Section <bold>4-3-301</bold> is amended to read:</secline><catline lineno="35"><bold>4-3-301<parens/>. Permits or certificates -- Application -- Fee -- Expiration -- Renewal -- <ln numlevel="1" lineno="36" slineno="1-3"/>Raw milk registration.</bold></catline><subsection ssid="22-null-1" dnum="1-o" numlevel="1" lineno="37" slineno="1-4" level="1" placement="noreturn"><display>(1)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="31" groupid="22" style="2" owner="jchristopherson" level="1" deltag="both">Application </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="30" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">A person shall apply to the department </amend>for a permit to operate a plant, <ln numlevel="1" lineno="38" slineno="1-5"/>manufacture butter or cheese, pasteurize milk, test milk for payment, haul milk in bulk, <ln numlevel="1" lineno="39" slineno="1-6"/>or for the wholesale distribution of dairy products <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="32" groupid="23" style="2" owner="jchristopherson" level="1" deltag="both">shall be made to the department upon <ln numlevel="1" lineno="40" slineno="1-7"/>forms </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="38" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">on a form </amend>prescribed and furnished by the department.</subsection><subsection ssid="22-null-2" dnum="2-o" numlevel="1" lineno="41" slineno="1-8" level="1"><display>(2)</display>Upon receipt of a proper application, compliance with the applicable rules, and payment <ln numlevel="1" lineno="42" slineno="1-9"/>of a permit fee determined by the department according to Subsection <xref depth="4" refnumber="4-2-103(2)" start="0">4-2-103(2)</xref>, the <ln numlevel="1" lineno="43" slineno="1-10"/>commissioner, if satisfied that the public convenience and necessity and the industry <ln numlevel="1" lineno="44" slineno="1-11"/>will be served, shall issue an appropriate permit to the applicant subject to suspension or <ln numlevel="1" lineno="45" slineno="1-12"/>revocation for cause.</subsection><subsection ssid="22-null-3" dnum="3-o" numlevel="1" lineno="46" slineno="1-13" level="1"><display>(3)</display>A permit issued under this section expires at midnight on December 31 of each year.</subsection><subsection ssid="22-null-4" dnum="4-o" numlevel="1" lineno="47" slineno="1-14" level="1"><display>(4)</display>A permit to operate a plant, manufacture butter or cheese, pasteurize milk, test milk for <ln numlevel="1" lineno="48" slineno="1-15"/>payment, haul milk in bulk, or for the wholesale distribution of dairy products, is <ln numlevel="1" lineno="49" slineno="1-16"/>renewable for a period of one year upon the payment of an annual permit renewal fee <ln numlevel="1" lineno="50" slineno="1-17"/>determined by the department according to Subsection <xref depth="4" refnumber="4-2-103(2)" start="0">4-2-103(2)</xref> on or before <ln numlevel="1" lineno="51" slineno="1-18"/>December 31 of each year.</subsection><subsection ssid="22-null-5" dnum="5-o:_-i" numlevel="1" lineno="52" slineno="1-19" ea="erase" anum="0" owner="jchristopherson" style="2" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1004" style="2" owner="o" level="1" deltag="start">(5)</amend></display><amend anum="0" ea="erase" pairid="22" groupid="16" style="2" owner="jchristopherson" level="1" deltag="end">Notwithstanding the requirements of Subsection <xref depth="4" refnumber="4-3-301(1)" start="0">(1)</xref>, application for a permit or <ln numlevel="1" lineno="53" slineno="1-20"/>certificate to produce milk or a raw milk product, as that term is defined in Section <xref depth="3" refnumber="4-3-503" start="0"><ln numlevel="1" lineno="54" slineno="1-21"/>4-3-503</xref>, shall be made to the department on forms prescribed and furnished by the <ln numlevel="1" lineno="55" slineno="1-22"/>department.</amend><amendoutend style="2"/></subsection><subsection ssid="22-null-6" dnum="6-o:_-i" numlevel="1" lineno="56" slineno="1-23" ea="erase" anum="0" owner="jchristopherson" style="2" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1005" style="2" owner="o" level="1" deltag="start">(6)</amend></display><subsection ssid="22-null-7" dnum="a-o:_-i" ea="erase" anum="0" owner="jchristopherson" style="2" level="2" placement="sameline"><display><amend anum="0" ea="erase" pairid="1006" style="2" owner="o" level="1">(a)</amend></display><amend anum="0" ea="erase" pairid="33" groupid="24" style="2" owner="jchristopherson" level="1" deltag="end">Upon receipt of a proper application and compliance with applicable rules, the <ln numlevel="1" lineno="57" slineno="1-24"/>commissioner shall issue a permit entitling the applicant to engage in the business of <ln numlevel="1" lineno="58" slineno="1-25"/>producer, subject to suspension or revocation for cause.</amend><amendoutend style="2"/></subsection><subsection ssid="22-null-8" dnum="b-o:_-i" numlevel="1" lineno="59" slineno="1-26" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1007" style="2" owner="o" level="1" deltag="start">(b)</amend></display><amend anum="0" ea="erase" pairid="34" groupid="25" style="2" owner="jchristopherson" level="1" deltag="end">A fee may not be charged by the department for issuance of a certificate.</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="22-10" dnum="_-o:5-i" numlevel="1" lineno="60" slineno="1-27" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="19" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="end">Notwithstanding Subsection <xref depth="4" refnumber="4-3-301(1)">(1)</xref>, in accordance with Part 6, Raw Milk, on a form <ln numlevel="1" lineno="61" slineno="1-28"/>prescribed and furnished by the department, a person shall register to produce and sell <ln numlevel="1" lineno="62" slineno="1-29"/>raw milk or a raw milk product.</amend></subsection></section></bsec><bsec buid="3" num="4-3-601" type="enact" src="code" uid="C4-3-S601_2026050620260506" sort="04 03 06010020260506" numlevel="1" lineno="63" slineno="2-1" sn="2"><section numlevel="1" lineno="65" slineno="2-3" number="4-3-601" type="enact"><secline lineno="63">Section 2. Section <bold>4-3-601</bold> is enacted to read:</secline><headpart number="4-3-6" numlevel="1" lineno="64" slineno="2-2">6. Raw Milk</headpart><catline lineno="65"><bold>4-3-601<parens/>. Definitions.