Section <bold>76-5-106.5</bold> is amended to read:</secline><catline lineno="22"><bold>76-5-106.5<parens/>. Stalking.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="23" slineno="1-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="1-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>As used in this section:<subsection ssid="1-null-3" dnum="i-o" numlevel="1" lineno="24" slineno="1-4" level="3" tab="1"><display>(i)</display>"Course of conduct" means two or more acts directed at or toward a specific <ln numlevel="1" lineno="25" slineno="1-5"/>individual, including:<subsection ssid="1-null-4" dnum="A-o" numlevel="1" lineno="26" slineno="1-6" level="4"><display>(A)</display>acts in which the actor follows, monitors, observes, photographs, surveils, <ln numlevel="1" lineno="27" slineno="1-7"/>threatens, or communicates to or about an individual, or interferes with an <ln numlevel="1" lineno="28" slineno="1-8"/>individual's property:<subsection ssid="1-null-5" dnum="I-o" numlevel="1" lineno="29" slineno="1-9" level="5"><display>(I)</display>directly, indirectly, or through any third party; and</subsection><subsection ssid="1-null-6" dnum="II-o" numlevel="1" lineno="30" slineno="1-10" level="5"><display>(II)</display>by any action, method, device, or means; or</subsection></subsection><subsection ssid="1-null-7" dnum="B-o" numlevel="1" lineno="31" slineno="1-11" level="4"><display>(B)</display>when the actor engages in any of the following acts or causes someone else to <ln numlevel="1" lineno="32" slineno="1-12"/>engage in any of these acts:<subsection ssid="1-null-8" dnum="I-o" numlevel="1" lineno="33" slineno="1-13" level="5"><display>(I)</display>approaches or confronts an individual;</subsection><subsection ssid="1-null-9" dnum="II-o" numlevel="1" lineno="34" slineno="1-14" level="5"><display>(II)</display>appears at the individual's workplace or contacts the individual's employer <ln numlevel="1" lineno="35" slineno="1-15"/>or coworker;</subsection><subsection ssid="1-null-10" dnum="III-o" numlevel="1" lineno="36" slineno="1-16" level="5"><display>(III)</display>appears at an individual's <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="67" groupid="55" style="2" owner="jchristopherson" level="1" deltag="both">residence </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="66" groupid="54" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">dwelling </amend>or contacts an individual's <ln numlevel="1" lineno="37" slineno="1-17"/>neighbor, or enters property owned, leased, or occupied by an individual;</subsection><subsection ssid="1-null-11" dnum="IV-o" numlevel="1" lineno="38" slineno="1-18" level="5"><display>(IV)</display>sends material by any means to the individual or for the purpose of <ln numlevel="1" lineno="39" slineno="1-19"/>obtaining or disseminating information about or communicating with the <ln numlevel="1" lineno="40" slineno="1-20"/>individual to a member of the individual's family or household, employer, <ln numlevel="1" lineno="41" slineno="1-21"/>coworker, friend, or associate of the individual;</subsection><subsection ssid="1-null-12" dnum="V-o" numlevel="1" lineno="42" slineno="1-22" level="5"><display>(V)</display>places an object on or delivers an object to property owned, leased, or <ln numlevel="1" lineno="43" slineno="1-23"/>occupied by an individual, or to the individual's place of employment with <ln numlevel="1" lineno="44" slineno="1-24"/>the intent that the object be delivered to the individual; or</subsection><subsection ssid="1-null-13" dnum="VI-o" numlevel="1" lineno="45" slineno="1-25" level="5"><display>(VI)</display>uses a computer, the Internet, text messaging, or any other electronic <ln numlevel="1" lineno="46" slineno="1-26"/>means to commit an act that is a part of the course of conduct.</subsection></subsection></subsection><subsection ssid="1-87" dnum="_-o:ii-i" numlevel="1" lineno="47" slineno="1-27" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1013" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="64" groupid="52" style="1" owner="jchristopherson" level="1" amendtag="end">"Dwelling" means the same as that term is defined in Section <xref depth="3" refnumber="76-6-201">76-6-201</xref>.