Peck</sponsorhead><otherSponsorhead>Senate Sponsor: </otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill expands on a requirement to provide instruction in human development.</gd><hphead lineno="6">Highlighted Provisions:</hphead><hp numlevel="1" lineno="7" slineno="0-7">This bill:<hl numlevel="1" lineno="8" slineno="0-8" level="1"> expands on a requirement to provide instruction in human development;</hl><hl numlevel="1" lineno="9" slineno="0-9" level="1">requires an LEA to:<hl numlevel="1" lineno="10" slineno="0-10" level="2">include certain videos during instruction on human growth and development; and</hl><hl numlevel="1" lineno="11" slineno="0-11" level="2">make instructional materials available to a student's parent upon request;</hl></hl><hl numlevel="1" lineno="12" slineno="0-12" level="1">requires the State Board of Education to:<hl numlevel="1" lineno="13" slineno="0-13" level="2">publish a list of materials;</hl><hl numlevel="1" lineno="14" slineno="0-14" level="2">conduct audits to verify compliance; and</hl><hl numlevel="1" lineno="15" slineno="0-15" level="2">publish audit findings; and</hl></hl><hl numlevel="1" lineno="16" slineno="0-16" level="1">makes technical and conforming changes.</hl></hp><moni numlevel="1" lineno="17" slineno="0-17" display="none">Money Appropriated in this Bill:</moni><moniNone lineno="18">None</moniNone><oc numlevel="1" lineno="19" slineno="0-19">Other Special Clauses:<ocl type="effdate" sort="2" numlevel="1" lineno="20" slineno="0-20">This bill provides a special effective date.</ocl></oc><sa numlevel="1" lineno="21" slineno="0-21">Utah Code Sections Affected:<saamd numlevel="1" lineno="22" slineno="0-22"><snhead>AMENDS:</snhead><sn num="53G-10-402" src="code" uid="C53G-10-S402_2026070120260701" buid="2" sort="53G10 04020020260701" numlevel="1" lineno="23" slineno="0-23"><bold>53G-10-402</bold>, as last amended by Laws of Utah 2025, Chapter 380</sn></saamd></sa></lt><enacthead lineno="24"/><enact numlevel="1" lineno="25" slineno="0-25">Be it enacted by the Legislature of the state of Utah:</enact><bdy><bsec buid="2" num="53G-10-402" type="amend" src="code" uid="C53G-10-S402_2026070120260701" sort="53G10 04020020260701" numlevel="1" lineno="26" slineno="1-1" sn="1"><section number="53G-10-402" numlevel="1" lineno="27" slineno="1-2" type="amend"><secline lineno="26">Section 1. Section <bold>53G-10-402</bold> is amended to read:</secline><catline lineno="27"><bold>53G-10-402<parens/>. Instruction in health -- Parental consent requirements -- Conduct <ln numlevel="1" lineno="28" slineno="1-3"/>and speech of school employees and volunteers -- Political and religious doctrine <ln numlevel="1" lineno="29" slineno="1-4"/>prohibited. </bold></catline><subsection ssid="2-null-1" dnum="1-o" numlevel="1" lineno="30" slineno="1-5" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="2-null-2" dnum="a-o" numlevel="1" lineno="31" slineno="1-6" level="2"><display>(a)</display>"LEA governing board" means a local school board or charter school governing <ln numlevel="1" lineno="32" slineno="1-7"/>board.</subsection><subsection ssid="2-null-3" dnum="b-o" numlevel="1" lineno="33" slineno="1-8" level="2"><display>(b)</display>"Refusal skills" means instruction:<subsection ssid="2-null-4" dnum="i-o" numlevel="1" lineno="34" slineno="1-9" level="3"><display>(i)</display>in a student's ability to clearly and expressly refuse sexual advances by a minor or <ln numlevel="1" lineno="35" slineno="1-10"/>adult;</subsection><subsection ssid="2-null-5" dnum="ii-o" numlevel="1" lineno="36" slineno="1-11" level="3"><display>(ii)</display>in a student's obligation to stop the student's sexual advances if refused by another <ln numlevel="1" lineno="37" slineno="1-12"/>individual;</subsection><subsection ssid="2-null-6" dnum="iii-o" numlevel="1" lineno="38" slineno="1-13" level="3"><display>(iii)</display>informing a student of the student's right to report and seek counseling for <ln numlevel="1" lineno="39" slineno="1-14"/>unwanted sexual advances; and</subsection><subsection ssid="2-null-7" dnum="iv-o" numlevel="1" lineno="40" slineno="1-15" level="3"><display>(iv)</display>informing a student that a student may not consent to criminally prohibited <ln numlevel="1" lineno="41" slineno="1-16"/>activities or activities for which the student is legally prohibited from giving <ln numlevel="1" lineno="42" slineno="1-17"/>consent, including the electronic transmission of sexually explicit images by an <ln numlevel="1" lineno="43" slineno="1-18"/>individual, regardless of whether the image is of the individual who transmits the <ln numlevel="1" lineno="44" slineno="1-19"/>image or of another individual.