Section <bold>58-37-8</bold> is amended to read:</secline><catline lineno="30"><bold>58-37-8<parens/>. Prohibited acts -- Penalties.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="31" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>Prohibited acts A -- Penalties and reporting:<subsection ssid="1-null-2" dnum="a-o" numlevel="1" lineno="32" slineno="1-4" level="2"><display>(a)</display>Except as authorized by this chapter, and under circumstances not amounting to an <ln numlevel="1" lineno="33" slineno="1-5"/>offense described in Section <xref depth="3" refnumber="58-37-8.1">58-37-8.1</xref>, trafficking of fentanyl or a fentanyl-related <ln numlevel="1" lineno="34" slineno="1-6"/>substance, it is unlawful for a person to knowingly and intentionally:<subsection ssid="1-null-3" dnum="i-o" numlevel="1" lineno="35" slineno="1-7" level="3"><display>(i)</display>produce, manufacture, or dispense, or to possess with intent to produce, <ln numlevel="1" lineno="36" slineno="1-8"/>manufacture, or dispense, a controlled or counterfeit substance;</subsection><subsection ssid="1-null-4" dnum="ii-o" numlevel="1" lineno="37" slineno="1-9" level="3"><display>(ii)</display>distribute a controlled or counterfeit substance, or to agree, consent, offer, or <ln numlevel="1" lineno="38" slineno="1-10"/>arrange to distribute a controlled or counterfeit substance;</subsection><subsection ssid="1-null-5" dnum="iii-o" numlevel="1" lineno="39" slineno="1-11" level="3"><display>(iii)</display>possess a controlled or counterfeit substance with intent to distribute; or</subsection><subsection ssid="1-null-6" dnum="iv-o" numlevel="1" lineno="40" slineno="1-12" level="3"><display>(iv)</display>engage in a continuing criminal enterprise where:<subsection ssid="1-null-7" dnum="A-o" numlevel="1" lineno="41" slineno="1-13" level="4"><display>(A)</display>the person participates, directs, or engages in conduct that results in a <ln numlevel="1" lineno="42" slineno="1-14"/>violation of this chapter, Chapter 37a, Utah Drug Paraphernalia Act, Chapter <ln numlevel="1" lineno="43" slineno="1-15"/>37b, Imitation Controlled Substances Act, Chapter 37c, Utah Controlled <ln numlevel="1" lineno="44" slineno="1-16"/>Substance Precursor Act, or Chapter 37d, Clandestine Drug Lab Act, that is a <ln numlevel="1" lineno="45" slineno="1-17"/>felony; and</subsection><subsection ssid="1-null-8" dnum="B-o" numlevel="1" lineno="46" slineno="1-18" level="4"><display>(B)</display>the violation is a part of a continuing series of two or more violations of this <ln numlevel="1" lineno="47" slineno="1-19"/>chapter, Chapter 37a, Utah Drug Paraphernalia Act, Chapter 37b, Imitation <ln numlevel="1" lineno="48" slineno="1-20"/>Controlled Substances Act, Chapter 37c, Utah Controlled Substance Precursor <ln numlevel="1" lineno="49" slineno="1-21"/>Act, or Chapter 37d, Clandestine Drug Lab Act, on separate occasions that are <ln numlevel="1" lineno="50" slineno="1-22"/>undertaken in concert with five or more persons with respect to whom the <ln numlevel="1" lineno="51" slineno="1-23"/>person occupies a position of organizer, supervisor, or any other position of <ln numlevel="1" lineno="52" slineno="1-24"/>management.</subsection></subsection></subsection><subsection ssid="1-null-9" dnum="b-o" numlevel="1" lineno="53" slineno="1-25" level="2"><display>(b)</display>A person convicted of violating Subsection <xref depth="4" refnumber="58-37-8(1)(a)">(1)(a)</xref> with respect to:<subsection ssid="1-null-10" dnum="i-o" numlevel="1" lineno="54" slineno="1-26" level="3"><display>(i)</display>a substance or a counterfeit of a substance classified in Schedule I or II, a <ln numlevel="1" lineno="55" slineno="1-27"/>controlled substance analog, or gammahydroxybutyric acid as listed in Schedule <ln numlevel="1" lineno="56" slineno="1-28"/>III is guilty of a second degree felony, punishable by imprisonment for not more <ln numlevel="1" lineno="57" slineno="1-29"/>than 15 years, and upon a second or subsequent conviction is guilty of a first <ln numlevel="1" lineno="58" slineno="1-30"/>degree felony;</subsection><subsection ssid="1-null-11" dnum="ii-o" numlevel="1" lineno="59" slineno="1-31" level="3"><display>(ii)</display>a substance or a counterfeit of a substance classified in Schedule III or IV, or <ln numlevel="1" lineno="60" slineno="1-32"/>marijuana, or a substance listed in Section <xref depth="3" refnumber="58-37-4.2">58-37-4.2</xref> is guilty of a third degree <ln numlevel="1" lineno="61" slineno="1-33"/>felony, and upon a second or subsequent conviction is guilty of a second degree <ln numlevel="1" lineno="62" slineno="1-34"/>felony; or</subsection><subsection ssid="1-null-12" dnum="iii-o" numlevel="1" lineno="63" slineno="1-35" level="3"><display>(iii)</display>a substance or a counterfeit of a substance classified in Schedule V is guilty of a <ln numlevel="1" lineno="64" slineno="1-36"/>class A misdemeanor and upon a second or subsequent conviction is guilty of a <ln numlevel="1" lineno="65" slineno="1-37"/>third degree felony.</subsection></subsection><subsection ssid="1-null-13" dnum="c-o" numlevel="1" lineno="66" slineno="1-38" level="2" space="false"><display>(c)</display><subsection ssid="1-null-14" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Except as provided in Subsection <xref depth="4" refnumber="58-37-8(1)(c)(iii)">(1)(c)(iii)</xref>, a person who has been convicted <ln numlevel="1" lineno="67" slineno="1-39"/>of a violation of Subsection <xref depth="4" refnumber="58-37-8(1)(a)(ii)">(1)(a)(ii)</xref> or <xref depth="4" refnumber="58-37-8(iii)">(iii)</xref> may be sentenced to imprisonment <ln numlevel="1" lineno="68" slineno="1-40"/>for an indeterminate term as described in Subsection <xref depth="4" refnumber="58-37-8(1)(c)(ii)">(1)(c)(ii)</xref> and <xref depth="3" refnumber="Title 76, Chapter 3, Punishments">Title 76, <ln numlevel="1" lineno="69" slineno="1-41"/>Chapter 3, Punishments</xref>.</subsection><subsection ssid="1-null-15" dnum="ii-o" numlevel="1" lineno="70" slineno="1-42" level="3"><display>(ii)</display>The court shall impose an indeterminate prison term for a person who has been <ln numlevel="1" lineno="71" slineno="1-43"/>convicted of a violation of Subsection <xref depth="4" refnumber="58-37-8(1)(a)(ii)">(1)(a)(ii)</xref> or <xref depth="4" refnumber="58-37-8(iii)">(iii)</xref> that is a first degree felony <ln numlevel="1" lineno="72" slineno="1-44"/>or a second degree felony if the trier of fact finds beyond a reasonable doubt that, <ln numlevel="1" lineno="73" slineno="1-45"/>during the commission or furtherance of the violation, the person intentionally or <ln numlevel="1" lineno="74" slineno="1-46"/>knowingly:<subsection ssid="1-null-16" dnum="A-o" numlevel="1" lineno="75" slineno="1-47" level="4"><display>(A)</display>used, drew, or exhibited a dangerous weapon, as that term is defined in <ln numlevel="1" lineno="76" slineno="1-48"/>Section <xref depth="3" refnumber="76-11-101">76-11-101</xref>, that is not a firearm, in an angry, threatening, intimidating, <ln numlevel="1" lineno="77" slineno="1-49"/>or coercive manner;</subsection><subsection ssid="1-null-17" dnum="B-o" numlevel="1" lineno="78" slineno="1-50" level="4"><display>(B)</display>used a firearm, as that term is defined in Section <xref depth="3" refnumber="76-11-101">76-11-101</xref>, or had a firearm <ln numlevel="1" lineno="79" slineno="1-51"/>readily accessible for immediate use, as that term is defined in Section <xref depth="3" refnumber="76-11-201"><ln numlevel="1" lineno="80" slineno="1-52"/>76-11-201</xref>; or</subsection><subsection ssid="1-null-18" dnum="C-o" numlevel="1" lineno="81" slineno="1-53" level="4"><display>(C)</display>distributed a firearm, as that term is defined in Section <xref depth="3" refnumber="76-11-101">76-11-101</xref>, or <ln numlevel="1" lineno="82" slineno="1-54"/>possessed a firearm with intent to distribute the firearm.</subsection></subsection><subsection ssid="1-null-19" dnum="iii-o" numlevel="1" lineno="83" slineno="1-55" level="3"><display>(iii)</display>Notwithstanding Subsection <xref depth="4" refnumber="58-37-8(1)(c)(ii)">(1)(c)(ii)</xref>, a court may suspend the indeterminate <ln numlevel="1" lineno="84" slineno="1-56"/>prison term for a person convicted under Subsection <xref depth="4" refnumber="58-37-8(1)(c)(ii)">(1)(c)(ii)</xref> if the court:<subsection ssid="1-null-20" dnum="A-o" numlevel="1" lineno="85" slineno="1-57" level="4"><display>(A)</display>details on the record the reasons why it is in the interests of justice not to <ln numlevel="1" lineno="86" slineno="1-58"/>impose the indeterminate prison term;</subsection><subsection ssid="1-null-21" dnum="B-o" numlevel="1" lineno="87" slineno="1-59" level="4"><display>(B)</display>makes a finding on the record that the person does not pose a significant <ln numlevel="1" lineno="88" slineno="1-60"/>safety risk to the public; and</subsection><subsection ssid="1-null-22" dnum="C-o" numlevel="1" lineno="89" slineno="1-61" level="4"><display>(C)</display>orders the person to complete the terms and conditions of supervised <ln numlevel="1" lineno="90" slineno="1-62"/>probation provided by the Department of Corrections.</subsection></subsection></subsection><subsection ssid="1-null-23" dnum="d-o" numlevel="1" lineno="91" slineno="1-63" level="2" space="false"><display>(d)</display><subsection ssid="1-null-24" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A person convicted of violating Subsection <xref depth="4" refnumber="58-37-8(1)(a)(iv)">(1)(a)(iv)</xref> is guilty of a first degree <ln numlevel="1" lineno="92" slineno="1-64"/>felony punishable by imprisonment for an indeterminate term of not less than:<subsection ssid="1-null-25" dnum="A-o" numlevel="1" lineno="93" slineno="1-65" level="4" tab="1"><display>(A)</display>seven years and which may be for life; or</subsection><subsection ssid="1-null-26" dnum="B-o" numlevel="1" lineno="94" slineno="1-66" level="4" tab="1"><display>(B)</display>15 years and which may be for life if the trier of fact determined that the <ln numlevel="1" lineno="95" slineno="1-67"/>defendant knew or reasonably should have known that any subordinate under <ln numlevel="1" lineno="96" slineno="1-68"/>Subsection <xref depth="4" refnumber="58-37-8(1)(a)(iv)(b)">(1)(a)(iv)(B)</xref> was under 18 years old.</subsection></subsection><subsection ssid="1-null-27" dnum="ii-o" numlevel="1" lineno="97" slineno="1-69" level="3"><display>(ii)</display>Imposition or execution of the sentence may not be suspended, and the person is <ln numlevel="1" lineno="98" slineno="1-70"/>not eligible for probation.</subsection><subsection ssid="1-null-28" dnum="iii-o" numlevel="1" lineno="99" slineno="1-71" level="3"><display>(iii)</display>Subsection <xref depth="4" refnumber="58-37-8(1)(d)(i)(b)">(1)(d)(i)(B)</xref> does not apply to any defendant who, at the time of the <ln numlevel="1" lineno="100" slineno="1-72"/>offense, was under 18 years old.</subsection></subsection><subsection ssid="1-null-29" dnum="e-o" numlevel="1" lineno="101" slineno="1-73" level="2"><display>(e)</display>The Administrative Office of the Courts shall report to the Division of Professional <ln numlevel="1" lineno="102" slineno="1-74"/>Licensing the name, case number, date of conviction, and if known, the date of birth <ln numlevel="1" lineno="103" slineno="1-75"/>of each person convicted of violating Subsection <xref depth="4" refnumber="58-37-8(1)(a)">(1)(a)</xref>.</subsection><subsection ssid="1-null-30" dnum="f-o" numlevel="1" lineno="104" slineno="1-76" level="2" space="false"><display>(f)</display><subsection ssid="1-null-31" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A court shall impose the mandatory jail sentence described in Subsection <xref tempid="154" depth="4" refnumber="58-37-8(1)(f)(ii)"><ln numlevel="1" lineno="105" slineno="1-77"/>(1)(f)(ii)</xref>, and may not suspend any portion of the jail sentence or grant early <ln numlevel="1" lineno="106" slineno="1-78"/>release, if:<subsection ssid="1-null-32" dnum="A-o" numlevel="1" lineno="107" slineno="1-79" level="4" tab="1"><display>(A)</display>the court suspends the imposition of a prison sentence for a felony conviction <ln numlevel="1" lineno="108" slineno="1-80"/>under Subsection <xref depth="4" refnumber="58-37-8(1)(a)">(1)(a)</xref> or sentences a person for a misdemeanor violation of <ln numlevel="1" lineno="109" slineno="1-81"/>an offense under Subsection <xref refnumber="58-37-8(1)(a)" depth="4">(1)(a)</xref>;</subsection><subsection ssid="1-null-33" dnum="B-o" numlevel="1" lineno="110" slineno="1-82" level="4" tab="1" space="false"><display>(B)</display><subsection ssid="1-null-34" dnum="I-o" level="5" placement="sameline"><display>(I)</display>the violation is the person's second or subsequent conviction for any <ln numlevel="1" lineno="111" slineno="1-83"/>level of offense under Subsection <xref refnumber="58-37-8(1)(a)" depth="4">(1)(a)</xref>; or</subsection><subsection ssid="1-null-35" dnum="II-o" numlevel="1" lineno="112" slineno="1-84" level="5"><display>(II)</display>the person previously has been convicted of a criminal violation in another <ln numlevel="1" lineno="113" slineno="1-85"/>jurisdiction, including a state or federal court, that is substantially <ln numlevel="1" lineno="114" slineno="1-86"/>equivalent to the violation of an offense under Subsection <xref refnumber="58-37-8(1)(a)" depth="4">(1)(a)</xref>; and</subsection></subsection><subsection ssid="1-null-36" dnum="C-o" numlevel="1" lineno="115" slineno="1-87" level="4" tab="1"><display>(C)</display>the person previously has been convicted of reentry of a removed alien under <ln numlevel="1" lineno="116" slineno="1-88"/>8 U.S.C. Sec. 1326.</subsection></subsection><subsection ssid="1-null-37" dnum="ii-o" numlevel="1" lineno="117" slineno="1-89" level="3"><display>(ii)</display>The mandatory jail sentences referred to in Subsection <xref tempid="603" depth="4" refnumber="58-37-8(1)(f)(i)">(1)(f)(i)</xref> are:<subsection ssid="1-null-38" dnum="A-o" numlevel="1" lineno="118" slineno="1-90" level="4"><display>(A)</display>for a felony or a class A misdemeanor, 360 days in jail;</subsection><subsection ssid="1-null-39" dnum="B-o" numlevel="1" lineno="119" slineno="1-91" level="4"><display>(B)</display>for a class B misdemeanor, 180 days in jail; and</subsection><subsection ssid="1-null-40" dnum="C-o" numlevel="1" lineno="120" slineno="1-92" level="4"><display>(C)</display>for a class C misdemeanor, 90 days in jail.</subsection></subsection><subsection ssid="1-null-41" dnum="iii-o" numlevel="1" lineno="121" slineno="1-93" level="3" space="false"><display>(iii)</display><subsection ssid="1-null-42" dnum="A-o" level="4" placement="sameline"><display>(A)</display>Except as provided in Subsection <xref depth="4" refnumber="58-37-8(1)(f)(iii)(b)">(1)(f)(iii)(B)</xref>, a person who is subject to <ln numlevel="1" lineno="122" slineno="1-94"/>a mandatory jail sentence under Subsection <xref tempid="130" depth="4" refnumber="58-37-8(1)(f)(i)">(1)(f)(i)</xref> may not be released to the <ln numlevel="1" lineno="123" slineno="1-95"/>federal Immigration and Customs Enforcement Agency of the United States <ln numlevel="1" lineno="124" slineno="1-96"/>Department of Homeland Security for deportation until the person has served <ln numlevel="1" lineno="125" slineno="1-97"/>the entire jail sentence described in Subsection <xref tempid="959" depth="4" refnumber="58-37-8(1)(f)(ii)">(1)(f)(ii)</xref>.</subsection><subsection ssid="1-null-43" dnum="B-o" numlevel="1" lineno="126" slineno="1-98" level="4"><display>(B)</display>A person may be released to the federal Immigration and Customs <ln numlevel="1" lineno="127" slineno="1-99"/>Enforcement Agency of the United States Department of Homeland Security <ln numlevel="1" lineno="128" slineno="1-100"/>for deportation at any time during the 14-day period before the final day of the <ln numlevel="1" lineno="129" slineno="1-101"/>person's jail sentence described in Subsection <xref depth="4" refnumber="58-37-8(1)(f)(ii)">(1)(f)(ii)</xref>.</subsection></subsection></subsection></subsection><subsection ssid="1-null-44" dnum="2-o" numlevel="1" lineno="130" slineno="1-102" level="1"><display>(2)</display>Prohibited acts B -- Penalties and reporting:<subsection ssid="1-null-45" dnum="a-o" numlevel="1" lineno="131" slineno="1-103" level="2"><display>(a)</display>It is unlawful:<subsection ssid="1-null-46" dnum="i-o" numlevel="1" lineno="132" slineno="1-104" level="3"><display>(i)</display>for a person knowingly and intentionally to possess or use a controlled substance <ln numlevel="1" lineno="133" slineno="1-105"/>analog or a controlled substance, unless it was obtained under a valid prescription <ln numlevel="1" lineno="134" slineno="1-106"/>or order, directly from a practitioner while acting in the course of the person's <ln numlevel="1" lineno="135" slineno="1-107"/>professional practice, or as otherwise authorized by this chapter;</subsection><subsection ssid="1-null-47" dnum="ii-o" numlevel="1" lineno="136" slineno="1-108" level="3"><display>(ii)</display>for an owner, tenant, licensee, or person in control of a building, room, tenement, <ln numlevel="1" lineno="137" slineno="1-109"/>vehicle, boat, aircraft, or other place to knowingly and intentionally permit a <ln numlevel="1" lineno="138" slineno="1-110"/>person to occupy the building, room, tenement, vehicle, boat, aircraft, or other <ln numlevel="1" lineno="139" slineno="1-111"/>place while the person is unlawfully manufacturing, possessing, using, or <ln numlevel="1" lineno="140" slineno="1-112"/>distributing a controlled substance at that location; or</subsection><subsection ssid="1-null-48" dnum="iii-o" numlevel="1" lineno="141" slineno="1-113" level="3"><display>(iii)</display>for a person knowingly and intentionally to possess an altered or forged <ln numlevel="1" lineno="142" slineno="1-114"/>prescription or written order for a controlled substance.