</bold></catline><sectionText lineno="66"><para/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both">As used in this part:</amend></sectionText><subsection ssid="3-1" dnum="_-o:1-i" numlevel="1" lineno="67" slineno="2-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="73" groupid="57" style="1" owner="jchristopherson" level="1" amendtag="end">"Batch" means the milk emptied from one bulk tank and bottled in a single day.</amend></subsection><subsection ssid="3-13" dnum="_-o:2-i" numlevel="1" lineno="68" slineno="2-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="71" groupid="55" style="1" owner="jchristopherson" level="1" amendtag="end">"Consumer" means an end user who purchases raw milk or a raw milk product for <ln numlevel="1" lineno="69" slineno="2-7"/>personal or household use.</amend></subsection><subsection ssid="3-15" dnum="_-o:3-i" numlevel="1" lineno="70" slineno="2-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="81" groupid="63" style="1" owner="jchristopherson" level="1" amendtag="end">"Delivery provider" means a person who under contract with a producer delivers raw <ln numlevel="1" lineno="71" slineno="2-9"/>milk or a raw milk product to a consumer or market.</amend></subsection><subsection ssid="3-2" dnum="_-o:4-i" numlevel="1" lineno="72" slineno="2-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1012" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="14" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="end">"Destruction" means to dispose of raw milk or a raw milk product in a manner that <ln numlevel="1" lineno="73" slineno="2-11"/>prevents use or consumption of the raw milk or raw milk product.</amend></subsection><subsection ssid="3-3" dnum="_-o:5-i" numlevel="1" lineno="74" slineno="2-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1013" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="21" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="end">"Foodborne illness outbreak" means the occurrence of two or more cases from different <ln numlevel="1" lineno="75" slineno="2-13"/>households of a similar illness resulting from the ingestion of a common food.</amend></subsection><subsection ssid="3-4" dnum="_-o:6-i" numlevel="1" lineno="76" slineno="2-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1014" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="end">"Food service establishment" means the same as that term is defined in Section <xref depth="3" refnumber="26B-7-401"><ln numlevel="1" lineno="77" slineno="2-15"/>26B-7-401</xref>.</amend></subsection><subsection ssid="3-5" dnum="_-o:7-i" numlevel="1" lineno="78" slineno="2-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1015" style="1" owner="i" level="1" amendtag="start">(7)</amend></display><amend anum="0" ea="amend" pairid="31" groupid="23" style="1" owner="jchristopherson" level="1" amendtag="end">"Market" means a retail location or establishment other than the premises of the <ln numlevel="1" lineno="79" slineno="2-17"/>producer that is registered with the department as a food establishment in accordance <ln numlevel="1" lineno="80" slineno="2-18"/>with Section <xref depth="3" refnumber="4-5-301">4-5-301</xref> and where raw milk or a raw milk product is offered for sale <ln numlevel="1" lineno="81" slineno="2-19"/>directly to a consumer.</amend></subsection><subsection ssid="3-7" dnum="_-o:8-i" numlevel="1" lineno="82" slineno="2-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="start">(8)</amend></display><amend anum="0" ea="amend" pairid="41" groupid="31" style="1" owner="jchristopherson" level="1" amendtag="end">"Premises" means the property or facility used for the:</amend><subsection ssid="3-11" dnum="_-o:a-i" numlevel="1" lineno="83" slineno="2-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1017" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="61" groupid="47" style="1" owner="jchristopherson" level="1" amendtag="end">housing or milking of lactating animals; or</amend></subsection><subsection ssid="3-12" dnum="_-o:b-i" numlevel="1" lineno="84" slineno="2-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="66" groupid="51" style="1" owner="jchristopherson" level="1" amendtag="end">processing, storage, or sale of raw milk or a raw milk product.</amend></subsection></subsection><subsection ssid="3-8" dnum="_-o:9-i" numlevel="1" lineno="85" slineno="2-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1019" style="1" owner="i" level="1" amendtag="start">(9)</amend></display><amend anum="0" ea="amend" pairid="46" groupid="35" style="1" owner="jchristopherson" level="1" amendtag="end">"Producer" means a person that owns a lactating animal and produces, bottles, packages, <ln numlevel="1" lineno="86" slineno="2-24"/>or sells raw milk or a raw milk product.</amend></subsection><subsection ssid="3-9" dnum="_-o:10-i" numlevel="1" lineno="87" slineno="2-25" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1020" style="1" owner="i" level="1" amendtag="start">(10)</amend></display><amend anum="0" ea="amend" pairid="51" groupid="39" style="1" owner="jchristopherson" level="1" amendtag="end">"Raw milk" means milk from a lactating animal that has not been pasteurized.</amend></subsection><subsection ssid="3-10" dnum="_-o:11-i" numlevel="1" lineno="88" slineno="2-26" ea="amend" anum="0" owner="jchristopherson" style="1" Registration.</bold></catline><subsection ssid="56-1" dnum="_-o:1-i" numlevel="1" lineno="91" slineno="3-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1022" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="13" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="end">A person may not produce and sell raw milk or a raw milk product without registering <ln numlevel="1" lineno="92" slineno="3-4"/>with the department.</amend></subsection><subsection ssid="56-2" dnum="_-o:2-i" numlevel="1" lineno="93" slineno="3-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1023" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="end">The registration application shall be in the form of a postcard and include:</amend><subsection ssid="56-21" dnum="_-o:a-i" numlevel="1" lineno="94" slineno="3-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1024" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="108" groupid="84" style="1" owner="jchristopherson" level="1" amendtag="end">the business name and address of the producer; and</amend></subsection><subsection ssid="56-6" dnum="_-o:b-i" numlevel="1" lineno="95" slineno="3-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1025" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="37" groupid="28" style="1" owner="jchristopherson" level="1" amendtag="end">the species of lactating animals that produce the raw milk.