Section <bold>76-3-301.7</bold> is amended to read:</secline><catline lineno="25"><bold>76-3-301.7<parens/>. Compensatory service -- Credit for cost of court-ordered treatment <ln numlevel="1" lineno="26" slineno="1-3"/>or course.</bold></catline><subsection ssid="5-null-1" dnum="1-o" numlevel="1" lineno="27" slineno="1-4" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="5-null-2" dnum="a-o" numlevel="1" lineno="28" slineno="1-5" level="2"><display>(a)</display>"Compensatory service" means service or unpaid work performed by a person, in <ln numlevel="1" lineno="29" slineno="1-6"/>lieu of the payment of a criminal fine<amend anum="0" ea="amend" pairid="8" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="both"> or a fee for a plea in abeyance described in <ln numlevel="1" lineno="30" slineno="1-7"/>Section <xref depth="3" refnumber="77-2a-1.5">77-2a-1.5</xref></amend>, for:<subsection ssid="5-null-3" dnum="i-o" numlevel="1" lineno="31" slineno="1-8" level="3"><display>(i)</display>a state or local government agency;</subsection><subsection ssid="5-null-4" dnum="ii-o" numlevel="1" lineno="32" slineno="1-9" level="3"><display>(ii)</display>an entity that is approved as a nonprofit organization under Section 501(c) of the <ln numlevel="1" lineno="33" slineno="1-10"/>Internal Revenue Code; or</subsection><subsection ssid="5-null-5" dnum="iii-o" numlevel="1" lineno="34" slineno="1-11" level="3"><display>(iii)</display>any other entity or organization if prior approval is obtained from the court.</subsection></subsection><subsection ssid="5-null-6" dnum="b-o" numlevel="1" lineno="35" slineno="1-12" level="2"><display>(b)</display>"Eligible offense" means a criminal conviction, including a traffic offense.</subsection></subsection><subsection ssid="5-null-7" dnum="2-o" numlevel="1" lineno="36" slineno="1-13" level="1" space="false"><display>(2)</display><subsection ssid="5-30" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>When a defendant is sentenced to pay a fine for an eligible offense<amend anum="0" ea="amend" pairid="9" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="both"> or a fee for a <ln numlevel="1" lineno="37" slineno="1-14"/>plea in abeyance described in Section <xref depth="3" refnumber="77-2a-1.5">77-2a-1.5</xref></amend>, the court shall consider allowing the <ln numlevel="1" lineno="38" slineno="1-15"/>defendant to complete compensatory service in lieu of the payment of the fine or <ln numlevel="1" lineno="39" slineno="1-16"/>account receivable<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="19" groupid="17" style="2" owner="jchristopherson" level="1" deltag="both">, exclusive of any victim restitution imposed</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="43" groupid="40" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"> or the fee</amend>.</subsection><subsection ssid="5-31" dnum="_-o:b-i" numlevel="1" lineno="40" slineno="1-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="end">Notwithstanding Subsection <xref depth="4" refnumber="76-3-301.7(2)(a)">(2)(a)</xref>, the court may not allow a defendant to complete <ln numlevel="1" lineno="41" slineno="1-18"/>compensatory service in lieu of the payment of any victim restitution that is imposed <ln numlevel="1" lineno="42" slineno="1-19"/>for an eligible offense.</amend></subsection></subsection><subsection ssid="5-null-8" dnum="3-o" numlevel="1" lineno="43" slineno="1-20" level="1"><display>(3)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="37" groupid="34" style="2" owner="jchristopherson" level="1" deltag="both">A</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="30" groupid="27" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">The court shall inform a</amend> defendant who intends to forfeit bail<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="46" groupid="43" style="2" owner="jchristopherson" level="1" deltag="both"> or who</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="45" groupid="42" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">, who</amend> is <ln numlevel="1" lineno="44" slineno="1-21"/>ordered to pay a fine by the court for an eligible offense<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="39" groupid="36" style="2" owner="jchristopherson" level="1" deltag="both"> shall be informed by the court</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="34" groupid="31" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">, <ln numlevel="1" lineno="45" slineno="1-22"/>or who is required to pay a fee for a plea in abeyance described in Section <xref depth="3" refnumber="77-2a-1.5">77-2a-1.5</xref> for <ln numlevel="1" lineno="46" slineno="1-23"/>an eligible offense,</amend> of the opportunity to perform compensatory service in lieu of the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="41" groupid="38" style="2" owner="jchristopherson" level="1" deltag="both"><ln numlevel="1" lineno="47" slineno="1-24"/>fine or bail</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="35" groupid="32" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">fine, fee, or bail</amend> amount.