</subsection></subsection><subsection ssid="2-null-8" dnum="c-o" numlevel="1" lineno="45" slineno="1-20" level="2"><display>(c)</display>"Situational awareness" means instruction in a student's ability to:<subsection ssid="2-null-9" dnum="i-o" numlevel="1" lineno="46" slineno="1-21" level="3"><display>(i)</display>observe the student's environment, including:<subsection ssid="2-null-10" dnum="A-o" numlevel="1" lineno="47" slineno="1-22" level="4"><display>(A)</display>increasing awareness; and</subsection><subsection ssid="2-null-11" dnum="B-o" numlevel="1" lineno="48" slineno="1-23" level="4"><display>(B)</display>noticing details and changes in the environment; and</subsection></subsection><subsection ssid="2-null-12" dnum="ii-o" numlevel="1" lineno="49" slineno="1-24" level="3"><display>(ii)</display>respond in unsafe situations, including how to seek help.</subsection></subsection><subsection ssid="2-null-13" dnum="d-o" numlevel="1" lineno="50" slineno="1-25" level="2"><display>(d)</display>"Success sequence" means a three-prong framework for youth and young adults that <ln numlevel="1" lineno="51" slineno="1-26"/>encourages:<subsection ssid="2-null-14" dnum="i-o" numlevel="1" lineno="52" slineno="1-27" level="3"><display>(i)</display>completing at least a high school education and pursuing further educational <ln numlevel="1" lineno="53" slineno="1-28"/>opportunities;</subsection><subsection ssid="2-null-15" dnum="ii-o" numlevel="1" lineno="54" slineno="1-29" level="3"><display>(ii)</display>obtaining full-time employment; and</subsection><subsection ssid="2-null-16" dnum="iii-o" numlevel="1" lineno="55" slineno="1-30" level="3"><display>(iii)</display>having children within a healthy and stable family and marriage.</subsection></subsection></subsection><subsection ssid="2-null-17" dnum="2-o" numlevel="1" lineno="56" slineno="1-31" level="1" space="false"><display>(2)</display><subsection ssid="2-null-18" dnum="a-o" level="2" placement="sameline"><display>(a)</display>In accordance with Section <xref depth="3" refnumber="53E-3-501">53E-3-501</xref>, the state board shall establish health <ln numlevel="1" lineno="57" slineno="1-32"/>curriculum requirements:<subsection ssid="2-null-19" dnum="i-o" numlevel="1" lineno="58" slineno="1-33" level="3" tab="1"><display>(i)</display>for the purpose of:<subsection ssid="2-null-20" dnum="A-o" numlevel="1" lineno="59" slineno="1-34" level="4"><display>(A)</display>equipping students with practical safety skills regarding sexual abuse, <ln numlevel="1" lineno="60" slineno="1-35"/>trafficking, and harassment;</subsection><subsection ssid="2-null-21" dnum="B-o" numlevel="1" lineno="61" slineno="1-36" level="4"><display>(B)</display>promoting respect for humankind and individual responsibility;</subsection><subsection ssid="2-null-22" dnum="C-o" numlevel="1" lineno="62" slineno="1-37" level="4"><display>(C)</display>fostering character development and decision- making through the success <ln numlevel="1" lineno="63" slineno="1-38"/>sequence; and</subsection><subsection ssid="2-null-23" dnum="D-o" numlevel="1" lineno="64" slineno="1-39" level="4"><display>(D)</display>encouraging healthy personal and family relationships; and</subsection></subsection><subsection ssid="2-null-24" dnum="ii-o" numlevel="1" lineno="65" slineno="1-40" level="3" tab="1"><display>(ii)</display>that include instruction in:<subsection ssid="2-null-25" dnum="A-o" numlevel="1" lineno="66" slineno="1-41" level="4"><display>(A)</display>the success sequence;</subsection><subsection ssid="2-null-26" dnum="B-o" numlevel="1" lineno="67" slineno="1-42" level="4"><display>(B)</display>community and personal health, including personal hygiene and the <ln numlevel="1" lineno="68" slineno="1-43"/>prevention of communicable disease;</subsection><subsection ssid="2-null-27" dnum="C-o" numlevel="1" lineno="69" slineno="1-44" level="4"><display>(C)</display>physiology;</subsection><subsection ssid="2-null-28" dnum="D-o" numlevel="1" lineno="70" slineno="1-45" level="4"><display>(D)</display>human <amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both">growth and </amend>development<amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both">, in accordance with Subsection <xref depth="4" refnumber="53G-10-402(2)(g)">(2)(g)</xref></amend>;</subsection><subsection ssid="2-null-29" dnum="E-o" numlevel="1" lineno="71" slineno="1-46" level="4"><display>(E)</display>marriage