Section <bold>11-14-103</bold> is amended to read:</secline><catline lineno="27"><bold>11-14-103<parens/>. Bond issues authorized -- Purposes -- Use of bond proceeds.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="28" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>Any local political subdivision may, in the manner and subject to the limitations and <ln numlevel="1" lineno="29" slineno="1-4"/>restrictions contained in this chapter, issue <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="7" groupid="6" style="2" owner="jchristopherson" level="1" deltag="both">its</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the local political subdivision's</amend> <ln numlevel="1" lineno="30" slineno="1-5"/>negotiable bonds for the purpose of paying all or part of the cost of:<subsection ssid="3-null-2" dnum="a-o" numlevel="1" lineno="31" slineno="1-6" level="2"><display>(a)</display>acquiring, improving, or extending any one or more improvements, facilities, or <ln numlevel="1" lineno="32" slineno="1-7"/>property that the local political subdivision is authorized by law to acquire, improve, <ln numlevel="1" lineno="33" slineno="1-8"/>or extend;</subsection><subsection ssid="3-null-3" dnum="b-o" numlevel="1" lineno="34" slineno="1-9" level="2"><display>(b)</display>acquiring, or acquiring an interest in, any one or more or any combination of the <ln numlevel="1" lineno="35" slineno="1-10"/>following types of improvements, facilities, or property to be owned by the local <ln numlevel="1" lineno="36" slineno="1-11"/>political subdivision, either alone or jointly with one or more other local political <ln numlevel="1" lineno="37" slineno="1-12"/>subdivisions, or for the improvement or extension of any of those wholly or jointly <ln numlevel="1" lineno="38" slineno="1-13"/>owned improvements, facilities, or properties:<subsection ssid="3-null-4" dnum="i-o" numlevel="1" lineno="39" slineno="1-14" level="3"><display>(i)</display>public buildings of every nature, including without limitation, offices, <ln numlevel="1" lineno="40" slineno="1-15"/>courthouses, jails, fire, police and sheriff's stations, detention homes, and any <ln numlevel="1" lineno="41" slineno="1-16"/>other buildings to accommodate or house lawful activities of a local political <ln numlevel="1" lineno="42" slineno="1-17"/>subdivision;</subsection><subsection ssid="3-null-5" dnum="ii-o" numlevel="1" lineno="43" slineno="1-18" level="3"><display>(ii)</display>waterworks, irrigation systems, water systems, dams, reservoirs, water treatment <ln numlevel="1" lineno="44" slineno="1-19"/>plants, and any other improvements, facilities, or property used in connection with <ln numlevel="1" lineno="45" slineno="1-20"/>the acquisition, storage, transportation, and supplying of water for domestic, <ln numlevel="1" lineno="46" slineno="1-21"/>industrial, irrigation, recreational, and other purposes and preventing pollution of <ln numlevel="1" lineno="47" slineno="1-22"/>water;</subsection><subsection ssid="3-null-6" dnum="iii-o" numlevel="1" lineno="48" slineno="1-23" level="3"><display>(iii)</display>sewer systems, sewage treatment plants, incinerators, and other improvements, <ln numlevel="1" lineno="49" slineno="1-24"/>facilities, or property used in connection with the collection, treatment, and <ln numlevel="1" lineno="50" slineno="1-25"/>disposal of sewage, garbage, or other refuse;</subsection><subsection ssid="3-null-7" dnum="iv-o" numlevel="1" lineno="51" slineno="1-26" level="3"><display>(iv)</display>drainage and flood control systems, storm sewers, and any other improvements, <ln numlevel="1" lineno="52" slineno="1-27"/>facilities, or property used in connection with the collection, transportation, or <ln numlevel="1" lineno="53" slineno="1-28"/>disposal of water;</subsection><subsection ssid="3-null-8" dnum="v-o" numlevel="1" lineno="54" slineno="1-29" level="3"><display>(v)</display>recreational facilities of every kind, including without limitation, athletic and play <ln numlevel="1" lineno="55" slineno="1-30"/>facilities, playgrounds, athletic fields, gymnasiums, public baths, swimming pools, <ln numlevel="1" lineno="56" slineno="1-31"/>camps, parks, picnic grounds, fairgrounds, golf courses, zoos, boating facilities, <ln numlevel="1" lineno="57" slineno="1-32"/>tennis courts, auditoriums, stadiums, arenas, and theaters;</subsection><subsection