Section <bold>53G-6-403</bold> is amended to read:</secline><catline lineno="32"><bold>53G-6-403<parens/>. Policies for acceptance and rejection of applications.</bold></catline><subsection ssid="1-null-40" dnum="1-o" numlevel="1" lineno="33" slineno="1-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="1-null-41" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A local school board shall adopt policies governing acceptance and rejection of <ln numlevel="1" lineno="34" slineno="1-4"/>applications required under Section <xref depth="3" refnumber="53G-6-402" start="0">53G-6-402</xref>.</subsection><subsection ssid="1-null-42" dnum="b-o" numlevel="1" lineno="35" slineno="1-5" level="2"><display>(b)</display>The policies adopted under Subsection <xref depth="4" refnumber="53G-6-403(1)(a)" start="0">(1)(a)</xref> shall include policies and procedures to <ln numlevel="1" lineno="36" slineno="1-6"/>assure that decisions regarding enrollment requests are administered fairly without <ln numlevel="1" lineno="37" slineno="1-7"/>prejudice to any student or class of student, except as provided in Subsection <xref depth="4" refnumber="53G-6-403(2)" start="0">(2)</xref>.</subsection></subsection><subsection ssid="1-null-43" dnum="2-o" numlevel="1" lineno="38" slineno="1-8" level="1"><display>(2)</display>Standards for accepting or rejecting an application for enrollment may include:<subsection ssid="1-null-44" dnum="a-o" numlevel="1" lineno="39" slineno="1-9" level="2"><display>(a)</display>for an elementary school, the capacity of the grade level;</subsection><subsection ssid="1-null-45" dnum="b-o" numlevel="1" lineno="40" slineno="1-10" level="2"><display>(b)</display>for a secondary school, the capacity of a comprehensive program;</subsection><subsection ssid="1-null-46" dnum="c-o" numlevel="1" lineno="41" slineno="1-11" level="2"><display>(c)</display>maintenance of heterogeneous student populations if necessary to avoid violation of <ln numlevel="1" lineno="42" slineno="1-12"/>constitutional or statutory rights of students;</subsection><subsection ssid="1-null-47" dnum="d-o" numlevel="1" lineno="43" slineno="1-13" level="2"><display>(d)</display>not offering, or having capacity in, an elementary or secondary special education or <ln numlevel="1" lineno="44" slineno="1-14"/>other special program the student requires;</subsection><subsection ssid="1-null-48" dnum="e-o" numlevel="1" lineno="45" slineno="1-15" level="2"><display>(e)</display>maintenance of reduced class sizes:<subsection ssid="1-null-49" dnum="i-o" numlevel="1" lineno="46" slineno="1-16" level="3"><display>(i)</display>in a Title I school that uses federal, state, and local money to reduce class sizes for <ln numlevel="1" lineno="47" slineno="1-17"/>the purpose of improving student achievement; or</subsection><subsection ssid="1-null-50" dnum="ii-o" numlevel="1" lineno="48" slineno="1-18" level="3"><display>(ii)</display>in a school that uses school trust money to reduce class size;</subsection></subsection><subsection ssid="1-null-51" dnum="f-o" numlevel="1" lineno="49" slineno="1-19" level="2"><display>(f)</display>willingness of prospective students to comply with district policies; and</subsection><subsection ssid="1-null-52" dnum="g-o" numlevel="1" lineno="50" slineno="1-20" level="2"><display>(g)</display>giving priority to intradistrict transfers over interdistrict transfers.</subsection></subsection><subsection ssid="1-null-53" dnum="3-o" numlevel="1" lineno="51" slineno="1-21" level="1" space="false"><display>(3)</display><subsection ssid="1-null-54" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Standards for accepting or rejecting applications for enrollment may not include:<subsection ssid="1-null-55" dnum="i-o" numlevel="1" lineno="52" slineno="1-22" level="3" tab="1"><display>(i)</display>previous academic achievement;</subsection><subsection ssid="1-null-56" dnum="ii-o" numlevel="1" lineno="53" slineno="1-23" level="3" tab="1"><display>(ii)</display>athletic or other extracurricular ability;</subsection><subsection ssid="1-null-57" dnum="iii-o" numlevel="1" lineno="54" slineno="1-24" level="3" tab="1"><display>(iii)</display>the fact that the student requires special education services for which space is <ln numlevel="1" lineno="55" slineno="1-25"/>available;</subsection><subsection ssid="1-null-58" dnum="iv-o" numlevel="1" lineno="56" slineno="1-26" level="3" tab="1"><display>(iv)</display>proficiency in the English language; or</subsection><subsection ssid="1-null-59" dnum="v-o" numlevel="1" lineno="57" slineno="1-27" level="3" tab="1"><display>(v)</display>previous disciplinary proceedings, except as provided in Subsection <xref depth="4" refnumber="53G-6-403(3)(b)" start="0">(3)(b)</xref>.</subsection></subsection><subsection ssid="1-null-60" dnum="b-o" numlevel="1" lineno="58" slineno="1-28" level="2"><display>(b)</display>A local school board may provide for the denial of applications from students who:<subsection ssid="1-null-61" dnum="i-o" numlevel="1" lineno="59" slineno="1-29" level="3"><display>(i)</display>have committed serious infractions of the law or school policies, including <ln numlevel="1" lineno="60" slineno="1-30"/>policies of the district in which enrollment is sought; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="7" groupid="6" style="2" owner="jchristopherson" level="1" deltag="both">or</amend><amendoutend style="2"/></subsection><subsection ssid="1-null-62" dnum="ii-o" numlevel="1" lineno="61" slineno="1-31" level="3"><display>(ii)</display>have been guilty of chronic misbehavior which would, if it were to continue after <ln numlevel="1" lineno="62" slineno="1-32"/>the student was admitted:<subsection ssid="1-null-63" dnum="A-o" numlevel="1" lineno="63" slineno="1-33" level="4"><display>(A)</display>endanger persons or property;</subsection><subsection ssid="1-null-64" dnum="B-o" numlevel="1" lineno="64" slineno="1-34" level="4"><display>(B)</display>cause serious disruptions in the school; or</subsection><subsection ssid="1-null-65" dnum="C-o" numlevel="1" lineno="65" slineno="1-35" level="4"><display>(C)</display>place unreasonable burdens on school staff<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="8" groupid="7" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; or</amend></subsection></subsection><subsection ssid="1-null-66" dnum="_-o:iii-i" numlevel="1" lineno="66" slineno="1-36" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1026" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="end">have any school safety incidents or safe-school violations.</amend></subsection></subsection><subsection ssid="1-null-67" dnum="c-o" numlevel="1" lineno="67" slineno="1-37" level="2"><display>(c)</display>A local school board may also provide for provisional enrollment of students with <ln numlevel="1" lineno="68" slineno="1-38"/>prior behavior problems, establishing conditions under which enrollment of a <ln numlevel="1" lineno="69" slineno="1-39"/>nonresident student would be permitted or continued.</subsection></subsection><subsection ssid="1-null-68" dnum="4-o" numlevel="1" lineno="70" slineno="1-40" level="1" space="false"><display>(4)</display><subsection ssid="1-null-69" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The state board, in consultation with the Utah High School Activities Association, <ln numlevel="1" lineno="71" slineno="1-41"/>shall establish policies regarding nonresident student participation in interscholastic <ln numlevel="1" lineno="72" slineno="1-42"/>competition.</subsection><subsection ssid="1-null-70" dnum="b-o" numlevel="1" lineno="73" slineno="1-43" level="2"><display>(b)</display>Nonresident students shall be eligible for extracurricular activities at a public school <ln numlevel="1" lineno="74" slineno="1-44"/>consistent with eligibility standards as applied to students that reside within the <ln numlevel="1" lineno="75" slineno="1-45"/>school attendance area, except as provided by policies established under Subsection <xref depth="4" refnumber="53G-6-403(4)(a)" start="0"><ln numlevel="1" lineno="76" slineno="1-46"/>(4)(a)</xref>.</subsection></subsection><subsection ssid="1-null-71" dnum="5-o" numlevel="1" lineno="77" slineno="1-47" level="1"><display>(5)</display>For each school in the district, the local school board shall post on the school district's <ln numlevel="1" lineno="78" slineno="1-48"/>website:<subsection ssid="1-null-72" dnum="a-o" numlevel="1" lineno="79" slineno="1-49" level="2"><display>(a)</display>the school's maximum capacity;</subsection><subsection ssid="1-null-73" dnum="b-o" numlevel="1" lineno="80" slineno="1-50" level="2"><display>(b)</display>the school's adjusted capacity;</subsection><subsection ssid="1-null-74" dnum="c-o" numlevel="1" lineno="81" slineno="1-51" level="2"><display>(c)</display>the school's projected enrollment used in the calculation of the open enrollment <ln numlevel="1" lineno="82" slineno="1-52"/>threshold;</subsection><subsection ssid="1-null-75" dnum="d-o" numlevel="1" lineno="83" slineno="1-53" level="2"><display>(d)</display>actual enrollment on October 1, January 2, and April 1;</subsection><subsection ssid="1-null-76" dnum="e-o" numlevel="1" lineno="84" slineno="1-54" level="2"><display>(e)</display>the number of nonresident student enrollment requests;</subsection><subsection ssid="1-null-77" dnum="f-o" numlevel="1" lineno="85" slineno="1-55" level="2"><display>(f)</display>the number of nonresident student enrollment requests accepted; and</subsection><subsection ssid="1-null-78" dnum="g-o" numlevel="1" lineno="86" slineno="1-56" level="2"><display>(g)</display>the number of resident students transferring to another school.