Section <bold>58-37-8</bold> is amended to read:</secline><catline lineno="39"><bold>58-37-8<parens/>. Prohibited acts -- Penalties -- Defenses -- Dismissal option.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="40" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>Prohibited acts A -- Penalties and reporting:<subsection ssid="3-null-2" dnum="a-o" numlevel="1" lineno="41" slineno="1-4" level="2"><display>(a)</display>Except as authorized by this chapter, and under circumstances not amounting to an <ln numlevel="1" lineno="42" slineno="1-5"/>offense described in Section <xref depth="3" refnumber="58-37-8.1">58-37-8.1</xref>, trafficking of fentanyl or a fentanyl-related <ln numlevel="1" lineno="43" slineno="1-6"/>substance, it is unlawful for a person to knowingly and intentionally:<subsection ssid="3-null-3" dnum="i-o" numlevel="1" lineno="44" slineno="1-7" level="3"><display>(i)</display>produce, manufacture, or dispense, or to possess with intent to produce, <ln numlevel="1" lineno="45" slineno="1-8"/>manufacture, or dispense, a controlled or counterfeit substance;</subsection><subsection ssid="3-null-4" dnum="ii-o" numlevel="1" lineno="46" slineno="1-9" level="3"><display>(ii)</display>distribute a controlled or counterfeit substance, or to agree, consent, offer, or <ln numlevel="1" lineno="47" slineno="1-10"/>arrange to distribute a controlled or counterfeit substance;</subsection><subsection ssid="3-null-5" dnum="iii-o" numlevel="1" lineno="48" slineno="1-11" level="3"><display>(iii)</display>possess a controlled or counterfeit substance with intent to distribute; or</subsection><subsection ssid="3-null-6" dnum="iv-o" numlevel="1" lineno="49" slineno="1-12" level="3"><display>(iv)</display>engage in a continuing criminal enterprise where:<subsection ssid="3-null-7" dnum="A-o" numlevel="1" lineno="50" slineno="1-13" level="4"><display>(A)</display>the person participates, directs, or engages in conduct that results in a <ln numlevel="1" lineno="51" slineno="1-14"/>violation of this chapter, Chapter 37a, Utah Drug Paraphernalia Act, Chapter <ln numlevel="1" lineno="52" slineno="1-15"/>37b, Imitation Controlled Substances Act, Chapter 37c, Utah Controlled <ln numlevel="1" lineno="53" slineno="1-16"/>Substance Precursor Act, or Chapter 37d, Clandestine Drug Lab Act, that is a <ln numlevel="1" lineno="54" slineno="1-17"/>felony; and</subsection><subsection ssid="3-null-8" dnum="B-o" numlevel="1" lineno="55" slineno="1-18" level="4"><display>(B)</display>the violation is a part of a continuing series of two or more violations of this <ln numlevel="1" lineno="56" slineno="1-19"/>chapter, Chapter 37a, Utah Drug Paraphernalia Act, Chapter 37b, Imitation <ln numlevel="1" lineno="57" slineno="1-20"/>Controlled Substances Act, Chapter 37c, Utah Controlled Substance Precursor <ln numlevel="1" lineno="58" slineno="1-21"/>Act, or Chapter 37d, Clandestine Drug Lab Act, on separate occasions that are <ln numlevel="1" lineno="59" slineno="1-22"/>undertaken in concert with five or more persons with respect to whom the <ln numlevel="1" lineno="60" slineno="1-23"/>person occupies a position of organizer, supervisor, or any other position of <ln numlevel="1" lineno="61" slineno="1-24"/>management.</subsection></subsection></subsection><subsection ssid="3-null-9" dnum="b-o" numlevel="1" lineno="62" slineno="1-25" level="2"><display>(b)</display>A person convicted of violating Subsection <xref depth="4" refnumber="58-37-8(1)(a)">(1)(a)</xref> with respect to:<subsection ssid="3-null-10" dnum="i-o" numlevel="1" lineno="63" slineno="1-26" level="3"><display>(i)</display>a substance or a counterfeit of a substance classified in Schedule I or II, a <ln numlevel="1" lineno="64" slineno="1-27"/>controlled substance analog, or gammahydroxybutyric acid as listed in Schedule <ln numlevel="1" lineno="65" slineno="1-28"/>III is guilty of a second degree felony, punishable by imprisonment for not more <ln numlevel="1" lineno="66" slineno="1-29"/>than 15 years, and upon a second or subsequent conviction is guilty of a first <ln numlevel="1" lineno="67" slineno="1-30"/>degree felony;</subsection><subsection ssid="3-null-11" dnum="ii-o" numlevel="1" lineno="68" slineno="1-31" level="3"><display>(ii)</display>a substance or a counterfeit of a substance classified in Schedule III or IV, or <ln numlevel="1" lineno="69" slineno="1-32"/>marijuana, or a substance listed in Section <xref depth="3" refnumber="58-37-4.2">58-37-4.2</xref> is guilty of a third degree <ln numlevel="1" lineno="70" slineno="1-33"/>felony, and upon a second or subsequent conviction is guilty of a second degree <ln numlevel="1" lineno="71" slineno="1-34"/>felony; or</subsection><subsection ssid="3-null-12" dnum="iii-o" numlevel="1" lineno="72" slineno="1-35" level="3"><display>(iii)</display>a substance or a counterfeit of a substance classified in Schedule V is guilty of a <ln numlevel="1" lineno="73" slineno="1-36"/>class A misdemeanor and upon a second or subsequent conviction is guilty of a <ln numlevel="1" lineno="74" slineno="1-37"/>third degree felony.</subsection></subsection><subsection ssid="3-null-13" dnum="c-o" numlevel="1" lineno="75" slineno="1-38" level="2" space="false"><display>(c)</display><subsection ssid="3-null-14" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Except as provided in Subsection <xref depth="4" refnumber="58-37-8(1)(c)(iii)">(1)(c)(iii)</xref>, a person who has been convicted <ln numlevel="1" lineno="76" slineno="1-39"/>of a violation of Subsection <xref depth="4" refnumber="58-37-8(1)(a)(ii)">(1)(a)(ii)</xref> or <xref depth="4" refnumber="58-37-8(iii)">(iii)</xref> may be sentenced to imprisonment <ln numlevel="1" lineno="77" slineno="1-40"/>for an indeterminate term as described in Subsection <xref depth="4" refnumber="58-37-8(1)(c)(ii)">(1)(c)(ii)</xref> and <xref depth="3" refnumber="Title 76, Chapter 3, Punishments">Title 76, <ln numlevel="1" lineno="78" slineno="1-41"/>Chapter 3, Punishments</xref>.</subsection><subsection ssid="3-null-15" dnum="ii-o" numlevel="1" lineno="79" slineno="1-42" level="3"><display>(ii)</display>The court shall impose an indeterminate prison term for a person who has been <ln numlevel="1" lineno="80" slineno="1-43"/>convicted of a violation of Subsection <xref depth="4" refnumber="58-37-8(1)(a)(ii)">(1)(a)(ii)</xref> or <xref depth="4" refnumber="58-37-8(iii)">(iii)</xref> that is a first degree felony <ln numlevel="1" lineno="81" slineno="1-44"/>or a second degree felony if the trier of fact finds beyond a reasonable doubt that, <ln numlevel="1" lineno="82" slineno="1-45"/>during the commission or furtherance of the violation, the person intentionally or <ln numlevel="1" lineno="83" slineno="1-46"/>knowingly:<subsection ssid="3-null-16" dnum="A-o" numlevel="1" lineno="84" slineno="1-47" level="4"><display>(A)</display>used, drew, or exhibited a dangerous weapon, as that term is defined in <ln numlevel="1" lineno="85" slineno="1-48"/>Section <xref depth="3" refnumber="76-11-101">76-11-101</xref>, that is not a firearm, in an angry, threatening, intimidating, <ln numlevel="1" lineno="86" slineno="1-49"/>or coercive manner;</subsection><subsection ssid="3-null-17" dnum="B-o" numlevel="1" lineno="87" slineno="1-50" level="4"><display>(B)</display>used a firearm, as that term is defined in Section <xref depth="3" refnumber="76-11-101">76-11-101</xref>, or had a firearm <ln numlevel="1" lineno="88" slineno="1-51"/>readily accessible for immediate use, as that term is defined in Section <xref depth="3" refnumber="76-11-201"><ln numlevel="1" lineno="89" slineno="1-52"/>76-11-201</xref>; or</subsection><subsection ssid="3-null-18" dnum="C-o" numlevel="1" lineno="90" slineno="1-53" level="4"><display>(C)</display>distributed a firearm, as that term is defined in Section <xref depth="3" refnumber="76-11-101">76-11-101</xref>, or <ln numlevel="1" lineno="91" slineno="1-54"/>possessed a firearm with intent to distribute the firearm.</subsection></subsection><subsection ssid="3-null-19" dnum="iii-o" numlevel="1" lineno="92" slineno="1-55" level="3"><display>(iii)</display>Notwithstanding Subsection <xref depth="4" refnumber="58-37-8(1)(c)(ii)">(1)(c)(ii)</xref>, a court may suspend the indeterminate <ln numlevel="1" lineno="93" slineno="1-56"/>prison term for a person convicted under Subsection <xref depth="4" refnumber="58-37-8(1)(c)(ii)">(1)(c)(ii)</xref> if the court:<subsection ssid="3-null-20" dnum="A-o" numlevel="1" lineno="94" slineno="1-57" level="4"><display>(A)</display>details on the record the reasons why it is in the interests of justice not to <ln numlevel="1" lineno="95" slineno="1-58"/>impose the indeterminate prison term;</subsection><subsection ssid="3-null-21" dnum="B-o" numlevel="1" lineno="96" slineno="1-59" level="4"><display>(B)</display>makes a finding on the record that the person does not pose a significant <ln numlevel="1" lineno="97" slineno="1-60"/>safety risk to the public; and</subsection><subsection ssid="3-null-22" dnum="C-o" numlevel="1" lineno="98" slineno="1-61" level="4"><display>(C)</display>orders the person to complete the terms and conditions of supervised <ln numlevel="1" lineno="99" slineno="1-62"/>probation provided by the Department of Corrections.</subsection></subsection></subsection><subsection ssid="3-null-23" dnum="d-o" numlevel="1" lineno="100" slineno="1-63" level="2" space="false"><display>(d)</display><subsection ssid="3-null-24" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A person convicted of violating Subsection <xref depth="4" refnumber="58-37-8(1)(a)(iv)">(1)(a)(iv)</xref> is guilty of a first degree <ln numlevel="1" lineno="101" slineno="1-64"/>felony punishable by imprisonment for an indeterminate term of not less than:<subsection ssid="3-null-25" dnum="A-o" numlevel="1" lineno="102" slineno="1-65" level="4" tab="1"><display>(A)</display>seven years and which may be for life; or</subsection><subsection ssid="3-null-26" dnum="B-o" numlevel="1" lineno="103" slineno="1-66" level="4" tab="1"><display>(B)</display>15 years and which may be for life if the trier of fact determined that the <ln numlevel="1" lineno="104" slineno="1-67"/>defendant knew or reasonably should have known that any subordinate under <ln numlevel="1" lineno="105" slineno="1-68"/>Subsection <xref depth="4" refnumber="58-37-8(1)(a)(iv)(b)">(1)(a)(iv)(B)</xref> was under 18 years old.</subsection></subsection><subsection ssid="3-null-27" dnum="ii-o" numlevel="1" lineno="106" slineno="1-69" level="3"><display>(ii)</display>Imposition or execution of the sentence may not be suspended, and the person is <ln numlevel="1" lineno="107" slineno="1-70"/>not eligible for probation.</subsection><subsection ssid="3-null-28" dnum="iii-o" numlevel="1" lineno="108" slineno="1-71" level="3"><display>(iii)</display>Subsection <xref depth="4" refnumber="58-37-8(1)(d)(i)(b)">(1)(d)(i)(B)</xref> does not apply to any defendant who, at the time of the <ln numlevel="1" lineno="109" slineno="1-72"/>offense, was under 18 years old.</subsection></subsection><subsection ssid="3-null-29" dnum="e-o" numlevel="1" lineno="110" slineno="1-73" level="2"><display>(e)</display>The Administrative Office of the Courts shall report to the Division of Professional <ln numlevel="1" lineno="111" slineno="1-74"/>Licensing the name, case number, date of conviction, and if known, the date of birth <ln numlevel="1" lineno="112" slineno="1-75"/>of each person convicted of violating Subsection <xref depth="4" refnumber="58-37-8(1)(a)">(1)(a)</xref>.</subsection><subsection ssid="3-null-30" dnum="f-o" numlevel="1" lineno="113" slineno="1-76" level="2" space="false"><display>(f)</display><subsection ssid="3-null-31" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A court shall impose the mandatory jail sentence described in Subsection <xref tempid="154" depth="4" refnumber="58-37-8(1)(f)(ii)"><ln numlevel="1" lineno="114" slineno="1-77"/>(1)(f)(ii)</xref>, and may not suspend any portion of the jail sentence or grant early <ln numlevel="1" lineno="115" slineno="1-78"/>release, if:<subsection ssid="3-null-32" dnum="A-o" numlevel="1" lineno="116" slineno="1-79" level="4" tab="1"><display>(A)</display>the court suspends the imposition of a prison sentence for a felony conviction <ln numlevel="1" lineno="117" slineno="1-80"/>under Subsection <xref depth="4" refnumber="58-37-8(1)(a)">(1)(a)</xref> or sentences a person for a misdemeanor violation of <ln numlevel="1" lineno="118" slineno="1-81"/>an offense under Subsection <xref refnumber="58-37-8(1)(a)" depth="4">(1)(a)</xref>;</subsection><subsection ssid="3-null-33" dnum="B-o" numlevel="1" lineno="119" slineno="1-82" level="4" tab="1" space="false"><display>(B)</display><subsection ssid="3-null-34" dnum="I-o" level="5" placement="sameline"><display>(I)</display>the violation is the person's second or subsequent conviction for any <ln numlevel="1" lineno="120" slineno="1-83"/>level of offense under Subsection <xref refnumber="58-37-8(1)(a)" depth="4">(1)(a)</xref>; or</subsection><subsection ssid="3-null-35" dnum="II-o" numlevel="1" lineno="121" slineno="1-84" level="5"><display>(II)</display>the person previously has been convicted of a criminal violation in another <ln numlevel="1" lineno="122" slineno="1-85"/>jurisdiction, including a state or federal court, that is substantially <ln numlevel="1" lineno="123" slineno="1-86"/>equivalent to the violation of an offense under Subsection <xref refnumber="58-37-8(1)(a)" depth="4">(1)(a)</xref>; and</subsection></subsection><subsection ssid="3-null-36" dnum="C-o" numlevel="1" lineno="124" slineno="1-87" level="4" tab="1"><display>(C)</display>the person previously has been convicted of reentry of a removed alien under <ln numlevel="1" lineno="125" slineno="1-88"/>8 U.S.C. Sec. 1326.