ssid="3-null-9" dnum="vi-o" numlevel="1" lineno="58" slineno="1-33" level="3"><display>(vi)</display>convention centers, sports arenas, auditoriums, theaters, and other facilities for <ln numlevel="1" lineno="59" slineno="1-34"/>the holding of public assemblies, conventions, and other meetings;</subsection><subsection ssid="3-null-10" dnum="vii-o" numlevel="1" lineno="60" slineno="1-35" level="3"><display>(vii)</display>roads, bridges, viaducts, tunnels, sidewalks, curbs, gutters, and parking <ln numlevel="1" lineno="61" slineno="1-36"/>buildings, lots, and facilities;</subsection><subsection ssid="3-null-11" dnum="viii-o" numlevel="1" lineno="62" slineno="1-37" level="3"><display>(viii)</display>airports, landing fields, landing strips, and air navigation facilities;</subsection><subsection ssid="3-null-12" dnum="ix-o" numlevel="1" lineno="63" slineno="1-38" level="3"><display>(ix)</display>educational facilities, including without limitation, schools, gymnasiums, <ln numlevel="1" lineno="64" slineno="1-39"/>auditoriums, theaters, museums, art galleries, libraries, stadiums, arenas, and <ln numlevel="1" lineno="65" slineno="1-40"/>fairgrounds;</subsection><subsection ssid="3-null-13" dnum="x-o" numlevel="1" lineno="66" slineno="1-41" level="3"><display>(x)</display>hospitals, convalescent homes, and homes for the aged or indigent; and</subsection><subsection ssid="3-null-14" dnum="xi-o" numlevel="1" lineno="67" slineno="1-42" level="3"><display>(xi)</display>electric light works, electric generating systems, and any other improvements, <ln numlevel="1" lineno="68" slineno="1-43"/>facilities, or property used in connection with the generation and acquisition of <ln numlevel="1" lineno="69" slineno="1-44"/>electricity for these local political subdivisions and transmission facilities and <ln numlevel="1" lineno="70" slineno="1-45"/>substations if they do not duplicate transmission facilities and substations of other <ln numlevel="1" lineno="71" slineno="1-46"/>entities operating in the state prepared to provide the proposed service unless these <ln numlevel="1" lineno="72" slineno="1-47"/>transmission facilities and substations proposed to be constructed will be more <ln numlevel="1" lineno="73" slineno="1-48"/>economical to these local political subdivisions;</subsection></subsection><subsection ssid="3-null-15" dnum="c-o" numlevel="1" lineno="74" slineno="1-49" level="2"><display>(c)</display>new construction, renovation, or improvement to a state highway within the <ln numlevel="1" lineno="75" slineno="1-50"/>boundaries of the local political subdivision or an environmental study for a state <ln numlevel="1" lineno="76" slineno="1-51"/>highway within the boundaries of the local political subdivision; or</subsection><subsection ssid="3-null-16" dnum="d-o" numlevel="1" lineno="77" slineno="1-52" level="2"><display>(d)</display>except as provided in Subsection (5), the portion of any claim, settlement, or <ln numlevel="1" lineno="78" slineno="1-53"/>judgment that exceeds $3,000,000.</subsection></subsection><subsection ssid="3-null-17" dnum="2-o" numlevel="1" lineno="79" slineno="1-54" level="1"><display>(2)</display>Except as provided in Subsection (1)(c), any improvement, facility, or property under <ln numlevel="1" lineno="80" slineno="1-55"/>Subsection (1) need not lie within the limits of the local political subdivision.</subsection><subsection ssid="3-null-18" dnum="3-o" numlevel="1" lineno="81" slineno="1-56" level="1"><display>(3)</display>A cost under Subsection (1) may include:<subsection ssid="3-null-19" dnum="a-o" numlevel="1" lineno="82" slineno="1-57" level="2"><display>(a)</display>the cost of equipment and furnishings for such improvements, facilities, or property;</subsection><subsection ssid="3-null-20" dnum="b-o" numlevel="1" lineno="83" slineno="1-58" level="2"><display>(b)</display>all costs incident to the authorization and issuance of bonds, including engineering, <ln numlevel="1" lineno="84" slineno="1-59"/>legal, and fiscal advisers' fees;</subsection><subsection ssid="3-null-21" dnum="c-o" numlevel="1" lineno="85" slineno="1-60" level="2"><display>(c)</display>costs incident to the issuance of bond anticipation notes, including interest to accrue <ln numlevel="1" lineno="86" slineno="1-61"/>on bond anticipation notes;</subsection><subsection ssid="3-null-22" dnum="d-o" numlevel="1" lineno="87" slineno="1-62" level="2"><display>(d)</display>interest estimated to accrue on the bonds during the period to be covered by the <ln numlevel="1" lineno="88" slineno="1-63"/>construction of the improvement, facility, or property and for 12 months after that <ln numlevel="1" lineno="89" slineno="1-64"/>period; and</subsection><subsection ssid="3-null-23" dnum="e-o" numlevel="1" lineno="90" slineno="1-65" level="2"><display>(e)</display>other amounts which the governing body finds necessary to establish bond reserve <ln numlevel="1" lineno="91" slineno="1-66"/>funds and to provide working capital related to the improvement, facility, or property.