</subsection></subsection></section></bsec><bsec buid="2" num="53G-6-604" type="amend" src="code" uid="C53G-6-S604_2026050620260506" sort="53G06 06040020260506" numlevel="1" lineno="87" slineno="2-1" sn="2"><section number="53G-6-604" numlevel="1" lineno="88" slineno="2-2" type="amend"><secline lineno="87">Section 2. Section <bold>53G-6-604</bold> is amended to read:</secline><catline lineno="88"><bold>53G-6-604<parens/>. Requirement of school record for transfer of student -- Procedures.</bold></catline><subsection ssid="2-null-8" dnum="1-o" numlevel="1" lineno="89" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>Except as provided in Section <xref depth="3" refnumber="53E-3-905" start="0">53E-3-905</xref>, a school shall request a certified copy of a <ln numlevel="1" lineno="90" slineno="2-4"/>transfer student's record, directly from the transfer student's previous school<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="6" groupid="4" style="2" owner="jchristopherson" level="1" deltag="both">, within 14 <ln numlevel="1" lineno="91" slineno="2-5"/>days after enrolling the transfer student</amend><amendoutend style="2"/>.</subsection><subsection ssid="2-null-9" dnum="2-o" numlevel="1" lineno="92" slineno="2-6" level="1" space="false"><display>(2)</display><subsection ssid="2-null-10" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="2-null-11" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1" placement="sameline"><display><amend anum="0" ea="amend" pairid="1042" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>Except as provided in Subsection <xref depth="4" refnumber="53G-6-604(2)(b)" start="0">(2)(b)</xref> and Section <xref depth="3" refnumber="53E-3-905" start="0">53E-3-905</xref>, a school <ln numlevel="1" lineno="93" slineno="2-7"/>requested to forward a certified copy of a transferring student's record to the new <ln numlevel="1" lineno="94" slineno="2-8"/>school shall comply within <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="7" groupid="5" style="2" owner="jchristopherson" level="1" deltag="both">30</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="5" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">10</amend> school days of the request.</subsection><subsection ssid="2-null-12" dnum="_-o:ii-i" numlevel="1" lineno="95" slineno="2-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1043" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="end">The student record shall include the student's discipline file including any <ln numlevel="1" lineno="96" slineno="2-10"/>safe-school violation, reintegration, or threat assessment.</amend></subsection></subsection><subsection ssid="2-null-13" dnum="b-o" numlevel="1" lineno="97" slineno="2-11" level="2"><display>(b)</display>If the record has been flagged <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="17" groupid="13" style="2" owner="jchristopherson" level="1" deltag="both">pursuant to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="16" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">in accordance with</amend> Section <xref depth="3" refnumber="53G-6-602" start="0">53G-6-602</xref>, a <ln numlevel="1" lineno="98" slineno="2-12"/>school may not forward the record to the new school and the requested school shall <ln numlevel="1" lineno="99" slineno="2-13"/>notify the division of the request.</subsection><subsection ssid="2-null-14" dnum="_-o:c-i" numlevel="1" lineno="100" slineno="2-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1045" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="end">A school may not enroll a student unless the student record from the previous school <ln numlevel="1" lineno="101" slineno="2-15"/>is received or the school administrator or designee reviews the data gateway for any <ln numlevel="1" lineno="102" slineno="2-16"/>safe-school violation, reintegration, or threat assessment.</amend></subsection></subsection></section></bsec><bsec buid="3" num="53G-8-213" type="amend" src="code" uid="C53G-8-S213_2026050620260506" sort="53G08 02130020260506" numlevel="1" lineno="103" slineno="3-1" sn="3"><section number="53G-8-213" numlevel="1" lineno="104" slineno="3-2" type="amend"><secline lineno="103">Section 3. Section <bold>53G-8-213</bold> is amended to read:</secline><catline lineno="104"><bold>53G-8-213<parens/>. Reintegration plan for student alleged to have committed violent <ln numlevel="1" lineno="105" slineno="3-3"/>felony or weapon offense.</bold></catline><subsection ssid="3-null-29" dnum="1-o" numlevel="1" lineno="106" slineno="3-4" level="1" placement="noreturn"><display>(1)</display>As used in this section,"multidisciplinary team" means: <subsection ssid="3-null-30" dnum="a-o" numlevel="1" lineno="107" slineno="3-5" level="2"><display>(a)</display>the local education agency<amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both"> or designee</amend>; </subsection><subsection ssid="3-null-31" dnum="b-o" numlevel="1" lineno="108" slineno="3-6" level="2"><display>(b)</display>the juvenile court<amend anum="0" ea="amend" pairid="5" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both"> or designee</amend>; </subsection><subsection ssid="3-null-32" dnum="c-o" numlevel="1" lineno="109" slineno="3-7" level="2"><display>(c)</display>the Division of Juvenile Justice and Youth Services<amend anum="0" ea="amend" pairid="9" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="both"> or designee</amend>; </subsection><subsection ssid="3-null-33" dnum="d-o" numlevel="1" lineno="110" slineno="3-8" level="2"><display>(d)</display>a school safety and security specialist designated under Section <xref depth="3" refnumber="53G-8-701.6">53G-8-701.6</xref><amend anum="0" ea="amend" pairid="11" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both"> or <ln numlevel="1" lineno="111" slineno="3-9"/>designee if applicable</amend>;</subsection><subsection ssid="3-null-34" dnum="e-o" numlevel="1" lineno="112" slineno="3-10" level="2"><display>(e)</display>school safety and security director designated under Section <xref depth="3" refnumber="53G-8-701.8">53G-8-701.8</xref><amend anum="0" ea="amend" pairid="13" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="both"> or designee <ln numlevel="1" lineno="113" slineno="3-11"/>if applicable</amend>;</subsection><subsection ssid="3-null-35" dnum="f-o" numlevel="1" lineno="114" slineno="3-12" level="2"><display>(f)</display>a school resource officer if applicable; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="7" groupid="7" style="2" owner="jchristopherson" level="1" deltag="both">and</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="6" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">or</amend> </subsection><subsection ssid="3-null-36" dnum="g-o" numlevel="1" lineno="115" slineno="3-13" level="2"><display>(g)</display>any other relevant party that should be involved in a reintegration plan.</subsection></subsection><subsection ssid="3-null-37" dnum="2-o" numlevel="1" lineno="116" slineno="3-14" level="1" space="false"><display>(2)</display><subsection ssid="3-null-38" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1055" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>If <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="70" groupid="62" style="2" owner="jchristopherson" level="1" deltag="both">a school district</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="63" groupid="55" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">an LEA</amend> receives a notification from the juvenile court or a law <ln numlevel="1" lineno="117" slineno="3-15"/>enforcement agency that a student was arrested for, charged with, or adjudicated in <ln numlevel="1" lineno="118" slineno="3-16"/>the juvenile court for a serious offense, the<amend anum="0" ea="amend" pairid="64" groupid="56" style="1" owner="jchristopherson" level="1" amendtag="both"> LEA and the relevant</amend> school shall develop <ln numlevel="1" lineno="119" slineno="3-17"/>a reintegration plan for the student with a multidisciplinary team, the student, and the <ln numlevel="1" lineno="120" slineno="3-18"/>student's parent or guardian, within <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="25" groupid="21" style="2" owner="jchristopherson" level="1" deltag="both">five</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="23" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">seven</amend> school days after the day on which <ln numlevel="1" lineno="121" slineno="3-19"/>the school receives a notification<amend anum="0" ea="amend" pairid="24" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="both"> while school is in session</amend>.