and safe dating practices;</subsection><subsection ssid="2-null-30" dnum="F-o" numlevel="1" lineno="72" slineno="1-47" level="4"><display>(F)</display>refusal skills;</subsection><subsection ssid="2-null-31" dnum="G-o" numlevel="1" lineno="73" slineno="1-48" level="4"><display>(G)</display>resilience;</subsection><subsection ssid="2-null-32" dnum="H-o" numlevel="1" lineno="74" slineno="1-49" level="4"><display>(H)</display>situational awareness;</subsection><subsection ssid="2-null-33" dnum="I-o" numlevel="1" lineno="75" slineno="1-50" level="4"><display>(I)</display>the harmful effects of pornography; and</subsection><subsection ssid="2-null-34" dnum="J-o" numlevel="1" lineno="76" slineno="1-51" level="4"><display>(J)</display>the consequences of behaviors that pose a risk to individual health or of failure <ln numlevel="1" lineno="77" slineno="1-52"/>under the success sequence.</subsection></subsection></subsection><subsection ssid="2-null-35" dnum="b-o" numlevel="1" lineno="78" slineno="1-53" level="2"><display>(b)</display>In accordance with <xref depth="1" refnumber="63G-3">Title 63G, Chapter 3, Utah Administrative Rulemaking Act</xref>, the <ln numlevel="1" lineno="79" slineno="1-54"/>state board shall make rules that:<subsection ssid="2-null-36" dnum="i-o" numlevel="1" lineno="80" slineno="1-55" level="3"><display>(i)</display>ensure that instruction stresses the importance of abstinence from all sexual <ln numlevel="1" lineno="81" slineno="1-56"/>activity before marriage and fidelity after marriage as methods for:<subsection ssid="2-null-37" dnum="A-o" numlevel="1" lineno="82" slineno="1-57" level="4"><display>(A)</display>maintaining mental, physical, and social health, including reducing stress;</subsection><subsection ssid="2-null-38" dnum="B-o" numlevel="1" lineno="83" slineno="1-58" level="4"><display>(B)</display>eliminating risks associated with sexual activity, including preventing <ln numlevel="1" lineno="84" slineno="1-59"/>pregnancy and certain communicable diseases; and</subsection><subsection ssid="2-null-39" dnum="C-o" numlevel="1" lineno="85" slineno="1-60" level="4"><display>(C)</display>achieving the success sequence;</subsection></subsection><subsection ssid="2-null-40" dnum="ii-o" numlevel="1" lineno="86" slineno="1-61" level="3"><display>(ii)</display>ensure that instruction stresses personal skills that encourage abstinence, the <ln numlevel="1" lineno="87" slineno="1-62"/>return to abstinence, and fidelity;</subsection><subsection ssid="2-null-41" dnum="iii-o" numlevel="1" lineno="88" slineno="1-63" level="3"><display>(iii)</display>prohibit instruction or discussion, regardless of parental consent or intent to <ln numlevel="1" lineno="89" slineno="1-64"/>receive the prohibited instruction, in or regarding:<subsection ssid="2-null-42" dnum="A-o" numlevel="1" lineno="90" slineno="1-65" level="4"><display>(A)</display>the intricacies of sexual stimulation or erotic behavior;</subsection><subsection ssid="2-null-43" dnum="B-o" numlevel="1" lineno="91" slineno="1-66" level="4"><display>(B)</display>the advocacy of premarital or extramarital sexual activity;</subsection><subsection ssid="2-null-44" dnum="C-o" numlevel="1" lineno="92" slineno="1-67" level="4"><display>(C)</display>the advocacy or encouragement of the use of contraceptive methods or <ln numlevel="1" lineno="93" slineno="1-68"/>devices; and</subsection><subsection ssid="2-null-45" dnum="D-o" numlevel="1" lineno="94" slineno="1-69" level="4"><display>(D)</display>any means or methods that facilitate or encourage the violation of any state or <ln numlevel="1" lineno="95" slineno="1-70"/>federal criminal law by a minor or an adult, including as a response to a <ln numlevel="1" lineno="96" slineno="1-71"/>spontaneous question from a student; and</subsection></subsection><subsection ssid="2-null-46" dnum="iv-o" numlevel="1" lineno="97" slineno="1-72" level="3"><display>(iv)</display>subject to Subsection <xref depth="4" refnumber="53G-10-402(2)(c)">(2)(c)</xref>, allow instruction to include information about <ln numlevel="1" lineno="98" slineno="1-73"/>contraceptive methods or devices, not including abortion or any abortive methods, <ln numlevel="1" lineno="99" slineno="1-74"/>that stresses effectiveness, failure rates for youth, limitations, risks, and <ln numlevel="1" lineno="100" slineno="1-75"/>information on state law applicable to minors obtaining contraceptive methods or <ln numlevel="1" lineno="101" slineno="1-76"/>devices.