</subsection></subsection><subsection ssid="3-null-37" dnum="ii-o" numlevel="1" lineno="126" slineno="1-89" level="3"><display>(ii)</display>The mandatory jail sentences referred to in Subsection <xref tempid="603" depth="4" refnumber="58-37-8(1)(f)(i)">(1)(f)(i)</xref> are:<subsection ssid="3-null-38" dnum="A-o" numlevel="1" lineno="127" slineno="1-90" level="4"><display>(A)</display>for a felony or a class A misdemeanor, 360 days in jail;</subsection><subsection ssid="3-null-39" dnum="B-o" numlevel="1" lineno="128" slineno="1-91" level="4"><display>(B)</display>for a class B misdemeanor, 180 days in jail; and</subsection><subsection ssid="3-null-40" dnum="C-o" numlevel="1" lineno="129" slineno="1-92" level="4"><display>(C)</display>for a class C misdemeanor, 90 days in jail.</subsection></subsection><subsection ssid="3-null-41" dnum="iii-o" numlevel="1" lineno="130" slineno="1-93" level="3" space="false"><display>(iii)</display><subsection ssid="3-null-42" dnum="A-o" level="4" placement="sameline"><display>(A)</display>Except as provided in Subsection <xref depth="4" refnumber="58-37-8(1)(f)(iii)(b)">(1)(f)(iii)(B)</xref>, a person who is subject to <ln numlevel="1" lineno="131" slineno="1-94"/>a mandatory jail sentence under Subsection <xref tempid="130" depth="4" refnumber="58-37-8(1)(f)(i)">(1)(f)(i)</xref> may not be released to the <ln numlevel="1" lineno="132" slineno="1-95"/>federal Immigration and Customs Enforcement Agency of the United States <ln numlevel="1" lineno="133" slineno="1-96"/>Department of Homeland Security for deportation until the person has served <ln numlevel="1" lineno="134" slineno="1-97"/>the entire jail sentence described in Subsection <xref tempid="959" depth="4" refnumber="58-37-8(1)(f)(ii)">(1)(f)(ii)</xref>.</subsection><subsection ssid="3-null-43" dnum="B-o" numlevel="1" lineno="135" slineno="1-98" level="4"><display>(B)</display>A person may be released to the federal Immigration and Customs <ln numlevel="1" lineno="136" slineno="1-99"/>Enforcement Agency of the United States Department of Homeland Security <ln numlevel="1" lineno="137" slineno="1-100"/>for deportation at any time during the 14-day period before the final day of the <ln numlevel="1" lineno="138" slineno="1-101"/>person's jail sentence described in Subsection <xref depth="4" refnumber="58-37-8(1)(f)(ii)">(1)(f)(ii)</xref>.</subsection></subsection></subsection></subsection><subsection ssid="3-null-44" dnum="2-o" numlevel="1" lineno="139" slineno="1-102" level="1"><display>(2)</display>Prohibited acts B -- Penalties and reporting:<subsection ssid="3-null-45" dnum="a-o" numlevel="1" lineno="140" slineno="1-103" level="2"><display>(a)</display>It is unlawful:<subsection ssid="3-null-46" dnum="i-o" numlevel="1" lineno="141" slineno="1-104" level="3"><display>(i)</display>for a person knowingly and intentionally to possess or use a controlled substance <ln numlevel="1" lineno="142" slineno="1-105"/>analog or a controlled substance, unless it was obtained under a valid prescription <ln numlevel="1" lineno="143" slineno="1-106"/>or order, directly from a practitioner while acting in the course of the person's <ln numlevel="1" lineno="144" slineno="1-107"/>professional practice, or as otherwise authorized by this chapter;</subsection><subsection ssid="3-null-47" dnum="ii-o" numlevel="1" lineno="145" slineno="1-108" level="3"><display>(ii)</display>for an owner, tenant, licensee, or person in control of a building, room, tenement, <ln numlevel="1" lineno="146" slineno="1-109"/>vehicle, boat, aircraft, or other place to knowingly and intentionally permit a <ln numlevel="1" lineno="147" slineno="1-110"/>person to occupy the building, room, tenement, vehicle, boat, aircraft, or other <ln numlevel="1" lineno="148" slineno="1-111"/>place while the person is unlawfully manufacturing, possessing, using, or <ln numlevel="1" lineno="149" slineno="1-112"/>distributing a controlled substance at that location; or</subsection><subsection ssid="3-null-48" dnum="iii-o" numlevel="1" lineno="150" slineno="1-113" level="3"><display>(iii)</display>for a person knowingly and intentionally to possess an altered or forged <ln numlevel="1" lineno="151" slineno="1-114"/>prescription or written order for a controlled substance.</subsection></subsection><subsection ssid="3-null-49" dnum="b-o" numlevel="1" lineno="152" slineno="1-115" level="2"><display>(b)</display>A person convicted of violating Subsection <xref depth="4" refnumber="58-37-8(2)(a)(i)">(2)(a)(i)</xref> with respect to:<subsection ssid="3-null-50" dnum="i-o" numlevel="1" lineno="153" slineno="1-116" level="3"><display>(i)</display>marijuana, if the amount is 100 pounds or more, is guilty of a second degree <ln numlevel="1" lineno="154" slineno="1-117"/>felony; or</subsection><subsection ssid="3-null-51" dnum="ii-o" numlevel="1" lineno="155" slineno="1-118" level="3"><display>(ii)</display>a substance classified in Schedule I or II, or a controlled substance analog, is <ln numlevel="1" lineno="156" slineno="1-119"/>guilty of a class A misdemeanor on a first or second conviction, and on a third or <ln numlevel="1" lineno="157" slineno="1-120"/>subsequent conviction if each prior offense was committed within seven years <ln numlevel="1" lineno="158" slineno="1-121"/>before the date of the offense upon which the current conviction is based is guilty <ln numlevel="1" lineno="159" slineno="1-122"/>of a third degree felony.</subsection></subsection><subsection ssid="3-null-52" dnum="c-o" numlevel="1" lineno="160" slineno="1-123" level="2"><display>(c)</display>Upon a person's conviction of a violation of this Subsection <xref depth="4" refnumber="58-37-8(2)">(2)</xref> subsequent to a <ln numlevel="1" lineno="161" slineno="1-124"/>conviction under Subsection <xref depth="4" refnumber="58-37-8(1)(a)">(1)(a)</xref>, that person shall be sentenced to a one degree <ln numlevel="1" lineno="162" slineno="1-125"/>greater penalty than provided in this Subsection <xref depth="4" refnumber="58-37-8(2)">(2)</xref>.</subsection><subsection ssid="3-null-53" dnum="d-o" numlevel="1" lineno="163" slineno="1-126" level="2" space="false"><display>(d)</display><subsection ssid="3-null-54" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A person who violates Subsection <xref depth="4" refnumber="58-37-8(2)(a)(i)">(2)(a)(i)</xref> with respect to all other controlled <ln numlevel="1" lineno="164" slineno="1-127"/>substances not included in Subsection <xref depth="4" refnumber="58-37-8(2)(b)(i)">(2)(b)(i)</xref> or <xref depth="4" refnumber="58-37-8(ii)">(ii)</xref>, including a substance listed <ln numlevel="1" lineno="165" slineno="1-128"/>in Section <xref depth="3" refnumber="58-37-4.2">58-37-4.2</xref>, or marijuana, is guilty of a class B misdemeanor.</subsection><subsection ssid="3-null-55" dnum="ii-o" numlevel="1" lineno="166" slineno="1-129" level="3"><display>(ii)</display>Upon a third conviction the person is guilty of a class A misdemeanor, if each <ln numlevel="1" lineno="167" slineno="1-130"/>prior offense was committed within seven years before the date of the offense <ln numlevel="1" lineno="168" slineno="1-131"/>upon which the current conviction is based.</subsection><subsection ssid="3-null-56" dnum="iii-o" numlevel="1" lineno="169" slineno="1-132" level="3"><display>(iii)</display>Upon a fourth or subsequent conviction the person is guilty of a third degree <ln numlevel="1" lineno="170" slineno="1-133"/>felony if each prior offense was committed within seven years before the date of <ln numlevel="1" lineno="171" slineno="1-134"/>the offense upon which the current conviction is based.</subsection></subsection><subsection ssid="3-null-57" dnum="e-o" numlevel="1" lineno="172" slineno="1-135" level="2"><display>(e)</display>A person convicted of violating Subsection <xref depth="4" refnumber="58-37-8(2)(a)(i)">(2)(a)(i)</xref> while inside the exterior <ln numlevel="1" lineno="173" slineno="1-136"/>boundaries of property occupied by a correctional facility as defined in Section <xref depth="3" refnumber="64-13-1"><ln numlevel="1" lineno="174" slineno="1-137"/>64-13-1</xref> or a public jail or other place of confinement shall be sentenced to a penalty <ln numlevel="1" lineno="175" slineno="1-138"/>one degree greater than provided in Subsection <xref depth="4" refnumber="58-37-8(2)(b)">(2)(b)</xref>, and if the conviction is with <ln numlevel="1" lineno="176" slineno="1-139"/>respect to controlled substances as listed in:<subsection ssid="3-null-58" dnum="i-o" numlevel="1" lineno="177" slineno="1-140" level="3"><display>(i)</display>Subsection <xref depth="4" refnumber="58-37-8(2)(b)">(2)(b)</xref>, the person may be sentenced to imprisonment for an <ln numlevel="1" lineno="178" slineno="1-141"/>indeterminate term as provided by law, and:<subsection ssid="3-null-59" dnum="A-o" numlevel="1" lineno="179" slineno="1-142" level="4"><display>(A)</display>the court shall additionally sentence the person convicted to a term of one year <ln numlevel="1" lineno="180" slineno="1-143"/>to run consecutively and not concurrently; and</subsection><subsection ssid="3-null-60" dnum="B-o" numlevel="1" lineno="181" slineno="1-144" level="4"><display>(B)</display>the court may additionally sentence the person convicted for an indeterminate <ln numlevel="1" lineno="182" slineno="1-145"/>term not to exceed five years to run consecutively and not concurrently; and</subsection></subsection><subsection ssid="3-null-61" dnum="ii-o" numlevel="1" lineno="183" slineno="1-146" level="3"><display>(ii)</display>Subsection <xref depth="4" refnumber="58-37-8(2)(d)">(2)(d)</xref>, the person may be sentenced to imprisonment for an <ln numlevel="1" lineno="184" slineno="1-147"/>indeterminate term as provided by law, and the court shall additionally sentence <ln numlevel="1" lineno="185" slineno="1-148"/>the person convicted to a term of six months to run consecutively and not <ln numlevel="1" lineno="186" slineno="1-149"/>concurrently.</subsection></subsection><subsection ssid="3-null-62" dnum="f-o" numlevel="1" lineno="187" slineno="1-150" level="2"><display>(f)</display>A person convicted of violating Subsection <xref depth="4" refnumber="58-37-8(2)(a)(ii)">(2)(a)(ii)</xref> or <xref depth="4" refnumber="58-37-8(iii)">(iii)</xref> is:<subsection ssid="3-null-63" dnum="i-o" numlevel="1" lineno="188" slineno="1-151" level="3"><display>(i)</display>on a first conviction, guilty of a class B misdemeanor;</subsection><subsection ssid="3-null-64" dnum="ii-o" numlevel="1" lineno="189" slineno="1-152" level="3"><display>(ii)</display>on a second conviction, guilty of a class A misdemeanor; and</subsection><subsection ssid="3-null-65" dnum="iii-o" numlevel="1" lineno="190" slineno="1-153" level="3"><display>(iii)</display>on a third or subsequent conviction, guilty of a third degree felony.</subsection></subsection><subsection ssid="3-null-66" dnum="g-o" numlevel="1" lineno="191" slineno="1-154" level="2"><display>(g)</display>The Administrative Office of the Courts shall report to the Division of Professional <ln numlevel="1" lineno="192" slineno="1-155"/>Licensing the name, case number, date of conviction, and if known, the date of birth <ln numlevel="1" lineno="193" slineno="1-156"/>of each person convicted of violating Subsection <xref depth="4" refnumber="58-37-8(2)(a)">(2)(a)</xref>.</subsection></subsection><subsection ssid="3-null-67" dnum="3-o" numlevel="1" lineno="194" slineno="1-157" level="1"><display>(3)</display>Prohibited acts C -- Penalties:<subsection ssid="3-null-68" dnum="a-o" numlevel="1" lineno="195" slineno="1-158" level="2"><display>(a)</display>It is unlawful for a person knowingly and intentionally:<subsection ssid="3-null-69" dnum="i-o" numlevel="1" lineno="196" slineno="1-159" level="3"><display>(i)</display>to use in the course of the manufacture or distribution of a controlled substance a <ln numlevel="1" lineno="197" slineno="1-160"/>license number which is fictitious, revoked, suspended, or issued to another <ln numlevel="1" lineno="198" slineno="1-161"/>person or, for the purpose of obtaining a controlled substance, to assume the title <ln numlevel="1" lineno="199" slineno="1-162"/>of, or represent oneself to be, a manufacturer, wholesaler, apothecary, physician, <ln numlevel="1" lineno="200" slineno="1-163"/>dentist, veterinarian, or other authorized person;</subsection><subsection ssid="3-null-70" dnum="ii-o" numlevel="1" lineno="201" slineno="1-164" level="3"><display>(ii)</display>to acquire or obtain possession of, to procure or attempt to procure the <ln numlevel="1" lineno="202" slineno="1-165"/>administration of, to obtain a prescription for, to prescribe or dispense to a person <ln numlevel="1" lineno="203" slineno="1-166"/>known to be attempting to acquire or obtain possession of, or to procure the <ln numlevel="1" lineno="204" slineno="1-167"/>administration of a controlled substance by misrepresentation or failure by the <ln numlevel="1" lineno="205" slineno="1-168"/>person to disclose receiving a controlled substance from another source, fraud, <ln numlevel="1" lineno="206" slineno="1-169"/>forgery, deception, subterfuge, alteration of a prescription or written order for a <ln numlevel="1" lineno="207" slineno="1-170"/>controlled substance, or the use of a false name or address;</subsection><subsection ssid="3-null-71" dnum="iii-o" numlevel="1" lineno="208" slineno="1-171" level="3"><display>(iii)</display>to make a false or forged prescription or written order for a controlled substance, <ln numlevel="1" lineno="209" slineno="1-172"/>or to utter the same, or to alter a prescription or written order issued or written <ln numlevel="1" lineno="210" slineno="1-173"/>under the terms of this chapter; or</subsection><subsection ssid="3-null-72" dnum="iv-o" numlevel="1" lineno="211" slineno="1-174" level="3"><display>(iv)</display>to make, distribute, or possess a punch, die, plate, stone, or other thing designed <ln numlevel="1" lineno="212" slineno="1-175"/>to print, imprint, or reproduce the trademark, trade name, or other identifying <ln numlevel="1" lineno="213" slineno="1-176"/>mark, imprint, or device of another or any likeness of any of the foregoing upon <ln numlevel="1" lineno="214" slineno="1-177"/>any drug or container or labeling so as to render a drug a counterfeit controlled <ln numlevel="1" lineno="215" slineno="1-178"/>substance.