</amend></subsection><subsection ssid="1-null-14" dnum="ii-o:iii-i" numlevel="1" lineno="48" slineno="1-28" level="3" tab="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1014" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1015" style="1" owner="i" level="1" amendtag="both" space="true">(iii)</amend></display><subsection ssid="1-null-15" dnum="A-o" level="4" placement="sameline"><display>(A)</display>"Emotional distress" means significant mental or psychological <ln numlevel="1" lineno="49" slineno="1-29"/>suffering, whether or not medical or other professional treatment or counseling <ln numlevel="1" lineno="50" slineno="1-30"/>is required.</subsection><subsection ssid="1-null-16" dnum="B-o" numlevel="1" lineno="51" slineno="1-31" level="4"><display>(B)</display>"Emotional distress" includes significant mental or psychological suffering <ln numlevel="1" lineno="52" slineno="1-32"/>resulting from harm to an animal.</subsection></subsection><subsection ssid="1-null-17" dnum="iii-o:iv-i" numlevel="1" lineno="53" slineno="1-33" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1017" style="2" owner="o" level="1" deltag="both">(iii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="both" space="true">(iv)</amend></display>"Immediate family" means a spouse, parent, child, sibling, or any other <ln numlevel="1" lineno="54" slineno="1-34"/>individual who regularly resides in the household or who regularly resided in the <ln numlevel="1" lineno="55" slineno="1-35"/>household within the prior six months.</subsection><subsection ssid="1-null-18" dnum="iv-o:v-i" numlevel="1" lineno="56" slineno="1-36" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1018" style="2" owner="o" level="1" deltag="both">(iv)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1019" style="1" owner="i" level="1" amendtag="both" space="true">(v)</amend></display>"Private investigator" means the same as that term is defined in Section <xref refnumber="76-12-305" depth="4"><ln numlevel="1" lineno="57" slineno="1-37"/>76-12-305</xref>.</subsection><subsection ssid="1-null-19" dnum="v-o:vi-i" numlevel="1" lineno="58" slineno="1-38" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1019" style="2" owner="o" level="1" deltag="both">(v)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1020" style="1" owner="i" level="1" amendtag="both" space="true">(vi)</amend></display>"Reasonable person" means a reasonable person in the victim's <ln numlevel="1" lineno="59" slineno="1-39"/>circumstances.</subsection><subsection ssid="1-null-20" dnum="vi-o:vii-i" numlevel="1" lineno="60" slineno="1-40" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1020" style="2" owner="o" level="1" deltag="both">(vi)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1021" style="1" owner="i" level="1" amendtag="both" space="true">(vii)</amend></display>"Stalking" means an offense as described in Subsection <xref depth="4" refnumber="76-5-106.5(2)">(2)</xref>.</subsection><subsection ssid="1-null-21" dnum="vii-o:viii-i" numlevel="1" lineno="61" slineno="1-41" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1021" style="2" owner="o" level="1" deltag="both">(vii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1022" style="1" owner="i" level="1" amendtag="both" space="true">(viii)</amend></display>"Text messaging" means a communication in the form of electronic text <ln numlevel="1" lineno="62" slineno="1-42"/>or one or more electronic images sent by the actor from a telephone or computer <ln numlevel="1" lineno="63" slineno="1-43"/>to another individual's telephone or computer by addressing the communication to <ln numlevel="1" lineno="64" slineno="1-44"/>the recipient's telephone number.</subsection></subsection><subsection ssid="1-null-22" dnum="b-o" numlevel="1" lineno="65" slineno="1-45" level="2"><display>(b)</display>Terms defined in Section <xref depth="3" refnumber="76-1-101.5">76-1-101.5</xref> apply to this section.</subsection></subsection><subsection ssid="1-null-23" dnum="2-o" numlevel="1" lineno="66" slineno="1-46" level="1"><display>(2)</display>An actor commits stalking if the actor intentionally or knowingly:<subsection ssid="1-null-24" dnum="a-o" numlevel="1" lineno="67" slineno="1-47" level="2"><display>(a)</display>engages in a course of conduct directed at a specific individual and knows or is <ln numlevel="1" lineno="68" slineno="1-48"/>reckless as to whether the course of conduct would cause a reasonable person:<subsection ssid="1-null-25" dnum="i-o" numlevel="1" lineno="69" slineno="1-49" level="3"><display>(i)</display>to fear for the individual's own safety or the safety of a third individual; or</subsection><subsection