno="4-17"/>beyond any regulation necessary to administer this part.</subsection></subsection><subsection ssid="13-null-7" dnum="2-o" numlevel="1" lineno="381" slineno="4-18" level="1"><display>(2)</display>A qualifying school or qualifying provider:<subsection ssid="13-null-8" dnum="a-o" numlevel="1" lineno="382" slineno="4-19" level="2"><display>(a)</display>has a right to maximum freedom from unlawful governmental control in providing <ln numlevel="1" lineno="383" slineno="4-20"/>for the educational needs of a scholarship student who attends or engages with the <ln numlevel="1" lineno="384" slineno="4-21"/>qualifying school or qualifying provider; and</subsection><subsection ssid="13-null-9" dnum="b-o" numlevel="1" lineno="385" slineno="4-22" level="2"><display>(b)</display>is not an agent of the state by virtue of the provider's acceptance of payment from a <ln numlevel="1" lineno="386" slineno="4-23"/>scholarship account in accordance with this part.</subsection></subsection><subsection ssid="13-null-10" dnum="3-o" numlevel="1" lineno="387" slineno="4-24" level="1"><display>(3)</display>Except as provided in Section <xref depth="3" refnumber="53E-7-403">53E-7-403</xref> regarding qualifying schools or qualifying <ln numlevel="1" lineno="388" slineno="4-25"/>providers, Section <xref depth="3" refnumber="53E-7-408">53E-7-408</xref> regarding eligible schools, or Section <xref depth="3" refnumber="53E-7-408.5">53E-7-408.5</xref> <ln numlevel="1" lineno="389" slineno="4-26"/>regarding eligible service providers, a scholarship granting organization may not require <ln numlevel="1" lineno="390" slineno="4-27"/>a qualifying provider to alter the qualifying provider's creed, practices, admissions <ln numlevel="1" lineno="391" slineno="4-28"/>policies, hiring practices, or curricula in order to accept scholarship funds.</subsection><subsection ssid="13-null-11" dnum="4-o" numlevel="1" lineno="392" slineno="4-29" level="1"><display>(4)</display>An LEA or a school in an LEA in which a scholarship student was previously enrolled <ln numlevel="1" lineno="393" slineno="4-30"/>shall provide to the scholarship student's parent a copy of all school records relating to <ln numlevel="1" lineno="394" slineno="4-31"/>the student that the LEA possesses within 30 days after the day on which the LEA or <ln numlevel="1" lineno="395" slineno="4-32"/>school receives the parent's request for the student's records, subject to:<subsection ssid="13-null-12" dnum="a-o" numlevel="1" lineno="396" slineno="4-33" level="2"><display>(a)</display>Title 53E, Chapter 9, Student Privacy and Data Protection; and</subsection><subsection ssid="13-null-13" dnum="b-o" numlevel="1" lineno="397" slineno="4-34" level="2"><display>(b)</display>Family Educational Rights and Privacy Act, 20 U.S.C. Sec. 1232g.</subsection></subsection><subsection ssid="13-null-14" dnum="5-o" numlevel="1" lineno="398" slineno="4-35" level="1"><display>(5)</display>By virtue of a scholarship student's involvement in the program and unless otherwise <ln numlevel="1" lineno="399" slineno="4-36"/>expressly provided in statute, a scholarship student is not:<subsection ssid="13-null-15" dnum="a-o" numlevel="1" lineno="400" slineno="4-37" level="2"><display>(a)</display>enrolled in the public education system; or</subsection><subsection ssid="13-null-16" dnum="b-o" numlevel="1" lineno="401" slineno="4-38" level="2"><display>(b)</display>otherwise subject to statute, administrative rules, or other state regulations as if the <ln numlevel="1" lineno="402" slineno="4-39"/>student was enrolled in the public education system.</subsection></subsection></section></bsec><bsec buid="24" num="53F-4-501" type="amend" src="code" uid="C53F-4-S501_2026050620260506" sort="53F04 05010020260506" numlevel="1" lineno="403" slineno="5-1" sn="5"><section number="53F-4-501" numlevel="1" lineno="404" slineno="5-2" type="amend"><secline lineno="403">Section 5. Section <bold>53F-4-501</bold> is amended to read:</secline><catline lineno="404"><bold>53F-4-501<parens/>. Definitions.</bold></catline><sectionText lineno="405"><tab/>As used in this part:</sectionText><subsection ssid="24-null-1" dnum="1-o" numlevel="1" lineno="406" slineno="5-4" level="1"><display>(1)</display>"Authorized online course provider" means the entities listed in Subsection <xref depth="3" refnumber="53F-4-504">53F-4-504</xref><ln numlevel="1" lineno="407" slineno="5-5"/>(1).</subsection><subsection ssid="24-null-2" dnum="2-o" numlevel="1" lineno="408" slineno="5-6" level="1" space="false"><display>(2)</display><subsection ssid="24-null-3" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Certified online course provider" means a provider that the state board approves <ln numlevel="1" lineno="409" slineno="5-7"/>to offer courses through the Statewide Online Education Program.</subsection><subsection ssid="24-null-4" dnum="b-o" numlevel="1" lineno="410" slineno="5-8" level="2"><display>(b)</display>"Certified online course provider" does not include an entity described in <ln numlevel="1" lineno="411" slineno="5-9"/>Subsections <xref depth="3" refnumber="53F-4-504">53F-4-504</xref>(1)(a) through (c).</subsection></subsection><subsection ssid="24-null-5" dnum="3-o" numlevel="1" lineno="412" slineno="5-10" level="1"><display>(3)</display>"Credit" means credit for a high school course, or the equivalent for a middle school <ln numlevel="1" lineno="413" slineno="5-11"/>course, as determined by the state board.</subsection><subsection ssid="24-null-6" dnum="4-o" numlevel="1" lineno="414" slineno="5-12" level="1"><display>(4)</display>"Eligible student" means a student who:<subsection ssid="24-null-7" dnum="a-o" numlevel="1" lineno="415" slineno="5-13" level="2"><display>(a)</display>intends to take a course for middle school or high school credit; and</subsection><subsection ssid="24-null-8" dnum="b-o" numlevel="1" lineno="416" slineno="5-14" level="2"><display>(b)</display>is:<subsection ssid="24-null-9" dnum="i-o" numlevel="1" lineno="417" slineno="5-15" level="3"><display>(i)</display>enrolled in an LEA in Utah; or</subsection><subsection ssid="24-null-10" dnum="ii-o" numlevel="1" lineno="418" slineno="5-16" level="3"><display>(ii)</display>a home-based student <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="2" groupid="2" style="2" owner="jchristopherson" level="1" deltag="both">in accordance with Section <xref depth="3" refnumber="53G-6-204">53G-6-204</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">as defined in <ln numlevel="1" lineno="419" slineno="5-17"/>Section <xref depth="3" refnumber="53E-1-102">53E-1-102</xref></amend>, whose custodial parent is a resident of Utah.</subsection></subsection></subsection><subsection ssid="24-null-11" dnum="5-o" numlevel="1" lineno="420" slineno="5-18" level="1"><display>(5)</display>"High school" means grade 9, 10, 11, or 12.</subsection><subsection ssid="24-null-12" dnum="6-o" numlevel="1" lineno="421" slineno="5-19" level="1"><display>(6)</display>"Middle school" means, only for purposes of student eligibility to participate in the <ln numlevel="1" lineno="422" slineno="5-20"/>Statewide Online Education Program, grade 6, 7, or 8.</subsection><subsection ssid="24-null-13" dnum="7-o" numlevel="1" lineno="423" slineno="5-21" level="1"><display>(7)</display>"Online course" means a course of instruction offered by the Statewide Online <ln numlevel="1" lineno="424" slineno="5-22"/>Education Program through the use of digital technology, regardless of whether the <ln numlevel="1" lineno="425" slineno="5-23"/>student participates in the course at home, at school, at another location, or any <ln numlevel="1" lineno="426" slineno="5-24"/>combination of these.</subsection><subsection ssid="24-null-14" dnum="8-o" numlevel="1" lineno="427" slineno="5-25" level="1"><display>(8)</display>"Plan for college and career readiness" means the same as that term is defined in Section <xref depth="3" refnumber="53E-2-304"><ln numlevel="1" lineno="428" slineno="5-26"/>53E-2-304</xref>.</subsection><subsection ssid="24-null-15" dnum="9-o" numlevel="1" lineno="429" slineno="5-27" level="1"><display>(9)</display>"Primary LEA of enrollment" or "primary LEA" means the LEA in which an eligible <ln numlevel="1" lineno="430" slineno="5-28"/>student is enrolled for courses other than online courses offered through the Statewide <ln numlevel="1" lineno="431" slineno="5-29"/>Online Education Program.</subsection><subsection ssid="24-null-16" dnum="10-o" numlevel="1" lineno="432" slineno="5-30" level="1"><display>(10)</display>"Released-time" means a period of time during the regular school day a student is <ln numlevel="1" lineno="433" slineno="5-31"/>excused from school at the request of the student's parent pursuant to rules of the state <ln numlevel="1" lineno="434" slineno="5-32"/>board.</subsection></section></bsec><bsec buid="15" num="53F-4-502" type="amend" src="code" uid="C53F-4-S502_2026050620260506" sort="53F04 05020020260506" numlevel="1" lineno="435" slineno="6-1" sn="6"><section number="53F-4-502" numlevel="1" lineno="436" slineno="6-2" type="amend"><secline lineno="435">Section 6. Section <bold>53F-4-502</bold> is amended to read:</secline><catline lineno="436"><bold>53F-4-502<parens/>. Statewide Online Education Program created -- Designated as <ln numlevel="1" lineno="437" slineno="6-3"/>program of the public education system -- Purposes.</bold></catline><subsection ssid="15-null-1" dnum="1-o" numlevel="1" lineno="438" slineno="6-4" level="1" placement="noreturn"><display>(1)</display>The Statewide Online Education Program is created to enable an eligible student to, <ln numlevel="1" lineno="439" slineno="6-5"/>through the completion of publicly funded online courses:<subsection ssid="15-null-2" dnum="a-o" numlevel="1" lineno="440" slineno="6-6" level="2"><display>(a)</display>earn college credit by July 1, 2025;</subsection><subsection ssid="15-null-3" dnum="b-o" numlevel="1" lineno="441" slineno="6-7" level="2"><display>(b)</display>earn high school graduation credit; or</subsection><subsection ssid="15-null-4" dnum="c-o" numlevel="1" lineno="442" slineno="6-8" level="2"><display>(c)</display>earn middle school credit.</subsection></subsection><subsection ssid="15-null-5" dnum="2-o" numlevel="1" lineno="443" slineno="6-9" level="1"><display>(2)</display>Pursuant to Utah Constitution, Article X, Section 2, the Statewide Online Education <ln numlevel="1" lineno="444" slineno="6-10"/>Program is designated as a program of the public education system.</subsection><subsection ssid="15-null-6" dnum="3-o" numlevel="1" lineno="445" slineno="6-11" level="1"><display>(3)</display>The purposes of the Statewide Online Education Program are to:<subsection ssid="15-null-7" dnum="a-o" numlevel="1" lineno="446" slineno="6-12" level="2"><display>(a)</display>provide a student with access to online learning options regardless of where the <ln numlevel="1" lineno="447" slineno="6-13"/>student attends school, whether a public, private, or home school<amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both"> as defined in <ln numlevel="1" lineno="448" slineno="6-14"/>Section <xref depth="3" refnumber="53E-1-102">53E-1-102</xref>, or a home-based student</amend>;</subsection><subsection ssid="15-null-8" dnum="b-o" numlevel="1" lineno="449" slineno="6-15" level="2"><display>(b)</display>provide digital learning options for a student regardless of language, residence, <ln numlevel="1" lineno="450" slineno="6-16"/>family income, or special needs;</subsection><subsection ssid="15-null-9" dnum="c-o" numlevel="1" lineno="451" slineno="6-17" level="2"><display>(c)</display>provide online learning options to allow a student to acquire the knowledge and <ln numlevel="1" lineno="452" slineno="6-18"/>technology skills necessary in a digital world;</subsection><subsection ssid="15-null-10" dnum="d-o" numlevel="1" lineno="453" slineno="6-19" level="2"><display>(d)</display>utilize the power and scalability of technology to customize education so that a <ln numlevel="1" lineno="454" slineno="6-20"/>student may learn in the student's own style preference and at the student's own pace;</subsection><subsection ssid="15-null-11" dnum="e-o" numlevel="1" lineno="455" slineno="6-21" level="2"><display>(e)</display>utilize technology to remove the constraints of traditional classroom learning, <ln numlevel="1" lineno="456" slineno="6-22"/>allowing a student to access learning virtually at any time and in any place and giving <ln numlevel="1" lineno="457" slineno="6-23"/>the student the flexibility to take advantage of the student's peak learning time;</subsection><subsection ssid="15-null-12" dnum="f-o" numlevel="1" lineno="458" slineno="6-24" level="2"><display>(f)</display>provide personalized learning, where a student can spend as little or as much time as <ln numlevel="1" lineno="459" slineno="6-25"/>the student needs to master the material;</subsection><subsection ssid="15-null-13" dnum="g-o" numlevel="1" lineno="460" slineno="6-26" level="2"><display>(g)</display>provide greater access to self-paced programs enabling a high achieving student to <ln numlevel="1" lineno="461" slineno="6-27"/>accelerate academically, while a struggling student may have additional time and <ln numlevel="1" lineno="462" slineno="6-28"/>help to gain competency;</subsection><subsection ssid="15-null-14" dnum="h-o" numlevel="1" lineno="463" slineno="6-29" level="2"><display>(h)</display>allow a student to customize the student's schedule to better meet the student's <ln numlevel="1" lineno="464" slineno="6-30"/>academic goals;</subsection><subsection ssid="15-null-15" dnum="i-o" numlevel="1" lineno="465" slineno="6-31" level="2"><display>(i)</display>provide quality learning options to better prepare a student for post-secondary <ln numlevel="1" lineno="466" slineno="6-32"/>education, vocational training, or career opportunities; and</subsection><subsection ssid="15-null-16" dnum="j-o" numlevel="1" lineno="467" slineno="6-33" level="2"><display>(j)</display>allow a student to have an individualized educational experience.</subsection></subsection><subsection ssid="15-null-17" dnum="4-o" numlevel="1" lineno="468" slineno="6-34" level="1"><display>(4)</display>The program name, "Statewide Online Education Program," shall be used in the <ln numlevel="1" lineno="469" slineno="6-35"/>dissemination of information on the program.</subsection></section></bsec><bsec buid="5" num="53F-6-401" type="amend" src="code" uid="C53F-6-S401_2026050620260506" sort="53F06 04010020260506" numlevel="1" lineno="470" slineno="7-1" sn="7"><section number="53F-6-401" numlevel="1" lineno="471" slineno="7-2" type="amend"><secline lineno="470">Section 7. Section <bold>53F-6-401</bold> is amended to read:</secline><catline lineno="471"><bold>53F-6-401<parens/>. Definitions.