</subsection><subsection ssid="3-null-39" dnum="_-o:b-i" numlevel="1" lineno="122" slineno="3-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1056" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="20" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="end">If a school district receives a notification when school is not in session from the <ln numlevel="1" lineno="123" slineno="3-21"/>juvenile court or a law enforcement agency that a student was arrested for, charged <ln numlevel="1" lineno="124" slineno="3-22"/>with, or adjudicated in the juvenile court for a serious offense, the school shall <ln numlevel="1" lineno="125" slineno="3-23"/>develop a reintegration plan for the student with a multidisciplinary team, the student, <ln numlevel="1" lineno="126" slineno="3-24"/>and the student's parent within seven school days of school being back in session <ln numlevel="1" lineno="127" slineno="3-25"/>from summer break.</amend></subsection></subsection><subsection ssid="3-null-40" dnum="3-o" numlevel="1" lineno="128" slineno="3-26" level="1"><display>(3)</display>The <amend anum="0" ea="amend" pairid="65" groupid="57" style="1" owner="jchristopherson" level="1" amendtag="both">relevant </amend>school<amend anum="0" ea="amend" pairid="66" groupid="58" style="1" owner="jchristopherson" level="1" amendtag="both"> described in Subsection (2)</amend> may deny admission to the student until <ln numlevel="1" lineno="129" slineno="3-27"/>the school completes the reintegration plan under Subsection <xref depth="4" refnumber="53G-8-213(2)">(2)</xref>.</subsection><subsection ssid="3-null-41" dnum="4-o" numlevel="1" lineno="130" slineno="3-28" level="1" space="false"><display>(4)</display><subsection ssid="3-null-47" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1059" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>The reintegration plan under Subsection <xref depth="4" refnumber="53G-8-213(2)">(2)</xref> shall <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="40" groupid="33" style="2" owner="jchristopherson" level="1" deltag="both">address</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="37" groupid="30" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">include</amend>:<subsection ssid="3-null-42" dnum="a-o:i-i" numlevel="1" lineno="131" slineno="3-29" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1060" style="2" owner="o" level="1" deltag="both">(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1061" style="1" owner="i" level="1" amendtag="both" space="true">(i)</amend></display>a behavioral intervention for the student;</subsection><subsection ssid="3-null-43" dnum="b-o:ii-i" numlevel="1" lineno="132" slineno="3-30" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1061" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1062" style="1" owner="i" level="1" amendtag="both" space="true">(ii)</amend></display>a short-term mental health or counseling service for the student;</subsection><subsection ssid="3-null-44" dnum="c-o:iii-i" numlevel="1" lineno="133" slineno="3-31" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1062" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1063" style="1" owner="i" level="1" amendtag="both" space="true">(iii)</amend></display>an academic intervention for the student; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="41" groupid="34" style="2" owner="jchristopherson" level="1" deltag="both">and</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="38" groupid="31" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">or</amend></subsection><subsection ssid="3-null-45" dnum="_-o:iv-i" numlevel="1" lineno="134" slineno="3-32" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1063" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="36" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="end">any other interventions that the multidisciplinary team, the student, and the <ln numlevel="1" lineno="135" slineno="3-33"/>student's parent or guardian determine are necessary.</amend></subsection></subsection><subsection ssid="3-null-46" dnum="d-o:b-i" numlevel="1" lineno="136" slineno="3-34" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1064" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1065" style="1" owner="i" level="1" amendtag="both" space="true">(b)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="46" groupid="39" style="2" owner="jchristopherson" level="1" deltag="both">if</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="45" groupid="38" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">If</amend> the serious offense was directed at a school employee or another student <ln numlevel="1" lineno="137" slineno="3-35"/>within the school, notification of the reintegration plan to that school employee or <ln numlevel="1" lineno="138" slineno="3-36"/>student and the student's parent.</subsection></subsection><subsection ssid="3-null-48" dnum="5-o" numlevel="1" lineno="139" slineno="3-37" level="1"><display>(5)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="71" groupid="63" style="2" owner="jchristopherson" level="1" deltag="both">A school district </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="67" groupid="59" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">An LEA </amend>may not reintegrate a student into a school where:<subsection ssid="3-null-49" dnum="a-o" numlevel="1" lineno="140" slineno="3-38" level="2"><display>(a)</display>a student or staff member has a protective order against the student being <ln numlevel="1" lineno="141" slineno="3-39"/>reintegrated; or</subsection><subsection ssid="3-null-50" dnum="b-o" numlevel="1" lineno="142" slineno="3-40" level="2"><display>(b)</display>a student or staff member is the victim of <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="55" groupid="47" style="2" owner="jchristopherson" level="1" deltag="both">a</amend><amendoutend style="2"/> <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="47" groupid="40" style="2" owner="jchristopherson" level="1" deltag="both">sexual crime or forcible felony <ln numlevel="1" lineno="143" slineno="3-41"/>committed by the student being reintegrated</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="51" groupid="43" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">an offense listed in Section <xref depth="3" refnumber="76-3-203.5">76-3-203.5</xref> <ln numlevel="1" lineno="144" slineno="3-42"/>where the student is seeking reintegration or continued enrollment has been found to <ln numlevel="1" lineno="145" slineno="3-43"/>be adjudicated</amend>.</subsection></subsection><subsection ssid="3-null-51" dnum="_-o:6-i" numlevel="1" lineno="146" slineno="3-44" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1068" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="48" groupid="41" style="1" owner="jchristopherson" level="1" amendtag="end">A reintegration plan under this section will remain in effect for an entire school year or <ln numlevel="1" lineno="147" slineno="3-45"/>180 days from the plan's implementation, or as long as the multidisciplinary team deems <ln numlevel="1" lineno="148" slineno="3-46"/>the reintegration plan necessary.</amend></subsection><subsection ssid="3-null-52" dnum="6-o:7-i" numlevel="1" lineno="149" slineno="3-47" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1069" style="2" owner="o" level="1" deltag="both">(6)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1070" style="1" owner="i" level="1" amendtag="both" space="true">(7)</amend></display><subsection ssid="3-null-53" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Notwithstanding Subsection <xref refnumber="53G-8-213(2)" depth="4">(2)</xref>, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="72" groupid="64" style="2" owner="jchristopherson" level="1" deltag="both">a school district</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="68" groupid="60" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">an LEA</amend> may elect to not <ln numlevel="1" lineno="150" slineno="3-48"/>integrate a student into a school if the student has committed, or allegedly committed, <ln numlevel="1" lineno="151" slineno="3-49"/>a forcible felony.</subsection><subsection ssid="3-null-54" dnum="b-o" numlevel="1" lineno="152" slineno="3-50" level="2"><display>(b)</display>If <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="73" groupid="65" style="2" owner="jchristopherson" level="1" deltag="both">a school district</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="69" groupid="61" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">an LEA</amend> elects to not integrate a student under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="54" groupid="46" style="2" owner="jchristopherson" level="1" deltag="both"><xref refnumber="53G-8-213(6)(a)" depth="4">(6)(a)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="53" groupid="45" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="153" slineno="3-51"/>(7)(a)</amend>, the school district shall provide alternative education options for the student.