</amend></subsection></subsection><subsection ssid="56-10" dnum="_-o:3-i" numlevel="1" lineno="96" slineno="3-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1026" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><subsection ssid="56-11" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1027" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="62" groupid="48" style="1" owner="jchristopherson" level="1" amendtag="end">Subject to Subsection <xref depth="4" refnumber="4-3-602(4)">(4)</xref>, registration is valid for the calendar year in which the <ln numlevel="1" lineno="97" slineno="3-9"/>person registers.</amend></subsection><subsection ssid="56-12" dnum="_-o:b-i" numlevel="1" lineno="98" slineno="3-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1028" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="66" groupid="51" style="1" owner="jchristopherson" level="1" amendtag="end">To renew a registration, a person shall file a renewal application with the department <ln numlevel="1" lineno="99" slineno="3-11"/>in the form of a postcard by no later than December 31.</amend></subsection></subsection><subsection ssid="56-15" dnum="_-o:4-i" numlevel="1" lineno="100" slineno="3-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1029" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="85" groupid="66" style="1" owner="jchristopherson" level="1" amendtag="end">If a producer changes information listed in Subsection <xref depth="4" refnumber="4-3-602(2)">(2)</xref> that is provided in a postcard <ln numlevel="1" lineno="101" slineno="3-13"/>registration application, the producer shall submit a new registration application by no <ln numlevel="1" lineno="102" slineno="3-14"/>later than 30 days before the change and mark that the registration application is an <ln numlevel="1" lineno="103" slineno="3-15"/>updated application.</amend></subsection></section></bsec><bsec buid="54" num="4-3-603" type="enact" src="code" uid="C4-3-S603_2026050620260506" sort="04 03 06030020260506" numlevel="1" lineno="104" slineno="4-1" sn="4"><section numlevel="1" lineno="105" slineno="4-2" number="4-3-603" type="enact"><secline lineno="104">Section 4. General operational requirements.</bold></catline><subsection ssid="54-36-201" dnum="_-o:1-i" numlevel="1" lineno="106" slineno="4-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn" space="false"><display><amend anum="0" ea="amend" pairid="1030" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><subsection ssid="54-36-202" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1031" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="19" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="end">A person may produce raw milk only from an animal owned by the registered <ln numlevel="1" lineno="107" slineno="4-4"/>producer.</amend></subsection><subsection ssid="54-36-203" dnum="_-o:b-i" numlevel="1" lineno="108" slineno="4-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1032" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="24" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="end">Raw milk shall originate from a lactating animal, including a cow, goat, or sheep.</amend></subsection></subsection><subsection ssid="54-281" dnum="_-o:2-i" numlevel="1" lineno="109" slineno="4-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1033" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="437" groupid="342" style="1" owner="jchristopherson" level="1" amendtag="end">A person may sell raw milk or a raw milk product only within Utah.</amend></subsection><subsection ssid="54-36-204" dnum="_-o:3-i" numlevel="1" lineno="110" slineno="4-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1034" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><subsection ssid="54-36-205" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1035" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="29" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="end">A producer shall obtain regular services by a licensed veterinarian for the <ln numlevel="1" lineno="111" slineno="4-8"/>producer's herd of lactating animals.</amend></subsection><subsection ssid="54-36-206" dnum="_-o:b-i" numlevel="1" lineno="112" slineno="4-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1036" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="34" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="end">Subject to Subsection <xref depth="4" refnumber="4-3-603(9)">(9)</xref>, a producer shall maintain veterinary care records, <ln numlevel="1" lineno="113" slineno="4-10"/>including:</amend><subsection ssid="54-36-207" dnum="_-o:i-i" numlevel="1" lineno="114" slineno="4-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1037" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="39" groupid="30" style="1" owner="jchristopherson" level="1" amendtag="end">routine herd health checks;</amend></subsection><subsection ssid="54-36-208" dnum="_-o:ii-i" numlevel="1" lineno="115" slineno="4-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1038" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="44" groupid="34" style="1" owner="jchristopherson" level="1" amendtag="end">disease screening;</amend></subsection><subsection ssid="54-36-209" dnum="_-o:iii-i" numlevel="1" lineno="116" slineno="4-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1039" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="49" groupid="38" style="1" owner="jchristopherson" level="1" amendtag="end">treatment documentation; and</amend></subsection><subsection ssid="54-36-210" dnum="_-o:iv-i" numlevel="1" lineno="117" slineno="4-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1040" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="54" groupid="42" style="1" owner="jchristopherson" level="1" amendtag="end">withdrawal period verification.