</subsection><subsection ssid="5-null-9" dnum="4-o" numlevel="1" lineno="48" slineno="1-25" level="1"><display>(4)</display>The court shall credit timely completed compensatory service reported in accordance <ln numlevel="1" lineno="49" slineno="1-26"/>with Subsection <xref depth="4" refnumber="76-3-301.7(5)" start="0">(5)</xref> against the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="42" groupid="39" style="2" owner="jchristopherson" level="1" deltag="both">fine or bail</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="36" groupid="33" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">fine, fee, or bail</amend> amount at the rate of $12 <ln numlevel="1" lineno="50" slineno="1-27"/>per hour and shall allow the defendant a reasonable amount of time to complete the <ln numlevel="1" lineno="51" slineno="1-28"/>service.</subsection><subsection ssid="5-null-10" dnum="5-o" numlevel="1" lineno="52" slineno="1-29" level="1" space="false"><display>(5)</display><subsection ssid="5-null-11" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The court shall provide the defendant with instructions that inform the <ln numlevel="1" lineno="53" slineno="1-30"/>organization:<subsection ssid="5-null-12" dnum="i-o" numlevel="1" lineno="54" slineno="1-31" level="3" tab="1"><display>(i)</display>about the requirements in Subsection <xref depth="4" refnumber="76-3-301.7(5)(b)" start="0">(5)(b)</xref>; and</subsection><subsection ssid="5-null-13" dnum="ii-o" numlevel="1" lineno="55" slineno="1-32" level="3" tab="1"><display>(ii)</display>that making a written false statement to the court about the defendant's <ln numlevel="1" lineno="56" slineno="1-33"/>compensatory service is punishable as a class B misdemeanor pursuant to Section <xref depth="3" refnumber="76-8-504" start="0"><ln numlevel="1" lineno="57" slineno="1-34"/>76-8-504</xref>.</subsection></subsection><subsection ssid="5-null-14" dnum="b-o" numlevel="1" lineno="58" slineno="1-35" level="2"><display>(b)</display>The defendant shall report compensatory service hours to the court in a letter that:<subsection ssid="5-null-15" dnum="i-o" numlevel="1" lineno="59" slineno="1-36" level="3"><display>(i)</display>is on the organization's official letterhead and includes contact information for the <ln numlevel="1" lineno="60" slineno="1-37"/>organization's representative;</subsection><subsection ssid="5-null-16" dnum="ii-o" numlevel="1" lineno="61" slineno="1-38" level="3"><display>(ii)</display>specifies the number of hours for which the defendant provided service;</subsection><subsection ssid="5-null-17" dnum="iii-o" numlevel="1" lineno="62" slineno="1-39" level="3"><display>(iii)</display>contains a brief description of what the service involved; and</subsection><subsection ssid="5-null-18" dnum="iv-o" numlevel="1" lineno="63" slineno="1-40" level="3" space="false"><display>(iv)</display><subsection ssid="5-null-19" dnum="A-o" level="4" placement="sameline"><display>(A)</display>is signed by an authorized representative of the organization; or</subsection><subsection ssid="5-null-20" dnum="B-o" numlevel="1" lineno="64" slineno="1-41" level="4"><display>(B)</display>is in a form otherwise acceptable to the court.</subsection></subsection></subsection></subsection><subsection ssid="5-null-21" dnum="6-o" numlevel="1" lineno="65" slineno="1-42" level="1"><display>(6)</display>The court may refuse to accept compensatory service:<subsection ssid="5-null-22" dnum="a-o" numlevel="1" lineno="66" slineno="1-43" level="2"><display>(a)</display>completed prior to the date of sentencing;</subsection><subsection ssid="5-null-23" dnum="b-o" numlevel="1" lineno="67" slineno="1-44" level="2"><display>(b)</display>that has been submitted to another court for credit; or</subsection><subsection ssid="5-null-24" dnum="c-o" numlevel="1" lineno="68" slineno="1-45" level="2"><display>(c)</display>completed at an agency or organization or is a type of service that is specifically <ln numlevel="1" lineno="69" slineno="1-46"/>prohibited by the court.