Section <bold>34-51-102</bold> is amended to read:</secline><catline lineno="32"><bold>34-51-102<parens/>. Definitions.</bold></catline><sectionText lineno="33"><tab/>As used in this chapter:</sectionText><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="34" slineno="1-4" level="1"><display>(1)</display>"Broadcasting employee" means an employee of a broadcasting company.</subsection><subsection ssid="1-null-2" dnum="2-o" numlevel="1" lineno="35" slineno="1-5" level="1"><display>(2)</display>"Broadcasting company" means a person engaged in the business of:<subsection ssid="1-null-3" dnum="a-o" numlevel="1" lineno="36" slineno="1-6" level="2"><display>(a)</display>distributing or transmitting electronic or electromagnetic signals to the general public <ln numlevel="1" lineno="37" slineno="1-7"/>using one or more of the following:<subsection ssid="1-null-4" dnum="i-o" numlevel="1" lineno="38" slineno="1-8" level="3"><display>(i)</display>television;</subsection><subsection ssid="1-null-5" dnum="ii-o" numlevel="1" lineno="39" slineno="1-9" level="3"><display>(ii)</display>cable; or</subsection><subsection ssid="1-null-6" dnum="iii-o" numlevel="1" lineno="40" slineno="1-10" level="3"><display>(iii)</display>radio; or</subsection></subsection><subsection ssid="1-null-7" dnum="b-o" numlevel="1" lineno="41" slineno="1-11" level="2"><display>(b)</display>preparing, developing, or creating one or more programs or messages for distribution <ln numlevel="1" lineno="42" slineno="1-12"/>or transmission by means described in Subsection <xref depth="4" refnumber="34-51-102(2)(a)" start="0">(2)(a)</xref>.</subsection></subsection><subsection ssid="1-null-8" dnum="3-o" numlevel="1" lineno="43" slineno="1-13" level="1"><display>(3)</display>"Exempt broadcasting employee" means a broadcasting employee who is compensated <ln numlevel="1" lineno="44" slineno="1-14"/>on a salary basis, as defined in 29 C.F.R. Sec. 541.602, at a rate equal to or greater than <ln numlevel="1" lineno="45" slineno="1-15"/>the greater of:<subsection ssid="1-null-9" dnum="a-o" numlevel="1" lineno="46" slineno="1-16" level="2"><display>(a)</display>$913 per week, or an equivalent amount if calculated for a period longer than one <ln numlevel="1" lineno="47" slineno="1-17"/>week; or</subsection><subsection ssid="1-null-10" dnum="b-o" numlevel="1" lineno="48" slineno="1-18" level="2"><display>(b)</display>the rate at which an employee qualifies as exempt under the Fair Labor Standards <ln numlevel="1" lineno="49" slineno="1-19"/>Act, 29 U.S.C. Sec. 213(a) on a salary basis as defined in 29 C.F.R. Part 541.</subsection></subsection><subsection ssid="1-15" dnum="_-o:4-i" numlevel="1" lineno="50" slineno="1-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="end">"Healthcare worker" means an individual licensed and practicing as:</amend><subsection ssid="1-62" dnum="_-o:a-i" numlevel="1" lineno="51" slineno="1-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="202" groupid="147" style="1" owner="jchristopherson" level="1" amendtag="end">an advanced practice registered nurse intern under Title 58, Chapter 31b, Nurse <ln numlevel="1" lineno="52" slineno="1-22"/>Practice Act;</amend></subsection><subsection ssid="1-63" dnum="_-o:b-i" numlevel="1" lineno="53" slineno="1-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1012" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="205" groupid="149" style="1" owner="jchristopherson" level="1" amendtag="end">an advanced practice registered nurse under Title 58, Chapter 31b, Nurse Practice <ln numlevel="1" lineno="54" slineno="1-24"/>Act;</amend></subsection><subsection ssid="1-64" dnum="_-o:c-i" numlevel="1" lineno="55" slineno="1-25" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend ea="amend" pairid="1014" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="243" groupid="175" style="1" owner="jchristopherson" level="1" amendtag="end">an associate marriage and family therapist