Section <bold>58-37-8</bold> is amended to read:</secline><catline lineno="26"><bold>58-37-8<parens/>. Prohibited acts -- Penalties.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="27" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>Prohibited acts A -- Penalties and reporting:<subsection ssid="1-null-2" dnum="a-o" numlevel="1" lineno="28" slineno="1-4" level="2"><display>(a)</display>Except as authorized by this chapter, and under circumstances not amounting to an <ln numlevel="1" lineno="29" slineno="1-5"/>offense described in Section <xref depth="3" refnumber="58-37-8.1">58-37-8.1</xref>, trafficking of fentanyl or a fentanyl-related <ln numlevel="1" lineno="30" slineno="1-6"/>substance, it is unlawful for a person to knowingly and intentionally:<subsection ssid="1-null-3" dnum="i-o" numlevel="1" lineno="31" slineno="1-7" level="3"><display>(i)</display>produce, manufacture, or dispense, or to possess with intent to produce, <ln numlevel="1" lineno="32" slineno="1-8"/>manufacture, or dispense, a controlled or counterfeit substance;</subsection><subsection ssid="1-null-4" dnum="ii-o" numlevel="1" lineno="33" slineno="1-9" level="3"><display>(ii)</display>distribute a controlled or counterfeit substance, or to agree, consent, offer, or <ln numlevel="1" lineno="34" slineno="1-10"/>arrange to distribute a controlled or counterfeit substance;</subsection><subsection ssid="1-null-5" dnum="iii-o" numlevel="1" lineno="35" slineno="1-11" level="3"><display>(iii)</display>possess a controlled or counterfeit substance with intent to distribute; or</subsection><subsection ssid="1-null-6" dnum="iv-o" numlevel="1" lineno="36" slineno="1-12" level="3"><display>(iv)</display>engage in a continuing criminal enterprise where:<subsection ssid="1-null-7" dnum="A-o" numlevel="1" lineno="37" slineno="1-13" level="4"><display>(A)</display>the person participates, directs, or engages in conduct that results in a <ln numlevel="1" lineno="38" slineno="1-14"/>violation of this chapter, Chapter 37a, Utah Drug Paraphernalia Act, Chapter <ln numlevel="1" lineno="39" slineno="1-15"/>37b, Imitation Controlled Substances Act, Chapter 37c, Utah Controlled <ln numlevel="1" lineno="40" slineno="1-16"/>Substance Precursor Act, or Chapter 37d, Clandestine Drug Lab Act, that is a <ln numlevel="1" lineno="41" slineno="1-17"/>felony; and</subsection><subsection ssid="1-null-8" dnum="B-o" numlevel="1" lineno="42" slineno="1-18" level="4"><display>(B)</display>the violation is a part of a continuing series of two or more violations of this <ln numlevel="1" lineno="43" slineno="1-19"/>chapter, Chapter 37a, Utah Drug Paraphernalia Act, Chapter 37b, Imitation <ln numlevel="1" lineno="44" slineno="1-20"/>Controlled Substances Act, Chapter 37c, Utah Controlled Substance Precursor <ln numlevel="1" lineno="45" slineno="1-21"/>Act, or Chapter 37d, Clandestine Drug Lab Act, on separate occasions that are <ln numlevel="1" lineno="46" slineno="1-22"/>undertaken in concert with five or more persons with respect to whom the <ln numlevel="1" lineno="47" slineno="1-23"/>person occupies a position of organizer, supervisor, or any other position of <ln numlevel="1" lineno="48" slineno="1-24"/>management.</subsection></subsection></subsection><subsection ssid="1-null-9" dnum="b-o" numlevel="1" lineno="49" slineno="1-25" level="2"><display>(b)</display>A person convicted of violating Subsection <xref depth="4" refnumber="58-37-8(1)(a)">(1)(a)</xref> with respect to:<subsection ssid="1-null-10" dnum="i-o" numlevel="1" lineno="50" slineno="1-26" level="3"><display>(i)</display>a substance or a counterfeit of a substance classified in Schedule I or II, a <ln numlevel="1" lineno="51" slineno="1-27"/>controlled substance analog, or gammahydroxybutyric acid as listed in Schedule <ln numlevel="1" lineno="52" slineno="1-28"/>III is guilty of a second degree felony, punishable by imprisonment for not more <ln numlevel="1" lineno="53" slineno="1-29"/>than 15 years, and upon a second or subsequent conviction is guilty of a first <ln numlevel="1" lineno="54" slineno="1-30"/>degree felony;</subsection><subsection ssid="1-null-11" dnum="ii-o" numlevel="1" lineno="55" slineno="1-31" level="3"><display>(ii)</display>a substance or a counterfeit of a substance classified in Schedule III or IV, or <ln numlevel="1" lineno="56" slineno="1-32"/>marijuana, or a substance listed in Section <xref depth="3" refnumber="58-37-4.2">58-37-4.2</xref> is guilty of a third degree <ln numlevel="1" lineno="57" slineno="1-33"/>felony, and upon a second or subsequent conviction is guilty of a second degree <ln numlevel="1" lineno="58" slineno="1-34"/>felony; or</subsection><subsection ssid="1-null-12" dnum="iii-o" numlevel="1" lineno="59" slineno="1-35" level="3"><display>(iii)</display>a substance or a counterfeit of a substance classified in Schedule V is guilty of a <ln numlevel="1" lineno="60" slineno="1-36"/>class A misdemeanor and upon a second or subsequent conviction is guilty of a <ln numlevel="1" lineno="61" slineno="1-37"/>third degree felony.</subsection></subsection><subsection ssid="1-null-13" dnum="c-o" numlevel="1" lineno="62" slineno="1-38" level="2" space="false"><display>(c)</display><subsection ssid="1-null-14" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Except as provided in Subsection <xref depth="4" refnumber="58-37-8(1)(c)(iii)">(1)(c)(iii)</xref>, a person who has been convicted <ln numlevel="1" lineno="63" slineno="1-39"/>of a violation of Subsection <xref depth="4" refnumber="58-37-8(1)(a)(ii)">(1)(a)(ii)</xref> or <xref depth="4" refnumber="58-37-8(iii)">(iii)</xref> may be sentenced to imprisonment <ln numlevel="1" lineno="64" slineno="1-40"/>for an indeterminate term as described in Subsection <xref depth="4" refnumber="58-37-8(1)(c)(ii)">(1)(c)(ii)</xref> and <xref depth="3" refnumber="Title 76, Chapter 3, Punishments">Title 76, <ln numlevel="1" lineno="65" slineno="1-41"/>Chapter 3, Punishments</xref>.</subsection><subsection ssid="1-null-15" dnum="ii-o" numlevel="1" lineno="66" slineno="1-42" level="3"><display>(ii)</display>The court shall impose an indeterminate prison term for a person who has been <ln numlevel="1" lineno="67" slineno="1-43"/>convicted of a violation of Subsection <xref depth="4" refnumber="58-37-8(1)(a)(ii)">(1)(a)(ii)</xref> or <xref depth="4" refnumber="58-37-8(iii)">(iii)</xref> that is a first degree felony <ln numlevel="1" lineno="68" slineno="1-44"/>or a second degree felony if the trier of fact finds beyond a reasonable doubt that, <ln numlevel="1" lineno="69" slineno="1-45"/>during the commission or furtherance of the violation, the person intentionally or <ln numlevel="1" lineno="70" slineno="1-46"/>knowingly:<subsection ssid="1-null-16" dnum="A-o" numlevel="1" lineno="71" slineno="1-47" level="4"><display>(A)</display>used, drew, or exhibited a dangerous weapon, as that term is defined in <ln numlevel="1" lineno="72" slineno="1-48"/>Section <xref depth="3" refnumber="76-11-101">76-11-101</xref>, that is not a firearm, in an angry, threatening, intimidating, <ln numlevel="1" lineno="73" slineno="1-49"/>or coercive manner;</subsection><subsection ssid="1-null-17" dnum="B-o" numlevel="1" lineno="74" slineno="1-50" level="4"><display>(B)</display>used a firearm, as that term is defined in Section <xref depth="3" refnumber="76-11-101">76-11-101</xref>, or had a firearm <ln numlevel="1" lineno="75" slineno="1-51"/>readily accessible for immediate use, as that term is defined in Section <xref depth="3" refnumber="76-11-201"><ln numlevel="1" lineno="76" slineno="1-52"/>76-11-201</xref>; or</subsection><subsection ssid="1-null-18" dnum="C-o" numlevel="1" lineno="77" slineno="1-53" level="4"><display>(C)</display>distributed a firearm, as that term is defined in Section <xref depth="3" refnumber="76-11-101">76-11-101</xref>, or <ln numlevel="1" lineno="78" slineno="1-54"/>possessed a firearm with intent to distribute the firearm.</subsection></subsection><subsection ssid="1-null-19" dnum="iii-o" numlevel="1" lineno="79" slineno="1-55" level="3"><display>(iii)</display>Notwithstanding Subsection <xref depth="4" refnumber="58-37-8(1)(c)(ii)">(1)(c)(ii)</xref>, a court may suspend the indeterminate <ln numlevel="1" lineno="80" slineno="1-56"/>prison term for a person convicted under Subsection <xref depth="4" refnumber="58-37-8(1)(c)(ii)">(1)(c)(ii)</xref> if the court:<subsection ssid="1-null-20" dnum="A-o" numlevel="1" lineno="81" slineno="1-57" level="4"><display>(A)</display>details on the record the reasons why it is in the interests of justice not to <ln numlevel="1" lineno="82" slineno="1-58"/>impose the indeterminate prison term;</subsection><subsection ssid="1-null-21" dnum="B-o" numlevel="1" lineno="83" slineno="1-59" level="4"><display>(B)</display>makes a finding on the record that the person does not pose a significant <ln numlevel="1" lineno="84" slineno="1-60"/>safety risk to the public; and</subsection><subsection ssid="1-null-22" dnum="C-o" numlevel="1" lineno="85" slineno="1-61" level="4"><display>(C)</display>orders the person to complete the terms and conditions of supervised <ln numlevel="1" lineno="86" slineno="1-62"/>probation provided by the Department of Corrections.</subsection></subsection></subsection><subsection ssid="1-null-23" dnum="d-o" numlevel="1" lineno="87" slineno="1-63" level="2" space="false"><display>(d)</display><subsection ssid="1-null-24" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A person convicted of violating Subsection <xref depth="4" refnumber="58-37-8(1)(a)(iv)">(1)(a)(iv)</xref> is guilty of a first degree <ln numlevel="1" lineno="88" slineno="1-64"/>felony punishable by imprisonment for an indeterminate term of not less than:<subsection ssid="1-null-25" dnum="A-o" numlevel="1" lineno="89" slineno="1-65" level="4" tab="1"><display>(A)</display>seven years and which may be for life; or</subsection><subsection ssid="1-null-26" dnum="B-o" numlevel="1" lineno="90" slineno="1-66" level="4" tab="1"><display>(B)</display>15 years and which may be for life if the trier of fact determined that the <ln numlevel="1" lineno="91" slineno="1-67"/>defendant knew or reasonably should have known that any subordinate under <ln numlevel="1" lineno="92" slineno="1-68"/>Subsection <xref depth="4" refnumber="58-37-8(1)(a)(iv)(b)">(1)(a)(iv)(B)</xref> was under 18 years old.</subsection></subsection><subsection ssid="1-null-27" dnum="ii-o" numlevel="1" lineno="93" slineno="1-69" level="3"><display>(ii)</display>Imposition or execution of the sentence may not be suspended, and the person is <ln numlevel="1" lineno="94" slineno="1-70"/>not eligible for probation.</subsection><subsection ssid="1-null-28" dnum="iii-o" numlevel="1" lineno="95" slineno="1-71" level="3"><display>(iii)</display>Subsection <xref depth="4" refnumber="58-37-8(1)(d)(i)(b)">(1)(d)(i)(B)</xref> does not apply to any defendant who, at the time of the <ln numlevel="1" lineno="96" slineno="1-72"/>offense, was under 18 years old.</subsection></subsection><subsection ssid="1-null-29" dnum="e-o" numlevel="1" lineno="97" slineno="1-73" level="2"><display>(e)</display>The Administrative Office of the Courts shall report to the Division of Professional <ln numlevel="1" lineno="98" slineno="1-74"/>Licensing the name, case number, date of conviction, and if known, the date of birth <ln numlevel="1" lineno="99" slineno="1-75"/>of each person convicted of violating Subsection <xref depth="4" refnumber="58-37-8(1)(a)">(1)(a)</xref>.</subsection><subsection ssid="1-null-30" dnum="f-o" numlevel="1" lineno="100" slineno="1-76" level="2" space="false"><display>(f)</display><subsection ssid="1-null-31" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A court shall impose the mandatory jail sentence described in Subsection <xref tempid="154" depth="4" refnumber="58-37-8(1)(f)(ii)"><ln numlevel="1" lineno="101" slineno="1-77"/>(1)(f)(ii)</xref>, and may not suspend any portion of the jail sentence or grant early <ln numlevel="1" lineno="102" slineno="1-78"/>release, if:<subsection ssid="1-null-32" dnum="A-o" numlevel="1" lineno="103" slineno="1-79" level="4" tab="1"><display>(A)</display>the court suspends the imposition of a prison sentence for a felony conviction <ln numlevel="1" lineno="104" slineno="1-80"/>under Subsection <xref depth="4" refnumber="58-37-8(1)(a)">(1)(a)</xref> or sentences a person for a misdemeanor violation of <ln numlevel="1" lineno="105" slineno="1-81"/>an offense under Subsection <xref refnumber="58-37-8(1)(a)" depth="4">(1)(a)</xref>;</subsection><subsection ssid="1-null-33" dnum="B-o" numlevel="1" lineno="106" slineno="1-82" level="4" tab="1" space="false"><display>(B)</display><subsection ssid="1-null-34" dnum="I-o" level="5" placement="sameline"><display>(I)</display>the violation is the person's second or subsequent conviction for any <ln numlevel="1" lineno="107" slineno="1-83"/>level of offense under Subsection <xref refnumber="58-37-8(1)(a)" depth="4">(1)(a)</xref>; or</subsection><subsection ssid="1-null-35" dnum="II-o" numlevel="1" lineno="108" slineno="1-84" level="5"><display>(II)</display>the person previously has been convicted of a criminal violation in another <ln numlevel="1" lineno="109" slineno="1-85"/>jurisdiction, including a state or federal court, that is substantially <ln numlevel="1" lineno="110" slineno="1-86"/>equivalent to the violation of an offense under Subsection <xref refnumber="58-37-8(1)(a)" depth="4">(1)(a)</xref>; and</subsection></subsection><subsection ssid="1-null-36" dnum="C-o" numlevel="1" lineno="111" slineno="1-87" level="4" tab="1"><display>(C)</display>the person previously has been convicted of reentry of a removed alien under <ln numlevel="1" lineno="112" slineno="1-88"/>8 U.S.C. Sec. 1326.