</subsection></subsection><subsection ssid="1-null-49" dnum="b-o" numlevel="1" lineno="143" slineno="1-115" level="2"><display>(b)</display>A person convicted of violating Subsection <xref depth="4" refnumber="58-37-8(2)(a)(i)">(2)(a)(i)</xref> with respect to<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="76" groupid="62" style="2" owner="ahaskell" level="1" deltag="both">:</amend><amendoutend style="2"/><subsection ssid="1-null-50" dnum="i-o:_-i" numlevel="1" lineno="144" slineno="1-116" ea="erase" anum="0" owner="ahaskell" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1049" style="2" owner="o" level="1" deltag="start">(i)</amend></display><amend anum="0" ea="erase" pairid="71" groupid="58" style="2" owner="ahaskell" level="1" deltag="end">marijuana, if the amount is 100 pounds or more, is guilty of a second degree <ln numlevel="1" lineno="145" slineno="1-117"/>felony; or</amend><amendoutend style="2"/></subsection><subsection ssid="1-null-51" dnum="ii-o:_-i" numlevel="1" lineno="146" slineno="1-118" ea="erase" anum="0" owner="ahaskell" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1050" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/></display><amend anum="0" ea="amend" pairid="125" groupid="106" style="1" owner="ahaskell" level="1" amendtag="both" space="true"> </amend>a substance classified in Schedule I or II, or a controlled substance analog,<amend anum="0" ea="amend" pairid="8" groupid="7" style="1" owner="ahaskell" level="1" amendtag="both"> not <ln numlevel="1" lineno="147" slineno="1-119"/>including marijuana,</amend> is guilty of a class A misdemeanor on a first or second <ln numlevel="1" lineno="148" slineno="1-120"/>conviction, and on a third or subsequent conviction if each prior offense was <ln numlevel="1" lineno="149" slineno="1-121"/>committed within seven years before the date of the offense upon which the <ln numlevel="1" lineno="150" slineno="1-122"/>current conviction is based is guilty of a third degree felony.</subsection></subsection><subsection ssid="1-null-52" dnum="c-o" numlevel="1" lineno="151" slineno="1-123" level="2"><display>(c)</display>Upon a person's conviction of a violation of this Subsection <xref depth="4" refnumber="58-37-8(2)">(2)</xref> <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="123" groupid="104" style="2" owner="ahaskell" level="1" deltag="both">subsequent to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="122" groupid="103" style="1" owner="ahaskell" level="1" amendtag="both" space="true">after</amend> a <ln numlevel="1" lineno="152" slineno="1-124"/>conviction under Subsection <xref depth="4" refnumber="58-37-8(1)(a)">(1)(a)</xref>, that person shall be sentenced to a one degree <ln numlevel="1" lineno="153" slineno="1-125"/>greater penalty than provided in this Subsection <xref depth="4" refnumber="58-37-8(2)">(2)</xref>.</subsection><subsection ssid="1-null-53" dnum="d-o" numlevel="1" lineno="154" slineno="1-126" level="2" space="false"><display>(d)</display><subsection ssid="1-null-54" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A person who violates Subsection <xref depth="4" refnumber="58-37-8(2)(a)(i)">(2)(a)(i)</xref> with respect to all other controlled <ln numlevel="1" lineno="155" slineno="1-127"/>substances not included in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="104" groupid="87" style="2" owner="ahaskell" level="1" deltag="both"><xref depth="4" refnumber="58-37-8(2)(b)(i)">(2)(b)(i)</xref> or <xref depth="4" refnumber="58-37-8(ii)">(ii)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="103" groupid="86" style="1" owner="ahaskell" level="1" amendtag="both" space="true">(2)(b)</amend>, including a <ln numlevel="1" lineno="156" slineno="1-128"/>substance listed in Section <xref depth="3" refnumber="58-37-4.2">58-37-4.2</xref>, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="84" groupid="69" style="2" owner="ahaskell" level="1" deltag="both">or</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="83" groupid="68" style="1" owner="ahaskell" level="1" amendtag="both" space="true">but not including</amend> marijuana, is guilty of <ln numlevel="1" lineno="157" slineno="1-129"/>a class B misdemeanor.</subsection><subsection ssid="1-null-55" dnum="ii-o" numlevel="1" lineno="158" slineno="1-130" level="3"><display>(ii)</display>Upon a third conviction the person is guilty of a class A misdemeanor, if each <ln numlevel="1" lineno="159" slineno="1-131"/>prior offense was committed within seven years before the date of the offense <ln numlevel="1" lineno="160" slineno="1-132"/>upon which the current conviction is based.</subsection><subsection ssid="1-null-56" dnum="iii-o" numlevel="1" lineno="161" slineno="1-133" level="3"><display>(iii)</display>Upon a fourth or subsequent conviction the person is guilty of a third degree <ln numlevel="1" lineno="162" slineno="1-134"/>felony if each prior offense was committed within seven years before the date of <ln numlevel="1" lineno="163" slineno="1-135"/>the offense upon which the current conviction is based.</subsection></subsection><subsection ssid="1-152" dnum="_-o:e-i" numlevel="1" lineno="164" slineno="1-136" ea="amend" anum="0" owner="ahaskell" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1056" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><subsection ssid="1-161" dnum="_-o:i-i" ea="amend" anum="0" owner="ahaskell" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1057" style="1" owner="i" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="91" groupid="75" style="1" owner="ahaskell" level="1" amendtag="end">Under circumstances not amounting to an offense described in Subsection <xref depth="4" refnumber="58-37-8(1)(a)">(1)(a)</xref>, <ln numlevel="1" lineno="165" slineno="1-137"/>a violation of Subsection <xref depth="4" refnumber="58-37-8(2)(a)(i)">(2)(a)(i)</xref> with respect to marijuana is:</amend><subsection ssid="1-157" dnum="_-o:A-i" numlevel="1" lineno="166" slineno="1-138" ea="amend" anum="0" owner="ahaskell" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1058" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="64" groupid="52" style="1" owner="ahaskell" level="1" amendtag="end">subject to Subsection <xref depth="4" refnumber="58-37-8(2)(e)(ii)">(2)(e)(ii)</xref>, a class B misdemeanor for less than eight <ln numlevel="1" lineno="167" slineno="1-139"/>grams of marijuana;</amend></subsection><subsection ssid="1-158" dnum="_-o:B-i" numlevel="1" lineno="168" slineno="1-140" ea="amend" anum="0" owner="ahaskell" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1059" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="82" groupid="67" style="1" owner="ahaskell" level="1" amendtag="end">a class A misdemeanor for eight grams or more but less than 71 grams of <ln numlevel="1" lineno="169" slineno="1-141"/>marijuana; or</amend></subsection><subsection ssid="1-164" dnum="_-o:C-i" numlevel="1" lineno="170" slineno="1-142" ea="amend" anum="0" owner="ahaskell" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1060" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="116" groupid="98" style="1" owner="ahaskell" level="1" amendtag="end">subject to Subsection <xref depth="4" refnumber="58-37-8(2)(e)(iii)">(2)(e)(iii)</xref>, a third degree felony for 71 grams or more of <ln numlevel="1" lineno="171" slineno="1-143"/>marijuana.</amend></subsection></subsection><subsection ssid="1-162" dnum="_-o:ii-i" numlevel="1" lineno="172" slineno="1-144" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1061" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="96" groupid="79" style="1" owner="ahaskell" level="1" amendtag="end">A first offense under Subsection <xref depth="4" refnumber="58-37-8(2)(e)(i)(a)">(2)(e)(i)(A)</xref> may be eligible for deferred <ln numlevel="1" lineno="173" slineno="1-145"/>prosecution under Section <xref depth="3" refnumber="77-2-4.6">77-2-4.6</xref>.</amend></subsection><subsection ssid="1-165" dnum="_-o:iii-i" numlevel="1" lineno="174" slineno="1-146" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1062" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="120" groupid="101" style="1" owner="ahaskell" level="1" amendtag="end">An actor who possesses 71 grams or more of marijuana is presumed to be in <ln numlevel="1" lineno="175" slineno="1-147"/>violation of Subsection <xref depth="4" refnumber="58-37-8(1)(a)">(1)(a)</xref>.</amend></subsection></subsection><subsection ssid="1-null-57" dnum="e-o:f-i" numlevel="1" lineno="176" slineno="1-148" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1063" style="2" owner="o" level="1" deltag="both">(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1064" style="1" owner="i" level="1" amendtag="both" space="true">(f)</amend></display>A person convicted of violating Subsection <xref depth="4" refnumber="58-37-8(2)(a)(i)">(2)(a)(i)</xref> while inside the exterior <ln numlevel="1" lineno="177" slineno="1-149"/>boundaries of property occupied by a correctional facility as defined in Section <xref depth="3" refnumber="64-13-1"><ln numlevel="1" lineno="178" slineno="1-150"/>64-13-1</xref> or a public jail or other place of confinement shall be sentenced to a penalty <ln numlevel="1" lineno="179" slineno="1-151"/>one degree greater than provided in Subsection <xref depth="4" refnumber="58-37-8(2)(b)">(2)(b)</xref><amend anum="0" ea="amend" pairid="68" groupid="56" style="1" owner="ahaskell" level="1" amendtag="both"> or <xref refnumber="(2)(e)" depth="4">(2)(e)</xref>, as applicable</amend>, and if <ln numlevel="1" lineno="180" slineno="1-152"/>the conviction is with respect to controlled substances as listed in:<subsection ssid="1-null-58" dnum="i-o" numlevel="1" lineno="181" slineno="1-153" level="3"><display>(i)</display>Subsection <xref depth="4" refnumber="58-37-8(2)(b)">(2)(b)</xref>, the person may be sentenced to imprisonment for an <ln numlevel="1" lineno="182" slineno="1-154"/>indeterminate term as provided by law, and:<subsection ssid="1-null-59" dnum="A-o" numlevel="1" lineno="183" slineno="1-155" level="4"><display>(A)</display>the court shall additionally sentence the person convicted to a term of one year <ln numlevel="1" lineno="184" slineno="1-156"/>to run consecutively and not concurrently; and</subsection><subsection ssid="1-null-60" dnum="B-o" numlevel="1" lineno="185" slineno="1-157" level="4"><display>(B)</display>the court may additionally sentence the person convicted for an indeterminate <ln numlevel="1" lineno="186" slineno="1-158"/>term not to exceed five years to run consecutively and not concurrently; and</subsection></subsection><subsection ssid="1-null-61" dnum="ii-o" numlevel="1" lineno="187" slineno="1-159" level="3"><display>(ii)</display>Subsection <xref depth="4" refnumber="58-37-8(2)(d)">(2)(d)</xref>, the person may be sentenced to imprisonment for an <ln numlevel="1" lineno="188" slineno="1-160"/>indeterminate term as provided by law, and the court shall additionally sentence <ln numlevel="1" lineno="189" slineno="1-161"/>the person convicted to a term of six months to run consecutively and not <ln numlevel="1" lineno="190" slineno="1-162"/>concurrently.</subsection></subsection><subsection ssid="1-null-62" dnum="f-o:g-i" numlevel="1" lineno="191" slineno="1-163" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1068" style="2" owner="o" level="1" deltag="both">(f)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1069" style="1" owner="i" level="1" amendtag="both" space="true">(g)</amend></display>A person convicted of violating Subsection <xref depth="4" refnumber="58-37-8(2)(a)(ii)">(2)(a)(ii)</xref> or <xref depth="4" refnumber="58-37-8(iii)">(iii)</xref> is:<subsection ssid="1-null-63" dnum="i-o" numlevel="1" lineno="192" slineno="1-164" level="3"><display>(i)</display>on a first conviction, guilty of a class B misdemeanor;</subsection><subsection ssid="1-null-64" dnum="ii-o" numlevel="1" lineno="193" slineno="1-165" level="3"><display>(ii)</display>on a second conviction, guilty of a class A misdemeanor; and</subsection><subsection ssid="1-null-65" dnum="iii-o" numlevel="1" lineno="194" slineno="1-166" level="3"><display>(iii)</display>on a third or subsequent conviction, guilty of a third degree felony.</subsection></subsection><subsection ssid="1-null-66" dnum="g-o:h-i" numlevel="1" lineno="195" slineno="1-167" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1072" style="2" owner="o" level="1" deltag="both">(g)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1073" style="1" owner="i" level="1" amendtag="both" space="true">(h)</amend></display>The Administrative Office of the Courts shall report to the Division of <ln numlevel="1" lineno="196" slineno="1-168"/>Professional Licensing the name, case number, date of conviction, and if known, the <ln numlevel="1" lineno="197" slineno="1-169"/>date of birth of each person convicted of violating Subsection <xref depth="4" refnumber="58-37-8(2)(a)">(2)(a)</xref>.</subsection></subsection><subsection ssid="1-null-67" dnum="3-o" numlevel="1" lineno="198" slineno="1-170" level="1"><display>(3)</display>Prohibited acts C -- Penalties:<subsection ssid="1-null-68" dnum="a-o" numlevel="1" lineno="199" slineno="1-171" level="2"><display>(a)</display>It is unlawful for a person knowingly and intentionally:<subsection ssid="1-null-69" dnum="i-o" numlevel="1" lineno="200" slineno="1-172" level="3"><display>(i)</display>to use in the course of the manufacture or distribution of a controlled substance a <ln numlevel="1" lineno="201" slineno="1-173"/>license number which is fictitious, revoked, suspended, or issued to another <ln numlevel="1" lineno="202" slineno="1-174"/>person or, for the purpose of obtaining a controlled substance, to assume the title <ln numlevel="1" lineno="203" slineno="1-175"/>of, or represent oneself to be, a manufacturer, wholesaler, apothecary, physician, <ln numlevel="1" lineno="204" slineno="1-176"/>dentist, veterinarian, or other authorized person;</subsection><subsection ssid="1-null-70" dnum="ii-o" numlevel="1" lineno="205" slineno="1-177" level="3"><display>(ii)</display>to acquire or obtain possession of, to procure or attempt to procure the <ln numlevel="1" lineno="206" slineno="1-178"/>administration of, to obtain a prescription for, to prescribe or dispense to a person <ln numlevel="1" lineno="207" slineno="1-179"/>known to be attempting to acquire or obtain possession of, or to procure the <ln numlevel="1" lineno="208" slineno="1-180"/>administration of a controlled substance by misrepresentation or failure by the <ln numlevel="1" lineno="209" slineno="1-181"/>person to disclose receiving a controlled substance from another source, fraud, <ln numlevel="1" lineno="210" slineno="1-182"/>forgery, deception, subterfuge, alteration of a prescription or written order for a <ln numlevel="1" lineno="211" slineno="1-183"/>controlled substance, or the use of a false name or address;</subsection><subsection ssid="1-null-71" dnum="iii-o" numlevel="1" lineno="212" slineno="1-184" level="3"><display>(iii)</display>to make a false or forged prescription or written order for a controlled substance, <ln numlevel="1" lineno="213" slineno="1-185"/>or to utter the same, or to alter a prescription or written order issued or written <ln numlevel="1" lineno="214" slineno="1-186"/>under the terms of this chapter; or</subsection><subsection ssid="1-null-72" dnum="iv-o" numlevel="1" lineno="215" slineno="1-187" level="3"><display>(iv)</display>to make, distribute, or possess a punch, die, plate, stone, or other thing designed <ln numlevel="1" lineno="216" slineno="1-188"/>to print, imprint, or reproduce the trademark, trade name, or other identifying <ln numlevel="1" lineno="217" slineno="1-189"/>mark, imprint, or device of another or any likeness of any of the foregoing upon <ln numlevel="1" lineno="218" slineno="1-190"/>any drug or container or labeling so as to render a drug a counterfeit controlled <ln numlevel="1" lineno="219" slineno="1-191"/>substance.</subsection></subsection><subsection ssid="1-null-73" dnum="b-o" numlevel="1" lineno="220" slineno="1-192" level="2" space="false"><display>(b)</display><subsection ssid="1-null-74" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A first or second conviction under Subsection <xref depth="4" refnumber="58-37-8(3)(a)(i)">(3)(a)(i)</xref>, <xref refnumber="(3)(a)(ii)" depth="4">(ii)</xref>, or <xref refnumber="(3)(a)(iii)" depth="4">(iii) </xref>is a class A <ln numlevel="1" lineno="221" slineno="1-193"/>misdemeanor.</subsection><subsection ssid="1-null-75" dnum="ii-o" numlevel="1" lineno="222" slineno="1-194" level="3"><display>(ii)</display>A third or subsequent conviction under Subsection <xref depth="4" refnumber="58-37-8(3)(a)(i)">(3)(a)(i)</xref>, <xref refnumber="(3)(a)(ii)" depth="4">(ii)</xref>, or <xref refnumber="(3)(a)(iii)" depth="4">(iii) </xref>is a third <ln numlevel="1" lineno="223" slineno="1-195"/>degree felony.</subsection></subsection><subsection ssid="1-null-76" dnum="c-o" numlevel="1" lineno="224" slineno="1-196" level="2"><display>(c)</display>A violation of Subsection <xref depth="4" refnumber="58-37-8(3)(a)(iv)">(3)(a)(iv)</xref> is a third degree felony.