</subsection></subsection><subsection ssid="3-null-73" dnum="b-o" numlevel="1" lineno="216" slineno="1-179" level="2" space="false"><display>(b)</display><subsection ssid="3-null-74" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A first or second conviction under Subsection <xref depth="4" refnumber="58-37-8(3)(a)(i)">(3)(a)(i)</xref>, <xref refnumber="(3)(a)(ii)" depth="4">(ii)</xref>, or <xref refnumber="(3)(a)(iii)" depth="4">(iii) </xref>is a class A <ln numlevel="1" lineno="217" slineno="1-180"/>misdemeanor.</subsection><subsection ssid="3-null-75" dnum="ii-o" numlevel="1" lineno="218" slineno="1-181" level="3"><display>(ii)</display>A third or subsequent conviction under Subsection <xref depth="4" refnumber="58-37-8(3)(a)(i)">(3)(a)(i)</xref>, <xref refnumber="(3)(a)(ii)" depth="4">(ii)</xref>, or <xref refnumber="(3)(a)(iii)" depth="4">(iii) </xref>is a third <ln numlevel="1" lineno="219" slineno="1-182"/>degree felony.</subsection></subsection><subsection ssid="3-null-76" dnum="c-o" numlevel="1" lineno="220" slineno="1-183" level="2"><display>(c)</display>A violation of Subsection <xref depth="4" refnumber="58-37-8(3)(a)(iv)">(3)(a)(iv)</xref> is a third degree felony.</subsection></subsection><subsection ssid="3-null-77" dnum="4-o" numlevel="1" lineno="221" slineno="1-184" level="1"><display>(4)</display>Prohibited acts D -- Penalties:<subsection ssid="3-null-78" dnum="a-o" numlevel="1" lineno="222" slineno="1-185" level="2"><display>(a)</display>Notwithstanding other provisions of this section, a person not authorized under this <ln numlevel="1" lineno="223" slineno="1-186"/>chapter who commits any act that is unlawful under Subsection <xref depth="4" refnumber="58-37-8(1)(a)">(1)(a)</xref> or Section <xref depth="3" refnumber="58-37b-4"><ln numlevel="1" lineno="224" slineno="1-187"/>58-37b-4</xref> is upon conviction subject to the penalties and classifications under this <ln numlevel="1" lineno="225" slineno="1-188"/>Subsection <xref depth="4" refnumber="58-37-8(4)">(4)</xref> if the trier of fact finds the act is committed:<subsection ssid="3-null-79" dnum="i-o" numlevel="1" lineno="226" slineno="1-189" level="3"><display>(i)</display>in a public or private elementary or secondary school or on the grounds of any of <ln numlevel="1" lineno="227" slineno="1-190"/>those schools during the hours of 6 a.m. through 10 p.m.;</subsection><subsection ssid="3-null-80" dnum="ii-o" numlevel="1" lineno="228" slineno="1-191" level="3"><display>(ii)</display>in a public or private vocational school or postsecondary institution or on the <ln numlevel="1" lineno="229" slineno="1-192"/>grounds of any of those schools or institutions during the hours of 6 a.m. through <ln numlevel="1" lineno="230" slineno="1-193"/>10 p.m.;</subsection><subsection ssid="3-null-81" dnum="iii-o" numlevel="1" lineno="231" slineno="1-194" level="3"><display>(iii)</display>in or on the grounds of a preschool or child-care facility during the preschool's or <ln numlevel="1" lineno="232" slineno="1-195"/>facility's hours of operation;</subsection><subsection ssid="3-null-82" dnum="iv-o" numlevel="1" lineno="233" slineno="1-196" level="3"><display>(iv)</display>in a public park, amusement park, arcade, or recreation center when the public or <ln numlevel="1" lineno="234" slineno="1-197"/>amusement park, arcade, or recreation center is open to the public;</subsection><subsection ssid="3-null-83" dnum="v-o" numlevel="1" lineno="235" slineno="1-198" level="3"><display>(v)</display>in or on the grounds of a house of worship as defined in Section <xref depth="3" refnumber="76-11-201">76-11-201</xref>;</subsection><subsection ssid="3-null-84" dnum="vi-o" numlevel="1" lineno="236" slineno="1-199" level="3"><display>(vi)</display>in or on the grounds of a library when the library is open to the public;</subsection><subsection ssid="3-null-85" dnum="vii-o" numlevel="1" lineno="237" slineno="1-200" level="3"><display>(vii)</display>within an area that is within 100 feet of any structure, facility, or grounds <ln numlevel="1" lineno="238" slineno="1-201"/>included in Subsections <xref depth="4" refnumber="58-37-8(4)(a)(i)">(4)(a)(i)</xref> through <xref depth="4" refnumber="58-37-8(vi)">(vi)</xref>;</subsection><subsection ssid="3-null-86" dnum="viii-o" numlevel="1" lineno="239" slineno="1-202" level="3"><display>(viii)</display>in the presence of a person younger than 18 years old, regardless of where the <ln numlevel="1" lineno="240" slineno="1-203"/>act occurs; or</subsection><subsection ssid="3-null-87" dnum="ix-o" numlevel="1" lineno="241" slineno="1-204" level="3"><display>(ix)</display>for the purpose of facilitating, arranging, or causing the transport, delivery, or <ln numlevel="1" lineno="242" slineno="1-205"/>distribution of a substance in violation of this section to an inmate or on the <ln numlevel="1" lineno="243" slineno="1-206"/>grounds of a correctional facility as defined in Section <xref depth="3" refnumber="76-8-311.3">76-8-311.3</xref>.</subsection></subsection><subsection ssid="3-null-88" dnum="b-o" numlevel="1" lineno="244" slineno="1-207" level="2" space="false"><display>(b)</display><subsection ssid="3-null-89" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A person convicted under this Subsection <xref depth="4" refnumber="58-37-8(4)">(4)</xref> is guilty of a first degree felony <ln numlevel="1" lineno="245" slineno="1-208"/>and shall be imprisoned for a term of not less than five years if the penalty that <ln numlevel="1" lineno="246" slineno="1-209"/>would otherwise have been established but for this Subsection <xref depth="4" refnumber="58-37-8(4)">(4)</xref> would have <ln numlevel="1" lineno="247" slineno="1-210"/>been a first degree felony.</subsection><subsection ssid="3-null-90" dnum="ii-o" numlevel="1" lineno="248" slineno="1-211" level="3"><display>(ii)</display>Imposition or execution of the sentence may not be suspended, and the person is <ln numlevel="1" lineno="249" slineno="1-212"/>not eligible for probation.</subsection></subsection><subsection ssid="3-null-91" dnum="c-o" numlevel="1" lineno="250" slineno="1-213" level="2"><display>(c)</display>If the classification that would otherwise have been established would have been less <ln numlevel="1" lineno="251" slineno="1-214"/>than a first degree felony but for this Subsection <xref depth="4" refnumber="58-37-8(4)">(4)</xref>, a person convicted under this <ln numlevel="1" lineno="252" slineno="1-215"/>Subsection <xref depth="4" refnumber="58-37-8(4)">(4)</xref> is guilty of one degree more than the maximum penalty prescribed for <ln numlevel="1" lineno="253" slineno="1-216"/>that offense.</subsection><subsection ssid="3-null-92" dnum="d-o" numlevel="1" lineno="254" slineno="1-217" level="2" space="false"><display>(d)</display><subsection ssid="3-null-93" dnum="i-o" level="3" placement="sameline"><display>(i)</display>If the violation is of Subsection <xref depth="4" refnumber="58-37-8(4)(a)(ix)">(4)(a)(ix)</xref>:<subsection ssid="3-null-94" dnum="A-o" numlevel="1" lineno="255" slineno="1-218" level="4" tab="1"><display>(A)</display>the person may be sentenced to imprisonment for an indeterminate term as <ln numlevel="1" lineno="256" slineno="1-219"/>provided by law, and the court shall additionally sentence the person convicted <ln numlevel="1" lineno="257" slineno="1-220"/>for a term of one year to run consecutively and not concurrently; and</subsection><subsection ssid="3-null-95" dnum="B-o" numlevel="1" lineno="258" slineno="1-221" level="4" tab="1"><display>(B)</display>the court may additionally sentence the person convicted for an indeterminate <ln numlevel="1" lineno="259" slineno="1-222"/>term not to exceed five years to run consecutively and not concurrently; and</subsection></subsection><subsection ssid="3-null-96" dnum="ii-o" numlevel="1" lineno="260" slineno="1-223" level="3"><display>(ii)</display>the penalties under this Subsection <xref depth="4" refnumber="58-37-8(4)(d)">(4)(d)</xref> apply also to a person who, acting with <ln numlevel="1" lineno="261" slineno="1-224"/>the mental state required for the commission of an offense, directly or indirectly <ln numlevel="1" lineno="262" slineno="1-225"/>solicits, requests, commands, coerces, encourages, or intentionally aids another <ln numlevel="1" lineno="263" slineno="1-226"/>person to commit a violation of Subsection <xref depth="4" refnumber="58-37-8(4)(a)(ix)">(4)(a)(ix)</xref>.</subsection></subsection><subsection ssid="3-null-97" dnum="e-o" numlevel="1" lineno="264" slineno="1-227" level="2"><display>(e)</display>It is not a defense to a prosecution under this Subsection <xref depth="4" refnumber="58-37-8(4)">(4)</xref> that:<subsection ssid="3-null-98" dnum="i-o" numlevel="1" lineno="265" slineno="1-228" level="3"><display>(i)</display>the actor mistakenly believed the individual to be 18 years old or older at the time <ln numlevel="1" lineno="266" slineno="1-229"/>of the offense or was unaware of the individual's true age; or</subsection><subsection ssid="3-null-99" dnum="ii-o" numlevel="1" lineno="267" slineno="1-230" level="3"><display>(ii)</display>the actor mistakenly believed that the location where the act occurred was not as <ln numlevel="1" lineno="268" slineno="1-231"/>described in Subsection <xref depth="4" refnumber="58-37-8(4)(a)">(4)(a)</xref> or was unaware that the location where the act <ln numlevel="1" lineno="269" slineno="1-232"/>occurred was as described in Subsection <xref depth="4" refnumber="58-37-8(4)(a)">(4)(a)</xref>.</subsection></subsection></subsection><subsection ssid="3-null-100" dnum="5-o" numlevel="1" lineno="270" slineno="1-233" level="1"><display>(5)</display>A violation of this chapter for which no penalty is specified is a class B misdemeanor.</subsection><subsection ssid="3-null-101" dnum="6-o" numlevel="1" lineno="271" slineno="1-234" level="1" space="false"><display>(6)</display><subsection ssid="3-null-102" dnum="a-o" level="2" placement="sameline"><display>(a)</display>For purposes of penalty enhancement under Subsections <xref depth="4" refnumber="58-37-8(1)">(1)</xref> and <xref depth="4" refnumber="58-37-8(2)">(2)</xref>, a plea of <ln numlevel="1" lineno="272" slineno="1-235"/>guilty or no contest to a violation or attempted violation of this section or a plea <ln numlevel="1" lineno="273" slineno="1-236"/>which is held in abeyance under Title 77, Chapter 2a, Pleas in Abeyance, is the <ln numlevel="1" lineno="274" slineno="1-237"/>equivalent of a conviction, even if the charge has been subsequently reduced or <ln numlevel="1" lineno="275" slineno="1-238"/>dismissed in accordance with the plea in abeyance agreement.</subsection><subsection ssid="3-null-103" dnum="b-o" numlevel="1" lineno="276" slineno="1-239" level="2"><display>(b)</display>A prior conviction used for a penalty enhancement under Subsection <xref depth="4" refnumber="58-37-8(2)">(2)</xref> shall be a <ln numlevel="1" lineno="277" slineno="1-240"/>conviction that is:<subsection ssid="3-null-104" dnum="i-o" numlevel="1" lineno="278" slineno="1-241" level="3"><display>(i)</display>from a separate criminal episode than the current charge; and</subsection><subsection ssid="3-null-105" dnum="ii-o" numlevel="1" lineno="279" slineno="1-242" level="3"><display>(ii)</display>from a conviction that is separate from any other conviction used to enhance the <ln numlevel="1" lineno="280" slineno="1-243"/>current charge.</subsection></subsection></subsection><subsection ssid="3-null-106" dnum="7-o" numlevel="1" lineno="281" slineno="1-244" level="1"><display>(7)</display>A person may be charged and sentenced for a violation of this section, notwithstanding <ln numlevel="1" lineno="282" slineno="1-245"/>a charge and sentence for a violation of any other section of this chapter.