</amend></subsection></subsection><subsection ssid="54-36-211" dnum="_-o:c-i" numlevel="1" lineno="118" slineno="4-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1041" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="209" groupid="165" style="1" owner="jchristopherson" level="1" amendtag="end">A producer shall:</amend><subsection ssid="54-36-212" dnum="_-o:i-i" numlevel="1" lineno="119" slineno="4-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1042" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="214" groupid="169" style="1" owner="jchristopherson" level="1" amendtag="end">comply with a withdrawal period after animal treatment;</amend></subsection><subsection ssid="54-36-213" dnum="_-o:ii-i" numlevel="1" lineno="120" slineno="4-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1043" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="219" groupid="173" style="1" owner="jchristopherson" level="1" amendtag="end">routinely screen for mastitis or illness; and</amend></subsection><subsection ssid="54-36-214" dnum="_-o:iii-i" numlevel="1" lineno="121" slineno="4-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1044" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="224" groupid="177" style="1" owner="jchristopherson" level="1" amendtag="end">refrain from selling raw milk or a raw milk product from a sick animal.</amend></subsection></subsection></subsection><subsection ssid="54-36-225" dnum="_-o:4-i" numlevel="1" lineno="122" slineno="4-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1045" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><subsection ssid="54-36-226" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1046" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="299" groupid="237" style="1" owner="jchristopherson" level="1" amendtag="end">A person may not sell raw milk or a raw milk product through a food service <ln numlevel="1" lineno="123" slineno="4-20"/>establishment or under Chapter 5a, Home Consumption and Homemade Food Act.</amend></subsection><subsection ssid="54-36-228" dnum="_-o:b-i" numlevel="1" lineno="124" slineno="4-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1047" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="337" groupid="266" style="1" owner="jchristopherson" level="1" amendtag="end">A person may not use raw milk in a commercial kitchen, in commercial food <ln numlevel="1" lineno="125" slineno="4-22"/>processing, or in a food service establishment.</amend></subsection><subsection ssid="54-272" dnum="_-o:c-i" numlevel="1" lineno="126" slineno="4-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1048" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="467" groupid="365" style="1" owner="jchristopherson" level="1" amendtag="end">A producer may not allow raw milk or a raw milk product, including cream from raw <ln numlevel="1" lineno="127" slineno="4-24"/>milk, to be removed from the premises where that raw milk is produced unless:</amend><subsection ssid="54-305" dnum="_-o:i-i" numlevel="1" lineno="128" slineno="4-25" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1049" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="487" groupid="381" style="1" owner="jchristopherson" level="1" amendtag="end">the raw milk or raw milk product is delivered to a consumer or market by the <ln numlevel="1" lineno="129" slineno="4-26"/>producer or a delivery provider; and</amend></subsection><subsection ssid="54-306" dnum="_-o:ii-i" numlevel="1" lineno="130" slineno="4-27" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1050" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="492" groupid="385" style="1" owner="jchristopherson" level="1" amendtag="end">the label on the raw milk or raw milk product is not changed from the label <ln numlevel="1" lineno="131" slineno="4-28"/>required under Section <xref depth="3" refnumber="4-3-604">4-3-604</xref> placed on the raw milk or raw milk product by the <ln numlevel="1" lineno="132" slineno="4-29"/>producer.</amend></subsection></subsection></subsection><subsection ssid="54-36-229" dnum="_-o:5-i" numlevel="1" lineno="133" slineno="4-30" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1051" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><subsection ssid="54-290" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1052" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="442" groupid="346" style="1" owner="jchristopherson" level="1" amendtag="end">A person shall cool raw milk to 41 degrees Fahrenheit or below within two hours <ln numlevel="1" lineno="134" slineno="4-31"/>of milking and maintain the raw milk or a raw milk product at or below 41 degrees <ln numlevel="1" lineno="135" slineno="4-32"/>Fahrenheit at all times.</amend></subsection><subsection ssid="54-294" dnum="_-o:b-i" numlevel="1" lineno="136" slineno="4-33" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1053" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="456" groupid="357" style="1" owner="jchristopherson" level="1" amendtag="end">A producer shall use a raw milk container that is tamper-resistant and food-grade.</amend></subsection><subsection ssid="54-36-230" dnum="_-o:c-i" numlevel="1" lineno="137" slineno="4-34" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1054" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="122" groupid="96" style="1" owner="jchristopherson" level="1" amendtag="end">During transport, a person shall:</amend><subsection ssid="54-36-231" dnum="_-o:i-i" numlevel="1" lineno="138" slineno="4-35" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1055" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="73" groupid="57" style="1" owner="jchristopherson" level="1" amendtag="end">maintain raw milk or a raw milk product at or below 41 degrees Fahrenheit; and</amend></subsection><subsection ssid="54-36-232" dnum="_-o:ii-i" numlevel="1" lineno="139" slineno="4-36" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1056" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="78" groupid="61" style="1" owner="jchristopherson" level="1" amendtag="end">if the producer, package the raw milk or a raw milk product in a tamper-resistant, <ln numlevel="1" lineno="140" slineno="4-37"/>food-grade container compliant with the labeling requirements of Section <xref depth="3" refnumber="4-3-604">4-3-604</xref>.