</subsection></subsection><subsection ssid="3-null-24" dnum="4-o" numlevel="1" lineno="92" slineno="1-67" level="1" space="false"><display>(4)</display><subsection ssid="3-null-25" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection (4)(b), the proceeds from bonds issued on or <ln numlevel="1" lineno="93" slineno="1-68"/>after May 14, 2013, may not be used:<subsection ssid="3-null-26" dnum="i-o" numlevel="1" lineno="94" slineno="1-69" level="3" tab="1"><display>(i)</display>for operation and maintenance expenses for more than one year after the date any <ln numlevel="1" lineno="95" slineno="1-70"/>of the proceeds are first used for those expenses; or</subsection><subsection ssid="3-null-27" dnum="ii-o" numlevel="1" lineno="96" slineno="1-71" level="3" tab="1"><display>(ii)</display>for capitalization of interest more than five years after the bonds are issued.</subsection></subsection><subsection ssid="3-null-28" dnum="b-o" numlevel="1" lineno="97" slineno="1-72" level="2"><display>(b)</display>The restrictions on the use of bond proceeds under Subsection (4)(a) do not apply to <ln numlevel="1" lineno="98" slineno="1-73"/>bonds issued to pay all or part of the costs of a claim, settlement, or judgment under <ln numlevel="1" lineno="99" slineno="1-74"/>Subsection (1)(d).</subsection></subsection><subsection ssid="3-null-29" dnum="5-o" numlevel="1" lineno="100" slineno="1-75" level="1"><display>(5)</display>Beginning on or after July 1, 2021, a local political subdivision may not issue its <ln numlevel="1" lineno="101" slineno="1-76"/>negotiable bonds for a purpose described in Subsection (1)(d).</subsection><subsection ssid="3-null-30" dnum="6-o" numlevel="1" lineno="102" slineno="1-77" level="1" space="false"><display>(6)</display><subsection ssid="3-null-31" dnum="a-o" level="2" placement="sameline"><display>(a)</display>As used in this Subsection (6):<subsection ssid="3-null-32" dnum="i-o" numlevel="1" lineno="103" slineno="1-78" level="3" tab="1"><display>(i)</display>"Applicable lease revenue bond" means a lease revenue bond in an amount that <ln numlevel="1" lineno="104" slineno="1-79"/>exceeds $10,000,000.</subsection><subsection ssid="3-null-33" dnum="ii-o" numlevel="1" lineno="105" slineno="1-80" level="3" tab="1"><display>(ii)</display>"Combined total" means the total of all lease revenue bonds issued by a local <ln numlevel="1" lineno="106" slineno="1-81"/>political subdivision within any consecutive three-year period.</subsection></subsection><subsection ssid="3-null-34" dnum="b-o" numlevel="1" lineno="107" slineno="1-82" level="2" space="false"><display>(b)</display><subsection ssid="3-null-35" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A local political subdivision may not issue a lease revenue bond if the issuance <ln numlevel="1" lineno="108" slineno="1-83"/>of the bond will cause the combined total to exceed $200,000,000.</subsection><subsection ssid="3-null-36" dnum="ii-o" numlevel="1" lineno="109" slineno="1-84" level="3"><display>(ii)</display>The amount of a lease revenue bond to pay for the construction, reconstruction, or <ln numlevel="1" lineno="110" slineno="1-85"/>remodeling of a correctional facility, as defined in Section <xref depth="3" refnumber="77-17b-102">77-17b-102</xref>, does not <ln numlevel="1" lineno="111" slineno="1-86"/>count toward the combined total.