</bold></catline><sectionText lineno="472"><tab/>As used in this part:</sectionText><subsection ssid="5-null-1" dnum="1-o" numlevel="1" lineno="473" slineno="7-4" level="1"><display>(1)</display>"Contract administrator" means the state board's appointed Deputy Superintendent of <ln numlevel="1" lineno="474" slineno="7-5"/>Operations that ensures the program manager or financial administrator meets <ln numlevel="1" lineno="475" slineno="7-6"/>contractual obligations.</subsection><subsection ssid="5-null-2" dnum="2-o" numlevel="1" lineno="476" slineno="7-7" level="1"><display>(2)</display>"Contract oversight and compliance" means the oversight and coordination functions <ln numlevel="1" lineno="477" slineno="7-8"/>performed by the Department of Operations contract administrator, including:<subsection ssid="5-null-3" dnum="a-o" numlevel="1" lineno="478" slineno="7-9" level="2"><display>(a)</display>establishing and maintaining program standards within a contract with a program <ln numlevel="1" lineno="479" slineno="7-10"/>manager or financial administrator;</subsection><subsection ssid="5-null-4" dnum="b-o" numlevel="1" lineno="480" slineno="7-11" level="2"><display>(b)</display>determining operational requirements and structures;</subsection><subsection ssid="5-null-5" dnum="c-o" numlevel="1" lineno="481" slineno="7-12" level="2"><display>(c)</display>procuring and managing contracts for program services and standards;</subsection><subsection ssid="5-null-6" dnum="d-o" numlevel="1" lineno="482" slineno="7-13" level="2"><display>(d)</display>ensuring program integrity through direct or contracted oversight;</subsection><subsection ssid="5-null-7" dnum="e-o" numlevel="1" lineno="483" slineno="7-14" level="2"><display>(e)</display>coordinating program functions and contracted services with a program manager or <ln numlevel="1" lineno="484" slineno="7-15"/>financial administrator; and</subsection><subsection ssid="5-null-8" dnum="f-o" numlevel="1" lineno="485" slineno="7-16" level="2"><display>(f)</display>maintaining appropriate separation between government oversight and independent <ln numlevel="1" lineno="486" slineno="7-17"/>program operations.</subsection></subsection><subsection ssid="5-null-9" dnum="3-o" numlevel="1" lineno="487" slineno="7-18" level="1"><display>(3)</display>"Contracted entity" means:<subsection ssid="5-null-10" dnum="a-o" numlevel="1" lineno="488" slineno="7-19" level="2"><display>(a)</display>an organization that:<subsection ssid="5-null-11" dnum="i-o" numlevel="1" lineno="489" slineno="7-20" level="3"><display>(i)</display>contracts with the state board under Section <xref depth="3" refnumber="53F-6-404">53F-6-404</xref> to perform duties and <ln numlevel="1" lineno="490" slineno="7-21"/>functions necessary for program administration and operations;</subsection><subsection ssid="5-null-12" dnum="ii-o" numlevel="1" lineno="491" slineno="7-22" level="3"><display>(ii)</display>is not affiliated with any international organization;</subsection><subsection ssid="5-null-13" dnum="iii-o" numlevel="1" lineno="492" slineno="7-23" level="3"><display>(iii)</display>does not harvest data for the purpose of reproducing or distributing the data to <ln numlevel="1" lineno="493" slineno="7-24"/>other entities;</subsection><subsection ssid="5-null-14" dnum="iv-o" numlevel="1" lineno="494" slineno="7-25" level="3"><display>(iv)</display>is not involved in guiding or directing any curriculum or curriculum standards; <ln numlevel="1" lineno="495" slineno="7-26"/>and</subsection><subsection ssid="5-null-15" dnum="v-o" numlevel="1" lineno="496" slineno="7-27" level="3"><display>(v)</display>performs the specific duties and functions assigned in the contract with the state <ln numlevel="1" lineno="497" slineno="7-28"/>board.</subsection></subsection><subsection ssid="5-null-16" dnum="b-o" numlevel="1" lineno="498" slineno="7-29" level="2"><display>(b)</display>"Contracted entity" includes:<subsection ssid="5-null-17" dnum="i-o" numlevel="1" lineno="499" slineno="7-30" level="3"><display>(i)</display>the program manager, unless the program manager is the Department of <ln numlevel="1" lineno="500" slineno="7-31"/>Operations for any duration of time;</subsection><subsection ssid="5-null-18" dnum="ii-o" numlevel="1" lineno="501" slineno="7-32" level="3"><display>(ii)</display>the financial administrator; and</subsection><subsection ssid="5-null-19" dnum="iii-o" numlevel="1" lineno="502" slineno="7-33" level="3"><display>(iii)</display>any other entity contracted to perform program functions under Section <xref depth="3" refnumber="53F-6-404"><ln numlevel="1" lineno="503" slineno="7-34"/>53F-6-404</xref>.</subsection></subsection><subsection ssid="5-null-20" dnum="c-o" numlevel="1" lineno="504" slineno="7-35" level="2"><display>(c)</display>"Contracted entity" does not include:<subsection ssid="5-null-21" dnum="i-o" numlevel="1" lineno="505" slineno="7-36" level="3"><display>(i)</display>a qualifying provider;</subsection><subsection ssid="5-null-22" dnum="ii-o" numlevel="1" lineno="506" slineno="7-37" level="3"><display>(ii)</display>an eligible school; or</subsection><subsection ssid="5-null-23" dnum="iii-o" numlevel="1" lineno="507" slineno="7-38" level="3"><display>(iii)</display>an eligible service provider.</subsection></subsection></subsection><subsection ssid="5-null-24" dnum="4-o" numlevel="1" lineno="508" slineno="7-39" level="1" space="false"><display>(4)</display><subsection ssid="5-null-25" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Contracted entity employee" means an individual working for an entity <ln numlevel="1" lineno="509" slineno="7-40"/>contracted under Section <xref depth="3" refnumber="53F-6-404">53F-6-404</xref> in a position in which the individual's salary, <ln numlevel="1" lineno="510" slineno="7-41"/>wages, pay, or compensation, including as a contractor, is paid from scholarship <ln numlevel="1" lineno="511" slineno="7-42"/>funds.</subsection><subsection ssid="5-null-26" dnum="b-o" numlevel="1" lineno="512" slineno="7-43" level="2"><display>(b)</display>"Contracted entity employee" does not include:<subsection ssid="5-null-27" dnum="i-o" numlevel="1" lineno="513" slineno="7-44" level="3"><display>(i)</display>an individual who volunteers for a contracted entity or for a qualifying provider;</subsection><subsection ssid="5-null-28" dnum="ii-o" numlevel="1" lineno="514" slineno="7-45" level="3"><display>(ii)</display>an individual who works for a qualifying provider; or</subsection><subsection ssid="5-null-29" dnum="iii-o" numlevel="1" lineno="515" slineno="7-46" level="3"><display>(iii)</display>a qualifying provider.</subsection></subsection></subsection><subsection ssid="5-null-30" dnum="5-o" numlevel="1" lineno="516" slineno="7-47" level="1"><display>(5)</display>"Contracted entity officer" means:<subsection ssid="5-null-31" dnum="a-o" numlevel="1" lineno="517" slineno="7-48" level="2"><display>(a)</display>a member of the board of a contracted entity; or</subsection><subsection ssid="5-null-32" dnum="b-o" numlevel="1" lineno="518" slineno="7-49" level="2"><display>(b)</display>the chief administrative officer of a contracted entity.</subsection></subsection><subsection ssid="5-null-33" dnum="6-o" numlevel="1" lineno="519" slineno="7-50" level="1"><display>(6)</display>"Department of Operations" means the section of the state board that oversees financial <ln numlevel="1" lineno="520" slineno="7-51"/>operations, procurement operations, data and statistics operations, school land trust, and <ln numlevel="1" lineno="521" slineno="7-52"/>information technology operations for the state board.</subsection><subsection ssid="5-null-34" dnum="7-o" numlevel="1" lineno="522" slineno="7-53" level="1" space="false"><display>(7)</display><subsection ssid="5-null-35" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Educational supplements" means:<subsection ssid="5-null-36" dnum="i-o" numlevel="1" lineno="523" slineno="7-54" level="3" tab="1"><display>(i)</display>materials, tools, and equipment that:<subsection ssid="5-null-37" dnum="A-o" numlevel="1" lineno="524" slineno="7-55" level="4"><display>(A)</display>are directly related to and necessary for subjects aligned with the core <ln numlevel="1" lineno="525" slineno="7-56"/>standards the state board establishes pursuant to Section <xref depth="3" refnumber="53E-4-202">53E-4-202</xref>;</subsection><subsection ssid="5-null-38" dnum="B-o" numlevel="1" lineno="526" slineno="7-57" level="4"><display>(B)</display>are used for specific learning objectives or competencies;</subsection><subsection ssid="5-null-39" dnum="C-o" numlevel="1" lineno="527" slineno="7-58" level="4"><display>(C)</display>support structured learning activities or lessons; and</subsection><subsection ssid="5-null-40" dnum="D-o" numlevel="1" lineno="528" slineno="7-59" level="4"><display>(D)</display>are consumable or non-reusable in nature;</subsection></subsection><subsection ssid="5-null-41" dnum="ii-o" numlevel="1" lineno="529" slineno="7-60" level="3" tab="1"><display>(ii)</display>supplemental learning materials that:<subsection ssid="5-null-42" dnum="A-o" numlevel="1" lineno="530" slineno="7-61" level="4"><display>(A)</display>directly support or enhance the delivery of instruction in core academic <ln numlevel="1" lineno="531" slineno="7-62"/>subjects;</subsection><subsection ssid="5-null-43" dnum="B-o" numlevel="1" lineno="532" slineno="7-63" level="4"><display>(B)</display>are tied to specific educational goals or outcomes; and</subsection><subsection ssid="5-null-44" dnum="C-o" numlevel="1" lineno="533" slineno="7-64" level="4"><display>(C)</display>are not primarily for entertainment or general enrichment purposes;</subsection></subsection><subsection ssid="5-null-45" dnum="iii-o" numlevel="1" lineno="534" slineno="7-65" level="3" tab="1"><display>(iii)</display>arts and music education materials that:<subsection ssid="5-null-46" dnum="A-o" numlevel="1" lineno="535" slineno="7-66" level="4"><display>(A)</display>align with state core standards; and</subsection><subsection ssid="5-null-47" dnum="B-o" numlevel="1" lineno="536" slineno="7-67" level="4"><display>(B)</display>are used in structured arts or music instruction; and</subsection></subsection><subsection ssid="5-null-48" dnum="iv-o" numlevel="1" lineno="537" slineno="7-68" level="3" tab="1"><display>(iv)</display>other educational materials that the program manager determines are:<subsection ssid="5-null-49" dnum="A-o" numlevel="1" lineno="538" slineno="7-69" level="4"><display>(A)</display>necessary for meeting specific learning objectives;</subsection><subsection ssid="5-null-50" dnum="B-o" numlevel="1" lineno="539" slineno="7-70" level="4"><display>(B)</display>appropriate for the student's age or grade level; and</subsection><subsection ssid="5-null-51" dnum="C-o" numlevel="1" lineno="540" slineno="7-71" level="4"><display>(C)</display>primarily educational rather than recreational in nature.</subsection></subsection></subsection><subsection ssid="5-null-52" dnum="b-o" numlevel="1" lineno="541" slineno="7-72" level="2"><display>(b)</display>"Educational supplements" does not include:<subsection ssid="5-null-53" dnum="i-o" numlevel="1" lineno="542" slineno="7-73" level="3"><display>(i)</display>entertainment materials;</subsection><subsection ssid="5-null-54" dnum="ii-o" numlevel="1" lineno="543" slineno="7-74" level="3"><display>(ii)</display>recreational equipment;</subsection><subsection ssid="5-null-55" dnum="iii-o" numlevel="1" lineno="544" slineno="7-75" level="3"><display>(iii)</display>food or nutritional items;</subsection><subsection ssid="5-null-56" dnum="iv-o" numlevel="1" lineno="545" slineno="7-76" level="3"><display>(iv)</display>furniture or household items;</subsection><subsection ssid="5-null-57" dnum="v-o" numlevel="1" lineno="546" slineno="7-77" level="3"><display>(v)</display>general office supplies not specific to an educational activity; or</subsection><subsection ssid="5-null-58" dnum="vi-o" numlevel="1" lineno="547" slineno="7-78" level="3"><display>(vi)</display>other items that do not have a clear, direct educational purpose aligned with <ln numlevel="1" lineno="548" slineno="7-79"/>academic instruction.</subsection></subsection></subsection><subsection ssid="5-null-59" dnum="8-o" numlevel="1" lineno="549" slineno="7-80" level="1"><display>(8)</display>"Eligible student" means a student:<subsection ssid="5-null-60" dnum="a-o" numlevel="1" lineno="550" slineno="7-81" level="2"><display>(a)</display>who is eligible to participate in public school, in kindergarten, or grades 1 through 12;</subsection><subsection ssid="5-null-61" dnum="b-o" numlevel="1" lineno="551" slineno="7-82" level="2"><display>(b)</display>who is a primary resident of the state, including a child of a military service member, <ln numlevel="1" lineno="552" slineno="7-83"/>as that term is defined in Section <xref depth="3" refnumber="53H-11-202">53H-11-202</xref>;</subsection><subsection ssid="5-null-62" dnum="c-o" numlevel="1" lineno="553" slineno="7-84" level="2"><display>(c)</display>who, during the school year for which the student is applying for a scholarship <ln numlevel="1" lineno="554" slineno="7-85"/>account:<subsection ssid="5-null-63" dnum="i-o" numlevel="1" lineno="555" slineno="7-86" level="3"><display>(i)</display>does not receive a scholarship under:<subsection ssid="5-null-64" dnum="A-o" numlevel="1" lineno="556" slineno="7-87" level="4"><display>(A)</display>the Carson Smith Scholarship Program established in Section <xref depth="3" refnumber="53F-4-302">53F-4-302</xref>; or</subsection><subsection ssid="5-null-65" dnum="B-o" numlevel="1" lineno="557" slineno="7-88" level="4"><display>(B)</display>the Carson Smith Opportunity Scholarship Program established in Section <xref depth="3" refnumber="53E-7-402"><ln numlevel="1" lineno="558" slineno="7-89"/>53E-7-402</xref>; and</subsection></subsection><subsection ssid="5-null-66" dnum="ii-o" numlevel="1" lineno="559" slineno="7-90" level="3"><display>(ii)</display>before receiving the scholarship is not enrolled in:<subsection ssid="5-null-67" dnum="A-o" numlevel="1" lineno="560" slineno="7-91" level="4"><display>(A)</display>an LEA; or</subsection><subsection ssid="5-null-68" dnum="B-o" numlevel="1" lineno="561" slineno="7-92" level="4"><display>(B)</display>the Statewide Online Education Program to participate in a course with <ln numlevel="1" lineno="562" slineno="7-93"/>funding provided under <xref depth="2" refnumber="53F-4-5">Chapter 4, Part 5</xref>, Statewide Online Education <ln numlevel="1" lineno="563" slineno="7-94"/>Program, which does not include participation in a course by an entity as <ln numlevel="1" lineno="564" slineno="7-95"/>described in Subsection <xref depth="3" refnumber="53F-6-409">53F-6-409</xref>(7);</subsection></subsection></subsection><subsection ssid="5-null-69" dnum="d-o" numlevel="1" lineno="565" slineno="7-96" level="2"><display>(d)</display>whose eligibility is not suspended or disqualified under Section <xref depth="3" refnumber="53F-6-401">53F-6-401</xref>;</subsection><subsection ssid="5-null-70" dnum="e-o" numlevel="1" lineno="566" slineno="7-97" level="2"><display>(e)</display>who completes, to maintain eligibility, the portfolio requirement described in <ln numlevel="1" lineno="567" slineno="7-98"/>Subsection <xref depth="3" refnumber="53F-6-402">53F-6-402</xref>(3)(d);</subsection><subsection ssid="5-null-71" dnum="f-o" numlevel="1" lineno="568" slineno="7-99" level="2"><display>(f)</display>who provides verification of primary residence in Utah, including a parent's utility <ln numlevel="1" lineno="569" slineno="7-100"/>bill, mortgage statement, lease agreement, or property tax records from the current <ln numlevel="1" lineno="570" slineno="7-101"/>calendar year in which the eligible student is renewing, reapplying, or applying for <ln numlevel="1" lineno="571" slineno="7-102"/>the scholarship for the first time; and</subsection><subsection ssid="5-null-72" dnum="g-o" numlevel="1" lineno="572" slineno="7-103" level="2"><display>(g)</display>for out-of-state military families, who attests that the student is not enrolled in a <ln numlevel="1" lineno="573" slineno="7-104"/>public school elsewhere while receiving the scholarship.