Section <bold>10-20-401</bold> is amended to read:</secline><catline lineno="39"><bold>10-20-401<parens/>. General plan required -- Content.</bold></catline><subsection ssid="8-null-1" dnum="1-o" numlevel="1" lineno="40" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>To accomplish the purposes of this chapter, a municipality shall prepare and adopt a <ln numlevel="1" lineno="41" slineno="1-4"/>comprehensive, long-range general plan for:<subsection ssid="8-null-2" dnum="a-o" numlevel="1" lineno="42" slineno="1-5" level="2"><display>(a)</display>present and future needs of the municipality; and</subsection><subsection ssid="8-null-3" dnum="b-o" numlevel="1" lineno="43" slineno="1-6" level="2"><display>(b)</display>growth and development of all or any part of the land within the municipality.</subsection></subsection><subsection ssid="8-null-4" dnum="2-o" numlevel="1" lineno="44" slineno="1-7" level="1"><display>(2)</display>The general plan <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="6" groupid="5" style="2" owner="jchristopherson" level="1" deltag="both">may provide for</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="5" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">shall address</amend>:<subsection ssid="8-null-5" dnum="a-o" numlevel="1" lineno="45" slineno="1-8" level="2"><display>(a)</display>health, general welfare, safety, energy conservation, transportation, prosperity, civic <ln numlevel="1" lineno="46" slineno="1-9"/>activities, aesthetics, and recreational, educational, and cultural opportunities;</subsection><subsection ssid="8-null-6" dnum="b-o" numlevel="1" lineno="47" slineno="1-10" level="2"><display>(b)</display>the reduction of the waste of physical, financial, or human resources that result from <ln numlevel="1" lineno="48" slineno="1-11"/>either excessive congestion or excessive scattering of population;</subsection><subsection ssid="8-null-7" dnum="c-o" numlevel="1" lineno="49" slineno="1-12" level="2"><display>(c)</display>the efficient and economical use, conservation, and production of the supply of:<subsection ssid="8-null-8" dnum="i-o" numlevel="1" lineno="50" slineno="1-13" level="3"><display>(i)</display>food and water; and</subsection><subsection ssid="8-null-9" dnum="ii-o" numlevel="1" lineno="51" slineno="1-14" level="3"><display>(ii)</display>drainage, sanitary, and other facilities and resources;</subsection></subsection><subsection ssid="8-null-10" dnum="d-o" numlevel="1" lineno="52" slineno="1-15" level="2"><display>(d)</display><amend anum="0" ea="amend" pairid="14" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="both">the maintenance and enhancement of wildlife habitat connectivity and migration <ln numlevel="1" lineno="53" slineno="1-16"/>corridors;</amend></subsection><subsection ssid="8-19" dnum="_-o:e-i" numlevel="1" lineno="54" slineno="1-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="both">(e)</amend></display>the use of energy conservation and solar and clean energy resources;</subsection><subsection ssid="8-null-11" dnum="e-o:f-i" numlevel="1" lineno="55" slineno="1-18" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1011" style="2" owner="o" level="1" deltag="both">(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1012" style="1" owner="i" level="1" amendtag="both" space="true">(f)</amend></display>the protection of urban development;</subsection><subsection ssid="8-null-12" dnum="f-o:g-i" numlevel="1" lineno="56" slineno="1-19" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1012" style="2" owner="o" level="1" deltag="both">(f)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1013" style="1" owner="i" level="1" amendtag="both" space="true">(g)</amend></display>if the municipality is a town, the protection or promotion of moderate income <ln numlevel="1" lineno="57" slineno="1-20"/>housing;</subsection><subsection ssid="8-null-13" dnum="g-o:h-i" numlevel="1" lineno="58" slineno="1-21" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1013" style="2" owner="o" level="1" deltag="both">(g)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1014" style="1" owner="i" level="1" amendtag="both" space="true">(h)</amend></display>the protection and promotion of air quality;</subsection><subsection ssid="8-null-14" dnum="h-o:i-i" numlevel="1" lineno="59" slineno="1-22" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1014" style="2" owner="o" level="1" deltag="both">(h)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1015" style="1" owner="i" level="1" amendtag="both" space="true">(i)</amend></display>historic preservation;</subsection><subsection ssid="8-null-15" dnum="i-o:j-i" numlevel="1" lineno="60" slineno="1-23" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1015" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="both" space="true">(j)</amend></display>identifying future uses of land that are likely to require an expansion or <ln numlevel="1" lineno="61" slineno="1-24"/>significant modification of services or facilities provided by an affected entity; and</subsection><subsection ssid="8-null-16" dnum="j-o:k-i" numlevel="1" lineno="62" slineno="1-25" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1016" style="2" owner="o" level="1" deltag="both">(j)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1017" style="1" owner="i" level="1" amendtag="both" space="true">(k)</amend></display>an official map.</subsection></subsection><subsection ssid="8-null-17" dnum="3-o" numlevel="1" lineno="63" slineno="1-26" level="1" space="false"><display>(3)</display><subsection ssid="8-20" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>Subject to Section <xref depth="3" refnumber="10-20-404">10-20-404</xref>, the municipality may determine the <ln numlevel="1" lineno="64" slineno="1-27"/>comprehensiveness, extent, and format of the general plan.</subsection><subsection ssid="8-21" dnum="_-o:b-i" numlevel="1" lineno="65" slineno="1-28" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1019" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="18" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="end">In preparing and adopting a general plan, the municipality shall, to the extent the <ln numlevel="1" lineno="66" slineno="1-29"/>municipality determines advisable, consider:</amend><subsection ssid="8-22" dnum="_-o:i-i" numlevel="1" lineno="67" slineno="1-30" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1020" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="23" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="end">the impacts of development on wildlife, wildlife movement, and wildlife habitat; <ln numlevel="1" lineno="68" slineno="1-31"/>and</amend></subsection><subsection ssid="8-23" dnum="_-o:ii-i" numlevel="1" lineno="69" slineno="1-32" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1021" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="28" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="end">how impacts of development on wildlife, wildlife movement, and wildlife habitat <ln numlevel="1" lineno="70" slineno="1-33"/>may be mitigated.</amend></subsection></subsection></subsection><subsection ssid="8-null-18" dnum="4-o" numlevel="1" lineno="71" slineno="1-34" level="1"><display>(4)</display>Except for a city of the fifth class or a town, on or before December 31, 2025, a <ln numlevel="1" lineno="72" slineno="1-35"/>municipality that has a general plan that does not include a water use and preservation <ln numlevel="1" lineno="73" slineno="1-36"/>element that complies with Section <xref depth="3" refnumber="10-20-404">10-20-404</xref> shall amend the municipality's general <ln numlevel="1" lineno="74" slineno="1-37"/>plan to comply with Section <xref depth="3" refnumber="10-20-404">10-20-404</xref>.</subsection></section></bsec><bsec buid="9" num="10-20-402" type="amend" src="code" uid="C10-20-S402_2026050620260506" sort="10 20 04020020260506" numlevel="1" lineno="75" slineno="2-1" sn="2"><section number="10-20-402" numlevel="1" lineno="76" slineno="2-2" type="amend"><secline lineno="75">Section 2. Section <bold>10-20-402</bold> is amended to read:</secline><catline lineno="76"><bold>10-20-402<parens/>. Information and technical assistance from the state.</bold></catline><subsection ssid="9-3" dnum="_-o:1-i" numlevel="1" lineno="77" slineno="2-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1023" style="1" owner="i" level="1" amendtag="both">(1)</amend></display>Each state official, department, and agency shall:<subsection ssid="9-null-1" dnum="1-o:a-i" numlevel="1" lineno="78" slineno="2-4" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1024" style="2" owner="o" level="1" deltag="both">(1)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1025" style="1" owner="i" level="1" amendtag="both" space="true">(a)</amend></display>promptly deliver any data and information requested by a municipality unless <ln numlevel="1" lineno="79" slineno="2-5"/>the disclosure is prohibited by <xref depth="1" refnumber="63G-2" start="0">Title 63G, Chapter 2, Government Records Access <ln numlevel="1" lineno="80" slineno="2-6"/>and Management Act</xref>; and</subsection><subsection ssid="9-null-2" dnum="2-o:b-i" numlevel="1" lineno="81" slineno="2-7" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1025" style="2" owner="o" level="1" deltag="both">(2)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1026" style="1" owner="i" level="1" amendtag="both" space="true">(b)</amend></display>furnish any other technical assistance and advice that they have available to the <ln numlevel="1" lineno="82" slineno="2-8"/>municipality without additional cost to the municipality.</subsection></subsection><subsection ssid="9-4" dnum="_-o:2-i" numlevel="1" lineno="83" slineno="2-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1026" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="8" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="end">Upon request, the Department of Natural Resources shall provide a municipality or a <ln numlevel="1" lineno="84" slineno="2-10"/>municipal legislative body with information relevant to the consideration described in <ln numlevel="1" lineno="85" slineno="2-11"/>Subsection <xref depth="4" refnumber="10-20-401(3)(b)">10-20-401(3</xref>)(b) or <xref depth="4" refnumber="10-20-501(3)(b)">10-20-501(3)(b)</xref>.</amend></subsection></section></bsec><bsec buid="13" num="10-20-404" type="amend" src="code" uid="C10-20-S404_2026050620260506" sort="10 20 04040020260506" numlevel="1" lineno="86" slineno="3-1" sn="3"><section number="10-20-404" numlevel="1" lineno="87" slineno="3-2" type="amend"><secline lineno="86">Section 3. Section <bold>10-20-404</bold> is amended to read:</secline><catline lineno="87"><bold>10-20-404<parens/>. General plan preparation.</bold></catline><subsection ssid="13-null-1" dnum="1-o" numlevel="1" lineno="88" slineno="3-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="13-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The planning commission shall provide notice, as provided in Section <xref depth="3" refnumber="10-20-203">10-20-203</xref>, <ln numlevel="1" lineno="89" slineno="3-4"/>of the planning commission's intent to make a recommendation to the municipal <ln numlevel="1" lineno="90" slineno="3-5"/>legislative body for a general plan or a comprehensive general plan amendment when <ln numlevel="1" lineno="91" slineno="3-6"/>the planning commission initiates the process of preparing the planning commission's <ln numlevel="1" lineno="92" slineno="3-7"/>recommendation.</subsection><subsection ssid="13-null-3" dnum="b-o" numlevel="1" lineno="93" slineno="3-8" level="2"><display>(b)</display>The planning commission shall make and recommend to the legislative body a <ln numlevel="1" lineno="94" slineno="3-9"/>proposed general plan for the area within the municipality.</subsection><subsection ssid="13-null-4" dnum="c-o" numlevel="1" lineno="95" slineno="3-10" level="2"><display>(c)</display>The plan may include areas outside the boundaries of the municipality if, in the <ln numlevel="1" lineno="96" slineno="3-11"/>planning commission's judgment, those areas are related to the planning of the <ln numlevel="1" lineno="97" slineno="3-12"/>municipality's territory.