</subsection></subsection><subsection ssid="5-null-25" dnum="7-o" numlevel="1" lineno="70" slineno="1-47" level="1"><display>(7)</display>In addition to any other provision of this section, a court may order that the unpaid <ln numlevel="1" lineno="71" slineno="1-48"/>amount of the criminal accounts receivable, that is not the principal or interest amount <ln numlevel="1" lineno="72" slineno="1-49"/>owed for restitution, be reduced in the amount of the cost of any treatment or course if:<subsection ssid="5-null-26" dnum="a-o" numlevel="1" lineno="73" slineno="1-50" level="2"><display>(a)</display>the treatment or course was ordered by the court as part of the case;</subsection><subsection ssid="5-null-27" dnum="b-o" numlevel="1" lineno="74" slineno="1-51" level="2"><display>(b)</display>the defendant has completed the court's requirements related to the treatment or <ln numlevel="1" lineno="75" slineno="1-52"/>course;</subsection><subsection ssid="5-null-28" dnum="c-o" numlevel="1" lineno="76" slineno="1-53" level="2"><display>(c)</display>the defendant provides proof that the defendant completed the court's requirements <ln numlevel="1" lineno="77" slineno="1-54"/>and paid the cost of the treatment or course; and</subsection><subsection ssid="5-null-29" dnum="d-o" numlevel="1" lineno="78" slineno="1-55" level="2"><display>(d)</display>the court finds that payment of an unpaid amount of a criminal accounts receivable <ln numlevel="1" lineno="79" slineno="1-56"/>will impose manifest hardship on the defendant or the defendant's family.</subsection></subsection></section></bsec><bsec buid="3" num="77-2a-1.5" type="enact" src="code" uid="C77-2a-S1.5_2026050620260506" sort="77 02a00010520260506" numlevel="1" lineno="80" slineno="2-1" sn="2"><section numlevel="1" lineno="81" slineno="2-2" number="77-2a-1.5" type="enact"><secline lineno="80">Section 2. Section <bold>77-2a-1.5</bold> is enacted to read:</secline><catline lineno="81"><bold>77-2a-1.5<parens/>. Offer of a plea in abeyance.</bold></catline><subsection ssid="3-10" dnum="_-o:1-i" numlevel="1" lineno="82" slineno="2-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1031" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="49" groupid="36" style="1" owner="jchristopherson" level="1" amendtag="end">As used in this section, "convicted" means the same as that term is defined in Section <xref depth="3" refnumber="76-3-201"><ln numlevel="1" lineno="83" slineno="2-4"/>76-3-201</xref>.</amend></subsection><subsection ssid="3-9" dnum="_-o:2-i" numlevel="1" lineno="84" slineno="2-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1032" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="45" groupid="34" style="1" owner="jchristopherson" level="1" amendtag="end">A prosecuting attorney shall offer a plea in abeyance to a defendant if:</amend><subsection ssid="3-6" dnum="_-o:a-i" numlevel="1" lineno="85" slineno="2-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1033" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="37" groupid="28" style="1" owner="jchristopherson" level="1" amendtag="end">the individual has never been convicted of an offense;</amend></subsection><subsection ssid="3-3" dnum="_-o:b-i" numlevel="1" lineno="86" slineno="2-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1034" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="19" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="end">the individual is charged with:</amend><subsection ssid="3-4" dnum="_-o:i-i" numlevel="1" lineno="87" slineno="2-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1035" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="end">retail theft, as described in Section <xref depth="3" refnumber="76-6-602">76-6-602</xref>;</amend></subsection><subsection ssid="3-7" dnum="_-o:ii-i" numlevel="1" lineno="88" slineno="2-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1036" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="41" groupid="31" style="1" owner="jchristopherson" level="1" amendtag="end">the unlawful purchase, possession, or consumption of alcohol by a minor, as <ln numlevel="1" lineno="89" slineno="2-10"/>described in Section <xref depth="3" refnumber="32B-4-409">32B-4-409</xref>; or</amend></subsection><subsection ssid="3-5" dnum="_-o:iii-i" numlevel="1" lineno="90" slineno="2-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1037" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="32" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="end">a misdemeanor offense for possession of a controlled substance in violation of <ln numlevel="1" lineno="91" slineno="2-12"/>Subsection <xref depth="4" refnumber="58-37-8(2)(a)(i)">58-37-8(2)(a)(i)</xref>; and</amend></subsection></subsection><subsection ssid="3-8" dnum="_-o:c-i" numlevel="1" lineno="92" slineno="2-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1038" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="42" groupid="32" style="1" owner="jchristopherson" level="1" amendtag="end">the individual was 18 years old at the time of the offense.