</subsection></subsection><subsection ssid="5-null-73" dnum="9-o" numlevel="1" lineno="574" slineno="7-105" level="1"><display>(9)</display>"Federal poverty level" means the United States poverty level as defined by the most <ln numlevel="1" lineno="575" slineno="7-106"/>recently revised poverty income guidelines published by the United States Department <ln numlevel="1" lineno="576" slineno="7-107"/>of Health and Human Services in the Federal Register.</subsection><subsection ssid="5-null-74" dnum="10-o" numlevel="1" lineno="577" slineno="7-108" level="1" space="false"><display>(10)</display><subsection ssid="5-null-75" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Financial administrator" means an organization that:<subsection ssid="5-null-76" dnum="i-o" numlevel="1" lineno="578" slineno="7-109" level="3" tab="1"><display>(i)</display>is not affiliated with any international organization;</subsection><subsection ssid="5-null-77" dnum="ii-o" numlevel="1" lineno="579" slineno="7-110" level="3" tab="1"><display>(ii)</display>does not harvest data for the purpose of reproducing or distributing the data to <ln numlevel="1" lineno="580" slineno="7-111"/>other entities;</subsection><subsection ssid="5-null-78" dnum="iii-o" numlevel="1" lineno="581" slineno="7-112" level="3" tab="1"><display>(iii)</display>is not involved in guiding or directing any curriculum or curriculum standards; <ln numlevel="1" lineno="582" slineno="7-113"/>and</subsection><subsection ssid="5-null-79" dnum="iv-o" numlevel="1" lineno="583" slineno="7-114" level="3" tab="1"><display>(iv)</display>contracts with the state board to administer scholarship payments in accordance <ln numlevel="1" lineno="584" slineno="7-115"/>with this part.</subsection></subsection><subsection ssid="5-null-80" dnum="b-o" numlevel="1" lineno="585" slineno="7-116" level="2"><display>(b)</display>"Financial administrator" may include an organization that serves as both program <ln numlevel="1" lineno="586" slineno="7-117"/>manager and financial administrator if the organization maintains appropriate <ln numlevel="1" lineno="587" slineno="7-118"/>separation of duties and meets all qualifications for both roles.</subsection></subsection><subsection ssid="5-null-81" dnum="11-o" numlevel="1" lineno="588" slineno="7-119" level="1" space="false"><display>(11)</display><subsection ssid="5-null-82" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Home-based scholarship student" means a student who:<subsection ssid="5-null-83" dnum="i-o" numlevel="1" lineno="589" slineno="7-120" level="3" tab="1"><display>(i)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="8" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">is eligible to participate in public school, in kindergarten or grades 1 through 12;</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="6" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="590" slineno="7-121"/>is a home-based student as defined in Section <xref depth="3" refnumber="53E-1-102">53E-1-102</xref>; and</amend></subsection><subsection ssid="5-null-84" dnum="ii-o:_-i" numlevel="1" lineno="591" slineno="7-122" ea="erase" anum="0" owner="jchristopherson" style="2" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1324" style="2" owner="o" level="1" deltag="start">(ii)</amend></display><amend anum="0" ea="erase" pairid="11" groupid="11" style="2" owner="jchristopherson" level="1" deltag="end">attests to being exited from enrollment in a public school to attend a home-based <ln numlevel="1" lineno="592" slineno="7-123"/>learning environment if the student was enrolled at any time in a public school; <ln numlevel="1" lineno="593" slineno="7-124"/>and</amend><amendoutend style="2"/></subsection><subsection ssid="5-null-85" dnum="iii-o:ii-i" numlevel="1" lineno="594" slineno="7-125" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1325" style="2" owner="o" level="1" deltag="both">(iii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1326" style="1" owner="i" level="1" amendtag="both" space="true">(ii)</amend></display>receives a benefit of scholarship funds.</subsection></subsection><subsection ssid="5-null-86" dnum="b-o" numlevel="1" lineno="595" slineno="7-126" level="2"><display>(b)</display>"Home-based scholarship student" does not mean a home-based student who does <ln numlevel="1" lineno="596" slineno="7-127"/>not receive a scholarship under the program<amend anum="0" ea="amend" pairid="3" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both"> or a home school student as defined in <ln numlevel="1" lineno="597" slineno="7-128"/>Section <xref depth="3" refnumber="53E-1-102">53E-1-102</xref></amend>.</subsection></subsection><subsection ssid="5-null-87" dnum="12-o" numlevel="1" lineno="598" slineno="7-129" level="1"><display>(12)</display>"Household income" means:<subsection ssid="5-null-88" dnum="a-o" numlevel="1" lineno="599" slineno="7-130" level="2"><display>(a)</display>the combined gross income of all parents residing in the same household as the <ln numlevel="1" lineno="600" slineno="7-131"/>eligible student;</subsection><subsection ssid="5-null-89" dnum="b-o" numlevel="1" lineno="601" slineno="7-132" level="2"><display>(b)</display>the gross income of a single parent who claims the student as a dependent; or</subsection><subsection ssid="5-null-90" dnum="c-o" numlevel="1" lineno="602" slineno="7-133" level="2"><display>(c)</display>the gross income of a parent who claims the student as a dependent under the terms <ln numlevel="1" lineno="603" slineno="7-134"/>of a joint custody agreement.</subsection></subsection><subsection ssid="5-null-91" dnum="13-o" numlevel="1" lineno="604" slineno="7-135" level="1"><display>(13)</display>"Parent" means:<subsection ssid="5-null-92" dnum="a-o" numlevel="1" lineno="605" slineno="7-136" level="2"><display>(a)</display>the same as that term is defined in Section <xref depth="3" refnumber="53E-1-102">53E-1-102</xref>; and</subsection><subsection ssid="5-null-93" dnum="b-o" numlevel="1" lineno="606" slineno="7-137" level="2"><display>(b)</display>a foster parent who has initiated a process to adopt the foster child.</subsection></subsection><subsection ssid="5-null-94" dnum="14-o" numlevel="1" lineno="607" slineno="7-138" level="1"><display>(14)</display>"Primary residence" means the one location where an individual resides for the <ln numlevel="1" lineno="608" slineno="7-139"/>majority of the year.</subsection><subsection ssid="5-null-95" dnum="15-o" numlevel="1" lineno="609" slineno="7-140" level="1"><display>(15)</display>"Private school" means a full-time, tuition-bearing educational institution where the <ln numlevel="1" lineno="610" slineno="7-141"/>student receives the majority of the student's academic instruction.</subsection><subsection ssid="5-null-96" dnum="16-o" numlevel="1" lineno="611" slineno="7-142" level="1" space="false"><display>(16)</display><subsection ssid="5-null-97" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Program manager" means a contracted entity or entities that:<subsection ssid="5-null-98" dnum="i-o" numlevel="1" lineno="612" slineno="7-143" level="3" tab="1"><display>(i)</display>perform program operational functions outlined in the procurement agreement <ln numlevel="1" lineno="613" slineno="7-144"/>described in Section <xref depth="3" refnumber="53F-6-404">53F-6-404</xref>, including:<subsection ssid="5-null-99" dnum="A-o" numlevel="1" lineno="614" slineno="7-145" level="4"><display>(A)</display>processing scholarship applications and eligibility determinations;</subsection><subsection ssid="5-null-100" dnum="B-o" numlevel="1" lineno="615" slineno="7-146" level="4"><display>(B)</display>maintaining scholarship account records;</subsection><subsection ssid="5-null-101" dnum="C-o" numlevel="1" lineno="616" slineno="7-147" level="4"><display>(C)</display>coordinating with qualifying providers and the financial administrator; and</subsection><subsection ssid="5-null-102" dnum="D-o" numlevel="1" lineno="617" slineno="7-148" level="4"><display>(D)</display>providing customer service to program participants;</subsection></subsection><subsection ssid="5-null-103" dnum="ii-o" numlevel="1" lineno="618" slineno="7-149" level="3" tab="1"><display>(ii)</display>in accordance with required program administration, implement established <ln numlevel="1" lineno="619" slineno="7-150"/>program standards and procedures; and</subsection><subsection ssid="5-null-104" dnum="iii-o" numlevel="1" lineno="620" slineno="7-151" level="3" tab="1"><display>(iii)</display>perform other operational duties as specified in the contract.</subsection></subsection><subsection ssid="5-null-105" dnum="b-o" numlevel="1" lineno="621" slineno="7-152" level="2"><display>(b)</display>"Program manager" may include an organization that serves as both program <ln numlevel="1" lineno="622" slineno="7-153"/>manager and financial administrator if the organization maintains appropriate <ln numlevel="1" lineno="623" slineno="7-154"/>separation of duties and meets all qualifications for both roles.</subsection></subsection><subsection ssid="5-null-106" dnum="17-o" numlevel="1" lineno="624" slineno="7-155" level="1" space="false"><display>(17)</display><subsection ssid="5-null-107" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Qualifying provider" means one of the following entities:<subsection ssid="5-null-108" dnum="i-o" numlevel="1" lineno="625" slineno="7-156" level="3" tab="1"><display>(i)</display>an eligible school that the program manager approves in accordance with Section <xref depth="3" refnumber="53F-6-408"><ln numlevel="1" lineno="626" slineno="7-157"/>53F-6-408</xref>; or</subsection><subsection ssid="5-null-109" dnum="ii-o" numlevel="1" lineno="627" slineno="7-158" level="3" tab="1"><display>(ii)</display>an eligible service provider that the program manager approves in accordance <ln numlevel="1" lineno="628" slineno="7-159"/>with Section <xref depth="3" refnumber="53F-6-409">53F-6-409</xref>.</subsection></subsection><subsection ssid="5-null-110" dnum="b-o" numlevel="1" lineno="629" slineno="7-160" level="2"><display>(b)</display>"Qualifying provider" does not include:<subsection ssid="5-null-111" dnum="i-o" numlevel="1" lineno="630" slineno="7-161" level="3"><display>(i)</display>a parent of a home-based scholarship student solely in relation to the parent's <ln numlevel="1" lineno="631" slineno="7-162"/>child; or</subsection><subsection ssid="5-null-112" dnum="ii-o" numlevel="1" lineno="632" slineno="7-163" level="3"><display>(ii)</display>any other individual that does not meet the requirements described in Subsection <xref depth="4" refnumber="53F-6-401(17)(a)"><ln numlevel="1" lineno="633" slineno="7-164"/>(17)(a)</xref>.</subsection></subsection></subsection><subsection ssid="5-null-113" dnum="18-o" numlevel="1" lineno="634" slineno="7-165" level="1"><display>(18)</display>"Relative" means a father, mother, husband, wife, son, daughter, sister, brother, uncle, <ln numlevel="1" lineno="635" slineno="7-166"/>aunt, nephew, niece, first cousin, mother-in-law, father-in-law, brother-in-law, <ln numlevel="1" lineno="636" slineno="7-167"/>sister-in-law, son-in-law, or daughter-in-law.</subsection><subsection ssid="5-null-114" dnum="19-o" numlevel="1" lineno="637" slineno="7-168" level="1"><display>(19)</display>"Scholarship account" means the account to which a program manager allocates funds <ln numlevel="1" lineno="638" slineno="7-169"/>for the payment of approved scholarship expenses in accordance with this part.