</subsection><subsection ssid="13-null-5" dnum="d-o" numlevel="1" lineno="98" slineno="3-13" level="2"><display>(d)</display>Except as otherwise provided by law or with respect to a municipality's power of <ln numlevel="1" lineno="99" slineno="3-14"/>eminent domain, when the plan of a municipality involves territory outside the <ln numlevel="1" lineno="100" slineno="3-15"/>boundaries of the municipality, the municipality may not take action affecting that <ln numlevel="1" lineno="101" slineno="3-16"/>territory without the concurrence of the county or other municipalities affected.</subsection></subsection><subsection ssid="13-null-6" dnum="2-o" numlevel="1" lineno="102" slineno="3-17" level="1" space="false"><display>(2)</display><subsection ssid="13-null-7" dnum="a-o" level="2" placement="sameline"><display>(a)</display>At a minimum, the proposed general plan, with the accompanying maps, charts, <ln numlevel="1" lineno="103" slineno="3-18"/>and descriptive and explanatory matter, shall include the planning commission's <ln numlevel="1" lineno="104" slineno="3-19"/>recommendations for the following plan elements:<subsection ssid="13-null-8" dnum="i-o" numlevel="1" lineno="105" slineno="3-20" level="3" tab="1"><display>(i)</display>a land use element that:<subsection ssid="13-null-9" dnum="A-o" numlevel="1" lineno="106" slineno="3-21" level="4"><display>(A)</display>designates the long-term goals and the proposed extent, general distribution, <ln numlevel="1" lineno="107" slineno="3-22"/>and location of land for housing for residents of various income levels, <ln numlevel="1" lineno="108" slineno="3-23"/>business, industry, agriculture, recreation, education, public buildings and <ln numlevel="1" lineno="109" slineno="3-24"/>grounds, open space, and other categories of public and private uses of land as <ln numlevel="1" lineno="110" slineno="3-25"/>appropriate;</subsection><subsection ssid="13-null-10" dnum="B-o" numlevel="1" lineno="111" slineno="3-26" level="4"><display>(B)</display>includes a statement of the projections for and standards of population density <ln numlevel="1" lineno="112" slineno="3-27"/>and building intensity recommended for the various land use categories <ln numlevel="1" lineno="113" or a town, is coordinated to integrate the <ln numlevel="1" lineno="115" slineno="3-30"/>land use element with the water use and preservation element;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="12" groupid="11" style="2" owner="jchristopherson" level="1" deltag="start"> </amend><amend anum="0" ea="erase" pairid="9" groupid="8" style="2" owner="jchristopherson" level="1" deltag="end">and</amend><amendoutend style="2"/></subsection><subsection ssid="13-null-12" dnum="D-o" numlevel="1" lineno="116" slineno="3-31" level="4"><display>(D)</display>except for a city of the fifth class or a town, accounts for the effect of land use <ln numlevel="1" lineno="117" slineno="3-32"/>categories and land uses on water demand;<amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both"> and</amend></subsection><subsection ssid="13-90" dnum="_-o:E-i" numlevel="1" lineno="118" slineno="3-33" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1039" style="1" owner="i" level="1" amendtag="start">(E)</amend></display><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">considers how land use categories and land uses will impact hunting <ln numlevel="1" lineno="119" slineno="3-34"/>opportunities, wildlife habitat connectivity, and wildlife migration corridors;</amend></subsection></subsection><subsection ssid="13-null-13" dnum="ii-o" numlevel="1" lineno="120" slineno="3-35" level="3" tab="1"><display>(ii)</display>a transportation and traffic circulation element that:<subsection ssid="13-null-14" dnum="A-o" numlevel="1" lineno="121" slineno="3-36" level="4"><display>(A)</display>provides the general location and extent of existing and proposed freeways, <ln numlevel="1" lineno="122" slineno="3-37"/>arterial and collector streets, public transit, active transportation facilities, and <ln numlevel="1" lineno="123" slineno="3-38"/>other modes of transportation that the planning commission considers <ln numlevel="1" lineno="124" slineno="3-39"/>appropriate;</subsection><subsection ssid="13-null-15" dnum="B-o" numlevel="1" lineno="125" slineno="3-40" level="4"><display>(B)</display>for a municipality that has access to a major transit investment corridor, <ln numlevel="1" lineno="126" slineno="3-41"/>addresses the municipality's plan for residential and commercial development <ln numlevel="1" lineno="127" slineno="3-42"/>around major transit investment corridors to maintain and improve the <ln numlevel="1" lineno="128" slineno="3-43"/>connections between housing, employment, education, recreation, and <ln numlevel="1" lineno="129" slineno="3-44"/>commerce;</subsection><subsection ssid="13-null-16" dnum="C-o" numlevel="1" lineno="130" slineno="3-45" level="4"><display>(C)</display>for a municipality that does not have access to a major transit investment <ln numlevel="1" lineno="131" slineno="3-46"/>corridor, addresses the municipality's plan for residential and commercial <ln numlevel="1" lineno="132" slineno="3-47"/>development in areas that will maintain and improve the connections between <ln numlevel="1" lineno="133" slineno="3-48"/>housing, transportation, employment, education, recreation, and commerce; and</subsection><subsection ssid="13-null-17" dnum="D-o" numlevel="1" lineno="134" slineno="3-49" level="4"><display>(D)</display>correlates with the population projections, the employment projections, and <ln numlevel="1" lineno="135" slineno="3-50"/>the proposed land use element of the general plan;</subsection></subsection><subsection ssid="13-null-18" dnum="iii-o" numlevel="1" lineno="136" slineno="3-51" level="3" tab="1"><display>(iii)</display>a moderate income housing element that meets the requirements of Section <xref depth="3" refnumber="10-21-201"><ln numlevel="1" lineno="137" slineno="3-52"/>10-21-201</xref>; and</subsection><subsection ssid="13-null-19" dnum="iv-o" numlevel="1" lineno="138" slineno="3-53" level="3" tab="1"><display>(iv)</display>except for a city of the fifth class or a town, a water use and preservation element <ln numlevel="1" lineno="139" slineno="3-54"/>that addresses:<subsection ssid="13-null-20" dnum="A-o" numlevel="1" lineno="140" slineno="3-55" level="4"><display>(A)</display>the effect of permitted development or patterns of development on water <ln numlevel="1" lineno="141" slineno="3-56"/>demand and water infrastructure;</subsection><subsection ssid="13-null-21" dnum="B-o" numlevel="1" lineno="142" slineno="3-57" level="4"><display>(B)</display>methods of reducing water demand and per capita consumption for future <ln numlevel="1" lineno="143" slineno="3-58"/>development;</subsection><subsection ssid="13-null-22" dnum="C-o" numlevel="1" lineno="144" slineno="3-59" level="4"><display>(C)</display>methods of reducing water demand and per capita consumption for existing <ln numlevel="1" lineno="145" slineno="3-60"/>development; and</subsection><subsection ssid="13-null-23" dnum="D-o" numlevel="1" lineno="146" slineno="3-61" level="4"><display>(D)</display>opportunities for the municipality to modify the municipality's operations to <ln numlevel="1" lineno="147" slineno="3-62"/>eliminate practices or conditions that waste water.</subsection></subsection></subsection><subsection ssid="13-null-24" dnum="b-o" numlevel="1" lineno="148" slineno="3-63" level="2"><display>(b)</display>In drafting the land use element, the planning commission shall:<subsection ssid="13-null-25" dnum="i-o" numlevel="1" lineno="149" slineno="3-64" level="3"><display>(i)</display>identify and consider each agriculture protection area within the municipality;</subsection><subsection ssid="13-null-26" dnum="ii-o" numlevel="1" lineno="150" slineno="3-65" level="3"><display>(ii)</display>avoid proposing a use of land within an agriculture protection area that is <ln numlevel="1" lineno="151" slineno="3-66"/>inconsistent with or detrimental to the use of the land for agriculture; and</subsection><subsection ssid="13-null-27" dnum="iii-o" numlevel="1" lineno="152" slineno="3-67" level="3"><display>(iii)</display>consider and coordinate with any station area plans adopted by the municipality <ln numlevel="1" lineno="153" slineno="3-68"/>if required under Section <xref depth="3" refnumber="10-21-203">10-21-203</xref>.</subsection></subsection><subsection ssid="13-null-28" dnum="c-o" numlevel="1" lineno="154" slineno="3-69" level="2"><display>(c)</display>In drafting the transportation and traffic circulation element, the planning <ln numlevel="1" lineno="155" slineno="3-70"/>commission shall:<subsection ssid="13-null-29" dnum="i-o" numlevel="1" lineno="156" slineno="3-71" level="3" space="false"><display>(i)</display><subsection ssid="13-null-30" dnum="A-o" level="4" placement="sameline"><display>(A)</display>consider and coordinate with the regional transportation plan developed by <ln numlevel="1" lineno="157" slineno="3-72"/>the municipality's region's metropolitan planning organization, if the <ln numlevel="1" lineno="158" slineno="3-73"/>municipality is within the boundaries of a metropolitan planning organization; <ln numlevel="1" lineno="159" slineno="3-74"/>or</subsection><subsection ssid="13-null-31" dnum="B-o" numlevel="1" lineno="160" slineno="3-75" level="4"><display>(B)</display>consider and coordinate with the long-range transportation plan developed by <ln numlevel="1" lineno="161" slineno="3-76"/>the Department of Transportation, if the municipality is not within the <ln numlevel="1" lineno="162" slineno="3-77"/>boundaries of a metropolitan planning organization; and</subsection></subsection><subsection ssid="13-null-32" dnum="ii-o" numlevel="1" lineno="163" slineno="3-78" level="3"><display>(ii)</display>consider and coordinate with any station area plans adopted by the municipality if <ln numlevel="1" lineno="164" slineno="3-79"/>required under Section <xref depth="3" refnumber="10-21-203">10-21-203</xref>.</subsection></subsection><subsection ssid="13-null-33" dnum="d-o" numlevel="1" lineno="165" slineno="3-80" level="2"><display>(d)</display>In drafting the water use and preservation element, the planning commission:<subsection ssid="13-null-34" dnum="i-o" numlevel="1" lineno="166" slineno="3-81" level="3"><display>(i)</display>shall consider:<subsection ssid="13-null-35" dnum="A-o" numlevel="1" lineno="167" slineno="3-82" level="4"><display>(A)</display>applicable regional water conservation goals recommended by the Division of <ln numlevel="1" lineno="168" slineno="3-83"/>Water Resources; and</subsection><subsection ssid="13-null-36" dnum="B-o" numlevel="1" lineno="169" slineno="3-84" level="4"><display>(B)</display>if Section <xref depth="3" refnumber="73-10-32">73-10-32</xref> requires the municipality to adopt a water conservation <ln numlevel="1" lineno="170" slineno="3-85"/>plan in accordance with Section <xref depth="3" refnumber="73-10-32">73-10-32</xref>, the municipality's water <ln numlevel="1" lineno="171" slineno="3-86"/>conservation plan;</subsection></subsection><subsection ssid="13-null-37" dnum="ii-o" numlevel="1" lineno="172" slineno="3-87" level="3"><display>(ii)</display>shall include a recommendation for:<subsection ssid="13-null-38" dnum="A-o" numlevel="1" lineno="173" slineno="3-88" level="4"><display>(A)</display>water conservation policies to be determined by the municipality; and</subsection><subsection ssid="13-null-39" dnum="B-o" numlevel="1" lineno="174" slineno="3-89" level="4"><display>(B)</display>landscaping options within a public street for current and future development <ln numlevel="1" lineno="175" slineno="3-90"/>that do not require the use of lawn or turf in a parkstrip;</subsection></subsection><subsection ssid="13-null-40" dnum="iii-o" numlevel="1" lineno="176" slineno="3-91" level="3"><display>(iii)</display>shall review the municipality's land use ordinances and include a <ln numlevel="1" lineno="177" slineno="3-92"/>recommendation for changes to an ordinance that promotes the inefficient use of <ln numlevel="1" lineno="178" slineno="3-93"/>water;</subsection><subsection ssid="13-null-41" dnum="iv-o" numlevel="1" lineno="179" slineno="3-94" level="3"><display>(iv)</display>shall consider principles of sustainable landscaping, including the:<subsection ssid="13-null-42" dnum="A-o" numlevel="1" lineno="180" slineno="3-95" level="4"><display>(A)</display>reduction