</subsection></subsection><subsection ssid="1-null-77" dnum="4-o" numlevel="1" lineno="225" slineno="1-197" level="1"><display>(4)</display>Prohibited acts D -- Penalties:<subsection ssid="1-null-78" dnum="a-o" numlevel="1" lineno="226" slineno="1-198" level="2"><display>(a)</display>Notwithstanding other provisions of this section, a person not authorized under this <ln numlevel="1" lineno="227" slineno="1-199"/>chapter who commits any act that is unlawful under Subsection <xref depth="4" refnumber="58-37-8(1)(a)">(1)(a)</xref> or Section <xref depth="3" refnumber="58-37b-4"><ln numlevel="1" lineno="228" slineno="1-200"/>58-37b-4</xref> is upon conviction subject to the penalties and classifications under this <ln numlevel="1" lineno="229" slineno="1-201"/>Subsection <xref depth="4" refnumber="58-37-8(4)">(4)</xref> if the trier of fact finds the act is committed:<subsection ssid="1-null-79" dnum="i-o" numlevel="1" lineno="230" slineno="1-202" level="3"><display>(i)</display>in a public or private elementary or secondary school or on the grounds of any of <ln numlevel="1" lineno="231" slineno="1-203"/>those schools during the hours of 6 a.m. through 10 p.m.;</subsection><subsection ssid="1-null-80" dnum="ii-o" numlevel="1" lineno="232" slineno="1-204" level="3"><display>(ii)</display>in a public or private vocational school or postsecondary institution or on the <ln numlevel="1" lineno="233" slineno="1-205"/>grounds of any of those schools or institutions during the hours of 6 a.m. through <ln numlevel="1" lineno="234" slineno="1-206"/>10 p.m.;</subsection><subsection ssid="1-null-81" dnum="iii-o" numlevel="1" lineno="235" slineno="1-207" level="3"><display>(iii)</display>in or on the grounds of a preschool or child-care facility during the preschool's or <ln numlevel="1" lineno="236" slineno="1-208"/>facility's hours of operation;</subsection><subsection ssid="1-null-82" dnum="iv-o" numlevel="1" lineno="237" slineno="1-209" level="3"><display>(iv)</display>in a public park, amusement park, arcade, or recreation center when the public or <ln numlevel="1" lineno="238" slineno="1-210"/>amusement park, arcade, or recreation center is open to the public;</subsection><subsection ssid="1-null-83" dnum="v-o" numlevel="1" lineno="239" slineno="1-211" level="3"><display>(v)</display>in or on the grounds of a house of worship as defined in Section <xref depth="3" refnumber="76-11-201">76-11-201</xref>;</subsection><subsection ssid="1-null-84" dnum="vi-o" numlevel="1" lineno="240" slineno="1-212" level="3"><display>(vi)</display>in or on the grounds of a library when the library is open to the public;</subsection><subsection ssid="1-null-85" dnum="vii-o" numlevel="1" lineno="241" slineno="1-213" level="3"><display>(vii)</display>within an area that is within 100 feet of any structure, facility, or grounds <ln numlevel="1" lineno="242" slineno="1-214"/>included in Subsections <xref depth="4" refnumber="58-37-8(4)(a)(i)">(4)(a)(i)</xref> through <xref depth="4" refnumber="58-37-8(vi)">(vi)</xref>;</subsection><subsection ssid="1-null-86" dnum="viii-o" numlevel="1" lineno="243" slineno="1-215" level="3"><display>(viii)</display>in the presence of a person younger than 18 years old, regardless of where the <ln numlevel="1" lineno="244" slineno="1-216"/>act occurs; or</subsection><subsection ssid="1-null-87" dnum="ix-o" numlevel="1" lineno="245" slineno="1-217" level="3"><display>(ix)</display>for the purpose of facilitating, arranging, or causing the transport, delivery, or <ln numlevel="1" lineno="246" slineno="1-218"/>distribution of a substance in violation of this section to an inmate or on the <ln numlevel="1" lineno="247" slineno="1-219"/>grounds of a correctional facility as defined in Section <xref depth="3" refnumber="76-8-311.3">76-8-311.3</xref>.</subsection></subsection><subsection ssid="1-null-88" dnum="b-o" numlevel="1" lineno="248" slineno="1-220" level="2" space="false"><display>(b)</display><subsection ssid="1-null-89" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A person convicted under this Subsection <xref depth="4" refnumber="58-37-8(4)">(4)</xref> is guilty of a first degree felony <ln numlevel="1" lineno="249" slineno="1-221"/>and shall be imprisoned for a term of not less than five years if the penalty that <ln numlevel="1" lineno="250" slineno="1-222"/>would otherwise have been established but for this Subsection <xref depth="4" refnumber="58-37-8(4)">(4)</xref> would have <ln numlevel="1" lineno="251" slineno="1-223"/>been a first degree felony.</subsection><subsection ssid="1-null-90" dnum="ii-o" numlevel="1" lineno="252" slineno="1-224" level="3"><display>(ii)</display>Imposition or execution of the sentence may not be suspended, and the person is <ln numlevel="1" lineno="253" slineno="1-225"/>not eligible for probation.</subsection></subsection><subsection ssid="1-null-91" dnum="c-o" numlevel="1" lineno="254" slineno="1-226" level="2"><display>(c)</display>If the classification that would otherwise have been established would have been less <ln numlevel="1" lineno="255" slineno="1-227"/>than a first degree felony but for this Subsection <xref depth="4" refnumber="58-37-8(4)">(4)</xref>, a person convicted under this <ln numlevel="1" lineno="256" slineno="1-228"/>Subsection <xref depth="4" refnumber="58-37-8(4)">(4)</xref> is guilty of one degree more than the maximum penalty prescribed for <ln numlevel="1" lineno="257" slineno="1-229"/>that offense.</subsection><subsection ssid="1-null-92" dnum="d-o" numlevel="1" lineno="258" slineno="1-230" level="2" space="false"><display>(d)</display><subsection ssid="1-null-93" dnum="i-o" level="3" placement="sameline"><display>(i)</display>If the violation is of Subsection <xref depth="4" refnumber="58-37-8(4)(a)(ix)">(4)(a)(ix)</xref>:<subsection ssid="1-null-94" dnum="A-o" numlevel="1" lineno="259" slineno="1-231" level="4" tab="1"><display>(A)</display>the person may be sentenced to imprisonment for an indeterminate term as <ln numlevel="1" lineno="260" slineno="1-232"/>provided by law, and the court shall additionally sentence the person convicted <ln numlevel="1" lineno="261" slineno="1-233"/>for a term of one year to run consecutively and not concurrently; and</subsection><subsection ssid="1-null-95" dnum="B-o" numlevel="1" lineno="262" slineno="1-234" level="4" tab="1"><display>(B)</display>the court may additionally sentence the person convicted for an indeterminate <ln numlevel="1" lineno="263" slineno="1-235"/>term not to exceed five years to run consecutively and not concurrently; and</subsection></subsection><subsection ssid="1-null-96" dnum="ii-o" numlevel="1" lineno="264" slineno="1-236" level="3"><display>(ii)</display>the penalties under this Subsection <xref depth="4" refnumber="58-37-8(4)(d)">(4)(d)</xref> apply also to a person who, acting with <ln numlevel="1" lineno="265" slineno="1-237"/>the mental state required for the commission of an offense, directly or indirectly <ln numlevel="1" lineno="266" slineno="1-238"/>solicits, requests, commands, coerces, encourages, or intentionally aids another <ln numlevel="1" lineno="267" slineno="1-239"/>person to commit a violation of Subsection <xref depth="4" refnumber="58-37-8(4)(a)(ix)">(4)(a)(ix)</xref>.</subsection></subsection><subsection ssid="1-null-97" dnum="e-o" numlevel="1" lineno="268" slineno="1-240" level="2"><display>(e)</display>It is not a defense to a prosecution under this Subsection <xref depth="4" refnumber="58-37-8(4)">(4)</xref> that:<subsection ssid="1-null-98" dnum="i-o" numlevel="1" lineno="269" slineno="1-241" level="3"><display>(i)</display>the actor mistakenly believed the individual to be 18 years old or older at the time <ln numlevel="1" lineno="270" slineno="1-242"/>of the offense or was unaware of the individual's true age; or</subsection><subsection ssid="1-null-99" dnum="ii-o" numlevel="1" lineno="271" slineno="1-243" level="3"><display>(ii)</display>the actor mistakenly believed that the location where the act occurred was not as <ln numlevel="1" lineno="272" slineno="1-244"/>described in Subsection <xref depth="4" refnumber="58-37-8(4)(a)">(4)(a)</xref> or was unaware that the location where the act <ln numlevel="1" lineno="273" slineno="1-245"/>occurred was as described in Subsection <xref depth="4" refnumber="58-37-8(4)(a)">(4)(a)</xref>.</subsection></subsection></subsection><subsection ssid="1-null-100" dnum="5-o" numlevel="1" lineno="274" slineno="1-246" level="1"><display>(5)</display>A violation of this chapter for which no penalty is specified is a class B misdemeanor.</subsection><subsection ssid="1-null-101" dnum="6-o" numlevel="1" lineno="275" slineno="1-247" level="1" space="false"><display>(6)</display><subsection ssid="1-null-102" dnum="a-o" level="2" placement="sameline"><display>(a)</display>For purposes of penalty enhancement under Subsections <xref depth="4" refnumber="58-37-8(1)">(1)</xref> and <xref depth="4" refnumber="58-37-8(2)">(2)</xref>, a plea of <ln numlevel="1" lineno="276" slineno="1-248"/>guilty or no contest to a violation or attempted violation of this section or a plea <ln numlevel="1" lineno="277" slineno="1-249"/>which is held in abeyance under Title 77, Chapter 2a, Pleas in Abeyance, is the <ln numlevel="1" lineno="278" slineno="1-250"/>equivalent of a conviction, even if the charge has been subsequently reduced or <ln numlevel="1" lineno="279" slineno="1-251"/>dismissed in accordance with the plea in abeyance agreement.</subsection><subsection ssid="1-null-103" dnum="b-o" numlevel="1" lineno="280" slineno="1-252" level="2"><display>(b)</display>A prior conviction used for a penalty enhancement under Subsection <xref depth="4" refnumber="58-37-8(2)">(2)</xref> shall be a <ln numlevel="1" lineno="281" slineno="1-253"/>conviction that is:<subsection ssid="1-null-104" dnum="i-o" numlevel="1" lineno="282" slineno="1-254" level="3"><display>(i)</display>from a separate criminal episode than the current charge; and</subsection><subsection ssid="1-null-105" dnum="ii-o" numlevel="1" lineno="283" slineno="1-255" level="3"><display>(ii)</display>from a conviction that is separate from any other conviction used to enhance the <ln numlevel="1" lineno="284" slineno="1-256"/>current charge.</subsection></subsection></subsection><subsection ssid="1-null-106" dnum="7-o" numlevel="1" lineno="285" slineno="1-257" level="1"><display>(7)</display>A person may be charged and sentenced for a violation of this section, notwithstanding <ln numlevel="1" lineno="286" slineno="1-258"/>a charge and sentence for a violation of any other section of this chapter.</subsection><subsection ssid="1-null-107" dnum="8-o" numlevel="1" lineno="287" slineno="1-259" level="1" space="false"><display>(8)</display><subsection ssid="1-null-108" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A penalty imposed for violation of this section is in addition to, and not in lieu of, <ln numlevel="1" lineno="288" slineno="1-260"/>a civil or administrative penalty or sanction authorized by law.</subsection><subsection ssid="1-null-109" dnum="b-o" numlevel="1" lineno="289" slineno="1-261" level="2"><display>(b)</display>When a violation of this chapter violates a federal law or the law of another state, <ln numlevel="1" lineno="290" slineno="1-262"/>conviction or acquittal under federal law or the law of another state for the same act <ln numlevel="1" lineno="291" slineno="1-263"/>is a bar to prosecution in this state.</subsection></subsection><subsection ssid="1-null-110" dnum="9-o" numlevel="1" lineno="292" slineno="1-264" level="1"><display>(9)</display>In any prosecution for a violation of this chapter, evidence or proof that shows a person <ln numlevel="1" lineno="293" slineno="1-265"/>or persons produced, manufactured, possessed, distributed, or dispensed a controlled <ln numlevel="1" lineno="294" slineno="1-266"/>substance or substances, is prima facie evidence that the person or persons did so with <ln numlevel="1" lineno="295" slineno="1-267"/>knowledge of the character of the substance or substances.</subsection><subsection ssid="1-null-111" dnum="10-o" numlevel="1" lineno="296" slineno="1-268" level="1"><display>(10)</display>This section does not prohibit a veterinarian, in good faith and in the course of the <ln numlevel="1" lineno="297" slineno="1-269"/>veterinarian's professional practice only and not for humans, from prescribing, <ln numlevel="1" lineno="298" slineno="1-270"/>dispensing, or administering controlled substances or from causing the substances to be <ln numlevel="1" lineno="299" slineno="1-271"/>administered by an assistant or orderly under the veterinarian's direction and supervision.</subsection><subsection ssid="1-null-112" dnum="11-o" numlevel="1" lineno="300" slineno="1-272" level="1"><display>(11)</display>Civil or criminal liability may not be imposed under this section on:<subsection ssid="1-null-113" dnum="a-o" numlevel="1" lineno="301" slineno="1-273" level="2"><display>(a)</display>a person registered under this chapter who manufactures, distributes, or possesses an <ln numlevel="1" lineno="302" slineno="1-274"/>imitation controlled substance for use as a placebo or investigational new drug by a <ln numlevel="1" lineno="303" slineno="1-275"/>registered practitioner in the ordinary course of professional practice or research;</subsection><subsection ssid="1-null-114" dnum="b-o" numlevel="1" lineno="304" slineno="1-276" level="2"><display>(b)</display>a law enforcement officer acting in the course and legitimate scope of the officer's <ln numlevel="1" lineno="305" slineno="1-277"/>employment; or</subsection><subsection ssid="1-null-115" dnum="c-o" numlevel="1" lineno="306" slineno="1-278" level="2"><display>(c)</display>a healthcare facility, substance use harm reduction services program, or drug <ln numlevel="1" lineno="307" slineno="1-279"/>addiction treatment facility that temporarily possesses a controlled or counterfeit <ln numlevel="1" lineno="308" slineno="1-280"/>substance to conduct a test or analysis on the controlled or counterfeit substance to <ln numlevel="1" lineno="309" slineno="1-281"/>identify or analyze the strength, effectiveness, or purity of the substance for a public <ln numlevel="1" lineno="310" slineno="1-282"/>health or safety reason.</subsection></subsection><subsection ssid="1-null-116" dnum="12-o" numlevel="1" lineno="311" slineno="1-283" level="1" space="false"><display>(12)</display><subsection ssid="1-null-117" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Civil or criminal liability may not be imposed under this section on any Indian, <ln numlevel="1" lineno="312" slineno="1-284"/>as defined in Section <xref depth="3" refnumber="58-37-2">58-37-2</xref>, who uses, possesses, or transports peyote for bona fide <ln numlevel="1" lineno="313" slineno="1-285"/>traditional ceremonial purposes in connection with the practice of a traditional Indian <ln numlevel="1" lineno="314" slineno="1-286"/>religion as defined in Section <xref depth="3" refnumber="58-37-2">58-37-2</xref>.</subsection><subsection ssid="1-null-118" dnum="b-o" numlevel="1" lineno="315" slineno="1-287" level="2"><display>(b)</display>In a prosecution alleging violation of this section regarding peyote as defined in <ln numlevel="1" lineno="316" slineno="1-288"/>Section <xref depth="3" refnumber="58-37-4">58-37-4</xref>, it is an affirmative defense that the peyote was used, possessed, or <ln numlevel="1" lineno="317" slineno="1-289"/>transported by an Indian for bona fide traditional ceremonial purposes in connection <ln numlevel="1" lineno="318" slineno="1-290"/>with the practice of a traditional Indian religion.</subsection><subsection ssid="1-null-119" dnum="c-o" numlevel="1" lineno="319" slineno="1-291" level="2" space="false"><display>(c)</display><subsection ssid="1-null-120" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The defendant shall provide written notice of intent to claim an affirmative <ln numlevel="1" lineno="320" slineno="1-292"/>defense under this Subsection <xref depth="4" refnumber="58-37-8(12)">(12)</xref> as soon as practicable, but not later than 10 <ln numlevel="1" lineno="321" slineno="1-293"/>days before trial.</subsection><subsection ssid="1-null-121" dnum="ii-o" numlevel="1" lineno="322" slineno="1-294" level="3"><display>(ii)</display>The notice shall include the specific claims of the affirmative defense.</subsection><subsection ssid="1-null-122" dnum="iii-o" numlevel="1" lineno="323" slineno="1-295" level="3"><display>(iii)</display>The court may waive the notice requirement in the interest of justice for good <ln numlevel="1" lineno="324" slineno="1-296"/>cause shown, if the prosecutor is not unfairly prejudiced by the lack of timely <ln numlevel="1" lineno="325" slineno="1-297"/>notice.</subsection></subsection><subsection ssid="1-null-123" dnum="d-o" numlevel="1" lineno="326" slineno="1-298" level="2"><display>(d)</display>The defendant shall establish the affirmative defense under this Subsection <xref depth="4" refnumber="58-37-8(12)">(12)</xref> by a <ln numlevel="1" lineno="327" slineno="1-299"/>preponderance of the evidence.  If the defense is established, it is a complete defense <ln numlevel="1" lineno="328" slineno="1-300"/>to the charges.</subsection></subsection><subsection ssid="1-null-124" dnum="13-o" numlevel="1" lineno="329" slineno="1-301" level="1" space="false"><display>(13)</display><subsection ssid="1-null-125" dnum="a-o" level="2" placement="sameline"><display>(a)</display>It is an affirmative defense that the person produced, possessed, or administered <ln numlevel="1" lineno="330" slineno="1-302"/>a controlled substance listed in Section <xref depth="3" refnumber="58-37-4.2">58-37-4.2</xref> if the person was:<subsection ssid="1-null-126" dnum="i-o" numlevel="1" lineno="331" slineno="1-303" level="3" tab="1"><display>(i)</display>engaged in medical research; and</subsection><subsection ssid="1-null-127" dnum="ii-o" numlevel="1" lineno="332" slineno="1-304" level="3" tab="1"><display>(ii)</display>a holder of a valid license to possess controlled substances under Section <xref depth="3" refnumber="58-37-6">58-37-6</xref>.</subsection></subsection><subsection ssid="1-null-128" dnum="b-o" numlevel="1" lineno="333" slineno="1-305" level="2"><display>(b)</display>It is not a defense under Subsection <xref depth="4" refnumber="58-37-8(13)(a)">(13)(a)</xref> that the person prescribed or dispensed a <ln numlevel="1" lineno="334" slineno="1-306"/>controlled substance listed in Section <xref depth="3" refnumber="58-37-4.2">58-37-4.2</xref>.</subsection></subsection><subsection ssid="1-null-129" dnum="14-o" numlevel="1" lineno="335" slineno="1-307" level="1"><display>(14)</display>It is an affirmative defense that the person possessed, in the person's body, a controlled <ln numlevel="1" lineno="336" slineno="1-308"/>substance listed in Section <xref depth="3" refnumber="58-37-4.2">58-37-4.2</xref> if:<subsection ssid="1-null-130" dnum="a-o" numlevel="1" lineno="337" slineno="1-309" level="2"><display>(a)</display>the person was the subject of medical research conducted by a holder of a valid <ln numlevel="1" lineno="338" slineno="1-310"/>license to possess controlled substances under Section <xref depth="3" refnumber="58-37-6">58-37-6</xref>; and</subsection><subsection ssid="1-null-131" dnum="b-o" numlevel="1" lineno="339" slineno="1-311" level="2"><display>(b)</display>the substance was administered to the person by the medical researcher.</subsection></subsection><subsection ssid="1-null-132" dnum="15-o" numlevel="1" lineno="340" slineno="1-312" level="1"><display>(15)</display>The application of any increase in penalty under this section to a violation of <ln numlevel="1" lineno="341" slineno="1-313"/>Subsection <xref depth="4" refnumber="58-37-8(2)(a)(i)">(2)(a)(i)</xref> may not result in any greater penalty than a second degree felony. <ln numlevel="1" lineno="342" slineno="1-314"/>This Subsection <xref depth="4" refnumber="58-37-8(15)">(15)</xref> takes precedence over any conflicting provision of this section.