under Section <xref depth="3" refnumber="58-60-304">58-60-304</xref>;</amend></subsection><subsection ssid="1-71" dnum="_-o:e-i" numlevel="1" owner="jchristopherson" level="1" deltag="both">post-employment restrictive covenant</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="29" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">non-compete agreement</amend> is part of a <ln numlevel="1" lineno="121" slineno="2-18"/>written employment contract of reasonable duration, based on industry standards, <ln numlevel="1" lineno="122" slineno="2-19"/>the position, the broadcasting employee's experience, geography, and the parties' <ln numlevel="1" lineno="123" slineno="2-20"/>unique circumstances; and</subsection><subsection ssid="2-null-6" dnum="iii-o" numlevel="1" lineno="124" slineno="2-21" level="3" tab="1" space="false"><display>(iii)</display><subsection ssid="2-null-7" dnum="A-o" level="4" placement="sameline"><display>(A)</display>the broadcasting company terminates the broadcasting employee for <ln numlevel="1" lineno="125" slineno="2-22"/>cause; or</subsection><subsection ssid="2-null-8" dnum="B-o" numlevel="1" lineno="126" slineno="2-23" level="4"><display>(B)</display>the broadcasting employee breaches the employment contract in a manner that <ln numlevel="1" lineno="127" slineno="2-24"/>results in the broadcasting employee no longer being employed by the <ln numlevel="1" lineno="128" slineno="2-25"/>broadcasting company.</subsection></subsection></subsection><subsection ssid="2-null-9" dnum="b-o" numlevel="1" lineno="129" slineno="2-26" level="2"><display>(b)</display>A <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="39" groupid="36" style="2" owner="jchristopherson" level="1" deltag="both">post-employment restrictive covenant</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="30" groupid="27" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">non-compete agreement</amend> described in <ln numlevel="1" lineno="130" slineno="2-27"/>Subsection <xref depth="4" refnumber="34-51-201(2)(a)" start="0">(2)(a)</xref> is enforceable for no longer than the earlier of:<subsection ssid="2-null-10" dnum="i-o" numlevel="1" lineno="131" slineno="2-28" level="3"><display>(i)</display>one year after the day on which the broadcasting employee is no longer employed <ln numlevel="1" lineno="132" slineno="2-29"/>by the broadcasting company; or</subsection><subsection ssid="2-null-11" dnum="ii-o" numlevel="1" lineno="133" slineno="2-30" level="3"><display>(ii)</display>the day on deltag="both"><ln numlevel="1" lineno="134" slineno="2-31"/>post-employment restrictive covenant</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="31" groupid="28" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">non-compete agreement</amend> ends.</subsection></subsection><subsection ssid="2-null-12" dnum="c-o" numlevel="1" lineno="135" Award of arbitration costs, attorney fees and court costs, and <ln numlevel="1" lineno="161" slineno="5-3"/>damages.</bold></catline><sectionText lineno="162"><tab/>If an employer seeks to enforce a <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="5" style="2" owner="jchristopherson" level="1" deltag="both">post-employment restrictive covenant</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">non-compete <ln numlevel="1" lineno="163" slineno="5-5"/>agreement</amend> through arbitration or by filing a civil action and it is determined that the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="6" groupid="6" style="2" owner="jchristopherson" level="1" deltag="both"><ln numlevel="1" lineno="164" slineno="5-6"/>post-employment restrictive covenant</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">non-compete agreement</amend> is unenforceable, the employer <ln numlevel="1" lineno="165" slineno="5-7"/>is liable for the employee's:</sectionText><subsection ssid="11-null-1" dnum="1-o" numlevel="1" lineno="166" slineno="5-8" level="1"><display>(1)</display>costs