</amend></subsection></subsection></subsection><subsection ssid="54-36-236" dnum="_-o:6-i" numlevel="1" lineno="141" slineno="4-38" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1057" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><subsection ssid="54-36-237" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1058" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="284" groupid="225" style="1" owner="jchristopherson" level="1" amendtag="end">A producer shall use a separate enclosed facility for:</amend><subsection ssid="54-36-238" dnum="_-o:i-i" numlevel="1" lineno="142" slineno="4-39" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1059" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="283" groupid="224" style="1" owner="jchristopherson" level="1" amendtag="end">animal housing;</amend></subsection><subsection ssid="54-36-239" dnum="_-o:ii-i" numlevel="1" lineno="143" slineno="4-40" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1060" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="289" groupid="229" style="1" owner="jchristopherson" level="1" amendtag="end">milking; or</amend></subsection><subsection ssid="54-36-254" dnum="_-o:iv-i" numlevel="1" lineno="155" slineno="4-52" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1071" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="204" groupid="161" style="1" owner="jchristopherson" level="1" amendtag="end">detectable levels of listeria, salmonella, campylobacter, or shiga toxin-producing <ln numlevel="1" lineno="156" slineno="4-53"/>e. coli.</amend></subsection></subsection><subsection ssid="54-278" dnum="_-o:b-i" numlevel="1" lineno="157" slineno="4-54" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1072" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="396" groupid="313" style="1" owner="jchristopherson" level="1" amendtag="end">A producer shall report positive pathogen or drug residue findings to the department <ln numlevel="1" lineno="158" slineno="4-55"/>within two business days of receipt of a test finding the pathogen or drug residue.</amend></subsection><subsection ssid="54-279" dnum="_-o:c-i" numlevel="1" lineno="159" slineno="4-56" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1073" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="403" groupid="318" style="1" owner="jchristopherson" level="1" amendtag="end">A producer shall comply with a department rule, made in accordance with Title 63G, <ln numlevel="1" lineno="160" slineno="4-57"/>Chapter 3, Utah Administrative Rulemaking Act, detailing what steps the producer is <ln numlevel="1" lineno="161" slineno="4-58"/>to take to address a finding described in Subsection <xref depth="4" refnumber="4-3-603(8)(b)">(8)(b)</xref>.</amend></subsection></subsection><subsection ssid="54-36-260" dnum="_-o:9-i" numlevel="1" lineno="162" slineno="4-59" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1074" style="1" owner="i" level="1" amendtag="start">(9)</amend></display><subsection ssid="54-36-261" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1075" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="243" groupid="192" style="1" owner="jchristopherson" level="1" amendtag="end">A producer shall retain the following records for a minimum of two years:</amend><subsection ssid="54-36-262" dnum="_-o:i-i" numlevel="1" lineno="163" slineno="4-60" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1076" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="248" groupid="196" style="1" owner="jchristopherson" level="1" amendtag="end">animal health and treatment records described in Subsection <xref depth="4" refnumber="4-3-603(3)">(3)</xref>;</amend></subsection><subsection ssid="54-36-263" dnum="_-o:ii-i" numlevel="1" lineno="164" slineno="4-61" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1077" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="253" groupid="200" style="1" owner="jchristopherson" level="1" amendtag="end">test results and corrective actions;</amend></subsection><subsection ssid="54-301" dnum="_-o:iii-i" numlevel="1" lineno="165" slineno="4-62" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1078" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="472" groupid="369" style="1" owner="jchristopherson" level="1" amendtag="end">a record of a contract with a delivery provider and a delivery made under the <ln numlevel="1" lineno="166" slineno="4-63"/>contract; and</amend></subsection><subsection ssid="54-302" dnum="_-o:iv-i" numlevel="1" lineno="167" slineno="4-64" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1079" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="477" groupid="373" style="1" owner="jchristopherson" level="1" amendtag="end">a record of a sale to a market.</amend></subsection></subsection><subsection ssid="54-269" dnum="_-o:b-i" numlevel="1" lineno="168" slineno="4-65" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1080" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="356" groupid="281" style="1" owner="jchristopherson" level="1" amendtag="end">A producer shall maintain a temperature log for a minimum of three months.</amend></subsection><subsection ssid="54-303" dnum="_-o:c-i" numlevel="1" lineno="169" slineno="4-66" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1081" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="482" groupid="377" style="1" owner="jchristopherson" level="1" amendtag="end">Except as provided in Subsection <xref depth="4" refnumber="4-3-603(8)">(8)</xref>, a producer shall disclose a record described in <ln numlevel="1" lineno="170" slineno="4-67"/>this Subsection <xref depth="4" refnumber="4-3-603(9)">(9)</xref> to the department upon request of the department in the case of a <ln numlevel="1" lineno="171" slineno="4-68"/>suspicion that the raw milk or raw milk product is linked to a foodborne illness <ln numlevel="1" lineno="172" slineno="4-69"/>outbreak.</amend></subsection></subsection></section></bsec><bsec buid="52" num="4-3-604" type="enact" src="code" uid="C4-3-S604_2026050620260506" sort="04 03 06040020260506" numlevel="1" lineno="173" slineno="5-1" sn="5"><section numlevel="1" lineno="174" slineno="5-2" number="4-3-604" type="enact"><secline lineno="173">Section 5. Section <bold>4-3-604</bold> is enacted to read:</secline><catline lineno="174"><bold>4-3-604<parens/>. source of a foodborne <ln numlevel="1" lineno="208" slineno="6-13"/>illness outbreak.</amend></subsection><subsection ssid="62-102" dnum="_-o:c-i" numlevel="1" lineno="209" slineno="6-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1106" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="125" groupid="99" style="1" owner="jchristopherson" level="1" amendtag="end">Notwithstanding Subsection <xref depth="4" refnumber="4-3-605(1)(a)(i)">(1)(a)(i)</xref>, if the Department of Health and Human <ln numlevel="1" lineno="210" slineno="6-15"/>Services or the department uses an epidemiological method to determine whether <ln numlevel="1" lineno="211" slineno="6-16"/>there is a foodborne illness outbreak linked to raw milk or a raw milk product, the <ln numlevel="1" lineno="212" slineno="6-17"/>epidemiological method shall include questions that probe the common sources of the <ln numlevel="1" lineno="213" slineno="6-18"/>implicated pathogen for the foodborne illness outbreak.