</subsection><subsection ssid="1-null-133" dnum="16-o" numlevel="1" lineno="343" slineno="1-315" level="1" space="false"><display>(16)</display><subsection ssid="1-null-134" dnum="a-o" level="2" placement="sameline"><display>(a)</display>It is an affirmative defense to an allegation of the commission of an offense <ln numlevel="1" lineno="344" slineno="1-316"/>listed in Subsection <xref depth="4" refnumber="58-37-8(16)(b)">(16)(b)</xref> that the person or bystander:<subsection ssid="1-null-135" dnum="i-o" numlevel="1" lineno="345" slineno="1-317" level="3" tab="1"><display>(i)</display>reasonably believes that the person or another person is experiencing an overdose <ln numlevel="1" lineno="346" slineno="1-318"/>event due to the ingestion, injection, inhalation, or other introduction into the <ln numlevel="1" lineno="347" slineno="1-319"/>human body of a controlled substance or other substance;</subsection><subsection ssid="1-null-136" dnum="ii-o" numlevel="1" lineno="348" slineno="1-320" level="3" tab="1"><display>(ii)</display>reports, or assists a person who reports, in good faith the overdose event to a <ln numlevel="1" lineno="349" slineno="1-321"/>medical provider, an emergency medical service provider as defined in Section <xref depth="3" refnumber="53-2d-101"><ln numlevel="1" lineno="350" slineno="1-322"/>53-2d-101</xref>, a law enforcement officer, a 911 emergency call system, or an <ln numlevel="1" lineno="351" slineno="1-323"/>emergency dispatch system, or the person is the subject of a report made under <ln numlevel="1" lineno="352" slineno="1-324"/>this Subsection <xref depth="4" refnumber="58-37-8(16)">(16)</xref>;</subsection><subsection ssid="1-null-137" dnum="iii-o" numlevel="1" lineno="353" slineno="1-325" level="3" tab="1"><display>(iii)</display>provides in the report under Subsection <xref depth="4" refnumber="58-37-8(16)(a)(ii)">(16)(a)(ii)</xref> a functional description of the <ln numlevel="1" lineno="354" slineno="1-326"/>actual location of the overdose event that facilitates responding to the person <ln numlevel="1" lineno="355" slineno="1-327"/>experiencing the overdose event;</subsection><subsection ssid="1-null-138" dnum="iv-o" numlevel="1" lineno="356" slineno="1-328" level="3" tab="1"><display>(iv)</display>remains at the location of the person experiencing the overdose event until a <ln numlevel="1" lineno="357" slineno="1-329"/>responding law enforcement officer or emergency medical service provider <ln numlevel="1" lineno="358" slineno="1-330"/>arrives, or remains at the medical care facility where the person experiencing an <ln numlevel="1" lineno="359" slineno="1-331"/>overdose event is located until a responding law enforcement officer arrives;</subsection><subsection ssid="1-null-139" dnum="v-o" numlevel="1" lineno="360" slineno="1-332" level="3" tab="1"><display>(v)</display>cooperates with the responding medical provider, emergency medical service <ln numlevel="1" lineno="361" slineno="1-333"/>provider, and law enforcement officer, including providing information regarding <ln numlevel="1" lineno="362" slineno="1-334"/>the person experiencing the overdose event and any substances the person may <ln numlevel="1" lineno="363" slineno="1-335"/>have injected, inhaled, or otherwise introduced into the person's body; and</subsection><subsection ssid="1-null-140" dnum="vi-o" numlevel="1" lineno="364" slineno="1-336" level="3" tab="1"><display>(vi)</display>is alleged to have committed the offense in the same course of events from which <ln numlevel="1" lineno="365" slineno="1-337"/>the reported overdose arose.</subsection></subsection><subsection ssid="1-null-141" dnum="b-o" numlevel="1" lineno="366" slineno="1-338" level="2"><display>(b)</display>The offenses referred to in Subsection <xref depth="4" refnumber="58-37-8(16)(a)">(16)(a)</xref> are:<subsection ssid="1-null-142" dnum="i-o" numlevel="1" lineno="367" slineno="1-339" level="3"><display>(i)</display>the possession or use of less than <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="101" groupid="84" style="2" owner="ahaskell" level="1" deltag="both">16 ounces</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="100" groupid="83" style="1" owner="ahaskell" level="1" amendtag="both" space="true">71 grams</amend> of marijuana;</subsection><subsection ssid="1-null-143" dnum="ii-o" numlevel="1" lineno="368" slineno="1-340" level="3"><display>(ii)</display>the possession or use of a scheduled or listed controlled substance other than <ln numlevel="1" lineno="369" slineno="1-341"/>marijuana; and</subsection><subsection ssid="1-null-144" dnum="iii-o" numlevel="1" lineno="370" slineno="1-342" level="3"><display>(iii)</display>any violation of Chapter 37a, Utah Drug Paraphernalia Act, or Chapter 37b, <ln numlevel="1" lineno="371" slineno="1-343"/>Imitation Controlled Substances Act.</subsection></subsection><subsection ssid="1-null-145" dnum="c-o" numlevel="1" lineno="372" slineno="1-344" level="2"><display>(c)</display>As used in this Subsection <xref depth="4" refnumber="58-37-8(16)">(16)</xref> and in Section <xref depth="3" refnumber="76-3-203.11">76-3-203.11</xref>, "good faith" does not <ln numlevel="1" lineno="373" slineno="1-345"/>include seeking medical assistance under this section during the course of a law <ln numlevel="1" lineno="374" slineno="1-346"/>enforcement agency's execution of a search warrant, execution of an arrest warrant, <ln numlevel="1" lineno="375" slineno="1-347"/>or other lawful search.</subsection></subsection><subsection ssid="1-null-146" dnum="17-o" numlevel="1" lineno="376" slineno="1-348" level="1"><display>(17)</display>If any provision of this chapter, or the application of any provision to any person or <ln numlevel="1" lineno="377" slineno="1-349"/>circumstances, is held invalid, the remainder of this chapter shall be given effect without <ln numlevel="1" lineno="378" slineno="1-350"/>the invalid provision or application.</subsection><subsection ssid="1-null-147" dnum="18-o" numlevel="1" lineno="379" slineno="1-351" level="1"><display>(18)</display>A legislative body of a political subdivision may not enact an ordinance that is less <ln numlevel="1" lineno="380" slineno="1-352"/>restrictive than any provision of this chapter.</subsection><subsection ssid="1-null-148" dnum="19-o" numlevel="1" lineno="381" slineno="1-353" level="1"><display>(19)</display>If a minor who is under 18 years old is found by a court to have violated this section or <ln numlevel="1" lineno="382" slineno="1-354"/>Subsection <xref depth="4" refnumber="76-5-102.1(2)(b)">76-5-102.1(2)(b)</xref> or <xref depth="4" refnumber="76-5-207(2)(b)">76-5-207(2)(b)</xref>, the court may order the minor to <ln numlevel="1" lineno="383" slineno="1-355"/>complete:<subsection ssid="1-null-149" dnum="a-o" numlevel="1" lineno="384" slineno="1-356" level="2"><display>(a)</display>a screening as defined in Section <xref depth="3" refnumber="41-6a-501">41-6a-501</xref>;</subsection><subsection ssid="1-null-150" dnum="b-o" numlevel="1" lineno="385" slineno="1-357" level="2"><display>(b)</display>an assessment as defined in Section <xref depth="3" refnumber="41-6a-501">41-6a-501</xref> if the screening indicates an <ln numlevel="1" lineno="386" slineno="1-358"/>assessment to be appropriate; and</subsection><subsection ssid="1-null-151" dnum="c-o" numlevel="1" lineno="387" slineno="1-359" level="2"><display>(c)</display>an educational series as defined in Section <xref depth="3" refnumber="41-6a-501">41-6a-501</xref> or substance use disorder <ln numlevel="1" lineno="388" slineno="1-360"/>treatment as indicated by an assessment.</subsection></subsection></section></bsec><bsec buid="3" num="58-37f-201" type="amend" src="code" uid="C58-37f-S201_2026050620260506" sort="58 37f02010020260506" numlevel="1" lineno="389" slineno="2-1" sn="2"><section number="58-37f-201" numlevel="1" lineno="390" slineno="2-2" type="amend"><secline lineno="389">Section 2. Section <bold>58-37f-201</bold> is amended to read:</secline><catline lineno="390"><bold>58-37f-201<parens/>. Controlled substance database -- Creation -- Purpose.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="391" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>There is created within the division a controlled substance database.</subsection><subsection ssid="3-null-2" dnum="2-o" numlevel="1" lineno="392" slineno="2-4" level="1"><display>(2)</display>The division shall administer and direct the functioning of the database in accordance <ln numlevel="1" lineno="393" slineno="2-5"/>with this chapter.</subsection><subsection ssid="3-null-3" dnum="3-o" numlevel="1" lineno="394" slineno="2-6" level="1"><display>(3)</display>The division may, under state procurement laws, contract with another state agency or a <ln numlevel="1" lineno="395" slineno="2-7"/>private entity to establish, operate, or maintain the database.</subsection><subsection ssid="3-null-4" dnum="4-o" numlevel="1" lineno="396" slineno="2-8" level="1"><display>(4)</display>The division shall, in collaboration with the board, determine whether to operate the <ln numlevel="1" lineno="397" slineno="2-9"/>database within the division or contract with another entity to operate the database, <ln numlevel="1" lineno="398" slineno="2-10"/>based on an analysis of costs and benefits.</subsection><subsection ssid="3-null-5" dnum="5-o" numlevel="1" lineno="399" slineno="2-11" level="1"><display>(5)</display>The purpose of the database is to contain:<subsection ssid="3-null-6" dnum="a-o" numlevel="1" lineno="400" slineno="2-12" level="2"><display>(a)</display>the data described in Section <xref depth="3" refnumber="58-37f-203" start="0">58-37f-203</xref> regarding prescriptions for dispensed <ln numlevel="1" lineno="401" slineno="2-13"/>controlled substances;</subsection><subsection ssid="3-null-7" dnum="b-o" numlevel="1" lineno="402" slineno="2-14" level="2"><display>(b)</display>data reported to the division under Section <xref depth="3" refnumber="26B-2-225" start="0">26B-2-225</xref> regarding poisoning or <ln numlevel="1" lineno="403" slineno="2-15"/>overdose;</subsection><subsection ssid="3-null-8" dnum="c-o" numlevel="1" lineno="404" slineno="2-16" level="2"><display>(c)</display>data reported to the division under Subsection <xref depth="4" refnumber="41-6a-502(5)" start="0">41-6a-502(5)</xref> or <xref depth="4" refnumber="41-6a-502.5(5)(b)" start="0">41-6a-502.5(5)(b)</xref> <ln numlevel="1" lineno="405" slineno="2-17"/>regarding convictions for driving under the influence of a prescribed controlled <ln numlevel="1" lineno="406" slineno="2-18"/>substance or impaired driving; and</subsection><subsection ssid="3-null-9" dnum="d-o" numlevel="1" lineno="407" slineno="2-19" level="2"><display>(d)</display>data reported to the division under Subsection <xref depth="4" refnumber="58-37-8(1)(e)" start="0">58-37-8(1)(e)</xref> or <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="ahaskell" level="1" deltag="both"><xref depth="4" refnumber="58-37-8(2)(g)" start="0">58-37-8(2)(g)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="ahaskell" level="1" amendtag="both" space="true"><xref depth="4" refnumber="58-37-8(2)(h)"><ln numlevel="1" lineno="408" slineno="2-20"/>58-37-8(2)(h)</xref></amend> regarding certain violations of <xref depth="1" refnumber="58-37" start="1">Chapter 37, Utah Controlled Substances <ln numlevel="1" lineno="409" slineno="2-21"/>Act</xref>.</subsection></subsection><subsection ssid="3-null-10" dnum="6-o" numlevel="1" lineno="410" slineno="2-22" level="1"><display>(6)</display>The division shall maintain the database in an electronic file or by other means <ln numlevel="1" lineno="411" slineno="2-23"/>established by the division to facilitate use of the database for identification of:<subsection ssid="3-null-11" dnum="a-o" numlevel="1" lineno="412" slineno="2-24" level="2"><display>(a)</display>prescribing practices and patterns of prescribing and dispensing controlled <ln numlevel="1" lineno="413" slineno="2-25"/>substances;</subsection><subsection ssid="3-null-12" dnum="b-o" numlevel="1" lineno="414" slineno="2-26" level="2"><display>(b)</display>practitioners prescribing controlled substances in an unprofessional or unlawful <ln numlevel="1" lineno="415" slineno="2-27"/>manner;</subsection><subsection ssid="3-null-13" dnum="c-o" numlevel="1" lineno="416" slineno="2-28" level="2"><display>(c)</display>individuals receiving prescriptions for controlled substances from licensed <ln numlevel="1" lineno="417" slineno="2-29"/>practitioners, and who subsequently obtain dispensed controlled substances from a <ln numlevel="1" lineno="418" slineno="2-30"/>drug outlet in quantities or with a frequency inconsistent with generally recognized <ln numlevel="1" lineno="419" slineno="2-31"/>standards of dosage for that controlled substance;</subsection><subsection ssid="3-null-14" dnum="d-o" numlevel="1" lineno="420" slineno="2-32" level="2"><display>(d)</display>individuals presenting forged or otherwise false or altered prescriptions for <ln numlevel="1" lineno="421" slineno="2-33"/>controlled substances to a pharmacy;</subsection><subsection ssid="3-null-15" dnum="e-o" numlevel="1" lineno="422" slineno="2-34" level="2"><display>(e)</display>individuals admitted to a general acute hospital for poisoning or overdose involving a <ln numlevel="1" lineno="423" slineno="2-35"/>prescribed controlled substance; and</subsection><subsection ssid="3-null-16" dnum="f-o" numlevel="1" lineno="424" slineno="2-36" level="2"><display>(f)</display>individuals convicted for:<subsection ssid="3-null-17" dnum="i-o" numlevel="1" lineno="425" slineno="2-37" level="3"><display>(i)</display>driving under the influence of a prescribed controlled substance that renders the <ln numlevel="1" lineno="426" slineno="2-38"/>individual incapable of safely operating a vehicle;</subsection><subsection ssid="3-null-18" dnum="ii-o" numlevel="1" lineno="427" slineno="2-39" level="3"><display>(ii)</display>driving while impaired, in whole or in part, by a prescribed controlled substance; <ln numlevel="1" lineno="428" slineno="2-40"/>or</subsection><subsection ssid="3-null-19" dnum="iii-o" numlevel="1" lineno="429" slineno="2-41" level="3"><display>(iii)</display>certain violations of <xref depth="1" refnumber="58-37" start="1">Chapter 37, Utah Controlled Substances Act</xref>.</subsection></subsection></subsection></section></bsec><bsec buid="7" num="58-37f-704" type="amend" src="code" uid="C58-37f-S704_2026050620260506" sort="58 37f07040020260506" numlevel="1" lineno="430" slineno="3-1" sn="3"><section number="58-37f-704" numlevel="1" lineno="431" slineno="3-2" type="amend"><secline lineno="430">Section 3. Section <bold>58-37f-704</bold> is amended to read:</secline><catline lineno="431"><bold>58-37f-704<parens/>. Entering certain convictions into the database. </bold></catline><sectionText lineno="432"><tab/>Beginning October 1, 2016, if the division receives a report from a court under <ln numlevel="1" lineno="433" slineno="3-4"/>Subsection <xref depth="4" refnumber="58-37-8(1)(e)" start="0">58-37-8(1)(e)</xref> or <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="ahaskell" level="1" deltag="both">58-37-8(2)(g)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="ahaskell" level="1" amendtag="both" space="true"><xref depth="4" refnumber="58-37-8(2)(h)">58-37-8(2)(h)</xref></amend>, the division shall daily enter into <ln numlevel="1" lineno="434" slineno="3-5"/>the database the information supplied in the report. </sectionText></section></bsec><bsec buid="15" num="64-14-204" type="amend" src="code" uid="C64-14-S204_2026050620260506" sort="64 14 02040020260506" numlevel="1" lineno="435" slineno="4-1" sn="4"><section number="64-14-204" numlevel="1" lineno="436" slineno="4-2" type="amend"><secline lineno="435">Section 4. Section <bold>64-14-204</bold> is amended to read:</secline><catline lineno="436"><bold>64-14-204<parens/>. Supervision of sentenced offenders placed in community -- <ln numlevel="1" lineno="437" slineno="4-3"/>Rulemaking -- POST certified parole or probation officers and peace officers -- Duties -- <ln numlevel="1" lineno="438" slineno="4-4"/>Supervision fee -- Coordination with local mental health authority.</bold></catline><subsection ssid="15-null-1" dnum="1-o" numlevel="1" lineno="439" slineno="4-5" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="15-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The division, except as otherwise provided by law, shall supervise a sentenced <ln numlevel="1" lineno="440" slineno="4-6"/>offender placed in the community if the offender:<subsection ssid="15-null-3" dnum="i-o" numlevel="1" lineno="441" slineno="4-7" level="3" tab="1" space="false"><display>(i)</display><subsection ssid="15-null-4" dnum="A-o" level="4" placement="sameline"><display>(A)</display>is placed on probation by a court;</subsection><subsection ssid="15-null-5" dnum="B-o" numlevel="1" lineno="442" slineno="4-8" level="4"><display>(B)</display>is released on parole by the Board of Pardons and Parole; or</subsection><subsection ssid="15-null-6" dnum="C-o" numlevel="1" lineno="443" slineno="4-9" level="4"><display>(C)</display>is accepted for supervision under the terms of the Interstate Compact for the <ln numlevel="1" lineno="444" slineno="4-10"/>Supervision of Parolees and Probationers; and</subsection></subsection><subsection ssid="15-null-7" dnum="ii-o" numlevel="1" lineno="445" slineno="4-11" level="3" tab="1"><display>(ii)</display>has been convicted of:<subsection ssid="15-null-8" dnum="A-o" numlevel="1" lineno="446" slineno="4-12" level="4"><display>(A)</display>a felony;</subsection><subsection ssid="15-null-9" dnum="B-o" numlevel="1" lineno="447" slineno="4-13" level="4"><display>(B)</display>a class A misdemeanor when an element of the offense is the use or attempted <ln numlevel="1" lineno="448" slineno="4-14"/>use of physical force against an individual or property; or</subsection><subsection ssid="15-null-10" dnum="C-o" numlevel="1" lineno="449" slineno="4-15" level="4"><display>(C)</display>notwithstanding Subsection <xref depth="4" refnumber="64-13-21(1)(a)(ii)(b)">(1)(a)(ii)(B)</xref>, a class A misdemeanor if the <ln numlevel="1" lineno="450" slineno="4-16"/>division is ordered by a court to supervise the offender under Section <xref depth="3" refnumber="77-18-105">77-18-105</xref>.