associated with arbitration;</subsection><subsection ssid="11-null-2" dnum="2-o" numlevel="1" lineno="167" slineno="5-9" level="1"><display>(2)</display>attorney fees and court costs; and</subsection><subsection ssid="11-null-3" dnum="3-o" numlevel="1" lineno="168" slineno="5-10" level="1"><display>(3)</display>actual damages. </subsection></section></bsec><bsec buid="9" num="34A-5-114" type="amend" src="code" uid="C34A-5-S114_2026050620260506" sort="34A05 01140020260506" numlevel="1" lineno="169" slineno="6-1" sn="6"><section number="34A-5-114" numlevel="1" lineno="170" slineno="6-2" type="amend"><secline lineno="169">Section 6. Section <bold>34A-5-114</bold> is amended to read:</secline><catline lineno="170"><bold>34A-5-114<parens/>. Limitations on enforceability of nondisclosure and <ln numlevel="1" lineno="171" slineno="6-3"/>non-disparagement clauses -- Retaliation prohibited.</bold></catline><subsection ssid="9-null-1" dnum="1-o" numlevel="1" lineno="172" slineno="6-4" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="9-null-2" dnum="a-o" numlevel="1" lineno="173" slineno="6-5" level="2"><display>(a)</display>"Confidentiality clause" means a nondisclosure clause or a non-disparagement clause.</subsection><subsection ssid="9-null-3" dnum="b-o" numlevel="1" lineno="174" slineno="6-6" level="2"><display>(b)</display>"Employee" means a current or a former employee.</subsection><subsection ssid="9-null-4" dnum="c-o" numlevel="1" lineno="175" slineno="6-7" level="2"><display>(c)</display>"Nondisclosure clause" means an agreement between an employee and employer that <ln numlevel="1" lineno="176" slineno="6-8"/>prevents, or has the effect of preventing, an employee from disclosing or discussing:<subsection ssid="9-null-5" dnum="i-o" numlevel="1" lineno="177" slineno="6-9" level="3"><display>(i)</display>sexual assault;</subsection><subsection ssid="9-null-6" dnum="ii-o" numlevel="1" lineno="178" slineno="6-10" level="3"><display>(ii)</display>allegations of sexual assault;</subsection><subsection ssid="9-null-7" dnum="iii-o" numlevel="1" lineno="179" slineno="6-11" level="3"><display>(iii)</display>sexual harassment; or</subsection><subsection ssid="9-null-8" dnum="iv-o" numlevel="1" lineno="180" slineno="6-12" level="3"><display>(iv)</display>allegations of sexual harassment.</subsection></subsection><subsection ssid="9-59" dnum="_-o:d-i" numlevel="1" lineno="181" slineno="6-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1080" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="end">"Non-compete agreement" means the same as that term is defined in Section <xref depth="3" refnumber="34-51-102"><ln numlevel="1" lineno="182" slineno="6-14"/>34-51-102</xref>.</amend></subsection><subsection ssid="9-null-9" dnum="d-o:e-i" numlevel="1" lineno="183" slineno="6-15" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1081" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1082" style="1" owner="i" level="1" amendtag="both" space="true">(e)</amend></display>"Non-disparagement clause" means an agreement between an employee and <ln numlevel="1" lineno="184" slineno="6-16"/>employer that prohibits, or has the effect of prohibiting, an employee from making a <ln numlevel="1" lineno="185" slineno="6-17"/>negative statement that is:<subsection ssid="9-null-10" dnum="i-o" numlevel="1" lineno="186" slineno="6-18" level="3"><display>(i)</display>about the employer; and</subsection><subsection ssid="9-null-11" dnum="ii-o" numlevel="1" lineno="187" slineno="6-19" level="3"><display>(ii)</display>related to:<subsection ssid="9-null-12" dnum="A-o" numlevel="1" lineno="188" slineno="6-20" level="4"><display>(A)</display>a claim of sexual assault or sexual harassment;</subsection><subsection ssid="9-null-13" dnum="B-o" numlevel="1" lineno="189" slineno="6-21" level="4"><display>(B)</display>a sexual assault dispute; or</subsection><subsection ssid="9-null-14" dnum="C-o" numlevel="1" lineno="190" slineno="6-22" level="4"><display>(C)</display>a sexual harassment dispute.