Section <bold>26B-4-514</bold> is amended to read:</secline><catline lineno="21"><bold>26B-4-514<parens/>. Opiate abuse prevention pamphlet.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="22" slineno="1-3" level="1" placement="noreturn"><display>(1)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="6" groupid="7" style="2" owner="jchristopherson" level="1" deltag="both">As funding is available, the</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="3" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">The</amend> department shall <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="8" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">produce and distribute</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="4" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">create and <ln numlevel="1" lineno="23" slineno="1-4"/>make available online</amend>, in conjunction with the Office of Substance Use and Mental <ln numlevel="1" lineno="24" slineno="1-5"/>Health, a pamphlet about opiates that includes information regarding:<subsection ssid="1-null-2" dnum="a-o" numlevel="1" lineno="25" slineno="1-6" level="2"><display>(a)</display>the risk of dependency and addiction;</subsection><subsection ssid="1-null-3" dnum="b-o" numlevel="1" lineno="26" slineno="1-7" level="2"><display>(b)</display>methods for proper storage and disposal;</subsection><subsection ssid="1-null-4" dnum="c-o" numlevel="1" lineno="27" slineno="1-8" level="2"><display>(c)</display>alternative options for pain management;</subsection><subsection ssid="1-null-5" dnum="d-o" numlevel="1" lineno="28" slineno="1-9" level="2"><display>(d)</display>the benefits of and ways to obtain naloxone; and</subsection><subsection ssid="1-null-6" dnum="e-o" numlevel="1" lineno="29" slineno="1-10" level="2"><display>(e)</display>resources if the patient believes that the patient has a substance use disorder.</subsection></subsection><subsection ssid="1-null-7" dnum="2-o" numlevel="1" lineno="30" slineno="1-11" level="1"><display>(2)</display>The pamphlet described in Subsection <xref depth="4" refnumber="26B-4-514(1)" start="0">(1)</xref> shall be:<subsection ssid="1-null-8" dnum="a-o" numlevel="1" lineno="31" slineno="1-12" level="2"><display>(a)</display>evaluated periodically for effectiveness at conveying necessary information and <ln numlevel="1" lineno="32" slineno="1-13"/>revised accordingly;</subsection><subsection ssid="1-null-9" dnum="b-o" numlevel="1" lineno="33" slineno="1-14" level="2"><display>(b)</display>written in simple and understandable language; and</subsection><subsection ssid="1-null-10" dnum="c-o" numlevel="1" lineno="34" slineno="1-15" level="2"><display>(c)</display>available in English and other languages that the department determines to be <ln numlevel="1" lineno="35" slineno="1-16"/>appropriate and necessary.</subsection></subsection></section></bsec><bsec buid="3" num="58-37-7" type="amend" src="code" uid="C58-37-S7_2026050620260506" sort="58 37 00070020260506" numlevel="1" lineno="36" slineno="2-1" sn="2"><section number="58-37-7" numlevel="1" lineno="37" slineno="2-2" type="amend"><secline lineno="36">Section 2. Section <bold>58-37-7</bold> is amended to read:</secline><catline lineno="37"><bold>58-37-7<parens/>. Labeling and packaging controlled substance -- Informational <ln numlevel="1" lineno="38" slineno="2-3"/>pamphlet for opiates -- Naloxone education and offer to dispense.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="39" slineno="2-4" level="1" placement="noreturn"><display>(1)</display>A person licensed pursuant to this act may not distribute a controlled substance unless it <ln numlevel="1" lineno="40" slineno="2-5"/>is packaged and labeled in compliance with the requirements of Section 305 of the <ln numlevel="1" lineno="41" slineno="2-6"/>Federal Comprehensive Drug Abuse Prevention and Control Act of 1970.</subsection><subsection ssid="3-null-2" dnum="2-o" numlevel="1" lineno="42" slineno="2-7" level="1"><display>(2)</display>No person except a pharmacist for the purpose of filling a prescription shall alter, <ln numlevel="1" lineno="43" slineno="2-8"/>deface, or remove any label affixed by the manufacturer.