</subsection></subsection><subsection ssid="2-null-47" dnum="c-o" numlevel="1" lineno="102" slineno="1-77" level="2" space="false"><display>(c)</display><subsection ssid="2-null-48" dnum="i-o" level="3" placement="sameline"><display>(i)</display>As used in this Subsection <xref depth="4" refnumber="53G-10-402(2)">(2)</xref>, "contraceptive methods or devices" does not <ln numlevel="1" lineno="103" slineno="1-78"/>include abortion or any abortive methods.</subsection><subsection ssid="2-null-49" dnum="ii-o" numlevel="1" lineno="104" slineno="1-79" level="3"><display>(ii)</display>Notwithstanding the allowance for instruction about contraceptive methods or <ln numlevel="1" lineno="105" slineno="1-80"/>devices in Subsection <xref depth="4" refnumber="53G-10-402(2)(b)">(2)(b)</xref>:<subsection ssid="2-null-50" dnum="A-o" numlevel="1" lineno="106" slineno="1-81" level="4"><display>(A)</display>the state board may not require an LEA to teach or adopt instructional <ln numlevel="1" lineno="107" slineno="1-82"/>materials that include information on contraceptive methods or devices; and</subsection><subsection ssid="2-null-51" dnum="B-o" numlevel="1" lineno="108" slineno="1-83" level="4"><display>(B)</display>the instruction may not demonstrate or otherwise depict the use of a <ln numlevel="1" lineno="109" slineno="1-84"/>contraceptive method or device.</subsection></subsection></subsection><subsection ssid="2-null-52" dnum="d-o" numlevel="1" lineno="110" slineno="1-85" level="2"><display>(d)</display>The state board shall:<subsection ssid="2-null-53" dnum="i-o" numlevel="1" lineno="111" slineno="1-86" level="3"><display>(i)</display>recommend instructional materials for use in the curricula required under <ln numlevel="1" lineno="112" slineno="1-87"/>Subsection <xref depth="4" refnumber="53G-10-402(2)(a)">(2)(a)</xref>; and</subsection><subsection ssid="2-null-54" dnum="ii-o" numlevel="1" lineno="113" slineno="1-88" level="3"><display>(ii)</display>in accordance with <xref depth="1" refnumber="63G-3">Title 63G, Chapter 3, Utah Administrative Rulemaking Act</xref>, <ln numlevel="1" lineno="114" slineno="1-89"/>make rules for an LEA governing board that adopts alternative instructional <ln numlevel="1" lineno="115" slineno="1-90"/>materials under Subsection <xref depth="4" refnumber="53G-10-402(2)(e)">(2)(e)</xref> to:<subsection ssid="2-null-55" dnum="A-o" numlevel="1" lineno="116" slineno="1-91" level="4"><display>(A)</display>require the LEA governing board to report on the materials the governing <ln numlevel="1" lineno="117" slineno="1-92"/>board selects and the governing board's compliance with Subsection <xref refnumber="53G-10-402(2)(e)" depth="4">(2)(e)</xref>; and</subsection><subsection ssid="2-null-56" dnum="B-o" numlevel="1" lineno="118" slineno="1-93" level="4"><display>(B)</display>provide for an appeal and review process of the LEA governing board's <ln numlevel="1" lineno="119" slineno="1-94"/>adoption of instructional materials.</subsection></subsection></subsection><subsection ssid="2-null-57" dnum="e-o" numlevel="1" lineno="120" slineno="1-95" level="2" space="false"><display>(e)</display><subsection ssid="2-null-58" dnum="i-o" level="3" placement="sameline"><display>(i)</display>An LEA governing board may choose to adopt:<subsection ssid="2-null-59" dnum="A-o" numlevel="1" lineno="121" slineno="1-96" level="4" tab="1"><display>(A)</display>the instructional materials recommended under Subsection <xref depth="4" refnumber="53G-10-402(2)(d)">(2)(d)</xref>; or</subsection><subsection ssid="2-null-60" dnum="B-o" numlevel="1" lineno="122" slineno="1-97" level="4" tab="1"><display>(B)</display>alternative instructional materials in accordance with Subsection <xref depth="4" refnumber="53G-10-402(2)(e)(ii)">(2)(e)(ii)</xref>.</subsection></subsection><subsection ssid="2-null-61" dnum="ii-o" numlevel="1" lineno="123" slineno="1-98" level="3"><display>(ii)</display>An LEA governing board that adopts instructional materials under Subsection <xref depth="4" refnumber="53G-10-402(2)(e)(i)"><ln numlevel="1" lineno="124" slineno="1-99"/>(2)(e)(i)</xref> shall:<subsection ssid="2-null-62" dnum="A-o" numlevel="1" lineno="125" slineno="1-100" level="4"><display>(A)</display>ensure that the materials comply with state law and state board rules;</subsection><subsection ssid="2-null-63" dnum="B-o" numlevel="1" lineno="126" slineno="1-101" level="4"><display>(B)</display>base the adoption of the materials on the recommendations of the LEA <ln numlevel="1" lineno="127" slineno="1-102"/>governing