type="amend"><secline lineno="39">Section 1. Section <bold>9-22-102</bold> is amended to read:</secline><catline lineno="40"><bold>9-22-102<parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>05/06/26</date></paren></parens>. Definitions.</bold></catline><sectionText lineno="41"><tab/>As used in this chapter:</sectionText><subsection ssid="18-null-1" dnum="1-o" numlevel="1" lineno="42" slineno="1-4" level="1"><display>(1)</display>"Computing partnerships" means a set of skills, knowledge, and aptitudes used in <ln numlevel="1" lineno="43" slineno="1-5"/>computer science, information technology, or computer engineering courses and career <ln numlevel="1" lineno="44" slineno="1-6"/>options.</subsection><subsection ssid="18-null-2" dnum="2-o" numlevel="1" lineno="45" slineno="1-7" level="1"><display>(2)</display>"Director" means the director appointed by the STEM board to oversee the <ln numlevel="1" lineno="46" slineno="1-8"/>administration of the STEM Action Center.</subsection><subsection ssid="18-null-3" dnum="3-o" numlevel="1" lineno="47" slineno="1-9" level="1"><display>(3)</display>"Educator" means the same as that term is defined in Section <xref depth="3" refnumber="53E-6-102" start="0">53E-6-102</xref>.</subsection><subsection ssid="18-null-4" dnum="4-o" numlevel="1" lineno="48" slineno="1-10" level="1"><display>(4)</display>"Foundation" means a foundation established as described in Subsections <xref depth="4" refnumber="9-22-104(3)" start="0">9-22-104(3)</xref> <ln numlevel="1" lineno="49" slineno="1-11"/>and <xref depth="4" refnumber="9-22-104(4)" start="0">(4)</xref>.</subsection><subsection ssid="18-null-5" dnum="5-o" numlevel="1" lineno="50" slineno="1-12" level="1"><display>(5)</display>"Fund" means the STEM Action Center Foundation Fund created in Section <xref depth="3" refnumber="9-22-105" start="0">9-22-105</xref>.</subsection><subsection ssid="18-null-6" dnum="6-o" numlevel="1" lineno="51" slineno="1-13" level="1"><display>(6)</display>"Grant program" means the Computing Partnerships Grants program created in this part.</subsection><subsection ssid="18-null-7" dnum="7-o" numlevel="1" lineno="52" slineno="1-14" level="1"><display>(7)</display>"High quality professional development" means professional development that meets <ln numlevel="1" lineno="53" slineno="1-15"/>high quality standards developed by the State Board of Education.</subsection><subsection ssid="18-null-8" dnum="8-o" numlevel="1" lineno="54" slineno="1-16" level="1"><display>(8)</display>"Institution of higher education" means the same as that term is defined in Section <xref depth="3" refnumber="53H-1-101"><ln numlevel="1" lineno="55" slineno="1-17"/>53H-1-101</xref>.</subsection><subsection ssid="18-null-9" dnum="9-o" numlevel="1" lineno="56" slineno="1-18" level="1"><display>(9)</display>"K-16" means kindergarten through grade 12 and post-secondary education programs.</subsection><subsection ssid="18-24" dnum="_-o:10-i" numlevel="1" lineno="57" slineno="1-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="start">(10)</amend></display><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="end">"Private postsecondary educational institution" means the same as that term is defined <ln numlevel="1" lineno="58" slineno="1-20"/>in Section <xref depth="3" refnumber="53H-1-101">53H-1-101</xref>.</amend></subsection><subsection ssid="18-null-10" dnum="10-o:11-i" numlevel="1" lineno="59" slineno="1-21" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1010" style="2" owner="o" level="1" deltag="both">(10)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="both" space="true">(11)</amend></display>"Provider" means a provider selected on behalf of the STEM board by the staff <ln numlevel="1" lineno="60" slineno="1-22"/>of the STEM board and the staff of the State Board of Education:<subsection ssid="18-null-11" dnum="a-o" numlevel="1" lineno="61" slineno="1-23" level="2"><display>(a)</display>through a request for proposals process; or</subsection><subsection ssid="18-null-12" dnum="b-o" numlevel="1" lineno="62" slineno="1-24" level="2"><display>(b)</display>through a direct award or sole source procurement process for a pilot described in <ln numlevel="1" lineno="63" slineno="1-25"/>Section <xref depth="3" refnumber="9-22-107" start="0">9-22-107</xref>.</subsection></subsection><subsection ssid="18-null-13" dnum="11-o:12-i" numlevel="1" lineno="64" slineno="1-26" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1013" style="2" owner="o" level="1" deltag="both">(11)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1014" style="1" owner="i" level="1" amendtag="both" space="true">(12)</amend></display>"Review committee" means the committee established under Section <xref depth="3" refnumber="9-22-114" start="0">9-22-114</xref>.</subsection><subsection ssid="18-null-14" dnum="12-o:13-i" numlevel="1" lineno="65" slineno="1-27" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1014" style="2" owner="o" level="1" deltag="both">(12)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1015" style="1" owner="i" level="1" amendtag="both" space="true">(13)</amend></display>"Stacked credentials" means credentials that:<subsection ssid="18-null-15" dnum="a-o" numlevel="1" lineno="66" slineno="1-28" level="2"><display>(a)</display>an individual can build upon to access an advanced job or higher wage;</subsection><subsection ssid="18-null-16" dnum="b-o" numlevel="1" lineno="67" slineno="1-29" level="2"><display>(b)</display>are part of a career pathway system;</subsection><subsection ssid="18-null-17" dnum="c-o" numlevel="1" lineno="68" slineno="1-30" level="2"><display>(c)</display>provide a pathway culminating in the equivalent of an associate's or bachelor's <ln numlevel="1" lineno="69" slineno="1-31"/>degree;</subsection><subsection ssid="18-null-18" dnum="d-o" numlevel="1" lineno="70" slineno="1-32" level="2"><display>(d)</display>facilitate multiple exit and entry points; and</subsection><subsection ssid="18-null-19" dnum="e-o" numlevel="1" lineno="71" slineno="1-33" level="2"><display>(e)</display>recognize sub-goals or momentum points.</subsection></subsection><subsection ssid="18-null-20" dnum="13-o:14-i" numlevel="1" lineno="72" slineno="1-34" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1020" style="2" owner="o" level="1" deltag="both">(13)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1021" style="1" owner="i" level="1" amendtag="both" space="true">(14)</amend></display>"STEM" means science, technology, engineering, and mathematics.</subsection><subsection ssid="18-null-21" dnum="14-o:15-i" numlevel="1" lineno="73" slineno="1-35" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1021" style="2" owner="o" level="1" deltag="both">(14)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1022" style="1" owner="i" level="1" amendtag="both" space="true">(15)</amend></display>"STEM Action Center" means the center described in Section <xref depth="3" refnumber="9-22-106" start="0">9-22-106</xref>.</subsection><subsection ssid="18-null-22" dnum="15-o:16-i" numlevel="1" lineno="74" slineno="1-36" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1022" style="2" owner="o" level="1" deltag="both">(15)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1023" style="1" owner="i" level="1" amendtag="both" space="true">(16)</amend></display>"STEM board" means the STEM Action Center Board created in Section <xref depth="3" refnumber="9-22-103" start="0"><ln numlevel="1" lineno="75" slineno="1-37"/>9-22-103</xref>.</subsection><subsection ssid="18-null-23" dnum="16-o:17-i" numlevel="1" lineno="76" slineno="1-38" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1023" style="2" owner="o" level="1" deltag="both">(16)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1024" style="1" owner="i" level="1" amendtag="both" space="true">(17)</amend></display>"Talent Ready Program" means the Talent Ready Utah Program created in <ln numlevel="1" lineno="77" slineno="1-39"/>Section <xref depth="3" refnumber="53H-13-303">53H-13-303</xref>.</subsection></section></bsec><bsec buid="20" num="9-22-104" type="amend" src="code" uid="C9-22-S104_2026050620260506" sort="09 22 01040020260506" numlevel="1" lineno="78" slineno="2-1" sn="2"><section number="9-22-104" numlevel="1" lineno="79" slineno="2-2" type="amend"><secline lineno="78">Section 2. Section <bold>9-22-104</bold> is amended to read:</secline><catline lineno="79"><bold>9-22-104<parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>05/06/26</date></paren></parens>. STEM Action Center Board -- Duties.</bold></catline><subsection ssid="20-null-1" dnum="1-o" numlevel="1" lineno="80" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>The STEM board shall:<subsection ssid="20-null-2" dnum="a-o" numlevel="1" lineno="81" slineno="2-4" level="2"><display>(a)</display>establish <marker pairid="7"><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="8" style="2" owner="jchristopherson" level="1" deltag="both">a</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="9" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the</amend></marker> STEM Action Center to:<subsection ssid="20-null-3" dnum="i-o" numlevel="1" lineno="82" slineno="2-5" level="3"><display>(i)</display>coordinate STEM activities in the state among the following stakeholders:<subsection ssid="20-null-4" dnum="A-o" numlevel="1" lineno="83" slineno="2-6" level="4"><display>(A)</display>the State Board of Education;</subsection><subsection ssid="20-null-5" dnum="B-o" numlevel="1" lineno="84" slineno="2-7" level="4"><display>(B)</display>school districts and charter schools;</subsection><subsection ssid="20-null-6" dnum="C-o" numlevel="1" lineno="85" slineno="2-8" level="4"><display>(C)</display>the Utah Board of Higher Education;</subsection><subsection ssid="20-null-7" dnum="D-o" numlevel="1" lineno="86" slineno="2-9" level="4"><display>(D)</display>institutions of higher education;</subsection><subsection ssid="20-44" dnum="_-o:E-i" numlevel="1" lineno="87" slineno="2-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1031" style="1" owner="i" level="1" amendtag="start">(E)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">private postsecondary educational institution;</amend></subsection><subsection ssid="20-null-8" dnum="E-o:F-i" numlevel="1" lineno="88" slineno="2-11" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1032" style="2" owner="o" level="1" deltag="both">(E)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1033" style="1" owner="i" level="1" amendtag="both" space="true">(F)</amend></display>parents of home-schooled students;</subsection><subsection ssid="20-null-9" dnum="F-o:G-i" numlevel="1" lineno="89" slineno="2-12" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1033" style="2" owner="o" level="1" deltag="both">(F)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1034" style="1" owner="i" level="1" amendtag="both" space="true">(G)</amend></display>other state agencies; and</subsection><subsection ssid="20-null-10" dnum="G-o:H-i" numlevel="1" lineno="90" slineno="2-13" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1034" style="2" owner="o" level="1" deltag="both">(G)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1035" style="1" owner="i" level="1" amendtag="both" space="true">(H)</amend></display>business and industry representatives; </subsection></subsection><subsection ssid="20-null-11" dnum="ii-o" numlevel="1" lineno="91" slineno="2-14" level="3"><display>(ii)</display>align public education STEM activities with higher education STEM activities; <ln numlevel="1" lineno="92" slineno="2-15"/>and</subsection><subsection ssid="20-null-12" dnum="iii-o" numlevel="1" lineno="93" slineno="2-16" level="3"><display>(iii)</display>create and coordinate best practices among public education and higher <ln numlevel="1" lineno="94" slineno="2-17"/>education;</subsection></subsection><subsection ssid="20-null-13" dnum="b-o" numlevel="1" lineno="95" slineno="2-18" level="2"><display>(b)</display>with the advice and consent of the Senate, appoint a director to oversee the <ln numlevel="1" lineno="96" slineno="2-19"/>administration of the STEM Action Center;</subsection><subsection ssid="20-null-14" dnum="c-o" numlevel="1" lineno="97" slineno="2-20" level="2"><display>(c)</display>select a physical location for the STEM Action Center;</subsection><subsection ssid="20-null-15" dnum="d-o" numlevel="1" lineno="98" slineno="2-21" level="2"><display>(d)</display>strategically engage industry and business entities to cooperate with the STEM board:<subsection ssid="20-null-16" dnum="i-o" numlevel="1" lineno="99" slineno="2-22" level="3"><display>(i)</display>to support high quality professional development and provide other assistance for <ln numlevel="1" lineno="100" slineno="2-23"/>educators and students; and</subsection><subsection ssid="20-null-17" dnum="ii-o" numlevel="1" lineno="101" slineno="2-24" level="3"><display>(ii)</display>to provide private funding and support for the STEM Action Center;</subsection></subsection><subsection ssid="20-null-18" dnum="e-o" numlevel="1" lineno="102" slineno="2-25" level="2"><display>(e)</display>give direction to the STEM Action Center and the providers selected through a <ln numlevel="1" lineno="103" slineno="2-26"/>request for proposals process pursuant to this part; and</subsection><subsection ssid="20-null-19" dnum="f-o" numlevel="1" lineno="104" slineno="2-27" level="2"><display>(f)</display>work to meet the following expectations:<subsection ssid="20-null-20" dnum="i-o" numlevel="1" lineno="105" slineno="2-28" level="3"><display>(i)</display>that at least 50 educators are implementing best practice learning tools in <ln numlevel="1" lineno="106" slineno="2-29"/>classrooms;</subsection><subsection ssid="20-null-21" dnum="ii-o" numlevel="1" lineno="107" slineno="2-30" level="3"><display>(ii)</display>performance change in student achievement in each classroom participating in a <ln numlevel="1" lineno="108" slineno="2-31"/>STEM Action Center project; and</subsection><subsection ssid="20-null-22" dnum="iii-o" numlevel="1" lineno="109" slineno="2-32" level="3"><display>(iii)</display>that students from at least 50 schools <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="4" style="2" owner="jchristopherson" level="1" deltag="both"> </amend><amendoutend style="2"/>in the state <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="6" groupid="5" style="2" owner="jchristopherson" level="1" deltag="both"> </amend><amendoutend style="2"/>participate in the STEM <ln numlevel="1" lineno="110" slineno="2-33"/>competitions, fairs, and camps described in Subsection <xref depth="4" refnumber="9-22-106(2)(d)" start="0">9-22-106(2)(d)</xref>.