</subsection><subsection ssid="3-null-107" dnum="8-o" numlevel="1" lineno="283" slineno="1-246" level="1" space="false"><display>(8)</display><subsection ssid="3-null-108" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A penalty imposed for violation of this section is in addition to, and not in lieu of, <ln numlevel="1" lineno="284" slineno="1-247"/>a civil or administrative penalty or sanction authorized by law.</subsection><subsection ssid="3-null-109" dnum="b-o" numlevel="1" lineno="285" slineno="1-248" level="2"><display>(b)</display>When a violation of this chapter violates a federal law or the law of another state, <ln numlevel="1" lineno="286" slineno="1-249"/>conviction or acquittal under federal law or the law of another state for the same act <ln numlevel="1" lineno="287" slineno="1-250"/>is a bar to prosecution in this state.</subsection></subsection><subsection ssid="3-null-110" dnum="9-o" numlevel="1" lineno="288" slineno="1-251" level="1"><display>(9)</display>In any prosecution for a violation of this chapter, evidence or proof that shows a person <ln numlevel="1" lineno="289" slineno="1-252"/>or persons produced, manufactured, possessed, distributed, or dispensed a controlled <ln numlevel="1" lineno="290" slineno="1-253"/>substance or substances, is prima facie evidence that the person or persons did so with <ln numlevel="1" lineno="291" slineno="1-254"/>knowledge of the character of the substance or substances.</subsection><subsection ssid="3-null-111" dnum="10-o" numlevel="1" lineno="292" slineno="1-255" level="1"><display>(10)</display>This section does not prohibit a veterinarian, in good faith and in the course of the <ln numlevel="1" lineno="293" slineno="1-256"/>veterinarian's professional practice only and not for humans, from prescribing, <ln numlevel="1" lineno="294" slineno="1-257"/>dispensing, or administering controlled substances or from causing the substances to be <ln numlevel="1" lineno="295" slineno="1-258"/>administered by an assistant or orderly under the veterinarian's direction and supervision.</subsection><subsection ssid="3-null-112" dnum="11-o" numlevel="1" lineno="296" slineno="1-259" level="1"><display>(11)</display>Civil or criminal liability may not be imposed under this section on:<subsection ssid="3-null-113" dnum="a-o" numlevel="1" lineno="297" slineno="1-260" level="2"><display>(a)</display>a person registered under this chapter who manufactures, distributes, or possesses an <ln numlevel="1" lineno="298" slineno="1-261"/>imitation controlled substance for use as a placebo or investigational new drug by a <ln numlevel="1" lineno="299" slineno="1-262"/>registered practitioner in the ordinary course of professional practice or research;</subsection><subsection ssid="3-null-114" dnum="b-o" numlevel="1" lineno="300" slineno="1-263" level="2"><display>(b)</display>a law enforcement officer acting in the course and legitimate scope of the officer's <ln numlevel="1" lineno="301" slineno="1-264"/>employment; or</subsection><subsection ssid="3-null-115" dnum="c-o" numlevel="1" lineno="302" slineno="1-265" level="2"><display>(c)</display>a healthcare facility, substance use harm reduction services program, or drug <ln numlevel="1" lineno="303" slineno="1-266"/>addiction treatment facility that temporarily possesses a controlled or counterfeit <ln numlevel="1" lineno="304" slineno="1-267"/>substance to conduct a test or analysis on the controlled or counterfeit substance to <ln numlevel="1" lineno="305" slineno="1-268"/>identify or analyze the strength, effectiveness, or purity of the substance for a public <ln numlevel="1" lineno="306" slineno="1-269"/>health or safety reason.</subsection></subsection><subsection ssid="3-null-116" dnum="12-o" numlevel="1" lineno="307" slineno="1-270" level="1" space="false"><display>(12)</display><subsection ssid="3-null-117" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Civil or criminal liability may not be imposed under this section on any Indian, <ln numlevel="1" lineno="308" slineno="1-271"/>as defined in Section <xref depth="3" refnumber="58-37-2">58-37-2</xref>, who uses, possesses, or transports peyote for bona fide <ln numlevel="1" lineno="309" slineno="1-272"/>traditional ceremonial purposes in connection with the practice of a traditional Indian <ln numlevel="1" lineno="310" slineno="1-273"/>religion as defined in Section <xref depth="3" refnumber="58-37-2">58-37-2</xref>.</subsection><subsection ssid="3-null-118" dnum="b-o" numlevel="1" lineno="311" slineno="1-274" level="2"><display>(b)</display>In a prosecution alleging violation of this section regarding peyote as defined in <ln numlevel="1" lineno="312" slineno="1-275"/>Section <xref depth="3" refnumber="58-37-4">58-37-4</xref>, it is an affirmative defense that the peyote was used, possessed, or <ln numlevel="1" lineno="313" slineno="1-276"/>transported by an Indian for bona fide traditional ceremonial purposes in connection <ln numlevel="1" lineno="314" slineno="1-277"/>with the practice of a traditional Indian religion.</subsection><subsection ssid="3-null-119" dnum="c-o" numlevel="1" lineno="315" slineno="1-278" level="2" space="false"><display>(c)</display><subsection ssid="3-null-120" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The defendant shall provide written notice of intent to claim an affirmative <ln numlevel="1" lineno="316" slineno="1-279"/>defense under this Subsection <xref depth="4" refnumber="58-37-8(12)">(12)</xref> as soon as practicable, but not later than 10 <ln numlevel="1" lineno="317" slineno="1-280"/>days before trial.</subsection><subsection ssid="3-null-121" dnum="ii-o" numlevel="1" lineno="318" slineno="1-281" level="3"><display>(ii)</display>The notice shall include the specific claims of the affirmative defense.</subsection><subsection ssid="3-null-122" dnum="iii-o" numlevel="1" lineno="319" slineno="1-282" level="3"><display>(iii)</display>The court may waive the notice requirement in the interest of justice for good <ln numlevel="1" lineno="320" slineno="1-283"/>cause shown, if the prosecutor is not unfairly prejudiced by the lack of timely <ln numlevel="1" lineno="321" slineno="1-284"/>notice.</subsection></subsection><subsection ssid="3-null-123" dnum="d-o" numlevel="1" lineno="322" slineno="1-285" level="2"><display>(d)</display>The defendant shall establish the affirmative defense under this Subsection <xref depth="4" refnumber="58-37-8(12)">(12)</xref> by a <ln numlevel="1" lineno="323" slineno="1-286"/>preponderance of the evidence.  If the defense is established, it is a complete defense <ln numlevel="1" lineno="324" slineno="1-287"/>to the charges.</subsection></subsection><subsection ssid="3-null-124" dnum="13-o" numlevel="1" lineno="325" slineno="1-288" level="1" space="false"><display>(13)</display><subsection ssid="3-null-125" dnum="a-o" level="2" placement="sameline"><display>(a)</display>It is an affirmative defense that the person produced, possessed, or administered <ln numlevel="1" lineno="326" slineno="1-289"/>a controlled substance listed in Section <xref depth="3" refnumber="58-37-4.2">58-37-4.2</xref> if the person was:<subsection ssid="3-null-126" dnum="i-o" numlevel="1" lineno="327" slineno="1-290" level="3" tab="1"><display>(i)</display>engaged in medical research; and</subsection><subsection ssid="3-null-127" dnum="ii-o" numlevel="1" lineno="328" slineno="1-291" level="3" tab="1"><display>(ii)</display>a holder of a valid license to possess controlled substances under Section <xref depth="3" refnumber="58-37-6">58-37-6</xref>.</subsection></subsection><subsection ssid="3-null-128" dnum="b-o" numlevel="1" lineno="329" slineno="1-292" level="2"><display>(b)</display>It is not a defense under Subsection <xref depth="4" refnumber="58-37-8(13)(a)">(13)(a)</xref> that the person prescribed or dispensed a <ln numlevel="1" lineno="330" slineno="1-293"/>controlled substance listed in Section <xref depth="3" refnumber="58-37-4.2">58-37-4.2</xref>.</subsection></subsection><subsection ssid="3-null-129" dnum="14-o" numlevel="1" lineno="331" slineno="1-294" level="1"><display>(14)</display>It is an affirmative defense that the person possessed, in the person's body, a controlled <ln numlevel="1" lineno="332" slineno="1-295"/>substance listed in Section <xref depth="3" refnumber="58-37-4.2">58-37-4.2</xref> if:<subsection ssid="3-null-130" dnum="a-o" numlevel="1" lineno="333" slineno="1-296" level="2"><display>(a)</display>the person was the subject of medical research conducted by a holder of a valid <ln numlevel="1" lineno="334" slineno="1-297"/>license to possess controlled substances under Section <xref depth="3" refnumber="58-37-6">58-37-6</xref>; and</subsection><subsection ssid="3-null-131" dnum="b-o" numlevel="1" lineno="335" slineno="1-298" level="2"><display>(b)</display>the substance was administered to the person by the medical researcher.</subsection></subsection><subsection ssid="3-null-132" dnum="15-o" numlevel="1" lineno="336" slineno="1-299" level="1"><display>(15)</display>The application of any increase in penalty under this section to a violation of <ln numlevel="1" lineno="337" slineno="1-300"/>Subsection <xref depth="4" refnumber="58-37-8(2)(a)(i)">(2)(a)(i)</xref> may not result in any greater penalty than a second degree felony. <ln numlevel="1" lineno="338" slineno="1-301"/>This Subsection <xref depth="4" refnumber="58-37-8(15)">(15)</xref> takes precedence over any conflicting provision of this section.</subsection><subsection ssid="3-null-133" dnum="16-o" numlevel="1" lineno="339" slineno="1-302" level="1" space="false"><display>(16)</display><subsection ssid="3-null-134" dnum="a-o" level="2" placement="sameline"><display>(a)</display><amend anum="0" ea="amend" pairid="15" groupid="13" style="1" owner="ahaskell" level="1" amendtag="both">As used in this Subsection <xref depth="4" refnumber="58-37-8(16)">(16)</xref>:</amend><subsection ssid="3-155" dnum="_-o:i-i" numlevel="1" lineno="340" slineno="1-303" ea="amend" anum="0" owner="ahaskell" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1134" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="15" style="1" owner="ahaskell" level="1" amendtag="end">"Emergency medical service provider" means the same as that term is defined in <ln numlevel="1" lineno="341" slineno="1-304"/>Section <xref depth="3" refnumber="53-2d-101">53-2d-101</xref>.</amend></subsection><subsection ssid="3-156" dnum="_-o:ii-i" numlevel="1" lineno="342" slineno="1-305" ea="amend" anum="0" owner="ahaskell" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1135" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="20" groupid="17" style="1" owner="ahaskell" level="1" amendtag="end">"Overdosing victim" means the same as that term is defined in Section <xref depth="3" refnumber="76-3-203.11"><ln numlevel="1" lineno="343" slineno="1-306"/>76-3-203.11</xref>.</amend></subsection></subsection><subsection ssid="3-152" dnum="_-o:b-i" numlevel="1" lineno="344" slineno="1-307" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1136" style="1" owner="i" level="1" amendtag="both">(b)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="26" groupid="22" style="2" owner="ahaskell" level="1" deltag="both">It is</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="24" groupid="20" style="1" owner="ahaskell" level="1" amendtag="both" space="true">Subject to Subsection <xref depth="4" refnumber="58-37-8(16)(e)">(16)(e)</xref>, an individual may assert</amend> an affirmative defense <ln numlevel="1" lineno="345" slineno="1-308"/>to an allegation of the commission of an offense listed in <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="31" groupid="27" style="2" owner="ahaskell" level="1" deltag="both">Subsection <xref depth="4" refnumber="58-37-8(16)(b)">(16)(b)</xref> that the <ln numlevel="1" lineno="346" slineno="1-309"/>person or bystander</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="ahaskell" level="1" amendtag="both" space="true">Subsection <xref depth="4" refnumber="58-37-8(16)(c)">(16)(c)</xref> if, in the same course of events in which the <ln numlevel="1" lineno="347" slineno="1-310"/>offense was committed, the individual</amend>:<subsection ssid="3-null-135" dnum="i-o" numlevel="1" lineno="348" slineno="1-311" level="3"><display>(i)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="102" groupid="91" style="2" owner="ahaskell" level="1" deltag="both">reasonably believes that the person or another person is experiencing an overdose <ln numlevel="1" lineno="349" slineno="1-312"/>event due to the ingestion, injection, inhalation, or other introduction into the <ln numlevel="1" lineno="350" slineno="1-313"/>human body of a controlled substance or other substance;</amend><amendoutend style="2"/><subsection ssid="3-null-136" dnum="ii-o:A-i" numlevel="1" lineno="351" slineno="1-314" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1138" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1139" style="1" owner="i" level="1" amendtag="start" space="true">(A)</amend></display><amend anum="0" ea="amend" pairid="230" groupid="186" style="1" owner="ahaskell" level="1" amendtag="end">reasonably believes that another individual is an overdosing victim;</amend></subsection><subsection ssid="3-174" dnum="_-o:B-i" numlevel="1" lineno="352" slineno="1-315" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1139" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" defined in Section <xref depth="3" refnumber="53-2d-101">53-2d-101</xref></amend><amendoutend style="2"/>, a law <ln