Section <bold>58-1-307</bold> is amended to read:</secline><catline lineno="21"><bold>58-1-307<parens/>. Exemptions from licensure.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="22" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>Except as otherwise provided by statute or rule, the following individuals may engage in <ln numlevel="1" lineno="23" slineno="1-4"/>the practice of their occupation or profession, subject to the stated circumstances and <ln numlevel="1" lineno="24" slineno="1-5"/>limitations, without being licensed under this title:<subsection ssid="1-null-2" dnum="a-o" numlevel="1" lineno="25" slineno="1-6" level="2"><display>(a)</display>an individual serving in the armed forces of the United States, the United States <ln numlevel="1" lineno="26" slineno="1-7"/>Public Health Service, the United States Department of Veterans Affairs, or other <ln numlevel="1" lineno="27" slineno="1-8"/>federal agencies while engaged in activities regulated under this chapter as a part of <ln numlevel="1" lineno="28" slineno="1-9"/>employment with that federal agency if the individual holds a valid license to practice <ln numlevel="1" lineno="29" slineno="1-10"/>a regulated occupation or profession issued by any other state or jurisdiction <ln numlevel="1" lineno="30" slineno="1-11"/>recognized by the division;</subsection><subsection ssid="1-null-3" dnum="b-o" numlevel="1" lineno="31" slineno="1-12" level="2"><display>(b)</display>a student engaged in activities constituting the practice of a regulated occupation or <ln numlevel="1" lineno="32" slineno="1-13"/>profession while in training in a recognized school approved by the division to the <ln numlevel="1" lineno="33" slineno="1-14"/>extent the activities are supervised by qualified faculty, staff, or designee and the <ln numlevel="1" lineno="34" slineno="1-15"/>activities are a defined part of the training program;</subsection><subsection ssid="1-null-4" dnum="c-o" numlevel="1" lineno="35" slineno="1-16" level="2"><display>(c)</display>an individual engaged in an internship, residency, preceptorship, postceptorship, <ln numlevel="1" lineno="36" slineno="1-17"/>fellowship, apprenticeship, or on-the-job training program approved by the division <ln numlevel="1" lineno="37" slineno="1-18"/>while under the supervision of qualified individuals;</subsection><subsection ssid="1-null-5" dnum="d-o" numlevel="1" lineno="38" slineno="1-19" level="2"><display>(d)</display>an individual residing in another state and licensed to practice a regulated occupation <ln numlevel="1" lineno="39" slineno="1-20"/>or profession in that state, who is called in for a consultation by an individual <ln numlevel="1" lineno="40" slineno="1-21"/>licensed in this state, and the services provided are limited to that consultation;</subsection><subsection ssid="1-null-6" dnum="e-o" numlevel="1" lineno="41" slineno="1-22" level="2"><display>(e)</display>an individual who is invited by a recognized school, association, society, or other <ln numlevel="1" lineno="42" slineno="1-23"/>body approved by the division to conduct a lecture, clinic, or demonstration of the <ln numlevel="1" lineno="43" slineno="1-24"/>practice of a regulated occupation or profession if the individual does not establish a <ln numlevel="1" lineno="44" slineno="1-25"/>place of business or regularly engage in the practice of the regulated occupation or <ln numlevel="1" lineno="45" slineno="1-26"/>profession in this state;</subsection><subsection ssid="1-null-7" dnum="f-o" numlevel="1" lineno="46" slineno="1-27" level="2"><display>(f)</display>an individual licensed under the laws of this state, other than under this title, to <ln numlevel="1" lineno="47" slineno="1-28"/>practice or engage in an occupation or profession, while engaged in the lawful, <ln numlevel="1" lineno="48" slineno="1-29"/>professional, and competent practice of that occupation or profession;</subsection><subsection