</subsection></subsection></subsection><subsection ssid="20-null-23" dnum="2-o" numlevel="1" lineno="111" slineno="2-34" level="1"><display>(2)</display>The STEM board may:<subsection ssid="20-null-24" dnum="a-o" numlevel="1" lineno="112" slineno="2-35" level="2"><display>(a)</display>enter into contracts for the purposes of this part;</subsection><subsection ssid="20-null-25" dnum="b-o" numlevel="1" lineno="113" slineno="2-36" level="2"><display>(b)</display>apply for, receive, and disburse funds, contributions, or grants from any source for <ln numlevel="1" lineno="114" slineno="2-37"/>the purposes set forth in this part;</subsection><subsection ssid="20-null-26" dnum="c-o" numlevel="1" lineno="115" slineno="2-38" level="2"><display>(c)</display>employ, compensate, and prescribe the duties and powers of individuals necessary to <ln numlevel="1" lineno="116" slineno="2-39"/>execute the duties and powers of the STEM board;</subsection><subsection ssid="20-null-27" dnum="d-o" numlevel="1" lineno="117" slineno="2-40" level="2"><display>(d)</display>prescribe the duties and powers of the STEM Action Center providers; and</subsection><subsection ssid="20-null-28" dnum="e-o" numlevel="1" lineno="118" slineno="2-41" level="2"><display>(e)</display>in accordance with <xref depth="1" refnumber="63G-3" start="0">Title 63G, Chapter 3, Utah Administrative Rulemaking Act</xref>, <ln numlevel="1" lineno="119" slineno="2-42"/>make rules to administer this part.</subsection></subsection><subsection ssid="20-null-29" dnum="3-o" numlevel="1" lineno="120" slineno="2-43" level="1"><display>(3)</display>The STEM board may establish a foundation to assist in:<subsection ssid="20-null-30" dnum="a-o" numlevel="1" lineno="121" slineno="2-44" level="2"><display>(a)</display>the development and implementation of the programs authorized under this part to <ln numlevel="1" lineno="122" slineno="2-45"/>promote STEM education; and</subsection><subsection ssid="20-null-31" dnum="b-o" numlevel="1" lineno="123" slineno="2-46" level="2"><display>(b)</display>implementation of other STEM education objectives described in this part.</subsection></subsection><subsection ssid="20-null-32" dnum="4-o" numlevel="1" lineno="124" slineno="2-47" level="1"><display>(4)</display>A foundation established by the STEM board under Subsection <xref depth="4" refnumber="9-22-104(3)" start="0">(3)</xref>:<subsection ssid="20-null-33" dnum="a-o" numlevel="1" lineno="125" slineno="2-48" level="2"><display>(a)</display>may solicit and receive contributions from a private organization for STEM <ln numlevel="1" lineno="126" slineno="2-49"/>education objectives described in this part;</subsection><subsection ssid="20-null-34" dnum="b-o" numlevel="1" lineno="127" slineno="2-50" level="2"><display>(b)</display>shall comply with the requirements described in Section <xref depth="3" refnumber="9-22-105" start="0">9-22-105</xref>;</subsection><subsection ssid="20-null-35" dnum="c-o" numlevel="1" lineno="128" slineno="2-51" level="2"><display>(c)</display>does not have power or authority to incur contractual obligations or liabilities that <ln numlevel="1" lineno="129" slineno="2-52"/>constitute a claim against public funds;</subsection><subsection ssid="20-null-36" dnum="d-o" numlevel="1" lineno="130" slineno="2-53" level="2"><display>(d)</display>may not exercise executive or administrative authority over the programs or other <ln numlevel="1" lineno="131" slineno="2-54"/>activities described in this part, except to the extent specifically authorized by the <ln numlevel="1" lineno="132" slineno="2-55"/>STEM board;</subsection><subsection ssid="20-null-37" dnum="e-o" numlevel="1" lineno="133" slineno="2-56" level="2"><display>(e)</display>shall provide the STEM board with information detailing transactions and balances <ln numlevel="1" lineno="134" slineno="2-57"/>associated with the foundation; and</subsection><subsection ssid="20-null-38" dnum="f-o" numlevel="1" lineno="135" slineno="2-58" level="2"><display>(f)</display>may not:<subsection ssid="20-null-39" dnum="i-o" numlevel="1" lineno="136" slineno="2-59" level="3"><display>(i)</display>engage in lobbying activities;</subsection><subsection ssid="20-null-40" dnum="ii-o" numlevel="1" lineno="137" slineno="2-60" level="3"><display>(ii)</display>attempt to influence legislation; or</subsection><subsection ssid="20-null-41" dnum="iii-o" numlevel="1" lineno="138" slineno="2-61" level="3"><display>(iii)</display>participate in any campaign activity for or against:<subsection ssid="20-null-42" dnum="A-o" numlevel="1" lineno="139" slineno="2-62" level="4"><display>(A)</display>a political candidate; or</subsection><subsection ssid="20-null-43" dnum="B-o" numlevel="1" lineno="140" slineno="2-63" level="4"><display>(B)</display>an initiative, referendum, proposed constitutional amendment, bond, or any <ln numlevel="1" lineno="141" slineno="2-64"/>other ballot proposition submitted to the voters.</subsection></subsection></subsection></subsection></section></bsec><bsec buid="22" num="9-22-113" type="amend" src="code" uid="C9-22-S113_2026050620260506" sort="09 22 01130020260506" numlevel="1" lineno="142" slineno="3-1" sn="3"><section number="9-22-113" numlevel="1" lineno="143" slineno="3-2" type="amend"><secline lineno="142">Section 3. Section <bold>9-22-113</bold> is amended to read:</secline><catline lineno="143"><bold>9-22-113<parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>05/06/26</date></paren></parens>. Computer science initiative for public schools.</bold></catline><subsection ssid="22-null-1" dnum="1-o" numlevel="1" lineno="144" slineno="3-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="22-null-2" dnum="a-o" numlevel="1" lineno="145" slineno="3-4" level="2"><display>(a)</display>"Computational thinking" means the set of problem-solving skills and techniques that <ln numlevel="1" lineno="146" slineno="3-5"/>software engineers use to write programs that underlie computer applications, <ln numlevel="1" lineno="147" slineno="3-6"/>including decomposition, pattern recognition, pattern generalization, and algorithm <ln numlevel="1" lineno="148" slineno="3-7"/>design.</subsection><subsection ssid="22-null-3" dnum="b-o" numlevel="1" lineno="149" slineno="3-8" level="2"><display>(b)</display>"Computer coding" means the process of writing script for a computer program or <ln numlevel="1" lineno="150" slineno="3-9"/>mobile device.</subsection><subsection ssid="22-null-4" dnum="c-o" numlevel="1" lineno="151" slineno="3-10" level="2"><display>(c)</display>"Educator" means the same as that term is defined in Section <xref depth="3" refnumber="53E-6-102" start="0">53E-6-102</xref>.</subsection><subsection ssid="22-null-5" dnum="d-o" numlevel="1" lineno="152" slineno="3-11" level="2"><display>(d)</display>"Endorsement" means a stipulation, authorized by the State Board of Education and <ln numlevel="1" lineno="153" slineno="3-12"/>appended to a license, that specifies the areas of practice to which the license applies.</subsection><subsection ssid="22-null-6" dnum="e-o" numlevel="1" lineno="154" slineno="3-13" level="2"><display>(e)</display>"Institution of higher education" means the same as that term is defined in Section <xref depth="3" refnumber="53H-1-101"><ln numlevel="1" lineno="155" slineno="3-14"/>53H-1-101</xref>.</subsection><subsection ssid="22-null-7" dnum="f-o" numlevel="1" lineno="156" slineno="3-15" level="2"><display>(f)</display>"Employer" means a private employer, public employer, industry association, union, <ln numlevel="1" lineno="157" slineno="3-16"/>or the military.</subsection><subsection ssid="22-null-8" dnum="g-o" numlevel="1" lineno="158" slineno="3-17" level="2"><display>(g)</display>"License" means the same as that term is defined in Section <xref depth="3" refnumber="53E-6-102" start="0">53E-6-102</xref>.</subsection><subsection ssid="22-28" dnum="_-o:h-i" numlevel="1" lineno="159" slineno="3-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1076" style="1" owner="i" level="1" amendtag="start">(h)</amend></display><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="end">"Private postsecondary educational institution" means the same as that term is <ln numlevel="1" lineno="160" slineno="3-19"/>defined in Section <xref depth="3" refnumber="53H-1-101">53H-1-101</xref>.</amend></subsection></subsection><subsection ssid="22-null-9" dnum="2-o" numlevel="1" lineno="161" slineno="3-20" level="1"><display>(2)</display>Subject to legislative appropriations, on behalf of the STEM board, the staff of the <ln numlevel="1" lineno="162" slineno="3-21"/>STEM board and the staff of the State Board of Education shall collaborate to develop <ln numlevel="1" lineno="163" slineno="3-22"/>and implement a computer science initiative for public schools by:<subsection ssid="22-null-10" dnum="a-o" numlevel="1" lineno="164" slineno="3-23" level="2"><display>(a)</display>creating an online repository that:<subsection ssid="22-null-11" dnum="i-o" numlevel="1" lineno="165" slineno="3-24" level="3"><display>(i)</display>is available for school districts and charter schools to use as a resource; and</subsection><subsection ssid="22-null-12" dnum="ii-o" numlevel="1" lineno="166" slineno="3-25" level="3"><display>(ii)</display>includes high quality computer science instructional resources that are designed <ln numlevel="1" lineno="167" slineno="3-26"/>to teach students in all grade levels:<subsection ssid="22-null-13" dnum="A-o" numlevel="1" lineno="168" slineno="3-27" level="4"><display>(A)</display>computational thinking skills; and</subsection><subsection ssid="22-null-14" dnum="B-o" numlevel="1" lineno="169" slineno="3-28" level="4"><display>(B)</display>computer coding skills;</subsection></subsection></subsection><subsection ssid="22-null-15" dnum="b-o" numlevel="1" lineno="170" slineno="3-29" level="2"><display>(b)</display>providing for professional development on teaching computer science by:<subsection ssid="22-null-16" dnum="i-o" numlevel="1" lineno="171" slineno="3-30" level="3"><display>(i)</display>including resources for educators related to teaching computational thinking and <ln numlevel="1" lineno="172" slineno="3-31"/>computer coding in the STEM education high quality professional development <ln numlevel="1" lineno="173" slineno="3-32"/>application described in Section <xref depth="3" refnumber="9-22-110" start="0">9-22-110</xref>; and</subsection><subsection ssid="22-null-17" dnum="ii-o" numlevel="1" lineno="174" slineno="3-33" level="3"><display>(ii)</display>providing statewide or regional professional development institutes; and</subsection></subsection><subsection ssid="22-null-18" dnum="c-o" numlevel="1" lineno="175" slineno="3-34" level="2"><display>(c)</display>awarding grants to a school district or charter school, on a competitive basis, that <ln numlevel="1" lineno="176" slineno="3-35"/>may be used to provide incentives for an educator to earn a computer science <ln numlevel="1" lineno="177" slineno="3-36"/>endorsement.</subsection></subsection><subsection ssid="22-null-19" dnum="3-o" numlevel="1" lineno="178" slineno="3-37" level="1"><display>(3)</display>A school district or charter school may enter into an agreement with one or more of the <ln numlevel="1" lineno="179" slineno="3-38"/>following entities to jointly apply for a grant under Subsection <xref depth="4" refnumber="9-22-113(2)(c)" start="0">(2)(c)</xref>:<subsection ssid="22-null-20" dnum="a-o" numlevel="1" lineno="180" slineno="3-39" level="2"><display>(a)</display>a school district;</subsection><subsection ssid="22-null-21" dnum="b-o" numlevel="1" lineno="181" slineno="3-40" level="2"><display>(b)</display>a charter school;</subsection><subsection ssid="22-null-22" dnum="c-o" numlevel="1" lineno="182" slineno="3-41" level="2"><display>(c)</display>an employer;</subsection><subsection ssid="22-29" dnum="_-o:d-i" numlevel="1" lineno="183" slineno="3-42" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1091" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="8" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="end">a private postsecondary educational institution;</amend></subsection><subsection ssid="22-null-23" dnum="d-o:e-i" numlevel="1" lineno="184" slineno="3-43" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1092" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1093" style="1" owner="i" level="1" amendtag="both" space="true">(e)</amend></display>an institution of higher education; or</subsection><subsection ssid="22-null-24" dnum="e-o:f-i" numlevel="1" lineno="185" slineno="3-44" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1093" style="2" owner="o" level="1" deltag="both">(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1094" style="1" owner="i" level="1" amendtag="both" space="true">(f)</amend></display>a non-profit organization.</subsection></subsection><subsection ssid="22-null-25" dnum="4-o" numlevel="1" lineno="186" slineno="3-45" level="1"><display>(4)</display>To apply for a grant described in Subsection <xref depth="4" refnumber="9-22-113(2)(c)" start="0">(2)(c)</xref>, a school district or charter school <ln numlevel="1" lineno="187" slineno="3-46"/>shall submit a plan to the State Board of Education for the use of the grant, including a <ln numlevel="1" lineno="188" slineno="3-47"/>statement of purpose that describes the methods the school district or charter school <ln numlevel="1" lineno="189" slineno="3-48"/>proposes to use to incentivize an educator to earn a computer science endorsement.</subsection><subsection ssid="22-null-26" dnum="5-o" numlevel="1" lineno="190" slineno="3-49" level="1"><display>(5)</display>The State Board of Education and the STEM board shall encourage schools to <ln numlevel="1" lineno="191" slineno="3-50"/>independently pursue computer science and coding initiatives, subject to local school <ln numlevel="1" lineno="192" slineno="3-51"/>board or charter school governing board approval, based on the unique needs of the <ln numlevel="1" lineno="193" slineno="3-52"/>school's students.