numlevel="1" lineno="356" slineno="1-319"/>enforcement officer, a 911 emergency call system, or an emergency dispatch <ln numlevel="1" lineno="357" slineno="1-320"/>system<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="194" groupid="157" style="2" owner="ahaskell" level="1" deltag="both">, or the person is the subject of a report made under this Subsection <xref depth="4" refnumber="58-37-8(16)">(16)</xref></amend><amendoutend style="2"/>;<subsection deltag="both">person's</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="77" groupid="68" style="1" owner="ahaskell" level="1" amendtag="both" space="true">overdosing victim's</amend> body; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="163" groupid="132" style="2" owner="ahaskell" level="1" deltag="both">and</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="3-null-140" dnum="vi-o:_-i" numlevel="1" lineno="373" slineno="1-336" ea="erase" anum="0" owner="ahaskell" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1144" style="2" owner="o" level="1" deltag="start">(vi)</amend></display><amend anum="0" ea="erase" pairid="164" level="3" space="false"><display><amend anum="0" ea="amend" pairid="1145" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><subsection ssid="3-166" dnum="_-o:A-i" ea="amend" anum="0" owner="ahaskell" style="1" level="4" placement="sameline"><display><amend anum="0" ea="amend" pairid="1146" style="1" owner="i" level="1">(A)</amend></display><amend anum="0" ea="amend" pairid="169" groupid="137" style="1" owner="ahaskell" level="1" amendtag="end">reasonably believes that another individual is an overdosing victim and <ln numlevel="1" lineno="376" ssid="3-169" dnum="_-o:B-i" numlevel="1" lineno="378" slineno="1-341" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1147" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="192" groupid="155" style="1" owner="ahaskell" level="1" amendtag="end">remains at the location of the overdosing victim until a responding law <ln numlevel="1" lineno="379" slineno="1-342"/>enforcement officer or emergency medical service provider arrives, or remains <ln numlevel="1" lineno="380" slineno="1-343"/>at the medical care facility where the overdosing victim is located until a <ln numlevel="1" lineno="381" slineno="1-344"/>responding law enforcement officer arrives; pairid="1148" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="180" groupid="145" style="1" owner="ahaskell" level="1" amendtag="end">cooperates with the responding medical provider, emergency medical service <ln numlevel="1" lineno="383" slineno="1-346"/>provider, and law enforcement officer, including providing information <ln numlevel="1" lineno="384" slineno="1-347"/>regarding the overdosing victim and any substances the overdosing victim may <ln numlevel="1" lineno="385" slineno="1-348"/>have injected, inhaled, or otherwise introduced into the overdosing victim's <ln numlevel="1" lineno="386" slineno="1-349"/>body; or</amend></subsection></subsection><subsection ssid="3-168" dnum="_-o:iii-i" numlevel="1" lineno="387" slineno="1-350" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1149" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="186" groupid="150" style="1" owner="ahaskell" level="1" amendtag="end">is the overdosing victim described in Subsection <xref depth="4" refnumber="58-37-8(16)(b)(i)">(16)(b)(i)</xref> or <xref depth="4" refnumber="58-37-8(ii)">(ii)</xref>.</amend></subsection></subsection><subsection ssid="3-null-141" dnum="b-o:c-i" numlevel="1" lineno="388" slineno="1-351" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1150" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1151" style="1" owner="i" level="1" amendtag="both" space="true">(c)</amend></display>The offenses referred to in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="197" groupid="160" style="2" owner="ahaskell" level="1" deltag="both"><xref depth="4" refnumber="58-37-8(16)(a)">(16)(a)</xref></amend><amendoutend style="2"/><amend anum="0" ssid="3-170" dnum="_-o:e-i" numlevel="1" lineno="400" slineno="1-363" ea="amend" anum="0" owner="ahaskell" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1155" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><subsection ssid="3-177" dnum="_-o:i-i" ea="amend" anum="0" owner="ahaskell" style="1" level="3" placement="sameline"><display><amend anum="0" owner="ahaskell" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1159" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="213" groupid="173" style="1" owner="ahaskell" level="1" amendtag="end">after the day of the offense, but before the day on which the case is <ln numlevel="1" lineno="407" slineno="1-370"/>adjudicated, the individual provides proof of a substance abuse evaluation and <ln numlevel="1" lineno="408" slineno="1-371"/>the completion of any recommended treatment.</amend></subsection></subsection><subsection ssid="3-178" dnum="_-o:ii-i" numlevel="1" lineno="409" slineno="1-372" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1160" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="245" groupid="198" style="1" owner="ahaskell" level="1" amendtag="end">An individual described in Subsection <xref depth="4" refnumber="58-37-8(16)(e)(i)">(16)(e)(i)</xref> may request a delay in the <ln numlevel="1" lineno="410" slineno="1-373"/>individual's adjudication in order to have time to complete any requirements <ln numlevel="1" lineno="411" slineno="1-374"/>described in Subsection <xref depth="4" refnumber="58-37-8(16)(e)(i)(c)">(16)(e)(i)(C)</xref>.</amend></subsection></subsection></subsection><subsection ssid="3-null-146" dnum="17-o" numlevel="1" lineno="412" slineno="1-375" level="1"><display>(17)</display>If any provision of this chapter, or the application of any provision to any person or <ln numlevel="1" lineno="413" slineno="1-376"/>circumstances, is held invalid, the remainder of this chapter shall be given effect without <ln numlevel="1" lineno="414" slineno="1-377"/>the invalid provision or application.</subsection><subsection ssid="3-null-147" dnum="18-o" numlevel="1" lineno="415" slineno="1-378" level="1"><display>(18)</display>A legislative body of a political subdivision may not enact an ordinance that is less <ln numlevel="1" lineno="416" slineno="1-379"/>restrictive than any provision of this chapter.</subsection><subsection ssid="3-null-148" dnum="19-o" numlevel="1" lineno="417" slineno="1-380" level="1"><display>(19)</display>If a minor who is under 18 years old is found by a court to have violated this section or <ln numlevel="1" lineno="418" slineno="1-381"/>Subsection <xref depth="4" refnumber="76-5-102.1(2)(b)">76-5-102.1(2)(b)</xref> or <xref depth="4" refnumber="76-5-207(2)(b)">76-5-207(2)(b)</xref>, the court may order the minor to <ln numlevel="1" lineno="419" slineno="1-382"/>complete:<subsection ssid="3-null-149" dnum="a-o" numlevel="1" lineno="420" slineno="1-383" level="2"><display>(a)</display>a screening as defined in Section <xref depth="3" refnumber="41-6a-501">41-6a-501</xref>;</subsection><subsection ssid="3-null-150" dnum="b-o" numlevel="1" lineno="421" slineno="1-384" level="2"><display>(b)</display>an assessment as defined in Section <xref depth="3" refnumber="41-6a-501">41-6a-501</xref> if the screening indicates an <ln numlevel="1" lineno="422" slineno="1-385"/>assessment to be appropriate; and</subsection><subsection ssid="3-null-151" dnum="c-o" numlevel="1" lineno="423" slineno="1-386" level="2"><display>(c)</display>an educational series as defined in Section <xref depth="3" refnumber="41-6a-501">41-6a-501</xref> or substance use disorder <ln numlevel="1" lineno="424" slineno="1-387"/>treatment as indicated by an assessment.</subsection></subsection></section></bsec><bsec buid="1" num="76-3-203.11" type="amend" src="code" uid="C76-3-S203.11_1800010118000101" sort="76 03 02031118000101" numlevel="1" lineno="425" slineno="2-1" sn="2"><section number="76-3-203.11" numlevel="1" lineno="426" slineno="2-2" type="amend"><secline lineno="425">Section 2. Section <bold>76-3-203.11</bold> is amended to read:</secline><catline lineno="426"><bold>76-3-203.11<parens/>. Reporting an overdose or being the victim of a reported overdose -- <ln numlevel="1" lineno="427" slineno="2-3"/>Mitigating factor.</bold></catline><subsection ssid="1-7" dnum="_-o:1-i" numlevel="1" lineno="428" slineno="2-4" ea="amend" anum="0" owner="ahaskell" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1167" style="1" owner="i" level="1" amendtag="both">(1)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="4" groupid="4" style="2" owner="ahaskell" level="1" deltag="both"><tab/>It is a mitigating factor in sentencing for an offense under <xref depth="1" refnumber="58-37" start="0">Title 58, Chapter 37, Utah <ln numlevel="1" lineno="429" slineno="2-5"/>Controlled Substances Act</xref>, that the person or bystander:</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="195" groupid="165" style="1" owner="ahaskell" level="1" amendtag="both" space="true">As used in this pairid="1168" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="49" groupid="43" style="1" owner="ahaskell" level="1" amendtag="end">"Emergency medical service provider" means the same as that term is defined in <ln numlevel="1" lineno="431" slineno="2-7"/>Section <xref depth="3" refnumber="53-2d-101">53-2d-101</xref>.</amend></subsection><subsection ssid="1-13" dnum="_-o:b-i" numlevel="1" lineno="432" slineno="2-8" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1169" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="55" groupid="48" style="1" owner="ahaskell" level="1" amendtag="end">"Overdosing victim" means an individual who is, or appears to be, experiencing an <ln numlevel="1" lineno="433" slineno="2-9"/>overdose event due to the ingestion, injection, inhalation, or other introduction into <ln numlevel="1" lineno="434" slineno="2-10"/>the human body of a controlled substance or other substance.</amend></subsection></subsection><subsection ssid="1-8" dnum="_-o:2-i" numlevel="1" lineno="435" slineno="2-11" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1170" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="13" groupid="11" style="1" owner="ahaskell" level="1" amendtag="end">An individual may assert a mitigating factor at sentencing if:</amend><subsection ssid="1-9" dnum="_-o:a-i" numlevel="1" lineno="436" slineno="2-12" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1171" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="24" groupid="21" style="1" owner="ahaskell" level="1" amendtag="end">the individual is being sentenced for an offense under Title 58, Chapter 37, Utah <ln numlevel="1" lineno="437" slineno="2-13"/>Controlled Substances Act; and</amend></subsection><subsection ssid="1-25" dnum="_-o:b-i" numlevel="1" lineno="438" slineno="2-14" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1172" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="153" groupid="130" style="1" owner="ahaskell" level="1" amendtag="end">in the same course of events in which the offense described in Subsection <xref depth="4" refnumber="76-3-203.11(2)(a)">(2)(a)</xref> was <ln numlevel="1" lineno="439" slineno="2-15"/>committed, the individual:</amend><subsection ssid="1-null-1" dnum="1-o:_-i" numlevel="1" lineno="440" slineno="2-16" ea="erase" anum="0" owner="ahaskell" style="2" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1173" style="2" owner="o" level="1" deltag="start">(1)</amend></display><amend anum="0" ea="erase" pairid="155" groupid="132" style="2" owner="ahaskell" level="1" deltag="end">reasonably believes that the person or another person is experiencing an overdose event <ln numlevel="1" lineno="441" slineno="2-17"/>due to the ingestion, injection, inhalation, or other introduction into the human body of a <ln numlevel="1" lineno="442" slineno="2-18"/>controlled substance or other substance;</amend><amendoutend style="2"/></subsection><subsection ssid="1-null-2" dnum="2-o:i-i" numlevel="1" lineno="443" slineno="2-19" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1174" style="2" owner="o" level="1" deltag="both">(2)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1175" style="1" owner="i" level="1" amendtag="both" space="true">(i)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="158" groupid="135" style="2" owner="ahaskell" level="1" deltag="both">reports, or assists a person who reports, in good faith the overdose event </amend><amendoutend style="2"/><subsection ssid="1-26" dnum="_-o:A-i" numlevel="1" lineno="444" slineno="2-20" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1175" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="194" groupid="164" style="1" owner="ahaskell" level="1" amendtag="end">reasonably believes that another individual is an overdosing victim;</amend></subsection><subsection ssid="1-29" dnum="_-o:B-i" numlevel="1" lineno="445" slineno="2-21" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1176" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend reports, or assists with the <ln numlevel="1" lineno="446" slineno="2-22"/>reporting of, the need for assistance for the overdosing victim </amend>to a medical <ln numlevel="1" lineno="447" slineno="2-23"/>provider, an emergency medical service provider<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="78" groupid="70" style="2" owner="ahaskell" level="1" deltag="both"> as