</subsection></subsection><subsection ssid="3-73" dnum="_-o:c-i" numlevel="1" lineno="112" slineno="1-87" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1036" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="end">A school district may not issue a lease revenue bond to pay for the construction, <ln numlevel="1" lineno="113" slineno="1-88"/>reconstruction, or remodeling of a school district building or facility unless, in <ln numlevel="1" lineno="114" slineno="1-89"/>accordance with Title 11, Chapter 14, Part 2, Bond Elections, the school district first <ln numlevel="1" lineno="115" slineno="1-90"/>gives the voters of the school district an opportunity to approve a general obligation <ln numlevel="1" lineno="116" slineno="1-91"/>bond, described in Section 11-14-310, to pay for the construction, reconstruction, or <ln numlevel="1" lineno="117" slineno="1-92"/>remodeling of the school district building or facility instead of the lease revenue bond.</amend></subsection><subsection ssid="3-null-37" dnum="c-o:d-i" numlevel="1" lineno="118" slineno="1-93" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1037" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1038" style="1" owner="i" level="1" amendtag="both" space="true">(d)</amend></display>Before issuing an applicable lease revenue bond on or after May 1, 2024, a local <ln numlevel="1" lineno="119" slineno="1-94"/>political subdivision shall:<subsection ssid="3-null-38" dnum="i-o" numlevel="1" lineno="120" slineno="1-95" level="3"><display>(i)</display>make a statement at a meeting of the local political subdivision, as provided in <ln numlevel="1" lineno="121" slineno="1-96"/>Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="57" groupid="55" style="2" owner="jchristopherson" level="1" deltag="both">(6)(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="23" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(6)(e)</amend>;</subsection><subsection ssid="3-null-39" dnum="ii-o" numlevel="1" lineno="122" slineno="1-97" level="3"><display>(ii)</display>as provided in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="58" groupid="56" style="2" owner="jchristopherson" level="1" deltag="both">(6)(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="24" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(6)(f)</amend>, publish notice of the proposed issuance <ln numlevel="1" lineno="123" slineno="1-98"/>of a lease revenue bond and of the public hearing under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="59" groupid="57" style="2" owner="jchristopherson" level="1" deltag="both">(6)(f)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="25" groupid="23" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(6)(g)</amend>; <ln numlevel="1" lineno="124" slineno="1-99"/>and</subsection><subsection ssid="3-null-40" dnum="iii-o" numlevel="1" lineno="125" slineno="1-100" level="3"><display>(iii)</display>hold a public hearing, as provided in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="60" groupid="58" style="2" owner="jchristopherson" level="1" deltag="both">(6)(f)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="26" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(6)(g)</amend>.</subsection></subsection><subsection ssid="3-null-41" dnum="d-o:e-i" numlevel="1" lineno="126" slineno="1-101" level="2" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1041" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1042" style="1" owner="i" level="1" amendtag="both" space="true">(e)</amend></display><subsection ssid="3-null-42" dnum="i-o" level="3" placement="sameline"><display>(i)</display>At a regular meeting of the local political subdivision that is held at least <ln numlevel="1" lineno="127" slineno="1-102"/>14 days before a public hearing under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="32" groupid="30" style="2" owner="jchristopherson" level="1" deltag="both">(6)(f)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="27" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(6)(f)</amend>, the governing <ln numlevel="1" lineno="128" slineno="1-103"/>body of a local political subdivision intending to issue an applicable lease revenue <ln numlevel="1" lineno="129" slineno="1-104"/>bond shall make a statement indicating:<subsection ssid="3-null-43" dnum="A-o" numlevel="1" lineno="130" slineno="1-105" level="4" tab="1"><display>(A)</display>the intent to issue a lease revenue bond; and</subsection><subsection ssid="3-null-44" dnum="B-o" numlevel="1" lineno="131" slineno="1-106" level="4" tab="1"><display>(B)</display>the purpose and estimated amount of the lease revenue bond.