</subsection><subsection ssid="22-null-27" dnum="6-o" numlevel="1" lineno="194" slineno="3-53" level="1"><display>(6)</display>The STEM board shall include information on the status of the computer science <ln numlevel="1" lineno="195" slineno="3-54"/>initiative in the annual report described in Section <xref depth="3" refnumber="9-22-109" start="0">9-22-109</xref>.</subsection></section></bsec><bsec buid="24" num="9-22-114" type="amend" src="code" uid="C9-22-S114_2026050620260506" sort="09 22 01140020260506" numlevel="1" lineno="196" slineno="4-1" sn="4"><section number="9-22-114" numlevel="1" lineno="197" slineno="4-2" type="amend"><secline lineno="196">Section 4. Section <bold>9-22-114</bold> is amended to read:</secline><catline lineno="197"><bold>9-22-114<parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>05/06/26</date></paren></parens>. Computing Partnerships Grants program.</bold></catline><subsection ssid="24-null-1" dnum="1-o" numlevel="1" lineno="198" slineno="4-3" level="1" placement="noreturn"><display>(1)</display>There is created the Computing Partnerships Grants program consisting of the grants <ln numlevel="1" lineno="199" slineno="4-4"/>created in this part to provide for the design and implementation of a comprehensive <ln numlevel="1" lineno="200" slineno="4-5"/>K-16 computing partnerships program, based upon the following common elements:<subsection ssid="24-null-2" dnum="a-o" numlevel="1" lineno="201" slineno="4-6" level="2"><display>(a)</display>outreach and student engagement;</subsection><subsection ssid="24-null-3" dnum="b-o" numlevel="1" lineno="202" slineno="4-7" level="2"><display>(b)</display>courses and content;</subsection><subsection ssid="24-null-4" dnum="c-o" numlevel="1" lineno="203" slineno="4-8" level="2"><display>(c)</display>instruction and instructional support;</subsection><subsection ssid="24-null-5" dnum="d-o" numlevel="1" lineno="204" slineno="4-9" level="2"><display>(d)</display>work-based learning opportunities;</subsection><subsection ssid="24-null-6" dnum="e-o" numlevel="1" lineno="205" slineno="4-10" level="2"><display>(e)</display>student retention;</subsection><subsection ssid="24-null-7" dnum="f-o" numlevel="1" lineno="206" slineno="4-11" level="2"><display>(f)</display>industry engagement;</subsection><subsection ssid="24-null-8" dnum="g-o" numlevel="1" lineno="207" slineno="4-12" level="2"><display>(g)</display>stacked credentials that allow for multiple exit and entry points;</subsection><subsection ssid="24-null-9" dnum="h-o" numlevel="1" lineno="208" slineno="4-13" level="2"><display>(h)</display>competency-based learning strategies; and</subsection><subsection ssid="24-null-10" dnum="i-o" numlevel="1" lineno="209" slineno="4-14" level="2"><display>(i)</display>secondary and post-secondary collaborations.</subsection></subsection><subsection ssid="24-null-11" dnum="2-o" numlevel="1" lineno="210" slineno="4-15" level="1"><display>(2)</display>The grant program shall incentivize public schools and school districts to work with the <ln numlevel="1" lineno="211" slineno="4-16"/>STEM Action Center, staff of the State Board of Education, Talent Ready Utah, industry <ln numlevel="1" lineno="212" slineno="4-17"/>representatives, and secondary partners on the design and implementation of <ln numlevel="1" lineno="213" slineno="4-18"/>comprehensive K-16 computing partnerships through:<subsection ssid="24-null-12" dnum="a-o" numlevel="1" lineno="214" slineno="4-19" level="2"><display>(a)</display>leveraging existing resources for content, professional learning, and instruction, <ln numlevel="1" lineno="215" slineno="4-20"/>including existing career and technical education funds, programs, and initiatives;</subsection><subsection ssid="24-null-13" dnum="b-o" numlevel="1" lineno="216" slineno="4-21" level="2"><display>(b)</display>allowing for the support of professional learning for pre- and in-service educators;</subsection><subsection ssid="24-null-14" dnum="c-o" numlevel="1" lineno="217" slineno="4-22" level="2"><display>(c)</display>supporting activities that promote and enhance access, diversity, and equity;</subsection><subsection ssid="24-null-15" dnum="d-o" numlevel="1" lineno="218" slineno="4-23" level="2"><display>(d)</display>supporting collaborations and partnerships between K-12, institutions of higher <ln numlevel="1" lineno="219" slineno="4-24"/>education, <amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">private postsecondary educational institutions, </amend>cultural and community <ln numlevel="1" lineno="220" slineno="4-25"/>partners, and industry representatives;</subsection><subsection ssid="24-null-16" dnum="e-o" numlevel="1" lineno="221" slineno="4-26" level="2"><display>(e)</display>identifying the appropriate credentials that align with industry needs and providing <ln numlevel="1" lineno="222" slineno="4-27"/>the credentials in a stacked credentials pathway;</subsection><subsection ssid="24-null-17" dnum="f-o" numlevel="1" lineno="223" slineno="4-28" level="2"><display>(f)</display>implementing a collaborative network that enables sharing and identification of best <ln numlevel="1" lineno="224" slineno="4-29"/>practices; and</subsection><subsection ssid="24-null-18" dnum="g-o" numlevel="1" lineno="225" slineno="4-30" level="2"><display>(g)</display>providing infrastructure assistance that allows for the support of new courses and the <ln numlevel="1" lineno="226" slineno="4-31"/>expansion of capacity for existing courses.</subsection></subsection><subsection ssid="24-null-19" dnum="3-o" numlevel="1" lineno="227" slineno="4-32" level="1"><display>(3)</display>The grant program shall include the following:<subsection ssid="24-null-20" dnum="a-o" numlevel="1" lineno="228" slineno="4-33" level="2"><display>(a)</display>rigorous and relevant metrics that are shared by all grant participants; and</subsection><subsection ssid="24-null-21" dnum="b-o" numlevel="1" lineno="229" slineno="4-34" level="2"><display>(b)</display>an evaluation by the STEM Action Center of the grant program that identifies best <ln numlevel="1" lineno="230" slineno="4-35"/>practices.</subsection></subsection><subsection ssid="24-null-22" dnum="4-o" numlevel="1" lineno="231" slineno="4-36" level="1"><display>(4)</display>The STEM Action Center, in consultation with the State Board of Education, shall:<subsection ssid="24-null-23" dnum="a-o" numlevel="1" lineno="232" slineno="4-37" level="2"><display>(a)</display>in accordance with <xref depth="1" refnumber="63G-3" start="0">Title 63G, Chapter 3, Utah Administrative Rulemaking Act</xref>, <ln numlevel="1" lineno="233" slineno="4-38"/>adopt rules:<subsection ssid="24-null-24" dnum="i-o" numlevel="1" lineno="234" slineno="4-39" level="3"><display>(i)</display>for the administration of the grant program and awarding of grants; and</subsection><subsection ssid="24-null-25" dnum="ii-o" numlevel="1" lineno="235" slineno="4-40" level="3"><display>(ii)</display>that define outcome-based measures appropriate to the type of grant awarded <ln numlevel="1" lineno="236" slineno="4-41"/>under this part;</subsection></subsection><subsection ssid="24-null-26" dnum="b-o" numlevel="1" lineno="237" slineno="4-42" level="2"><display>(b)</display>establish a grant application process;</subsection><subsection ssid="24-null-27" dnum="c-o" numlevel="1" lineno="238" slineno="4-43" level="2"><display>(c)</display>in accordance with Subsection <xref depth="4" refnumber="9-22-114(5)" start="0">(5)</xref>, establish a review committee to make <ln numlevel="1" lineno="239" slineno="4-44"/>recommendations for:<subsection ssid="24-null-28" dnum="i-o" numlevel="1" lineno="240" slineno="4-45" level="3"><display>(i)</display>metrics to analyze the quality of a grant application;</subsection><subsection ssid="24-null-29" dnum="ii-o" numlevel="1" lineno="241" slineno="4-46" level="3"><display>(ii)</display>approval of a grant application; and</subsection><subsection ssid="24-null-30" dnum="iii-o" numlevel="1" lineno="242" slineno="4-47" level="3"><display>(iii)</display>criteria to establish a requirement for an applicant to demonstrate financial need; <ln numlevel="1" lineno="243" slineno="4-48"/>and</subsection></subsection><subsection ssid="24-null-31" dnum="d-o" numlevel="1" lineno="244" slineno="4-49" level="2"><display>(d)</display>with input from the review committee, adopt metrics to analyze the quality of a grant <ln numlevel="1" lineno="245" slineno="4-50"/>application.</subsection></subsection><subsection ssid="24-null-32" dnum="5-o" numlevel="1" lineno="246" slineno="4-51" level="1" space="false"><display>(5)</display><subsection ssid="24-null-33" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The review committee shall consist of K-16 educators, staff of the State Board of <ln numlevel="1" lineno="247" slineno="4-52"/>Education, representatives of Talent Ready Utah, post-secondary partners, and <ln numlevel="1" lineno="248" slineno="4-53"/>industry representatives.</subsection><subsection ssid="24-null-34" dnum="b-o" numlevel="1" lineno="249" slineno="4-54" level="2"><display>(b)</display>The review committee shall:<subsection ssid="24-null-35" dnum="i-o" numlevel="1" lineno="250" slineno="4-55" level="3"><display>(i)</display>review a grant application submitted;</subsection><subsection ssid="24-null-36" dnum="ii-o" numlevel="1" lineno="251" slineno="4-56" level="3"><display>(ii)</display>make recommendations to a grant applicant to modify the grant application, if <ln numlevel="1" lineno="252" slineno="4-57"/>necessary; and</subsection><subsection ssid="24-null-37" dnum="iii-o" numlevel="1" lineno="253" slineno="4-58" level="3"><display>(iii)</display>make recommendations regarding the final disposition of an application.</subsection></subsection></subsection><subsection ssid="24-null-38" dnum="6-o" numlevel="1" lineno="254" slineno="4-59" level="1"><display>(6)</display>The STEM Action Center shall report annually on the grant program to the State Board <ln numlevel="1" lineno="255" slineno="4-60"/>of Education and any findings and recommendations on the grant program shall be <ln numlevel="1" lineno="256" slineno="4-61"/>included in the STEM Action Center annual report to the Education Interim Committee.</subsection></section></bsec><bsec buid="9" num="53-8-105" type="amend" src="code" uid="C53-8-S105_2026050620260506" sort="53 08 01050020260506" numlevel="1" lineno="257" slineno="5-1" sn="5"><section number="53-8-105" numlevel="1" lineno="258" slineno="5-2" type="amend"><secline lineno="257">Section 5. Section <bold>53-8-105</bold> is amended to read:</secline><catline lineno="258"><bold>53-8-105<parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>05/06/26</date></paren></parens>. Duties of Highway Patrol.</bold></catline><subsection ssid="9-null-1" dnum="1-o" numlevel="1" lineno="259" slineno="5-3" level="1" placement="noreturn"><display>(1)</display>In addition to the duties in this chapter, the Highway Patrol shall:<subsection ssid="9-null-2" dnum="a-o" numlevel="1" lineno="260" slineno="5-4" level="2"><display>(a)</display>enforce the state laws and rules governing use of the state highways;</subsection><subsection ssid="9-null-3" dnum="b-o" numlevel="1" lineno="261" slineno="5-5" level="2"><display>(b)</display>regulate traffic on all highways and roads of the state;</subsection><subsection ssid="9-null-4" dnum="c-o" numlevel="1" lineno="262" slineno="5-6" level="2"><display>(c)</display>assist the governor in an emergency or at other times at his discretion;</subsection><subsection ssid="9-null-5" dnum="d-o" numlevel="1" lineno="263" slineno="5-7" level="2"><display>(d)</display>in cooperation with federal, state, and local agencies, enforce and assist in the <ln numlevel="1" lineno="264" slineno="5-8"/>enforcement of all state and federal laws related to the operation of a motor carrier on <ln numlevel="1" lineno="265" slineno="5-9"/>a highway, including all state and federal rules and regulations;</subsection><subsection ssid="9-null-6" dnum="e-o" numlevel="1" lineno="266" slineno="5-10" level="2"><display>(e)</display>inspect certain vehicles to determine road worthiness and safe condition as provided <ln numlevel="1" lineno="267" slineno="5-11"/>in Section <xref depth="3" refnumber="41-6a-1630">41-6a-1630</xref>;</subsection><subsection ssid="9-null-7" dnum="f-o" numlevel="1" lineno="268" slineno="5-12" level="2"><display>(f)</display>upon request, assist with any condition of unrest existing or developing on a campus <ln numlevel="1" lineno="269" slineno="5-13"/>or related facility of an institution of higher education<amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both"> or private postsecondary <ln numlevel="1" lineno="270" slineno="5-14"/>educational institution</amend>;</subsection><subsection ssid="9-null-8" dnum="g-o" numlevel="1" lineno="271" slineno="5-15" level="2"><display>(g)</display>assist the Alcoholic Beverage Services Commission in an emergency to enforce the <ln numlevel="1" lineno="272" slineno="5-16"/>state liquor laws;</subsection><subsection ssid="9-null-9" dnum="h-o" numlevel="1" lineno="273" slineno="5-17" level="2"><display>(h)</display>provide security and protection for both houses of the Legislature while in session as <ln numlevel="1" lineno="274" slineno="5-18"/>the speaker of the House of Representatives and the president of the Senate find <ln numlevel="1" lineno="275" slineno="5-19"/>necessary;</subsection><subsection ssid="9-null-10" dnum="i-o" numlevel="1" lineno="276" slineno="5-20" level="2"><display>(i)</display>enforce the state laws and rules governing use of capitol hill; and</subsection><subsection ssid="9-null-11" dnum="j-o" numlevel="1" lineno="277" slineno="5-21" level="2"><display>(j)</display>carry out the following for the Supreme Court and the Court of Appeals:<subsection ssid="9-null-12" dnum="i-o" numlevel="1" lineno="278" slineno="5-22" level="3"><display>(i)</display>provide security and protection to those courts when in session in the capital city <ln numlevel="1" lineno="279" slineno="5-23"/>of the state;</subsection><subsection ssid="9-null-13" dnum="ii-o" numlevel="1" lineno="280" slineno="5-24" level="3"><display>(ii)</display>execute orders issued by the courts; and</subsection><subsection ssid="9-null-14" dnum="iii-o" numlevel="1" lineno="281" slineno="5-25" level="3"><display>(iii)</display>carry out duties as directed by the courts.