or limitation of the use of lawn or turf;</subsection><subsection ssid="13-null-43" dnum="B-o" numlevel="1" lineno="181" slineno="3-96" level="4"><display>(B)</display>promotion of site-specific landscape design that decreases stormwater runoff <ln numlevel="1" lineno="182" slineno="3-97"/>or runoff of water used for irrigation;</subsection><subsection ssid="13-null-44" dnum="C-o" numlevel="1" lineno="183" slineno="3-98" level="4"><display>(C)</display>preservation and use of healthy trees that have a reasonable water requirement <ln numlevel="1" lineno="184" slineno="3-99"/>or are resistant to dry soil conditions;</subsection><subsection ssid="13-null-45" dnum="D-o" numlevel="1" lineno="185" slineno="3-100" level="4"><display>(D)</display>elimination or regulation of ponds, pools, and other features that promote <ln numlevel="1" lineno="186" slineno="3-101"/>unnecessary water evaporation;</subsection><subsection ssid="13-null-46" dnum="E-o" numlevel="1" lineno="187" slineno="3-102" level="4"><display>(E)</display>reduction of yard waste; and</subsection><subsection ssid="13-null-47" dnum="F-o" numlevel="1" lineno="188" slineno="3-103" level="4"><display>(F)</display>use of an irrigation system, including drip irrigation, best adapted to provide <ln numlevel="1" lineno="189" slineno="3-104"/>the optimal amount of water to the plants being irrigated;</subsection></subsection><subsection ssid="13-null-48" dnum="v-o" numlevel="1" lineno="190" slineno="3-105" level="3"><display>(v)</display>shall consult with the public water system or systems serving the municipality <ln numlevel="1" lineno="191" slineno="3-106"/>with drinking water regarding how implementation of the land use element and <ln numlevel="1" lineno="192" slineno="3-107"/>water use and preservation element may affect:<subsection ssid="13-null-49" dnum="A-o" numlevel="1" lineno="193" slineno="3-108" level="4"><display>(A)</display>water supply planning, including drinking water source and storage capacity <ln numlevel="1" lineno="194" slineno="3-109"/>consistent with Section <xref depth="3" refnumber="19-4-114">19-4-114</xref>; and</subsection><subsection ssid="13-null-50" dnum="B-o" numlevel="1" lineno="195" slineno="3-110" level="4"><display>(B)</display>water distribution planning, including master plans, infrastructure asset <ln numlevel="1" lineno="196" slineno="3-111"/>management programs and plans, infrastructure replacement plans, and impact <ln numlevel="1" lineno="197" slineno="3-112"/>fee facilities plans;</subsection></subsection><subsection ssid="13-null-51" dnum="vi-o" numlevel="1" lineno="198" slineno="3-113" level="3"><display>(vi)</display>shall consult with the Division of Water Resources for information and technical <ln numlevel="1" lineno="199" slineno="3-114"/>resources regarding regional water conservation goals, including how <ln numlevel="1" lineno="200" slineno="3-115"/>implementation of the land use element and the water use and preservation <ln numlevel="1" lineno="201" slineno="3-116"/>element may affect the Great Salt Lake;</subsection><subsection ssid="13-null-52" dnum="vii-o" numlevel="1" lineno="202" slineno="3-117" level="3"><display>(vii)</display>may include recommendations for additional water demand reduction strategies, <ln numlevel="1" lineno="203" slineno="3-118"/>including:<subsection ssid="13-null-53" dnum="A-o" numlevel="1" lineno="204" slineno="3-119" level="4"><display>(A)</display>creating a water budget associated with a particular type of development;</subsection><subsection ssid="13-null-54" dnum="B-o" numlevel="1" lineno="205" slineno="3-120" level="4"><display>(B)</display>adopting new or modified lot size, configuration, and landscaping standards <ln numlevel="1" lineno="206" slineno="3-121"/>that will reduce water demand for new single family development;</subsection><subsection ssid="13-null-55" dnum="C-o" numlevel="1" lineno="207" slineno="3-122" level="4"><display>(C)</display>providing one or more water reduction incentives for existing development <ln numlevel="1" lineno="208" slineno="3-123"/>such as modification of existing landscapes and irrigation systems and <ln numlevel="1" lineno="209" slineno="3-124"/>installation of water fixtures or systems that minimize water demand;</subsection><subsection ssid="13-null-56" dnum="D-o" numlevel="1" lineno="210" slineno="3-125" level="4"><display>(D)</display>discouraging incentives for economic development activities that do not <ln numlevel="1" lineno="211" slineno="3-126"/>adequately account for water use or do not include strategies for reducing <ln numlevel="1" lineno="212" slineno="3-127"/>water demand; and</subsection><subsection ssid="13-null-57" dnum="E-o" numlevel="1" lineno="213" slineno="3-128" level="4"><display>(E)</display>adopting water concurrency standards requiring that adequate water supplies <ln numlevel="1" lineno="214" slineno="3-129"/>and facilities are or will be in place for new development; and</subsection></subsection><subsection ssid="13-null-58" dnum="viii-o" numlevel="1" lineno="215" slineno="3-130" level="3"><display>(viii)</display>for a town, may include, and for another municipality, shall include, a <ln numlevel="1" lineno="216" slineno="3-131"/>recommendation for low water use landscaping standards for a new:<subsection ssid="13-null-59" dnum="A-o" numlevel="1" lineno="217" slineno="3-132" level="4"><display>(A)</display>commercial, industrial, or institutional development;</subsection><subsection ssid="13-null-60" dnum="B-o" numlevel="1" lineno="218" slineno="3-133" level="4"><display>(B)</display>common interest community, as defined in Section <xref depth="3" refnumber="57-25-102">57-25-102</xref>; or</subsection><subsection ssid="13-null-61" dnum="C-o" numlevel="1" lineno="219" slineno="3-134" level="4"><display>(C)</display>multifamily housing project.</subsection></subsection></subsection></subsection><subsection ssid="13-null-62" dnum="3-o" numlevel="1" lineno="220" slineno="3-135" level="1"><display>(3)</display>The proposed general plan may include:<subsection ssid="13-null-63" dnum="a-o" numlevel="1" lineno="221" slineno="3-136" level="2"><display>(a)</display>an environmental element that addresses:<subsection ssid="13-null-64" dnum="i-o" numlevel="1" lineno="222" slineno="3-137" level="3"><display>(i)</display>the protection, conservation, development, and use of natural resources, including <ln numlevel="1" lineno="223" slineno="3-138"/>the quality of:<subsection ssid="13-null-65" dnum="A-o" numlevel="1" lineno="224" slineno="3-139" level="4"><display>(A)</display>air;</subsection><subsection ssid="13-null-66" dnum="B-o" numlevel="1" lineno="225" slineno="3-140" level="4"><display>(B)</display>forests;</subsection><subsection ssid="13-null-67" dnum="C-o" numlevel="1" lineno="226" slineno="3-141" level="4"><display>(C)</display>soils;</subsection><subsection ssid="13-null-68" dnum="D-o" numlevel="1" lineno="227" slineno="3-142" level="4"><display>(D)</display>rivers;</subsection><subsection ssid="13-null-69" dnum="E-o" numlevel="1" lineno="228" slineno="3-143" level="4"><display>(E)</display>groundwater and other waters;</subsection><subsection ssid="13-null-70" dnum="F-o" numlevel="1" lineno="229" slineno="3-144" level="4"><display>(F)</display>harbors;</subsection><subsection ssid="13-null-71" dnum="G-o" numlevel="1" lineno="230" slineno="3-145" level="4"><display>(G)</display>fisheries;</subsection><subsection ssid="13-null-72" dnum="H-o" numlevel="1" lineno="231" slineno="3-146" level="4"><display>(H)</display>wildlife<amend anum="0" ea="amend" pairid="11" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both">, habitat connectivity, and migration corridors</amend>;</subsection><subsection ssid="13-null-73" dnum="I-o" numlevel="1" lineno="232" slineno="3-147" level="4"><display>(I)</display>minerals; and</subsection><subsection ssid="13-null-74" dnum="J-o" numlevel="1" lineno="233" slineno="3-148" level="4"><display>(J)</display>other natural resources; and</subsection></subsection><subsection ssid="13-null-75" dnum="ii-o" numlevel="1" lineno="234" slineno="3-149" level="3" space="false"><display>(ii)</display><subsection ssid="13-null-76" dnum="A-o" level="4" placement="sameline"><display>(A)</display>the reclamation of land, flood control, prevention and control of the <ln numlevel="1" lineno="235" slineno="3-150"/>pollution of streams and other waters;</subsection><subsection ssid="13-null-77" dnum="B-o" numlevel="1" lineno="236" slineno="3-151" level="4"><display>(B)</display>the regulation of the use of land on hillsides, stream channels and other <ln numlevel="1" lineno="237" slineno="3-152"/>environmentally sensitive areas;</subsection><subsection ssid="13-null-78" dnum="C-o" numlevel="1" lineno="238" slineno="3-153" level="4"><display>(C)</display>the prevention, control, and correction of the erosion of soils;</subsection><subsection ssid="13-null-79" dnum="D-o" numlevel="1" lineno="239" slineno="3-154" level="4"><display>(D)</display>the preservation and enhancement of watersheds and wetlands; and</subsection><subsection ssid="13-null-80" dnum="E-o" numlevel="1" lineno="240" slineno="3-155" level="4"><display>(E)</display>the mapping of known geologic hazards;</subsection></subsection></subsection><subsection ssid="13-null-81" dnum="b-o" numlevel="1" lineno="241" slineno="3-156" level="2"><display>(b)</display>a public services and facilities element showing general plans for sewage, water, <ln numlevel="1" lineno="242" slineno="3-157"/>waste disposal, drainage, public utilities, rights-of-way, easements, and facilities for <ln numlevel="1" lineno="243" slineno="3-158"/>them, police and fire protection, and other public services;</subsection><subsection ssid="13-null-82" dnum="c-o" numlevel="1" lineno="244" slineno="3-159" level="2"><display>(c)</display>a rehabilitation, redevelopment, and conservation element consisting of plans and <ln numlevel="1" lineno="245" slineno="3-160"/>programs for:<subsection ssid="13-null-83" dnum="i-o" numlevel="1" lineno="246" slineno="3-161" level="3"><display>(i)</display>historic preservation;</subsection><subsection ssid="13-null-84" dnum="ii-o" numlevel="1" lineno="247" slineno="3-162" level="3"><display>(ii)</display>the diminution or elimination of a development impediment as defined in Section <xref depth="3" refnumber="17C-1-102"><ln numlevel="1" lineno="248" slineno="3-163"/>17C-1-102</xref>; and</subsection><subsection ssid="13-null-85" dnum="iii-o" numlevel="1" lineno="249" slineno="3-164" level="3"><display>(iii)</display>redevelopment of land, including housing sites, business and industrial sites, and <ln numlevel="1" lineno="250" slineno="3-165"/>public building sites;</subsection></subsection><subsection ssid="13-null-86" dnum="d-o" numlevel="1" lineno="251" slineno="3-166" level="2"><display>(d)</display>an economic element composed of appropriate studies and forecasts, as well as an <ln numlevel="1" lineno="252" slineno="3-167"/>economic development plan, which may include review of existing and projected <ln numlevel="1" lineno="253" slineno="3-168"/>municipal revenue and expenditures, revenue sources, identification of basic and <ln numlevel="1" lineno="254" slineno="3-169"/>secondary industry, primary and secondary market areas, employment, and retail <ln numlevel="1" lineno="255" slineno="3-170"/>sales activity;</subsection><subsection ssid="13-null-87" dnum="e-o" numlevel="1" lineno="256" slineno="3-171" level="2"><display>(e)</display>recommendations for implementing all or any portion of the general plan, including <ln numlevel="1" lineno="257" slineno="3-172"/>the adoption of land and water use ordinances, capital improvement plans, <ln numlevel="1" lineno="258" slineno="3-173"/>community development and promotion, and any other appropriate action;</subsection><subsection ssid="13-null-88" dnum="f-o" numlevel="1" lineno="259" slineno="3-174" level="2"><display>(f)</display>provisions addressing any of the matters listed in Subsection <xref depth="4" refnumber="10-20-401(2)">10-20-401(2)</xref> or Section <xref depth="3" refnumber="10-20-403"><ln numlevel="1" lineno="260" slineno="3-175"/>10-20-403</xref>; and</subsection><subsection ssid="13-null-89" dnum="g-o" numlevel="1" lineno="261" slineno="3-176" level="2"><display>(g)</display>any other element the municipality considers appropriate.