</amend></subsection></subsection><subsection ssid="62-48-94" dnum="_-o:2-i" numlevel="1" lineno="214" slineno="6-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1107" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="47" groupid="37" style="1" owner="jchristopherson" level="1" amendtag="end">The department shall issue a cease and desist order in accordance with Subsection <xref depth="4" refnumber="4-2-606(7)"><ln numlevel="1" lineno="215" slineno="6-20"/>4-2-606(7)</xref> if the department proves that a producer is the likely source of a foodborne <ln numlevel="1" lineno="216" slineno="6-21"/>illness outbreak linked to raw milk or a raw milk product.</amend></subsection><subsection ssid="62-48-95" dnum="_-o:3-i" numlevel="1" lineno="217" slineno="6-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1108" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><subsection ssid="62-48-96" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1109" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="121" groupid="96" style="1" owner="jchristopherson" level="1" amendtag="end">Within two working days of issuing a cease and desist order, the department shall <ln numlevel="1" lineno="218" slineno="6-23"/>collect a sample of raw milk or a raw milk product for whole genome sequencing and <ln numlevel="1" lineno="219" slineno="6-24"/>may test for an item listed in Subsection <xref depth="4" refnumber="4-3-603(8)(a)">4-3-603(8)(a)</xref>.</amend></subsection><subsection ssid="62-48-97" dnum="_-o:b-i" numlevel="1" lineno="220" slineno="6-25" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1110" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="72" groupid="57" style="1" owner="jchristopherson" level="1" amendtag="end">The department shall share with the producer whole genome sequencing results <ln numlevel="1" lineno="221" slineno="6-26"/>within 15 working days from the day the sample is taken under this Subsection <xref depth="4" refnumber="4-3-606(3)">(3)</xref> <ln numlevel="1" lineno="222" slineno="6-27"/>unless the time frame is extended by the department in writing.</amend></subsection><subsection ssid="62-48-98" dnum="_-o:c-i" numlevel="1" lineno="223" slineno="6-28" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1111" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="77" groupid="61" style="1" owner="jchristopherson" level="1" amendtag="end">Upon request of a producer, and at the producer's expense, the department shall <ln numlevel="1" lineno="224" slineno="6-29"/>submit a sample tested in one lab to a second lab approved by the department for <ln numlevel="1" lineno="225" slineno="6-30"/>testing.</amend></subsection></subsection><subsection ssid="62-48-99" dnum="_-o:4-i" numlevel="1" lineno="226" slineno="6-31" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1112" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="82" groupid="65" style="1" owner="jchristopherson" level="1" amendtag="end">The department, the Department of Health and Human Services, or a local health <ln numlevel="1" lineno="227" slineno="6-32"/>department may publicly disclose that a producer is the likely source of a foodborne <ln numlevel="1" lineno="228" slineno="6-33"/>illness outbreak only:</amend><subsection ssid="62-48-100" dnum="_-o:a-i" numlevel="1" lineno="229" slineno="6-34" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1113" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="111" groupid="88" style="1" owner="jchristopherson" level="1" amendtag="end">if proven by a positive whole genome sequencing test; and</amend></subsection><subsection ssid="62-48-101" dnum="_-o:b-i" numlevel="1" lineno="230" slineno="6-35" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1114" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="116" groupid="92" style="1" owner="jchristopherson" level="1" amendtag="end">after the department notifies the producer in writing before the disclosure.</amend></subsection></subsection></section></bsec><bsec buid="64" num="4-3-606" type="enact" src="code" or</amend></subsection><subsection ssid="64-46-74" dnum="_-o:c-i" numlevel="1" lineno="238" slineno="7-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1118" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="183" groupid="142" style="1" owner="jchristopherson" level="1" amendtag="end">when the department receives a complaint from the public that a producer violates <ln numlevel="1" lineno="239" slineno="7-9"/>this part and the department discloses to the producer the underlying facts of the <ln numlevel="1" lineno="240" slineno="7-10"/>complaint before the sample is collected.</amend></subsection></subsection><subsection ssid="64-46-75" dnum="_-o:2-i" numlevel="1" lineno="241" slineno="7-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1119" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><subsection ssid="64-46-76" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1120" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="135" groupid="104" style="1" owner="jchristopherson" level="1" amendtag="end">The department may inspect premises:</amend><subsection ssid="64-46-77" dnum="_-o:i-i" numlevel="1" lineno="242" slineno="7-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1121" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="188" groupid="146" style="1" owner="jchristopherson" level="1" amendtag="end">upon initial registration by a producer;</amend></subsection><subsection ssid="64-46-78" dnum="_-o:ii-i" numlevel="1" lineno="243" slineno="7-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1122" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="195" groupid="152" style="1" owner="jchristopherson" level="1" amendtag="end">anytime there is a suspicion that a producer is linked to a foodborne illness <ln numlevel="1" lineno="244" slineno="7-14"/>outbreak; or</amend></subsection><subsection ssid="64-46-79" dnum="_-o:iii-i" numlevel="1" lineno="245" slineno="7-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1123" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="198" groupid="154" style="1" owner="jchristopherson" level="1" amendtag="end">when the department receives a complaint from the public that a producer <ln numlevel="1" lineno="246" slineno="7-16"/>violates this part and the department discloses to the producer the underlying facts <ln numlevel="1" lineno="247" slineno="7-17"/>of the complaint before the inspection.