ssid="1-null-8" dnum="g-o" numlevel="1" lineno="49" slineno="1-30" level="2"><display>(g)</display>an individual licensed in a health care profession in another state who performs that <ln numlevel="1" lineno="50" slineno="1-31"/>profession while attending to the immediate needs of a patient for a reasonable period <ln numlevel="1" lineno="51" slineno="1-32"/>during which the patient is being transported from outside of this state, into this state, <ln numlevel="1" lineno="52" slineno="1-33"/>or through this state;</subsection><subsection ssid="1-null-9" dnum="h-o" numlevel="1" lineno="53" slineno="1-34" level="2"><display>(h)</display>an individual licensed in another state or country who is in this state temporarily to <ln numlevel="1" lineno="54" slineno="1-35"/>attend to the needs of an athletic team or group, except that the practitioner may only <ln numlevel="1" lineno="55" slineno="1-36"/>attend to the needs of the athletic team or group, including all individuals who travel <ln numlevel="1" lineno="56" slineno="1-37"/>with the team or group in any capacity except as a spectator;</subsection><subsection ssid="1-null-10" dnum="i-o" numlevel="1" lineno="57" slineno="1-38" level="2"><display>(i)</display>an individual licensed and in good standing in another state, who is in this state:<subsection ssid="1-null-11" dnum="i-o" numlevel="1" lineno="58" slineno="1-39" level="3"><display>(i)</display>temporarily, under the invitation and control of a sponsoring entity;</subsection><subsection ssid="1-null-12" dnum="ii-o" numlevel="1" lineno="59" slineno="1-40" level="3"><display>(ii)</display>for a reason associated with a special purpose event, based upon needs that may <ln numlevel="1" lineno="60" slineno="1-41"/>exceed the ability of this state to address through its licensees, as determined by <ln numlevel="1" lineno="61" slineno="1-42"/>the division; and</subsection><subsection ssid="1-null-13" dnum="iii-o" numlevel="1" lineno="62" slineno="1-43" level="3"><display>(iii)</display>for a limited period of time not to exceed the duration of that event, together with <ln numlevel="1" lineno="63" slineno="1-44"/>any necessary preparatory and conclusionary periods;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="15" groupid="14" style="2" owner="jchristopherson" level="1" deltag="both"> and</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="1-null-14" dnum="j-o" numlevel="1" lineno="64" slineno="1-45" level="2"><display>(j)</display>the spouse of an individual serving in the armed forces of the United States or the <ln numlevel="1" lineno="65" slineno="1-46"/>spouse of a DOD civilian while the individual or DOD civilian is stationed within <ln numlevel="1" lineno="66" slineno="1-47"/>this state, provided:<subsection ssid="1-null-15" dnum="i-o" numlevel="1" lineno="67" slineno="1-48" level="3"><display>(i)</display>the spouse holds a valid license to practice a regulated occupation or profession <ln numlevel="1" lineno="68" slineno="1-49"/>issued by any other state or jurisdiction recognized by the division; and</subsection><subsection ssid="1-null-16" dnum="ii-o" numlevel="1" lineno="69" slineno="1-50" level="3"><display>(ii)</display>the license is current and the spouse is in good standing in the state of licensure<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="8" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; <ln numlevel="1" lineno="70" slineno="1-51"/>and</amend></subsection></subsection><subsection ssid="1-67" dnum="_-o:k-i" numlevel="1" lineno="71" slineno="1-52" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="start">(k)</amend></display><amend anum="0" ea="amend" pairid="14" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="end">a traditional healing provider engaging in the practice of traditional healing services, <ln numlevel="1" lineno="72" slineno="1-53"/>as those terms are defined in Section <xref depth="3" refnumber="26B-3-230">26B-3-230</xref> and as established by rule by the <ln numlevel="1" lineno="73" slineno="1-54"/>division, in consultation with Utah Native American tribes and indigenous <ln numlevel="1" lineno="74" slineno="1-55"/>communities, in accordance with Title 63G, Chapter 3, Utah Administrative <ln numlevel="1" lineno="75" slineno="1-56"/>Rulemaking Act.