</subsection></subsection><subsection ssid="3-null-55" dnum="7-o:8-i" numlevel="1" lineno="154" slineno="3-52" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1072" style="2" owner="o" level="1" deltag="both">(7)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1073" style="1" owner="i" level="1" amendtag="both" space="true">(8)</amend></display>A reintegration plan under this section is classified as a protected record under <ln numlevel="1" lineno="155" slineno="3-53"/>Section <xref depth="3" refnumber="63G-2-305">63G-2-305</xref>.</subsection><subsection ssid="3-null-56" dnum="8-o:9-i" numlevel="1" lineno="156" slineno="3-54" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1073" style="2" owner="o" level="1" disclosures under this section are governed by Title 63G, <ln numlevel="1" lineno="157" slineno="3-55"/>Chapter 2, Government Records Access and Management Act, and the Family <ln numlevel="1" lineno="158" slineno="3-56"/>Educational Rights and Privacy Act, 20 U.S.C. Sec. 1232g.</subsection></section></bsec><bsec buid="4" num="53G-8-403" type="amend" src="code" uid="C53G-8-S403_2026050620260506" sort="53G08 04030020260506" numlevel="1" lineno="159" slineno="4-1" sn="4"><section number="53G-8-403" numlevel="1" lineno="160" slineno="4-2" type="amend"><secline lineno="159">Section 4. Section <bold>53G-8-403</bold> is amended to read:</secline><catline lineno="160"><bold>53G-8-403<parens/>. Superintendent required to notify school.</bold></catline><subsection ssid="4-null-9" dnum="1-o" numlevel="1" lineno="161" slineno="4-3" level="1" placement="noreturn"><display>(1)</display>"LEA head" means the superintendent of a school district or the director of a charter <ln numlevel="1" lineno="162" slineno="4-4"/>school.</subsection><subsection ssid="4-null-10" dnum="2-o" numlevel="1" lineno="163" slineno="4-5" level="1"><display>(2)</display>Within three days of receiving a notification from the juvenile court or a law <ln numlevel="1" lineno="164" slineno="4-6"/>enforcement agency under Section <xref depth="3" refnumber="80-6-103">80-6-103</xref>, the LEA head or LEA head's designee <ln numlevel="1" lineno="165" slineno="4-7"/>shall notify the principal of the school the juvenile attends or last attended.</subsection><subsection ssid="4-null-11" dnum="3-o" numlevel="1" lineno="166" slineno="4-8" level="1"><display>(3)</display>Upon receipt of the information, the principal shall:<subsection ssid="4-null-12" dnum="a-o" numlevel="1" lineno="167" slineno="4-9" level="2"><display>(a)</display>make a notation in a secure file other than the student's permanent file; and</subsection><subsection ssid="4-null-13" dnum="b-o" numlevel="1" lineno="168" slineno="4-10" level="2"><display>(b)</display>if the student is still enrolled in the school, notify staff members who, in his opinion, <ln numlevel="1" lineno="169" slineno="4-11"/>should know of the adjudication.</subsection></subsection><subsection ssid="4-null-14" dnum="4-o" numlevel="1" lineno="170" slineno="4-12" level="1"><display>(4)</display>A person receiving information <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="8" groupid="8" style="2" owner="jchristopherson" level="1" deltag="both">pursuant to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">in accordance with</amend> this part may only <ln numlevel="1" lineno="171" slineno="4-13"/>disclose the information to other persons having both a right and a current need to know.</subsection><subsection ssid="4-null-15" dnum="5-o" numlevel="1" lineno="172" slineno="4-14" level="1"><display>(5)</display>Access to secure files shall be limited to persons authorized to receive information <ln numlevel="1" lineno="173" slineno="4-15"/>under this part.</subsection><subsection ssid="4-null-16" dnum="6-o" numlevel="1" lineno="174" slineno="4-16" level="1"><display>(6)</display>Beginning no later than July 1, 2025, an LEA shall digitally maintain the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both">secure</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="175" slineno="4-17"/>cumulative</amend> file described in Subsection <xref depth="4" refnumber="53G-8-403(3)">(3)</xref> or, if available, the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="11" groupid="11" style="2" owner="jchristopherson" level="1" deltag="both">students </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="10" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">student's </amend><ln numlevel="1" lineno="176" slineno="4-18"/>related reintegration plan described in <xref depth="3" refnumber="53G-8-213">53G-8-213</xref>, for one year from the day the notice is <ln numlevel="1" lineno="177" slineno="4-19"/>received and ensure the secure file follows the student if the student transfers to a <ln numlevel="1" lineno="178" slineno="4-20"/>different school or LEA.</subsection></section></bsec><bsec buid="5" num="53G-9-902" type="amend" src="code" uid="C53G-9-S902_2026050620260506" sort="53G09 09020020260506" numlevel="1" lineno="179" slineno="5-1" sn="5"><section number="53G-9-902" numlevel="1" lineno="180" slineno="5-2" type="amend"><secline lineno="179">Section 5. Section <bold>53G-9-902</bold> is amended to read:</secline><catline lineno="180"><bold>53G-9-902<parens/>. Informed parental consent required -- Parental notification required.</bold></catline><subsection ssid="5-null-33" dnum="1-o" numlevel="1" lineno="181" slineno="5-3" level="1" placement="noreturn"><display>(1)</display>Except as provided in a student's IEP or Section 504 accommodation plan:<subsection ssid="5-null-34" dnum="a-o" numlevel="1" lineno="182" slineno="5-4" level="2"><display>(a)</display>an individual who is not authorized personnel may not provide a restricted service; <ln numlevel="1" lineno="183" slineno="5-5"/>and</subsection><subsection ssid="5-null-35" dnum="b-o" numlevel="1" lineno="184" slineno="5-6" level="2"><display>(b)</display>authorized personnel may not provide a restricted service:<subsection ssid="5-null-36" dnum="i-o" numlevel="1" lineno="185" slineno="5-7" level="3"><display>(i)</display>outside the scope of the relevant license; or</subsection><subsection ssid="5-null-37" dnum="ii-o" numlevel="1" lineno="186" slineno="5-8" level="3"><display>(ii)</display>with other students present.</subsection></subsection></subsection><subsection ssid="5-null-38" dnum="2-o" numlevel="1" lineno="187" slineno="5-9" level="1"><display>(2)</display>For authorized personnel to provide a restricted service<amend anum="0" ea="amend" pairid="22" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="both">,</amend><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="14" groupid="10" style="2" owner="jchristopherson" level="1" deltag="both">:</amend><amendoutend style="2"/><subsection ssid="5-null-39" dnum="a-o:_-i" numlevel="1" lineno="188" slineno="5-10" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1088" style="2" owner="o" level="1" deltag="both">(a)</amend><amendoutend style="2"/></display>the relevant LEA, school, or authorized personnel shall obtain informed written <ln numlevel="1" lineno="189" slineno="5-11"/>parental consent before the first session of a restricted service in a given school year, <ln numlevel="1" lineno="190" slineno="5-12"/>using a standard form that includes:<subsection ssid="5-null-40" dnum="i-o:a-i" numlevel="1" lineno="191" slineno="5-13" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1089" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1090" style="1" owner="i" level="1" amendtag="both" space="true">(a)</amend></display>fields for at least the following information:<subsection ssid="5-null-41" dnum="A-o:i-i" numlevel="1" lineno="192" slineno="5-14" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1090" style="2" owner="o" level="1" deltag="both">(A)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1091" style="1" owner="i" level="1" amendtag="both" space="true">(i)</amend></display>the name of the student;</subsection><subsection ssid="5-null-42" dnum="B-o:ii-i" numlevel="1" lineno="193" slineno="5-15" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1091" style="2" owner="o" level="1" deltag="both">(B)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1092" style="1" owner="i" level="1" amendtag="both" space="true">(ii)</amend></display>the name of the individual giving informed consent; and</subsection><subsection ssid="5-null-43" dnum="C-o:iii-i" numlevel="1" lineno="194" slineno="5-16" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1092" style="2" owner="o" level="1" deltag="both">(C)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1093" style="1" owner="i" level="1" amendtag="both" space="true">(iii)</amend></display>the