ssid="1-null-26" dnum="ii-o" numlevel="1" lineno="70" slineno="1-50" level="3"><display>(ii)</display>to suffer other emotional distress; or</subsection></subsection><subsection ssid="1-null-27" dnum="b-o" numlevel="1" lineno="71" slineno="1-51" level="2"><display>(b)</display>violates:<subsection ssid="1-null-28" dnum="i-o" numlevel="1" lineno="72" slineno="1-52" level="3"><display>(i)</display>a stalking injunction issued under Title 78B, Chapter 7, Part 7, Civil Stalking <ln numlevel="1" lineno="73" slineno="1-53"/>Injunctions; or</subsection><subsection ssid="1-null-29" dnum="ii-o" numlevel="1" lineno="74" slineno="1-54" level="3"><display>(ii)</display>a permanent criminal stalking injunction issued under Title 78B, Chapter 7, Part 9, <ln numlevel="1" lineno="75" slineno="1-55"/>Criminal Stalking Injunctions.</subsection></subsection></subsection><subsection ssid="1-null-30" dnum="3-o" numlevel="1" lineno="76" slineno="1-56" level="1" space="false"><display>(3)</display><subsection ssid="1-null-31" dnum="a-o" level="2" placement="sameline"><display>(a)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="52" groupid="41" style="2" owner="jchristopherson" level="1" deltag="both">A </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="48" groupid="37" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Except as provided in Subsection <xref depth="4" refnumber="76-5-106.5(3)(b)">(3)(b)</xref> or <xref depth="4" refnumber="76-5-106.5(c)">(c)</xref>, a </amend>violation of Subsection <xref depth="4" refnumber="76-5-106.5(2)">(2)</xref> is <ln numlevel="1" lineno="77" slineno="1-57"/>a class A misdemeanor:<subsection ssid="1-null-32" dnum="i-o" numlevel="1" lineno="78" slineno="1-58" level="3" tab="1"><display>(i)</display>upon the actor's first violation of Subsection <xref depth="4" refnumber="76-5-106.5(2)">(2)</xref>; or</subsection><subsection ssid="1-null-33" dnum="ii-o" numlevel="1" lineno="79" slineno="1-59" level="3" tab="1"><display>(ii)</display>if the actor violated a stalking injunction issued under Title 78B, Chapter 7, Part 7, <ln numlevel="1" lineno="80" slineno="1-60"/>Civil Stalking Injunctions.</subsection></subsection><subsection ssid="1-null-34" dnum="b-o" numlevel="1" lineno="81" slineno="1-61" level="2"><display>(b)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="53" groupid="42" style="2" owner="jchristopherson" level="1" deltag="both">Notwithstanding Subsection (3)(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="49" groupid="38" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Except as provided in Subsection <xref refnumber="1-null-40">(3)(c)</xref></amend>, a <ln numlevel="1" lineno="82" slineno="1-62"/>violation of Subsection <xref depth="4" refnumber="76-5-106.5(2)">(2)</xref> is a third degree felony if the actor:<subsection ssid="1-null-35" dnum="i-o" numlevel="1" lineno="83" slineno="1-63" level="3"><display>(i)</display>has been previously convicted of an offense of stalking;</subsection><subsection ssid="1-null-36" dnum="ii-o" numlevel="1" lineno="84" slineno="1-64" level="3"><display>(ii)</display>has been previously convicted in another jurisdiction of an offense that is <ln numlevel="1" lineno="85" slineno="1-65"/>substantially similar to the offense of stalking;</subsection><subsection ssid="1-null-37" dnum="iii-o" numlevel="1" lineno="86" slineno="1-66" level="3"><display>(iii)</display>has been previously convicted of any felony offense in Utah or of any crime in <ln numlevel="1" lineno="87" slineno="1-67"/>another jurisdiction which if committed in Utah would be a felony, in which the <ln numlevel="1" lineno="88" slineno="1-68"/>victim of the stalking offense or a member of the victim's immediate family was <ln numlevel="1" lineno="89" slineno="1-69"/>also a victim of the previous felony offense;</subsection><subsection ssid="1-null-38" dnum="iv-o" numlevel="1" lineno="90" slineno="1-70" level="3"><display>(iv)</display>violated a permanent criminal stalking injunction issued under Title 78B, <ln numlevel="1" lineno="91" slineno="1-71"/>Chapter 7, Part 9, Criminal Stalking Injunctions; or</subsection><subsection ssid="1-null-39" dnum="v-o" numlevel="1" lineno="92" slineno="1-72" level="3"><display>(v)</display>has been or is at the time of the offense a cohabitant, as defined in Section <xref depth="3" refnumber="78B-7-102"><ln numlevel="1" lineno="93" slineno="1-73"/>78B-7-102</xref>, of the victim.