</subsection><subsection ssid="5-null-115" dnum="20-o" numlevel="1" lineno="639" slineno="7-170" level="1" space="false"><display>(20)</display><subsection ssid="5-null-116" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Scholarship expense" means an expense described in Section <xref depth="3" refnumber="53F-6-402">53F-6-402</xref> that a <ln numlevel="1" lineno="640" slineno="7-171"/>parent or scholarship student incurs in the education of the scholarship student for a <ln numlevel="1" lineno="641" slineno="7-172"/>service or goods that a qualifying provider provides, including:<subsection ssid="5-null-117" dnum="i-o" numlevel="1" lineno="642" slineno="7-173" level="3" tab="1"><display>(i)</display>tuition and fees of a qualifying provider;</subsection><subsection ssid="5-null-118" dnum="ii-o" numlevel="1" lineno="643" slineno="7-174" level="3" tab="1"><display>(ii)</display>fees and instructional materials at a technical college;</subsection><subsection ssid="5-null-119" dnum="iii-o" numlevel="1" lineno="644" slineno="7-175" level="3" tab="1"><display>(iii)</display>tutoring services;</subsection><subsection ssid="5-null-120" dnum="iv-o" numlevel="1" lineno="645" slineno="7-176" level="3" tab="1"><display>(iv)</display>fees for after-school or summer education programs;</subsection><subsection ssid="5-null-121" dnum="v-o" numlevel="1" lineno="646" slineno="7-177" level="3" tab="1"><display>(v)</display>textbooks, curricula, or other instructional materials, including any supplemental <ln numlevel="1" lineno="647" slineno="7-178"/>materials or associated online instruction that a curriculum or a qualifying <ln numlevel="1" lineno="648" slineno="7-179"/>provider recommends;</subsection><subsection ssid="5-null-122" dnum="vi-o" numlevel="1" lineno="649" slineno="7-180" level="3" tab="1"><display>(vi)</display>educational software and applications;</subsection><subsection ssid="5-null-123" dnum="vii-o" numlevel="1" lineno="650" slineno="7-181" level="3" tab="1"><display>(vii)</display>supplies or other equipment related to a scholarship student's educational needs;</subsection><subsection ssid="5-null-124" dnum="viii-o" numlevel="1" lineno="651" slineno="7-182" level="3" tab="1"><display>(viii)</display>computer hardware or other technological devices that are intended primarily <ln numlevel="1" lineno="652" slineno="7-183"/>for a scholarship student's educational needs, not to exceed once every three years <ln numlevel="1" lineno="653" slineno="7-184"/>for a scholarship student;</subsection><subsection ssid="5-null-125" dnum="ix-o" numlevel="1" lineno="654" slineno="7-185" level="3" tab="1"><display>(ix)</display>fees for the following examinations, or for a preparation course for the following <ln numlevel="1" lineno="655" slineno="7-186"/>examinations, that the program manager approves:<subsection ssid="5-null-126" dnum="A-o" numlevel="1" lineno="656" slineno="7-187" level="4"><display>(A)</display>a national norm-referenced or standardized assessment described in Section <xref depth="3" refnumber="53F-6-410"><ln numlevel="1" lineno="657" slineno="7-188"/>53F-6-410</xref>, an advanced placement examination, or another similar assessment;</subsection><subsection ssid="5-null-127" dnum="B-o" numlevel="1" lineno="658" slineno="7-189" level="4"><display>(B)</display>a state-recognized industry certification examination; and</subsection><subsection ssid="5-null-128" dnum="C-o" numlevel="1" lineno="659" slineno="7-190" level="4"><display>(C)</display>an examination related to college or university admission;</subsection></subsection><subsection ssid="5-null-129" dnum="x-o" numlevel="1" lineno="660" slineno="7-191" level="3" tab="1"><display>(x)</display>educational services for students with disabilities from a licensed or accredited <ln numlevel="1" lineno="661" slineno="7-192"/>practitioner or provider, including occupational, behavioral, physical, audiology, <ln numlevel="1" lineno="662" slineno="7-193"/>or speech-language therapies;</subsection><subsection ssid="5-null-130" dnum="xi-o" numlevel="1" lineno="663" slineno="7-194" level="3" tab="1"><display>(xi)</display>contracted services that the program manager approves and that an LEA provider <ln numlevel="1" lineno="664" slineno="7-195"/>offers, including individual classes, after-school tutoring services, transportation, <ln numlevel="1" lineno="665" slineno="7-196"/>or fees or costs associated with participation in extracurricular activities;</subsection><subsection ssid="5-null-131" dnum="xii-o" numlevel="1" lineno="666" slineno="7-197" level="3" tab="1"><display>(xii)</display>ride fees or fares for a fee-for-service transportation provider to transport the <ln numlevel="1" lineno="667" slineno="7-198"/>scholarship student to and from a qualifying provider, not to exceed $750 in a <ln numlevel="1" lineno="668" slineno="7-199"/>given school year;</subsection><subsection ssid="5-null-132" dnum="xiii-o" numlevel="1" lineno="669" slineno="7-200" level="3" tab="1"><display>(xiii)</display>in accordance with Subsection <xref depth="4" refnumber="53F-6-401(20)(c)">(20)(c)</xref>, expenses related to extracurricular <ln numlevel="1" lineno="670" slineno="7-201"/>activities, field trips, educational supplements, physical education experiences, <ln numlevel="1" lineno="671" slineno="7-202"/>and other educational experiences;</subsection><subsection ssid="5-null-133" dnum="xiv-o" numlevel="1" lineno="672" slineno="7-203" level="3" tab="1"><display>(xiv)</display>coursework or an educational supplement for arts and music that aligns with <ln numlevel="1" lineno="673" slineno="7-204"/>state core standards;</subsection><subsection ssid="5-null-134" dnum="xv-o" numlevel="1" lineno="674" slineno="7-205" level="3" tab="1"><display>(xv)</display>a musical instrument rental, excluding purchase; or</subsection><subsection ssid="5-null-135" dnum="xvi-o" numlevel="1" lineno="675" slineno="7-206" level="3" tab="1"><display>(xvi)</display>any other expense for a good or service that:<subsection ssid="5-null-136" dnum="A-o" numlevel="1" lineno="676" slineno="7-207" level="4"><display>(A)</display>a parent or scholarship student incurs in the education of the scholarship <ln numlevel="1" lineno="677" slineno="7-208"/>student; and</subsection><subsection ssid="5-null-137" dnum="B-o" numlevel="1" lineno="678" slineno="7-209" level="4"><display>(B)</display>the program manager approves.</subsection></subsection></subsection><subsection ssid="5-null-138" dnum="b-o" numlevel="1" lineno="679" slineno="7-210" level="2"><display>(b)</display>"Scholarship expense" does not include:<subsection ssid="5-null-139" dnum="i-o" numlevel="1" lineno="680" slineno="7-211" level="3"><display>(i)</display>chaperone expenses, except that a family with one or more scholarship students <ln numlevel="1" lineno="681" slineno="7-212"/>receiving the scholarship under Subsection <xref depth="4" refnumber="53F-6-402(2)(c)">53F-6-402(2)(c)</xref> may use scholarship <ln numlevel="1" lineno="682" slineno="7-213"/>funds for one chaperone expense or pass per family, regardless of how many <ln numlevel="1" lineno="683" slineno="7-214"/>scholarship students are in the family or household;</subsection><subsection ssid="5-null-140" dnum="ii-o" numlevel="1" lineno="684" slineno="7-215" level="3"><display>(ii)</display>season tickets or subscriptions to entertainment venues;</subsection><subsection ssid="5-null-141" dnum="iii-o" numlevel="1" lineno="685" slineno="7-216" level="3"><display>(iii)</display>ski passes or lift tickets;</subsection><subsection ssid="5-null-142" dnum="iv-o" numlevel="1" lineno="686" slineno="7-217" level="3"><display>(iv)</display>access to recreational facilities unless for physical education of the student;</subsection><subsection ssid="5-null-143" dnum="v-o" numlevel="1" lineno="687" slineno="7-218" level="3"><display>(v)</display>playground equipment;</subsection><subsection ssid="5-null-144" dnum="vi-o" numlevel="1" lineno="688" slineno="7-219" level="3"><display>(vi)</display>the purchase of any type of:<subsection ssid="5-null-145" dnum="A-o" numlevel="1" lineno="689" slineno="7-220" level="4"><display>(A)</display>furniture; or</subsection><subsection ssid="5-null-146" dnum="B-o" numlevel="1" lineno="690" slineno="7-221" level="4"><display>(B)</display>a musical instrument;</subsection></subsection><subsection ssid="5-null-147" dnum="vii-o" numlevel="1" lineno="691" slineno="7-222" level="3"><display>(vii)</display>apparel; and</subsection><subsection ssid="5-null-148" dnum="viii-o" numlevel="1" lineno="692" slineno="7-223" level="3"><display>(viii)</display>other non-educational expenses as the program manager determines.</subsection></subsection><subsection ssid="5-null-149" dnum="c-o" numlevel="1" lineno="693" slineno="7-224" level="2" space="false"><display>(c)</display><subsection ssid="5-null-150" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A scholarship expense for extracurricular activities may not exceed 20% of the <ln numlevel="1" lineno="694" slineno="7-225"/>total scholarship amount.</subsection><subsection ssid="5-null-151" dnum="ii-o" numlevel="1" lineno="695" slineno="7-226" level="3"><display>(ii)</display>A scholarship expense for physical education requirements may not exceed an <ln numlevel="1" lineno="696" slineno="7-227"/>additional 20% of the total scholarship amount from the amount described in <ln numlevel="1" lineno="697" slineno="7-228"/>Subsection <xref depth="4" refnumber="53F-6-401(20)(c)(i)">(20)(c)(i)</xref>.</subsection><subsection ssid="5-null-152" dnum="iii-o" numlevel="1" lineno="698" slineno="7-229" level="3"><display>(iii)</display>A scholarship expense for arts and music described in Subsection <xref depth="4" refnumber="53F-6-401(20)(a)(xiv)">(20)(a)(xiv)</xref> is <ln numlevel="1" lineno="699" slineno="7-230"/>not an extracurricular activity.</subsection></subsection></subsection><subsection ssid="5-null-153" dnum="21-o" numlevel="1" lineno="700" slineno="7-231" level="1"><display>(21)</display>"Scholarship funds" means:<subsection ssid="5-null-154" dnum="a-o" numlevel="1" lineno="701" slineno="7-232" level="2"><display>(a)</display>funds that the Legislature appropriates for the program; and</subsection><subsection ssid="5-null-155" dnum="b-o" numlevel="1" lineno="702" slineno="7-233" level="2"><display>(b)</display>interest that scholarship funds accrue.</subsection></subsection><subsection ssid="5-null-156" dnum="22-o" numlevel="1" lineno="703" slineno="7-234" level="1" space="false"><display>(22)</display><subsection ssid="5-null-157" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Scholarship student" means an eligible student, including a home-based <ln numlevel="1" lineno="704" slineno="7-235"/>scholarship student, for whom the program manager establishes and maintains a <ln numlevel="1" lineno="705" slineno="7-236"/>scholarship account in accordance with this part.</subsection><subsection ssid="5-null-158" dnum="b-o" numlevel="1" lineno="706" slineno="7-237" level="2"><display>(b)</display>"Scholarship student" does not include a home-based student who does not receive a <ln numlevel="1" lineno="707" slineno="7-238"/>scholarship award under the program<amend anum="0" ea="amend" pairid="13" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="both"> or a home school student as defined in Section <xref depth="3" refnumber="53E-1-102"><ln numlevel="1" lineno="708" slineno="7-239"/>53E-1-102</xref></amend>.</subsection></subsection><subsection ssid="5-null-159" dnum="23-o" numlevel="1" lineno="709" slineno="7-240" level="1"><display>(23)</display>"Utah Fits All Scholarship Program" or "program" means the scholarship program <ln numlevel="1" lineno="710" slineno="7-241"/>established in Section <xref depth="3" refnumber="53F-6-402">53F-6-402</xref>.</subsection></section></bsec><bsec buid="28" num="53F-6-412" type="amend" src="code" uid="C53F-6-S412_2026050620260506" sort="53F06 04120020260506" numlevel="1" lineno="711" slineno="8-1" sn="8"><section number="53F-6-412" numlevel="1" lineno="712" slineno="8-2" type="amend"><secline lineno="711">Section 8. Section <bold>53F-6-412</bold> is amended to read:</secline><catline lineno="712"><bold>53F-6-412<parens/>. Reports.</bold></catline><sectionText lineno="713"><tab/>In accordance with Section <xref depth="3" refnumber="68-3-14">68-3-14</xref> and the Family Educational Rights and Privacy Act, <ln numlevel="1" lineno="714" slineno="8-4"/>20 U.S.C. Sec. 1232g, the program manager shall submit a report on the program to the <ln numlevel="1" lineno="715" slineno="8-5"/>Education Interim Committee no later than September 1 of each year that includes:</sectionText><subsection ssid="28-null-1" dnum="1-o" numlevel="1" lineno="716" slineno="8-6" level="1"><display>(1)</display>the number and outcomes of appeals processed through the appeals process established <ln numlevel="1" lineno="717" slineno="8-7"/>in Section <xref depth="3" refnumber="53F-6-417">53F-6-417</xref>;</subsection><subsection ssid="28-null-2" dnum="2-o" numlevel="1" lineno="718" slineno="8-8" level="1"><display>(2)</display>the total amount and usage of rollover funds as described in Section <xref depth="3" refnumber="53F-6-411">53F-6-411</xref>;</subsection><subsection ssid="28-null-3" dnum="3-o" numlevel="1" lineno="719" slineno="8-9" level="1"><display>(3)</display>a summary of the income verification process and outcomes, including the number of <ln numlevel="1" lineno="720" slineno="8-10"/>households verified through each method described in Section <xref depth="3" refnumber="53F-6-402">53F-6-402</xref>;</subsection><subsection ssid="28-null-4" dnum="4-o" numlevel="1" lineno="721" slineno="8-11" level="1"><display>(4)</display>for scholarship rollovers:<subsection ssid="28-null-5" dnum="a-o" numlevel="1" lineno="722" slineno="8-12" level="2"><display>(a)</display>the total amount of funds rolled over;</subsection><subsection ssid="28-null-6" dnum="b-o" numlevel="1" lineno="723" slineno="8-13" level="2"><display>(b)</display>the number of students with rollovers; and</subsection><subsection ssid="28-null-7" dnum="c-o" numlevel="1" lineno="724" slineno="8-14" level="2"><display>(c)</display>the impact on subsequent year scholarship amounts;</subsection></subsection><subsection ssid="28-null-8" dnum="5-o" numlevel="1" lineno="725" slineno="8-15" level="1"><display>(5)</display>for restricted expenses:<subsection ssid="28-null-9" dnum="a-o" numlevel="1" lineno="726" slineno="8-16" level="2"><display>(a)</display>the total amount spent on extracurricular and physical education expenses;</subsection><subsection ssid="28-null-10" dnum="b-o" numlevel="1" lineno="727" slineno="8-17" level="2"><display>(b)</display>the percentage of scholarship funds used for restricted expenses by students; and</subsection><subsection ssid="28-null-11" dnum="c-o" numlevel="1" lineno="728" slineno="8-18" level="2"><display>(c)</display>the number of students reaching:<subsection ssid="28-null-12" dnum="i-o" numlevel="1" lineno="729" slineno="8-19" level="3"><display>(i)</display>the 20% restriction limit for physical education expenses; and</subsection><subsection ssid="28-null-13" dnum="ii-o" numlevel="1" lineno="730" slineno="8-20" level="3"><display>(ii)</display>the 20% limit for extracurricular related expenses;</subsection></subsection></subsection><subsection ssid="28-null-14" dnum="6-o" numlevel="1" lineno="731" slineno="8-21" level="1"><display>(6)</display>in consultation with the financial administrator, all financial data necessary for the <ln numlevel="1" lineno="732" slineno="8-22"/>preparation of the report required under this section no later than 30 days before each <ln numlevel="1" lineno="733" slineno="8-23"/>reporting deadline;</subsection><subsection ssid="28-null-15" dnum="7-o" numlevel="1" lineno="734" slineno="8-24" level="1"><display>(7)</display>the total amount of tuition and fees qualifying providers charged for the current year and <ln numlevel="1" lineno="735" slineno="8-25"/>previous two years;</subsection><subsection ssid="28-null-16" dnum="8-o" numlevel="1" lineno="736" slineno="8-26" level="1"><display>(8)</display>the total amount of goods paid for with scholarship funds in the previous year and a <ln numlevel="1" lineno="737" slineno="8-27"/>general characterization of the types of goods;</subsection><subsection ssid="28-null-17" dnum="9-o" numlevel="1" lineno="738" slineno="8-28" level="1"><display>(9)</display>administrative costs of the program;</subsection><subsection ssid="28-null-18" dnum="10-o" numlevel="1" lineno="739" slineno="8-29" level="1"><display>(10)</display>the number of scholarship students from each county and the aggregate number of <ln numlevel="1" lineno="740" slineno="8-30"/>eligible students on the waitlist described in Section <xref depth="3" refnumber="53F-6-405">53F-6-405</xref>;</subsection><subsection ssid="28-null-19" dnum="11-o" numlevel="1" lineno="741" slineno="8-31" level="1"><display>(11)</display>the percentage of