</subsection></subsection></subsection><subsection ssid="9-null-15" dnum="2-o" numlevel="1" lineno="282" slineno="5-26" level="1" space="false"><display>(2)</display><subsection ssid="9-null-16" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The division and the department shall annually:<subsection ssid="9-null-17" dnum="i-o" numlevel="1" lineno="283" slineno="5-27" level="3" tab="1"><display>(i)</display>evaluate the inventory of new and existing state highways, in coordination with <ln numlevel="1" lineno="284" slineno="5-28"/>relevant local law enforcement agencies, to determine which law enforcement <ln numlevel="1" lineno="285" slineno="5-29"/>agency is best suited to patrol and enforce state laws and regulate traffic on each <ln numlevel="1" lineno="286" slineno="5-30"/>state highway; and</subsection><subsection ssid="9-null-18" dnum="ii-o" numlevel="1" lineno="287" slineno="5-31" level="3" tab="1"><display>(ii)</display>before October 1 of each year, report to the Transportation Interim Committee <ln numlevel="1" lineno="288" slineno="5-32"/>and the Criminal Justice Appropriations Subcommittee regarding:<subsection ssid="9-null-19" dnum="A-o" numlevel="1" lineno="289" slineno="5-33" level="4"><display>(A)</display>significant changes to the patrol and enforcement responsibilities resulting <ln numlevel="1" lineno="290" slineno="5-34"/>from the evaluation described in Subsection <xref depth="4" refnumber="53-8-105(2)(a)(i)">(2)(a)(i)</xref>; and</subsection><subsection ssid="9-null-20" dnum="B-o" numlevel="1" lineno="291" slineno="5-35" level="4"><display>(B)</display>any budget request necessary to accommodate additional patrol and <ln numlevel="1" lineno="292" slineno="5-36"/>enforcement responsibilities.</subsection></subsection></subsection><subsection ssid="9-null-21" dnum="b-o" numlevel="1" lineno="293" slineno="5-37" level="2"><display>(b)</display>The division and the department shall, before July 1 of each year, coordinate with the <ln numlevel="1" lineno="294" slineno="5-38"/>Department of Transportation created in Section <xref depth="3" refnumber="72-1-201">72-1-201</xref> regarding patrol and <ln numlevel="1" lineno="295" slineno="5-39"/>enforcement responsibilities described in Subsection <xref depth="4" refnumber="53-8-105(2)(a)">(2)(a)</xref> and incident management <ln numlevel="1" lineno="296" slineno="5-40"/>services on state highways.</subsection></subsection><subsection ssid="9-null-22" dnum="3-o" numlevel="1" lineno="297" slineno="5-41" level="1" space="false"><display>(3)</display><subsection ssid="9-null-23" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A district court and a justice court shall collect and maintain data regarding <ln numlevel="1" lineno="298" slineno="5-42"/>violations in Sections <xref depth="3" refnumber="41-6a-1712">41-6a-1712</xref>, <xref depth="3" refnumber="41-6a-1713">41-6a-1713</xref>, and <xref depth="3" refnumber="72-7-409">72-7-409</xref>.</subsection><subsection ssid="9-null-24" dnum="b-o" numlevel="1" lineno="299" slineno="5-43" level="2"><display>(b)</display>Each court shall transmit dispositions described in Subsection <xref depth="4" refnumber="53-8-105(3)(a)">(3)(a)</xref> electronically to <ln numlevel="1" lineno="300" slineno="5-44"/>the department.</subsection></subsection></section></bsec><bsec buid="14" num="53H-11-306" type="amend" src="code" uid="C53H-11-S306_2026050620260506" sort="53H11 03060020260506" numlevel="1" lineno="301" slineno="6-1" sn="6"><section number="53H-11-306" numlevel="1" lineno="302" slineno="6-2" type="amend"><secline lineno="301">Section 6. Section <bold>53H-11-306</bold> is amended to read:</secline><catline lineno="302"><bold>53H-11-306<parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>05/06/26</date></paren></parens>. Police officer's and firefighter's survivor tuition <ln numlevel="1" lineno="303" slineno="6-3"/>waiver.</bold></catline><subsection ssid="14-null-1" dnum="1-o" numlevel="1" lineno="304" slineno="6-4" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="14-null-2" dnum="a-o" numlevel="1" lineno="305" slineno="6-5" level="2"><display>(a)</display>"Child" means an individual who:<subsection ssid="14-null-3" dnum="i-o" numlevel="1" lineno="306" slineno="6-6" level="3"><display>(i)</display>is a natural or adopted child of a deceased peace officer or deceased firefighter; and</subsection><subsection ssid="14-null-4" dnum="ii-o" numlevel="1" lineno="307" slineno="6-7" level="3"><display>(ii)</display>was under the age of 25 at the time of the peace officer's or firefighter's death.</subsection></subsection><subsection ssid="14-null-5" dnum="b-o" numlevel="1" lineno="308" slineno="6-8" level="2"><display>(b)</display>"Department" means the Department of Public Safety.</subsection><subsection ssid="14-null-6" dnum="c-o" numlevel="1" lineno="309" slineno="6-9" level="2" space="false"><display>(c)</display><subsection ssid="14-null-7" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"Fees" means general course fees, in addition to tuition, that are:<subsection ssid="14-null-8" dnum="A-o" numlevel="1" lineno="310" slineno="6-10" level="4" tab="1"><display>(A)</display>imposed by an institution of higher education; and</subsection><subsection ssid="14-null-9" dnum="B-o" numlevel="1" lineno="311" slineno="6-11" level="4" tab="1"><display>(B)</display>required to be paid by a student to engage in a course of study at the <ln numlevel="1" lineno="312" slineno="6-12"/>institution of higher education.</subsection></subsection><subsection ssid="14-null-10" dnum="ii-o" numlevel="1" lineno="313" slineno="6-13" level="3"><display>(ii)</display>"Fees" does not include a special course fee.</subsection></subsection><subsection ssid="14-null-11" dnum="d-o" numlevel="1" lineno="314" slineno="6-14" level="2"><display>(d)</display>"Killed" means that the peace officer's or firefighter's death is the direct and <ln numlevel="1" lineno="315" slineno="6-15"/>proximate result of a traumatic injury incurred in the line of duty.</subsection><subsection ssid="14-null-12" dnum="e-o" numlevel="1" lineno="316" slineno="6-16" level="2"><display>(e)</display>"Line of duty" means an action that a peace officer or firefighter is obligated or <ln numlevel="1" lineno="317" slineno="6-17"/>authorized to perform by rule, regulation, condition of employment or service, or <ln numlevel="1" lineno="318" slineno="6-18"/>law, including a social, ceremonial, or athletic function that the peace officer or <ln numlevel="1" lineno="319" slineno="6-19"/>firefighter is assigned to or compensated for by the public agency being served.</subsection><subsection ssid="14-null-13" dnum="f-o" numlevel="1" lineno="320" slineno="6-20" level="2"><display>(f)</display>"Occupational disease" means a disease that routinely constitutes a special hazard in, <ln numlevel="1" lineno="321" slineno="6-21"/>or is commonly regarded as concomitant of, the peace officer's or firefighter's <ln numlevel="1" lineno="322" slineno="6-22"/>occupation.</subsection><subsection ssid="14-null-14" dnum="g-o" numlevel="1" lineno="323" slineno="6-23" level="2"><display>(g)</display>"Traumatic injury" means a wound or the condition of the body caused by external <ln numlevel="1" lineno="324" slineno="6-24"/>force, including an injury inflicted by bullet, explosive, sharp instrument, blunt <ln numlevel="1" lineno="325" slineno="6-25"/>object, or other physical blow, fire, smoke, chemical, electricity, climatic condition, <ln numlevel="1" lineno="326" slineno="6-26"/>infectious disease, radiation, or bacteria, but excluding an occupational disease.</subsection><subsection ssid="14-null-15" dnum="h-o" numlevel="1" lineno="327" slineno="6-27" level="2"><display>(h)</display>"Tuition" means tuition and fees at the rate charged for residents of the state.</subsection><subsection ssid="14-null-16" dnum="i-o" numlevel="1" lineno="328" slineno="6-28" level="2" space="false"><display>(i)</display><subsection ssid="14-null-17" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"Utah firefighter" or "firefighter" means a member, including volunteer <ln numlevel="1" lineno="329" slineno="6-29"/>members and members paid on call, of a fire department or other organization that <ln numlevel="1" lineno="330" slineno="6-30"/>provides fire suppression and other fire-related services, of a political subdivision <ln numlevel="1" lineno="331" slineno="6-31"/>who is responsible for or is in a capacity that includes responsibility for the <ln numlevel="1" lineno="332" slineno="6-32"/>extinguishment of fires.</subsection><subsection ssid="14-null-18" dnum="ii-o" numlevel="1" lineno="333" slineno="6-33" level="3"><display>(ii)</display>"Utah firefighter" or "firefighter" does not include a person whose job <ln numlevel="1" lineno="334" slineno="6-34"/>description, duties, or responsibilities do not include direct involvement in fire <ln numlevel="1" lineno="335" slineno="6-35"/>suppression.</subsection></subsection><subsection ssid="14-null-19" dnum="j-o" numlevel="1" lineno="336" slineno="6-36" level="2"><display>(j)</display>"Utah peace officer" or "peace officer" means an employee of a law enforcement <ln numlevel="1" lineno="337" slineno="6-37"/>agency that is part of or administered by<amend anum="0" ea="amend" pairid="1" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both"> a private postsecondary educational <ln numlevel="1" lineno="338" slineno="6-38"/>institution,</amend> the state<amend anum="0" ea="amend" pairid="3" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both">,</amend> or any of its political subdivisions, and whose duties consist <ln numlevel="1" lineno="339" slineno="6-39"/>primarily of the prevention and detection of crime and the enforcement of criminal <ln numlevel="1" lineno="340" slineno="6-40"/>statutes or ordinances of this state or any of its political subdivisions.</subsection></subsection><subsection ssid="14-null-20" dnum="2-o" numlevel="1" lineno="341" slineno="6-41" level="1"><display>(2)</display>Subject to the limitations in Subsections <xref depth="4" refnumber="53B-8c-102(3)">(3)</xref>, (4), and (5), an institution of higher <ln numlevel="1" lineno="342" slineno="6-42"/>education shall waive tuition for each child and surviving spouse of a Utah peace officer <ln numlevel="1" lineno="343" slineno="6-43"/>or Utah firefighter who has been killed or is killed in the line of duty if the individual <ln numlevel="1" lineno="344" slineno="6-44"/>meets the following requirements:<subsection ssid="14-null-21" dnum="a-o" numlevel="1" lineno="345" slineno="6-45" level="2"><display>(a)</display>applies, qualifies, and is admitted as a full-time, part-time, or summer school student <ln numlevel="1" lineno="346" slineno="6-46"/>in a program of study leading to a degree or certificate;</subsection><subsection ssid="14-null-22" dnum="b-o" numlevel="1" lineno="347" slineno="6-47" level="2"><display>(b)</display>is a resident student of the state as determined under Section <xref depth="3" refnumber="53H-11-202">53H-11-202</xref>;</subsection><subsection ssid="14-null-23" dnum="c-o" numlevel="1" lineno="348" slineno="6-48" level="2"><display>(c)</display>applies to the department for a waiver of tuition under this section and provides <ln numlevel="1" lineno="349" slineno="6-49"/>evidence satisfactory to the department that:<subsection ssid="14-null-24" dnum="i-o" numlevel="1" lineno="350" slineno="6-50" level="3"><display>(i)</display>the applicant is the surviving spouse or child of a peace officer or firefighter who <ln numlevel="1" lineno="351" slineno="6-51"/>was killed in the line of duty;</subsection><subsection ssid="14-null-25" dnum="ii-o" numlevel="1" lineno="352" slineno="6-52" level="3"><display>(ii)</display>the course or courses for which the applicant is seeking a tuition waiver meet the <ln numlevel="1" lineno="353" slineno="6-53"/>requirements of Subsection <xref depth="4" refnumber="53B-8c-102(3)">(3)</xref>; and</subsection><subsection ssid="14-null-26" dnum="iii-o" numlevel="1" lineno="354" slineno="6-54" level="3"><display>(iii)</display>the applicant meets the other requirements of this section;</subsection></subsection><subsection ssid="14-null-27" dnum="d-o" numlevel="1" lineno="355" slineno="6-55" level="2"><display>(d)</display>for a child of a peace officer or firefighter killed in the line of duty, applies under <ln numlevel="1" lineno="356" slineno="6-56"/>Subsection <xref depth="4" refnumber="53B-8c-102(2)(c)">(2)(c)</xref> for the first time before turning 25 years old;</subsection><subsection ssid="14-null-28" dnum="e-o" numlevel="1" lineno="357" slineno="6-57" level="2"><display>(e)</display>maintains satisfactory academic progress, as defined by the institution of higher <ln numlevel="1" lineno="358" slineno="6-58"/>education, for each term or semester in which the individual is enrolled, which may <ln numlevel="1" lineno="359" slineno="6-59"/>be measured by the definition used for federal student assistance programs under <ln numlevel="1" lineno="360" slineno="6-60"/>Title IV of the Higher Education Act of 1965; and</subsection><subsection ssid="14-null-29" dnum="f-o" numlevel="1" lineno="361" slineno="6-61" level="2"><display>(f)</display>has not achieved a bachelor's degree and has received tuition reimbursement under <ln numlevel="1" lineno="362" slineno="6-62"/>this section for less than 124 semester credits or 180 quarter credits at an institution <ln numlevel="1" lineno="363" slineno="6-63"/>of higher education.</subsection></subsection><subsection ssid="14-null-30" dnum="3-o" numlevel="1" lineno="364" slineno="6-64" level="1"><display>(3)</display>A child or surviving spouse of a peace officer or firefighter who was killed in the line of <ln numlevel="1" lineno="365" slineno="6-65"/>duty is eligible for a tuition waiver under this section of not more than nine semesters or <ln numlevel="1" lineno="366" slineno="6-66"/>the equivalent number of quarters.</subsection><subsection ssid="14-null-31" dnum="4-o" numlevel="1" lineno="367" slineno="6-67" level="1"><display>(4)</display>Tuition shall be waived only to the extent that the tuition is not covered or paid by any <ln numlevel="1" lineno="368" slineno="6-68"/>scholarship, trust fund, statutory benefit, or any other source of tuition coverage <ln numlevel="1" lineno="369" slineno="6-69"/>available for a waiver under this section.