name of each authorized personnel who has authority under the <ln numlevel="1" lineno="195" slineno="5-17"/>informed written consent to provide a restricted service;</subsection></subsection><subsection ssid="5-null-44" dnum="ii-o:b-i" numlevel="1" lineno="196" slineno="5-18" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1093" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1094" style="1" owner="i" level="1" amendtag="both" space="true">(b)</amend></display>a statement that the authorized personnel will provide information about the <ln numlevel="1" lineno="197" slineno="5-19"/>restricted service <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="15" groupid="11" style="2" owner="jchristopherson" level="1" deltag="both">in accordance with Subsection <xref refnumber="53G-9-902(2)(b)" depth="4">(2)(b)</xref></amend><amendoutend style="2"/>, including that the parent has <ln numlevel="1" lineno="198" slineno="5-20"/>the right to opt out of receiving notifications at any time; and</subsection><subsection ssid="5-null-45" dnum="iii-o:c-i" numlevel="1" lineno="199" slineno="5-21" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1094" style="2" owner="o" level="1" deltag="both">(iii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1095" style="1" owner="i" level="1" amendtag="both" space="true">(c)</amend></display>a statement that authorized personnel will adhere to the topics or issues the <ln numlevel="1" lineno="200" slineno="5-22"/>parent identifies, in collaboration with authorized personnel, for discussion or <ln numlevel="1" lineno="201" slineno="5-23"/>exclusion with the student under Subsection <xref refnumber="53G-9-902(3)(a)" depth="4">(3)(a)</xref>, except that the authorized <ln numlevel="1" lineno="202" slineno="5-24"/>personnel may address topics if the omission would compromise the student's <ln numlevel="1" lineno="203" slineno="5-25"/>immediate safety, the omission would violate mandatory reporting obligations, or, <ln numlevel="1" lineno="204" slineno="5-26"/>based on behaviors or statements the authorized personnel observes, the authorized <ln numlevel="1" lineno="205" slineno="5-27"/>personnel determines a need to assess the student's safety<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="27" groupid="22" style="2" owner="jchristopherson" level="1" deltag="both">; and</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="23" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">.</amend></subsection></subsection><subsection ssid="5-null-46" dnum="b-o:_-i" numlevel="1" lineno="206" slineno="5-28" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1095" style="2" owner="o" level="1" deltag="start">(b)</amend></display><amend anum="0" ea="erase" pairid="7" groupid="4" style="2" owner="jchristopherson" level="1" deltag="end">unless the student's parent opts out of receiving notifications from the authorized <ln numlevel="1" lineno="207" slineno="5-29"/>personnel under this Subsection <xref refnumber="53G-9-902(2)(b)" depth="4">(2)(b)</xref>, within one business day after each session of <ln numlevel="1" lineno="208" slineno="5-30"/>a restricted service, the authorized personnel shall provide to the student's parent:</amend><amendoutend style="2"/><subsection ssid="5-null-47" dnum="i-o:_-i" numlevel="1" lineno="209" slineno="5-31" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1096" style="2" owner="o" level="1" deltag="start">(i)</amend></display><amend anum="0" ea="erase" pairid="10" groupid="7" style="2" owner="jchristopherson" level="1" deltag="end">notice that the restricted service took place; and</amend><amendoutend style="2"/></subsection><subsection ssid="5-null-48" dnum="ii-o:_-i" numlevel="1" lineno="210" slineno="5-32" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1097" style="2" owner="o" level="1" deltag="start">(ii)</amend></display><amend anum="0" ea="erase" pairid="11" groupid="8" style="2" owner="jchristopherson" level="1" deltag="end">a description of the topic of the restricted service.</amend><amendoutend style="2"/></subsection></subsection></subsection><subsection ssid="5-null-49" dnum="3-o" numlevel="1" lineno="211" slineno="5-33" level="1" space="false"><display>(3)</display><subsection ssid="5-null-50" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="5-null-51" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>When obtaining the informed written parental consent described in <ln numlevel="1" lineno="212" slineno="5-34"/>Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="29" groupid="24" style="2" owner="jchristopherson" level="1" deltag="both"><xref refnumber="53G-9-902(2)(a)" depth="4">(2)(a)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="24" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(2)</amend>, the LEA, school, or authorized personnel shall, through <ln numlevel="1" lineno="213" slineno="5-35"/>consultation with the parent, provide the parent an opportunity to identify topics <ln numlevel="1" lineno="214" slineno="5-36"/>or issues the parent intends the authorized personnel to address or to not address <ln numlevel="1" lineno="215" slineno="5-37"/>with the student.</subsection><subsection ssid="5-null-52" dnum="ii-o" numlevel="1" lineno="216" slineno="5-38" level="3" tab="1"><display>(ii)</display>Except as described in Subsection <xref tempid="251" depth="4" refnumber="53G-9-902(3)(a)(iii)">(3)(a)(iii)</xref>, authorized personnel may not <ln numlevel="1" lineno="217" slineno="5-39"/>address a topic or issue for which a parent has expressly stated an intent for <ln numlevel="1" lineno="218" slineno="5-40"/>authorized personnel to not address with the student under this Subsection <xref refnumber="53G-9-902(3)(a)" depth="4">(3)(a)</xref>.</subsection><subsection ssid="5-null-53" dnum="iii-o" numlevel="1" lineno="219" slineno="5-41" level="3" tab="1"><display>(iii)</display>Subsection <xref tempid="368" depth="4" refnumber="53G-9-902(3)(a)(ii)">(3)(a)(ii)</xref> does not apply if:<subsection ssid="5-null-54" dnum="A-o" numlevel="1" lineno="220" slineno="5-42" level="4"><display>(A)</display>an omission within a restricted service would compromise the student's <ln numlevel="1" lineno="221" slineno="5-43"/>immediate safety; or</subsection><subsection ssid="5-null-55" dnum="B-o" numlevel="1" lineno="222" slineno="5-44" level="4"><display>(B)</display>the student discloses information that creates a duty on the authorized <ln numlevel="1" lineno="223" slineno="5-45"/>personnel to make a mandatory report for the purpose of discussing the <ln numlevel="1" lineno="224" slineno="5-46"/>information with the student to the extent necessary to make the report, <ln numlevel="1" lineno="225" slineno="5-47"/>including for suspected cases of child abuse or neglect under Section <xref depth="3" refnumber="80-2-602">80-2-602</xref>, <ln numlevel="1" lineno="226" slineno="5-48"/>abuse of a student under Section <xref depth="3" refnumber="53E-6-701">53E-6-701</xref>, or any other legally mandated <ln numlevel="1" lineno="227" slineno="5-49"/>duty to report an incident.</subsection></subsection></subsection><subsection ssid="5-null-56" dnum="b-o" numlevel="1" lineno="228" slineno="5-50" level="2" space="false"><display>(b)</display><subsection ssid="5-null-57" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The requirement to obtain prior informed written parental consent before <ln numlevel="1" lineno="229" slineno="5-51"/>providing a restricted service described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="30" groupid="25" style="2" owner="jchristopherson" level="1" deltag="both"><xref refnumber="53G-9-902(2)(a)" depth="4">(2)(a)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="25" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(2)</amend> does not apply in <ln numlevel="1" lineno="230" slineno="5-52"/>a case in which a delay to contact a parent would create an immediate serious risk <ln numlevel="1" lineno="231" slineno="5-53"/>of suicide or serious bodily injury, as defined in Section <xref depth="3" refnumber="76-1-101.5">76-1-101.5</xref>, to the student <ln numlevel="1" lineno="232" slineno="5-54"/>or to another individual.</subsection><subsection ssid="5-null-58" dnum="ii-o" numlevel="1" lineno="233" slineno="5-55" level="3"><display>(ii)</display>For a circumstance described in Subsection <xref tempid="999" depth="4" refnumber="53G-9-902(3)(b)(i)">(3)(b)(i)</xref>, the LEA, school, or <ln numlevel="1" lineno="234" slineno="5-56"/>authorized personnel shall notify a parent in accordance with Section <xref depth="3" refnumber="53G-9-604">53G-9-604</xref>.