first-time scholarship students who were enrolled in a public school <ln numlevel="1" lineno="742" slineno="8-32"/>during the previous school year or who entered kindergarten or a higher grade for the <ln numlevel="1" lineno="743" slineno="8-33"/>first time in Utah;</subsection><subsection ssid="28-null-20" dnum="12-o" numlevel="1" lineno="744" slineno="8-34" level="1"><display>(12)</display>the program manager's strategy and outreach efforts to reach eligible students whose <ln numlevel="1" lineno="745" slineno="8-35"/>family income is at or below 200% of the federal poverty level and related obstacles to <ln numlevel="1" lineno="746" slineno="8-36"/>enrollments;</subsection><subsection ssid="28-null-21" dnum="13-o" numlevel="1" lineno="747" slineno="8-37" level="1"><display>(13)</display>in the report that the program manager submits in 2025, information on steps the <ln numlevel="1" lineno="748" slineno="8-38"/>program manager has taken and processes the program manager has adopted to <ln numlevel="1" lineno="749" slineno="8-39"/>implement the program; </subsection><subsection ssid="28-null-22" dnum="14-o" numlevel="1" lineno="750" slineno="8-40" level="1"><display>(14)</display>breakdown of scholarship students by:<subsection ssid="28-null-23" dnum="a-o" numlevel="1" lineno="751" slineno="8-41" level="2"><display>(a)</display><amend anum="0" ea="amend" pairid="7" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="both">a student enrolled in </amend>private school<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="10" style="2" owner="jchristopherson" level="1" deltag="both"> enrollment </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="8" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"> </amend>versus<amend anum="0" ea="amend" pairid="9" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="both"> a</amend> home-based <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both">education</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="752" slineno="8-42"/>student as defined in Section <xref depth="3" refnumber="53E-1-102">53E-1-102</xref></amend>; and</subsection><subsection ssid="28-null-24" dnum="b-o" numlevel="1" lineno="753" slineno="8-43" level="2"><display>(b)</display>enrollment preference tier through which the student received the scholarship; and</subsection></subsection><subsection ssid="28-null-25" dnum="15-o" numlevel="1" lineno="754" slineno="8-44" level="1"><display>(15)</display>any other information regarding the program and the program's implementation that <ln numlevel="1" lineno="755" slineno="8-45"/>the committee requests.</subsection></section></bsec><bsec buid="20" num="53G-6-204" type="amend" src="code" uid="C53G-6-S204_2026050620260506" sort="53G06 02040020260506" numlevel="1" lineno="756" slineno="9-1" sn="9"><section number="53G-6-204" numlevel="1" lineno="757" slineno="9-2" type="amend"><secline lineno="756">Section 9. Section <bold>53G-6-204</bold> is amended to read:</secline><catline lineno="757"><bold>53G-6-204<parens/>. School-age children exempt from school attendance.</bold></catline><subsection ssid="20-null-1" dnum="1-o" numlevel="1" lineno="758" slineno="9-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="20-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A local school board or charter school governing board may excuse a school-age <ln numlevel="1" lineno="759" slineno="9-4"/>child from attendance for any of the following reasons:<subsection ssid="20-null-3" dnum="i-o" numlevel="1" lineno="760" slineno="9-5" level="3" tab="1"><display>(i)</display>a school-age child over 16 years old may receive a partial release from school to <ln numlevel="1" lineno="761" slineno="9-6"/>enter employment, or attend a trade school, if the school-age child has completed <ln numlevel="1" lineno="762" slineno="9-7"/>grade 8; or</subsection><subsection ssid="20-null-4" dnum="ii-o" numlevel="1" lineno="763" slineno="9-8" level="3" tab="1"><display>(ii)</display>on an annual basis, a school-age child may receive a full release from attending a <ln numlevel="1" lineno="764" slineno="9-9"/>public, regularly established private, or part-time school or class if:<subsection ssid="20-null-5" dnum="A-o" numlevel="1" lineno="765" slineno="9-10" level="4"><display>(A)</display>the school-age child has already completed the work required for graduation <ln numlevel="1" lineno="766" slineno="9-11"/>from high school;</subsection><subsection ssid="20-null-6" dnum="B-o" numlevel="1" lineno="767" slineno="9-12" level="4"><display>(B)</display>the school-age child is in a physical or mental condition, certified by a <ln numlevel="1" lineno="768" slineno="9-13"/>competent physician or physician assistant if required by the local school board <ln numlevel="1" lineno="769" slineno="9-14"/>or charter school governing board, which renders attendance inexpedient and <ln numlevel="1" lineno="770" slineno="9-15"/>impracticable;</subsection><subsection ssid="20-null-7" dnum="C-o" numlevel="1" lineno="771" slineno="9-16" level="4"><display>(C)</display>proper influences and adequate opportunities for education are provided in <ln numlevel="1" lineno="772" slineno="9-17"/>connection with the school-age child's employment; or</subsection><subsection ssid="20-null-8" dnum="D-o" numlevel="1" lineno="773" slineno="9-18" level="4"><display>(D)</display>the district superintendent or charter school governing board has determined <ln numlevel="1" lineno="774" slineno="9-19"/>that a school-age child over 16 years old is unable to profit from attendance at <ln numlevel="1" lineno="775" slineno="9-20"/>school because of inability or a continuing negative attitude toward school <ln numlevel="1" lineno="776" slineno="9-21"/>regulations and discipline.</subsection></subsection></subsection><subsection ssid="20-null-9" dnum="b-o" numlevel="1" lineno="777" slineno="9-22" level="2"><display>(b)</display>A school-age child receiving a partial release from school under Subsection <xref depth="4" refnumber="53G-6-204(1)(a)(i)">(1)(a)(i)</xref> <ln numlevel="1" lineno="778" slineno="9-23"/>is required to attend:<subsection ssid="20-null-10" dnum="i-o" numlevel="1" lineno="779" slineno="9-24" level="3"><display>(i)</display>school part time as prescribed by the local school board or charter school <ln numlevel="1" lineno="780" slineno="9-25"/>governing board; or</subsection><subsection ssid="20-null-11" dnum="ii-o" numlevel="1" lineno="781" slineno="9-26" level="3"><display>(ii)</display>a home school part time.</subsection></subsection><subsection ssid="20-null-12" dnum="c-o" numlevel="1" lineno="782" slineno="9-27" level="2"><display>(c)</display>In each case, evidence of reasons for granting an exemption under <amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both">this </amend>Subsection <xref depth="4" refnumber="53G-6-204(1)">(1)</xref> <ln numlevel="1" lineno="783" slineno="9-28"/>must be sufficient to satisfy the local school board or charter school governing board.</subsection><subsection ssid="20-null-13" dnum="d-o" numlevel="1" lineno="784" slineno="9-29" level="2"><display>(d)</display>A local school board or charter school governing board that excuses a school-age <ln numlevel="1" lineno="785" slineno="9-30"/>child from attendance as provided by this Subsection <xref depth="4" refnumber="53G-6-204(1)">(1)</xref> shall issue a certificate that <ln numlevel="1" lineno="786" slineno="9-31"/>the child is excused from attendance during the time specified on the certificate.</subsection></subsection><subsection ssid="20-null-14" dnum="2-o" numlevel="1" lineno="787" slineno="9-32" level="1" space="false"><display>(2)</display><subsection ssid="20-null-15" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A parent or legal guardian of a school-age child who attends a home school<amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both"> as <ln numlevel="1" lineno="788" slineno="9-33"/>defined in Section <xref depth="3" refnumber="53E-1-102">53E-1-102</xref></amend> is solely responsible for:<subsection ssid="20-null-16" dnum="i-o" numlevel="1" lineno="789" slineno="9-34" level="3" tab="1"><display>(i)</display>the selection of instructional materials and textbooks;</subsection><subsection ssid="20-null-17" dnum="ii-o" numlevel="1" lineno="790" slineno="9-35" level="3" tab="1"><display>(ii)</display>the time, place, and method of instruction; and</subsection><subsection ssid="20-null-18" dnum="iii-o" numlevel="1" lineno="791" slineno="9-36" level="3" tab="1"><display>(iii)</display>the evaluation of the home school instruction.</subsection></subsection><subsection ssid="20-null-19" dnum="b-o" numlevel="1" lineno="792" slineno="9-37" level="2"><display>(b)</display>A local school board may not:<subsection ssid="20-null-20" dnum="i-o" numlevel="1" lineno="793" slineno="9-38" level="3"><display>(i)</display>require a parent or legal guardian of a school-age child who attends a home school <ln numlevel="1" lineno="794" slineno="9-39"/>to maintain records of instruction or attendance;</subsection><subsection ssid="20-null-21" dnum="ii-o" numlevel="1" lineno="795" slineno="9-40" level="3"><display>(ii)</display>require credentials for individuals providing home school instruction;</subsection><subsection ssid="20-null-22" dnum="iii-o" numlevel="1" lineno="796" slineno="9-41" level="3"><display>(iii)</display>inspect home school facilities; or</subsection><subsection ssid="20-null-23" dnum="iv-o" numlevel="1" lineno="797" slineno="9-42" level="3"><display>(iv)</display>require standardized or other testing of home school students.</subsection></subsection><subsection ssid="20-null-24" dnum="c-o" numlevel="1" lineno="798" slineno="9-43" level="2"><display>(c)</display>Upon the request of a parent or legal guardian, a local school board shall identify the <ln numlevel="1" lineno="799" slineno="9-44"/>knowledge, skills, and competencies a student is recommended to attain by grade <ln numlevel="1" lineno="800" slineno="9-45"/>level and subject area to assist the parent or legal guardian in achieving college and <ln numlevel="1" lineno="801" slineno="9-46"/>career readiness through home schooling.</subsection></subsection><subsection ssid="20-null-25" dnum="3-o" numlevel="1" lineno="802" slineno="9-47" level="1"><display>(3)</display>When a parent withdraws an enrolled school-age child from school for the purpose of <ln numlevel="1" lineno="803" slineno="9-48"/>home-schooling, or chooses not to enroll a school-age child, the parent shall provide a <ln numlevel="1" lineno="804" slineno="9-49"/>one-time initial notification, that may include a letter of intent, to the local school board <ln numlevel="1" lineno="805" slineno="9-50"/>of the school-age child's district of residence.</subsection><subsection ssid="20-null-26" dnum="4-o" numlevel="1" lineno="806" slineno="9-51" level="1"><display>(4)</display>A local school board may not require a notification described in Subsection <xref depth="4" refnumber="53G-6-204(3)">(3)</xref> if a <ln numlevel="1" lineno="807" slineno="9-52"/>parent of a school-age child provided a notification to the local school board on or <ln numlevel="1" lineno="808" slineno="9-53"/>before May 7, 2025, including through a home-school affidavit.</subsection><subsection ssid="20-null-27" dnum="5-o" numlevel="1" lineno="809" slineno="9-54" level="1"><display>(5)</display> Upon receiving the notification in Subsection <xref refnumber="53G-6-204(3)" depth="4">(3)</xref>:<subsection ssid="20-null-28" dnum="a-o" numlevel="1" lineno="810" slineno="9-55" level="2"><display>(a)</display>the local school board shall:<subsection ssid="20-null-29" dnum="i-o" numlevel="1" lineno="811" slineno="9-56" level="3"><display>(i)</display>maintain a record of the notification; and</subsection><subsection ssid="20-null-30" dnum="ii-o" numlevel="1" lineno="812" slineno="9-57" level="3"><display>(ii)</display>acknowledge receipt of the notification to the parent within 30 days; and</subsection></subsection><subsection ssid="20-null-31" dnum="b-o" numlevel="1" lineno="813" slineno="9-58" level="2"><display>(b)</display>the local school board and school of enrollment are not liable for the education or <ln numlevel="1" lineno="814" slineno="9-59"/>services of the school-age child.</subsection></subsection><subsection ssid="20-null-32" dnum="6-o" numlevel="1" lineno="815" slineno="9-60" level="1" space="false"><display>(6)</display><subsection ssid="20-null-33" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Nothing in this section may be construed to prohibit or discourage voluntary <ln numlevel="1" lineno="816" slineno="9-61"/>cooperation, resource sharing, or testing opportunities between a school or school <ln numlevel="1" lineno="817" slineno="9-62"/>district and a parent or legal guardian of a child attending a home school.</subsection><subsection ssid="20-null-34" dnum="b-o" numlevel="1" lineno="818" slineno="9-63" level="2"><display>(b)</display>The exemptions in this section apply regardless of whether:<subsection ssid="20-null-35" dnum="i-o" numlevel="1" lineno="819" slineno="9-64" level="3"><display>(i)</display>a parent or legal guardian provides education instruction to the parent's or legal <ln numlevel="1" lineno="820" slineno="9-65"/>guardian's child alone or in cooperation with other parents or legal guardians <ln numlevel="1" lineno="821" slineno="9-66"/>similarly exempted under this section; or</subsection><subsection ssid="20-null-36" dnum="ii-o" numlevel="1" lineno="822" slineno="9-67" level="3"><display>(ii)</display>the parent or legal guardian makes payment for educational services the parent's <ln numlevel="1" lineno="823" slineno="9-68"/>or legal guardian's child receives.</subsection></subsection></subsection></section></bsec><bsec buid="7" num="53G-6-702" type="amend" src="code" uid="C53G-6-S702_2026050620260506" sort="53G06 07020020260506" numlevel="1" lineno="824" slineno="10-1" sn="10"><section number="53G-6-702" numlevel="1" lineno="825" slineno="10-2" type="amend"><secline lineno="824">Section 10. Section <bold>53G-6-702</bold> is amended to read:</secline><catline lineno="825"><bold>53G-6-702<parens/>. Dual enrollment.</bold></catline><subsection ssid="7-null-1" dnum="1-o" numlevel="1" lineno="826" slineno="10-3" level="1" placement="noreturn"><display>(1)</display>As used in this section, "minor" means the same as that term is defined in Section <xref depth="3" refnumber="53G-6-201" start="0"><ln numlevel="1" lineno="827" slineno="10-4"/>53G-6-201</xref>.</subsection><subsection ssid="7-null-2" dnum="2-o" numlevel="1" lineno="828" slineno="10-5" level="1"><display>(2)</display>A person having control of a minor who is enrolled in a regularly established private <ln numlevel="1" lineno="829" slineno="10-6"/>school or a home school<amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both"> as defined in Section <xref depth="3" refnumber="53E-1-102">53E-1-102</xref></amend> may also enroll the minor in a <ln numlevel="1" lineno="830" slineno="10-7"/>public school for dual enrollment purposes.