</amend></subsection></subsection></section></bsec><bsec buid="1" num="77-2a-2" type="amend" src="code" uid="C77-2a-S2_2026050620260506" sort="77 02a00020020260506" numlevel="1" lineno="93" slineno="3-1" sn="3"><section number="77-2a-2" numlevel="1" lineno="94" slineno="3-2" type="amend"><secline lineno="93">Section 3. Section <bold>77-2a-2</bold> is amended to read:</secline><catline lineno="94"><bold>77-2a-2<parens/>. Plea in abeyance agreement -- Negotiation -- Contents -- Terms of <ln numlevel="1" lineno="95" slineno="3-3"/>agreement -- Waiver of time for sentencing.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="96" slineno="3-4" level="1" placement="noreturn"><display>(1)</display>At any time after acceptance of a plea of guilty or no contest but before entry of <ln numlevel="1" lineno="97" slineno="3-5"/>judgment of conviction and imposition of sentence, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="15" groupid="14" style="2" owner="jchristopherson" level="1" deltag="both">the court may, </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="11" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">and </amend>upon motion of <ln numlevel="1" lineno="98" slineno="3-6"/>both the prosecuting attorney and the defendant, <amend anum="0" ea="amend" pairid="17" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="both">the court may </amend>hold the plea in abeyance <ln numlevel="1" lineno="99" slineno="3-7"/>and not enter judgment of conviction against the defendant nor impose sentence upon <ln numlevel="1" lineno="100" slineno="3-8"/>the defendant within the time periods contained in Rule 22(a)<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both">,</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"> of the</amend> Utah Rules of <ln numlevel="1" lineno="101" slineno="3-9"/>Criminal Procedure.</subsection><subsection ssid="1-null-2" dnum="2-o" numlevel="1" lineno="102" slineno="3-10" level="1"><display>(2)</display>A defendant shall be represented by counsel during negotiations for a plea in abeyance <ln numlevel="1" lineno="103" slineno="3-11"/>and at the time of acknowledgment and affirmation of any plea in abeyance agreement <ln numlevel="1" lineno="104" slineno="3-12"/>unless the defendant knowingly and intelligently waives the defendant's right to counsel.</subsection><subsection ssid="1-null-3" dnum="3-o" numlevel="1" lineno="105" slineno="3-13" level="1"><display>(3)</display>A defendant has the right to be represented by counsel at any court hearing relating to a <ln numlevel="1" lineno="106" slineno="3-14"/>plea in abeyance agreement.</subsection><subsection ssid="1-null-4" dnum="4-o" numlevel="1" lineno="107" slineno="3-15" level="1" space="false"><display>(4)</display><subsection ssid="1-null-5" dnum="a-o" level="2" placement="sameline"><display>(a)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="22" groupid="21" style="2" owner="jchristopherson" level="1" deltag="both">Any </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="20" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Subject to Subsection <xref depth="4" refnumber="77-2a-2(6)">(6)</xref>, a </amend>plea in abeyance agreement entered into <ln numlevel="1" lineno="108" slineno="3-16"/>between the prosecution and the defendant and approved by the court shall<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="23" groupid="22" style="2" owner="jchristopherson" level="1" deltag="both">, subject <ln numlevel="1" lineno="109" slineno="3-17"/>to Subsection <xref refnumber="77-2a-2(7)" depth="4">(7)</xref>,</amend><amendoutend style="2"/> include a full, detailed recitation of the requirements and <ln numlevel="1" lineno="110" slineno="3-18"/>conditions agreed to by the defendant and the reason for requesting the court to hold <ln numlevel="1" lineno="111" slineno="3-19"/>the plea in abeyance.