</subsection></subsection></subsection><subsection ssid="15-null-11" dnum="b-o" numlevel="1" lineno="451" slineno="4-17" level="2"><display>(b)</display>If a sentenced offender participates in substance use treatment or a residential <ln numlevel="1" lineno="452" slineno="4-18"/>vocational or life skills program, as defined in Section <xref depth="3" refnumber="13-53-102">13-53-102</xref>, while under <ln numlevel="1" lineno="453" slineno="4-19"/>supervision on probation or parole, the division shall monitor the offender's <ln numlevel="1" lineno="454" slineno="4-20"/>compliance with and completion of the treatment or program.</subsection><subsection ssid="15-null-12" dnum="c-o" numlevel="1" lineno="455" slineno="4-21" level="2"><display>(c)</display>The department shall establish standards for:<subsection ssid="15-null-13" dnum="i-o" numlevel="1" lineno="456" slineno="4-22" level="3"><display>(i)</display>the supervision of offenders in accordance with the adult sentencing and <ln numlevel="1" lineno="457" slineno="4-23"/>supervision length guidelines, as defined in Section <xref depth="3" refnumber="63M-7-401.1">63M-7-401.1</xref>, giving priority, <ln numlevel="1" lineno="458" slineno="4-24"/>based on available resources, to felony offenders and offenders sentenced under <ln numlevel="1" lineno="459" slineno="4-25"/>Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="ahaskell" level="1" deltag="both"><xref depth="3" refnumber="58-37-8">58-37-8</xref><xref refnumber="58-37-8(2)(b)(ii)" depth="4"> (2)(b)(ii)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="ahaskell" level="1" amendtag="both" space="true"><xref depth="4" refnumber="58-37-8(2)(b)">58-37-8(2)(b)</xref></amend>; and</subsection><subsection ssid="15-null-14" dnum="ii-o" numlevel="1" lineno="460" slineno="4-26" level="3"><display>(ii)</display>the monitoring described in Subsection <xref depth="4" refnumber="64-13-21(1)(b)">(1)(b)</xref>.</subsection></subsection></subsection><subsection ssid="15-null-15" dnum="2-o" numlevel="1" lineno="461" slineno="4-27" level="1"><display>(2)</display>The division shall apply the graduated and evidence-based responses established in the <ln numlevel="1" lineno="462" slineno="4-28"/>adult sentencing and supervision length guidelines, as defined in Section <xref depth="3" refnumber="63M-7-401.1">63M-7-401.1</xref>, <ln numlevel="1" lineno="463" slineno="4-29"/>to facilitate a prompt and appropriate response to an individual's violation of the terms of <ln numlevel="1" lineno="464" slineno="4-30"/>probation or parole, including:<subsection ssid="15-null-16" dnum="a-o" numlevel="1" lineno="465" slineno="4-31" level="2"><display>(a)</display>sanctions to be used in response to a violation of the terms of probation or parole; and</subsection><subsection ssid="15-null-17" dnum="b-o" numlevel="1" lineno="466" slineno="4-32" level="2"><display>(b)</display>requesting approval from the court or Board of Pardons and Parole to impose a <ln numlevel="1" lineno="467" slineno="4-33"/>sanction for an individual's violation of the terms of probation or parole, for a period <ln numlevel="1" lineno="468" slineno="4-34"/>of incarceration of not more than three consecutive days and not more than a total of <ln numlevel="1" lineno="469" slineno="4-35"/>six days within a period of 30 days.</subsection></subsection><subsection ssid="15-null-18" dnum="3-o" numlevel="1" lineno="470" slineno="4-36" level="1"><display>(3)</display>The division shall implement a program of graduated incentives as established in the <ln numlevel="1" lineno="471" slineno="4-37"/>adult sentencing and supervision length guidelines, as defined in Section <xref depth="3" refnumber="63M-7-401.1">63M-7-401.1</xref> <ln numlevel="1" lineno="472" slineno="4-38"/>to facilitate the department's prompt and appropriate response to an offender's:<subsection ssid="15-null-19" dnum="a-o" numlevel="1" lineno="473" slineno="4-39" level="2"><display>(a)</display>compliance with the terms of probation or parole; or</subsection><subsection ssid="15-null-20" dnum="b-o" numlevel="1" lineno="474" slineno="4-40" level="2"><display>(b)</display>positive conduct that exceeds those terms.</subsection></subsection><subsection ssid="15-null-21" dnum="4-o" numlevel="1" lineno="475" slineno="4-41" level="1" space="false"><display>(4)</display><subsection ssid="15-null-22" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The department shall, in collaboration with the State Commission on Criminal and <ln numlevel="1" lineno="476" slineno="4-42"/>Juvenile Justice and the Division of Substance Use and Mental Health, create <ln numlevel="1" lineno="477" slineno="4-43"/>standards and procedures for the collection of information, including cost savings <ln numlevel="1" lineno="478" slineno="4-44"/>related to recidivism reduction and the reduction in the number of inmates, related to <ln numlevel="1" lineno="479" slineno="4-45"/>the use of the graduated and evidence-based responses and graduated incentives, and <ln numlevel="1" lineno="480" slineno="4-46"/>offenders' outcomes.</subsection><subsection ssid="15-null-23" dnum="b-o" numlevel="1" lineno="481" slineno="4-47" level="2"><display>(b)</display>The collected information shall be provided to the State Commission on Criminal <ln numlevel="1" lineno="482" slineno="4-48"/>and Juvenile Justice not less frequently than annually on or before August 31.</subsection></subsection><subsection ssid="15-null-24" dnum="5-o" numlevel="1" lineno="483" slineno="4-49" level="1"><display>(5)</display>Employees of the division who are POST certified as law enforcement officers or <ln numlevel="1" lineno="484" slineno="4-50"/>correctional officers and who are designated as parole and probation officers by the <ln numlevel="1" lineno="485" slineno="4-51"/>executive director have the following duties:<subsection ssid="15-null-25" dnum="a-o" numlevel="1" lineno="486" slineno="4-52" level="2"><display>(a)</display>monitoring, investigating, and supervising a parolee's or probationer's compliance <ln numlevel="1" lineno="487" slineno="4-53"/>with the conditions of the parole or probation agreement;</subsection><subsection ssid="15-null-26" dnum="b-o" numlevel="1" lineno="488" slineno="4-54" level="2"><display>(b)</display>investigating or apprehending any offender who has escaped from the custody of the <ln numlevel="1" lineno="489" slineno="4-55"/>department or absconded from supervision by the division;</subsection><subsection ssid="15-null-27" dnum="c-o" numlevel="1" lineno="490" slineno="4-56" level="2"><display>(c)</display>supervising any offender during transportation; or</subsection><subsection ssid="15-null-28" dnum="d-o" numlevel="1" lineno="491" slineno="4-57" level="2"><display>(d)</display>collecting DNA specimens when the specimens are required under Section <xref depth="3" refnumber="53-10-404">53-10-404</xref>.</subsection></subsection><subsection ssid="15-null-29" dnum="6-o" numlevel="1" lineno="492" slineno="4-58" level="1" space="false"><display>(6)</display><subsection ssid="15-null-30" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="15-null-31" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>A monthly supervision fee of $30 shall be collected from each offender on <ln numlevel="1" lineno="493" slineno="4-59"/>probation or parole.</subsection><subsection ssid="15-null-32" dnum="ii-o" numlevel="1" lineno="494" slineno="4-60" level="3" tab="1"><display>(ii)</display>The fee described in Subsection <xref depth="4" refnumber="64-13-21(6)(a)(i)">(6)(a)(i)</xref> may be suspended or waived by the <ln numlevel="1" lineno="495" slineno="4-61"/>division upon a showing by the offender that imposition would create a substantial <ln numlevel="1" lineno="496" slineno="4-62"/>hardship or if the offender owes restitution to a victim.</subsection></subsection><subsection ssid="15-null-33" dnum="b-o" numlevel="1" lineno="497" slineno="4-63" level="2" space="false"><display>(b)</display><subsection ssid="15-null-34" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The department shall make rules in accordance with Title 63G, Chapter 3, Utah <ln numlevel="1" lineno="498" slineno="4-64"/>Administrative Rulemaking Act, specifying the criteria for suspension or waiver <ln numlevel="1" lineno="499" slineno="4-65"/>of the supervision fee and the circumstances under which an offender may request <ln numlevel="1" lineno="500" slineno="4-66"/>a hearing.</subsection><subsection ssid="15-null-35" dnum="ii-o" numlevel="1" lineno="501" slineno="4-67" level="3"><display>(ii)</display>In determining whether the imposition of the supervision fee would constitute a <ln numlevel="1" lineno="502" slineno="4-68"/>substantial hardship, the division shall consider the financial resources of the <ln numlevel="1" lineno="503" slineno="4-69"/>offender and the burden that the fee would impose, with regard to the offender's <ln numlevel="1" lineno="504" slineno="4-70"/>other obligations.</subsection></subsection><subsection ssid="15-null-36" dnum="c-o" numlevel="1" lineno="505" slineno="4-71" level="2"><display>(c)</display>The division shall deposit money received from the monthly supervision fee <ln numlevel="1" lineno="506" slineno="4-72"/>established in this Subsection <xref depth="4" refnumber="64-13-21(6)">(6)</xref> into the General Fund as a parole and probation <ln numlevel="1" lineno="507" slineno="4-73"/>dedicated credit to be used to cover costs incurred in the collection of the fee and in <ln numlevel="1" lineno="508" slineno="4-74"/>the development of offender supervision programs.</subsection></subsection><subsection ssid="15-null-37" dnum="7-o" numlevel="1" lineno="509" slineno="4-75" level="1" space="false"><display>(7)</display><subsection ssid="15-null-38" dnum="a-o" level="2" placement="sameline"><display>(a)</display>For offenders placed on probation under Section <xref depth="3" refnumber="77-18-105">77-18-105</xref> or parole under <ln numlevel="1" lineno="510" slineno="4-76"/>Subsection <xref depth="4" refnumber="76-3-202(2)(a)">76-3-202(2)(a)</xref> on or after October 1, 2015, but before January 1, 2019, <ln numlevel="1" lineno="511" slineno="4-77"/>the division shall establish a program allowing an offender to earn a reduction credit <ln numlevel="1" lineno="512" slineno="4-78"/>of 30 days from the offender's period of probation or parole for each month the <ln numlevel="1" lineno="513" slineno="4-79"/>offender complies with the terms of the offender's probation or parole agreement, <ln numlevel="1" lineno="514" slineno="4-80"/>including the case action plan.</subsection><subsection ssid="15-null-39" dnum="b-o" numlevel="1" lineno="515" slineno="4-81" level="2" space="false"><display>(b)</display><subsection ssid="15-null-40" dnum="i-o" level="3" placement="sameline"><display>(i)</display>For offenders placed on probation under Section <xref depth="3" refnumber="77-18-105">77-18-105</xref> or parole under <ln numlevel="1" lineno="516" slineno="4-82"/>Section <xref depth="3" refnumber="76-3-202">76-3-202</xref> on or after July 1, 2026, the division shall establish a program, <ln numlevel="1" lineno="517" slineno="4-83"/>consistent with the adult sentencing and supervision length guidelines, as defined <ln numlevel="1" lineno="518" slineno="4-84"/>in Section <xref depth="3" refnumber="63M-7-401.1">63M-7-401.1</xref>, to provide incentives for an offender that maintains <ln numlevel="1" lineno="519" slineno="4-85"/>eligible employment, as defined in Section <xref depth="3" refnumber="64-13g-101">64-13g-101</xref>.</subsection><subsection ssid="15-null-41" dnum="ii-o" numlevel="1" lineno="520" slineno="4-86" level="3"><display>(ii)</display>The program under Subsection <xref depth="4" refnumber="64-13-21(7)(b)(i)">(7)(b)(i)</xref> may include a credit towards the <ln numlevel="1" lineno="521" slineno="4-87"/>reduction of the length of supervision for an offender at a rate of up to 30 days for <ln numlevel="1" lineno="522" slineno="4-88"/>each month that the offender maintains eligible employment, as defined in Section <xref depth="3" refnumber="64-13g-101"><ln numlevel="1" lineno="523" slineno="4-89"/>64-13g-101</xref>.</subsection><subsection ssid="15-null-42" dnum="iii-o" numlevel="1" lineno="524" slineno="4-90" level="3"><display>(iii)</display>A court, or the Board of Pardons and Parole, is not required to grant a request for <ln numlevel="1" lineno="525" slineno="4-91"/>termination of supervision under the program described in this Subsection <xref depth="4" refnumber="64-13-21(7)(b)">(7)(b)</xref> if <ln numlevel="1" lineno="526" slineno="4-92"/>the court, or the Board of Pardons and Parole, finds that:<subsection ssid="15-null-43" dnum="A-o" numlevel="1" lineno="527" slineno="4-93" level="4"><display>(A)</display>the offender presents a substantial risk to public safety;</subsection><subsection ssid="15-null-44" dnum="B-o" numlevel="1" lineno="528" slineno="4-94" level="4"><display>(B)</display>termination would prevent the offender from completing risk reduction <ln numlevel="1" lineno="529" slineno="4-95"/>programming or treatment; or</subsection><subsection ssid="15-null-45" dnum="C-o" numlevel="1" lineno="530" slineno="4-96" level="4"><display>(C)</display>the eligibility criteria for termination of supervision, as established in the adult <ln numlevel="1" lineno="531" slineno="4-97"/>sentencing and supervision length guidelines, as defined in Section <xref depth="3" refnumber="63M-7-401.1"><ln numlevel="1" lineno="532" slineno="4-98"/>63M-7-401.1</xref>, have not been met.</subsection></subsection><subsection ssid="15-null-46" dnum="iv-o" numlevel="1" lineno="533" slineno="4-99" level="3"><display>(iv)</display>This Subsection <xref depth="4" refnumber="64-13-21(7)(b)">(7)(b)</xref> does not prohibit the division, or another supervision <ln numlevel="1" lineno="534" slineno="4-100"/>services provider, from requesting termination of supervision based on the <ln numlevel="1" lineno="535" slineno="4-101"/>eligibility criteria in the adult sentencing and supervision length guidelines, as <ln numlevel="1" lineno="536" slineno="4-102"/>defined in Section <xref depth="3" refnumber="63M-7-401.1">63M-7-401.1</xref>.</subsection></subsection><subsection ssid="15-null-47" dnum="c-o" numlevel="1" lineno="537" slineno="4-103" level="2"><display>(c)</display>The division shall:<subsection ssid="15-null-48" dnum="i-o" numlevel="1" lineno="538" slineno="4-104" level="3"><display>(i)</display>maintain a record of credits earned by an offender under this Subsection <xref depth="4" refnumber="64-13-21(7)">(7)</xref>; and</subsection><subsection ssid="15-null-49" dnum="ii-o" numlevel="1" lineno="539" slineno="4-105" level="3"><display>(ii)</display>request from the court or the Board of Pardons and Parole the termination of <ln numlevel="1" lineno="540" slineno="4-106"/>probation or parole not fewer than 30 days <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="6" groupid="6" style="2" owner="ahaskell" level="1" deltag="both">prior to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="5" groupid="5" style="1" owner="ahaskell" level="1" amendtag="both" space="true">before</amend> the termination date <ln numlevel="1" lineno="541" slineno="4-107"/>that reflects the credits earned under this Subsection <xref depth="4" refnumber="64-13-21(7)">(7)</xref>.</subsection></subsection><subsection ssid="15-null-50" dnum="d-o" numlevel="1" lineno="542" slineno="4-108" level="2"><display>(d)</display>This Subsection <xref depth="4" refnumber="64-13-21(7)">(7)</xref> does not prohibit the division from requesting a termination date <ln numlevel="1" lineno="543" slineno="4-109"/>earlier than the termination date established by earned credits under Subsection <xref depth="4" refnumber="64-13-21(7)(c)">(7)(c)</xref>.</subsection><subsection ssid="15-null-51" dnum="e-o" numlevel="1" lineno="544" slineno="4-110" level="2"><display>(e)</display>The court or the Board of Pardons and Parole shall terminate an offender's probation <ln numlevel="1" lineno="545" slineno="4-111"/>or parole upon completion of the period of probation or parole accrued by time <ln numlevel="1" lineno="546" slineno="4-112"/>served and credits earned under this Subsection <xref depth="4" refnumber="64-13-21(7)">(7)</xref> unless the court or the Board of <ln numlevel="1" lineno="547" slineno="4-113"/>Pardons and Parole finds that termination would interrupt the completion of a <ln numlevel="1" lineno="548" slineno="4-114"/>necessary treatment program, in which case the termination of probation or parole <ln numlevel="1" lineno="549" slineno="4-115"/>shall occur when the treatment program is completed.</subsection><subsection ssid="15-null-52" dnum="f-o" numlevel="1" lineno="550" slineno="4-116" level="2"><display>(f)</display>The department shall report annually to the State Commission on Criminal and <ln numlevel="1" lineno="551" slineno="4-117"/>Juvenile Justice on or before August 31:<subsection ssid="15-null-53" dnum="i-o" numlevel="1" lineno="552" slineno="4-118" level="3"><display>(i)</display>the number of offenders who have earned probation or parole credits under this <ln numlevel="1" lineno="553" slineno="4-119"/>Subsection <xref depth="4" refnumber="64-13-21(7)">(7)</xref> in one or more months of the preceding fiscal year and the <ln numlevel="1" lineno="554" slineno="4-120"/>percentage of the offenders on probation or parole during that time that this <ln numlevel="1" lineno="555" slineno="4-121"/>number represents;</subsection><subsection ssid="15-null-54" dnum="ii-o" numlevel="1" lineno="556" slineno="4-122" level="3"><display>(ii)</display>the average number of credits earned by those offenders who earned credits;</subsection><subsection ssid="15-null-55" dnum="iii-o" numlevel="1" lineno="557" slineno="4-123" level="3"><display>(iii)</display>the number of offenders who earned credits by county of residence while on <ln numlevel="1" lineno="558" slineno="4-124"/>probation or parole;</subsection><subsection ssid="15-null-56" dnum="iv-o" numlevel="1" lineno="559" slineno="4-125" level="3"><display>(iv)</display>the cost savings associated with sentencing reform programs and practices; and</subsection><subsection ssid="15-null-57" dnum="v-o" numlevel="1" lineno="560" slineno="4-126" level="3"><display>(v)</display>a description of how the savings will be invested in treatment and <ln numlevel="1" lineno="561" slineno="4-127"/>early-intervention programs and practices at the county and state levels.