</subsection></subsection></section></bsec><bsec buid="11" num="10-20-501" type="amend" src="code" Enactment of land use regulation, land use decision, or development <ln numlevel="1" lineno="264" slineno="4-3"/>agreement.</bold></catline><subsection ssid="11-null-1" dnum="1-o" numlevel="1" lineno="265" slineno="4-4" level="1" placement="noreturn"><display>(1)</display>Only a legislative body, as the body authorized to weigh policy considerations, may <ln numlevel="1" lineno="266" slineno="4-5"/>enact a land use regulation.</subsection><subsection ssid="11-null-2" dnum="2-o" numlevel="1" lineno="267" slineno="4-6" level="1" space="false"><display>(2)</display><subsection ssid="11-null-3" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="10-9a-501(2)(b)" start="0">(2)(b)</xref>, a legislative body may enact a land use <ln numlevel="1" lineno="268" slineno="4-7"/>regulation only by ordinance.</subsection><subsection ssid="11-null-4" dnum="b-o" numlevel="1" lineno="269" slineno="4-8" level="2"><display>(b)</display>A legislative body may, by ordinance or resolution, enact a land use regulation that <ln numlevel="1" lineno="270" slineno="4-9"/>imposes a fee.</subsection></subsection><subsection ssid="11-null-5" dnum="3-o" numlevel="1" lineno="271" slineno="4-10" level="1" space="false"><display>(3)</display><subsection ssid="11-15" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1122" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>A legislative body shall ensure that a land use regulation is consistent with the <ln numlevel="1" lineno="272" slineno="4-11"/>purposes set forth in this chapter.</subsection><subsection ssid="11-16" dnum="_-o:b-i" numlevel="1" lineno="273" slineno="4-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1123" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="end">In considering and adopting a land use regulation, a legislative body shall, to the exte<ln numlevel="1" lineno="274" slineno="4-13"/>nt<marker pairid="20"/> the legislative body determines advisable, consider:</amend><subsection ssid="11-17" dnum="_-o:i-i" numlevel="1" lineno="275" slineno="4-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1124" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="end">the impacts of development on wildlife, wildlife movement, and wildlife habitat; <ln numlevel="1" lineno="276" slineno="4-15"/>and</amend></subsection><subsection ssid="11-18" dnum="_-o:ii-i" numlevel="1" lineno="277" slineno="4-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1125" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">how the impacts of development on wildlife, wildlife movement, and wildlife <ln numlevel="1" lineno="278" slineno="4-17"/>habitat may be mitigated.</amend></subsection></subsection></subsection><subsection ssid="11-null-6" dnum="4-o" numlevel="1" lineno="279" slineno="4-18" level="1" space="false"><display>(4)</display><subsection ssid="11-null-7" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A legislative body shall adopt a land use regulation to:<subsection ssid="11-null-8" dnum="i-o" numlevel="1" lineno="280" slineno="4-19" level="3" tab="1"><display>(i)</display>create or amend a zoning district under Subsection <xref depth="4" refnumber="10-20-503(1)(a)">10-20-503(1)(a)</xref>; and</subsection><subsection ssid="11-null-9" dnum="ii-o" numlevel="1" lineno="281" slineno="4-20" level="3" tab="1"><display>(ii)</display>designate general uses allowed in each zoning district.</subsection></subsection><subsection ssid="11-null-10" dnum="b-o" numlevel="1" lineno="282" slineno="4-21" level="2"><display>(b)</display>A land use authority may establish or modify other restrictions or requirements other <ln numlevel="1" lineno="283" slineno="4-22"/>than those described in Subsection <xref depth="4" refnumber="10-9a-501(4)(a)" start="0">(4)(a)</xref>, including the configuration or modification <ln numlevel="1" lineno="284" slineno="4-23"/>of uses or density, through a land use decision that applies criteria or policy elements <ln numlevel="1" lineno="285" slineno="4-24"/>that a land use regulation establishes or describes.</subsection></subsection><subsection ssid="11-null-11" dnum="5-o" numlevel="1" lineno="286" slineno="4-25" level="1"><display>(5)</display>A municipality may not adopt a land use regulation, development agreement, or land <ln numlevel="1" lineno="287" slineno="4-26"/>use decision that restricts the type of crop that may be grown in an area that is:<subsection ssid="11-null-12" dnum="a-o" numlevel="1" lineno="288" slineno="4-27" level="2"><display>(a)</display>zoned agricultural; or</subsection><subsection ssid="11-null-13" dnum="b-o" numlevel="1" lineno="289" slineno="4-28" level="2"><display>(b)</display>assessed under <xref depth="2" refnumber="59-2-5" start="0">Title 59, Chapter 2, Part 5, Farmland Assessment Act</xref>.</subsection></subsection><subsection ssid="11-null-14" dnum="6-o" numlevel="1" lineno="290" slineno="4-29" level="1"><display>(6)</display>A municipal land use regulation pertaining to an airport or an airport influence area, as <ln numlevel="1" lineno="291" slineno="4-30"/>that term is defined in Section <xref depth="3" refnumber="72-10-401" start="0">72-10-401</xref>, is subject to <xref depth="2" refnumber="72-10-4" start="0">Title 72, Chapter 10, Part 4, <ln numlevel="1" lineno="292" slineno="4-31"/>Airport Zoning Act</xref>.</subsection></section></bsec><bsec buid="1" num="17-79-401" type="amend" src="code" uid="C17-79-S401_2026050620260506" sort="17 79 04010020260506" numlevel="1" lineno="293" slineno="5-1" sn="5"><section number="17-79-401" numlevel="1" lineno="294" slineno="5-2" type="amend"><secline lineno="293">Section 5. Section <bold>17-79-401</bold> is amended to read:</secline><catline lineno="294"><bold>17-79-401<parens/>. General plan required -- Content -- Resource management plan -- <ln numlevel="1" lineno="295" slineno="5-3"/>Provisions related to radioactive waste facility.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="296" slineno="5-4" level="1" placement="noreturn"><display>(1)</display>To accomplish the purposes of this chapter, a county shall prepare and adopt a <ln numlevel="1" lineno="297" slineno="5-5"/>comprehensive, long-range general plan:<subsection ssid="1-null-2" dnum="a-o" numlevel="1" lineno="298" slineno="5-6" level="2"><display>(a)</display>for present and future needs of the county;</subsection><subsection ssid="1-null-3" dnum="b-o" numlevel="1" lineno="299" slineno="5-7" level="2" space="false"><display>(b)</display><subsection ssid="1-null-4" dnum="i-o" level="3" placement="sameline"><display>(i)</display>for growth and development of all or any part of the land within the <ln numlevel="1" lineno="300" slineno="5-8"/>unincorporated portions of the county; or</subsection><subsection ssid="1-null-5" dnum="ii-o" numlevel="1" lineno="301" slineno="5-9" level="3"><display>(ii)</display>if a county has designated a mountainous planning district, for growth and <ln numlevel="1" lineno="302" slineno="5-10"/>development of all or any part of the land within the mountainous planning <ln numlevel="1" lineno="303" slineno="5-11"/>district; and</subsection></subsection><subsection ssid="1-null-6" dnum="c-o" numlevel="1" lineno="304" slineno="5-12" level="2"><display>(c)</display>as a basis for communicating and coordinating with the federal government on land <ln numlevel="1" lineno="305" slineno="5-13"/>and resource management issues.</subsection></subsection><subsection ssid="1-null-7" dnum="2-o" numlevel="1" lineno="306" slineno="5-14" level="1"><display>(2)</display>To promote health, safety, and welfare, the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both"> </amend><amendoutend style="2"/>general plan <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="6" groupid="5" style="2" owner="jchristopherson" level="1" deltag="both">may provide for</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="5" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">shall <ln numlevel="1" lineno="307" slineno="5-15"/>address</amend>:<subsection ssid="1-null-8" dnum="a-o" numlevel="1" lineno="308" slineno="5-16" level="2"><display>(a)</display>health, general welfare, safety, energy conservation, transportation, prosperity, civic <ln numlevel="1" lineno="309" slineno="5-17"/>activities, aesthetics, and recreational, educational, and cultural opportunities;</subsection><subsection ssid="1-null-9" dnum="b-o" numlevel="1" lineno="310" slineno="5-18" level="2"><display>(b)</display>the reduction of the waste of physical, financial, or human resources that result from <ln numlevel="1" lineno="311" slineno="5-19"/>either excessive congestion or excessive scattering of population;</subsection><subsection ssid="1-null-10" dnum="c-o" numlevel="1" lineno="312" slineno="5-20" level="2"><display>(c)</display>the efficient and economical use, conservation, and production of the supply of:<subsection ssid="1-null-11" dnum="i-o" numlevel="1" lineno="313" slineno="5-21" level="3"><display>(i)</display>food and water; and</subsection><subsection ssid="1-null-12" dnum="ii-o" numlevel="1" lineno="314" slineno="5-22" level="3"><display>(ii)</display>drainage, sanitary, and other facilities and resources;</subsection></subsection><subsection ssid="1-null-13" dnum="d-o" numlevel="1" lineno="315" slineno="5-23" level="2"><display>(d)</display><amend anum="0" ea="amend" pairid="9" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="both">the maintenance and enhancement of wildlife habitat connectivity and migration <ln numlevel="1" lineno="316" slineno="5-24"/>corridors;</amend></subsection><subsection ssid="1-23" dnum="_-o:e-i" numlevel="1" lineno="317" slineno="5-25" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1148" style="1" owner="i" level="1" amendtag="both">(e)</amend></display>the use of energy conservation and solar and clean energy resources;</subsection><subsection ssid="1-null-14" dnum="e-o:f-i" numlevel="1" lineno="318" slineno="5-26" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1149" style="2" owner="o" level="1" deltag="both">(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1150" style="1" owner="i" level="1" amendtag="both" space="true">(f)</amend></display>the protection of urban development;</subsection><subsection ssid="1-null-15" dnum="f-o:g-i" numlevel="1" lineno="319" slineno="5-27" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1150" style="2" owner="o" level="1" deltag="both">(f)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1151" style="1" owner="i" level="1" amendtag="both" space="true">(g)</amend></display>the protection and promotion of air quality;</subsection><subsection ssid="1-null-16" dnum="g-o:h-i" numlevel="1" lineno="320" slineno="5-28" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1151" style="2" owner="o" level="1" deltag="both">(g)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1152" style="1" owner="i" level="1" amendtag="both" space="true">(h)</amend></display>historic preservation;</subsection><subsection ssid="1-null-17" dnum="h-o:i-i" numlevel="1" lineno="321" slineno="5-29" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1152" style="2" owner="o" level="1" deltag="both">(h)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1153" style="1" owner="i" level="1" amendtag="both" space="true">(i)</amend></display>identifying future uses of land that are likely to require an expansion or <ln numlevel="1" lineno="322" slineno="5-30"/>significant modification of services or facilities provided by an affected entity; and</subsection><subsection ssid="1-null-18" dnum="i-o:j-i" numlevel="1" lineno="323" slineno="5-31" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1153" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1154" style="1" owner="i" level="1" amendtag="both" space="true">(j)</amend></display>an official map.</subsection></subsection><subsection ssid="1-null-19" dnum="3-o" numlevel="1" lineno="324" slineno="5-32" level="1"><display>(3)</display>The general plan may define the county's local customs, local culture, and the <ln numlevel="1" lineno="325" slineno="5-33"/>components necessary for the county's economic stability.