</subsection></subsection><subsection ssid="1-null-40" dnum="c-o" numlevel="1" lineno="94" slineno="1-74" level="2"><display>(c)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="56" groupid="45" style="2" owner="jchristopherson" level="1" deltag="both">Notwithstanding Subsection (3)(a) or (b), a </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="50" groupid="39" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">A </amend>violation of Subsection <xref depth="4" refnumber="76-5-106.5(2)">(2)</xref> is a <ln numlevel="1" lineno="95" slineno="1-75"/>second degree felony if the actor:<subsection ssid="1-null-41" dnum="i-o" numlevel="1" lineno="96" slineno="1-76" level="3"><display>(i)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="34" groupid="26" style="2" owner="jchristopherson" level="1" deltag="both">used a dangerous weapon or used other means or force likely to produce death or <ln numlevel="1" lineno="97" slineno="1-77"/>serious bodily injury, </amend><amendoutend style="2"/>in the commission of the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="59" groupid="48" style="2" owner="jchristopherson" level="1" deltag="both">crime of stalking;</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="33" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">violation of <ln numlevel="1" lineno="98" slineno="1-78"/>Subsection <xref refnumber="1-null-23">(2)</xref>:</amend><subsection ssid="1-79" dnum="_-o:A-i" numlevel="1" lineno="99" slineno="1-79" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1042" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="41" groupid="32" style="1" owner="jchristopherson" level="1" amendtag="end">used a dangerous weapon or used other means or force likely to produce death <ln numlevel="1" lineno="100" slineno="1-80"/>or serious bodily injury; or</amend></subsection><subsection ssid="1-86" dnum="_-o:B-i" numlevel="1" lineno="101" slineno="1-81" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1043" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="40" groupid="31" style="1" owner="jchristopherson" level="1" amendtag="end">entered, under circumstances that the actor knew were unlawful, the victim's <ln numlevel="1" lineno="102" slineno="1-82"/>dwelling;</amend></subsection></subsection><subsection ssid="1-null-42" dnum="ii-o" numlevel="1" lineno="103" slineno="1-83" level="3"><display>(ii)</display>has been previously convicted two or more times of the offense of stalking;</subsection><subsection ssid="1-null-43" dnum="iii-o" numlevel="1" lineno="104" slineno="1-84" level="3"><display>(iii)</display>has been convicted two or more times in another jurisdiction or jurisdictions of <ln numlevel="1" lineno="105" slineno="1-85"/>offenses that are substantially similar to the offense of stalking;</subsection><subsection ssid="1-null-44" dnum="iv-o" numlevel="1" lineno="106" slineno="1-86" level="3"><display>(iv)</display>has been convicted two or more times, in any combination, of offenses under <ln numlevel="1" lineno="107" slineno="1-87"/>Subsection <xref depth="4" refnumber="76-5-106.5(3)(b)(i)">(3)(b)(i)</xref>, (ii), or (iii);</subsection><subsection ssid="1-null-45" dnum="v-o" numlevel="1" lineno="108" slineno="1-88" level="3"><display>(v)</display>has been previously convicted two or more times of felony offenses in Utah or of <ln numlevel="1" lineno="109" slineno="1-89"/>crimes in another jurisdiction or jurisdictions which, if committed in Utah, would <ln numlevel="1" lineno="110" slineno="1-90"/>be felonies, in which the victim of the stalking was also a victim of the previous <ln numlevel="1" lineno="111" slineno="1-91"/>felony offenses; or</subsection><subsection ssid="1-null-46" dnum="vi-o" numlevel="1" lineno="112" slineno="1-92" level="3"><display>(vi)</display>has been previously convicted of an offense under Subsection <xref depth="4" refnumber="76-5-106.5(3)(b)(iv)">(3)(b)(iv)</xref> or <xref depth="4" refnumber="76-5-106.5(v)">(v)</xref>.</subsection></subsection></subsection><subsection ssid="1-null-47" dnum="4-o" numlevel="1" lineno="113" slineno="1-93" level="1"><display>(4)</display>In a prosecution under this section, it is not a defense that the actor:<subsection ssid="1-null-48" dnum="a-o" numlevel="1" lineno="114" slineno="1-94" level="2"><display>(a)</display>was not given actual notice that the course of conduct was unwanted; or</subsection><subsection ssid="1-null-49" dnum="b-o" numlevel="1" lineno="115" slineno="1-95" level="2"><display>(b)</display>did not intend to cause the victim fear or other emotional distress.