</subsection></subsection><subsection ssid="1-null-37" dnum="ii-o" numlevel="1" lineno="113" slineno="1-89" level="3"><display>(ii)</display>The mandatory jail sentences referred to in Subsection <xref tempid="603" depth="4" refnumber="58-37-8(1)(f)(i)">(1)(f)(i)</xref> are:<subsection ssid="1-null-38" dnum="A-o" numlevel="1" lineno="114" slineno="1-90" level="4"><display>(A)</display>for a felony or a class A misdemeanor, 360 days in jail;</subsection><subsection ssid="1-null-39" dnum="B-o" numlevel="1" lineno="115" slineno="1-91" level="4"><display>(B)</display>for a class B misdemeanor, 180 days in jail; and</subsection><subsection ssid="1-null-40" dnum="C-o" numlevel="1" lineno="116" slineno="1-92" level="4"><display>(C)</display>for a class C misdemeanor, 90 days in jail.</subsection></subsection><subsection ssid="1-null-41" dnum="iii-o" numlevel="1" lineno="117" slineno="1-93" level="3" space="false"><display>(iii)</display><subsection ssid="1-null-42" dnum="A-o" level="4" placement="sameline"><display>(A)</display>Except as provided in Subsection <xref depth="4" refnumber="58-37-8(1)(f)(iii)(b)">(1)(f)(iii)(B)</xref>, a person who is subject to <ln numlevel="1" lineno="118" slineno="1-94"/>a mandatory jail sentence under Subsection <xref tempid="130" depth="4" refnumber="58-37-8(1)(f)(i)">(1)(f)(i)</xref> may not be released to the <ln numlevel="1" lineno="119" slineno="1-95"/>federal Immigration and Customs Enforcement Agency of the United States <ln numlevel="1" lineno="120" slineno="1-96"/>Department of Homeland Security for deportation until the person has served <ln numlevel="1" lineno="121" slineno="1-97"/>the entire jail sentence described in Subsection <xref tempid="959" depth="4" refnumber="58-37-8(1)(f)(ii)">(1)(f)(ii)</xref>.</subsection><subsection ssid="1-null-43" dnum="B-o" numlevel="1" lineno="122" slineno="1-98" level="4"><display>(B)</display>A person may be released to the federal Immigration and Customs <ln numlevel="1" lineno="123" slineno="1-99"/>Enforcement Agency of the United States Department of Homeland Security <ln numlevel="1" lineno="124" slineno="1-100"/>for deportation at any time during the 14-day period before the final day of the <ln numlevel="1" lineno="125" slineno="1-101"/>person's jail sentence described in Subsection <xref depth="4" refnumber="58-37-8(1)(f)(ii)">(1)(f)(ii)</xref>.</subsection></subsection></subsection></subsection><subsection ssid="1-null-44" dnum="2-o" numlevel="1" lineno="126" slineno="1-102" level="1"><display>(2)</display>Prohibited acts B -- Penalties and reporting:<subsection ssid="1-null-45" dnum="a-o" numlevel="1" lineno="127" slineno="1-103" level="2"><display>(a)</display>It is unlawful:<subsection ssid="1-null-46" dnum="i-o" numlevel="1" lineno="128" slineno="1-104" level="3"><display>(i)</display>for a person knowingly and intentionally to possess or use a controlled substance <ln numlevel="1" lineno="129" slineno="1-105"/>analog or a controlled substance, unless it was obtained under a valid prescription <ln numlevel="1" lineno="130" slineno="1-106"/>or order, directly from a practitioner while acting in the course of the person's <ln numlevel="1" lineno="131" slineno="1-107"/>professional practice, or as otherwise authorized by this chapter;</subsection><subsection ssid="1-null-47" dnum="ii-o" numlevel="1" lineno="132" slineno="1-108" level="3"><display>(ii)</display>for an owner, tenant, licensee, or person in control of a building, room, tenement, <ln numlevel="1" lineno="133" slineno="1-109"/>vehicle, boat, aircraft, or other place to knowingly and intentionally permit a <ln numlevel="1" lineno="134" slineno="1-110"/>person to occupy the building, room, tenement, vehicle, boat, aircraft, or other <ln numlevel="1" lineno="135" slineno="1-111"/>place while the person is unlawfully manufacturing, possessing, using, or <ln numlevel="1" lineno="136" slineno="1-112"/>distributing a controlled substance at that location; or</subsection><subsection ssid="1-null-48" dnum="iii-o" numlevel="1" lineno="137" slineno="1-113" level="3"><display>(iii)</display>for a person knowingly and intentionally to possess an altered or forged <ln numlevel="1" lineno="138" slineno="1-114"/>prescription or written order for a controlled substance.</subsection></subsection><subsection ssid="1-null-49" dnum="b-o" numlevel="1" lineno="139" slineno="1-115" level="2"><display>(b)</display>A person convicted of violating Subsection <xref depth="4" refnumber="58-37-8(2)(a)(i)">(2)(a)(i)</xref> with respect to:<subsection ssid="1-null-50" dnum="i-o" numlevel="1" lineno="140" slineno="1-116" level="3"><display>(i)</display>marijuana, if the amount is 100 pounds or more, is guilty of a second degree <ln numlevel="1" lineno="141" slineno="1-117"/>felony; or</subsection><subsection ssid="1-null-51" dnum="ii-o" numlevel="1" lineno="142" slineno="1-118" level="3"><display>(ii)</display>a substance classified in Schedule I or II, or a controlled substance analog,<amend anum="0" ea="amend" pairid="8" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="both"> not <ln numlevel="1" lineno="143" slineno="1-119"/>including marijuana,</amend> is guilty of a class A misdemeanor on a first or second <ln numlevel="1" lineno="144" slineno="1-120"/>conviction, and on a third or subsequent conviction if each prior offense was <ln numlevel="1" lineno="145" slineno="1-121"/>committed within seven years before the date of the offense upon which the <ln numlevel="1" lineno="146" slineno="1-122"/>current conviction is based is guilty of a third degree felony.</subsection></subsection><subsection ssid="1-null-52" dnum="c-o" numlevel="1" lineno="147" slineno="1-123" level="2"><display>(c)</display>Upon a person's conviction of a violation of this Subsection <xref depth="4" refnumber="58-37-8(2)">(2)</xref> subsequent to a <ln numlevel="1" lineno="148" slineno="1-124"/>conviction under Subsection <xref depth="4" refnumber="58-37-8(1)(a)">(1)(a)</xref>, that person shall be sentenced to a one degree <ln numlevel="1" lineno="149" slineno="1-125"/>greater penalty than provided in this Subsection <xref depth="4" refnumber="58-37-8(2)">(2)</xref>.</subsection><subsection ssid="1-null-53" dnum="d-o" numlevel="1" lineno="150" slineno="1-126" level="2" space="false"><display>(d)</display><subsection ssid="1-null-54" dnum="i-o" level="3" placement="sameline"><display>(i)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="49" groupid="41" style="2" owner="jchristopherson" level="1" deltag="both">A</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="48" groupid="40" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Except as provided in Subsection <xref depth="4" refnumber="58-37-8(2)(e)">(2)(e)</xref>, a</amend> person who violates Subsection <xref depth="4" refnumber="58-37-8(2)(a)(i)"><ln numlevel="1" lineno="151" slineno="1-127"/>(2)(a)(i)</xref> with respect to all other controlled substances not included in Subsection <xref depth="4" refnumber="58-37-8(2)(b)(i)"><ln numlevel="1" lineno="152" slineno="1-128"/>(2)(b)(i)</xref> or <xref depth="4" refnumber="58-37-8(ii)">(ii)</xref>, including a substance listed in Section <xref depth="3" refnumber="58-37-4.2">58-37-4.2</xref>, or marijuana, is <ln numlevel="1" lineno="153" slineno="1-129"/>guilty of a class B misdemeanor.</subsection><subsection ssid="1-null-55" dnum="ii-o" numlevel="1" lineno="154" slineno="1-130" level="3"><display>(ii)</display>Upon a third conviction the person is guilty of a class A misdemeanor, if each <ln numlevel="1" lineno="155" slineno="1-131"/>prior offense was committed within seven years before the date of the offense <ln numlevel="1" lineno="156" slineno="1-132"/>upon which the current conviction is based.</subsection><subsection ssid="1-null-56" dnum="iii-o" numlevel="1" lineno="157" slineno="1-133" level="3"><display>(iii)</display>Upon a fourth or subsequent conviction the person is guilty of a third degree <ln numlevel="1" lineno="158" slineno="1-134"/>felony if each prior offense was committed within seven years before the date of <ln numlevel="1" lineno="159" slineno="1-135"/>the offense upon which the current conviction is based.</subsection></subsection><subsection ssid="1-152" dnum="_-o:e-i" numlevel="1" lineno="160" slineno="1-136" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1056" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="end">A violation of Subsection <xref depth="4" refnumber="58-37-8(2)(a)(i)">(2)(a)(i)</xref> with respect to 14 grams or less of marijuana is:</amend><subsection ssid="1-157" dnum="_-o:i-i" numlevel="1" lineno="161" slineno="1-137" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1057" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="64" groupid="52" style="1" owner="jchristopherson" level="1" amendtag="end">an infraction on a first conviction;</amend></subsection><subsection ssid="1-154" dnum="_-o:ii-i" numlevel="1" lineno="162" slineno="1-138" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1058" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="27" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="end">a class C misdemeanor on a second conviction or on a subsequent conviction not <ln numlevel="1" lineno="163" slineno="1-139"/>described in Subsection <xref depth="4" refnumber="58-37-8(2)(e)(iii)">(2)(e)(iii)</xref> or <xref depth="4" refnumber="58-37-8(iv)">(iv)</xref>;</amend></subsection><subsection ssid="1-155" dnum="_-o:iii-i" numlevel="1" lineno="164" slineno="1-140" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1059" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="33" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="end">a class B misdemeanor if the conviction is the person's third conviction and each <ln numlevel="1" lineno="165" slineno="1-141"/>prior offense was committed within seven years before the date of the offense <ln numlevel="1" lineno="166" slineno="1-142"/>upon which the current conviction is based; or</amend></subsection><subsection ssid="1-156" dnum="_-o:iv-i" numlevel="1" lineno="167" slineno="1-143" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1060" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="41" groupid="33" style="1" owner="jchristopherson" level="1" amendtag="end">a class A misdemeanor if the conviction is the person's fourth conviction and <ln numlevel="1" lineno="168" slineno="1-144"/>each prior offense was committed within seven years before the date of the <ln numlevel="1" lineno="169" slineno="1-145"/>offense upon which the current conviction is based.</amend></subsection></subsection><subsection ssid="1-null-57" dnum="e-o:f-i" numlevel="1" lineno="170" slineno="1-146" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1061" style="2" owner="o" level="1" deltag="both">(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1062" style="1" owner="i" level="1" amendtag="both" space="true">(f)</amend></display>A person convicted of violating Subsection <xref depth="4" refnumber="58-37-8(2)(a)(i)">(2)(a)(i)</xref> while inside the exterior <ln numlevel="1" lineno="171" slineno="1-147"/>boundaries of property occupied by a correctional facility as defined in Section <xref depth="3" refnumber="64-13-1"><ln numlevel="1" lineno="172" slineno="1-148"/>64-13-1</xref> or a public jail or other place of confinement shall be sentenced to a penalty <ln numlevel="1" lineno="173" slineno="1-149"/>one degree greater than provided in Subsection <xref depth="4" refnumber="58-37-8(2)(b)">(2)(b)</xref><amend anum="0" ea="amend" pairid="68" groupid="56" style="1" owner="jchristopherson" level="1" amendtag="both"> or <xref refnumber="(2)(e)" depth="4">(2)(e)</xref>, as applicable</amend>, and if <ln numlevel="1" lineno="174" slineno="1-150"/>the conviction is with respect to controlled substances as listed in:<subsection ssid="1-null-58" dnum="i-o" numlevel="1" lineno="175" slineno="1-151" level="3"><display>(i)</display>Subsection <xref depth="4" refnumber="58-37-8(2)(b)">(2)(b)</xref>, the person may be sentenced to imprisonment for an <ln numlevel="1" lineno="176" slineno="1-152"/>indeterminate term as provided by law, and:<subsection ssid="1-null-59" dnum="A-o" numlevel="1" lineno="177" slineno="1-153" level="4"><display>(A)</display>the court shall additionally sentence the person convicted to a term of one year <ln numlevel="1" lineno="178" slineno="1-154"/>to run consecutively and not concurrently; and</subsection><subsection ssid="1-null-60" dnum="B-o" numlevel="1" lineno="179" slineno="1-155" level="4"><display>(B)</display>the court may additionally sentence the person convicted for an indeterminate <ln numlevel="1" lineno="180" slineno="1-156"/>term not to exceed five years to run consecutively and not concurrently; and</subsection></subsection><subsection ssid="1-null-61" dnum="ii-o" numlevel="1" lineno="181" slineno="1-157" level="3"><display>(ii)</display>Subsection <xref depth="4" refnumber="58-37-8(2)(d)">(2)(d)</xref>, the person may be sentenced to imprisonment for an <ln numlevel="1" lineno="182" slineno="1-158"/>indeterminate term as provided by law, and the court shall additionally sentence <ln numlevel="1" lineno="183" slineno="1-159"/>the person convicted to a term of six months to run consecutively and not <ln numlevel="1" lineno="184" slineno="1-160"/>concurrently.