board's Curriculum Materials Review Committee;</subsection><subsection ssid="2-null-64" dnum="C-o" numlevel="1" lineno="128" slineno="1-103" level="4"><display>(C)</display>adopt the instructional materials in an open and regular meeting of the LEA <ln numlevel="1" lineno="129" slineno="1-104"/>governing board for which parents of students who attend the respective <ln numlevel="1" lineno="130" slineno="1-105"/>schools receive prior notice; and</subsection><subsection ssid="2-null-65" dnum="D-o" numlevel="1" lineno="131" slineno="1-106" level="4"><display>(D)</display>give parents an opportunity to express the parents' views and opinions on the <ln numlevel="1" lineno="132" slineno="1-107"/>materials at the meeting described in Subsection <xref depth="4" refnumber="53G-10-402(2)(e)(ii)(C)">(2)(e)(ii)(C)</xref>.</subsection></subsection></subsection><subsection ssid="2-null-66" dnum="f-o" numlevel="1" lineno="133" slineno="1-108" level="2"><display>(f)</display>At the request of the state board, the Department of Health and Human Services shall <ln numlevel="1" lineno="134" slineno="1-109"/>provide recommendations to the state board as the state board develops the <ln numlevel="1" lineno="135" slineno="1-110"/>curriculum, rules, or programs described in this Subsection <xref depth="4" refnumber="53G-10-402(2)">(2)</xref>.</subsection><subsection ssid="2-100" dnum="_-o:g-i" numlevel="1" lineno="136" slineno="1-111" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1066" style="1" owner="i" level="1" amendtag="start">(g)</amend></display><subsection ssid="2-111" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1067" style="1" owner="i" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="46" groupid="33" style="1" owner="jchristopherson" level="1" amendtag="end">Each LEA shall include instruction in grades 3 through 12 on human growth <ln numlevel="1" lineno="137" slineno="1-112"/>and development that includes, at a minimum, both of the following:</amend><subsection ssid="2-101" dnum="_-o:A-i" numlevel="1" lineno="138" slineno="1-113" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1068" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="end">a high-definition ultrasound video, at least three minutes in duration, showing <ln numlevel="1" lineno="139" slineno="1-114"/>the development of the brain, heart, sex organs, and other vital organs in early <ln numlevel="1" lineno="140" slineno="1-115"/>fetal development; and</amend></subsection><subsection ssid="2-102" dnum="_-o:B-i" numlevel="1" lineno="141" slineno="1-116" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1069" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="15" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">a video showing the process of fertilization and each stage of human <ln numlevel="1" lineno="142" slineno="1-117"/>development inside the uterus, noting significant markers in cell growth and <ln numlevel="1" lineno="143" slineno="1-118"/>organ development for every stage of pregnancy until birth.</amend></subsection></subsection><subsection ssid="2-106" dnum="_-o:ii-i" numlevel="1" lineno="144" slineno="1-119" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1070" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="27" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="end">Upon request, an LEA or school shall make available to the parent of a student <ln numlevel="1" lineno="145" slineno="1-120"/>enrolled in the LEA or school any instructional materials the LEA or school uses <ln numlevel="1" lineno="146" slineno="1-121"/>in accordance with this Subsection <xref depth="4" refnumber="53G-10-402(2)(g)">(2)(g)</xref>.</amend></subsection><subsection ssid="2-107" dnum="_-o:iii-i" numlevel="1" lineno="147" slineno="1-122" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1071" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="30" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="end">The state board shall:</amend><subsection ssid="2-108" dnum="_-o:A-i" numlevel="1" lineno="148" slineno="1-123" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1072" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="33" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="end">publish a list of materials the state board deems appropriate for providing <ln numlevel="1" lineno="149" slineno="1-124"/>instruction under this Subsection <xref depth="4" refnumber="53G-10-402(2)(g)">(2)(g)</xref> on the state board's publicly accessible <ln