</subsection></subsection></subsection><subsection ssid="15-null-58" dnum="8-o" numlevel="1" lineno="562" slineno="4-128" level="1" space="false"><display>(8)</display><subsection ssid="15-null-59" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The department shall coordinate with a local mental health authority to complete <ln numlevel="1" lineno="563" slineno="4-129"/>the requirements of this Subsection <xref refnumber="64-13-21(8)" depth="4">(8)</xref> for an offender who:<subsection ssid="15-null-60" dnum="i-o" numlevel="1" lineno="564" slineno="4-130" level="3" tab="1"><display>(i)</display>is a habitual offender as that term is defined in Section <xref depth="3" refnumber="77-18-102">77-18-102</xref>;</subsection><subsection ssid="15-null-61" dnum="ii-o" numlevel="1" lineno="565" slineno="4-131" level="3" tab="1"><display>(ii)</display>has a mental illness as that term is defined in Section <xref depth="3" refnumber="26B-5-301">26B-5-301</xref>; and</subsection><subsection ssid="15-null-62" dnum="iii-o" numlevel="1" lineno="566" slineno="4-132" level="3" tab="1"><display>(iii)</display>based on a risk and needs assessment:<subsection ssid="15-null-63" dnum="A-o" numlevel="1" lineno="567" slineno="4-133" level="4"><display>(A)</display>is at a high risk of reoffending; and</subsection><subsection ssid="15-null-64" dnum="B-o" numlevel="1" lineno="568" slineno="4-134" level="4"><display>(B)</display>has risk factors that may be addressed by available community-based services.</subsection></subsection></subsection><subsection ssid="15-null-65" dnum="b-o" numlevel="1" lineno="569" slineno="4-135" level="2"><display>(b)</display>For an offender described in Subsection <xref depth="4" refnumber="64-13-21(8)(a)">(8)(a)</xref>, at any time clinically appropriate or <ln numlevel="1" lineno="570" slineno="4-136"/>at least three months before termination of an offender's parole or expiration of an <ln numlevel="1" lineno="571" slineno="4-137"/>offender's sentence, the department shall coordinate with the Department of Health <ln numlevel="1" lineno="572" slineno="4-138"/>and Human Services and the relevant local mental health authority to provide <ln numlevel="1" lineno="573" slineno="4-139"/>applicable clinical assessments and transitional treatment planning and services for <ln numlevel="1" lineno="574" slineno="4-140"/>the offender so that the offender may receive appropriate treatment and support <ln numlevel="1" lineno="575" slineno="4-141"/>services after the termination of parole or expiration of sentence.</subsection><subsection ssid="15-null-66" dnum="c-o" numlevel="1" lineno="576" slineno="4-142" level="2"><display>(c)</display>The local mental health authority may determine whether the offender:<subsection ssid="15-null-67" dnum="i-o" numlevel="1" lineno="577" slineno="4-143" level="3"><display>(i)</display>meets the criteria for civil commitment;</subsection><subsection ssid="15-null-68" dnum="ii-o" numlevel="1" lineno="578" slineno="4-144" level="3"><display>(ii)</display>meets the criteria for assisted outpatient treatment; or</subsection><subsection ssid="15-null-69" dnum="iii-o" numlevel="1" lineno="579" slineno="4-145" level="3"><display>(iii)</display>would benefit from assignment to an assertive community treatment team or <ln numlevel="1" lineno="580" slineno="4-146"/>available community-based services.</subsection></subsection><subsection ssid="15-null-70" dnum="d-o" numlevel="1" lineno="581" slineno="4-147" level="2"><display>(d)</display>Based on the local mental health authority's determination under Subsection <xref refnumber="64-13-21(8)(c)" depth="4">(8)(c)</xref>, <ln numlevel="1" lineno="582" slineno="4-148"/>the local mental health authority shall, as appropriate:<subsection ssid="15-null-71" dnum="i-o" numlevel="1" lineno="583" slineno="4-149" level="3"><display>(i)</display>initiate an involuntary commitment court proceeding;</subsection><subsection ssid="15-null-72" dnum="ii-o" numlevel="1" lineno="584" slineno="4-150" level="3"><display>(ii)</display>file a written application for assisted outpatient treatment; or</subsection><subsection ssid="15-null-73" dnum="iii-o" numlevel="1" lineno="585" slineno="4-151" level="3"><display>(iii)</display>seek to have the offender assigned to an assertive community treatment team or <ln numlevel="1" lineno="586" slineno="4-152"/>available community-based services.</subsection></subsection><subsection ssid="15-null-74" dnum="e-o" numlevel="1" lineno="587" slineno="4-153" level="2"><display>(e)</display>On or before November 1, 2025, the department shall provide a report to the Law <ln numlevel="1" lineno="588" slineno="4-154"/>Enforcement and Criminal Justice Interim Committee regarding any proposed <ln numlevel="1" lineno="589" slineno="4-155"/>changes to the requirements in this Subsection <xref refnumber="64-13-21(8)" depth="4">(8)</xref>, including whether the <ln numlevel="1" lineno="590" slineno="4-156"/>requirements of this Subsection <xref depth="4" refnumber="64-13-21(8)">(8)</xref> should also apply to any other category of <ln numlevel="1" lineno="591" slineno="4-157"/>offenders.</subsection></subsection></section></bsec><bsec buid="18" num="77-2-4.6" type="enact" src="code" uid="C77-2-S4.6_2026050620260506" sort="77 02 00040620260506" numlevel="1" lineno="592" slineno="5-1" sn="5"><section numlevel="1" lineno="593" slineno="5-2" number="77-2-4.6" type="enact"><secline lineno="592">Section 5. Section <bold>77-2-4.6</bold> is enacted to read:</secline><catline lineno="593"><bold>77-2-4.6<parens/>. Deferred prosecution for certain marijuana use or possession offenses.</bold></catline><subsection ssid="18-1" dnum="_-o:1-i" numlevel="1" lineno="594" slineno="5-3" ea="amend" anum="0" owner="ahaskell" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1251" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="13" groupid="10" style="1" owner="ahaskell" level="1" amendtag="end">As used in this section:</amend><subsection ssid="18-4" dnum="_-o:a-i" numlevel="1" lineno="595" slineno="5-4" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1252" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="22" groupid="17" style="1" owner="ahaskell" level="1" amendtag="end">"Deferral period" means the 12-month period following the date on which an <ln numlevel="1" lineno="596" slineno="5-5"/>individual submits an application for deferred prosecution.</amend></subsection><subsection ssid="18-6" dnum="_-o:b-i" numlevel="1" lineno="597" slineno="5-6" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1253" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="25" groupid="19" style="1" owner="ahaskell" level="1" amendtag="end">"Deferred prosecution" means the deferral of prosecution of an individual charged <ln numlevel="1" lineno="598" slineno="5-7"/>with an eligible marijuana offense if the individual complies with the requirements <ln numlevel="1" lineno="599" slineno="5-8"/>described in Subsections <xref depth="4" refnumber="77-2-4.6(2)">(2)</xref> and (3).</amend></subsection><subsection ssid="18-111" dnum="_-o:c-i" numlevel="1" lineno="600" slineno="5-9" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1254" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="359" groupid="247" style="1" owner="ahaskell" level="1" amendtag="end">"Drug offense" means an offense described in:</amend><subsection ssid="18-113" dnum="_-o:i-i" numlevel="1" lineno="601" slineno="5-10" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1255" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="372" groupid="255" style="1" owner="ahaskell" level="1" amendtag="end">Title 58, Chapter 37, Utah Controlled Substances Act;</amend></subsection><subsection ssid="18-114" dnum="_-o:ii-i" numlevel="1" lineno="602" slineno="5-11" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1256" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="377" groupid="259" style="1" owner="ahaskell" level="1" amendtag="end">Title 58, Chapter 37a, Utah Drug Paraphernalia Act;</amend></subsection><subsection ssid="18-115" dnum="_-o:iii-i" numlevel="1" lineno="603" slineno="5-12" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1257" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="383" groupid="263" style="1" owner="ahaskell" level="1" amendtag="end">Title 58, Chapter 37b, Imitation Controlled Substances Act;</amend></subsection><subsection ssid="18-116" dnum="_-o:iv-i" numlevel="1" lineno="604" slineno="5-13" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1258" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="388" groupid="267" style="1" owner="ahaskell" level="1" amendtag="end">Title 58, Chapter 37c, Utah Controlled Substance Precursor Act; or</amend></subsection><subsection ssid="18-117" dnum="_-o:v-i" numlevel="1" lineno="605" slineno="5-14" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1259" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="395" groupid="273" style="1" owner="ahaskell" level="1" amendtag="end">Title 58, Chapter 37d, Clandestine Drug Lab Act.</amend></subsection></subsection><subsection ssid="18-7" dnum="_-o:d-i" numlevel="1" lineno="606" slineno="5-15" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1260" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="28" groupid="21" style="1" owner="ahaskell" level="1" amendtag="end">"Eligible marijuana offense" means an individual's first drug offense that is a <ln numlevel="1" lineno="607" slineno="5-16"/>marijuana offense punishable as a class B misdemeanor under Subsection <xref depth="4" refnumber="58-37-8(2)(e)(i)(a)"><ln numlevel="1" lineno="608" slineno="5-17"/>58-37-8(2)(e)(i)(A)</xref>.</amend></subsection><subsection ssid="18-112" dnum="_-o:e-i" numlevel="1" lineno="609" slineno="5-18" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1261" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="363" groupid="250" style="1" owner="ahaskell" level="1" amendtag="end">"Marijuana offense" means a violation of Subsection <xref depth="4" refnumber="58-37-8(2)(a)(i)">58-37-8(2)(a)(i)</xref> for the use or <ln numlevel="1" lineno="610" slineno="5-19"/>possession of marijuana.</amend></subsection></subsection><subsection ssid="18-37" dnum="_-o:2-i" numlevel="1" lineno="611" slineno="5-20" ea="amend" anum="0" owner="ahaskell" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1262" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><subsection ssid="18-119" dnum="_-o:a-i" ea="amend" anum="0" owner="ahaskell" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1263" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="400" groupid="277" style="1" owner="ahaskell" level="1" amendtag="end">Except as provided in Subsection <xref depth="4" refnumber="77-2-4.6(2)(b)">(2)(b)</xref>, for an offense committed on or after <ln numlevel="1" lineno="612" slineno="5-21"/>October 1, 2026, an individual who is charged with an eligible marijuana offense <ln numlevel="1" lineno="613" slineno="5-22"/>may apply for deferred prosecution under Subsection <xref depth="4" refnumber="77-2-4.6(3)">(3)</xref>.</amend></subsection><subsection ssid="18-120" dnum="_-o:b-i" numlevel="1" lineno="614" slineno="5-23" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1264" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="404" groupid="280" style="1" owner="ahaskell" level="1" amendtag="end">The following individuals may not apply for or be granted a deferred prosecution as <ln numlevel="1" lineno="615" slineno="5-24"/>described in this section:</amend><subsection ssid="18-121" dnum="_-o:i-i" numlevel="1" lineno="616" slineno="5-25" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1265" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="409" groupid="284" style="1" owner="ahaskell" level="1" amendtag="end">an individual under 21 years old; or</amend></subsection><subsection ssid="18-122" dnum="_-o:ii-i" numlevel="1" lineno="617" slineno="5-26" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1266" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="414" groupid="288" style="1" owner="ahaskell" level="1" amendtag="end">an individual with a commercial driver license.</amend></subsection></subsection></subsection><subsection ssid="18-66" dnum="_-o:3-i" numlevel="1" lineno="618" slineno="5-27" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1267" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="205" groupid="139" style="1" owner="ahaskell" level="1" amendtag="end">An individual who applies for deferred prosecution shall:</amend><subsection ssid="18-67" dnum="_-o:a-i" numlevel="1" lineno="619" slineno="5-28" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1268" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="208" groupid="141" style="1" owner="ahaskell" level="1" amendtag="end">apply through an online application process developed by the Administrative Office <ln numlevel="1" lineno="620" slineno="5-29"/>of the Courts;</amend></subsection><subsection ssid="18-68" dnum="_-o:b-i" numlevel="1" lineno="621" slineno="5-30" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1269" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="211" groupid="143" style="1" owner="ahaskell" level="1" amendtag="end">pay the relevant fine, as provided by the uniform fine schedule described in Section <xref depth="3" refnumber="76-3-301.5"><ln numlevel="1" lineno="622" slineno="5-31"/>76-3-301.5</xref>, associated with the eligible marijuana offense;</amend></subsection><subsection ssid="18-69" dnum="_-o:c-i" numlevel="1" lineno="623" slineno="5-32" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1270" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="214" groupid="145" style="1" owner="ahaskell" level="1" amendtag="end">pay an administrative fee as established by the Judicial Council; and</amend></subsection><subsection ssid="18-78" dnum="_-o:c-i" numlevel="1" lineno="629" slineno="5-38" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1275" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="241" groupid="163" style="1" owner="ahaskell" level="1" amendtag="end">if the individual fails to comply with the terms of the deferred prosecution, enter a <ln numlevel="1" lineno="630" slineno="5-39"/>judgment of conviction as described in Subsection <xref depth="4" refnumber="77-2-4.6(5)(b)">(5)(b)</xref>.</amend></subsection></subsection><subsection ssid="18-80" dnum="_-o:5-i" numlevel="1" lineno="631" slineno="5-40" ea="amend" anum="0" owner="ahaskell" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1276" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><subsection ssid="18-109" dnum="_-o:a-i" ea="amend" anum="0" owner="ahaskell" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1277" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="350" groupid="240" style="1" owner="ahaskell" level="1" amendtag="end">Except as provided in Subsection <xref depth="4" refnumber="77-2-4.6(5)(b)">(5)(b)</xref>, if an individual enters a deferred plea of <ln numlevel="1" lineno="632" slineno="5-41"/>no contest as described in Subsection <xref depth="4" refnumber="77-2-4.6(3)(d)">(3)(d)</xref> and is not convicted of another drug <ln numlevel="1" lineno="633" slineno="5-42"/>offense during the deferral period:</amend><subsection ssid="18-81" dnum="_-o:i-i" numlevel="1" lineno="634" slineno="5-43" ea="amend" anum="0" owner="ahaskell" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1278" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="250" groupid="169" style="1" owner="ahaskell" level="1" amendtag="end">the prosecutor may not prosecute the individual for the eligible marijuana offense <ln numlevel="1" lineno="635" slineno="5-44"/>subject to the deferred prosecution;</amend></subsection><subsection ssid="18-82" dnum="_-o:ii-i" numlevel="1" lineno="636" slineno="5-45" ea="amend" anum="0" owner="ahaskell" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1279" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="253" groupid="171" style="1" owner="ahaskell" level="1" amendtag="end">the court may not enter judgment of conviction against the individual or impose a <ln numlevel="1" lineno="637" slineno="5-46"/>sentence for the eligible marijuana offense; and</amend></subsection><subsection ssid="18-83" dnum="_-o:iii-i" numlevel="1" lineno="638" slineno="5-47" ea="amend" anum="0" owner="ahaskell" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1280" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="256" groupid="173" style="1" owner="ahaskell" level="1" amendtag="end">the court shall dismiss the eligible marijuana offense to which the individual <ln numlevel="1" lineno="639" slineno="5-48"/>entered a deferred plea of no contest.</amend></subsection></subsection><subsection ssid="18-84" dnum="_-o:b-i" numlevel="1" lineno="640" slineno="5-49" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1281" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="259" groupid="175" style="1" owner="ahaskell" level="1" amendtag="end">If an individual enters a deferred plea of no contest as described in Subsection <xref depth="4" refnumber="77-2-4.6(3)(d)">(3)(d)</xref> <ln numlevel="1" lineno="641" slineno="5-50"/>and is convicted of a drug offense within the deferral period, the court shall enter <ln numlevel="1" lineno="642" slineno="5-51"/>judgment of conviction against the individual for the eligible marijuana offense to <ln numlevel="1" lineno="643" slineno="5-52"/>which the individual entered a deferred plea of no contest.</amend></subsection></subsection><subsection ssid="18-89" dnum="_-o:6-i" numlevel="1" lineno="644" slineno="5-53" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1282" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="274" groupid="185" style="1" owner="ahaskell" level="1" amendtag="end">A deferred prosecution is not a prosecution for purposes of Section <xref depth="3" refnumber="76-1-403">76-1-403</xref>.