</subsection></subsection><subsection ssid="1-null-62" dnum="f-o:g-i" numlevel="1" lineno="185" slineno="1-161" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1066" style="2" owner="o" level="1" deltag="both">(f)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1067" style="1" owner="i" level="1" amendtag="both" space="true">(g)</amend></display>A person convicted of violating Subsection <xref depth="4" refnumber="58-37-8(2)(a)(ii)">(2)(a)(ii)</xref> or <xref depth="4" refnumber="58-37-8(iii)">(iii)</xref> is:<subsection ssid="1-null-63" dnum="i-o" numlevel="1" lineno="186" slineno="1-162" level="3"><display>(i)</display>on a first conviction, guilty of a class B misdemeanor;</subsection><subsection ssid="1-null-64" dnum="ii-o" numlevel="1" lineno="187" slineno="1-163" level="3"><display>(ii)</display>on a second conviction, guilty of a class A misdemeanor; and</subsection><subsection ssid="1-null-65" dnum="iii-o" numlevel="1" lineno="188" slineno="1-164" level="3"><display>(iii)</display>on a third or subsequent conviction, guilty of a third degree felony.</subsection></subsection><subsection ssid="1-null-66" dnum="g-o:h-i" numlevel="1" lineno="189" slineno="1-165" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1070" style="2" owner="o" level="1" deltag="both">(g)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1071" style="1" owner="i" level="1" amendtag="both" space="true">(h)</amend></display>The Administrative Office of the Courts shall report to the Division of <ln numlevel="1" lineno="190" slineno="1-166"/>Professional Licensing the name, case number, date of conviction, and if known, the <ln numlevel="1" lineno="191" slineno="1-167"/>date of birth of each person convicted of violating Subsection <xref depth="4" refnumber="58-37-8(2)(a)">(2)(a)</xref>.</subsection></subsection><subsection ssid="1-null-67" dnum="3-o" numlevel="1" lineno="192" slineno="1-168" level="1"><display>(3)</display>Prohibited acts C -- Penalties:<subsection ssid="1-null-68" dnum="a-o" numlevel="1" lineno="193" slineno="1-169" level="2"><display>(a)</display>It is unlawful for a person knowingly and intentionally:<subsection ssid="1-null-69" dnum="i-o" numlevel="1" lineno="194" slineno="1-170" level="3"><display>(i)</display>to use in the course of the manufacture or distribution of a controlled substance a <ln numlevel="1" lineno="195" slineno="1-171"/>license number which is fictitious, revoked, suspended, or issued to another <ln numlevel="1" lineno="196" slineno="1-172"/>person or, for the purpose of obtaining a controlled substance, to assume the title <ln numlevel="1" lineno="197" slineno="1-173"/>of, or represent oneself to be, a manufacturer, wholesaler, apothecary, physician, <ln numlevel="1" lineno="198" slineno="1-174"/>dentist, veterinarian, or other authorized person;</subsection><subsection ssid="1-null-70" dnum="ii-o" numlevel="1" lineno="199" slineno="1-175" level="3"><display>(ii)</display>to acquire or obtain possession of, to procure or attempt to procure the <ln numlevel="1" lineno="200" slineno="1-176"/>administration of, to obtain a prescription for, to prescribe or dispense to a person <ln numlevel="1" lineno="201" slineno="1-177"/>known to be attempting to acquire or obtain possession of, or to procure the <ln numlevel="1" lineno="202" slineno="1-178"/>administration of a controlled substance by misrepresentation or failure by the <ln numlevel="1" lineno="203" slineno="1-179"/>person to disclose receiving a controlled substance from another source, fraud, <ln numlevel="1" lineno="204" slineno="1-180"/>forgery, deception, subterfuge, alteration of a prescription or written order for a <ln numlevel="1" lineno="205" slineno="1-181"/>controlled substance, or the use of a false name or address;</subsection><subsection ssid="1-null-71" dnum="iii-o" numlevel="1" lineno="206" slineno="1-182" level="3"><display>(iii)</display>to make a false or forged prescription or written order for a controlled substance, <ln numlevel="1" lineno="207" slineno="1-183"/>or to utter the same, or to alter a prescription or written order issued or written <ln numlevel="1" lineno="208" slineno="1-184"/>under the terms of this chapter; or</subsection><subsection ssid="1-null-72" dnum="iv-o" numlevel="1" lineno="209" slineno="1-185" level="3"><display>(iv)</display>to make, distribute, or possess a punch, die, plate, stone, or other thing designed <ln numlevel="1" lineno="210" slineno="1-186"/>to print, imprint, or reproduce the trademark, trade name, or other identifying <ln numlevel="1" lineno="211" slineno="1-187"/>mark, imprint, or device of another or any likeness of any of the foregoing upon <ln numlevel="1" lineno="212" slineno="1-188"/>any drug or container or labeling so as to render a drug a counterfeit controlled <ln numlevel="1" lineno="213" slineno="1-189"/>substance.</subsection></subsection><subsection ssid="1-null-73" dnum="b-o" numlevel="1" lineno="214" slineno="1-190" level="2" space="false"><display>(b)</display><subsection ssid="1-null-74" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A first or second conviction under Subsection <xref depth="4" refnumber="58-37-8(3)(a)(i)">(3)(a)(i)</xref>, <xref refnumber="(3)(a)(ii)" depth="4">(ii)</xref>, or <xref refnumber="(3)(a)(iii)" depth="4">(iii) </xref>is a class A <ln numlevel="1" lineno="215" slineno="1-191"/>misdemeanor.</subsection><subsection ssid="1-null-75" dnum="ii-o" numlevel="1" lineno="216" slineno="1-192" level="3"><display>(ii)</display>A third or subsequent conviction under Subsection <xref depth="4" refnumber="58-37-8(3)(a)(i)">(3)(a)(i)</xref>, <xref refnumber="(3)(a)(ii)" depth="4">(ii)</xref>, or <xref refnumber="(3)(a)(iii)" depth="4">(iii) </xref>is a third <ln numlevel="1" lineno="217" slineno="1-193"/>degree felony.</subsection></subsection><subsection ssid="1-null-76" dnum="c-o" numlevel="1" lineno="218" slineno="1-194" level="2"><display>(c)</display>A violation of Subsection <xref depth="4" refnumber="58-37-8(3)(a)(iv)">(3)(a)(iv)</xref> is a third degree felony.</subsection></subsection><subsection ssid="1-null-77" dnum="4-o" numlevel="1" lineno="219" slineno="1-195" level="1"><display>(4)</display>Prohibited acts D -- Penalties:<subsection ssid="1-null-78" dnum="a-o" numlevel="1" lineno="220" slineno="1-196" level="2"><display>(a)</display>Notwithstanding other provisions of this section, a person not authorized under this <ln numlevel="1" lineno="221" slineno="1-197"/>chapter who commits any act that is unlawful under Subsection <xref depth="4" refnumber="58-37-8(1)(a)">(1)(a)</xref> or Section <xref depth="3" refnumber="58-37b-4"><ln numlevel="1" lineno="222" slineno="1-198"/>58-37b-4</xref> is upon conviction subject to the penalties and classifications under this <ln numlevel="1" lineno="223" slineno="1-199"/>Subsection <xref depth="4" refnumber="58-37-8(4)">(4)</xref> if the trier of fact finds the act is committed:<subsection ssid="1-null-79" dnum="i-o" numlevel="1" lineno="224" slineno="1-200" level="3"><display>(i)</display>in a public or private elementary or secondary school or on the grounds of any of <ln numlevel="1" lineno="225" slineno="1-201"/>those schools during the hours of 6 a.m. through 10 p.m.;</subsection><subsection ssid="1-null-80" dnum="ii-o" numlevel="1" lineno="226" slineno="1-202" level="3"><display>(ii)</display>in a public or private vocational school or postsecondary institution or on the <ln numlevel="1" lineno="227" slineno="1-203"/>grounds of any of those schools or institutions during the hours of 6 a.m. through <ln numlevel="1" lineno="228" slineno="1-204"/>10 p.m.;</subsection><subsection ssid="1-null-81" dnum="iii-o" numlevel="1" lineno="229" slineno="1-205" level="3"><display>(iii)</display>in or on the grounds of a preschool or child-care facility during the preschool's or <ln numlevel="1" lineno="230" slineno="1-206"/>facility's hours of operation;</subsection><subsection ssid="1-null-82" dnum="iv-o" numlevel="1" lineno="231" slineno="1-207" level="3"><display>(iv)</display>in a public park, amusement park, arcade, or recreation center when the public or <ln numlevel="1" lineno="232" slineno="1-208"/>amusement park, arcade, or recreation center is open to the public;</subsection><subsection ssid="1-null-83" dnum="v-o" numlevel="1" lineno="233" slineno="1-209" level="3"><display>(v)</display>in or on the grounds of a house of worship as defined in Section <xref depth="3" refnumber="76-11-201">76-11-201</xref>;</subsection><subsection ssid="1-null-84" dnum="vi-o" numlevel="1" lineno="234" slineno="1-210" level="3"><display>(vi)</display>in or on the grounds of a library when the library is open to the public;</subsection><subsection ssid="1-null-85" dnum="vii-o" numlevel="1" lineno="235" slineno="1-211" level="3"><display>(vii)</display>within an area that is within 100 feet of any structure, facility, or grounds <ln numlevel="1" lineno="236" slineno="1-212"/>included in Subsections <xref depth="4" refnumber="58-37-8(4)(a)(i)">(4)(a)(i)</xref> through <xref depth="4" refnumber="58-37-8(vi)">(vi)</xref>;</subsection><subsection ssid="1-null-86" dnum="viii-o" numlevel="1" lineno="237" slineno="1-213" level="3"><display>(viii)</display>in the presence of a person younger than 18 years old, regardless of where the <ln numlevel="1" lineno="238" slineno="1-214"/>act occurs; or</subsection><subsection ssid="1-null-87" dnum="ix-o" numlevel="1" lineno="239" slineno="1-215" level="3"><display>(ix)</display>for the purpose of facilitating, arranging, or causing the transport, delivery, or <ln numlevel="1" lineno="240" slineno="1-216"/>distribution of a substance in violation of this section to an inmate or on the <ln numlevel="1" lineno="241" slineno="1-217"/>grounds of a correctional facility as defined in Section <xref depth="3" refnumber="76-8-311.3">76-8-311.3</xref>.</subsection></subsection><subsection ssid="1-null-88" dnum="b-o" numlevel="1" lineno="242" slineno="1-218" level="2" space="false"><display>(b)</display><subsection ssid="1-null-89" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A person convicted under this Subsection <xref depth="4" refnumber="58-37-8(4)">(4)</xref> is guilty of a first degree felony <ln numlevel="1" lineno="243" slineno="1-219"/>and shall be imprisoned for a term of not less than five years if the penalty that <ln numlevel="1" lineno="244" slineno="1-220"/>would otherwise have been established but for this Subsection <xref depth="4" refnumber="58-37-8(4)">(4)</xref> would have <ln numlevel="1" lineno="245" slineno="1-221"/>been a first degree felony.</subsection><subsection ssid="1-null-90" dnum="ii-o" numlevel="1" lineno="246" slineno="1-222" level="3"><display>(ii)</display>Imposition or execution of the sentence may not be suspended, and the person is <ln numlevel="1" lineno="247" slineno="1-223"/>not eligible for probation.</subsection></subsection><subsection ssid="1-null-91" dnum="c-o" numlevel="1" lineno="248" slineno="1-224" level="2"><display>(c)</display>If the classification that would otherwise have been established would have been less <ln numlevel="1" lineno="249" slineno="1-225"/>than a first degree felony but for this Subsection <xref depth="4" refnumber="58-37-8(4)">(4)</xref>, a person convicted under this <ln numlevel="1" lineno="250" slineno="1-226"/>Subsection <xref depth="4" refnumber="58-37-8(4)">(4)</xref> is guilty of one degree more than the maximum penalty prescribed for <ln numlevel="1" lineno="251" slineno="1-227"/>that offense.