</subsection><subsection ssid="1-null-20" dnum="4-o" numlevel="1" lineno="326" slineno="5-34" level="1" space="false"><display>(4)</display><subsection ssid="1-24" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1156" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>Subject to Section <xref depth="3" refnumber="17-79-403">17-79-403</xref>, the county may determine the comprehensiveness, <ln numlevel="1" lineno="327" slineno="5-35"/>extent, and format of the general plan.</subsection><subsection ssid="1-25" dnum="_-o:b-i" numlevel="1" lineno="328" slineno="5-36" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1157" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="end">In preparing and adopting a general plan, the county shall, to the extent the county <ln numlevel="1" lineno="329" slineno="5-37"/>determines advisable, consider:</amend><subsection ssid="1-26" dnum="_-o:i-i" numlevel="1" lineno="330" slineno="5-38" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1158" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="22" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="end">the impacts of development on wildlife, wildlife movement, and wildlife habitat; <ln numlevel="1" lineno="331" slineno="5-39"/>and</amend></subsection><subsection ssid="1-27" dnum="_-o:ii-i" numlevel="1" lineno="332" slineno="5-40" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1159" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="27" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="end">how the impacts of development on wildlife, wildlife movement, and wildlife <ln numlevel="1" lineno="333" slineno="5-41"/>habitat may be mitigated.</amend></subsection></subsection></subsection><subsection ssid="1-null-21" dnum="5-o" numlevel="1" lineno="334" slineno="5-42" level="1"><display>(5)</display>Nothing in this part may be construed to limit the authority of the state to manage and <ln numlevel="1" lineno="335" slineno="5-43"/>protect wildlife under Title <xref depth="0" refnumber="23A">23A, Wildlife Resources Act</xref>.</subsection><subsection ssid="1-null-22" dnum="6-o" numlevel="1" lineno="336" slineno="5-44" level="1"><display>(6)</display>On or before December 31, 2025, a county that has a general plan that does not include <ln numlevel="1" lineno="337" slineno="5-45"/>a water use and preservation element that complies with Section <xref depth="3" refnumber="17-79-403">17-79-403</xref> shall amend <ln numlevel="1" lineno="338" slineno="5-46"/>the county's general plan to comply with Section <xref depth="3" refnumber="17-79-403">17-79-403</xref>.</subsection></section></bsec><bsec buid="3" num="17-79-402" type="amend" src="code" uid="C17-79-S402_2026050620260506" sort="17 79 04020020260506" numlevel="1" lineno="339" slineno="6-1" sn="6"><section number="17-79-402" numlevel="1" lineno="340" slineno="6-2" type="amend"><secline lineno="339">Section 6. Section <bold>17-79-402</bold> is amended to read:</secline><catline lineno="340"><bold>17-79-402<parens/>. Specific provisions for general plan.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="341" slineno="6-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="3-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The general plan of a specified county, as defined in Section <xref depth="3" refnumber="17-80-101">17-80-101</xref>, shall <ln numlevel="1" lineno="342" slineno="6-4"/>include a moderate income housing element that meets the requirements of Section <xref depth="3" refnumber="17-80-201"><ln numlevel="1" lineno="343" slineno="6-5"/>17-80-201</xref>.</subsection><subsection ssid="3-null-3" dnum="b-o" numlevel="1" lineno="344" slineno="6-6" level="2" space="false"><display>(b)</display><subsection ssid="3-null-4" dnum="i-o" level="3" placement="sameline"><display>(i)</display>This Subsection <xref depth="4" refnumber="17-79-402(1)(b))">(1)(b)</xref> applies to a county that does not qualify as a specified <ln numlevel="1" lineno="345" slineno="6-7"/>county as of January 1, 2023.</subsection><subsection ssid="3-null-5" dnum="ii-o" numlevel="1" lineno="346" slineno="6-8" level="3"><display>(ii)</display>As of January 1, if a county changes from one class to another or grows in <ln numlevel="1" lineno="347" slineno="6-9"/>population to qualify as a specified county, the county shall amend the county's <ln numlevel="1" lineno="348" slineno="6-10"/>general plan to include a moderate income housing element that meets the <ln numlevel="1" lineno="349" slineno="6-11"/>requirements of Section <xref depth="3" refnumber="17-80-201">17-80-201</xref> on or before August 1 of the first calendar year <ln numlevel="1" lineno="350" slineno="6-12"/>beginning on January 1 in which the county qualifies as a specified county.</subsection><subsection ssid="3-null-6" dnum="iii-o" numlevel="1" lineno="351" slineno="6-13" level="3"><display>(iii)</display>A county described in Subsection <xref depth="4" refnumber="17-79-402(1)(b)(ii)">(1)(b)(ii)</xref> shall send a copy of the county's <ln numlevel="1" lineno="352" slineno="6-14"/>amended general plan to the association of governments, established in <ln numlevel="1" lineno="353" slineno="6-15"/>accordance with an interlocal agreement under <xref depth="1" refnumber="11-13">Title 11, Chapter 13</xref>, Interlocal <ln numlevel="1" lineno="354" slineno="6-16"/>Cooperation Act, of which the county is a member.</subsection></subsection></subsection><subsection ssid="3-null-7" dnum="2-o" numlevel="1" lineno="355" slineno="6-17" level="1" space="false"><display>(2)</display><subsection ssid="3-null-8" dnum="a-o" level="2" placement="sameline"><display>(a)</display>All county general plans shall contain a resource management plan for the public <ln numlevel="1" lineno="356" slineno="6-18"/>lands, as defined in Section <xref depth="3" refnumber="63L-6-102">63L-6-102</xref>, within the county.</subsection><subsection ssid="3-null-9" dnum="b-o" numlevel="1" lineno="357" slineno="6-19" level="2"><display>(b)</display>The resource management plan described in Subsection <xref depth="4" refnumber="17-79-402(2)(a))">(2)(a)</xref> shall address:<subsection ssid="3-null-10" dnum="i-o" numlevel="1" lineno="358" slineno="6-20" level="3"><display>(i)</display>mining;</subsection><subsection ssid="3-null-11" dnum="ii-o" numlevel="1" lineno="359" slineno="6-21" level="3"><display>(ii)</display>land use;</subsection><subsection ssid="3-null-12" dnum="iii-o" numlevel="1" lineno="360" slineno="6-22" level="3"><display>(iii)</display>livestock and grazing;</subsection><subsection ssid="3-null-13" dnum="iv-o" numlevel="1" lineno="361" slineno="6-23" level="3"><display>(iv)</display>irrigation;</subsection><subsection ssid="3-null-14" dnum="v-o" numlevel="1" lineno="362" slineno="6-24" level="3"><display>(v)</display>agriculture;</subsection><subsection ssid="3-null-15" dnum="vi-o" numlevel="1" lineno="363" slineno="6-25" level="3"><display>(vi)</display>fire management;</subsection><subsection ssid="3-null-16" dnum="vii-o" numlevel="1" lineno="364" slineno="6-26" level="3"><display>(vii)</display>noxious weeds;</subsection><subsection ssid="3-null-17" dnum="viii-o" numlevel="1" lineno="365" slineno="6-27" level="3"><display>(viii)</display>forest management;</subsection><subsection ssid="3-null-18" dnum="ix-o" numlevel="1" lineno="366" slineno="6-28" level="3"><display>(ix)</display>water rights;</subsection><subsection ssid="3-null-19" dnum="x-o" numlevel="1" lineno="367" slineno="6-29" level="3"><display>(x)</display>ditches and canals;</subsection><subsection ssid="3-null-20" dnum="xi-o" numlevel="1" lineno="368" slineno="6-30" level="3"><display>(xi)</display>water quality and hydrology;</subsection><subsection ssid="3-null-21" dnum="xii-o" numlevel="1" lineno="369" slineno="6-31" level="3"><display>(xii)</display>flood plains and river terraces;</subsection><subsection ssid="3-null-22" dnum="xiii-o" numlevel="1" lineno="370" slineno="6-32" level="3"><display>(xiii)</display>wetlands;</subsection><subsection ssid="3-null-23" dnum="xiv-o" numlevel="1" lineno="371" slineno="6-33" level="3"><display>(xiv)</display>riparian areas;</subsection><subsection ssid="3-null-24" dnum="xv-o" numlevel="1" lineno="372" slineno="6-34" level="3"><display>(xv)</display>predator control;</subsection><subsection ssid="3-null-25" dnum="xvi-o" numlevel="1" lineno="373" slineno="6-35" level="3"><display>(xvi)</display>wildlife<amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both">, habitat connectivity, and migration corridors</amend>;</subsection><subsection ssid="3-null-26" dnum="xvii-o" numlevel="1" lineno="374" slineno="6-36" level="3"><display>(xvii)</display>fisheries;</subsection><subsection ssid="3-null-27" dnum="xviii-o" numlevel="1" lineno="375" slineno="6-37" level="3"><display>(xviii)</display>recreation and tourism;</subsection><subsection ssid="3-null-28" dnum="xix-o" numlevel="1" lineno="376" slineno="6-38" level="3"><display>(xix)</display>energy resources;</subsection><subsection ssid="3-null-29" dnum="xx-o" numlevel="1" lineno="377" slineno="6-39" level="3"><display>(xx)</display>mineral resources;</subsection><subsection ssid="3-null-30" dnum="xxi-o" numlevel="1" lineno="378" slineno="6-40" level="3"><display>(xxi)</display>cultural, historical, geological, and paleontological resources;</subsection><subsection ssid="3-null-31" dnum="xxii-o" numlevel="1" lineno="379" slineno="6-41" level="3"><display>(xxii)</display>wilderness;</subsection><subsection ssid="3-null-32" dnum="xxiii-o" numlevel="1" lineno="380" slineno="6-42" level="3"><display>(xxiii)</display>wild and scenic rivers;</subsection><subsection ssid="3-null-33" dnum="xxiv-o" numlevel="1" lineno="381" slineno="6-43" level="3"><display>(xxiv)</display>threatened, endangered, and sensitive species;</subsection><subsection ssid="3-null-34" dnum="xxv-o" numlevel="1" lineno="382" slineno="6-44" level="3"><display>(xxv)</display>land access;</subsection><subsection ssid="3-null-35" dnum="xxvi-o" numlevel="1" lineno="383" slineno="6-45" level="3"><display>(xxvi)</display>law enforcement;</subsection><subsection ssid="3-null-36" dnum="xxvii-o" numlevel="1" lineno="384" slineno="6-46" level="3"><display>(xxvii)</display>economic considerations; and</subsection><subsection ssid="3-null-37" dnum="xxviii-o" numlevel="1" lineno="385" slineno="6-47" level="3"><display>(xxviii)</display>air.</subsection></subsection><subsection ssid="3-null-38" dnum="c-o" numlevel="1" lineno="386" slineno="6-48" level="2"><display>(c)</display>For each item listed under Subsection <xref depth="4" refnumber="17-79-402(2)(b)">(2)(b)</xref>, a county's resource management plan <ln numlevel="1" lineno="387" slineno="6-49"/>shall:<subsection ssid="3-null-39" dnum="i-o" numlevel="1" lineno="388" slineno="6-50" level="3"><display>(i)</display>establish findings pertaining to the item;</subsection><subsection ssid="3-null-40" dnum="ii-o" numlevel="1" lineno="389" slineno="6-51" level="3"><display>(ii)</display>establish defined objectives; and</subsection><subsection ssid="3-null-41" dnum="iii-o" numlevel="1" lineno="390" slineno="6-52" level="3"><display>(iii)</display>outline general policies and guidelines on how the objectives described in <ln numlevel="1" lineno="391" slineno="6-53"/>Subsection <xref depth="4" refnumber="17-79-402(2)(c)(ii)">(2)(c)(ii)</xref> are to be accomplished.</subsection></subsection></subsection><subsection ssid="3-null-42" dnum="3-o" numlevel="1" lineno="392" slineno="6-54" level="1" space="false"><display>(3)</display><subsection ssid="3-null-43" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="3-null-44" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>All county general plans shall include specific provisions related to an area <ln numlevel="1" lineno="393" slineno="6-55"/>within, or partially within, the exterior boundaries of the county, or contiguous to <ln numlevel="1" lineno="394" slineno="6-56"/>the boundaries of a county, which are proposed for the siting of a storage facility <ln numlevel="1" lineno="395" slineno="6-57"/>or transfer facility for the placement of high-level nuclear waste or greater than <ln numlevel="1" lineno="396" slineno="6-58"/>class C radioactive nuclear waste, as these wastes are defined in Section <xref depth="3" refnumber="19-3-303">19-3-303</xref>.