</subsection></subsection><subsection ssid="5-null-59" dnum="c-o" numlevel="1" lineno="235" slineno="5-57" level="2"><display>(c)</display>A student's IEP or Section 504 accommodation plan that includes a restricted service <ln numlevel="1" lineno="236" slineno="5-58"/>satisfies the informed parental consent requirement described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="31" groupid="26" style="2" owner="jchristopherson" level="1" deltag="both"><xref refnumber="53G-9-902(2)(a)" depth="4">(2)(a)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="26" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(2)</amend>.</subsection></subsection><subsection ssid="5-null-60" dnum="4-o" numlevel="1" lineno="237" slineno="5-59" level="1" space="false"><display>(4)</display><subsection ssid="5-null-61" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The state board may make rules, in accordance with <xref depth="1" refnumber="63G-3">Title 63G, Chapter 3, Utah <ln numlevel="1" lineno="238" slineno="5-60"/>Administrative Rulemaking Act</xref>, regarding the application of this section to the <ln numlevel="1" lineno="239" slineno="5-61"/>actions of educators and staff in the public education system.</subsection><subsection ssid="5-null-62" dnum="b-o" numlevel="1" lineno="240" slineno="5-62" level="2"><display>(b)</display>The state board shall, in consultation with the Department of Health and Human <ln numlevel="1" lineno="241" slineno="5-63"/>Services, provide guidance to authorized personnel, educators, and school support <ln numlevel="1" lineno="242" slineno="5-64"/>staff on conduct and practices that constitute and do not constitute a restricted service.</subsection></subsection><subsection ssid="5-null-63" dnum="5-o" numlevel="1" lineno="243" slineno="5-65" level="1"><display>(5)</display>Nothing in this part authorizes an individual to take an action that exceeds the scope of <ln numlevel="1" lineno="244" slineno="5-66"/>the individual's license or certification.</subsection><subsection ssid="5-null-64" dnum="6-o" numlevel="1" lineno="245" slineno="5-67" level="1"><display>(6)</display>This section does not apply to a service a student accesses through the SafeUT Crisis <ln numlevel="1" lineno="246" slineno="5-68"/>Line established in Section <xref depth="3" refnumber="53H-4-210">53H-4-210</xref>.</subsection></section></bsec><bsec buid="6" num="63M-7-208" type="amend" src="code" uid="C63M-7-S208_2026050620260506" sort="63M07 02080020260506" numlevel="1" lineno="247" slineno="6-1" sn="6"><section number="63M-7-208" numlevel="1" lineno="248" slineno="6-2" type="amend"><secline lineno="247">Section 6. Section <bold>63M-7-208</bold> is amended to read:</secline><catline lineno="248"><bold>63M-7-208<parens/>. Juvenile justice oversight -- Delegation -- Effective dates.</bold></catline><subsection ssid="6-null-38" dnum="1-o" numlevel="1" lineno="249" slineno="6-3" level="1" placement="noreturn"><display>(1)</display>The State Commission on Criminal and Juvenile Justice shall:<subsection ssid="6-null-39" dnum="a-o" numlevel="1" lineno="250" slineno="6-4" level="2"><display>(a)</display>support implementation and expansion of evidence-based juvenile justice programs <ln numlevel="1" lineno="251" slineno="6-5"/>and practices, including assistance regarding implementation fidelity, quality <ln numlevel="1" lineno="252" slineno="6-6"/>assurance, and ongoing evaluation;</subsection><subsection ssid="6-null-40" dnum="b-o" numlevel="1" lineno="253" slineno="6-7" level="2"><display>(b)</display>examine and make recommendations on the use of third-party entities or an <ln numlevel="1" lineno="254" slineno="6-8"/>intermediary organization to assist with implementation and to support the <ln numlevel="1" lineno="255" slineno="6-9"/>performance-based contracting system authorized in Subsection <xref depth="4" refnumber="63M-7-208(1)(m)">(1)(m)</xref>;</subsection><subsection ssid="6-null-41" dnum="c-o" numlevel="1" lineno="256" slineno="6-10" level="2"><display>(c)</display>oversee the development of performance measures to track juvenile justice reforms, <ln numlevel="1" lineno="257" slineno="6-11"/>and ensure early and ongoing stakeholder engagement in identifying the relevant <ln numlevel="1" lineno="258" slineno="6-12"/>performance measures;</subsection><subsection ssid="6-null-42" dnum="d-o" numlevel="1" lineno="259" slineno="6-13" level="2"><display>(d)</display>evaluate currently collected data elements throughout the juvenile justice system and <ln numlevel="1" lineno="260" slineno="6-14"/>contract reporting requirements to streamline reporting, reduce redundancies, <ln numlevel="1" lineno="261" slineno="6-15"/>eliminate inefficiencies, and ensure a focus on recidivism reduction;</subsection><subsection ssid="6-null-43" dnum="e-o" numlevel="1" lineno="262" slineno="6-16" level="2"><display>(e)</display>review averted costs from reductions in out-of-home placements for juvenile justice <ln numlevel="1" lineno="263" slineno="6-17"/>youth placed with the Division of Juvenile Justice and Youth Services and the <ln numlevel="1" lineno="264" slineno="6-18"/>Division of Child and Family Services, and make recommendations to prioritize the <ln numlevel="1" lineno="265" slineno="6-19"/>reinvestment and realignment of resources into community-based programs for youth <ln numlevel="1" lineno="266" slineno="6-20"/>living at home, including the following:<subsection ssid="6-null-44" dnum="i-o" numlevel="1" lineno="267" slineno="6-21" level="3"><display>(i)</display>statewide expansion of:<subsection ssid="6-null-45" dnum="A-o" numlevel="1" lineno="268" slineno="6-22" level="4"><display>(A)</display>juvenile receiving centers, as defined in Section <xref depth="3" refnumber="80-1-102">80-1-102</xref>;</subsection><subsection ssid="6-null-46" dnum="B-o" numlevel="1" lineno="269" slineno="6-23" level="4"><display>(B)</display>mobile crisis outreach teams, as defined in Section <xref depth="3" refnumber="26B-5-101">26B-5-101</xref>;</subsection><subsection ssid="6-null-47" dnum="C-o" numlevel="1" lineno="270" slineno="6-24" level="4"><display>(C)</display>youth courts; and</subsection><subsection ssid="6-null-48" dnum="D-o" numlevel="1" lineno="271" slineno="6-25" level="4"><display>(D)</display>victim-offender mediation;</subsection></subsection><subsection ssid="6-null-49" dnum="ii-o" numlevel="1" lineno="272" slineno="6-26" level="3"><display>(ii)</display>statewide implementation of nonresidential diagnostic assessment;</subsection><subsection ssid="6-null-50" dnum="iii-o" numlevel="1" lineno="273" slineno="6-27" level="3"><display>(iii)</display>statewide availability of evidence-based programs and practices including <ln numlevel="1" lineno="274" slineno="6-28"/>cognitive behavioral and family therapy programs for minors assessed by a <ln numlevel="1" lineno="275" slineno="6-29"/>validated risk and needs assessment as moderate or high risk;</subsection><subsection ssid="6-null-51" dnum="iv-o" numlevel="1" lineno="276" slineno="6-30" level="3"><display>(iv)</display>implementation and infrastructure to support the sustainability and fidelity of <ln numlevel="1" lineno="277" slineno="6-31"/>evidence-based juvenile justice programs, including resources for staffing, <ln numlevel="1" lineno="278" slineno="6-32"/>transportation, and flexible funds; and</subsection><subsection ssid="6-null-52" dnum="v-o" numlevel="1" lineno="279" slineno="6-33" level="3"><display>(v)</display>early intervention programs such as family strengthening programs, family <ln numlevel="1" lineno="280" slineno="6-34"/>wraparound services, and proven truancy interventions;</subsection></subsection><subsection ssid="6-null-53" dnum="f-o" numlevel="1" lineno="281" slineno="6-35" level="2"><display>(f)</display>assist the Administrative Office of the Courts in the development of a statewide <ln numlevel="1" lineno="282" slineno="6-36"/>sliding scale for the assessment of fines, fees, and restitution, based on the ability of <ln numlevel="1" lineno="283" slineno="6-37"/>the minor's family to pay;</subsection><subsection ssid="6-null-54" dnum="g-o" numlevel="1" lineno="284" slineno="6-38" level="2"><display>(g)</display>analyze the alignment of resources and the roles and responsibilities of agencies, <ln numlevel="1" lineno="285" slineno="6-39"/>such as the operation of early intervention services, receiving centers, and diversion, <ln numlevel="1" lineno="286" slineno="6-40"/>and make recommendations to reallocate functions as appropriate, in accordance with <ln numlevel="1" lineno="287" slineno="6-41"/>Section <xref depth="3" refnumber="80-5-401">80-5-401</xref>;</subsection><subsection ssid="6-null-55" dnum="h-o" numlevel="1" lineno="288" slineno="6-42" level="2"><display>(h)</display>comply with the data collection and reporting requirements under Section <xref depth="3" refnumber="80-6-104">80-6-104</xref>;</subsection><subsection ssid="6-null-56" dnum="i-o" numlevel="1" lineno="289" slineno="6-43" level="2"><display>(i)</display>develop a reasonable timeline within which all programming delivered to minors in <ln numlevel="1" lineno="290" slineno="6-44"/>the juvenile justice system <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="6" groupid="6" style="2" owner="jchristopherson" level="1" deltag="both">must</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="5" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">shall</amend> be evidence-based or consist of practices that <ln numlevel="1" lineno="291" slineno="6-45"/>are rated as effective for reducing recidivism by a standardized program evaluation <ln numlevel="1" lineno="292" slineno="6-46"/>tool;</subsection><subsection ssid="6-null-57" dnum="j-o" numlevel="1" lineno="293" slineno="6-47" level="2"><display>(j)</display>provide guidelines to be considered by the Administrative Office of the Courts and <ln numlevel="1" lineno="294" slineno="6-48"/>the Division of Juvenile Justice and Youth Services in developing tools considered <ln numlevel="1" lineno="295" slineno="6-49"/>by the Administrative Office of the Courts and the Division of Juvenile Justice and <ln numlevel="1" lineno="296" slineno="6-50"/>Youth Services in developing or selecting tools to be used for the evaluation of <ln numlevel="1" lineno="297" slineno="6-51"/>juvenile justice programs;</subsection><subsection ssid="6-null-58" dnum="k-o" numlevel="1" lineno="298" slineno="6-52" level="2"><display>(k)</display>develop a timeline to support improvements to juvenile justice programs to achieve <ln numlevel="1" lineno="299" slineno="6-53"/>reductions in recidivism and review reports from relevant state agencies on progress <ln numlevel="1" lineno="300" slineno="6-54"/>toward reaching that timeline;</subsection><subsection ssid="6-null-59" dnum="l-o" numlevel="1" lineno="301" slineno="6-55" level="2"><display>(l)</display>subject to Subsection <xref depth="4" refnumber="63M-7-208(2)">(2)</xref>, assist in the development of training for juvenile justice <ln numlevel="1" lineno="302" slineno="6-56"/>stakeholders, including educators, law enforcement officers, probation staff, judges, <ln numlevel="1" lineno="303" slineno="6-57"/>Division of Juvenile Justice and Youth Services staff, Division of Child and Family <ln numlevel="1" lineno="304" slineno="6-58"/>Services staff, and program providers;</subsection><subsection ssid="6-null-60" dnum="m-o" numlevel="1" lineno="305" slineno="6-59" level="2"><display>(m)</display>subject to Subsection <xref depth="4" refnumber="63M-7-208(3)">(3)</xref>, assist in the development of a performance-based <ln numlevel="1" lineno="306" slineno="6-60"/>contracting system, which shall be developed by the Administrative Office of the <ln numlevel="1" lineno="307" slineno="6-61"/>Courts and the Division of Juvenile Justice and Youth Services for contracted <ln numlevel="1" lineno="308" slineno="6-62"/>services in the community and contracted out-of-home placement providers;</subsection><subsection ssid="6-null-61" dnum="n-o" numlevel="1" lineno="309" slineno="6-63" level="2"><display>(n)</display>assist in the development of a validated detention risk assessment tool that is <ln numlevel="1" lineno="310" slineno="6-64"/>developed or adopted and validated by the Administrative Office of the Courts and <ln numlevel="1" lineno="311" slineno="6-65"/>the Division of Juvenile Justice and Youth Services as provided in Section <xref depth="3" refnumber="80-5-203">80-5-203</xref>; <ln numlevel="1" lineno="312" slineno="6-66"/>and</subsection><subsection ssid="6-null-62" dnum="o-o" numlevel="1" lineno="313" slineno="6-67" level="2"><display>(o)</display>annually issue and make public a report to the governor, president of the Senate, <ln numlevel="1" lineno="314" slineno="6-68"/>speaker of the House of Representatives, and chief justice of the Utah Supreme Court <ln numlevel="1" lineno="315" slineno="6-69"/>on the progress of the reforms and any additional areas in need of review.</subsection></subsection><subsection ssid="6-null-63" dnum="2-o" numlevel="1" lineno="316" slineno="6-70" level="1"><display>(2)</display>Training described in Subsection <xref depth="4" refnumber="63M-7-208(1)(l)">(1)(l)</xref> should include instruction on evidence-based <ln numlevel="1" lineno="317" slineno="6-71"/>programs and principles of juvenile justice, such as risk, needs, responsivity, and <ln numlevel="1" lineno="318" slineno="6-72"/>fidelity, and <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both">shall </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">changes in legislation that impact the juvenile justice system and <ln numlevel="1" lineno="319" slineno="6-73"/>may </amend>be supplemented by the following topics:<subsection ssid="6-null-64" dnum="a-o" numlevel="1" lineno="320" slineno="6-74" level="2"><display>(a)</display>adolescent development;</subsection><subsection ssid="6-null-65" dnum="b-o" numlevel="1" lineno="321" slineno="6-75" level="2"><display>(b)</display>identifying and using local behavioral health resources;</subsection><subsection ssid="6-null-66" dnum="c-o" numlevel="1" lineno="322" slineno="6-76" level="2"><display>(c)</display>cross-cultural awareness;</subsection><subsection ssid="6-null-67" dnum="d-o" numlevel="1" lineno="323" slineno="6-77" level="2"><display>(d)</display>graduated responses;</subsection><subsection ssid="6-null-68" dnum="e-o" numlevel="1" lineno="324" slineno="6-78" level="2"><display>(e)</display>Utah juvenile justice system data and outcomes; and</subsection><subsection ssid="6-null-69" dnum="f-o" numlevel="1" lineno="325" slineno="6-79" level="2"><display>(f)</display>gangs.</subsection></subsection><subsection ssid="6-null-70" dnum="3-o" numlevel="1" lineno="326" slineno="6-80" level="1"><display>(3)</display>The system described in Subsection <xref depth="4" refnumber="63M-7-208(1)(m)">(1)(m)</xref> shall provide incentives for:<subsection ssid="6-null-71" dnum="a-o" numlevel="1" lineno="327" slineno="6-81" level="2"><display>(a)</display>the use of evidence-based juvenile justice programs and practices rated as effective <ln numlevel="1" lineno="328" slineno="6-82"/>by the tools selected in accordance with Subsection <xref depth="4" refnumber="63M-7-208(1)(j)">(1)(j)</xref>;</subsection><subsection ssid="6-null-72" dnum="b-o" numlevel="1" lineno="329" slineno="6-83" level="2"><display>(b)</display>the use of three-month timelines for program completion; and</subsection><subsection ssid="6-null-73" dnum="c-o" numlevel="1" lineno="330" slineno="6-84" level="2"><display>(c)</display>evidence-based programs and practices for minors living at home in rural areas.</subsection></subsection><subsection ssid="6-null-74" dnum="4-o" numlevel="1" lineno="331" slineno="6-85" level="1"><display>(4)</display>The State Commission on Criminal and Juvenile Justice may delegate the duties <ln numlevel="1" lineno="332" slineno="6-86"/>imposed under this section to a subcommittee or board established by the State <ln numlevel="1" lineno="333" slineno="6-87"/>Commission on Criminal and Juvenile Justice in accordance with Subsection <xref depth="4" refnumber="63M-7-204(2)"><ln numlevel="1" lineno="334" slineno="6-88"/>63M-7-204(2)</xref>.</subsection></section></bsec><bsec buid="7" num="80-6-103" type="amend" src="code" uid="C80-6-S103_2026050620260506" sort="80 06 01030020260506" numlevel="1" lineno="335" slineno="7-1" sn="7"><section number="80-6-103" numlevel="1" lineno="336" slineno="7-2" type="amend"><secline lineno="335">Section 7. Section <bold>80-6-103</bold> is amended to read:</secline><catline lineno="336"><bold>80-6-103<parens/>. Notification to a school -- Civil and criminal liability.</bold></catline><subsection ssid="7-null-37" dnum="1-o" numlevel="1" lineno="337" slineno="7-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="7-null-38" dnum="a-o" numlevel="1" lineno="338" slineno="7-4" level="2"><display>(a)</display>"School" means a school in a local education agency.</subsection><subsection ssid="7-null-39" dnum="b-o" numlevel="1" lineno="339" slineno="7-5" level="2"><display>(b)</display>"Local education agency" means a school district, a charter school, or the Utah <ln numlevel="1" lineno="340" slineno="7-6"/>Schools for the Deaf and the Blind.</subsection><subsection ssid="7-null-40" dnum="c-o" numlevel="1" lineno="341" slineno="7-7" level="2"><display>(c)</display>"School official" means the superintendent of a school district or the director of a <ln numlevel="1" lineno="342" slineno="7-8"/>charter school or designee in which the minor resides or attends school.</subsection><subsection ssid="7-null-41" dnum="d-o" numlevel="1" lineno="343" slineno="7-9" level="2"><display>(d)</display>"Serious offense" means:<subsection ssid="7-null-42" dnum="i-o" numlevel="1" lineno="344" slineno="7-10" level="3"><display>(i)</display>a violent felony as defined in Section <xref depth="3" refnumber="76-3-203.5">76-3-203.5</xref>;</subsection><subsection ssid="7-null-43" dnum="ii-o" numlevel="1" lineno="345" slineno="7-11" level="3"><display>(ii)</display>an offense that is a violation of an offense under <xref depth="2" refnumber="76-6-4">Title 76, Chapter 6, Part 4, Theft</xref>, <ln numlevel="1" lineno="346" slineno="7-12"/>and the property stolen is a firearm; or</subsection><subsection ssid="7-null-44" dnum="iii-o" numlevel="1" lineno="347" slineno="7-13" level="3"><display>(iii)</display>an offense that is a violation of an offense under Title 76, Chapter 11, Weapons.