</amend></subsection></subsection><subsection ssid="64-46-80" dnum="_-o:b-i" numlevel="1" lineno="248" slineno="7-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1124" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="144" groupid="111" style="1" owner="jchristopherson" level="1" amendtag="end">For a producer, the department may inspect the following under this Subsection <xref depth="4" refnumber="4-3-606(2)">(2)</xref>:</amend><subsection ssid="64-46-81" dnum="_-o:i-i" numlevel="1" lineno="249" slineno="7-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1125" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="149" groupid="115" style="1" owner="jchristopherson" level="1" amendtag="end">a production area;</amend></subsection><subsection ssid="64-46-82" dnum="_-o:ii-i" numlevel="1" lineno="250" slineno="7-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1126" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="154" groupid="119" style="1" owner="jchristopherson" level="1" amendtag="end">a milking space; or</amend></subsection><subsection ssid="64-46-83" dnum="_-o:iii-i" numlevel="1" lineno="251" slineno="7-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1127" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="159" groupid="123" style="1" owner="jchristopherson" level="1" amendtag="end">a bottling or processing facility.</amend></subsection></subsection></subsection><subsection ssid="64-46-85" dnum="_-o:3-i" numlevel="1" lineno="252" slineno="7-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1128" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="60" groupid="45" style="1" owner="jchristopherson" level="1" amendtag="end">The department may detain, test, or order the destruction of raw milk or a raw milk <ln numlevel="1" lineno="253" slineno="7-23"/>product:</amend><subsection ssid="64-46-86" dnum="_-o:a-i" numlevel="1" lineno="254" slineno="7-24" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1129" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="115" groupid="88" style="1" owner="jchristopherson" level="1" amendtag="end">that is adulterated or misbranded as provided in Section <xref depth="3" refnumber="4-5-401">4-5-401</xref>; or</amend></subsection><subsection ssid="64-46-87" dnum="_-o:b-i" numlevel="1" lineno="255" slineno="7-25" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1130" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="120" groupid="92" style="1" owner="jchristopherson" level="1" amendtag="end">if there is a suspicion that the raw milk or raw milk product is linked to a foodborne <ln numlevel="1" lineno="256" slineno="7-26"/>illness outbreak.</amend></subsection></subsection><subsection ssid="64-46-88" dnum="_-o:4-i" numlevel="1" lineno="257" slineno="7-27" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1131" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><subsection ssid="64-46-89" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1132" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="81" groupid="61" style="1" owner="jchristopherson" level="1" amendtag="end">The department shall establish and collect a fee in accordance with Section <xref depth="3" refnumber="63J-1-504"><ln numlevel="1" lineno="258" slineno="7-28"/>63J-1-504</xref> for a test conducted under this part or an inspection under Subsection <xref depth="4" refnumber="4-3-606(2)">(2)</xref>.</amend></subsection><subsection ssid="64-46-90" dnum="_-o:b-i" numlevel="1" lineno="259" slineno="7-29" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1133" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="86" groupid="65" style="1" owner="jchristopherson" level="1" amendtag="end">Notwithstanding Section <xref depth="3" refnumber="63J-1-504">63J-1-504</xref>, the department shall retain the fee as a dedicated <ln numlevel="1" lineno="260" slineno="7-30"/>credit and may only use the fee to administer and enforce this part.</amend></subsection></subsection><subsection ssid="64-46-91" dnum="_-o:5-i" numlevel="1" lineno="261" slineno="7-31" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1134" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="52" groupid="39" style="1" owner="jchristopherson" level="1" amendtag="end">During a 12-month period, the department may impose an administrative fine against a <ln numlevel="1" lineno="262" slineno="7-32"/>person that produces or sells adulterated or misbranded raw milk or raw milk product as <ln numlevel="1" lineno="263" slineno="7-33"/>follows:</amend><subsection ssid="64-46-92" dnum="_-o:a-i" numlevel="1" lineno="264" slineno="7-34" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1135" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="end">upon the first violation, an administrative fine of not more than $500;</amend></subsection><subsection ssid="64-46-93" dnum="_-o:b-i" numlevel="1" lineno="265" slineno="7-35" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1136" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="end">upon a second violation, an administrative fine of not more than $1,000; and</amend></subsection><subsection ssid="64-46-94" dnum="_-o:c-i" numlevel="1" lineno="266" slineno="7-36" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1137" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="22" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="end">upon a third or subsequent violation, an administrative fine of not more than $3,000.</amend></subsection></subsection><subsection ssid="64-46-95" dnum="_-o:6-i" numlevel="1" lineno="267" slineno="7-37" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1138" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="91" groupid="69" style="1" owner="jchristopherson" level="1" amendtag="end">The department may impose an administrative fine or suspension of operations in the <ln numlevel="1" lineno="268" slineno="7-38"/>amount and time frame listed in Subsection <xref depth="4" refnumber="4-3-607(5)">(5)</xref> if a producer sells raw milk or a raw <ln numlevel="1" lineno="269" slineno="7-39"/>milk product without being registered under this part.