</subsection><subsection ssid="1-null-6" dnum="b-o" numlevel="1" lineno="112" slineno="3-20" level="2"><display>(b)</display>If the plea is to a felony or any combination of misdemeanors and felonies, the <ln numlevel="1" lineno="113" slineno="3-21"/>agreement shall be in writing and shall, before acceptance by the court, be executed <ln numlevel="1" lineno="114" slineno="3-22"/>by the prosecuting attorney, the defendant, and the defendant's counsel in the <ln numlevel="1" lineno="115" slineno="3-23"/>presence of the court.</subsection></subsection><subsection ssid="1-null-7" dnum="5-o" numlevel="1" lineno="116" slineno="3-24" level="1" space="false"><display>(5)</display><subsection ssid="1-null-8" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="26" groupid="25" style="2" owner="jchristopherson" level="1" deltag="both">Subsection <xref depth="4" refnumber="77-2a-2(5)(b)">(5)(b)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="21" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Subsections <xref depth="4" refnumber="77-2a-2(5)(b)">(5)(b)</xref> and <xref depth="4" refnumber="77-2a-2(5)(c)">(5)(c)</xref></amend>, a plea may <ln numlevel="1" lineno="117" slineno="3-25"/>not be held in abeyance for a period longer than 18 months if the plea is to any class <ln numlevel="1" lineno="118" slineno="3-26"/>of misdemeanor or longer than three years if the plea is to any degree of felony or to <ln numlevel="1" lineno="119" slineno="3-27"/>any combination of misdemeanors and felonies.</subsection><subsection ssid="1-null-9" dnum="b-o" numlevel="1" lineno="120" slineno="3-28" level="2" space="false"><display>(b)</display><subsection ssid="1-null-10" dnum="i-o" level="3" placement="sameline"><display>(i)</display>For a plea in abeyance agreement that the Division of Adult Probation and <ln numlevel="1" lineno="121" slineno="3-29"/>Parole created in Section <xref depth="3" refnumber="64-14-202">64-14-202</xref> supervises, the plea may not be held in <ln numlevel="1" lineno="122" slineno="3-30"/>abeyance for a period longer than the initial term of probation required under the <ln numlevel="1" lineno="123" slineno="3-31"/>adult sentencing and supervision length guidelines, as defined in Section <xref depth="3" refnumber="63M-7-401.1"><ln numlevel="1" lineno="124" slineno="3-32"/>63M-7-401.1</xref>, if the initial term of probation is shorter than the period required <ln numlevel="1" lineno="125" slineno="3-33"/>under Subsection <xref depth="4" refnumber="77-2a-2(5)(a)">(5)(a)</xref>.</subsection><subsection ssid="1-null-11" dnum="ii-o" numlevel="1" lineno="126" slineno="3-34" level="3"><display>(ii)</display>Subsection <xref depth="4" refnumber="77-2a-2(5)(b)(i)">(5)(b)(i)</xref> does not:<subsection ssid="1-null-12" dnum="A-o" numlevel="1" lineno="127" slineno="3-35" level="4"><display>(A)</display>apply to a plea that is held in abeyance in a drug court created under Title <ln numlevel="1" lineno="128" slineno="3-36"/>78A, Chapter 5, Part 2, Drug Court, or a problem solving court approved by <ln numlevel="1" lineno="129" slineno="3-37"/>the Judicial Council; or</subsection><subsection ssid="1-null-13" dnum="B-o" numlevel="1" lineno="130" slineno="3-38" level="4"><display>(B)</display>prohibit court supervision of a plea in abeyance agreement after the day on <ln numlevel="1" lineno="131" slineno="3-39"/>which the Division of Adult Probation and Parole supervision described in <ln numlevel="1" lineno="132" slineno="3-40"/>Subsection <xref depth="4" refnumber="77-2a-2(5)(b)(i)">(5)(b)(i)</xref> ends and before the day on which the plea in abeyance <ln numlevel="1" lineno="133" slineno="3-41"/>agreement ends.</subsection></subsection></subsection><subsection ssid="1-null-14" dnum="6-o:c-i" numlevel="1" lineno="134" slineno="3-42" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1052" style="2" owner="o" level="1" deltag="both">(6)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1053" style="1" owner="i" level="1" amendtag="both" space="true">(c)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="36" groupid="34" style="2" owner="jchristopherson" level="1" deltag="both">Notwithstanding Subsection <xref depth="4" refnumber="77-2a-2(5)">(5)</xref>, a</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="34" groupid="32" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">A</amend> plea may be held in abeyance for up to <ln numlevel="1" lineno="135" slineno="3-43"/>two years if the plea is to any class of misdemeanor and the plea in abeyance <ln numlevel="1" lineno="136" slineno="3-44"/>agreement includes a condition that the defendant participate in a problem solving <ln numlevel="1" lineno="137" slineno="3-45"/>court approved by the Judicial Council.