</subsection></subsection><subsection ssid="3-null-45" dnum="ii-o" numlevel="1" lineno="132" slineno="1-107" level="3"><display>(ii)</display>The local political subdivision's agenda under Section <xref depth="3" refnumber="52-4-202">52-4-202</xref> for a meeting <ln numlevel="1" lineno="133" slineno="1-108"/>described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="61" groupid="59" style="2" owner="jchristopherson" level="1" deltag="both">(6)(d)(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="45" groupid="43" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(6)(e)(i)</amend> shall include a separate item for the <ln numlevel="1" lineno="134" slineno="1-109"/>statement required under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="62" groupid="60" style="2" owner="jchristopherson" level="1" deltag="both">(6)(d)(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="46" groupid="44" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(6)(e)(i)</amend>.</subsection></subsection><subsection ssid="3-null-46" dnum="e-o:f-i" numlevel="1" lineno="135" slineno="1-110" level="2" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1046" style="2" owner="o" level="1" deltag="both">(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1047" style="1" owner="i" level="1" amendtag="both" space="true">(f)</amend></display><subsection ssid="3-null-47" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A local political subdivision intending to issue an applicable lease revenue <ln numlevel="1" lineno="136" slineno="1-111"/>bond shall provide notice of the intent to issue a lease revenue bond and of the <ln numlevel="1" lineno="137" slineno="1-112"/>public hearing required under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="63" groupid="61" style="2" owner="jchristopherson" level="1" deltag="both">(6)(f)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="47" groupid="45" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(6)(g)</amend>.</subsection><subsection ssid="3-null-48" dnum="ii-o" numlevel="1" lineno="138" slineno="1-113" level="3"><display>(ii)</display>The notice required under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="64" groupid="62" style="2" owner="jchristopherson" level="1" deltag="both">(6)(e)(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="48" groupid="46" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(6)(f)(i)</amend> shall be published:<subsection ssid="3-null-49" dnum="A-o" numlevel="1" lineno="139" slineno="1-114" level="4"><display>(A)</display>subject to Section <xref depth="3" refnumber="45-1-101">45-1-101</xref>, in a newspaper or combination of newspapers of <ln numlevel="1" lineno="140" slineno="1-115"/>general circulation in the local political subdivision;</subsection><subsection ssid="3-null-50" dnum="B-o" numlevel="1" lineno="141" slineno="1-116" level="4"><display>(B)</display>electronically in accordance with Section <xref depth="3" refnumber="45-1-101">45-1-101</xref>; and</subsection><subsection ssid="3-null-51" dnum="C-o" numlevel="1" lineno="142" slineno="1-117" level="4"><display>(C)</display>for the local political subdivision, as a class A notice under Section <xref depth="3" refnumber="63G-30-102"><ln numlevel="1" lineno="143" slineno="1-118"/>63G-30-102</xref>, for at least 14 days immediately before the public hearing under <ln numlevel="1" lineno="144" slineno="1-119"/>Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="65" groupid="63" style="2" owner="jchristopherson" level="1" deltag="both">(6)(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="49" groupid="47" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(6)(e)</amend>.</subsection></subsection><subsection ssid="3-null-52" dnum="iii-o" numlevel="1" lineno="145" slineno="1-120" level="3"><display>(iii)</display>If the local political subdivision intending to issue an applicable lease revenue <ln numlevel="1" lineno="146" slineno="1-121"/>bond is a school district, the notice required by Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="66" groupid="64" style="2" owner="jchristopherson" level="1" deltag="both">(6)(e)(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="50" groupid="48" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(6)(f)(i)</amend> shall <ln numlevel="1" lineno="147" slineno="1-122"/>include a statement that contains substantially the following language: "This <ln numlevel="1" lineno="148" slineno="1-123"/>proposed lease revenue bond commits money from future property tax and income <ln numlevel="1" lineno="149" slineno="1-124"/>tax revenue allocated to the school district.  