</subsection><subsection ssid="14-null-32" dnum="5-o" numlevel="1" lineno="370" slineno="6-70" level="1"><display>(5)</display>An institution of higher education shall waive tuition under this section only for courses <ln numlevel="1" lineno="371" slineno="6-71"/>that are applicable toward the degree or certificate requirements of the program in which <ln numlevel="1" lineno="372" slineno="6-72"/>the child or surviving spouse is enrolled.</subsection><subsection ssid="14-null-33" dnum="6-o" numlevel="1" lineno="373" slineno="6-73" level="1"><display>(6)</display>Upon receiving an application under Subsection <xref depth="4" refnumber="53B-8c-102(2)(c)">(2)(c)</xref>, the department shall determine <ln numlevel="1" lineno="374" slineno="6-74"/>whether the applicant and the courses for which tuition waiver is sought meet the <ln numlevel="1" lineno="375" slineno="6-75"/>requirements of this section and, if so, shall approve the application and notify the <ln numlevel="1" lineno="376" slineno="6-76"/>institution that the application has been approved.</subsection><subsection numlevel="1" lineno="378" slineno="6-78"/>the institution of higher education in developing efficient procedures for the <ln numlevel="1" lineno="379" slineno="6-79"/>implementation of this section.</subsection><subsection ssid="14-null-35" dnum="8-o" numlevel="1" lineno="380" slineno="6-80" level="1"><display>(8)</display>The Legislature may annually appropriate the funds necessary to implement this section, <ln numlevel="1" lineno="381" slineno="6-81"/>including money to offset the tuition waivers at each institution.</subsection></section></bsec><bsec buid="2" num="58-37-3.5" Drugs for behavioral health <ln numlevel="1" lineno="384" slineno="7-3"/>treatment.</bold></catline><subsection ssid="2-null-1" dnum="1-o" numlevel="1" lineno="385" slineno="7-4" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="2-null-2" dnum="a-o" numlevel="1" lineno="386" slineno="7-5" level="2"><display>(a)</display>"Drug" means any form of psilocybin or methylenedioxymethamphetamine that is in <ln numlevel="1" lineno="387" slineno="7-6"/>federal Food and Drug Administration Phase 3 testing for an investigational drug <ln numlevel="1" lineno="388" slineno="7-7"/>described in 21 C.F.R. Part 312.</subsection><subsection ssid="2-null-3" dnum="b-o" numlevel="1" lineno="389" slineno="7-8" level="2"><display>(b)</display>"Healthcare system" means:<subsection ssid="2-null-4" dnum="i-o" numlevel="1" lineno="390" slineno="7-9" level="3"><display>(i)</display>a privately-owned, non-profit, vertically-integrated healthcare system that operates <ln numlevel="1" lineno="391" slineno="7-10"/>at least 15 licensed hospitals in the state; <marker pairid="10"><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="11" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">or</amend><amendoutend style="2"/></marker></subsection><subsection ssid="2-null-5" dnum="ii-o" numlevel="1" lineno="392" slineno="7-11" level="3"><display>(ii)</display>a health care system closely affiliated with an institution of higher education <ln numlevel="1" lineno="393" slineno="7-12"/>listed in Section <xref depth="3" refnumber="53H-1-102">53H-1-102</xref><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="8" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; or</amend></subsection><subsection ssid="2-16" dnum="_-o:iii-i" numlevel="1" lineno="394" slineno="7-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1199" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">a health care system closely affiliated with a private postsecondary educational <ln numlevel="1" lineno="395" slineno="7-14"/>institution as defined in Section <xref depth="3" refnumber="53H-1-101">53H-1-101</xref>.</amend></subsection></subsection></subsection><subsection ssid="2-null-6" dnum="2-o" numlevel="1" lineno="396" slineno="7-15" level="1"><display>(2)</display>A healthcare system may develop a behavioral health treatment program that includes a <ln numlevel="1" lineno="397" slineno="7-16"/>treatment based on a drug that the healthcare system determines is supported by a broad <ln numlevel="1" lineno="398" slineno="7-17"/>collection of scientific and medical research.</subsection><subsection ssid="2-null-7" dnum="3-o" numlevel="1" lineno="399" slineno="7-18" level="1"><display>(3)</display>A healthcare system described in Subsection <xref depth="4" refnumber="58-37-3.5(2)">(2)</xref>:<subsection ssid="2-null-8" dnum="a-o" numlevel="1" lineno="400" slineno="7-19" level="2"><display>(a)</display>shall ensure that a drug used under the exclusive authority of this section is used by a <ln numlevel="1" lineno="401" slineno="7-20"/>patient only under the direct supervision and control of the healthcare system and the <ln numlevel="1" lineno="402" slineno="7-21"/>healthcare system's health care providers who are licensed under this title; and</subsection><subsection ssid="2-null-9" dnum="b-o" numlevel="1" lineno="403" slineno="7-22" level="2"><display>(b)</display>may not provide treatments that are authorized exclusively under this section to an <ln numlevel="1" lineno="404" slineno="7-23"/>individual who is not at least 18 years old.</subsection></subsection><subsection ssid="2-null-10" dnum="4-o" numlevel="1" lineno="405" slineno="7-24" level="1"><display>(4)</display>Before July 1, 2026, a healthcare system that creates a behavioral health treatment <ln numlevel="1" lineno="406" slineno="7-25"/>program under this section shall provide a written report to the Health and Human <ln numlevel="1" lineno="407" slineno="7-26"/>Services Interim Committee regarding:<subsection ssid="2-null-11" dnum="a-o" numlevel="1" lineno="408" slineno="7-27" level="2"><display>(a)</display>drugs used;</subsection><subsection ssid="2-null-12" dnum="b-o" numlevel="1" lineno="409" slineno="7-28" level="2"><display>(b)</display>health outcomes of patients;</subsection><subsection ssid="2-null-13" dnum="c-o" numlevel="1" lineno="410" slineno="7-29" level="2"><display>(c)</display>side effects of any drugs used; and</subsection><subsection ssid="2-null-14" dnum="d-o" numlevel="1" lineno="411" slineno="7-30" level="2"><display>(d)</display>any other information necessary for the Legislature to evaluate the medicinal value <ln numlevel="1" lineno="412" slineno="7-31"/>of any drugs.</subsection></subsection><subsection ssid="2-null-15" dnum="5-o" numlevel="1" lineno="413" slineno="7-32" level="1"><display>(5)</display>An individual or entity that complies with this section when using, distributing, <ln numlevel="1" lineno="414" slineno="7-33"/>possessing, administering, or supervising the use of, a drug is not guilty of a violation of <ln numlevel="1" lineno="415" slineno="7-34"/>this title.</subsection></section></bsec><bsec buid="5" num="76-6-113" type="amend" src="code" uid="C76-6-S113_2026050620260506" sort="76 06 01130020260506" numlevel="1" lineno="416" slineno="8-1" sn="8"><section number="76-6-113" numlevel="1" lineno="417" slineno="8-2" type="amend"><secline lineno="416">Section 8. Section <bold>76-6-113</bold> is amended to read:</secline><catline lineno="417"><bold>76-6-113<parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>05/06/26</date></paren></parens>. Property damage resulting in economic <ln numlevel="1" lineno="418" slineno="8-3"/>interruption -- Enhanced penalties.</bold></catline><subsection ssid="5-null-1" dnum="1-o" numlevel="1" lineno="419" slineno="8-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="5-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>As used in this section:<subsection ssid="5-null-3" dnum="i-o" numlevel="1" lineno="420" slineno="8-5" level="3" tab="1"><display>(i)</display>"Business" means an enterprise carried on for the purpose of gain or economic <ln numlevel="1" lineno="421" slineno="8-6"/>profit.</subsection><subsection ssid="5-null-4" dnum="ii-o" numlevel="1" lineno="422" slineno="8-7" level="3" tab="1"><display>(ii)</display>"Governmental entity" means the state, a county, a municipality, a special district, <ln numlevel="1" lineno="423" slineno="8-8"/>a special service district, a school district, a state institution of higher education, or <ln numlevel="1" lineno="424" slineno="8-9"/>any other political subdivision or administrative unit of the state.</subsection><subsection ssid="5-null-5" dnum="iii-o" numlevel="1" lineno="425" slineno="8-10" level="3" tab="1"><display>(iii)</display>"Economic interruption" means any disruption or cessation to the operations of a <ln numlevel="1" lineno="426" slineno="8-11"/>business or governmental entity that results in:<subsection ssid="5-null-6" dnum="A-o" numlevel="1" lineno="427" slineno="8-12" level="4"><display>(A)</display>the business or governmental entity ceasing operations for at least one day; or</subsection><subsection ssid="5-null-7" dnum="B-o" numlevel="1" lineno="428" slineno="8-13" level="4"><display>(B)</display>the employees of the business or governmental entity being unable to perform <ln numlevel="1" lineno="429" slineno="8-14"/>labor for the business or governmental entity for at least one day.</subsection></subsection><subsection ssid="5-21" dnum="_-o:iv-i" numlevel="1" lineno="430" slineno="8-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1217" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="end">"Private postsecondary educational institution" means the same as that term is <ln numlevel="1" lineno="431" slineno="8-16"/>defined in Section <xref depth="3" refnumber="53H-1-101">53H-1-101</xref>.</amend></subsection></subsection><subsection ssid="5-null-8" dnum="b-o" numlevel="1" lineno="432" slineno="8-17" level="2"><display>(b)</display>Terms defined in Sections <xref depth="3" refnumber="76-1-101.5">76-1-101.5</xref> and <xref depth="3" refnumber="76-6-101">76-6-101</xref> apply to this section.</subsection></subsection><subsection ssid="5-null-9" dnum="2-o" numlevel="1" lineno="433" slineno="8-18" level="1"><display>(2)</display>An actor commits property damage resulting in economic interruption if:<subsection ssid="5-null-10" dnum="a-o" numlevel="1" lineno="434" slineno="8-19" level="2"><display>(a)</display>the actor intentionally, knowingly, recklessly, or negligently damages, defaces, or <ln numlevel="1" lineno="435" slineno="8-20"/>destroys a business's<amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both">, private postsecondary educational institution's,</amend> or governmental <ln numlevel="1" lineno="436" slineno="8-21"/>entity's property; and</subsection><subsection ssid="5-null-11" dnum="b-o" numlevel="1" lineno="437" slineno="8-22" level="2"><display>(b)</display>the actor's actions under Subsection <xref depth="4" refnumber="76-6-113(2)(a)">(2)(a)</xref> cause an economic interruption for the <ln numlevel="1" lineno="438" slineno="8-23"/>business<amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both">, private postsecondary educational institution,</amend> or governmental entity.</subsection></subsection><subsection ssid="5-null-12" dnum="3-o" numlevel="1" lineno="439" slineno="8-24" level="1"><display>(3)</display>A violation of Subsection <xref depth="4" refnumber="76-6-113(2)">(2)</xref> is a class A misdemeanor.</subsection><subsection ssid="5-null-13" dnum="4-o" numlevel="1" lineno="440" slineno="8-25" level="1"><display>(4)</display>It is not a defense under this section that the actor did not know that the victim is a <ln numlevel="1" lineno="441" slineno="8-26"/>business<amend anum="0" ea="amend" pairid="9" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="both">, private postsecondary educational institution,</amend> or governmental entity.</subsection><subsection ssid="5-null-14" dnum="5-o" numlevel="1" lineno="442" slineno="8-27" level="1"><display>(5)</display>If the trier of facts finds that the actor committed a violation of Subsection <xref depth="4" refnumber="76-6-113(2)">(2)</xref>, the actor <ln numlevel="1" lineno="443" slineno="8-28"/>is guilty of:<subsection ssid="5-null-15" dnum="a-o" numlevel="1" lineno="444" slineno="8-29" level="2"><display>(a)</display>a third degree felony if the actor has two prior convictions for a violation of <ln numlevel="1" lineno="445" slineno="8-30"/>Subsection <xref depth="4" refnumber="76-6-113(2)">(2)</xref> within five years before the day on which the actor committed the <ln numlevel="1" lineno="446" slineno="8-31"/>most recent violation of Subsection <xref depth="4" refnumber="76-6-113(2)">(2)</xref>; and</subsection><subsection ssid="5-null-16" dnum="b-o" numlevel="1" lineno="447" slineno="8-32" level="2"><display>(b)</display>a second degree felony if the actor has at least three prior convictions for a violation <ln numlevel="1" lineno="448" slineno="8-33"/>of Subsection <xref depth="4" refnumber="76-6-113(2)">(2)</xref> within five years before the day on which the actor committed the <ln numlevel="1" lineno="449" slineno="8-34"/>most recent violation of Subsection <xref depth="4" refnumber="76-6-113(2)">(2)</xref>.</subsection></subsection><subsection ssid="5-null-17" dnum="6-o" numlevel="1" lineno="450" slineno="8-35" level="1"><display>(6)</display>A prior conviction used for a penalty enhancement under Subsection <xref depth="4" refnumber="76-6-113(5)">(5)</xref> is a conviction <ln numlevel="1" lineno="451" slineno="8-36"/>that is from a separate criminal episode than:<subsection ssid="5-null-18" dnum="a-o" numlevel="1" lineno="452" slineno="8-37" level="2"><display>(a)</display>the most recent violation of Subsection <xref depth="4" refnumber="76-6-113(2)">(2)</xref>; and</subsection><subsection ssid="5-null-19" dnum="b-o" numlevel="1" lineno="453" slineno="8-38" level="2"><display>(b)</display>any other prior conviction that is used to enhance the penalty for the most recent <ln numlevel="1" lineno="454" slineno="8-39"/>violation of Subsection <xref depth="4" refnumber="76-6-113(2)">(2)</xref>.</subsection></subsection><subsection ssid="5-null-20" dnum="7-o" numlevel="1" lineno="455" slineno="8-40" level="1"><display>(7)</display>The prosecuting attorney, or the grand jury if an indictment is returned, shall include <ln numlevel="1" lineno="456" slineno="8-41"/>notice in the information or indictment that the offense is subject to an enhancement <ln numlevel="1" lineno="457" slineno="8-42"/>under Subsection <xref depth="4" refnumber="76-6-113(5)">(5)</xref>.