</subsection></subsection><subsection ssid="1-null-50" dnum="5-o" numlevel="1" lineno="116" slineno="1-96" level="1"><display>(5)</display>An offense of stalking may be prosecuted under this section in any jurisdiction where <ln numlevel="1" lineno="117" slineno="1-97"/>one or more of the acts that is part of the course of conduct was initiated or caused an <ln numlevel="1" lineno="118" slineno="1-98"/>effect on the victim.</subsection><subsection ssid="1-null-51" dnum="6-o" numlevel="1" lineno="119" slineno="1-99" level="1" space="false"><display>(6)</display><subsection ssid="1-null-52" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="76-5-106.5(6)(b)">(6)(b)</xref>, an actor does not violate this section if:<subsection ssid="1-null-53" dnum="i-o" numlevel="1" lineno="120" slineno="1-100" level="3" tab="1"><display>(i)</display>the actor is acting: <subsection ssid="1-null-54" dnum="A-o" numlevel="1" lineno="121" slineno="1-101" level="4"><display>(A)</display>in the actor's official capacity as a law enforcement officer, governmental <ln numlevel="1" lineno="122" slineno="1-102"/>investigator, or private investigator; and </subsection><subsection ssid="1-null-55" dnum="B-o" numlevel="1" lineno="123" slineno="1-103" level="4"><display>(B)</display>for a legitimate official or business purpose; or </subsection></subsection><subsection ssid="1-null-56" dnum="ii-o" numlevel="1" lineno="124" slineno="1-104" level="3" tab="1" space="false"><display>(ii)</display><subsection ssid="1-null-57" dnum="A-o" level="4" placement="sameline"><display>(A)</display>the actor is the owner of a business;</subsection><subsection ssid="1-null-58" dnum="B-o" numlevel="1" lineno="125" slineno="1-105" level="4"><display>(B)</display>the actor engages in a course of conduct that is reasonable and necessary to <ln numlevel="1" lineno="126" slineno="1-106"/>protect the actor's ownership interest in the business;</subsection><subsection ssid="1-null-59" dnum="C-o" numlevel="1" lineno="127" slineno="1-107" level="4"><display>(C)</display>the conduct is not directed at a cohabitant, as that term is defined in Section <xref depth="3" refnumber="78B-7-102"><ln numlevel="1" lineno="128" slineno="1-108"/>78B-7-102</xref>; and</subsection><subsection ssid="1-null-60" dnum="D-o" numlevel="1" lineno="129" slineno="1-109" level="4"><display>(D)</display>the actor's conduct does not violate any other provision of this code.</subsection></subsection></subsection><subsection ssid="1-null-61" dnum="b-o" numlevel="1" lineno="130" slineno="1-110" level="2"><display>(b)</display>A private investigator is not exempt from this section if the private investigator <ln numlevel="1" lineno="131" slineno="1-111"/>engages in conduct that would constitute a ground for disciplinary action under <ln numlevel="1" lineno="132" slineno="1-112"/>Section <xref depth="3" refnumber="53-9-118">53-9-118</xref>.</subsection></subsection><subsection ssid="1-null-62" dnum="7-o" numlevel="1" lineno="133" slineno="1-113" level="1" space="false"><display>(7)</display><subsection ssid="1-null-63" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A permanent criminal stalking injunction limiting the contact between the actor <ln numlevel="1" lineno="134" slineno="1-114"/>and victim may be filed in accordance with Section <xref depth="3" refnumber="78B-7-902">78B-7-902</xref>.</subsection><subsection ssid="1-null-64" dnum="b-o" numlevel="1" lineno="135" slineno="1-115" level="2"><display>(b)</display>This section does not preclude the filing of criminal information for stalking based <ln numlevel="1" lineno="136" slineno="1-116"/>on the same act <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="60" groupid="49" style="2" owner="jchristopherson" level="1" deltag="both">which</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="51" groupid="40" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">that</amend> is the basis for the violation of the stalking injunction <ln numlevel="1" lineno="137" slineno="1-117"/>issued under Title 78B, Chapter 7, Part 7, Civil Stalking Injunctions, or a permanent <ln numlevel="1" lineno="138" slineno="1-118"/>criminal stalking injunction issued under Title 78B, Chapter 7, Part 9, Criminal <ln numlevel="1" lineno="139" slineno="1-119"/>Stalking Injunctions.