</subsection><subsection ssid="7-null-3" dnum="3-o" numlevel="1" lineno="831" slineno="10-8" level="1"><display>(3)</display>The minor may participate in any academic activity in the public school available to <ln numlevel="1" lineno="832" slineno="10-9"/>students in the minor's grade or age group, subject to compliance with the same rules <ln numlevel="1" lineno="833" slineno="10-10"/>and requirements that apply to a full-time student's participation in the activity.</subsection><subsection ssid="7-null-4" dnum="4-o" numlevel="1" lineno="834" slineno="10-11" level="1" space="false"><display>(4)</display><subsection ssid="7-null-5" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="8" groupid="8" style="2" owner="jchristopherson" level="1" deltag="both">student</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="6" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">minor</amend> enrolled in a dual enrollment program in a district school is <ln numlevel="1" lineno="835" slineno="10-12"/>considered a student of the district in which the district school of attendance is <ln numlevel="1" lineno="836" slineno="10-13"/>located for purposes of state funding to the extent of the student's participation in the <ln numlevel="1" lineno="837" slineno="10-14"/>district school programs.</subsection><subsection ssid="7-null-6" dnum="b-o" numlevel="1" lineno="838" slineno="10-15" level="2"><display>(b)</display>A <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">student</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">minor</amend> enrolled in a dual enrollment program in a charter school is <ln numlevel="1" lineno="839" slineno="10-16"/>considered a student of the charter school for purposes of state funding to the extent <ln numlevel="1" lineno="840" slineno="10-17"/>of the student's participation in the charter school programs.</subsection></subsection><subsection ssid="7-null-7" dnum="5-o" numlevel="1" lineno="841" slineno="10-18" level="1"><display>(5)</display>In accordance with <xref depth="1" refnumber="63G-3" start="0">Title 63G, Chapter 3, Utah Administrative Rulemaking Act</xref>, the <ln numlevel="1" lineno="842" slineno="10-19"/>state board shall make rules for purposes of dual enrollment to govern and regulate the <ln numlevel="1" lineno="843" slineno="10-20"/>transferability of credits toward graduation that are earned in a private or home school.</subsection></section></bsec><bsec buid="8" num="53G-6-703" type="amend" src="code" uid="C53G-6-S703_2026050620260506" sort="53G06 07030020260506" numlevel="1" lineno="844" slineno="11-1" sn="11"><section number="53G-6-703" numlevel="1" lineno="845" slineno="11-2" type="amend"><secline lineno="844">Section 11. Section <bold>53G-6-703</bold> is amended to read:</secline><catline lineno="845"><bold>53G-6-703<parens/>. Private school and home school students' participation in <ln numlevel="1" lineno="846" slineno="11-3"/>extracurricular activities in a public school.</bold></catline><subsection ssid="8-null-1" dnum="1-o" numlevel="1" lineno="847" slineno="11-4" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="8-null-2" dnum="a-o" numlevel="1" lineno="848" slineno="11-5" level="2"><display>(a)</display>"Academic eligibility requirements" means the academic eligibility requirements that <ln numlevel="1" lineno="849" slineno="11-6"/>a home school student is required to meet to participate in an extracurricular activity <ln numlevel="1" lineno="850" slineno="11-7"/>in a public school.</subsection><subsection ssid="8-null-3" dnum="b-o" numlevel="1" lineno="851" slineno="11-8" level="2"><display>(b)</display>"Association" means the same as that term is defined in Section <xref depth="3" refnumber="53G-7-1101" start="0">53G-7-1101</xref>.</subsection><subsection ssid="8-null-4" dnum="c-o" numlevel="1" lineno="852" slineno="11-9" level="2"><display>(c)</display>"Extracurricular activity" means the same as that term is defined in Section <xref depth="3" refnumber="53G-7-501" start="0"><ln numlevel="1" lineno="853" slineno="11-10"/>53G-7-501</xref>.</subsection><subsection ssid="8-81" dnum="_-o:d-i" numlevel="1" lineno="854" slineno="11-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1472" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">"Home school" means the same as that term is defined in Section <xref depth="3" refnumber="53E-1-102">53E-1-102</xref>.</amend></subsection><subsection ssid="8-80" dnum="_-o:e-i" numlevel="1" lineno="855" slineno="11-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1473" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="end">"Home school student" means the same as that term is defined in Section <xref depth="3" refnumber="53E-1-102">53E-1-102</xref>.</amend></subsection><subsection ssid="8-null-5" dnum="d-o:f-i" numlevel="1" lineno="856" slineno="11-13" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1474" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1475" style="1" owner="i" level="1" amendtag="both" space="true">(f)</amend></display>"Initial establishment of eligibility requirements" means an association's <ln numlevel="1" lineno="857" slineno="11-14"/>eligibility requirements, policies, procedures, and transfer rules that a school student <ln numlevel="1" lineno="858" slineno="11-15"/>in grade 9 or 10 must meet, and to which the student is bound, to participate on a <ln numlevel="1" lineno="859" slineno="11-16"/>high school sports team when the student:<subsection ssid="8-null-6" dnum="i-o" numlevel="1" lineno="860" slineno="11-17" level="3"><display>(i)</display>attends the high school in which the student is selected for membership on a high <ln numlevel="1" lineno="861" slineno="11-18"/>school sports team; or</subsection><subsection ssid="8-null-7" dnum="ii-o" numlevel="1" lineno="862" slineno="11-19" level="3"><display>(ii)</display>does not attend the high school in which the student tries out for and is selected <ln numlevel="1" lineno="863" slineno="11-20"/>for membership on a high school sports team.</subsection></subsection><subsection ssid="8-null-8" dnum="e-o:g-i" numlevel="1" lineno="864" slineno="11-21" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1477" style="2" owner="o" level="1" deltag="both">(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1478" style="1" owner="i" level="1" amendtag="both" space="true">(g)</amend></display>"Minor" means the same as that term is defined in Section <xref depth="3" refnumber="53G-6-201" start="0">53G-6-201</xref>.</subsection><subsection ssid="8-null-9" dnum="f-o:h-i" numlevel="1" lineno="865" slineno="11-22" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1478" style="2" owner="o" level="1" deltag="both">(f)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1479" style="1" owner="i" level="1" amendtag="both" space="true">(h)</amend></display>"Parent" means the same as that term is defined in Section <xref depth="3" refnumber="53G-6-201" start="0">53G-6-201</xref>.</subsection><subsection ssid="8-null-10" dnum="g-o:i-i" numlevel="1" lineno="866" slineno="11-23" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1479" style="2" owner="o" level="1" deltag="both">(g)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1480" style="1" owner="i" level="1" amendtag="both" space="true">(i)</amend></display>"Principal" means the principal of the school in which a home school student <ln numlevel="1" lineno="867" slineno="11-24"/>participates or intends to participate in an extracurricular activity.</subsection></subsection><subsection ssid="8-null-11" dnum="2-o" numlevel="1" lineno="868" slineno="11-25" level="1" space="false"><display>(2)</display><subsection ssid="8-null-12" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A minor who is enrolled in a private school or a home school is eligible to <ln numlevel="1" lineno="869" slineno="11-26"/>participate in an extracurricular activity at a public school as provided in this section.</subsection><subsection ssid="8-null-13" dnum="b-o" numlevel="1" lineno="870" slineno="11-27" level="2"><display>(b)</display>A private school student may only participate in an extracurricular activity at a <ln numlevel="1" lineno="871" slineno="11-28"/>public school that is not offered by the student's private school.</subsection><subsection ssid="8-null-14" dnum="c-o" numlevel="1" lineno="872" slineno="11-29" level="2" space="false"><display>(c)</display><subsection ssid="8-null-15" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Except as provided in Subsection <xref depth="4" refnumber="53G-6-703(2)(d)" start="0">(2)(d)</xref>, a private school student or a home <ln numlevel="1" lineno="873" slineno="11-30"/>school student may only participate in an extracurricular activity at:<subsection ssid="8-null-16" dnum="A-o" numlevel="1" lineno="874" slineno="11-31" level="4" tab="1"><display>(A)</display>the school with attendance boundaries within which the student's custodial <ln numlevel="1" lineno="875" slineno="11-32"/>parent resides; or</subsection><subsection ssid="8-null-17" dnum="B-o" numlevel="1" lineno="876" slineno="11-33" level="4" tab="1"><display>(B)</display>the school from which the student withdrew for the purpose of attending a <ln numlevel="1" lineno="877" slineno="11-34"/>private or home school.</subsection></subsection><subsection ssid="8-null-18" dnum="ii-o" numlevel="1" lineno="878" slineno="11-35" level="3"><display>(ii)</display>A private school student or a home school student retains the ability to participate <ln numlevel="1" lineno="879" slineno="11-36"/>in an extracurricular activity at a school described in Subsection <xref depth="4" refnumber="53G-6-703(2)(c)(i)" start="0">(2)(c)(i)</xref> if the <ln numlevel="1" lineno="880" slineno="11-37"/>student did not initially establish the student's eligibility at another school in grade <ln numlevel="1" lineno="881" slineno="11-38"/>9 or 10.</subsection></subsection><subsection ssid="8-null-19" dnum="d-o" numlevel="1" lineno="882" slineno="11-39" level="2"><display>(d)</display>A school other than a school described in Subsection <xref depth="4" refnumber="53G-6-703(2)(c)(i)" start="0">(2)(c)(i)</xref> may allow a private <ln numlevel="1" lineno="883" slineno="11-40"/>school student or a home school student to participate in an extracurricular activity <ln numlevel="1" lineno="884" slineno="11-41"/>that the public school sponsors and supports if:<subsection ssid="8-null-20" dnum="i-o" numlevel="1" lineno="885" slineno="11-42" level="3"><display>(i)</display>for an interscholastic competition of athletic teams, the private school student or <ln numlevel="1" lineno="886" slineno="11-43"/>the home school student meets the initial establishment of eligibility requirements;</subsection><subsection ssid="8-null-21" dnum="ii-o" numlevel="1" lineno="887" slineno="11-44" level="3"><display>(ii)</display>for an interscholastic contest or competition for music, drama, or forensic groups <ln numlevel="1" lineno="888" slineno="11-45"/>or teams, the private school student, subject to Subsection <xref depth="4" refnumber="53G-6-703(2)(b)" start="0">(2)(b)</xref>, or the home <ln numlevel="1" lineno="889" slineno="11-46"/>school student meets the entry requirements for participation;</subsection><subsection ssid="8-null-22" dnum="iii-o" numlevel="1" lineno="890" slineno="11-47" level="3"><display>(iii)</display>the private school student or the home school student meets the eligibility <ln numlevel="1" lineno="891" slineno="11-48"/>requirements under this section; and</subsection><subsection ssid="8-null-23" dnum="iv-o" numlevel="1" lineno="892" slineno="11-49" level="3"><display>(iv)</display>the private school student or the home school student meets the enrollment <ln numlevel="1" lineno="893" slineno="11-50"/>requirements for public school in accordance with <xref depth="2" refnumber="53G-6-4" start="2">Part 4, School District <ln numlevel="1" lineno="894" slineno="11-51"/>Enrollment</xref>.</subsection></subsection></subsection><subsection ssid="8-null-24" dnum="3-o" numlevel="1" lineno="895" slineno="11-52" level="1" space="false"><display>(3)</display><subsection ssid="8-null-25" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsections <xref depth="4" refnumber="53G-6-703(4)" start="0">(4)</xref> through <xref depth="4" refnumber="53G-6-703(13)" start="0">(13)</xref>, a private school student or a <ln numlevel="1" lineno="896" slineno="11-53"/>home school student is eligible to participate in an extracurricular activity at a public <ln numlevel="1" lineno="897" slineno="11-54"/>school consistent with eligibility standards:<subsection ssid="8-null-26" dnum="i-o" numlevel="1" lineno="898" slineno="11-55" level="3" tab="1"><display>(i)</display>applied to a fully enrolled public school student;</subsection><subsection ssid="8-null-27" dnum="ii-o" numlevel="1" lineno="899" slineno="11-56" level="3" tab="1"><display>(ii)</display>of the public school where the private school student or the home school student <ln numlevel="1" lineno="900" slineno="11-57"/>participates in an extracurricular activity; and</subsection><subsection ssid="8-null-28" dnum="iii-o" numlevel="1" lineno="901" slineno="11-58" level="3" tab="1"><display>(iii)</display>for the extracurricular activity in which the private school or the home school <ln numlevel="1" lineno="902" slineno="11-59"/>student participates.</subsection></subsection><subsection ssid="8-null-29" dnum="b-o" numlevel="1" lineno="903" slineno="11-60" level="2"><display>(b)</display>A school district or public school may not impose additional requirements on a <ln numlevel="1" lineno="904" slineno="11-61"/>private school student or a home school student to participate in an extracurricular <ln numlevel="1" lineno="905" slineno="11-62"/>activity that are not imposed on a fully enrolled public school student.</subsection><subsection ssid="8-null-30" dnum="c-o" numlevel="1" lineno="906" slineno="11-63" level="2" space="false"><display>(c)</display><subsection ssid="8-null-31" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A private school student or a home school student who participates in an <ln numlevel="1" lineno="907" slineno="11-64"/>extracurricular activity at a public school shall pay the same fees as required of a <ln numlevel="1" lineno="908" slineno="11-65"/>fully enrolled public school student to participate in an extracurricular activity.