</subsection><subsection ssid="3-null-45" dnum="ii-o" numlevel="1" lineno="397" slineno="6-59" level="3" tab="1"><display>(ii)</display>The provisions described in Subsection <xref depth="4" refnumber="17-79-402(3)(a)(i)">(3)(a)(i)</xref> shall address the effects of the <ln numlevel="1" lineno="398" slineno="6-60"/>proposed site upon the health and general welfare of citizens of the state, and shall <ln numlevel="1" lineno="399" slineno="6-61"/>provide:<subsection ssid="3-null-46" dnum="A-o" numlevel="1" lineno="400" slineno="6-62" level="4"><display>(A)</display>the information identified in Section <xref depth="3" refnumber="19-3-305">19-3-305</xref>;</subsection><subsection ssid="3-null-47" dnum="B-o" numlevel="1" lineno="401" slineno="6-63" level="4"><display>(B)</display>information supported by credible studies that demonstrates that Subsection <xref depth="4" refnumber="19-3-307(2)"><ln numlevel="1" lineno="402" slineno="6-64"/>19-3-307(2)</xref> has been satisfied; and</subsection><subsection ssid="3-null-48" dnum="C-o" numlevel="1" lineno="403" slineno="6-65" level="4"><display>(C)</display>specific measures to mitigate the effects of high-level nuclear waste and <ln numlevel="1" lineno="404" slineno="6-66"/>greater than class C radioactive waste and guarantee the health and safety of <ln numlevel="1" lineno="405" slineno="6-67"/>the citizens of the state.</subsection></subsection></subsection><subsection ssid="3-null-49" dnum="b-o" numlevel="1" lineno="406" slineno="6-68" level="2"><display>(b)</display>A county may, in lieu of complying with Subsection <xref depth="4" refnumber="17-79-402(3)(a)">(3)(a)</xref>, adopt an ordinance <ln numlevel="1" lineno="407" slineno="6-69"/>indicating that all proposals for the siting of a storage facility or transfer facility for <ln numlevel="1" lineno="408" slineno="6-70"/>the placement of high-level nuclear waste or greater than class C radioactive waste <ln numlevel="1" lineno="409" slineno="6-71"/>wholly or partially within the county are rejected.</subsection><subsection ssid="3-null-50" dnum="c-o" numlevel="1" lineno="410" slineno="6-72" level="2"><display>(c)</display>A county may adopt the ordinance listed in Subsection <xref depth="4" refnumber="17-79-402(3)(b)">(3)(b)</xref> at any time.</subsection><subsection ssid="3-null-51" dnum="d-o" numlevel="1" lineno="411" slineno="6-73" level="2"><display>(d)</display>The county shall send a certified copy of the ordinance described in Subsection <xref depth="4" refnumber="17-79-402(3)(b)">(3)(b)</xref> <ln numlevel="1" lineno="412" slineno="6-74"/>to the executive director of the Department of Environmental Quality by certified <ln numlevel="1" lineno="413" slineno="6-75"/>mail within 30 days of enactment.</subsection><subsection ssid="3-null-52" dnum="e-o" numlevel="1" lineno="414" slineno="6-76" level="2"><display>(e)</display>If a county repeals an ordinance adopted under Subsection <xref depth="4" refnumber="17-79-402(3)(b)">(3)(b)</xref>, the county shall:<subsection ssid="3-null-53" dnum="i-o" numlevel="1" lineno="415" slineno="6-77" level="3"><display>(i)</display>comply with Subsection <xref depth="4" refnumber="17-79-402(3)(a)">(3)(a)</xref> as soon as reasonably possible; and</subsection><subsection ssid="3-null-54" dnum="ii-o" numlevel="1" lineno="416" slineno="6-78" level="3"><display>(ii)</display>send a certified copy of the repeal to the executive director of the Department of <ln numlevel="1" lineno="417" slineno="6-79"/>Environmental Quality by certified mail within 30 days after the repeal.</subsection></subsection></subsection><subsection ssid="3-null-55" dnum="4-o" numlevel="1" lineno="418" slineno="6-80" level="1"><display>(4)</display>If a county has designated a mountainous planning district, the general plan for the <ln numlevel="1" lineno="419" slineno="6-81"/>mountainous planning district is the controlling plan.</subsection></section></bsec><bsec buid="4" num="17-79-403" type="amend" src="code" uid="C17-79-S403_2026050620260506" sort="17 79 04030020260506" numlevel="1" lineno="420" slineno="7-1" sn="7"><section number="17-79-403" numlevel="1" lineno="421" slineno="7-2" type="amend"><secline lineno="420">Section 7. Section <bold>17-79-403</bold> is amended to read:</secline><catline lineno="421"><bold>17-79-403<parens/>. General plan preparation. </bold></catline><subsection ssid="4-null-1" dnum="1-o" numlevel="1" lineno="422" slineno="7-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="4-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The planning commission shall provide notice, as provided in Section <xref depth="3" refnumber="17-79-203">17-79-203</xref>, <ln numlevel="1" lineno="423" slineno="7-4"/>of the planning commission's intent to make a recommendation to the county <ln numlevel="1" lineno="424" slineno="7-5"/>legislative body for a general plan or a comprehensive general plan amendment when <ln numlevel="1" lineno="425" slineno="7-6"/>the planning commission initiates the process of preparing the planning commission's <ln numlevel="1" lineno="426" slineno="7-7"/>recommendation.</subsection><subsection ssid="4-null-3" dnum="b-o" numlevel="1" lineno="427" slineno="7-8" level="2"><display>(b)</display>The planning commission shall make and recommend to the legislative body a <ln numlevel="1" lineno="428" slineno="7-9"/>proposed general plan for:<subsection ssid="4-null-4" dnum="i-o" numlevel="1" lineno="429" slineno="7-10" level="3"><display>(i)</display>the unincorporated area within the county; or</subsection><subsection ssid="4-null-5" dnum="ii-o" numlevel="1" lineno="430" slineno="7-11" level="3"><display>(ii)</display>if the planning commission is a planning commission for a mountainous planning <ln numlevel="1" lineno="431" slineno="7-12"/>district, the mountainous planning district.</subsection></subsection><subsection ssid="4-null-6" dnum="c-o" numlevel="1" lineno="432" slineno="7-13" level="2" space="false"><display>(c)</display><subsection ssid="4-null-7" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The plan may include planning for incorporated areas if, in the planning <ln numlevel="1" lineno="433" slineno="7-14"/>commission's judgment, they are related to the planning of the unincorporated <ln numlevel="1" lineno="434" slineno="7-15"/>territory or of the county as a whole.</subsection><subsection ssid="4-null-8" dnum="ii-o" numlevel="1" lineno="435" slineno="7-16" level="3"><display>(ii)</display>Elements of the county plan that address incorporated areas are not an official <ln numlevel="1" lineno="436" slineno="7-17"/>plan or part of a municipal plan for any municipality, unless the county plan is <ln numlevel="1" lineno="437" slineno="7-18"/>recommended by the municipal planning commission and adopted by the <ln numlevel="1" lineno="438" slineno="7-19"/>governing body of the municipality.</subsection></subsection></subsection><subsection ssid="4-null-9" dnum="2-o" numlevel="1" lineno="439" slineno="7-20" level="1" space="false"><display>(2)</display><subsection ssid="4-null-10" dnum="a-o" level="2" placement="sameline"><display>(a)</display>At a minimum, the proposed general plan, with the accompanying maps, charts, <ln numlevel="1" lineno="440" slineno="7-21"/>and descriptive and explanatory matter, shall include the planning commission's <ln numlevel="1" lineno="441" slineno="7-22"/>recommendations for the following plan elements:<subsection ssid="4-null-11" dnum="i-o" numlevel="1" lineno="442" slineno="7-23" level="3" tab="1"><display>(i)</display>a land use element that:<subsection ssid="4-null-12" dnum="A-o" numlevel="1" lineno="443" slineno="7-24" level="4"><display>(A)</display>designates the long-term goals and the proposed extent, general distribution, <ln numlevel="1" lineno="444" slineno="7-25"/>and location of land for housing for residents of various income levels, <ln numlevel="1" lineno="445" slineno="7-26"/>business, industry, agriculture, recreation, education, public buildings and <ln numlevel="1" lineno="446" slineno="7-27"/>grounds, open space, and other categories of public and private uses of land as <ln numlevel="1" lineno="447" slineno="7-28"/>appropriate;</subsection><subsection ssid="4-null-13" dnum="B-o" numlevel="1" lineno="448" slineno="7-29" level="4"><display>(B)</display>includes a statement of the projections for and standards of population density <ln numlevel="1" lineno="449" slineno="7-30"/>and building intensity recommended for the various land use categories <ln numlevel="1" lineno="450" slineno="7-31"/>covered by the plan;</subsection><subsection ssid="4-null-14" dnum="C-o" numlevel="1" lineno="451" slineno="7-32" level="4"><display>(C)</display>is coordinated to integrate the land use element with the water use and <ln numlevel="1" lineno="452" slineno="7-33"/>preservation element;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="8" style="2" owner="jchristopherson" level="1" deltag="both"> and</amend><amendoutend style="2"/></subsection><subsection ssid="4-null-15" dnum="D-o" numlevel="1" lineno="453" slineno="7-34" level="4"><display>(D)</display>accounts for the effect of land use categories and land uses on water demand;<amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both"> <ln numlevel="1" lineno="454" slineno="7-35"/>and</amend></subsection><subsection ssid="4-94" dnum="_-o:E-i" numlevel="1" lineno="455" slineno="7-36" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1232" style="1" owner="i" level="1" amendtag="start">(E)</amend></display><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">considers how land use categories and land uses will impact hunting <ln numlevel="1" lineno="456" slineno="7-37"/>opportunities, wildlife habitat connectivity, and migration corridors;</amend></subsection></subsection><subsection ssid="4-null-16" dnum="ii-o" numlevel="1" lineno="457" slineno="7-38" level="3" tab="1"><display>(ii)</display>a transportation and traffic circulation element that:<subsection ssid="4-null-17" dnum="A-o" numlevel="1" lineno="458" slineno="7-39" level="4"><display>(A)</display>provides the general location and extent of existing and proposed freeways, <ln numlevel="1" lineno="459" slineno="7-40"/>arterial and collector streets, public transit, active transportation facilities, and <ln numlevel="1" lineno="460" slineno="7-41"/>other modes of transportation that the planning commission considers <ln numlevel="1" lineno="461" slineno="7-42"/>appropriate;</subsection><subsection ssid="4-null-18" dnum="B-o" numlevel="1" lineno="462" slineno="7-43" level="4"><display>(B)</display>addresses the county's plan for residential and commercial development <ln numlevel="1" lineno="463" slineno="7-44"/>around major transit investment corridors to maintain and improve the <ln numlevel="1" lineno="464" slineno="7-45"/>connections between housing, employment, education, recreation, and <ln numlevel="1" lineno="465" slineno="7-46"/>commerce; and</subsection><subsection ssid="4-null-19" dnum="C-o" numlevel="1" lineno="466" slineno="7-47" level="4"><display>(C)</display>correlates with the population projections, the employment projections, and <ln numlevel="1" lineno="467" slineno="7-48"/>the proposed land use element of the general plan;</subsection></subsection><subsection ssid="4-null-20" dnum="iii-o" numlevel="1" lineno="468" slineno="7-49" level="3" tab="1"><display>(iii)</display>for a specified county as defined in Section <xref depth="3" refnumber="17-80-101">17-80-101</xref>, a moderate income <ln numlevel="1" lineno="469" slineno="7-50"/>housing element that meets the requirements of Section <xref depth="3" refnumber="17-80-202">17-80-202</xref>;</subsection><subsection ssid="4-null-21" dnum="iv-o" numlevel="1" lineno="470" slineno="7-51" level="3" tab="1"><display>(iv)</display>a resource management plan detailing the findings, objectives, and policies <ln numlevel="1" lineno="471" slineno="7-52"/>required by Section <xref depth="3" refnumber="17-79-402">17-79-402</xref>; and</subsection><subsection ssid="4-null-22" dnum="v-o" numlevel="1" lineno="472" slineno="7-53" level="3" tab="1"><display>(v)</display>a water use and preservation element that addresses:<subsection ssid="4-null-23" dnum="A-o" numlevel="1" lineno="473" slineno="7-54" level="4"><display>(A)</display>the effect of permitted development or patterns of development on water <ln numlevel="1" lineno="474" slineno="7-55"/>demand and water infrastructure;</subsection><subsection ssid="4-null-24" dnum="B-o" numlevel="1" lineno="475" slineno="7-56" level="4"><display>(B)</display>methods of reducing water demand and per capita consumption for future <ln numlevel="1" lineno="476" slineno="7-57"/>development;</subsection><subsection ssid="4-null-25" dnum="C-o" numlevel="1" lineno="477" slineno="7-58" level="4"><display>(C)</display>methods of reducing water demand and per capita consumption for existing <ln numlevel="1" lineno="478" slineno="7-59"/>development; and</subsection><subsection ssid="4-null-26" dnum="D-o" numlevel="1" lineno="479" slineno="7-60" level="4"><display>(D)</display>opportunities for the county to modify the county's operations to eliminate <ln numlevel="1" lineno="480" slineno="7-61"/>practices or conditions that waste water.