numlevel="1" lineno="150" slineno="1-125"/>website;</amend></subsection><subsection ssid="2-113" dnum="_-o:B-i" numlevel="1" lineno="151" slineno="1-126" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1073" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="56" groupid="41" style="1" owner="jchristopherson" level="1" amendtag="end">at the beginning of each school year, conduct an audit of each LEA to verify <ln numlevel="1" lineno="152" slineno="1-127"/>the LEA's compliance with this section; and</amend></subsection><subsection ssid="2-109" dnum="_-o:C-i" numlevel="1" lineno="153" slineno="1-128" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1074" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="36" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="end">publish the findings of each audit no later than 120 days after the beginning of <ln numlevel="1" lineno="154" slineno="1-129"/>the school year on the state board's publicly accessible website.</amend></subsection></subsection></subsection></subsection><subsection ssid="2-null-67" dnum="3-o" numlevel="1" lineno="155" slineno="1-130" level="1"><display>(3)</display>A student shall receive the instruction described in Subsection <xref depth="4" refnumber="53G-10-402(2)">(2)</xref> on at least two <ln numlevel="1" lineno="156" slineno="1-131"/>occasions between the beginning of grade 7 and the end of grade 12.</subsection><subsection ssid="2-null-68" dnum="4-o" numlevel="1" lineno="157" slineno="1-132" level="1" space="false"><display>(4)</display><subsection ssid="2-null-69" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The state board shall, in accordance with <xref depth="1" refnumber="63G-3">Title 63G, Chapter 3, Utah <ln numlevel="1" lineno="158" slineno="1-133"/>Administrative Rulemaking Act</xref>, make rules that:<subsection ssid="2-null-70" dnum="i-o" numlevel="1" lineno="159" slineno="1-134" level="3" tab="1"><display>(i)</display>provide for the compliance with the parental consent requirements of <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="63" groupid="44" style="2" owner="jchristopherson" level="1" deltag="both">Sections</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="62" groupid="43" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="160" slineno="1-135"/>Section</amend> <xref depth="3" refnumber="76-7-322">76-7-322</xref>; and</subsection><subsection ssid="2-null-71" dnum="ii-o" numlevel="1" lineno="161" slineno="1-136" level="3" tab="1"><display>(ii)</display>require advance notice to a student's parent that provides an opportunity to review <ln numlevel="1" lineno="162" slineno="1-137"/>the information for which parental consent is required under Sections <xref depth="3" refnumber="76-7-322">76-7-322</xref> <ln numlevel="1" lineno="163" slineno="1-138"/>and <xref depth="3" refnumber="76-7-323">76-7-323</xref>.</subsection></subsection><subsection ssid="2-null-72" dnum="b-o" numlevel="1" lineno="164" slineno="1-139" level="2"><display>(b)</display>The state board shall provide procedures for disciplinary action for violation of <ln numlevel="1" lineno="165" slineno="1-140"/>Section <xref depth="3" refnumber="76-7-322">76-7-322</xref> or <xref depth="3" refnumber="76-7-323">76-7-323</xref>.</subsection></subsection><subsection ssid="2-null-73" dnum="5-o" numlevel="1" lineno="166" slineno="1-141" level="1" space="false"><display>(5)</display><subsection ssid="2-null-74" dnum="a-o" level="2" placement="sameline"><display>(a)</display>In accordance with Section <xref depth="3" refnumber="53G-10-204">53G-10-204</xref> and Subsection <xref refnumber="53G-10-402(2)" depth="4">(2)</xref><xref depth="4" refnumber="53G-10-402(b)(iii)">(b)(iii)</xref>, and because <ln numlevel="1" lineno="167" slineno="1-142"/>school employees and volunteers serve as examples to students, school employees or <ln numlevel="1" lineno="168" slineno="1-143"/>volunteers acting in an official capacity may not support or encourage criminal <ln numlevel="1" lineno="169" slineno="1-144"/>conduct by students, teachers, or volunteers.