</amend></subsection></subsection><subsection ssid="1-null-17" dnum="2-o" numlevel="1" lineno="76" slineno="1-57" level="1" space="false"><display>(2)</display><subsection ssid="1-null-18" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A practitioner temporarily in this state who is exempted from licensure under <ln numlevel="1" lineno="77" slineno="1-58"/>Subsection <xref depth="4" refnumber="58-1-307(1)" start="0">(1)</xref> shall comply with each requirement of the licensing jurisdiction from <ln numlevel="1" lineno="78" slineno="1-59"/>which the practitioner derives authority to practice.</subsection><subsection ssid="1-null-19" dnum="b-o" numlevel="1" lineno="79" slineno="1-60" level="2"><display>(b)</display>Violation of a limitation imposed by this section constitutes grounds for removal of <ln numlevel="1" lineno="80" slineno="1-61"/>exempt status, denial of license, or other disciplinary proceedings.</subsection></subsection><subsection ssid="1-null-20" dnum="3-o" numlevel="1" lineno="81" slineno="1-62" level="1"><display>(3)</display>An individual who is licensed under a specific chapter of this title to practice or engage <ln numlevel="1" lineno="82" slineno="1-63"/>in an occupation or profession may engage in the lawful, professional, and competent <ln numlevel="1" lineno="83" slineno="1-64"/>practice of that occupation or profession without additional licensure under other <ln numlevel="1" lineno="84" slineno="1-65"/>chapters of this title, except as otherwise provided by this title.</subsection><subsection ssid="1-null-21" dnum="4-o" numlevel="1" lineno="85" slineno="1-66" level="1"><display>(4)</display>Upon the declaration of a national, state, or local emergency, a public health emergency <ln numlevel="1" lineno="86" slineno="1-67"/>as defined in Section <xref depth="3" refnumber="26B-7-301" start="0">26B-7-301</xref>, or a declaration by the president of the United States or <ln numlevel="1" lineno="87" slineno="1-68"/>other federal official requesting public health-related activities, the division in <ln numlevel="1" lineno="88" slineno="1-69"/>collaboration with the relevant board may:<subsection ssid="1-null-22" dnum="a-o" numlevel="1" lineno="89" slineno="1-70" level="2"><display>(a)</display>suspend the requirements for permanent or temporary licensure of individuals who <ln numlevel="1" lineno="90" slineno="1-71"/>are licensed in another state for the duration of the emergency while engaged in the <ln numlevel="1" lineno="91" slineno="1-72"/>scope of practice for which they are licensed in the other state;</subsection><subsection ssid="1-null-23" dnum="b-o" numlevel="1" lineno="92" slineno="1-73" level="2"><display>(b)</display>modify, under the circumstances described in this Subsection <xref depth="4" refnumber="58-1-307(4)" start="0">(4)</xref> and Subsection <xref depth="4" refnumber="58-1-307(5)" start="0">(5)</xref>, <ln numlevel="1" lineno="93" slineno="1-74"/>the scope of practice restrictions under this title for individuals who are licensed <ln numlevel="1" lineno="94" slineno="1-75"/>under this title as:<subsection ssid="1-null-24" dnum="i-o" numlevel="1" lineno="95" slineno="1-76" level="3"><display>(i)</display>a physician under <xref depth="1" refnumber="58-67" start="1">Chapter 67, Utah Medical Practice Act</xref>, or <xref depth="1" refnumber="58-68" start="1">Chapter 68, Utah <ln numlevel="1" lineno="96" slineno="1-77"/>Osteopathic Medical Practice Act</xref>;</subsection><subsection ssid="1-null-25" dnum="ii-o" numlevel="1" lineno="97" slineno="1-78" level="3"><display>(ii)</display>a nurse under <xref depth="1" refnumber="58-31b" start="1">Chapter 