</subsection></subsection></subsection><subsection ssid="4-null-27" dnum="b-o" numlevel="1" lineno="481" slineno="7-62" level="2"><display>(b)</display>In drafting the land use element, the planning commission shall:<subsection ssid="4-null-28" dnum="i-o" numlevel="1" lineno="482" slineno="7-63" level="3"><display>(i)</display>identify and consider each agriculture protection area within the unincorporated <ln numlevel="1" lineno="483" slineno="7-64"/>area of the county or mountainous planning district;</subsection><subsection ssid="4-null-29" dnum="ii-o" numlevel="1" lineno="484" slineno="7-65" level="3"><display>(ii)</display>avoid proposing a use of land within an agriculture protection area that is <ln numlevel="1" lineno="485" slineno="7-66"/>inconsistent with or detrimental to the use of the land for agriculture; and</subsection><subsection ssid="4-null-30" dnum="iii-o" numlevel="1" lineno="486" slineno="7-67" level="3"><display>(iii)</display>consider and coordinate with any station area plans adopted by municipalities <ln numlevel="1" lineno="487" slineno="7-68"/>located within the county under <xref depth="3" refnumber="10-21-203">10-21-203</xref>.</subsection></subsection><subsection ssid="4-null-31" dnum="c-o" numlevel="1" lineno="488" slineno="7-69" level="2"><display>(c)</display>In drafting the transportation and traffic circulation element, the planning <ln numlevel="1" lineno="489" slineno="7-70"/>commission shall:<subsection ssid="4-null-32" dnum="i-o" numlevel="1" lineno="490" slineno="7-71" level="3" space="false"><display>(i)</display><subsection ssid="4-null-33" dnum="A-o" level="4" placement="sameline"><display>(A)</display>consider and coordinate with the regional transportation plan developed by <ln numlevel="1" lineno="491" slineno="7-72"/>the county's region's metropolitan planning organization, if the relevant areas <ln numlevel="1" lineno="492" slineno="7-73"/>of the county are within the boundaries of a metropolitan planning <ln numlevel="1" lineno="493" slineno="7-74"/>organization; or</subsection><subsection ssid="4-null-34" dnum="B-o" numlevel="1" lineno="494" slineno="7-75" level="4"><display>(B)</display>consider and coordinate with the long-range transportation plan developed by <ln numlevel="1" lineno="495" slineno="7-76"/>the Department of Transportation, if the relevant areas of the county are not <ln numlevel="1" lineno="496" slineno="7-77"/>within the boundaries of a metropolitan planning organization; and</subsection></subsection><subsection ssid="4-null-35" dnum="ii-o" numlevel="1" lineno="497" slineno="7-78" level="3"><display>(ii)</display>consider and coordinate with any station area plans adopted by municipalities <ln numlevel="1" lineno="498" slineno="7-79"/>located within the county under Section <xref depth="3" refnumber="10-21-203">10-21-203</xref>.</subsection></subsection><subsection ssid="4-null-36" dnum="d-o" numlevel="1" lineno="499" slineno="7-80" level="2"><display>(d)</display>In drafting the water use and preservation element, the planning commission:<subsection ssid="4-null-37" dnum="i-o" numlevel="1" lineno="500" slineno="7-81" level="3"><display>(i)</display>shall consider applicable regional water conservation goals recommended by the <ln numlevel="1" lineno="501" slineno="7-82"/>Division of Water Resources;</subsection><subsection ssid="4-null-38" dnum="ii-o" numlevel="1" lineno="502" slineno="7-83" level="3"><display>(ii)</display>shall consult with the Division of Water Resources for information and technical <ln numlevel="1" lineno="503" slineno="7-84"/>resources regarding regional water conservation goals, including how <ln numlevel="1" lineno="504" slineno="7-85"/>implementation of the land use element and water use and preservation element <ln numlevel="1" lineno="505" slineno="7-86"/>may affect the Great Salt Lake;</subsection><subsection ssid="4-null-39" dnum="iii-o" numlevel="1" lineno="506" slineno="7-87" level="3"><display>(iii)</display>shall notify the community water systems serving drinking water within the <ln numlevel="1" lineno="507" slineno="7-88"/>unincorporated portion of the county and request feedback from the community <ln numlevel="1" lineno="508" slineno="7-89"/>water systems about how implementation of the land use element and water use <ln numlevel="1" lineno="509" slineno="7-90"/>and preservation element may affect:<subsection ssid="4-null-40" dnum="A-o" numlevel="1" lineno="510" slineno="7-91" level="4"><display>(A)</display>water supply planning, including drinking water source and storage capacity <ln numlevel="1" lineno="511" slineno="7-92"/>consistent with Section <xref depth="3" refnumber="19-4-114">19-4-114</xref>; and</subsection><subsection ssid="4-null-41" dnum="B-o" numlevel="1" lineno="512" slineno="7-93" level="4"><display>(B)</display>water distribution planning, including master plans, infrastructure asset <ln numlevel="1" lineno="513" slineno="7-94"/>management programs and plans, infrastructure replacement plans, and impact <ln numlevel="1" lineno="514" slineno="7-95"/>fee facilities plans;</subsection></subsection><subsection ssid="4-null-42" dnum="iv-o" numlevel="1" lineno="515" slineno="7-96" level="3"><display>(iv)</display>shall consider the potential opportunities and benefits of planning for <ln numlevel="1" lineno="516" slineno="7-97"/>regionalization of public water systems;</subsection><subsection ssid="4-null-43" dnum="v-o" numlevel="1" lineno="517" slineno="7-98" level="3"><display>(v)</display>shall consult with the Department of Agriculture and Food for information and <ln numlevel="1" lineno="518" slineno="7-99"/>technical resources regarding the potential benefits of agriculture conservation <ln numlevel="1" lineno="519" slineno="7-100"/>easements and potential implementation of agriculture water optimization projects <ln numlevel="1" lineno="520" slineno="7-101"/>that would support regional water conservation goals;</subsection><subsection ssid="4-null-44" dnum="vi-o" numlevel="1" lineno="521" slineno="7-102" level="3"><display>(vi)</display>shall notify an irrigation or canal company located in the county so that the <ln numlevel="1" lineno="522" slineno="7-103"/>irrigation or canal company can be involved in the protection and integrity of the <ln numlevel="1" lineno="523" slineno="7-104"/>irrigation or canal company's delivery systems;</subsection><subsection ssid="4-null-45" dnum="vii-o" numlevel="1" lineno="524" slineno="7-105" level="3"><display>(vii)</display>shall include a recommendation for:<subsection ssid="4-null-46" dnum="A-o" numlevel="1" lineno="525" slineno="7-106" level="4"><display>(A)</display>water conservation policies to be determined by the county; and</subsection><subsection ssid="4-null-47" dnum="B-o" numlevel="1" lineno="526" slineno="7-107" level="4"><display>(B)</display>landscaping options within a public street for current and future development <ln numlevel="1" lineno="527" slineno="7-108"/>that do not require the use of lawn or turf in a parkstrip;</subsection></subsection><subsection ssid="4-null-48" dnum="viii-o" numlevel="1" lineno="528" slineno="7-109" level="3"><display>(viii)</display>shall review the county's land use ordinances and include a recommendation for <ln numlevel="1" lineno="529" slineno="7-110"/>changes to an ordinance that promotes the inefficient use of water;</subsection><subsection ssid="4-null-49" dnum="ix-o" numlevel="1" lineno="530" slineno="7-111" level="3"><display>(ix)</display>shall consider principles of sustainable landscaping, including the:<subsection ssid="4-null-50" dnum="A-o" numlevel="1" lineno="531" slineno="7-112" level="4"><display>(A)</display>reduction or limitation of the use of lawn or turf;</subsection><subsection ssid="4-null-51" dnum="B-o" numlevel="1" lineno="532" slineno="7-113" level="4"><display>(B)</display>promotion of site-specific landscape design that decreases stormwater runoff <ln numlevel="1" lineno="533" slineno="7-114"/>or runoff of water used for irrigation;</subsection><subsection ssid="4-null-52" dnum="C-o" numlevel="1" lineno="534" slineno="7-115" level="4"><display>(C)</display>preservation and use of healthy trees that have a reasonable water requirement <ln numlevel="1" lineno="535" slineno="7-116"/>or are resistant to dry soil conditions;</subsection><subsection ssid="4-null-53" dnum="D-o" numlevel="1" lineno="536" slineno="7-117" level="4"><display>(D)</display>elimination or regulation of ponds, pools, and other features that promote <ln numlevel="1" lineno="537" slineno="7-118"/>unnecessary water evaporation;</subsection><subsection ssid="4-null-54" dnum="E-o" numlevel="1" lineno="538" slineno="7-119" level="4"><display>(E)</display>reduction of yard waste; and</subsection><subsection ssid="4-null-55" dnum="F-o" numlevel="1" lineno="539" slineno="7-120" level="4"><display>(F)</display>use of an irrigation system, including drip irrigation, best adapted to provide <ln numlevel="1" lineno="540" slineno="7-121"/>the optimal amount of water to the plants being irrigated;</subsection></subsection><subsection ssid="4-null-56" dnum="x-o" numlevel="1" lineno="541" slineno="7-122" level="3"><display>(x)</display>may include recommendations for additional water demand reduction strategies, <ln numlevel="1" lineno="542" slineno="7-123"/>including:<subsection ssid="4-null-57" dnum="A-o" numlevel="1" lineno="543" slineno="7-124" level="4"><display>(A)</display>creating a water budget associated with a particular type of development;</subsection><subsection ssid="4-null-58" dnum="B-o" numlevel="1" lineno="544" slineno="7-125" level="4"><display>(B)</display>adopting new or modified lot size, configuration, and landscaping standards <ln numlevel="1" lineno="545" slineno="7-126"/>that will reduce water demand for new single family development;</subsection><subsection ssid="4-null-59" dnum="C-o" numlevel="1" lineno="546" slineno="7-127" level="4"><display>(C)</display>providing one or more water reduction incentives for existing landscapes and <ln numlevel="1" lineno="547" slineno="7-128"/>irrigation systems and installation of water fixtures or systems that minimize <ln numlevel="1" lineno="548" slineno="7-129"/>water demand;</subsection><subsection ssid="4-null-60" dnum="D-o" numlevel="1" lineno="549" slineno="7-130" level="4"><display>(D)</display>discouraging incentives for economic development activities that do not <ln numlevel="1" lineno="550" slineno="7-131"/>adequately account for water use or do not include strategies for reducing <ln numlevel="1" lineno="551" slineno="7-132"/>water demand; and</subsection><subsection ssid="4-null-61" dnum="E-o" numlevel="1" lineno="552" slineno="7-133" level="4"><display>(E)</display>adopting water concurrency standards requiring that adequate water supplies <ln numlevel="1" lineno="553" slineno="7-134"/>and facilities are or will be in place for new development; and</subsection></subsection><subsection ssid="4-null-62" dnum="xi-o" numlevel="1" lineno="554" slineno="7-135" level="3"><display>(xi)</display>shall include a recommendation for low water use landscaping standards for a <ln numlevel="1" lineno="555" slineno="7-136"/>new:<subsection ssid="4-null-63" dnum="A-o" numlevel="1" lineno="556" slineno="7-137" level="4"><display>(A)</display>commercial, industrial, or institutional development;</subsection><subsection ssid="4-null-64" dnum="B-o" numlevel="1" lineno="557" slineno="7-138" level="4"><display>(B)</display>common interest community, as defined in Section <xref depth="3" refnumber="57-25-102">57-25-102</xref>; or</subsection><subsection ssid="4-null-65" dnum="C-o" numlevel="1" lineno="558" slineno="7-139" level="4"><display>(C)</display>multifamily housing project.