</subsection><subsection ssid="3-null-3" dnum="3-o" numlevel="1" lineno="44" slineno="2-9" level="1"><display>(3)</display>Whenever a pharmacy sells or dispenses any controlled substance on a prescription <ln numlevel="1" lineno="45" slineno="2-10"/>issued by a practitioner, the pharmacy shall affix to the container in which the substance <ln numlevel="1" lineno="46" slineno="2-11"/>is sold or dispensed:<subsection ssid="3-null-4" dnum="a-o" numlevel="1" lineno="47" slineno="2-12" level="2"><display>(a)</display>a label showing the:<subsection ssid="3-null-5" dnum="i-o" numlevel="1" lineno="48" slineno="2-13" level="3"><display>(i)</display>pharmacy name and address;</subsection><subsection ssid="3-null-6" dnum="ii-o" numlevel="1" lineno="49" slineno="2-14" level="3"><display>(ii)</display>serial number; and</subsection><subsection ssid="3-null-7" dnum="iii-o" numlevel="1" lineno="50" slineno="2-15" level="3"><display>(iii)</display>date of initial filling;</subsection></subsection><subsection ssid="3-null-8" dnum="b-o" numlevel="1" lineno="51" slineno="2-16" level="2"><display>(b)</display>the prescription number, the name of the patient, or if the patient is an animal, the <ln numlevel="1" lineno="52" slineno="2-17"/>name of the owner of the animal and the species of the animal;</subsection><subsection ssid="3-null-9" dnum="c-o" numlevel="1" lineno="53" slineno="2-18" level="2"><display>(c)</display>the name of the practitioner by whom the prescription was written;</subsection><subsection ssid="3-null-10" dnum="d-o" numlevel="1" lineno="54" slineno="2-19" level="2"><display>(d)</display>any directions stated on the prescription; and</subsection><subsection ssid="3-null-11" dnum="e-o" numlevel="1" lineno="55" slineno="2-20" level="2"><display>(e)</display>any directions required by rules and regulations promulgated by the department.</subsection></subsection><subsection ssid="3-null-12" dnum="4-o" numlevel="1" lineno="56" slineno="2-21" level="1"><display>(4)</display>Whenever a pharmacy sells or dispenses a Schedule II or Schedule III controlled <ln numlevel="1" lineno="57" slineno="2-22"/>substance that is an opiate, the pharmacy shall:<subsection ssid="3-null-13" dnum="a-o" numlevel="1" lineno="58" slineno="2-23" level="2"><display>(a)</display>affix a warning to the container or the lid for the container in which the substance is <ln numlevel="1" lineno="59" slineno="2-24"/>sold or dispensed that contains the following text:<subsection ssid="3-null-14" dnum="i-o" numlevel="1" lineno="60" slineno="2-25" level="3"><display>(i)</display>"Caution: Opioid. Risk of overdose and addiction"; or</subsection><subsection ssid="3-null-15" dnum="ii-o" numlevel="1" lineno="61" slineno="2-26" level="3"><display>(ii)</display>any other language that is approved by the Department of Health and Human <ln numlevel="1" lineno="62" slineno="2-27"/>Services;</subsection></subsection><subsection ssid="3-null-16" dnum="b-o" numlevel="1" lineno="63" slineno="2-28" level="2"><display>(b)</display>beginning January 1, 2024:<subsection ssid="3-null-17" dnum="i-o" numlevel="1" lineno="64" slineno="2-29" level="3"><display>(i)</display>offer to counsel the patient or the patient's representative on the use and <ln numlevel="1" lineno="65" slineno="2-30"/>availability of an opiate antagonist as defined in Section <xref depth="3" refnumber="26B-4-501">26B-4-501</xref>; and</subsection><subsection ssid="3-null-18" dnum="ii-o" numlevel="1" lineno="66" slineno="2-31" level="3"><display>(ii)</display>offer to dispense an opiate antagonist as defined in Section <xref depth="3" refnumber="26B-4-501">26B-4-501</xref> to the <ln numlevel="1" lineno="67" slineno="2-32"/>patient or the patient's representative, under a prescription from a practitioner or <ln numlevel="1" lineno="68" slineno="2-33"/>under Section <xref depth="3" refnumber="26B-4-510">26B-4-510</xref>, if the patient:<subsection ssid="3-null-19" dnum="A-o" numlevel="1" lineno="69" slineno="2-34" level="4"><display>(A)</display>receives a single prescription for 50 morphine milligram equivalents or more <ln numlevel="1" lineno="70" slineno="2-35"/>per day, calculated in accordance with guidelines developed by the United <ln numlevel="1" lineno="71" slineno="2-36"/>States Centers for Disease Control and Prevention;</subsection><subsection ssid="3-null-20" dnum="B-o" numlevel="1" lineno="72" slineno="2-37" level="4"><display>(B)</display>is being dispensed an opioid and the pharmacy dispensed a benzodiazepine to <ln numlevel="1" lineno="73" slineno="2-38"/>the patient in the previous 30 day period; or</subsection><subsection ssid="3-null-21" dnum="C-o" numlevel="1" lineno="74" slineno="2-39" level="4"><display>(C)</display>is being dispensed a benzodiazepine and the pharmacy dispensed an opioid to <ln numlevel="1" lineno="75" slineno="2-40"/>the patient in the previous 30 day period.