</subsection><subsection ssid="2-null-75" dnum="b-o" numlevel="1" lineno="170" slineno="1-145" level="2"><display>(b)</display>To ensure the effective performance of school personnel, the limitations described in <ln numlevel="1" lineno="171" slineno="1-146"/>Subsection <xref depth="4" refnumber="53G-10-402(5)(a)">(5)(a)</xref> also apply to a school employee or volunteer acting outside of the <ln numlevel="1" lineno="172" slineno="1-147"/>school employee's or volunteer's official capacity if:<subsection ssid="2-null-76" dnum="i-o" numlevel="1" lineno="173" slineno="1-148" level="3"><display>(i)</display>the employee or volunteer knew or should have known that the employee's or <ln numlevel="1" lineno="174" slineno="1-149"/>volunteer's action could result in a material and substantial interference or <ln numlevel="1" lineno="175" slineno="1-150"/>disruption in the normal activities of the school; and</subsection><subsection ssid="2-null-77" dnum="ii-o" numlevel="1" lineno="176" slineno="1-151" level="3"><display>(ii)</display>the employee's or volunteer's action results in a material and substantial <ln numlevel="1" lineno="177" slineno="1-152"/>interference or disruption in the normal activities of the school.</subsection></subsection><subsection ssid="2-null-78" dnum="c-o" numlevel="1" lineno="178" slineno="1-153" level="2"><display>(c)</display>The state board or an LEA governing board may not allow training of school <ln numlevel="1" lineno="179" slineno="1-154"/>employees or volunteers that supports or encourages criminal conduct.</subsection><subsection ssid="2-null-79" dnum="d-o" numlevel="1" lineno="180" slineno="1-155" level="2"><display>(d)</display>The state board shall, in accordance with <xref depth="1" refnumber="63G-3">Title 63G, Chapter 3, Utah Administrative <ln numlevel="1" lineno="181" slineno="1-156"/>Rulemaking Act</xref>, make rules implementing this Subsection <xref depth="4" refnumber="53G-10-402(5)">(5)</xref>.</subsection><subsection ssid="2-null-80" dnum="e-o" numlevel="1" lineno="182" slineno="1-157" level="2"><display>(e)</display>Nothing in this section limits the ability or authority of the state board or an LEA <ln numlevel="1" lineno="183" slineno="1-158"/>governing board to enact and enforce rules or take actions that are otherwise lawful <ln numlevel="1" lineno="184" slineno="1-159"/>regarding an educator's, employee's, or volunteer's qualifications or behavior <ln numlevel="1" lineno="185" slineno="1-160"/>evidencing unfitness for duty.</subsection></subsection><subsection ssid="2-null-81" dnum="6-o" numlevel="1" lineno="186" slineno="1-161" level="1"><display>(6)</display>Except as provided in Section <xref depth="3" refnumber="53G-10-202">53G-10-202</xref>, an individual may not teach or provide <ln numlevel="1" lineno="187" slineno="1-162"/>instruction on political, atheistic, sectarian, religious, or denominational doctrine in the <ln numlevel="1" lineno="188" slineno="1-163"/>public schools.</subsection><subsection ssid="2-null-82" dnum="7-o" numlevel="1" lineno="189" slineno="1-164" level="1" space="false"><display>(7)</display><subsection ssid="2-null-83" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An LEA governing board and an LEA governing board's employees shall <ln numlevel="1" lineno="190" slineno="1-165"/>cooperate and share responsibility in carrying out the purposes of this chapter.</subsection><subsection ssid="2-null-84" dnum="b-o" numlevel="1" lineno="191" slineno="1-166" level="2"><display>(b)</display>An LEA governing board shall:<subsection ssid="2-null-85" dnum="i-o" numlevel="1" lineno="192" slineno="1-167" level="3" space="false"><display>(i)</display><subsection ssid="2-null-86" dnum="A-o" level="4" placement="sameline"><display>(A)</display>provide appropriate professional development for the LEA governing <ln numlevel="1" lineno="193" slineno="1-168"/>board's teachers, counselors, and school administrators to enable the teachers, <ln numlevel="1" lineno="194" slineno="1-169"/>counselors, and school administrators to understand, protect, and properly <ln numlevel="1" lineno="195" slineno="1-170"/>instruct students in the values and character traits referred to in this section and <ln numlevel="1" lineno="196" slineno="1-171"/>Sections <xref depth="3" refnumber="53E-9-202">53E-9-202</xref>, <xref depth="3" refnumber="53E-9-203">53E-9-203</xref>, <xref depth="3" refnumber="53G-10-202">53G-10-202</xref>, <xref depth="3" refnumber="53G-10-203">53G-10-203</xref>, <xref depth="3" refnumber="53G-10-204">53G-10-204</xref>, and <xref depth="3" refnumber="53G-10-205"><ln numlevel="1" lineno="197" slineno="1-172"/>53G-10-205</xref>; and</subsection><subsection ssid="2-null-87" dnum="B-o" numlevel="1" lineno="198" slineno="1-173" level="4"><display>(B)</display>distribute appropriate written materials on the values, character traits, and <ln numlevel="1" lineno="199" slineno="1-174"/>conduct described in Subsection <xref tempid="585" depth="4" refnumber="53G-10-402(7)(b)(i)">(7)(b)(i)</xref> to each individual receiving the <ln numlevel="1" lineno="200" slineno="1-175"/>professional development; and</subsection></subsection><subsection ssid="2-null-88" dnum="ii-o" numlevel="1" lineno="201" slineno="1-176" level="3"><display>(ii)</display>make the written materials described in Subsection <xref depth="4" refnumber="53G-10-402(7)(b)">(7)(b)</xref> available to education <ln numlevel="1" lineno="202" slineno="1-177"/>support professionals, students, and students' parents.