</subsection></subsection></subsection><subsection ssid="9-null-15" dnum="e-o:_-i" numlevel="1" lineno="191" slineno="6-23" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1087" style="2" owner="o" level="1" deltag="start">(e)</amend></display><amend anum="0" ea="erase" pairid="5" groupid="5" style="2" owner="jchristopherson" level="1" deltag="end">"Post-employment restrictive covenant" means the same as that term is defined in <ln numlevel="1" lineno="192" slineno="6-24"/>Section <xref depth="3" refnumber="34-51-102">34-51-102</xref>.</amend><amendoutend style="2"/></subsection><subsection ssid="9-null-16" dnum="f-o" numlevel="1" lineno="193" slineno="6-25" level="2"><display>(f)</display>"Proprietary information" means an employer's business plan or customer <ln numlevel="1" lineno="194" slineno="6-26"/>information.</subsection><subsection ssid="9-null-17" dnum="g-o" numlevel="1" lineno="195" slineno="6-27" level="2"><display>(g)</display>"Retaliate" means taking an adverse action against an employee because the <ln numlevel="1" lineno="196" slineno="6-28"/>employee made an allegation of sexual harassment or assault, including:<subsection ssid="9-null-18" dnum="i-o" numlevel="1" lineno="197" slineno="6-29" level="3"><display>(i)</display>discharge;</subsection><subsection ssid="9-null-19" dnum="ii-o" numlevel="1" lineno="198" slineno="6-30" level="3"><display>(ii)</display>suspension;</subsection><subsection ssid="9-null-20" dnum="iii-o" numlevel="1" lineno="199" slineno="6-31" level="3"><display>(iii)</display>demotion; or</subsection><subsection ssid="9-null-21" dnum="iv-o" numlevel="1" lineno="200" slineno="6-32" level="3"><display>(iv)</display>discrimination in the terms, conditions, or privileges of employment.</subsection></subsection><subsection ssid="9-null-22" dnum="h-o" numlevel="1" lineno="201" slineno="6-33" level="2" space="false"><display>(h)</display><subsection ssid="9-null-23" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"Sexual assault" means:<subsection ssid="9-null-24" dnum="A-o" numlevel="1" lineno="202" slineno="6-34" level="4" tab="1"><display>(A)</display>conduct that would constitute a violation of 18 U.S.C. Secs. 2241 through <ln numlevel="1" lineno="203" slineno="6-35"/>2244; or</subsection><subsection ssid="9-null-25" dnum="B-o" numlevel="1" lineno="204" slineno="6-36" level="4" tab="1"><display>(B)</display>criminal conduct described in Title 76, Chapter 5, Part 4, Sexual Offenses.</subsection></subsection><subsection ssid="9-null-26" dnum="ii-o" numlevel="1" lineno="205" slineno="6-37" level="3"><display>(ii)</display>"Sexual assault" does not include criminal conduct described in:<subsection ssid="9-null-27" dnum="A-o" numlevel="1" lineno="206" slineno="6-38" level="4"><display>(A)</display>Section <xref depth="3" refnumber="76-5-417">76-5-417</xref>, enticing a minor;</subsection><subsection ssid="9-null-28" dnum="B-o" numlevel="1" lineno="207" slineno="6-39" level="4"><display>(B)</display>Section <xref depth="3" refnumber="76-5-418">76-5-418</xref>, sexual battery;</subsection><subsection ssid="9-null-29" dnum="C-o" numlevel="1" lineno="208" slineno="6-40" level="4"><display>(C)</display>Section <xref depth="3" refnumber="76-5-419">76-5-419</xref>, lewdness; or</subsection><subsection ssid="9-null-30" dnum="D-o" numlevel="1" lineno="209" slineno="6-41" level="4"><display>(D)</display>Section <xref depth="3" refnumber="76-5-420">76-5-420</xref>, lewdness involving a child.</subsection></subsection></subsection><subsection ssid="9-null-31" dnum="i-o" numlevel="1" lineno="210" slineno="6-42" level="2"><display>(i)</display>"Sexual assault dispute" means a dispute between an employer and the employer's <ln numlevel="1" lineno="211" slineno="6-43"/>employee relating to alleged sexual assault.