31b, Nurse Practice Act</xref>, or <xref depth="1" refnumber="58-31e" start="1">Chapter 31e, Nurse Licensure <ln numlevel="1" lineno="98" slineno="1-79"/>Compact - Revised</xref>;</subsection><subsection ssid="1-null-26" dnum="iii-o" numlevel="1" lineno="99" slineno="1-80" level="3"><display>(iii)</display>a certified nurse midwife under <xref depth="1" refnumber="58-44a" start="1">Chapter 44a, Nurse Midwife Practice Act</xref>;</subsection><subsection ssid="1-null-27" dnum="iv-o" numlevel="1" lineno="100" slineno="1-81" level="3"><display>(iv)</display>a pharmacist, pharmacy technician, or pharmacy intern under <xref depth="1" refnumber="58-17b" start="1">Chapter 17b, <ln numlevel="1" lineno="101" slineno="1-82"/>Pharmacy Practice Act</xref>;</subsection><subsection ssid="1-null-28" dnum="v-o" numlevel="1" lineno="102" slineno="1-83" level="3"><display>(v)</display>a respiratory therapist under <xref depth="1" refnumber="58-57" start="1">Chapter 57, Respiratory Care Practices Act</xref>;</subsection><subsection ssid="1-null-29" dnum="vi-o" numlevel="1" lineno="103" slineno="1-84" level="3"><display>(vi)</display>a dentist and dental hygienist under <xref depth="1" refnumber="58-69" start="1">Chapter 69, Dentist and Dental Hygienist <ln numlevel="1" lineno="104" slineno="1-85"/>Practice Act</xref>; and</subsection><subsection ssid="1-null-30" dnum="vii-o" numlevel="1" lineno="105" slineno="1-86" level="3"><display>(vii)</display>a physician assistant under <xref depth="1" refnumber="58-70a" start="1">Chapter 70a, Utah Physician Assistant Act</xref>;</subsection></subsection><subsection ssid="1-null-31" dnum="c-o" numlevel="1" lineno="106" slineno="1-87" level="2"><display>(c)</display>suspend the requirements for licensure under this title and modify the scope of <ln numlevel="1" lineno="107" slineno="1-88"/>practice in the circumstances described in this Subsection <xref depth="4" refnumber="58-1-307(4)" start="0">(4)</xref> and Subsection <xref depth="4" refnumber="58-1-307(5)" start="0">(5)</xref> for <ln numlevel="1" lineno="108" slineno="1-89"/>medical services personnel or paramedics required to be licensed under Section <xref depth="3" refnumber="53-2d-402" start="0"><ln numlevel="1" lineno="109" slineno="1-90"/>53-2d-402</xref>;</subsection><subsection ssid="1-null-32" dnum="d-o" numlevel="1" lineno="110" slineno="1-91" level="2"><display>(d)</display>suspend requirements in Subsections <xref depth="4" refnumber="58-17b-620(3)" start="0">58-17b-620(3)</xref> through <xref depth="4" refnumber="58-17b-620(6)" start="0">(6)</xref> which require <ln numlevel="1" lineno="111" slineno="1-92"/>certain prescriptive procedures;</subsection><subsection ssid="1-null-33" dnum="e-o" numlevel="1" lineno="112" slineno="1-93" level="2"><display>(e)</display>exempt or modify the requirement for licensure of an individual who is activated as a <ln numlevel="1" lineno="113" slineno="1-94"/>member of a medical reserve corps during a time of emergency as provided in <ln numlevel="1" lineno="114" slineno="1-95"/>Section <xref depth="3" refnumber="26A-1-126" start="0">26A-1-126</xref>;</subsection><subsection ssid="1-null-34" dnum="f-o" numlevel="1" lineno="115" slineno="1-96" level="2"><display>(f)</display>exempt or modify the requirement for licensure of an individual who is registered as <ln numlevel="1" lineno="116" slineno="1-97"/>a volunteer health practitioner as provided in <xref depth="2" refnumber="26B-4-8" start="0">Title 26B, Chapter 4, Part 8, Uniform <ln numlevel="1" lineno="117" slineno="1-98"/>Emergency Volunteer Health Practitioners Act</xref>; and</subsection><subsection ssid="1-null-35" dnum="g-o" numlevel="1" lineno="118" slineno="1-99" level="2"><display>(g)</display>in accordance with rules made by the division in accordance with <xref depth="1" refnumber="63G-3" start="0">Title 63G, Chapter <ln numlevel="1" lineno="119" slineno="1-100"/>3, Utah Administrative Rulemaking Act</xref>, exempt or modify the requirements for <ln numlevel="1" lineno="120" slineno="1-101"/>licensure of an individual engaged in one or more of the construction trades described <ln numlevel="1" lineno="121" slineno="1-102"/>in <xref depth="1" refnumber="58-55" start="1">Chapter 55, Utah Construction Trades Licensing Act</xref>.