Additionally, a lease revenue bond <ln numlevel="1" lineno="150" slineno="1-125"/>generally has a higher interest cost than a voter-approved general obligation bond."</subsection><subsection ssid="3-null-53" dnum="iv-o" numlevel="1" lineno="151" slineno="1-126" level="3"><display>(iv)</display>The notice described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="67" groupid="65" style="2" owner="jchristopherson" level="1" deltag="both">(6)(e)(ii)(A)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="51" groupid="49" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(6)(f)(ii)(A)</amend>:<subsection ssid="3-null-54" dnum="A-o" numlevel="1" lineno="152" slineno="1-127" level="4"><display>(A)</display>shall be no less than 1/4 page in size, use type no smaller than 18 point, and be <ln numlevel="1" lineno="153" slineno="1-128"/>surrounded by a 1/4-inch border;</subsection><subsection ssid="3-null-55" dnum="B-o" numlevel="1" lineno="154" slineno="1-129" level="4"><display>(B)</display>shall be run once each week for the two weeks before a local political <ln numlevel="1" lineno="155" slineno="1-130"/>subdivision conducts a public hearing under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="68" groupid="66" style="2" owner="jchristopherson" level="1" deltag="both">(6)(f)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="52" groupid="50" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(6)(g)</amend>; and</subsection><subsection ssid="3-null-56" dnum="C-o" numlevel="1" lineno="156" slineno="1-131" level="4"><display>(C)</display>may not be placed in the portion of a newspaper where legal notices and <ln numlevel="1" lineno="157" slineno="1-132"/>classified advertisements appear.</subsection></subsection><subsection ssid="3-null-57" dnum="v-o" numlevel="1" lineno="158" slineno="1-133" level="3"><display>(v)</display>A notice required under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="69" groupid="67" style="2" owner="jchristopherson" level="1" deltag="both">(6)(e)(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="53" groupid="51" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(6)(f)(i)</amend> shall:<subsection ssid="3-null-58" dnum="A-o" numlevel="1" lineno="159" slineno="1-134" level="4"><display>(A)</display>contain a clear statement indicating that the local political subdivision intends <ln numlevel="1" lineno="160" slineno="1-135"/>to issue a lease revenue bond;</subsection><subsection ssid="3-null-59" dnum="B-o" numlevel="1" lineno="161" slineno="1-136" level="4"><display>(B)</display>explain the purpose, proposed amount, and length of term of the lease revenue <ln numlevel="1" lineno="162" slineno="1-137"/>bond and the annual amount that the local political subdivision will be required <ln numlevel="1" lineno="163" slineno="1-138"/>to pay in principal and interest on the lease revenue bond;</subsection><subsection ssid="3-null-60" dnum="C-o" numlevel="1" lineno="164" slineno="1-139" level="4"><display>(C)</display>identify the intended lessee of the facility to be constructed using proceeds <ln numlevel="1" lineno="165" slineno="1-140"/>from the lease revenue bond and the expected annual amount of lease <ln numlevel="1" lineno="166" slineno="1-141"/>payments that the lessee will pay;</subsection><subsection ssid="3-null-61" dnum="D-o" numlevel="1" lineno="167" slineno="1-142" level="4"><display>(D)</display>provide the date, time, place, and purpose of the public hearing under <ln numlevel="1" lineno="168" slineno="1-143"/>Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="70" groupid="68" style="2" owner="jchristopherson" level="1" deltag="both">(6)(f)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="54" groupid="52" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(6)(g)</amend>; and</subsection><subsection ssid="3-null-62" dnum="E-o" numlevel="1" lineno="169" slineno="1-144" level="4"><display>(E)</display>provide the date, time, and place of the local political subdivision governing <ln numlevel="1" lineno="170" slineno="1-145"/>body meeting at which the governing body anticipates taking action on the <ln numlevel="1" lineno="171" slineno="1-146"/>proposal to issue a lease revenue bond.