</subsection></subsection></subsection></subsection><subsection ssid="4-null-66" dnum="3-o" numlevel="1" lineno="559" slineno="7-140" level="1"><display>(3)</display>The proposed general plan may include:<subsection ssid="4-null-67" dnum="a-o" numlevel="1" lineno="560" slineno="7-141" level="2"><display>(a)</display>an environmental element that addresses:<subsection ssid="4-null-68" dnum="i-o" numlevel="1" lineno="561" slineno="7-142" level="3"><display>(i)</display>to the extent not covered by the county's resource management plan, the <ln numlevel="1" lineno="562" slineno="7-143"/>protection, conservation, development, and use of natural resources, including the <ln numlevel="1" lineno="563" slineno="7-144"/>quality of:<subsection ssid="4-null-69" dnum="A-o" numlevel="1" lineno="564" slineno="7-145" level="4"><display>(A)</display>air;</subsection><subsection ssid="4-null-70" dnum="B-o" numlevel="1" lineno="565" slineno="7-146" level="4"><display>(B)</display>forests;</subsection><subsection ssid="4-null-71" dnum="C-o" numlevel="1" lineno="566" slineno="7-147" level="4"><display>(C)</display>soils;</subsection><subsection ssid="4-null-72" dnum="D-o" numlevel="1" lineno="567" slineno="7-148" level="4"><display>(D)</display>rivers;</subsection><subsection ssid="4-null-73" dnum="E-o" numlevel="1" lineno="568" slineno="7-149" level="4"><display>(E)</display>groundwater and other waters;</subsection><subsection ssid="4-null-74" dnum="F-o" numlevel="1" lineno="569" slineno="7-150" level="4"><display>(F)</display>harbors;</subsection><subsection ssid="4-null-75" dnum="G-o" numlevel="1" lineno="570" slineno="7-151" level="4"><display>(G)</display>fisheries;</subsection><subsection ssid="4-null-76" dnum="H-o" numlevel="1" lineno="571" slineno="7-152" level="4"><display>(H)</display>wildlife<amend anum="0" ea="amend" pairid="11" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both">, habitat connectivity, and migration corridors</amend>;</subsection><subsection ssid="4-null-77" dnum="I-o" numlevel="1" lineno="572" slineno="7-153" level="4"><display>(I)</display>minerals; and</subsection><subsection ssid="4-null-78" dnum="J-o" numlevel="1" lineno="573" slineno="7-154" level="4"><display>(J)</display>other natural resources; and</subsection></subsection><subsection ssid="4-null-79" dnum="ii-o" numlevel="1" lineno="574" slineno="7-155" level="3" space="false"><display>(ii)</display><subsection ssid="4-null-80" dnum="A-o" level="4" placement="sameline"><display>(A)</display>the reclamation of land, flood control, prevention and control of the <ln numlevel="1" lineno="575" slineno="7-156"/>pollution of streams and other waters;</subsection><subsection ssid="4-null-81" dnum="B-o" numlevel="1" lineno="576" slineno="7-157" level="4"><display>(B)</display>the regulation of the use of land on hillsides, stream channels and other <ln numlevel="1" lineno="577" slineno="7-158"/>environmentally sensitive areas;</subsection><subsection ssid="4-null-82" dnum="C-o" numlevel="1" lineno="578" slineno="7-159" level="4"><display>(C)</display>the prevention, control, and correction of the erosion of soils;</subsection><subsection ssid="4-null-83" dnum="D-o" numlevel="1" lineno="579" slineno="7-160" level="4"><display>(D)</display>the preservation and enhancement of watersheds and wetlands; and</subsection><subsection ssid="4-null-84" dnum="E-o" numlevel="1" lineno="580" slineno="7-161" level="4"><display>(E)</display>the mapping of known geologic hazards;</subsection></subsection></subsection><subsection ssid="4-null-85" dnum="b-o" numlevel="1" lineno="581" slineno="7-162" level="2"><display>(b)</display>a public services and facilities element showing general plans for sewage, water, <ln numlevel="1" lineno="582" slineno="7-163"/>waste disposal, drainage, public utilities, rights-of-way, easements, and facilities for <ln numlevel="1" lineno="583" slineno="7-164"/>them, police and fire protection, and other public services;</subsection><subsection ssid="4-null-86" dnum="c-o" numlevel="1" lineno="584" slineno="7-165" level="2"><display>(c)</display>a rehabilitation, redevelopment, and conservation element consisting of plans and <ln numlevel="1" lineno="585" slineno="7-166"/>programs for:<subsection ssid="4-null-87" dnum="i-o" numlevel="1" lineno="586" slineno="7-167" level="3"><display>(i)</display>historic preservation;</subsection><subsection ssid="4-null-88" dnum="ii-o" numlevel="1" lineno="587" slineno="7-168" level="3"><display>(ii)</display>the diminution or elimination of a development impediment as defined in Section <xref depth="3" refnumber="17C-1-102"><ln numlevel="1" lineno="588" slineno="7-169"/>17C-1-102</xref>; and</subsection><subsection ssid="4-null-89" dnum="iii-o" numlevel="1" lineno="589" slineno="7-170" level="3"><display>(iii)</display>redevelopment of land, including housing sites, business and industrial sites, and <ln numlevel="1" lineno="590" slineno="7-171"/>public building sites;</subsection></subsection><subsection ssid="4-null-90" dnum="d-o" numlevel="1" lineno="591" slineno="7-172" level="2"><display>(d)</display>an economic element composed of appropriate studies and forecasts, as well as an <ln numlevel="1" lineno="592" slineno="7-173"/>economic development plan, which may include review of existing and projected <ln numlevel="1" lineno="593" slineno="7-174"/>county revenue and expenditures, revenue sources, identification of basic and <ln numlevel="1" lineno="594" slineno="7-175"/>secondary industry, primary and secondary market areas, employment, and retail <ln numlevel="1" lineno="595" slineno="7-176"/>sales activity;</subsection><subsection ssid="4-null-91" dnum="e-o" numlevel="1" lineno="596" slineno="7-177" level="2"><display>(e)</display>recommendations for implementing all or any portion of the general plan, including <ln numlevel="1" lineno="597" slineno="7-178"/>the adoption of land and water use ordinances, capital improvement plans, <ln numlevel="1" lineno="598" slineno="7-179"/>community development and promotion, and any other appropriate action;</subsection><subsection ssid="4-null-92" dnum="f-o" numlevel="1" lineno="599" slineno="7-180" level="2"><display>(f)</display>provisions addressing any of the matters listed in Subsection <xref depth="4" refnumber="17-79-401(2)">17-79-401(2)</xref> or <xref depth="4" refnumber="17-79-402(1)"><ln numlevel="1" lineno="600" slineno="7-181"/>17-79-402(1)</xref>; and</subsection><subsection ssid="4-null-93" dnum="g-o" numlevel="1" lineno="601" slineno="7-182" level="2"><display>(g)</display>any other element the county considers appropriate.</subsection></subsection></section></bsec><bsec buid="6" num="17-79-501" type="amend" src="code" uid="C17-79-S501_2026050620260506" sort="17 79 05010020260506" numlevel="1" lineno="602" slineno="8-1" sn="8"><section number="17-79-501" numlevel="1" lineno="603" slineno="8-2" type="amend"><secline lineno="602">Section 8. Section <bold>17-79-501</bold> is amended to read:</secline><catline lineno="603"><bold>17-79-501<parens/>. Enactment of land use regulation.</bold></catline><subsection ssid="6-null-1" dnum="1-o" numlevel="1" lineno="604" slineno="8-3" level="1" placement="noreturn"><display>(1)</display>Only a legislative body, as the body authorized to weigh policy considerations, may <ln numlevel="1" lineno="605" slineno="8-4"/>enact a land use regulation.</subsection><subsection ssid="6-null-2" dnum="2-o" numlevel="1" lineno="606" slineno="8-5" level="1" space="false"><display>(2)</display><subsection ssid="6-null-3" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="17-27a-501(2)(b)" start="0">(2)(b)</xref>, a legislative body may enact a land use <ln numlevel="1" lineno="607" slineno="8-6"/>regulation only by ordinance.</subsection><subsection ssid="6-null-4" dnum="b-o" numlevel="1" lineno="608" slineno="8-7" level="2"><display>(b)</display>A legislative body may, by ordinance or resolution, enact a land use regulation that <ln numlevel="1" lineno="609" slineno="8-8"/>imposes a fee.</subsection></subsection><subsection ssid="6-null-5" dnum="3-o" numlevel="1" lineno="610" slineno="8-9" level="1" space="false"><display>(3)</display><subsection ssid="6-15" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1316" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>A land use regulation shall be consistent with the purposes set forth in this chapter.</subsection><subsection ssid="6-16" dnum="_-o:b-i" numlevel="1" lineno="611" slineno="8-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1317" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="end">In considering and adopting a land use regulation, a legislative body shall, to the <ln numlevel="1" lineno="612" slineno="8-11"/>extent the legislative body determines advisable, consider:</amend><subsection ssid="6-17" dnum="_-o:i-i" numlevel="1" lineno="613" slineno="8-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1318" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="end">the impacts of development on wildlife, wildlife movement, and wildlife habitat; <ln numlevel="1" lineno="614" slineno="8-13"/>and</amend></subsection><subsection ssid="6-18" dnum="_-o:ii-i" numlevel="1" lineno="615" slineno="8-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1319" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">how the impacts of development on wildlife, wildlife movement, and wildlife <ln numlevel="1" lineno="616" slineno="8-15"/>habitat may be mitigated.</amend></subsection></subsection></subsection><subsection ssid="6-null-6" dnum="4-o" numlevel="1" lineno="617" slineno="8-16" level="1" space="false"><display>(4)</display><subsection ssid="6-null-7" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A legislative body shall adopt a land use regulation to:<subsection ssid="6-null-8" dnum="i-o" numlevel="1" lineno="618" slineno="8-17" level="3" tab="1"><display>(i)</display>create or amend a zoning district under Subsection <xref depth="4" refnumber="17-79-503(1)(a)">17-79-503(1)(a)</xref>; and</subsection><subsection ssid="6-null-9" dnum="ii-o" numlevel="1" lineno="619" slineno="8-18" level="3" tab="1"><display>(ii)</display>designate general uses allowed in each zoning district.</subsection></subsection><subsection ssid="6-null-10" dnum="b-o" numlevel="1" lineno="620" slineno="8-19" level="2"><display>(b)</display>A land use authority may establish or modify other restrictions or requirements other <ln numlevel="1" lineno="621" slineno="8-20"/>than those described in Subsection <xref depth="4" refnumber="17-27a-501(4)(a)" start="0">(4)(a)</xref>, including the configuration or modification <ln numlevel="1" lineno="622" slineno="8-21"/>of uses or density, through a land use decision that applies criteria or policy elements <ln numlevel="1" lineno="623" slineno="8-22"/>that a land use regulation establishes or describes.</subsection></subsection><subsection ssid="6-null-11" dnum="5-o" numlevel="1" lineno="624" slineno="8-23" level="1"><display>(5)</display>A county may not adopt a land use regulation, development agreement, or land use <ln numlevel="1" lineno="625" slineno="8-24"/>decision that restricts the type of crop that may be grown in an area that is:<subsection ssid="6-null-12" dnum="a-o" numlevel="1" lineno="626" slineno="8-25" level="2"><display>(a)</display>zoned agricultural; or</subsection><subsection ssid="6-null-13" dnum="b-o" numlevel="1" lineno="627" slineno="8-26" level="2"><display>(b)</display>assessed under <xref depth="2" refnumber="59-2-5" start="0">Title 59, Chapter 2, Part 5, Farmland Assessment Act</xref>.</subsection></subsection><subsection ssid="6-null-14" dnum="6-o" numlevel="1" lineno="628" slineno="8-27" level="1"><display>(6)</display>A county land use regulation pertaining to an airport or an airport influence area, as that <ln numlevel="1" lineno="629" slineno="8-28"/>term is defined in Section <xref depth="3" refnumber="72-10-401" start="0">72-10-401</xref>, is subject to <xref depth="2" refnumber="72-10-4" start="0">Title 72, Chapter 10, Part 4, Airport <ln numlevel="1" lineno="630" slineno="8-29"/>Zoning Act</xref>.</subsection></section></bsec><bsec buid="16" num="17E-7-402" type="enact" src="code" uid="C17E-7-S402_2026050620260506" sort="17E07 04020020260506" numlevel="1" lineno="631" slineno="9-1" sn="9"><section numlevel="1" lineno="632" slineno="9-2" number="17E-7-402" type="enact"><secline lineno="631">Section 9.