</subsection></subsection><subsection ssid="1-null-36" dnum="5-o" numlevel="1" lineno="122" slineno="1-103" level="1"><display>(5)</display>Individuals exempt under Subsection <xref depth="4" refnumber="58-1-307(4)(c)" start="0">(4)(c)</xref> and individuals operating under modified <ln numlevel="1" lineno="123" slineno="1-104"/>scope of practice provisions under Subsection <xref depth="4" refnumber="58-1-307(4)(b)" start="0">(4)(b)</xref>:<subsection ssid="1-null-37" dnum="a-o" numlevel="1" lineno="124" slineno="1-105" level="2"><display>(a)</display>are exempt from licensure or subject to modified scope of practice for the duration of <ln numlevel="1" lineno="125" slineno="1-106"/>the emergency;</subsection><subsection ssid="1-null-38" dnum="b-o" numlevel="1" lineno="126" slineno="1-107" level="2"><display>(b)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="24" groupid="23" style="2" owner="jchristopherson" level="1" deltag="both">must</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="20" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">shall</amend> be engaged in the distribution of medicines or medical devices in <ln numlevel="1" lineno="127" slineno="1-108"/>response to the emergency or declaration; and</subsection><subsection ssid="1-null-39" dnum="c-o" numlevel="1" lineno="128" slineno="1-109" level="2"><display>(c)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="25" groupid="24" style="2" owner="jchristopherson" level="1" deltag="both">must</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="21" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">shall</amend> be employed by or volunteering for:<subsection ssid="1-null-40" dnum="i-o" numlevel="1" lineno="129" slineno="1-110" level="3"><display>(i)</display>a local or state department of health; or</subsection><subsection ssid="1-null-41" dnum="ii-o" numlevel="1" lineno="130" slineno="1-111" level="3"><display>(ii)</display>a host entity as defined in Section <xref depth="3" refnumber="26B-4-801" start="0">26B-4-801</xref>.</subsection></subsection></subsection><subsection ssid="1-null-42" dnum="6-o" numlevel="1" lineno="131" slineno="1-112" level="1"><display>(6)</display>In accordance with the protocols established under Subsection <xref depth="4" refnumber="58-1-307(8)" start="0">(8)</xref>, upon the declaration <ln numlevel="1" lineno="132" slineno="1-113"/>of a national, state, or local emergency, the Department of Health and Human Services <ln numlevel="1" lineno="133" slineno="1-114"/>or a local health department shall coordinate with public safety authorities as defined in <ln numlevel="1" lineno="134" slineno="1-115"/>Subsection <xref depth="4" refnumber="26B-7-323(1)" start="0">26B-7-323(1)</xref> and may:<subsection ssid="1-null-43" dnum="a-o" numlevel="1" lineno="135" slineno="1-116" level="2"><display>(a)</display>use a vaccine, antiviral, antibiotic, or other prescription medication that is not a <ln numlevel="1" lineno="136" slineno="1-117"/>controlled substance to prevent or treat a disease or condition that gave rise to, or was <ln numlevel="1" lineno="137" slineno="1-118"/>a consequence of, the emergency; or</subsection><subsection ssid="1-null-44" dnum="b-o" numlevel="1" lineno="138" slineno="1-119" level="2"><display>(b)</display>distribute a vaccine, antiviral, antibiotic, or other prescription medication that is not a <ln numlevel="1" lineno="139" slineno="1-120"/>controlled substance:<subsection ssid="1-null-45" dnum="i-o" numlevel="1" lineno="140" slineno="1-121" level="3"><display>(i)</display>if necessary, to replenish a commercial pharmacy <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="26" groupid="25" style="2" owner="jchristopherson" level="1" deltag="both">in the event that</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="22" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">if</amend> the <ln numlevel="1" lineno="141" slineno="1-122"/>commercial pharmacy's normal source of the vaccine, antiviral, antibiotic, or other <ln numlevel="1" lineno="142" slineno="1-123"/>prescription medication is exhausted; or</subsection><subsection ssid="1-null-46" dnum="ii-o" numlevel="1" lineno="143" slineno="1-124" level="3"><display>(ii)</display>for dispensing or direct administration to treat the disease or condition that gave <ln numlevel="1" lineno="144" slineno="1-125"/>rise to, or was a consequence of, the emergency by:<subsection ssid="1-null-47" dnum="A-o" numlevel="1" lineno="145" slineno="1-126" level="4"><display>(A)</display>a pharmacy;</subsection><subsection ssid="1-null-48" dnum="B-o" numlevel="1" lineno="146" slineno="1-127" level="4"><display>(B)</display>a prescribing practitioner;</subsection><subsection ssid="1-null-49" dnum="C-o" numlevel="1" lineno="147" slineno="1-128" level="4"><display>(C)</display>a licensed health care facility;</subsection><subsection ssid="1-null-50" dnum="D-o" numlevel="1" lineno="148" slineno="1-129" level="4"><display>(D)</display>a federally qualified community health clinic; or</subsection><subsection ssid="1-null-51" dnum="E-o" numlevel="1" lineno="149" slineno="1-130" level="4"><display>(E)</display>a governmental entity for use by a community more than 50 miles from a <ln numlevel="1" lineno="150" slineno="1-131"/>person described in Subsections <xref depth="4" refnumber="58-1-307(6)(b)(ii)(A)" start="0">(6)(b)(ii)(A)</xref> through <xref depth="4" refnumber="58-1-307(6)(b)(ii)(D)" start="0">(D)</xref>.</subsection></subsection></subsection></subsection><subsection ssid="1-null-52" dnum="7-o" numlevel="1" lineno="151" slineno="1-132" level="1"><display>(7)</display>In accordance with protocols established under Subsection <xref depth="4" refnumber="58-1-307(8)" start="0">(8)</xref>, upon the declaration of a <ln numlevel="1" lineno="152" slineno="1-133"/>national, state, or local emergency, the Department of Health and Human Services shall <ln numlevel="1" lineno="153" slineno="1-134"/>coordinate the distribution of medications:<subsection ssid="1-null-53" dnum="a-o" numlevel="1" lineno="154" slineno="1-135" level="2"><display>(a)</display>received from the strategic national stockpile to local health departments; and</subsection><subsection ssid="1-null-54" dnum="b-o" numlevel="1" lineno="155" slineno="1-136" level="2"><display>(b)</display>from local health departments to emergency personnel within the local health <ln numlevel="1" lineno="156" slineno="1-137"/>departments' geographic region.</subsection></subsection><subsection ssid="1-null-55" dnum="8-o" numlevel="1" lineno="157" slineno="1-138" level="1"><display>(8)</display>The Department of Health and Human Services shall establish by rule, made in <ln numlevel="1" lineno="158" slineno="1-139"/>accordance with <xref depth="1" refnumber="63G-3" start="0">Title 63G, Chapter 3, Utah Administrative Rulemaking Act</xref>, protocols <ln numlevel="1" lineno="159" slineno="1-140"/>for administering, dispensing, and distributing a vaccine, an antiviral, an antibiotic, or <ln numlevel="1" lineno="160" slineno="1-141"/>other prescription medication that is not a controlled substance <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="27" groupid="26" style="2" owner="jchristopherson" level="1" deltag="both">in the event of</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="23" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">if there is</amend> <ln numlevel="1" lineno="161" slineno="1-142"/>a declaration of a national, state, or local emergency.  