</subsection><subsection ssid="8-null-32" dnum="ii-o" numlevel="1" lineno="909" slineno="11-66" level="3"><display>(ii)</display>If a local school board or a charter school governing board imposes a mandatory <ln numlevel="1" lineno="910" slineno="11-67"/>student activity fee for a student enrolled in a public school, the fee may be <ln numlevel="1" lineno="911" slineno="11-68"/>imposed on a private school student or a home school student who participates in <ln numlevel="1" lineno="912" slineno="11-69"/>an extracurricular activity at the public school if the same benefits of paying the <ln numlevel="1" lineno="913" slineno="11-70"/>mandatory student activity fee that are available to a fully enrolled public school <ln numlevel="1" lineno="914" slineno="11-71"/>student are available to a private school student or a home school student who <ln numlevel="1" lineno="915" slineno="11-72"/>participates in an extracurricular activity at the public school.</subsection></subsection></subsection><subsection ssid="8-null-33" dnum="4-o" numlevel="1" lineno="916" slineno="11-73" level="1"><display>(4)</display>Eligibility requirements based on school attendance are not applicable to a home school <ln numlevel="1" lineno="917" slineno="11-74"/>student.</subsection><subsection ssid="8-null-34" dnum="5-o" numlevel="1" lineno="918" slineno="11-75" level="1"><display>(5)</display>A home school student meets academic eligibility requirements to participate in an <ln numlevel="1" lineno="919" slineno="11-76"/>extracurricular activity if:<subsection ssid="8-null-35" dnum="a-o" numlevel="1" lineno="920" slineno="11-77" level="2"><display>(a)</display>the student is mastering the material in each course or subject being taught; and</subsection><subsection ssid="8-null-36" dnum="b-o" numlevel="1" lineno="921" slineno="11-78" level="2"><display>(b)</display>the student is maintaining satisfactory progress towards achievement or promotion.</subsection></subsection><subsection ssid="8-null-37" dnum="6-o" numlevel="1" lineno="922" slineno="11-79" level="1" space="false"><display>(6)</display><subsection ssid="8-null-38" dnum="a-o" level="2" placement="sameline"><display>(a)</display>To establish a home school student's academic eligibility, a parent, teacher, or <ln numlevel="1" lineno="923" slineno="11-80"/>organization providing instruction to the student shall submit an affidavit to the <ln numlevel="1" lineno="924" slineno="11-81"/>principal indicating the student meets academic eligibility requirements.</subsection><subsection ssid="8-null-39" dnum="b-o" numlevel="1" lineno="925" slineno="11-82" level="2"><display>(b)</display>Upon submission of an affidavit pursuant to Subsection <xref depth="4" refnumber="53G-6-703(6)(a)" start="0">(6)(a)</xref>, a home school student <ln numlevel="1" lineno="926" slineno="11-83"/>shall:<subsection ssid="8-null-40" dnum="i-o" numlevel="1" lineno="927" slineno="11-84" level="3"><display>(i)</display>be considered to meet academic eligibility requirements; and</subsection><subsection ssid="8-null-41" dnum="ii-o" numlevel="1" lineno="928" slineno="11-85" level="3"><display>(ii)</display>retain academic eligibility for all extracurricular activities during the activity <ln numlevel="1" lineno="929" slineno="11-86"/>season for which the affidavit is submitted, until:<subsection ssid="8-null-42" dnum="A-o" numlevel="1" lineno="930" slineno="11-87" level="4"><display>(A)</display>a panel established under Subsection <xref depth="4" refnumber="53G-6-703(10)" start="0">(10)</xref> determines the home school student <ln numlevel="1" lineno="931" slineno="11-88"/>does not meet academic eligibility requirements; or</subsection><subsection ssid="8-null-43" dnum="B-o" numlevel="1" lineno="932" slineno="11-89" level="4"><display>(B)</display>the person who submitted the affidavit under Subsection <xref depth="4" refnumber="53G-6-703(6)(a)" start="0">(6)(a)</xref> provides <ln numlevel="1" lineno="933" slineno="11-90"/>written notice to the school principal that the student no longer meets academic <ln numlevel="1" lineno="934" slineno="11-91"/>eligibility requirements.</subsection></subsection></subsection></subsection><subsection ssid="8-null-44" dnum="7-o" numlevel="1" lineno="935" slineno="11-92" level="1" space="false"><display>(7)</display><subsection ssid="8-null-45" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A home school student who loses academic eligibility pursuant to Subsection <xref depth="4" refnumber="53G-6-703(6)(b)(ii)(B)" start="0"><ln numlevel="1" lineno="936" slineno="11-93"/>(6)(b)(ii)(B)</xref> may not participate in an extracurricular activity until the person who <ln numlevel="1" lineno="937" slineno="11-94"/>submitted the affidavit under Subsection <xref depth="4" refnumber="53G-6-703(6)(a)" start="0">(6)(a)</xref> provides written notice to the school <ln numlevel="1" lineno="938" slineno="11-95"/>principal that the home school student has reestablished academic eligibility.</subsection><subsection ssid="8-null-46" dnum="b-o" numlevel="1" lineno="939" slineno="11-96" level="2"><display>(b)</display>If a home school student reestablishes academic eligibility pursuant to Subsection <xref depth="4" refnumber="53G-6-703(7)(a)" start="0"><ln numlevel="1" lineno="940" slineno="11-97"/>(7)(a)</xref>, the home school student may participate in extracurricular activities for the <ln numlevel="1" lineno="941" slineno="11-98"/>remainder of the activity season for which an affidavit was submitted under <ln numlevel="1" lineno="942" slineno="11-99"/>Subsection <xref depth="4" refnumber="53G-6-703(6)(a)" start="0">(6)(a)</xref>.</subsection></subsection><subsection ssid="8-null-47" dnum="8-o" numlevel="1" lineno="943" slineno="11-100" level="1"><display>(8)</display>A person who has probable cause to believe a home school student does not meet <ln numlevel="1" lineno="944" slineno="11-101"/>academic eligibility requirements may submit an affidavit to the principal:<subsection ssid="8-null-48" dnum="a-o" numlevel="1" lineno="945" slineno="11-102" level="2"><display>(a)</display>asserting the home school student does not meet academic eligibility requirements; <ln numlevel="1" lineno="946" slineno="11-103"/>and</subsection><subsection ssid="8-null-49" dnum="b-o" numlevel="1" lineno="947" slineno="11-104" level="2"><display>(b)</display>providing information indicating that the home school student does not meet the <ln numlevel="1" lineno="948" slineno="11-105"/>academic eligibility requirements.</subsection></subsection><subsection ssid="8-null-50" dnum="9-o" numlevel="1" lineno="949" slineno="11-106" level="1"><display>(9)</display>A principal shall review the affidavit submitted under Subsection <xref depth="4" refnumber="53G-6-703(8)" start="0">(8)</xref>, and if the <ln numlevel="1" lineno="950" slineno="11-107"/>principal determines it contains information which constitutes probable cause to believe <ln numlevel="1" lineno="951" slineno="11-108"/>a home school student may not meet academic eligibility requirements, the principal <ln numlevel="1" lineno="952" slineno="11-109"/>shall request a panel established pursuant to Subsection <xref depth="4" refnumber="53G-6-703(10)" start="0">(10)</xref> to verify the student's <ln numlevel="1" lineno="953" slineno="11-110"/>compliance with academic eligibility requirements.</subsection><subsection ssid="8-null-51" dnum="10-o" numlevel="1" lineno="954" slineno="11-111" level="1" space="false"><display>(10)</display><subsection ssid="8-null-52" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A school district superintendent shall:<subsection ssid="8-null-53" dnum="i-o" numlevel="1" lineno="955" slineno="11-112" level="3" tab="1"><display>(i)</display>appoint a panel of three individuals to verify a home school student's compliance <ln numlevel="1" lineno="956" slineno="11-113"/>with academic eligibility requirements when requested by a principal pursuant to <ln numlevel="1" lineno="957" slineno="11-114"/>Subsection <xref depth="4" refnumber="53G-6-703(9)" start="0">(9)</xref>; and</subsection><subsection ssid="8-null-54" dnum="ii-o" numlevel="1" lineno="958" slineno="11-115" level="3" tab="1"><display>(ii)</display>select the panel members from nominees submitted by national, state, or regional <ln numlevel="1" lineno="959" slineno="11-116"/>organizations whose members are home school students and parents.</subsection></subsection><subsection ssid="8-null-55" dnum="b-o" numlevel="1" lineno="960" slineno="11-117" level="2"><display>(b)</display>Of the members appointed to a panel under Subsection <xref depth="4" refnumber="53G-6-703(10)(a)" start="0">(10)(a)</xref>:<subsection ssid="8-null-56" dnum="i-o" numlevel="1" lineno="961" slineno="11-118" level="3"><display>(i)</display>one member shall have experience teaching in a public school as a licensed <ln numlevel="1" lineno="962" slineno="11-119"/>teacher and in home schooling high school-age students;</subsection><subsection ssid="8-null-57" dnum="ii-o" numlevel="1" lineno="963" slineno="11-120" level="3"><display>(ii)</display>one member shall have experience teaching in a higher education institution and <ln numlevel="1" lineno="964" slineno="11-121"/>in home schooling; and</subsection><subsection ssid="8-null-58" dnum="iii-o" numlevel="1" lineno="965" slineno="11-122" level="3"><display>(iii)</display>one member shall have experience in home schooling high school-age students.</subsection></subsection></subsection><subsection ssid="8-null-59" dnum="11-o" numlevel="1" lineno="966" slineno="11-123" level="1"><display>(11)</display>A panel appointed under Subsection <xref depth="4" refnumber="53G-6-703(10)" start="0">(10)</xref>:<subsection ssid="8-null-60" dnum="a-o" numlevel="1" lineno="967" slineno="11-124" level="2"><display>(a)</display>shall review the affidavit submitted under Subsection <xref depth="4" refnumber="53G-6-703(8)" start="0">(8)</xref>;</subsection><subsection ssid="8-null-61" dnum="b-o" numlevel="1" lineno="968" slineno="11-125" level="2"><display>(b)</display>may confer with the person who submitted the affidavit under Subsection <xref depth="4" refnumber="53G-6-703(8)" start="0">(8)</xref>;</subsection><subsection ssid="8-null-62" dnum="c-o" numlevel="1" lineno="969" slineno="11-126" level="2"><display>(c)</display>shall request the home school student to submit test scores or a portfolio of work <ln numlevel="1" lineno="970" slineno="11-127"/>documenting the student's academic achievement to the panel;</subsection><subsection ssid="8-null-63" dnum="d-o" numlevel="1" lineno="971" slineno="11-128" level="2"><display>(d)</display>shall review the test scores or portfolio of work; and</subsection><subsection ssid="8-null-64" dnum="e-o" numlevel="1" lineno="972" slineno="11-129" level="2"><display>(e)</display>shall determine whether the home school student meets academic eligibility <ln numlevel="1" lineno="973" slineno="11-130"/>requirements.</subsection></subsection><subsection ssid="8-null-65" dnum="12-o" numlevel="1" lineno="974" slineno="11-131" level="1"><display>(12)</display>A home school student who meets academic eligibility requirements pursuant to <ln numlevel="1" lineno="975" slineno="11-132"/>Subsection <xref depth="4" refnumber="53G-6-703(11)" start="0">(11)</xref>, retains academic eligibility for all extracurricular activities during the <ln numlevel="1" lineno="976" slineno="11-133"/>activity season for which an affidavit is submitted pursuant to Subsection <xref depth="4" refnumber="53G-6-703(6)" start="0">(6)</xref>.</subsection><subsection ssid="8-null-66" dnum="13-o" numlevel="1" lineno="977" slineno="11-134" level="1" space="false"><display>(13)</display><subsection ssid="8-null-67" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A panel's determination that a home school student does not comply with <ln numlevel="1" lineno="978" slineno="11-135"/>academic eligibility requirements is effective for an activity season and all <ln numlevel="1" lineno="979" slineno="11-136"/>extracurricular activities that have academic eligibility requirements.</subsection><subsection ssid="8-null-68" dnum="b-o" numlevel="1" lineno="980" slineno="11-137" level="2"><display>(b)</display>A home school student who is not in compliance with academic eligibility <ln numlevel="1" lineno="981" slineno="11-138"/>requirements as determined by a panel appointed under Subsection <xref depth="4" refnumber="53G-6-703(11)" start="0">(11)</xref> may seek to <ln numlevel="1" lineno="982" slineno="11-139"/>establish academic eligibility under this section for the next activity season.</subsection></subsection><subsection ssid="8-null-69" dnum="14-o" numlevel="1" lineno="983" slineno="11-140" level="1" space="false"><display>(14)</display><subsection ssid="8-null-70" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A public school student who has been declared to be academically ineligible to <ln numlevel="1" lineno="984" slineno="11-141"/>participate in an extracurricular activity and who subsequently enrolls in a home <ln numlevel="1" lineno="985" slineno="11-142"/>school shall lose eligibility for participation in the extracurricular activity until the <ln numlevel="1" lineno="986" slineno="11-143"/>student:<subsection ssid="8-null-71" dnum="i-o" numlevel="1" lineno="987" slineno="11-144" level="3" tab="1"><display>(i)</display>demonstrates academic eligibility by providing test results or a portfolio of the <ln numlevel="1" lineno="988" slineno="11-145"/>student's work to the school principal, provided that a student may not reestablish <ln numlevel="1" lineno="989" slineno="11-146"/>academic eligibility under this Subsection <xref depth="4" refnumber="53G-6-703(14)(a)" start="0">(14)(a)</xref> during the same activity season <ln numlevel="1" lineno="990" slineno="11-147"/>in which the student was declared to be academically ineligible;</subsection><subsection ssid="8-null-72" dnum="ii-o" numlevel="1" lineno="991" slineno="11-148" level="3" tab="1"><display>(ii)</display>returns to public school and reestablishes academic eligibility; or</subsection><subsection ssid="8-null-73" dnum="iii-o" numlevel="1" lineno="992" slineno="11-149" level="3" tab="1"><display>(iii)</display>enrolls in a private school and establishes academic eligibility.</subsection></subsection><subsection ssid="8-null-74" dnum="b-o" numlevel="1" lineno="993" slineno="11-150" level="2"><display>(b)</display>A public school student who has been declared to be behaviorally ineligible to <ln numlevel="1" lineno="994" slineno="11-151"/>participate in an extracurricular activity and who subsequently enrolls in a home <ln numlevel="1" lineno="995" slineno="11-152"/>school shall lose eligibility for participation in the extracurricular activity until the <ln numlevel="1" lineno="996" slineno="11-153"/>student meets eligibility standards as provided in Subsection <xref depth="4" refnumber="53G-6-703(3)" start="0">(3)</xref>.</subsection></subsection><subsection ssid="8-null-75" dnum="15-o" numlevel="1" lineno="997" slineno="11-154" level="1"><display>(15)</display>When selection to participate in an extracurricular activity at a public school is made <ln numlevel="1" lineno="998" slineno="11-155"/>on a competitive basis, a private school student or a home school student is eligible to <ln numlevel="1" lineno="999" slineno="11-156"/>try out for and participate in the activity as provided in this section.