</subsection><subsection ssid="1-null-92" dnum="d-o" numlevel="1" lineno="252" slineno="1-228" level="2" space="false"><display>(d)</display><subsection ssid="1-null-93" dnum="i-o" level="3" placement="sameline"><display>(i)</display>If the violation is of Subsection <xref depth="4" refnumber="58-37-8(4)(a)(ix)">(4)(a)(ix)</xref>:<subsection ssid="1-null-94" dnum="A-o" numlevel="1" lineno="253" slineno="1-229" level="4" tab="1"><display>(A)</display>the person may be sentenced to imprisonment for an indeterminate term as <ln numlevel="1" lineno="254" slineno="1-230"/>provided by law, and the court shall additionally sentence the person convicted <ln numlevel="1" lineno="255" slineno="1-231"/>for a term of one year to run consecutively and not concurrently; and</subsection><subsection ssid="1-null-95" dnum="B-o" numlevel="1" lineno="256" slineno="1-232" level="4" tab="1"><display>(B)</display>the court may additionally sentence the person convicted for an indeterminate <ln numlevel="1" lineno="257" slineno="1-233"/>term not to exceed five years to run consecutively and not concurrently; and</subsection></subsection><subsection ssid="1-null-96" dnum="ii-o" numlevel="1" lineno="258" slineno="1-234" level="3"><display>(ii)</display>the penalties under this Subsection <xref depth="4" refnumber="58-37-8(4)(d)">(4)(d)</xref> apply also to a person who, acting with <ln numlevel="1" lineno="259" slineno="1-235"/>the mental state required for the commission of an offense, directly or indirectly <ln numlevel="1" lineno="260" slineno="1-236"/>solicits, requests, commands, coerces, encourages, or intentionally aids another <ln numlevel="1" lineno="261" slineno="1-237"/>person to commit a violation of Subsection <xref depth="4" refnumber="58-37-8(4)(a)(ix)">(4)(a)(ix)</xref>.</subsection></subsection><subsection ssid="1-null-97" dnum="e-o" numlevel="1" lineno="262" slineno="1-238" level="2"><display>(e)</display>It is not a defense to a prosecution under this Subsection <xref depth="4" refnumber="58-37-8(4)">(4)</xref> that:<subsection ssid="1-null-98" dnum="i-o" numlevel="1" lineno="263" slineno="1-239" level="3"><display>(i)</display>the actor mistakenly believed the individual to be 18 years old or older at the time <ln numlevel="1" lineno="264" slineno="1-240"/>of the offense or was unaware of the individual's true age; or</subsection><subsection ssid="1-null-99" dnum="ii-o" numlevel="1" lineno="265" slineno="1-241" level="3"><display>(ii)</display>the actor mistakenly believed that the location where the act occurred was not as <ln numlevel="1" lineno="266" slineno="1-242"/>described in Subsection <xref depth="4" refnumber="58-37-8(4)(a)">(4)(a)</xref> or was unaware that the location where the act <ln numlevel="1" lineno="267" slineno="1-243"/>occurred was as described in Subsection <xref depth="4" refnumber="58-37-8(4)(a)">(4)(a)</xref>.</subsection></subsection></subsection><subsection ssid="1-null-100" dnum="5-o" numlevel="1" lineno="268" slineno="1-244" level="1"><display>(5)</display>A violation of this chapter for which no penalty is specified is a class B misdemeanor.</subsection><subsection ssid="1-null-101" dnum="6-o" numlevel="1" lineno="269" slineno="1-245" level="1" space="false"><display>(6)</display><subsection ssid="1-null-102" dnum="a-o" level="2" placement="sameline"><display>(a)</display>For purposes of penalty enhancement under Subsections <xref depth="4" refnumber="58-37-8(1)">(1)</xref> and <xref depth="4" refnumber="58-37-8(2)">(2)</xref>, a plea of <ln numlevel="1" lineno="270" slineno="1-246"/>guilty or no contest to a violation or attempted violation of this section or a plea <ln numlevel="1" lineno="271" slineno="1-247"/>which is held in abeyance under Title 77, Chapter 2a, Pleas in Abeyance, is the <ln numlevel="1" lineno="272" slineno="1-248"/>equivalent of a conviction, even if the charge has been subsequently reduced or <ln numlevel="1" lineno="273" slineno="1-249"/>dismissed in accordance with the plea in abeyance agreement.</subsection><subsection ssid="1-null-103" dnum="b-o" numlevel="1" lineno="274" slineno="1-250" level="2"><display>(b)</display>A prior conviction used for a penalty enhancement under Subsection <xref depth="4" refnumber="58-37-8(2)">(2)</xref> shall be a <ln numlevel="1" lineno="275" slineno="1-251"/>conviction that is:<subsection ssid="1-null-104" dnum="i-o" numlevel="1" lineno="276" slineno="1-252" level="3"><display>(i)</display>from a separate criminal episode than the current charge; and</subsection><subsection ssid="1-null-105" dnum="ii-o" numlevel="1" lineno="277" slineno="1-253" level="3"><display>(ii)</display>from a conviction that is separate from any other conviction used to enhance the <ln numlevel="1" lineno="278" slineno="1-254"/>current charge.</subsection></subsection></subsection><subsection ssid="1-null-106" dnum="7-o" numlevel="1" lineno="279" slineno="1-255" level="1"><display>(7)</display>A person may be charged and sentenced for a violation of this section, notwithstanding <ln numlevel="1" lineno="280" slineno="1-256"/>a charge and sentence for a violation of any other section of this chapter.</subsection><subsection ssid="1-null-107" dnum="8-o" numlevel="1" lineno="281" slineno="1-257" level="1" space="false"><display>(8)</display><subsection ssid="1-null-108" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A penalty imposed for violation of this section is in addition to, and not in lieu of, <ln numlevel="1" lineno="282" slineno="1-258"/>a civil or administrative penalty or sanction authorized by law.</subsection><subsection ssid="1-null-109" dnum="b-o" numlevel="1" lineno="283" slineno="1-259" level="2"><display>(b)</display>When a violation of this chapter violates a federal law or the law of another state, <ln numlevel="1" lineno="284" slineno="1-260"/>conviction or acquittal under federal law or the law of another state for the same act <ln numlevel="1" lineno="285" slineno="1-261"/>is a bar to prosecution in this state.</subsection></subsection><subsection ssid="1-null-110" dnum="9-o" numlevel="1" lineno="286" slineno="1-262" level="1"><display>(9)</display>In any prosecution for a violation of this chapter, evidence or proof that shows a person <ln numlevel="1" lineno="287" slineno="1-263"/>or persons produced, manufactured, possessed, distributed, or dispensed a controlled <ln numlevel="1" lineno="288" slineno="1-264"/>substance or substances, is prima facie evidence that the person or persons did so with <ln numlevel="1" lineno="289" slineno="1-265"/>knowledge of the character of the substance or substances.</subsection><subsection ssid="1-null-111" dnum="10-o" numlevel="1" lineno="290" slineno="1-266" level="1"><display>(10)</display>This section does not prohibit a veterinarian, in good faith and in the course of the <ln numlevel="1" lineno="291" slineno="1-267"/>veterinarian's professional practice only and not for humans, from prescribing, <ln numlevel="1" lineno="292" slineno="1-268"/>dispensing, or administering controlled substances or from causing the substances to be <ln numlevel="1" lineno="293" slineno="1-269"/>administered by an assistant or orderly under the veterinarian's direction and supervision.</subsection><subsection ssid="1-null-112" dnum="11-o" numlevel="1" lineno="294" slineno="1-270" level="1"><display>(11)</display>Civil or criminal liability may not be imposed under this section on:<subsection ssid="1-null-113" dnum="a-o" numlevel="1" lineno="295" slineno="1-271" level="2"><display>(a)</display>a person registered under this chapter who manufactures, distributes, or possesses an <ln numlevel="1" lineno="296" slineno="1-272"/>imitation controlled substance for use as a placebo or investigational new drug by a <ln numlevel="1" lineno="297" slineno="1-273"/>registered practitioner in the ordinary course of professional practice or research;</subsection><subsection ssid="1-null-114" dnum="b-o" numlevel="1" lineno="298" slineno="1-274" level="2"><display>(b)</display>a law enforcement officer acting in the course and legitimate scope of the officer's <ln numlevel="1" lineno="299" slineno="1-275"/>employment; or</subsection><subsection ssid="1-null-115" dnum="c-o" numlevel="1" lineno="300" slineno="1-276" level="2"><display>(c)</display>a healthcare facility, substance use harm reduction services program, or drug <ln numlevel="1" lineno="301" slineno="1-277"/>addiction treatment facility that temporarily possesses a controlled or counterfeit <ln numlevel="1" lineno="302" slineno="1-278"/>substance to conduct a test or analysis on the controlled or counterfeit substance to <ln numlevel="1" lineno="303" slineno="1-279"/>identify or analyze the strength, effectiveness, or purity of the substance for a public <ln numlevel="1" lineno="304" slineno="1-280"/>health or safety reason.</subsection></subsection><subsection ssid="1-null-116" dnum="12-o" numlevel="1" lineno="305" slineno="1-281" level="1" space="false"><display>(12)</display><subsection ssid="1-null-117" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Civil or criminal liability may not be imposed under this section on any Indian, <ln numlevel="1" lineno="306" slineno="1-282"/>as defined in Section <xref depth="3" refnumber="58-37-2">58-37-2</xref>, who uses, possesses, or transports peyote for bona fide <ln numlevel="1" lineno="307" slineno="1-283"/>traditional ceremonial purposes in connection with the practice of a traditional Indian <ln numlevel="1" lineno="308" slineno="1-284"/>religion as defined in Section <xref depth="3" refnumber="58-37-2">58-37-2</xref>.</subsection><subsection ssid="1-null-118" dnum="b-o" numlevel="1" lineno="309" slineno="1-285" level="2"><display>(b)</display>In a prosecution alleging violation of this section regarding peyote as defined in <ln numlevel="1" lineno="310" slineno="1-286"/>Section <xref depth="3" refnumber="58-37-4">58-37-4</xref>, it is an affirmative defense that the peyote was used, possessed, or <ln numlevel="1" lineno="311" slineno="1-287"/>transported by an Indian for bona fide traditional ceremonial purposes in connection <ln numlevel="1" lineno="312" slineno="1-288"/>with the practice of a traditional Indian religion.</subsection><subsection ssid="1-null-119" dnum="c-o" numlevel="1" lineno="313" slineno="1-289" level="2" space="false"><display>(c)</display><subsection ssid="1-null-120" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The defendant shall provide written notice of intent to claim an affirmative <ln numlevel="1" lineno="314" slineno="1-290"/>defense under this Subsection <xref depth="4" refnumber="58-37-8(12)">(12)</xref> as soon as practicable, but not later than 10 <ln numlevel="1" lineno="315" slineno="1-291"/>days before trial.</subsection><subsection ssid="1-null-121" dnum="ii-o" numlevel="1" lineno="316" slineno="1-292" level="3"><display>(ii)</display>The notice shall include the specific claims of the affirmative defense.</subsection><subsection ssid="1-null-122" dnum="iii-o" numlevel="1" lineno="317" slineno="1-293" level="3"><display>(iii)</display>The court may waive the notice requirement in the interest of justice for good <ln numlevel="1" lineno="318" slineno="1-294"/>cause shown, if the prosecutor is not unfairly prejudiced by the lack of timely <ln numlevel="1" lineno="319" slineno="1-295"/>notice.</subsection></subsection><subsection ssid="1-null-123" dnum="d-o" numlevel="1" lineno="320" slineno="1-296" level="2"><display>(d)</display>The defendant shall establish the affirmative defense under this Subsection <xref depth="4" refnumber="58-37-8(12)">(12)</xref> by a <ln numlevel="1" lineno="321" slineno="1-297"/>preponderance of the evidence.  If the defense is established, it is a complete defense <ln numlevel="1" lineno="322" slineno="1-298"/>to the charges.</subsection></subsection><subsection ssid="1-null-124" dnum="13-o" numlevel="1" lineno="323" slineno="1-299" level="1" space="false"><display>(13)</display><subsection ssid="1-null-125" dnum="a-o" level="2" placement="sameline"><display>(a)</display>It is an affirmative defense that the person produced, possessed, or administered <ln numlevel="1" lineno="324" slineno="1-300"/>a controlled substance listed in Section <xref depth="3" refnumber="58-37-4.2">58-37-4.2</xref> if the person was:<subsection ssid="1-null-126" dnum="i-o" numlevel="1" lineno="325" slineno="1-301" level="3" tab="1"><display>(i)</display>engaged in medical research; and</subsection><subsection ssid="1-null-127" dnum="ii-o" numlevel="1" lineno="326" slineno="1-302" level="3" tab="1"><display>(ii)</display>a holder of a valid license to possess controlled substances under Section <xref depth="3" refnumber="58-37-6">58-37-6</xref>.</subsection></subsection><subsection ssid="1-null-128" dnum="b-o" numlevel="1" lineno="327" slineno="1-303" level="2"><display>(b)</display>It is not a defense under Subsection <xref depth="4" refnumber="58-37-8(13)(a)">(13)(a)</xref> that the person prescribed or dispensed a <ln numlevel="1" lineno="328" slineno="1-304"/>controlled substance listed in Section <xref depth="3" refnumber="58-37-4.2">58-37-4.2</xref>.