</amend></subsection><subsection ssid="64-46-96" dnum="_-o:7-i" numlevel="1" lineno="270" slineno="7-40" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1139" style="1" owner="i" level="1" amendtag="start">(7)</amend></display><subsection ssid="64-46-97" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1140" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="125" groupid="96" style="1" owner="jchristopherson" level="1" amendtag="end">The department may impose the following against a person that the department <ln numlevel="1" lineno="271" slineno="7-41"/>proves to be the likely source of a foodborne illness outbreak under Section <xref depth="3" refnumber="4-3-606">4-3-606</xref> <ln numlevel="1" lineno="272" slineno="7-42"/>during a 12-month period described in Subsection <xref depth="4" refnumber="4-3-607(7)(b)">(7)(b)</xref>:</amend><subsection ssid="64-46-98" dnum="_-o:i-i" numlevel="1" lineno="273" slineno="7-43" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1141" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="33" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="end">upon a first proof of a foodborne illness outbreak, a cease and desist order of 14 <ln numlevel="1" lineno="274" slineno="7-44"/>days;</amend></subsection><subsection ssid="64-46-99" dnum="_-o:ii-i" numlevel="1" lineno="275" slineno="7-45" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1142" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="96" groupid="73" style="1" owner="jchristopherson" level="1" amendtag="end">upon a finding of a new case after the imposition of a penalty under Subsection <xref depth="4" refnumber="4-3-607(7)(a)(i)"><ln numlevel="1" lineno="276" slineno="7-46"/>(7)(a)(i)</xref> or upon a second proof of a foodborne illness outbreak, a cease and desist <ln numlevel="1" lineno="277" slineno="7-47"/>order of 14 days and an administrative fine of $500;</amend></subsection><subsection ssid="64-46-100" dnum="_-o:iii-i" numlevel="1" lineno="278" slineno="7-48" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1143" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="101" groupid="77" style="1" owner="jchristopherson" level="1" amendtag="end">upon a finding of a new case after the imposition of a penalty under Subsection <xref depth="4" refnumber="4-3-607(7)(a)(ii)"><ln numlevel="1" lineno="279" slineno="7-49"/>(7)(a)(ii)</xref> or upon a third proof of a foodborne illness outbreak, a cease and desist <ln numlevel="1" lineno="280" slineno="7-50"/>order of 14 days and an administrative fine of $1,000; and</amend></subsection><subsection ssid="64-46-101" dnum="_-o:iv-i" numlevel="1" lineno="281" slineno="7-51" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1144" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="106" groupid="81" style="1" owner="jchristopherson" level="1" amendtag="end">upon a finding of a new case after the imposition of a penalty under Subsection <xref depth="4" refnumber="4-3-607(7)(a)(iii)"><ln numlevel="1" lineno="282" slineno="7-52"/>(7)(a)(iii)</xref> or upon a fourth or subsequent proof of a foodborne illness outbreak, an <ln numlevel="1" lineno="283" slineno="7-53"/>administrative fine of $3,000.</amend></subsection></subsection><subsection ssid="64-46-102" dnum="_-o:b-i" numlevel="1" lineno="284" slineno="7-54" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1145" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="130" groupid="100" style="1" owner="jchristopherson" level="1" amendtag="end">A penalty imposed under Subsection <xref depth="4" refnumber="4-3-607(7)(a)">(7)(a)</xref> is based on a time period that begins the <ln numlevel="1" lineno="285" slineno="7-55"/>day on which a cease and desist order is imposed under Subsection <xref depth="4" refnumber="4-3-607(7)(a)(i)">(7)(a)(i)</xref> and ends <ln numlevel="1" lineno="286" slineno="7-56"/>12 months after the day which the cease and desist order is imposed under Subsection <xref depth="4" refnumber="4-3-607(7)(a)(i)"><ln numlevel="1" lineno="287" slineno="7-57"/>(7)(a)(i)</xref>. A foodborne illness outbreak or new case that occurs after the 12-month <ln numlevel="1" lineno="288" slineno="7-58"/>period described in this Subsection <xref depth="4" refnumber="4-3-607(7)(b)">(7)(b)</xref> results in the start of a new 12-month <ln numlevel="1" lineno="289" slineno="7-59"/>period.</amend></subsection></subsection><subsection ssid="64-46-103" dnum="_-o:8-i" numlevel="1" lineno="290" slineno="7-60" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1146" style="1" owner="i" level="1" amendtag="start">(8)</amend></display><amend anum="0" ea="amend" pairid="110" groupid="84" style="1" owner="jchristopherson" level="1" amendtag="end">The department may impose a civil penalty under Section <xref depth="3" refnumber="4-2-304">4-2-304</xref> for a violation of this <ln numlevel="1" lineno="291" slineno="7-61"/>part not described in Subsections <xref depth="4" refnumber="4-3-607(5)">(5)</xref> through <xref depth="4" refnumber="4-3-607(7)">(7)</xref>.</amend></subsection><subsection ssid="64-46-104" dnum="_-o:9-i" numlevel="1" lineno="292" slineno="7-62" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1147" style="1" owner="i" level="1" amendtag="start">(9)</amend></display><amend anum="0" ea="amend" pairid="43" groupid="32" style="1" owner="jchristopherson" level="1" amendtag="end">A person subject to an action under Subsections <xref depth="4" refnumber="4-3-607(5)">(5)</xref> through <xref depth="4" refnumber="4-3-607(8)">(8)</xref> may appeal the action in <ln numlevel="1" lineno="293" slineno="7-63"/>accordance with Title 63G, Chapter 4, Administrative Procedures Act.</amend></subsection></section></bsec><bsec buid="1" type="repealer" src="code" sort="TRepealer" numlevel="1" lineno="294" slineno="8-1" sn="8"><secline>Section 8. <bold>Repealer.</bold></secline><rhead lineno="295"/><sectionText><repsec num="4-3-503" uid="C4-3-S503_2026050620260506" sort="04 03 05030020260506" src="code" sn="8" numlevel="1" lineno="296" slineno="8-3"><parens/>Sale of raw milk products -- Suspension of producer's permit -- <ln numlevel="1" lineno="297" slineno="8-4"/>Severability not permitted.</repsec></sectionText></bsec><bsec buid="65" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="298" slineno="9-1" sn="9"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="298">Section 9.  <bold>Effective Date.</bold></secline><sectionText lineno="299"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-13-26 12:53 PM</tm></rev></foot></leg>