</subsection></subsection><subsection ssid="7-null-45" dnum="e-o" numlevel="1" lineno="348" slineno="7-14" level="2"><display>(e)</display>"Transferee school official" means the superintendent of a school district or the <ln numlevel="1" lineno="349" slineno="7-15"/>director of a charter school or designee in which the minor resides or attends school if <ln numlevel="1" lineno="350" slineno="7-16"/>the minor is admitted to home detention.</subsection></subsection><subsection ssid="7-null-46" dnum="2-o" numlevel="1" lineno="351" slineno="7-17" level="1"><display>(2)</display>A notification under this section is provided for a minor's supervision and student safety.</subsection><subsection ssid="7-null-47" dnum="3-o" numlevel="1" lineno="352" slineno="7-18" level="1" space="false"><display>(3)</display><subsection ssid="7-null-48" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If a minor is taken into temporary custody under Section <xref depth="3" refnumber="80-6-201">80-6-201</xref> for a serious <ln numlevel="1" lineno="353" slineno="7-19"/>offense, the peace officer, or other person who has taken the minor into temporary <ln numlevel="1" lineno="354" slineno="7-20"/>custody, shall notify a school official within five days after the day on which the <ln numlevel="1" lineno="355" slineno="7-21"/>minor is <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both">taken into</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">released from</amend> temporary custody.</subsection><subsection ssid="7-null-49" dnum="b-o" numlevel="1" lineno="356" slineno="7-22" level="2"><display>(b)</display>A notification under this Subsection <xref depth="4" refnumber="80-6-103(3)">(3)</xref> shall only disclose:<subsection ssid="7-null-50" dnum="i-o" numlevel="1" lineno="357" slineno="7-23" level="3"><display>(i)</display>the name of the minor;</subsection><subsection ssid="7-null-51" dnum="ii-o" numlevel="1" lineno="358" slineno="7-24" level="3"><display>(ii)</display>the offense for which the minor was taken into temporary custody or admitted to <ln numlevel="1" lineno="359" slineno="7-25"/>detention; and</subsection><subsection ssid="7-null-52" dnum="iii-o" numlevel="1" lineno="360" slineno="7-26" level="3"><display>(iii)</display>if available, the name of the victim if the victim resides in the same school <ln numlevel="1" lineno="361" slineno="7-27"/>district as the minor or attends the same school as the minor.</subsection></subsection></subsection><subsection ssid="7-null-53" dnum="4-o" numlevel="1" lineno="362" slineno="7-28" level="1"><display>(4)</display>After a detention hearing for a minor who is alleged to have committed a serious <ln numlevel="1" lineno="363" slineno="7-29"/>offense, the juvenile court shall order a juvenile probation officer to notify a school <ln numlevel="1" lineno="364" slineno="7-30"/>official, or a transferee school official, and the appropriate local law enforcement agency <ln numlevel="1" lineno="365" slineno="7-31"/>of the juvenile court's decision, including any disposition, order, or no-contact order.</subsection><subsection ssid="7-null-54" dnum="5-o" numlevel="1" lineno="366" slineno="7-32" level="1"><display>(5)</display>If a designated staff member of a detention facility admits a minor to home detention <ln numlevel="1" lineno="367" slineno="7-33"/>under Section <xref depth="3" refnumber="80-6-205">80-6-205</xref> and notifies the juvenile court of that admission, the juvenile <ln numlevel="1" lineno="368" slineno="7-34"/>court shall order a juvenile probation officer to notify a school official, or a transferee <ln numlevel="1" lineno="369" slineno="7-35"/>school official, and the appropriate local law enforcement agency that the minor has <ln numlevel="1" lineno="370" slineno="7-36"/>been admitted to home detention.</subsection><subsection ssid="7-null-55" dnum="6-o" numlevel="1" lineno="371" slineno="7-37" level="1" space="false"><display>(6)</display><subsection ssid="7-null-56" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If the juvenile court adjudicates a minor for a serious offense, the juvenile court <ln numlevel="1" lineno="372" slineno="7-38"/>shall order a juvenile probation officer to notify a school official, or a transferee <ln numlevel="1" lineno="373" slineno="7-39"/>school official, of the adjudication.</subsection><subsection ssid="7-null-57" dnum="b-o" numlevel="1" lineno="374" slineno="7-40" level="2"><display>(b)</display>A notification under this Subsection <xref depth="4" refnumber="80-6-103(6)">(6)</xref> shall be given to a school official, or a <ln numlevel="1" lineno="375" slineno="7-41"/>transferee school official, within three days after the day on which the minor is <ln numlevel="1" lineno="376" slineno="7-42"/>adjudicated.</subsection><subsection ssid="7-null-58" dnum="c-o" numlevel="1" lineno="377" slineno="7-43" level="2"><display>(c)</display>A notification under this section shall include:<subsection ssid="7-null-59" dnum="i-o" numlevel="1" lineno="378" slineno="7-44" level="3"><display>(i)</display>the name of the minor;</subsection><subsection ssid="7-null-60" dnum="ii-o" numlevel="1" lineno="379" slineno="7-45" level="3"><display>(ii)</display>the offense for which the minor was adjudicated; and</subsection><subsection ssid="7-null-61" dnum="iii-o" numlevel="1" lineno="380" slineno="7-46" level="3"><display>(iii)</display>if available, the name of the victim if the victim:<subsection ssid="7-null-62" dnum="A-o" numlevel="1" lineno="381" slineno="7-47" level="4"><display>(A)</display>resides in the same school district as the minor; or</subsection><subsection ssid="7-null-63" dnum="B-o" numlevel="1" lineno="382" slineno="7-48" level="4"><display>(B)</display>attends the same school as the minor.</subsection></subsection></subsection></subsection><subsection ssid="7-null-64" dnum="7-o" numlevel="1" lineno="383" slineno="7-49" level="1"><display>(7)</display>If the juvenile court orders formal probation under Section <xref depth="3" refnumber="80-6-702">80-6-702</xref>, the juvenile court <ln numlevel="1" lineno="384" slineno="7-50"/>shall order a juvenile probation officer to notify the appropriate local law enforcement <ln numlevel="1" lineno="385" slineno="7-51"/>agency and the school official of the juvenile court's order for formal probation.</subsection><subsection ssid="7-null-65" dnum="8-o" numlevel="1" lineno="386" slineno="7-52" level="1" space="false"><display>(8)</display><subsection ssid="7-null-66" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An employee of the local law enforcement agency, or the school the minor <ln numlevel="1" lineno="387" slineno="7-53"/>attends, who discloses a notification under this section is not:<subsection ssid="7-null-67" dnum="i-o" numlevel="1" lineno="388" slineno="7-54" level="3" tab="1"><display>(i)</display>civilly liable except when the disclosure constitutes fraud or willful misconduct as <ln numlevel="1" lineno="389" slineno="7-55"/>provided in Section <xref depth="3" refnumber="63G-7-202">63G-7-202</xref>; and</subsection><subsection ssid="7-null-68" dnum="ii-o" numlevel="1" lineno="390" slineno="7-56" level="3" tab="1"><display>(ii)</display>civilly or criminally liable except when the disclosure constitutes a knowing <ln numlevel="1" lineno="391" slineno="7-57"/>violation of Section <xref depth="3" refnumber="63G-2-801">63G-2-801</xref>.</subsection></subsection><subsection ssid="7-null-69" dnum="b-o" numlevel="1" lineno="392" slineno="7-58" level="2"><display>(b)</display>An employee of a governmental agency is immune from any criminal liability for <ln numlevel="1" lineno="393" slineno="7-59"/>failing to provide the information required by this section, unless the employee fails <ln numlevel="1" lineno="394" slineno="7-60"/>to act due to malice, gross negligence, or deliberate indifference to the consequences.</subsection></subsection><subsection ssid="7-null-70" dnum="9-o" numlevel="1" lineno="395" slineno="7-61" level="1" space="false"><display>(9)</display><subsection ssid="7-null-71" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A notification under this section shall be classified as a protected record under <ln numlevel="1" lineno="396" slineno="7-62"/>Section <xref depth="3" refnumber="63G-2-305">63G-2-305</xref>.</subsection><subsection ssid="7-null-72" dnum="b-o" numlevel="1" lineno="397" slineno="7-63" level="2"><display>(b)</display>All other records of disclosures under this section are governed by <xref depth="1" refnumber="63G-2">Title 63G, <ln numlevel="1" lineno="398" slineno="7-64"/>Chapter 2, Government Records Access and Management Act</xref>, and the Family <ln numlevel="1" lineno="399" slineno="7-65"/>Educational Rights and Privacy Act, 20 U.S.C.