</subsection></subsection><subsection ssid="1-null-129" dnum="14-o" numlevel="1" lineno="329" slineno="1-305" level="1"><display>(14)</display>It is an affirmative defense that the person possessed, in the person's body, a controlled <ln numlevel="1" lineno="330" slineno="1-306"/>substance listed in Section <xref depth="3" refnumber="58-37-4.2">58-37-4.2</xref> if:<subsection ssid="1-null-130" dnum="a-o" numlevel="1" lineno="331" slineno="1-307" level="2"><display>(a)</display>the person was the subject of medical research conducted by a holder of a valid <ln numlevel="1" lineno="332" slineno="1-308"/>license to possess controlled substances under Section <xref depth="3" refnumber="58-37-6">58-37-6</xref>; and</subsection><subsection ssid="1-null-131" dnum="b-o" numlevel="1" lineno="333" slineno="1-309" level="2"><display>(b)</display>the substance was administered to the person by the medical researcher.</subsection></subsection><subsection ssid="1-null-132" dnum="15-o" numlevel="1" lineno="334" slineno="1-310" level="1"><display>(15)</display>The application of any increase in penalty under this section to a violation of <ln numlevel="1" lineno="335" slineno="1-311"/>Subsection <xref depth="4" refnumber="58-37-8(2)(a)(i)">(2)(a)(i)</xref> may not result in any greater penalty than a second degree felony. <ln numlevel="1" lineno="336" slineno="1-312"/>This Subsection <xref depth="4" refnumber="58-37-8(15)">(15)</xref> takes precedence over any conflicting provision of this section.</subsection><subsection ssid="1-null-133" dnum="16-o" numlevel="1" lineno="337" slineno="1-313" level="1" space="false"><display>(16)</display><subsection ssid="1-null-134" dnum="a-o" level="2" placement="sameline"><display>(a)</display>It is an affirmative defense to an allegation of the commission of an offense <ln numlevel="1" lineno="338" slineno="1-314"/>listed in Subsection <xref depth="4" refnumber="58-37-8(16)(b)">(16)(b)</xref> that the person or bystander:<subsection ssid="1-null-135" dnum="i-o" numlevel="1" lineno="339" slineno="1-315" level="3" tab="1"><display>(i)</display>reasonably believes that the person or another person is experiencing an overdose <ln numlevel="1" lineno="340" slineno="1-316"/>event due to the ingestion, injection, inhalation, or other introduction into the <ln numlevel="1" lineno="341" slineno="1-317"/>human body of a controlled substance or other substance;</subsection><subsection ssid="1-null-136" dnum="ii-o" numlevel="1" lineno="342" slineno="1-318" level="3" tab="1"><display>(ii)</display>reports, or assists a person who reports, in good faith the overdose event to a <ln numlevel="1" lineno="343" slineno="1-319"/>medical provider, an emergency medical service provider as defined in Section <xref depth="3" refnumber="53-2d-101"><ln numlevel="1" lineno="344" slineno="1-320"/>53-2d-101</xref>, a law enforcement officer, a 911 emergency call system, or an <ln numlevel="1" lineno="345" slineno="1-321"/>emergency dispatch system, or the person is the subject of a report made under <ln numlevel="1" lineno="346" slineno="1-322"/>this Subsection <xref depth="4" refnumber="58-37-8(16)">(16)</xref>;</subsection><subsection ssid="1-null-137" dnum="iii-o" numlevel="1" lineno="347" slineno="1-323" level="3" tab="1"><display>(iii)</display>provides in the report under Subsection <xref depth="4" refnumber="58-37-8(16)(a)(ii)">(16)(a)(ii)</xref> a functional description of the <ln numlevel="1" lineno="348" slineno="1-324"/>actual location of the overdose event that facilitates responding to the person <ln numlevel="1" lineno="349" slineno="1-325"/>experiencing the overdose event;</subsection><subsection ssid="1-null-138" dnum="iv-o" numlevel="1" lineno="350" slineno="1-326" level="3" tab="1"><display>(iv)</display>remains at the location of the person experiencing the overdose event until a <ln numlevel="1" lineno="351" slineno="1-327"/>responding law enforcement officer or emergency medical service provider <ln numlevel="1" lineno="352" slineno="1-328"/>arrives, or remains at the medical care facility where the person experiencing an <ln numlevel="1" lineno="353" slineno="1-329"/>overdose event is located until a responding law enforcement officer arrives;</subsection><subsection ssid="1-null-139" dnum="v-o" numlevel="1" lineno="354" slineno="1-330" level="3" tab="1"><display>(v)</display>cooperates with the responding medical provider, emergency medical service <ln numlevel="1" lineno="355" slineno="1-331"/>provider, and law enforcement officer, including providing information regarding <ln numlevel="1" lineno="356" slineno="1-332"/>the person experiencing the overdose event and any substances the person may <ln numlevel="1" lineno="357" slineno="1-333"/>have injected, inhaled, or otherwise introduced into the person's body; and</subsection><subsection ssid="1-null-140" dnum="vi-o" numlevel="1" lineno="358" slineno="1-334" level="3" tab="1"><display>(vi)</display>is alleged to have committed the offense in the same course of events from which <ln numlevel="1" lineno="359" slineno="1-335"/>the reported overdose arose.</subsection></subsection><subsection ssid="1-null-141" dnum="b-o" numlevel="1" lineno="360" slineno="1-336" level="2"><display>(b)</display>The offenses referred to in Subsection <xref depth="4" refnumber="58-37-8(16)(a)">(16)(a)</xref> are:<subsection ssid="1-null-142" dnum="i-o" numlevel="1" lineno="361" slineno="1-337" level="3"><display>(i)</display>the possession or use of less than 16 ounces of marijuana;</subsection><subsection ssid="1-null-143" dnum="ii-o" numlevel="1" lineno="362" slineno="1-338" level="3"><display>(ii)</display>the possession or use of a scheduled or listed controlled substance other than <ln numlevel="1" lineno="363" slineno="1-339"/>marijuana; and</subsection><subsection ssid="1-null-144" dnum="iii-o" numlevel="1" lineno="364" slineno="1-340" level="3"><display>(iii)</display>any violation of Chapter 37a, Utah Drug Paraphernalia Act, or Chapter 37b, <ln numlevel="1" lineno="365" slineno="1-341"/>Imitation Controlled Substances Act.</subsection></subsection><subsection ssid="1-null-145" dnum="c-o" numlevel="1" lineno="366" slineno="1-342" level="2"><display>(c)</display>As used in this Subsection <xref depth="4" refnumber="58-37-8(16)">(16)</xref> and in Section <xref depth="3" refnumber="76-3-203.11">76-3-203.11</xref>, "good faith" does not <ln numlevel="1" lineno="367" slineno="1-343"/>include seeking medical assistance under this section during the course of a law <ln numlevel="1" lineno="368" slineno="1-344"/>enforcement agency's execution of a search warrant, execution of an arrest warrant, <ln numlevel="1" lineno="369" slineno="1-345"/>or other lawful search.</subsection></subsection><subsection ssid="1-null-146" dnum="17-o" numlevel="1" lineno="370" slineno="1-346" level="1"><display>(17)</display>If any provision of this chapter, or the application of any provision to any person or <ln numlevel="1" lineno="371" slineno="1-347"/>circumstances, is held invalid, the remainder of this chapter shall be given effect without <ln numlevel="1" lineno="372" slineno="1-348"/>the invalid provision or application.</subsection><subsection ssid="1-null-147" dnum="18-o" numlevel="1" lineno="373" slineno="1-349" level="1"><display>(18)</display>A legislative body of a political subdivision may not enact an ordinance that is less <ln numlevel="1" lineno="374" slineno="1-350"/>restrictive than any provision of this chapter.</subsection><subsection ssid="1-null-148" dnum="19-o" numlevel="1" lineno="375" slineno="1-351" level="1"><display>(19)</display>If a minor who is under 18 years old is found by a court to have violated this section or <ln numlevel="1" lineno="376" slineno="1-352"/>Subsection <xref depth="4" refnumber="76-5-102.1(2)(b)">76-5-102.1(2)(b)</xref> or <xref depth="4" refnumber="76-5-207(2)(b)">76-5-207(2)(b)</xref>, the court may order the minor to <ln numlevel="1" lineno="377" slineno="1-353"/>complete:<subsection ssid="1-null-149" dnum="a-o" numlevel="1" lineno="378" slineno="1-354" level="2"><display>(a)</display>a screening as defined in Section <xref depth="3" refnumber="41-6a-501">41-6a-501</xref>;</subsection><subsection ssid="1-null-150" dnum="b-o" numlevel="1" lineno="379" slineno="1-355" level="2"><display>(b)</display>an assessment as defined in Section <xref depth="3" refnumber="41-6a-501">41-6a-501</xref> if the screening indicates an <ln numlevel="1" lineno="380" slineno="1-356"/>assessment to be appropriate; and</subsection><subsection ssid="1-null-151" dnum="c-o" numlevel="1" lineno="381" slineno="1-357" level="2"><display>(c)</display>an educational series as defined in Section <xref depth="3" refnumber="41-6a-501">41-6a-501</xref> or substance use disorder <ln numlevel="1" lineno="382" slineno="1-358"/>treatment as indicated by an assessment.</subsection></subsection></section></bsec><bsec buid="3" num="58-37f-201" type="amend" src="code" uid="C58-37f-S201_2026050620260506" sort="58 37f02010020260506" numlevel="1" lineno="383" slineno="2-1" sn="2"><section number="58-37f-201" numlevel="1" lineno="384" slineno="2-2" type="amend"><secline lineno="383">Section 2. Section <bold>58-37f-201</bold> is amended to read:</secline><catline lineno="384"><bold>58-37f-201<parens/>. Controlled substance database -- Creation -- Purpose.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="385" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>There is created within the division a controlled substance database.</subsection><subsection ssid="3-null-2" dnum="2-o" numlevel="1" lineno="386" slineno="2-4" level="1"><display>(2)</display>The division shall administer and direct the functioning of the database in accordance <ln numlevel="1" lineno="387" slineno="2-5"/>with this chapter.</subsection><subsection ssid="3-null-3" dnum="3-o" numlevel="1" lineno="388" slineno="2-6" level="1"><display>(3)</display>The division may, under state procurement laws, contract with another state agency or a <ln numlevel="1" lineno="389" slineno="2-7"/>private entity to establish, operate, or maintain the database.</subsection><subsection ssid="3-null-4" dnum="4-o" numlevel="1" lineno="390" slineno="2-8" level="1"><display>(4)</display>The division shall, in collaboration with the board, determine whether to operate the <ln numlevel="1" lineno="391" slineno="2-9"/>database within the division or contract with another entity to operate the database, <ln numlevel="1" lineno="392" slineno="2-10"/>based on an analysis of costs and benefits.</subsection><subsection ssid="3-null-5" dnum="5-o" numlevel="1" lineno="393" slineno="2-11" level="1"><display>(5)</display>The purpose of the database is to contain:<subsection ssid="3-null-6" dnum="a-o" numlevel="1" lineno="394" slineno="2-12" level="2"><display>(a)</display>the data described in Section <xref depth="3" refnumber="58-37f-203" start="0">58-37f-203</xref> regarding prescriptions for dispensed <ln numlevel="1" lineno="395" slineno="2-13"/>controlled substances;</subsection><subsection ssid="3-null-7" dnum="b-o" numlevel="1" lineno="396" slineno="2-14" level="2"><display>(b)</display>data reported to the division under Section <xref depth="3" refnumber="26B-2-225" start="0">26B-2-225</xref> regarding poisoning or <ln numlevel="1" lineno="397" slineno="2-15"/>overdose;</subsection><subsection ssid="3-null-8" dnum="c-o" numlevel="1" lineno="398" slineno="2-16" level="2"><display>(c)</display>data reported to the division under Subsection <xref depth="4" refnumber="41-6a-502(5)" start="0">41-6a-502(5)</xref> or <xref depth="4" refnumber="41-6a-502.5(5)(b)" start="0">41-6a-502.5(5)(b)</xref> <ln numlevel="1" lineno="399" slineno="2-17"/>regarding convictions for driving under the influence of a prescribed controlled <ln numlevel="1" lineno="400" slineno="2-18"/>substance or impaired driving; and</subsection><subsection ssid="3-null-9" dnum="d-o" numlevel="1" lineno="401" slineno="2-19" level="2"><display>(d)</display>data reported to the division under Subsection <xref depth="4" refnumber="58-37-8(1)(e)" start="0">58-37-8(1)(e)</xref> or <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="58-37-8(2)(g)" start="0">58-37-8(2)(g)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="58-37-8(2)(h)"><ln numlevel="1" lineno="402" slineno="2-20"/>58-37-8(2)(h)</xref></amend> regarding certain violations of <xref depth="1" refnumber="58-37" start="1">Chapter 37, Utah Controlled Substances <ln numlevel="1" lineno="403" slineno="2-21"/>Act</xref>.