</subsection><subsection ssid="9-null-32" dnum="j-o" numlevel="1" lineno="212" slineno="6-44" level="2"><display>(j)</display>"Sexual harassment" means harassment on the basis of sex, sexual orientation, or <ln numlevel="1" lineno="213" slineno="6-45"/>gender, as prohibited in:<subsection ssid="9-null-33" dnum="i-o" numlevel="1" lineno="214" slineno="6-46" level="3"><display>(i)</display>Title VII of the Civil Rights Act of 1964, 42 U.S.C. Sec. 2000e et seq.; or</subsection><subsection ssid="9-null-34" dnum="ii-o" numlevel="1" lineno="215" slineno="6-47" level="3"><display>(ii)</display>Subsection <xref depth="4" refnumber="34A-5-106(1)(a)(i)">34A-5-106(1)(a)(i)</xref>.</subsection></subsection><subsection ssid="9-null-35" dnum="k-o" numlevel="1" lineno="216" slineno="6-48" level="2"><display>(k)</display>"Sexual harassment dispute" means a dispute between an employer and the <ln numlevel="1" lineno="217" slineno="6-49"/>employer's employee relating to alleged sexual harassment.</subsection></subsection><subsection ssid="9-null-36" dnum="2-o" numlevel="1" lineno="218" slineno="6-50" level="1" space="false"><display>(2)</display><subsection ssid="9-null-37" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A confidentiality clause regarding sexual misconduct, as a condition of <ln numlevel="1" lineno="219" slineno="6-51"/>employment, is against public policy and is void and unenforceable.</subsection><subsection ssid="9-null-38" dnum="b-o" numlevel="1" lineno="220" slineno="6-52" level="2"><display>(b)</display>After an employee makes an allegation of sexual harassment or sexual assault, an <ln numlevel="1" lineno="221" slineno="6-53"/>employer of any sized business, regardless of Subsection <xref depth="4" refnumber="34-5-102(1)(i)(d)">34-5-102(1)(i)(D)</xref>:<subsection ssid="9-null-39" dnum="i-o" numlevel="1" lineno="222" slineno="6-54" level="3"><display>(i)</display>may not retaliate against the employee because the employee made an allegation <ln numlevel="1" lineno="223" slineno="6-55"/>of sexual harassment or assault; or</subsection><subsection ssid="9-null-40" dnum="ii-o" numlevel="1" lineno="224" slineno="6-56" level="3"><display>(ii)</display>may not retaliate based on an employee's refusal to enter into a confidentiality <ln numlevel="1" lineno="225" slineno="6-57"/>clause or an employment contract that, as a condition of employment, contains a <ln numlevel="1" lineno="226" slineno="6-58"/>confidentiality clause.</subsection></subsection><subsection ssid="9-null-41" dnum="c-o" numlevel="1" lineno="227" slineno="6-59" level="2"><display>(c)</display>An employee may, within three business days after the day on which the employee <ln numlevel="1" lineno="228" slineno="6-60"/>agrees to a settlement agreement that includes a confidentiality clause regarding <ln numlevel="1" lineno="229" slineno="6-61"/>sexual misconduct, withdraw from the settlement agreement.</subsection></subsection><subsection ssid="9-null-42" dnum="3-o" numlevel="1" lineno="230" slineno="6-62" level="1"><display>(3)</display>An employer who attempts to enforce a confidentiality clause in violation of this section:<subsection ssid="9-null-43" dnum="a-o" numlevel="1" lineno="231" slineno="6-63" level="2"><display>(a)</display>is liable for all costs, including reasonable attorney fees, resulting from legal action <ln numlevel="1" lineno="232" slineno="6-64"/>to enforce the confidentiality clause; and</subsection><subsection ssid="9-null-44" dnum="b-o" numlevel="1" lineno="233" slineno="6-65" level="2"><display>(b)</display>is not entitled to monetary damages resulting from a breach of a confidentiality <ln numlevel="1" lineno="234" slineno="6-66"/>clause.