</amend></subsection><subsection ssid="18-91" dnum="_-o:7-i" numlevel="1" lineno="645" slineno="5-54" ea="amend" anum="0" owner="ahaskell" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1283" style="1" owner="i" level="1" amendtag="start">(7)</amend></display><subsection ssid="18-110" dnum="_-o:a-i" ea="amend" anum="0" owner="ahaskell" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1284" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="355" groupid="244" style="1" owner="ahaskell" level="1" amendtag="end">The Judicial Council shall set and periodically adjust the fee described in <ln numlevel="1" lineno="646" slineno="5-55"/>Subsection <xref depth="4" refnumber="77-2-4.6(3)(c)">(3)(c)</xref> in an amount that the J<marker pairid="415"/>udicial Council determines to be necessary <ln numlevel="1" lineno="647" slineno="5-56"/>to cover the cost to implement, operate, and maintain the deferred prosecution <ln numlevel="1" lineno="648" slineno="5-57"/>program described in this section.</amend></subsection><subsection ssid="18-92" dnum="_-o:b-i" numlevel="1" lineno="649" slineno="5-58" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1285" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="283" groupid="191" style="1" owner="ahaskell" level="1" amendtag="end">The state treasurer shall deposit the revenue generated from the administrative fee <ln numlevel="1" lineno="650" slineno="5-59"/>described in Subsection <xref depth="4" refnumber="77-2-4.6(3)(c)">(3)(c)</xref> into the Justice Court Technology, Security, and <ln numlevel="1" lineno="651" slineno="5-60"/>Training Account created in Section <xref depth="3" refnumber="78A-7-301">78A-7-301</xref>.</amend></subsection></subsection></section></bsec><bsec buid="13" num="77-11b-102" type="amend" src="code" uid="C77-11b-S102_2026050620260506" sort="77 11b01020020260506" numlevel="1" lineno="652" slineno="6-1" sn="6"><section number="77-11b-102" numlevel="1" lineno="653" slineno="6-2" type="amend"><secline lineno="652">Section 6. Section <bold>77-11b-102</bold> is amended to read:</secline><catline lineno="653"><bold>77-11b-102<parens/>. Property subject to forfeiture.</bold></catline><subsection ssid="13-null-1" dnum="1-o" numlevel="1" lineno="654" slineno="6-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="13-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="77-11b-102(2)" start="0">(2)</xref>, <xref depth="4" refnumber="77-11b-102(3)" start="0">(3)</xref>, <xref depth="4" refnumber="77-11b-102(4)" start="0">(4)</xref>, or <xref depth="4" refnumber="77-11b-102(5)" start="0">(5)</xref>, an agency may seek to <ln numlevel="1" lineno="655" slineno="6-4"/>forfeit:<subsection ssid="13-null-3" dnum="i-o" numlevel="1" lineno="656" slineno="6-5" level="3" tab="1"><display>(i)</display>seized property that was used to facilitate the commission of an offense that is a <ln numlevel="1" lineno="657" slineno="6-6"/>violation of federal or state law; or</subsection><subsection ssid="13-null-4" dnum="ii-o" numlevel="1" lineno="658" slineno="6-7" level="3" tab="1"><display>(ii)</display>seized proceeds.</subsection></subsection><subsection ssid="13-null-5" dnum="b-o" numlevel="1" lineno="659" slineno="6-8" level="2"><display>(b)</display>An agency, or the prosecuting attorney, may not forfeit the seized property of an <ln numlevel="1" lineno="660" slineno="6-9"/>innocent owner or an interest holder.</subsection></subsection><subsection ssid="13-null-6" dnum="2-o" numlevel="1" lineno="661" slineno="6-10" level="1"><display>(2)</display>If seized property is used to facilitate an offense that is a violation of Section <xref depth="3" refnumber="76-5c-202">76-5c-202</xref>, <xref depth="3" refnumber="76-5c-203"><ln numlevel="1" lineno="662" slineno="6-11"/>76-5c-203</xref>, <xref depth="3" refnumber="76-5c-204">76-5c-204</xref>, <xref depth="3" refnumber="76-5c-205">76-5c-205</xref>, <xref depth="3" refnumber="76-5c-206">76-5c-206</xref>, or <xref depth="3" refnumber="76-5c-305">76-5c-305</xref>, an agency may not forfeit <ln numlevel="1" lineno="663" slineno="6-12"/>the property if the forfeiture would constitute a prior restraint on the exercise of an <ln numlevel="1" lineno="664" slineno="6-13"/>affected party's rights under the First Amendment to the Constitution of the United <ln numlevel="1" lineno="665" slineno="6-14"/>States or <ext_ref type="Utah Constitution">Utah Constitution, Article I, Section 15</ext_ref>, or would otherwise unlawfully <ln numlevel="1" lineno="666" slineno="6-15"/>interfere with the exercise of the party's rights under the First Amendment to the <ln numlevel="1" lineno="667" slineno="6-16"/>Constitution of the United States or <ext_ref type="Utah Constitution">Utah Constitution, Article I, Section 15.</ext_ref></subsection><subsection ssid="13-null-7" dnum="3-o" numlevel="1" lineno="668" slineno="6-17" level="1"><display>(3)</display>If a motor vehicle is used in an offense that is a violation of Section <xref depth="3" refnumber="41-6a-502" start="0">41-6a-502</xref><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="12" groupid="3" style="2" owner="ahaskell" level="1" deltag="both">,</amend><amendoutend style="2"/> <amend anum="0" ea="amend" pairid="11" groupid="2" style="1" owner="ahaskell" level="1" amendtag="both">or </amend><xref depth="3" refnumber="41-6a-517" start="0"><ln numlevel="1" lineno="669" slineno="6-18"/>41-6a-517</xref>, a local ordinance that complies with the requirements of Subsection <xref depth="4" refnumber="41-6a-510(1)" start="0"><ln numlevel="1" lineno="670" slineno="6-19"/>41-6a-510(1)</xref>, Subsection <xref depth="4" refnumber="76-5-102.1(2)(b)" start="0">76-5-102.1(2)(b)</xref>, or Section <xref depth="3" refnumber="76-5-207" start="0">76-5-207</xref>, an agency may not <ln numlevel="1" lineno="671" slineno="6-20"/>seek forfeiture of the motor vehicle, unless:<subsection ssid="13-null-8" dnum="a-o" numlevel="1" lineno="672" slineno="6-21" level="2"><display>(a)</display>the operator of the vehicle has previously been convicted of an offense committed <ln numlevel="1" lineno="673" slineno="6-22"/>after May 12, 2009, that is:<subsection ssid="13-null-9" dnum="i-o" numlevel="1" lineno="674" slineno="6-23" level="3"><display>(i)</display>a felony driving under the influence violation under Section <xref depth="3" refnumber="41-6a-502" start="0">41-6a-502</xref> or <ln numlevel="1" lineno="675" slineno="6-24"/>Subsection <xref depth="4" refnumber="76-5-102.1(2)(a)" start="0">76-5-102.1(2)(a)</xref>;</subsection><subsection ssid="13-null-10" dnum="ii-o" numlevel="1" lineno="676" slineno="6-25" level="3"><display>(ii)</display>a felony violation under Subsection <xref depth="4" refnumber="76-5-102.1(2)(b)" start="0">76-5-102.1(2)(b)</xref>;</subsection><subsection ssid="13-null-11" dnum="iii-o" numlevel="1" lineno="677" slineno="6-26" level="3"><display>(iii)</display>a violation under Section <xref depth="3" refnumber="76-5-207" start="0">76-5-207</xref>; or</subsection><subsection ssid="13-null-12" dnum="iv-o" numlevel="1" lineno="678" slineno="6-27" level="3"><display>(iv)</display>operating a motor vehicle with any amount of a controlled substance in an <ln numlevel="1" lineno="679" slineno="6-28"/>individual's body and causing serious bodily injury or death, as codified before <ln numlevel="1" lineno="680" slineno="6-29"/>May 4, 2022, <ext_ref type="Laws of Utah">Laws of Utah 2021, Chapter 236</ext_ref>, Section 1, Subsection <xref depth="4" refnumber="58-37-8(2)(g)" start="0"><ln numlevel="1" lineno="681" slineno="6-30"/>58-37-8(2)(g)</xref>; or</subsection></subsection><subsection ssid="13-null-13" dnum="b-o" numlevel="1" lineno="682" slineno="6-31" level="2"><display>(b)</display>the operator of the vehicle was driving on a denied, suspended, revoked, or <ln numlevel="1" lineno="683" slineno="6-32"/>disqualified license and:<subsection ssid="13-null-14" dnum="i-o" numlevel="1" lineno="684" slineno="6-33" level="3"><display>(i)</display>the denial, suspension, revocation, or disqualification under Subsection <xref depth="4" refnumber="77-11b-102(3)(b)(ii)" start="0">(3)(b)(ii)</xref> <ln numlevel="1" lineno="685" slineno="6-34"/>was imposed because of a violation under:<subsection ssid="13-null-15" dnum="A-o" numlevel="1" lineno="686" slineno="6-35" level="4"><display>(A)</display>Section <xref depth="3" refnumber="41-6a-502" start="0">41-6a-502</xref>;</subsection><subsection ssid="13-null-16" dnum="B-o" numlevel="1" lineno="687" slineno="6-36" level="4"><display>(B)</display>Section <xref depth="3" refnumber="41-6a-517" start="0">41-6a-517</xref>;</subsection><subsection ssid="13-null-17" dnum="C-o" numlevel="1" lineno="688" slineno="6-37" level="4"><display>(C)</display>a local ordinance that complies with the requirements of Subsection <xref depth="4" refnumber="41-6a-510(1)" start="0"><ln numlevel="1" lineno="689" slineno="6-38"/>41-6a-510(1)</xref>;</subsection><subsection ssid="13-null-18" dnum="D-o" numlevel="1" lineno="690" slineno="6-39" level="4"><display>(D)</display>Section <xref depth="3" refnumber="41-6a-520.1" start="0">41-6a-520.1</xref>;</subsection><subsection ssid="13-null-19" dnum="E-o" numlevel="1" lineno="691" slineno="6-40" level="4"><display>(E)</display>operating a motor vehicle with any amount of a controlled substance in an <ln numlevel="1" lineno="692" slineno="6-41"/>individual's body and causing serious bodily injury or death, as codified before <ln numlevel="1" lineno="693" slineno="6-42"/>May 4, 2022, <ext_ref type="Laws of Utah">Laws of Utah 2021, Chapter 236</ext_ref>, Section 1, Subsection <xref depth="4" refnumber="58-37-8(2)(g)" start="0"><ln numlevel="1" lineno="694" slineno="6-43"/>58-37-8(2)(g)</xref>;</subsection><subsection ssid="13-null-20" dnum="F-o" numlevel="1" lineno="695" slineno="6-44" level="4"><display>(F)</display>Section <xref depth="3" refnumber="76-5-102.1" start="0">76-5-102.1</xref>;</subsection><subsection ssid="13-null-21" dnum="G-o" numlevel="1" lineno="696" slineno="6-45" level="4"><display>(G)</display>Section <xref depth="3" refnumber="76-5-207" start="0">76-5-207</xref>; or</subsection><subsection ssid="13-null-22" dnum="H-o" numlevel="1" lineno="697" slineno="6-46" level="4"><display>(H)</display>a criminal prohibition as a result of a plea bargain after having been originally <ln numlevel="1" lineno="698" slineno="6-47"/>charged with violating one or more of the sections or ordinances described in <ln numlevel="1" lineno="699" slineno="6-48"/>Subsections <xref depth="4" refnumber="77-11b-102(3)(b)(i)(A)" start="0">(3)(b)(i)(A)</xref> through <xref depth="4" refnumber="77-11b-102(3)(b)(i)(G)" start="0">(G)</xref>; or</subsection></subsection><subsection ssid="13-null-23" dnum="ii-o" numlevel="1" lineno="700" slineno="6-49" level="3"><display>(ii)</display>the denial, suspension, revocation, or disqualification described in Subsection <xref depth="4" refnumber="77-11b-102(3)(b)(i)" start="0"><ln numlevel="1" lineno="701" slineno="6-50"/>(3)(b)(i)</xref>:<subsection ssid="13-null-24" dnum="A-o" numlevel="1" lineno="702" slineno="6-51" level="4"><display>(A)</display>is an extension imposed under Subsection <xref depth="4" refnumber="53-3-220(2)" start="0">53-3-220(2)</xref> of a denial, suspension, <ln numlevel="1" lineno="703" slineno="6-52"/>revocation, or disqualification; and</subsection><subsection ssid="13-null-25" dnum="B-o" numlevel="1" lineno="704" slineno="6-53" level="4"><display>(B)</display>the original denial, suspension, revocation, or disqualification was imposed <ln numlevel="1" lineno="705" slineno="6-54"/>because of a violation described in Subsection <xref depth="4" refnumber="77-11b-102(3)(b)(i)" start="0">(3)(b)(i)</xref>.</subsection></subsection></subsection></subsection><subsection ssid="13-null-26" dnum="4-o" numlevel="1" lineno="706" slineno="6-55" level="1"><display>(4)</display>If a peace officer seizes property incident to an arrest solely for possession of a <ln numlevel="1" lineno="707" slineno="6-56"/>controlled substance under Subsection <xref depth="4" refnumber="58-37-8(2)(a)(i)" start="0">58-37-8(2)(a)(i)</xref><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="0" groupid="0" style="2" owner="ahaskell" level="1" deltag="both"> but not Subsection <xref depth="4" refnumber="58-37-8(2)(b)(i)" start="0"><ln numlevel="1" lineno="708" slineno="6-57"/>58-37-8(2)(b)(i)</xref></amend><amendoutend style="2"/>, an agency may not seek to forfeit the property that was seized in <ln numlevel="1" lineno="709" slineno="6-58"/>accordance with the arrest.</subsection><subsection ssid="13-null-27" dnum="5-o" numlevel="1" lineno="710" slineno="6-59" level="1"><display>(5)</display>If a peace officer seizes an individual's firearm as the result of an offense under Section <xref depth="3" refnumber="76-11-218"><ln numlevel="1" lineno="711" slineno="6-60"/>76-11-218</xref>, an agency may not seek to forfeit the individual's firearm if the individual <ln numlevel="1" lineno="712" slineno="6-61"/>may lawfully possess the firearm.</subsection></section></bsec><bsec buid="9" num="77-40a-101" type="amend" src="code" uid="C77-40a-S101_2026050620260506" sort="77 40a01010020260506" numlevel="1" lineno="713" slineno="7-1" sn="7"><section number="77-40a-101" numlevel="1" lineno="714" slineno="7-2" type="amend"><secline lineno="713">Section 7. Section <bold>77-40a-101</bold> is amended to read:</secline><catline lineno="714"><bold>77-40a-101<parens/>. Definitions.</bold></catline><sectionText lineno="715"><tab/>As used in this chapter:</sectionText><subsection ssid="9-null-1" dnum="1-o" numlevel="1" lineno="716" slineno="7-4" level="1"><display>(1)</display>"Agency" means a state, county, or local government entity that generates or maintains <ln numlevel="1" lineno="717" slineno="7-5"/>records relating to an investigation, arrest, detention, or conviction for an offense for <ln numlevel="1" lineno="718" slineno="7-6"/>which expungement may be ordered.</subsection><subsection ssid="9-null-2" dnum="2-o" numlevel="1" lineno="719" slineno="7-7" level="1"><display>(2)</display>"Automatic expungement" means the expungement of records of an investigation, <ln numlevel="1" lineno="720" slineno="7-8"/>arrest, detention, or conviction of an offense without the filing of a petition.</subsection><subsection ssid="9-null-3" dnum="3-o" numlevel="1" lineno="721" slineno="7-9" level="1"><display>(3)</display>"Bureau" means the Bureau of Criminal Identification of the Department of Public <ln numlevel="1" lineno="722" slineno="7-10"/>Safety established in Section <xref depth="3" refnumber="53-10-201">53-10-201</xref>.</subsection><subsection ssid="9-null-4" dnum="4-o" numlevel="1" lineno="723" slineno="7-11" level="1"><display>(4)</display>"Certificate of eligibility" means a document issued by the bureau stating that the <ln numlevel="1" lineno="724" slineno="7-12"/>criminal record and all records of arrest, investigation, and detention associated with a <ln numlevel="1" lineno="725" slineno="7-13"/>case that is the subject of a petition for expungement is eligible for expungement.</subsection><subsection ssid="9-null-5" dnum="5-o" numlevel="1" lineno="726" slineno="7-14" level="1"><display>(5)</display>"Civil accounts receivable" means the same as that term is defined in Section <xref depth="3" refnumber="77-32b-102"><ln numlevel="1" lineno="727" slineno="7-15"/>77-32b-102</xref>.</subsection><subsection ssid="9-null-6" dnum="6-o" numlevel="1" lineno="728" slineno="7-16" level="1"><display>(6)</display>"Civil judgment of restitution" means the same as that term is defined in Section <xref depth="3" refnumber="77-32b-102"><ln numlevel="1" lineno="729" slineno="7-17"/>77-32b-102</xref>.</subsection><subsection ssid="9-null-7" dnum="7-o" numlevel="1" lineno="730" slineno="7-18" level="1"><display>(7)</display>"Civil protective order" means the same as that term is defined in Section <xref depth="3" refnumber="78B-7-102">78B-7-102</xref>.</subsection><subsection ssid="9-null-8" dnum="8-o" numlevel="1" lineno="731" slineno="7-19" level="1"><display>(8)</display>"Clean slate eligible case" means a case that is eligible for automatic expungement <ln numlevel="1" lineno="732" slineno="7-20"/>under Section <xref depth="3" refnumber="77-40a-205">77-40a-205</xref>.</subsection><subsection ssid="9-null-9" dnum="9-o" numlevel="1" lineno="733" slineno="7-21" level="1"><display>(9)</display>"Conviction" means judgment by a criminal court on a verdict or finding of guilty after <ln numlevel="1" lineno="734" slineno="7-22"/>trial, a plea of guilty, or a plea of nolo contendere.</subsection><subsection ssid="9-null-10" dnum="10-o" numlevel="1" lineno="735" slineno="7-23" level="1"><display>(10)</display>"Court" means a district court or a justice court.</subsection><subsection ssid="9-null-11" dnum="11-o" numlevel="1" lineno="736" slineno="7-24" level="1"><display>(11)</display>"Criminal accounts receivable" means the same as that term is defined in Section <xref depth="3" refnumber="77-32b-102"><ln numlevel="1" lineno="737" slineno="7-25"/>77-32b-102</xref>.</subsection><subsection ssid="9-null-12" dnum="12-o" numlevel="1" lineno="738" slineno="7-26" level="1"><display>(12)</display>"Criminal protective order" means the same as that term is defined in Section <xref depth="3" refnumber="78B-7-102"><ln numlevel="1" lineno="739" slineno="7-27"/>78B-7-102</xref>.</subsection><subsection ssid="9-null-13" dnum="13-o" numlevel="1" lineno="740" slineno="7-28" level="1"><display>(13)</display>"Criminal stalking injunction" means the same as that term is defined in Section <xref depth="3" refnumber="78B-7-102"><ln numlevel="1" lineno="741" slineno="7-29"/>78B-7-102</xref>.</subsection><subsection ssid="9-null-14" dnum="14-o" numlevel="1" lineno="742" slineno="7-30" level="1"><display>(14)</display>"Department" means the Department of Public Safety established in Section <xref depth="3" refnumber="53-1-103">53-1-103</xref>.