</subsection></subsection></subsection><subsection ssid="3-null-63" dnum="f-o:g-i" numlevel="1" lineno="172" slineno="1-147" level="2" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1063" style="2" owner="o" level="1" deltag="both">(f)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1064" style="1" owner="i" level="1" amendtag="both" space="true">(g)</amend></display><subsection ssid="3-null-64" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A local political subdivision intending to issue an applicable lease revenue <ln numlevel="1" lineno="173" slineno="1-148"/>bond shall hold a public hearing on the proposed lease revenue bond.</subsection><subsection ssid="3-null-65" dnum="ii-o" numlevel="1" lineno="174" slineno="1-149" level="3"><display>(ii)</display>A public hearing under this Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="71" groupid="69" style="2" owner="jchristopherson" level="1" deltag="both">(6)(f)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="55" groupid="53" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(6)(g)</amend>:<subsection ssid="3-null-66" dnum="A-o" numlevel="1" lineno="175" slineno="1-150" level="4"><display>(A)</display>shall be held beginning at or after 6:00 p.m.;</subsection><subsection ssid="3-null-67" dnum="B-o" numlevel="1" lineno="176" slineno="1-151" level="4"><display>(B)</display>shall be held separate from any other public hearing; and</subsection><subsection ssid="3-null-68" dnum="C-o" numlevel="1" lineno="177" slineno="1-152" level="4"><display>(C)</display>may be held the same day as another public hearing, including immediately <ln numlevel="1" lineno="178" slineno="1-153"/>before or after the other public hearing.</subsection></subsection><subsection ssid="3-null-69" dnum="iii-o" numlevel="1" lineno="179" slineno="1-154" level="3"><display>(iii)</display>At a public hearing under this Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="72" groupid="70" style="2" owner="jchristopherson" level="1" deltag="both">(6)(f)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="56" groupid="54" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(6)(g)</amend>, the governing body of <ln numlevel="1" lineno="180" slineno="1-155"/>the local political subdivision shall provide a member of the public desiring to be <ln numlevel="1" lineno="181" slineno="1-156"/>heard an opportunity to present testimony on the proposed issuance of a lease <ln numlevel="1" lineno="182" slineno="1-157"/>revenue bond:<subsection ssid="3-null-70" dnum="A-o" numlevel="1" lineno="183" slineno="1-158" level="4"><display>(A)</display>within reasonable time limits; and</subsection><subsection ssid="3-null-71" dnum="B-o" numlevel="1" lineno="184" slineno="1-159" level="4"><display>(B)</display>without unreasonable restriction on the number of individuals allowed to <ln numlevel="1" lineno="185" slineno="1-160"/>make public comment.</subsection></subsection></subsection></subsection></section></bsec><bsec buid="8" num="11-72-101" type="enact" src="code" uid="C11-72-S101_2026050620260506" sort="11 72 01010020260506" numlevel="1" lineno="186" slineno="2-1" sn="2"><section numlevel="1" lineno="188" slineno="2-3" number="11-72-101" type="enact"><secline lineno="186">Section 2. Section <bold>11-72-101</bold> is enacted to read:</secline><headchap number="11-72" numlevel="1" lineno="187" slineno="2-2">72. Public-Private Partnerships </headchap><catline lineno="188"><bold>11-72-101<parens/>. Definitions.</bold></catline><sectionText lineno="189"><para/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both">As used in this chapter, "public-private partnership" means an arrangement or agreement <ln numlevel="1" lineno="190" slineno="2-5"/>between a political subdivision and one or more private persons to fund and provide for a <ln numlevel="1" lineno="191" slineno="2-6"/>public need through the development or operation of a public project in which the private <ln numlevel="1" lineno="192" slineno="2-7"/>person or persons share with the government entity the responsibility or risk of developing, <ln numlevel="1" lineno="193" slineno="2-8"/>owning, maintaining, financing, or operating the project.</amend></sectionText></section></bsec><bsec buid="10" num="11-72-102" type="enact" src="code" uid="C11-72-S102_2026050620260506" sort="11 72 01020020260506" numlevel="1" lineno="194" slineno="3-1" sn="3"><section numlevel="1" lineno="195" slineno="3-2" number="11-72-102" type="enact"><secline lineno="194">Section 3.