</subsection></section></bsec><bsec buid="16" num="76-8-705" type="amend" src="code" uid="C76-8-S705_2026050620260506" sort="76 08 07050020260506" numlevel="1" lineno="458" slineno="9-1" sn="9"><section number="76-8-705" numlevel="1" lineno="459" slineno="9-2" type="amend"><secline lineno="458">Section 9. or</subsection><subsection ssid="16-null-8" dnum="iii-o" numlevel="1" lineno="473" slineno="9-16" level="3"><display>(iii)</display>ingress or egress to the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="26" groupid="24" style="2" owner="jchristopherson" level="1" deltag="both">institution's</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="24" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">institution or private postsecondary <ln numlevel="1" lineno="474" slineno="9-17"/>educational institution's</amend> physical facilities;</subsection></subsection><subsection ssid="16-null-9" dnum="b-o" numlevel="1" lineno="475" slineno="9-18" level="2"><display>(b)</display>impedes a faculty or staff member of the institution<amend anum="0" ea="amend" pairid="25" groupid="23" style="1" owner="jchristopherson" level="1" amendtag="both"> or private postsecondary <ln numlevel="1" lineno="476" slineno="9-19"/>educational institution</amend> in the lawful performance of the member's duties; or</subsection><subsection ssid="16-null-10" dnum="c-o" numlevel="1" lineno="477" slineno="9-20" level="2"><display>(c)</display>impedes a student of the institution<amend anum="0" ea="amend" pairid="28" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="both"> or private postsecondary educational institution</amend> <ln numlevel="1" lineno="478" slineno="9-21"/>in the lawful pursuit of the student's educational activities.</subsection></subsection><subsection ssid="16-null-11" dnum="3-o" numlevel="1" lineno="479" slineno="9-22" level="1"><display>(3)</display>A violation of Subsection <xref depth="4" refnumber="76-8-705(2)">(2)</xref> is a class C misdemeanor.</subsection></section></bsec><bsec buid="7" num="77-11a-101" type="amend" src="code" uid="C77-11a-S101_2026050620260506" sort="77 11a01010020260506" numlevel="1" lineno="480" slineno="10-1" sn="10"><section number="77-11a-101" numlevel="1" lineno="481" slineno="10-2" type="amend"><secline lineno="480">Section 10. Definitions.</bold></catline><sectionText lineno="482"><tab/>As used in this chapter:</sectionText><subsection ssid="7-null-1" dnum="1-o" numlevel="1" lineno="483" slineno="10-4" level="1" space="false"><display>(1)</display><subsection ssid="7-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Agency" means an agency of this state or a political subdivision of this state.</subsection><subsection ssid="7-null-3" dnum="b-o" numlevel="1" lineno="484" slineno="10-5" level="2"><display>(b)</display>"Agency" includes a law enforcement agency or a multijurisdictional task force.</subsection></subsection><subsection ssid="7-null-4" dnum="2-o" numlevel="1" lineno="485" slineno="10-6" level="1"><display>(2)</display>"Claimant" means:<subsection ssid="7-null-5" dnum="a-o" numlevel="1" lineno="486" slineno="10-7" level="2"><display>(a)</display>an owner of property;</subsection><subsection ssid="7-null-6" dnum="b-o" numlevel="1" lineno="487" slineno="10-8" level="2"><display>(b)</display>an interest holder; or</subsection><subsection ssid="7-null-7" dnum="c-o" numlevel="1" lineno="488" slineno="10-9" level="2"><display>(c)</display>an individual or entity who asserts a claim to any property for which an agency seeks <ln numlevel="1" lineno="489" slineno="10-10"/>to forfeit.</subsection></subsection><subsection ssid="7-null-8" dnum="3-o" numlevel="1" lineno="490" slineno="10-11" level="1" space="false"><display>(3)</display><subsection ssid="7-null-9" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Computer" means, except as provided in Subsection <xref depth="4" refnumber="77-11a-101(3)(c)">(3)(c)</xref>, an electronic, <ln numlevel="1" lineno="491" slineno="10-12"/>magnetic, optical, electrochemical, or other high-speed data processing device that <ln numlevel="1" lineno="492" slineno="10-13"/>performs logical, arithmetic, and storage functions.</subsection><subsection ssid="7-null-10" dnum="b-o" numlevel="1" lineno="493" slineno="10-14" level="2"><display>(b)</display>"Computer" includes any device that is used for the storage of digital or electronic <ln numlevel="1" lineno="494" slineno="10-15"/>files, flash memory, software, or other electronic information.</subsection><subsection ssid="7-null-11" dnum="c-o" numlevel="1" lineno="495" slineno="10-16" level="2"><display>(c)</display>"Computer" does not mean a computer server of an <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="4" groupid="4" style="2" owner="jchristopherson" level="1" deltag="both">Internet</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">internet</amend> or electronic <ln numlevel="1" lineno="496" slineno="10-17"/>service provider, or the service provider's employee, if used to comply with the <ln numlevel="1" lineno="497" slineno="10-18"/>requirements under 18 U.S.C. Sec. 2258A.</subsection></subsection><subsection ssid="7-null-12" dnum="4-o" numlevel="1" lineno="498" slineno="10-19" level="1" space="false"><display>(4)</display><subsection ssid="7-null-13" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Contraband" means any property, item, or substance that is unlawful to produce <ln numlevel="1" lineno="499" slineno="10-20"/>or to possess under state or federal law.</subsection><subsection ssid="7-null-14" dnum="b-o" numlevel="1" lineno="500" slineno="10-21" level="2"><display>(b)</display>"Contraband" includes:<subsection ssid="7-null-15" dnum="i-o" numlevel="1" lineno="501" slineno="10-22" level="3"><display>(i)</display>a controlled substance that is possessed, transferred, distributed, or offered for <ln numlevel="1" lineno="502" slineno="10-23"/>distribution in violation of Title 58, Chapter 37, Utah Controlled Substances Act; <ln numlevel="1" lineno="503" slineno="10-24"/>or</subsection><subsection ssid="7-null-16" dnum="ii-o" numlevel="1" lineno="504" slineno="10-25" level="3"><display>(ii)</display>a computer that:<subsection ssid="7-null-17" dnum="A-o" numlevel="1" lineno="505" slineno="10-26" level="4"><display>(A)</display>contains or houses child sexual abuse material, or is used to create, download, <ln numlevel="1" lineno="506" slineno="10-27"/>transfer, upload to a storage account, or store any electronic or digital files <ln numlevel="1" lineno="507" slineno="10-28"/>containing child sexual abuse material; or</subsection><subsection ssid="7-null-18" dnum="B-o" numlevel="1" lineno="508" slineno="10-29" level="4"><display>(B)</display>contains the personal identifying information of another individual, as defined <ln numlevel="1" lineno="509" slineno="10-30"/>in Section <xref depth="3" refnumber="76-6-1101">76-6-1101</xref>, whether that individual is alive or deceased, and the <ln numlevel="1" lineno="510" slineno="10-31"/>personal identifying information has been used to create false or fraudulent <ln numlevel="1" lineno="511" slineno="10-32"/>identification documents or financial transaction cards in violation of Title 76, <ln numlevel="1" lineno="512" slineno="10-33"/>Chapter 6, Part 5, Fraud.</subsection></subsection></subsection></subsection><subsection ssid="7-null-19" dnum="5-o" numlevel="1" lineno="513" slineno="10-34" level="1"><display>(5)</display>"Controlled substance" means the same as that term is defined in Section <xref depth="3" refnumber="58-37-2">58-37-2</xref>.</subsection><subsection ssid="7-null-20" dnum="6-o" numlevel="1" lineno="514" slineno="10-35" level="1"><display>(6)</display>"Court" means a municipal, county, or state court.</subsection><subsection ssid="7-null-21" dnum="7-o" numlevel="1" lineno="515" slineno="10-36" level="1"><display>(7)</display>"Division of Law Enforcement" means the division within the Department of Natural <ln numlevel="1" lineno="516" slineno="10-37"/>Resources created under Title 79, Chapter 2, Part 7, Division of Law Enforcement.</subsection><subsection ssid="7-null-22" dnum="8-o" numlevel="1" lineno="517" slineno="10-38" level="1"><display>(8)</display>"Evidence" means the same as that term is defined in Section <xref depth="3" refnumber="77-11c-101">77-11c-101</xref>.</subsection><subsection ssid="7-null-23" dnum="9-o" numlevel="1" lineno="518" slineno="10-39" level="1"><display>(9)</display>"Forfeit" means to divest a claimant of an ownership interest in property seized by a <ln numlevel="1" lineno="519" slineno="10-40"/>peace officer or agency.</subsection><subsection ssid="7-null-24" dnum="10-o" numlevel="1" lineno="520" slineno="10-41" level="1"><display>(10)</display>"Innocent owner" means a claimant who:<subsection ssid="7-null-25" dnum="a-o" numlevel="1" lineno="521" slineno="10-42" level="2"><display>(a)</display>held an ownership interest in property at the time of the commission of an offense <ln numlevel="1" lineno="522" slineno="10-43"/>subjecting the property to seizure, and:<subsection ssid="7-null-26" dnum="i-o" numlevel="1" lineno="523" slineno="10-44" level="3"><display>(i)</display>did not have actual knowledge of the offense subjecting the property to seizure; or</subsection><subsection ssid="7-null-27" dnum="ii-o" numlevel="1" lineno="524" slineno="10-45" level="3"><display>(ii)</display>upon learning of the commission of the offense, took reasonable steps to prohibit <ln numlevel="1" lineno="525" slineno="10-46"/>the use of the property in the commission of the offense; or</subsection></subsection><subsection ssid="7-null-28" dnum="b-o" numlevel="1" lineno="526" slineno="10-47" level="2"><display>(b)</display>acquired an ownership interest in the property and had no knowledge that the <ln numlevel="1" lineno="527" slineno="10-48"/>commission of the offense subjecting the property to seizure had occurred or that the <ln numlevel="1" lineno="528" slineno="10-49"/>property had been seized, and:<subsection ssid="7-null-29" dnum="i-o" numlevel="1" lineno="529" slineno="10-50" level="3"><display>(i)</display>acquired the property in a bona fide transaction for value;</subsection><subsection ssid="7-null-30" dnum="ii-o" numlevel="1" lineno="530" slineno="10-51" level="3"><display>(ii)</display>was an individual, including a minor child, who acquired an interest in the <ln numlevel="1" lineno="531" slineno="10-52"/>property through probate or inheritance; or</subsection><subsection ssid="7-null-31" dnum="iii-o" numlevel="1" lineno="532" slineno="10-53" level="3"><display>(iii)</display>was a spouse who acquired an interest in property through dissolution of <ln numlevel="1" lineno="533" slineno="10-54"/>marriage or by operation of law.</subsection></subsection></subsection><subsection ssid="7-null-32" dnum="11-o" numlevel="1" lineno="534" slineno="10-55" level="1" space="false"><display>(11)</display><subsection ssid="7-null-33" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Interest holder" means a secured party as defined in Section <xref depth="3" refnumber="70A-9a-102">70A-9a-102</xref>, a <ln numlevel="1" lineno="535" slineno="10-56"/>party with a right-of-offset, a mortgagee, lien creditor, or the beneficiary of a security <ln numlevel="1" lineno="536" slineno="10-57"/>interest or encumbrance pertaining to an interest in property, whose interest would be <ln numlevel="1" lineno="537" slineno="10-58"/>perfected against a good faith purchaser for value.</subsection><subsection ssid="7-null-34" dnum="b-o" numlevel="1" lineno="538" slineno="10-59" level="2"><display>(b)</display>"Interest holder" does not mean a person:<subsection ssid="7-null-35" dnum="i-o" numlevel="1" lineno="539" slineno="10-60" level="3"><display>(i)</display>who holds property for the benefit of or as an agent or nominee for another <ln numlevel="1" lineno="540" slineno="10-61"/>person; or</subsection><subsection ssid="7-null-36" dnum="ii-o" numlevel="1" lineno="541" slineno="10-62" level="3"><display>(ii)</display>who is not in substantial compliance with any statute requiring an interest in <ln numlevel="1" lineno="542" slineno="10-63"/>property to be:<subsection ssid="7-null-37" dnum="A-o" numlevel="1" lineno="543" slineno="10-64" level="4"><display>(A)</display>recorded or reflected in public records in order to perfect the interest against a <ln numlevel="1" lineno="544" slineno="10-65"/>good faith purchaser for value; or</subsection><subsection ssid="7-null-38" dnum="B-o" numlevel="1" lineno="545" slineno="10-66" level="4"><display>(B)</display>held in control by a secured party, as defined in Section <xref depth="3" refnumber="70A-9a-102">70A-9a-102</xref>, in <ln numlevel="1" lineno="546" slineno="10-67"/>accordance with Section <xref depth="3" refnumber="70A-9a-314">70A-9a-314</xref> in order to perfect the interest against a <ln numlevel="1" lineno="547" slineno="10-68"/>good faith purchaser for value.</subsection></subsection></subsection></subsection><subsection ssid="7-null-39" dnum="12-o" numlevel="1" lineno="548" slineno="10-69" level="1"><display>(12)</display>"Law enforcement agency" means:<subsection ssid="7-null-40" dnum="a-o" numlevel="1" lineno="549" slineno="10-70" level="2"><display>(a)</display>a municipal, county, state institution of higher education, <amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">private postsecondary <ln numlevel="1" lineno="550" slineno="10-71"/>educational institution, </amend>or state police force or department;</subsection><subsection ssid="7-null-41" dnum="b-o" numlevel="1" lineno="551" slineno="10-72" level="2"><display>(b)</display>a sheriff's office; or</subsection><subsection ssid="7-null-42" dnum="c-o" numlevel="1" lineno="552" slineno="10-73" level="2"><display>(c)</display>a municipal, county, or state prosecuting authority.