</subsection><subsection ssid="9-null-15" dnum="15-o" numlevel="1" lineno="743" slineno="7-31" level="1"><display>(15)</display>"Drug possession offense" means:<subsection ssid="9-null-16" dnum="a-o" numlevel="1" lineno="744" slineno="7-32" level="2"><display>(a)</display>an offense described in Subsection <xref depth="4" refnumber="58-37-8(2)">58-37-8(2)</xref>, except for:<subsection ssid="9-null-17" dnum="i-o:_-i" numlevel="1" lineno="745" slineno="7-33" ea="erase" anum="0" owner="ahaskell" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1329" style="2" owner="o" level="1" deltag="start">(i)</amend></display><amend anum="0" ea="erase" pairid="6" groupid="5" style="2" owner="ahaskell" level="1">an offense under Subsection <xref depth="4" refnumber="58-37-8(2)(b)(i)">58-37-8(2)(b)(i)</xref>, possession of 100 pounds or more <ln numlevel="1" lineno="746" slineno="7-34"/>of </amend><amend anum="0" ea="erase" pairid="9" groupid="8" style="2" owner="ahaskell" level="1">marijuana</amend><amend anum="0" ea="erase" pairid="10" groupid="9" style="2" owner="ahaskell" level="1" deltag="end">;</amend><amendoutend style="2"/></subsection><subsection ssid="9-null-18" dnum="ii-o:i-i" numlevel="1" lineno="747" slineno="7-35" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1330" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1331" style="1" owner="i" level="1" amendtag="both" space="true">(i)</amend></display>an offense enhanced under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="ahaskell" level="1" deltag="both">58-37-8(2)(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="ahaskell" level="1" amendtag="both" space="true"><xref depth="4" refnumber="58-37-8(2)(f)">58-37-8(2)(f)</xref></amend>, violation <ln numlevel="1" lineno="748" slineno="7-36"/>in a correctional facility; or</subsection><subsection ssid="9-null-19" dnum="iii-o:ii-i" numlevel="1" lineno="749" slineno="7-37" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1331" style="2" owner="o" level="1" deltag="both">(iii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1332" style="1" owner="i" level="1" amendtag="both" space="true">(ii)</amend></display>an offense for driving with a controlled substance illegally in the person's <ln numlevel="1" lineno="750" slineno="7-38"/>body and negligently causing serious bodily injury or death of another, as codified <ln numlevel="1" lineno="751" slineno="7-39"/>before May 4, 2022, Laws of Utah 2021, Chapter 236, Section 1, Subsection <xref depth="4" refnumber="58-37-8(2)(g)"><ln numlevel="1" lineno="752" slineno="7-40"/>58-37-8(2)(g)</xref>;</subsection></subsection><subsection ssid="9-null-20" dnum="b-o" numlevel="1" lineno="753" slineno="7-41" level="2"><display>(b)</display>an offense described in Subsection <xref depth="4" refnumber="58-37a-5(1)">58-37a-5(1)</xref>, use or possession of drug <ln numlevel="1" lineno="754" slineno="7-42"/>paraphernalia;</subsection><subsection ssid="9-null-21" dnum="c-o" numlevel="1" lineno="755" slineno="7-43" level="2"><display>(c)</display>an offense described in Section <xref depth="3" refnumber="58-37b-6">58-37b-6</xref>, possession or use of an imitation <ln numlevel="1" lineno="756" slineno="7-44"/>controlled substance; or</subsection><subsection ssid="9-null-22" dnum="d-o" numlevel="1" lineno="757" slineno="7-45" level="2"><display>(d)</display>any local ordinance which is substantially similar to any of the offenses described in <ln numlevel="1" lineno="758" slineno="7-46"/>this Subsection <xref depth="4" refnumber="77-40a-101(15)">(15)</xref>.</subsection></subsection><subsection ssid="9-null-23" dnum="16-o" numlevel="1" lineno="759" slineno="7-47" level="1" space="false"><display>(16)</display><subsection ssid="9-null-24" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Expunge" means to remove a record from public inspection by:<subsection ssid="9-null-25" dnum="i-o" numlevel="1" lineno="760" slineno="7-48" level="3" tab="1"><display>(i)</display>sealing the record; or</subsection><subsection ssid="9-null-26" dnum="ii-o" numlevel="1" lineno="761" slineno="7-49" level="3" tab="1"><display>(ii)</display>restricting or denying access to the record.</subsection></subsection><subsection ssid="9-null-27" dnum="b-o" numlevel="1" lineno="762" slineno="7-50" level="2"><display>(b)</display>"Expunge" does not include the destruction of a record.</subsection></subsection><subsection ssid="9-null-28" dnum="17-o" numlevel="1" lineno="763" slineno="7-51" level="1"><display>(17)</display>"Indigent" means a financial status that results from a court finding that a petitioner is <ln numlevel="1" lineno="764" slineno="7-52"/>financially unable to pay the fee to file a petition for expungement under Section <xref depth="3" refnumber="78A-2-302"><ln numlevel="1" lineno="765" slineno="7-53"/>78A-2-302</xref>.</subsection><subsection ssid="9-null-29" dnum="18-o" numlevel="1" lineno="766" slineno="7-54" level="1"><display>(18)</display>"Jurisdiction" means a state, district, province, political subdivision, territory, or <ln numlevel="1" lineno="767" slineno="7-55"/>possession of the United States or any foreign country.</subsection><subsection ssid="9-null-30" dnum="19-o" numlevel="1" lineno="768" slineno="7-56" level="1" space="false"><display>(19)</display><subsection ssid="9-null-31" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Minor regulatory offense" means a class B or C misdemeanor offense or a local <ln numlevel="1" lineno="769" slineno="7-57"/>ordinance.</subsection><subsection ssid="9-null-32" dnum="b-o" numlevel="1" lineno="770" slineno="7-58" level="2"><display>(b)</display>"Minor regulatory offense" includes an offense under Section <xref depth="3" refnumber="76-9-110">76-9-110</xref> or <xref depth="3" refnumber="76-9-1106">76-9-1106</xref>.</subsection><subsection ssid="9-null-33" dnum="c-o" numlevel="1" lineno="771" slineno="7-59" level="2"><display>(c)</display>"Minor regulatory offense" does not include:<subsection ssid="9-null-34" dnum="i-o" numlevel="1" lineno="772" slineno="7-60" level="3"><display>(i)</display>any drug possession offense;</subsection><subsection ssid="9-null-35" dnum="ii-o" numlevel="1" lineno="773" slineno="7-61" level="3"><display>(ii)</display>an offense under Title 41, Chapter 6a, Part 5, Driving Under the Influence and <ln numlevel="1" lineno="774" slineno="7-62"/>Reckless Driving;</subsection><subsection ssid="9-null-36" dnum="iii-o" numlevel="1" lineno="775" slineno="7-63" level="3"><display>(iii)</display>an offense under Sections <xref depth="3" refnumber="73-18-13">73-18-13</xref> through <xref depth="3" refnumber="73-18-13.6">73-18-13.6</xref>;</subsection><subsection ssid="9-null-37" dnum="iv-o" numlevel="1" lineno="776" slineno="7-64" level="3"><display>(iv)</display>except as provided in Subsection <xref depth="4" refnumber="77-40a-101(19)(b)">(19)(b)</xref>, an offense under Title 76, Utah <ln numlevel="1" lineno="777" slineno="7-65"/>Criminal Code; or</subsection><subsection ssid="9-null-38" dnum="v-o" numlevel="1" lineno="778" slineno="7-66" level="3"><display>(v)</display>any local ordinance that is substantially similar to an offense listed in Subsections <xref depth="4" refnumber="77-40a-101(19)(c)(i)"><ln numlevel="1" lineno="779" slineno="7-67"/>(19)(c)(i)</xref> through <xref depth="4" refnumber="77-40a-101(iv)">(iv)</xref>.</subsection></subsection></subsection><subsection ssid="9-null-39" dnum="20-o" numlevel="1" lineno="780" slineno="7-68" level="1"><display>(20)</display>"Petitioner" means an individual applying for expungement under this chapter.</subsection><subsection ssid="9-null-40" dnum="21-o" numlevel="1" lineno="781" slineno="7-69" level="1"><display>(21)</display>"Plea in abeyance" means the same as that term is defined in Section <xref depth="3" refnumber="77-2a-1">77-2a-1</xref>.</subsection><subsection ssid="9-null-41" dnum="22-o" numlevel="1" lineno="782" slineno="7-70" level="1"><display>(22)</display>"Record" means a book, letter, document, paper, map, plan, photograph, film, card, <ln numlevel="1" lineno="783" slineno="7-71"/>tape, recording, electronic data, or other documentary material, regardless of physical <ln numlevel="1" lineno="784" slineno="7-72"/>form or characteristics, that:<subsection ssid="9-null-42" dnum="a-o" numlevel="1" lineno="785" slineno="7-73" level="2"><display>(a)</display>is contained in the agency's file regarding the arrest, detention, investigation, <ln numlevel="1" lineno="786" slineno="7-74"/>conviction, sentence, incarceration, probation, or parole of an individual; and</subsection><subsection ssid="9-null-43" dnum="b-o" numlevel="1" lineno="787" slineno="7-75" level="2"><display>(b)</display>is prepared, owned, received, or retained by an agency, including a court.</subsection></subsection><subsection ssid="9-null-44" dnum="23-o" numlevel="1" lineno="788" slineno="7-76" level="1"><display>(23)</display>"Special certificate" means a document issued as described in Subsection <xref depth="4" refnumber="77-40a-304(1)(c)"><ln numlevel="1" lineno="789" slineno="7-77"/>77-40a-304(1)(c)</xref> by the bureau stating that the criminal record and all records of arrest, <ln numlevel="1" lineno="790" slineno="7-78"/>investigation, and detention associated with the case do not clearly demonstrate whether <ln numlevel="1" lineno="791" slineno="7-79"/>the case is eligible for expungement.</subsection><subsection ssid="9-null-45" dnum="24-o" numlevel="1" lineno="792" slineno="7-80" level="1" space="false"><display>(24)</display><subsection ssid="9-null-46" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Traffic offense" means:<subsection ssid="9-null-47" dnum="i-o" numlevel="1" lineno="793" slineno="7-81" level="3" tab="1"><display>(i)</display>an infraction or a class C misdemeanor offense under Title 41, Chapter 1a, Motor <ln numlevel="1" lineno="794" slineno="7-82"/>Vehicle Act;</subsection><subsection ssid="9-null-48" dnum="ii-o" numlevel="1" lineno="795" slineno="7-83" level="3" tab="1"><display>(ii)</display>an infraction, a class B misdemeanor offense, or a class C misdemeanor offense <ln numlevel="1" lineno="796" slineno="7-84"/>under Title 41, Chapter 6a, Traffic Code;</subsection><subsection ssid="9-null-49" dnum="iii-o" numlevel="1" lineno="797" slineno="7-85" level="3" tab="1"><display>(iii)</display>an infraction or a class C misdemeanor offense under Title 41, Chapter 12a, <ln numlevel="1" lineno="798" slineno="7-86"/>Financial Responsibility of Motor Vehicle Owners and Operators Act;</subsection><subsection ssid="9-null-50" dnum="iv-o" numlevel="1" lineno="799" slineno="7-87" level="3" tab="1"><display>(iv)</display>an infraction, a class B misdemeanor offense, or a class C misdemeanor offense <ln numlevel="1" lineno="800" slineno="7-88"/>under Title 53, Chapter 3, Part 2, Driver Licensing Act;</subsection><subsection ssid="9-null-51" dnum="v-o" numlevel="1" lineno="801" slineno="7-89" level="3" tab="1"><display>(v)</display>an infraction, a class B misdemeanor offense, or a class C misdemeanor offense <ln numlevel="1" lineno="802" slineno="7-90"/>under Title 73, Chapter 18, State Boating Act; and</subsection><subsection ssid="9-null-52" dnum="vi-o" numlevel="1" lineno="803" slineno="7-91" level="3" tab="1"><display>(vi)</display>all local ordinances that are substantially similar to an offense listed in <ln numlevel="1" lineno="804" slineno="7-92"/>Subsections <xref depth="4" refnumber="77-40a-101(24)(a)(i)">(24)(a)(i)</xref> through <xref depth="4" refnumber="77-40a-101(iii)">(iii)</xref>.</subsection></subsection><subsection ssid="9-null-53" dnum="b-o" numlevel="1" lineno="805" slineno="7-93" level="2"><display>(b)</display>"Traffic offense" does not include:<subsection ssid="9-null-54" dnum="i-o" numlevel="1" lineno="806" slineno="7-94" level="3"><display>(i)</display>an offense under Title 41, Chapter 6a, Part 5, Driving Under the Influence and <ln numlevel="1" lineno="807" slineno="7-95"/>Reckless Driving;</subsection><subsection ssid="9-null-55" dnum="ii-o" numlevel="1" lineno="808" slineno="7-96" level="3"><display>(ii)</display>an offense under Section <xref depth="3" refnumber="41-12a-302">41-12a-302</xref> for operating a motor vehicle without <ln numlevel="1" lineno="809" slineno="7-97"/>owner's or operator's security;</subsection><subsection ssid="9-null-56" dnum="iii-o" numlevel="1" lineno="810" slineno="7-98" level="3"><display>(iii)</display>an offense under Section <xref depth="3" refnumber="41-12a-303.3">41-12a-303.3</xref> for providing false evidence of owner's or <ln numlevel="1" lineno="811" slineno="7-99"/>operator's security;</subsection><subsection ssid="9-null-57" dnum="iv-o" numlevel="1" lineno="812" slineno="7-100" level="3"><display>(iv)</display>an offense under Sections <xref depth="3" refnumber="73-18-13">73-18-13</xref> through <xref depth="3" refnumber="73-18-13.6">73-18-13.6</xref>; or</subsection><subsection ssid="9-null-58" dnum="v-o" numlevel="1" lineno="813" slineno="7-101" level="3"><display>(v)</display>any local ordinance that is substantially similar to an offense listed in Subsection <xref depth="4" refnumber="77-40a-101(24)(b)(i)"><ln numlevel="1" lineno="814" slineno="7-102"/>(24)(b)(i)</xref> or <xref depth="4" refnumber="77-40a-101(ii)">(ii)</xref>.</subsection></subsection></subsection><subsection ssid="9-null-59" dnum="25-o" numlevel="1" lineno="815" slineno="7-103" level="1"><display>(25)</display>"Traffic offense case" means that each offense in the case is a traffic offense.</subsection></section></bsec><bsec buid="22" num="78A-7-301" type="amend" src="code" uid="C78A-7-S301_2026050620260506" sort="78A07 03010020260506" numlevel="1" lineno="816" slineno="8-1" sn="8"><section number="78A-7-301" numlevel="1" lineno="817" slineno="8-2" type="amend"><secline lineno="816">Section 8. Section <bold>78A-7-301</bold> is amended to read:</secline><catline lineno="817"><bold>78A-7-301<parens/>. Justice Court Technology, Security, and Training Account <ln numlevel="1" lineno="818" slineno="8-3"/>established -- Funding -- Uses.</bold></catline><subsection ssid="22-null-1" dnum="1-o" numlevel="1" lineno="819" slineno="8-4" level="1" placement="noreturn"><display>(1)</display>There is created a restricted account in the General Fund known as the Justice Court <ln numlevel="1" lineno="820" slineno="8-5"/>Technology, Security, and Training Account.</subsection><subsection ssid="22-null-2" dnum="2-o" numlevel="1" lineno="821" slineno="8-6" level="1"><display>(2)</display>The state treasurer shall deposit in the account:<subsection ssid="22-null-3" dnum="a-o" numlevel="1" lineno="822" slineno="8-7" level="2"><display>(a)</display>money collected from the surcharge established in Subsection <xref depth="4" refnumber="78A-7-122(4)(b)(iii)" start="0">78A-7-122(4)(b)(iii)</xref>; <ln numlevel="1" lineno="823" slineno="8-8"/>and</subsection><subsection ssid="22-null-4" dnum="b-o" numlevel="1" lineno="824" slineno="8-9" level="2"><display>(b)</display>the administrative fee from<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="37" groupid="32" style="2" owner="ahaskell" level="1" deltag="both"> </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="35" groupid="30" style="1" owner="ahaskell" level="1" amendtag="both" space="true">:</amend><subsection ssid="22-12" dnum="_-o:i-i" numlevel="1" lineno="825" slineno="8-10" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1376" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>a deferred prosecution or traffic school deferred prosecution under Subsection <xref depth="4" refnumber="77-2-4.2(5)" start="0"><ln numlevel="1" lineno="826" slineno="8-11"/>77-2-4.2(5)</xref> or <xref depth="4" refnumber="77-2-4.2(6)" start="0">(6)</xref><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="39" groupid="34" style="2" owner="ahaskell" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="45" groupid="39" style="1" owner="ahaskell" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="22-13" dnum="_-o:ii-i" numlevel="1" lineno="827" slineno="8-12" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1377" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="44" groupid="38" style="1" owner="ahaskell" level="1" amendtag="end">a deferred prosecution for certain marijuana use or possession offenses under <ln numlevel="1" lineno="828" slineno="8-13"/>Section <xref depth="3" refnumber="77-2-4.6">77-2-4.6</xref>.</amend></subsection></subsection></subsection><subsection ssid="22-null-5" dnum="3-o" numlevel="1" lineno="829" slineno="8-14" level="1"><display>(3)</display>Money shall be appropriated from the account to the Administrative Office of the <ln numlevel="1" lineno="830" slineno="8-15"/>Courts to be used for:<subsection ssid="22-null-6" dnum="a-o" numlevel="1" lineno="831" slineno="8-16" level="2"><display>(a)</display>audit, technology, security, and training needs in justice courts throughout the state;</subsection><subsection ssid="22-null-7" dnum="b-o" numlevel="1" lineno="832" slineno="8-17" level="2"><display>(b)</display>additional compensation for presiding judges and associate presiding judges for <ln numlevel="1" lineno="833" slineno="8-18"/>justice courts under Section <xref depth="3" refnumber="78A-7-209.5" start="0">78A-7-209.5</xref>; and</subsection><subsection ssid="22-null-8" dnum="c-o" numlevel="1" lineno="834" slineno="8-19" level="2"><display>(c)</display>costs to implement, operate, and maintain<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="24" groupid="21" style="2" owner="ahaskell" level="1" deltag="both"> </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="22" groupid="19" style="1" owner="ahaskell" level="1" amendtag="both" space="true">:</amend><subsection ssid="22-11" dnum="_-o:i-i" numlevel="1" lineno="835" slineno="8-20" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1382" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>deferred prosecution and traffic school deferred prosecution <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="48" groupid="42" style="2" owner="ahaskell" level="1" deltag="both">pursuant to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="47" groupid="41" style="1" owner="ahaskell" level="1" amendtag="both" space="true">in <ln numlevel="1" lineno="836" slineno="8-21"/>accordance with</amend> Subsections <xref depth="4" refnumber="77-2-4.2(5)" start="0">77-2-4.2(5)</xref> and <xref depth="4" refnumber="77-2-4.2(6)" start="0">(6)</xref><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="16" groupid="14" style="2" owner="ahaskell" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="14" groupid="12" style="1" owner="ahaskell" level="1" amendtag="both" space="true">;