defined in Section <xref depth="3" refnumber="53-2d-101" start="0"><ln numlevel="1" lineno="448" slineno="2-24"/>53-2d-101</xref></amend><amendoutend style="2"/>, a law enforcement officer, a 911 emergency call system, or an <ln numlevel="1" lineno="449" slineno="2-25"/>emergency dispatch system<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="80" groupid="72" style="2" owner="ahaskell" level="1" deltag="both">, or the person is the subject of a report made <ln numlevel="1" lineno="450" slineno="2-26"/>under this section</amend><amendoutend introduced into the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="90" groupid="82" style="2" owner="ahaskell" level="1" deltag="both">person's</amend><amendoutend style="2"/><amend slineno="2-43" ea="amend" anum="0" owner="ahaskell" style="1" level="3" space="false"><display><amend anum="0" ea="amend" pairid="1181" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><subsection ssid="1-30" dnum="_-o:A-i" ea="amend" anum="0" owner="ahaskell" style="1" level="4" placement="sameline"><display><amend anum="0" ea="amend" pairid="1182" style="1" owner="i" level="1">(A)</amend></display><amend anum="0" ea="amend" pairid="187" groupid="158" style="1" owner="ahaskell" level="1" amendtag="end">reasonably believes that another individual is an overdosing victim and <ln numlevel="1" lineno="468" slineno="2-44"/>knows that a request for assistance for the overdosing victim is being made or <ln numlevel="1" lineno="469" slineno="2-45"/>has been made;</amend></subsection><subsection ssid="1-19" dnum="_-o:B-i" numlevel="1" lineno="470" slineno="2-46" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1183" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="117" groupid="103" style="1" owner="ahaskell" level="1" amendtag="end">remains at the location of the overdosing victim until a responding law <ln numlevel="1" lineno="471" slineno="2-47"/>enforcement officer or emergency medical service provider arrives, or remains <ln numlevel="1" lineno="472" slineno="2-48"/>at the medical care facility where the overdosing victim is located until a <ln numlevel="1" lineno="473" owner="ahaskell" level="1" amendtag="end">cooperates with the responding medical provider, emergency medical service <ln numlevel="1" lineno="475" slineno="2-51"/>provider, and law enforcement officer, including providing information <ln numlevel="1" lineno="476" slineno="2-52"/>regarding the overdosing victim and any substances the overdosing victim may <ln numlevel="1" lineno="477" slineno="2-53"/>have injected, inhaled, or otherwise introduced into the overdosing victim's <ln numlevel="1" lineno="478" slineno="2-54"/>body; or</amend></subsection></subsection><subsection ssid="1-14" dnum="_-o:iii-i" numlevel="1" lineno="479" slineno="2-55" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1185" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="95" groupid="86" style="1" owner="ahaskell" level="1" amendtag="end">is the overdosing victim described in Subsection <xref depth="4" refnumber="76-3-203.11(2)(b)(i)">(2)(b)(i)</xref> or <xref depth="4" refnumber="76-3-203.11(ii)">(ii)</xref>.</amend></subsection></subsection></subsection><subsection ssid="1-27" dnum="_-o:3-i" numlevel="1" lineno="480" slineno="2-56" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1186" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="172" groupid="145" style="1" owner="ahaskell" level="1" amendtag="end">An individual's request for medical assistance for an overdosing victim during the <ln numlevel="1" lineno="481" slineno="2-57"/>course of a law enforcement agency's execution of a search warrant, execution of an <ln numlevel="1" lineno="482" slineno="2-58"/>arrest warrant, or other lawful search is not a good faith report under Subsection <xref depth="4" refnumber="76-3-203.11(2)(b)(i)(b)"><ln numlevel="1" lineno="483" slineno="2-59"/>(2)(b)(i)(B)</xref>.</amend></subsection></section></bsec><bsec buid="16" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="484" slineno="3-1" sn="3"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="484">Section 3.  <bold>Effective Date.</bold></secline><sectionText lineno="485"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="ahaskell" level="1" amendtag="both">This bill takes effect:</amend></sectionText><subsection ssid="16-1" numlevel="1" lineno="486" amendtag="end">without the governor's signature, the day following the constitutional time limit of <ln numlevel="1" lineno="490" slineno="3-7"/>Utah Constitution, Article VII, Section 8; or</amend></subsection><subsection ssid="16-5" numlevel="1" lineno="491" slineno="3-8" dnum="_-o:c-i" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1191" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="18" groupid="13" style="1" owner="ahaskell" level="1" amendtag="end">in the case of a veto, the date of veto override.</amend></subsection></subsection></section></bsec><bsec buid="14" type="uncod" untype="coord" src="uncod" uid="CRD0000" sort="UZT00000" langlock="false" numlevel="1" lineno="492" slineno="4-1" sn="4"><section ccsum="true" type="uncod" untype="coord" display="false" src="uncod"><secline lineno="492">Section 4.  <bold>Coordinating H.B. 295 with H.B. 301.</bold></secline><sectionText lineno="493"><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="ahaskell" level="1" amendtag="both">If H.B. 295, Overdose Amendments, and H.B. 301, Drug Recodification, both pass and <ln numlevel="1" lineno="494" slineno="4-3"/>become law, the Legislature intends that, on May 6, 2026:<eol numlevel="1" lineno="495" slineno="4-4"/>(1) Section 76-3-203.11 in H.B. 295 and H.B. 301 be amended to read:<eol numlevel="1" lineno="496" slineno="4-5"/>"(1) </amend><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="15" groupid="14" style="2" owner="ahaskell" level="1" deltag="both">It is a mitigating factor in sentencing for an offense under Title 58, Chapter 37, Utah <ln numlevel="1" lineno="497" slineno="4-6"/>Controlled Substances Act, that the person or bystander</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="14" groupid="13" style="1" owner="ahaskell" level="1" amendtag="both" space="true">As used in this section</amend>:<amend anum="0" ea="amend" pairid="13" groupid="12" style="1" owner="ahaskell" level="1" amendtag="both"><eol numlevel="1" lineno="498" slineno="4-7"/><para/>(a) "Emergency medical service provider" means the same as that term is defined in <ln numlevel="1" lineno="499" slineno="4-8"/>Section 53-2d-101.<eol numlevel="1" lineno="500" slineno="4-9"/><para/>(b) "Overdosing victim" means an individual who is, or appears to be, experiencing an <ln numlevel="1" lineno="501" slineno="4-10"/>overdose event due to the ingestion, injection, inhalation, or other introduction into the human <ln numlevel="1" lineno="502" slineno="4-11"/>body of a controlled substance or other substance.<eol numlevel="1" lineno="503" slineno="4-12"/>(2) An individual may assert a mitigating factor at sentencing if:<eol numlevel="1" lineno="504" slineno="4-13"/><para/>(a) the individual is being sentenced for an offense under Chapter 18, Part 2, Offenses <ln numlevel="1" lineno="505" slineno="4-14"/>Concerning Controlled Substances, or Title 58, Chapter 37, Controlled Substances; and<eol numlevel="1" lineno="506" slineno="4-15"/><para/>(b) in the same course of events in which the offense described in Subsection (2)(a) was <ln numlevel="1" lineno="507" slineno="4-16"/>committed, the individual:<eol numlevel="1" lineno="508" slineno="4-17"/></amend><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="16" groupid="15" style="2" owner="ahaskell" level="1" deltag="both">(1) reasonably believes that the person or another person is experiencing an overdose event <ln numlevel="1" lineno="509" slineno="4-18"/>due to the ingestion, injection, inhalation, or other introduction into the human body of a <ln numlevel="1" lineno="510" slineno="4-19"/>controlled substance or other substance;</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="8" groupid="7" style="1" owner="ahaskell" level="1" amendtag="both" space="true"><eol numlevel="1" lineno="511" slineno="4-20"/></amend><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="22" groupid="19" style="2" owner="ahaskell" level="1" deltag="both">(2) reports, or assists a person who reports, in good faith the overdose event</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="101" groupid="93" style="1" owner="ahaskell" level="1" amendtag="both" space="true"><eol numlevel="1" lineno="512" slineno="4-21"/><para/>(i) (A) reasonably believes that another individual is an overdosing victim;<eol numlevel="1" lineno="513" slineno="4-22"/><para/>(B) except as provided in Subsection (3), in good faith reports, or assists with the <ln numlevel="1" lineno="514" slineno="4-23"/>reporting of, the need for assistance for the overdosing victim</amend> to a medical provider, an <ln numlevel="1" lineno="515" slineno="4-24"/>emergency medical service provider<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="31" groupid="28" style="2" owner="ahaskell" level="1" deltag="both"> as defined in Section 53-2d-101</amend><amendoutend style="2"/>, a law enforcement <ln numlevel="1" lineno="516" slineno="4-25"/>officer, a 911 emergency call system, or an emergency dispatch system<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="32" groupid="29" style="2" owner="ahaskell" level="1" deltag="both">, or the person is the <ln numlevel="1" lineno="517" slineno="4-26"/>subject of a report made under this section</amend><amendoutend style="2"/>;<amend anum="0" ea="amend" pairid="9" groupid="8" style="1" owner="ahaskell" level="1" amendtag="both"><eol numlevel="1" lineno="518" slineno="4-27"/></amend><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="33" groupid="30" style="2" owner="ahaskell" level="1" deltag="both">(3)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="27" groupid="24" style="1" owner="ahaskell" level="1" amendtag="both" space="true">(C)</amend> provides in the report under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="34" groupid="31" style="2" owner="ahaskell" level="1" deltag="both">(2)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="28" groupid="25" style="1" owner="ahaskell" level="1" amendtag="both" space="true">(2)(b)(i)(B)</amend> a functional description of <ln numlevel="1" lineno="519" slineno="4-28"/>the location of the actual overdose event that facilitates responding to the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="35" groupid="32" style="2" owner="ahaskell" level="1" deltag="both">person experiencing <ln numlevel="1" lineno="520" slineno="4-29"/>the overdose event</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="29" groupid="26" style="1" owner="ahaskell" level="1" amendtag="both" space="true">overdosing victim</amend>;<amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="ahaskell" level="1" amendtag="both"><eol numlevel="1" lineno="521" slineno="4-30"/></amend><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="36" groupid="33" style="2" owner="ahaskell" level="1" deltag="both">(4)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="30" groupid="27" style="1" owner="ahaskell" level="1" amendtag="both" space="true">(D) if applicable to the circumstances,</amend> remains at the location of the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="52" groupid="49" style="2" owner="ahaskell" level="1" deltag="both">person <ln numlevel="1" lineno="522" slineno="4-31"/>experiencing the overdose event</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="45" groupid="42" style="1" owner="ahaskell" level="1" amendtag="both" space="true">overdosing victim</amend> until a responding law enforcement officer <ln numlevel="1" lineno="523" slineno="4-32"/>or emergency medical service provider arrives, or remains at the medical care facility where <ln numlevel="1" lineno="524" slineno="4-33"/>the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="53" groupid="50" style="2" owner="ahaskell" level="1" deltag="both">person experiencing an overdose event</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="46" groupid="43" style="1" owner="ahaskell" level="1" amendtag="both" space="true">overdosing victim</amend> is located until a responding <ln numlevel="1" lineno="525" slineno="4-34"/>law enforcement officer arrives;<amend anum="0" ea="amend" pairid="47" groupid="44" style="1" owner="ahaskell" level="1" amendtag="both"> and<eol numlevel="1" lineno="526" slineno="4-35"/></amend><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="54" groupid="51" style="2" owner="ahaskell" level="1" deltag="both">(5)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="48" groupid="45" style="1" owner="ahaskell" level="1" amendtag="both" space="true">(E)</amend> cooperates with the responding medical provider, emergency medical service <ln numlevel="1" lineno="527" slineno="4-36"/>provider, and law enforcement officer, including providing information regarding the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="55" groupid="52" style="2" owner="ahaskell" level="1" deltag="both">person <ln numlevel="1" lineno="528" slineno="4-37"/>experiencing the overdose event</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="49" groupid="46" style="1" owner="ahaskell" level="1" amendtag="both" space="true">overdosing victim</amend> and any substances the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="56" groupid="53" style="2" owner="ahaskell" level="1" deltag="both">person</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="50" groupid="47" style="1" owner="ahaskell" level="1" amendtag="both" space="true">overdosing <ln numlevel="1" lineno="529" slineno="4-38"/>victim</amend> may have injected, inhaled, or otherwise introduced into the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="57" groupid="54" style="2" owner="ahaskell" level="1" deltag="both">person's</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="51" groupid="48" style="1" owner="ahaskell" level="1" amendtag="both" space="true">overdosing <ln numlevel="1" lineno="530" slineno="4-39"/>victim's</amend> body; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="58" groupid="55" style="2" owner="ahaskell" level="1" deltag="both">and</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="11" groupid="10" style="1" owner="ahaskell" level="1" amendtag="both" space="true"><eol numlevel="1" lineno="531" slineno="4-40"/></amend><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="60" groupid="57" style="2" owner="ahaskell" level="1" deltag="both">(6) committed the offense in the same course of events from which the reported overdose <ln numlevel="1" lineno="532" slineno="4-41"/>arose.