</subsection></subsection><subsection ssid="1-null-65" dnum="8-o" numlevel="1" lineno="140" slineno="1-120" level="1" space="false"><display>(8)</display><subsection ssid="1-null-66" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A law enforcement officer who responds to an allegation of stalking shall use all <ln numlevel="1" lineno="141" slineno="1-121"/>reasonable means to protect the victim and prevent further violence, including:<subsection ssid="1-null-67" dnum="i-o" numlevel="1" lineno="142" slineno="1-122" level="3" tab="1"><display>(i)</display>taking action that, in the officer's discretion, is reasonably necessary to provide for <ln numlevel="1" lineno="143" slineno="1-123"/>the safety of the victim and any family or household member;</subsection><subsection ssid="1-null-68" dnum="ii-o" numlevel="1" lineno="144" slineno="1-124" level="3" tab="1"><display>(ii)</display>confiscating the weapon or weapons involved in the alleged stalking;</subsection><subsection ssid="1-null-69" dnum="iii-o" numlevel="1" lineno="145" slineno="1-125" level="3" tab="1"><display>(iii)</display>making arrangements for the victim and any child to obtain emergency housing <ln numlevel="1" lineno="146" slineno="1-126"/>or shelter;</subsection><subsection ssid="1-null-70" dnum="iv-o" numlevel="1" lineno="147" slineno="1-127" level="3" tab="1"><display>(iv)</display>providing protection while the victim removes essential personal effects;</subsection><subsection ssid="1-null-71" dnum="v-o" numlevel="1" lineno="148" slineno="1-128" level="3" tab="1"><display>(v)</display>arranging, facilitating, or providing for the victim and any child to obtain medical <ln numlevel="1" lineno="149" slineno="1-129"/>treatment; and</subsection><subsection ssid="1-null-72" dnum="vi-o" numlevel="1" lineno="150" slineno="1-130" level="3" tab="1"><display>(vi)</display>arranging, facilitating, or providing the victim with immediate and adequate <ln numlevel="1" lineno="151" slineno="1-131"/>notice of the rights of victims and of the remedies and services available to <ln numlevel="1" lineno="152" slineno="1-132"/>victims of stalking, in accordance with Subsection <xref depth="4" refnumber="76-5-106.5(8)(b)">(8)(b)</xref>.</subsection></subsection><subsection ssid="1-null-73" dnum="b-o" numlevel="1" lineno="153" slineno="1-133" level="2" space="false"><display>(b)</display><subsection ssid="1-null-74" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A law enforcement officer shall give written notice to the victim in simple <ln numlevel="1" lineno="154" slineno="1-134"/>language, describing the rights and remedies available under this section and Title <ln numlevel="1" lineno="155" slineno="1-135"/>78B, Chapter 7, Part 7, Civil Stalking Injunctions.</subsection><subsection ssid="1-null-75" dnum="ii-o" numlevel="1" lineno="156" slineno="1-136" level="3"><display>(ii)</display>The written notice shall also include:<subsection ssid="1-null-76" dnum="A-o" numlevel="1" lineno="157" slineno="1-137" level="4"><display>(A)</display>a statement that the forms needed in order to obtain a stalking injunction are <ln numlevel="1" lineno="158" slineno="1-138"/>available from the court clerk's office in the judicial district where the victim <ln numlevel="1" lineno="159" slineno="1-139"/>resides or is temporarily domiciled; and</subsection><subsection ssid="1-null-77" dnum="B-o" numlevel="1" lineno="160" slineno="1-140" level="4"><display>(B)</display>a list of shelters, services, and resources available in the appropriate <ln numlevel="1" lineno="161" slineno="1-141"/>community, together with telephone numbers, to assist the victim in accessing <ln numlevel="1" lineno="162" slineno="1-142"/>any needed assistance.</subsection></subsection></subsection><subsection ssid="1-null-78" dnum="c-o" numlevel="1" lineno="163" slineno="1-143" level="2"><display>(c)</display>If a weapon is confiscated under this Subsection <xref depth="4" refnumber="76-5-106.5(8)">(8)</xref>, the law enforcement agency <ln numlevel="1" lineno="164" slineno="1-144"/>shall return the weapon to the individual from whom the weapon is confiscated if a <ln numlevel="1" lineno="165" slineno="1-145"/>stalking injunction is not issued or once the stalking injunction is terminated.</subsection></subsection></section></bsec><bsec buid="2" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="166" slineno="2-1" sn="2"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="166">Section 2.  <bold>Effective Date.</bold></secline><sectionText lineno="167"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6,