</subsection></subsection><subsection ssid="7-null-43" dnum="13-o" numlevel="1" lineno="553" slineno="10-74" level="1"><display>(13)</display>"Legislative body" means:<subsection ssid="7-null-44" dnum="a-o" numlevel="1" lineno="554" slineno="10-75" level="2" space="false"><display>(a)</display><subsection ssid="7-null-45" dnum="i-o" level="3" placement="sameline"><display>(i)</display>the Legislature, county commission, county council, city commission, city <ln numlevel="1" lineno="555" slineno="10-76"/>council, or town council that has fiscal oversight and budgetary approval authority <ln numlevel="1" lineno="556" slineno="10-77"/>over an agency; or</subsection><subsection ssid="7-null-46" dnum="ii-o" numlevel="1" lineno="557" slineno="10-78" level="3"><display>(ii)</display>the agency's governing political subdivision; or</subsection></subsection><subsection ssid="7-null-47" dnum="b-o" numlevel="1" lineno="558" slineno="10-79" level="2"><display>(b)</display>the lead governmental entity of a multijurisdictional task force, as designated in a <ln numlevel="1" lineno="559" slineno="10-80"/>memorandum of understanding executed by the agencies participating in the task <ln numlevel="1" lineno="560" slineno="10-81"/>force.</subsection></subsection><subsection ssid="7-null-48" dnum="14-o" numlevel="1" lineno="561" slineno="10-82" level="1"><display>(14)</display>"Multijurisdictional task force" means a law enforcement task force or other agency <ln numlevel="1" lineno="562" slineno="10-83"/>comprised of individuals who are employed by or acting under the authority of different <ln numlevel="1" lineno="563" slineno="10-84"/>governmental entities, including federal, state, county, or municipal governments, or any <ln numlevel="1" lineno="564" slineno="10-85"/>combination of federal, state, county, or municipal agencies.</subsection><subsection ssid="7-null-49" dnum="15-o" numlevel="1" lineno="565" slineno="10-86" level="1"><display>(15)</display>"Owner" means an individual or entity, other than an interest holder, that possesses a <ln numlevel="1" lineno="566" slineno="10-87"/>bona fide legal or equitable interest in property.</subsection><subsection ssid="7-null-50" dnum="16-o" numlevel="1" lineno="567" slineno="10-88" level="1"><display>(16)</display>"Pawn or secondhand business" means the same as that term is defined in Section <xref depth="3" refnumber="13-32a-102"><ln numlevel="1" lineno="568" slineno="10-89"/>13-32a-102</xref>.</subsection><subsection ssid="7-null-51" dnum="17-o" numlevel="1" lineno="569" slineno="10-90" level="1"><display>(17)</display>"Peace officer" means an employee:<subsection ssid="7-null-52" dnum="a-o" numlevel="1" lineno="570" slineno="10-91" level="2"><display>(a)</display>of an agency;</subsection><subsection ssid="7-null-53" dnum="b-o" numlevel="1" lineno="571" slineno="10-92" level="2"><display>(b)</display>whose duties consist primarily of the prevention and detection of violations of laws <ln numlevel="1" lineno="572" slineno="10-93"/>of this state or a political subdivision of this state; and</subsection><subsection ssid="7-null-54" dnum="c-o" numlevel="1" lineno="573" slineno="10-94" level="2"><display>(c)</display>who is authorized by the agency to seize property.</subsection></subsection><subsection ssid="7-null-55" dnum="18-o" numlevel="1" lineno="574" slineno="10-95" level="1" space="false"><display>(18)</display><subsection ssid="7-null-56" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Proceeds" means:<subsection ssid="7-null-57" dnum="i-o" numlevel="1" lineno="575" slineno="10-96" level="3" tab="1"><display>(i)</display>property of any kind that is obtained directly or indirectly as a result of the <ln numlevel="1" lineno="576" slineno="10-97"/>commission of an offense; or</subsection><subsection ssid="7-null-58" dnum="ii-o" numlevel="1" lineno="577" slineno="10-98" level="3" tab="1"><display>(ii)</display>any property acquired directly or indirectly from, produced through, realized <ln numlevel="1" lineno="578" slineno="10-99"/>through, or caused by an act or omission regarding property under Subsection <xref depth="4" refnumber="77-11a-101(18)(a)(i)"><ln numlevel="1" lineno="579" slineno="10-100"/>(18)(a)(i)</xref>.</subsection></subsection><subsection ssid="7-null-59" dnum="b-o" numlevel="1" lineno="580" slineno="10-101" level="2"><display>(b)</display>"Proceeds" includes any property of any kind without reduction for expenses <ln numlevel="1" lineno="581" slineno="10-102"/>incurred in the acquisition, maintenance, or production of that property, or any other <ln numlevel="1" lineno="582" slineno="10-103"/>purpose regarding property under Subsection <xref depth="4" refnumber="77-11a-101(18)(a)(i)">(18)(a)(i)</xref>.</subsection><subsection ssid="7-null-60" dnum="c-o" numlevel="1" lineno="583" slineno="10-104" level="2"><display>(c)</display>"Proceeds" is not limited to the net gain or profit realized from the offense that <ln numlevel="1" lineno="584" slineno="10-105"/>subjects the property to seizure.</subsection></subsection><subsection ssid="7-null-61" dnum="19-o" numlevel="1" lineno="585" slineno="10-106" level="1" space="false"><display>(19)</display><subsection ssid="7-null-62" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Property" means all property, whether real or personal, tangible or intangible.</subsection><subsection ssid="7-null-63" dnum="b-o" numlevel="1" lineno="586" slineno="10-107" level="2"><display>(b)</display>"Property" does not include contraband.</subsection></subsection><subsection ssid="7-null-64" dnum="20-o" numlevel="1" lineno="587" slineno="10-108" level="1"><display>(20)</display>"Prosecuting attorney" means:<subsection ssid="7-null-65" dnum="a-o" numlevel="1" lineno="588" slineno="10-109" level="2"><display>(a)</display>the attorney general and an assistant attorney general;</subsection><subsection ssid="7-null-66" dnum="b-o" numlevel="1" lineno="589" slineno="10-110" level="2"><display>(b)</display>a district attorney or deputy district attorney;</subsection><subsection ssid="7-null-67" dnum="c-o" numlevel="1" lineno="590" slineno="10-111" level="2"><display>(c)</display>a county attorney or assistant county attorney; and</subsection><subsection ssid="7-null-68" dnum="d-o" numlevel="1" lineno="591" slineno="10-112" level="2"><display>(d)</display>an attorney authorized to commence an action on behalf of the state.</subsection></subsection><subsection ssid="7-null-69" dnum="21-o" numlevel="1" lineno="592" slineno="10-113" level="1"><display>(21)</display>"Public interest use" means a:<subsection ssid="7-null-70" dnum="a-o" numlevel="1" lineno="593" slineno="10-114" level="2"><display>(a)</display>use by a government agency as determined by the legislative body of the agency's <ln numlevel="1" lineno="594" slineno="10-115"/>jurisdiction; or</subsection><subsection ssid="7-null-71" dnum="b-o" numlevel="1" lineno="595" slineno="10-116" level="2"><display>(b)</display>donation of the property to a nonprofit charity registered with the state.</subsection></subsection><subsection ssid="7-null-72" dnum="22-o" numlevel="1" lineno="596" slineno="10-117" level="1"><display>(22)</display>"Real property" means land, including any building, fixture, improvement, <ln numlevel="1" lineno="597" slineno="10-118"/>appurtenance, structure, or other development that is affixed permanently to land.</subsection><subsection ssid="7-null-73" dnum="23-o" numlevel="1" lineno="598" slineno="10-119" level="1" space="false"><display>(23)</display><subsection ssid="7-null-74" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Seized property" means property seized by a peace officer or agency in <ln numlevel="1" lineno="599" slineno="10-120"/>accordance with Section <xref depth="3" refnumber="77-11a-201">77-11a-201</xref>.</subsection><subsection ssid="7-null-75" dnum="b-o" numlevel="1" lineno="600" slineno="10-121" level="2"><display>(b)</display>"Seized property" includes property that the agency seeks to forfeit under Chapter <ln numlevel="1" lineno="601" slineno="10-122"/>11b, Forfeiture of Seized Property.</subsection></subsection></section></bsec><bsec buid="28" num="79-3-202" type="amend" src="code" uid="C79-3-S202_2026050620260506" sort="79 03 02020020260506" numlevel="1" lineno="602" slineno="11-1" sn="11"><section number="79-3-202" numlevel="1" lineno="603" slineno="11-2" type="amend"><secline lineno="602">Section 11. Section <bold>79-3-202</bold> is amended to read:</secline><catline lineno="603"><bold>79-3-202<parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>05/06/26</date></paren></parens>. Powers and duties of survey.</bold></catline><subsection ssid="28-null-1" dnum="1-o" numlevel="1" lineno="604" slineno="11-3" level="1" placement="noreturn"><display>(1)</display>The survey shall:<subsection ssid="28-null-2" dnum="a-o" numlevel="1" lineno="605" slineno="11-4" level="2"><display>(a)</display>assist and advise state and local agencies<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="7" groupid="7" style="2" owner="jchristopherson" level="1" deltag="both"> and state educational institutions</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="6" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">, <ln numlevel="1" lineno="606" slineno="11-5"/>institutions of higher education as defined in Section <xref depth="3" refnumber="53H-1-101">53H-1-101</xref>, and private <ln numlevel="1" lineno="607" slineno="11-6"/>postsecondary educational institutions as defined in Section <xref depth="3" refnumber="53H-1-101">53H-1-101</xref></amend> on geologic, <ln numlevel="1" lineno="608" slineno="11-7"/>paleontologic, and mineralogic subjects;</subsection><subsection ssid="28-null-3" dnum="b-o" numlevel="1" lineno="609" slineno="11-8" level="2"><display>(b)</display>collect and distribute reliable information regarding the mineral industry and mineral <ln numlevel="1" lineno="610" slineno="11-9"/>resources, topography, paleontology, and geology of the state;</subsection><subsection ssid="28-null-4" dnum="c-o" numlevel="1" lineno="611" slineno="11-10" level="2"><display>(c)</display>survey the geology of the state, including mineral occurrences and the ores of metals, <ln numlevel="1" lineno="612" slineno="11-11"/>energy resources, industrial minerals and rocks, mineral-bearing waters, and surface <ln numlevel="1" lineno="613" slineno="11-12"/>and ground water resources, with special reference to their economic contents, <ln numlevel="1" lineno="614" slineno="11-13"/>values, uses, kind, and availability in order to facilitate their economic use;</subsection><subsection ssid="28-null-5" dnum="d-o" numlevel="1" lineno="615" slineno="11-14" level="2"><display>(d)</display>investigate the kind, amount, and availability of mineral substances contained in  <ln numlevel="1" lineno="616" slineno="11-15"/>lands owned and controlled by the state, to contribute to the most effective and <ln numlevel="1" lineno="617" slineno="11-16"/>beneficial administration of these lands for the state;</subsection><subsection ssid="28-null-6" dnum="e-o" numlevel="1" lineno="618" slineno="11-17" level="2"><display>(e)</display>determine and investigate areas of geologic and topographic hazards that could affect <ln numlevel="1" lineno="619" slineno="11-18"/>the safety of, or cause economic loss to, the citizens of the state;</subsection><subsection ssid="28-null-7" dnum="f-o" numlevel="1" lineno="620" slineno="11-19" level="2"><display>(f)</display>assist local and state agencies in their planning, zoning, and building regulation <ln numlevel="1" lineno="621" slineno="11-20"/>functions by publishing maps, delineating appropriately wide special earthquake risk <ln numlevel="1" lineno="622" slineno="11-21"/>areas, and, at the request of state agencies or other governmental agencies, review the <ln numlevel="1" lineno="623" slineno="11-22"/>siting of critical facilities;</subsection><subsection ssid="28-null-8" dnum="g-o" numlevel="1" lineno="624" slineno="11-23" level="2"><display>(g)</display>cooperate with state agencies, political subdivisions of the state, quasi-governmental <ln numlevel="1" lineno="625" slineno="11-24"/>agencies, federal agencies, schools of higher education, and others in fields of mutual <ln numlevel="1" lineno="626" slineno="11-25"/>concern, which may include field investigations and preparation, publication, and <ln numlevel="1" lineno="627" slineno="11-26"/>distribution of reports and maps;</subsection><subsection ssid="28-null-9" dnum="h-o" numlevel="1" lineno="628" slineno="11-27" level="2"><display>(h)</display>collect and preserve data pertaining to mineral resource exploration and development <ln numlevel="1" lineno="629" slineno="11-28"/>programs and construction activities, such as claim maps, location of drill holes, <ln numlevel="1" lineno="630" slineno="11-29"/>location of surface and underground workings, geologic plans and sections, drill logs, <ln numlevel="1" lineno="631" slineno="11-30"/>and assay and sample maps, including the maintenance of a sample library of cores <ln numlevel="1" lineno="632" slineno="11-31"/>and cuttings;</subsection><subsection ssid="28-null-10" dnum="i-o" numlevel="1" lineno="633" slineno="11-32" level="2"><display>(i)</display>study and analyze other scientific, economic, or aesthetic problems as, in the <ln numlevel="1" lineno="634" slineno="11-33"/>judgment of the board, should be undertaken by the survey to serve the needs of the <ln numlevel="1" lineno="635" slineno="11-34"/>state and to support the development of natural resources and utilization of lands <ln numlevel="1" lineno="636" slineno="11-35"/>within the state;</subsection><subsection ssid="28-null-11" dnum="j-o" numlevel="1" lineno="637" slineno="11-36" level="2"><display>(j)</display>prepare, publish, distribute, and sell maps, reports, and bulletins, embodying the work <ln numlevel="1" lineno="638" slineno="11-37"/>accomplished by the survey, directly or in collaboration with others, and collect and <ln numlevel="1" lineno="639" slineno="11-38"/>prepare exhibits of the geological and mineral resources of this state and interpret <ln numlevel="1" lineno="640" slineno="11-39"/>their significance;</subsection><subsection ssid="28-null-12" dnum="k-o" numlevel="1" lineno="641" slineno="11-40" level="2"><display>(k)</display>collect, maintain, and preserve data and information in order to accomplish the <ln numlevel="1" lineno="642" slineno="11-41"/>purposes of this section and act as a repository for information concerning the <ln numlevel="1" lineno="643" slineno="11-42"/>geology of this state;</subsection><subsection ssid="28-null-13" dnum="l-o" numlevel="1" lineno="644" slineno="11-43" level="2"><display>(l)</display>stimulate research, study, and activities in the field of paleontology;</subsection><subsection ssid="28-null-14" dnum="m-o" numlevel="1" lineno="645" slineno="11-44" level="2"><display>(m)</display>mark, protect, and preserve critical paleontological sites;</subsection><subsection ssid="28-null-15" dnum="n-o" numlevel="1" lineno="646" slineno="11-45" level="2"><display>(n)</display>collect, preserve, and administer critical paleontological specimens until the <ln numlevel="1" lineno="647" slineno="11-46"/>specimens are placed in a repository or curation facility;</subsection><subsection ssid="28-null-16" dnum="o-o" numlevel="1" lineno="648" slineno="11-47" level="2"><display>(o)</display>administer critical paleontological site excavation records;</subsection><subsection ssid="28-null-17" dnum="p-o" numlevel="1" lineno="649" slineno="11-48" level="2"><display>(p)</display>edit and publish critical paleontological records and reports; and</subsection><subsection ssid="28-null-18" dnum="q-o" numlevel="1" lineno="650" slineno="11-49" level="2"><display>(q)</display>collect the land use permits described in Sections <xref depth="3" refnumber="10-20-611">10-20-611</xref> and <xref depth="3" refnumber="17-79-608">17-79-608</xref>.