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="44" groupid="41" style="1" owner="ahaskell" level="1" amendtag="both" space="true"><eol numlevel="1" lineno="533" slineno="4-42"/><para/>(ii) (A) reasonably believes that another individual is an overdosing victim and knows <ln numlevel="1" lineno="534" slineno="4-43"/>that a request for assistance for the overdosing victim is being made or has been made;<eol numlevel="1" lineno="535" slineno="4-44"/></amend> <amend anum="0" ea="amend" pairid="100" groupid="92" style="1" owner="ahaskell" level="1" amendtag="both"><tab/>(B) remains at the location of the overdosing victim until a responding law enforcement <ln numlevel="1" lineno="536" slineno="4-45"/>officer or emergency medical service provider arrives, or remains at the medical care facility <ln numlevel="1" lineno="537" slineno="4-46"/>where the overdosing victim is located until a responding law enforcement officer arrives; and<eol numlevel="1" lineno="538" slineno="4-47"/><para/>(C) cooperates with the responding medical provider, emergency medical service <ln numlevel="1" lineno="539" slineno="4-48"/>provider, and law enforcement officer, including providing information regarding the <ln numlevel="1" lineno="540" slineno="4-49"/>overdosing victim and any substances the overdosing victim may have injected, inhaled, or <ln numlevel="1" lineno="541" slineno="4-50"/>otherwise introduced into the overdosing victim's body; or<eol numlevel="1" lineno="542" slineno="4-51"/><para/>(iii) is the overdosing victim described in Subsection (2)(b)(i) or (ii).<eol numlevel="1" lineno="543" slineno="4-52"/>(3) An individual's request for medical assistance for an overdosing victim during the <ln numlevel="1" lineno="544" slineno="4-53"/>course of a law enforcement agency's execution of a search warrant, execution of an arrest <ln numlevel="1" lineno="545" slineno="4-54"/>warrant, or other lawful search is not a good faith report under Subsection (2)(b)(i)(B).";<eol numlevel="1" lineno="546" slineno="4-55"/>(2) Subsection 76-18-207(1)(a) enacted in H.B. 301 be amended to read:<eol numlevel="1" lineno="547" slineno="4-56"/>"(1) (a) As used in this section:<eol numlevel="1" lineno="548" slineno="4-57"/><para/>(i) "Correctional facility" means the same as that term is defined in Section 64-13-1.<eol numlevel="1" lineno="549" slineno="4-58"/><para/>(ii) "Emergency medical service provider" means the same as that term is defined in <ln numlevel="1" lineno="550" slineno="4-59"/>Section 53-2d-101.<eol numlevel="1" lineno="551" slineno="4-60"/><para/>(iii) "Overdosing victim" means the same as that term is defined in Section <ln numlevel="1" lineno="552" slineno="4-61"/>76-3-203.11.";<eol numlevel="1" lineno="553" slineno="4-62"/>(3) Subsection 76-18-207(10) enacted in H.B. 301 be amended to read:<eol numlevel="1" lineno="554" slineno="4-63"/>"(10) (a) Subject to Subsection (10)(d), an individual may assert an affirmative defense to a <ln numlevel="1" lineno="555" slineno="4-64"/>violation of Subsection (2) under the circumstances listed in Subsection (10)(b) if, in the same <ln numlevel="1" lineno="556" slineno="4-65"/>course of events in which the offense was committed, the individual:<eol numlevel="1" lineno="557" slineno="4-66"/><para/>(i) (A) reasonably believes that another individual is an overdosing victim; <eol numlevel="1" lineno="558" slineno="4-67"/><para/><tab/>(B) except as provided in Subsection (10)(c), in good faith reports, or assists with the <ln numlevel="1" lineno="559" slineno="4-68"/>reporting of, the need for assistance for the overdosing victim to a medical provider, an <ln numlevel="1" lineno="560" slineno="4-69"/>emergency medical service provider, a law enforcement officer, a 911 emergency call system, <ln numlevel="1" lineno="561" slineno="4-70"/>or an emergency dispatch system;<eol numlevel="1" lineno="562" slineno="4-71"/><para/><tab/>(C) provides in the report described in Subsection (10)(a)(i)(B) a functional <ln numlevel="1" lineno="563" slineno="4-72"/>description of the actual location of the overdose event that facilitates responding to the <ln numlevel="1" lineno="564" slineno="4-73"/>overdosing victim;<eol numlevel="1" lineno="565" slineno="4-74"/><para/><tab/>(D) if applicable to the circumstances, remains at the location of the overdosing <ln numlevel="1" lineno="566" slineno="4-75"/>victim until a responding law enforcement officer or emergency medical service provider <ln numlevel="1" lineno="567" slineno="4-76"/>arrives, or remains at the medical care facility where the overdosing victim is located until a <ln numlevel="1" lineno="568" slineno="4-77"/>responding law enforcement officer arrives; and<eol numlevel="1" lineno="569" slineno="4-78"/><para/><tab/>(E) cooperates with the responding medical provider, emergency medical service <ln numlevel="1" lineno="570" slineno="4-79"/>provider, and law enforcement officer, including providing information regarding the <ln numlevel="1" lineno="571" slineno="4-80"/>overdosing victim and any substances the overdosing victim may have injected, inhaled, or <ln numlevel="1" lineno="572" slineno="4-81"/>otherwise introduced into the overdosing victim's body; <eol numlevel="1" lineno="573" slineno="4-82"/><para/>(ii) (A) reasonably believes that another individual is an overdosing victim and knows <ln numlevel="1" lineno="574" slineno="4-83"/>that a request for assistance for the overdosing victim is being made or has been made;<eol numlevel="1" lineno="575" slineno="4-84"/><para/><tab/>(B) remains at the location of the overdosing victim until a responding law <ln numlevel="1" lineno="576" slineno="4-85"/>enforcement officer or emergency medical service provider arrives, or remains at the medical <ln numlevel="1" lineno="577" slineno="4-86"/>care facility where the overdosing victim is located until a responding law enforcement officer <ln numlevel="1" lineno="578" slineno="4-87"/>arrives; and<eol numlevel="1" lineno="579" slineno="4-88"/><para/><tab/>(C) cooperates with the responding medical provider, emergency medical service <ln numlevel="1" lineno="580" slineno="4-89"/>provider, and law enforcement officer, including providing information regarding the <ln numlevel="1" lineno="581" slineno="4-90"/>overdosing victim and any substances the overdosing victim may have injected, inhaled, or <ln numlevel="1" lineno="582" slineno="4-91"/>otherwise introduced into the overdosing victim's body; or<eol numlevel="1" lineno="583" slineno="4-92"/><para/>(iii) is the overdosing victim described in Subsection (10)(a)(i) or (ii).<eol numlevel="1" lineno="584" slineno="4-93"/>(b) The circumstances referred to in Subsection (10)(a) are:<eol numlevel="1" lineno="585" slineno="4-94"/><para/>(i) the possession or use of less than 16 ounces of marijuana; or<eol numlevel="1" lineno="586" slineno="4-95"/><para/>(ii) the possession or use of a scheduled or listed controlled substance other than <ln numlevel="1" lineno="587" slineno="4-96"/>marijuana.<eol numlevel="1" lineno="588" slineno="4-97"/>(c) An individual's request for medical assistance for an overdosing victim during the <ln numlevel="1" lineno="589" slineno="4-98"/>course of a law enforcement agency's execution of a search warrant, execution of an arrest <ln numlevel="1" lineno="590" slineno="4-99"/>warrant, or other lawful search is not a good faith report under Subsection (10)(a)(i)(B).<eol numlevel="1" lineno="591" slineno="4-100"/>(d) (i) In a prosecution for a violation of Subsection (2) under the circumstances listed in <ln numlevel="1" lineno="592" slineno="4-101"/>Subsection (10)(b), the prosecutor may move the court to dismiss the charge if:<eol numlevel="1" lineno="593" slineno="4-102"/><para/><tab/>(A) the individual qualifies for an affirmative defense under Subsection (10)(a);<eol numlevel="1" lineno="594" slineno="4-103"/><para/><tab/>(B) the charge for which the individual would be able to assert the affirmative <ln numlevel="1" lineno="595" slineno="4-104"/>defense under Subsection (10)(a) is the individual's first time being charged with the offense; <ln numlevel="1" lineno="596" slineno="4-105"/>and<eol numlevel="1" lineno="597" slineno="4-106"/><para/><tab/>(C) after the day of the offense, but before the day on which the case is adjudicated, <ln numlevel="1" lineno="598" slineno="4-107"/>the individual provides proof of a substance abuse evaluation and the completion of any <ln numlevel="1" lineno="599" slineno="4-108"/>recommended treatment.<eol numlevel="1" lineno="600" slineno="4-109"/><para/>(ii) An individual described in Subsection (10)(d)(i) may request a delay in the <ln numlevel="1" lineno="601" slineno="4-110"/>individual's adjudication in order to have time to complete any requirements described in <ln numlevel="1" lineno="602" slineno="4-111"/>Subsection (10)(d)(i)(C).";<eol numlevel="1" lineno="603" slineno="4-112"/>(4) Section 76-18-303 (renumbered from Section 58-37a-6) in H.B. 301 be amended to read:<eol numlevel="1" lineno="604" slineno="4-113"/>"(1) (a) As used in this section:<eol numlevel="1" lineno="605" slineno="4-114"/><para/><tab/>(i) "Emergency medical service provider" means the same as that term is defined in <ln numlevel="1" lineno="606" slineno="4-115"/>Section 53-2d-101.<eol numlevel="1" lineno="607" slineno="4-116"/><para/><tab/>(ii) "Overdosing victim" means the same as that term is defined in Section <ln numlevel="1" lineno="608" slineno="4-117"/>76-3-203.11.<eol numlevel="1" lineno="609" slineno="4-118"/><para/>(b) Terms defined in Sections 76-1-101.5, 76-18-101, and 76-18-301 apply to this <ln numlevel="1" lineno="610" slineno="4-119"/>section.<eol numlevel="1" lineno="611" slineno="4-120"/>(2) </amend>Drug paraphernalia is subject to seizure and forfeiture in accordance with the <ln numlevel="1" lineno="612" slineno="4-121"/>procedures and substantive protections of<amend anum="0" ea="amend" pairid="70" groupid="64" style="1" owner="ahaskell" level="1" amendtag="both">:<eol numlevel="1" lineno="613" slineno="4-122"/><para/>(a)</amend> Title 77, Chapter 11a, Seizure of Property and Contraband<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="75" groupid="68" style="2" owner="ahaskell" level="1" deltag="both">,</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="74" groupid="67" style="1" owner="ahaskell" level="1" amendtag="both" space="true">;</amend> and <amend anum="0" ea="amend" pairid="73" groupid="66" style="1" owner="ahaskell" level="1" amendtag="both"><eol numlevel="1" lineno="614" slineno="4-123"/><para/>(b) </amend>Title 77, Chapter 11b, Forfeiture of Seized Property.