The protocol shall establish <ln numlevel="1" lineno="162" slineno="1-143"/>procedures for the Department of Health and Human Services or a local health <ln numlevel="1" lineno="163" slineno="1-144"/>department to:<subsection ssid="1-null-56" dnum="a-o" numlevel="1" lineno="164" slineno="1-145" level="2"><display>(a)</display>coordinate the distribution of:<subsection ssid="1-null-57" dnum="i-o" numlevel="1" lineno="165" slineno="1-146" level="3"><display>(i)</display>a vaccine, an antiviral, an antibiotic, or other prescription medication that is not a <ln numlevel="1" lineno="166" slineno="1-147"/>controlled substance received by the Department of Health and Human Services <ln numlevel="1" lineno="167" slineno="1-148"/>from the strategic national stockpile to local health departments; and</subsection><subsection ssid="1-null-58" dnum="ii-o" numlevel="1" lineno="168" slineno="1-149" level="3"><display>(ii)</display>a vaccine, an antiviral, an antibiotic, or other non-controlled prescription <ln numlevel="1" lineno="169" slineno="1-150"/>medication received by a local health department to emergency personnel within <ln numlevel="1" lineno="170" slineno="1-151"/>the local health department's geographic region;</subsection></subsection><subsection ssid="1-null-59" dnum="b-o" numlevel="1" lineno="171" slineno="1-152" level="2"><display>(b)</display>authorize the dispensing, administration, or distribution of a vaccine, an antiviral, an <ln numlevel="1" lineno="172" slineno="1-153"/>antibiotic, or other prescription medication that is not a controlled substance to the <ln numlevel="1" lineno="173" slineno="1-154"/>contact of a patient without a patient-practitioner relationship, if the contact's <ln numlevel="1" lineno="174" slineno="1-155"/>condition is the same as that of the physician's or physician assistant's patient; and</subsection><subsection ssid="1-null-60" dnum="c-o" numlevel="1" lineno="175" slineno="1-156" level="2"><display>(c)</display>authorize the administration, distribution, or dispensing of a vaccine, an antiviral, an <ln numlevel="1" lineno="176" slineno="1-157"/>antibiotic, or other non-controlled prescription medication to an individual who:<subsection ssid="1-null-61" dnum="i-o" numlevel="1" lineno="177" slineno="1-158" level="3"><display>(i)</display>is working in a triage situation;</subsection><subsection ssid="1-null-62" dnum="ii-o" numlevel="1" lineno="178" slineno="1-159" level="3"><display>(ii)</display>is receiving preventative or medical treatment in a triage situation;</subsection><subsection ssid="1-null-63" dnum="iii-o" numlevel="1" lineno="179" slineno="1-160" level="3"><display>(iii)</display>does not have coverage for the prescription in the individual's health insurance <ln numlevel="1" lineno="180" slineno="1-161"/>plan;</subsection><subsection ssid="1-null-64" dnum="iv-o" numlevel="1" lineno="181" slineno="1-162" level="3"><display>(iv)</display>is involved in the delivery of medical or other emergency services in response to <ln numlevel="1" lineno="182" slineno="1-163"/>the declared national, state, or local emergency; or</subsection><subsection ssid="1-null-65" dnum="v-o" numlevel="1" lineno="183" slineno="1-164" level="3"><display>(v)</display>otherwise has a direct impact on public health.</subsection></subsection></subsection><subsection ssid="1-null-66" dnum="9-o" numlevel="1" lineno="184" slineno="1-165" level="1"><display>(9)</display>The Department of Health and Human Services shall give notice to the division upon <ln numlevel="1" lineno="185" slineno="1-166"/>implementation of the protocol established under Subsection <xref depth="4" refnumber="58-1-307(8)" start="0">(8)</xref>.</subsection></section></bsec><bsec buid="2" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="186" slineno="2-1" sn="2"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="186">Section 2.  <bold>Effective Date.</bold></secline><sectionText lineno="187"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>1-28-26 7:57 AM</tm></rev></foot></leg>