</subsection></subsection><subsection ssid="3-null-10" dnum="6-o" numlevel="1" lineno="404" slineno="2-22" level="1"><display>(6)</display>The division shall maintain the database in an electronic file or by other means <ln numlevel="1" lineno="405" slineno="2-23"/>established by the division to facilitate use of the database for identification of:<subsection ssid="3-null-11" dnum="a-o" numlevel="1" lineno="406" slineno="2-24" level="2"><display>(a)</display>prescribing practices and patterns of prescribing and dispensing controlled <ln numlevel="1" lineno="407" slineno="2-25"/>substances;</subsection><subsection ssid="3-null-12" dnum="b-o" numlevel="1" lineno="408" slineno="2-26" level="2"><display>(b)</display>practitioners prescribing controlled substances in an unprofessional or unlawful <ln numlevel="1" lineno="409" slineno="2-27"/>manner;</subsection><subsection ssid="3-null-13" dnum="c-o" numlevel="1" lineno="410" slineno="2-28" level="2"><display>(c)</display>individuals receiving prescriptions for controlled substances from licensed <ln numlevel="1" lineno="411" slineno="2-29"/>practitioners, and who subsequently obtain dispensed controlled substances from a <ln numlevel="1" lineno="412" slineno="2-30"/>drug outlet in quantities or with a frequency inconsistent with generally recognized <ln numlevel="1" lineno="413" slineno="2-31"/>standards of dosage for that controlled substance;</subsection><subsection ssid="3-null-14" dnum="d-o" numlevel="1" lineno="414" slineno="2-32" level="2"><display>(d)</display>individuals presenting forged or otherwise false or altered prescriptions for <ln numlevel="1" lineno="415" slineno="2-33"/>controlled substances to a pharmacy;</subsection><subsection ssid="3-null-15" dnum="e-o" numlevel="1" lineno="416" slineno="2-34" level="2"><display>(e)</display>individuals admitted to a general acute hospital for poisoning or overdose involving a <ln numlevel="1" lineno="417" slineno="2-35"/>prescribed controlled substance; and</subsection><subsection ssid="3-null-16" dnum="f-o" numlevel="1" lineno="418" slineno="2-36" level="2"><display>(f)</display>individuals convicted for:<subsection ssid="3-null-17" dnum="i-o" numlevel="1" lineno="419" slineno="2-37" level="3"><display>(i)</display>driving under the influence of a prescribed controlled substance that renders the <ln numlevel="1" lineno="420" slineno="2-38"/>individual incapable of safely operating a vehicle;</subsection><subsection ssid="3-null-18" dnum="ii-o" numlevel="1" lineno="421" slineno="2-39" level="3"><display>(ii)</display>driving while impaired, in whole or in part, by a prescribed controlled substance; <ln numlevel="1" lineno="422" slineno="2-40"/>or</subsection><subsection ssid="3-null-19" dnum="iii-o" numlevel="1" lineno="423" slineno="2-41" level="3"><display>(iii)</display>certain violations of <xref depth="1" refnumber="58-37" start="1">Chapter 37, Utah Controlled Substances Act</xref>.</subsection></subsection></subsection></section></bsec><bsec buid="7" num="58-37f-704" type="amend" src="code" uid="C58-37f-S704_2026050620260506" sort="58 37f07040020260506" numlevel="1" lineno="424" slineno="3-1" sn="3"><section number="58-37f-704" numlevel="1" lineno="425" slineno="3-2" type="amend"><secline lineno="424">Section 3. Section <bold>58-37f-704</bold> is amended to read:</secline><catline lineno="425"><bold>58-37f-704<parens/>. Entering certain convictions into the database. </bold></catline><sectionText lineno="426"><tab/>Beginning October 1, 2016, if the division receives a report from a court under <ln numlevel="1" lineno="427" slineno="3-4"/>Subsection <xref depth="4" refnumber="58-37-8(1)(e)" start="0">58-37-8(1)(e)</xref> or <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both">58-37-8(2)(g)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="58-37-8(2)(h)">58-37-8(2)(h)</xref></amend>, the division shall daily enter into <ln numlevel="1" lineno="428" slineno="3-5"/>the database the information supplied in the report. </sectionText></section></bsec><bsec buid="9" num="77-40a-101" type="amend" src="code" uid="C77-40a-S101_2026050620260506" sort="77 40a01010020260506" numlevel="1" lineno="429" slineno="4-1" sn="4"><section number="77-40a-101" numlevel="1" lineno="430" slineno="4-2" type="amend"><secline lineno="429">Section 4. Section <bold>77-40a-101</bold> is amended to read:</secline><catline lineno="430"><bold>77-40a-101<parens/>. Definitions.</bold></catline><sectionText lineno="431"><tab/>As used in this chapter:</sectionText><subsection ssid="9-null-1" dnum="1-o" numlevel="1" lineno="432" slineno="4-4" level="1"><display>(1)</display>"Agency" means a state, county, or local government entity that generates or maintains <ln numlevel="1" lineno="433" slineno="4-5"/>records relating to an investigation, arrest, detention, or conviction for an offense for <ln numlevel="1" lineno="434" slineno="4-6"/>which expungement may be ordered.</subsection><subsection ssid="9-null-2" dnum="2-o" numlevel="1" lineno="435" slineno="4-7" level="1"><display>(2)</display>"Automatic expungement" means the expungement of records of an investigation, <ln numlevel="1" lineno="436" slineno="4-8"/>arrest, detention, or conviction of an offense without the filing of a petition.</subsection><subsection ssid="9-null-3" dnum="3-o" numlevel="1" lineno="437" slineno="4-9" level="1"><display>(3)</display>"Bureau" means the Bureau of Criminal Identification of the Department of Public <ln numlevel="1" lineno="438" slineno="4-10"/>Safety established in Section <xref depth="3" refnumber="53-10-201">53-10-201</xref>.</subsection><subsection ssid="9-null-4" dnum="4-o" numlevel="1" lineno="439" slineno="4-11" level="1"><display>(4)</display>"Certificate of eligibility" means a document issued by the bureau stating that the <ln numlevel="1" lineno="440" slineno="4-12"/>criminal record and all records of arrest, investigation, and detention associated with a <ln numlevel="1" lineno="441" slineno="4-13"/>case that is the subject of a petition for expungement is eligible for expungement.</subsection><subsection ssid="9-null-5" dnum="5-o" numlevel="1" lineno="442" slineno="4-14" level="1"><display>(5)</display>"Civil accounts receivable" means the same as that term is defined in Section <xref depth="3" refnumber="77-32b-102"><ln numlevel="1" lineno="443" slineno="4-15"/>77-32b-102</xref>.</subsection><subsection ssid="9-null-6" dnum="6-o" numlevel="1" lineno="444" slineno="4-16" level="1"><display>(6)</display>"Civil judgment of restitution" means the same as that term is defined in Section <xref depth="3" refnumber="77-32b-102"><ln numlevel="1" lineno="445" slineno="4-17"/>77-32b-102</xref>.</subsection><subsection ssid="9-null-7" dnum="7-o" numlevel="1" lineno="446" slineno="4-18" level="1"><display>(7)</display>"Civil protective order" means the same as that term is defined in Section <xref depth="3" refnumber="78B-7-102">78B-7-102</xref>.</subsection><subsection ssid="9-null-8" dnum="8-o" numlevel="1" lineno="447" slineno="4-19" level="1"><display>(8)</display>"Clean slate eligible case" means a case that is eligible for automatic expungement <ln numlevel="1" lineno="448" slineno="4-20"/>under Section <xref depth="3" refnumber="77-40a-205">77-40a-205</xref>.</subsection><subsection ssid="9-null-9" dnum="9-o" numlevel="1" lineno="449" slineno="4-21" level="1"><display>(9)</display>"Conviction" means judgment by a criminal court on a verdict or finding of guilty after <ln numlevel="1" lineno="450" slineno="4-22"/>trial, a plea of guilty, or a plea of nolo contendere.</subsection><subsection ssid="9-null-10" dnum="10-o" numlevel="1" lineno="451" slineno="4-23" level="1"><display>(10)</display>"Court" means a district court or a justice court.</subsection><subsection ssid="9-null-11" dnum="11-o" numlevel="1" lineno="452" slineno="4-24" level="1"><display>(11)</display>"Criminal accounts receivable" means the same as that term is defined in Section <xref depth="3" refnumber="77-32b-102"><ln numlevel="1" lineno="453" slineno="4-25"/>77-32b-102</xref>.</subsection><subsection ssid="9-null-12" dnum="12-o" numlevel="1" lineno="454" slineno="4-26" level="1"><display>(12)</display>"Criminal protective order" means the same as that term is defined in Section <xref depth="3" refnumber="78B-7-102"><ln numlevel="1" lineno="455" slineno="4-27"/>78B-7-102</xref>.</subsection><subsection ssid="9-null-13" dnum="13-o" numlevel="1" lineno="456" slineno="4-28" level="1"><display>(13)</display>"Criminal stalking injunction" means the same as that term is defined in Section <xref depth="3" refnumber="78B-7-102"><ln numlevel="1" lineno="457" slineno="4-29"/>78B-7-102</xref>.</subsection><subsection ssid="9-null-14" dnum="14-o" numlevel="1" lineno="458" slineno="4-30" level="1"><display>(14)</display>"Department" means the Department of Public Safety established in Section <xref depth="3" refnumber="53-1-103">53-1-103</xref>.</subsection><subsection ssid="9-null-15" dnum="15-o" numlevel="1" lineno="459" slineno="4-31" level="1"><display>(15)</display>"Drug possession offense" means:<subsection ssid="9-null-16" dnum="a-o" numlevel="1" lineno="460" slineno="4-32" level="2"><display>(a)</display>an offense described in Subsection <xref depth="4" refnumber="58-37-8(2)">58-37-8(2)</xref>, except for:<subsection ssid="9-null-17" dnum="i-o" numlevel="1" lineno="461" slineno="4-33" level="3"><display>(i)</display>an offense under Subsection <xref depth="4" refnumber="58-37-8(2)(b)(i)">58-37-8(2)(b)(i)</xref>, possession of 100 pounds or more <ln numlevel="1" lineno="462" slineno="4-34"/>of marijuana;</subsection><subsection ssid="9-null-18" dnum="ii-o" numlevel="1" lineno="463" slineno="4-35" level="3"><display>(ii)</display>an offense enhanced under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both">58-37-8(2)(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="58-37-8(2)(f)">58-37-8(2)(f)</xref></amend>, violation in a <ln numlevel="1" lineno="464" slineno="4-36"/>correctional facility; or</subsection><subsection ssid="9-null-19" dnum="iii-o" numlevel="1" lineno="465" slineno="4-37" level="3"><display>(iii)</display>an offense for driving with a controlled substance illegally in the person's body <ln numlevel="1" lineno="466" slineno="4-38"/>and negligently causing serious bodily injury or death of another, as codified <ln numlevel="1" lineno="467" slineno="4-39"/>before May 4, 2022, Laws of Utah 2021, Chapter 236, Section 1, Subsection <xref depth="4" refnumber="58-37-8(2)(g)"><ln numlevel="1" lineno="468" slineno="4-40"/>58-37-8(2)(g)</xref>;</subsection></subsection><subsection ssid="9-null-20" dnum="b-o" numlevel="1" lineno="469" slineno="4-41" level="2"><display>(b)</display>an offense described in Subsection <xref depth="4" refnumber="58-37a-5(1)">58-37a-5(1)</xref>, use or possession of drug <ln numlevel="1" lineno="470" slineno="4-42"/>paraphernalia;</subsection><subsection ssid="9-null-21" dnum="c-o" numlevel="1" lineno="471" slineno="4-43" level="2"><display>(c)</display>an offense described in Section <xref depth="3" refnumber="58-37b-6">58-37b-6</xref>, possession or use of an imitation <ln numlevel="1" lineno="472" slineno="4-44"/>controlled substance; or</subsection><subsection ssid="9-null-22" dnum="d-o" numlevel="1" lineno="473" slineno="4-45" level="2"><display>(d)</display>any local ordinance which is substantially similar to any of the offenses described in <ln numlevel="1" lineno="474" slineno="4-46"/>this Subsection <xref depth="4" refnumber="77-40a-101(15)">(15)</xref>.</subsection></subsection><subsection ssid="9-null-23" dnum="16-o" numlevel="1" lineno="475" slineno="4-47" level="1" space="false"><display>(16)</display><subsection ssid="9-null-24" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Expunge" means to remove a record from public inspection by:<subsection ssid="9-null-25" dnum="i-o" numlevel="1" lineno="476" slineno="4-48" level="3" tab="1"><display>(i)</display>sealing the record; or</subsection><subsection ssid="9-null-26" dnum="ii-o" numlevel="1" lineno="477" slineno="4-49" level="3" tab="1"><display>(ii)</display>restricting or denying access to the record.</subsection></subsection><subsection ssid="9-null-27" dnum="b-o" numlevel="1" lineno="478" slineno="4-50" level="2"><display>(b)</display>"Expunge" does not include the destruction of a record.</subsection></subsection><subsection ssid="9-null-28" dnum="17-o" numlevel="1" lineno="479" slineno="4-51" level="1"><display>(17)</display>"Indigent" means a financial status that results from a court finding that a petitioner is <ln numlevel="1" lineno="480" slineno="4-52"/>financially unable to pay the fee to file a petition for expungement under Section <xref depth="3" refnumber="78A-2-302"><ln numlevel="1" lineno="481" slineno="4-53"/>78A-2-302</xref>.</subsection><subsection ssid="9-null-29" dnum="18-o" numlevel="1" lineno="482" slineno="4-54" level="1"><display>(18)</display>"Jurisdiction" means a state, district, province, political subdivision, territory, or <ln numlevel="1" lineno="483" slineno="4-55"/>possession of the United States or any foreign country.</subsection><subsection ssid="9-null-30" dnum="19-o" numlevel="1" lineno="484" slineno="4-56" level="1" space="false"><display>(19)</display><subsection ssid="9-null-31" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Minor regulatory offense" means a class B or C misdemeanor offense or a local <ln numlevel="1" lineno="485" slineno="4-57"/>ordinance.