<amend anum="0" ea="amend" pairid="64" groupid="60" style="1" owner="ahaskell" level="1" amendtag="both"><eol numlevel="1" lineno="615" slineno="4-124"/>(3) (a) Subject to Subsection (3)(c), an individual may assert an affirmative defense to a <ln numlevel="1" lineno="616" slineno="4-125"/>violation of an offense under this part if, in the same course of events in which the offense was <ln numlevel="1" lineno="617" slineno="4-126"/>committed, the individual:<eol numlevel="1" lineno="618" slineno="4-127"/><para/><tab/>(i) (A) reasonably believes that another individual is an overdosing victim; <eol numlevel="1" lineno="619" slineno="4-128"/><para/><tab/><tab/>(B) except as provided in Subsection (3)(b), in good faith reports, or assists with <ln numlevel="1" lineno="620" slineno="4-129"/>the reporting of, the need for assistance for the overdosing victim to a medical provider, an <ln numlevel="1" lineno="621" slineno="4-130"/>emergency medical service provider, a law enforcement officer, a 911 emergency call system, <ln numlevel="1" lineno="622" slineno="4-131"/>or an emergency dispatch system;<eol numlevel="1" lineno="623" slineno="4-132"/><para/><tab/><tab/>(C) provides in the report described in Subsection (3)(a)(i)(B) a functional <ln numlevel="1" lineno="624" slineno="4-133"/>description of the actual location of the overdose event that facilitates responding to the <ln numlevel="1" lineno="625" slineno="4-134"/>overdosing victim;<eol numlevel="1" lineno="626" slineno="4-135"/><para/><tab/><tab/>(D) if applicable to the circumstances, remains at the location of the overdosing <ln numlevel="1" lineno="627" slineno="4-136"/>victim until a responding law enforcement officer or emergency medical service provider <ln numlevel="1" lineno="628" slineno="4-137"/>arrives, or remains at the medical care facility where the overdosing victim is located until a <ln numlevel="1" lineno="629" slineno="4-138"/>responding law enforcement officer arrives; and<eol numlevel="1" lineno="630" slineno="4-139"/><para/><tab/><tab/>(E) cooperates with the responding medical provider, emergency medical service <ln numlevel="1" lineno="631" slineno="4-140"/>provider, and law enforcement officer, including providing information regarding the <ln numlevel="1" lineno="632" slineno="4-141"/>overdosing victim and any substances the overdosing victim may have injected, inhaled, or <ln numlevel="1" lineno="633" slineno="4-142"/>otherwise introduced into the overdosing victim's body; <eol numlevel="1" lineno="634" slineno="4-143"/><para/><tab/>(ii) (A) reasonably believes that another individual is an overdosing victim and <ln numlevel="1" lineno="635" slineno="4-144"/>knows that a request for assistance for the overdosing victim is being made or has been made;<eol numlevel="1" lineno="636" slineno="4-145"/><para/><tab/><tab/>(B) remains at the location of the overdosing victim until a responding law <ln numlevel="1" lineno="637" slineno="4-146"/>enforcement officer or emergency medical service provider arrives, or remains at the medical <ln numlevel="1" lineno="638" slineno="4-147"/>care facility where the overdosing victim is located until a responding law enforcement officer <ln numlevel="1" lineno="639" slineno="4-148"/>arrives; and<eol numlevel="1" lineno="640" slineno="4-149"/><para/><tab/><tab/>(C) cooperates with the responding medical provider, emergency medical service <ln numlevel="1" lineno="641" slineno="4-150"/>provider, and law enforcement officer, including providing information regarding the <ln numlevel="1" lineno="642" slineno="4-151"/>overdosing victim and any substances the overdosing victim may have injected, inhaled, or <ln numlevel="1" lineno="643" slineno="4-152"/>otherwise introduced into the overdosing victim's body; or<eol numlevel="1" lineno="644" slineno="4-153"/><para/><tab/>(iii) is the overdosing victim described in Subsection (3)(a)(i) or (ii).<eol numlevel="1" lineno="645" slineno="4-154"/><para/>(b) An individual's request for medical assistance for an overdosing victim during the <ln numlevel="1" lineno="646" slineno="4-155"/>course of a law enforcement agency's execution of a search warrant, execution of an arrest <ln numlevel="1" lineno="647" slineno="4-156"/>warrant, or other lawful search is not a good faith report under Subsection (3)(a)(i)(B).<eol numlevel="1" lineno="648" slineno="4-157"/><para/>(c) (i) In a prosecution for a violation of an offense under this part, the prosecutor may <ln numlevel="1" lineno="649" slineno="4-158"/>move the court to dismiss the charge if:<eol numlevel="1" lineno="650" slineno="4-159"/><para/><tab/><tab/>(A) the individual qualifies for an affirmative defense under Subsection (3)(a);<eol numlevel="1" lineno="651" slineno="4-160"/><para/><tab/><tab/>(B) the charge for which the individual would be able to assert the affirmative <ln numlevel="1" lineno="652" slineno="4-161"/>defense under Subsection (3)(a) is the individual's first time being charged with the offense; <ln numlevel="1" lineno="653" slineno="4-162"/>and<eol numlevel="1" lineno="654" slineno="4-163"/><para/><tab/><tab/>(C) after the day of the offense, but before the day on which the case is <ln numlevel="1" lineno="655" slineno="4-164"/>adjudicated, the individual provides proof of a substance abuse evaluation and the completion <ln numlevel="1" lineno="656" slineno="4-165"/>of any recommended treatment.<eol numlevel="1" lineno="657" slineno="4-166"/><para/><tab/>(ii) An individual described in Subsection (3)(c)(i) may request a delay in the <ln numlevel="1" lineno="658" slineno="4-167"/>individual's adjudication in order to have time to complete any requirements described in <ln numlevel="1" lineno="659" slineno="4-168"/>Subsection (3)(c)(i)(C)."; and<eol numlevel="1" lineno="660" slineno="4-169"/>(5) Section 76-18-402 (renumbered from Section 58-37b-8) in H.B. 301 be amended to <ln numlevel="1" lineno="661" slineno="4-170"/>read:<eol numlevel="1" lineno="662" slineno="4-171"/>"(1) (a) As used in this section:<eol numlevel="1" lineno="663" slineno="4-172"/><para/><tab/>(i) "Emergency medical service provider" means the same as that term is defined in <ln numlevel="1" lineno="664" slineno="4-173"/>Section 53-2d-101.<eol numlevel="1" lineno="665" slineno="4-174"/><para/><tab/>(ii) "Overdosing victim" means the same as that term is defined in Section <ln numlevel="1" lineno="666" slineno="4-175"/>76-3-203.11.<eol numlevel="1" lineno="667" slineno="4-176"/><para/>(b) Terms defined in Sections 76-1-101.5, 76-18-101, and 76-18-401 apply to this <ln numlevel="1" lineno="668" slineno="4-177"/>section.<eol numlevel="1" lineno="669" slineno="4-178"/>(2) </amend>No civil or criminal liability shall be imposed by virtue of this <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="85" groupid="77" style="2" owner="ahaskell" level="1" deltag="both">act</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="82" groupid="74" style="1" owner="ahaskell" level="1" amendtag="both" space="true">part</amend> on<amend anum="0" ea="amend" pairid="83" groupid="75" style="1" owner="ahaskell" level="1" amendtag="both">:<eol numlevel="1" lineno="670" slineno="4-179"/><para/>(a)</amend> any person registered under <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="93" groupid="85" style="2" owner="ahaskell" level="1" deltag="both">the</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="90" groupid="82" style="1" owner="ahaskell" level="1" amendtag="both" space="true">Title 58, Chapter 37,</amend> Controlled Substances<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="94" groupid="86" style="2" owner="ahaskell" level="1" deltag="both"> Act</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="91" groupid="83" style="1" owner="ahaskell" level="1" amendtag="both" space="true">,</amend> <ln numlevel="1" lineno="671" slineno="4-180"/>who manufactures, distributes, or possesses an imitation controlled substance for use as a <ln numlevel="1" lineno="672" slineno="4-181"/>placebo or investigational new drug by a registered practitioner in the ordinary course of <ln numlevel="1" lineno="673" slineno="4-182"/>professional practice or research<amend anum="0" ea="amend" pairid="92" groupid="84" style="1" owner="ahaskell" level="1" amendtag="both">;</amend> or<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="95" groupid="87" style="2" owner="ahaskell" level="1" deltag="both"> on any</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="89" groupid="81" style="1" owner="ahaskell" level="1" amendtag="both" space="true"><eol numlevel="1" lineno="674" slineno="4-183"/><para/>(b) a</amend> law enforcement officer acting in the course and legitimate scope of <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="99" groupid="91" style="2" owner="ahaskell" level="1" deltag="both">that</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="98" groupid="90" style="1" owner="ahaskell" level="1" amendtag="both" space="true">the law <ln numlevel="1" lineno="675" slineno="4-184"/>enforcement officer's</amend> employment.<amend anum="0" ea="amend" pairid="97" groupid="89" style="1" owner="ahaskell" level="1" amendtag="both"><eol numlevel="1" lineno="676" slineno="4-185"/>(3) (a) Subject to Subsection (3)(c), an individual may assert an affirmative defense to a <ln numlevel="1" lineno="677" slineno="4-186"/>violation of an offense under this part if, in the same course of events in which the offense was <ln numlevel="1" lineno="678" slineno="4-187"/>committed, the individual:<eol numlevel="1" lineno="679" slineno="4-188"/><para/><tab/>(i) (A) reasonably believes that another individual is an overdosing victim; <eol numlevel="1" lineno="680" slineno="4-189"/><para/><tab/><tab/>(B) except as provided in Subsection (3)(b), in good faith reports, or assists with <ln numlevel="1" lineno="681" slineno="4-190"/>the reporting of, the need for assistance for the overdosing victim to a medical provider, an <ln numlevel="1" lineno="682" slineno="4-191"/>emergency medical service provider, a law enforcement officer, a 911 emergency call system, <ln numlevel="1" lineno="683" slineno="4-192"/>or an emergency dispatch system;<eol numlevel="1" lineno="684" slineno="4-193"/><para/><tab/><tab/>(C) provides in the report described in Subsection (3)(a)(i)(B) a functional <ln numlevel="1" lineno="685" slineno="4-194"/>description of the actual location of the overdose event that facilitates responding to the <ln numlevel="1" lineno="686" slineno="4-195"/>overdosing victim;<eol numlevel="1" lineno="687" slineno="4-196"/><para/><tab/><tab/>(D) if applicable to the circumstances, remains at the location of the overdosing <ln numlevel="1" lineno="688" slineno="4-197"/>victim until a responding law enforcement officer or emergency medical service provider <ln numlevel="1" lineno="689" slineno="4-198"/>arrives, or remains at the medical care facility where the overdosing victim is located until a <ln numlevel="1" lineno="690" slineno="4-199"/>responding law enforcement officer arrives; and<eol numlevel="1" lineno="691" slineno="4-200"/><para/><tab/><tab/>(E) cooperates with the responding medical provider, emergency medical service <ln numlevel="1" lineno="692" slineno="4-201"/>provider, and law enforcement officer, including providing information regarding the <ln numlevel="1" lineno="693" slineno="4-202"/>overdosing victim and any substances the overdosing victim may have injected, inhaled, or <ln numlevel="1" lineno="694" slineno="4-203"/>otherwise introduced into the overdosing victim's body; <eol numlevel="1" lineno="695" slineno="4-204"/><para/><tab/>(ii) (A) reasonably believes that another individual is an overdosing victim and <ln numlevel="1" lineno="696" slineno="4-205"/>knows that a request for assistance for the overdosing victim is being made or has been made;<eol numlevel="1" lineno="697" slineno="4-206"/><para/><tab/><tab/>(B) remains at the location of the overdosing victim until a responding law <ln numlevel="1" lineno="698" slineno="4-207"/>enforcement officer or emergency medical service provider arrives, or remains at the medical <ln numlevel="1" lineno="699" slineno="4-208"/>care facility where the overdosing victim is located until a responding law enforcement officer <ln numlevel="1" lineno="700" slineno="4-209"/>arrives; and<eol numlevel="1" lineno="701" slineno="4-210"/><para/><tab/><tab/>(C) cooperates with the responding medical provider, emergency medical service <ln numlevel="1" lineno="702" slineno="4-211"/>provider, and law enforcement officer, including providing information regarding the <ln numlevel="1" lineno="703" slineno="4-212"/>overdosing victim and any substances the overdosing victim may have injected, inhaled, or <ln numlevel="1" lineno="704" slineno="4-213"/>otherwise introduced into the overdosing victim's body; or<eol numlevel="1" lineno="705" slineno="4-214"/><para/><tab/>(iii) is the overdosing victim described in Subsection (3)(a)(i) or (ii).<eol numlevel="1" lineno="706" slineno="4-215"/><para/>(b) An individual's request for medical assistance for an overdosing victim during the <ln numlevel="1" lineno="707" slineno="4-216"/>course of a law enforcement agency's execution of a search warrant, execution of an arrest <ln numlevel="1" lineno="708" slineno="4-217"/>warrant, or other lawful search is not a good faith report under Subsection (3)(a)(i)(B).<eol numlevel="1" lineno="709" slineno="4-218"/><para/>(c) (i) In a prosecution for a violation of an offense under this part, the prosecutor may <ln numlevel="1" lineno="710" slineno="4-219"/>move the court to dismiss the charge if:<eol numlevel="1" lineno="711" slineno="4-220"/><para/><tab/><tab/>(A) the individual qualifies for an affirmative defense under Subsection (3)(a);<eol numlevel="1" lineno="712" slineno="4-221"/><para/><tab/><tab/>(B) the charge for which the individual would be able to assert the affirmative <ln numlevel="1" lineno="713" slineno="4-222"/>defense under Subsection (3)(a) is the individual's first time being charged with the offense; <ln numlevel="1" lineno="714" slineno="4-223"/>and<eol numlevel="1" lineno="715" slineno="4-224"/><para/><tab/><tab/>(C) after the day of the offense, but before the day on which the case is <ln numlevel="1" lineno="716" slineno="4-225"/>adjudicated, the individual provides proof of a substance abuse evaluation and the completion <ln numlevel="1" lineno="717" slineno="4-226"/>of any recommended treatment.<eol numlevel="1" lineno="718" slineno="4-227"/><para/><tab/>(ii) An individual described in Subsection (3)(c)(i) may request a delay in the <ln numlevel="1" lineno="719" slineno="4-228"/>individual's adjudication in order to have time to complete any requirements described in <ln numlevel="1" lineno="720" slineno="4-229"/>Subsection