</subsection></subsection><subsection ssid="2-null-89" dnum="c-o" numlevel="1" lineno="203" slineno="1-178" level="2"><display>(c)</display>To assist an LEA governing board in providing the professional development <ln numlevel="1" lineno="204" slineno="1-179"/>required under Subsection <xref depth="4" refnumber="53G-10-402(7)(b)">(7)(b)</xref>, the state board shall, as appropriate, contract with a <ln numlevel="1" lineno="205" slineno="1-180"/>qualified individual or entity possessing expertise in the areas described in <ln numlevel="1" lineno="206" slineno="1-181"/>Subsection <xref depth="4" refnumber="53G-10-402(7)(b)">(7)(b)</xref> to develop and disseminate model teacher professional <ln numlevel="1" lineno="207" slineno="1-182"/>development programs that an LEA governing board may use to train the individuals <ln numlevel="1" lineno="208" slineno="1-183"/>described in Subsection <xref depth="4" refnumber="53G-10-402(7)(b)">(7)(b)</xref> to effectively teach the values and qualities of <ln numlevel="1" lineno="209" slineno="1-184"/>character described in Subsection <xref depth="4" refnumber="53G-10-402(7)(b)">(7)(b)</xref>.</subsection><subsection ssid="2-null-90" dnum="d-o" numlevel="1" lineno="210" slineno="1-185" level="2"><display>(d)</display>In accordance with Subsection <xref depth="4" refnumber="53G-10-402(5)(c)">(5)(c)</xref>, professional development may not support or <ln numlevel="1" lineno="211" slineno="1-186"/>encourage criminal conduct.</subsection></subsection><subsection ssid="2-null-91" dnum="8-o" numlevel="1" lineno="212" slineno="1-187" level="1"><display>(8)</display>An LEA governing board shall review every two years:<subsection ssid="2-null-92" dnum="a-o" numlevel="1" lineno="213" slineno="1-188" level="2"><display>(a)</display>LEA governing board policies on instruction described in this section;</subsection><subsection ssid="2-null-93" dnum="b-o" numlevel="1" lineno="214" slineno="1-189" level="2"><display>(b)</display>for a local school board, data for each county in which the school district is located, <ln numlevel="1" lineno="215" slineno="1-190"/>or, for a charter school governing board, data for the county in which the charter <ln numlevel="1" lineno="216" slineno="1-191"/>school is located, on the following:<subsection ssid="2-null-94" dnum="i-o" numlevel="1" lineno="217" slineno="1-192" level="3"><display>(i)</display>teen pregnancy;</subsection><subsection ssid="2-null-95" dnum="ii-o" numlevel="1" lineno="218" slineno="1-193" level="3"><display>(ii)</display>child sexual abuse; and</subsection><subsection ssid="2-null-96" dnum="iii-o" numlevel="1" lineno="219" slineno="1-194" level="3"><display>(iii)</display>sexually transmitted diseases and sexually transmitted infections; and</subsection></subsection><subsection ssid="2-null-97" dnum="c-o" numlevel="1" lineno="220" slineno="1-195" level="2"><display>(c)</display>the number of pornography complaints or other instances reported within the <ln numlevel="1" lineno="221" slineno="1-196"/>jurisdiction of the LEA governing board.</subsection></subsection><subsection ssid="2-null-98" dnum="9-o" numlevel="1" lineno="222" slineno="1-197" level="1"><display>(9)</display>If any one or more provision, subsection, sentence, clause, phrase, or word of this <ln numlevel="1" lineno="223" slineno="1-198"/>section, or the application thereof to any person or circumstance, is found to be <ln numlevel="1" lineno="224" slineno="1-199"/>unconstitutional, the balance of this section shall be given effect without the invalid <ln numlevel="1" lineno="225" slineno="1-200"/>provision, subsection, sentence, clause, phrase, or word.</subsection></section></bsec><bsec buid="4" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="226" slineno="2-1" sn="2"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="226">Section 2.  <bold>Effective Date.</bold></secline><sectionText lineno="227"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="7/1/2026">July 1, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>1-21-26 1:58 PM</tm></rev></foot></leg>