</subsection><subsection ssid="9-null-32" dnum="b-o" numlevel="1" lineno="486" slineno="4-58" level="2"><display>(b)</display>"Minor regulatory offense" includes an offense under Section <xref depth="3" refnumber="76-9-110">76-9-110</xref> or <xref depth="3" refnumber="76-9-1106">76-9-1106</xref>.</subsection><subsection ssid="9-null-33" dnum="c-o" numlevel="1" lineno="487" slineno="4-59" level="2"><display>(c)</display>"Minor regulatory offense" does not include:<subsection ssid="9-null-34" dnum="i-o" numlevel="1" lineno="488" slineno="4-60" level="3"><display>(i)</display>any drug possession offense;</subsection><subsection ssid="9-null-35" dnum="ii-o" numlevel="1" lineno="489" slineno="4-61" level="3"><display>(ii)</display>an offense under Title 41, Chapter 6a, Part 5, Driving Under the Influence and <ln numlevel="1" lineno="490" slineno="4-62"/>Reckless Driving;</subsection><subsection ssid="9-null-36" dnum="iii-o" numlevel="1" lineno="491" slineno="4-63" level="3"><display>(iii)</display>an offense under Sections <xref depth="3" refnumber="73-18-13">73-18-13</xref> through <xref depth="3" refnumber="73-18-13.6">73-18-13.6</xref>;</subsection><subsection ssid="9-null-37" dnum="iv-o" numlevel="1" lineno="492" slineno="4-64" level="3"><display>(iv)</display>except as provided in Subsection <xref depth="4" refnumber="77-40a-101(19)(b)">(19)(b)</xref>, an offense under Title 76, Utah <ln numlevel="1" lineno="493" slineno="4-65"/>Criminal Code; or</subsection><subsection ssid="9-null-38" dnum="v-o" numlevel="1" lineno="494" slineno="4-66" level="3"><display>(v)</display>any local ordinance that is substantially similar to an offense listed in Subsections <xref depth="4" refnumber="77-40a-101(19)(c)(i)"><ln numlevel="1" lineno="495" slineno="4-67"/>(19)(c)(i)</xref> through <xref depth="4" refnumber="77-40a-101(iv)">(iv)</xref>.</subsection></subsection></subsection><subsection ssid="9-null-39" dnum="20-o" numlevel="1" lineno="496" slineno="4-68" level="1"><display>(20)</display>"Petitioner" means an individual applying for expungement under this chapter.</subsection><subsection ssid="9-null-40" dnum="21-o" numlevel="1" lineno="497" slineno="4-69" level="1"><display>(21)</display>"Plea in abeyance" means the same as that term is defined in Section <xref depth="3" refnumber="77-2a-1">77-2a-1</xref>.</subsection><subsection ssid="9-null-41" dnum="22-o" numlevel="1" lineno="498" slineno="4-70" level="1"><display>(22)</display>"Record" means a book, letter, document, paper, map, plan, photograph, film, card, <ln numlevel="1" lineno="499" slineno="4-71"/>tape, recording, electronic data, or other documentary material, regardless of physical <ln numlevel="1" lineno="500" slineno="4-72"/>form or characteristics, that:<subsection ssid="9-null-42" dnum="a-o" numlevel="1" lineno="501" slineno="4-73" level="2"><display>(a)</display>is contained in the agency's file regarding the arrest, detention, investigation, <ln numlevel="1" lineno="502" slineno="4-74"/>conviction, sentence, incarceration, probation, or parole of an individual; and</subsection><subsection ssid="9-null-43" dnum="b-o" numlevel="1" lineno="503" slineno="4-75" level="2"><display>(b)</display>is prepared, owned, received, or retained by an agency, including a court.</subsection></subsection><subsection ssid="9-null-44" dnum="23-o" numlevel="1" lineno="504" slineno="4-76" level="1"><display>(23)</display>"Special certificate" means a document issued as described in Subsection <xref depth="4" refnumber="77-40a-304(1)(c)"><ln numlevel="1" lineno="505" slineno="4-77"/>77-40a-304(1)(c)</xref> by the bureau stating that the criminal record and all records of arrest, <ln numlevel="1" lineno="506" slineno="4-78"/>investigation, and detention associated with the case do not clearly demonstrate whether <ln numlevel="1" lineno="507" slineno="4-79"/>the case is eligible for expungement.</subsection><subsection ssid="9-null-45" dnum="24-o" numlevel="1" lineno="508" slineno="4-80" level="1" space="false"><display>(24)</display><subsection ssid="9-null-46" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Traffic offense" means:<subsection ssid="9-null-47" dnum="i-o" numlevel="1" lineno="509" slineno="4-81" level="3" tab="1"><display>(i)</display>an infraction or a class C misdemeanor offense under Title 41, Chapter 1a, Motor <ln numlevel="1" lineno="510" slineno="4-82"/>Vehicle Act;</subsection><subsection ssid="9-null-48" dnum="ii-o" numlevel="1" lineno="511" slineno="4-83" level="3" tab="1"><display>(ii)</display>an infraction, a class B misdemeanor offense, or a class C misdemeanor offense <ln numlevel="1" lineno="512" slineno="4-84"/>under Title 41, Chapter 6a, Traffic Code;</subsection><subsection ssid="9-null-49" dnum="iii-o" numlevel="1" lineno="513" slineno="4-85" level="3" tab="1"><display>(iii)</display>an infraction or a class C misdemeanor offense under Title 41, Chapter 12a, <ln numlevel="1" lineno="514" slineno="4-86"/>Financial Responsibility of Motor Vehicle Owners and Operators Act;</subsection><subsection ssid="9-null-50" dnum="iv-o" numlevel="1" lineno="515" slineno="4-87" level="3" tab="1"><display>(iv)</display>an infraction, a class B misdemeanor offense, or a class C misdemeanor offense <ln numlevel="1" lineno="516" slineno="4-88"/>under Title 53, Chapter 3, Part 2, Driver Licensing Act;</subsection><subsection ssid="9-null-51" dnum="v-o" numlevel="1" lineno="517" slineno="4-89" level="3" tab="1"><display>(v)</display>an infraction, a class B misdemeanor offense, or a class C misdemeanor offense <ln numlevel="1" lineno="518" slineno="4-90"/>under Title 73, Chapter 18, State Boating Act; and</subsection><subsection ssid="9-null-52" dnum="vi-o" numlevel="1" lineno="519" slineno="4-91" level="3" tab="1"><display>(vi)</display>all local ordinances that are substantially similar to an offense listed in <ln numlevel="1" lineno="520" slineno="4-92"/>Subsections <xref depth="4" refnumber="77-40a-101(24)(a)(i)">(24)(a)(i)</xref> through <xref depth="4" refnumber="77-40a-101(iii)">(iii)</xref>.</subsection></subsection><subsection ssid="9-null-53" dnum="b-o" numlevel="1" lineno="521" slineno="4-93" level="2"><display>(b)</display>"Traffic offense" does not include:<subsection ssid="9-null-54" dnum="i-o" numlevel="1" lineno="522" slineno="4-94" level="3"><display>(i)</display>an offense under Title 41, Chapter 6a, Part 5, Driving Under the Influence and <ln numlevel="1" lineno="523" slineno="4-95"/>Reckless Driving;</subsection><subsection ssid="9-null-55" dnum="ii-o" numlevel="1" lineno="524" slineno="4-96" level="3"><display>(ii)</display>an offense under Section <xref depth="3" refnumber="41-12a-302">41-12a-302</xref> for operating a motor vehicle without <ln numlevel="1" lineno="525" slineno="4-97"/>owner's or operator's security;</subsection><subsection ssid="9-null-56" dnum="iii-o" numlevel="1" lineno="526" slineno="4-98" level="3"><display>(iii)</display>an offense under Section <xref depth="3" refnumber="41-12a-303.3">41-12a-303.3</xref> for providing false evidence of owner's or <ln numlevel="1" lineno="527" slineno="4-99"/>operator's security;</subsection><subsection ssid="9-null-57" dnum="iv-o" numlevel="1" lineno="528" slineno="4-100" level="3"><display>(iv)</display>an offense under Sections <xref depth="3" refnumber="73-18-13">73-18-13</xref> through <xref depth="3" refnumber="73-18-13.6">73-18-13.6</xref>; or</subsection><subsection ssid="9-null-58" dnum="v-o" numlevel="1" lineno="529" slineno="4-101" level="3"><display>(v)</display>any local ordinance that is substantially similar to an offense listed in Subsection <xref depth="4" refnumber="77-40a-101(24)(b)(i)"><ln numlevel="1" lineno="530" slineno="4-102"/>(24)(b)(i)</xref> or <xref depth="4" refnumber="77-40a-101(ii)">(ii)</xref>.</subsection></subsection></subsection><subsection ssid="9-null-59" dnum="25-o" numlevel="1" lineno="531" slineno="4-103" level="1"><display>(25)</display>"Traffic offense case" means that each offense in the case is a traffic offense.</subsection></section></bsec><bsec buid="5" num="77-40a-205" type="amend" src="code" uid="C77-40a-S205_2026050620260506" sort="77 40a02050020260506" numlevel="1" lineno="532" slineno="5-1" sn="5"><section number="77-40a-205" numlevel="1" lineno="533" slineno="5-2" type="amend"><secline lineno="532">Section 5. Section <bold>77-40a-205</bold> is amended to read:</secline><catline lineno="533"><bold>77-40a-205<parens/>. Automatic expungement of state records for a clean slate case.</bold></catline><subsection ssid="5-null-1" dnum="1-o" numlevel="1" lineno="534" slineno="5-3" level="1" placement="noreturn"><display>(1)</display>A court shall issue an order of expungement, without the filing of a petition, for all <ln numlevel="1" lineno="535" slineno="5-4"/>records of the case that are held by the court and the bureau if:<subsection ssid="5-null-2" dnum="a-o" numlevel="1" lineno="536" slineno="5-5" level="2"><display>(a)</display>on and after October 1, 2024, but before January 1, 2026, the individual submitted a <ln numlevel="1" lineno="537" slineno="5-6"/>form requesting expungement of a case as described in Section <xref depth="3" refnumber="77-40a-204">77-40a-204</xref>;</subsection><subsection ssid="5-null-3" dnum="b-o" numlevel="1" lineno="538" slineno="5-7" level="2"><display>(b)</display>the case is eligible for expungement under this section; and</subsection><subsection ssid="5-null-4" dnum="c-o" numlevel="1" lineno="539" slineno="5-8" level="2"><display>(c)</display>the prosecuting agency does not object to the expungement of the case as described <ln numlevel="1" lineno="540" slineno="5-9"/>in Subsection <xref depth="4" refnumber="77-40a-205(6)">(6)</xref>.</subsection></subsection><subsection ssid="5-null-5" dnum="2-o" numlevel="1" lineno="541" slineno="5-10" level="1"><display>(2)</display>Except as otherwise provided in Subsection <xref depth="4" refnumber="77-40a-205(3)">(3)</xref>, a case is eligible for expungement <ln numlevel="1" lineno="542" slineno="5-11"/>under this section if:<subsection ssid="5-null-6" dnum="a-o" numlevel="1" lineno="543" slineno="5-12" level="2" space="false"><display>(a)</display><subsection ssid="5-null-7" dnum="i-o" level="3" placement="sameline"><display>(i)</display>each conviction within the case is a conviction for:<subsection ssid="5-null-8" dnum="A-o" numlevel="1" lineno="544" slineno="5-13" level="4" tab="1"><display>(A)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="7" groupid="7" style="2" owner="jchristopherson" level="1" deltag="both">a</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="5" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">an infraction or a</amend> misdemeanor offense for possession of a controlled <ln numlevel="1" lineno="545" slineno="5-14"/>substance in violation of Subsection <xref depth="4" refnumber="58-37-8(2)(a)(i)">58-37-8(2)(a)(i)</xref>;</subsection><subsection ssid="5-null-9" dnum="B-o" numlevel="1" lineno="546" slineno="5-15" level="4" tab="1"><display>(B)</display>a class B misdemeanor offense;</subsection><subsection ssid="5-null-10" dnum="C-o" numlevel="1" lineno="547" slineno="5-16" level="4" tab="1"><display>(C)</display>a class C misdemeanor offense; or</subsection><subsection ssid="5-null-11" dnum="D-o" numlevel="1" lineno="548" slineno="5-17" level="4" tab="1"><display>(D)</display>an infraction; and</subsection></subsection><subsection ssid="5-null-12" dnum="ii-o" numlevel="1" lineno="549" slineno="5-18" level="3"><display>(ii)</display>the following time periods have passed after the day on which the individual is <ln numlevel="1" lineno="550" slineno="5-19"/>adjudicated:<subsection ssid="5-null-13" dnum="A-o" numlevel="1" lineno="551" slineno="5-20" level="4"><display>(A)</display>at least five years for the conviction of a class C misdemeanor offense or an <ln numlevel="1" lineno="552" slineno="5-21"/>infraction;</subsection><subsection ssid="5-null-14" dnum="B-o" numlevel="1" lineno="553" slineno="5-22" level="4"><display>(B)</display>at least six years for the conviction of a class B misdemeanor offense; or</subsection><subsection ssid="5-null-15" dnum="C-o" numlevel="1" lineno="554" slineno="5-23" level="4"><display>(C)</display>at least seven years for the conviction of a class A misdemeanor offense for <ln numlevel="1" lineno="555" slineno="5-24"/>possession of a controlled substance in violation of Subsection <xref depth="4" refnumber="58-37-8(2)(a)(i)">58-37-8(2)(a)(i)</xref>; <ln numlevel="1" lineno="556" slineno="5-25"/>or</subsection></subsection></subsection><subsection ssid="5-null-16" dnum="b-o" numlevel="1" lineno="557" slineno="5-26" level="2" space="false"><display>(b)</display><subsection ssid="5-null-17" dnum="i-o" level="3" placement="sameline"><display>(i)</display>the case is dismissed as a result of a successful completion of a plea