</subsection></subsection></subsection></subsection><subsection ssid="3-null-22" dnum="5-o" numlevel="1" lineno="76" slineno="2-41" level="1" space="false"><display>(5)</display><subsection ssid="3-null-23" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A pharmacy who sells or dispenses a Schedule II or Schedule III controlled <ln numlevel="1" lineno="77" slineno="2-42"/>substance that is an opiate shall<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="4" style="2" owner="jchristopherson" level="1" deltag="both">, if available from the Department of Health and <ln numlevel="1" lineno="78" slineno="2-43"/>Human Services, </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"> print and </amend>prominently display at the point of sale the informational <ln numlevel="1" lineno="79" slineno="2-44"/>pamphlet <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="8" style="2" owner="jchristopherson" level="1" deltag="both">developed</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="8" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">created</amend> by the Department of Health and Human Services <ln numlevel="1" lineno="80" slineno="2-45"/>under Section <xref depth="3" refnumber="26B-4-514">26B-4-514</xref>.</subsection><subsection ssid="3-null-24" dnum="b-o" numlevel="1" lineno="81" slineno="2-46" level="2"><display>(b)</display>The board and the Department of Health and Human Services shall encourage <ln numlevel="1" lineno="82" slineno="2-47"/>pharmacies to use the informational pamphlet to engage in patient counseling <ln numlevel="1" lineno="83" slineno="2-48"/>regarding the risks associated with taking opiates.</subsection><subsection ssid="3-null-25" dnum="c-o:_-i" numlevel="1" lineno="84" slineno="2-49" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1034" style="2" owner="o" level="1" deltag="start">(c)</amend></display><amend anum="0" ea="erase" pairid="6" groupid="5" style="2" owner="jchristopherson" level="1" deltag="end">The requirement in Subsection (5)(a) does not apply to a pharmacy if the pharmacy <ln numlevel="1" lineno="85" slineno="2-50"/>is unable to obtain the informational pamphlet from the Department of Health and <ln numlevel="1" lineno="86" slineno="2-51"/>Human Services for any reason.</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="3-null-26" dnum="6-o" numlevel="1" lineno="87" slineno="2-52" level="1"><display>(6)</display>A person may not alter the face or remove any label so long as any of the original <ln numlevel="1" lineno="88" slineno="2-53"/>contents remain.</subsection><subsection ssid="3-null-27" dnum="7-o" numlevel="1" lineno="89" slineno="2-54" level="1" space="false"><display>(7)</display><subsection ssid="3-null-28" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An individual to whom or for whose use any controlled substance has been <ln numlevel="1" lineno="90" slineno="2-55"/>prescribed, sold, or dispensed by a practitioner and the owner of any animal for <ln numlevel="1" lineno="91" slineno="2-56"/>which any controlled substance has been prescribed, sold, or dispensed by a <ln numlevel="1" lineno="92" slineno="2-57"/>veterinarian may lawfully possess it only in the container in which it was delivered to <ln numlevel="1" lineno="93" slineno="2-58"/>the individual by the person selling or dispensing it.</subsection><subsection ssid="3-null-29" dnum="b-o" numlevel="1" lineno="94" slineno="2-59" level="2"><display>(b)</display>It is a defense to a prosecution under this subsection that the person being prosecuted <ln numlevel="1" lineno="95" slineno="2-60"/>produces in court a valid prescription for the controlled substance or the original <ln numlevel="1" lineno="96" slineno="2-61"/>container with the label attached.</subsection></subsection></section></bsec><bsec buid="4" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="97" slineno="3-1" sn="3"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="97">Section 3.  <bold>Effective Date.</bold></secline><sectionText lineno="98"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-19-26 4:02 PM</tm></rev></foot></leg>