</subsection></subsection><subsection ssid="28-null-19" dnum="2-o" numlevel="1" lineno="651" slineno="11-50" level="1" space="false"><display>(2)</display><subsection ssid="28-null-20" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The survey may maintain as confidential, and not as a public record, information <ln numlevel="1" lineno="652" slineno="11-51"/>provided to the survey by any source.</subsection><subsection ssid="28-null-21" dnum="b-o" numlevel="1" lineno="653" slineno="11-52" level="2"><display>(b)</display>The board shall adopt rules in order to determine whether to accept the information <ln numlevel="1" lineno="654" slineno="11-53"/>described in Subsection <xref depth="4" refnumber="79-3-202(2)(a)">(2)(a)</xref> and to maintain the confidentiality of the accepted <ln numlevel="1" lineno="655" slineno="11-54"/>information.</subsection><subsection ssid="28-null-22" dnum="c-o" numlevel="1" lineno="656" slineno="11-55" level="2"><display>(c)</display>The survey shall maintain information received from any source at the level of <ln numlevel="1" lineno="657" slineno="11-56"/>confidentiality assigned to it by the source.</subsection></subsection><subsection ssid="28-null-23" dnum="3-o" numlevel="1" lineno="658" slineno="11-57" level="1"><display>(3)</display>Upon approval of the board, the survey shall undertake other activities consistent with <ln numlevel="1" lineno="659" slineno="11-58"/>Subsection <xref depth="4" refnumber="79-3-202(1)">(1)</xref>.</subsection><subsection ssid="28-null-24" dnum="4-o" numlevel="1" lineno="660" slineno="11-59" level="1" space="false"><display>(4)</display><subsection ssid="28-null-25" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Subject to the authority granted to the department, the survey may enter into <ln numlevel="1" lineno="661" slineno="11-60"/>cooperative agreements with the entities specified in Subsection <xref depth="4" refnumber="79-3-202(1)(g)">(1)(g)</xref>, if approved <ln numlevel="1" lineno="662" slineno="11-61"/>by the board, and may accept or commit allocated or budgeted funds in connection <ln numlevel="1" lineno="663" slineno="11-62"/>with those agreements.</subsection><subsection ssid="28-null-26" dnum="b-o" numlevel="1" lineno="664" slineno="11-63" level="2"><display>(b)</display>The survey may undertake joint projects with private entities if:<subsection ssid="28-null-27" dnum="i-o" numlevel="1" lineno="665" slineno="11-64" level="3"><display>(i)</display>the action is approved by the board;</subsection><subsection ssid="28-null-28" dnum="ii-o" numlevel="1" lineno="666" slineno="11-65" level="3"><display>(ii)</display>the projects are not inconsistent with the state's objectives; and</subsection><subsection ssid="28-null-29" dnum="iii-o" numlevel="1" lineno="667" slineno="11-66" level="3"><display>(iii)</display>the results of the projects are available to the public.</subsection></subsection></subsection></section></bsec><bsec buid="30" num="79-6-106" type="amend" src="code" uid="C79-6-S106_2026050620260506" sort="79 06 01060020260506" numlevel="1" lineno="668" slineno="12-1" sn="12"><section number="79-6-106" numlevel="1" lineno="669" slineno="12-2" type="amend"><secline lineno="668">Section 12. Section <bold>79-6-106</bold> is amended to read:</secline><catline lineno="669"><bold>79-6-106<parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>05/06/26</date></paren></parens>. Hydrogen advisory council.</bold></catline><subsection ssid="30-null-1" dnum="1-o" numlevel="1" lineno="670" slineno="12-3" level="1" placement="noreturn"><display>(1)</display>The department shall create a hydrogen advisory council within the office that consists <ln numlevel="1" lineno="671" slineno="12-4"/>of seven to nine members appointed by the executive director, in consultation with the <ln numlevel="1" lineno="672" slineno="12-5"/>director. The executive director shall appoint members with expertise in:<subsection ssid="30-null-2" dnum="a-o" numlevel="1" lineno="673" slineno="12-6" level="2"><display>(a)</display>hydrogen energy in general;</subsection><subsection ssid="30-null-3" dnum="b-o" numlevel="1" lineno="674" slineno="12-7" level="2"><display>(b)</display>hydrogen project facilities;</subsection><subsection ssid="30-null-4" dnum="c-o" numlevel="1" lineno="675" slineno="12-8" level="2"><display>(c)</display>technology suppliers;</subsection><subsection ssid="30-null-5" dnum="d-o" numlevel="1" lineno="676" slineno="12-9" level="2"><display>(d)</display>hydrogen producers or processors;</subsection><subsection ssid="30-null-6" dnum="e-o" numlevel="1" lineno="677" slineno="12-10" level="2"><display>(e)</display>renewable and fossil based power generation industries; and</subsection><subsection ssid="30-null-7" dnum="f-o" numlevel="1" lineno="678" slineno="12-11" level="2"><display>(f)</display>fossil fuel based hydrogen feedstock providers.</subsection></subsection><subsection ssid="30-null-8" dnum="2-o" numlevel="1" lineno="679" slineno="12-12" level="1" space="false"><display>(2)</display><subsection ssid="30-null-9" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as required by Subsection <xref depth="4" refnumber="79-6-106(2)(b)">(2)(b)</xref>, a member shall serve a four-year term.</subsection><subsection ssid="30-null-10" dnum="b-o" numlevel="1" lineno="680" slineno="12-13" level="2"><display>(b)</display>The executive director shall, at the time of appointment or reappointment, adjust the <ln numlevel="1" lineno="681" slineno="12-14"/>length of terms to ensure that the terms of council members are staggered so that <ln numlevel="1" lineno="682" slineno="12-15"/>approximately half of the hydrogen advisory council is appointed every two years.</subsection><subsection ssid="30-null-11" dnum="c-o" numlevel="1" lineno="683" slineno="12-16" level="2"><display>(c)</display>When a vacancy occurs in the membership for any reason, the replacement shall be <ln numlevel="1" lineno="684" slineno="12-17"/>appointed for the unexpired term.</subsection></subsection><subsection ssid="30-null-12" dnum="3-o" numlevel="1" lineno="685" slineno="12-18" level="1" space="false"><display>(3)</display><subsection ssid="30-null-13" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A majority of the members appointed under this section constitutes a quorum of <ln numlevel="1" lineno="686" slineno="12-19"/>the hydrogen advisory council.</subsection><subsection ssid="30-null-14" dnum="b-o" numlevel="1" lineno="687" slineno="12-20" level="2"><display>(b)</display>The hydrogen advisory council shall determine:<subsection ssid="30-null-15" dnum="i-o" numlevel="1" lineno="688" slineno="12-21" level="3"><display>(i)</display>the time and place of meetings; and</subsection><subsection ssid="30-null-16" dnum="ii-o" numlevel="1" lineno="689" slineno="12-22" level="3"><display>(ii)</display>any other procedural matter not specified in this section.</subsection></subsection></subsection><subsection ssid="30-null-17" dnum="4-o" numlevel="1" lineno="690" slineno="12-23" level="1"><display>(4)</display>A member may not receive compensation or benefits for the member's service, but may <ln numlevel="1" lineno="691" slineno="12-24"/>receive per diem and travel expenses in accordance with:<subsection ssid="30-null-18" dnum="a-o" numlevel="1" lineno="692" slineno="12-25" level="2"><display>(a)</display>Section <xref depth="3" refnumber="63A-3-106">63A-3-106</xref>;</subsection><subsection ssid="30-null-19" dnum="b-o" numlevel="1" lineno="693" slineno="12-26" level="2"><display>(b)</display>Section <xref depth="3" refnumber="63A-3-107">63A-3-107</xref>; and</subsection><subsection ssid="30-null-20" dnum="c-o" numlevel="1" lineno="694" slineno="12-27" level="2"><display>(c)</display>rules made by the Division of Finance pursuant to Sections <xref depth="3" refnumber="63A-3-106">63A-3-106</xref> and <xref depth="3" refnumber="63A-3-107"><ln numlevel="1" lineno="695" slineno="12-28"/>63A-3-107</xref>.</subsection></subsection><subsection ssid="30-null-21" dnum="5-o" numlevel="1" lineno="696" slineno="12-29" level="1"><display>(5)</display>The office shall staff the hydrogen advisory council.</subsection><subsection ssid="30-null-22" dnum="6-o" numlevel="1" lineno="697" slineno="12-30" level="1"><display>(6)</display>The hydrogen advisory council may:<subsection ssid="30-null-23" dnum="a-o" numlevel="1" lineno="698" slineno="12-31" level="2"><display>(a)</display>develop hydrogen facts and figures that facilitate use of hydrogen fuel within the <ln numlevel="1" lineno="699" slineno="12-32"/>state;</subsection><subsection ssid="30-null-24" dnum="b-o" numlevel="1" lineno="700" slineno="12-33" level="2"><display>(b)</display>encourage cross-state cooperation with states that have hydrogen programs;</subsection><subsection ssid="30-null-25" dnum="c-o" numlevel="1" lineno="701" slineno="12-34" level="2"><display>(c)</display>work with state agencies, the private sector, and other stakeholders, such as <ln numlevel="1" lineno="702" slineno="12-35"/>environmental groups, to:<subsection ssid="30-null-26" dnum="i-o" numlevel="1" lineno="703" slineno="12-36" level="3"><display>(i)</display>recommend realistic goals for hydrogen development that can be executed within <ln numlevel="1" lineno="704" slineno="12-37"/>realistic time frames; and</subsection><subsection ssid="30-null-27" dnum="ii-o" numlevel="1" lineno="705" slineno="12-38" level="3"><display>(ii)</display>educate, discuss, consult, and make recommendations in hydrogen related matters <ln numlevel="1" lineno="706" slineno="12-39"/>that benefit the state;</subsection></subsection><subsection ssid="30-null-28" dnum="d-o" numlevel="1" lineno="707" slineno="12-40" level="2"><display>(d)</display>promote hydrogen research at an institution of higher education<amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both"> or a private <ln numlevel="1" lineno="708" slineno="12-41"/>postsecondary educational institution</amend>, as defined in Section <xref depth="3" refnumber="53H-1-101">53H-1-101</xref>;</subsection><subsection ssid="30-null-29" dnum="e-o" numlevel="1" lineno="709" slineno="12-42" level="2"><display>(e)</display>make recommendations regarding how to qualify for federal funding of hydrogen <ln numlevel="1" lineno="710" slineno="12-43"/>projects, including hydrogen related projects for:<subsection ssid="30-null-30" dnum="i-o" numlevel="1" lineno="711" slineno="12-44" level="3"><display>(i)</display>the state;</subsection><subsection ssid="30-null-31" dnum="ii-o" numlevel="1" lineno="712" slineno="12-45" level="3"><display>(ii)</display>a local government;</subsection><subsection ssid="30-null-32" dnum="iii-o" numlevel="1" lineno="713" slineno="12-46" level="3"><display>(iii)</display>a privately commissioned project;</subsection><subsection ssid="30-null-33" dnum="iv-o" numlevel="1" lineno="714" slineno="12-47" level="3"><display>(iv)</display>an educational project;</subsection><subsection ssid="30-null-34" dnum="v-o" numlevel="1" lineno="715" slineno="12-48" level="3"><display>(v)</display>scientific development; and</subsection><subsection ssid="30-null-35" dnum="vi-o" numlevel="1" lineno="716" slineno="12-49" level="3"><display>(vi)</display>engineering and novel technologies;</subsection></subsection><subsection ssid="30-null-36" dnum="f-o" numlevel="1" lineno="717" slineno="12-50" level="2"><display>(f)</display>make recommendations related to the development of multiple feedstock or energy <ln numlevel="1" lineno="718" slineno="12-51"/>resources in the state such as wind, solar, hydroelectric, geothermal, coal, natural gas, <ln numlevel="1" lineno="719" slineno="12-52"/>oil, water, electrolysis, coal gasification, liquefaction, hydrogen storage, safety <ln numlevel="1" lineno="720" slineno="12-53"/>handling, compression, and transportation;</subsection><subsection ssid="30-null-37" dnum="g-o" numlevel="1" lineno="721" slineno="12-54" level="2"><display>(g)</display>make recommendations to establish statewide safety protocols for production, <ln numlevel="1" lineno="722" slineno="12-55"/>transportation, and handling of hydrogen for both residential and commercial <ln numlevel="1" lineno="723" slineno="12-56"/>applications;</subsection><subsection ssid="30-null-38" dnum="h-o" numlevel="1" lineno="724" slineno="12-57" level="2"><display>(h)</display>facilitate public events to raise the awareness of hydrogen and hydrogen related fuels <ln numlevel="1" lineno="725" slineno="12-58"/>within the state and how hydrogen can be advantageous to all forms of transportation, <ln numlevel="1" lineno="726" slineno="12-59"/>heat, and power generation;</subsection><subsection ssid="30-null-39" dnum="i-o" numlevel="1" lineno="727" slineno="12-60" level="2"><display>(i)</display>review and make recommendations regarding legislation; and</subsection><subsection ssid="30-null-40" dnum="j-o" numlevel="1" lineno="728" slineno="12-61" level="2"><display>(j)</display>make other recommendations to the director related to hydrogen development in the <ln numlevel="1" lineno="729" slineno="12-62"/>state.</subsection></subsection></section></bsec><bsec buid="32" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="730" slineno="13-1" sn="13"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="730">Section 13.  <bold>Effective Date.</bold></secline><sectionText lineno="731"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>1-16-26 3:47 PM</tm></rev></foot></leg>