in <ln numlevel="1" lineno="558" slineno="5-27"/>abeyance agreement governed by Subsection <xref depth="4" refnumber="77-2a-3(2)(b)">77-2a-3(2)(b)</xref> or the case is <ln numlevel="1" lineno="559" slineno="5-28"/>dismissed without prejudice;</subsection><subsection ssid="5-null-18" dnum="ii-o" numlevel="1" lineno="560" slineno="5-29" level="3"><display>(ii)</display>each charge within the case is:<subsection ssid="5-null-19" dnum="A-o" numlevel="1" lineno="561" slineno="5-30" level="4"><display>(A)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="8" groupid="8" style="2" owner="jchristopherson" level="1" deltag="both">a</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">an infraction or a</amend> misdemeanor offense for possession of a controlled <ln numlevel="1" lineno="562" slineno="5-31"/>substance in violation of Subsection <xref depth="4" refnumber="58-37-8(2)(a)(i)">58-37-8(2)(a)(i)</xref>;</subsection><subsection ssid="5-null-20" dnum="B-o" numlevel="1" lineno="563" slineno="5-32" level="4"><display>(B)</display>a class B misdemeanor offense;</subsection><subsection ssid="5-null-21" dnum="C-o" numlevel="1" lineno="564" slineno="5-33" level="4"><display>(C)</display>a class C misdemeanor offense; or</subsection><subsection ssid="5-null-22" dnum="D-o" numlevel="1" lineno="565" slineno="5-34" level="4"><display>(D)</display>an infraction; and</subsection></subsection><subsection ssid="5-null-23" dnum="iii-o" numlevel="1" lineno="566" slineno="5-35" level="3"><display>(iii)</display>the following time periods have passed after the day on which the case is <ln numlevel="1" lineno="567" slineno="5-36"/>dismissed:<subsection ssid="5-null-24" dnum="A-o" numlevel="1" lineno="568" slineno="5-37" level="4"><display>(A)</display>at least five years for a charge in the case for a class C misdemeanor offense <ln numlevel="1" lineno="569" slineno="5-38"/>or an infraction;</subsection><subsection ssid="5-null-25" dnum="B-o" numlevel="1" lineno="570" slineno="5-39" level="4"><display>(B)</display>at least six years for a charge in the case for a class B misdemeanor offense; or</subsection><subsection ssid="5-null-26" dnum="C-o" numlevel="1" lineno="571" slineno="5-40" level="4"><display>(C)</display>at least seven years for a charge in the case for a class A misdemeanor offense <ln numlevel="1" lineno="572" slineno="5-41"/>for possession of a controlled substance in violation of Subsection <xref depth="4" refnumber="58-37-8(2)(a)(i)"><ln numlevel="1" lineno="573" slineno="5-42"/>58-37-8(2)(a)(i)</xref>.</subsection></subsection></subsection></subsection><subsection ssid="5-null-27" dnum="3-o" numlevel="1" lineno="574" slineno="5-43" level="1"><display>(3)</display>A case is not eligible for expungement under this section if:<subsection ssid="5-null-28" dnum="a-o" numlevel="1" lineno="575" slineno="5-44" level="2"><display>(a)</display>the individual has a total number of convictions in courts of this state that exceed the <ln numlevel="1" lineno="576" slineno="5-45"/>limits under Subsection <xref depth="4" refnumber="77-40a-303(4)">77-40a-303(4)</xref> or <xref depth="4" refnumber="77-40a-205(5)">(5)</xref> without taking into consideration:<subsection ssid="5-null-29" dnum="i-o" numlevel="1" lineno="577" slineno="5-46" level="3"><display>(i)</display>the exception in Subsection <xref depth="4" refnumber="77-40a-303(7)">77-40a-303(7)</xref>; or</subsection><subsection ssid="5-null-30" dnum="ii-o" numlevel="1" lineno="578" slineno="5-47" level="3"><display>(ii)</display>any infraction, traffic offense, or minor regulatory offense;</subsection></subsection><subsection ssid="5-null-31" dnum="b-o" numlevel="1" lineno="579" slineno="5-48" level="2"><display>(b)</display>there is a criminal proceeding for a misdemeanor or felony offense pending in a <ln numlevel="1" lineno="580" slineno="5-49"/>court of this state against the individual, unless the proceeding is for a traffic offense;</subsection><subsection ssid="5-null-32" dnum="c-o" numlevel="1" lineno="581" slineno="5-50" level="2"><display>(c)</display>for an individual seeking an automatic expungement on and after January 1, 2025, <ln numlevel="1" lineno="582" slineno="5-51"/>the individual is incarcerated in the state prison or on probation or parole that is <ln numlevel="1" lineno="583" slineno="5-52"/>supervised by the Division of Adult Probation and Parole created in Section <xref depth="3" refnumber="64-14-202"><ln numlevel="1" lineno="584" slineno="5-53"/>64-14-202</xref>;</subsection><subsection ssid="5-null-33" dnum="d-o" numlevel="1" lineno="585" slineno="5-54" level="2"><display>(d)</display>the case resulted in the individual being found not guilty by reason of insanity;</subsection><subsection ssid="5-null-34" dnum="e-o" numlevel="1" lineno="586" slineno="5-55" level="2"><display>(e)</display>the case establishes a criminal accounts receivable that:<subsection ssid="5-null-35" dnum="i-o" numlevel="1" lineno="587" slineno="5-56" level="3"><display>(i)</display>has been entered as a civil accounts receivable or a civil judgment of restitution <ln numlevel="1" lineno="588" slineno="5-57"/>and transferred to the Office of State Debt Collection under Section <xref depth="3" refnumber="77-18-114">77-18-114</xref>; or</subsection><subsection ssid="5-null-36" dnum="ii-o" numlevel="1" lineno="589" slineno="5-58" level="3"><display>(ii)</display>has not been satisfied according to court records; or</subsection></subsection><subsection ssid="5-null-37" dnum="f-o" numlevel="1" lineno="590" slineno="5-59" level="2"><display>(f)</display>the case resulted in a plea held in abeyance or a conviction for the following offenses:<subsection ssid="5-null-38" dnum="i-o" numlevel="1" lineno="591" slineno="5-60" level="3"><display>(i)</display>any of the offenses listed in Subsection <xref depth="4" refnumber="77-40a-303(2)(a)">77-40a-303(2)(a)</xref>;</subsection><subsection ssid="5-null-39" dnum="ii-o" numlevel="1" lineno="592" slineno="5-61" level="3"><display>(ii)</display>an offense against the person in violation of Title 76, Chapter 5, Offenses Against <ln numlevel="1" lineno="593" slineno="5-62"/>the Individual;</subsection><subsection ssid="5-null-40" dnum="iii-o" numlevel="1" lineno="594" slineno="5-63" level="3"><display>(iii)</display>a weapons offense in violation of Title 76, Chapter 11, Weapons;</subsection><subsection ssid="5-null-41" dnum="iv-o" numlevel="1" lineno="595" slineno="5-64" level="3"><display>(iv)</display>sexual battery in violation of Section <xref refnumber="76-5-418" depth="4">76-5-418</xref>;</subsection><subsection ssid="5-null-42" dnum="v-o" numlevel="1" lineno="596" slineno="5-65" level="3"><display>(v)</display>an act of lewdness in violation of Section <xref refnumber="76-5-419" depth="4">76-5-419</xref> or <xref refnumber="76-5-420" depth="4">76-5-420</xref>;</subsection><subsection ssid="5-null-43" dnum="vi-o" numlevel="1" lineno="597" slineno="5-66" level="3"><display>(vi)</display>an offense in violation of Title 41, Chapter 6a, Part 5, Driving Under the <ln numlevel="1" lineno="598" slineno="5-67"/>Influence and Reckless Driving;</subsection><subsection ssid="5-null-44" dnum="vii-o" numlevel="1" lineno="599" slineno="5-68" level="3"><display>(vii)</display>damage to or interruption of a communication device in violation of Section <xref depth="3" refnumber="76-6-108"><ln numlevel="1" lineno="600" slineno="5-69"/>76-6-108</xref>;</subsection><subsection ssid="5-null-45" dnum="viii-o" numlevel="1" lineno="601" slineno="5-70" level="3"><display>(viii)</display>a domestic violence offense as defined in Section <xref depth="3" refnumber="77-36-1">77-36-1</xref>; </subsection><subsection ssid="5-null-46" dnum="ix-o" numlevel="1" lineno="602" slineno="5-71" level="3"><display>(ix)</display>driving under the influence of alcohol, drugs, or a combination of both, or with <ln numlevel="1" lineno="603" slineno="5-72"/>specified or unsafe blood alcohol concentration, as codified before February 2, <ln numlevel="1" lineno="604" slineno="5-73"/>2005, Laws of Utah 2005, Chapter 2; or</subsection><subsection ssid="5-null-47" dnum="x-o" numlevel="1" lineno="605" slineno="5-74" level="3"><display>(x)</display>any other offense classified in the Utah Code as a felony or a class A <ln numlevel="1" lineno="606" slineno="5-75"/>misdemeanor other than a class A misdemeanor conviction for possession of a <ln numlevel="1" lineno="607" slineno="5-76"/>controlled substance in violation of Subsection <xref depth="4" refnumber="58-37-8(2)(a)(i)">58-37-8(2)(a)(i)</xref>.</subsection></subsection></subsection><subsection ssid="5-null-48" dnum="4-o" numlevel="1" lineno="608" slineno="5-77" level="1"><display>(4)</display>A prosecuting agency that has complied with Rule 42 of the Utah Rules of Criminal <ln numlevel="1" lineno="609" slineno="5-78"/>Procedure shall receive notice on a monthly basis for any case prosecuted by that agency <ln numlevel="1" lineno="610" slineno="5-79"/>that appears to be eligible for automatic expungement under this section.</subsection><subsection ssid="5-null-49" dnum="5-o" numlevel="1" lineno="611" slineno="5-80" level="1"><display>(5)</display>Within 35 days after the day on which the notice described in Subsection <xref depth="4" refnumber="77-40a-205(4)">(4)</xref> is sent, the <ln numlevel="1" lineno="612" slineno="5-81"/>prosecuting agency shall provide written notice in accordance with Rule 42 of the Utah <ln numlevel="1" lineno="613" slineno="5-82"/>Rules of Criminal Procedure if the prosecuting agency objects to an automatic <ln numlevel="1" lineno="614" slineno="5-83"/>expungement for any of the following reasons:<subsection ssid="5-null-50" dnum="a-o" numlevel="1" lineno="615" slineno="5-84" level="2"><display>(a)</display>the prosecuting agency believes that the case is not eligible for expungement under <ln numlevel="1" lineno="616" slineno="5-85"/>this section after reviewing the agency record;</subsection><subsection ssid="5-null-51" dnum="b-o" numlevel="1" lineno="617" slineno="5-86" level="2"><display>(b)</display>the individual has not paid restitution to the victim as ordered by the court; or</subsection><subsection ssid="5-null-52" dnum="c-o" numlevel="1" lineno="618" slineno="5-87" level="2"><display>(c)</display>the prosecuting agency has a reasonable belief, grounded in supporting facts, that an <ln numlevel="1" lineno="619" slineno="5-88"/>individual involved in the case is continuing to engage in criminal activity within or <ln numlevel="1" lineno="620" slineno="5-89"/>outside of the state.</subsection></subsection><subsection ssid="5-null-53" dnum="6-o" numlevel="1" lineno="621" slineno="5-90" level="1"><display>(6)</display>If a prosecuting agency provides written notice of an objection for a reason described in <ln numlevel="1" lineno="622" slineno="5-91"/>Subsection <xref depth="4" refnumber="77-40a-205(5)">(5)</xref> within 35 days after the day on which the notice under Subsection <xref depth="4" refnumber="77-40a-205(4)">(4)</xref> is <ln numlevel="1" lineno="623" slineno="5-92"/>sent, the court may not proceed with automatic expungement of the case.</subsection><subsection ssid="5-null-54" dnum="7-o" numlevel="1" lineno="624" slineno="5-93" level="1"><display>(7)</display>If 35 days pass after the day on which the notice described in Subsection <xref depth="4" refnumber="77-40a-205(4)">(4)</xref> is sent <ln numlevel="1" lineno="625" slineno="5-94"/>without the prosecuting agency providing written notice of an objection under <ln numlevel="1" lineno="626" slineno="5-95"/>Subsection <xref depth="4" refnumber="77-40a-205(5)">(5)</xref>, the court shall proceed with automatic expungement of the case.</subsection><subsection ssid="5-null-55" dnum="8-o" numlevel="1" lineno="627" slineno="5-96" level="1"><display>(8)</display>If a court issues an order of expungement under Subsection <xref depth="4" refnumber="77-40a-205(1)">(1)</xref>, the court shall:<subsection ssid="5-null-56" dnum="a-o" numlevel="1" lineno="628" slineno="5-97" level="2"><display>(a)</display>expunge all records of the case held by the court in accordance with Section <xref depth="3" refnumber="77-40a-401"><ln numlevel="1" lineno="629" slineno="5-98"/>77-40a-401</xref>; and</subsection><subsection ssid="5-null-57" dnum="b-o" numlevel="1" lineno="630" slineno="5-99" level="2"><display>(b)</display>notify the bureau and the prosecuting agency identified in the case, based on <ln numlevel="1" lineno="631" slineno="5-100"/>information available to the court, of the order of expungement.</subsection></subsection></section></bsec><bsec buid="10" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="632" slineno="6-1" sn="6"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="632">Section 6.  <bold>Effective Date.</bold></secline><sectionText lineno="633"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>1-14-26 12:47 PM</tm></rev></foot></leg>