</subsection><subsection ssid="8-null-76" dnum="16-o" numlevel="1" lineno="1000" slineno="11-157" level="1" space="false"><display>(16)</display><subsection ssid="8-null-77" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If a student exits a public school to enroll in a private school or a home school <ln numlevel="1" lineno="1001" slineno="11-158"/>mid-semester or during an activity season, and the student desires to participate in an <ln numlevel="1" lineno="1002" slineno="11-159"/>extracurricular activity at the public school, the public school shall issue an interim <ln numlevel="1" lineno="1003" slineno="11-160"/>academic assessment based on the student's work in each class.</subsection><subsection ssid="8-null-78" dnum="b-o" numlevel="1" lineno="1004" slineno="11-161" level="2"><display>(b)</display>A student's academic eligibility to participate in an extracurricular activity under the <ln numlevel="1" lineno="1005" slineno="11-162"/>circumstances described in Subsection <xref depth="4" refnumber="53G-6-703(16)(a)" start="0">(16)(a)</xref> is dependent on the student meeting <ln numlevel="1" lineno="1006" slineno="11-163"/>public school academic eligibility standards at the time of exiting public school.</subsection><subsection ssid="8-null-79" dnum="c-o" numlevel="1" lineno="1007" slineno="11-164" level="2"><display>(c)</display>A student may appeal an academic eligibility determination made under Subsection <xref depth="4" refnumber="53G-6-703(16)(b)" start="0"><ln numlevel="1" lineno="1008" slineno="11-165"/>(16)(b)</xref> in accordance with procedures for appealing a public school student's <ln numlevel="1" lineno="1009" slineno="11-166"/>academic eligibility.</subsection></subsection></section></bsec><bsec buid="9" num="53G-6-706" type="amend" src="code" uid="C53G-6-S706_2026050620260506" sort="53G06 07060020260506" numlevel="1" lineno="1010" slineno="12-1" sn="12"><section number="53G-6-706" numlevel="1" lineno="1011" slineno="12-2" type="amend"><secline lineno="1010">Section 12. Section <bold>53G-6-706</bold> is amended to read:</secline><catline lineno="1011"><bold>53G-6-706<parens/>. Placement of a student of a home school, micro-education entity, or <ln numlevel="1" lineno="1012" slineno="12-3"/>home-based microschool, who transfers to a public school.</bold></catline><subsection ssid="9-null-1" dnum="1-o" numlevel="1" lineno="1013" slineno="12-4" level="1" placement="noreturn"><display>(1)</display>For the purposes of this section<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="8" groupid="7" style="2" owner="jchristopherson" level="1" deltag="both">,</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="25" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">:</amend> <subsection ssid="9-18" dnum="_-o:a-i" numlevel="1" lineno="1014" slineno="12-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1550" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="end">"Home-based student" means the same as that term is defined in Section <xref depth="3" level="2"><display><amend anum="0" ea="amend" pairid="1552" style="1" owner="i" level="1" amendtag="both">(c)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="15" groupid="13" style="2" owner="jchristopherson" level="1" deltag="both">"parent"</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="14" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">"Parent"</amend> means the same as that term is defined in Section <xref depth="3" refnumber="53G-6-201">53G-6-201</xref>.</subsection></subsection><subsection ssid="9-null-2" dnum="2-o" numlevel="1" lineno="1017" slineno="12-8" level="1"><display>(2)</display>When a home school student, <amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both">a home-based student, </amend>a home-based microschool student, <ln numlevel="1" lineno="1018" slineno="12-9"/>or a micro-education entity student transfers from a home school, a home-based <ln numlevel="1" lineno="1019" slineno="12-10"/>microschool, or a micro-education entity to a public school, the public school shall place <ln numlevel="1" lineno="1020" slineno="12-11"/>the student in the grade levels, classes, or courses that the student's parent and the school <ln numlevel="1" lineno="1021" slineno="12-12"/>administrator determine are appropriate based on the parent's assessment of the student's <ln numlevel="1" lineno="1022" slineno="12-13"/>academic performance.</subsection><subsection ssid="9-null-3" dnum="3-o" numlevel="1" lineno="1023" slineno="12-14" level="1" space="false"><display>(3)</display><subsection ssid="9-null-4" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Within 30 days of the student's placement in a public school grade level, class, or <ln numlevel="1" lineno="1024" slineno="12-15"/>course, either the student's teacher or the student's parent may request a conference to <ln numlevel="1" lineno="1025" slineno="12-16"/>consider changing the student's placement.</subsection><subsection ssid="9-null-5" dnum="b-o" numlevel="1" lineno="1026" slineno="12-17" level="2"><display>(b)</display>If the student's teacher and the student's parent agree on a placement change, the <ln numlevel="1" lineno="1027" slineno="12-18"/>public school shall place the student in the agreed upon grade level, class, or course.</subsection><subsection ssid="9-null-6" dnum="c-o" numlevel="1" lineno="1028" slineno="12-19" level="2"><display>(c)</display>If the student's teacher and the student's parent do not agree on a placement change, <ln numlevel="1" lineno="1029" slineno="12-20"/>the public school shall evaluate the student's subject matter mastery in accordance <ln numlevel="1" lineno="1030" slineno="12-21"/>with Subsection <xref depth="4" refnumber="53G-6-706(3)(d)">(3)(d)</xref>.</subsection><subsection ssid="9-null-7" dnum="d-o" numlevel="1" lineno="1031" slineno="12-22" level="2"><display>(d)</display>The student's parent has the option of:<subsection ssid="9-null-8" dnum="i-o" numlevel="1" lineno="1032" slineno="12-23" level="3"><display>(i)</display>allowing the public school to administer, to the student, assessments that are:<subsection ssid="9-null-9" dnum="A-o" numlevel="1" lineno="1033" slineno="12-24" level="4"><display>(A)</display>regularly administered to public school students; and</subsection><subsection ssid="9-null-10" dnum="B-o" numlevel="1" lineno="1034" slineno="12-25" level="4"><display>(B)</display>used to measure public school students' subject matter mastery and determine <ln numlevel="1" lineno="1035" slineno="12-26"/>placement; or</subsection></subsection><subsection ssid="9-null-11" dnum="ii-o" numlevel="1" lineno="1036" slineno="12-27" level="3"><display>(ii)</display>having a private entity or individual administer assessments of subject matter <ln numlevel="1" lineno="1037" slineno="12-28"/>mastery to the student at the parent's expense.</subsection></subsection><subsection ssid="9-null-12" dnum="e-o" numlevel="1" lineno="1038" slineno="12-29" level="2"><display>(e)</display>After an evaluation of a student's subject matter mastery, a public school may change <ln numlevel="1" lineno="1039" slineno="12-30"/>the student's placement in a grade level, class, or course.</subsection></subsection><subsection ssid="9-null-13" dnum="4-o" numlevel="1" lineno="1040" slineno="12-31" level="1"><display>(4)</display>In accordance with Section <xref depth="3" refnumber="53G-6-702">53G-6-702</xref>, this section does not apply to a student who is <ln numlevel="1" lineno="1041" slineno="12-32"/>dual enrolled in a public school and a:<subsection ssid="9-null-14" dnum="a-o" numlevel="1" lineno="1042" slineno="12-33" level="2"><display>(a)</display>home school;</subsection><subsection ssid="9-null-15" dnum="b-o" numlevel="1" lineno="1043" slineno="12-34" level="2"><display>(b)</display>home-based microschool; or</subsection><subsection ssid="9-null-16" dnum="c-o" numlevel="1" lineno="1044" slineno="12-35" level="2"><display>(c)</display>micro-education entity.</subsection></subsection></section></bsec><bsec buid="22" num="53G-6-710" type="amend" src="code" uid="C53G-6-S710_2026050620260506" sort="53G06 07100020260506" numlevel="1" lineno="1045" slineno="13-1" sn="13"><section number="53G-6-710" numlevel="1" lineno="1046" slineno="13-2" type="amend"><secline lineno="1045">Section 13. Section <bold>53G-6-710</bold> is amended to read:</secline><catline lineno="1046"><bold>53G-6-710<parens/>. Home-centered, school-supported enrollment option.</bold></catline><subsection ssid="22-null-1" dnum="1-o" numlevel="1" lineno="1047" slineno="13-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="22-null-2" dnum="a-o" numlevel="1" lineno="1048" slineno="13-4" level="2"><display>(a)</display>"Home-centered, school-supported enrollment option" means an enrollment option <ln numlevel="1" lineno="1049" slineno="13-5"/>for an LEA that allows participating students to:<subsection ssid="22-null-3" dnum="i-o" numlevel="1" lineno="1050" slineno="13-6" level="3"><display>(i)</display>complete the course work for one or more courses or subject areas from home <ln numlevel="1" lineno="1051" slineno="13-7"/>during part of the school day; and</subsection><subsection ssid="22-null-4" dnum="ii-o" numlevel="1" lineno="1052" slineno="13-8" level="3"><display>(ii)</display>attend in-person instruction for the remainder of the school day.</subsection></subsection><subsection ssid="22-21" dnum="_-o:b-i" numlevel="1" lineno="1053" slineno="13-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1572" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="end">"Home school" means the same as that term is defined in Section <xref depth="3" refnumber="53E-1-102">53E-1-102</xref>.</amend></subsection><subsection ssid="22-null-5" dnum="b-o:c-i" numlevel="1" lineno="1054" slineno="13-10" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1573" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1574" style="1" owner="i" level="1" amendtag="both" space="true">(c)</amend></display>"Local education agency" or "LEA" means a school district or charter school.</subsection><subsection ssid="22-null-6" dnum="c-o:d-i" numlevel="1" lineno="1055" slineno="13-11" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1574" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1575" style="1" owner="i" level="1" amendtag="both" space="true">(d)</amend></display>"Participating student" means a student who is:<subsection ssid="22-null-7" dnum="i-o" numlevel="1" lineno="1056" slineno="13-12" level="3"><display>(i)</display>enrolled in an LEA; and</subsection><subsection ssid="22-null-8" dnum="ii-o" numlevel="1" lineno="1057" slineno="13-13" level="3"><display>(ii)</display>approved to participate in a home-centered, school-supported enrollment option <ln numlevel="1" lineno="1058" slineno="13-14"/>provided by the LEA.</subsection></subsection></subsection><subsection ssid="22-null-9" dnum="2-o" numlevel="1" lineno="1059" slineno="13-15" level="1" space="false"><display>(2)</display><subsection ssid="22-null-10" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An LEA may provide a home-centered, school-supported enrollment option.</subsection><subsection ssid="22-null-11" dnum="b-o" numlevel="1" lineno="1060" slineno="13-16" level="2"><display>(b)</display>An LEA that provides a home-centered, school-supported enrollment option shall:<subsection ssid="22-null-12" dnum="i-o" numlevel="1" lineno="1061" slineno="13-17" level="3"><display>(i)</display>establish standards and requirements for student participation;</subsection><subsection ssid="22-null-13" dnum="ii-o" numlevel="1" lineno="1062" slineno="13-18" level="3"><display>(ii)</display>provide the instructional materials to be used by a participating student;</subsection><subsection ssid="22-null-14" dnum="iii-o" numlevel="1" lineno="1063" slineno="13-19" level="3"><display>(iii)</display>provide a participating student's parent with resources the LEA considers <ln numlevel="1" lineno="1064" slineno="13-20"/>appropriate to assist in parent involvement with student learning;</subsection><subsection ssid="22-null-15" dnum="iv-o" numlevel="1" lineno="1065" slineno="13-21" level="3"><display>(iv)</display>develop assessments to measure a participating student's academic progress;</subsection><subsection ssid="22-null-16" dnum="v-o" numlevel="1" lineno="1066" slineno="13-22" level="3"><display>(v)</display>administer the assessments described in Subsection <xref depth="4" refnumber="53G-6-710(2)(b)(iv)" start="0">(2)(b)(iv)</xref> to a participating <ln numlevel="1" lineno="1067" slineno="13-23"/>student, subject to Subsection <xref depth="4" refnumber="53G-6-803(9)" start="0">53G-6-803(9)</xref>; and</subsection><subsection ssid="22-null-17" dnum="vi-o" numlevel="1" lineno="1068" slineno="13-24" level="3"><display>(vi)</display>monitor compliance with the standards and requirements established under <ln numlevel="1" lineno="1069" slineno="13-25"/>Subsection <xref depth="4" refnumber="53G-6-710(2)(b)(i)" start="0">(2)(b)(i)</xref>.</subsection></subsection></subsection><subsection ssid="22-null-18" dnum="3-o" numlevel="1" lineno="1070" slineno="13-26" level="1"><display>(3)</display>A student who attends a home school pursuant to Section <xref depth="3" refnumber="53G-6-204" start="0">53G-6-204</xref> is not eligible to <ln numlevel="1" lineno="1071" slineno="13-27"/>participate in a home-centered, school-supported enrollment option.</subsection><subsection ssid="22-null-19" dnum="4-o" numlevel="1" lineno="1072" slineno="13-28" level="1"><display>(4)</display>A participating student is subject to a statewide assessment, as defined in Section <xref depth="3" refnumber="53E-4-301" start="0"><ln numlevel="1" lineno="1073" slineno="13-29"/>53E-4-301</xref>, to the same extent as a student who is not participating.</subsection><subsection ssid="22-null-20" dnum="5-o" numlevel="1" lineno="1074" slineno="13-30" level="1"><display>(5)</display>A student's participation in a home-centered, school-supported enrollment option <ln numlevel="1" lineno="1075" slineno="13-31"/>provided by an LEA does not reduce or otherwise affect enrollment count for purposes <ln numlevel="1" lineno="1076" slineno="13-32"/>of computing the LEA's Minimum School Program funds under <xref depth="1" refnumber="53F-2" start="0">Title 53F, Chapter 2, <ln numlevel="1" lineno="1077" slineno="13-33"/>State Funding -- Minimum School Program</xref>.</subsection></section></bsec><bsec buid="29" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="1078" slineno="14-1" sn="14"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="1078">Section 14.  <bold>Effective Date.</bold></secline><sectionText lineno="1079"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>1-12-26 3:12 PM</tm></rev></foot></leg>