</subsection></subsection><subsection ssid="1-null-15" dnum="7-o:6-i" numlevel="1" lineno="138" slineno="3-46" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1053" style="2" owner="o" level="1" deltag="both">(7)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1054" style="1" owner="i" level="1" amendtag="start" space="true">(6)</amend></display><subsection ssid="1-24" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1054" style="1" owner="i" level="1" amendtag="end">(a)</amend></display>A plea in abeyance agreement may not:<subsection ssid="1-null-16" dnum="a-o:i-i" numlevel="1" lineno="139" slineno="3-47" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1055" style="2" owner="o" level="1" deltag="both">(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1056" style="1" owner="i" level="1" amendtag="both" space="true">(i)</amend></display>be approved unless the defendant, before the court, and any written <ln numlevel="1" lineno="140" slineno="3-48"/>agreement, knowingly and intelligently waives time for sentencing as designated <ln numlevel="1" lineno="141" slineno="3-49"/>in Rule 22(a)<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="39" groupid="37" style="2" owner="jchristopherson" level="1" deltag="both">,</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="35" groupid="33" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"> of the</amend> Utah Rules of Criminal Procedure; or</subsection><subsection ssid="1-null-17" dnum="b-o:ii-i" numlevel="1" lineno="142" slineno="3-50" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1056" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1057" style="1" owner="i" level="1" amendtag="both" space="true">(ii)</amend></display>notwithstanding any other provision of law, include as part of the <ln numlevel="1" lineno="143" slineno="3-51"/>requirements and conditions agreed to by the defendant that the defendant will <ln numlevel="1" lineno="144" slineno="3-52"/>forfeit a firearm owned by the defendant if the offense the defendant will plea to is <ln numlevel="1" lineno="145" slineno="3-53"/>not an offense that would make the defendant a restricted person under Section <xref depth="3" refnumber="76-11-302"><ln numlevel="1" lineno="146" slineno="3-54"/>76-11-302</xref> or <xref refnumber="76-11-303" depth="4">76-11-303</xref> or federal law.</subsection></subsection><subsection ssid="1-19" dnum="_-o:b-i" numlevel="1" lineno="147" slineno="3-55" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1057" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="31" groupid="30" style="1" owner="jchristopherson" level="1" amendtag="end">For a plea in abeyance described in Section <xref depth="3" refnumber="77-2a-1.5">77-2a-1.5</xref>:</amend><subsection ssid="1-28" dnum="_-o:i-i" numlevel="1" lineno="148" slineno="3-56" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1058" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="85" groupid="73" style="1" owner="jchristopherson" level="1" amendtag="end">the plea in abeyance agreement may not:</amend><subsection ssid="1-25" dnum="_-o:A-i" numlevel="1" lineno="149" slineno="3-57" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1059" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="70" groupid="61" style="1" owner="jchristopherson" level="1" amendtag="end">require incarceration of the defendant; or</amend></subsection><subsection ssid="1-26" dnum="_-o:B-i" numlevel="1" lineno="150" slineno="3-58" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1060" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="75" groupid="65" style="1" owner="jchristopherson" level="1" amendtag="end">require the defendant to pay a fee of $200 or more; and</amend></subsection></subsection><subsection ssid="1-29" dnum="_-o:ii-i" numlevel="1" lineno="151" slineno="3-59" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1061" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="90" groupid="77" style="1" owner="jchristopherson" level="1" amendtag="end">the plea in abeyance agreement shall allow the defendant to perform <ln numlevel="1" lineno="152" slineno="3-60"/>compensatory service as described in Section <xref depth="3" refnumber="76-3-301.7">76-3-301.7</xref> in lieu of the fee <ln numlevel="1" lineno="153" slineno="3-61"/>described in Subsection <xref depth="4" refnumber="77-2a-2(6)(b)(i)(b)">(6)(b)(i)(B)</xref>.</amend></subsection></subsection></subsection></section></bsec><bsec buid="6" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="154" slineno="4-1" sn="4"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="154">Section 4.  <bold>Effective