</subsection></subsection><subsection ssid="9-null-45" dnum="4-o" numlevel="1" lineno="235" slineno="6-67" level="1"><display>(4)</display>This section does not:<subsection ssid="9-null-46" dnum="a-o" numlevel="1" lineno="236" slineno="6-68" level="2"><display>(a)</display>prohibit an agreement between an employee who alleges sexual assault or sexual <ln numlevel="1" lineno="237" slineno="6-69"/>harassment and an employer from containing a nondisclosure clause, a <ln numlevel="1" lineno="238" slineno="6-70"/>non-disparagement clause, or any other clause prohibiting disclosure of:<subsection ssid="9-null-47" dnum="i-o" numlevel="1" lineno="239" slineno="6-71" level="3"><display>(i)</display>the amount of a monetary settlement; or</subsection><subsection ssid="9-null-48" dnum="ii-o" numlevel="1" lineno="240" slineno="6-72" level="3"><display>(ii)</display>at the request of the employee, facts that could reasonably lead to the <ln numlevel="1" lineno="241" slineno="6-73"/>identification of the employee;</subsection></subsection><subsection ssid="9-null-49" dnum="b-o" numlevel="1" lineno="242" slineno="6-74" level="2"><display>(b)</display>prohibit an employer from requiring an employee to:<subsection ssid="9-null-50" dnum="i-o" numlevel="1" lineno="243" slineno="6-75" level="3"><display>(i)</display>sign a <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="6" groupid="6" style="2" owner="jchristopherson" level="1" deltag="both">post-employment restrictive covenant</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">non-compete agreement</amend>; or</subsection><subsection ssid="9-null-51" dnum="ii-o" numlevel="1" lineno="244" slineno="6-76" level="3"><display>(ii)</display>agree not to disclose an employer's non-public trade secrets, proprietary <ln numlevel="1" lineno="245" slineno="6-77"/>information, or confidential information that does not involve illegal acts;</subsection></subsection><subsection ssid="9-null-52" dnum="c-o" numlevel="1" lineno="246" slineno="6-78" level="2"><display>(c)</display>authorize an employee to:<subsection ssid="9-null-53" dnum="i-o" numlevel="1" lineno="247" slineno="6-79" level="3"><display>(i)</display>disclose data otherwise protected by law or legal privilege; or</subsection><subsection ssid="9-null-54" dnum="ii-o" numlevel="1" lineno="248" slineno="6-80" level="3"><display>(ii)</display>knowingly make statements or disclosures that are false or made with reckless <ln numlevel="1" lineno="249" slineno="6-81"/>disregard of the truth;</subsection></subsection><subsection ssid="9-null-55" dnum="d-o" numlevel="1" lineno="250" slineno="6-82" level="2"><display>(d)</display>prohibit an employee from discussing sexual misconduct or allegations of sexual <ln numlevel="1" lineno="251" slineno="6-83"/>misconduct in a civil or criminal case when subpoenaed if the sexual misconduct or <ln numlevel="1" lineno="252" slineno="6-84"/>allegations of sexual misconduct are against the individual whom the employee <ln numlevel="1" lineno="253" slineno="6-85"/>alleged engaged in sexual misconduct;</subsection><subsection ssid="9-null-56" dnum="e-o" numlevel="1" lineno="254" slineno="6-86" level="2"><display>(e)</display>permit a disclosure that would violate state or federal law; or</subsection><subsection ssid="9-null-57" dnum="f-o" numlevel="1" lineno="255" slineno="6-87" level="2"><display>(f)</display>limit other grounds that may exist at law or in equity for the unenforceability of a <ln numlevel="1" lineno="256" slineno="6-88"/>confidentiality clause.</subsection></subsection></section></bsec><bsec buid="15" type="repealer" src="code" sort="TRepealer" numlevel="1" lineno="257" slineno="7-1" sn="7"><secline>Section 7. <bold>Repealer.</bold></secline><rhead lineno="258"/><sectionText><repsec num="34-51-101" uid="C34-51-S101_2026050620260506" sort="34 51 01010020260506" src="code" sn="1" numlevel="1" lineno="259" slineno="7-3"><parens/>Title.</repsec></sectionText></bsec><bsec buid="16" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="260" slineno="8-1" sn="8"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="260">Section 8.  <bold>Effective Date.</bold></secline><sectionText lineno="261"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>1-15-26 4:09 PM</tm></rev></foot></leg>
